I came down here to Austin [01:52.980 --> 02:06.180] and Brett and I were here and I went to a district judge and I asked the district, the judges, [02:07.620 --> 02:15.140] Bailiff if the judge had a good sense of humor. And he said, yeah, she did. And it was the judge [02:15.140 --> 02:24.820] was a fairly attractive upper middle age blonde woman who had a very pleasant look about her. [02:25.860 --> 02:32.740] When I looked at her, I didn't see what I considered to be any particular attitude. [02:34.420 --> 02:42.900] So I gave the Bailiff this red folder with and told him that I had business with the court. [02:43.860 --> 02:49.620] And he said, can I tell the judge the nature of the business? It's in the folder there, [02:49.620 --> 02:58.660] just give her that. He was a little confused, but he took it up and the clerk did the judge's desk. [02:59.940 --> 03:04.020] Well, the judge, she was out for some kind of recess or checking something. [03:05.620 --> 03:10.980] It was nine o'clock, the court had just started, but she had obviously convened the court but then [03:10.980 --> 03:17.620] went out for some reason. And then she came back in and she addressed a couple of people there. [03:17.620 --> 03:24.340] And then she looked over and she saw the red folder and the red folder did its job. [03:25.940 --> 03:32.180] She had to pick up the red folder and see what was in it. And she pulled it out, the stuff out, [03:32.180 --> 03:36.260] and she saw my name on there and called me and looked out at me and asked if I was Randall Kelton. [03:36.500 --> 03:42.260] Yes, it was, and she called me up. And I went up there and I said, Your Honor, I talked to your [03:42.260 --> 03:49.140] Bailiff and he said you have a good sense of humor. And she said, well, I like to think so. [03:50.260 --> 03:57.780] I said, well, I'm here to test it. And that took her back a little bit, but I was setting her up. [03:59.300 --> 04:05.060] I knew I was about to step on her toes and I was trying to put her in a spot. [04:06.660 --> 04:10.420] I'm gonna step on her toes, but since I accused her of having a good [04:10.420 --> 04:14.660] sense of humor, it would be harder for her to get really testy with me. [04:15.700 --> 04:21.940] And she looked at the documents and she said, asked me what I wanted her to do with those. [04:21.940 --> 04:29.300] And I told her I want you to do exactly what article 15.9 commands you to do and issue [04:29.300 --> 04:40.020] warrants forthwith. And she instructed me that she had 24 people on her docket and she had to [04:40.020 --> 04:44.340] take care of them. And I said, I understand that, but you have this before you right now and you [04:44.340 --> 04:50.420] need to handle this. And she ducked and dodged and finally I got her to say, I said, Your Honor, [04:50.420 --> 04:56.980] are you telling me you're not gonna issue warrants? And she finally, yeah, yeah, I'm not [04:56.980 --> 05:00.340] gonna issue warrants. Well, thank you, Your Honor, that's all I needed. [05:01.220 --> 05:07.300] Then I walked over to the bailiff. I said, Mr. Bailiff, I need you to arrest that judge. [05:08.500 --> 05:13.060] Why can't I arrest a judge? I told him he needed to take his chicken suit off. [05:13.780 --> 05:17.780] And he kind of got a chuckle out of that because I'd been real pleasant and kind of joking with him. [05:18.420 --> 05:26.180] I didn't take on a serious and angry persona. And I'm kind of keeping things lighthearted [05:26.180 --> 05:32.020] and he took it that way. And he said, No, Mr. Carlton, I am not gonna arrest the judge. And [05:32.820 --> 05:37.780] told him, well, I had to ask, you had to refuse and did all this in front of the judge. [05:39.460 --> 05:46.500] The reason I'm saying this this way is we as citizens in a republic, [05:48.420 --> 05:53.780] we are what you would consider the CEO of the republic. [05:54.740 --> 06:03.460] Everybody answers to us. And I was trying to give the judge and the bailiff the idea and the [06:03.460 --> 06:10.740] understanding that I'm the CEO and you're the servants. I'm treating them like servants, [06:11.380 --> 06:16.020] but I'm also being pleasant and professional. And they seem to get it. [06:16.180 --> 06:24.660] And then Brett and I left and went downstairs and went across the, we were in the district court [06:25.620 --> 06:30.420] in Tarrant County. And in Tarrant County, I'm sorry, not Tarrant County, Travis County, [06:30.980 --> 06:37.380] the district court is right behind the county court. So we went across to the county court [06:37.380 --> 06:44.900] and within what we're at about 30 minutes, he had a suit filed against the district judge. [06:46.500 --> 06:55.140] Yeah, pretty quickly. So she knows that when I went in there and asked her to issue these warrants, [06:56.340 --> 07:02.180] that I knew she wasn't gonna issue the warrants. And I forced her to refuse to issue the warrants. [07:03.220 --> 07:10.020] And then I got the bailiff to refuse to arrest her while I had that lawsuit in my hand [07:10.980 --> 07:12.580] so that I could sue her with it. [07:14.500 --> 07:21.780] We need these public officials to know and understand that we're playing them like cheap [07:21.780 --> 07:25.940] fiddles. You guys don't wanna do your job, you don't wanna follow law. [07:26.900 --> 07:32.420] Here, we'll see how this works out for you. [07:43.060 --> 07:49.460] That and the judge, this is a district judge and all these lawyers come up and they [07:49.460 --> 07:56.500] grovel and they slither up to the bench and they beseech the judge to do what they want. [07:57.860 --> 08:00.500] And I come up there and just stand right in the middle of her. [08:00.900 --> 08:07.140] Tell her, I hear you have a good sense of humor. Well, I'm here to test it, and then I did test it. [08:08.660 --> 08:13.860] Because I did that to her, she wanted to get frustrated, but I'd already set her up. [08:15.060 --> 08:20.980] She had a good sense of humor, so she had to act like it. So she did in fact maintain her [08:20.980 --> 08:24.660] professionalism the whole time. Did not- [08:25.620 --> 08:29.860] Yeah, she