[01:05.760 --> 01:10.440] Since Governor Greg Abbott signed House Bill 1325 legalizing Hemp and attacks his law back [01:10.440 --> 01:15.000] in June, county prosecutors around the state including Houston, Austin and San Antonio [01:15.000 --> 01:19.120] have been dropping marijuana possession charges and even refusing to file new ones since they [01:19.120 --> 01:23.200] are stipulating that they do not have the time or the lavatory equipment to test the [01:23.200 --> 01:27.920] or for THC. Margaret Moore, the Travis County District Attorney announced earlier this [01:27.920 --> 01:32.880] month that she was dismissing 32 felony possession and delivery of marijuana cases because of [01:32.880 --> 01:33.880] the law. [01:33.880 --> 01:37.600] Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter [01:37.600 --> 01:42.080] to county district attorneys back on Thursday that marijuana has not been decriminalized [01:42.080 --> 01:48.240] in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works as [01:48.240 --> 01:54.480] well as other cities too like the District Attorney in El Paso, Cayma Esparza, a Democrat [01:54.480 --> 01:58.960] who also stated earlier this month that the law, quote, will not have an effect on the [01:58.960 --> 02:01.840] prosecution of marijuana cases in El Paso. [02:01.840 --> 02:06.760] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender [02:06.760 --> 02:10.760] in Harris County who stated that, quote, the law is constantly changing on what makes [02:10.760 --> 02:13.480] something illegal based on its chemical makeup. [02:13.480 --> 02:17.360] It's important that if someone is charged with something, the test matches what they're [02:17.360 --> 02:22.600] charged with. [02:22.600 --> 02:27.200] A paper by Tulane University identified a five and a half inch American pocket shark [02:27.200 --> 02:32.320] as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket [02:32.320 --> 02:38.000] shark ever captured or recorded with the other one being found way back in 1979 in the East [02:38.000 --> 02:39.000] Pacific Ocean. [05:45.320 --> 05:52.480] Brett, if you've been listening to the show a long time, you've heard a lot of Wood County and [05:52.480 --> 05:58.280] Brett has some cock-a-doodle-doing to do. Oh, I don't know. Hey, get away. [05:58.280 --> 06:05.360] Hey, Brett. Randy sounds, he seems really convinced that it's something I did. I don't know, [06:05.360 --> 06:12.920] it was sitting quiet for a really long time. This is something that started back in 2018. [06:12.920 --> 06:22.960] And I beat them up really good. They started in the city. And the municipality, they had about [06:22.960 --> 06:31.600] eight months of me calling them on their lawlessness and they decided to just dismiss the case. In [06:31.600 --> 06:39.360] the process, they lost their city prosecutor. The whole law firm that the city prosecutor worked [06:39.360 --> 06:48.560] for, they ended up switching out to get a different law firm. And the second law firm that [06:48.560 --> 06:55.520] took... How many bar grievances, how many grievances did you put on the first one? [06:55.520 --> 07:04.480] The first guy, I think he only got two, got three. The first law, they're pretty quick. [07:04.480 --> 07:11.800] The law firm, let's see, I think there were two partners of that firm. And so they both got a few [07:11.800 --> 07:22.240] each. And they disappeared. The whole law firm disappeared, I mean. And it seems like there [07:22.240 --> 07:29.120] was, oh, I know what, there was a... I had just happened to have already bar grieved one of those [07:29.120 --> 07:34.520] partners before because I was helping out somebody in a different city and I got his traffic ticket [07:34.520 --> 07:40.920] dismissed. But in the process, I had needed to bar grieve that lawyer in that other city. [07:40.920 --> 07:48.720] Well, it just turns out that the law firm was serving more than one city. That happens often. [07:48.720 --> 07:56.000] You know, you'll have one law firm that they serve as city attorney for multiple cities. Well, [07:56.000 --> 08:04.080] it just turns out, it just happens that when I got this traffic ticket out in East Texas, [08:04.080 --> 08:13.200] the partner of that law firm was the city attorney of that other city. So he didn't need to get [08:13.200 --> 08:21.840] bargeried very much. And so, yeah, another