Margaret Moore, the Travis County District Attorney announced earlier [01:27.760 --> 01:32.400] this month that she was dismissing 32 felony possession and delivery of marijuana cases [01:32.400 --> 01:37.040] because of the law. Mr. Abbott and other state officials including the Attorney General stipulated [01:37.040 --> 01:42.080] in a letter to county district attorneys back on Thursday that marijuana has not been decriminalized [01:42.080 --> 01:48.000] in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, [01:48.000 --> 01:54.400] as well as other cities too like the District Attorney in El Paso, Kaima Esparza, a Democrat [01:54.400 --> 01:59.600] who also stated earlier this month that the law, quote, will not have an effect on the prosecution [01:59.600 --> 02:05.040] of marijuana cases in El Paso. However, the issue was succinctly summarized by Mr. Brandon Ball [02:05.040 --> 02:09.760] and assistant public defender in Harris County who stated that quote, the law is constantly [02:09.760 --> 02:14.160] changing on what makes something illegal based on its chemical makeup. It's important that if [02:14.160 --> 02:18.080] someone is charged with something, the test matches what they're charged with. [02:22.480 --> 02:27.840] A paper by Tulane University identified a five and a half inch American pocket shark as the first [02:27.840 --> 02:33.520] of its kind in the Gulf of Mexico, the specimen being only the second pocket shark ever captured [02:33.520 --> 02:39.360] or recorded with the other one being found way back in 1979 in the East Pacific Ocean. I'm a lot better than it was last week. I told my wife I was gonna die. [04:16.080 --> 04:22.960] And she didn't buy that story. She said the only way I would die if I kept annoying her. [04:26.320 --> 04:28.880] Anyways. That sounds more believable. [04:30.960 --> 04:38.480] I kind of got over it. I'm a real sissy when I give you all. But I still got a little issue with [04:38.480 --> 04:44.800] my throat. So I may have a few coughing fits. I'll try not to cough too much into the microphone. [04:44.800 --> 04:52.560] But Brett, you wanted to talk about how to prepare and file criminal complaints. [04:54.240 --> 05:00.480] Well, yeah, we have had a lot of people that were asking about the nitty gritty details. [05:00.480 --> 05:05.840] How do we file a criminal complaint? And people are understanding that they need to do that. [05:05.840 --> 05:11.040] They realize that, you know, they've been listening enough to understand that there's [05:11.040 --> 05:17.600] going to be a powerful effect if they will do it. And they realize that they're going to become a [05:17.600 --> 05:24.480] protected party. There's going to be some immunity as a witness to a crime. And they're all for it. [05:24.480 --> 05:32.880] They just don't quite know how. And it seems good if we will help people understand how to [05:32.880 --> 05:39.760] get that first step. We can handle that. Brett and I have been on a telegram site, [05:39.760 --> 05:47.600] Alphonse Figlio has a telegram site, and I have one. And we talk about these issues. And Alphonse [05:48.560 --> 05:56.880] does affidavits. And essentially, an affidavit is a statement of facts. [05:58.000 --> 06:03.840] Now, the way they do their affidavits is they embellish it a little bit with some legal opinion. [06:03.840 --> 06:12.560] But essentially, in order to write a criminal complaint, the first thing you need to do is put [06:12.560 --> 06:19.840] together a statement of facts. And you would do that in the form of an affidavit. This happened, [06:19.840 --> 06:28.640] and this happened, and this happened. And there's kind of an art to that. You don't tell every fact. [06:28.640 --> 06:34.480] If you're going to charge someone, say, with official misconduct, which in our case is the one [06:34.480 --> 06:42.880] we use the most, because it's kind of a catch-all. It says that if a public official acting under [06:42.880 --> 06:50.560] the color or pretense of an official capacity exerts or purports to exert an authority he [06:50.560 --> 06:57.520] does not express to have, or fails to perform a duty he's required to perform, and in the process [06:57.520 --> 07:02.960] denies a citizen for free access to or enjoyment of life. I just walked through the elements [07:03.680 --> 07:12.720] of the crime of official misconduct. All of those elements must be stated in terms of [07:14.800 --> 07:23.200] factual actions or behaviors on the part of the accused. The accused police officer [07:23.200 --> 07:36.000] arrested me for a crime that was not defined in the penal code as a crime. By that action, [07:37.440 --> 07:43.040] the officer exerted or purported to exert an authority he did not expressly have. [07:44.240 --> 07:51.040] And by physically confining me, he denied me the full free access or enjoyment [07:51.040 --> 