did, and she kept on smiling too. She was very pleasant. [08:29.860 --> 08:36.900] Yeah, and I'm smiling back at her and I'm stepping right in the middle of her. She [08:36.900 --> 08:43.460] knows I'm stepping in the middle of her, but I'm giving the impression of civility. [08:45.140 --> 08:51.300] And it's her duty to do the same thing. It would have been inappropriate for her to be [08:52.020 --> 08:56.980] rude and disrespectful to me when I was being respectful to her. [08:57.540 --> 09:01.140] Even though I was asking her to do something, asking for her to do something she didn't want [09:01.140 --> 09:09.700] to do, I knew she didn't want to do it. But still, and this is part, if you've only been to [09:10.260 --> 09:17.540] municipal courts, you might not get this part. But district judges, they tend to spend most of [09:17.540 --> 09:24.420] their time dealing with lawyers, with professional lawyers. And the lawyers always treat the judge [09:24.420 --> 09:31.300] with a considerable amount of deference and a good judge. [09:32.260 --> 09:35.540] That is one diplomatic way of putting it. [09:37.060 --> 09:43.220] Well, they try to act like professionals. This is a job. This is not personal. We're just doing [09:43.220 --> 09:51.620] our job. Nobody takes this personal. And I'm asking her to issue arrest warrants against another [09:51.620 --> 10:02.260] judge. She really does not want to do that. And frankly, she has no idea what's going on here. [10:03.380 --> 10:10.020] She has never had anything like that happen before. But I'm not giving her time to figure it out. [10:10.020 --> 10:15.540] I'm telling her I want her to issue warrants and I'm pressing on her. I'm not letting her [10:16.740 --> 10:23.060] ducking and dodging. I got 24 people on my docket. I don't care how many people you got on your docket. [10:23.060 --> 10:26.900] I'm here. I'm in front of you. I've invoked your duty. I want you to do it. [10:28.740 --> 10:33.940] And she might have wanted to order me out of the courtroom. And if I had been there [10:34.900 --> 10:42.020] in a dago tee, is what we used to call them in Chicago, and down south they call them wife [10:42.020 --> 10:48.500] beater t-shirts and then shorts or something, she might have thrown me out of the courtroom. [10:49.460 --> 10:55.940] I didn't have a shirt and tie on, but I was well dressed and well presented. So [10:56.900 --> 11:05.060] since I was being civil, she felt like she had a duty to be equally civil, and she was. [11:05.860 --> 11:12.420] She was pleasant. She was not happy, but she handled herself well. [11:14.820 --> 11:20.500] I came in and kind of stepped in the middle of her, asked her to do something she didn't want to do. [11:20.500 --> 11:29.380] But unlike what they do in the traffic courts, this was a more sophisticated court. [11:30.340 --> 11:36.100] She did not cop an attitude, get nasty and angry and threatening with me. [11:37.300 --> 11:44.260] But then because this was a district court, and I had come in there and stepped right in the middle [11:44.260 --> 11:50.820] of her, she had her spidey sense going. And her spidey sense is saying, [11:52.660 --> 11:59.060] something is not exactly the way it appears here, that this guy knows something [11:59.860 --> 12:03.700] that I'm not sure if I know or not, so I need to be careful. [12:05.620 --> 12:11.540] That's what we need to do when we approach these people. When I talk to everybody about these rules [12:11.540 --> 12:16.660] that we've got, never ask a public official to do anything you actually want them to do, [12:17.300 --> 12:26.580] never give fair warning. This is primarily all about establishing a professional posture. [12:29.860 --> 12:34.100] I didn't try to explain to the judge what her duty was. [12:34.180 --> 12:37.860] That would have been rude and inconsiderate. [12:39.460 --> 12:46.660] I presupposed that she knew precisely what her duty was, so I didn't give her legal advice. the mandatory annual training and so forth well so today they they got all of these judges [19:27.220 --> 19:34.500] down there well seven of them anyway got criminal complaints against her for each [19:35.140 --> 19:41.620] uh so they might be starting to smell like say hey this smells like a little different than usual [19:42.580 --> 19:49.860] yes they might start getting the idea something's [21:04.340 --> 21:10.180] put my name and stuff in in it and said see attachment and gave that to him said give that [21:10.180 --> 21:14.660] to the judge if the judge doesn't like it she'll let me know and i'll fix it so you guys can all [21:14.660 --> 21:23.700] go to lunch so they did that and uh i went went back to to will's house and i'm sitting at will's [21:23.700 --> 21:29.380] that's where i'm staying while i'm in austin and i'm thinking the judge wanted me to fill one out [21:30.500 --> 21:36.900] and i talked to brett about filling one out and he he reminded me that giving that information [21:37.860 --> 21:44.100] amounted to giving up my right to privacy in order to enjoy my right to [21:46.900 --> 21:53.700] petition the court for redress of grievance so i filled one out in case the magistrate [21:53.700 --> 21:57.780] asked for one but everywhere it asked for financial information i put private [21:57.780 --> 22:00.740] it [22:00.740 --> 22:07.780] i did not get an email today from the gp and what they told me was that they're doing everything [22:07.780 --> 22:16.980] electronic so i can file suits with them electronically so that was great because [22:16.980 --> 22:23.140] i filed against all these uh if i file in all these judges if i send them all criminal complaints [22:23.940 --> 22:31.540] and i don't get my cover letter back letting me know that they issued warrants then i can [22:31.540 --> 22:41.300] sue them all to email that's great i don't even have to go down there [22:43.540 --> 22:52.980] so that's what i'll do i'll sue all of them and once i have all of them sued then i will uh prepare [22:52.980 --> 23:02.100] a petition to the texas attorney general and ask that the attorney the attorney general who happens [23:02.100 --> 