[01:34.040 --> 01:37.640] Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter [01:37.640 --> 01:42.120] to county district attorneys back on Thursday that marijuana has not been decriminalized [01:42.120 --> 01:48.280] in Texas and that these actions demonstrate a misunderstanding of how HB1325 works, as [01:48.280 --> 01:51.240] well as other cities too, like the District Attorney. primarily pointed at the SEC somewhat other way essentially to all government [05:33.040 --> 05:40.440] agencies but when I read these I see the SEC smeared all over them the [05:40.440 --> 05:49.160] Stewardess Exchange Commission wrote a set of codes of federal regulations all [05:49.160 --> 05:57.840] of these agencies they take the federal statutes enacted by the legislature [05:57.840 --> 06:05.640] addressing the issue of their particular concern and then they write a set the [06:05.640 --> 06:11.840] agency itself produces a code of federal regulation and the code of federal [06:11.840 --> 06:19.600] regulation are the rules and guidelines for how the agency will implement the [06:19.600 --> 06:28.280] intent of the legislative statutes well what's been happening is the agencies [06:28.280 --> 06:37.400] issue their codes of federal regulation and then sometimes the codes are [06:37.400 --> 06:47.280] understandable sometimes not and for a good example of scraping bottom or the [06:47.280 --> 06:54.120] is just section chapter 17 of the code of federal regulations the Stewardess [06:54.120 --> 07:00.960] Exchange Commission rules no reasonable person of ordinary prudence can read [07:00.960 --> 07:09.160] that garbage and makes sense of it if you read the Singaporean securities code [07:09.160 --> 07:18.000] or the Swiss securities code to which I've went through personally an eighth [07:18.000 --> 07:25.440] grader could read those and understand them when one of those codes has [07:25.440 --> 07:33.520] requirements they listen right there they because the FCC right [10:19.520 --> 10:30.600] now if a regulator has reason to believe that you are acting in a way that they [10:30.600 --> 10:38.600] believe is not in compliance with the code then they can issue a investigation [10:38.600 --> 10:46.600] against you they start out with a MUI what they call it a matter under [10:46.600 --> 10:55.320] investigation that's just they think maybe they might have enough to warrant [10:55.320 --> 11:02.360] launching an investigation if the regulator determines that there's [11:02.360 --> 11:09.240] enough evidence to warrant opening an investigation he will go to his bosses [11:09.240 --> 11:18.480] and request permission the first consideration he must make is will the [11:18.480 --> 11:25.320] litigation if will any resulting litigation that you anticipate generate [11:25.320 --> 11:33.440] enough fines and fees to to compensate us for the litigation first [11:33.440 --> 11:41.560] consideration then they issue a investigation and they shut you down [11:41.560 --> 11:47.960] immediately if you're in business and you're selling securities they shut you [11:47.960 --> 11:55.560] down immediately when they initiate the investigation not when they produce [11:55.560 --> 12:04.960] finding against you and once they produce findings against you then they either [12:04.960 --> 12:09.280] take you to court or what they actually do is come to the table say let's make a [12:09.280 --> 12:18.400] deal I looked back through the coach through the court cases and they have [12:18.400 --> 12:27.280] them all listed on the SEC site I could go back as far as 2011 and in all of [12:27.280 --> 12:36.000] those I would ask you to guess how many times the you know these judges or [12:36.000 --> 12:44.800] magistrates work are strictly SEC magistrates and they were appointed by [12:44.800 --> 12:52.960] the SEC until Trump sick the feds on them and they the feds had declared that [12:52.960 --> 13:01.120] was improper and they had to have these judges or whatever they are [13:01.120 --> 13:06.360] magistrates appointed in the same process that other judges are appointed [13:06.360 --> 13:13.720] cost them a really big problem but using those magistrates all the way back to [13:13.720 --> 13:20.440] 2011 not one single person was found innocent [13:20.440 --> 13:32.520] everybody took the SEC's deal and it's because they simply had no option the [13:32.520 --> 13:38.760] SEC shut them down as they object and resist the SEC they'll be shut down for [13:38.760 --> 13:44.520] the next three to five years and but then the outcome won't make any [13:44.520 --> 13:49.160] difference because I'll already be bankrupt this is what's called an [13:49.160 --> 14:02.000] exposed factor law the SEC will not tell you how their regulations will apply to [14:02.000 --> 14:07.680] your application until you've already launched the application people have [14:07.680 --> 14:16.080] been sending requests to the SEC for an opinion based on their intended offering [14:16.080 --> 14:23.160] and the SEC does nothing until they launch and once they launch then they [14:23.160 --> 14:30.360] define their policy by coming and shutting you down and it's claiming that [14:30.360 --> 14:37.600] you violated it that's exposed facto that's forbidden by constitution we [14:37.600 --> 14:43.200] fought a revolution over that kind of nonsense King George would send his [14:43.200 --> 14:47.360] governor's over here and if you had a nice big company making a lot of money he [14:47.360 --> 14:50.960] would look what you're doing and pass a law making it illegal for you to do what [14:50.960 --> 14:57.120] you were doing and then prosecute you for doing what you were doing [25:04.360 --> 25:12.280] or not the proposal if executed in the way that it is proposed to be executed [25:12.280 --> 25:17.680] would be in compliance with all relevant law and they're going to use it for toilet [25:17.680 --> 25:25.760] paper at least I hope they hope they use it for toilet paper never ask a public [25:25.760 --> 25:32.920] official to do anything you actually want them to do because you never ask a [25:32.920 --> 25:40.000] public official especially an SEC public official to do anything that President [25:40.000 --> 25:47.360] Trump and his two executive orders did not declaratory judgments these guys don't [25:59.160 --> 26:06.720] know how to adjudicate a declaratory judgment these lawyers these judges so [26:06.720 --> 26:13.600] what I expect when I file a petition for declaratory judgment that I'm going to [26:13.600 --> 26:18.120] get a rule 12 motion to dismiss for various data claiming which credit can [26:18.120 --> 26:26.520] be had a rule 12 be six motion to dismiss at least I hope I do that's what I [26:26.520 --> 26:34.800] got in Fort Worth and because of that filing Judge McBride the federal judge [26:34.800 --> 26:40.680] in Fort Worth dismissed my case with prejudice for failure state of claim [26:40.680 --> 26:48.960] which cover can be had problem declaratory judgment suits don't have claims they [26:48.960 --> 26:55.320] ask the court to rule on the rights of the parties and I'm gonna say I'm the [26:55.320 --> 27:02.400] party and I have a right to determine a predetermination by the department [27:02.400 --> 27:12.720] before I launch my project since their codes are indecipherable by reasonable [27:12.720 --> 27:20.200] persons of ordinary prudence their regulations do not meet the ringquist [27:20.200 --> 27:25.920] courts statutory construction requirements and I say the ringquist courts [27:25.920 --> 27:33.080] because unlike Texas the feds do not have a statutory construction statute [27:33.080 --> 27:39.200] but ringquist the ringquist court they put out a set of standards by which [27:39.200 --> 27:47.400] federal judges will make determinations concerning the constitutionality of a [27:47.400 --> 27:56.000] law based on the verbiage of the law itself and the the matter in which the [27:56.000 --> 28:02.240] law was constructed so I'm going to maintain that 17 CFR does not meet [28:02.240 --> 28:08.920] statutory construction requirements and since it doesn't then the agency who [28:08.920 --> 28:16.880] created it has a duty to explain it to us and when they didn't I'd drag them [28:16.880 --> 28:23.720] into court and then I pull out all my stinking rotten low-down nasty tricks [28:23.720 --> 28:28.720] that I got we got a on this show we have developed a whole bucket full thousand dollars in fines they let them [34:29.400 --> 34:34.760] open up and do exactly what they were going to do to start with this was [34:34.760 --> 34:41.080] clearly extortion and nothing else I said why don't you file a have your [34:41.080 --> 34:45.280] lawyers file a petition to declare to her judgment he had no idea what a [34:45.280 --> 34:51.480] petition for declaratory judgment was but when I mentioned filing suit he [34:51.480 --> 35:01.640] visibly shuttered the idea of filing anything against the SEC was just [35:01.640 --> 35:10.280] simply not going to happen he's got people's money in his hands he cannot [35:10.280 --> 35:15.280] take this kind of risk he said if I follow a suit against the SEC they'll [35:15.280 --> 35:20.960] start auditing everything I've got these so-called officials that are purporting or acting [38:02.280 --> 38:10.120] and purporting under the color of law and that's exactly the point I can't [38:10.120 --> 38:16.440] find that anybody has ever come after the SEC we had a company called Kick [38:16.440 --> 38:23.280] Interactive and they essentially dared the SEC to sue them they claimed that [38:23.280 --> 38:32.080] they were trying to stand up for everyone in the token community and they [38:32.080 --> 38:39.400] dared the SEC to sue them and the SEC accommodated them they called they [38:39.400 --> 38:43.960] bragged that they had already paid Piper in the largest one of the largest [38:43.960 --> 38:49.400] two one of the two largest law firms on the planet had already paid them ten [38:49.400 --> 38:57.720] million dollars in attorney fees over this issue and I thought that was insane [38:57.720 --> 39:05.640] excuse me I still think it's insane I think what they're actually doing is [39:05.640 --> 39:11.400] money laundering they're not trying to beat the SEC because I read their [39:11.400 --> 39:18.720] pleadings are pleading with garbage they're using this litigation as a way [39:18.720 --> 39:26.360] to gut the business and pump all that money through a law firm and then [39:26.360 --> 39:34.120] launder it and then