Today in history, and recent news, since Governor Greg Abbott signed House Bill [01:07.440 --> 01:12.640] 1325 legalizing hemp into taxes law back in June, county prosecutors around the state, [01:12.640 --> 01:17.120] including Houston, Austin, and San Antonio, have been dropping marijuana possession charges and [01:17.120 --> 01:21.600] even refusing to file new ones, since they are stipulating that they do not have the time or [01:21.600 --> 01:26.720] the laboratory equipment to test the herb for THC. Margaret Moore, the Travis County District [01:26.720 --> 01:30.640] Attorney, announced earlier this month that she was dismissing 32 felony possession and [01:30.640 --> 01:35.360] delivery of marijuana cases because of the law. Mr. Abbott and other state officials, [01:35.360 --> 01:39.360] including the Attorney General, stipulated in a letter to county district attorneys back on [01:39.360 --> 01:44.400] Thursday that marijuana has not been decriminalized in Texas and that these actions demonstrate [01:44.400 --> 01:51.040] a misunderstanding of how HB 1325 works, as well as other cities too, like the District Attorney [01:51.040 --> 01:57.280] in El Paso, Cayma Esparza, a Democrat who also stated earlier this month that the law, quote, [01:57.280 --> 02:02.720] will not have an effect on the prosecution of marijuana cases in El Paso. However, the issue [02:02.720 --> 02:07.520] was succinctly summarized by Mr. Brandon Ball, an assistant public defender in Harris County, [02:07.520 --> 02:11.920] who stated that quote, the law is constantly changing on what makes something illegal based [02:11.920 --> 02:15.920] on its chemical makeup. It's important that if someone is charged with something, [02:15.920 --> 02:24.960] the test matches what they're charged with. A paper by Tulane University identified a five [02:24.960 --> 02:29.920] and a half inch American pocket shark. As the first of its kind in the Gulf of Mexico, [02:29.920 --> 02:35.440] the specimen being only the second pocket shark ever captured or recorded with the other one [02:35.440 --> 02:40.800] being found way back in 1979 in the East Pacific Ocean. According to the university paper, the [02:40.800 --> 02:47.520] shark secretes a luminous fluid from a gland near its front fins. For the purpose, it is hypothesized [02:47.520 --> 03:15.520] to lure and prey who may be drawn into the glow. [03:17.520 --> 03:37.520] What are you going to do when they come for you? [04:17.520 --> 04:20.520] Okay, howdy, howdy, Randy Kelton, Brett Fountain [04:20.520 --> 04:27.520] We'll do the wrong radio on this Friday, the 18th day of December, 2020 [04:27.520 --> 04:31.520] And we're gonna start talking about, start out talking about Wise County [04:31.520 --> 04:35.520] That's, for you who don't know, that's the county I'm from [04:35.520 --> 04:39.520] And one of their deputies picked a fight with me [04:39.520 --> 04:46.520] And it's the kind of fight I really like because he did something really stupid [04:46.520 --> 04:56.520] You know, I've gotten older and I've gotten better at not acting when I'm upset or frustrated [04:56.520 --> 05:00.520] Every time I do, I wind up embarrassing myself [05:00.520 --> 05:02.520] And I've gotten a lot better at it [05:02.520 --> 05:08.520] And I did that, I used that skill with this deputy [05:08.520 --> 05:18.520] And he was trying to railroad me into a position to where he could throw me out of the courthouse [05:18.520 --> 05:22.520] And he just couldn't pull it off [05:22.520 --> 05:24.520] And I kind of stuck it to him instead [05:24.520 --> 05:27.520] When I first got to the courthouse, I was there to file some criminal complaints [05:27.520 --> 05:32.520] He said, Miss Kelton, are you willing to use force to get those complaints filed? [05:32.520 --> 05:34.520] I said, of course not [05:34.520 --> 05:39.520] So now, I could do a citizen's arrest, but I'm a combat veteran [05:39.520 --> 05:41.520] I had enough of that, I don't do that anymore [05:41.520 --> 05:43.520] That's what I got you for [05:43.520 --> 05:46.520] Three times he asked me that [05:46.520 --> 05:50.520] And he didn't realize, I got it the first time, I knew exactly what he was trying to do [05:50.520 --> 05:52.520] And it wasn't my first rodeo [05:52.520 --> 05:55.520] He's trying to get some kind of probable cause [05:55.520 --> 05:58.520] So we go up to the district court judge's office [05:58.520 --> 06:02.520] And I'm there to file criminal charges against the county judge [06:02.520 --> 06:05.520] And they know that [06:05.520 --> 06:15.520] And Dick Woods, the bailiff for the district court, blocked the entrance to the judge's office [06:15.520 --> 06:18.520] So I couldn't get to his clerk [06:18.520 --> 06:23.520] And when he wouldn't let me in there, I turned to Riggs [06:23.520 --> 06:26.520] Who had been asking me if I was going to use force [06:26.520 --> 06:30.520] And I was telling him each time that that's his job, not my job [06:30.520 --> 06:35.520] I turned to him and I said, well, Sergeant Riggs, you're up [06:35.520 --> 06:38.520] Arrest that man [06:38.520 --> 06:42.520] He said, I'm not going to arrest him, and you're not going in that office [06:42.520 --> 06:46.520] I said, well, this is awkward [06:46.520 --> 06:50.520] I would ask you to arrest yourself, but I really don't see how that would work [06:50.520 --> 06:57.520] And I would ask Dick to arrest you, but it would be kind of hard [06:57.520 --> 07:03.520] To ask him to arrest you because you didn't arrest him [07:03.520 --> 07:06.520] Somehow I don't think that'll work out so good [07:06.520 --> 07:09.520] So they're standing there, both of them, just fuming [07:09.520 --> 07:13.520] I looked across and there's the district attorney's office [07:13.520 --> 07:16.520] Well, the district attorney, I can get him to take my complaints [07:16.520 --> 07:20.520] They were between