library put in a [04:32.600 --> 04:36.720] request with them and then wait for an answer to be emailed to me about what [04:36.720 --> 04:41.280] we've got and several of the things that I have noticed from the ones I've gotten [04:41.280 --> 04:45.520] especially when it comes to these older laws there are things going on here and [04:45.520 --> 04:50.480] the way Texas law was originally set up that have affected how the laws have [04:50.480 --> 04:55.280] been interpreted over the years originally the state Constitution for [04:55.280 --> 05:04.720] bad any legislative enactment to contain more than one object not subject object [05:04.720 --> 05:11.880] so every law had to be written independent of everything else to deal [05:11.880 --> 05:17.880] with a specific object of the legislation later on they amended the [05:17.880 --> 05:24.720] Constitution to allow them to deal with subjects involving multiple objects this [05:24.720 --> 05:32.400] is where the law became more clear as to its intent because under the object rule [05:32.400 --> 05:38.000] they can enact laws that said things for instance this is an act for the purpose [05:38.000 --> 05:43.160] of creating a law requiring the registration of motor vehicles okay [05:43.160 --> 05:50.520] motor vehicle being the individual object in that regard but what that meant [05:50.520 --> 05:55.040] was that the caption since it was limited to the object the title of the [05:55.040 --> 05:59.360] bill was limited to the object that it was being that was being legislated upon [05:59.360 --> 06:05.760] it didn't tell us what the context was the context being the subject matter to [06:05.760 --> 06:12.520] which the object related now even at that time frame though there should have [06:12.520 --> 06:17.280] been certain things that should have been obvious to the courts but they [06:17.280 --> 06:22.840] weren't and I don't know why but let's think about this for a second [06:22.840 --> 06:30.240] automobiles started appearing in this country and the various states pre 1900 [06:30.240 --> 06:36.240] believe it or not okay they weren't mass-manufactured until later after the [06:36.240 --> 06:43.200] 19 after 1900 but different types of inventions that were for all intents and [06:43.200 --> 06:49.160] purposes the original motor vehicles created and used in this country they [06:49.160 --> 06:54.640] did exist and they didn't require licensing or registration or any of that [06:54.640 --> 06:58.440] other kind of crap in order for the people that invented them to use them [06:58.440 --> 07:03.640] the courts were ruling on those things in those days was very simple it was [07:03.640 --> 07:08.680] very direct it was very rights oriented a person had the right to use anything [07:08.680 --> 07:14.120] they purchased or created in any manner they wanted to as long as they didn't [07:14.120 --> 07:18.360] harm someone else or someone else's property while they were doing it or [07:18.360 --> 07:27.000] simply by using it okay and so anything that happened that they used whatever [07:27.000 --> 07:33.240] type of motor vehicle they'd invented whether it was you know whatever if they [07:33.240 --> 07:37.320] injured someone with it they were liable for the injury but it had nothing to do [07:37.320 --> 07:42.360] with them using it for as a motor vehicle okay it wasn't even called a [07:42.360 --> 07:48.440] motor vehicle in those days but the fact of the matter is as the law developed [07:48.440 --> 07:55.360] over time the subject matter issue came to the forefront to clarify what the [07:55.360 --> 08:01.040] limitations originally were as well as what they are today now you have to [08:01.040 --> 08:05.000] understand that even though the legislature had to focus on the object [08:05.000 --> 08:10.000] of the legislation what the legislature had no power to do was to deprive the [08:10.000 --> 08:18.160] people of their right of creation ownership and use of their own property [08:18.160 --> 08:25.280] for their own purposes the courts knew this very very well they understood it [08:25.280 --> 08:30.920] very very well and they upheld everything they did accordingly at that [08:30.920 --> 08:39.240] time when the issue became one of subject matter context being the way of [08:39.240 --> 08:44.440] containing legislation then when the legislature first pinned the subject [08:44.440 --> 08:50.280] matter of these individual laws into a cohesive cohesive whole which they did [08:50.280 --> 09:00.200] in 1995 okay and turned it from a different grouping of objects under a [09:00.200 --> 09:07.880] category of law into a specific group of objects within a specific subject matter [09:07.880 --> 09:14.360] context of law the law became crystal clear as to what it pertained to and how [09:14.360 --> 09:20.840] it had to be applied the problem we're having right now today is that our [09:20.840 --> 09:30.040] courts are using the old object method of analysis and the court rulings on the [09:30.040 --> 09:37.400] objects of the day rather than looking at the current method that allows them [09:37.400 --> 09:42.520] to put it with it the legislature to put the objects within a specific legal [09:42.520 --> 09:48.600] context and then the courts have to apply them within that context they're [09:48.600 --> 09:55.960] ignoring that aspect of what they do what they're required to do this is one [09:55.960 --> 09:59.880] of the major rules of statutory construction you have to read the law as [09:59.880 --> 10:05.680] a whole the courts have told us time and time again that the statute is not the [10:05.680 --> 10:11.200] law the original bill that's been enrolled with the governor's signature [10:11.200 --> 10:21.240] and the signature of the two chairs of the each house is the actual law and in [10:21.240 --> 10:27.560] that it tells us that the subject matter that all of that law is related to [10:27.560 --> 10:36.920] within that given bill is something in the case of the transportation code in [10:36.920 --> 10:45.760] 1995 we know that subject was set to transportation now we also know the [10:45.760 --> 10:52.160] third Court of Appeals here in Texas has ardently tried to avoid the issue by [10:52.160 --> 10:58.160] never ruling on the subject directly they have never given us a definition of [10:58.160 --> 11:02.920] transportation they simply said they've disagreed with the definition that the [11:02.920 --> 