[04:53.400 --> 04:59.960] We want to start out talking about someone who's been in jail for a while that we're [04:59.960 --> 05:01.640] working to get him out. [05:01.640 --> 05:08.360] Brett, I haven't been keeping up with Jay lately, you want to bring me up to speak? [05:08.360 --> 05:13.720] Sure, I'll tell you what I know so far. [05:13.720 --> 05:19.960] So the guy's name is Jay, he's in Henderson County Jail. [05:19.960 --> 05:30.080] He is being held there, there are 10 indictments from the grand jury. [05:30.080 --> 05:37.600] Only one of these indictments is supported with a sworn complaint. [05:37.600 --> 05:43.840] And there are 10 warrants for his arrest that got him there. [05:43.840 --> 05:48.520] And zero of those are supported by a sworn complaint. [05:48.520 --> 05:55.840] There is no statement of fact or probable cause asserted on which to base these warrants. [05:55.840 --> 06:02.760] So right now, as you know, we've already had a habeas in the state. [06:02.760 --> 06:11.700] Go to all nine of the highest judges in Texas, and they're all sitting on it ignoring it. [06:11.700 --> 06:17.760] And we have criminal complaints against them for blowing off their duties. [06:17.760 --> 06:22.320] Then we have a federal habeas that's in the works right now. [06:22.320 --> 06:27.360] I haven't heard yet if anything has happened with that, apparently not. [06:27.360 --> 06:34.800] Oh yeah, there was a little pushback from that. [06:34.800 --> 06:43.320] So the magistrate judge, federal magistrate judge, decided to try to categorize this petition [06:43.320 --> 06:50.960] for a writ of habeas corpus as a regular lawsuit in which the person who is coming to the [06:50.960 --> 06:54.660] court needs to prove standing. [06:54.660 --> 07:00.720] And since it was signed by somebody besides Jay, whose mail is being tampered with, he [07:00.720 --> 07:04.640] can't get any documents reliably in or out. [07:04.640 --> 07:10.520] So since it was signed by somebody besides Jay, oh, well then this court can't hear it [07:10.520 --> 07:15.000] has no jurisdiction, can't issue any writs, can't do anything. [07:15.000 --> 07:20.760] It needs to be signed by Jay because you don't have any standing. [07:20.760 --> 07:27.440] And he also said, oh, besides that, you're supposed to use the standard habeas form. [07:27.440 --> 07:37.120] And he ordered the clerk to send the habeas form, one to Jay in jail and one to the petitioner. [07:37.120 --> 07:39.560] Only thing is there are two different forms. [07:39.560 --> 07:42.240] Number one, nobody needs to use any form. [07:42.240 --> 07:46.920] Just so everybody that's listening is clear, you could use a roll of toilet paper if you [07:46.920 --> 07:47.920] need to. [07:47.920 --> 07:52.440] I think Randy has seen somebody do that before. [07:52.440 --> 08:01.920] But the form that is for a prisoner is a different form than for somebody who's on the outside [08:01.920 --> 08:04.160] filing on their behalf. [08:04.160 --> 08:05.160] Two different ones. [08:05.160 --> 08:08.620] And it actually doesn't even have to be inside, outside. [08:08.620 --> 08:13.120] It's anything where your liberty is restrained, but it's typically used for incarceration. [08:13.120 --> 08:22.880] Anyway, this magistrate judge was never referred any pretrial or dispositive matter. [08:22.880 --> 08:26.360] He didn't have any business injecting himself in there at all. [08:26.360 --> 08:32.800] This same issue that we've already been talking about before and addressing. [08:32.800 --> 08:37.240] But in addition to that, he's come up, he's very incompetent, clearly. [08:37.240 --> 08:46.160] He is thinking or at least acting like he thinks that the habeas is somehow a regular [08:46.160 --> 08:50.120] lawsuit where somebody has to show standing and they have to be, well, if you're going [08:50.120 --> 08:56.980] to file this on behalf of the person whose liberty is restrained, then you need to categorize [08:56.980 --> 09:00.120] yourself as a next friend. [09:00.120 --> 09:04.640] And then you have to prove upstanding to be, you know, why are you the next friend? [09:04.640 --> 09:07.560] Prove