me and the judge's door [07:20.520 --> 07:24.520] So there's nothing between me and the DA's door [07:24.520 --> 07:28.520] So I turned, I was in there like a shot [07:28.520 --> 07:33.520] And told him I need to talk to a prosecutor to get him to verify some criminal evidence [07:33.520 --> 07:37.520] And according to his duty under Article 2.05, Texas Code of Criminal Procedure [07:37.520 --> 07:40.520] And the bailiffs took a step back [07:40.520 --> 07:48.520] And they said, well, I'll check to see if the prosecutor has time and that an ADA come out [07:48.520 --> 07:53.520] He said hello to me and said, hey, you got a minute? I need you to verify some criminal evidence [07:53.520 --> 07:58.520] He said, well, I will a little while, but right now I've got something I've got to take care of [07:58.520 --> 08:01.520] I said, okay, I'll be here and he went on out [08:01.520 --> 08:07.520] So let the bailiffs know that they couldn't interfere with me at that point [08:07.520 --> 08:13.520] And then the prosecutors told me to come on back and these two guys followed me into the prosecutor's office [08:13.520 --> 08:20.520] And that's where I said SOB or the venecular for poop [08:20.520 --> 08:23.520] He accused me of saying that [08:23.520 --> 08:25.520] He didn't say venecular for poop [08:25.520 --> 08:30.520] He said that I said SHIT [08:30.520 --> 08:33.520] He accused me of that [08:33.520 --> 08:35.520] Me! [08:35.520 --> 08:39.520] And then he arrested me for it [08:39.520 --> 08:42.520] He was furious [08:42.520 --> 08:47.520] And I was gouging him. I'm talking to the prosecutor and I made a comment about the sheriff's department [08:47.520 --> 08:54.520] I pointed him how the governor had no power to order the sheriff to do anything [08:54.520 --> 08:57.520] And they had claimed the reason they blocked me [08:57.520 --> 09:01.520] They wouldn't let me come in without a mask was because the governor said so [09:01.520 --> 09:07.520] And I can see this guy just thriving in his skin [09:07.520 --> 09:16.520] Finally, he interrupted our conversation with the district attorney to tell me I couldn't use that language [09:16.520 --> 09:19.520] I think I said SOB [09:19.520 --> 09:23.520] I think I called somebody an SOB. I don't know who it was [09:23.520 --> 09:28.520] And I told him, this is a private conversation. You need to butt out [09:28.520 --> 09:33.520] That's what he arrested me for disorderly conduct [09:33.520 --> 09:38.520] Well, you can't commit disorderly conduct in a private office, period [09:38.520 --> 09:41.520] Private conversation, that doesn't apply [09:41.520 --> 09:55.520] And if you do do something that uses vulgar or profane language, it must incite an immediate breach of the peace [09:55.520 --> 10:02.520] Well, he asked one of the women that worked in the office, they were all out front [10:02.520 --> 10:05.520] They heard what I said and was offended [10:05.520 --> 10:09.520] And one of them said, well, she wasn't sure if she heard or not [10:09.520 --> 10:11.520] And in his statement he said that [10:11.520 --> 10:16.520] And then she called him back later and said, no, I was not offended because I didn't hear anything [10:16.520 --> 10:19.520] And that's because you're in the DA's office [10:19.520 --> 10:26.520] And the foyer is next to the DA's office, so you go through a back door [10:26.520 --> 10:32.520] And then down a hall and then back in the DA's office, so they were about 25 feet away [10:32.520 --> 10:36.520] So I wasn't worried about anybody listening in on our conversation [10:36.520 --> 10:39.520] If they were, they shouldn't have been, it's a private conversation [10:39.520 --> 10:42.520] So anyway, that was a good one [10:42.520 --> 10:46.520] That was about as stupid an arrest as he could get [10:46.520 --> 10:54.520] And then instead of taking me to a magistrate when I was in a courthouse full of them [10:54.520 --> 10:58.520] There was the only one that had to take me to would have been the district judge [10:58.520 --> 11:00.520] And that's the one I was trying to get to [11:00.520 --> 11:02.520] That would have worked out well [11:02.520 --> 11:04.520] So they took me straight to jail [11:04.520 --> 11:09.520] So they kicked this soapbox up under my feet, so I'm taking on Wise County [11:09.520 --> 11:16.520] And I had an issue about cash bond [11:16.520 --> 11:23.520] There is no requirement in law for a cash bond [11:23.520 --> 11:28.520] There actually is no provision in law for a cash bond [11:28.520 --> 11:35.520] There is a provision in law for a bail [11:35.520 --> 11:42.520] A bail, actually it's called a bail bond, but a bail bond does not involve money [11:42.520 --> 11:50.520] It is a written agreement between the accused and the state [11:50.520 --> 11:58.520] Stating that you are worth double the amount of the bail exclusive of all costs [11:58.520 --> 12:01.520] You have to be a property owner or a pledge property [12:01.520 --> 12:07.520] But it doesn't say real property, Constitution just says property [12:07.520 --> 12:12.520] It doesn't be a car or truck or set of golf clubs, there may be a difference [12:12.520 --> 12:14.520] But that's a constitutional right [12:14.520 --> 12:25.520] If you can't post bail, then the courts will allow you to post a cash bond in the amount of the bail [12:25.520 --> 12:29.520] Because now you are, they are completely indignified [12:29.520 --> 12:33.520] They require a cash bond [12:33.520 --> 12:36.520] I had a debit card, they wouldn't take a debit card [12:36.520 --> 12:39.520] You know, a property owner in the county [12:39.520 --> 12:46.520] And it turns out that in Chapter 45, Texas Code of Criminal Procedure [12:46.520 --> 12:58.520] In the matter of a classy misdemeanor, a magistrate cannot set a bond [12:58.520 --> 13:03.520] Brett, do you remember which one that is? 45.016 I think [13:03.520 --> 13:07.520] 