Mr. Abbott and other state officials including [01:35.960 --> 01:39.960] the Attorney General stipulated in a letter that County District attorneys back on Thursday [01:39.960 --> 01:44.560] that marijuana has not been decriminalized in Texas and that these actions demonstrate [01:44.560 --> 01:50.480] a misunderstanding of how HB 1325 works as well as other cities too like the District [01:50.480 --> 01:56.680] Attorney in El Paso Kyma Esparza a Democrat who also stated earlier this month that the [01:56.680 --> 02:02.560] law quote will not have an effect on the prosecution of marijuana cases in El Paso. However the [02:02.560 --> 02:07.240] issue was succinctly summarized by Mr. Brandon Ball an assistant public defender in Harris [02:07.240 --> 02:12.040] County who stated that quote the law is constantly changing on what makes something illegal based [02:12.040 --> 02:16.560] on its chemical makeup. It's important that if someone is charged with something the test [02:16.560 --> 02:25.240] matches what they're charged with. We don't want to damage or ruin the reputation of a actual [04:18.520 --> 04:26.960] honest person if we have one and there are actually some honest judges out there I think [04:26.960 --> 04:32.240] maybe that's wishful thinking. But I'm not being difficult when you bring these things [04:32.240 --> 04:41.160] up I'm just taking the devil's advocate I'm taking the defense's side. So where were [04:41.160 --> 04:49.960] we on this judge when you went out? Well we were talking about a lot of things about [04:49.960 --> 04:56.200] her different interests and the fact that she got her position potentially through her [04:56.200 --> 05:02.360] husband being on the board of trustee who was then her boss and you know I'm looking [05:02.360 --> 05:08.720] at the Illinois canons of judicial conduct and it says a judge like in California and [05:08.720 --> 05:15.880] therefore should avoid improprietary and the appearance of improprietary in all of the [05:15.880 --> 05:21.760] judges activities and from what this judge has been doing in the reports on us he's not [05:21.760 --> 05:33.720] avoiding it at all. Well that we come across a lot and one of the problems we have is that [05:33.720 --> 05:47.840] we're asking judges to prosecute judges. If we're to get an honest judiciary we're going [05:47.840 --> 05:56.960] to have to get a separate body to enforce these provisions or these canons of judicial [05:56.960 --> 06:06.400] ethics. Judges are not going to do it to themselves. If you are a plumber you don't have a bunch [06:06.400 --> 06:15.720] of plumbers on the licensing board. You may have one or two but primarily it's other people. [06:15.720 --> 06:23.240] If you're an electrician or a physician you don't have people that are there to protect [06:23.240 --> 06:29.800] yourself like lawyers. If you're any of these other things you have lawyers. Lawyers and [06:29.800 --> 06:38.840] judges they're all lawyers and they all protect each other and we have the Fox Garden in-house [06:38.840 --> 06:44.200] issue here. So the only way we're going to get these judges is we're going to have [06:44.200 --> 06:59.640] SUM. Does either of you have an issue with this particular judge? No but John knows this [06:59.640 --> 07:08.520] person who does and a member of his family was found after all this has been seen. Well [07:08.520 --> 07:17.880] we'll talk about that part another time. So make a long story short there was one person [07:17.880 --> 07:24.440] that came up in the news and I was just curious because it had to do with the judge. Anyway [07:24.440 --> 07:33.560] I do have just in general what do you think of that law? Just in general the New York [07:33.560 --> 07:40.320] State Legislature has passed a law that the bank has approved legal standing before a [07:40.320 --> 07:45.840] foreclosure could take place. I mean that's long overdue that should have been 200 years [07:45.840 --> 07:53.440] ago they should have passed that. Yes it should have. They waited until this whole monstrous [07:53.440 --> 08:02.280] mess was over until the banks had completely decimated a generation and then they passed [08:02.280 --> 08:07.640] this law. Well what will happen is something similar to what happened in this case. After [08:07.640 --> 08:17.040] the Depression in 1929 they passed the Glass-Steagall Act and the prohibition against the derivatives. [08:17.040 --> 08:26.280] Yep and then something like in 1999 they removed those two provisions and allowed all this [08:26.280 --> 08:37.680] stuff to happen. After everybody's been okay you can't talk when I'm talking. After this [08:37.680 --> 08:45.400] crash after the banks stole everybody's property then they put these laws back in place. If [08:45.400 --> 08:50.800] they ever removed these look at the provisions that