[00:00.000 --> 00:06.800] The following news flash is brought to you by The Lowest Star Lowdown. [00:06.800 --> 00:13.200] Markets for Monday the 22nd of July 2019 open with precious metals, gold at $1,429 an ounce, [00:13.200 --> 00:21.400] silver $16.45 an ounce, copper $2.75 an ounce, oil Texas crude $55.63 a barrel, brand crude [00:21.400 --> 00:29.720] $62.47 a barrel, and cryptos in order of market cap, bitcoin core $10,566.52, Ethereum [00:29.720 --> 00:41.320] $227.26, XRP Ripple $0.33, Litecoin $100.31, and Bitcoin Cash is at $324.10 a crypto coin. [00:41.320 --> 00:52.320] Today in history, the year 1916, the preparedness day bombing, a time suitcase bomb, was detonated [00:52.320 --> 00:57.760] on Market Street in San Francisco during the World War I Preparedness Day Parade, killing [00:57.760 --> 01:04.760] 10 and injuring 40. [01:04.760 --> 01:09.440] And recent news, since Governor Greg Abbott signed House Bill 1325 legalizing hemp into [01:09.440 --> 01:14.240] Texas law back in June, county prosecutors around the state including Houston, Austin, [01:14.240 --> 01:18.840] San Antonio have been dropping marijuana possession charges and even refusing to file new ones [01:18.840 --> 01:22.800] since they are stipulating that they do not have the time or the laboratory equipment to [01:22.800 --> 01:27.800] test the herb for THC. Margaret Moore, the Travis County District Attorney announced earlier [01:27.800 --> 01:32.520] this month that she was dismissing 32 felony possession and delivery of marijuana cases [01:32.520 --> 01:33.720] because of the law. [01:33.720 --> 01:37.600] Mr. Abbott and other state officials, including the Attorney General stipulated in a letter [01:37.600 --> 01:42.120] to county district attorneys back on Thursday that marijuana has not been decriminalized [01:42.120 --> 01:48.240] in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, as [01:48.240 --> 01:54.480] well as other cities too, like the District Attorney in El Paso, Cayma Esparza, a Democrat [01:54.480 --> 01:58.960] who also stated earlier this month that the law, quote, will not have an effect on the [01:58.960 --> 02:01.760] prosecution of marijuana cases in El Paso. [02:01.760 --> 02:06.760] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender [02:06.760 --> 02:10.760] in Harris County who stated that, quote, the law is constantly changing on what makes [02:10.760 --> 02:13.480] something illegal based on its chemical makeup. [02:13.480 --> 02:17.360] It's important that if someone is charged with something, the test matches what they're [02:17.360 --> 02:22.600] charged with. [02:22.600 --> 02:27.240] A paper by Tulane University identified a five and a half inch American pocket shark [02:27.240 --> 02:32.360] as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket [02:32.360 --> 02:38.000] shark ever captured or recorded with the other one being found way back in 1979 in the East [02:38.000 --> 02:39.500] Pacific Ocean. [02:39.500 --> 02:43.800] According to the university paper, the shark secretes a luminous fluid from a gland near [02:43.800 --> 02:50.080] its front fins for the purpose it is hypothesized to lure and prey who may be drawn into the [02:50.080 --> 03:16.080] glow. [03:16.080 --> 03:23.080] A paper by Tulane University identified a five and a half inch American pocket shark as [03:23.080 --> 03:32.080] the first of its kind in the Gulf of Mexico, the specimen being only the second pocket shark [03:32.080 --> 03:39.080] ever captured or recorded with the other one being found way back in 1979 in the Gulf of [03:39.080 --> 04:04.080] Mexico, the specimen being only the first of its kind in the Gulf of Mexico, the specimen [04:04.080 --> 04:10.240] Okay, howdy, howdy, Randy Kelton, Brett Soutton, Rue LaValle Radio on this Friday, the 22nd [04:10.240 --> 04:20.440] day of October 2021, and Brett assures me that today really is Friday. [04:20.440 --> 04:23.640] I thought yesterday was Friday. [04:23.640 --> 04:24.640] That's all right. [04:24.640 --> 04:25.640] What do you expect? [04:25.640 --> 04:27.640] Probably never a problem, right? [04:27.640 --> 04:29.640] Never a problem. [04:29.640 --> 04:40.600] Okay, so I got a text that someone wanted me to talk about what happens when the prosecuting [04:40.600 --> 04:48.640] attorney after you have filed a complaint with the grand jury and the prosecuting attorney [04:48.640 --> 04:51.200] doesn't give it to the grand jury. [04:51.200 --> 04:55.360] Well, it opens all sorts of doors. [04:55.360 --> 04:56.360] Go ahead. [04:56.360 --> 04:57.360] Did that ever really happen? [04:57.360 --> 05:01.560] I don't think a prosecuting, I mean, if they don't do it, that probably means they weren't [05:01.560 --> 05:03.080] supposed to, right? [05:03.080 --> 05:08.880] They wouldn't deviate from the law, would they? [05:08.880 --> 05:12.720] Was that a rhetorical question? [05:12.720 --> 05:17.080] Sometimes I'm dealing with people that they think that just because things are a certain [05:17.080 --> 05:23.560] way, and they say, well, I thought that they must be doing it right, and that must be just [05:23.560 --> 05:26.960] that's the way it's supposed to be. [05:26.960 --> 05:44.080] That's a common problem and issue that I probably need to craft a really good metaphor to interrupt. [05:44.080 --> 05:49.720] Anybody here that studies neurologistic programming, they don't understand what I'm talking about. [05:49.720 --> 06:01.120] We do get that a lot, that people take on issues that assume that what the officials [06:01.120 --> 06:03.120] do they're allowed to do. [06:03.120 --> 06:09.400] It doesn't automatically come to mind that, say, well, they did this this way, so that [06:09.400 --> 06:10.400] must be right. [06:10.400 --> 06:11.400] What did I miss? [06:11.400 --> 06:18.840] I said, wait, wait, wait, wait, wait, let's not assume anybody did anything right. [06:18.840 --> 06:25.640] Because it's been my experience, and I'm certain it's been Brett's experience, that [06:25.640 --> 06:32.240] the public officials almost never do it right. [06:32.240 --> 06:40.680] So we need to step back and realize that we're looking through a glass darkly when we look [06:40.680 --> 06:41.680] at the code. [06:41.680 --> 06:45.840] We look at the code, and we think that's the way it is. [06:45.840 --> 06:49.120] No, no, no, that's not how it is. [06:49.120 --> 06:58.120] That's how it ought to be, and in a perfect world, that's how it probably would be, so [06:58.120 --> 07:05.560] that the problem with that is, if this was a perfect world, I'm pretty sure I wouldn't [07:05.560 --> 07:10.080] be here, and I'm not so sure about you. [07:10.080 --> 07:19.640] No, I beg you, I beg you, we have to consider that even the most knowledgeable and professional [07:19.640 --> 07:31.160] among us, bar card carrying attorneys could make a mistake, or could do something wrong [07:31.160 --> 07:32.160] on purpose. [07:32.160 --> 07:33.160] No. [07:33.160 --> 07:37.440] And we all know what the acronym assume actually means. [07:37.440 --> 07:44.200] And sometimes it's, okay, it's hard to look behind the curtain. [07:44.200 --> 07:51.440] I was, I'm preparing for a presentation I'm going to do tomorrow at Circle Grill in Dallas [07:51.440 --> 08:01.280] on, is that a nice segue into a little shameless self-promotion, the 3701 Buckner Boulevard, [08:01.280 --> 08:11.000] 3 o'clock, if you're in the Dallas area, be there, or B-square, I was working on my presentation. [08:11.000 --> 08:16.840] I'm trying to increase the sophistication. [08:16.840 --> 08:22.800] And I was just speaking to the very issues you're talking about, but I forgot what it [08:22.800 --> 08:23.800] was, Brad. [08:23.800 --> 08:24.800] What was I talking about? [08:24.800 --> 08:25.800] Oh yeah. [08:25.800 --> 08:32.320] When a DA does not turn in the paperwork as he wants. [08:32.320 --> 08:39.440] Unstated presuppositions, that's where I was really meeting to. [08:39.440 --> 08:47.280] The hardest thing for all of us to do is to step outside our internally held, unstated [08:47.280 --> 08:50.360] presuppositions. [08:50.360 --> 08:58.480] We hold this presupposition that the law governs. [08:58.480 --> 09:04.600] We're taught in school that we live in a land of law, and the law applies, and the law will [09:04.600 --> 09:05.600] protect us. [09:05.600 --> 09:10.000] Well, that's a bunch of hockey. [09:10.000 --> 09:17.160] The law is out there, and we do have the best body of law, Corpus Juris, of any state that [09:17.160 --> 09:21.360] I've ever looked at. [09:21.360 --> 09:24.520] The only one that's closest to us is California. [09:24.520 --> 09:33.160] I look at the mess California's in, but their body of law has just about every remedy you [09:33.160 --> 09:34.160] need. [09:34.160 --> 09:41.840] Texas has remedies California doesn't have, so what's the problem? [09:41.840 --> 09:46.360] The problem is that the law is not self-actuating. [09:46.360 --> 09:50.600] It's supposed to be, but it's not. [09:50.600 --> 09:55.640] If you want your rights, you must claim them. [09:55.640 --> 10:03.200] Johnson v. State, rights belong to the belligerent litigant. [10:03.200 --> 10:07.240] We have to activate the law. [10:07.240 --> 10:16.200] We can't sit back and assume that law will activate itself, that public officials will [10:16.200 --> 10:19.920] do what the law says. [10:19.920 --> 10:24.640] I do like to say that for the most part, public officials are not bad guys. [10:24.640 --> 10:29.160] For the most part, public officials are just ordinary people. [10:29.160 --> 10:33.840] Doing the best they can in the circumstance that they're in, they get into these jobs [10:33.840 --> 10:37.760] and they're taught how to do things, and they do things the way they're taught, and [10:37.760 --> 10:44.320] they act from this unstated presupposition, that if they are taught to do things this [10:44.320 --> 10:52.280] way, then it must be right, and if I say, well, it's not right, then their presumption [10:52.280 --> 10:55.240] is you must have missed something. [10:55.240 --> 11:04.040] Mark Autry, 20-year Sheriff's Deputy, 12-year Justice of the Peace, I sat down and laid [11:04.040 --> 11:11.000] the law out in front of him, and he said, Mr. Kelton, are you telling me that everything [11:11.000 --> 11:19.560] I did as a policeman for 20 years and as a Justice of the Peace for 12 years was wrong, [11:19.560 --> 11:25.840] everything everybody in Texas is doing is wrong, and you're right. [11:25.840 --> 11:33.120] Don't ask me, Mark, I didn't write the code, I just read it, there it is, right in front [11:33.120 --> 11:41.200] of you, and unstated presuppositions create what we call cognitive dissonance. [11:41.200 --> 11:51.640] He can't imagine that he and everyone else has been doing things wrong for 30 years. [11:51.640 --> 11:57.040] You get up in the morning, you go to work, 90% of what you do, you do based on unstated [11:57.040 --> 11:58.120] presuppositions. [11:58.120 --> 12:05.680] Maybe 10% are stated presuppositions, but most of them are things that we have learned [12:05.680 --> 12:16.480] in the past and placed them into our memory so that our inner mind can access these behavioral [12:16.480 --> 12:22.160] responses without engaging the conscious awareness. [12:22.160 --> 12:27.960] If the conscious awareness had to address every single thing we do, we wouldn't be able [12:27.960 --> 12:30.480] to function elegantly. [12:30.480 --> 12:34.280] And for the most part, that is a very good characteristic. [12:34.280 --> 12:39.320] That's what gives us our ability to be sophisticated. [12:39.320 --> 12:45.280] But with every advantage comes a disadvantage. [12:45.280 --> 12:52.120] When something we learned a long time ago was relevant and accurate then, but things [12:52.120 --> 12:59.880] in circumstances have changed, or we've learned to apply what we learned to a circumstance [12:59.880 --> 13:06.080] that's not appropriate, or it was just wrong when we learned it. [13:06.080 --> 13:10.600] But it occurs for the most part out of conscious awareness. [13:10.600 --> 13:17.480] Mark does what he does, or did what he did, automatically, you do the same thing over [13:17.480 --> 13:21.440] and over and over, and we come to him and tell him it's wrong. [13:21.440 --> 13:24.560] Well, who the heck are you, Bubba? [13:24.560 --> 13:32.080] Yeah, and just the fact that he asks you that question, he's really not expecting a response [13:32.080 --> 13:35.720] that is a yes or no response. [13:35.720 --> 13:41.320] He's only expecting that situation that he paints that picture for you. [13:41.320 --> 13:46.000] He's expecting that to intimidate you into acknowledging that he's right. [13:46.000 --> 13:47.000] Exactly. [13:47.000 --> 13:50.880] It's not going to possibly be wrong. [13:50.880 --> 13:56.080] If you bounce the ball and it comes up where you can catch it, 10,000 times and it comes [13:56.080 --> 14:00.600] up where you can catch it, and somebody comes along and tells you you're not bouncing the [14:00.600 --> 14:08.480] ball right, that's what we're dealing with here. [14:08.480 --> 14:19.320] And Brad and I, we spend our time trying to find a way to interrupt these automatic internal [14:19.320 --> 14:28.720] unstated presuppositions and then replace them with more effective or current behaviors. [14:28.720 --> 14:33.040] Is everybody completely confused now? [14:33.040 --> 14:44.760] Okay, I had a question on the Telegram group asking me, what do you do if a prosecutor, [14:44.760 --> 14:51.000] when you file a criminal complaint, doesn't