07:53.520] of the right to be free from unlawful arrest. [07:56.560 --> 08:03.920] You have to state all of these elements, or you haven't stated a crime. It's the same thing. [08:03.920 --> 08:06.720] Let's talk to people about where they're going to get those elements. [08:09.360 --> 08:18.400] Best place to get them is the penal code. Read your codes. Especially if you're dealing [08:18.400 --> 08:26.240] on any kind of regular basis, public officials, if you're objecting to this mask issue, if you're [08:27.200 --> 08:32.720] having an issue with traffic, if you have any issue where they're messing with you very much, [08:33.600 --> 08:40.000] get the penal code out and read it. Just the first half. The second half gets into really [08:40.000 --> 08:45.920] less generic stuff we mostly don't care about. But in the front half, it has all of the standard [08:45.920 --> 08:52.800] criminal actions. It doesn't matter what state you're in. They're almost always the same. [08:53.760 --> 08:59.360] And I know I think I kind of make wet cringe when I say that, but if God created us, [09:00.560 --> 09:07.840] He created us horribly flawed. But He did it on purpose. If He made us perfect, what the heck [09:07.840 --> 09:17.120] would be the point? But He made us consistently flawed. If you're in the United States, if you're [09:17.120 --> 09:27.040] in Russia, Siberia, China, Taiwan, Singapore, penal code is almost exactly the same. [09:29.280 --> 09:34.320] I was in Australia. I read the New South Wales Grimes Act. It looked just like ours. [09:34.320 --> 09:41.520] The exact same issues. They formed them the exact same way except to do [09:42.080 --> 09:48.640] South Wales Crimes Act was a lot more inclusive than ours is. It just went into a lot more detail. [09:49.200 --> 09:54.000] All the same things were in there. Anything that you sit down and look at something and say, [09:54.800 --> 10:02.960] you know, that in a civil society, that should be illegal. And if you're a reasonable person [10:02.960 --> 10:08.240] of ordinary prudence, I can almost guarantee you it is illegal. There ought to be a law. [10:08.800 --> 10:18.240] There ought to be a law. And we in Texas have absolutely the best body of law I have ever [10:18.240 --> 10:27.280] seen in any state. California is next. But Texas is still a bit better. California has a little [10:27.280 --> 10:32.880] bit better grand jury, but it's so corrupt you can't get to it. But the law is there and that's [10:32.880 --> 10:38.800] what we use. We don't just get to say he's a dirty rotten scoundrel and he did this bad thing and he [10:38.800 --> 10:46.320] did that bad thing. I don't mean anything. You have to speak to it in the terms of the elements [10:46.320 --> 10:54.960] of the law. When I was in Johnson County recently, and I told the bailiff that I wanted the bailiff [10:54.960 --> 11:01.360] to arrest the district judge. Well, why would I arrest the district judge? Class A misdemeanor, [11:01.360 --> 11:07.520] official oppression, criminal violation, 39.03 penal code. In that, he failed to perform a duty. [11:07.520 --> 11:12.480] He was required to perform it in the process, denied me the full and free access to her enjoyment [11:12.480 --> 11:18.480] of a right. She said, don't give me all that legal jargon. I just need the elements. And I leaned [11:18.480 --> 11:28.320] over and said, I just gave you the elements. This is what we have to have when we make a criminal [11:28.320 --> 11:37.120] complaint, the elements. Best if you've read the codes first. Because that way you make sure you get [11:37.680 --> 11:44.720] the party on the other side to touch on all the elements. I know you've heard my stories about [11:44.720 --> 11:52.000] asking a policeman. I said, I see you're wearing a pistol. And they said, yes, I am. Tell me, [11:52.000 --> 11:59.280] is that pistol loaded? Yes, it is. Are you fixing to pull that pistol on me? I will if I have to. [11:59.280 --> 12:03.680] Well, what I'm doing is setting up the elements of aggravated assault. [12:03.680 --> 12:14.480] They don't get it. And I don't know of an explanation. But I know what those elements are. [12:15.840 --> 12:22.160] So I ask them for the elements. And they're always very accommodating. And they'll give [12:22.160 --> 12:28.400] them to me. So read the code. Read it twice. Just read it. The first half of it, just read [12:28.400 --> 12:34.800] it through. Don't even bother to try to understand it. Then go back and read it a second time. You [12:34.800 --> 12:41.760] will know the codes better than the prosecutors and the police officers do. And when I have a [12:41.760 --> 12:47.680] conversation on the air with someone who's read the codes, we have some really interesting and [12:47.680 --> 12:53.840] in-depth conversations. So if you want to be good at this, start out by reading