it up. [09:07.560 --> 09:09.820] So yeah, there's that. [09:09.820 --> 09:16.760] So we got an objection in about that to kind of put that magistrate judge back in his place [09:16.760 --> 09:20.200] and show him all the ways he's wrong about that. [09:20.200 --> 09:23.080] How do you get to a magistrate judge? [09:23.080 --> 09:29.720] In the first place, habeas should go to the trial judge. [09:29.720 --> 09:36.200] Yeah, the only thing is, magistrate judge intercepts. [09:36.200 --> 09:40.920] So it needs a judicial conduct complaint against the trial judge. [09:40.920 --> 09:42.920] Yes, in the Fed. [09:42.920 --> 09:48.000] That would put him in a really bad mood. [09:48.000 --> 09:49.800] Well somebody just needs to issue the writ. [09:49.800 --> 09:52.680] I don't care what mood they're in as long as they just follow the law. [09:52.680 --> 09:53.920] Issue the writ, you're done with it. [09:53.920 --> 10:00.000] Well, it's a good chance the trial judge doesn't even know it exists. [10:00.000 --> 10:04.160] Exactly, because it's been intercepted by somebody who feels like he's going to treat [10:04.160 --> 10:07.280] it like a regular lawsuit. [10:07.280 --> 10:14.880] So you file a judicial conduct complaint against the judge for failing to hear the writ because [10:14.880 --> 10:19.120] the writ's a great writ and everything stands down before the writ. [10:19.120 --> 10:27.360] If the judge is hearing anything and he has a writ before him, then he's violating law [10:27.360 --> 10:29.720] and it should get zapped for him. [10:29.720 --> 10:32.640] Oh, wait a second, am I understanding you right? [10:32.640 --> 10:37.600] Are you saying we should file a judicial misconduct complaint against the district judge? [11:25.600 --> 11:30.480] Jay was in there, he's been in there since March 10th. [11:30.480 --> 11:37.620] No actual trial set, there's not been any kind of examining trial even, no determination [11:37.620 --> 11:42.200] of probable cause, nothing, he's just sitting there. [11:42.200 --> 11:50.840] And so it's been obviously well over two months and now on May 10th, his wife was arrested [11:50.840 --> 11:51.840] and she's been in there. [11:51.840 --> 11:58.560] Now, she just has one indictment and one warrant, but neither one are supported by a sworn affidavit. [11:58.560 --> 11:59.560] There's nothing. [11:59.560 --> 12:04.680] It's just an indictment and a warrant. [12:04.680 --> 12:10.200] So those can obviously, we could move the court to set aside or quash the indictment. [12:10.200 --> 12:18.240] Wait, wait, wait, there cannot be an indictment without, they've been arrested. [12:18.240 --> 12:22.920] The requirement was that they be brought before the magistrate when they were arrested. [12:22.920 --> 12:26.760] Yeah, they didn't do that. [12:26.760 --> 12:28.400] For the probable cause, yeah. [12:28.400 --> 12:32.040] But it hasn't, they have nobody's determined probable cause. [12:32.040 --> 12:35.520] They even sent bail before they brought her in. [12:35.520 --> 12:42.280] I sent Jay a 1617 order motion. [12:42.280 --> 12:45.200] Do you know if they've got that filed? [13:43.840 --> 13:51.200] Nothing on either one of them is supported by any probable cause affidavit or anything. [13:51.200 --> 13:54.200] There's no complaint. [13:54.200 --> 13:55.200] Wow. [14:26.840 --> 14:27.840] Anyway. [14:27.840 --> 14:33.640] Oh, the two children, the grandchildren, the children over. [14:33.640 --> 14:34.640] Yeah. [14:34.640 --> 14:35.640] Okay. [14:35.640 --> 14:37.900] Jay's daughter and son-in-law. [14:37.900 --> 14:40.760] Has anything been filed in their behalf? [14:40.760 --> 14:44.640] I don't know yet. [15:42.160 --> 15:46.120] They give the mail, some of the mail to them. [15:46.120 --> 15:51.840] It's obviously pretty messed up, but anyway, that's that current situation. [21:25.640 --> 21:31.280] Okay, this is Daniel with the foreclosure issue, tell me what you got. [21:31.280 --> 21:35.440] Okay, so here's the base fact. [21:35.440 --> 21:42.200] His husband and wife, just called mom and pops, in 2005, they entered into a verbal [21:42.200 --> 21:51.840] contract with a company