act on the criminal complaint? [14:51.000 --> 14:56.000] Brad, are you hearing that beeping? [14:56.000 --> 14:58.080] I don't hear any beeps. [14:58.080 --> 14:59.560] Maybe it's just in my head. [14:59.560 --> 15:05.000] I think it may be my Telegram group itself, and let me close it. [15:05.000 --> 15:08.360] Oh man, I'm getting some terrible beeping. [15:08.360 --> 15:09.360] It's distracting. [15:09.360 --> 15:12.240] I'll try to fix it on the break. [15:12.240 --> 15:20.240] But what do you do if a prosecutor doesn't do what he's supposed to? [15:20.240 --> 15:29.360] Randy, now I'm not hearing you at all. [15:29.360 --> 15:33.560] Did you unplug your beeping program and in my seminars? [15:33.560 --> 15:44.280] You say that everything's political, that you can never expect to win your case simply [15:44.280 --> 15:48.680] because you have the law and the facts on your side. [15:48.680 --> 15:55.480] Brad, I've got something really going on in my background and I can't seem to get it shut [15:55.480 --> 15:56.480] off. [15:56.480 --> 15:58.840] Okay, I think I've turned something off. [15:58.840 --> 16:02.680] You can hold out one minute until we get to our sponsors and then you can unplug everything. [16:02.680 --> 16:09.360] Well, I'm really short on mental space as you get older that window narrows. [16:09.360 --> 16:12.440] But anyway, it opens a lot of doors. [16:12.440 --> 16:18.680] Once you realize everything is political, then you look around for where the politics [16:18.680 --> 16:19.680] is. [16:19.680 --> 16:24.120] Brad, take us out. [16:24.120 --> 16:25.120] This is driving me crazy. [16:25.120 --> 16:26.120] I can feel it. [16:26.120 --> 16:27.120] All right. [16:27.120 --> 16:28.120] This is coming from... [16:28.120 --> 16:36.640] Well, where I think Randy is going with this is to show what we can do when they don't [16:36.640 --> 16:39.080] do their job. [16:39.080 --> 16:41.200] I had a similar situation. [16:41.200 --> 16:47.720] One of the prosecutors asked me one time, she was so frustrated in front of the judge. [16:47.720 --> 16:48.720] She looked over at me. [16:48.720 --> 16:50.120] You're not supposed to talk to the other party. [16:50.120 --> 16:53.080] She looked over at me and she asked me a similar question. [16:53.080 --> 16:57.400] Is everybody in Texas doing it wrong and you're right? [16:57.400 --> 17:00.440] We'll talk about it more on the other side. [17:00.440 --> 17:05.760] Are you being harassed by debt collectors with phone calls, letters, or even lawsuits? [17:59.720 --> 18:04.720] Rule of Law Radio is proud to offer the Rule of Law Traffic Seminar. [18:04.720 --> 18:08.400] In today's America, we live in an us against them society and if we, the people, are ever [18:08.400 --> 18:12.720] going to have a free society, then we're going to have to stand and defend our own rights. [18:12.720 --> 18:15.560] Among those rights are the right to travel freely from place to place, the right to [18:15.560 --> 18:19.040] act in our own private capacity, and most importantly, the right to due process of [18:19.040 --> 18:20.040] law. [18:20.040 --> 18:23.680] Traffic courts afford us the least expensive opportunity to learn how to enforce and preserve [18:23.680 --> 18:25.480] our rights through due process. [21:16.840 --> 21:20.600] Randy Kelton, Brett Shalton, Rule of Law Radio, I think I got that fixed. [21:20.600 --> 21:24.800] That beepin' was driving me sane. [21:24.800 --> 21:26.840] I can't have that. [21:26.840 --> 21:27.840] That would be horrible. [21:27.840 --> 21:28.840] Okay. [21:28.840 --> 21:33.120] I could put up with all these public officials in that kind of a state. [21:33.120 --> 21:35.600] Anyway, okay. [21:35.600 --> 21:39.240] So we have this cognitive dissonance. [21:39.240 --> 21:42.160] So how do we get past it? [21:42.160 --> 21:49.720] If anybody's on our telegram side, I've posted on the telegram side the documents, the criminal [21:49.720 --> 21:55.800] complaints I filed with the grand jury, through the district attorney. [21:55.800 --> 22:07.200] And in there I have a brief on how a prosecuting attorney has no power under Constitution or [22:07.200 --> 22:11.400] state law to dismiss a prosecution. [22:11.400 --> 22:17.800] We had Scott on yesterday, oh, let me turn, I'm turning the phone lines on. [22:17.800 --> 22:29.200] Okay, if you have a question or comment, give us a call, phone lines are on 512-646-1984. [22:29.200 --> 22:36.600] We'll be taking your calls all night as soon as I get through with this breaching. [22:36.600 --> 22:45.560] Okay, so I filed a criminal complaint not with the prosecuting attorney, but with the [22:45.560 --> 22:53.360] foreman of the grand jury and put it in an envelope and put foreman of grand jury and [22:53.360 --> 23:00.600] gave it to the prosecutor's investigator with instructions for her not to open it. [23:00.600 --> 23:05.320] And to tell her boss, do not open it, it's a trap. [23:05.320 --> 23:10.720] So I'm sure the first thing he did is ripped the court off the envelope to strip it open [23:10.720 --> 23:12.800] and jerk that out of there and looked at it. [23:12.800 --> 23:18.960] And on the top was a letter to the grand jury foreman asking him to email me to let me know [23:18.960 --> 23:26.920] he actually received this and let me know if Cecile was broken on the envelope. [23:26.920 --> 23:31.960] So what do you think the likelihood the prosecutor is going to show that to the grand jury foreman? [23:31.960 --> 23:36.800] I think you just reduced what was already slim to a zero. [23:36.800 --> 23:37.800] Exactly. [23:37.800 --> 23:40.960] So I didn't get that email. [23:40.960 --> 23:42.840] I didn't get that email. [23:42.840 --> 23:48.440] That gives me reasonable probable cause to believe that the prosecutor didn't give that [23:48.440 --> 23:50.400] to the foreman of the grand jury. [23:50.400 --> 23:52.480] So what are my options? [23:52.480 --> 23:56.320] One is the Texas Rangers. [23:56.320 --> 24:02.800] Now I know that the Texas Rangers are in the pocket of the prosecutor. [24:02.800 --> 24:15.040] The Ron Earl got the legislature to give him funding for a public integrity unit. [24:15.040 --> 24:23.000] And I raised a complaint about that claiming that a prosecuting attorney had no business [24:23.000 --> 24:27.640] doing anything with claims against public officials. [24:27.640 --> 24:30.360] Article 2.03 ordered him not to. [24:30.360 --> 24:35.440] He used to give any complaint he gets against a public official. [24:35.440 --> 24:40.200] He is to give to the foreman of the grand jury under 2.03. [24:40.200 --> 24:44.320] He has no discretion, but they ignore that. [24:44.320 --> 24:47.040] They pretend like it isn't even there. [24:47.040 --> 24:51.760] And a good portion of them don't even know it's there. [24:51.760 --> 25:00.240] Now, I have reason to believe and do believe that he secreted those complaints from the [25:00.240 --> 25:06.360] grand jury in violation of Article 2.03, Texas Code of Criminal Procedure, and that [25:06.360 --> 25:14.840] he obstructed justice by secreting criminal complaints against himself from the grand jury. [25:14.840 --> 25:21.160] At the very least, he should have appointed a special prosecutor, but I have no evidence [25:21.160 --> 25:24.000] that he did that either. [25:24.000 --> 25:27.680] So I have reason to believe and do believe that he committed these crimes, and there's [25:27.680 --> 25:31.400] three or four more I'll get in there as well. [25:31.400 --> 25:32.400] So who do I give it to? [25:32.400 --> 25:38.600] I can give it to the Texas Rangers, but they're just low-level chumps. [25:38.600 --> 25:45.880] If I file with the intent of it going to the Rangers, I'll file it with the colonel, I forget [25:45.880 --> 25:52.280] what his name is, the XX FBI agent, who is the head of the Department of Public Safety [25:52.280 --> 25:58.600] because Texas Rangers fall under Department of Public Safety, and direct him to send it [25:58.600 --> 26:06.000] to his Texas Rangers to investigate my allegations against the district attorney. [26:06.000 --> 26:15.000] Now that's a problem for them, because when the Texas Rangers, I'm sorry, when the legislature [26:15.000 --> 26:22.280] removed the public integrity unit funding from the prosecuting attorney's office, they [26:22.280 --> 26:27.000] gave that job to the Texas Rangers. [26:27.000 --> 26:34.360] Now Texas Rangers aren't forbidden by Article 2.03 the way the prosecutor is, and directed [26:34.360 --> 26:39.120] the Department of Public Safety to develop a set of protocols. [26:39.120 --> 26:46.200] For this, a Texas Ranger could not take a complaint against a public official or investigate [26:46.200 --> 26:52.840] a complaint against a public official without permission from the district attorney. [26:52.840 --> 26:54.920] So they set up their own protocol. [26:54.920 --> 27:01.000] First protocol, before they could investigate a criminal complaint against a public official, [27:01.000 --> 27:03.800] they had to get permission from the district attorney. [27:03.800 --> 27:10.680] Well, as you might guess, I had a problem with that, so how do we handle that problem? [27:10.680 --> 27:13.800] Well, file against the district attorney. [27:13.800 --> 27:16.320] See, try that out, Bubba. [27:16.320 --> 27:22.800] Go ahead, go down and ask that district attorney for permission to investigate himself. [27:22.800 --> 27:25.520] We'll see how that works out for you. [27:25.520 --> 27:29.360] So that's one avenue we could take. [27:29.360 --> 27:36.440] Another avenue we could take is to file with the attorney general. [27:36.440 --> 27:46.160] He is logically and politically the next guy in line, but by constitution he's not. [27:46.160 --> 27:54.160] By constitution, only elected county attorneys and elected district attorneys can prosecute [27:54.160 --> 27:57.240] crime in the state of Texas. [27:57.240 --> 28:05.160] They recently passed a law that gave the attorney general concurrent jurisdiction with the district [28:05.160 --> 28:09.240] attorney in the matter of a complaint against a public official. [28:09.240 --> 28:14.680] Well, that sounded good, but that's unconstitutional. [28:14.680 --> 28:23.240] The constitution did not allow an attorney general prosecutorial power except for one [28:23.240 --> 28:28.640] case, and that case was actually statutory as well. [28:28.640 --> 28:39.240] The only time a attorney general had prosecutorial power was in a complaint against a district [28:39.240 --> 28:45.040] attorney for a violation of the Open Records Act, but there's no constitutional authority [28:45.040 --> 28:46.040] for that either. [28:46.040 --> 28:54.920] A few years ago, they upgraded 3903 official oppression to include the attorney general [28:54.920 --> 28:59.520] giving him concurrent jurisdiction with the district attorney. [28:59.520 --> 29:04.000] Well, that's in the law, but it's unconstitutional. [29:04.000 --> 29:09.840] But as long as it's on the books, why not stick it to the attorney general? [29:09.840 --> 29:11.800] That's a political filing. [29:11.800 --> 29:21.200] The attorney general happens to be a Republican, and the district attorney happens to be a Democrat. [29:21.200 --> 29:29.720] So we'll give the attorney general opportunity to work over the district attorney. [29:29.720 --> 29:32.480] So all politics. [29:32.480 --> 29:39.280] We could also send a set of complaints to the Chief Justice of Texas Supreme presiding [29:39.280 --> 29:43.000] judges a Court of Criminal Appeals. [29:43.000 --> 29:52.760] Every one of the judges of the Court of Criminal Appeals, a few district judges, put them all [29:52.760 --> 29:55.320] on the dime. [29:55.320 --> 30:02.680] So I saw that in Idaho, I just, hang on, we'll look at it on the other side. [30:02.680 --> 30:06.320] It's clear cell phones have changed the way we live and work, but have they negatively [30:06.320 --> 30:07.320] affected our health? [30:07.320 --> 30:11.360] I'm Dr. Cameron Albrecht, and I'll be back in just a moment with new findings about [30:11.360 --> 30:15.800] how cell phones may actually alter our brain chemistry. [30:15.800 --> 30:17.400] Privacy is under attack. [30:17.400 --> 30:21.000] When you give up data about yourself, you'll never get it back again. [30:21.000 --> 30:25.760] And once your privacy is gone, you'll find your freedoms will start to vanish too. [30:25.760 --> 30:30.880] So protect your rights, say no to surveillance, and keep your information to yourself. [30:30.880 --> 30:33.520] Privacy, it's worth hanging on to. [30:33.520 --> 30:37.840] This public service announcement is brought to you by StartPage.com, the private search [30:37.840 --> 30:41.360] engine alternative to Google, Yahoo, and Bing. [30:41.360 --> 30:45.120] Start over with StartPage. [30:45.120 --> 30:47.280] Cell phones emit radio frequency energy. [30:47.280 --> 30:48.280] It's a fact. [30:48.280 --> 30:51.440] But whether it's dangerous to have a phone beaming this kind of radiation near your [30:51.440 --> 30:52.680] head has been disputed. [30:52.680 --> 30:57.120] Some have blamed it for brain tumors, while cell phone companies have downplayed concerns. [30:57.120 --> 31:01.680] Well, now the Journal of the American Medical Association is confirming that cell phones [31:01.680 --> 31:03.240] affect brain chemistry. [31:03.240 --> 31:08.320] A study of 47 volunteers showed that glucose metabolism in the area of the brain closest [31:08.320 --> 31:11.920] to the cell phone antenna increases when the cell phone is on. [31:11.920 --> 31:15.880] While