It's an act of official misconduct [22:17.300 --> 22:20.420] And a class A misdemeanor in the fed [22:21.540 --> 22:24.980] And a class A misdemeanor in every state I've looked at [22:28.180 --> 22:33.460] If the municipality or the county corporation [22:33.460 --> 22:39.540] Attempts to apply its ordinances to the general public [22:41.380 --> 22:45.860] Then I maintain that is a constitutional violation [22:47.380 --> 22:54.260] The one thing that the courts want to avoid the most are constitutional claims [22:56.180 --> 22:58.180] In a case here in Texas, we had a [22:58.980 --> 23:00.340] municipality [23:00.340 --> 23:04.100] Go after someone over junk vehicles [23:04.740 --> 23:08.340] And we filed a petition for rid of mandamus [23:09.540 --> 23:11.540] Right, I know [23:12.260 --> 23:16.660] Okay, you remember that now that was odd because the court [23:17.540 --> 23:25.140] In in texas a mandamus is accepted by the the court of appeals 12 of the time [23:25.140 --> 23:32.740] Two percent of the time mandamuses are ruled on in favor of the filer in this case [23:33.940 --> 23:35.940] The filing was by a pro se [23:37.380 --> 23:40.980] They accepted it and they ruled in favor of the pro se [23:41.780 --> 23:43.780] And dismissed the case outright [23:44.340 --> 23:47.700] Claiming that the trial court did not have subject matter jurisdiction [23:48.340 --> 23:50.500] But they didn't just dismiss it [23:50.500 --> 23:55.220] They dismissed it on an issue we did not bring [23:57.060 --> 24:00.100] We claim that ordinances as applied to [24:00.980 --> 24:02.980] an individual [24:03.300 --> 24:07.460] Rendered them laws and was unconstitutional. They dismissed it [24:08.340 --> 24:11.700] claiming that the municipality didn't have the [24:12.340 --> 24:14.340] authority to hold the hearing [24:15.220 --> 24:18.260] That adjudicated the the claim against [24:18.260 --> 24:20.260] the defendant [24:21.060 --> 24:23.700] And I look at that and say what in the heck is this? [24:25.380 --> 24:28.500] We didn't know what they were talking about. I had to go dig in the code [24:29.380 --> 24:31.380] To figure out what they were talking about [24:31.940 --> 24:35.780] They came up with their own reason to dismiss the case [24:36.420 --> 24:38.420] They didn't dismiss it [24:38.420 --> 24:44.420] Based on the claim we brought because if they had the city could have appealed that [24:44.420 --> 24:49.700] And the court of criminal appeals might have ruled that what we said was true [24:50.340 --> 24:52.340] So they come up with some other issue [24:53.060 --> 24:58.740] To dismiss our case on to render our claim moot. community in the dfw [46:00.920 --> 46:10.200] metaplex and he complained that the uh the what is it the [46:11.960 --> 46:20.840] use of conduct commission only came after municipal courts municipal judges because [46:20.840 --> 46:27.160] municipal judges who aren't elected they are appointed and they don't have to be lawyers [46:27.160 --> 46:34.600] they're considered an inferior court that the commission never goes after elected judges they [46:34.600 --> 46:41.960] only go after these low level municipal judges and justices of the peace who are not actually lawyers [46:43.720 --> 46:51.560] and he's right for the most part they do they use these lower court judges as cannon fodder [46:51.560 --> 46:56.520] to make it look like they're actually doing something while they're actually shielding all [46:56.520 --> 47:04.360] of the county and district judges in prosecution so all these guys are terrified of the state [47:04.360 --> 47:10.760] commission on judicial conduct had how many judicial conduct complaints have you filed against [47:12.040 --> 47:25.960] the municipal judge none yet what what you should take your phone and beat yourself around the eyes [47:25.960 --> 47:35.480] and ears you are missing the most fun yes i understand that but i'm not hoping this would [47:35.480 --> 47:46.040] go away good luck with that oh it's really nice to have illusions a lot of people hope that and you [47:46.040 --> 47:52.920] know it's nice to hope that and then you find out that it's pretty much the same way every time they [47:52.920 --> 47:58.520] don't just really go away even if they leave you alone for a while they eventually at some point [47:58.520 --> 48:04.040] want to go and close up some cases and they just start bothering people again so if you 