the code. [12:53.840 --> 12:59.280] Once you guys code read, then whenever you have an interaction where you believe that a public [12:59.280 --> 13:08.480] official has done something illegal, if you don't have it recorded, then even if you do [13:08.480 --> 13:14.160] have it recorded, when you walk away from this interaction, go sit down somewhere, take out [13:14.160 --> 13:22.240] a pen and paper, and write down what happened. You can type it into your computer, but that's [13:22.240 --> 13:32.240] not as visceral as writing it down. Now you've got hand, eye, brain all working together. You [13:32.240 --> 13:41.520] solidify it. Get a statement. Just what happened? No arguments, no explanations. Does this happen? [13:41.520 --> 13:47.440] This happened? This happened? This happened? Before you lose anything, because especially [13:47.440 --> 13:52.320] in an emotionally charged circumstance, you will start losing stuff very quickly. [13:53.920 --> 14:00.240] When you come down out of the emotional state, you tend not to remember a lot that went on in [14:00.240 --> 14:08.160] the emotional state. A lot of times memory is state related. So when you're really cranked up, [14:08.160 --> 14:14.480] you're having these experience in a really cranked up state. You drop down from that and calm down, [14:14.480 --> 14:21.360] then you shift to another state and those memories don't always lock in. So you need to write them [14:21.360 --> 14:28.800] down. Write you down a statement of everything that happened. Then go pull the code out and go [14:28.800 --> 14:38.080] down the code. What are the elements of the code? Now you write and affidavit. On this day at this [14:38.080 --> 14:47.200] time, I was at whatever place you were. You want date, time, place, what you did, what the officer [14:47.200 --> 14:59.920] did. You don't argue. You don't say the officer acted belligerently. You avoid putting in descriptions. [15:02.320 --> 15:06.720] There's an art to a statement of facts. You don't say that he unlawfully did this [15:06.720 --> 15:13.440] and you don't use some term that in itself involves other things that would have to be explained. [15:14.960 --> 15:22.320] He did this without cause. Well, you better have a way to say that there was no cause or you have [15:22.320 --> 15:31.680] to say that or if you say that he did battery or he battered me, don't try to use a word that you [15:31.680 --> 15:38.080] don't know what else is going to go into it. It would be better to say he gave me a whack upside [15:38.080 --> 15:47.040] the head. Now that's saying the same thing. The thing about statement of facts being an art form [15:48.400 --> 15:56.240] is you want to craft your facts so that your reader will come to those conclusions himself. [15:56.240 --> 16:07.520] If you feed your reader the conclusions, they tend to resist that or they tend to feel, [16:09.680 --> 16:15.760] what's the term Brett, like you think they're not smart enough to figure that out. [16:18.240 --> 16:25.200] Craft your facts that you give in a way that would have caused a reasonable person of ordinary [16:25.200 --> 16:32.720] prudence to put those facts in it together in a way to say, this guy acted improper. This guy was [16:32.720 --> 16:37.280] out of line. Don't tell him he was out of line. Give him facts that indicate he was out of line. [16:38.160 --> 16:42.400] If I say it, it can be a lie. You craft your statement of facts to get your listener or reader [20:18.000 --> 20:25.840] to come to the conclusions that you want them to come to and in the process of doing that you can [20:25.840 --> 20:33.840] say the officer did this he did that and okay I didn't say that right. Do your statement of [20:33.840 --> 20:40.800] facts and when you finish your statement of facts then you say based on the above the officer violated [20:42.960 --> 20:51.440] committed this crime in violation of this statute and in textual this crime you say the words like [20:51.440 --> 20:58.880] official oppression and this statute you would say Texas penal code section 39.03. [21:00.720 --> 21:07.920] And then in Texas and you can do this in any state it won't be harmful but it's a good terminator [21:08.720 --> 21:14.240] against the peace and dignity of the state. I'd say the state of Texas I just did something this [21:14.240 --> 21:23.360] morning against the peace and dignity of the state of North Carolina. Now a preface Texas in my [21:23.360 --> 21:33.920] opinion has the best structure. Most states don't really have any requirements as to how a complaint [21:33.920 --> 21:43.600] should be structured but in Texas the law says that a criminal complaint must run in the name [21:43.600 --> 21:49.600] and authority of the state of Texas. So every complaint in Texas starts with in the name and [21:49.600 --> 21:57.760] under the authority of the state of