are there to protect you if they're ever [08:50.800 --> 08:58.400] removed then the banks are running the scam on you again. The banks are the greatest evil [08:58.400 --> 09:08.880] out there. Jesus Christ went around the Holy Land preaching what the Pharisees construed [09:08.880 --> 09:19.120] as heresy and Saul from Tarsus went to the Pharisees and asked them, I'm sorry it wasn't [09:19.120 --> 09:23.840] Saul, someone else Saul was already, Jesus was dead when he came on. They removed that prohibition in 2007. In July, in August, they used naked [12:12.160 --> 12:20.520] short selling to bankrupt Sherson Lehman and cause a crash in 2008. It was very carefully [12:20.520 --> 12:30.080] crafted by the banks. They are the biggest scoundrels out there. That's my story and [12:30.080 --> 12:41.160] I'm sticking to it. Thank you. But then again, if you broke up all the money and spread it out amongst [14:50.000 --> 14:57.280] all the people, it would wind up in the same hands. So this is not a battle we're going [14:57.280 --> 15:03.920] to win. It's not a war we're going to win, we'll just win some battles in the meantime. New York State Supreme Court judge Dan Doyle signed [20:49.200 --> 20:58.200] an order ordering a boy named Soren Schwartz back to school at Monroe One Boses in Fairport, [20:58.200 --> 21:05.040] New York. Schwartz lives in Ten Yan. The boy has severe autism and he was banned from [21:05.040 --> 21:11.040] his school in September of 2019 because the school doctor denied his medical exemption [21:11.040 --> 21:16.920] from vaccines under the emergency regulation set by the New York State Department of Health [21:16.920 --> 21:22.720] in August of 2019. I guess there was a measles outbreak and the legislature in New York responded [21:22.720 --> 21:31.960] to it and denied medical exemptions as a reason for not taking vaccines. Since then he had [21:31.960 --> 21:36.520] been attending school for three years with a medical exemption and now the New York State [21:36.520 --> 21:45.000] legislature no longer recognizes it and the judge, Dan Doyle, signed a paper that said [21:45.000 --> 21:53.240] you better send the boy back to school as immediate as practical and now they're considering [21:53.240 --> 22:00.200] whether or not that's going to have any weight with the rest of the number of students that [22:00.200 --> 22:06.960] have been banned from schools because of their refusal to take vaccines based on medical [22:06.960 --> 22:14.080] exemptions which now the state no longer honors. But Judge Doyle seems to be moving back in [22:14.080 --> 22:21.760] the direction of individual rights for the individual, individual rights for the individual. [22:21.760 --> 22:25.480] But anyway, it's redundant. But you know what I mean. [22:25.480 --> 22:35.760] One of those issues that make me glad that I am not a judge, this is one of those issues [22:35.760 --> 22:48.640] that make me glad I'm not a judge. How do we find a middle ground here? We have children [22:48.640 --> 22:56.840] were sending to schools and schools are just filled with all sorts of contaminants. My [22:56.840 --> 23:06.240] kids used to bring me presents home from school. The flu, head lice, all kind of cool stuff. [23:06.240 --> 23:14.320] Now we're looking at a measles outbreak that could cause the death of your children. How [23:14.320 --> 23:20.480] many children are we willing to sacrifice to make sure that this person who can't be [23:20.480 --> 23:27.760] vaccinated doesn't catch the disease and spread it amongst our kids and kill some of them? [23:27.760 --> 23:32.720] Well there's several who's rights are more fundamental. [23:32.720 --> 23:40.760] I could get into it from a medical standpoint but as far as measles, not enough of people [23:40.760 --> 23:44.840] die from measles. In fact, more people die from measles. [23:44.840 --> 23:50.000] Okay, not only one in six die from rushing relit. [23:50.000 --> 23:57.760] Well, yeah, but one in six is not measles. Most of the diseases, I'm just going to say [23:57.760 --> 24:01.320] one sentence and then we'll get off to subject. [24:01.320 --> 24:08.280] How many chances are you willing to take with your children's life? How many chances are [24:08.280 --> 24:11.000] you willing to take that could be prevented? [24:11.000 --> 24:16.400] Well, that's the whole idea about not getting a vaccine because they've been proven not [24:16.400 --> 24:17.400] to be safe. [24:17.400 --> 24:18.400] The United Nations... [24:18.400 --> 24:19.400] Different arguments. [24:19.400 --> 24:27.760] Different arguments. Let's not jump to relevant arguments as to this issue. We have a child [24:27.760 --> 24:35.480] here who can't take this vaccine for whatever reason. And we have all of these children [24:35.480 --> 24:40.800] in the school who've taken the vaccine