Margaret Moore, the Travis County District Attorney announced earlier [01:27.800 --> 01:32.520] this month that she was dismissing 32 felony possession and delivery of marijuana cases [01:32.520 --> 01:33.520] because of the law. [01:33.520 --> 01:37.600] Mr. Abbott and other state officials, including the Attorney General stipulated in a letter [01:37.600 --> 01:42.120] to county district attorneys back on Thursday that marijuana has not been decriminalized [01:42.120 --> 01:48.240] in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, as [01:48.240 --> 01:54.480] well as other cities too like the District Attorney in El Paso, Cayma Esparza, a Democrat [01:54.480 --> 01:58.960] who also stated earlier this month that the law, quote, will not have an effect on the [01:58.960 --> 02:01.840] prosecution of marijuana cases in El Paso. [02:01.840 --> 02:06.760] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender [02:06.760 --> 02:10.760] in Harris County who stated that, quote, the law is constantly changing on what makes [02:10.760 --> 02:13.480] something illegal based on its chemical makeup. [02:13.480 --> 02:17.360] It's important that if someone is charged with something, the test matches what they're [02:17.360 --> 02:22.600] charged with. [02:22.600 --> 02:27.240] A paper by Tulane University identified a five and a half inch American pocket shark [02:27.240 --> 02:32.360] as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket [02:32.360 --> 02:38.000] shark ever captured or recorded with the other one being found way back in 1979 in the East [02:38.000 --> 02:39.500] Pacific Ocean. And when they don't, you get the hammer them for it. So I have the documents up primarily [07:57.800 --> 08:05.320] for Texas, but some of them are for other states as well. And I have other state documents up. [08:05.960 --> 08:11.880] And as I get more research from other states, I will start adding in the other states. [08:12.680 --> 08:18.520] But right now it's mostly for Texas. It'll drop you down about 150 pages. You just sign them and [08:18.520 --> 08:24.200] send them. And what's going to happen is you're going to go to court and they're going to do the [08:24.200 --> 08:30.840] things they always do. And they're going to look at your emotions and pleadings and just [08:30.840 --> 08:39.880] blow them off. Just deny everything out of hand. The important thing is not so much what they do. [08:40.840 --> 08:48.360] It's important that we know what they're going to do. So we set up for it. The purpose of all [08:48.360 --> 08:55.160] of these documents is to get them to ignore them. So you go to the first hearing, the judge ignores [08:55.160 --> 09:02.600] all that stuff. You come back and you go to our first questionnaire. They'll ask, did they do this? [09:02.600 --> 09:08.280] Did they do this? Did they do this? Just walk down the line of the things they can do with traffic [09:08.280 --> 09:19.320] hearing, which not very much. They're all pretty much the same. So the number of things the court [09:19.320 --> 09:25.800] can actually do and the number of things they do wrong is really consistent. So we can build a [09:25.800 --> 09:35.560] relatively simple questionnaire. While the questionnaire is simple on its face, courts aren't [09:35.560 --> 09:40.520] going to think it's very simple because you go into court and the judge just blow everything off [09:40.520 --> 09:46.680] like he always does. You come home, go through the questionnaire and come back the next day [09:46.680 --> 09:53.560] with a bigger set of documents than you came with the first day. Criminal complaints, [09:53.560 --> 10:03.080] bar grievances, judicial conduct complaints, motions and pleadings and potentially a request [10:03.080 --> 10:10.200] for findings, a fact and conclusions at law. They never get that in a traffic case and they'll say, [10:10.200 --> 10:16.680] well, I don't have to respond to that. They'll say, that's right, you don't. But if you don't, [10:16.680 --> 10:21.880] that gives me reasonable probable cause to believe that you abused your discretion and by [10:21.880 --> 10:25.800] failing to properly apply the law to the facts and in the process to not have been full and free [10:25.800 --> 10:31.240] access to or enjoyment right. And that's a crime in the state of Texas. So now you come back with [10:31.240 --> 10:36.760] criminal charges against more criminal charges against the judge and on and on and on. We're just [10:36.760 --> 10:43.960] a big stack up. They won't believe what they'll see. And this is all for practice because you will [10:43.960 --> 10:48.920] file