11:09.880] defendant in the cases they've decided attempted to apply it and use it they [11:09.880 --> 11:14.760] didn't tell us what that definition was in their opinions that the defendant was [11:14.760 --> 11:19.800] putting forward nor did they turn around and tell us what they believe the proper [11:19.800 --> 11:27.120] legal definition of transportation was they've avoided the issue and the things [11:27.120 --> 11:34.360] I'm telling you right now are the reason why if these people are as well educated [11:34.360 --> 11:40.320] in the law as they want the rest of us to believe then it is not a stretch of [11:40.320 --> 11:44.480] my imagination to say that they know damn good and well that what they're [11:44.480 --> 11:52.640] doing is wrong how they're doing it is wrong and that the reason they're doing [11:52.640 --> 12:03.760] it is money thus it makes what they're doing willful and illegal the courts are [12:03.760 --> 12:10.240] required to apply the law as it is enacted by the legislature that's any [12:10.240 --> 12:16.320] law not just transportation law it's criminal law it's civil law it's tort [12:16.320 --> 12:24.400] law it's any law the courts cannot rewrite it the courts cannot make it [12:24.400 --> 12:32.480] apply to something that the letter of the law does not have in it and nowhere [12:32.480 --> 12:41.920] in our entire history do we have where transportation has ever been ruled to [12:41.920 --> 12:49.440] encompass the private activities of the people upon the highways not once ever [12:49.440 --> 12:58.280] in any precedent setting court not once now when we go through this and we hear [12:58.280 --> 13:01.520] all the arguments from the other side going well it says right here well it [13:01.520 --> 13:05.080] says right here they're doing what they always do they are cherry-picking [13:05.080 --> 13:09.880] specific statutes with the phrasing they want to use and they're ignoring the [13:09.880 --> 13:15.760] context of the bill that created the statute they're using okay they're [13:15.760 --> 13:21.960] completely ignoring the single subject context that the Constitution requires [13:21.960 --> 13:28.560] that the law requires and that the bill actually contains but the statutes do [13:28.560 --> 13:39.040] not so part of what's taking so long with this is trying to draw the diagram [13:39.040 --> 13:43.480] that goes with it because I've told y'all for years part of what I'm [13:43.480 --> 13:51.600] working on is basically a flow chart mind map of how all of the individual [13:51.600 --> 13:56.880] statutes across all of the codes are interacting at any given point for [13:56.880 --> 14:01.840] instance when a police officer initiates a traffic stop there are portions of the [14:01.840 --> 14:05.400] transportation code there are portions of the code of criminal procedure there [14:05.400 --> 14:13.360] are portions of the penal code there are portions of the business code or I'm [14:13.360 --> 14:20.040] sorry occupation code etc etc there's all kinds local government code [14:20.040 --> 14:27.760] government code all of these are kicking in at individual points across this [14:27.760 --> 14:35.120] encounter whether it be at the moment to stop is performed or it be when you make [14:35.120 --> 14:41.320] your first appearance or be when you file for emotions hearing or any type of [14:41.320 --> 14:45.920] receding in the matter etc etc etc all the way through the appellate course [14:45.920 --> 14:52.520] process and final opinion there are tons of codes and statutes that are [14:52.520 --> 14:58.080] interacting with each other across the board and making that mind map is [14:58.080 --> 15:03.440] extremely difficult okay there's no easy way to make it there's no [15:03.440 --> 15:10.000] convoluted way to make it and I see some very advanced mappings of some of this [15:10.000 --> 15:15.120] stuff that take up I mean I'm not this stuff but similar types of objects and [15:15.120 --> 15:21.200] subjects that are very very complicated in their relationships and there is no [15:21.200 --> 15:27.080] easy way to read any of it much less to work with it on a computer screen of [15:27.080 --> 15:35.040] such small size and still be able to read it it's complicated so given that [15:35.040 --> 15:41.280] this has taken a lot of time to put this material together I know it's been you [15:41.280 --> 15:49.000] know a while it's been 2009 was the original seminar and here we are what 20 [15:49.000 --> 15:54.800] years 20 or I'm sorry 11 years later and we still haven't got a second version of [15:54.800 --> 15:59.840] it and the reason for that also is that the law itself doesn't change that often [15:59.840 --> 16:08.280] at any significant way but here in the last six years that has yet the courts have ruled that you don't have privacy in that car [24:29.560 --> 24:34.920] even though it's yours and the state can tell you what you can and can't do with [24:34.920 --> 24:39.440] it and that they can search it if they arrest you even though the arrest itself [24:39.440 --> 24:45.200] is absolutely illegal because it is based upon a subject matter application [24:45.200 --> 24:49.880] of the law that violates the law [24:50.320 --> 24:56.200] because the state is committing fraud upon the people the moment they try to [24:56.200 --> 25:01.680] convert their private conveyance into a motor vehicle without full disclosure of [25:01.680 --> 25:06.080] what the person is doing when they're told they have to register it they are [25:06.080 --> 25:11.160] converting their right to travel into a privileged activity of working and using [25:11.160 --> 25:15.480] the roads as a place of business by insisting you have to have a license to [25:15.480 --> 25:26.520] get on the road in the first place it is fraud through conversion every single [25:26.520 --> 25:32.080] part of it this is what they're protecting because that fraud gives them [25:32.080 --> 25:42.080] enormous power over the people okay there's an old saying that it's really [25:42.080 --> 25:46.880] hard to get a man to understand what he's doing wrong with his paycheck [25:46.880 --> 25:55.440] depends entirely upon his not knowing at understanding that's what lawyers are [25:55.440 --> 26:05.200] there for what judges are there for that's what cops are there for they are going to call it [26:35.880 --> 26:40.680] criminal law then we're going to create a set of administrative