and even if you have the vaccine it doesn't mean [24:40.800 --> 24:49.400] you're protected. And they're reluctant to risk being contaminated even though the risk [24:49.400 --> 24:59.800] is small. Who has rights here? If someone has tuberculosis, can we ban them from the [24:59.800 --> 25:00.800] school? [25:00.800 --> 25:11.880] Granted, the person who has tuberculosis didn't do anything wrong. They didn't go out and [25:11.880 --> 25:20.640] get tuberculosis. It's a role of the dice. But do we risk our children? How do we find [25:20.640 --> 25:22.280] this balance? [25:22.280 --> 25:27.800] Well, number one, if the vaccine's really worked then you wouldn't be afraid of one [25:27.800 --> 25:29.480] or two children that didn't get the vaccine. [25:29.480 --> 25:34.280] Different argument. Different argument. Different argument. Don't do that. One argument at [25:34.280 --> 25:39.240] a time. You can throw 10,000 arguments to me. One after the other after the other after [25:39.240 --> 25:45.600] the other after the other. This is what I get a lot of these patriot mythologists. That's [25:45.600 --> 25:52.040] what they do. They throw some crazy stuff at you. You argue that issue and they say, [25:52.040 --> 25:56.720] well, what about this? And you argue that one. What about this? We're talking about one [25:56.720 --> 26:05.760] issue here. How do we find a balance for those parents who are sending their kids to school [26:05.760 --> 26:08.200] and don't want them to die? [26:08.200 --> 26:15.080] And this other parent who has a child with a disability and can't give them this vaccine, [26:15.080 --> 26:21.280] but the child has a right to an education, has a right to a fair education and the irractured [26:21.280 --> 26:27.000] other kids. Where do we strike a balance here? [26:27.000 --> 26:31.720] Well, you said something about, yeah, I heard you say the word die. Now, die from what? [26:31.720 --> 26:33.720] Die from what? [26:33.720 --> 26:35.720] You're dodging the question. [26:35.720 --> 26:38.520] No, no, no, no, no, no. But you said die. [26:38.520 --> 26:47.840] You are dodging the question. It doesn't matter what you die from. If you die, you're dead. [26:47.840 --> 26:59.800] Who cares? If someone brings a potential for death, how much risk do we have to take to [26:59.800 --> 27:07.640] make sure that person's rights are protected when that person is not guilty of anything? [27:07.640 --> 27:10.800] I'll answer the question if you tell me what they're dying from. [27:10.800 --> 27:13.400] Oh, okay. We're not going to go. [27:13.400 --> 27:14.600] We need to know what they're dying from. [27:14.600 --> 27:20.000] You're dying from something. Then you're going to go off into some other [27:20.000 --> 27:29.680] argument. We can't find an answer to an issue if you insist on changing the rules. Every [27:29.680 --> 27:36.880] time something said, this is my biggest frustration when I'm dealing with these patriot mythologists. [27:36.880 --> 27:44.120] No matter what you say, you can't propose a legal issue in order to, rather than address [27:44.120 --> 27:48.600] a difficult issue, you want to change the issue into something else. [27:48.600 --> 27:54.680] So which is worse, to die from a pistol or a shotgun? [27:54.680 --> 28:11.880] I'm saying that the student can die from measles, hooping cough, diphtheria, cholera. [28:11.880 --> 28:21.040] You are trying to force this into a separate issue, so you don't have to address the hard [28:21.040 --> 28:32.840] question of when does someone have a right that may jeopardize the rights of someone [28:32.840 --> 28:34.640] else? [28:34.640 --> 28:39.840] This has always been a really hard issue to address. [28:39.840 --> 28:45.560] In a case like this, we have this child who has done nothing wrong, who's done nothing [28:45.560 --> 28:53.320] to give the reason to lose their rights. The child has a right to go to a public school. [28:53.320 --> 29:00.480] But I also have a right to protect my children. [29:00.480 --> 29:07.680] How do we find a balance? [29:07.680 --> 29:14.160] Do we say, okay, the child has a right to go to school, but he does not necessarily [29:14.160 --> 29:21.320] have a right to go to this particular school that would create an unreasonable risk. [29:21.320 --> 29:31.520] He can exercise that right by going to a private school or a school geared toward this issue. [29:31.520 --> 29:38.520] How do we find a solution that balances everybody's rights? [29:38.520 --> 29:48.960] I could answer that, but I know it's a hard question. That was the whole point. He's getting much better, but we had an issue [34:07.000 --> 34:15.400] today where we're talking about a specific legal point, and in the middle of a sentence [34:15.400 --> 34:22.200] he shifted to another legal point. In court, this will get you