all those criminal complaints and they'll go to prosecutors and various other individuals [10:49.960 --> 10:55.960] and all those individuals will fail to do what they're required to do and you come back and [10:55.960 --> 11:04.440] go to the next questionnaire and hammer them again. If we're going to take the system back, [11:05.880 --> 11:13.960] this is probably the place where we will do it. I've been 30 years trying to get jurisdictions [11:13.960 --> 11:25.560] to do examining trials with little if any success. But when I start getting people to use the traffic [11:25.560 --> 11:33.000] site and they start hammering these judges all over the state because the third motion [11:35.000 --> 11:45.720] in the stack is for an examining trial. There's one I have to add. It's a 16-17 motion to dismiss. [11:45.720 --> 11:56.600] 16.17 is in chapter 16, which is examining trial. That's required to be done in every [11:56.600 --> 12:05.320] arrest felony or misdemeanor traffic or penal. And at the examining trial, the judge is to [12:05.320 --> 12:12.920] issue an order and take that order along with all documents had in the hearing, seal it in an [12:12.920 --> 12:19.960] envelope and forward it to the clerk at the court of jurisdiction. If the order is not filed with [12:19.960 --> 12:31.000] the clerk within 48 hours, the accused has a what? To discharge. Current law says discharge. [12:31.000 --> 12:43.720] Excuse me. They changed it last year. They changed the verbiage. And they claim that there were [12:43.720 --> 12:55.640] no substantive changes. But this change appears to be substantive. What the statute said before [12:55.640 --> 13:07.720] this change was that the accused has a right to dismissal. They changed it to discharge. That [13:07.720 --> 13:15.720] is substantive. Discharge means they just discharge him to the person from custody. [13:16.840 --> 13:24.680] Doesn't mean they dismiss the case. So we'll be working on that one. We'll be using the old verbiage [13:24.680 --> 13:32.120] since the new verbiage was not substantive. Then it's simply cosmetic and we can use the [13:32.120 --> 13:41.880] old verbiage. But you have a right to dismissal. That's the statutory right. So that will be [13:41.880 --> 13:48.120] in there. We got a whole bunch of cool stuff in there. But it's all for the purpose of getting [13:48.120 --> 13:55.800] the judge to not do what he's supposed to do. Goes to one of our rules. Never ask a public [13:55.800 --> 14:03.400] official to do anything you actually want him to do. Because you never ask a public official to do [14:03.400 --> 14:11.480] anything that the law does not command him to do. So we will, I'm getting that thing up. It's a way to keep from having to go to court because the accuser has to explain [15:19.080 --> 15:25.080] himself right up front. And then the magistrate has an opportunity to say, well, that doesn't seem [15:25.080 --> 15:32.200] like that needs to go to court. You got no probable cause to bother this person. Leave him alone. [15:32.200 --> 15:37.080] And that's what he's talking about the examining trial and why it's so important that [15:37.800 --> 15:42.280] we reinstate that. It's part of our role. It's not making up something new. This is [15:42.280 --> 15:50.840] what our law already says should be happening. Yes, this has been in law since 1215 AD. [15:53.080 --> 16:00.680] We had the first signing of the Magna Carta Libertatum, the requirement that if a sheriff [16:00.680 --> 16:06.760] arrests a free person for any reason, he was to take them directly to the nearest magistrate [16:07.400 --> 16:13.800] and explain himself. It's not because they didn't trust the police. It's because they didn't want [16:13.800 --> 16:19.400] the public to fear the police. They did not want the policeman to hold the key to the jailhouse [16:19.400 --> 16:26.360] door. They left that with the magistrate. We've since stopped doing that and we now stand as the [16:26.360 --> 16:33.960] worst police state the world has ever seen bar none. I know lawyers have to be licensed [22:11.720 --> 22:24.120] in the state in which they operate or they have to register with the state and notify the [22:24.120 --> 22:34.040] if a lawyer is from a different state and he let's say he has a client in the state that gets [22:34.040 --> 22:42.280] a issue in another state that's related to the issue the client's already representing he can go [22:42.280 --> 22:57.720] to that state and be the client's lawyer what is it but it's pro v2 yeah say that again pro [22:57.720 --> 23:06.920] hawk yeah pro hawk of each day but that's only