superstitious but sometimes a lot of people are [02:12.720 --> 02:17.840] and so uh when they receive those kinds of things holding them accountable on that day it's just [02:17.840 --> 02:23.520] extra fun thinking about it like a fly on the wall well we're gonna go ahead i've got the phone [02:23.520 --> 02:37.680] lines open anybody wants to call it's 512-646-1984 512-646-1984 until we have some callers i'll just [02:37.680 --> 02:45.040] start out um talking about the rules of evidence i think it's really really important for people [02:45.040 --> 02:45.600] to get this [02:48.480 --> 02:56.080] people try to win their their cases in court without knowing how to get the evidence before [02:56.080 --> 03:04.640] the court and it's really sad because a lot of times they would win if only they knew how to [03:04.640 --> 03:13.840] get the evidence before the court so you know they'll try to bring something on a piece of [03:13.840 --> 03:21.440] paper and show the court what the law is and i don't know all kinds of ways that that people [03:21.440 --> 03:28.160] try to say or introduce something that could be evidence if it were brought properly [03:29.760 --> 03:33.600] but they don't know how to bring it properly go look at the rules of evidence people [03:34.240 --> 03:40.960] this is big this will help you it's not a big document it's small there's not a lot to it [03:41.520 --> 03:47.920] but you'll see that there are certain ways that you bring things for example if you're trying [03:47.920 --> 03:55.920] to establish a fact you're trying to you brought some document or some people send affidavits and [03:56.720 --> 04:02.320] think that that's going to trigger a response of some kind well it was not rebutted and so therefore [04:02.320 --> 04:09.680] it stands not exactly go read the rules of evidence it's really helpful once you [04:11.760 --> 04:17.760] you realize here are the things that can come in and here are the ways they can come in [04:20.240 --> 04:24.240] it takes a lot of the frustration away too when you as a litigant [04:27.440 --> 04:32.720] you know if you bring things and you you really wanted to introduce this evidence and honestly [04:32.720 --> 04:40.640] you need that evidence in order to win it's super frustrating if you didn't realize that something [04:40.640 --> 04:46.400] has to be a certain way in order to get for the judge to allow it now the judge might really [04:46.400 --> 04:54.160] favor you and and uh might wait for the attorney to object but if the attorney objects it says [04:54.160 --> 05:00.720] well your honor that's uh that's hearsay man you've just been shot down now you have no way [05:00.720 --> 05:06.400] to do that because you didn't bring the witness with you somebody who could testify to the [05:06.400 --> 05:14.000] veracity of that statement you've just got hearsay or oh there are several others but [05:15.600 --> 05:23.360] it's i just want to encourage everybody to prioritize learning those rules of evidence [05:23.360 --> 05:27.520] pay attention to what they are you don't have to memorize them like you're doing bible memory [05:27.520 --> 05:33.760] but memorize them i mean but but go over them so that you're familiar with them that way when you [05:34.160 --> 05:39.760] uh when you're in the moment it will stand out to you and you'll think oh i need i doing here i've got [05:58.240 --> 06:04.240] i've got i've looked over a couple different documents i'm kind of following up on my [06:04.240 --> 06:13.200] conversation last week where i have the san antonio municipal court let's see here what did they [06:13.200 --> 06:20.240] they did so many missteps and avoidance of law um i'm going back and i was going to do a uh [06:20.320 --> 06:25.520] petition for certiorari and wait did you say avoidance of law [06:27.680 --> 06:32.560] i don't know what to call it they did some missteps and what did you call it avoidance of law [06:34.800 --> 06:40.320] yeah that sounds like a pretty good description for what typically happens [06:41.360 --> 06:47.920] yeah yeah well i'm i'm trying to figure out the right method of attack on this so i've looked at [06:47.920 --> 06:54.640] your uh petition for rid of certiorari in the one of the uh the state trooper channels that you [06:54.640 --> 07:02.960] you put together and maintained and uh grod had a nice article a nice article a petition for [07:02.960 --> 07:09.440] rid of mandamus in the law society channel and i've looked that one over um i have a [07:09.440 --> 07:20.320] a let's see here um a motion for default judgment on the affidavit of inability to pay [07:21.440 --> 07:26.880] what i was trying to