in a lot of trouble. It'll [34:22.200 --> 34:31.800] get all your arguments tossed out. If you're speaking to one issue, speak clearly and specifically [34:31.800 --> 34:39.040] to that issue. Do not introduce another issue until you have addressed the issue you're [34:39.040 --> 34:47.840] speaking to. John, when I asked you about this particular issue, you asked about an [34:47.840 --> 34:54.920] irrelevant fact that did not go to either one of the issues which would have pulled the [34:54.920 --> 35:01.680] discussion away from what we were talking about, and you were absolutely insistent that [35:01.680 --> 35:06.880] we had to go to some irrelevant issue. If you're going to argue any kind of legal issues, [35:06.880 --> 35:15.160] you have to fix this. One issue at a time. Do not let your arguments stray to different [35:15.160 --> 35:26.120] issues unless you say, in this case, we believe this is what we would do, and then we can [35:26.120 --> 35:31.600] add a variable and say, in this other case, this is what we can do, but if you stitch [35:31.600 --> 35:43.240] the two together, you lose them both. In my legal 101, where I have a dissertation on [35:43.240 --> 35:50.640] how to write legal documents, I suggest that when you're writing a legal document, put [35:50.640 --> 36:01.480] a heading on every paragraph. Then when you write to that paragraph, make sure you stay [36:01.480 --> 36:08.880] true to the heading. If anyone here has read legal documents, you'll see this huge document [36:08.880 --> 36:13.840] with paragraph after paragraph after paragraph after paragraph. Sometimes I've seen paragraphs [36:13.840 --> 36:19.840] a half a page long. No human being can read that garbage, and in there, they go from one [36:19.840 --> 36:27.160] subject to another to another to another, all in one paragraph. I have read documents [36:27.160 --> 36:33.040] where I've read them four or five times and still could not get them sorted out. Tim's [36:33.040 --> 36:38.120] reading these documents and he's saying that he has to read them over and over to make [36:38.120 --> 36:44.560] sense of them, and that's because these lawyers do not exercise discipline in writing their [36:44.560 --> 36:56.760] documents. If you read court opinions, you will find that they are very strict about [36:56.760 --> 37:04.240] addressing a single issue at one time. They never let their issues drift from one point [37:04.240 --> 37:10.520] to a different point. I suspect that when they write those documents, they put a heading [37:10.520 --> 37:16.440] on every paragraph. Then when they're done, you can take those headings out, but put them [37:16.440 --> 37:23.360] in there anyway to keep you focused. This whole thing with John was about how do we [37:23.360 --> 37:29.080] focus on one issue without drifting away from it. That's why I spent so much time on it. [37:29.080 --> 37:44.040] Okay, John, you asked the question, what right did this child have? I don't know. They were [37:44.040 --> 37:56.760] afraid he would spread measles and start an epidemic. And you absolutely refuse to go back to the original question. Okay, the original [39:12.120 --> 39:21.720] question is, do not ever try to argue with court. You will lose. If you take control of my vehicle [56:14.000 --> 56:25.120] without my permission, that's theft. Yes. And that's what this says. Obtain without, okay. [56:26.080 --> 56:32.400] Person commits an aggravated motor vehicle theft in the first degree. If he or she knowingly obtains, [56:33.040 --> 56:38.960] but here we got or exercises control over the motor vehicle of another without authorization by [56:38.960 --> 56:50.560] or by threat or deception. Did the owner of the vehicle demand that you return the vehicle? [56:53.520 --> 56:56.960] Yeah. On May 9th of last year. [57:01.600 --> 57:07.440] You may have a problem. I was told by the officer after he listened to the audio file between [57:07.440 --> 57:14.000] the owner of the vehicle and myself that it was a civil matter and that I needed to speak to the [57:14.000 --> 57:20.320] court for the title to the vehicle in accordance with the agreement he and I had made. [57:25.120 --> 57:33.120] If you obtained the vehicle in accordance with an agreement, whether it was written agreement [57:33.120 --> 57:42.240] or verbal agreement. Yeah. Did he, did he violate a tenet of the agreement? Completely. [57:43.360 --> 57:50.240] Yeah. You really need. How did he? Well, how did he violated the tenet of the agreement? So then you go down there and hand them the [01:10:05.600 --> 01:10:12.000] request, and when they deny the records, then you call 911 or call if there's a bailiff around, [01:10:12.000 --> 01:10:21.520] call him over, and hand him the complaint that's already made out. They'll feel like you set them [01:10:21.520 --> 