23:13.060] to be a republican to uh petition quote for quote want to removal of these judge these democratic [23:13.140 --> 23:23.060] judges for failing to perform their duty under 15.09 texas code of criminal procedure [23:23.060 --> 23:29.940] which has the effect of repudiating their contract they entered into based on their sworn oath [23:33.540 --> 23:35.700] what do you think brett think that'll get their attention [23:36.260 --> 23:41.380] one can hope one can certainly hope you know the track record seems to be [23:42.900 --> 23:50.340] it's difficult to get their attention now we have one can hope we hadn't been suing them in their [23:50.340 --> 23:57.300] personal capacity that's something that hadn't been happening i know what they're going to do [23:57.300 --> 24:03.060] they're going to file the standard motion to dismiss claiming judicial immunity [24:06.340 --> 24:12.100] and i already got the response for that set up so at the end of the day it doesn't matter if we [24:12.100 --> 24:27.140] win or lose it's about dragging them into court i was at a a a meeting of uh patriots and the [24:27.780 --> 24:34.740] the supreme court justice divine was at the meeting he gave a presentation [24:37.220 --> 24:41.060] oh it was remarkable brett you should have heard it [24:43.060 --> 24:48.340] this guy's been arrested 52 times for protesting over abortion [24:50.820 --> 24:52.980] he's a supreme court justice [24:53.940 --> 25:03.540] his his wife they they had a child and it had a brain condition where the [25:04.100 --> 25:10.500] two hemispheres of the brains merged together they had a name for it and these children never survive [25:13.060 --> 25:18.100] and there was a very good chance that the mother would not survive and they tried to get her to [25:18.100 --> 25:25.140] survive and they tried to get her to abort and she refused because they were religious [25:25.140 --> 25:32.980] and they were devout in their faith and they felt like if it was intended that she die in [25:34.420 --> 25:43.140] because of this then that's so be it they held their faith and he told how the child was born [25:43.140 --> 25:49.220] and the the church they went to there were 50 something people there [25:51.060 --> 25:57.300] and the child was born alive and they each person took the child in their arms [25:58.740 --> 26:01.620] and they passed it from one person to the other [26:03.140 --> 26:08.340] and the father was the last one they put it in his arms and it died in his arms [26:08.500 --> 26:16.500] I you know listened to that story and I his house [35:25.100 --> 35:29.100] And it's worth more than a million dollars and it's paid off [35:29.100 --> 35:35.100] So shame on him for having it in his name instead of a trust [35:35.100 --> 35:41.100] So they come along this man's drowning and they offer him a lifesaver [35:41.100 --> 35:44.100] And they're gurus and they're gonna help them [35:44.100 --> 35:47.100] So this is for his foot [37:02.100 --> 37:05.100] And then they turned around but the hospital did [37:05.100 --> 37:15.100] And then they, about three or four days later they decided they needed to chop off some more so they chopped off his leg [37:15.100 --> 37:19.100] So and this is a karma [37:19.100 --> 37:27.100] So Randy, would you say that this man no longer has a legal leg to stand on? [37:27.100 --> 37:34.100] Oh, that is so cold [37:34.100 --> 37:40.100] Karma is a dish best served cold too [37:40.100 --> 37:44.100] And I'm sorry, you know it's a horrible thing [37:44.100 --> 37:51.100] But karma does come around, it's like the guys that prosecuted me [37:51.100 --> 37:59.100] And way back when I had my heart attack and a letter was brought to the courtroom [37:59.100 --> 38:06.100] And the deputy DA was given a copy and it said that I'd had a heart attack and that deputy DA started laughing [38:06.100 --> 38:12.100] Well about a year later that deputy DA got cancer [38:12.100 --> 38:16.100] Did you send him a get well quick letter? [38:16.100 --> 38:19.100] Oh, no [38:19.100 --> 38:26.100] And by the way the other deputy DA, he got pneumonia and almost died [38:26.100 --> 38:36.100] But I don't know, I'll let somebody else or the people listening decide where this all goes [38:36.100 --> 38:42.100] And I'll shift on to I am in Silicon Valley right now [38:42.100 --> 38:49.100] Because my mom decided to wiggle out of her wheelchair and give herself a femur fracture [38:49.100 --> 38:55.100] So I was able, now for a year, 12 months, I could not leave the house [38:55.100 --> 39:00.100] And I was taking, I'm her only caretaker [39:00.100 --> 39:08.100] So I was able and her, now here's another one, her uncle or my uncle, her brother [39:08.100 --> 39:16.100] Came up to visit us and he saw the situation and his wife was with him and we hosted him for three days [39:16.100 --> 39:22.100] It was a good visit, but I never heard from him since and that was last June [39:22.100 --> 39:27.100] Well, he got a brain bleed two weeks ago and died [39:27.100 --> 39:34.100] So I can't be mad at him anymore for not helping me and giving me a couple days off [39:34.100 --> 39:44.100] I'm going to segue out of this and let you know the current status of my federal lawsuit against Santa Clara County [39:44.100 --> 39:50.100] Yeah, and Randy, I think what he's trying to say is if you don't help him, you could be in danger [39:50.100 --> 39:55.100] You mean my brain's next? [44:56.100 --> 44:58.100] It's only two miles from the house. [44:58.100 --> 45:02.100] And it had a bad reputation, but it's under new management. [45:02.100 --> 45:08.100] She's getting the treatment now that she should have gotten a year and a half ago. [45:08.100 --> 45:10.100] Oh, wonderful. [45:10.100 --> 45:22.100] So tell me, how does that feel, knowing that you gave up your whole life to do the right thing for the right reason? [45:22.100 --> 45:29.100] How many people are there out there that would do that? [45:29.100 --> 45:36.100] Not a lot for various reasons. [45:36.100 --> 45:43.100] And I don't have any disrespect for people that just flat admit that they cannot do this. [45:43.100 --> 