Texas and then it has a required sentence. You must have [21:57.760 --> 22:08.000] reason to believe and do believe. One of the others not enough. So my first sentence is [22:08.000 --> 22:17.760] I have reason to believe and do believe that so-and-so committed this crime based on the following [22:18.960 --> 22:25.680] and then I do my statement of facts and when I finish the statement of facts then I reiterate it. [22:25.680 --> 22:31.200] I haven't been doing that before and I've started shifting dearest so I tell them what I'm going [22:31.200 --> 22:41.520] to charge him with at the very beginning. Now I give him a set of facts and now they will evaluate [22:41.520 --> 22:51.840] those facts to see how I came to the charge that I indicated. So the reader will say okay [22:53.360 --> 22:58.880] this officer committed official oppression as follows. Now the reader is going to try to [22:58.880 --> 23:06.640] stitch my facts together to support a claim of official oppression. So that's you don't want to [23:07.760 --> 23:16.080] give put in their determinations for them. You give them the facts and let them come to the [23:16.080 --> 23:21.840] conclusions and if you already told them where you're trying to go they will try to stitch the [23:21.840 --> 23:29.760] facts together in a way to get to the place that you're trying to get them to and then you close with [23:29.760 --> 23:36.720] based on the above I charge that so-and-so committed this crime in violation of this [23:36.720 --> 23:43.520] statute against peace and dignity of the state boom that will fly in any state of the union. [23:43.520 --> 23:54.560] But form and structure is not critical to a criminal complaint. One thing is criminal [23:55.600 --> 24:01.440] and I think I didn't tell you at the beginning when you start your criminal complaint you say [24:01.440 --> 24:12.880] only before this date and before the filing of this complaint so-and-so did all this stuff. [24:15.040 --> 24:22.160] In Texas, if you don't put the location in there it won't trigger their territorial jurisdiction [24:22.160 --> 24:31.920] and they won't know where it belongs. Yeah in the county of almost all crimes will be county [24:31.920 --> 24:41.600] jurisdictions in the state of Texas county of but on or before if you get the if you screw up the date [24:41.600 --> 24:51.840] and if you say on or before November 10th 2021 instead of 2020 that's the one thing that can't [24:51.840 --> 25:01.040] be fixed. You can't correct that the complaint is trash. Anything else in the complaint you can [25:01.040 --> 25:07.520] correct but if you accuse someone of committing a crime before they committed it the complaint is [25:07.520 --> 25:17.200] the complaint is trash but other than that there really are no restrictions on how to build one. [25:18.400 --> 25:27.760] You merely need to give the magistrate notice that you have reason to believe a crime had been [25:27.760 --> 25:39.600] committed and give the magistrate enough assertions of fact so that they can find that a crime has [25:39.600 --> 25:47.360] been committed and there is reason to believe this person committed that crime and if you do [25:47.360 --> 25:54.640] that with a statement of facts and then you have to make the allegation at the end you assert [25:54.640 --> 25:59.600] that you have reason to believe and do believe based on this that this person committed this crime [26:00.240 --> 26:08.160] and the violation of this statute and that's it. A complaint is intended to be [26:09.200 --> 26:19.280] filed by a citizen not learning counsel so it's not critical as to form otherwise than that day [26:19.280 --> 26:24.080] other than that date issue even in Texas if it doesn't run in the name of the state of Texas [26:24.080 --> 26:30.400] don't make any difference they'll fix it because when you give a complaint to a prosecutor in [26:30.400 --> 26:37.440] every state the prosecutor is required to reduce the complaint to an information. If you want to [26:37.440 --> 26:45.280] know in your state how a complaint should be structured go into some criminal cases and [26:45.280 --> 26:54.880] look at the information. An information is a criminal complaint in proper form so just build [26:54.880 --> 27:00.320] your complaint just like that is and change from information to complaint you got one. [27:00.320 --> 27:12.000] That's the easy part or actually that's the work part from there it starts to get into the fun part. [27:15.600 --> 27:22.320] From there you want to take your complaint to some magistrate now some states you don't get to do [27:22.320 --> 27:30.880] that like Pennsylvania. Pennsylvania you're required to give it to the prosecuting attorney [27:31.520 --> 27:38.720] and the prosecuting attorney has first plus he can make a determination as to whether or not [27:38.720 --> 27:41.600] he believes