one came in the law firm. I think they were called [08:21.840 --> 08:29.920] Flowers Davis and they got a few bar grievances. It didn't take very many. And they dismissed the [08:29.920 --> 08:37.400] case. Everything was over. And what do you know? A few months after that, I think it's about four [08:37.400 --> 08:45.800] months, the county decided to pick it up. And then they probably wished they hadn't because I was [08:45.800 --> 08:54.280] very diligent at just tirelessly holding them accountable. Criminal complaints and bar grievances, [08:54.280 --> 09:01.720] judicial misconduct complaints, and a motion for disqualification of the prosecutor and for [09:01.720 --> 09:07.280] the judge. And it just went on from there. And then when they would try to have a hearing for [09:07.280 --> 09:15.360] disqualification of a judge, well, I'm sorry, but you can't have that judge hold the hearing because, [09:15.360 --> 09:20.720] yeah, I remember that judge. I've got a criminal complaint that I've already filed against him. [09:20.720 --> 09:26.080] Yeah, it looks like I've called him out on a felony before. Oh, see if you can get yourself [09:26.080 --> 09:36.400] another judge. And they went on, they went up, let's say you had the trial judge, two admin judges, [09:36.400 --> 09:43.080] and then a senior justice. And then it went to the Supreme Court, the Texas Supreme. And I just, [09:43.080 --> 09:49.640] I wrote in one of my documents, I was asking for a petition for mandamus. And I wrote that it's [09:49.640 --> 09:58.520] really not my fault that you haven't yet been able to find a judge whose crimes I haven't reported. [09:58.520 --> 10:11.360] That's not my fault. I've done my civic duty and you just need to find the judge. Well, [10:11.360 --> 10:22.760] it sat there because I asked for them to, I asked for the Texas Supreme to address the issues with [10:22.760 --> 10:30.840] the outstanding criminal charges against all these judges and address the motions for disqualification [10:30.840 --> 10:37.240] before they go back and try to address the merits. Well, obviously that's what they have to do, [10:37.240 --> 10:43.200] but I just put it in writing. I didn't really do anything special. It's obvious. And it sat there [10:43.200 --> 10:54.600] for, let's see, January 2020 until now, that's 18 months. It's just been doing nothing. And I was [10:54.600 --> 11:02.920] just, July 1st, I was writing a document. I started drafting up something that was just [11:02.920 --> 11:10.520] complaining and like you say, railing righteous indignation. I was writing up a document to just [11:10.520 --> 11:15.080] give them what for. You're still holding this over my head for that, what, you alleged that I had a [11:15.080 --> 11:19.160] flaky headlight and it just went from there and ballooned into all of this mess and you're still [11:19.160 --> 11:30.600] holding onto it. Come on. But before I could finish my draft, I got a letter in the mail. And this [11:30.600 --> 11:40.680] letter showed up on Tuesday afternoon, just a few days ago, and it wasn't signed. But it looked [11:41.560 --> 11:47.080] like it was supposed to be a summons. And it said it wanted me to come show up for an [11:47.080 --> 11:53.720] arraignment hearing. And I said, well, that's interesting, an arraignment hearing. Now, [11:53.720 --> 12:03.400] how can they have an arraignment hearing after I've already filed an answer to the charges? [12:03.400 --> 12:08.600] Not just a plea, but an answer. We're way down the line. You want to start at what? You want to go [12:08.600 --> 12:15.240] back to arraignment? So I checked on it to see, maybe they changed the number. You know, sometimes [12:15.240 --> 12:19.640] they'll throw out a case and start a new case with a different number to try to get rid of all [12:19.640 --> 12:25.560] of your pleadings. Well, no, the number was the same. So I said, well, this is the same thing. [12:25.560 --> 12:31.640] They are trying to revive this same thing and pretend like they're starting over. But wait, [12:31.640 --> 12:40.440] the judge has a pending judicial disqualification. And she's not allowed to issue any orders [12:41.080 --> 12:48.120] or have any hearings, any kind of proceedings at all while she's got her judicial disqualification [12:48.120 --> 12:57.560] pending. And wait a second. She's also, this is not court