limited if they operate regularly regularly [23:06.920 --> 23:15.160] in the state they have to be registered to do business in the state if you are a licensed [23:16.040 --> 23:24.680] operator or a legal fiction you have to register with the state we had some problems with a [23:24.680 --> 23:33.800] trying to remember the name of the company it was a foreclosure company that never existed [23:35.160 --> 23:46.760] huh wow they were a they were claimed to be a part of another company that did exist but it [23:46.760 --> 23:53.400] went out of business but this one never existed at all and they were foreclosing on properties [23:53.400 --> 24:00.200] all over the place and the courts were allowing them to master cluster bought in courts were [24:00.200 --> 24:07.080] bought and paid for but yes you're supposed to be regularly supposed to be registered within [24:07.080 --> 24:13.400] the state you're doing in which you're doing business and do you know if in every state [24:13.400 --> 24:23.880] they have to can only do business in the exact name they are registered to do business as way too [24:23.880 --> 24:33.400] specific in code to for me be able to comment on that one i have to read the specific code for [24:33.400 --> 24:43.960] each state yeah you know that's that's pretty specific if we were talking about this earlier [24:43.960 --> 24:49.880] and the secretary of state asked you if the name had a comma in it yeah and that implied that they [24:49.880 --> 24:56.680] were being so specific that even a comma missing would put them out of compliance [24:56.680 --> 25:06.840] well that is likely to be state specific i doubt that every state would be quite that particular [25:07.880 --> 25:15.320] or the state might let you operate if you're registered in the state under one name and you [25:15.320 --> 25:22.440] have a company that's a subsidiary of the company you're registered in they may let you operate [25:22.440 --> 25:28.280] under that name i don't know but that's something specific i'd have to look at the code on [25:30.520 --> 25:38.520] because i know one of my you know ones keep they change names three times and their headquarters [25:38.520 --> 25:46.360] in texas but they are operating doing business in california and i know that they've put misleading [25:46.360 --> 25:53.560] information on the bottom of a letter you know calling themselves index west allcy and that's [25:53.560 --> 26:01.080] a violation of the fdcpa if you're attempting to collect a debt in the name of somebody that you're [26:01.080 --> 26:13.400] not because it's considered confusing good and but it's hard to get the fdcpa actions i mean you've [26:13.400 --> 26:24.520] got to be oh who cares you get to file against them you file the complaint thinking yeah you file for [26:24.520 --> 26:33.800] sanctions in the court if it's wrongful what they say is that these consumer protection laws do not [26:33.800 --> 26:41.000] create a separate cause of action well who cares we'll claim this cause of action anyway let them [26:41.000 --> 26:49.080] adjudicate it in court let them dig in their pocket and prove to the court that they shouldn't be [26:49.080 --> 26:58.280] sanctioned that's what they do to you so don't about the fair play but having sanctions well [26:58.280 --> 27:04.840] after the fact though is difficult but i think they deserve and that that would deserve another [27:04.840 --> 27:10.360] bar complaint and criminal complaint i would think just for using that name on one of the letters [27:10.360 --> 27:15.080] right at the bottom the top name was one thing and then the bottom name was another [27:16.440 --> 27:23.240] so which one is it i don't know i'm just a poor if if one of them was accurate [27:24.760 --> 27:33.640] then they're likely to say that's a nun's protunk that means a non-substantive error [27:33.640 --> 27:42.920] essentially a typo because they are if one of the add names or addresses is gonna make them really unhappy when all of them are [28:52.840 --> 28:58.280] going before grand juries and they're all going for a grand oh before grand juries because of [28:59.320 --> 29:06.120] what one lawyer did but then in their own right they've all done this so the potential is they [29:06.120 --> 29:12.200] could get criminal complaints for every time they've done it well we've gotten to actually we've got [29:12.200 --> 29:20.920] two complaints two separate complaints about each attorney so that's 226 total and um there's only [29:20.920 --> 29:29.320] one attorney that could criminal complaint has multiple crimes listed in it so out of the [35:08.440 --> 