figure out do i do with certiorari or do a mandamus and i started reading [07:26.880 --> 07:36.880] in the the texas rules of appellate procedure as it pertains to certiorari and while i cannot find [07:36.880 --> 07:45.280] a specific passage that allows it or disallows it for municipal court i did see that there is a 90 [07:45.280 --> 07:52.720] day time limit and that that time starts when the final order is entered so i guess what i'm trying [07:52.720 --> 08:01.360] to figure out is on the fifth of may the final order got entered and i i did a notice of intent [08:01.360 --> 08:07.120] to appeal on the 16th of may and then the actual appeal on the third of june [08:08.160 --> 08:13.680] and they never responded but in between you did a request for findings of fact and conclusions [08:13.680 --> 08:22.880] of law right i did that on the 16th yes the 16th of may right and did you follow up did they did [08:22.880 --> 08:28.800] they give you anything with that or not they never did anything the only other just ignored you so [08:28.800 --> 08:36.880] then did you follow up with the the little past due notice i did not i've never done this part [08:36.880 --> 08:43.520] before and i waited until they got their their stuff together and responded to the appeal and [08:43.520 --> 08:47.840] sent it to the county court no problem you don't have to give them a past due notice it's just [08:49.040 --> 08:54.240] in the rules it's listed there as that's the next action that you do it's not saying that you must [08:55.200 --> 09:04.640] uh but you can as soon as what is it in texas i think it's 20 days that he has to answer [09:05.600 --> 09:10.960] and then if he doesn't answer then as long as you don't wait more than 30 days [09:11.760 --> 09:16.400] then you can give him a past due notice and he has an extra 20 days [09:16.400 --> 09:26.960] so that's just referring to the past due notice for the uh what'd you say conclusions uh finding [09:26.960 --> 09:32.800] of facts and conclusions at law that yeah request for findings of fact and conclusions of law [09:32.800 --> 09:38.080] otherwise how do you know what you're appealing because he just pulled this out of his ear he [09:38.080 --> 09:44.240] doesn't have any reasons for saying what he said there was no finding of fact he's just ignoring [09:44.240 --> 09:52.320] everything so how can he find facts that would establish his jurisdiction when nothing was filed [09:53.840 --> 10:01.920] okay so he doesn't have a good answer for you spoiler alert there's nothing for him to give [10:01.920 --> 10:12.640] you he can't he made it up but the good news is that is a part of the appeal that's what you're [10:12.640 --> 10:20.160] appealing is um so if if you hadn't requested findings of facts and conclusions of law then [10:20.160 --> 10:24.480] it would be a little more tricky because then it could look like to the appellate court [10:25.040 --> 10:31.040] that you had waived that issue and you already understood what to appeal but because you [10:31.040 --> 10:38.240] requested that you're making it clear in writing i don't know where you came up with this judge [10:38.240 --> 10:43.600] i need to know how to appeal what you just said because it seems like it just came out of left [10:43.600 --> 10:48.640] field and i have no idea how to make a how do i formulate my appeal if i don't know where you [10:48.640 --> 10:56.240] got this okay see what i mean so that means the appellate court can look at the not only [10:57.520 --> 11:03.440] judicial error that's that's obvious like that but the appellate court can also look at the [11:03.440 --> 11:09.680] fact that he did not give you a response to your request for findings of fact conclusions of law [11:10.240 --> 11:18.880] i think it's rule 296 297 let me go take a quick look well i see it in there i happen to have the [11:18.880 --> 11:23.520] rules of civil procedure handy so i looked it up real quick and i found it i haven't read through [11:23.520 --> 11:29.120] it but i guess here's the list of things i've got i've got the affidavit of inability to pay [11:30.000 --> 11:38.480] and then i have the notice of intent to appeal and the the motion requesting the finding of [11:38.480 --> 11:44.560] facts and conclusions at law and then i have the actual appeal well that's not actually a motion [11:46.000 --> 11:53.600] it's a request it's it's similar to a motion but yeah go ahead you you had that yeah so i've got [11:53.600 --> 12:02.000] those items those what is that uh one two three i have those four things and the court didn't do [12:02.000 --> 12:09.280] anything until the 8th of august when they scheduled