all laws over [26:40.680 --> 26:44.360] here with criminal penalties but you don't have the same protections under it [26:44.360 --> 26:48.880] and it's criminal law that you do over here under this criminal law it's [26:48.880 --> 26:55.200] completely hypocritical because we didn't give them the power to decide any [26:55.200 --> 27:09.680] of that but they do it day in and day out and my biggest concern is how few [27:09.680 --> 27:16.880] people in this country bother to ask why why do they do it and why do they [27:16.880 --> 27:22.880] continue to get away with it then they also forget to ask how how do they [27:22.880 --> 27:29.360] continue to get away with it nobody they're prosecuting you or defending you don't [36:37.120 --> 36:49.120] do their job their job is to know the law they don't they only read the law [36:49.120 --> 36:53.320] when they have a question about it that they can't directly answer and then they [36:53.320 --> 36:58.120] only know the small portion of it they chose to read to try and find that [36:58.120 --> 37:04.960] answer they never being [38:32.640 --> 38:40.000] improperly applied that it doesn't apply that it is unconstitutional that it [38:40.000 --> 38:46.400] violates a right and thus is unconstitutional but the courts and the [38:46.400 --> 38:54.680] lawyers defend it with the laws not on trial the courts have taken away our [38:54.680 --> 39:01.880] ability to self-govern the courts have taken away our ability to challenge bad [39:01.880 --> 39:11.680] law the courts have taken away our ability to hold them accountable at [39:11.680 --> 39:22.600] every level and every office of government we know this because they [39:22.600 --> 39:27.440] have violated more rules that we can shake a stick at and I'm not talking [39:27.440 --> 39:31.300] just about the transportation code and how they're misapplying it I'm talking [39:31.300 --> 39:35.760] about the fact that they have created the state bars they specifically say in [39:35.760 --> 39:41.200] the legislation that created those state bars that those bar agencies are [39:41.200 --> 39:47.400] administrative offices within the judicial department of government okay [39:47.400 --> 39:53.200] which I know I've talked about on this show many many many many many times but [39:53.200 --> 40:00.560] again this is all about getting that big-picture overview okay the state bar [40:00.560 --> 40:05.160] is an administrative office of the judicial department of government [40:05.160 --> 40:13.120] therefore anyone with a bar card is a de facto judicial officer if not does your [40:13.120 --> 40:20.000] judicial officer and yet you have the courts ruling that attorneys are not [40:20.000 --> 40:25.880] judicial officers and yet you have a law that gives them the power to practice [40:25.880 --> 40:34.040] law that says they are which by the way in the opinions the courts used to say [40:34.040 --> 40:42.760] they're not the court never once addressed the state bar act not once it [40:42.760 --> 40:47.520] was avoided you see what happens when you don't take the whole law the whole [40:47.520 --> 40:55.080] of the law and apply it this is where my mind map of that would have come into [40:55.080 --> 40:59.360] really hard focus right here wait a minute you're saying they're not [40:59.360 --> 41:05.840] judicial officers excuse me mr. attorney do you have a bar card why yes I do who [41:05.840 --> 41:10.720] issued you that bar card well the Bar Association did you mean the State Bar [41:10.720 --> 41:17.000] Association that was created and put in place by the 1939 State Bar Act yes that [41:17.000 --> 41:25.440] same bar well right here in this section of the government code chapter 82 [41:25.440 --> 41:31.120] specifically says that the state bar is created as an administrative office of [41:31.120 --> 41:36.200] the judicial department of government now as a card-carrying member of the [41:36.200 --> 41:42.800] state bar you're a member of the bar as a member of the bar you're part of this [41:42.800 --> 41:46.840] agency this agency is an administrative office of the judicial department of [41:46.840 --> 41:54.320] government so how can you sit in the legislature as a legislator how can you [41:54.320 --> 41:59.320] sit as governor how can you sit as lieutenant governor how can you sit as [41:59.320 --> 42:02.560] Attorney General [42:04.760 --> 42:09.360] because you're a judicial officer and we have an article in the Constitution [42:09.360 --> 42:17.960] article 3 ok I'm sorry separation of power to article 2 that specifically [42:17.960 --> 42:24.400] says you can't operate I don't know what county it was in that's part of why I asked them if they would send the order the other is so I could put it up on the blog with their personal information redacted so that we could there yeah I definitely I mean that's that's the beauty of you know what you teach and you know and then the thoroughness that we go through looking at the code of criminal procedure I mean it's okay so i just don't know how to [01:04:57.680 --> 01:05:04.680] well this is an administrative court in california see here's the problem with it being a civil infraction [01:05:04.680 --> 01:05:12.680] okay because they don't criminalize it they're allowed the cops to act as both the accuser and the prosecutor [01:05:12.680 --> 01:05:26.680] that's a conflict of interest anyway you want to slice it okay but the fact of the matter is is that if the officer does not present evidence showing that you were engaged in the act at which the law covers which is commerce [01:05:26.680 --> 01:05:39.680] there in california that deprives that little tribunal of theirs of any jurisdiction to hear the argument so the first thing you've got to do is challenge their ability to have the cop even open his mouth [01:05:39.680 --> 01:05:54.680] because there's no jurisdictional issue in play here the court doesn't lacks jurisdiction because there's no conflict there is no conflict because the officer misapplied the law to someone it cannot possibly apply to [01:05:54.680 --> 01:06:15.680] okay i think i can get that by them but one of the other things that happened here is the charges also a revoked license and they charge on the initial ticket they're using the ticket as the charging instrument [01:06:15.680 --> 01:06:19.680] well what does california law say about them being able to do that [01:06:19.680 --> 01:06:25.680] well