researchers aren't sure whether this exposure causes damage, I'm not taking any [31:15.880 --> 31:16.880] chances. [31:16.880 --> 31:20.960] I always keep the phone far from my body, and I use a corded headset. [31:20.960 --> 31:22.160] I'm Dr. Catherine Albrecht. [31:22.160 --> 31:30.640] More news and information at CatherineAlbrecht.com. [31:30.640 --> 31:31.640] I lost my son. [31:31.640 --> 31:32.640] My nephew. [31:32.640 --> 31:33.640] My son. [31:33.640 --> 31:38.600] On September 11th, 2000, most people don't know that a third tower fell on September [31:38.600 --> 31:39.600] 11th. [31:39.600 --> 31:43.160] World Trade Center 7, a 47-story skyscraper, was not hit by a plane. [31:43.160 --> 31:48.920] Although the official explanation is that fire brought down building 7, over 1,200 architects [31:48.920 --> 31:52.640] and engineers have looked into the evidence and believed there is more to the story. [31:52.640 --> 31:54.120] Bring justice to my son. [31:54.120 --> 31:55.120] My uncle. [31:55.120 --> 31:56.120] My nephew. [31:56.120 --> 31:57.120] My son. [31:57.120 --> 31:58.120] Go to buildingwatch.org. [31:58.120 --> 31:59.120] Why it fell? [31:59.120 --> 32:00.120] Why it matters? [32:00.120 --> 32:01.120] And what you can do. [32:01.120 --> 32:06.000] Logos Radio Network welcomes a new show to our lineup for the new year. [32:06.000 --> 32:12.280] Scripture Talk with Nana will begin Wednesday, January 8th, from 8 to 10 p.m. central time. [32:12.280 --> 32:15.360] Our goal is in accord with Matthew 5.16. [32:15.360 --> 32:20.400] Let your light so shine before men that they may see your good works and glorify your Father [32:20.400 --> 32:21.960] which is in heaven. [32:21.960 --> 32:26.800] We wish to reflect God's light and be a blessing to all those with a hearing ear. [32:26.800 --> 32:32.280] Join Nana and guests for both verse by verse Bible studies and topical Bible studies designed [32:32.280 --> 32:35.400] to provoke unto love and good works. [32:35.400 --> 32:39.800] Our verse by verse Bible studies will begin in the book of Matthew where we will discuss [32:39.800 --> 32:41.560] one chapter per week. [32:41.560 --> 32:46.640] Our topical Bible studies will vary each week and will explore sound doctrine as well as [32:46.640 --> 32:48.840] Christian character development. [32:48.840 --> 32:55.880] So mark your calendar and join us live on LogosRadioNetwork.com Wednesdays from 8 to 10 p.m. starting [32:55.880 --> 33:00.880] January 8th for an inspiring and motivating discussion of the Scriptures. [33:00.880 --> 33:16.200] You're listening to the Logos Radio Network at LogosRadioNetwork.com Yeah, I got that one [33:16.200 --> 33:33.560] out and I'm going to solve them to the end of the government and prosecute them. [33:33.560 --> 33:44.360] Okay, we are back Randy Kelton, Brett Fountain, Rue de la Radio and when we went out I just [33:44.360 --> 33:47.800] saved Brett from diving off the cliff. [33:47.800 --> 33:53.760] Yep, I was just about to launch into something there. [33:53.760 --> 34:01.920] You were talking about reading the code and the magistrates and I just noticed that recently [34:01.920 --> 34:07.160] I was looking to help somebody in Idaho and boy, I really like what I see in Idaho. [34:07.160 --> 34:09.200] It's really easy to read. [34:09.200 --> 34:14.120] Everything is right where you think you're going to find it about the criminal code and [34:14.120 --> 34:15.120] the crimes themselves. [34:15.120 --> 34:21.600] It's defined so well and so cleanly and they only use half the words that you thought you [34:21.600 --> 34:23.280] were going to have to read. [34:23.280 --> 34:26.320] It's just really well done. [34:26.320 --> 34:33.200] But they also, I noticed that they don't have as many magistrates. [34:33.200 --> 34:35.600] They start at a higher level. [34:35.600 --> 34:42.920] Most of the time I'm accustomed to seeing magistrates be spread all over the place. [34:42.920 --> 34:49.480] They're scattered everywhere, mayors and JPs and municipal court judges, not so in Idaho. [34:49.480 --> 34:52.040] It started at a higher level. [34:52.040 --> 35:01.120] In Idaho, our magistrates define in the same way as they Texas. [35:01.120 --> 35:06.560] Reason I'm asking that is in the Fed, you have magistrate judges. [35:06.560 --> 35:16.080] So they're not magistrates the way we use magistrates in Texas. [35:16.080 --> 35:19.560] How are magistrates defined in Idaho? [35:19.560 --> 35:24.760] They start out at a higher level like, I think it might be county or district, judge and [35:24.760 --> 35:25.760] up. [35:25.760 --> 35:26.760] Okay. [35:26.760 --> 35:31.560] Are they defined as those officers that do preliminary hearings? [35:31.560 --> 35:34.520] Oh, that's a good question. [35:34.520 --> 35:36.320] I'm not sure. [35:36.320 --> 35:39.280] Because in the Fed it's somewhat different. [35:39.280 --> 35:44.120] The federal judges are defined as magistrates. [35:44.120 --> 35:53.600] But each of these federal judges have magistrate judges, which are in effect clerks for the [35:53.600 --> 35:57.000] judge or assistants for the judges. [35:57.000 --> 36:03.520] The magistrates can issue recommendations, but they can't issue rulings. [36:03.520 --> 36:09.960] And so the magistrate does all the work for the federal judge, the magistrate judge does [36:09.960 --> 36:13.000] all the work for the federal judge. [36:13.000 --> 36:16.000] And then the federal judge has to sign off on it. [36:16.000 --> 36:23.840] So since this starts out higher, there may be a different definition of magistrates in [36:23.840 --> 36:24.840] Idaho. [36:24.840 --> 36:27.840] Yeah, it could be. [36:27.840 --> 36:35.920] But go ahead, you were describing how do you deal with these when they're recalcitrant, [36:35.920 --> 36:36.920] incorrigible. [36:36.920 --> 36:41.280] Yeah, now it gets into politics. [36:41.280 --> 36:43.960] You just pick who you want to file with. [36:43.960 --> 36:56.000] You can sue the prosecutor because shielding himself from prosecution, obstruction of justice, [36:56.000 --> 37:03.200] fitness, I mean the jury tampering, those are all crimes in the state of Texas. [37:03.200 --> 37:14.800] So if a public official commits a crime, that action is not within scope, so you can sue [37:14.800 --> 37:15.800] him personally. [37:15.800 --> 37:20.400] And let him show how he has immunity. [37:20.400 --> 37:23.440] They think they have absolute immunity. [37:23.440 --> 37:29.560] I told him it was a trap, he should have listened. [37:29.560 --> 37:34.040] And that's probably the best way to go at him, at least from my perspective from what [37:34.040 --> 37:35.200] I'm doing. [37:35.200 --> 37:42.920] I'm trying to soften the prosecutor up so that when I come to him with some public officials [37:42.920 --> 37:50.640] that I really want indicted, he's not going to be quite so cavalier about tossing them. [37:50.640 --> 37:54.400] It's all politics. [37:54.400 --> 38:02.440] And when Sunset Valley finds that I've filed criminal charges against their officers with [38:02.440 --> 38:08.880] the district attorney, and that I've also filed criminal charges against the district [38:08.880 --> 38:14.880] attorney for not giving complaints to the grand jury, Brett, if you were an officer [38:14.880 --> 38:21.640] on Sunset Valley, how would you feel? [38:21.640 --> 38:25.960] See who drinks it up, aren't you? [38:25.960 --> 38:29.560] Who's going to get thrown under the bus? [38:29.560 --> 38:32.920] The DA or me? [38:32.920 --> 38:34.760] Good luck, Bubba. [38:34.760 --> 38:42.920] So anytime we're going after these guys, we need to look a step or two ahead of ourselves. [38:42.920 --> 38:50.960] We need to know what the next two steps are at least before we take an action. [38:50.960 --> 38:59.800] And that way, once you know two or three steps ahead, it doesn't matter what they do because [38:59.800 --> 39:03.320] whatever they do, you've already planned for it. [39:03.320 --> 39:06.000] Okay, I hope that answers that question. [39:06.000 --> 39:11.280] We do have a board full of callers, so I'm going to go to the board. [39:11.280 --> 39:16.160] And we have Ted called in last night, so I'm going to go to Ted first. [39:16.160 --> 39:17.160] Hello, Ted. [39:17.160 --> 39:22.280] Hey, good evening, Randy and Brett. [39:22.280 --> 39:28.280] Okay, what do you have for us today? [39:28.280 --> 39:36.880] Well, I went to court on my criminal charge this Monday. [39:36.880 --> 39:44.320] And as you know, I've been battling that the judge ordered a public defender on me, and [39:44.320 --> 39:54.240] I immediately sued that public defender for trespassing and harassing me. [39:54.240 --> 40:01.120] And that went to a judge who also has a conflict with me. [40:01.120 --> 40:09.840] But any case, to get right down to it, went into court on Monday, and this time it was [40:09.840 --> 40:14.360] a new judge, a woman judge. [40:14.360 --> 40:22.720] So after the public defender ran up there and made the appearance for the case, and [40:22.720 --> 40:29.200] the judge immediately told him the case would be continued until December 13th. [40:29.200 --> 40:33.080] And keep in mind, these are trial dates that keep getting put off. [40:33.080 --> 40:38.640] As soon as that happened, the public defender started to walk away, so I stepped up for [40:38.640 --> 40:45.840] the mic, and I said, for the record, he doesn't represent me. [40:45.840 --> 40:51.920] And on and for the record, suing him civilly, he's represented by counsel, so he absolutely [40:51.920 --> 40:55.520] cannot speak for me. [40:55.520 --> 41:02.000] I left it at that, I didn't ask for the judge to discharge him or dismiss him or whatever. [41:02.000 --> 41:07.520] And I stood there a few minutes, the judge didn't do anything, the deputy brought my [41:07.520 --> 41:13.960] docket sheet over, and since it was put out until December 13th, I went ahead and walked [41:13.960 --> 41:14.960] away. [41:14.960 --> 41:24.040] I left the courtroom, started up the stairs, the public defender kind of followed me, and [41:24.040 --> 41:28.680] I just said, before this is over, you're not going to be a lawyer anymore. [41:28.680 --> 41:34.360] I'm going to file against you federally for deprivation of rights. [41:34.360 --> 41:39.840] And I headed on up to the front door of the court house, and there's a podium right at [41:39.840 --> 41:40.840] the front door. [41:40.840 --> 41:47.280] He was right beside me or behind me, and this is the public defender, and he said something [41:47.280 --> 41:56.840] which caused me to turn and tell him, a recording, a quick claim deed is not a crime, to which [41:56.840 --> 42:03.560] he said, the house isn't yours, and the house wasn't yours anymore, and it's a crime. [42:03.560 --> 42:11.320] And I said, well, there you go, but I've been to over 30 defense lawyers and told them [42:11.320 --> 42:16.920] the situation, and every one of them told me it's not a crime, but you still think it's [42:16.920 --> 42:17.920] a crime. [42:17.920 --> 42:24.760] I said, oh, that's right, you're in cahoots with the district attorney to get a conviction. [42:24.760 --> 42:26.360] I said, have a nice day. [42:26.360 --> 42:32.840] I left the building, proceeded down the sidewalk, we're now out in front of the jail, and he's [42:32.840 --> 42:34.720] still behind me. [42:34.720 --> 42:39.360] I want to make it clear, he's kind of following me, and yeah, he's probably going back to [42:39.360 --> 42:43.520] his public defender's office, but he's following me. [42:43.520 --> 42:51.080] He said something else this time, whatever he said, I responded with, I'm suing you, [42:51.080 --> 42:54.040] you're represented by a county lawyer. [42:54.040 --> 43:00.280] I'm suing the deputy prosecutor in federal court, and he's represented by the same county [43:00.280 --> 43:07.160] lawyer, so you guys are in collusion, and it's a conspiracy to convict. [43:07.160 --> 43:11.280] I got you, I've got you. [43:11.280 --> 43:17.920] And he started shaking, sweating profusely, and then kind of jumped up and down and started [43:17.920 --> 43:25.840] screaming, why don't you have another heart attack and die? [43:25.840 --> 43:29.320] Wow. [43:29.320 --> 43:32.840] You see, do you think you got to him? [43:32.840 --> 43:40.160] No, I think he was upset because he couldn't get to you. [43:40.160 --> 43:45.320] That should get assault charges. [43:45.320 --> 43:48.040] Have you filed assault, Anstin? [43:48.040 --> 43:51.800] I'm writing this up, and I hear the music coming in, but... [43:51.800 --> 43:54.320] What's harassment in this talking? [43:54.320 --> 44:00.800] Hang on, we'll be right back. [44:00.800 --> 44:06.840] Through advances in technology, our lives have greatly improved, except in the area of nutrition. [44:06.840 --> 44:11.600] People feed their pets better than they feed themselves, and it's time we changed all that. [44:11.600 --> 44:17.240] Our primary defense against aging and disease in this toxic environment is good nutrition. [44:17.240 --> 44:22.720] In a world where natural foods have been irradiated, adulterated, and mutilated, young [44:22.720 --> 44:26.080] jevity can provide the nutrients you need. [46:22.600 --> 46:51.040] Okay, we are back, Randy Kelton, Brett Stanton, Ruleoflaw Radio, and Ted, what do you think [46:51.040 --> 47:02.200] the chances are you're going to get a Christmas card from your lawyer from your pretender? [47:02.200 --> 47:06.040] I think it's pretty slim to none. [47:06.040 --> 47:14.120] When somebody, you know, Randy, this is beyond, this is