16, I was thinking maybe 14, let me take a look [13:07.520 --> 13:12.520] It actually said that she had to release you on your own reconnaissance [13:12.520 --> 13:20.520] She couldn't set a bond, that was odd, I wouldn't have expected to find that [13:20.520 --> 13:24.520] But there it was, right there, clearly in the code [13:24.520 --> 13:29.520] But to set one anyway, and it says the maximum amount they possibly could [13:29.520 --> 13:37.520] And the JP set bail, that's what her form said, bail [13:37.520 --> 13:43.520] But the sheriff's office wouldn't take bail, they demanded cash [13:43.520 --> 13:49.520] And that reminded me of a sheriff we had a number of years ago [13:49.520 --> 13:54.520] They had this scam going, the sheriff and two or three deputies [13:54.520 --> 14:03.520] Where we had a rest stop on Highway 287, which is a four-lane highway [14:03.520 --> 14:08.520] And they would go into this rest stop, and if somebody's come and used a urinal [14:08.520 --> 14:14.520] They'd walk and bump up and bump into them, and then accuse them of making a homosexual pass at them [14:14.520 --> 14:16.520] And arrest them [14:16.520 --> 14:22.520] And then, yeah, that's really an ugly charge to have on your record [14:22.520 --> 14:29.520] Then they had charged a $10,000 to $15,000 bond, depending on how much they thought you had [14:29.520 --> 14:38.520] And if you put up a cash bond and waived the bond, they would drop all the charges [14:38.520 --> 14:40.520] And it wouldn't go on your record [14:40.520 --> 14:43.520] Well, they got caught, they made a mistake [14:43.520 --> 14:47.520] Why don't you say what it means to waive a bond? [14:47.520 --> 14:56.520] You give the bond, let the state keep the bond if they'll just drop the case [14:56.520 --> 14:59.520] Well, that's extortion [14:59.520 --> 15:08.520] But if you're a high-level, well-respected member of the community [15:08.520 --> 15:15.520] And a deacon in the church to have that charge against you, no matter how bogus it is [15:15.520 --> 15:18.520] Would absolutely ruin your career [15:18.520 --> 15:22.520] I mean, it would ruin your status in the community [15:22.520 --> 15:25.520] So that was really a big deal [15:25.520 --> 15:31.520] So people would do that to keep from getting their reputation ruined [15:31.520 --> 15:34.520] Well, they made a mistake [15:34.520 --> 15:38.520] They bumped up against this one guy and he liked it [15:38.520 --> 15:42.520] He was the gay guy out of California [15:42.520 --> 15:49.520] And when they arrested him and threatened to move this charge against him, he was not impressed [15:49.520 --> 15:54.520] And he took them on and they all went to jail, including the sheriff [15:54.520 --> 15:58.520] Well, I was thinking about that [15:58.520 --> 16:02.520] Why force a cash bond? [16:02.520 --> 16:09.520] They didn't even indicate that they would take a bail bond from a bondsman [16:09.520 --> 16:12.520] They wanted cash [16:12.520 --> 16:13.520] And I wondered why [16:13.520 --> 16:20.520] And then I got enough, it took a month and my case finally went to a court [16:20.520 --> 16:22.520] Because my case just was in limbo [16:22.520 --> 16:27.520] I put in requests for documentation and there was nothing there [16:27.520 --> 16:28.520] I got nothing [16:28.520 --> 16:33.520] And then a month later, it appears at the J.P.'s office [16:33.520 --> 16:39.520] And she sent me a letter, this is how I knew she had it [16:39.520 --> 16:44.520] Telling me that I could plead guilty and pay a fine if I wanted to [16:44.520 --> 16:51.520] But the first sentence, and I think about this, any of you who's ever had a traffic ticket [16:51.520 --> 16:59.520] That's the misdemeanor in Texas and you get a notice that you could pay the fine or plead not guilty [16:59.520 --> 17:04.520] Are you being harassed by debt collectors with phone calls, letters, or even lawsuits? [20:56.520 --> 21:02.520] I did raise some objection to the bond, especially that it was a cash bond [21:02.520 --> 21:07.520] But it sent up a red flag, so I did some research [21:07.520 --> 21:11.520] And then I wanted to see where the money went [21:11.520 --> 21:17.520] And sent a request to the county auditor because the code said that [21:17.520 --> 21:22.520] The any deputy who takes a cash bond [21:22.520 --> 21:30.520] Must have a receipt book with the seal of the state of Texas on each receipt [21:30.520 --> 21:41.520] And he must file that receipt book with the county auditor every month [21:41.520 --> 21:47.520] Well I wanted to see those receipts and the county auditor had no idea what I was talking about [21:47.520 --> 21:54.520] And I came in, and I thought she was doing a little song and dance self-serve dance [21:54.520 --> 21:59.520] It turned out she really didn't understand what I was asking her [21:59.520 --> 22:03.520] Because as I looked through some of her records [22:03.520 --> 22:09.520] She finally realized what I was after and went across to the county treasurer [22:09.520 --> 22:13.520] And the county treasurer had them [22:13.520 --> 22:17.520] All the receipts, she had all the receipt books [22:17.520 --> 22:24.520] And all the numbers, I went through two or three months and all the numbers were in order [22:24.520 --> 22:32.520] The only thing that I didn't find was numbers out of sequence [22:32.520 --> 22:37.520] All of these receipt books they have printed [22:37.520 --> 22:44.520] And then whichever deputy gets one, they have to sign for it [22:44.520 --> 22:49.520] So they know exactly what numbers each deputy has [22:49.520 --> 22:55.520] The only thing that wasn't covered is if the deputy had his own book printed up [22:55.520 --> 23:01.520] And I need to go see, I'm going to go see my daughter there or so [23:01.520 --> 23:05.520] And finish off that sweeper and I want to see, she paid my bond [23:05.520 --> 23:09.520] I want to see what