Mr. Abbott and other state officials, [01:35.360 --> 01:38.960] including the Attorney General, stipulated in a letter to County District Attorneys [01:38.960 --> 01:43.840] back on Thursday that marijuana has not been decriminalized in Texas and that these actions [01:43.840 --> 01:50.320] demonstrate a misunderstanding of how HB1325 works, as well as other cities too, like the District [01:50.320 --> 01:57.040] Attorney in El Paso. Cayma Esparza, a Democrat who also stated earlier this month that the law [01:57.040 --> 02:02.720] quote will not have an effect on the prosecution of marijuana cases in El Paso. However, the issue [02:02.720 --> 02:07.680] was succinctly summarized by Mr. Brandon Ball, an assistant public defender in Harris County who [02:07.680 --> 02:12.160] stated that quote, the law is constantly changing on what makes something illegal based on its [02:12.160 --> 02:17.200] chemical makeup. [05:43.100 --> 05:50.220] When this coronavirus first launched upon us there was a lot of conjecture about it [05:50.220 --> 06:00.100] being implemented by the Rockefeller group and Bates and his cronies and there was allegations [06:00.100 --> 06:10.280] that our government sent, infected some troops somewhere in Kansas and then sent them to [06:10.280 --> 06:17.260] Wuhan, China and that there was conjecture that maybe the United States sent these guys [06:17.260 --> 06:29.180] to China to start this epidemic in China and then there was speculation that the Chinese [06:29.180 --> 06:37.260] launched this for some reason I can't imagine but none of that made any sense. [06:37.260 --> 06:44.340] I went through who could benefit from it and at this point in time I couldn't find anybody [06:44.340 --> 06:47.380] who could benefit from it. [06:47.380 --> 06:52.660] If it was the Rockefeller group it was way premature. [06:52.660 --> 06:56.540] If they were going to launch something like this as a way to get the government under [06:56.540 --> 07:01.860] control they needed a president in their pocket and they didn't have one. [07:01.860 --> 07:08.180] If it was the Chinese I couldn't imagine how the Chinese could imagine that launching [07:08.180 --> 07:15.980] a worldwide epidemic in one of their own cities would benefit them in any way and it has caused [07:15.980 --> 07:20.020] them immeasurable grief. [07:20.020 --> 07:26.660] The only one who could possibly benefit from this is Trump. [07:26.660 --> 07:34.020] Trump would benefit from it if he made decisions if he took action and he did that. [07:34.020 --> 07:41.580] So it was my conjecture that either this just got out by accident or if somebody launched [07:41.580 --> 07:47.740] it they did it in a very inopportune time it was launched too soon and that by the time [07:47.740 --> 07:56.780] the election got here this epidemic would begin to slow down and run its course and [07:56.780 --> 08:06.380] over the period of time while this was going on the Democrat candidate would have little [08:06.380 --> 08:12.580] influence so for the most part people forget who the heck he is and that's exactly what's [08:12.580 --> 08:23.660] happened and the Democrats seemed to be scrambling to find some way to discredit this and right [08:23.660 --> 08:29.980] now they're saying that because Trump decided to open the country back up that we're having [08:29.980 --> 08:33.700] a peak in infections. [08:33.700 --> 08:39.740] Well yeah we are having a peak infections but what we're not having a peak in are deaths [08:39.740 --> 08:50.180] from the infections because early on they pretty well infected the most vulnerable part of [08:50.180 --> 08:56.740] the population people in old folks homes 50% of all the deaths were people in old folks [08:56.740 --> 09:04.900] homes we had directors of old folks homes absolutely refused to take infected patients [09:04.900 --> 09:11.020] when the the governments when the the governors were ordering them to and they refused one [09:11.020 --> 09:15.780] particular in New York absolutely refused told him it was insane he was not letting [09:15.780 --> 09:23.940] them in his facility and he had zero deaths