a hearing to show cause so i guess [12:09.280 --> 12:14.880] what i'm trying to figure out is all of the timers as far as i can understand for doing a [12:14.880 --> 12:21.280] certiorari have expired i have not found a timer for a petition for writ of mandamus [12:21.920 --> 12:27.600] but at this point i'm trying to figure out the the the best way to tackle this [12:28.240 --> 12:34.640] and what i've started put together is a is a a second petition for writ of mandamus because [12:34.640 --> 12:39.200] the first one back on the second of may the county court wouldn't put the clerk for the county court [12:39.840 --> 12:45.760] would not allow me to file it so as a hail mary effort i filed it with the municipal court [12:46.720 --> 12:51.360] so part of this new yeah that won't go anywhere for writ of mandamus what's that [12:52.800 --> 12:58.160] filing it with the lower court won't get you anywhere however i do recall seeing a rule [12:58.160 --> 13:03.040] somewhere that if the lower court receives it they're required to forward it to the higher court [13:05.600 --> 13:12.880] well not only is i i i bet that's the case but remember this is the court that went in the [13:12.880 --> 13:19.040] municipal court that heard their own mandamus so in this yeah that's pretty handy new [13:20.000 --> 13:25.600] yeah it is so this new petition for writ of mandamus i'm citing that i'm going to include [13:25.600 --> 13:32.160] the criminal complaint against the clerk that denied me that at the county court to show here's [13:32.160 --> 13:39.360] all the things i tried to do county court judge and i hear the music coming up so i'm trying to [13:39.360 --> 13:44.400] formulate my question there's there's kind of a very good points of reference [17:23.280 --> 17:31.440] about a writ of mandamus and i know that i my job is to do the petition for writ of mandamus [17:31.440 --> 17:38.160] but i can't just find a good time or sir that now for yeah the certiorari it has a 90-day [17:38.880 --> 17:45.680] timer based on the day that the final order is issued um but okay time [17:46.560 --> 17:54.160] well is it when it was issued or when it became final because i think the lower court has plenary [17:54.160 --> 18:02.560] power for anywhere from 75 to 100 and what 105 days when they could do things like um [18:03.360 --> 18:05.280] reverse or vacate or things like that [18:07.200 --> 18:14.640] so is it from when the judge signed it or when it became final i'll have to re-examine the rule [18:15.200 --> 18:23.120] but i guess what i'm trying to figure out is since i i at least did enough i filed enough motions [18:23.120 --> 18:28.160] between the the notice of intent to appeal and the appeal and the request for that finding of [18:28.160 --> 18:33.280] facts and conclusions of law i did enough of those things that it put responsibility on the [18:33.280 --> 18:40.960] municipal court and they did nothing so if a if a if a writ like a mandamus or a certiorari [18:41.920 --> 18:48.240] is not sufficient enough or it may not be sufficient enough what is my ace that i would [18:48.240 --> 18:55.680] want to use to tackle this i mean do i go in there with both a petition for writ of certiorari and [18:55.680 --> 18:57.440] a petition for writ of mandamus [19:01.200 --> 19:09.040] you know i guess i can't see any reason why not i would start out with the the cert and because [19:09.040 --> 19:14.640] it's specifically dealing with the fact that there's a threshold issue of lack of jurisdiction [19:14.640 --> 19:22.160] in the first place ab initio from the beginning they never the court was never vested with [19:22.160 --> 19:28.960] jurisdiction at all it was acting in the clear absence of all jurisdiction [19:30.800 --> 19:39.040] that's a fun phrase acting in the clear absence of all jurisdiction and if the judge is is [19:39.040 --> 19:44.640] attentive at all he will see that phrase and he's going to hear lawsuit [19:44.640 --> 19:51.120] judge [19:51.120 --> 19:56.160] because he doesn't have immunity for anything that he does acting in the clear absence of [19:56.160 --> 19:59.680] all jurisdiction [19:59.680 --> 20:07.760] which judge you referring to municipal or county yes no the municipal the county judge [20:07.760 --> 20:11.640] uh well he will see that too he won't feel threatened or scared because he's not the [20:11.640 --> 20:17.240] one that that tried to hear a case that he had no business hearing that was the lower court [20:21.480 --> 20:27.000] so what are you saying by by filing a petition for writ of certiorari with the [20:27.800 --> 20:33.400] appeal at county court and all yes on a copy with the