there's sufficient evidence to believe crimes have been committed. [27:44.080 --> 27:50.480] Well that sounds like a problem because it bypasses magistrates and all this other [27:50.480 --> 27:58.560] stuff we talk about but they have compensation. In most other states you have a duty to give [27:58.560 --> 28:06.560] notice of crime but we no longer have private prosecutions so the prosecutor the state prosecutor [28:06.560 --> 28:15.040] has been given exclusive prosecutorial power that means you have no standing you have a duty to give [28:15.040 --> 28:21.120] notice but what they do after that technically is not any of your business it is and we'll get to [28:21.120 --> 28:27.200] that in a little bit but in Pennsylvania where you're you don't give it to a magistrate but give [28:27.200 --> 28:33.280] it to a prosecutor you have standing if the prosecutor decides not to prosecute you can [28:33.280 --> 28:41.200] appeal his decision to the court of common please to the district court all the way up to the [28:41.200 --> 28:46.960] Pennsylvania Supreme. I had a friend in Pennsylvania just south of Harrisburg [28:48.240 --> 28:56.560] appeal a traffic ticket all the way to the Pennsylvania Supreme and they sent him back [28:56.560 --> 29:03.120] a 36 page brief in support of why they were denying his appeal. Now we get to the good part, [34:12.800 --> 34:17.520] you make up your criminal complaint and depending on what state you're in, [34:18.720 --> 34:26.000] most states you would take it to some magistrate. In Tennessee, if your complaint is against a [34:26.720 --> 34:31.360] public official, you cannot give your complaint to a public official. [34:31.360 --> 34:41.200] You must give it to the foreman of the grand jury with two members of the grand jury present. [34:43.120 --> 34:49.120] Is that cool or what? I think every state should have that. [34:50.720 --> 34:55.200] If you're in Tennessee and a citizen follows a complaint against you, [34:55.200 --> 35:04.560] it is absolutely going to the grand jury. Period. Now they might not indict, [35:06.400 --> 35:11.760] but you got to run that risk now. We had a caller calling in. His next door neighbor he had been [35:11.760 --> 35:18.240] feuding with for 20 years. He ran for office, got elected as constable and this guy was really [35:18.240 --> 35:25.440] worried about him. As soon as he got elected, he pulled this guy over and harassed him big time, [35:25.440 --> 35:32.560] but he hadn't been sworn in yet. So he went to the grand jury with criminal complaints against him [35:33.920 --> 35:45.120] and they stripped him of his position. Got him. So that's in Tennessee. I haven't looked at every [35:45.120 --> 35:50.640] state, but the vast majority of the states, you would take your complaint to some magistrate. [35:51.600 --> 36:00.560] And I'm going to suggest a strategy, a procedure. You go find some municipal judge or mayor, [36:01.600 --> 36:08.800] you know, all mayors are magistrates or justice to the peace. You take your complaint to one of them [36:08.800 --> 36:15.360] and the magistrate is going to say that the mayor is going to say, Oh, I don't know what this is. [36:15.360 --> 36:22.720] I don't do that. You need to take this to the police department. And you say, Oh, wow. Thank you [36:22.720 --> 36:29.200] very much, your honor, for that sage advice. And then you go to the police department and you [36:29.200 --> 36:37.840] file criminal charges against the mayor for not doing his job as a magistrate. Now don't sit there and [36:37.840 --> 36:49.520] instruct the mayor on his duties. Don't give free legal advice. Don't give legal advice at all. [36:51.120 --> 36:56.000] Don't tell them, Oh, boy, God, I got this right. I got that right. You're supposed to do this. [36:56.000 --> 37:02.000] You're supposed to do that. They're going to call you agitated. Don't give them legal advice. [37:02.000 --> 37:08.720] Bushwack is so much better. Oh, thank you for that sage advice. Your honor, go to the share [37:08.720 --> 37:12.240] the police department file criminal charges against the mayor. [37:15.280 --> 37:21.360] And then when the police department, they're going to tell you, Oh, you need to give that to [37:21.360 --> 37:27.040] the prosecuting attorney. Oh, wow. Well, thank you very much. What did you say your name was? [37:27.040 --> 37:32.320] And guess what you do when you go to the prosecuting attorney? [37:33.920 --> 37:41.120] They're on top. Yep. He touched it. He stuck to it. So he filed against the police officer for [37:41.120 --> 37:48.400] not taking your complaint against the mayor for not taking your complaint against the original [37:48.400 --> 37:54.480] perpetrator. By this time, it doesn't matter what the original complaint was about. [37:54.480 --> 38:01.760] Now you got public officials committing official misconduct. It's