here called Panhandle to purchase the house for $10,000 at $2.50 [21:51.840 --> 21:53.320] a month. [21:53.320 --> 22:01.160] So fast forward to 2012, I believe, or 2013, the owner stopped by and he let him know that [22:01.160 --> 22:06.360] they'd paid $6,000 of it, and he considered it paid. [22:06.360 --> 22:13.960] And upon request of their IDs, licenses, whatever, he said he was going to go to the courthouse [22:13.960 --> 22:18.120] and transfer the deed into their name. [22:18.120 --> 22:23.480] Well, he never, he came back and brought their IDs, but he never brought the deed. [22:23.480 --> 22:31.880] And then in 2014, he went either to state or federal prison for tax evasion. [22:31.880 --> 22:37.360] And last Saturday, they got the letter in the mail that said they were going to sell [22:37.360 --> 22:49.800] their house at the courthouse, side door courthouse for unpaid taxes in the amount of almost $10,100. [22:49.800 --> 22:57.080] So the end of the story, they went to the courthouse to talk to them. [22:57.080 --> 23:02.800] And after speaking with the county clerk, the county clerk allowed them to enter into [23:02.800 --> 23:14.340] a contract with the county to pay $312 a month for three years, excuse me. [23:14.340 --> 23:21.640] And then after the three years and the, which turns out to be $13,000, but that's irrelevant. [23:21.640 --> 23:27.520] At the end of the three years, they would give them a deed in their name, because right [23:27.520 --> 23:34.200] now the deed is not in their name, but they're getting ready to get put on the streets. [23:34.200 --> 23:39.040] And it just doesn't, it didn't sound right, it doesn't sound right. [23:39.040 --> 23:46.640] There's 29, 29 houses that are going up to the highest bidder at the courthouse door [23:46.640 --> 23:52.160] on June 6th in a town of 12,000 people. [23:52.160 --> 23:53.160] Wow. [38:55.480 --> 38:59.320] In Texas, if a property is vacant, [38:59.320 --> 39:02.080] and you take possession of that, oh, no, they [39:02.080 --> 39:05.680] can't do adverse possession anyway. [39:05.680 --> 39:09.080] Because they took possession of the property [39:09.080 --> 39:10.680] with the permission of the owner. [39:13.360 --> 39:15.400] When you take it with permission, [39:15.400 --> 39:19.160] you can never claim adverse possession. [39:19.160 --> 39:21.760] I knew a guy who used to go around looking [39:21.760 --> 39:29.200] for properties that hadn't had taxes paid on them in forever, [39:29.200 --> 39:32.320] and they hadn't been able to sell it. [39:32.320 --> 39:34.560] And if he wanted the property, he [39:34.560 --> 39:39.560] would go in and get an old newspaper [39:39.560 --> 39:45.520] and photograph himself in the yard with his old newspaper, [39:45.520 --> 39:46.680] holding up the newspaper. [39:46.680 --> 39:49.200] And then he'd mow it all out and clean it all up. [39:49.200 --> 39:51.240] And then he'd photograph himself again [39:51.240 --> 39:54.160] and then pay the taxes on it. [39:54.160 --> 39:58.320] And then he would go to the court with a petition [39:58.320 --> 39:59.440] to transfer the property. [39:59.440 --> 40:02.520] There's a way to do that in four years. [40:02.520 --> 40:05.600] So he'd get a four-year-old newspaper. [40:05.600 --> 40:08.080] And then the judge would look at it and look out [40:08.080 --> 40:13.120] at the audience in the gallery and say, does anyone object? [40:13.120 --> 40:15.840] If no one objects, he sends property over to them. [40:15.840 --> 40:18.520] Now, it's in their interest because they get the property [40:18.520 --> 40:19.840] back on the tax rolls. [40:22.560 --> 40:24.440] And since it was abandoned property, [40:24.440 --> 40:26.920] there's apparently no harm, no foul. [40:26.920 --> 40:31.040] So in their position, they have no adverse position [40:31.040 --> 40:33.600] because they took it on agreement. [40:33.600 --> 40:37.640] It sounds like there was a misunderstanding. [40:37.640 --> 40:41.960] Well, I mean, I have the notice of the sale [40:41.960 --> 40:44.240] and the cause number and everything [40:44.240 --> 40:47.760] and Hutchinson County versus Cannon