35:20.600] 114 uh partners of this firm one of them did the crimes and the other 113 are responsible [35:20.600 --> 35:29.720] they they share criminal culpability based on the texas penal code 7.02 and based on the [35:30.360 --> 35:37.640] texas disciplinary rules of professional conduct which says in 501 that if somebody is a partner [35:37.640 --> 35:42.680] of that law firm they share that responsibility they should have taken care of it not let these [35:42.680 --> 35:51.320] people run them up and do all these crimes so in the first criminal complaint we have aggravated [35:51.320 --> 35:58.440] perjury tampering with a governmental record tampering with physical evidence and then a [35:58.440 --> 36:04.040] false statement to obtain property or credit or in the provision of certain services all of this goes [36:04.040 --> 36:11.880] to some certain facts that that was associated with the way that these attorneys were pushing [36:11.880 --> 36:20.040] through a a fraudulent foreclosure so there's a fraudulent foreclosure and they did this aggravated [36:20.040 --> 36:24.680] perjury tampering with a governmental record and tampering with physical evidence in order to [36:24.680 --> 36:30.760] accomplish their fraud and that's one fact set and that's some serious crimes that's third degree [36:30.760 --> 36:38.040] felony state jail felony third degree felony and first degree felony respectively so that's [36:38.040 --> 36:42.440] some pretty serious and randy you mentioned that's that's kind of cool that we have multiple in here [36:42.440 --> 36:48.200] because if the grand jury how did you put it if they see one crime they might just say no bill [36:48.200 --> 36:55.560] but if they see multiple then they very easily say no to everything yeah they people only have [36:55.560 --> 37:02.200] so many nos in them you know your kids that's dead could i have a after another after another after another they can pick the one [37:16.280 --> 37:23.000] they want to go to to toville to and ignore the rest they don't have to file against all of them [37:23.000 about 2012 or 13 that's when it started to taper off somewhat [38:00.840 --> 38:09.240] but it was really bad then so the second criminal complaint we've got against one of each of the [38:09.240 --> 38:15.640] 114 partners the second criminal complaint has a slightly different fact different fact set [38:15.640 --> 38:22.520] but it goes to some different crimes it goes to falsely holding oneself out as a lawyer [38:23.880 --> 38:29.240] and because this is what dean is talking about that they they were not a texas lawyer they're [38:29.240 --> 38:33.960] not in good standing with the state bar of texas and that's what the penal code says that they have [38:33.960 --> 38:41.400] to be if they're going to practice law here so they're falsely holding oneself out as a lawyer [38:41.400 --> 38:50.120] unauthorized practice of law 38 123 and they're hindering apprehension or prosecution 3805 so [38:50.120 --> 38:55.720] that's also some severe you got a third degree felony again a state jail felony or a class A [38:55.720 --> 39:03.880] misdemeanor depending on whether or not uh some pieces of that facts get um match different part [39:03.880 --> 39:08.600] essential elements of the offense it might be a state jail felony or a class A misdemeanor but [39:08.600 --> 39:13.320] that's definitely definitely severe and we've got another third degree felony and another first [39:13.320 --> 39:19.880] degree felony so it's not going to really look good for these guys no matter how you paint it [39:22.600 --> 39:29.640] I think whether we get uh two bills or not this is going to terrify these attorneys [39:29.640 --> 39:37.880] they're terrified of the system anyway uh you take a criminal defense lawyer [39:39.160 --> 39:45.080] they're more afraid of the system than anybody else because they know how crooked it is exactly [39:46.760 --> 39:51.560] and when they get hammered when they you know they're looking at being put before that system [39:51.560 --> 39:59.320] it terrifies them and besides an indictment their bark card goes in the toilet the career's [39:59.320 --> 40:07.640] ended so and and this is what I've talked about for years about about uh grand juries uh most of [40:07.640 --> 40:15.240] the time grand juries are not going to indict public officials and I have people you know [40:15.240 --> 40:21.640] complaining about that I said no no no no that's not the point with public officials these guys [40:21.640 --> 40:27.160] are different they're not public officials but when you have public officials doing their job [40:27.160 --> 40:32.440] um acting in accordance with policy doing what everybody else has been doing for 20 years [40:33.160 --> 40:39.240] you don't necessarily want to get them fired cause them to go to jail uh you just want to get their [40:39.240 --> 40:51.080] attention so they're pretty sure that the system will protect them pretty sure but who here wants [40:51.080 --> 41:00.280] to play rush and roulette with their career and their liberty even if we take a let's take 14 blanks [41:00.280 --> 41:05.960] and one live round and mix them all up put them in a cliff who wants to take the first shot [41:09.160 --> 41:15.720] that's the point I put all the highest judges in Texas in front of a grand jury in 2008 [41:15.720 --> 41:24.360] because they asked for a motion for leave to file a writ of habeas corpus I did not get them indicted [41:26.200 --> 41:31.000] but if you file a motion uh a writ of habeas corpus with court of criminal appeals in Texas [41:31.720 --> 41:38.360] you're not going to get any request for a motion for leave to file they cut that stuff out and they [41:38.360 --> 41:48.040] had been doing that for 20 years and no lawyer in their right professional mind would would raise an [41:48.040 --> 41:53.320] issue the last thing they want to do is annoy the court of criminal appeals [41:55.560 --> 42:01.000] a sue denton county for 11 million dollars sued 24 litigants all of them public officials [42:01.000 --> 42:08.120] the 60th lawyer I talked to I kept a list of lawyers the last one was jerry cob jerry cob [42:08.680 --> 42:14.840] was the district attorney before the current district attorney the district current district [42:14.840 --> 42:22.120] attorney was named I called I got him on the line I said hello jerry my name is randy kelton [42:22.120 --> 42:26.200] and I have sued denton county and I need someone to represent for 11 million dollars and I need [42:26.200 --> 42:31.960] someone to represent that suit oh mr. kelton I know all about your suit I can't represent you [42:31.960 --> 42:36.680] you made accusations against judges in there and I have to represent clients in this county [42:37.400 --> 42:42.440] I said what's how much you can go after these attorneys for and how they [49:11.720 --> 49:18.360] just skate by the rules because the judges just assume that attorneys tell the truth and submit [49:18.360 --> 49:26.360] proper documents whenever they do it they just never check the judges know full well the lawyers [49:26.360 --> 49:32.840] don't tell the truth but they give it them the presumption of validity if you don't challenge [49:32.840 --> 49:40.920] every single thing yeah exactly here's how it works if you make a proactive statement of fact [49:40.920 --> 49:49.880] or law to the court the court must accept it is true unless it is challenged so the court may [49:49.880 --> 49:58.680] know that it's not true but in the litigation process they're not allowed to become a litigator [50:00.120 --> 50:05.960] if the lawyer lies to the judge you have to bring it to the judge's attention then the judge can [50:05.960 --> 50:15.160] act on it but the judge won't act on it anyway and straight to the part where we take the house so it's making [51:59.240 --> 52:07.480] her feel obviously stressed and she hasn't hasn't known what to do um right now we are waiting for [52:07.480 --> 52:15.640] a hearing where the judge will hear the petition and the opposition to see whether or not this [52:15.640 --> 52:23.080] ought to be granted some quick shortcut thing so patty does that give a good synopsis of [52:24.360 --> 52:35.160] what's going on yeah pretty much so what's on your mind particular questions that that maybe [52:35.160 --> 52:47.960] randy can speak to or can discuss together well i i i just don't want to be in foreclosure [52:49.080 --> 52:57.960] i've been dealing with this um for well ever since my mom passed in 2011 [52:57.960 --> 53:07.960] and i talked with the mortgage company and um i was trying to do a modification [53:08.520 --> 53:17.240] you know and get it in my name and this and that the other and so they i did this at least five [53:17.240 --> 53:32.760] times at least since 2011 or yeah until 2019 and at the time you didn't even know that this was [53:32.760 --> 53:40.920] fraudulent you were just trying to get things squared away right and i i was you know i i kept [53:40.920 --> 53:47.480] submitting kept submitting and you know they kept putting me off and telling me i didn't submit this [53:47.480 --> 53:55.960] right and that i didn't submit that right and it was just very stressful and and did a lot of [53:55.960 --> 54:06.600] crime a lot of friends for a lot of crime and so i i just you know i felt like i was at my worst [54:06.600 --> 54:17.560] end and um of course that's when i met donna and and brett so i'm just real grateful and thankful [54:17.560 --> 54:31.160] that i met them both okay uh brett one of the things we were talking to a lawyer in california [54:31.160 --> 54:39.800] and he wouldn't take anything concerning foreclosure except modification fraud he said that's the only [54:39.800 --> 54:48.040] thing i can win so you have if you've been trying to get a modification and they've been pulling [54:48.040 --> 54:55.320] this standard you're sending the wrong docs and blah blah blah in order to double tracks they use [54:55.320 --> 55:03.320] the modification process as a fraud to get you to not pay so you get so far behind you can't catch up [55:03.960 --> 55:10.360] and then they come in and foreclose uh this is well known in the courts have you filed a [55:10.360 --> 55:23.960] counter complaint against these guys for fraud are you talking to me yes no i could okay brett and [55:23.960 --> 55:36.360] tina you want to speak to this well you can file suits against any of them for anything and you [55:36.360 --> 55:45.160] should um i've i'm in the appeals court right now i filed against uh some for you know refusing to [55:45.160 --> 55:52.520] give me the original note after satisfied when they promised to do this um you know i i think you [55:52.520 --> 55:58.600] should absolutely go against them because it really it messes with them they have to spend a lot of [55:58.600 --> 56:06.680] money and they are more likely to come to the table at least some of them are the really big ones like [56:06.680 --> 56:13.160] the one i'm going against uh they've got huge sums of money that they can fight and they will spend [56:13.160 --> 56:19.640] more than the home is worth to fight you so they can get that home some of these well let me make [56:19.640 --> 56:27.080] a comment about that here uh they're not worried about spending paid and i want to foreclose on the property [01:40:09.640 --> 01:40:17.080] and the first thing they have to do is demonstrate to the court that they have standing [01:40:18.760 --> 01:40:23.960] excuse me they have standing to invoke the subject matter jurisdiction of the court [01:40:23.960 --> 01:40:31.960] the court may have jurisdiction over the general subject matter [01:40:33.800 --> 01:40:43.400] but the petitioner has to bring a real controversy to the court and if i couldn't go in and foreclose [01:40:43.400 --> 01:40:50.520] on your property because you're going to say who the heck are you and i can't prove up my position [01:40:50.520 --> 01:40:57.880] well with all this shenanigans they've been pulling for the last 20 years [01:40:58.840 --> 01:41:02.920] they can't prove up their position either that's their big Achilles heel [01:41:04.920 --> 01:41:10.440] and if you challenge subject matter jurisdiction now you're at arm's length to the court [01:41:10.440 --> 01:41:18.440] when an issue is presented to the court if it appears [01:41:19.400 --> 01:41:25.800] that the court has jurisdiction on its face then jurisdiction is presumed [01:41:27.160 --> 01:41:33.560] but once jurisdiction is challenged then the judge must prove up jurisdiction [01:41:33.560 --> 01:41:41.080] and not deposing counsel of opposing party it's the judge who's going to render a ruling [01:41:41.720 --> 01:41:48.440] and he has to have the power to do that now he can get the other she can ask the other side to [01:41:48.440 --> 01:41:54.760] prove up jurisdiction but the judge is the ones who are responsible because if that judge acts [01:41:54.760 --> 01:42:00.520] without jurisdiction you can sue the judge personally so jurisdiction is a big deal [01:42:00.520 --> 01:42:08.120] and it's a threshold issue they can't get across the threshold of the courthouse [01:42:08.120 --> 01:42:15.240] door until they've proved up that they have standing to invoke the subject matter jurisdiction [01:42:15.240 --> 01:42:22.520] of the court and i can almost assure you these guys are not going to be able to prove standing [01:42:22.520 --> 01:42:32.360] because to do [01:46:56.120 --> 01:47:05.120] Brett was concerned that he has already filed documents in your case and you might have screwed up your chances of subject matter jurisdiction. [01:47:05.120 --> 01:47:17.120] No, not a problem. In personum jurisdiction, the court can have subject matter jurisdiction over the subject matter generally. [01:47:17.120 --> 01:47:37.120] And the petitioner can have standing