kind of receipt she got [23:09.520 --> 23:14.520] And see if the number fits in the number scheme [23:14.520 --> 23:21.520] But I was concerned, but in speaking to the auditor and going through their records [23:21.520 --> 23:25.520] It appeared that everything was in order [23:25.520 --> 23:34.520] The concern was that they had everything in printed documents [23:34.520 --> 23:39.520] And I was looking at the documents and I'd asked for them in electronic format [23:39.520 --> 23:45.520] And clearly these were computer generated documents [23:45.520 --> 23:49.520] Didn't raise that issue yet [23:49.520 --> 23:53.520] But I need to do some more research first [23:53.520 --> 23:55.520] But it appeared as though everything was in order [23:55.520 --> 24:03.520] But then again, they had two or three weeks, about a month to get everything in order [24:03.520 --> 24:10.520] But they had the receipts for all the way back to the first of the year [24:10.520 --> 24:16.520] Just in front of me, so if that was the case, then they were very busy [24:16.520 --> 24:21.520] They did a lot of work, but it looked like everything was like it should be [24:21.520 --> 24:23.520] And that's what I'd like to find [24:23.520 --> 24:28.520] That way my allegations don't get spread out [24:28.520 --> 24:33.520] And I don't wind up making an allegation that I get stuffed down my throat [24:33.520 --> 24:40.520] But I understand that you are having some issues with Wiser County and records [24:40.520 --> 24:46.520] Well, yeah, this time it's unrelated to what I was asking for before [24:46.520 --> 24:51.520] This time I'm going to their IT department [24:51.520 --> 24:59.520] Every department head according to Texas government code 552.202 [24:59.520 --> 25:05.520] Every department head is responsible for giving you records out of their office [25:05.520 --> 25:11.520] So 201 says that everybody gets elected [25:11.520 --> 25:18.520] Whoever is the elected official or the chief administrative officer for that office [25:18.520 --> 25:21.520] But 202 says that every department head [25:21.520 --> 25:26.520] So when you go to a governmental body, you can expect to be able to just reach out to the head of the department [25:26.520 --> 25:30.520] And ask for whatever records you need to see [25:30.520 --> 25:36.520] Okay, wait, you're saying that every department head is considered a custodian of the record [25:36.520 --> 25:41.520] Yes, and even if that person turns around and hires somebody [25:41.520 --> people [25:49.520 --> 25:54.520] It doesn't matter, but they're the ones, the head is still the one who's responsible according to the law [25:54.520 --> 26:03.520] So they might hire somebody to do this work for them and they might never even see the records, the request [26:03.520 --> 26:07.520] That's okay, the responsibility is with them though [26:07.520 --> 26:13.520] So I reach out to the Wiser County IT director, he's the head of IT [26:13.520 --> 26:17.520] And I asked him for some IT records [26:17.520 --> 26:23.520] Well, it turns out he doesn't want to give them to me, clearly [26:23.520 --> 26:33.520] Because he's trying to tell me that the county clerk and the appraisal district, yeah, they don't deal with any electronic filing systems [26:33.520 --> 26:36.520] There aren't any [26:36.520 --> 26:43.520] And he's trying to tell me that when I asked about the freshness of their data [26:43.520 --> 26:50.520] You know, should I be considering that it's anywhere from what's typical, two weeks old to maybe two months old [26:50.520 --> 26:56.520] What's a typical refresh, I can expect how fresh of a data set am I looking at [26:56.520 --> 27:03.520] And he says, well, there's no intervals to be considered because there are no electronic filing systems [27:03.520 --> 27:09.520] So, I kind of don't believe that [27:09.520 --> 27:15.520] I know Wise is a small county, but I don't think everybody's using the advocacy system [27:15.520 --> 27:22.520] I looked at some records today and one of them was, one set of records was noticed as e-file [27:22.520 --> 27:31.520] Well, it can't have been because they don't use any of those systems, they don't have electronic filing systems [27:31.520 --> 27:38.520] So, yeah, tomorrow he's going to have a different kind of request on his head [27:38.520 --> 27:52.520] When I sent him a request, I wanted to extract all of the criminal files from the district clerk's record, district and county clerk records [27:52.520 --> 27:59.520] I wanted the criminal for every cause number, every document that had been filed in the case [27:59.520 --> 28:06.520] Now, I know these are in electronic format because I looked at them in electronic format [28:06.520 --> 28:17.520] And ask him for any, for the methods for extracting these records from the database [28:17.520 --> 28:23.520] And his response was, we have no records responsive to your request [28:23.520 --> 28:32.520] And I looked at that and I thought, this must be this guy's first rodeo [28:32.520 --> 28:37.520] He hasn't been down this road before [28:37.520 --> 28:42.520] And now that you've landed on him, started on him [28:42.520 --> 28:54.520] But I suspect before too long his attitude begin to adjust because I will file a complaint against him with the district judge [28:54.520 --> 29:00.520] Along with several others, the district judge would do nothing with any of them [29:00.520 --> 29:05.520] And then we take them all to Travis County [29:05.520 --> 29:16.520] And see how it works out in Travis County because I'm claiming, the primary claim is that all of these public officials are acting in concert collusion with one another [29:16.520 --> 29:20.520] Because they won't hold an examining trial [29:20.520 --> 29:36.520] And I have officials that I'm claiming as part of this concert collusion, if not conspiracy, from Travis County as well as Wise County [29:36.520 --> 29:41.520] That means I can file any one I want to, we'll do that in Travis [29:41.520 --> 29:46.520] And make this little guy go down to Travis I want to compare the arrest records with the filings in the district court. I still think they're stealing bond money [34:30.520 --> 34:54.520] I want to see if I find people who have been arrested and for an on-site offences but I don't see a filing in the district court or the county court that just kind of get arrested and then they disappear from the system [34:54.520 --> 35:15.520] See, I was arrested and it was a month before I appeared in the system. If it had been someone else, that would have been time for them to make a deal with me, especially if I put up a cash spot [35:15.520 --> 35:36.520] They already know better. They know you're not gonna make a deal. They know you. Yeah, they wouldn't do it to me because they absolutely knew better but somebody who doesn't, like the guy who gets arrested a lot, he knows the deal [35:36.520 --> 35:49.520] He knows if you get accused of a crime in Texas, they're gonna find you guilty and that's all there is to it. So they know that. So they'll make any kind of deal they can if they can keep this off the record and stay out of jail [35:49.520 --> 36:10.520] So they're easy marks and that's what I'm looking for. I'm looking for discrepancies and the clerk knows that. They know exactly what I'm looking for and did that on purpose because I wanted them to do exactly what they're doing [36:10.520 --> 36:23.520] I personally went to the district clerk's office to look at the records because they're not online but you can look at them on their computer in their office [36:23.520 --> 36:36.520] I put in the guest password. It let me look up the file but it said I did not have permission to look at any of the documents [36:36.520 --> 36:56.520] Now Brett, how does that happen? How does it happen that the password works? It got me in the system but then there was some kind of restriction got put on that [36:56.520 --> 37:08.520] Yeah, they've got it set up where we the people are not allowed to see records. They have special permission from the gods in the back room [37:08.520 --> 37:14.520] I've been in there before and didn't have this problem [37:14.520 --> 37:18.520] Was it some certain records that they didn't want you to see or is it any records? [37:18.520 --> 37:31.520] Well right now they know that I know that every single one of them is illegal. There's no 16-17 order [37:31.520 --> 37:36.520] They probably learned that by paying attention to what you were asking them for [37:36.520 --> 37:59.520] Well the last request to the head of the criminal section, I made that abundantly clear. How can you issue a cause number in a criminal case when there is no order from a magistrate finding jurisdiction? [37:59.520 --> 38:09.520] These documents must be somewhere otherwise there is a serious problem with your procedures [38:09.520 --> 38:18.520] So show me these records. I know that they're somewhere and this one went quite a while before they responded [38:18.520 --> 38:34.520] And I pressed this clerk. When I didn't get a response, I sent her another one back and I explained all of this and I said that I have an issue [38:34.520 --> 38:40.520] But you're not part of it and I don't want you to be part of it [38:40.520 --> 38:49.520] So if you don't have any records responsive to my request just say so and I'll be done with you [38:49.520 --> 38:59.520] And I think because it took so long and this time I didn't get anything from the prosecuting attorney who had been answering these requests [38:59.520 --> 39:11.520] And I kind of questioned him about that. He's a county attorney. Excuse me the county [39:11.520 --> 39:19.520] We don't have a, you're supposed to have a little button on your microphone that you can shut it off and our systems don't have one of my policies [39:19.520 --> 39:34.520] Where was I? The county attorney. The county attorney is paid by the county [39:34.520 --> 39:41.520] The district attorney and the district judge and all that are paid by the state [39:41.520 --> 39:52.520] So asking what are you doing, acting as an attorney for the state, that should be Greg Lowry, the district attorney [39:52.520 --> 40:06.520] My concern is that if this becomes an issue, then I raise an issue and try to use your response to my information request in court [40:06.520 --> 40:14.520] They're going to say that's not valid because you had no standing to issue that answer [40:14.520 --> 40:22.520] I told him I'm not too concerned about that now but it may become a problem in the future [40:22.520 --> 40:29.520] And I stopped getting responses from him from the district court [40:29.520 --> 40:36.520] He thought maybe it would be if he'd have only one crime of impersonating a public official, that would be enough [40:36.520 --> 40:50.520] Possibly. So when I filed this last one, I didn't get a response from the district attorney because I'm sure he told him that [40:50.520 --> 41:01.520] Greg Lowry knows I know the code better than his people do because I took him on once over this exact issue [41:01.520 --> 41:08.520] The requirement that you've been taking to a magistrate and he brought out his ADA who was also a law professor [41:08.520 --> 41:17.520] And now it wasn't this issue, it was about grand juries, about how the prosecuting attorney had no jurisdiction [41:17.520 --> 41:26.520] Step back, the prosecuting attorney had no discretion in the matter of a complaint against a public official [41:26.520 --> 41:34.520] He must give it to the grand jury and he brought her in and we had a meeting and we kind of went toe to toe [41:34.520 --> 41:44.520] And when I was done, Lindy turned to the prosecutor and said, he's right, that's what it says [41:44.520 --> 41:51.520] So he knows I do my homework, he knows I know my