01:10:31.520] up. Okay. And they'll be right, you did. All right, so yeah, the thing that kind of stumbled [01:10:31.520 --> 01:10:36.320] me up was just they refused to accept the paperwork. I had it all made out and everything that said, [01:10:36.320 --> 01:10:42.960] we cannot accept, we can't accept the documents from you. Nice and outrageous. When you start putting it, you put the bailiff on the dime, and the [01:11:58.400 --> 01:12:06.080] bailiff's going to be real unhappy with the guy who got you to do that. And when you ask the bailiff to [01:12:13.040 --> 01:12:18.960] arrest someone, you become a protected class. Now all of a sudden they have a problem. Well, so I have a question about the nine. Also, let's say we do go the [01:12:34.960 --> 01:12:46.400] 9-1-1 route. They refuse to accept the paperwork. Call them. Tell them where you're at, and you [01:12:46.400 --> 01:12:53.760] need them to dispatch an officer to take your criminal affidavit of class A misdemeanor [01:12:53.760 --> 01:13:01.200] official misconduct against this person. And sometimes you'll get some blowback from the [01:13:01.200 --> 01:13:08.000] dispatcher. When the dispatcher asks, well, what all happened, you ask the dispatcher, [01:13:08.000 --> 01:13:14.960] are you the responding officer? And they'll say, no, I'm the dispatcher. Well, then dispatch. [01:13:15.760 --> 01:13:21.680] I'll give a full statement to the responding officer. Excuse me. That's the only good [01:13:21.680 --> 01:13:26.240] dispatch out of the way. And then when the officer gets there, the first thing he [01:13:26.240 --> 01:13:33.360] asks them to do is arrest this person. Well, they can't arrest this person because they [01:13:33.360 --> 01:13:41.920] didn't see it occur. So if I have a bailiff in the building, and if he could have seen them, [01:13:41.920 --> 01:13:49.280] he saw them. You order him to arrest them because it happened within your site. The code says within [01:13:49.280 --> 01:13:54.480] your site or within your hearing. It does not say that you have to see it. [01:13:56.880 --> 01:14:01.680] You just have to stay within your site. You might not have been paid attention, [01:14:01.680 --> 01:14:09.600] makes no difference. Let them argue that in court. And then when the bailiff refuses to arrest, [01:14:09.600 --> 01:14:16.240] then you file against the bailiff. When the 911 officer refuses to arrest, [01:14:16.240 --> 01:14:22.480] you can't charge him criminally for that. But if he refuses to take your complaint, [01:14:22.480 --> 01:14:28.800] then you can charge him for shielding for 3805, shielding for prosecution. And that's a felony. They changed the law to give him original jurisdiction [01:23:58.320 --> 01:24:08.720] in a complaint against a public official under 3903. That's been added. But before that, one [01:24:08.720 --> 01:24:17.120] instance, and that was a allegation of a violation of the Freedom of Information Act against a [01:24:17.120 --> 01:24:26.560] district attorney. So, you want to look and see if that specification is still in there. [01:24:30.000 --> 01:24:35.920] The specification of the district attorney? Yeah, it gave the attorney general original [01:24:35.920 --> 01:24:43.520] jurisdiction only in the case of a violation of the Open Records Act by a district attorney. [01:24:43.520 --> 01:24:49.920] Hmm. Well, they have definitely been acting on it. When I send to them something, I send to [01:24:49.920 --> 01:24:54.640] the attorney general, and it's not just been district clerks, it's been different county [01:24:54.640 --> 01:25:02.000] clerks, and whoever's doing these violations of the act, I report to the attorney general, [01:25:02.000 --> 01:25:08.560] and he is pretty quick. His office responds, and they say, you know, we need one more piece [01:25:08.560 --> 01:25:14.240] of information. We're missing this. I just see where your records are. So they sent that to the attorney general. Before that, [01:26:41.680 --> 01:26:47.680] at that time, that was the only prosecutorial authority an attorney general had. [01:26:47.680 --> 01:26:58.960] And then recently, they've added concurrent jurisdiction with the district attorney in the [01:26:58.960 --> 01:27:07.760] matter of a complaint against a public official for official oppression. [01:27:07.760 --> 01:27:17.440] And I think that was because of this situation in Houston where the cops chased down this [01:27:18.240 --> 01:27:24.240] 120-pound, 12-year-old and kicked him and stomped him for a minute and a half. [01:27:25.760 --> 01:27:35.520] Six cops. I'm surprised they didn't kill him, but the population come unglued, [01:27:35.520 --> 01:27:40.880] and they made it a felony to commit official oppression with bodily injury. [01:27:42.960 --> 01:27:49.840] And that was also the time they gave the prosecuting the attorney