to invoke the subject matter jurisdiction of the court. But if let's say the petitioner is suing the wrong person, then you can file a special appearance. [01:47:37.120 --> 01:47:51.120] A special appearance is a challenge to in personum jurisdiction, jurisdiction over the person. And that has to be filed the first day. [01:47:51.120 --> 01:48:02.120] It doesn't have to be the first documents heard, but with the first set of documents that has to be in there. But subject matter jurisdiction is altogether different. [01:48:02.120 --> 01:48:13.120] It's threshold. If the judge was never able to step across the threshold, anything he did is void. [01:48:13.120 --> 01:48:23.120] So it makes no difference what was done. The case law says subject matter jurisdiction may be challenged no matter how remote in history. [01:48:23.120 --> 01:48:40.120] So anything that was done, anything that was signed, if we can show that the claimant failed to prove standing to invoke the subject matter jurisdiction in the court, everything's garbage. [01:48:40.120 --> 01:48:47.120] Everything that went on is gone. We started all over. [01:48:47.120 --> 01:48:59.120] So always in any case, first thing I want to do subject matter jurisdiction and especially in foreclosure. [01:48:59.120 --> 01:49:05.120] It is the process that they use. They use this MERS company. [01:49:05.120 --> 01:49:14.120] They wrote all these mortgages and then they took all these mortgages and sold them to an investment pool. [01:49:14.120 --> 01:49:33.120] So the investment pool buys 10, 15,000 of these mortgages and they put them into one pool and then they sell percentages to different investments and generally to long term investments like retirement funds mainly. [01:49:33.120 --> 01:49:38.120] And they would buy percentages of it. They would slice a percentage off of it. [01:49:38.120 --> 01:49:55.120] Well, I caused a problem because when they changed the holder status of these mortgages, each change had to be registered with the county clerk with the registrar of deeds. [01:49:55.120 --> 01:50:11.120] That cost about 40 bucks. So sometimes they have three or four of these pools of mortgages running at the same time and one may be profitable and the other one not profitable. [01:50:11.120 --> 01:50:14.120] The one that's profitable is going to have to pay tax on it. [01:50:14.120 --> 01:50:30.120] So they would take a slice off of that one and move it over to the one that's not profitable to balance them out to where they don't have to pay taxes, but they're all making a little bit of profit or at least show a little bit of profit. [01:50:30.120 --> 01:50:49.120] Well, the problem with that is if they got 10,000 notes and they take a slice off that move it to another pool, that's 10,000 times 40 bucks a piece and that doesn't count the time your employees time. [01:50:49.120 --> 01:51:03.120] That's just the fee that have to pay to the clerk. That's 400 grand. That would make this scheme they had going unworkable. [01:51:03.120 --> 01:51:28.120] So they came up with this company called Merse mortgage registered mortgage electronic registration systems and they would pretend to be the holder of the note and this pool would be behind them and they would slice and dice these pools back and forth all they wanted to without filing those with the clerk. [01:51:28.120 --> 01:51:33.120] There was a problem with that. It was illegal. [01:51:33.120 --> 01:51:38.120] There's another problem with that because of the note. [01:51:38.120 --> 01:51:44.120] The holder should have the note, but the whole is changing all over the place. [01:51:44.120 --> 01:51:49.120] So having to move these notes around was very difficult. [01:51:49.120 --> 01:51:57.120] So what they did and they couldn't just put them somewhere because the notes like a bear bond. [01:51:57.120 --> 01:52:10.120] If I have the note, it's payable to me and I can take it and cash it in, sell the note to somebody else and get all that money. [01:52:10.120 --> 01:52:17.120] So these criminals are dealing with criminals. So they had to protect themselves so they shredded the notes. [01:52:17.120 --> 01:52:22.120] That's the solution. Now nobody gets to turn in that note. [01:52:22.120 --> 01:52:31.120] Well, that's another problem because once the mortgage is satisfied, they're required to return the note. [01:52:31.120 --> 01:52:36.120] Remember the Christmas, it's a wonderful life. [01:52:36.120 --> 01:52:43.120] At the end of the program, they had a note burning party and that used to be common. [01:52:43.120 --> 01:52:52.120] You gave a promise to pay once you've