code, and he didn't respond [41:51.520 --> 41:57.520] I think he wants nothing to do with this [41:57.520 --> 42:03.520] And that works for me, but at least I got the county attorney out of it [42:03.520 --> 42:06.520] Have you barged with the county attorney yet? [42:06.520 --> 42:07.520] Nope [42:07.520 --> 42:09.520] No, I haven't, I didn't [42:09.520 --> 42:11.520] Yes, I did, early on [42:11.520 --> 42:15.520] Oh, good. In the recent round I haven't [42:15.520 --> 42:18.520] Well, yeah, he got one early on [42:18.520 --> 42:25.520] Just for the record, he is fair game [42:25.520 --> 42:34.520] I take great pleasure, he's the one that told me once, you know, I've told the story about the officer stopping me from my [42:34.520 --> 42:43.520] registration being expired and I told him only two years, what's the problem? Well, that case never came to court [42:43.520 --> 42:50.520] And I saw James, the county attorney in the courthouse, and I said, James, what happened to my criminal, my complaint against me? [47:38.520 --> 47:40.520] And I went back and I'm looking at my records [47:40.520 --> 47:43.520] And I was wondering where did I leave off with Sheriff Aiken [47:43.520 --> 47:47.520] Because I had asked him about this arrest business [47:47.520 --> 47:50.520] And they're trying to withhold [47:50.520 --> 47:54.520] They don't want to give me those records [47:54.520 --> 47:57.520] Like, I don't know if they're just so scared that [47:57.520 --> 48:01.520] We the people might have to hear a four letter word [48:01.520 --> 48:03.520] Or what it is that they're really concerned about [48:03.520 --> 48:06.520] Or they might notice that there was no disturbance of the piece [48:06.520 --> 48:10.520] And it's right there on video and they don't want to show me [48:10.520 --> 48:14.520] But for whatever reason, they're trying to not give me the records [48:14.520 --> 48:16.520] They don't want to give me the incident report [48:16.520 --> 48:19.520] Any kind of written things, body cams, nothing [48:19.520 --> 48:21.520] They're trying to withhold everything [48:21.520 --> 48:28.520] And they went ahead and sent a letter to the AG [48:28.520 --> 48:32.520] The Attorney General asking for the Attorney General [48:32.520 --> 48:37.520] To give them permission to withhold this public information [48:37.520 --> 48:43.520] And they didn't tell me about it until, I think it was eight days later [48:43.520 --> 48:49.520] When they finally said that they were reaching out to the AG [48:49.520 --> 48:53.520] Well, I immediately, same day, reached out to the AG [48:53.520 --> 48:58.520] And made sure that Mr. Paxson knows full well what's really going on here [48:58.520 --> 49:05.520] And I put it in there to make sure that they know that [49:05.520 --> 49:09.520] My request was ignored for over ten business days [49:09.520 --> 49:12.520] Obviously triggering the lawful conclusion [49:12.520 --> 49:17.520] Responsive records are 100% public information [49:17.520 --> 49:21.520] So Sheriff Aiken failed to comply with the deadlines that are made mandatory [49:21.520 --> 49:29.520] By 552-301 and 305, Texas government code [49:29.520 --> 49:32.520] Have you received a response? [49:32.520 --> 49:34.520] No, no response at all [49:34.520 --> 49:35.520] How long has it been? [49:35.520 --> 49:38.520] That was November 26 [49:38.520 --> 49:41.520] Been what, that's like three weeks? [49:41.520 --> 49:45.520] Approaching a month [49:45.520 --> 49:53.520] Yep, might be a good time to get Paxson to touch the tar baby [49:53.520 --> 49:58.520] Send him a criminal complaint [49:58.520 --> 50:03.520] And when he doesn't give it to a magistrate [50:03.520 --> 50:08.520] Then we name him [50:08.520 --> 50:11.520] I guess I should do that [50:11.520 --> 50:19.520] Unless you want to be part of what I'm doing going after him [50:19.520 --> 50:22.520] Because you're the one that they, you know [50:22.520 --> 50:27.520] Wise County denied records in this case [50:27.520 --> 50:34.520] And the criminal acts associated with this case are now acts from [50:34.520 --> 50:38.520] Not just in Wise County, but also in Travis County [50:38.520 --> 50:42.520] If you file with the Attorney General [50:42.520 --> 50:48.520] And the Attorney General a few years ago, they changed 39.03 [50:48.520 --> 50:53.520] That's, for all of you don't know, that's official oppression [50:53.520 --> 50:59.520] And the legislature changed the statute so that [50:59.520 --> 51:06.520] The Attorney General who used to only have original jurisdiction [51:06.520 --> 51:14.520] In the matter of a criminal complaint against a district attorney [51:14.520 --> 51:17.520] For violating the Open Records Act [51:17.520 --> 51:21.520] That was the only time that a Texas Attorney General had original [51:21.520 --> 51:25.520] Original jurisdiction to prosecute [51:25.520 --> 51:27.520] They changed it [51:27.520 --> 51:31.520] And now the Attorney General has original prosecution [51:31.520 --> 51:36.520] In any allegation against a public official [51:36.520 --> 51:43.520] The last time I filed with him they responded that they didn't have jurisdiction [51:43.520 --> 51:49.520] And with most of those, we had too many fights to follow that one through [51:49.520 --> 51:52.520] But this time I don't [51:52.520 --> 51:59.520] This time I will file against this tech guy [51:59.520 --> 52:04.520] So they're going to get your full attention, full and undivided attention [52:04.520 --> 52:10.520] Oh yeah, it's going to make me a lot of money [52:10.520 --> 52:13.520] Well, you know, doing the right thing for the right reasons is one thing [52:13.520 --> 52:19.520] But money's better [52:19.520 --> 52:22.520] So money [52:22.520 --> 52:25.520] But that's the only way you can get it done [52:25.520 --> 52:28.520] They don't pay any attention to anything else [52:28.520 --> 52:32.520] But mainly I want