term time. That particular court has [12:58.680 --> 13:06.920] four times of the year where they have three week terms. And we're outside of all of those right [13:06.920 --> 13:12.040] now. They won't be starting the next one until the first Monday of August. What are they doing [13:12.040 --> 13:20.120] holding hearings when it's not even term time? And wait a second. This issue is, has a steady of [13:20.120 --> 13:28.760] proceedings for the Texas Supreme Court. What does she think she's doing? And hold on a second. [13:29.400 --> 13:35.080] Also, we've got threshold issues before the court. Subject matter jurisdiction has been [13:35.080 --> 13:40.680] challenged and they haven't dealt with it yet. That was something they were supposed to deal with [13:40.680 --> 13:50.280] in January 2020. And they actually scheduled up a hearing for it. But then all this disqualification [13:50.280 --> 13:54.840] stuff caught up to them and they didn't actually end up dealing with it. So that would be the last [13:54.840 --> 13:59.320] thing that they were going to deal with. So the first thing they need to deal with is the threshold [13:59.320 --> 14:05.800] issues. I've got one is for the, excuse me, the subject matter jurisdiction of the court. And the [14:05.800 --> 14:15.480] other is for improper venue. That's not the right court to hear this in. And of course, [14:15.480 --> 14:19.480] venue depends on jurisdiction. So if you don't, if they don't have jurisdiction, then it's not [14:19.480 --> 14:25.000] the right court. So they've got those issues they need to handle first. And they've got a whole [14:25.000 --> 14:33.880] pile of dispositive motions. One reason after another, I think I was up to 900 documents or any [14:33.880 --> 14:43.320] thing that these people are going to have to flip through all of these dispositive motions of why [14:43.880 --> 14:51.240] this should be dismissed. And they want to start right now with an arraignment. So I got this on [14:51.240 --> 14:59.080] Tuesday afternoon and I said, hmm, that's very interesting. And I emailed on, I was trying to [14:59.080 --> 15:04.440] think, do I write up a whole bunch of new criminal complaints? What do I do with this? And you [15:04.440 --> 15:10.840] suggested, well, just ask them for clarification. So I think you also asked them to move for [15:10.840 --> 15:14.760] continuance, but I didn't really feel comfortable about that because I've been whining a lot about [15:14.760 --> 15:19.160] speedy trials. So I didn't say anything about continuance. I just asked them for clarification. [15:19.160 --> 15:24.520] And I didn't even write a motion for it. I just, I just emailed the court coordinator. [15:24.520 --> 15:31.480] Now this court coordinator and I have had words a few times about what it is the law requires [15:31.480 --> 15:38.840] her to do. And she's been maybe embarrassed here and there about what it was she thought the law [15:39.560 --> 15:47.000] was saying. And it turns out that she was on the wrong side of it. But I emailed this court [15:47.000 --> 15:51.720] coordinator and I asked her for clarification. I said, well, it really looks like this is illegal. [15:51.720 --> 15:57.000] This hearing that's coming up is illegal. And I don't want to be a part of any [15:57.000 --> 16:02.760] crime. I don't want to participate, facilitate any criminal activity. Far be it from me. [16:05.800 --> 16:12.680] Well, I got a, I got a email back that says it was an order, a judicial dismissal [16:13.720 --> 16:20.280] and the judge signed it. So there was not really a lot of explanation, but they just decided they're [16:20.280 --> 16:28.600] not going to have that hearing after all. What do you think? I think the judge saw this and said, [16:29.320 --> 16:34.920] get him out of my court. I don't ever want to see him again. State of Texas is [23:34.360 --> 23:38.360] in general and Travis County specifically [23:38.360 --> 23:42.360] is not a legal venue of prosecution. Is that a [23:42.360 --> 23:46.360] fact, Jack? [26:47.360 --> 26:50.360] It's distinctive. [26:50.360 --> 26:56.360] If you look at the signature, the first name that looks like... [26:56.360 --> 26:57.360] Is it Rod? [26:57.360 --> 26:58.360] Yeah, Rod. [26:58.360 --> 26:59.360] They are. [26:59.360 --> 27:03.360] It has just a line with a serif on it [27:03.360 --> 27:05.360] and it drops