Reynolds. [40:47.760 --> 40:51.960] So if this guy went to court on this cause number, [40:51.960 --> 40:54.920] if I'm hearing you correctly, he would have been [40:54.920 --> 40:57.080] on the cause number if I'm hearing you correctly. [40:57.080 --> 41:00.600] So he represented the property and he agreed [41:00.600 --> 41:03.720] to give it to the county for the taxes owed. [50:04.800 --> 50:07.000] Okay, so then you're talking, [50:07.000 --> 50:10.600] I'm going to be suing upwards of 30 people. [50:10.600 --> 50:15.400] I'm going to name the judges involved, the district attorney. [50:15.400 --> 50:18.600] I'm going to name the county board of supervisors, [50:18.600 --> 50:23.400] the county executive who runs the daily operations of the county. [50:23.400 --> 50:28.800] And down the road, I'll probably name their spouses. [50:28.800 --> 50:35.000] And all the lawyers involved, the prosecutors, [50:35.000 --> 50:39.400] your court-appointed counsel that you couldn't fire, name them all. [50:39.400 --> 50:43.600] And you're alleging an ongoing criminal enterprise. [50:43.600 --> 50:47.600] It's not reasonable to think [50:47.600 --> 50:51.000] that you're the only person they're doing this to. [50:51.000 --> 50:54.200] If you're accepting money from the county, [50:54.200 --> 50:57.400] then they're doing it to everybody. [50:57.400 --> 51:01.000] So that means no statute of limitations. [51:01.000 --> 51:05.600] It's ongoing. [51:05.600 --> 51:12.400] Well, for my issue, I believe there's a statute of limitations. [51:12.400 --> 51:14.200] I mean, there is an ongoing... [51:14.200 --> 51:20.800] Well, even if there was, it would be two years. [51:20.800 --> 51:27.000] Okay, but again, so this is a new pivot here [51:27.000 --> 51:32.200] because I was going to sue the county. [51:32.200 --> 51:39.000] And so because you're suing the county, you've got six months. [51:39.000 --> 51:43.200] No, no, no. Sue the individuals. [51:43.200 --> 51:47.600] The county is a legal fiction. It really doesn't exist. [51:47.600 --> 51:49.600] The county can't do anything. [51:49.600 --> 51:54.800] The county cannot participate in an ongoing criminal enterprise. [51:54.800 --> 52:00.400] Only human beings can participate in a criminal enterprise. [52:00.400 --> 52:05.400] I sued all of the judges, [52:05.400 --> 52:11.600] the directors of several agencies that train magistrates, [52:11.600 --> 52:16.200] and the president of Texas State University. [52:16.200 --> 52:19.200] I sued each one of them personally. [52:19.200 --> 52:28.800] I did not sue the state. [52:28.800 --> 52:33.600] Well, this is a new revelation for me, Randy. [52:33.600 --> 52:36.200] It's something I'm going to have to think about more. [52:36.200 --> 52:39.600] I would like to get a copy of the lawsuit you filed [52:39.600 --> 52:43.400] where you're suing for $500 million. [52:43.400 --> 52:45.200] I'd like to look at that. [53:16.000 --> 53:19.600] And they're the ones that not to have to come forward [53:19.600 --> 53:21.400] and answer to the habeas. [53:21.400 --> 53:26.600] But I also named, when I filed it in federal court, [53:26.600 --> 53:30.600] I picked the judge, put the judge's name on the habeas [53:30.600 --> 53:32.200] that it was going to go to, [53:32.200 --> 53:34.400] and like I said, I listed the people [53:34.400 --> 53:37.400] that had to come appear to answer. [53:37.400 --> 53:39.800] And so maybe that's something that should be done, [53:39.800 --> 53:43.000] like the presiding judge of the Superior Court, [53:43.000 --> 53:45.600] or whatever you call that in Texas, [53:45.600 --> 53:47.600] is the name that needs to go on that [53:47.600 --> 53:51.800] to bypass this magistrate. [53:51.800 --> 53:56.600] And I'll also say, when I was listening to this, [53:56.600 --> 53:59.600] it's very clear to me that these judges [53:59.600 --> 54:04.000] all get trained by the same school. [54:04.000 --> 54:07.600] The game is being played down there. [54:07.600 --> 54:14.400] That is exactly what the nature of my Rico suit was about. [54:14.400 --> 54:17.600] Yeah, the secretary was talking about Texas, [54:17.600 --> 