somebody that's supposed to be protecting [47:14.120 --> 47:22.920] all of my constitutional rights, and let me be clear, I fired him in open court. [47:22.920 --> 47:29.080] I told him he doesn't represent me, but he claims that the judge appointed him, and therefore [47:29.080 --> 47:32.400] he has the right to trespass on our case. [47:32.400 --> 47:40.320] But for a lawyer to wish a painful death on you, that's a pretty hard question. [47:40.320 --> 47:50.520] You know what that says to me, Bubba, you should not play poker. [47:50.520 --> 47:54.720] You're a touch ass for that matter. [47:54.720 --> 47:59.040] He must be under a lot of pressure here. [47:59.040 --> 48:04.840] I suspect he was brought in as a hot shot to handle you, and he probably told him he [48:04.840 --> 48:10.960] could handle you, and it's not working for him so good. [48:10.960 --> 48:17.800] Well, Randy, I planted that seed in the very beginning when he first started showing up [48:17.800 --> 48:18.800] on my case. [48:18.800 --> 48:24.240] I told him, hey, look, bud, you're brand new to the public defender's office. [48:24.240 --> 48:31.440] You don't know the history on this, and you might want to question, you know, the people [48:31.440 --> 48:37.600] that hired you and put you on this case because you're the sucker. [48:37.600 --> 48:41.040] There's nobody in that office that will touch this. [48:41.040 --> 48:42.440] You didn't know any better. [48:42.440 --> 48:48.720] I'm giving you a chance right now to get out, and I told him that two years ago. [48:48.720 --> 48:52.680] And so the words are very important, Randy. [48:52.680 --> 49:00.240] He said, why don't you have another heart attack and die? [49:00.240 --> 49:06.680] And that has caused me to believe that he's absolutely in collusion. [49:06.680 --> 49:12.840] They probably even choked about it, that, you know, we'll just drag this guy up to [49:12.840 --> 49:18.520] trial as many times as it takes for him just to come to a final heart attack. [49:18.520 --> 49:23.920] And keep in mind I have my second heart attack in the courtroom because the judge ordered [49:23.920 --> 49:34.840] me into a ministerial hearing against the cardiologist's prescription and letter that [49:34.840 --> 49:37.080] said I was subject to sudden death. [49:37.080 --> 49:42.440] And then when I started to have another heart attack in the courtroom, the judge had taken [49:42.440 --> 49:45.840] to her chambers and she was alerted by the bailiff. [49:45.840 --> 49:50.400] She came back on the bench and continued to prosecute me, even knowing that the paramedics [49:50.400 --> 49:52.600] had been called and were on the way. [49:52.600 --> 49:57.560] I'm sitting there in the transcript, which I have a copy of begging for aspirin and [49:57.560 --> 50:01.480] they refused and gave me no aid. [50:01.480 --> 50:09.440] But yet the judge continued to harass me and ask me questions and prosecute the case while [50:09.440 --> 50:13.720] I'm in the throes of a second heart attack just five weeks after the first one. [50:13.720 --> 50:18.080] Have you filed criminal charges against the judge in the Fed? [50:18.080 --> 50:20.920] No, I have not. [50:20.920 --> 50:21.920] You need to. [50:21.920 --> 50:25.560] So Randy, we're getting so far down the road. [50:25.560 --> 50:31.920] One thing for everybody right now, the moment something starts, get your paper and pencil [50:31.920 --> 50:34.800] out and start your timeline. [50:34.800 --> 50:37.240] My timeline is so long. [50:37.240 --> 50:44.520] There are so many cases that all intertwined that I'm going to have to unravel this and [50:44.520 --> 50:47.920] finish the timeline. [50:47.920 --> 50:54.280] This is going to involve, it all started when I sued Dr. T. Peter Mnuchin, a state court [50:54.280 --> 50:55.280] judge. [50:55.280 --> 50:57.520] I sued him in federal court. [50:57.520 --> 51:02.800] That six weeks later, I've got an army at my house dragging me out of my house with [51:02.800 --> 51:05.120] machine guns in my face. [51:05.120 --> 51:09.280] Okay, that's where it all started. [51:09.280 --> 51:16.240] And by the way, between the time I filed the federal lawsuit and Judge Mnuchin would serve [51:16.240 --> 51:21.640] in the time that the army came to life, when I say army, the SWAT team, sheriff's department [51:21.640 --> 51:29.080] and the Saturday police department, two armored vehicles, big shields, as big as your refrigerator [51:29.080 --> 51:35.480] and these battering rams, and they all, a bunch of them, at least 20, you know, there [51:35.480 --> 51:40.720] were 30 some people, 30 some people there, law enforcement. [51:40.720 --> 51:45.680] I saw at least 10 of them with the machine guns, the AR-15. [51:45.680 --> 51:47.240] They're fully automatic. [51:47.240 --> 51:51.960] Okay, this is for what? [51:51.960 --> 51:52.960] Recording a quick clean deed? [51:52.960 --> 51:54.240] No, they were there to kill me. [51:54.240 --> 51:58.920] They were there to let me think that they were there to evict me from the house. [51:58.920 --> 52:01.080] I wasn't going to answer the door. [52:01.080 --> 52:05.920] They were going to smash the door down and say that I reached for a weapon and they were [52:05.920 --> 52:06.920] going to murder me. [52:06.920 --> 52:07.920] That was the plan. [52:07.920 --> 52:13.200] It was just luck that I stepped outside. [52:13.200 --> 52:20.440] So that's where it started and that's why it's so hard for me to have gotten a timeline. [52:20.440 --> 52:28.400] Also after that day, which just twisted my head, something terrible, nine months later [52:28.400 --> 52:36.120] after about 12 court hearings is when I succumbed to a heart attack and remember, I'm broke, [52:36.120 --> 52:45.160] I'm on the street homeless after being in my home for 32 years, the shock of all of that [52:45.160 --> 52:48.480] left me in a capacity that I couldn't defend myself. [52:48.480 --> 52:56.560] That's how this all began and now that was on February 11th of 2015. [52:56.560 --> 53:01.920] This has been going on for six and a half years. [53:01.920 --> 53:10.160] And back to the current day, I think as I've replayed this in my mind what happened on [53:10.160 --> 53:23.000] Monday, I believe this public defender, Goldman, I believe when I said, I know that Amir, who [53:23.000 --> 53:29.000] is the deputy DA, has had secret meetings with the judge. [53:29.000 --> 53:36.480] Somehow I think he took that as, I know you've had secret meetings with the judge and that's [53:36.480 --> 53:43.160] when he screamed at the top of his lungs, why don't you have another heart attack and [53:43.160 --> 53:44.160] die. [53:44.160 --> 53:50.600] And I really actually, even though he was saying this to me and acting that way, I was [53:50.600 --> 53:57.280] actually concerned for his mental health and I was watching him because I believe he was [53:57.280 --> 54:02.320] about to collapse onto this sidewalk. [54:02.320 --> 54:12.800] So they're caught and apparently this guy may have some kind of conscious or his credentials [54:12.800 --> 54:21.720] are that he's a seasoned defense lawyer and I think he may fully understand the ramifications [54:21.720 --> 54:28.640] of what he's involved in and that he may well go to jail. [54:28.640 --> 54:34.120] That's what I'm thinking, that's why I say he should not play poker. [54:34.120 --> 54:39.200] Clearly this is a real problem for him. [54:39.200 --> 54:44.720] If he was a experienced defense lawyer when he came in, then they may have brought him [54:44.720 --> 54:51.400] in as a hotshot to handle you and he hasn't been able to do it. [54:51.400 --> 54:58.680] And he's probably at this point on the hot seat big time and like you said, he realizes [54:58.680 --> 55:02.840] that this point is likely to come back to haunt him. [55:02.840 --> 55:03.840] What's this guy's name? [55:03.840 --> 55:04.840] This defense? [55:04.840 --> 55:05.840] This attorney? [55:05.840 --> 55:06.840] Goldberg? [55:06.840 --> 55:07.840] Goldman. [55:07.840 --> 55:08.840] Howard Goldman. [55:08.840 --> 55:20.600] We had a hearing where I was trying to excuse him and he went off with all of his credentials [55:20.600 --> 55:27.760] and background and everything and he's not just out of college, looking for his first [55:27.760 --> 55:28.760] job public though. [55:28.760 --> 55:35.320] This guy's got more than 20 years experience and his credentials are solid. [55:35.320 --> 55:42.400] What the heck is a 20 year lawyer doing as a public defender? [55:42.400 --> 55:46.120] It means one of two things. [55:46.120 --> 55:55.000] He was brought in as a hotshot but he's not the sharpest knife in the world. [55:55.000 --> 56:04.160] After 20 years, you would not expect him to be doing pro bono type cases or working in [56:04.160 --> 56:12.080] a public defender's office, he could be in a hotshot law firm as a defense lawyer. [56:12.080 --> 56:20.880] So I'm betting they brought him in to handle you and he's absolutely correct. [56:20.880 --> 56:25.760] He wasn't able to do it, now he's really on the hot seat. [56:25.760 --> 56:35.120] Well and it's unraveling, see the longer this goes on, the more mistakes they make and it's [56:35.120 --> 56:44.200] this one was like revelation, okay, this guy, he folded and it's exactly, I don't play [56:44.200 --> 56:55.840] poker because to me, I don't know if I did play poker, I guess I'd be pretty good at [56:55.840 --> 57:01.400] it but I'll tell you, yeah, I also had the information to back me up. [57:01.400 --> 57:08.720] I was holding the trump cards and for me to tell him, you know, I think he's smart enough [57:08.720 --> 57:14.800] to realize that it doesn't look good that a county lawyer was assigned to represent [57:14.800 --> 57:17.840] him and the district attorney that's prosecuting me. [57:17.840 --> 57:24.760] That shows collusion, okay and that shows, that's just bad, it's bad for him, it's bad [57:24.760 --> 57:31.720] for the deputy DA and it's bad for the lawyer in the county that's taken that. [57:31.720 --> 57:36.960] And the beauty of it is they sent out the letters, you know, probably some paralegals [57:36.960 --> 57:44.800] sent out the letter noticing me that they're representing Goldman but they may notice me [57:44.800 --> 57:50.600] that they were representing Amir Allen, the deputy DA. [57:50.600 --> 57:57.760] And I have, of course I have those letters tucked away, you need copies of them somewhere [57:57.760 --> 58:05.880] else, they're scanned and sent out, oh good, if you want to send me a set of them, I will [58:05.880 --> 58:14.920] post them inside one of my websites, okay, so I'll just load them up and give you a link [58:14.920 --> 58:19.440] to them, nobody can get to them from the outside unless they know exactly where they're at [58:19.440 --> 58:24.840] but we'll have them in a place that will be hard to get to. [58:24.840 --> 58:30.280] But I think his actions demand disciplinary action. [58:30.280 --> 58:36.480] Okay, you have him sued, what's happening with your lawsuit against him? [58:36.480 --> 58:46.840] Well, the judge dismissed the case and gave me a first leave to amend, I appealed it, [58:46.840 --> 58:50.560] okay, hang on, we'll be right back. [58:50.560 --> 58:54.680] Would you like to make more definite progress in your walk with God? [01:00:00.880 --> 01:00:06.920] To follow in these flashes brought to you by the Lone Star Lowdowns. [01:00:06.920 --> 01:00:13.320] Markets for Monday the 22nd of July 2019 open with precious metals, gold $1,429 an ounce, [01:00:13.320 --> 01:00:21.640] silver $16.45 an ounce, copper $2.75 an ounce, oil, Texas crude $55.63 a barrel, brand crude [01:00:21.640 --> 01:00:29.960] $62.47 a barrel, and cryptos in order of market cap, bitcoin, core $10,566.52, ethereum [01:00:29.960 --> 01:00:46.400] $227.26, XRP Ripple $0.33, litecoin $100.31, and bitcoin cash is at $324.10 a crypto coin. [01:00:46.400 --> 01:00:52.600] In history the year 1916 the preparedness day bombing, a time suitcase bomb was detonated [01:00:52.600 --> 01:00:57.920] on Market Street in San Francisco during the World War I preparedness day parade killing [01:00:57.920 --> 01:01:04.960] 10 and entering 40 today in history. [01:01:04.960 --> 01:01:09.960] And recent news, since Governor Greg Abbott signed House Bill 1325 legalizing Hepit attacks [01:01:09.960 --> 01:01:14.560] his law back in June, county prosecutors around the state including Houston, Austin and San [01:01:14.560 --> 01:01:19.040] Antonio have been dropping marijuana possession charges and even refusing to file new ones [01:01:19.040 --> 01:01:23.000] since they are stipulating that they do not have the time or the laboratory equipment to [01:01:23.000 --> 01:01:27.960] test the herb for THC. Margaret Moore, the Travis County District Attorney announced earlier [01:01:27.960 --> 01:01:32.680] this month that she was dismissing 32 felony possession and delivery of marijuana cases [01:01:32.680 --> 01:01:33.880] because of the law. [01:01:33.880 --> 01:01:37.760] Mr. Abbott and other state officials including the Attorney General stipulated in a letter [01:01:37.760 --> 01:01:42.280] that county district attorneys back on Thursday that marijuana has not been decriminalized [01:01:42.280 --> 01:01:48.440] in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works as [01:01:48.440 --> 01:01:54.680] well as other cities too like the District Attorney in El Paso, Cayma Esparza, a Democrat [01:01:54.680 --> 01:01:59.880] who also stated earlier this month that the law quote will not have an effect on the prosecution [01:01:59.880 --> 01:02:02.040] of marijuana cases in El Paso. [01:02:02.040 --> 01:02:06.960] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender [01:02:06.960 --> 01:02:11.400] in Harris County who stated that quote, the law is constantly changing on what makes something [01:02:11.400 --> 01:02:13.680] illegal based on its chemical makeup. [01:02:13.680 --> 01:02:17.560] It's important that if someone is charged with something, the test matches with their [01:02:17.560 --> 01:02:22.760] charge with it. [01:02:22.760 --> 01:02:27.400] A paper by Tulane University identified a five and a half inch American pocket shark [01:02:27.400 --> 01:02:32.520] as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket [01:02:32.520 --> 01:02:38.160] shark ever captured or recorded with the other one being found way back in 1979 in the East [01:02:38.160 --> 01:02:39.640] Pacific Ocean. [01:02:39.640 --> 01:02:43.960] According to the university paper, the shark secretes a luminous fluid from a gland near [01:02:43.960 --> 01:02:50.240] its front fins for the purposes hypothesized to lure and prey who may be drawn into the [01:02:50.240 --> 01:03:16.480] glow. [01:03:16.480 --> 01:03:34.480] I won't pay for the war with my body, I ain't gonna pay for the car with my money, I won't [01:03:34.480 --> 01:03:49.480] pay for the oil with my body, I won't pay for the boys with my money, I ain't gonna pay [01:03:49.480 --> 01:03:54.480] for the kids with my body, the whole agenda sounds funny. [01:03:54.480 --> 01:03:56.480] Okay, we are back. [01:03:56.480 --> 01:04:03.480] Randy Kelton, Brett Fountain, RulaVera Radio on this Friday, the 22nd day of October 2000, [01:04:03.480 --> 01:04:13.480] 2021, and we're talking to Ted in California and Ted, we gave you 10 minutes to tell you [01:04:13.480 --> 01:04:15.480] live story, what were you thinking? [01:04:15.480 --> 01:04:18.480] You only gave him 10 seconds. [01:04:18.480 --> 01:04:22.480] Oh, seconds, okay, 10 seconds. [01:04:22.480 --> 01:04:24.480] Okay, we're over. [01:04:24.480 --> 01:04:32.480] To finish what I was saying is, so I sued Goldman in state court for intentional [01:04:32.480 --> 01:04:36.480] conflict of emotional distress, trespassing, et cetera. [01:04:36.480 --> 01:04:42.480] The judge that got that is the judge that gave my house away, I recused her for cause, [01:04:42.480 --> 01:04:48.480] and I also served her a subpoena to be a witness in the criminal case. [01:04:48.480 --> 01:05:06.480] I had a lawyer, county lawyer, that turned around and denied my, I put in an American [01:05:06.480 --> 01:05:13.480] with Disabilities Act request ADA, I know you don't like acronyms, that's why I tried [01:05:13.480 --> 01:05:14.480] to say it first. [01:05:14.480 --> 01:05:21.480] Get this, there is a ADA coordinator for the court, her name's George Koo. [01:05:21.480 --> 01:05:27.480] The lawyer that had already sent me a letter saying she represents the judge and that they [01:05:27.480 --> 01:05:33.480] would consider my subpoena withdrawn, I turned around and wrote her back and said, no, you [01:05:33.480 --> 01:05:40.480] will not consider my subpoena withdrawn, and if the judge doesn't show up, I'll be seeking [01:05:40.480 --> 01:05:43.480] a warrant for her arrest. [01:05:43.480 --> 01:05:50.480] Subsequent to that, they're trying to proceed with the civil case and get it thrown out, [01:05:50.480 --> 01:05:55.480] and you can tell they're all helping each other, so the judge tries to have a hearing [01:05:55.480 --> 01:05:56.480] on it. [01:05:56.480 --> 01:06:03.480] I put a recusal for cause on the judge, and as I mentioned, I also gave her a subpoena, [01:06:03.480 --> 01:06:10.480] so she's conflicted out just from the subpoena alone, but for cause for the other reasons, [01:06:10.480 --> 01:06:17.480] and then she ruled on her own recusal for cause, because I had to get this, the first judge [01:06:17.480 --> 01:06:26.480] they put on it was Dr. T. Peter Manuchius, so I eliminated him with a 170.6, so you can [01:06:26.480 --> 01:06:34.480] only do that once, so I came back with, for cause, she ruled on her own recusal, and now [01:06:34.480 --> 01:06:41.480] this lawyer that represents her, I put in all the stuff I'm supposed to, I should have [01:06:41.480 --> 01:06:50.480] gotten the continuance for the ADA accommodation, and this lawyer that represents the judge [01:06:50.480 --> 01:06:58.480] kicked Georgia Coo, the ADA coordinator to the curb, took her job for the day, I guess, [01:06:58.480 --> 01:07:00.480] and denied my ADA request. [01:07:00.480 --> 01:07:09.480] So now I've got him for violating my ADA rights, and remember, I am declared handicapped or [01:07:09.480 --> 01:07:15.480] whatever because of my heart attacks, it was a slam dunk for this to be put off, there's [01:07:15.480 --> 01:07:24.480] no reason to rush this, but in any case, the judge ultimately gave, granted the motion [01:07:24.480 --> 01:07:33.480] to dismiss with a 45 days leave to amend, I did not amend because the judge doesn't [01:07:33.480 --> 01:07:38.480] have jurisdiction, I recused her for cause, I'm not going to turn around and then follow [01:07:38.480 --> 01:07:44.480] that judge's order, so I just appealed right at that point. [01:07:44.480 --> 01:07:46.480] You appealed the order? [01:07:46.480 --> 01:07:52.480] I mean, okay, she dismissed, so you just appealed her dismissal? [01:07:52.480 --> 01:07:59.480] No, she didn't dismiss yet, I was appealing her order because she didn't have jurisdiction, [01:07:59.480 --> 01:08:01.480] so I put down two things in the appeal. [01:08:01.480 --> 01:08:04.480] Okay, so that was an interlocutory appeal? [01:08:04.480 --> 01:08:08.480] Yes, and I said the court could consider it an interlocutory appeal. [01:08:08.480 --> 01:08:15.480] Anyway, remember, there's two judges up there in the appellate court, one is Manukian, the [01:08:15.480 --> 01:08:23.480] woman married to Socrates Peter Manukian, okay, and the other one is Greenwood, who's [01:08:23.480 --> 01:08:29.480] married to Judge Dabala, okay, and Judge Dabala is the federal court judge that he won't touch [01:08:29.480 --> 01:08:36.480] my case with anyone, he's the one that dismissed my lawsuit against Manukian. [01:08:36.480 --> 01:08:49.480] So where is that now is the appellate court, Greenwood, ruled that my appeal was premature. [01:08:49.480 --> 01:08:56.480] So fine, it went back down, the remitter came down, they went in and got a dismissal now, [01:08:56.480 --> 01:09:02.480] so I'm just going to turn around and appeal now, and I'm going to appeal on jurisdiction, [01:09:02.480 --> 01:09:10.480] and the judge can't rule on her own just this qualification, and that she's got a [01:09:10.480 --> 01:09:15.480] conflict of interest, she's got an absolute interest in the outcome. [01:09:15.480 --> 01:09:21.480] So again, going back to what happened on Monday, however, I think it's time for me to file a [01:09:21.480 --> 01:09:31.480] federal lawsuit against Goldman for deprivation of rights, and possibly the judge who put him [01:09:31.480 --> 01:09:39.480] on my case, because I believe it's a violation of the Eighth Amendment. [01:09:39.480 --> 01:09:44.480] I have the right to the counsel of my choice, and I definitely didn't want him. [01:09:44.480 --> 01:09:53.480] What they were trying to do, and again, because Goldman rattles, it became obvious to me that [01:09:53.480 --> 01:10:00.480] they brought Goldman in to try to get me to admit that I was representing myself. [01:10:00.480 --> 01:10:04.480] And I will never tell the court I'm representing myself. [01:10:04.480 --> 01:10:10.480] I filed motions, and I acted as my own attorney, but I'm not a trial lawyer, okay? [01:10:10.480 --> 01:10:17.480] I can do the stuff prior to trial, but I have no intention of going to trial, [01:10:17.480 --> 01:10:19.480] representing myself in trial. [01:10:19.480 --> 01:10:23.480] And at this point, I don't see how they can even have a trial. [01:10:23.480 --> 01:10:33.480] We're so far past the time statutes, you know, but this is starting to really, [01:10:33.480 --> 01:10:37.480] what's happened in all of this, and why the timeline is going to be so important. [01:10:37.480 --> 01:10:42.480] As I've mentioned these other cases, well, there's several other cases as well, [01:10:42.480 --> 01:10:50.480] that all go to show the collusion of the county, the district attorney's office, [01:10:50.480 --> 01:10:54.480] the public defender's office. And remember, I'm the one that exposed the fact [01:10:54.480 --> 01:11:02.480] that the county is paying sums of money and approximately $60,000 a year per judge, [01:11:02.480 --> 01:11:05.480] and the state is the employer of the judges. [01:11:05.480 --> 01:11:09.480] So no wonder I can't get a fair trial or hearing in this county. [01:11:09.480 --> 01:11:15.480] The county's prosecuted me, and the county's paying the judges about $60,000 a year. [01:11:15.480 --> 01:11:19.480] One of the payments that they're making to them, and no judge gets the same amount, [01:11:19.480 --> 01:11:27.480] but it's the cash type stipend amount. It's like $9,400 to one, $9,600 to another, $9,700. [01:11:27.480 --> 01:11:34.480] All just under $10,000, guys. Now, you or I do that? That's money laundering. [01:11:34.480 --> 01:11:41.480] The feds come in and get you for money laundering, but it's okay for the county to do this? [01:11:41.480 --> 01:11:47.480] It's a rhetorical question, of course it is. It should govern the biggest mafia there is. [01:11:47.480 --> 01:11:51.480] So this, you know, they make laws. [01:11:51.480 --> 01:11:58.480] This is really good down to some of the crux items for rule of law. [01:11:58.480 --> 01:12:04.480] We're not going to restore the rule of law until the law applies equally to everyone. [01:12:04.480 --> 01:12:08.480] And this is an example right here. [01:12:08.480 --> 01:12:13.480] There's so many examples throughout the six and a half years of this case, [01:12:13.480 --> 01:12:19.480] where the rule of law applies to these, but not me. [01:12:19.480 --> 01:12:26.480] And remember, guys, we also sent in the criminal complaints to the grand jury, [01:12:26.480 --> 01:12:32.480] and some deputy DA opened them and went so far as to write me a letter, [01:12:32.480 --> 01:12:36.480] tell me that I can't address the grand jury, [01:12:36.480 --> 01:12:46.480] and admitted she opened my registered mail and was sending it back to me. [01:12:46.480 --> 01:12:53.480] I mean, they won't adhere to Brady. [01:12:53.480 --> 01:12:59.480] You know, they refused to hand over all the discoveries. [01:12:59.480 --> 01:13:06.480] They refused to, they wouldn't even come to the hearing where I motioned for dismissal [01:13:06.480 --> 01:13:13.480] for their failure to prove the enacting clause that makes the statutes a constitutionally valid law. [01:13:13.480 --> 01:13:15.480] They didn't even come to that hearing. [01:13:15.480 --> 01:13:19.480] They sent some flunky who has nothing to do with the case, [01:13:19.480 --> 01:13:26.480] and he provided hearsay saying Amir, the prosecutor, well, Amir says he found the enacting clause. [01:13:26.480 --> 01:13:31.480] And they allowed him to just give that oral testimony, and the judge said, [01:13:31.480 --> 01:13:34.480] okay, motion denied. [01:13:34.480 --> 01:13:41.480] So, again, rule of law, there is no rule of law in these courts in Santa Clara County, [01:13:41.480 --> 01:13:46.480] and the whole state of California, as you know, is a mess, [01:13:46.480 --> 01:13:51.480] but Santa Clara County is beyond. [01:13:51.480 --> 01:13:56.480] We've got problems with, we can't even, when I go into Superior Court now, [01:13:56.480 --> 01:13:59.480] the clerks don't want to file your papers. [01:13:59.480 --> 01:14:01.480] They give you a bunch of guff. [01:14:01.480 --> 01:14:04.480] They look for every reason not to file them. [01:14:04.480 --> 01:14:10.480] And this county court has already been sued in federal court in the past, [01:14:10.480 --> 01:14:19.480] like eight years ago, for this type of behavior of not filing people's documents. [01:14:19.480 --> 01:14:21.480] Yeah, filing. [01:14:21.480 --> 01:14:28.480] So, it's just beyond, you know. [01:14:28.480 --> 01:14:32.480] And then all we can do is just keep exposing it. [01:14:32.480 --> 01:14:34.480] Yes, that's what we need to do. [01:14:34.480 --> 01:14:37.480] And Tina has been doing the same thing. [01:14:37.480 --> 01:14:41.480] The complaints I filed with the district attorney, against the district attorney, [01:14:41.480 --> 01:14:46.480] was based on complaints that Tina filed. [01:14:46.480 --> 01:14:49.480] Tina, I think you will agree with him. [01:14:49.480 --> 01:14:51.480] You there? [01:14:51.480 --> 01:14:52.480] Yes, I am. [01:14:52.480 --> 01:14:56.480] And yes, I totally agree with him. [01:14:56.480 --> 01:14:58.480] Ted, you're doing a great job. [01:14:58.480 --> 01:15:03.480] I wish you'd got that on video or audio, what that attorney said. [01:15:03.480 --> 01:15:05.480] Wow. [01:15:05.480 --> 01:15:08.480] There's a good chance that the... [01:15:08.480 --> 01:15:11.480] Yes, I have a witness that doesn't know me. [01:15:11.480 --> 01:15:16.480] I took a video of him, I took a video statement of him on the spot. [01:15:16.480 --> 01:15:19.480] I'm going to prepare his affidavit. [01:15:19.480 --> 01:15:27.480] I'm hoping that the security cameras on the buildings captured this as well. [01:15:27.480 --> 01:15:28.480] Excellent idea. [01:15:28.480 --> 01:15:29.480] They'll hide those. [01:15:29.480 --> 01:15:32.480] They'll lose them