down in a slide able. [27:05.360 --> 27:11.360] And then the loop has two breaks in it. [27:11.360 --> 27:17.360] The only way you get breaks like that, those are ticks. [27:17.360 --> 27:20.360] His hands, he's got a tick [27:20.360 --> 27:27.360] and those ticks like that are almost always drugs. [27:27.360 --> 27:29.360] All through his writings. [27:29.360 --> 27:32.360] He breaks and ticks in it. [27:32.360 --> 27:35.360] And he doesn't... [27:35.360 --> 27:39.360] His last name is just a straight line. [27:39.360 --> 27:43.360] Initially, this is an inferior handwriting. [27:43.360 --> 27:48.360] The weight of the pencil is real heavy. [27:48.360 --> 27:56.360] That tends to be someone who's very body-oriented. [27:56.360 --> 28:01.360] I have to get my books out to do this more careful. [28:01.360 --> 28:09.360] The top loop in the B, he doesn't have a back loop on it. [28:09.360 --> 28:14.360] The straight-up line stops at a point and drops down. [28:14.360 --> 28:19.360] And in Drummond, he's got an O at the beginning [28:19.360 --> 28:25.360] and a line that starts below, well below the baseline, [28:25.360 --> 28:30.360] comes up, does a 90-degree and goes straight over to the end [28:30.360 --> 28:32.360] and does a loop. [28:32.360 --> 28:39.360] When the lines below the center section don't have loops [28:39.360 --> 28:47.360] and the bigger the loops, the more someone is physically open. [28:47.360 --> 28:51.360] Other way people often use big loops in the bottom. [28:51.360 --> 28:59.360] People who are very sexually inhibited will make those straight lines. [28:59.360 --> 29:02.360] It's been a long time since I've done this [29:02.360 --> 29:07.360] and it's not necessarily sexually inhibited. [29:07.360 --> 29:14.360] It's someone who's real insecure about body-wise. [29:14.360 --> 29:18.360] I'm going to get this guy as a little guy. [34:16.360 --> 34:17.360] Well, I do that. [34:17.360 --> 34:19.360] That's how I do my signatures. [34:19.360 --> 34:24.360] And when I drop it on there, I set the size of it. [34:24.360 --> 34:26.360] You can grab the corner and make it bigger, smaller. [34:26.360 --> 34:27.360] Do it when I drop it in. [34:27.360 --> 34:29.360] It's real big. [34:29.360 --> 34:34.360] And when you, if you're doing that, when you drop it in and Microsoft Word, it'll [34:34.360 --> 34:37.360] pull a little, show a little box next to it. [34:37.360 --> 34:45.360] And that's so that you can tell word rather the image should be separated from the text [34:45.360 --> 34:52.360] like you want the text to stop when it gets to the image and jump across it. [34:52.360 --> 34:58.360] Or you want the image in front of the text over the top of the text, or you want the [34:58.360 --> 35:01.360] text to flow over the image. [35:01.360 --> 35:06.360] When you put your signature in, you always want the text to flow over your image. [35:06.360 --> 35:13.360] So when I move it down to the signature line, if part of your signature goes below the [35:13.360 --> 35:17.360] line, it will look like it's on top of the line. [35:17.360 --> 35:21.360] If you do it the other way around, the word doesn't handle it well. [35:21.360 --> 35:28.360] But I always set it down there and then adjust my size to what looks good for me. [35:28.360 --> 35:35.360] And what looks good for me is my signature bigger than my typed name. [35:35.360 --> 35:39.360] This guy's signature is, then it's ready. [35:39.360 --> 35:44.360] His typed name is in, appears to be in bold. [35:44.360 --> 35:52.360] But I've got to expand it and shrink it down. [35:52.360 --> 35:55.360] Yeah, regular type. [35:55.360 --> 36:05.360] This is not bold type, but his signature is just, the line is really tiny, thin. [36:05.360 --> 36:09.360] Like it's just barely down there. [36:09.360 --> 36:12.360] Man, I would never let my signature look like that. [36:12.360 --> 36:20.360] I actually made up my signatures with a felt pen so that when I put it on the page, the [36:20.360 --> 36:23.360] signature would look bigger, bigger than the typed image. [36:23.360 --> 36:25.360] This guy didn't. [36:25.360 --> 36:31.360] I see a small, tiny guy who has no confidence. [36:31.360 --> 36:39.360] He's probably a, he uses that to cover up for his, how small he feels. [36:39.360 --> 36:43.360] Randy, have we ripped him to shreds enough? [36:43.360 --> 36:48.360] Yeah, we've