they can do it okay it's an administrative court that's the part you need to understand [01:06:25.680 --> 01:06:36.680] okay an administrative court you're not innocent until proven guilty that's the problem that's how they've gotten away with this in california for so long [01:06:36.680 --> 01:06:49.680] okay okay well because it gets to ignore all of your rights because they're using a series of laws that just like what i was discussing at the beginning of the show [01:06:49.680 --> 01:06:58.680] they've created a body of law that lets them ignore our individual protections by claiming that we're operating under this part of the law [01:06:58.680 --> 01:07:06.680] where we're not protected when in fact it's impossible for us to be doing so [01:07:06.680 --> 01:07:15.680] well i think they have a little problem in that the officer marked on the citation that it was a misdemeanor [01:07:15.680 --> 01:07:24.680] but when i got into court they gave me a copy of the ticket where the court changed it to an infraction [01:07:24.680 --> 01:07:38.680] and in california that's called a wobblet and they can't change it from a misdemeanor to an infraction without getting my consent [01:07:38.680 --> 01:07:45.680] a written waiver that i'm giving up my rights to a trial to a trial [01:07:45.680 --> 01:07:50.680] well the thing is is they can't charge you for an offense the law doesn't cover [01:07:50.680 --> 01:08:04.680] so you need to see if there's a staging category in the law that allows them to seek elevated actions based upon the number of times you've been convicted previously [01:08:04.680 --> 01:08:08.680] for instance the first one or two times i know but just hear me out [01:08:08.680 --> 01:08:15.680] the first two times it may be civil the third time it may be a class b misdemeanor or class c misdemeanor [01:08:15.680 --> 01:08:20.680] and then the fourth time it may be a class b a class a whatever you see what i'm saying? [01:08:20.680 --> 01:08:21.680] okay [01:08:21.680 --> 01:08:31.680] so if they are trying to elevate it in that fashion then they have to prove the prior convictions which is another heel they've got to jump over [01:08:31.680 --> 01:08:32.680] okay [01:08:32.680 --> 01:08:40.680] they're trying to make it go down they're trying to make it from a criminal from a [01:08:40.680 --> 01:08:46.680] yeah but what law says that they cannot correct an invalid charging instrument before it's heard [01:08:46.680 --> 01:08:51.680] oh i see okay okay i'll look into that [01:08:51.680 --> 01:08:55.680] okay if they're trying to charge you for an offense that they absolutely haven't [01:08:55.680 --> 01:09:02.680] see the problem is that they would definitely lack jurisdiction to hear a misdemeanor [01:09:02.680 --> 01:09:17.680] their jurisdiction is entirely administrative so if you walked in there under a misdemeanor they'd have to drop it right then and there they can't prosecute you because they don't have misdemeanor authority in those little courts like that in california [01:09:17.680 --> 01:09:20.680] because they're civil infractions [01:09:20.680 --> 01:09:23.680] right okay [01:09:23.680 --> 01:09:33.680] okay so if they leave it at misdemeanor they're already hosed themselves unless they then tell you that they are trying to seek an elevated charge because of prior convictions [01:09:33.680 --> 01:09:44.680] and then you have to come around and say objection i've never been convicted if you're saying i'm convicted so you can elevate this i demand you present proof of the prior convictions [01:09:44.680 --> 01:09:47.680] okay [01:09:47.680 --> 01:09:52.680] all right this will be fun [01:09:52.680 --> 01:09:57.680] yeah this will be fun because the judge i'm dealing with it's a commissioner [01:09:57.680 --> 01:10:05.680] right it's not a judge that's my whole point they don't have any judicial authority to prosecute a misdemeanor [01:10:05.680 --> 01:10:20.680] okay well when i put her on the dime the first time i said is this criminal or civil and she didn't want to say it under her breath she said criminal [01:10:20.680 --> 01:10:25.680] that's a lie and i've got california supreme court case that says it's a lie [01:10:25.680 --> 01:10:33.680] i i have those two and i stated them there in the courtroom because i've taken i've got those [01:10:33.680 --> 01:10:43.680] so she she uh adjourned the court until she cleared the courtroom and then she came back and entered a plea for me [01:10:43.680 --> 01:10:57.680] and i sent a letter to her superior because in california before you can put a judicial complaint against her you have to go to her superior in the court [01:10:57.680 --> 01:11:05.680] which would be the presiding judge and he kicked me back a letter and said oh she didn't do anything wrong [01:11:05.680 --> 01:11:19.680] that uh it was all fine that i refused to enter a plea and that's not true because i i just said that i was uh [01:11:19.680 --> 01:11:28.680] i said that any plea would be unconscionable there is no there is no charging instrument there is no complaint [01:11:28.680 --> 01:11:33.680] and at that time i didn't know that they could use the ticket as the [01:11:33.680 --> 01:11:39.680] well now wait a minute wait a minute wait a minute you need to be very careful in how you give me the information you're giving me [01:11:39.680 --> 01:11:48.680] because under the infraction side they can use the ticket if they're going to make it criminal and prosecuted as a crime [01:11:48.680 --> 01:11:54.680] now the question is is can they still use the ticket by itself [01:11:54.680 --> 01:12:03.680] you're talking about two different areas of law which require two different methods of possibly two different methods of charging an offense [01:12:03.680 --> 01:12:08.680] because one of them is an actual crime and the other is not [01:12:08.680 --> 01:12:20.680] okay so you cannot presume when you tell when i when you tell me without context that they say they can use the citation and it's a commissioner here in my case and blah blah blah [01:12:20.680 --> 01:12:25.680] i know you're talking about a civil infraction so everything i tell you is based upon that premise [01:12:25.680 --> 01:12:33.680] but now you're telling me she tried to say that it's a criminal case and that they're trying to get a plea from you as it as an actual crime [01:12:33.680 --> 01:12:40.680] which their own case law says they can't do because it's