45:46.100] It's tough. [45:46.100 --> 45:49.100] It's actually tougher than the court. [45:49.100 --> 45:55.100] Okay, well, one thing, let me... [45:55.100 --> 46:04.100] I would just ask that people be upfront about it and say that they're just not capable for whatever... [46:04.100 --> 46:06.100] They don't even have to give the reason, okay? [46:06.100 --> 46:11.100] But just don't be an armchair quarterback. [46:11.100 --> 46:17.100] And for God's sake, don't do anything to burden the person that's trying to do it. [46:17.100 --> 46:22.100] Yeah, good point. [46:23.100 --> 46:35.100] Did you feel like, with your uncle visiting and you said you had a three-day visit, did you feel like that there was some of that going on? [46:35.100 --> 46:38.100] That was like last June. [46:38.100 --> 46:41.100] And so, no. [46:41.100 --> 46:47.100] Well, my disappointment was that his wife had actually taken care of her mother. [46:47.100 --> 46:53.100] I'm super glad they came because they had a very, very quality three days. [46:53.100 --> 47:00.100] They were fully engaged in the situation there. [47:00.100 --> 47:09.100] But they have been on permanent vacation for about 10 years, so that's where some of my upset came from. [47:09.100 --> 47:11.100] They couldn't be bothered. [47:11.100 --> 47:13.100] They're always on vacation, literally, for the last 10 years. [47:13.100 --> 47:16.100] And I went to his funeral. [47:16.100 --> 47:19.100] All of this has fallen into place. [47:19.100 --> 47:25.100] And I'll tell you, you know, there is a God. [47:25.100 --> 47:34.100] So many times over the past 10 years, things have gone together like a puzzle. [47:34.100 --> 47:36.100] I'm not saying it's great. [47:36.100 --> 47:38.100] It's been painful. [47:38.100 --> 47:42.100] All of this is going on for something. [47:42.100 --> 47:55.100] And I just held that in me that they could see the situation and not even want to give me a couple of days' relief. [47:55.100 --> 48:02.100] And literally, my life in the Bay Area of San Jose has been crumbling the last 12 months. [48:02.100 --> 48:11.100] I've spent the past week and a half here doing everything I can to get it all handled. [48:11.100 --> 48:25.100] However, I went to the urgent care, and my blood pressure was 228 over 130. [48:25.100 --> 48:28.100] So, yeah. [48:28.100 --> 48:37.100] And I left without any treatment for that, but I went back three days later yesterday and got some treatment for it. [48:37.100 --> 48:46.100] I was deciding whether I was going to go to urgent care or to emergency, because at emergency, they'll give you IVs for this. [48:46.100 --> 48:54.100] Remember, my second heart attack in the courtroom when the judge ordered me to court, that's what they did. [48:54.100 --> 48:57.100] They took me to emergency and gave me IVs. [48:57.100 --> 49:02.100] So from that experience about five years ago, that was the right course of action. [49:02.100 --> 49:05.100] However, it's down and under control. [49:05.100 --> 49:12.100] One of the things that happened while I've been taking care of my mom is that my medical insurance lapsed. [49:12.100 --> 49:16.100] And so I'm halfway through getting that reinstated right now. [49:16.100 --> 49:27.100] So again, I literally gave everything to taking care of my mom, and I couldn't get anybody to help me even for a few days. [49:27.100 --> 49:29.100] And that's fine. [49:29.100 --> 49:32.100] Ted, how old are you? [49:32.100 --> 49:36.100] 63. [49:36.100 --> 49:45.100] Okay, you're old enough to get retirement, but are you old enough to get Medicare or Medicaid? [49:45.100 --> 49:47.100] No. [49:47.100 --> 49:49.100] But anyway, Randy, I've got this handled. [49:49.100 --> 50:00.100] Okay, so I really want to go on to, like I said before the break, I'm now at the Ninth Circuit with an appeal. [50:00.100 --> 50:03.100] I did get some help. [50:03.100 --> 50:05.100] I paid somebody to help me. [50:05.100 --> 50:10.100] And I did go to San Francisco and get a 30-day extension. [50:10.100 --> 50:17.100] So my opening meeting is now due on April 9. [50:17.100 --> 50:21.100] The person that's helping me, I don't think they know this part. [50:21.100 --> 50:26.100] And they're a disbarred lawyer, and my favorite kind. [50:26.100 --> 50:34.100] And one of the things is, come on, you have to designate the record. [50:34.100 --> 50:36.100] And that hasn't been done. [50:36.100 --> 50:40.100] So I have some time to now straighten that out. [50:40.100 --> 50:49.100] And I will tell you this, I thought Portland was ahead of the Bay Area in Waco. [50:49.100 --> 50:59.100] But since I've been down here, I actually have fear when I go out in public here now. [50:59.100 --> 51:05.100] This place is completely off the rail, completely. [51:05.100 --> 51:14.100] The level of violence that's going on, it's crazy. [51:14.100 --> 51:20.100] And you know, 10 years ago, you didn't go to Oakland. [51:20.100 --> 51:23.100] Now I wouldn't go anywhere near Oakland. [51:23.100 --> 51:26.100] That's where they're emboldened. [51:26.100 --> 51:36.100] And then, my God, we've got the San Jose City Councilmen that was just hit with child pedophilia stuff. [51:36.100 --> 51:42.100] We have the mayor of Oakland who just got the job in the last election. [51:42.100 --> 51:48.100] She's up on all kinds of criminal charges, and she was removed from office. [51:48.100 --> 51:56.100] I mean, this place is casters up. [51:56.100 --> 52:06.100] And yet, you still have these people that seem to be oblivious to why we're where we're at. [52:06.100 --> 52:10.100] So I'm not going to fix that. [52:10.100 --> 52:14.100] What I want at this point is compensation. [52:14.100 --> 52:18.100] I want to get on with whatever life I have left. [52:18.100 --> 52:21.100] And I did go to the city council today. [52:21.100 --> 52:25.100] I wanted to talk directly to the mayor since I met him before he came mayor. [52:25.100 --> 52:27.100] I was at a dinner with him. [52:27.100 --> 52:30.100] And I told him I was going to come to him after he went. [52:30.100 --> 52:33.100] And he knows a little of the story about the DA. [52:33.100 --> 52:38.100] And so they pushed me off onto my councilman. [52:38.100 --> 52:44.100] The councilman's new, and he had one of his people come out and meet with me in a conference room. [52:44.100 --> 52:46.100] I was trying to give him the background. [52:46.100 --> 52:52.100] And I didn't get all hyper, trying to give him a little bit of background and tell him I need help. [52:52.100 --> 52:56.100] And my plan is I need housing here. [52:56.100 --> 53:00.100] I need to get my mom here, because the one thing they do have here is medical. [53:00.100 --> 53:03.100] They still have medical here. [53:04.100 --> 53:09.100] There's enough nurses and doctors out in Oregon. [53:09.100 --> 53:10.100] Forget it. [53:10.100 --> 53:15.100] The whole state should declare an emergency up there. [53:15.100 --> 53:21.100] So however, Randy and Brett, I'm 10 minutes into this meeting. [53:21.100 --> 53:23.100] We're in a conference room. [53:23.100 --> 53:27.100] And the guy, he was engaged. [53:27.100 --> 53:28.100] He asked me some questions. [53:28.100 --> 53:33.100] And he says, hey, I'm going to go get the housing person. [53:33.100 --> 53:35.100] They're on the 12th floor. [53:35.100 --> 53:37.100] He leaves the room. [53:37.100 --> 53:41.100] I'm finishing writing my letter to the mayor on my phone. [53:41.100 --> 53:44.100] And all of a sudden, the security guard appeared. [53:44.100 --> 53:47.100] And right out the gate, it's like he's wanting me to leave the room. [53:47.100 --> 53:51.100] And I'm like, well, what happened to the councilman's assistant? [53:51.100 --> 53:53.100] And I'm like, whoa, wait a minute. [53:53.100 --> 53:56.100] So I turned on my video. [53:56.100 --> 54:00.100] So that is a little nugget for everybody listening. [54:00.100 --> 54:02.100] I suggest body cams at this point. [54:02.100 --> 54:07.100] But for God's sake, turn your phone on, video everything. [54:07.100 --> 54:14.100] And so I engaged this guy, and I was trying to get him to explain why he was there. [54:14.100 --> 54:16.100] And was he asking me to leave? [54:16.100 --> 54:20.100] And had I caused a problem or was I considered a threat? [54:20.100 --> 54:21.100] He wouldn't answer any of that. [54:21.100 --> 54:24.100] I said, you know, if the guy wanted me to go down to the 12th floor, [54:24.100 --> 54:26.100] because that's what he said, you go down to the 12th floor. [54:26.100 --> 54:33.100] Had he, the security guards tell me that, had he just, the councilman's assistant just said, [54:33.100 --> 54:40.100] well, I got a meeting to go ahead and go to the 12th floor, I would have just left. [54:40.100 --> 54:43.100] And that's what I told the security guards. [54:43.100 --> 54:46.100] I said, well, what the hell is going on here? [54:46.100 --> 54:48.100] And that was really weird. [54:48.100 --> 54:53.100] And then I went down to the 12th floor and I spent an hour with the housing people. [54:53.100 --> 54:59.100] You know, going through the, you know, the process to get help. [54:59.100 --> 55:04.100] But yeah, pretty bizarre. [55:04.100 --> 55:06.100] Yeah, you never know what's going to happen. [01:02:38.100 --> 01:02:41.100] And he's really looking [01:02:41.100 --> 01:02:44.100] for someone to come in [01:02:44.100 --> 01:02:47.100] and take over. [01:02:47.100 --> 01:02:50.100] And, you know, [01:02:50.100 --> 01:02:53.100] he says, I can't believe that more people [01:02:53.100 --> 01:02:56.100] do not know about the training [01:02:56.100 --> 01:02:59.100] and education you can get with his program. [01:02:59.100 --> 01:03:02.100] So, [01:03:02.100 --> 01:03:05.100] the more [01:03:05.100 --> 01:03:08.100] you read it, [01:03:08.100 --> 01:03:11.100] and all of my [01:03:11.100 --> 01:03:14.100] experience in the court, man, [01:03:14.100 --> 01:03:17.100] it's just dead on what he's telling you in this [01:03:17.100 --> 01:03:20.100] program. And [01:03:20.100 --> 01:03:23.100] you have to, [01:03:23.100 --> 01:03:26.100] you know, he says that this is the way [01:03:26.100 --> 01:03:29.100] he believes this is the way we're really going to change things. [01:03:29.100 --> 01:03:32.100] And [01:03:32.100 --> 01:03:35.100] I kind of concur, but back to my case [01:03:35.100 --> 01:03:38.100] now, Randy, I need to [01:03:38.100 --> 01:03:41.100] fire up the criminal complaint presses. [01:03:41.100 --> 01:03:44.100] And we already discussed it [01:03:44.100 --> 01:03:47.100] the last time I called in. [01:03:47.100 --> 01:03:50.100] I'm going to, I've got to get a hold of the feds. [01:03:50.100 --> 01:03:53.100] And so it's [01:03:53.100 --> 01:03:56.100] obvious that the people involved in what was [01:03:56.100 --> 01:03:59.100] done to me for eight years, they all [01:03:59.100 --> 01:04:02.100] belong in prison. And the case, [01:04:02.100 --> 01:04:05.100] I'm blowing [01:04:05.100 --> 01:04:08.100] gaskets over the judge dismissing this. [01:04:08.100 --> 01:04:11.100] And I told you, the federal lawsuit that I [01:04:11.100 --> 01:04:14.100] have against Santa Clara County, specifically the district [01:04:14.100 --> 01:04:17.100] attorney and his two deputy DAs, who [01:04:17.100 --> 01:04:20.100] prosecuted me for eight years, [01:04:20.100 --> 01:04:23.100] 24 court appearances and 20 [01:04:23.100 --> 01:04:26.100] drop dead trial dates. [01:04:26.100 --> 01:04:29.100] And how in the hell [01:04:29.100 --> 01:04:32.100] can anybody say this isn't abuse? [01:04:32.100 --> 01:04:35.100] This is not in any [01:04:35.100 --> 01:04:38.100] shape or form [01:04:38.100 --> 01:04:41.100] under the [01:04:41.100 --> 01:04:44.100] community, [01:04:44.100 --> 01:04:47.100] specifically when they put in writing [01:04:47.100 --> 01:04:50.100] their intent, which was [01:04:50.100 --> 01:04:53.100] they wouldn't put me in prison if I would [01:04:53.100 --> 01:04:56.100] drop civil litigation for my home of [01:04:56.100 --> 01:04:59.100] 32 years. There's their intent. [01:04:59.100 --> 01:05:02.100] They made up a phony felony [01:05:02.100 --> 01:05:05.100] charge that does not exist. [01:05:05.100 --> 01:05:08.100] And then went at it for eight [01:05:08.100 --> 