ripped him to shreds and I looked on Facebook and found a picture of him. [36:48.360 --> 36:52.360] He's a very short, stocky guy. [36:52.360 --> 36:54.360] Bolding. [36:54.360 --> 36:56.360] I wonder how that happened. [36:56.360 --> 36:59.360] He definitely looks. [36:59.360 --> 37:01.360] He looks just like he does. [37:01.360 --> 37:06.360] That's the image that his signature gave me. [37:06.360 --> 37:10.360] And not over here, he's a small guy in Texas. [37:10.360 --> 37:11.360] Yeah. [37:11.360 --> 37:16.360] A lot of places, that's not a problem, but in Texas, it's always a problem. [37:16.360 --> 37:19.360] So we've got a really insecure guy there. [37:19.360 --> 37:30.360] When you land on him and you drag his boss and his boss, his boss in with him, he is not going to be a happy camper. [37:30.360 --> 37:40.360] So it'll be interesting to see what they do and then what we'll do is go back with those complaints and take the renewing complaint [37:40.360 --> 37:51.360] and attach it to the complaints against the prosecutors and give them a hug at the grand jury together. [37:51.360 --> 37:55.360] People prosecutors can't touch them. [37:55.360 --> 38:00.360] My other question is... [38:00.360 --> 38:06.360] Why did it take them a year to figure this out? [38:06.360 --> 38:08.360] I'll tell you why. [38:08.360 --> 38:11.360] Okay. [38:11.360 --> 38:17.360] The first person who was there was planning on handling this. [39:03.360 --> 39:14.360] And changing people, Randy, you were saying that the changing of people might have something to do with the fact that who it is that's getting charged, right? [40:21.360 --> 40:31.360] Most of the letters came from San Antonio, Barrack, Daphne, Frappia, the substitute trustees were located in Travis County. [40:31.360 --> 40:37.360] The nodar is located in Travis County. [40:37.360 --> 40:43.360] That's where this California attorney told them they didn't have to send their stuff in violation of Texas and California law. [40:43.360 --> 40:51.360] And Buckley Maddow, another agent for Meduchin, is located in Travis County. [40:51.360 --> 40:57.360] What part of this do they not understand? [40:57.360 --> 41:00.360] Good question. [41:00.360 --> 41:07.360] They hammer them and they got a Republican governor that he presented to the grand jury. [41:07.360 --> 41:12.360] And the Republican governor is not going to be his buddy. [41:12.360 --> 41:18.360] He is a Democratic prosecutor in a red state. [41:18.360 --> 41:22.360] He is surrounded by enemies. [41:22.360 --> 41:28.360] And now we throw him in the lion's den. [41:28.360 --> 41:34.360] Welcome to the deep end of the pool, new prosecutor. [48:01.360 --> 48:08.360] He had recently left the office, and the person on the phone was quite caught, you know, didn't know. [48:08.360 --> 48:11.360] Well, if you don't have a case number, I can't help you. [48:11.360 --> 48:12.360] What's the guy's name? [48:12.360 --> 48:13.360] What's your name? [48:13.360 --> 48:14.360] I don't find anything. [48:14.360 --> 48:16.360] Well, you know, can you find out for me? [48:16.360 --> 48:17.360] I don't know. [48:17.360 --> 48:20.360] If you don't have a case number, there's nothing I can find. [48:20.360 --> 48:21.360] And I said, okay. [48:21.360 --> 48:27.360] So I contacted that first person and said, what's happening here? [48:27.360 --> 48:29.360] It seems to have been dropped the ball. [48:29.360 --> 48:30.360] This person's left. [48:30.360 --> 48:34.360] Since you left, it's gone into the black hole. [48:34.360 --> 48:38.360] And he said, oh, I'm so sorry, I'll see what I can find out for you. [48:38.360 --> 48:41.360] And I said, well, it seems someone's dropped the ball. [48:41.360 --> 48:45.360] And then he didn't respond directly back to me. [48:45.360 --> 48:52.360] But within three days, I got that letter. [48:52.360 --> 48:56.360] So they were just going to ignore it? [48:56.360 --> 48:58.360] Yes. [48:58.360 --> 49:01.360] I'm inclined to ask a few questions. [49:01.360 --> 49:04.360] Start poking around. [49:04.360 --> 49:07.360] But I didn't know what to ask and of whom. [49:07.360 --> 49:13.360] And if I should contact that friendly person who really disliked Mnuchin and wanted to [49:13.360 --> 49:20.360] go after him and told me that he was going to give an hour presentation to the grand jury [49:20.360 --> 49:22.360] instead