general concurrent [01:27:49.840 --> 01:27:59.760] jurisdiction. Okay. Where were we, Taylor? And, you know, if they're coming after you and, okay, [01:28:06.960 --> 01:28:13.760] users just a traffic ticket anyway, so there's not much they can do. He found a [01:34:51.120 --> 01:35:01.280] bankruptcy to stop foreclosure on his mother's house. Did she do a quick claim to you or how did [01:35:01.280 --> 01:35:10.320] she get you? She did a quick claim with $1,000 consideration back on August 17, 2017. And not [01:35:10.320 --> 01:35:15.520] knowing the future, we had no idea how things were going to move forward. Leaving aside that the [01:35:15.520 --> 01:35:22.720] whole case was sitting at the state court in New York, and the motions were absolutely fantastic. [01:35:23.120 --> 01:35:30.000] They admitted to a lot of things, which I'm not going to get into right now, because at the end [01:35:30.000 --> 01:35:35.920] of the day, the judges say, okay, they have no standing. There's no obligation to pay. But guess [01:35:35.920 --> 01:35:42.000] what? Deny all that, grant summary judgment in the favor of the non-party HSDT, sell the property [01:35:42.000 --> 01:35:47.120] next month. And then we didn't know the future, but the bankruptcy really helped out tremendously [01:35:47.120 --> 01:35:53.840] because we're in front of a semi-honest federal bankruptcy judge. He's 100 times better than [01:35:53.840 --> 01:35:58.800] these lower court judges. These lower court judges, they smile, drink coffee. Well, you're doing a [01:35:58.800 --> 01:36:03.440] great job, but I can't grant any of this. Denied. And they do it with a smile, Randy. They do it [01:36:03.440 --> 01:36:10.960] with a beautiful, you know, Joker smile, you know, like the movie Joker. It's absolutely incredible, [01:36:10.960 --> 01:36:17.200] how corrupt this area is. Actually, everybody wants to stay more corrupt than the others, [01:36:17.200 --> 01:36:22.560] and everybody's, you know, everybody's trying to be first place in it, but, you know, Buffalo is [01:36:22.560 --> 01:36:29.120] a horrible town, and very corrupt judges in the county. But that's a pretty amazing story. But [01:36:29.120 --> 01:36:34.320] then we went to bankruptcy court, and then at the last minute, they're going to sell the property [01:36:34.320 --> 01:36:39.680] July 24, 2019, and that's when I found bankruptcy the day before the sale, and that's not that. [01:36:40.560 --> 01:36:46.000] And now we're moving progressively forward, and the nation started Mr. Cooper, which is located [01:36:46.000 --> 01:36:51.280] right near Neck of the Woods at the service, sir. And they filed their motion to let this [01:36:51.280 --> 01:36:56.320] stay back in October. That was granted. And based on all the stuff I put on the record, [01:36:56.320 --> 01:37:01.040] they did not move forward and sell the property. So they handed it off to Keybank. Keybank filed [01:37:02.720 --> 01:37:07.840] a motion to let this stay one day before Thanksgiving. And I didn't find out about it [01:37:07.840 --> 01:37:11.680] until like a week later, because somebody called me and they were checking my mail because I drove [01:37:11.680 --> 01:37:18.560] down to Dallas to visit family, I got a family in Dallas. And so we had very, very little time [01:37:18.560 --> 01:37:23.920] to respond. So we did, we filed a motion to reschedule based on the circumstances. And then [01:37:23.920 --> 01:37:29.600] David P. K. is the attorney in Rochester, oppose it. So you're not getting no extension of time. [01:37:29.600 --> 01:37:34.560] We're moving forward with the hearing. So the judge is law clerk called me up and says, [01:37:34.560 --> 01:37:38.880] look, we need you to show up, but can you show up by telephone? And I said, no problem. So [01:37:38.880 --> 01:37:44.400] that hearing went on for a good hour and 25 minutes and the attorney representing Keybank, [01:37:44.960 --> 01:37:50.240] which is the second lean holder, the key lock, which was, which has been charged off [01:37:50.240 --> 01:37:54.480] about almost six years ago, Randy, that's where you've been charged off and even [01:37:54.480 --> 01:38:00.160] admitted when charged off, but they're still moving forward. But this attorney admitted on the record. [01:38:01.360 --> 01:38:04.720] He got really upset at the end of the hearings. And this is ridiculous. This is going on for this [01:38:04.720 --> 01:38:08.960] long. You know, he was yelling, almost yelling at the bankruptcy judge saying that this hearing [01:38:08.960 --> 01:38:14.880] is going on this long. And he goes, our attorney fees have superseded the amount owed on this [01:38:14.880 --> 01:38:20.640] property. And he goes, this is ridiculous. Meanwhile, I'm moving forward to try to have the [01:38:20.640 --> 01:38:25.680] whole hearing postponed. It's