conveniently. [01:15:32.480 --> 01:15:43.480] Of course, but actually I feel in my favor because my written description is going to be better than the hidden videos anyway. [01:15:43.480 --> 01:15:49.480] And I do think that the course... [01:15:49.480 --> 01:15:55.480] Guys, you got to remember, I had a heart attack and almost died. [01:15:55.480 --> 01:16:06.480] And then with that, then I was absolutely tortured, forced into court and started having another heart attack and dying right in the courtroom. [01:16:06.480 --> 01:16:08.480] And they were... [01:16:08.480 --> 01:16:10.480] They could care less. [01:16:10.480 --> 01:16:22.480] And so now for this Goldman to tell me why don't you have another heart attack and die brings back all that trauma. [01:16:22.480 --> 01:16:29.480] Okay, so that's why I think of us doing him in federal court now. [01:16:29.480 --> 01:16:37.480] Instead of state court, I have to weigh that out because that's intentional infliction of emotional distress. [01:16:37.480 --> 01:16:41.480] Sure. [01:16:41.480 --> 01:16:49.480] You need to find a way to get out of California federal courts and get into DC court. [01:16:49.480 --> 01:16:51.480] Absolutely. [01:16:51.480 --> 01:16:54.480] Are you familiar with Rod's class? [01:16:54.480 --> 01:16:58.480] That's what I needed to ask you. I want Olivia and Rod. [01:18:00.480 --> 01:18:04.480] I love logos. Without the shows on this network, I'd be almost as ignorant as my friends. [01:18:04.480 --> 01:18:07.480] I'm so addicted to the truth now that there's no going back. [01:18:07.480 --> 01:18:13.480] I need my truth fix. I'd be lost without logos and I really want to help keep this network on the air. [01:18:13.480 --> 01:18:16.480] I'd love to volunteer as a show producer but I'm a bit of a Luddite [01:18:16.480 --> 01:18:20.480] and I really don't have any money to give because I spent it all on supplements. [01:18:20.480 --> 01:18:22.480] How can I help logos? [01:18:22.480 --> 01:18:24.480] Well, I'm glad you asked. [01:18:24.480 --> 01:18:27.480] Whenever you order anything from Amazon, you can help logos. [01:18:27.480 --> 01:18:29.480] You can order them in your supplies or holiday gifts. [01:18:29.480 --> 01:18:31.480] First thing you do is clear your cookies. [01:18:31.480 --> 01:18:34.480] Now, go to LogosRadioNetwork.com. [01:18:34.480 --> 01:18:37.480] Click on the Amazon logo and bookmark it. [01:18:37.480 --> 01:18:43.480] Now, when you order anything from Amazon, you use that link and Logos gets a few pesos. [01:18:43.480 --> 01:18:44.480] Do I pay extra? [01:18:44.480 --> 01:18:45.480] No. [01:18:45.480 --> 01:18:47.480] Do you have to do anything different when I order? [01:18:47.480 --> 01:18:48.480] No. [01:18:48.480 --> 01:18:49.480] Can I use my Amazon Prime? [01:18:49.480 --> 01:18:50.480] No. [01:18:50.480 --> 01:18:51.480] I mean, yes. [01:18:51.480 --> 01:18:55.480] Wow. Giving without doing anything or spending any money. This is perfect. [01:18:55.480 --> 01:18:57.480] Thank you so much. [01:18:57.480 --> 01:18:58.480] You're welcome. [01:18:58.480 --> 01:19:10.480] Happy Holidays, Logos! [01:19:28.480 --> 01:19:48.480] Okay, we are back. Randy Kelton, Brett Fountain, Will of Law Radio, and we have Ted and Tina. [01:19:48.480 --> 01:20:02.480] Okay, Ted, so if you will send me an email asking for an introduction, I will forward it to both Olivier and to Rod Class. [01:20:02.480 --> 01:20:08.480] You really need to talk to Rod Class. He can help you get into the federal court in D.C. [01:20:08.480 --> 01:20:13.480] Okay, over the break, I did send that email to you already, Randy. [01:20:13.480 --> 01:20:14.480] Okay. [01:20:14.480 --> 01:20:23.480] I really think for all the listeners, okay, I don't, this is not just been done orally, okay? [01:20:23.480 --> 01:20:33.480] I like the disqualification of the judge with a 25-page document that I wrote and filed and served the judge, okay? [01:20:33.480 --> 01:20:42.480] If you look at my case and stacked all the papers up that I filed into the various cases, you're talking about a stack that's over six feet high. [01:20:42.480 --> 01:20:45.480] I've been paid lawyers to do the work that I've done. [01:20:45.480 --> 01:20:51.480] The papers, you're looking at more than half a million dollars of legal work. [01:20:51.480 --> 01:20:55.480] It's probably closer to six or seven hundred thousand at this point. [01:20:55.480 --> 01:20:59.480] So I want to be clear to people, whatever you say doesn't mean anything. [01:20:59.480 --> 01:21:01.480] You've got to put the papers into the court. [01:21:01.480 --> 01:21:07.480] You have to keep your file stamp copies and keep them secure. [01:21:07.480 --> 01:21:09.480] Yeah, because they lose them. [01:21:09.480 --> 01:21:19.480] So as much talking as I've done, please, everyone know I have filed paper after paper after paper. [01:21:19.480 --> 01:21:22.480] And that's what it takes. [01:21:22.480 --> 01:21:30.480] And again, critical from the very beginning, start writing your time line. [01:21:30.480 --> 01:21:32.480] Otherwise, it gets out of hand. [01:21:32.480 --> 01:21:33.480] Yeah. [01:21:33.480 --> 01:21:34.480] You're in a hurry. [01:21:34.480 --> 01:21:56.480] Yeah, the last thing, now that Tina's online, thank you so much, Tina, because whether you know it or not, listening to you and knowing that you're out there, it gives me motivation and even energy to continue to defend myself. [01:21:56.480 --> 01:22:04.480] You're dynamite. I mean, you know, an inspiration to many. [01:22:04.480 --> 01:22:07.480] We're having a hard time understanding you. [01:22:07.480 --> 01:22:13.480] I said he's doing a marvelous job and an inspiration to many of us. [01:22:13.480 --> 01:22:14.480] Yes, he has. [01:22:14.480 --> 01:22:18.480] This is the most egregious case I've ever heard of. [01:22:18.480 --> 01:22:21.480] This is beyond outrageous. [01:22:21.480 --> 01:22:29.480] And maybe I can get him hold of Rod Class and Rod Class and get him into the Article III courts in D.C. [01:22:29.480 --> 01:22:35.480] And maybe we can actually get something done. [01:22:35.480 --> 01:22:39.480] Okay, do you have anything else, Ted? [01:22:39.480 --> 01:22:42.480] No, that's my story and I'm sticking to it. [01:22:42.480 --> 01:22:48.480] And of course, as always, Randy, I've said it before. [01:22:48.480 --> 01:22:53.480] I wouldn't even be alive if it wasn't for you and this show. [01:22:53.480 --> 01:22:59.480] And there was the dark times that, you know, I wouldn't have made it. [01:22:59.480 --> 01:23:03.480] And then a special shout out to Brett as well. [01:23:03.480 --> 01:23:08.480] You're bringing a whole other angle and you come up with great things. [01:23:08.480 --> 01:23:09.480] I listen to you guys all the time. [01:23:09.480 --> 01:23:17.480] I don't always call in, but I listen because I learn from every situation you guys discuss. [01:23:17.480 --> 01:23:18.480] Well, good. [01:23:18.480 --> 01:23:19.480] Well, thank you. [01:23:19.480 --> 01:23:27.480] I'll send you a check for that plug. [01:23:27.480 --> 01:23:28.480] Okay. [01:23:28.480 --> 01:23:30.480] Thank you, Ted. [01:23:30.480 --> 01:23:36.480] Now, since we've got Tina on, Tina, what do you have for us today? [01:23:36.480 --> 01:23:47.480] Well, I was wondering if you could let me know if that lawsuit that by an insider of [01:23:47.480 --> 01:23:55.480] Warm West Bank would help in what we're doing when they're shielding them from prostitution [01:23:55.480 --> 01:24:07.480] in Texas, because one of the claims in it is that the relator, the whistleblower, did [01:24:07.480 --> 01:24:15.480] have a meeting with the top brass, including Mnuchin, and they pretty much ignored him. [01:24:15.480 --> 01:24:25.480] And it says here, I'm seeing that Warm West submitted faults or fraudulent claims for [01:24:25.480 --> 01:24:34.480] and received incentive payments and pay for success compensation payments for FHA mortgages [01:24:34.480 --> 01:24:39.480] that were required to be timely evaluated for loss mitigation. [01:24:39.480 --> 01:24:45.480] And they falsely certified compliance with the above-described terms of the program, [01:24:45.480 --> 01:24:52.480] when in fact it had knowingly violated material terms of the program by failing to engage [01:24:52.480 --> 01:24:55.480] in loss mitigation within the prescribed time frames. [01:24:55.480 --> 01:24:57.480] And that's just one of the things... [01:24:57.480 --> 01:24:58.480] Okay. [01:24:58.480 --> 01:24:59.480] Okay. [01:24:59.480 --> 01:25:03.480] The claim itself will not be of much value. [01:25:03.480 --> 01:25:09.480] The underlying documentation and support of those claims, that will be of great value. [01:25:09.480 --> 01:25:15.480] Well, the claims will be of value because they will help us know how to construct the [01:25:15.480 --> 01:25:21.480] claim or complaint, but the claim itself is not of great value because it hasn't been [01:25:21.480 --> 01:25:22.480] proven up. [01:25:22.480 --> 01:25:27.480] The documentation and support will be of great value. [01:25:27.480 --> 01:25:28.480] Okay. [01:25:28.480 --> 01:25:34.480] I'm not sure if we can get hold of all the documentation and support. [01:25:34.480 --> 01:25:41.480] It's not important at this point because they're not moving on that at this point. [01:25:41.480 --> 01:25:45.480] We have to get that back before the grand jury. [01:25:45.480 --> 01:25:52.480] And what we can do is, once I'm beaten up the prosecutor now for not giving that to the [01:25:52.480 --> 01:25:54.480] grand jury. [01:25:54.480 --> 01:26:02.480] So once I get him beat up good, if we come back and file it directly with the grand jury, [01:26:02.480 --> 01:26:06.480] then he will have plausible deniability. [01:26:06.480 --> 01:26:10.480] He can say, I've already been beat up for that. [01:26:10.480 --> 01:26:11.480] I'm going to step back. [01:26:11.480 --> 01:26:12.480] They sent it to the grand jury. [01:26:12.480 --> 01:26:15.480] I'm not going to touch it. [01:26:15.480 --> 01:26:17.480] It's between them and the grand jury. [01:26:17.480 --> 01:26:18.480] I got nothing to do with it. [01:26:18.480 --> 01:26:23.480] Now, he has plausible deniability because of what it did to it. [01:26:23.480 --> 01:26:26.480] Does that make sense? [01:26:26.480 --> 01:26:28.480] Yeah, I think it does. [01:26:28.480 --> 01:26:32.480] And just to let people know that it wasn't just the complaints we did. [01:26:32.480 --> 01:26:36.480] We're not just about the notary problem. [01:26:36.480 --> 01:26:44.480] There was, on the first one, there were 12 different points that we went through on serious [01:26:44.480 --> 01:26:47.480] offenses in the Texas penal code. [01:26:47.480 --> 01:26:56.480] Tendering secured creditors and changing asserted value increasing and decreasing by different [01:26:56.480 --> 01:26:57.480] amounts. [01:26:57.480 --> 01:27:05.480] So we put in quite a little bit about minutiae, but also aughting. [01:27:05.480 --> 01:27:07.480] And they completely ignored that one. [01:27:07.480 --> 01:27:14.480] And even though I bought it to their attention, I don't know if in your complaint you bought [01:27:14.480 --> 01:27:21.480] about the fact that they not only said they were going to prosecute or submit minutiae's [01:27:21.480 --> 01:27:28.480] criminal complaint to the grand jury, but they did not even submit or say they were going [01:27:28.480 --> 01:27:39.480] to submit aughting's complaint or the attorney who, you know, got those notaries to violate [01:27:39.480 --> 01:27:40.480] the law. [01:27:40.480 --> 01:27:41.480] Right. [01:27:41.480 --> 01:27:43.480] It doesn't matter what they said. [01:27:43.480 --> 01:27:49.480] It only matters that the complaints were filed or in the record. [01:27:49.480 --> 01:27:53.480] And the prosecutor did not give them to the grand jury. [01:27:53.480 --> 01:27:54.480] Okay. [01:27:54.480 --> 01:28:02.480] Yeah, this is not the place to argue the merits of the complaints that were filed. [01:28:02.480 --> 01:28:06.480] We'll argue that when we get it back in front of the grand jury. [01:28:06.480 --> 01:28:13.480] Well, then that means you ought to be able to also raise a stink about aughting all of [01:28:13.480 --> 01:28:15.480] those complaints against aughting. [01:28:15.480 --> 01:28:17.480] They were filed contemporaneously. [01:28:17.480 --> 01:28:18.480] Okay. [01:28:18.480 --> 01:28:21.480] Let me ask a question about the complaints themselves. [01:28:21.480 --> 01:28:28.480] I addressed the notary because clearly the notary was fixed. [01:28:28.480 --> 01:28:31.480] The jurisdiction was fixed in Travis County. [01:28:31.480 --> 01:28:33.480] It couldn't be anywhere else. [01:28:33.480 --> 01:28:35.480] There was no question about it. [01:28:35.480 --> 01:28:36.480] There were other complaints. [01:28:36.480 --> 01:28:41.480] How do you fix them to a Texas court? [01:28:41.480 --> 01:28:50.480] Because the letters and documents that came with, let's say, the amount, different amounts [01:28:50.480 --> 01:28:59.480] where it says ranging from 142,000 to 47,000, they all transpired, or almost all of them [01:28:59.480 --> 01:29:06.480] transpired from a substitute trustee that was located in Texas. [01:29:06.480 --> 01:29:17.480] If they sent the letters to you in California, that gives exclusive jurisdiction to the Fed. [01:29:17.480 --> 01:29:23.480] That's the problem with that one. [01:29:23.480 --> 01:29:28.480] These are civil issues. [01:29:28.480 --> 01:29:37.480] The crime only becomes a crime because they sent these letters to you. [01:29:37.480 --> 