in his facility good for him but 50% of all [09:23.940 --> 09:31.540] the deaths were people in old folks homes so now they've opened things up but they were [09:31.540 --> 09:38.420] the I don't want to say that that was intentional but whether it was intentional or not they [09:38.420 --> 09:48.420] did get a lot of supposed numbers early on but now they're getting a lot of infections [09:48.420 --> 09:54.380] but the death rate hasn't increased and it's an indication that this thing is running [09:54.380 --> 09:59.500] its course and then last week we had a group of doctors do a press conference in front [09:59.500 --> 10:06.860] of the Supreme Court and these were doctors who call themselves frontline doctors and [10:06.860 --> 10:15.100] they're actually treating the virus themselves and they're saying that hydroxychloroquine [10:15.100 --> 10:24.260] works one particular doctor from Houston claimed that she has treated over 350 people in her [10:24.260 --> 10:32.660] practice and not has not had one single death and you know that was okay that was was nice [10:32.660 --> 10:40.900] to hear that but what surprised me was not that Facebook and Twitter and YouTube took [10:40.900 --> 10:50.380] it down but that before they could get it took down in one day it got 17 million hits [10:50.380 --> 11:03.420] was it 17 or 19 it was the number I've hired 19 thrown out but the number I heard was with [11:03.420 --> 11:09.060] Facebook Twitter and YouTube it was 17 when they pulled it down apparently there were [11:09.060 --> 11:17.740] hits elsewhere that I've heard the number 19 million this is in one day either way yeah [11:17.740 --> 11:24.500] either way that's big time viral and that tells me that the public's paying attention [11:24.500 --> 11:30.980] that the public is awake and these this group subsequently held another press conference [11:30.980 --> 11:36.380] that was more complete than the first one but the fact that it got that many hits that [11:36.380 --> 11:45.180] quickly says that the the public is getting incredulous they're not buying the doom and [11:45.180 --> 11:55.180] gloom story of the World Health Organization and Fauci and the CDC and the NIH National [11:55.180 --> 12:00.780] Institute of Health we just not buying their stories I did a show with Pastor Massage [12:00.780 --> 12:10.300] yesterday morning and he told of a friend of his was in Arizona somewhere and a couple [12:10.300 --> 12:15.340] of his friends went to get tested for some reason said they were down there half a day [12:15.340 --> 12:19.900] and couldn't get anything done they finally said heck with this and they left a week later [12:19.900 --> 12:25.860] they both got a notice in the mail that they tested positive even though they never actually [12:25.860 --> 12:35.820] got tested at all exactly the problem they're having is these facts are coming out and they're [12:35.820 --> 12:45.940] not getting enough deaths to sustain their allegations their story and by the end this [12:45.940 --> 12:59.580] is 1st of August September October November the move is you know this wave of opposition [12:59.580 --> 13:05.540] against the doom and gloomers the ones trying to jack the numbers is beginning to build [13:05.540 --> 13:10.900] up the time election gets here I think it will be clear to almost everybody that the [13:10.900 --> 13:17.300] whole thing was built up by the Democrats for the singular and specific purpose of [13:17.300 --> 13:21.460] discrediting a president they've been trying to force out of office since he was first [13:21.460 --> 13:27.940] elected well there's another angle that I mean you're mentioning about Trump but another [13:27.940 --> 13:35.100] thing we might notice or consider as a potential factor is like Pelosi and these gazillions [13:35.100 --> 13:42.100] of dollars that they are calling emergency funds and they're sending like millions to [13:42.100 --> 13:50.060] their buddies say Smithsonian or something where it has nothing to do with the health [13:50.060 --> 13:58.340] and they're they're spending by the millions and billions and they wouldn't be able to [13:58.340 --> 14:06.100] do this you know on regular days but then they throw the word pandemic around and have [14:06.100 --> 14:12.140] all this emergency spending I think that could be a factor and it's always goes to the money [14:12.140 --> 14:17.460] one of the doctors was saying that when we tried to get that he was saying that there's [14:17.460 --> 14:27.180] no evidence at all that children are transmitting the virus he referenced a virologist in Scotland [14:27.180 --> 14:34.180] a pediatrician and virologist and he claimed there is no evidence of children passing [14:34.180 --> 14:43.060] the virus to teachers in the world wow that while children are getting it they're not [14:43.060 --> 14:50.180] being harmed by it and they're not transmitting it that the number of children's actually [14:50.180 --> 15:05.900] died from this pandemic is point zero zero zero two two tenths of one percent so he's [15:05.900 --> 15:10.020] saying that's not an issue we need to get the kids back in school but when we try to [15:10.020 --> 15:16.860] get them back in school he's in California and the teachers union is asking that before [15:16.860 --> 15:22.220] they'll come back to work they want the police defunded they want several other things had [15:22.220 --> 15:32.020] nothing to do with the children in the school and their health but simply money that everybody [15:32.020 --> 15:37.540] and their brothers trying to use this to serve their own purpose without regard to the to [15:37.540 --> 15:42.260] the public or the economy but I think this is going to play itself out before we get [23:02.980 --> 23:04.740] was out of motion [23:04.740 --> 23:08.980] and my grandson took a moment and said yes i make a motion to dismiss this case [23:08.980 --> 23:10.260] because it's [23:10.260 --> 23:11.700] not a valid statute [23:11.700 --> 23:14.140] in the charge and immediately the judge [23:14.140 --> 23:15.980] granted that motion [23:15.980 --> 23:20.340] my favorite part of the whole thing was [23:20.340 --> 23:23.860] that you had practice did practices [23:23.860 --> 23:26.420] with your son and you [23:26.420 --> 23:29.500] projected what you expected everyone to do [23:29.500 --> 23:33.300] and your grandson had what twenty one questions [23:33.300 --> 23:36.340] i think there was twenty two but yes twenty one twenty two twenty three [23:36.340 --> 23:38.820] questions roughly uh... [28:32.620 --> 28:36.700] what my son and grandson have said my grandson has indicated [28:36.700 --> 28:41.340] he really doesn't want to go after the second judge that badly [28:41.340 --> 28:45.380] but he would like to revisit the first judge because she wasn't very cooperative [28:45.380 --> 28:48.820] she just ignored everything and did whatever she wanted and that was it [28:48.820 --> 28:51.020] which the second one [28:51.020 --> 28:57.340] was close to that now the second judge i have filed a judicial conduct complaint [28:57.340 --> 29:02.540] with him and i have filed a criminal complaint because i was in pennsylvania [29:02.540 --> 29:04.940] i don't live there normally but i was in there [29:04.940 --> 29:09.260] and on a friday i went down to get the files to look at his record [29:09.260 --> 29:13.460] because we uh... my grandson had lost control a little bit of the bookkeeping [29:13.460 --> 29:15.900] of the timeline accuracy [29:15.900 --> 29:18.540] so i said no problem we'll go down there [29:18.540 --> 29:25.420] and the clerk absolutely refused to let me see or have that file whatsoever [29:25.420 --> 29:27.580] during normal business hours task on [34:27.100 --> 34:33.020] their faulty criminal complaints and he beat him [34:33.020 --> 34:39.900] he didn't just beat him he beat him while he was still getting warmed up [34:39.900 --> 34:47.100] so now he has an opportunity to demonstrate to these public [34:47.100 --> 34:52.380] officials the the consequences of their bad behavior [34:52.380 --> 34:58.220] it's not about anger or avarice or retribution it's about [34:58.220 --> 35:02.940] creating a level playing field for his fellow students [35:02.940 --> 35:10.060] who don't have the