48:26.200] of way they want to deal with it is not to bother you again or try to get you to come in there they [48:26.200 --> 48:31.560] actually want you to go away so then that's when they feel like dismissing on their own or they [48:31.560 --> 48:37.000] feel like coming up with some really silly reason why oh they couldn't have handled that case anyway [48:37.000 --> 48:49.400] or or something right i i understand that but i'm just about too sick to fight them oh that's a [48:49.400 --> 48:58.600] separate issue huh wait this is this is therapy i'm very hard does good lack of medicine yeah sentenced me to a year in jail and $10,000 fine [50:42.920 --> 50:52.040] maximum they could possibly find against me when the prosecutor accused me of operating a [50:54.680 --> 50:59.080] investigating business without a private investigating business without a license [50:59.080 --> 51:05.160] because i called myself an investigative journalist the judge who prosecuted me [51:05.800 when i filed 35 criminal complaints [51:23.240 --> 51:32.600] against him with the court of appeals two days i was out of there yeah my bad i should have filed [51:32.600 --> 51:41.800] criminal charges the first day i should have been down their throats from day one you guys want to [51:41.800 --> 51:51.320] fight i will give you one and now just go ahead try to start a fight with me rest me texas i went to judge whitaker and we had we were down in south texas [01:15:18.360 --> 01:15:30.120] last week trying to locate and retrieve a stolen airplane right we think we found it it's a really [01:15:30.120 --> 01:15:36.920] cool story but it's kind of long so we'll go into it here but i'll go to another another time uh we [01:15:36.920 --> 01:15:44.040] found the airplane we found who had it and we picked the police on them and we did a lot of stuff [01:15:44.040 --> 01:15:50.520] to get a lot of politics going and then on the way back we stopped at victoria texas [01:15:51.400 --> 01:15:59.960] and the plane had been reported stolen there several years ago uh and the sheriff did nothing [01:16:00.840 --> 01:16:10.120] so we went to the justice of the peace with whom we had history and i took him a set of [01:16:10.120 --> 01:16:15.880] criminal complaints against these guys that stole the other plane and went up into his office and [01:16:15.880 --> 01:16:22.280] they've all got glass now and they're all behind this bulletproof glass and all protected and separated [01:16:22.280 --> 01:16:32.680] from the public and i told the clerks that i needed to talk to the jp because i had some [01:16:32.680 --> 01:16:39.560] criminal accusations and i needed him to issue some warrants so the jp came out and i handed him [01:16:39.560 --> 01:16:45.480] some criminal complaints against these two guys that had stolen the airplane and he looked at him [01:16:45.480 --> 01:16:53.560] and he he said are you an attorney oh no no no no i sleep well at night and keep my hands [01:16:53.560 --> 01:17:02.840] in my own pockets thank you very much and that was intended to kind of put him off his game [01:17:02.840 --> 01:17:11.480] intended to give him the idea that i was just some two-bit chump coming in here and he said well [01:17:11.480 --> 01:17:16.120] since you're not an attorney i'm not not going to accept these you need to talk to an attorney [01:17:17.080 violation 3903 penal code uh i'll swear out to come point i'll wait so i'm gonna staff here did [01:17:45.640 --> 01:17:50.200] you put it on speaker are they only here in one side of this i made it now they could only hear [01:17:50.200 --> 01:17:57.640] one side but i made sure they could hear me so then i went went and sat down i was writing out [01:17:57.640 --> 01:18:06.680] a criminal complaint and the judge came back out and he said mr kelton did you contact an attorney [01:18:08.200 --> 01:18:16.520] and i said hold on judge uh we can't be having any conversation i've called the sheriff department [01:18:16.520 --> 01:18:21.320] and they'll be sending their deputy out i'll make a full statement to the deputy but since [01:18:21.320 --> 01:18:26.520] i'll be filing criminal charges against you it would be inappropriate for us to have any further [01:18:26.520 --> 01:18:36.280] communication and you'd have thought i hit him with a baseball bat he just kind of his jaw dropped [01:18:36.280 --> 01:18:42.440] to me had his hands on the counters like he