54:23.000] and this is that federal level, but same thing. [54:23.000 --> 54:24.800] Yeah, they're all trained by the same, [54:24.800 --> 54:27.800] if they are, my argument was, [54:27.800 --> 54:32.000] they were trained not in proper procedures, [54:32.000 --> 54:35.000] but they were trained in the elements [54:35.000 --> 54:39.400] of an ongoing criminal enterprise. [54:39.400 --> 54:42.800] And because it's an ongoing criminal enterprise, [54:42.800 --> 54:50.800] crimes cannot be construed to be within scope. [54:50.800 --> 54:53.400] Well, I'll just say the games that are being played [54:53.400 --> 54:56.000] are very familiar. [54:56.000 --> 54:59.000] You know, a couple of suggestions. [54:59.000 --> 55:02.400] You got to go visit the prisoner, [55:02.400 --> 55:05.400] get a power of attorney signed. [55:05.400 --> 55:08.000] The other thing is take the documents on a visit [55:08.000 --> 55:09.800] and have them sign them. [55:09.800 --> 55:15.600] But this is BS, anybody can do a habeas, and they know it. [55:15.600 --> 55:18.600] And so you're just getting, you're getting, [55:18.600 --> 55:19.800] I don't know the term for it, [55:19.800 --> 55:25.000] but they're teaching these judges to do this dirty stuff. [55:25.000 --> 55:30.000] And the same thing happens here in California. [55:30.000 --> 55:33.000] And so I just say, first, [55:33.000 --> 55:34.800] if you're going to stay in the Superior Court [55:34.800 --> 55:39.200] or whatever Texas calls the court where they're at, [55:39.200 --> 55:41.200] and then the whole thing here is, you know, [55:41.200 --> 55:50.400] they've been in jail with no due process for too long. [55:50.400 --> 55:53.200] You have a right to a preliminary hearing in California. [55:53.200 --> 55:55.200] One minute is too long. [55:55.200 --> 55:58.200] They're not allowed to do it at all. [55:58.200 --> 56:00.600] Well, for the other reasons that were already described, [56:00.600 --> 56:02.000] but just a couple of things there. [56:02.000 --> 56:05.800] One, name the judge that you want to hear the habeas. [56:05.800 --> 56:06.800] And also... [56:06.800 --> 56:09.000] Well, we got some pushback on that. [56:09.000 --> 56:14.600] I don't know if you want to just hear what they like to say about that [56:14.600 --> 56:17.400] so that you can skirt it next time. [56:17.400 --> 56:21.400] But the district judge will tell you [56:21.400 --> 56:24.200] that a party has no right to have his case heard [56:24.200 --> 56:28.400] by a district judge of his choosing, Brown v. U.S. [56:28.400 --> 56:30.800] And so then they will try to use that [56:30.800 --> 56:34.800] as if you're trying to get one particular judge of your choosing, [56:34.800 --> 56:38.600] when really all you care about is having a real Article 3 judge [56:38.600 --> 56:44.800] instead of, you know, the magistrate judge. [56:44.800 --> 56:49.000] Right. So, well, at the federal... [56:49.000 --> 56:50.000] I don't know. [56:50.000 --> 56:52.000] I do want to get back to my situation [56:52.000 --> 56:53.800] because I'm running out of time. [56:53.800 --> 56:59.200] But everybody should be bothered what's happening with this family. [56:59.200 --> 57:01.800] And, I mean, there should be protests [57:01.800 --> 57:05.000] out in front of wherever they're being held. [57:05.000 --> 57:09.000] And, you know, whatever it takes to get the news media on this, [57:09.000 --> 57:13.600] I don't know what the heck these guys stepped into that has caused this. [57:13.600 --> 57:16.400] You know, I don't know if they went after the judge's bonds [57:16.400 --> 57:18.200] or if there's some other thing under... [57:18.200 --> 57:21.400] Yeah, yeah, yeah. His house. [57:21.400 --> 57:24.200] They went after the judge's houses. [57:24.200 --> 57:26.600] Two judge's houses and the sheriff's house. [57:26.600 --> 57:30.000] I'm a prosecutor's house. [57:30.000 --> 57:33.200] Didn't think that would make anybody mad. [57:33.200 --> 57:37.400] If those public servants weren't violating the law before, [57:37.400 --> 57:41.400] they were ready to at that point. [57:41.400 --> 57:46.000] Well, that's, you know, that's the