paid, you get that promise back and then you go burn it so nobody else comes up with it. [01:52:52.120 --> 01:52:57.120] Well, they can't come up with that note. [01:52:57.120 --> 01:53:00.120] That's their problem. [01:53:00.120 --> 01:53:05.120] And that's why we know we can, that they can't prove up their position. [01:53:05.120 --> 01:53:18.120] Now they bought and paid for the judges, at least in the feds. All the federal judges are pretty well bought and paid for, not so much so in the state. [01:53:18.120 --> 01:53:25.120] So when we challenge you, we want to be careful of what we do so we keep it in the state. [01:53:25.120 --> 01:53:33.120] But point is that Patty, that we can do a lot to them. [01:53:33.120 --> 01:53:37.120] We can give them reason to want to come to the table. [01:53:37.120 --> 01:53:44.120] There is one other possibility and it's likely in your case. [01:53:44.120 --> 01:53:54.120] If they have sold your note more than one time, this was the real scam that was going on. [01:53:54.120 --> 01:53:57.120] The banks were giving out mortgages. [01:53:57.120 --> 01:54:01.120] Mortgages, they did not want to be paid off. [01:54:01.120 --> 01:54:10.120] Because they took the mortgage, once they wrote the mortgage and they sold it to what they called a special purpose vehicle. [01:54:10.120 --> 01:54:17.120] And that special purpose vehicle would collect a bunch of these mortgages and sell them to a pool. [01:54:17.120 --> 01:54:24.120] Each pool had mortgages of about the same mortgage rate and interest rate. [01:54:24.120 --> 01:54:30.120] They're all essentially the same because if one defaulted, they could take it out and replace it with another one. [01:54:30.120 --> 01:54:33.120] And keep the pool stable. [01:54:33.120 --> 01:54:40.120] Well, where I lost my place, where was I? [01:54:40.120 --> 01:54:47.120] They would sell it to a pool, to a special purpose vehicle. [01:54:47.120 --> 01:54:56.120] And then they would take the note that the documentation and change it somewhat and sell it to another pool. [01:54:56.120 --> 01:55:05.120] And another one and another one. China accused Bank of America of selling them the same note 60 times. [01:55:05.120 --> 01:55:10.120] Each time they sold a note, they would buy mortgage insurance on it. [01:55:10.120 --> 01:55:16.120] So they would sell the note for 103% of the original principal. [01:55:16.120 --> 01:55:22.120] So if they sold it 60 times, they've got 60 times the value of your property. [01:55:22.120 --> 01:55:28.120] If you make a payment, they have to make a payment on each one of these to match. [01:55:28.120 --> 01:55:34.120] So they want you to pay it down to 85% of the original principal. [01:55:34.120 --> 01:55:43.120] Because the insurance, the mortgage insurance they purchase on each one of these will pay off 85%. [01:55:43.120 --> 01:55:51.120] But in order for them to get that pay off, you have to foreclose. [01:55:51.120 --> 01:55:57.120] See the problem? This was a horrible scam. [01:55:57.120 --> 01:56:05.120] And they will do anything to get the foreclosure. [01:56:05.120 --> 01:56:10.120] But we got way around that. [01:56:10.120 --> 01:56:14.120] I'll explain that one more off the air. [01:56:14.120 --> 01:56:18.120] What we do is we let them foreclose and then buy the property back. [01:56:18.120 --> 01:56:29.120] We make a deal with them that if this property sells for more than the amount owed, [01:56:29.120 --> 01:56:34.120] you drop all of the fees that you have against it. [01:56:34.120 --> 01:56:44.120] And we'll step back and let you foreclose on the written agreement that immediately on the sale, [01:56:44.120 --> 01:56:54.120] you will return to us any amount over what's owed against the property. [01:56:54.120 --> 01:56:57.120] And then you send a straw buyer in to purchase the property. [01:56:57.120 --> 01:57:02.120] Now you can purchase the property for any amount you want to. [01:57:02.120 --> 01:57:09.120] If somebody else tries to bid against you, you can just bid it right up because everything you bid extra, you're going to get right back. [01:57:09.120 --> 01:57:16.120] And the bank gets their foreclosure and they get their fraudulent insurance scam taken care of. [01:57:16.120 --> 01:57:20.120] But you get your property back. [01:57:20.120 --> 01:57:25.120] So the point of all that stuff is been around this a long time. [01:57:25.120 --> 01:57:27.120] We got lots of maneuvers. [01:57:27.120 --> 01:57:31.120] There is a whole lot you can do. [01:57:31.120 --> 01:57:36.120] This is not anywhere near over. [01:57:36.120 --> 01:57:41.120] What do you think, Patty?