01:05:11.100] years. And now we have a federal judge, [01:05:11.100 --> 01:05:14.100] the brother of the [01:05:14.100 --> 01:05:17.100] Supreme Court judge that retired two years ago, [01:05:17.100 --> 01:05:20.100] Breyer, his brother, [01:05:20.100 --> 01:05:23.100] in the federal court is dismissed in my case. [01:05:23.100 --> 01:05:26.100] And I'm not clear that it's on immunity, but [01:05:26.100 --> 01:05:29.100] that's all they were pleading for their, the county [01:05:29.100 --> 01:05:32.100] was pleading for the dismissal is immunity. [01:05:32.100 --> 01:05:35.100] And that kind of immunity [01:05:35.100 --> 01:05:38.100] just doesn't exist. So why am I [01:05:38.100 --> 01:05:41.100] in this boat? And then the [01:05:41.100 --> 01:05:44.100] case in general, the way I see it, there's not [01:05:44.100 --> 01:05:47.100] enough of a record [01:05:47.100 --> 01:05:50.100] to appeal because I wasn't given a chance. [01:05:50.100 --> 01:05:53.100] He wrote his opinion in such a way he [01:05:53.100 --> 01:05:56.100] doesn't specifically say that they have [01:05:56.100 --> 01:05:59.100] immunity. So what the hell am I appealing? [01:05:59.100 --> 01:06:02.100] And I think what's going to happen is [01:06:02.100 --> 01:06:05.100] I may have to go past the ninth. [01:06:05.100 --> 01:06:08.100] I may have to go [01:06:08.100 --> 01:06:11.100] to some other venue, [01:06:11.100 --> 01:06:14.100] but it's now time for [01:06:14.100 --> 01:06:17.100] a full investigation. [01:06:17.100 --> 01:06:20.100] Okay, hold on. Let me see if I'm hearing the question. Is the question [01:06:20.100 --> 01:06:23.100] can we boil that down to [01:06:23.100 --> 01:06:26.100] how do you effectively appeal [01:06:26.100 --> 01:06:29.100] when you were [01:06:29.100 --> 01:06:32.100] prevented from making a record? Is that [01:06:32.100 --> 01:06:35.100] does that summarize it? [01:06:35.100 --> 01:06:38.100] I was dismissed before I was able to even [01:06:38.100 --> 01:06:41.100] create a record. [01:06:44.100 --> 01:06:47.100] And I was denied two hearings. [01:06:47.100 --> 01:06:50.100] I went back for [01:06:50.100 --> 01:06:53.100] I went back on a Rule 60 [01:06:53.100 --> 01:06:56.100] and he wasn't supposed to hear it because I'd also [01:06:56.100 --> 01:06:59.100] filed the appeal, but he went ahead [01:06:59.100 --> 01:07:02.100] and had it, he didn't hear it. [01:07:02.100 --> 01:07:05.100] He decided on it [01:07:05.100 --> 01:07:08.100] without a hearing. Without a hearing? [01:07:08.100 --> 01:07:11.100] Right. A hearing was set by the clerk, [01:07:11.100 --> 01:07:14.100] but he made a ruling on my [01:07:14.100 --> 01:07:17.100] Rule 60 [01:07:17.100 --> 01:07:20.100] two weeks prior to the hearing date [01:07:20.100 --> 01:07:23.100] on the Rule 60. [01:07:23.100 --> 01:07:26.100] He didn't allow a hearing [01:07:26.100 --> 01:07:29.100] on the motion for dismissal either. [01:07:29.100 --> 01:07:32.100] Okay, let me speak to what I did in my case. [01:07:32.100 --> 01:07:35.100] In my case, [01:07:35.100 --> 01:07:38.100] the Fifth Circuit [01:07:38.100 --> 01:07:41.100] dismissed my case with prejudice [01:07:41.100 --> 01:07:44.100] with one sentence. It said, this case is frivolous [01:07:44.100 --> 01:07:47.100] dismissed with prejudice. [01:07:47.100 --> 01:07:50.100] So, I filed [01:07:50.100 --> 01:07:53.100] criminal complaints against the three judges [01:07:53.100 --> 01:07:56.100] of the Court of Criminal Appeals [01:07:56.100 --> 01:07:59.100] against the federal grand jury. [01:07:59.100 --> 01:08:02.100] I've sent the documents in [01:08:02.100 --> 01:08:05.100] and I included a cover page. [01:08:05.100 --> 01:08:08.100] When I came [01:08:08.100 --> 01:08:11.100] from Boyd, north of Fort Worth, [01:08:11.100 --> 01:08:14.100] down to Austin, at that time [01:08:14.100 --> 01:08:17.100] I had received no response. [01:08:17.100 --> 01:08:20.100] As soon as I get back, I'll check my PO Box 1 [01:08:20.100 --> 01:08:23.100] and see if there is a response in there. [01:08:23.100 --> 01:08:26.100] If there is not a response in there, [01:08:26.100 --> 01:08:29.100] then I have reason to believe [01:08:29.100 --> 01:08:32.100] and do believe that the U.S. Attorney [01:08:32.100 --> 01:08:35.100] intercepted my criminal complaint [01:08:35.100 --> 01:08:38.100] to the federal grand jury [01:08:38.100 --> 01:08:41.100] and secreted it from them. [01:08:41.100 --> 01:08:44.100] So, I will file [01:08:44.100 --> 01:08:47.100] criminal charges against the U.S. Attorney [01:08:47.100 --> 01:08:50.100] in Fort Worth. [01:08:50.100 --> 01:08:53.100] I'm sorry, yeah, I filed it in Fort Worth. [01:08:53.100 --> 01:08:56.100] So, I'll file against the U.S. Attorney in Fort Worth [01:08:56.100 --> 01:08:59.100] with the U.S. Attorney in D.C. [01:08:59.100 --> 01:09:02.100] and accuse the U.S. Attorney [01:09:02.100 --> 01:09:05.100] in Fort Worth [01:09:05.100 --> 01:09:08.100] of [01:09:08.100 --> 01:09:11.100] secreting my criminal complaints from a grand jury. [01:09:11.100 --> 01:09:14.100] And then when the U.S. Attorney [01:09:14.100 --> 01:09:17.100] in D.C. [01:09:17.100 --> 01:09:20.100] fails to [01:09:20.100 --> 01:09:23.100] present my complaint to the grand jury, [01:09:23.100 --> 01:09:26.100] what I'll send is a complaint to the [01:09:26.100 --> 01:09:29.100] D.C. grand jury [01:09:29.100 --> 01:09:32.100] by way of the [01:09:32.100 --> 01:09:35.100] U.S. Attorney's office in D.C. [01:09:35.100 --> 01:09:38.100] And when I don't get the cover letter back [01:09:38.100 --> 01:09:41.100] for my criminal complaint against the [01:09:41.100 --> 01:09:44.100] U.S. Attorney in Fort Worth, [01:09:44.100 --> 01:09:47.100] accusing him of secreting my [01:09:47.100 --> 01:09:50.100] criminal complaints from the grand jury [01:09:50.100 --> 01:09:53.100] in- [01:09:53.100 --> 01:09:56.100] I lost my place. [01:09:56.100 --> 01:09:59.100] Secreting my criminal complaints from the grand jury [01:09:59.100 --> 01:10:02.100] in Fort Worth, then I will [01:10:02.100 --> 01:10:05.100] expect the Attorney General in D.C. [01:10:05.100 --> 01:10:08.100] to present