like to back off the bus flow, which, you know, which, [01:38:25.680 --> 01:38:31.200] which that was denied. But make a long story short, he granted the motion to list this day, [01:38:31.200 --> 01:38:37.120] but denied the motion to dismiss the bankruptcy case. And the attorney representing Keybank [01:38:37.120 --> 01:38:42.880] literally flipped out. And so I got right back up here, Randy, and found the motion for rehearing, [01:38:42.880 --> 01:38:47.040] which is going to be heard on Monday. And I already filed a notice of appeal. [01:38:48.080 --> 01:38:51.600] And I've already been working on the brief. So we're already ready to go because we know [01:38:51.600 --> 01:38:54.720] he's going to deny the re-hearing, but I want to put some more stuff on the record because [01:38:55.680 --> 01:39:01.280] the bankruptcy judge signed an order stating, which was made for David P. K. C., the attorney [01:39:01.280 --> 01:39:05.920] representing Keybank, signed an opportunity to do the proposed orders. I don't even think [01:39:05.920 --> 01:39:09.760] you read the proposed order, but in that order, he says, I'm doing this bankruptcy in bad faith. [01:39:09.760 --> 01:39:16.080] So that's where we're at there. I filed a notice of appeal. I filed in for poppers because of the [01:39:16.080 --> 01:39:21.520] filing fees are super high here in New York, you know, the federal. It's like 513, what's 505, [01:39:21.520 --> 01:39:27.920] I think, filing fee. So I filed in for poppers to have the filing fees raised based on my income. [01:39:28.800 --> 01:39:33.040] And he filed the attorney objected to my informal poppers to say, wait a second, [01:39:33.040 --> 01:39:38.720] he's got money to travel down to Dallas. And he said, if this many miles he had to stay at [01:39:38.720 --> 01:39:44.720] this hotel and he made two pages long about all the money I possibly spent going from [01:39:44.720 --> 01:39:48.640] Buffalo to Dallas, can you imagine that? And I was, I drove my parents' daughter in a family. [01:39:49.280 --> 01:39:54.640] So he made a big thing about that. He objected to my informal poppers. He filed an objection to [01:39:54.640 --> 01:40:00.400] the motion for re-hearing. And all he did was cry and cry and cried. And I filed four bar [01:40:00.400 --> 01:40:05.200] grievances against him. I filed complaints with the attorney general, the consumer protection [01:40:05.200 --> 01:40:10.160] bureau. And he says, I'm harassing law firms and calling people up and harassing people and [01:40:10.160 --> 01:40:15.520] threatening people. And it was like three or four pages long. Most of it is filled with lies. [01:40:16.160 --> 01:40:19.920] Very similar with Trump's going through, they take one little thing and twist it and blow [01:40:19.920 --> 01:40:28.000] right up to a huge thing. So that's what we're at as of right now. So file a motion for sanctions. [01:40:28.000 --> 01:40:42.800] The lawyer filed a motion to deny you informal poppers. The lawyer has no standing. The only [01:40:42.800 --> 01:40:50.240] one that has standing is the court clerk. Because the court clerk is the one that doesn't get paid, [01:40:50.240 --> 01:40:59.440] not the lawyer. He has no standing in that issue. It's a frivolous filing. And that should get [01:40:59.440 --> 01:41:07.920] sanctions. We have to do that on our own. We have to actually file a motion for sanctions. [01:41:10.320 --> 01:41:13.840] I believe that was the file of the district court because he filed the objection. [01:41:13.840 --> 01:41:19.920] No, no, no. Does that be filed in whatever court he filed the objection to? [01:41:21.680 --> 01:41:26.640] Well, I forgot to tell you one part of the story. He filed the objection in the bankruptcy court. [01:41:26.640 --> 01:41:32.240] Bankruptcy court issued a deficiency notice today that he needs to file in the proper court. [01:41:32.880 --> 01:41:36.000] They asked to go to the United States District Court, which is the Apollo court above the [01:41:36.000 --> 01:41:44.720] bankruptcy court. Then file, ask for sanctions against him. He's a lawyer. He knew better. [01:41:44.720 --> 01:41:48.240] Accus him of doing that just to harass you. [01:41:52.240 --> 01:41:56.800] I will say one thing that telephone hearing, I've never done that before. I didn't even know it [01:41:57.520 --> 01:42:01.120] didn't even exist. And so the law clerk for the bankruptcy court called me and says, [01:42:01.120 --> 01:42:06.640] we need you to call it in at this number, hit the code, and here's a security code. So I thought [01:42:06.640 --> 01:42:13.040] that was kind of thoughtful. At least they let me do that part. Okay. How did that work out for you? [01:42:14.240 --> 01:42:18.400] Actually, pretty good. I had a nice little script. The court was very quiet. [01:42:19.280 --> 01:42:23.920] And