municipal court you're saying when [20:33.400 --> 20:37.800] the municipal judge gets wind of that that should cause their ears to perk up [20:38.120 --> 20:43.880] well yes not that you really care i mean i think it's fun kind of like fly on the wall i like to [20:44.600 --> 20:50.920] imagine that uh how they're going to get how it'll hit them but it really it's it's neither here nor [20:50.920 --> 20:56.120] there it needs to go to the higher court and the higher court needs to take a look at that and say [20:56.120 --> 21:04.920] oh you're right they didn't have jurisdiction to start with so in a sense you could say that the [21:05.480 --> 21:13.480] that the there is no final judgment there is no order there's nothing there's just this judge [21:13.480 --> 21:19.080] acting out in the clear absence of all jurisdiction we don't have a 90-day timer [21:19.960 --> 21:23.560] he's just defrauding the people by pretending like there was jurisdiction [21:25.640 --> 21:30.200] a 90-day timer would start if there really were a judgment but he can't make a judgment [21:30.760 --> 21:31.800] not when there's no case [21:33.960 --> 21:39.880] yeah so you know that's somewhat something that you could talk about or bring up as an aspect of [21:40.440 --> 21:47.080] defeating the deadline yeah yeah well that that makes sense in the scope of both a certiorari [21:47.080 --> 21:53.720] and a mandamus um but so i guess i've got a three-pronged approach here uh i guess four [21:53.720 --> 22:00.040] because i've got the request for finding the facts and conclusions at law i have the actual appeal [22:00.040 --> 22:06.200] itself and i didn't get all of the extra points that i i missed a couple important points like [22:06.200 --> 22:12.680] the the municipal court hearing their own mandamus but i've got the appeal and then i have uh i can [22:12.680 --> 22:19.720] put together a petition for writ of mandamus and certiorari so with those four things going to the [22:19.720 --> 22:25.240] county court i mean i get that there they may are the the municipal court may argue well there is [22:25.240 --> 22:31.720] deadlines and there's timers except they failed to act where they should have and this just seems [22:31.720 --> 22:38.280] so it's so flagrant when i'm going back through and i'm making four copies of everything i filed [22:38.280 --> 22:45.320] that i'm naming and the petition for writ of mandamus and it's just it's daunting to figure [22:45.320 --> 22:51.000] out how they're going to get out of this because of all they've done wrong in in the the avoidance [22:51.000 --> 22:56.680] of law so i'm just trying to figure out how to put it together in a meaningful way [22:57.400 --> 23:02.440] so that a county judge will actually pay it some attention and take the right kind of action [23:02.440 --> 23:08.520] i guess well if it would be me i would go to the county judge with a criminal complaint against [23:08.520 --> 23:17.160] the lower judge a criminal complaint is like a grenade you you don't have to follow it up [23:17.160 --> 23:24.440] and think about it's uh what happens after that you can because likely they're just going to [23:25.000 --> 23:33.880] not do their job but you don't have to it's a it it will have some effect just by the fact that [23:33.880 --> 23:42.840] you filed it and the person that you're giving it to is a county judge he's the same one that's over [23:42.840 --> 23:49.480] this um the appellate court so he sees cases coming from this judge all the time [23:50.760 --> 23:57.080] right every time somebody appeals well honestly i don't know how often that happens but [23:57.880 --> 24:05.720] theoretically it happens all the time and uh when he sees this judge's the lower judge's name on [24:05.720 --> 24:13.160] the criminal complaint that to me that feels stronger than just putting a bullet point on [24:13.160 --> 24:18.280] the line you know some line item that says hey i requested findings of fact and he didn't do [24:18.280 --> 24:25.640] anything that's a crime the way i look at that he had a responsibility that was part of his [24:25.640 --> 24:31.320] sworn duties of office he doesn't get to just blow that off and and pretend like i didn't say [24:31.320 --> 24:35.000] anything i requested findings of fact and conclusions of law he has a certain number [24:35.000 --> 24:42.600] of days in which to perform his duty that's the rules he wants to talk about rules and say i [24:42.600 --> 24:47.240] missed a 90-day deadline no let's talk about rules before that let's talk about you judge you didn't [24:47.240 --> 24:56.760] follow the rules before that yeah well the the day of the