of a 20 minute. [49:22.360 --> 49:29.360] And then he got removed to a different area and everything fell apart. [49:29.360 --> 49:32.360] Hmm. [49:32.360 --> 49:37.360] I need a complete story of your interactions. [49:37.360 --> 49:38.360] Okay. [49:38.360 --> 49:43.360] So I can show that to the grand jury. [49:43.360 --> 49:44.360] Okay. [49:44.360 --> 49:50.360] We show a prosecutor who was hot to go after them and felt like we had standing. [49:50.360 --> 49:57.360] And then all of a sudden they get this guy to lie like a dog. [49:57.360 --> 50:00.360] Well, I don't know. [50:00.360 --> 50:08.360] The problem is how we affect this guy who was helpful. [50:08.360 --> 50:10.360] Yeah, I know. [50:10.360 --> 50:15.360] I think at the end of the day this won't hurt him a bit. [50:15.360 --> 50:17.360] Because he was doing the right thing. [50:17.360 --> 50:21.360] He was following the law and the facts. [50:21.360 --> 50:24.360] And these guys wanted to do something else. [50:24.360 --> 50:30.360] So I'm going to suggest do not talk to this guy that was helpful. [50:30.360 --> 50:33.360] Don't talk to him at all again. [50:33.360 --> 50:34.360] Okay. [50:34.360 --> 50:39.360] That will give him some protection. [50:39.360 --> 50:40.360] Yeah. [50:40.360 --> 50:48.360] And if he tries to call you, tell him it would be better if we didn't talk. [50:48.360 --> 50:51.360] Because I do not want to compromise you. [50:51.360 --> 50:55.360] And what he'll do is go back to these guys and say I tried to talk to her. [01:01:23.360 --> 01:01:32.360] Margaret Moore, the Travis County District Attorney, announced earlier this month that she was dismissing 32 felony possession and delivery of marijuana cases because of the law. [01:01:32.360 --> 01:02:01.360] Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter to county district attorneys back on Thursday that marijuana has not been decriminalized in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, as well as other cities, too, like the district attorney in El Paso, Kyma Esparza, a Democrat who also stated earlier this month that the law, quote, will not have an effect on the prosecution of marijuana cases in El Paso. [01:04:59.360 --> 01:05:15.360] And I put something, I said, you know, recently a Washington D.C. court suspended New York attorney Rudy Giuliani from practicing law for lying and this is exactly what attorney Mr. McGinnity, and he explained it. [01:05:15.360 --> 01:05:29.360] Mr. McGinnity appears to be getting a free pass for doing the very same thing, lying, that Rudy Giuliani was suspended for an act that is in violation of the professional rules of conduct for attorneys. [01:05:29.360 --> 01:05:50.360] It follows this honorable court should deny the defendant's opposition because this attorney violated the rules of professional conduct as alleged herein and in the conclusion, I put, further the plaintiff, oh, given the laws and oaths of office required by attorneys for the privilege of practicing law, [01:05:50.360 --> 01:06:04.360] the plaintiff believes it would be unjust for a court to overlook the property-appropriate measure such as allowing limited discovery, truthfulness, and honesty is a basic tenet of the legal system. [01:06:04.360 --> 01:06:09.360] I don't know if that's gonna get the judge to what, but I'll put it in. [01:06:09.360 --> 01:06:21.360] I know what the judges were thinking. Lady, you are naive. If you think truth matters here. [01:06:21.360 --> 01:06:24.360] Yeah, but it's good for her to say it's their politics. [01:06:24.360 --> 01:06:43.360] Yeah, I have neither what's in truth. The fact that you, Tina, have put that in front of them means you have made them aware. They now have knowledge of this particular violation of rules. [01:06:43.360 --> 01:06:55.360] And when you make them aware, you triggered their judicial responsibility to follow the, there's a Canon 3D, well, I don't know, it might be a different one in California. [01:06:55.360 --> 01:07:11.360] I'm not sure which side you were writing to for that, but in Texas, it's 3D and it says that if they are aware of another judge's violation of the Code of Judicial Conduct, they have to report them. [01:07:11.360 --> 01:07:21.360] And if they're aware of a lawyer's violation of the rules of professional conduct that attorneys have to follow, well, then they have to bar grieve