not [01:12:40.680 --> 01:12:49.680] and so under the criminal code and rules what are they required to have as a charging instrument [01:12:49.680 --> 01:12:56.680] and does that court have jurisdiction over an actual misdemeanor [01:12:56.680 --> 01:13:07.680] well apparently not because everything i tried to enter into the court into the case the clerks would not take [01:13:07.680 --> 01:13:14.680] they said this is an infraction and i said no it's right here on the ticket it says it's a misdemeanor [01:13:14.680 --> 01:13:19.680] no it's an infraction i couldn't get any motion [01:13:19.680 --> 01:13:24.680] did you have an invalid charging instrument and you have an improper lack of notice [01:13:24.680 --> 01:13:30.680] or you have you have improper notice of the offense against you [01:13:30.680 --> 01:13:31.680] okay [01:13:31.680 --> 01:13:43.680] okay but the fact of the matter is if you go in there and the judge the so-called judge is telling you that they're still charging it as a crime despite what the clerks tell you [01:13:43.680 --> 01:13:49.680] then they've denied you your ability to put on a vigorous defense by filing your own motions [01:13:49.680 --> 01:13:57.680] this is all due process violations even in an administrative court you have the right to file pleadings on your own behalf [01:13:57.680 --> 01:13:58.680] okay [01:13:58.680 --> 01:14:04.680] and the fact that they're interfering with that that's a whole other issue [01:14:04.680 --> 01:14:19.680] yeah i've been i've sent in a judicial complaint now on her for that once i got the reject letter i included that with the judicial complaint or her actions [01:14:19.680 --> 01:14:29.680] did you file against her boss that you wrote to you also should have filed a complaint against him for covering her backside knowing it was a lie [01:14:29.680 --> 01:14:41.680] well i just i just got the letter from him today and i read that and uh i thought okay now i have to to uh have a single subject matter requirement for legislation [01:21:20.680 --> 01:21:40.680] i can't honestly ask answer that question accurately because i i do not know that but i'll mark that down as does it say the subject matter is that that bill relates to if the constitution has a single subject matter requirement then the bill has to tell you what that single subject matter is [01:21:58.680 oregon once you've gotten to 20 convictions you are automatically going to be charged with a misdemeanor i think it's level two misdemeanor two because it's the first time mister there's misdemeanor one and misdemeanor two misdemeanor two is the first time for the offense it will be considered [01:25:09.680 --> 01:25:24.680] what is it what is it called um habitual traffic offender level at at that point and they're going to charge me with a with a crime and arrest me for it when i get to 20 convictions [01:25:24.680 --> 01:25:27.680] and [01:25:27.680 --> 01:25:43.680] that's what it says and i'm not sure i didn't describe what the penalties could be i have to look it up again to what it is with the penalties in suit for that but i think anytime after that then it goes up to misdemeanor one and i could be looking at jail time [01:25:43.680 --> 01:25:53.680] well again this is one knowing what i'm talking about in relation to the subject of those statutes is so important [01:25:53.680 --> 01:26:05.680] right exactly exactly so i've got a question about this while it is a civil infraction uh you know about that in texas so you don't know what it is in oregon but it you know for example they're in texas [01:26:05.680 --> 01:26:13.680] if it is a civil infraction charge texas doesn't have civil infractions it doesn't have you don't have civil infractions in texas on this [01:26:13.680 --> 01:26:24.680] no no for this you don't everything in the transportation code is criminal the only thing in the transportation code that wasn't criminal was the red light camera citations [01:26:24.680 --> 01:26:36.680] i see i see the uh the bill is it's charged as a civil infraction but of course i i told you about this before she said oh it's a quasi criminal they always say that [01:26:36.680 --> 01:26:48.680] but there is no such jurisdiction in law the constitution doesn't recognize any such jurisdiction the statutes don't recognize any such jurisdiction [01:26:48.680 --> 01:26:58.680] correct correct but this once again is a fabrication of the bar associations creating a body of law outside of constitutional protections [01:26:58.680 --> 01:27:15.680] correct yeah that's why i've seen that so while it's still a civil infraction is what they have to you know kind of mutters that civil infraction you know they don't want to she doesn't really want to say it straight out but it's a civil infraction at this level at least at least for now [01:27:15.680 --> 01:27:29.680] you cannot plead guilty to that can you you cannot plead guilty or not guilty you're either found um liable and at fault or not liable and not at fault is that correct [01:27:29.680 --> 01:27:49.680] well technically speaking yes okay okay so they always want me to make a plea and i i declined to plea and i informed them that this is a civil infraction i cannot plead guilty or not guilty to something because there isn't any harm or any crime [01:27:49.680 --> 01:28:13.680] i can only be found to be liable and at fault for any so-called imaginary damage that i did or not and they don't have much to say about that but then they of course they don't because they know damn good and well that they've created a quandary that doesn't make sense when somebody actually looks at it [01:28:13.680 --> 01:28:23.680] they're trying to have their cake and eat it too and that's what they've been getting away with for decades that's that's the whole reason i'm here trying to make people see and understand that [01:28:23.680 --> 01:28:52.680] yes so they stumble and they don't know what to say and then oh the officer turns your honor i have this document here it's called the suspension packet i'd like to introduce this into evidence i say objection your honor material that that has not been researched and found out by the officer by this officer who does not have the qualifications in law to present anything and he didn't find this information by himself malicious administrative cases with civil infractions in this administrative court [01:34:07.680 --> 01:34:29.680] they never once send me the sent