01:29:39.480] That makes it federal. [01:29:39.480 --> 01:29:47.480] The JP committed the crime in the state because the state specifically referenced the JP and [01:29:47.480 --> 01:29:50.480] the JP's authority. [01:29:50.480 --> 01:29:52.480] The others are ambiguous. [01:29:52.480 --> 01:30:01.480] The JP not sending you that to transcript is strictly Texas law. [01:30:01.480 --> 01:30:03.480] Sorry, soft drink lovers. [01:30:03.480 --> 01:30:06.480] Even diet drinks can make you fat. [01:30:06.480 --> 01:30:11.480] A new study shows that diet soda drinkers gain much more weight than people who avoid the stuff. [01:30:11.480 --> 01:30:17.480] I've got your camera at all breaks, and I'll be back in a moment with a scoop on supposedly skinny sodas. [01:30:17.480 --> 01:30:19.480] Privacy is under attack. [01:30:19.480 --> 01:30:22.480] If you have data about yourself, you'll never get it back again. [01:30:22.480 --> 01:30:27.480] And once your privacy is gone, you'll find your freedoms will start to vanish too. [01:30:35.480 --> 01:30:38.480] This public service announcement is brought to you by StartPage.com. [01:30:38.480 --> 01:30:42.480] The private search engine alternative to Google, Yahoo, and Bing. [01:30:42.480 --> 01:30:45.480] Start over with StartPage. [01:30:45.480 --> 01:30:49.480] Artificial sweeteners cut the calories and help you lose weight, right? [01:30:49.480 --> 01:30:50.480] Wrong. [01:30:50.480 --> 01:30:55.480] Researchers at UT San Antonio followed hundreds of diet soda drinkers for nearly a decade. [01:30:55.480 --> 01:31:02.480] They found that regularly drinking diet soda expanded people's waistlines five times more than no soda at all. [01:31:02.480 --> 01:31:09.480] The study's authors say artificial sweeteners triggered the appetite, but unlike regular sugars, don't deliver anything to squelch it. [01:31:09.480 --> 01:31:15.480] Waking up hunger without satisfying it leads to cravings, which can result in a larger overall calorie intake. [01:31:15.480 --> 01:31:18.480] So use natural sweeteners to maintain a healthy weight, [01:31:18.480 --> 01:31:23.480] and if you need to shed some pounds, avoid the sweet stuff altogether and drink water instead. [01:31:23.480 --> 01:31:30.480] I'm Dr. Catherine Albrecht. More news and information at CatherineAlbrecht.com. [01:31:30.480 --> 01:31:35.480] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11th. [01:31:35.480 --> 01:31:37.480] The government says that fire brought it down. [01:31:37.480 --> 01:31:42.480] However, 1,500 architects and engineers have concluded it was a controlled demolition. [01:31:42.480 --> 01:31:45.480] Over 6,000 of my fellow service members have given their lives, [01:31:45.480 --> 01:31:48.480] and thousands of my fellow force responders have died. [01:31:48.480 --> 01:31:49.480] I'm not a conspiracy theorist. [01:31:49.480 --> 01:31:50.480] I'm a structural engineer. [01:31:50.480 --> 01:31:52.480] I'm a New York City correction officer. [01:31:52.480 --> 01:31:53.480] I'm an Air Force pilot. [01:31:53.480 --> 01:31:54.480] I'm a father who lost his son. [01:31:54.480 --> 01:31:57.480] We are Americans, and we deserve the truth. [01:32:04.480 --> 01:32:07.480] In today's America, we live in an us-against-them society, [01:32:07.480 --> 01:32:09.480] and if we, the people, are ever going to have a free society, [01:32:09.480 --> 01:32:12.480] then we're going to have to stand and defend our home rights. [01:32:12.480 --> 01:32:15.480] Among those rights are the right to travel freely from place to place, [01:32:15.480 --> 01:32:17.480] the right to act in our own private capacity, [01:32:17.480 --> 01:32:19.480] and most importantly, the right to due process of law. [01:32:19.480 --> 01:32:23.480] Traffic courts afford us the least expensive opportunity to learn how to enforce [01:32:23.480 --> 01:32:25.480] and preserve our rights through due process. [01:32:25.480 --> 01:32:28.480] Former Sheriff's Deputy Eddie Craig, in conjunction with Rule of Law Radio, [01:32:28.480 --> 01:32:30.480] has put together the most comprehensive teaching tool available [01:32:30.480 --> 01:32:34.480] that will help you understand what due process is and how to hold courts to the Rule of Law. [01:33:42.480 --> 01:33:47.480] They're trying to buy the whole place. [01:33:47.480 --> 01:33:53.480] They want to force the nation [01:33:53.480 --> 01:33:58.480] because they're falling from grace. [01:33:58.480 --> 01:34:06.480] I will not bring you back to life. [01:34:06.480 --> 01:34:08.480] Okay, we are back with Randy Kelton Brett, [01:34:08.480 --> 01:34:12.480] found in RuleofLawRadio and we're talking to Tina in California. [01:34:12.480 --> 01:34:20.480] Tina, you and Brett, these other more serious charges that you brought, [01:34:20.480 --> 01:34:22.480] the felony charges, [01:34:22.480 --> 01:34:31.480] Brett, how do we give Texas jurisdiction as opposed to the Fed? [01:34:31.480 --> 01:34:32.480] I don't know. [01:34:32.480 --> 01:34:38.480] I'll have to go back and look at those again and see what we can see. [01:34:38.480 --> 01:34:48.480] Yes, so let's check that because if I can raise the issue of secreting felonies from the grand jury, [01:34:48.480 --> 01:34:54.480] that's a lot bigger, but if they can raise the issue of jurisdiction, [01:34:54.480 --> 01:35:00.480] that kind of dilutes things. [01:35:00.480 --> 01:35:10.480] At the end of the day, I've got the one and what he's going to say is that it is a misdemeanor [01:35:10.480 --> 01:35:15.480] and that it doesn't go before a grand jury. [01:35:15.480 --> 01:35:19.480] I'm going to say, naughty, naughty, yes, it does. [01:35:19.480 --> 01:35:24.480] According to the Texas Constitution, it does. [01:35:24.480 --> 01:35:38.480] In Texas, they say that they can prosecute a misdemeanor on the charge alone or on the information. [01:35:38.480 --> 01:35:42.480] Well, that's not what the Constitution says. [01:35:42.480 --> 01:35:49.480] So you always want to bring up a constitutional challenge or a challenge, [01:35:49.480 --> 01:35:53.480] the nature of which would undermine everything. [01:35:53.480 --> 01:36:01.480] And in the complaints I filed, I included a brief in there that went through the code [01:36:01.480 --> 01:36:12.480] and showed where only magistrates and judges could dismiss a criminal accusation. [01:36:12.480 --> 01:36:18.480] The law demands that a criminal accusation be forwarded to a magistrate. [01:36:18.480 --> 01:36:26.480] If a policeman receives a criminal accusation under 2.13 code criminal procedure, [01:36:26.480 --> 01:36:28.480] he's forwarded that to some magistrate. [01:36:28.480 --> 01:36:31.480] If a prosecuting attorney receives a criminal accusation, [01:36:31.480 --> 01:36:36.480] he's to reduce it into an information, submit the information to the court of jurisdiction, [01:36:36.480 --> 01:36:40.480] and file the complaint with some magistrate. [01:36:40.480 --> 01:36:43.480] It doesn't say may, might, or can if he wants to. [01:36:43.480 --> 01:36:47.480] It doesn't say wipe his behind with it and throw it in the trash. [01:36:47.480 --> 01:36:55.480] It directs him to give it to some magistrate because it is the magistrate who makes a determination of probable cause. [01:36:55.480 --> 01:37:02.480] If the complaint is insufficient, it is the job of the magistrate to make that determination, [01:37:02.480 --> 01:37:07.480] not a lawyer held hired to work for the state. [01:37:07.480 --> 01:37:10.480] He's just a mouthpiece. [01:37:10.480 --> 01:37:16.480] If a magistrate finds probable cause, [01:37:16.480 --> 01:37:21.480] but the prosecutor looks at it and says, I don't have enough here to prosecute. [01:37:21.480 --> 01:37:23.480] He can't dismiss. [01:37:23.480 --> 01:37:29.480] He has to go to the court and ask the court to dismiss it. [01:37:29.480 --> 01:37:35.480] Lawyers have told me if a prosecutor asks the judge to dismiss, the judge almost has to. [01:37:35.480 --> 01:37:38.480] But I think that's just practice. [01:37:38.480 --> 01:37:44.480] If there's probable cause, technically he doesn't have power to, [01:37:44.480 --> 01:37:51.480] but I won't argue with the judge dismissing the case because they do have power to do that kind of thing in the interest of justice. [01:37:51.480 --> 01:37:56.480] And you notice Scott was on yesterday and that's what they said, in the interest of justice. [01:37:56.480 --> 01:37:58.480] They moved to dismiss the case. [01:37:58.480 --> 01:38:01.480] That was exactly how it was supposed to be done. [01:38:01.480 --> 01:38:02.480] A lawyer doesn't do it. [01:38:02.480 --> 01:38:07.480] He asked the judge to do it and the judge has to rule on it. [01:38:07.480 --> 01:38:19.480] So if I win this ruling, judicial discretion or prosecutorial discretion in Texas disappears. [01:38:19.480 --> 01:38:27.480] Prosecutors can no longer accept a case without a ruling from a justice of the peace. [01:38:27.480 --> 01:38:30.480] And that's exactly what the law commands. [01:38:30.480 --> 01:38:46.480] Well, this prosecuting attorney is not going to want to be the one who causes every prosecutor in the state to lose the ability to exercise prosecutorial discretion. [01:38:46.480 --> 01:38:54.480] They want something that if you get a ruling, it screws up everything. [01:38:54.480 --> 01:39:00.480] So we'll see how this, you know, this is not a lawsuit against the prosecutor. [01:39:00.480 --> 01:39:04.480] I'm strictly going at him criminal. [01:39:04.480 --> 01:39:17.480] And I need to look at this. I need suggestions. Who lives in Austin and is more familiar with Austin politics than me? [01:39:17.480 --> 01:39:22.480] What is the politics concerning the prosecuting attorney? [01:39:22.480 --> 01:39:30.480] Now I have Mary Crennic down there and she's a wealth of information about politics in Austin. [01:39:30.480 --> 01:39:51.480] Austin is very blue and apparently was listening to a state rep speaking to the house about how Biden's policy on protecting the border is likely to lead to a constitutional conflict with Texas, [01:39:51.480 --> 01:40:04.480] because Texas is sending the governor is sending DPS officers down there to patrol the borders themselves because the feds are not doing it. [01:40:04.480 --> 01:40:07.480] Border patrol is trying to, but they're being defunded. [01:40:07.480 --> 01:40:17.480] They've taken away their horses so that they can't act in areas that's not suitable for automobiles to do everything they can to interfere with them. [01:40:17.480 --> 01:40:22.480] And Texas has taken the brunt of the illegal border crossings. [01:40:22.480 --> 01:40:33.480] There's another problem. In the Texas Constitution, it forbids Texas to close its borders. [01:40:33.480 --> 01:40:48.480] So that may make it difficult, but in any case, the Republicans are funneling money into Texas to push Texas further red than blue. [01:40:48.480 --> 01:40:53.480] So that may help, but where is the politics? [01:40:53.480 --> 01:41:00.480] What officials are in place that are potentially vulnerable? [01:41:00.480 --> 01:41:16.480] What I'm thinking of doing is giving this to a Democratic judge and asking the judge to petition for a court of inquiry under Chapter 52 called a criminal procedure. [01:41:16.480 --> 01:41:20.480] And when he doesn't, then I go after the judge. [01:41:20.480 --> 01:41:35.480] I petition the court of criminal appeals for rid of mandamus ordering the judge, ordering the attorney, county attorney, district attorney to act in accordance with law. [01:41:35.480 --> 01:41:37.480] In Texas, they don't have county attorneys. [01:41:37.480 --> 01:41:39.480] They only had the district attorney. [01:41:39.480 --> 01:41:41.480] Wait a minute. Do they? [01:41:41.480 --> 01:41:43.480] Yeah, I'm sorry. They do. [01:41:43.480 --> 01:41:47.480] Some counties don't have county attorneys. [01:41:47.480 --> 01:41:53.480] I don't think of one that doesn't. Anyway, just a handful. [01:41:53.480 --> 01:42:05.480] Trying to want to get the judge to issue a petition for court of inquiry to inquire into the improper actions of the district attorney, they are not going to want to get that in front of court. [01:42:05.480 --> 01:42:23.480] And to do that, if the Democratic judge refuses to, then I accuse the district judge of acting in concert inclusion with the prosecuting attorney to usurp the Constitution. [01:42:23.480 --> 01:42:36.480] And so anybody's got any other useful politics who want judges, Democratic judges are the most vulnerable. [01:42:36.480 --> 01:42:41.480] That's the one I'd like to hit with this and create bad press for. [01:42:41.480 --> 01:43:00.480] Well, I took a look at these criminal complaints that we've put together and Tina and I a while back and the way we got the jurisdiction squarely in Texas was to accuse this guy of doing the things in Travis County, Texas. [01:43:00.480 --> 01:43:18.480] Because that's the location of the lawyer who was his agent was, you know, acting. So Stephen Mnuchin was the principal, but the agent that did the thing was in Travis County, Texas. [01:43:18.480 --> 01:43:20.480] So we said. [01:43:20.480 --> 01:43:26.480] The problem here is it was Mnuchin in Travis County. [01:43:26.480 --> 01:43:29.480] Don't have any idea where he was physically. [01:43:29.480 --> 01:43:32.480] This goes to international issue, minimum contacts. [01:43:32.480 --> 01:43:53.480] They'll be able to show that Mnuchin, if he was out of state had sufficient minimum and some sufficient contacts with Texas to give diversity jurisdiction or it'll just be straight up diversity jurisdiction if Mnuchin was not in