to go after at this point [52:32.520 --> 52:36.520] I'm not taking on the grand jury issue [52:36.520 --> 52:43.520] I'm taking on only the take before magistrate issue [52:43.520 --> 52:47.520] I send this complaint to the Attorney General [52:47.520 --> 52:49.520] He's a really nitpicking complaint [52:49.520 --> 52:53.520] This is a tech guy who doesn't necessarily know squat [52:53.520 --> 52:57.520] Sent me this frivolous little response [52:57.520 --> 53:02.520] And he probably doesn't realize it's a class A misdemeanor [53:02.520 --> 53:05.520] So I'm not going to tell him [53:05.520 --> 53:10.520] You know, if he needs legal advice, well, I'm sure he can go to the county attorney [53:10.520 --> 53:13.520] But he hadn't done so good so far [53:13.520 --> 53:18.520] Maybe you want to try the district attorney, but maybe you won't talk to him either [53:18.520 --> 53:19.520] So we'll see [53:19.520 --> 53:22.520] But anyway, I'm not giving him legal advice [53:22.520 --> 53:25.520] And I'm certainly not going to give him fair warning [53:25.520 --> 53:28.520] I'll just go ahead and file the criminal complaint [53:28.520 --> 53:31.520] And the more nitpicking it is, the better [53:31.520 --> 53:37.520] Because the Attorney General is not going to want to prosecute this guy [53:37.520 --> 53:39.520] And that's what I want [53:39.520 --> 53:46.520] That's what I keep telling everybody, never ask a public official to do anything you actually want them to do [53:46.520 --> 53:53.520] If he does what the code says he's supposed to do, well, he'll ruin everything [53:53.520 --> 53:59.520] If he takes it to a magistrate, the magistrate will not find probable cause [53:59.520 --> 54:03.520] There goes all my stuff right out the window [54:03.520 --> 54:10.520] So I'm counting on him not doing what I ask him to do [54:10.520 --> 54:13.520] So also, I think the frauds are pretty good [54:13.520 --> 54:15.520] I think they are too [54:15.520 --> 54:20.520] And then I get to sue him personally [54:20.520 --> 54:24.520] And all of these suits I want them to be personally [54:24.520 --> 54:28.520] Because when this tech guy sent me that response [54:28.520 --> 54:33.520] He did not do that in his capacity as a public official [54:33.520 --> 54:37.520] Or even as an, I don't know if he's a public official or not [54:37.520 --> 54:42.520] But if he is the head of the technical department for the county [54:42.520 --> 54:46.520] Then essentially he's at least a quasi-public official [54:46.520 --> 54:50.520] He certainly falls under open records [54:50.520 --> 54:54.520] So he is liable [54:54.520 --> 54:58.520] Even though he probably doesn't have a clue [54:58.520 --> 55:06.520] But a culpability, chapter 7, Texas code or Texas penal code [55:06.520 --> 55:12.520] Doesn't go to what you actually knew [55:12.520 --> 55:19.520] It goes to the intent of your action [55:19.520 --> 55:25.520] It doesn't go to whether you know something is criminal or not [55:25.520 --> 55:27.520] It goes to the intent of your action [55:27.520 --> 55:30.520] If you intended to do this thing [55:30.520 --> 55:32.520] And this thing was criminal [55:32.520 --> 55:36.520] But you didn't know it was [01:05:59.520 --> 01:06:04.520] He said that they have no records responsive to my request [01:06:04.520 --> 01:06:08.520] Now this is different from, I've asked that same question of other places [01:06:08.520 --> 01:06:12.520] And I've gotten other sheriffs to tell me that some of them send me a CD [01:06:12.520 --> 01:06:19.520] With all kinds of stuff from their training manuals, things that they, nope, not him, nothing [01:06:19.520 --> 01:06:28.520] Good, so I get to say that the statute's 14.06 [01:06:28.520 --> 01:06:33.520] And 543.006 [01:06:33.520 --> 01:06:38.520] Both require, I'm sorry, 543.002 [01:06:38.520 --> 01:06:43.520] Under 002, if they make an arrest, they are to take them directly to a magistrate [01:06:43.520 --> 01:06:45.520] That's in the transportation code [01:06:45.520 --> 01:06:52.520] And the penal code 14.006 requires them to take the person directly to the nearest magistrate [01:06:52.520 --> 01:06:56.520] Now that's really, really clear in the statute [01:06:56.520 --> 01:07:03.520] So since the officer did not get any training otherwise [01:07:03.520 --> 01:07:12.520] Then I just got a call from someone who normally calls into the show [01:07:12.520 --> 01:07:21.520] Brett, while I'm talking can you call in the caller line and see if it's working? [01:07:21.520 --> 01:07:23.520] Okay [01:07:23.520 --> 01:07:27.520] Okay, and then tell me where I was before I got interrupted [01:07:27.520 --> 01:07:30.520] Oh, oh, oh, I got it, I got it, okay [01:07:30.520 --> 01:07:34.520] So this deputy arrests somebody [01:07:34.520 --> 01:07:38.520] And hasn't anybody told him what to do [01:07:38.520 --> 01:07:44.520] So he decides, well, I'm not going to do what the statute says [01:07:44.520 --> 01:07:51.520] I'm going to take this sucker to jail instead, throw his behind in the can [01:07:51.520 --> 01:07:55.520] So well, nobody told you to do that [01:07:55.520 --> 01:07:58.520] So you acted on your own [01:07:58.520 --> 01:08:05.520] Acted in clear and direct violation of well-established law [01:08:05.520 --> 01:08:08.520] That was a crime, so I'm going to charge him criminally [01:08:08.520 --> 01:08:12.520] And then I'll file a complaint with T. Cole [01:08:12.520 --> 01:08:18.520] And claim that T. Cole is the ones who trains these officers [01:08:18.520 --> 01:08:22.520] And since this is a clear statutory commandment [01:08:22.520 --> 01:08:29.520] Certainly T. Cole trained him to follow the law, but he didn't [01:08:29.520 --> 01:08:35.520] He chose to take the person to jail instead [01:08:35.520 --> 01:08:40.520] So that's first degree felony aggravated assault [01:08:40.520 --> 01:08:46.520] And T. Cole, the officer, T. Cole, the