problem. [57:46.000 --> 57:50.400] You know, the political winds as they are in this country, [57:50.400 --> 57:55.400] it really, it's just shocking to me where we're at. [01:04:39.600 --> 01:04:46.600] In the second, if you claim an ongoing criminal enterprise, [01:04:46.600 --> 01:04:50.600] then you eliminate any statute of limitations. [01:04:50.600 --> 01:04:55.600] It's not what you can prove that keeps you in court. [01:04:55.600 --> 01:04:59.600] It is the nature of the claim that you make. [01:04:59.600 --> 01:05:05.600] So if you make the claim that they were without subject matter jurisdiction, [01:05:05.600 --> 01:05:07.600] and you can establish that, [01:05:07.600 --> 01:05:10.600] then they are necessarily without any immunity, [01:05:10.600 --> 01:05:16.600] because immunity is the first thing you're going to claim. She's real friendly, but she's got a streak in her. [01:34:32.600 --> 01:34:52.600] So, anyway, the thing I want to discuss, though, is I was out in my black car, and no plates, no license, no registration, nothing. It was raining out. [01:34:52.600 --> 01:35:01.600] I usually ride my electric bike. But I was going to the store, and I decided to take a stop at the 7-Eleven. [01:35:01.600 --> 01:35:07.600] Well, a sheriff rolls up, sits at the pump, and I'm stuck there. [01:35:07.600 --> 01:35:14.600] So now I go in there. I say, I'm going to see if he sees me, because I don't need no hassle tonight, getting late. [01:35:14.600 --> 01:35:18.600] So I went to the bathroom. The bathroom was locked. [01:35:18.600 --> 01:35:24.600] So I went back to my car, threw in reverse, and pulled right back into the spot. [01:35:24.600 --> 01:35:31.600] Well, that, because I knew he was watching me. He was watching me from the pump. [01:35:31.600 --> 01:35:35.600] And I think he saw that I don't have no plates on the car. [01:35:35.600 --> 01:35:43.600] So I got out of my car, and I sat on the curb, and I waited for him to walk up to me. [01:35:43.600 --> 01:35:52.600] He walked up to me, put me in handcuffs, said, you got a gun? I said, no. [01:35:52.600 --> 01:35:58.600] He said, well, that's a big jacket you got on. I said, well, I could take it off. [01:35:58.600 --> 01:36:04.600] I was being real nice to him. But I had something for him, because you guys taught me a lot. [01:36:04.600 --> 01:36:12.600] So I said, well, you almost drove into the street. I said, I'm not using a license. [01:36:12.600 --> 01:36:17.600] I said, I'm not in transportation. Do your worst. [01:36:17.600 --> 01:36:26.600] He says, you got ID? I says, no. I got in a car accident, hit me crossing the street, and the hospital lost my ID. [01:36:26.600 --> 01:36:35.600] But I can tell you, you show me why probable cause. I'll give you my name and my phone number. [01:36:35.600 --> 01:36:41.600] Not my phone number, my address. So I gave him that. [01:36:41.600 --> 01:36:48.600] And he says, well, I'm going to have to run you downtown, because you're a failure to ID. [01:36:48.600 --> 01:36:55.600] I said, I just ID'd. He said, well, I don't like to do this, but. [01:36:55.600 --> 01:37:03.600] So I says, are you going to tow my car? He says, I don't know. [01:37:03.600 --> 01:37:18.600] I says, OK. So I started stalling. I says, well, I think I was hit by a car May of 2016. [01:37:18.600 --> 01:37:28.600] And I had my ID at the time, and the officer took my ID. He says, OK, wait here. [01:37:28.600 --> 01:37:36.600] So he called a policeman who looked it up, got my ID, but no photo. [01:37:36.600 --> 01:37:41.600] There was no photo on the ID. He says, why don't you got a photo on your ID? [01:37:41.600 --> 01:37:46.600] I says, because it's probably been expired for the last six years. [01:37:46.600 --> 01:37:52.600] So he took that. And another lady came up. She was a sheriff deputy. [01:37:52.600 --> 01:38:01.600] And I told her, well, when the Constitution gets kicks back in in Austin, [01:38:01.600 --> 01:38:10.600] you're not going to be able to harass people by exercising the right of locomotion. [01:38:10.600 --> 01:38:13.600] She said, exercising the right of locomotion. [01:38:13.600 --> 01:38:24.600] I