hearing on may 5th the morning started [24:56.760 --> 25:03.320] with their their fake their uh fake hearing on the petition for writ of mandamus and then they [25:03.320 --> 25:12.120] did the trial immediately afterwards and in the trial i presented one of the uh uh basically it [25:12.120 --> 25:17.960] was a challenge on jurisdiction um that they didn't have any because of the absence of a [25:18.920 --> 25:24.680] proper charging instruments in accordance with the what is it article five section 12 of the [25:24.680 --> 25:30.760] texas constitution okay well let me just pause you right there i want to hear the rest of this [25:30.760 --> 25:37.720] but just for everybody all the listeners i want to um i would suggest that instead of talking [25:37.720 --> 25:43.480] about charging instrument in that moment i mean you're exactly right there was the the primary [25:43.480 --> 25:48.760] pleadings were missing but when you say charging instrument you're going to their playing field [25:48.760 --> 25:52.760] they love to get you off away from talking about the primary pleadings [25:53.560 --> 25:57.720] being missing and get you over to where you can talk about a charging instrument because that's [25:57.720 --> 26:05.720] a bigger category the charging instruments includes not only an indictment or information [26:06.600 --> 26:13.000] which are needed in order to commence a court case but that bigger category also includes [26:13.800 --> 26:19.480] a complaint which does not commence a court case but which is also included as part of [26:20.760 --> 26:27.240] charging instruments so just a little tidbit i mean you you did fine i mean bringing up the [26:27.240 --> 26:30.680] fact that there's no court case because nobody filed anything but go ahead go ahead [26:32.680 --> 26:40.200] so right then and there when they were when they they denied my motion to dismiss on the basis [26:40.200 --> 26:47.000] that there was no jurisdiction because of no proper charging instrument i dialed 9-1-1 and [26:47.000 --> 26:51.800] when i did i stepped out into the hall and completed that and i got a card from the [26:52.360 --> 26:58.280] police officer with the oh this is getting good okay we have to go to [27:01.080 --> 27:05.480] it's that [32:43.640 --> 32:48.760] come out of it one for the first 20 days and then the second one for the [32:49.560 --> 32:56.920] ignoring it of the past due notice as well what what do you allege 3903 brett because he denied [32:56.920 --> 33:03.880] your yes to a uh okay all right so yeah he's supposed to follow the rules he doesn't get [33:03.880 --> 33:11.000] to choose whether or not he's going to do what the rules require of him and by him not following [33:11.000 --> 33:17.080] the rules he's denying you your right to statutory due process yeah right that's if you want to take [33:17.080 --> 33:23.800] it to the fed and you want to turn it into a due process uh like a 1983 suit or something then [33:23.800 --> 33:30.520] then that could fit in there as a count because criminal depriving you of that right from the [33:30.520 --> 33:39.080] criminal side it's 3903 interesting thing about these judges they think if i don't do what i'm [33:39.080 --> 33:47.960] supposed to well you can always appeal they forget if i don't do what i'm supposed to and the law [33:47.960 --> 33:56.920] commands me to do it that's a criminal act just because you can appeal it doesn't mean it's not [33:56.920 --> 34:03.560] a criminal act yeah especially when the thing that you're asking for is supposed to facilitate [34:04.200 --> 34:10.520] you know make it so that you are able to appeal you are asking for the facts and the law [34:11.080 --> 34:15.880] on which he came up with that ruling because you need to formulate your appellate brief [34:17.960 --> 34:20.280] and he won't tell you i just pulled it out of my ear [34:23.080 --> 34:26.360] so how are you supposed to argue what are you supposed to bring in [34:26.360 --> 34:38.440] and he didn't say what he how he came up with it yeah well i've got the the uh there's going [34:38.440 --> 34:45.720] to be a 3903 violation no no 3248 penal code violation for the judge who ruled on the petition [34:45.720 --> 34:53.160] for rid of mandamus and then the next judge gets a 3903 because she continued the hearing [34:53.880 --> 35:00.520] based on on the outcome of that fake ruling but even better as they were doing that hearing [35:01.640 --> 35:06.920] following the petition for the for the written up rid of mandamus i got up and dog 9-1-1 [35:06.920 --> 35:14.600] because they denied my motion for dismissal based on them not having jurisdiction so then [35:14.600 --> 35:20.920] i walked back into the courtroom holding up over my head the half piece of paper that's a bright [35:20.920 --> 35:27.640] yellow color that the police officer wrote the incident number on and i told the judge [35:29.560 --> 35:35.160] you now have an interest because i have filed criminal charges against you i moved for your [35:35.160 --> 35:43.960] disqualification and she ignored me so that in and of itself right there is another thing to bring [35:43.960 --> 35:50.200] up on the mandamus that they proceeded despite having an interest because i had a claim against [35:50.200 --> 36:01.320] them is that well what did you do when she ignored you this is important i believe i said [36:01.320 --> 36:08.360] that i raised an exception and that was all i knew to do at the time okay well that's good [36:09.960 --> 36:17.000] did the judge take any actions after that oh yeah she continued on with the trial like it never [36:17.000 --> 36:19.720] happened well how many actions did she take [36:25.400 --> 36:32.200] every action she takes is in direct violation of the rule that when when you've moved for [36:32.200 --> 36:41.800] disqualification she does not get a choice she must within three days three business days [36:42.760 --> 36:50.280] refer the matter of her disqualification to the admin judge well she actually does have a choice [36:50.280 --> 36:58.520] she can she can back away she has a or b she can say you know what i've you're moving from my [36:58.520 --> 37:06.360] disqualification i'm just gonna back away i'm gonna bow out yeah she can recuse herself voluntarily [37:07.320 --> 37:15.560] or within three business days refer that matter to the admin judge she may not continue [37:15.560 --> 37:21.000] she may not pass go she may not collect 200 or however much she wants from you [37:21.720 --> 37:29.400] she may not do anything it specifically prohibits that judge from taking any further action in the [37:29.480 --> 37:36.920] case so if she did three more actions in the case then that's three criminal complaints for you to [37:36.920 --> 37:49.720] file i'm guessing back to 3903 for denial of a right of a due process yes exerting or purporting [37:49.720 --> 37:57.880] to exert an authority she does not expressly have and in the process denying you and the full and [37:57.880 --> 38:05.480] free access to or enjoyment of a right okay yeah take a look at that here's 18a [38:06.360 --> 38:16.360] recusal and disqualification of judges yes and underneath that once that has been [38:18.280 --> 38:25.560] once you've moved for her disqualification it specifically prohibits the judge from taking [38:25.560 --> 38:36.360] any further action okay so right there and it also but go ahead okay so i'm going to pretend [38:36.360 --> 38:40.520] that i don't know what you're talking about you like how i did that and uh say for the for the [38:40.520 --> 38:48.280] benefit of the other listeners if a judge continues to take other actions after someone moves for [38:48.280 --> 38:51.880] their disqualification when they actually have grounds they're not just saying it to say it [38:52.520 --> 38:58.200] and the judge continues to take actions do you just sit there and go along for the ride and [38:58.200 --> 39:03.560] raise objections to every action they take or is there something that can be done that can stop [39:03.560 --> 39:10.120] the hearing right then and there the way it should happen well you could put you the next one and somehow everything in the lower court just fixes itself [45:13.880 --> 45:20.840] because the chief justice he said we got a new one but he's gonna know what i did to the old one [45:22.360 --> 45:26.920] when he didn't issue a warrant based on a complaint i sued him in the federal court [45:26.920 --> 45:35.400] 20 million bucks and he was not a happy camper and i talked to uh supreme court justice divine [45:36.760 --> 45:46.040] i really like this guy and when he found out i sued the chief justice he was not happy with me [45:46.040 --> 45:55.320] not one little bit and told about how he got sued and won the case but it cost him personally [45:55.320 --> 46:09.480] 20 000 so i'm wondering how much it cost the chief justice for my suit well i guess one [46:09.480 --> 46:17.560] possibility of difference there is this chief justice had somebody paid with the public coffers [46:18.120 --> 46:23.720] who stepped up and i know you called them on that but did divine have that same situation or did [46:23.720 --> 46:30.040] divine have to pay for his own attorney i didn't query him much on that he was a little bit too [46:30.040 --> 46:35.960] ticked off at