officer's immediate supervisor [01:08:46.520 --> 01:08:50.520] T. Cole, the intake officer at the jail [01:08:50.520 --> 01:08:54.520] T. Cole, the intake officer's lieutenant [01:08:54.520 --> 01:09:00.520] And T. Cole, the sheriff on every one of them [01:09:00.520 --> 01:09:05.520] And then I'll build this lawsuit for them taking me to jail [01:09:05.520 --> 01:09:08.520] Now, this is nice and clean [01:09:08.520 --> 01:09:14.520] The officer arrested me inside the courthouse [01:09:14.520 --> 01:09:17.520] In the prosecutor's office, if you open [01:09:17.520 --> 01:09:21.520] There's a side door that opens right into the courtroom [01:09:21.520 --> 01:09:24.520] And the judge was in there [01:09:24.520 --> 01:09:29.520] So there was a judge 50 feet away, a magistrate [01:09:29.520 --> 01:09:33.520] There's another magistrate about 150 feet away downstairs [01:09:33.520 --> 01:09:40.520] There's another magistrate about 500 yards away in JP's office across street [01:09:40.520 --> 01:09:44.520] He took me straight to jail instead, didn't beat me up [01:09:44.520 --> 01:09:47.520] Didn't talk nasty to me [01:09:47.520 --> 01:09:50.520] He did get excited when I got a phone call and answered it [01:09:50.520 --> 01:09:52.520] He got pretty excited about that [01:09:52.520 --> 01:09:55.520] But took me straight to jail [01:09:55.520 --> 01:09:59.520] And then the intake guy put me into the jail [01:09:59.520 --> 01:10:03.520] Even after I asked him to take me directly to the nearest magistrate [01:10:03.520 --> 01:10:05.520] He said, that's not going to happen [01:10:05.520 --> 01:10:08.520] Well, I had to ask you how to refuse [01:10:08.520 --> 01:10:11.520] It's clean [01:10:11.520 --> 01:10:16.520] There are no secondary issues [01:10:16.520 --> 01:10:18.520] The only one issue [01:10:18.520 --> 01:10:23.520] You did not take me directly to the nearest magistrate [01:10:23.520 --> 01:10:28.520] And when I look at the records, they do it to everybody [01:10:28.520 --> 01:10:32.520] But the sheriff said he didn't train him to do that [01:10:32.520 --> 01:10:37.520] He threw his officers under the bus [01:10:37.520 --> 01:10:45.520] I seriously doubt that he was considering that when he gave Brett that frivolous response [01:10:45.520 --> 01:10:52.520] But we'll see if we can adjust his attitude for doing that [01:10:52.520 --> 01:10:56.520] Maybe he'll think better of it next time because we'll charge each officer [01:10:56.520 --> 01:11:02.520] And Brett, what do you think that's going to do to their bond rating? [01:11:02.520 --> 01:11:07.520] And if Scott was on, Scott would tell you what's going to happen [01:11:07.520 --> 01:11:12.520] When we start filing TECO complaints against the deputies [01:11:12.520 --> 01:11:17.520] They're going to disappear, but that's not going to help them [01:11:17.520 --> 01:11:21.520] Even if they quit, even if they go to another department [01:11:21.520 --> 01:11:28.520] I'll keep hammering them for each arrest they made back as far as I want to go [01:11:28.520 --> 01:11:35.520] I'm building a tool [01:11:35.520 --> 01:11:43.520] If I can get that little tech guy to give me the database query [01:11:43.520 --> 01:11:47.520] So I can download all these records I want to see [01:11:47.520 --> 01:11:55.520] If they email the records to me, then I can take those [01:11:55.520 --> 01:11:59.520] And extract all the information I need into a spreadsheet [01:11:59.520 --> 01:12:04.520] Use that spreadsheet to merge all of the emerging to complaints [01:12:04.520 --> 01:12:07.520] And have the system just spit them out [01:12:07.520 --> 01:12:11.520] I won't even have to wear out a pencil [01:12:11.520 --> 01:12:15.520] And then we start every day, we send another one [01:12:15.520 --> 01:12:19.520] That's one after the next, after the next, after the next [01:12:19.520 --> 01:12:22.520] I think they're going to get real excited [01:12:22.520 --> 01:12:30.520] So Brett, what are they likely to try to do to stop me? [01:14:05.520 --> 01:14:09.520] Where I'm getting my information is in the public record and he can't get to it [01:14:09.520 --> 01:14:12.520] He can't change what's in the record [01:14:12.520 --> 01:14:18.520] So he's going to have to do something in the courts [01:14:18.520 --> 01:14:23.520] Other than having me arrested and shot [01:14:23.520 --> 01:14:26.520] But that's why I'm building this into a tool [01:14:26.520 --> 01:14:31.520] So what I'll do is when I file these criminal complaints [01:14:31.520 --> 01:14:36.520] I'll have their address and if they have an email I'll have that as well [01:14:36.520 --> 01:14:40.520] I will email to them what I did [01:14:40.520 --> 01:14:46.520] And a link to a lawsuit they can download and file [01:14:46.520 --> 01:15:00.520] And I will secure an offshore server in a place like Finland or Switzerland [01:15:00.520 --> 01:15:04.520] Somewhere that if the United States comes to them and tells them [01:15:04.520 --> 01:15:06.520] I want you to shut down this server [01:15:06.520 --> 01:15:13.520] They will show them where the door is. 70% of Finland's income is internet [01:15:13.520 --> 01:15:20.520] Finland, Norway, a number of these northern countries, Iceland is probably the most protective [01:15:20.520 --> 01:15:25.520] But I have trouble dealing with Iceland because nobody speaks English [01:15:25.520 --> 01:15:31.520] And their language is so different [01:15:31.520 --> 01:15:34.520] I couldn't figure any of it out [01:15:34.520 --> 01:15:39.520] But anyway, I'll have one offshore so they can't shut it down [01:15:39.520 --> 01:15:44.520] And I'm not writing the complaints the computer is [01:15:44.520 --> 01:15:49.520] So even if they could charge the computer with the illegal practice of law [01:15:49.520 --> 01:15:52.520] It's offshore and it's out of their jurisdiction [01:15:52.520 --> 01:15:55.520] So what would you do?