me the fine amount by way of the mail you know about it goes like six or eight months or so down the line after that thicker conviction i'll get a you know telemarker or what what do you call the bill collector a bill collector will call me and say that they're collecting they're collecting a debt for the city of milwaukee [01:34:29.680 --> 01:34:55.680] they'll say that then i have to inform them to cease and desist with malicious prosecution there's no there was no legal conclusion to it no trial by jury no evidence no damage no harm to anybody else so it's invalid cease and desist the call and then they disconnect the call and then they never called back okay so that's what the result of that is and [01:34:55.680 --> 01:35:18.680] yeah but that isn't helping you that isn't helping you do the stuff i told you to do and that i've talked about on this show a thousand times about knowing what you're walking into and what to do about it you told me you haven't even looked at the at the way that they're required to enact law in the state of oregon via the constitution whether or not the law they're operating under actually complies with the requirements of the constitution [01:35:18.680 --> 01:35:40.680] and if it does if it tells you what it is they're limited to and applying that law what subject does it apply to so i could care less what the telemarkers are doing my concern right now is what these people are doing and what you're letting them get away with and how you wound up with 70 convictions about not doing your due diligence in the first place [01:35:40.680 --> 01:35:52.680] right well one of them i'll say this one of them isn't a county court not the one here in milwaukee one of them is and well the thing is is does a county court have original jurisdiction to hear these cases [01:35:52.680 --> 01:36:20.680] uh for those of yeah i was detained by by eso a couple of times and that is not my question i didn't ask who detained you arrested you or cited you did i well the question is to whom does those laws in oregon give original jurisdiction for these infractions [01:36:20.680 --> 01:36:26.680] hmm [01:36:26.680 --> 01:36:48.680] see here in texas class c misdemeanors which is what traffic is all class c misdemeanors must be originally prosecuted in a municipal or justice court it cannot be initially prosecuted in any other court it can be appealed to one but it can't be originally prosecuted [01:36:48.680 --> 01:37:02.680] because they are not the court of original jurisdiction okay okay so yeah the county court says it's a court it's a justice court it does say that because it's a justice court [01:37:02.680 --> 01:37:10.680] and does the laws of oregon give a justice court original jurisdiction in civil infraction cases [01:37:10.680 --> 01:37:38.680] you know the answer to that do you know i'll look that up i i didn't know to even question that so i will since you brought to my attention i'll go ahead and mark that down as something i need to look up something i've overlooked just haven't seen this because there's so much things that do you overlook some of the key things that you need to need to research and get done so i will do that so okay last but not least you and i are both veteran airmen [01:37:38.680 --> 01:38:07.680] we both served our country so as you and i being airmen or veterans veteran airmen we don't have the privilege of going to these courts or entering these courts or helping anybody else in the case of course we have the right to why because we did not take a license to go into that court and exercise the privilege we have the right to because we served our country and you cannot pay for a license to exercise that [01:38:07.680 --> 01:38:29.680] right but we always have a right to that to that court that's a separate issue that's a completely different issue than the one we're talking about right now worry about yourself i wouldn't want you walking into a courtroom on somebody else's behalf if you're not going to do what's necessary to protect your own butt 17 convictions is not protecting your own butt [01:38:29.680 --> 01:38:49.680] wow that was along the way yeah yeah it gets deceptive because that's that's all in total the last five years last few years has been quite a bit yeah but is there is there a statute of limitations on when that 20 can be accumulated is it 20 within a certain period of time or is it just 20 total in your entire life [01:38:49.680 --> 01:38:57.680] what was read to me is that it's total uh it's 20 uh total 20 total [01:38:57.680 --> 01:39:00.680] in a lifetime [01:39:00.680 --> 01:39:06.680] yeah somehow or other i don't see that being a valid law [01:39:06.680 --> 01:39:26.680] yeah i i don't either it's something that they that they wrote in their their definition of their their their book their lawyer's reference book however that well there stop reading stop worrying about the lawyer's reference book and find the damn law the reference book is talking about [01:39:26.680 --> 01:39:37.680] and see what it actually says how many times do i have to tell you guys that always read the law never trust somebody else to tell you what it means or what it says read it [01:39:37.680 --> 01:39:47.680] right and then find out if it's the only part that deals with what you're it says or is there something else that goes with it because they're almost always is [01:39:47.680 --> 01:40:06.680] right right right definitely look at that no i don't take it as as gospel no but that's that's what they're saying that by the time you when you get to 20 you can be charged for the first time you'd be misdemeanor two the first time and then there'll be misdemeanor one every offense after that [01:40:06.680 --> 01:40:22.680] but yeah i don't i don't think it holds water either i don't i'm just just reading to you what what i was uh what it says you know it says it's going to do but on that note anyway you know we're now we're both patriots we have the right to the court so [01:40:22.680 --> 01:40:39.680] you know just know that that you have rights to go to those courts so if they tell you you can't go into that court you just tell them hey you're you're a patriot you're served your country you cannot pay for the privilege to be there to represent somebody or help somebody you have the right to you have the unbelievable god-given right to be in that court [01:40:39.680 --> 01:40:46.680] well they think differently and that's