said, yeah, you can go to Cornell Law and type in your Google search Cornell Law right of locomotion. [01:38:24.600 --> 01:38:28.600] Just type that into your phone whenever you get a chance. [01:38:28.600 --> 01:38:38.600] And you go right to the black letter law of how the whole transportation things got started in Texas and everything and all that stuff. [01:38:38.600 --> 01:38:44.600] And if you're interested, I'm not trying to threaten your career or nothing. [01:38:44.600 --> 01:38:50.600] But basically, I'm exercising my right to locomotion. [01:38:50.600 --> 01:38:56.600] You got no probable cause. You got no agreement whatsoever. [01:38:56.600 --> 01:38:59.600] My car is not even my car is not even in my name. [01:38:59.600 --> 01:39:05.600] It's still I got a receipt for the car and I got the title signed. [01:39:05.600 --> 01:39:09.600] And I have not made any agreements with the state. [01:39:09.600 --> 01:39:14.600] The state has no interest in this in this car. [01:39:14.600 --> 01:39:22.600] So basically, they got all spooked and they I think they really know. [01:39:22.600 --> 01:39:30.600] That there is no agreement whatsoever between me and the state of Texas. [01:39:30.600 --> 01:39:40.600] As far as transportation goes, I think what they know is I got somebody here who's going to drag me into the courts for the next three or four years. [01:39:40.600 --> 01:39:46.600] And I don't want to have to put up with that. Yeah, that's a strong possibility. [01:39:46.600 --> 01:39:52.600] So what happened was he says, OK, guys, don't drive. [01:39:52.600 --> 01:40:03.600] And I said, I never do. And I followed him out into the street and I traveled all the way to my house. [01:40:03.600 --> 01:40:09.600] Well, they did that to me once when they asked me for my driver's license, I gave them my ID. [01:40:09.600 --> 01:40:14.600] This was before you could at the time, you could have both an ID and a driver's license. [01:40:14.600 --> 01:40:19.600] He goes back, comes back up to me and he said, Mr. Kelton, this is a Texas ID. [01:40:19.600 --> 01:40:22.600] Do you have a driver's license? I said, yes, I do. [01:40:22.600 --> 01:40:30.600] But I'm not using it right now. He said, are you one of those guys that said, yes, I am. [01:40:30.600 --> 01:40:33.600] Go have a nice day. [01:48:26.600 --> 01:48:33.600] Mm-hmm, for $0.00 and eviction says $0.00 and 0 cents. [01:48:33.600 --> 01:48:40.600] So is it your perspective or your perception that they were just trying to find a way to evict you [01:48:40.600 --> 01:48:45.600] and so they filed a bunch of weird stuff to try to make it look like you were doing fraud? [01:48:49.600 --> 01:48:58.600] I rented from her and then I found out two months into it that she had did an acquisition of abandonment, which is 1099A. [01:48:58.600 --> 01:49:03.600] So just a little tidbit for everybody in case y'all don't know, but I'm sure you do. [01:49:03.600 --> 01:49:11.600] Since we've been bankrupt since 1933, at the end of every year in a bankruptcy comes a discharge. [01:49:11.600 --> 01:49:19.600] So what the IRS said to us is at the end of every year we will write off all your debts, but every American doesn't know this. [01:49:19.600 --> 01:49:24.600] But if you get wind of it, then there's a form. It's called a 1099A. [01:49:24.600 --> 01:49:29.600] And this particular form you file with the IRS. You can file it online. [01:49:29.600 --> 01:49:32.600] You file with the IRS, but you have to have the person who says... [01:49:32.600 --> 01:49:37.600] Wait a minute. Wait a minute. Is this a 1099OID? [01:49:37.600 --> 01:49:41.600] No, this is a 1099A, which is filed with the OID. [01:49:41.600 --> 01:49:46.600] If, in fact, you're filing it to purchase something through your trustee. [01:49:46.600 --> 01:49:51.600] But this is, I'm talking about writing off your debt. So this is what she did. [01:49:51.600 --> 01:49:59.600] She pretended as if I came and bought this property from her and used a 1099A. [01:49:59.600 --> 01:50:04.600] But I did not do that. I came and signed a lease with her. [01:50:04.600 --> 01:50:07.600] And then once I called her on it, she was