my [01:10:08.100 --> 01:10:11.100] complaints to the D.C. grand jury. [01:10:32.100 --> 01:10:35.100] As the U.S. Attorney has a [01:10:35.100 --> 01:10:38.100] rubber stamp with your name on it that he uses [01:10:38.100 --> 01:10:41.100] to rubber stamp superseding indictments, and we want to make [01:10:41.100 --> 01:10:44.100] sure he didn't rubber stamp this document and send it [01:10:44.100 --> 01:10:47.100] back to me. So I ask you to sign it and [01:10:47.100 --> 01:10:50.100] send it back to me. Acknowledge [01:10:50.100 --> 01:10:53.100] received. Yes, exactly. [01:12:52.100 --> 01:12:55.100] If somebody in the federal government [01:12:55.100 --> 01:12:58.100] is doing something nefarious, [01:12:58.100 --> 01:13:01.100] to the U.S. attorneys in the United States, [01:13:01.100 --> 01:13:04.100] when they get a criminal [01:13:04.100 --> 01:13:07.100] complaint against a public official, [01:13:07.100 --> 01:13:10.100] to stand aside [01:13:10.100 --> 01:13:13.100] and forward that complaint [01:13:13.100 --> 01:13:16.100] to the grand jury, [01:13:16.100 --> 01:13:19.100] then all of these- any time [01:13:19.100 --> 01:13:22.100] these public offices start doing [01:13:22.100 --> 01:13:25.100] criminal stuff, you have some citizens [01:13:25.100 --> 01:13:28.100] who know about it. The county stole his airplane. [01:17:46.100 --> 01:17:49.100] No, it was a Boeing PT-17 [01:17:49.100 --> 01:17:52.100] Stearman in original Stinson. [01:17:52.100 --> 01:17:55.100] Oh, Stearman! Oh! [01:17:55.100 --> 01:17:58.100] I would so love to get my hands on a Stearman. Oh! [01:17:58.100 --> 01:18:01.100] It was priceless [01:18:01.100 --> 01:18:04.100] because it was in original condition [01:18:04.100 --> 01:18:07.100] from when it left the factory. It belongs [01:18:07.100 --> 01:18:10.100] in the Smithsonian Museum. [01:18:10.100 --> 01:18:13.100] And they destroyed it when they took it out of the [01:18:13.100 --> 01:18:16.100] hangar and trucked it on a flatbed [01:18:16.100 --> 01:18:19.100] down to Fresno, which is a four-hour [01:18:19.100 --> 01:18:22.100] truck ride down south. [01:18:22.100 --> 01:18:25.100] And I humiliated the county, [01:18:25.100 --> 01:18:28.100] even the local paper reported on it. [01:18:28.100 --> 01:18:31.100] The county bungled [01:18:31.100 --> 01:18:34.100] seizure of antique Stearman. [01:18:34.100 --> 01:18:37.100] Anybody who hasn't seen it, [01:18:37.100 --> 01:18:40.100] how many pistons [01:18:40.100 --> 01:18:43.100] does that radial engine have? [01:18:43.100 --> 01:18:46.100] I think seven. Seven. [01:18:46.100 --> 01:18:49.100] This thing is massive. I was in [01:18:49.100 --> 01:18:52.100] Homestead, Florida. [01:18:52.100 --> 01:18:55.100] A friend of mine there, his grandfather [01:18:55.100 --> 01:18:58.100] had a chicken farm. [01:18:58.100 --> 01:19:01.100] And I went out to the chicken farm [01:19:01.100 --> 01:19:04.100] and I walked between two of the buildings [01:19:04.100 --> 01:19:07.100] and looked up and there's a Stearman. [01:19:07.100 --> 01:19:10.100] This thing was incredible. [01:19:10.100 --> 01:19:13.100] It's a massive two-wing [01:19:13.100 --> 01:19:16.100] radial engine aircraft. [01:19:16.100 --> 01:19:19.100] I wanted more than anything [01:19:19.100 --> 01:19:22.100] to get my hands on that thing. [01:19:22.100 --> 01:19:25.100] Never got an opportunity to fly a Stearman [01:19:25.100 --> 01:19:28.100] such as Stearman. [01:19:28.100 --> 01:19:31.100] Okay, go ahead. I interrupted. [01:19:31.100 --> 01:19:34.100] It may have been as many as nine cylinders [01:19:34.100 --> 01:19:37.100] and it was, again, [01:19:37.100 --> 01:19:40.100] as it left the factory and that's why it was priceless [01:19:40.100 --> 01:19:43.100] because of its historical value [01:19:43.100 --> 01:19:46.100] and the fact that all of these [01:19:46.100 --> 01:19:49.100] had been modified. [01:19:49.100 --> 01:19:52.100] This one had about 225 horsepower, [01:19:52.100 --> 01:19:55.100] original propeller, everything, [01:19:55.100 --> 01:19:58.100] and everybody throws these Pat Whitney [01:19:58.100 --> 01:20:01.100] 450 horsepower engines on them. [01:20:01.100 --> 01:20:04.100] And they paint them and they do various things. [01:20:04.100 --> 01:20:07.100] But this had not been restored or modified [01:20:07.100 --> 01:20:10.100] in any way. [01:20:10.100 --> 01:20:13.100] And George Panzer was telling me stories about [01:20:13.100 --> 01:20:16.100] in the 60s, people would fly into [01:20:16.100 --> 01:20:19.100] Reed Hillview Airport in their P-51 Mustangs [01:20:19.100 --> 01:20:22.100] and they tried to trade him straight across. [01:20:28.100 --> 01:20:31.100] You have to appreciate these things. [01:20:31.100 --> 01:20:34.100] This Stearman, the engine radius, [01:20:34.100 --> 01:20:37.100] the radial engine, the pistons [01:20:37.100 --> 01:20:40.100] are in a circle. [01:20:40.100 --> 01:20:43.100] The radius of the engine [01:20:43.100 --> 01:20:46.100] was larger than I was tall. [01:20:46.100 --> 01:20:49.100] I'm 72 inches. [01:20:49.100 --> 01:20:52.100] Massive engine. [01:20:52.100 --> 01:20:55.100] Anyway, go ahead. [01:20:55.100 --> 01:20:58.100] That, again, sounds like a modified one [01:20:58.100 --> 01:21:01.100] because this has little cylinders on it. [01:21:40.100 --> 01:21:43.100] And it was known all over the day, you know, [01:21:43.100 --> 01:21:46.100] the South Bay here, San Jose, [01:21:46.100 --> 01:21:49.100] Santa Clara and all that. It was blue, [01:21:49.100 --> 01:21:52.100] 79 Z-28 Camaro. [01:21:52.100 --> 01:21:55.100] And I'd get a ticket once in a while and I'd go to court. [01:21:55.100 --> 01:21:58.100] And I'd win. [01:21:58.100 --> 01:22:01.100] And I got [01:22:01.100 --> 01:22:04.100] the ticket, but it really got heavy. [01:22:04.100 --> 01:22:07.100] I'm trying to remember. There was some other reason. [01:22:07.100 --> 01:22:10.100] I got exposed to courts [01:22:10.100 --> 01:22:13.100] and saw how corrupt it was. [01:22:13.100 --> 01:22:16.100] And the lawyers were terrible. [01:22:16.100 --> 01:22:19.100] I was like, wow. [01:22:19.100 --> 