another problem that we can't get into with the time we've got or on the subject we're general jurisdiction here in pennsylvania that uh is authorized to hear matters pertain to the vehicle code [01:41:45.680 --> 01:41:57.680] i was just questioning my thought on whether or not merely challenging the subject matter jurisdiction of the court based on not being engaged [01:41:57.680 --> 01:42:07.680] in the regulated activity under the vehicle that's not the subject matter jurisdiction of the court that's the subject matter jurisdiction of the statutes the court is attempting to apply [01:42:07.680 --> 01:42:18.680] okay there are different things here the court has jurisdiction over those offenses you just said they did right they have the they have the authority to hear an offense under that code right [01:42:18.680 --> 01:42:31.680] yes so their subject matter jurisdiction is not at issue what is at issue however is the subject matter jurisdiction of the code itself to you and your actions [01:42:31.680 --> 01:42:43.680] gotcha do you understand the distinction i understand the distinction i just don't believe i perhaps i didn't challenge it correctly [01:42:43.680 --> 01:42:58.680] well you know it's it's a it's the way you have to build up the argument okay you are correct the court's jurisdiction is lacking for the very reason that the law it's that it has jurisdiction over is also lacking [01:42:58.680 --> 01:43:11.680] see they're linked together it's you can't just go directly to the court and say you don't have subject matter jurisdiction because their argument is well right here the law gives us jurisdiction over these types of offenses [01:43:11.680 --> 01:43:31.680] nowhere did you make the argument yeah but those offenses don't apply because that law doesn't apply you see what i'm saying now had you made the direct challenge that this statute is being unlawfully applied to a subject matter to which it is not intended according to the original legislation [01:43:31.680 --> 01:43:53.680] and here's what the original legislation says here's the subject matter it's limited to here's why it doesn't apply to me because i am not acting within this subject matter context therefore the court lacks jurisdiction about how that distinction works you have to build up to why the court lacks jurisdiction it's not that it lacks subject matter jurisdiction directly because it doesn't [01:47:12.680 --> 01:47:30.680] it has jurisdiction over those offenses what it does lack is personal jurisdiction over you because the law itself lacks personal jurisdiction over you thus absent personal jurisdiction the court has no jurisdiction subject matter or otherwise [01:47:30.680 --> 01:47:43.680] but it's personal jurisdiction they're lacking here because the statutes in that code do not apply to an activity that falls outside of the subject matter context for which it was enacted [01:47:43.680 --> 01:48:05.680] i'm completely plugged in that was what i was looking for i i was thinking that it was personal jurisdiction but i wasn't confident enough um i used the title of my motion to dismisses challenge to subject matter jurisdiction and i stated most of everything that you uh outlined there [01:48:05.680 --> 01:48:22.680] yeah well they're tied together if you lack either subject matter or personal jurisdiction you lack all jurisdiction okay so you can challenge uh the court subject matter jurisdiction based upon a lack of personal jurisdiction [01:48:22.680 --> 01:48:43.680] gotcha gotcha all right yeah but basically i have a merits um case and i took the route of um uh forcing um forcing a public defender uh they were trying not to give me one and i'm just in the process now of hammering him [01:48:43.680 --> 01:48:58.680] um i'm kind of trying to play both ends to the middle here um to get this dismissed um so i i just want to keep him honest um with the pleadings i already have before the court [01:48:58.680 --> 01:49:15.680] um what he did for me because i have a merits argument um he did a habeas he took my uh motion to suppress and my challenge to subject matter jurisdiction and just had a little habeas hearing uh where he interrogated the uh the cop [01:49:15.680 --> 01:49:33.680] and he was putting together in the next uh i think he said 20 days so that was 10 days ago he was putting together a um a memorandum in support of whatever whatever he's going to do in writing because i demanded that he do that also his lack of time is not my problem [01:49:33.680 --> 01:49:53.680] um so he he was definitely motivated to represent me after i uh i tuned him up with certified mail um so i'm going to just tighten up and play my um pro se card that you know this is what i was intending to argue if wasn't clear enough in the motion i had there [01:49:53.680 --> 01:50:07.680] i still want these issues uh preserved i had other ones also including a speedy trial but um so that's the way i'll handle that so it's personal jurisdiction is one of the other keywords guys [01:50:07.680 --> 01:50:19.680] now the thing you're going to have to have to prove that is first and foremost like i was telling truth raider you need to look at whether or not pennsylvania's got a single subject matter clause in its constitution which i'm sure it does [01:50:19.680 --> 01:50:29.680] and then once it does that you need to find the original bill that enacted the codified version and collection of statutes that fall under that subject matter [01:50:29.680 --> 01:50:45.680] and find out what the title of that original bill says that subject matter is and then get a certified copy of that of that uh subject matter of the title of that bill uh from the secretary of state or whoever can issue you a certified copy [01:50:45.680 --> 01:51:01.680] okay because that's your evidence that the legislature specifically limited everything in that code to this specific subject matter the state has no evidence i was engaging in this subject none it's simply presuming it and it cannot do that [01:51:01.680 --> 01:51:21.680] gotcha no i'm all plugged in that was the the last piece that i didn't uh hunt down i just made the assertions um that was that was all that i had done so um i need to find the original bill and yes it does it's actually the first item in under that article [01:51:21.680 --> 01:51:39.680] where it says that um it can't uh they can't change what they're talking about it has to be related to whatever