called official misconduct in [38:01.760 --> 38:10.240] most states. In Texas, it's called official oppression. If a public official exerts a [38:10.240 --> 38:18.400] proportion to exert an authority does not express it have or fails to perform a duty he is required [38:18.400 --> 38:24.000] to perform. And in the process, not as you in the full and free access to your enjoyment of your [38:24.000 --> 38:31.520] right to the due course of the laws. Well, that's crime in most every state without regard to the [38:31.520 --> 38:39.280] original complaint, whether it was sufficient, insufficient, irrelevant. Now you started up the [38:39.280 --> 38:48.320] chain. I did it backwards recently. Most of your listeners know I filed a criminal complaint against [38:48.320 --> 38:58.560] governor. And he thought I was after him. I was just setting him up. I took that I filed that [38:58.560 --> 39:04.960] complaint with the governor on the 8th of October. On the 9th of October, I forwarded that complaint [39:05.520 --> 39:13.440] to the Chief Justice of the Texas Supreme in his capacity as a magistrate. Article 2.09, [39:13.440 --> 39:24.560] Texas Code of Criminal Procedure, titled Who Are Magistrates? First one, Justices of the Supreme [39:24.560 --> 39:33.120] Court. Okay, Bubba, Mr. Highest Level Judge in Texas. I argued that since I was filing against the [39:33.120 --> 39:40.080] highest executive officer in the state of Texas, it was appropriate that I filed a complaint with [39:40.080 --> 39:46.080] the highest judicial officer in the state of Texas. Well, he didn't seem to buy that reasoning [39:46.800 --> 39:54.160] and failed to hold the examining trial. So I went to the presiding judge of the Court of Criminal [39:54.160 --> 40:01.120] Appeals and filed against the Chief Justice for not holding the examining trial on the [40:01.120 --> 40:12.400] governor. Now, imagine you're sitting in a grand jury listening to this. See, here's [40:12.400 --> 40:21.280] what the code says you must do. And here you have the highest level judge in the state of Texas [40:21.280 --> 40:31.120] justices, ignoring that very clearly written legal stipulation. How are you going to walk through, [40:31.120 --> 40:37.520] how are you going to rationally walk around that? And then you go to the next highest judge [40:37.520 --> 40:43.200] and he refuses. And then you go to the county you live in and file with the district judge there [40:43.200 --> 40:52.400] and wind up getting arrested. Well, those two jumps didn't know what I had in my hand [40:54.720 --> 41:02.240] since they arrested me in Wise County to prevent me from filing criminal complaints against [41:02.240 --> 41:11.520] these two judges in Travis County, which this is the case in Texas and every other state I've [41:11.520 --> 41:20.640] looked at. It is intended that if a sheriff or police officer arrests someone for any reason, [41:21.360 --> 41:29.520] they are to take them directly to the nearest magistrate. So if you committed a crime in El Paso [41:30.720 --> 41:35.360] and a policeman arrests you for that crime in say Denison, [41:35.360 --> 41:44.640] he doesn't take you to a magistrate in El Paso. He takes you to the nearest magistrate and under [41:44.640 --> 41:53.840] Attorney General opinion JM 500, it states that any magistrate may take any complaint [41:53.840 --> 42:01.040] felony or misdemeanor state or federal. He can hold an examining trial even on federal charges, [42:01.040 --> 42:07.200] make a determination a problem cause and then forward the complaint to the clerk of the court [42:07.200 --> 42:15.040] that would have original jurisdiction. That's easy enough and that's going to be consistent in every [42:15.040 --> 42:22.160] state. In every state you have magistrates spread around the county during the form of justices [42:22.160 --> 42:29.440] of the peace. All the other judges are grouped in the courthouse but magistrates at JPs are spread [42:29.440 --> 42:34.400] around the county. The reason they're spread around the county is they wanted a magistrate [42:34.400 --> 42:40.560] within a day's ride of any point in the county. Policemen couldn't arrest you and take you to [42:40.560 --> 42:45.120] jail. They had to arrest you and take you to the magistrate and the magistrate would examine [42:45.120 --> 42:50.640] into the sufficiency of the allegation and determine whether or not you had to stand and answer. [42:51.360 --> 42:57.600] If he didn't find a problem cause, he sent you home. So how do we handle that? [42:57.600 --> 43:05.440] How do we help people know how to actually write that complaint? The complaint that gets in the [43:05.440 --> 43:11.920] front. Like what language are they going to use? First step, baby steps. First step, this happened [43:11.920 --> 43:17.440] and this happened and this happened. You're talking to