kind of wavered for a second and then caught himself [01:18:42.440 --> 01:18:48.200] and i'd i would look down and went back to writing like he wasn't there and then in my peripheral [01:18:48.200 --> 01:18:59.000] vision i saw him go back in the back and i was thinking bubba you should not play poker that he [01:18:59.000 --> 01:19:13.800] came back out tried to uh engage me in a conversation bad move because now i did i did not grin in his [01:19:13.800 --> 01:19:22.360] face and i did not chuckle out loud but that's because i am a professional and i have those [01:19:22.360 --> 01:19:31.240] things under control but i did kind of grin at the clerks after he left they all looked over at [01:19:31.240 --> 01:19:39.400] me and i grinned at him and i held up both hands and my palms up like oh well what the heck as they [01:19:39.400 --> 01:19:46.360] looked at each other like what in the heck is going on and i'm sitting here writing out this [01:19:46.360 --> 01:19:56.840] complaint and this deputy comes in asked me if i'll step outside i said why sure and then you [01:19:56.840 --> 01:20:01.080] know the deputies are going to want to protect the judge because they're terrified of these judges [01:20:01.080 --> 01:20:09.400] the deputy asked me you know what occurred and i told him that i gave verified criminal [01:20:09.400 --> 01:20:19.160] affidavits to the magistrate and he refused to issue an order as commanded by 15.09 code of [01:20:19.160 --> 01:20:27.960] criminal procedure and the deputy said well i don't know what that is and i said your problem [01:20:27.960 --> 01:20:36.680] not my problem my problem is is that the law commands him to issue a warrant and he fails to [01:20:36.680 --> 01:20:42.680] do so and by so doing he failed to perform a duty he is required to perform and in the process [01:20:42.680 --> 01:20:49.400] denied me the full and free access to enjoyment right and violation of Texas penal code section [01:20:49.400 --> 01:20:54.280] 39.03 which is a class A misdemeanor state of Texas and i need you to arrest him [01:20:54.280 --> 01:21:03.080] well i'm not going to arrest the judge i didn't figure you would i get that a lot but you can't [01:21:03.080 --> 01:21:10.440] take my criminal complaint against him and he was being kind of difficult at first and i am [01:21:10.440 --> 01:21:15.800] pushing him quoting him quoting code to him you know he said you know when he said what did he do [01:21:15.800 --> 01:21:20.440] i said he he vowed he failed to perform a duty he is required to perform it in the process denied [01:21:20.440 --> 01:21:26.920] me the full and free access to her enjoyment right and violation of 39.03 penal code so and [01:21:26.920 --> 01:21:33.800] well what did he do to violate that code he failed to perform a duty he was required to perform under [01:21:33.800 --> need you to give me a voluntary statement he said well uh right i need to know what happened [01:22:05.160 --> 01:22:11.800] i said the judge refused to take a criminal complaint well he said well what's wrong with [01:22:11.800 --> 01:22:18.840] that i said well uh i made a verified criminal complaint against i made a complaint to the judge [01:22:18.840 --> 01:22:27.240] alleging a crime by public officials alleging crime by by certain individuals and the judge [01:22:28.440 --> 01:22:37.240] failed to issue a warrant under 15.09 and he said well uh i said are you going to get me my [01:22:37.240 --> 01:22:44.680] uh uh voluntary statement he said well i need to to make sure that a crime has been committed [01:22:44.680 --> 01:22:54.440] i said no you don't oh boy he just stopped there i gave i will give you a verified criminal [01:22:54.440 --> 01:23:04.840] complaint alleging crime you have no jurisdiction or authority to challenge my assertion you have [01:23:04.840 --> 01:23:12.280] a you're a magistrate are you a magistrate yeah you have a duty perform it and i was trying not [01:23:12.280 --> 01:23:24.440] to give him legal advice so what he's not getting is the responses that he expects to get he's [01:23:24.440 --> 01:23:30.840] expecting me to justify myself he's expecting me to argue my position with him and i didn't [01:23:30.840 --> 01:23:38.520] i instructed him and he did not like being instructed that was the idea but that was a [01:23:38.520 --> 01:23:49.320] little back and forth and he finally got the idea he clearly realized this is and i