the original uh intent right what i what i'm saying is you're talking about changing the purpose of the legislation i.e. its subject matter by amendment [01:51:39.680 --> 01:51:54.680] that's a different provision than the fact that the original legislation must contain a statement of what that single subject is within its caption or title whatever pennsylvania calls it that's why you need a copy of the original bill [01:51:54.680 --> 01:52:09.680] that put all of those statutes together under that original recodification which probably happened sometime around the same time ours did or from sometime from 1963 forward [01:52:09.680 --> 01:52:28.680] there was an original recodification that collected all of those statutes dealing with that single subject under the title of that single subject and into one bill and that bill is the one that's going to save your butt if it comes up and says that this is all transportation [01:52:28.680 --> 01:52:42.680] gotcha gotcha all right i got i'm sorry i got my homework to do okay well good luck man appreciate your time thank you yes sir you have a good one you too bye bye bye [01:52:42.680 --> 01:52:57.680] and that folks is what we have to do in all these cases it doesn't matter whether it's traffic or you're accused of robbing a bank the more you know about the process procedure your rights the law [01:52:57.680 --> 01:53:07.680] all of that will help you understand whether or not your attorney is doing his job for you or he's trying to throw you under the bus [01:53:07.680 --> 01:53:16.680] now you also have to remember the aspect that truth and courts of law do not often travel in the same circles [01:53:16.680 --> 01:53:27.680] the truth as the old saying goes set you free except when it comes to a court of law in a court of law the truth is hardly ever known [01:53:27.680 --> 01:53:39.680] it is simply a matter of if we apply the law in this manner this must be the result we have on the other end end of discussion and that's as far as the truth of the matter ever gets [01:53:39.680 --> 01:53:50.680] okay this means that you have to become a master of how the game is played which starts with knowing the rules [01:53:50.680 --> 01:53:58.680] then you have to become a master tactician and how you apply those rules and everything that goes with them [01:53:58.680 --> 01:54:07.680] this once again is the difference between the attorney that writes the briefs and the attorney that takes those briefs to trial [01:54:07.680 --> 01:54:15.680] a trial attorney is a different species from the brief attorney the guy who never leaves the office [01:54:15.680 --> 01:54:25.680] the guy who's always in the law library doing the research and writing the legal documents while the one that goes to court just rides the wave [01:54:25.680 --> 01:54:43.680] okay it takes a particular mindset to go into court and handle yourself and your case well it takes practice it takes insight into how the other guy is thinking and what he's going to do [01:54:43.680 --> 01:54:56.680] this is why you have to know what he knows and things that he doesn't know and you have to be willing to do things he's either not expecting and prepared for or how to counteract the things that he is expecting and prepared for [01:54:56.680 --> 01:55:05.680] it's a very lively game of chess through oral argument and presentation [01:55:05.680 --> 01:55:15.680] and that was part of what I tried to teach folks down there in class you always have to be thinking like the other guy as well as yourself [01:55:15.680 --> 01:55:26.680] you have to take everything you know and everything this guy thinks he knows and put them together in your own mind and figure out how to make them work for you instead of against you [01:55:26.680 --> 01:55:37.680] and when you fail to do that that's when you hand the advantage right back to them and you lose [01:55:37.680 --> 01:55:48.680] sometimes you can do it before it ever gets to trial if you do the paperwork right we've done that more than once I've got proof positive up on the web that we've done that more than once [01:55:48.680 --> 01:56:00.680] and we've done it with some very high end cases felony cases versus misdemeanor cases versus any other kind of case drug cases felony evasion cases [01:56:00.680 --> 01:56:15.680] I mean just all kinds of stuff and then we've got all the way back down to the let's see they were trying to charge my nephew with misdemeanors and a felony for taking contraband into a county jail [01:56:15.680 --> 01:56:26.680] and I showed his lawyer the actual statute which she had never bothered to read and got him off of those charges [01:56:26.680 --> 01:56:36.680] because the law specifically required that he be in the population with the contraband before they could apply those charges [01:56:36.680 --> 01:56:49.680] and what had happened was he was actually flushing the contraband down the toilet when he came back in from his work release specifically so he would not be taking that contraband which was his cigarettes by the way [01:56:49.680 --> 01:57:01.680] into the jail itself he was not in the jail proper he was coming back from work release and he was flushing his cigarettes down the toilet and a deputy busted it on him [01:57:01.680 --> 01:57:09.680] seized the ones that he hadn't gotten flushed yet and then tried to charge him for carrying those into a detention facility in Texas [01:57:09.680 --> 01:57:20.680] it was BS from the word go but no one had bothered to read the statute to defend him with it until I took it to his attorney and said what the hell [01:57:20.680 --> 01:57:32.680] why aren't you applying this it says right here that they cannot charge him with this under these conditions [01:57:32.680 --> 01:57:40.680] because they were threatened they had five years with that felony they were trying to hit him with [01:57:40.680 --> 01:57:46.680] that's the kind of stuff folks you better learn to expect from your so called public servants [01:57:46.680 --> 01:57:53.680] they don't care about us when it gets in the way of either A how they think they have to do their job [01:57:53.680 --> 01:57:59.680] B what they think they know and most important of all C their friggin ego [01:57:59.680 --> 01:58:03.680] or their paycheck ok [01:58:03.680 --> 01:58:14.680] the sooner you realize that the happier you're gonna be and the more you're gonna be able of understanding what you have to do if and