like, she's an old lady. [01:50:07.600 --> 01:50:12.600] She's like, I don't want to go to jail. I'm just a little old lady. [01:50:12.600 --> 01:50:19.600] And I was like, but you can't do that. And she was like, you can just have the property and I'll just walk away. [01:50:19.600 --> 01:50:24.600] And I was like, look, okay, we're believers. I came to her house, prayed for her husband. [01:50:24.600 --> 01:50:28.600] You know, we had a good, so I thought friendship, relationship growing. [01:50:28.600 --> 01:50:30.600] And all along she was doing these things. [01:50:30.600 --> 01:50:36.600] So then when I went out of town to visit my mom for a week, I ended up getting into a car accident. [01:50:36.600 --> 01:50:40.600] And my car got totaled and I was gone for two weeks instead of one. [01:50:40.600 --> 01:50:48.600] And when I got back the next day, she put a note on my door for eviction that said I ordered $0.00 and zero cents. [01:50:48.600 --> 01:50:58.600] And then she wrote a sign on the property. If I come down and say I owe her one month rent and late fees, I said, what is going on? [01:50:58.600 --> 01:51:08.600] So the guy who actually got me connected to you guys, he said, this is the most bizarre, craziest, the lawyer. [01:51:08.600 --> 01:51:17.600] Like it's the craziest story I ever heard. But it's where this part is my part of the movie, I guess, for The Great Awakening. [01:51:17.600 --> 01:51:20.600] You're part of the movie. [01:51:20.600 --> 01:51:28.600] What she will have to do in order to evict you is she will have to give you a three day notice to vacate. [01:51:28.600 --> 01:51:37.600] Then when you ignore that notice to vacate, she has to file for eviction with the local justice of the peace. [01:51:37.600 --> 01:51:44.600] And I suspect when you show this to the justice of the peace, their eviction won't go very far. [01:51:44.600 --> 01:51:49.600] Are you paid up on your rental on the property? [01:51:49.600 --> 01:52:02.600] Listen, I am Indian and I look more mixed, but I'm saying that to say there's not a lot of melanin where I live. [01:52:02.600 --> 01:52:08.600] She's been out here for 70 some years. She has the sheriff in her pocket. [01:52:08.600 --> 01:52:11.600] No, no, no, no, this is too small. [01:52:11.600 --> 01:52:14.600] Yes, he does. I'm telling you. [01:52:14.600 --> 01:52:18.600] No, the sheriff is not going to, he's not going to risk prison. [01:52:18.600 --> 01:52:21.600] I'm not the only person that she's done this to. [01:52:21.600 --> 01:52:27.600] No, no, no, I've heard this. She's not going to, the sheriff is not going to risk going to prison. [01:52:27.600 --> 01:52:32.600] There are things that must be done in order to evict. [01:52:32.600 --> 01:52:38.600] Are you paid up? Are you current with payments? [01:52:38.600 --> 01:52:40.600] I don't owe her any money. [01:52:40.600 --> 01:52:45.600] Okay, well then this eviction is not going to be very easy for her. [01:52:45.600 --> 01:52:46.600] Right. [01:52:46.600 --> 01:52:57.600] Yeah, this will go to the local JP and the JP knows if he screws around, he'll get it appealed. [01:52:57.600 --> 01:53:01.600] And they don't have any grounds for eviction. [01:53:01.600 --> 01:53:04.600] And the fact that she knows the sheriff's not going to help her. [01:53:04.600 --> 01:53:18.600] I wrote up my, I wrote up a letter for dismissal and I also got my tort complaint going on in case it doesn't go the way it's supposed to be. [01:53:18.600 --> 01:53:26.600] Hold on, hold on. You wrote up a notice for dismissal. Has she filed for eviction? [01:53:26.600 --> 01:53:30.600] Yeah, she did. I have a hearing on the 24th. [01:55:15.600 --> 01:55:20.600] But I want, the only reason, listen, I've been frauded, people have taken from me. [01:56:41.600 --> 01:56:51.600] You may have an older woman that's talked to some of these patriot mythologist guys and they fed her a bunch of stuff that's going to get her in trouble. [01:56:51.600 --> 01:57:03.600] I've got a guy in Arizona right now that I'm trying to get his warrants lifted because he listened to one of these guys and filed a lot of this patriot mythology stuff.