a lot of times people are going to [43:17.440 --> 43:25.760] write about what they felt like during that time and they are how... We suggest against that but [43:25.760 --> 43:32.320] it really at the end of the day doesn't hurt because you're not writing this to a judge. You're [43:32.320 --> 43:42.320] not writing this to the court. You're writing this to a trial of fact to give him enough information [43:42.320 --> 43:46.720] to have reason to believe that a crime was committed and that this person committed it [43:46.720 --> 43:53.360] and you're not expected to be a professional. So it's really loose on how you actually have [43:53.360 --> 43:58.160] to write them. We'll touch on this a little more when we get back. We'll be right there. Now the officer has got to come up with a really good reason for whacking [47:31.200 --> 47:38.720] you upside the head with a pistol. And that's all this is about, convincing a magistrate [47:38.720 --> 47:45.280] that there's reason to believe a crime has been committed and this guy committed it. They expect [47:45.280 --> 47:52.480] complaints to be written by ordinary people, not by lawyers. That's the reason in every state, [47:54.080 --> 47:59.440] the lawyer is commanded to take the complaint and reduce it to an information [48:00.560 --> 48:06.560] because they don't expect it to be improper form. And then the lawyer will convert it to proper form. [48:06.560 --> 48:12.960] So at the end of the day, it can make any difference. Just write what you need to to convince [48:12.960 --> 48:18.640] the magistrate that a crime has been committed and this guy committed. Does that make sense for it? And also, we had some news [52:32.320 --> 52:38.160] press on Kailaday AM saying that we were suspending in Travis County, Austin, Texas, [52:39.440 --> 52:45.040] jury trials. Jury trials were going to be suspended last week. And also in the morning, [52:45.040 --> 52:50.640] somebody, a defense attorney, a criminal attorney, said his client has been sitting for 18 months. [52:51.360 --> 52:57.520] I know you threw out my word quite strong. What do I do? Do I go to the state attorney [52:57.520 --> 53:07.200] or do I try to get that defense attorney to do it? I'm thinking you might consider going to our [53:07.200 --> 53:15.520] Republican attorney general and ask the Republican attorney general to [53:17.840 --> 53:25.920] get a district judge to initiate a court of inquiry for the purpose of examining into [53:25.920 --> 53:36.800] a quarantine action against the district attorney. We did not pay him to decide he didn't want to do [53:36.800 --> 53:48.000] his job. If you don't want to prosecute crimes against citizens of the state of Texas, well, [53:48.000 --> 53:53.200] we'll just quarantine your butt to the curb and get someone in there who will do what they're [53:53.200 --> 54:06.080] paying to do. It's all politics. What is a core warranty? A core warranty is an action to remove [54:06.080 --> 54:13.520] a public official from office for cause. And that generally is only authorized by a prosecuting [54:13.520 --> 54:25.280] attorney. Well, it used to be that the only actions the attorney general in Texas had a [54:25.280 --> 54:32.240] regional jurisdiction in was an open records request against a prosecuting attorney. But a few [54:32.240 --> 54:39.760] years ago, they changed the code so that in the matter of a criminal complaint against a public [54:39.760 --> 54:46.560] official, the attorney general has concurrent jurisdiction with the district attorney. So [54:46.560 --> 54:53.920] that means if the district attorney is the perpetrator, then the attorney general has jurisdiction [54:53.920 --> 55:02.640] to step in and take on the district attorney and get him bumped to the curb. And my allegation [55:02.640 --> 55:13.360] is that he's not doing his job because he... Misfeasance in office. Okay. Misfeasance is where [55:13.360 --> 55:18.800] a public official fails to perform a duty he's required to perform and in the process denies [55:18.800 --> 55:25.920] everybody in their right to vehicle protection of the laws. He doesn't have authority to do that. [55:26.720 --> 55:32.000] If you come to work for me and I pay you, you don't get to tell me, well, [55:32.000 --> 55:39.760] I don't want to do what you paid me to do. How does that work? This week, the police union [55:39.760 --> 55:47.040] decided they were going to go after the DA. So everyone started to get mad. They waited to [55:47.040 --> 55:53.680] prosecute somebody who was defending himself from an armed rider in the middle of the night [55:53.680 --> 56:00.320] at downtown Austin as he was driving over. They didn't prosecute him for months waiting for Jose [56:00.320 --> 56:08.000] Garza to take seats to prosecute. This sergeant who was driving Uber and some armed radical [56:08.000 --> 56:14.960] and