01:22:22.100] Wait a minute. I'm comfortable with this. [01:22:22.100 --> 01:22:25.100] Yeah, the lawyers were terrible. [01:22:25.100 --> 01:22:28.100] But to imply that [01:22:28.100 --> 01:22:31.100] the system is so absolutely corrupt, [01:22:31.100 --> 01:22:34.100] it is my opinion [01:22:34.100 --> 01:22:37.100] and my experience [01:22:37.100 --> 01:22:40.100] that most everybody in the legal system [01:22:40.100 --> 01:22:43.100] is doing what they believe [01:22:43.100 --> 01:22:46.100] is right in accordance [01:22:46.100 --> 01:22:49.100] with their training. [01:22:49.100 --> 01:22:52.100] I have a son-in-law [01:22:52.100 --> 01:22:55.100] who's a justice of the peace. [01:22:55.100 --> 01:22:58.100] He does everything wrong. [01:22:58.100 --> 01:23:01.100] It's not true, Randy. [01:23:01.100 --> 01:23:04.100] He does everything in accordance with his training. [01:23:04.100 --> 01:23:07.100] There are some like that, [01:23:07.100 --> 01:23:10.100] but there are also others who are, [01:23:10.100 --> 01:23:13.100] they have other motivations. [01:23:13.100 --> 01:23:16.100] Wait a minute. [01:23:16.100 --> 01:23:19.100] Don't get the idea that I'm defending you. [01:23:19.100 --> 01:23:22.100] I know you're not. [01:23:22.100 --> 01:23:25.100] The focus of the problem. [01:23:25.100 --> 01:23:28.100] You can pick on these JPs [01:23:28.100 --> 01:23:31.100] and these police all you want to [01:23:31.100 --> 01:23:34.100] and you're not going to fix the problem. [01:23:43.100 --> 01:23:46.100] They want to be the guy to rush in a burning house. [01:23:46.100 --> 01:23:49.100] They want to be the guy [01:23:49.100 --> 01:23:52.100] who's abusing a woman. [01:23:52.100 --> 01:23:55.100] They want to be the good guy. [01:23:55.100 --> 01:23:58.100] But they've been thrust into a system [01:23:58.100 --> 01:24:01.100] that is so corrupt [01:24:01.100 --> 01:24:04.100] that they do what they're trained [01:24:04.100 --> 01:24:07.100] and ordered to do, and when heat comes down, [01:24:07.100 --> 01:24:10.100] it doesn't come down on the guys [01:24:10.100 --> 01:24:13.100] who order them to do this. [01:24:13.100 --> 01:24:16.100] It comes down on them. [01:24:16.100 --> 01:24:19.100] The system is corrupt. [01:24:19.100 --> 01:24:22.100] Not people. [01:24:22.100 --> 01:24:25.100] I don't hate these people, [01:24:25.100 --> 01:24:28.100] but the bottom line is a lot of lawyers, [01:24:28.100 --> 01:24:31.100] most lawyers, I would say, [01:24:31.100 --> 01:24:34.100] they know the system's messed up, [01:24:34.100 --> 01:24:37.100] but guess what? [01:24:37.100 --> 01:24:40.100] They're not changing careers and they got bills to pay. [01:24:40.100 --> 01:24:43.100] So it comes down to this. [01:24:43.100 --> 01:24:46.100] I told you the story. I'm going to tell it again right now. [01:24:46.100 --> 01:24:49.100] Okay, hold on. Let me make this statement. [01:24:49.100 --> 01:24:52.100] I understand the lawyer has probably [01:24:52.100 --> 01:24:57.100] a student loan to pay off. [01:24:57.100 --> 01:25:00.100] He has probably a wife [01:25:00.100 --> 01:25:03.100] and a couple of kids and a car [01:25:03.100 --> 01:25:06.100] and a couple of cars and a mortgage payment, [01:25:06.100 --> 01:25:09.100] and he's got all of this weight on him [01:25:09.100 --> 01:25:12.100] and that he's trying to find a way [01:25:12.100 --> 01:25:15.100] to pay all these bills. [01:25:15.100 --> 01:25:18.100] Tough. [01:25:18.100 --> 01:25:21.100] You still have to follow law. [01:25:21.100 --> 01:25:24.100] Just because life is hard for you [01:25:24.100 --> 01:25:27.100] doesn't mean you get to cut corners. [01:25:27.100 --> 01:25:30.100] What I'm trying to do is [01:25:30.100 --> 01:25:33.100] focus on the problem. [01:25:33.100 --> 01:25:36.100] The lawyers and the police are not the problem. [01:25:37.100 --> 01:25:40.100] But unfortunately, [01:25:40.100 --> 01:25:43.100] excepting these guys, [01:25:43.100 --> 01:25:46.100] they're doing the best they can [01:25:46.100 --> 01:25:49.100] in circumstances that they deal with. [01:26:37.100 --> 01:26:40.100] The prosecutor said his trial date [01:26:40.100 --> 01:26:43.100] has to happen by this date, [01:26:43.100 --> 01:26:46.100] and the prosecutor said [01:26:46.100 --> 01:26:49.100] we can't get the lab results back in time. [01:37:00.100 --> 01:37:03.100] So, we got the president doing that, now we [01:37:03.100 --> 01:37:06.100] come back to the lower courts. [01:37:06.100 --> 01:37:09.100] Everything I do, [01:37:09.100 --> 01:37:12.100] when you come before the courts, [01:37:12.100 --> 01:37:15.100] you can't just say, oh, there's no good [01:37:15.100 --> 01:37:18.100] rotten scoundrel, he mistreated me, [01:37:18.100 --> 01:37:21.100] poor me, poor me, you need to do something. [01:37:21.100 --> 01:37:24.100] In order to invoke [01:37:24.100 --> 01:37:27.100] the duty of the court, [01:37:27.100 --> 01:37:30.100] you have to specifically [01:37:30.100 --> 01:37:33.100] allege the violation of [01:37:33.100 --> 01:37:36.100] a specified criminal [01:37:36.100 --> 01:37:39.100] statute. [01:37:39.100 --> 01:37:42.100] You can't just say he did something wrong. This public official [01:37:51.100 --> 01:37:54.100] exerted or purported [01:37:54.100 --> 01:37:57.100] to exert an authority [01:37:57.100 --> 01:38:00.100] that the official did not specifically [01:38:00.100 --> 01:38:03.100] have, and in the process [01:38:03.100 --> 01:38:06.100] denied me the full and free access [01:38:06.100 --> 01:38:09.100] to or enjoyment [01:38:09.100 --> 01:38:12.100] of a right. That is a statute, [01:38:12.100 --> 01:38:15.100] 39.03 Texas Code of Criminal Procedure, [01:38:15.100 --> 01:38:18.100] that every citizen should have [01:38:18.100 --> 01:38:21.100] memorized. [01:38:21.100 --> 01:38:24.100] And you shouldn't just, they say a bare recitation [01:38:24.100 --> 01:38:27.100] of the statute is not good enough. [01:38:27.100 --> 01:38:30.100] You have to actually put facts in there. [01:38:30.100 --> 01:38:33.100] So when you say that, then you follow it up with [01:38:33.100 --> 01:38:36.100] to wit, or just as follows.