background and support that he has 36:00.060] willing to revisit the second judge and work some things there [36:00.060 --> 36:03.660] now i looked down over just a quick listing and i figured that [36:03.660 --> 36:07.580] between the two judges there were at least a dozen offenses that could be [36:07.580 --> 36:11.100] addressed the bulk of them rested with the first [36:11.100 --> 36:16.700] judge so i'm figuring at least eight or more with the first judge [36:16.700 --> 36:21.100] um so i'm hoping that we go back to that first judge [36:21.100 --> 36:26.620] because i said to him it's like if he went 75 70 mile an hour in a 45 [36:26.620 --> 36:30.220] and the cop pulled Jerry again say well let me go back and drive 45 and [36:30.220 --> 36:33.980] everything will be okay that's the day one lets you do that [36:33.980 --> 36:37.740] nor should we let this judge do the thing she's done and [36:37.740 --> 36:41.740] haven't don't have it addressed so we probably will go back against the [36:41.740 --> 36:48.620] first judge who ignored orders to think who ignored [36:48.620 --> 36:53.820] information requests and did lots of other criminal things that i just think [36:53.820 --> 36:57.340] we should talk to her about or talk to somebody about it [36:57.340 --> 37:02.940] yeah let me give an example of why i like what you're doing [37:02.940 --> 37:06.220] it's the right way to go after public officials i had a [37:06.220 --> 37:09.660] sheriff's deputy a bailiff in the courthouse dragged me down the [37:09.660 --> 37:13.580] stairs shoved me out the door knocked me down broke my elbow [37:13.580 --> 37:17.420] to prevent me from giving criminal complaints against the district attorney [37:17.420 --> 37:23.100] to the grand jury now when he showed when he [37:23.100 --> 37:26.780] he opened the door to me i stepped out and he gave me a little [37:26.780 --> 37:32.060] push they shouldn't have done that should have kept his hands off of me [37:32.060 --> 37:37.580] but he's just a little push but it just happened i was stepping off a step [37:37.580 --> 37:42.220] and my foot hit a carpet there they had there it was in the winter to clean your [37:42.220 --> 37:45.660] feet on and when my foot hit that carpet with that [37:45.660 --> 37:49.500] extra little push scooted that carpet out from under me [37:49.500 --> 37:54.540] and i went down backwards and landed on a on a granite step on my [37:54.540 --> 38:01.260] point of my elbow he was mortified he absolutely did not [38:01.260 --> 38:07.260] mean to injure me but he did something he should not have done [38:07.260 --> 38:15.020] and caused me that injury so a couple weeks later i come back to the [38:15.020 --> 38:18.460] county attorney's office and i was good friends with the county attorney and i [38:18.460 --> 38:23.100] i've got my arm in my in a swing and he said how you doing mr calton [38:23.100 --> 38:27.180] well i've been better he said yes i heard [38:27.180 --> 38:31.260] he said are you going to file against dick [38:31.260 --> 38:38.540] dick was the bailiff who knocked me down and i told him [38:38.540 --> 38:44.140] no he said well why not he he knocked you down and [38:44.140 --> 38:47.340] interviewed you i said yeah i understand that [38:47.340 --> 38:51.180] but dick's been a a sheriff's deputy and a [38:51.180 --> 38:59.020] bailiff combined for some 25 years and you know when i do these things i [38:59.020 --> 39:06.060] always have a clearly stated ultimate outcome [39:06.060 --> 39:10.060] in mind my personal ultimate outcome is to [39:10.060 --> 39:13.500] place every judge in the country in a position such that [39:13.500 --> 39:17.820] when they step up behind the bench look out across the bar at the gallery i [39:17.820 --> 39:22.220] want them wondering which one which one of those scoundrels are out there [39:22.220 --> 39:25.900] wait for me to render a ruling that they don't like so they can run down try to [39:25.900 --> 39:31.660] get me arrested but it's not that i want the judge arrested [39:31.660 --> 39:39.660] i want the judge to be clearly aware that that's a possibility [39:39.660 --> 