the lawyer. [01:07:21.360 --> 01:07:32.360] Or if they think that it might be because he has a drug problem, then they don't have to bar grieve and they can send him to drug rehab. [01:07:32.360 --> 01:07:41.360] You just triggered that responsibility. [01:07:41.360 --> 01:07:52.360] There is a file about grievance. The lawyer is forbidden to talk to anybody about that grievance except bar. [01:07:52.360 --> 01:08:16.360] But as far as I know, the filer is not forbidden. So can the judge admit that he filed a bar grievance or can he stand on secrecy and say, oh, I'm forbidden to admit or deny? [01:08:16.360 --> 01:08:32.360] I would think he's free to talk about it if he wants to. There's no rule about that. We got free speech and everything. [01:08:32.360 --> 01:08:48.360] Go ahead. So I sent another email saying, oh, evidently you overlooked obvious and I went through every violation that they were, you know, that they were everything they were in violation of. [01:13:49.360 --> 01:14:01.360] And then I got another email back saying, well, they're not part, they don't have control over Texas Department of Crescent that I need to direct my complaints to the ombudsman. [01:14:01.360 --> 01:14:07.360] So I did get an email from the ombudsman last Wednesday. [01:14:07.360 --> 01:14:13.360] And I talked to him that Thursday and he seemed genuinely concerned. [01:14:13.360 --> 01:14:27.360] And he said he had one of the videos in front of him, but he had yet to look at it and he was going to send to ombudsman to the wind unit to talk to, you know, to give an investigation. [01:14:27.360 --> 01:14:42.360] I got to visit my son on Sunday, I mean, on Saturday and he told me, yeah, they come down there, but they were more than trying to find something that he did wrong instead of doing a real honest investigation. [01:14:42.360 --> 01:14:55.360] Now since then, I've talked to this ombudsman and he's like a totally different tune now, you know, and, you know, oh, yeah, yeah, well, I still have a video, but I haven't got to look at it yet. [01:14:55.360 --> 01:14:59.360] And I asked him about the other videos from the last assault. [01:14:59.360 --> 01:15:01.360] He said, well, I don't know if they still have that or not. [01:22:16.400 --> 01:22:20.720] In fact, all they have done is retaliated against him time and time again, one time [01:22:20.720 --> 01:22:24.400] sent him to the hospital and they lied about it and hit it from me. [01:22:24.400 --> 01:22:28.640] And so I called around because I had a gut feeling and I found him in the hospital because [01:22:28.640 --> 01:22:32.120] they wouldn't let me, you know, give me any information. [01:22:32.120 --> 01:22:36.400] So I had to go to my lawyer and all that stuff to get it. [01:22:36.400 --> 01:22:44.520] And so what happens on that case, he gets G5, which means the worst case or, you know, [01:22:44.520 --> 01:22:46.040] worst scenario there is. [01:22:46.040 --> 01:22:49.440] Well, that case finally gets overturned. [01:22:49.440 --> 01:22:54.040] But in the meantime, now they brought him up any kind of case they can because they [01:22:54.040 --> 01:23:04.240] are covering for each other, you know, and I mean, I am fighting tooth and nail to save [01:23:04.240 --> 01:23:05.240] my son. [01:23:05.240 --> 01:23:09.800] And I gave you a little bit of information about him last time, you know, he's had mental [01:23:09.800 --> 01:23:17.680] problems and he tried to commit suicide in 2015, well, he still got a bullet in his head. [01:23:17.680 --> 01:23:23.120] And I've said this in numerous emails to the ombudsman and to the health services and [01:23:23.120 --> 01:23:28.960] all of them that, you know, any kind of head trauma could kill this young man and they don't [01:23:28.960 --> 01:23:29.960] care. [01:23:29.960 --> 01:23:30.960] They don't care. [01:23:30.960 --> 01:23:33.040] You know, it's like they're trying to kill him. [01:23:33.040 --> 01:23:37.960] You know, the last assault was by another inmate. [01:23:37.960 --> 01:23:43.360] And I know the guards put him up to it because my son had been helping this guy out. [01:23:43.360 --> 01:23:44.680] They had been good friends all of a sudden. [01:23:44.680 --> 01:23:48.280] He just took him well and on him for no reason. [01:23:48.280 --> 01:23:51.920] And you know, he made an excuse that Luke was on the phone or something.