Texas. [01:43:53.480 --> 01:44:00.480] But they had an office. Does this potentially show why they would have blown off? [01:44:00.480 --> 01:44:11.480] Through advances in technology, our lives have greatly improved, except in the area of nutrition. People feed their pets better than they feed themselves and it's time we changed all that. [01:44:11.480 --> 01:44:17.480] Our primary defense against aging and disease in this toxic environment is good nutrition. [01:46:39.480 --> 01:46:43.480] And it proves the words that put on hold. [01:46:43.480 --> 01:46:44.480] Oh, I love you. [01:46:44.480 --> 01:46:46.480] I'm not a demaculon. [01:46:46.480 --> 01:46:48.480] I'm not your gypsy. [01:46:48.480 --> 01:46:51.480] I'm a small step to the gypsy. [01:46:51.480 --> 01:46:54.480] And my waffles are on point. [01:46:54.480 --> 01:46:59.480] As before, so shall we be. [01:46:59.480 --> 01:47:01.480] Okay, we are back. [01:47:01.480 --> 01:47:08.480] Randy Kelton-Breath out in the root of our radio, and I violated my own rule. [01:47:08.480 --> 01:47:13.480] Sometimes presuppositions are subtle. [01:47:13.480 --> 01:47:19.480] We're talking about, are these cases state or are they federal? [01:47:19.480 --> 01:47:32.480] I was speaking to those as if that was relevant to the issue of the prosecuting attorney not giving them to the grand jury. [01:47:32.480 --> 01:47:41.480] Even if all of them were strictly and exclusively federal jurisdiction, it doesn't matter. [01:47:41.480 --> 01:47:45.480] In fact, even if you had accused them of having red hair. [01:47:45.480 --> 01:47:49.480] Exactly, standing on their head, walking like a chicken. [01:47:49.480 --> 01:47:51.480] It's still got to give it to the grand jury. [01:47:51.480 --> 01:47:52.480] No discretion. [01:47:52.480 --> 01:48:02.480] Or petition the district judge to dismiss the case, dismiss the claim, or find no probable cause. [01:48:02.480 --> 01:48:14.480] The prosecutor cannot do it, even if it's obviously and blatantly not within the jurisdiction of the state, the prosecutor can't make that determination. [01:48:14.480 --> 01:48:16.480] That's a judicial determination. [01:48:16.480 --> 01:48:20.480] And he is not a member of the judiciary. [01:48:20.480 --> 01:48:23.480] So I was going down the rabbit hole. [01:48:23.480 --> 01:48:26.480] Guys, why didn't you tell me? [01:48:26.480 --> 01:48:30.480] It's really hard not to go down rabbit holes. [01:48:30.480 --> 01:48:36.480] But when you catch yourself, it really makes the other side crazy. [01:48:36.480 --> 01:48:41.480] Because they're going to think that the arguments are valid. [01:48:41.480 --> 01:48:44.480] And when you step around them, it makes them nuts. [01:48:44.480 --> 01:48:49.480] These lawyers, for the most part, that work for the government are not the sharpest knives in the drawer. [01:48:49.480 --> 01:48:53.480] So we won't even allow that as an argument. [01:48:53.480 --> 01:48:56.480] Objection, relevance. [01:48:56.480 --> 01:48:58.480] He's the prosecutor. [01:48:58.480 --> 01:48:59.480] He prosecutes. [01:48:59.480 --> 01:49:05.480] He doesn't make determination, judicial determinations, probable cause. [01:49:05.480 --> 01:49:07.480] Okay. [01:49:07.480 --> 01:49:08.480] That's my story. [01:49:08.480 --> 01:49:09.480] I'm sticking to it. [01:49:09.480 --> 01:49:10.480] Tina, do you have anything else for us? [01:49:10.480 --> 01:49:13.480] Just a quick question. [01:49:13.480 --> 01:49:26.480] Would it help if we filed criminal charges against the notaries themselves as we're doing all this to kind of go at them in different angles? [01:49:26.480 --> 01:49:35.480] Because according to what I found, the notaries are, you know, culpable in, you know, the violations of laws. [01:49:35.480 --> 01:49:36.480] Okay. [01:49:36.480 --> 01:49:48.480] So that raises the question, did you file against this notary who refused to send the, what do you call it, the ledger? [01:49:48.480 --> 01:49:51.480] We haven't filed criminal complaints against them yet. [01:49:51.480 --> 01:49:59.480] I filed complaints with the notary commission, but no criminal complaint has yet. [01:49:59.480 --> 01:50:06.480] Okay. And we need a criminal complaint against the notary. [01:50:06.480 --> 01:50:11.480] That'll bring the notary to the table and she'll throw everybody onto the bus. [01:50:11.480 --> 01:50:13.480] She or he. [01:50:13.480 --> 01:50:18.480] But yeah, that's when we get back to refiling these complaints. [01:50:18.480 --> 01:50:22.480] Right now, all that doesn't matter. [01:50:22.480 --> 01:50:29.480] The prosecutor had a duty to give it to the grand jury or to present it to some magistrate. [01:50:29.480 --> 01:50:37.480] He could do that because in the statute it says that he's sent it to the court of jurisdiction or to some magistrate. [01:50:37.480 --> 01:50:47.480] If we send it to the grand jury, it's my issue and my argument here that he doesn't have any discretion. [01:50:47.480 --> 01:50:53.480] He can't make a determination of probable cause. He must give it to the grand jury, let them do it. [01:50:53.480 --> 01:51:02.480] Now he can go before the grand jury and argue that this particular allegation does not fall within the jurisdiction of the state. [01:51:02.480 --> 01:51:06.480] But the grand jury has to know Bill. [01:51:06.480 --> 01:51:08.480] He can't dismiss it himself. [01:51:08.480 --> 01:51:10.480] So we need to keep with that argument. [01:51:10.480 --> 01:51:18.480] So we can go after when we should, but not for the issue right now. [01:51:18.480 --> 01:51:25.480] Did I get confused and answer a question you didn't ask? [01:51:25.480 --> 01:51:27.480] Yes, both. [01:51:27.480 --> 01:51:42.480] But I think Brett and I will talk about this off the air because I think you've got to get the complaints with the secretary of state, that's for sure, and go after them because they do have insurance. [01:51:42.480 --> 01:51:45.480] It's only $10,000 bond for each. [01:51:45.480 --> 01:51:51.480] No, but they may have insurance, but this is criminal. [01:51:51.480 --> 01:51:55.480] The insurance won't help them with criminal. [01:51:55.480 --> 01:51:57.480] Let's put the pressure on. [01:51:57.480 --> 01:51:59.480] Absolutely. That's what I'm doing. [01:51:59.480 --> 01:52:03.480] I got to get the prosecutor softened up a little bit. [01:52:03.480 --> 01:52:12.480] Now that he hasn't, that I didn't receive that email back, he may not realize the importance of that cover letter. [01:52:12.480 --> 01:52:19.480] I'll demonstrate the importance of it because I come in with another set of charges. [01:52:19.480 --> 01:52:29.480] Take those through a stack of judges and get all the judges engaged in the issue. [01:52:29.480 --> 01:52:31.480] Okay, we need to move on. [01:52:31.480 --> 01:52:35.480] Yep, thank you. [01:52:35.480 --> 01:52:37.480] Okay, thank you, Tina. [01:52:37.480 --> 01:52:38.480] Bye. [01:52:38.480 --> 01:52:45.480] Now we're going to go to what appears to be a first time caller. [01:52:45.480 --> 01:52:50.480] If you are in the 856 area code, talk to us. [01:52:50.480 --> 01:53:00.480] Give us a name, any name, your name, somebody else's name, and a state just so we know what to call you and what jurisdiction. [01:53:00.480 --> 01:53:03.480] This is John from New Jersey. [01:53:03.480 --> 01:53:06.480] Okay, are you a first time caller? [01:53:06.480 --> 01:53:17.480] Actually, I've called you a number of times and maybe about two or three months ago, I touched base with you on the things I'm involved with here locally. [01:53:17.480 --> 01:53:19.480] No, I'm not a first time caller. [01:53:19.480 --> 01:53:22.480] Is this a different phone? [01:53:22.480 --> 01:53:25.480] This is 85646483. [01:53:25.480 --> 01:53:36.480] Just, yeah, I'm looking at my listing this in our database and if you've called before, you should be in the database. [01:53:36.480 --> 01:53:42.480] So that generally means it's a different phone and we don't like to get phones out on the air. [01:53:42.480 --> 01:53:44.480] I give out mine with that. [01:53:44.480 --> 01:53:45.480] That's all. [01:53:45.480 --> 01:53:48.480] I don't answer the phone anyway, so just going to send messages. [01:53:48.480 --> 01:53:51.480] Okay, I just didn't want you to get any crap calls. [01:53:51.480 --> 01:53:54.480] Well, I don't. [01:53:54.480 --> 01:53:59.480] Okay, John from New Jersey, we'll put this number in the database so it comes up clear next time. [01:53:59.480 --> 01:54:01.480] Okay, what do you have for us? [01:54:01.480 --> 01:54:07.480] I sent you a little e-mail at around, say I think about four or five o'clock. [01:54:07.480 --> 01:54:13.480] There's just a little brief summary of what I'm involved here. [01:54:13.480 --> 01:54:16.480] There's a project. [01:54:16.480 --> 01:54:18.480] I'm in Southern New Jersey. [01:54:18.480 --> 01:54:21.480] Okay, I'm about 10 or 15 miles away from Philadelphia. [01:54:21.480 --> 01:54:30.480] And there's a multi-billion dollar project underway here for a light rail line. [01:54:30.480 --> 01:54:33.480] Okay, and there's two agencies involved. [01:54:33.480 --> 01:54:35.480] There's the Delaware Report Authority. [01:54:35.480 --> 01:54:38.480] That's a by state. [01:54:38.480 --> 01:54:41.480] Yeah, I'm looking at your e-mail. [01:54:41.480 --> 01:54:47.480] Okay, and you did bring up a real question I'm going to want to get to here in a second. [01:54:47.480 --> 01:54:48.480] Go ahead. [01:54:48.480 --> 01:54:49.480] Okay. [01:54:49.480 --> 01:54:52.480] I have a website too, so there's some information. [01:54:52.480 --> 01:55:01.480] As I unravel this, my concern, I'm going, as I unravel this, as I peel off the layers of the onion, [01:55:01.480 --> 01:55:06.480] I find out that, you know, I'm falling through the looking glass here. [01:55:06.480 --> 01:55:19.480] I'm requesting information from the state agency and the Delaware Report Authority. [01:55:19.480 --> 01:55:23.480] I get no response from the state, which I'm going to deal with later, [01:55:23.480 --> 01:55:30.480] but the Delaware Report Authority is the 900-pound gorilla in the room here. [01:55:30.480 --> 01:55:37.480] I'm in contact with their legal counsel on an issue I have of collusion, [01:55:37.480 --> 01:55:44.480] and I think there was someone interfered with the progress of the project, [01:55:44.480 --> 01:55:49.480] and they more or less maneuvered things around for their benefit. [01:55:49.480 --> 01:55:53.480] There's a group that's opposed to a large influential group, [01:55:53.480 --> 01:55:56.480] and they've got a lot of people and apparently a lot of resources. [01:55:56.480 --> 01:56:08.480] They were able to get some influence and have something changed somewhere along the line here. [01:56:08.480 --> 01:56:20.480] It seems like it's inconsequential, but they were able to maneuver the process around. [01:56:20.480 --> 01:56:23.480] I don't know how they did it, who did it, or when it was done, [01:56:23.480 --> 01:56:32.480] but the scope of the project was changed and it benefited a small group of a local community here. [01:56:32.480 --> 01:56:38.480] I'm just about a mile away from someone within walking distance of one of the stops along the line, [01:56:38.480 --> 01:56:46.480] and my concern that I raised with the Delaware Report Authority is why was this stop removed? [01:56:46.480 --> 01:56:49.480] Was it removed? Has it been removed? Who did it? [01:56:49.480 --> 01:56:58.480] At the very least, all I can get is I deal with the counsel, with the legal counsel, [01:56:58.480 --> 01:57:04.480] and I kind of threatened him with the criminal complaint in the Justice Department [01:57:04.480 --> 01:57:07.480] and the Attorney General down here. [01:57:07.480 --> 01:57:18.480] What he did was I had filed a complaint with what I thought was the Office of the Inspector General. [01:57:18.480 --> 01:57:24.480] That's kind of a long convoluted process. [01:57:24.480 --> 01:57:29.480] That was a part of the email I wanted to get to. [01:57:29.480 --> 01:57:34.480] What I determined was that we don't have an Inspector General. [01:57:34.480 --> 01:57:39.480] The previous Inspector General, I think four or five years ago, he was hired on [01:57:39.480 --> 01:57:47.480] and he quit after a couple of weeks or a month because of interference from the Board of Directors of the Port Authority. [01:57:47.480 --> 01:57:51.480] I hired the guy to be an Inspector General. He couldn't do his job. He left. [01:57:51.480 --> 01:58:00.480] Apparently, in the interim, they've hired this company called Ethics Point. [01:58:00.480 --> 01:58:11.480] Ethics Point is a cloud-based, anonymous website that is acting as if they are the Attorney General [01:58:11.480 --> 01:58:14.480] or the Office of the Inspector General. [01:58:14.480 --> 01:58:18.480] Pardon? Is it a bot? [01:58:18.480 --> 01:58:24.480] I think that based on, I've got copies of all my responses. [01:58:24.480 --> 01:58:30.480] What it looks like is when I ask them a question, what they do is they rejigger the question around [01:58:30.480 --> 01:58:36.480] and it's regenerated and that's their response is my question. [01:58:36.480 --> 01:58:44.480] So we've gone through it, you know, I've pretty much come to the conclusion I'm not going to do that anymore. [01:58:44.480 --> 01:58:47.480] Okay, we have some questions. [01:58:47.480 --> 01:58:50.480] The Office of Inspector General. [01:58:50.480 --> 01:58:54.480] The Bible remains the most popular book in the world. [01:58:54.480 --> 01:58:58.480] Yet countless readers are frustrated because they struggle to understand it.