39:43.420] once the judges are aware that that's a possibility [39:43.420 --> 39:48.460] the vast majority of the problems we are having will simply [39:48.460 --> 39:54.860] go away and i looked at going after dick [39:54.860 --> 40:01.900] and i simply could not frame this in a way that would lead me [40:01.900 --> 40:09.100] toward my ultimate outcome and besides i just couldn't bring it to [40:09.100 --> 40:16.940] myself to potentially ruin this guy's 25 year career [40:16.940 --> 40:20.460] possibly causing to lose his pension and no matter no [40:20.460 --> 40:25.020] no telling what else because of a mistake an [40:25.020 --> 40:31.900] incautious moment coupled with the fact that i do have a way of pushing them [40:31.900 --> 40:35.260] over the edge when he asked me what i was doing in the [40:35.260 --> 40:40.780] courthouse he knew exactly why i was there i told him i have business in this [40:40.780 --> 40:45.180] courthouse and it's none of yours well i'm the court bailiff and the court [40:45.180 --> 40:48.940] security officer and i want to know what you're doing in this courthouse [40:48.940 --> 40:52.380] i said if you're the court bailiff then you scoot your little behind in that [40:52.380 --> 40:57.260] courtroom and be a good little bailiff you're dismissed [40:57.260 --> 41:03.580] well he didn't take that well and after i did that to him [41:03.580 --> 41:11.500] uh made a minor error in judgments would you ruin somebody's entire life for [41:11.500 --> 41:16.140] that i couldn't bring myself to so i didn't go [41:16.140 --> 41:19.740] after him it turned out to be the most powerful thing [41:19.740 --> 41:25.900] i've ever done if you go to wise county and ask about me [41:25.900 --> 41:31.740] a lot of people there that don't like me but everybody respects me and we went over this over and over and i believe that's why he succeeded [01:24:31.660 --> 01:24:36.380] his dad said it now his dad was the secretary at that hearing [01:24:36.380 --> 01:24:40.380] keeping the paper straight giving him what he needed just as he needed it [01:24:40.380 --> 01:24:45.340] kind of nudging him saying hey say something there jump on this [01:24:45.340 --> 01:24:50.540] his dad said i don't think he would have ever made it without my assistance [01:24:50.540 --> 01:24:54.860] in the courtroom and i said i believe you're correct [01:24:54.860 --> 01:25:03.100] so he was a 16 year old boy but it's a lot to take in it's intimidating [01:25:03.100 --> 01:25:07.100] and we're fearful until we understand more [01:25:07.100 --> 01:25:10.700] and the [01:51:38.460 --> 01:51:43.100] Well, basically, to sum it up, there's two things that were gnawing at my brain. One, [01:51:45.100 --> 01:51:51.020] because of all the convolution of everything with the way the calendar is gone, I never got my [01:51:51.020 --> 01:51:58.140] attorney. I want to reintroduce that before they try and say that I waived my rights to it by [01:51:59.100 --> 01:52:07.020] not bringing it up recently. I have in there a, what did I call it, a shoot. I forget the exact [01:52:07.020 --> 01:52:12.700] words of it. I don't know if they're the exact right ones. It's a motion for court to comply [01:52:13.580 --> 01:52:19.820] because he had issued an order to assign me counsel and proceed in formal plot press, [01:52:19.820 --> 01:52:23.660] but nothing ever came to that. Okay, you raise an objection to [01:52:24.780 --> 01:52:31.900] appearing without counsel. Okay. They always, they will ask, [01:52:33.260 --> 01:52:37.500] is the prosecutor ready? Is the defense ready? And you'll say, absolutely not. [01:52:38.540 --> 01:52:46.460] I don't have counsel. And very good chance because the courts always want you to have counsel [01:52:46.460 --> 01:52:51.500] because it is counsel they use to throw you under the bus with. [01:52:52.780 --> 01:52:58.700] So he wants you to have counsel as a rule. So first thing to do is object to the hearing [01:52:58.700 --> 01:53:04.860] is you don't have counsel. And we absolutely, you can absolutely refuse to participate to [01:53:04.860 --> 01:53:14.540] move forward without