white man put a... They changed something in his face, white, the second time the man [56:14.960 --> 56:21.040] defended himself in his Uber car. And they kept him until his new DA got seated. We're going to make this quick and just let me see your ID. I gave him my ID and [01:36:58.640 --> 01:37:05.120] all that because I wanted to do my business and get on with my life. I gave him my ID [01:37:05.120 --> 01:37:14.800] and I sat there for about 15 minutes and backup came up from St. John's area, [01:37:14.800 --> 01:37:20.800] so I knew they drove a ways to get there. Anyway, they did a felony stop on me and I'm like, [01:37:20.800 --> 01:37:25.680] I know what a felony stop is. It's when they have you step backwards, walk to their voice, [01:37:25.680 --> 01:37:29.600] and they put their hands on your head and then you're supposed to hit or lock you, [01:37:29.600 --> 01:37:33.840] get on your knees. Anyway, all that stuff. I said, hey, guys, you guys are making a mistake. [01:37:33.840 --> 01:37:39.040] There's no way I have a fugitive from justice felony warrant. You guys are making a mistake. [01:37:39.840 --> 01:37:45.360] But anyway, it turns out that it was out of Colorado. I was supposed to go to trial on a [01:37:45.360 --> 01:37:54.720] misdemeanor, no license, and expired tags. I mean, not tags, expired registration. [01:37:55.840 --> 01:38:02.080] Right. I was fighting it and telling them, hey, I'm a traveler. I'm not in the driving program. [01:38:02.080 --> 01:38:13.680] I'm not for hire. I'm not in commerce or any of that stuff. But anyway, I left Colorado. [01:38:14.640 --> 01:38:21.360] I told the DA, the district attorney and his secretary that I was leaving. I called them [01:38:21.360 --> 01:38:33.760] right at, because I got the ticket in April of 2020. And then right after Christmas 2020, I called the [01:38:34.480 --> 01:38:40.080] DA and the secretary and said, hey, I'm leaving for my property to develop my property. And if you [01:38:40.080 --> 01:38:45.200] guys haven't got this wrapped up and we haven't gone to trial, I'm just leaving. I'm not going to [01:38:45.200 --> 01:38:50.720] let you guys hold up my life because you haven't gotten it in gear or whatever. And so I did. I [01:38:50.720 --> 01:38:57.520] left, came out here in February 20th, just like I told the secretary and the prosecutors that I was [01:38:57.520 --> 01:39:05.600] leaving. And so it took a couple of months for them to put the warrant out, the fugitive from [01:39:05.600 --> 01:39:13.680] justice warrant. And so anyways, to make a long story short, they... Yeah, yeah, make it a little [01:39:13.680 --> 01:39:23.120] bit shorter. Yeah, they towed my car and took me to jail. I spent 36 hours in jail. And I saw a [01:39:23.120 --> 01:39:30.640] magistrate after about 34 hours and told her my story and that I don't think that the prosecutor [01:39:30.640 --> 01:39:38.320] has any right or the judge has any right to put a state-wide... I mean, a neighboring state warrant, [01:39:38.320 --> 01:39:46.720] a fugitive of justice felony warrant for a misdemeanor. And so, I mean, do I have a good case? [01:39:46.720 --> 01:39:52.480] Do I have a case for their misconduct, judicial misconduct? And then... Okay, what happened with [01:39:52.480 --> 01:40:02.880] the magistrate in Arizona? Oh, yeah, when I was in St. John's jail, I told her the story, the whole [01:40:02.880 --> 01:40:11.200] story. I just told you guys. And she says, yeah, that doesn't sound right. And she didn't say she [01:40:11.200 --> 01:40:19.840] was going to let me out or anything like that. But it was just a few hours later, the guard came [01:40:19.840 --> 01:40:23.520] up and says, yeah, you're getting out of here. They're kicking you out and they're dropping the [01:40:23.520 --> 01:40:30.080] whole thing. And so, yeah, they did all this, felony fugitive of justice, felony warrant, [01:40:30.080 --> 01:40:38.320] had me arrested at gunpoint. I spent 36 hours in lockup. My car's still gone. I still don't have [01:40:38.320 --> 01:40:45.120] my car right now. And I can't get water because I'm living off grid. Now, I can't get water now [01:40:45.120 --> 01:40:54.000] because my car's gone. Okay. You originally called me about this, what, how long ago? [01:40:54.000 --> 01:41:02.400] Oh, about three weeks or something. Okay. Right after it happened. What have you done with the [01:41:02.400 --> 01:41:12.160] Colorado people? I haven't found out. I haven't actually tried to call Montezuma County, which [01:41:12.160 --> 01:41:21.840] is where I... Here's the deal. If you're going to take up this fight, you need to be ready to have [01:41:21.840 --> 01:41:31.200] this fight. If you took those plates off your car to have this fight, and then you're not taking care [01:41:31.200 --> 01:41:39.600] of business, this is not a way to address this issue.