there was one moment where he says, look, I need some time. I need to review some of these [01:42:23.920 --> 01:42:27.680] things. And I think we waited about seven minutes, maybe 10 minutes, but he had to review [01:42:27.680 --> 01:42:32.080] what I was saying was true. And I'm not going to sit here and give you a whole [01:42:32.080 --> 01:42:36.640] hearing over the phone here, but he was getting mad as the hearing was going on. [01:42:36.640 --> 01:42:41.200] He couldn't believe how long it was going on. The attorney that's allegedly representing [01:42:41.200 --> 01:42:46.400] Keybank. I don't even think Keybank knows the attorney fees have superseded the amount owed. [01:42:46.400 --> 01:42:49.360] I don't think they even know what's going on because they make, you know, Keybank's worth. [01:42:49.360 --> 01:42:58.720] Okay. Objection, relevance. Right. So what? Your attorney fees exceeded the amount [01:42:58.720 --> 01:43:04.000] owed. Your problem, not my problem. Certainly not the court's problem. [01:43:07.600 --> 01:43:12.720] But what was interesting about it is he was telling me that, or not telling me, but telling [01:43:12.720 --> 01:43:18.240] the court in his motion to lift the state, he spent three pages about all the complaints I [01:43:18.240 --> 01:43:23.840] filed over the last five years, filed complaints with the consumer protection bill several times, [01:43:23.840 --> 01:43:30.160] barred grievances, attorney generals, he listened. I mean, he was very notate. Then he made some [01:43:30.160 --> 01:43:36.320] false statements. But what was interesting about it is that I heard the music in the background. [01:43:37.360 --> 01:43:43.520] Yeah, I was just, I was actually looking at the clock this time. It's Randy Kelton, Brett [01:43:43.520 --> 01:43:48.480] Fountain, rule of law radio. That was an [01:47:15.680 --> 01:47:21.280] improper attempt to, is his attempt to improperly influence the court. So, you should grieve him [01:47:21.280 --> 01:47:28.960] for that. Well, it's all in here. It says here that he has personal knowledge of the harassing [01:47:28.960 --> 01:47:37.280] mailings to the CFPB complaints, grievances that are in other cohorts sent to counsel or against [01:47:37.280 --> 01:47:42.240] counsel, and then he goes on and he has personal knowledge of the state court actions. By the way, [01:47:42.240 --> 01:47:46.480] he's never showed up to one damn court date in the state court. He sends some other attorney in, [01:47:46.480 --> 01:47:51.280] and then they hire somebody else, and they take somebody else in. So, it's absolutely, but here's [01:47:51.280 --> 01:47:55.760] one, you know, I want to read this one little section here. It says, that or continues to try [01:47:55.760 --> 01:47:59.520] to attack the validity of the court creditor's mortgage and the rights of the court of state, [01:48:00.240 --> 01:48:05.280] which was confirmed by the court order from state foreclosure actions in Erie County. [01:48:05.280 --> 01:48:09.840] However, such attack on mortgage and state court foreclosure actions, right, ready for this one, [01:48:09.840 --> 01:48:14.880] is barred worker-felman doctrine, since the court creditor has a final state court judgment [01:48:14.880 --> 01:48:19.520] of sale. Well, I've never been served. I've filed three motions to get into this case, [01:48:19.520 --> 01:48:25.360] all been denied, and they're moving forward when my mom is not on the property anymore, [01:48:25.360 --> 01:48:29.520] and I have tried like hell to get into this case, and any time I file anything, it's stricken. [01:48:30.720 --> 01:48:34.320] So, he's trying to, I said, well, how can worker-felman apply to me [01:48:34.320 --> 01:48:38.240] when you guys haven't even served me? Now, finally, somebody's recognized me, [01:48:38.240 --> 01:48:42.000] the bankruptcy court has recognized me as a real party of interest, and that's why the [01:48:42.000 --> 01:48:47.040] sale stopped. This is the first time a court has recognized me. So, Randy, the question is, [01:48:48.880 --> 01:48:54.640] and I asked you this before, can they move forward on an old state judgment [01:48:55.440 --> 01:49:02.480] from what year, year and a half ago, and use a party that no longer owns the property anymore, [01:49:02.480 --> 01:49:05.840] and I have never been served, and I have did everything I could to get added into the case, [01:49:05.840 --> 01:49:10.800] and they denied me to be joined into the case. I am good to be asked. [01:49:10.800 --> 01:49:16.160] Well, if you were at the time of party and interest, and you were not included in the suit, [01:49:16.160 --> 01:49:20.720] then you need to file a challenge subject-managed jurisdiction to the original suit. [01:49:21.920 --> 01:49:25.200] I can't do that. It gets stricken and removed from the record.