counsel. Okay. And we had people out here use that very effectively. [01:53:14.540 --> 01:53:18.460] Okay. But you do need to be there. You do need to show up. You can't just [01:53:18.460 --> 01:53:23.260] object and say, well, I didn't show up because I didn't have a lawyer. You have to, [01:53:24.620 --> 01:53:26.940] you probably realized that already. They would use that against me. [01:53:26.940 --> 01:53:29.660] Well, even when I did appear, so I got the memo on that one. [01:53:30.540 --> 01:53:38.860] Yeah. But the other one was, as I was thinking about it, they issued two. The one was for the [01:53:38.860 --> 01:53:46.060] conference. And the other one was setting the calendar for jury selection and the trial. [01:53:46.620 --> 01:53:51.900] And they're all within a couple of weeks of right now. I think the trial is scheduled [01:53:51.900 --> 01:53:58.460] for the 24th of August. And the jury selection start like the 11th status conference is the [01:53:58.460 --> 01:54:04.700] 6th. So they went from doing nothing to all of a sudden jamming everything right on top of me. [01:54:04.700 --> 01:54:10.700] Okay. Have you requested discovery? Yes. And there's still some issues with it. [01:54:10.700 --> 01:54:16.060] And, you know, again, my last meeting with them, I was supposed to hash out a lot of [01:54:16.060 --> 01:54:21.500] these things at another, the previous conference. And that's when they made me the offer. And [01:54:21.500 --> 01:54:26.380] that's why everything got delayed. So, but as I was thinking about all these things, [01:54:26.380 --> 01:54:33.180] I came up with the fact that when I presented a motion to dismiss on subject matter jurisdiction [01:54:33.180 --> 01:54:42.620] to the magistrate, and he ignored it and held it over for trial, you know, to process it further, [01:54:45.580 --> 01:54:51.580] they skipped a step. He didn't rule on it in a manner where I could appeal it. [01:54:52.780 --> 01:55:02.780] So everything that has been done from that moment to now has been outside of law. So my idea was [01:55:02.780 --> 01:55:08.620] to put in a motion to vacate. It's late. Wait, wait, wait. You said he didn't rule on it. [01:55:08.620 --> 01:55:14.540] Are you talking about appointment of counsel? No, on the motion to dismiss. [01:55:14.540 --> 01:55:21.900] The jury hearing, my preliminary hearing, the argument of subject matter jurisdiction was [01:55:21.900 --> 01:55:27.340] raised. He turned to the district attorney and said, what is this? The district attorney said, [01:55:27.340 --> 01:55:32.380] well, this is nothing we need to deal with right now. This is not for, this isn't something to [01:55:32.380 --> 01:55:40.300] be addressed at this juncture. What? Then he proceeded. Did you, okay, did you file against [01:55:40.300 --> 01:55:50.780] the prosecutor? Did you file a... I ignored everything. I barred. This is a criminal complaint. [01:55:50.780 --> 01:55:57.100] I attempted to file in Pennsylvania to no avail. And that's when I have something sitting with the [01:55:57.100 --> 01:56:03.340] Fed and with the FBI, which I need to push that pressure again with the former and the grand jury. [01:56:03.340 --> 01:56:09.740] I haven't done that yet. So yes, I've gone down all those paths. I was merely thinking just to [01:56:09.740 --> 01:56:14.540] make more of a mess of it, to throw in a motion to vacate that spells out that even the setting of [01:56:14.540 --> 01:56:21.580] the conference, even the setting of the calendar is outside of law until that motion is dealt with. [01:56:21.580 --> 01:56:27.340] But, you know, that was my thought. I just wanted to make sure I wasn't out of lunch on that thought. [01:56:28.220 --> 01:56:31.820] You might send a notice of tort to the judge and the prosecutor. [01:56:34.140 --> 01:56:42.380] Like your standard certified mail tort letter? Yes. Okay. If they have acted, since you filed a [01:56:42.380 --> 01:56:47.500] subject matter jurisdiction challenge and subject matter jurisdiction is a threshold issue, [01:56:47.500 --> 01:56:52.700] they had no jurisdiction to move forward, but they moved forward anyway.