they'll just let the litigation go away well after you know [39:34.120 --> 39:40.360] a reference to where they dared the SEC to sue them I put in my presentation no [39:40.360 --> 39:49.680] no no no no do not let the SEC sue you soon first you always want to be the [39:49.680 --> 39:58.480] plaintiff if you sue them first then you ask for a restraining order if they sue [39:58.480 --> 40:04.560] you they issue an a restraining order against you so if you sue them first [40:04.560 --> 40:09.040] then you ask for a restraining order against them to maintain the status quo [40:09.040 --> 40:16.000] now you've stopped them in their tracks now you drag them into court instead [40:16.000 --> 40:20.440] of them dragging you into court but even so these guys are not going to do that [40:20.440 --> 40:27.160] because they have their clients money at stake it'll take someone to come in and [40:27.160 --> 40:33.600] demonstrate how well you can beat them up what you can do to them and there's [40:33.600 --> 40:40.280] nothing to do about it they just the East LA Sheriff's office and [42:15.240 --> 42:22.680] they are running rough shot over their own sheriff's deputies beating them up [42:22.680 --> 42:26.440] and doing all kinds of stuff and now the sheriff's deputies are having to sue [42:26.440 --> 42:32.360] them seven sheriffs are suing this LA Sheriff's County Department and you [42:32.360 --> 42:40.400] can't make this stuff up it is absolutely mind-boggling how everybody has [42:40.400 --> 42:44.240] put all their like I said they're put their trust and faith in these people [42:44.240 --> 42:50.920] that are no better than [46:57.920 --> 47:04.120] a guy was kind of mentoring him a little bit about a month or so ago and he was [47:04.120 --> 47:08.400] telling me he was just getting really harassed big time he's out in Rockwall [47:08.400 --> 47:14.240] County and he was getting harassed pretty hard and he knew of I guess a friend [47:14.240 --> 47:19.120] quasi friend that was an attorney and you know and he was he was wanting to [47:19.120 --> 47:22.880] try to buy the cops and all this stuff and he didn't know how to go about doing [47:22.880 --> 47:28.680] it and he was like what do I do and and he goes man these guys just keep coming [47:28.680 --> 47:32.720] after me and coming after me and that attorney told him he said until you follow [47:32.720 --> 47:40.000] lawsuit they will not take you serious period in the story and I thought wow [47:40.000 --> 47:46.280] that was a really good you know little nugget there considering you know I've [47:46.280 --> 47:49.640] already followed tons and tons of these suits they didn't go nowhere but I [47:49.640 --> 47:56.720] guarantee you all those declaratory judgments got their attention and not [47:56.720 --> 48:01.040] only that it went on the record and it went on the public record for everybody [48:01.040 --> 48:08.240] to read so they couldn't deny it they just had to sit there and take it and [48:08.240 --> 48:20.640] they don't like it and I love it so as we get our tools more streamlined if I'm [48:20.640 --> 48:28.280] gonna do this to the this federal agency I will use this as an opportunity to add [48:28.280 --> 48:39.840] to my tool that I'm developing every time a the the lawyer is a quasi public [48:39.840 --> 48:47.600] official he's acting under authorization or sanctioned by the state and he's [48:47.600 --> 48:53.800] working with other officials who are more than quasi for instance the judge [48:53.800 --> 49:02.920] and the laws are pretty clear about a judge a judge has two primary duties [49:02.920 --> 49:06.920] determine the facts in accordance with the rules of evidence apply the laws [49:06.920 --> 49:13.680] it comes to him to the facts in the case so Scott what if a judge fails to [49:13.680 --> 49:18.680] properly apply the law to the facts or and in the process deny you full free [49:18.680 --> 49:23.720] access to her enjoyment of right we would call that you call that official [49:23.720 --> 49:28.560] oppression obstruction witness tampering oh I could go on but you file [49:28.560 --> 49:33.520] criminally against that guy and then you file criminal charges and send that to [49:33.520 --> 49:39.080] the sdjc and let them deal with it [49:39.080 --> 49:47.080] sdjc well whatever the the judge what's the judge thing here in Texas I forgot [49:47.080 --> 49:52.920] been a while since I filed one on the place you'd file it is the special agent [49:52.920 --> 50:03.040] in charge of the FBI the reason special agent in charge is that the only name [50:03.040 --> 50:08.720] you can actually get is the name of the special agent in charge we now [50:08.720 --> 50:15.520] officially have secret police well the CIA has always been a secret police but [50:15.520 --> 50:20.680] they weren't in the United States yet the CIA were technically forbidden to [50:20.680 --> 50:26.120] operate within the borders they did anyway but they were forbidden to and [50:26.120 --> 50:32.160] they were secret now we have the FBI here who won't identify themselves so if [50:32.160 --> 50:38.760] you go to any FBI office the only name you can find of an agent is the agent [50:38.760 --> 50:45.960] in charge and that works perfectly don't talk to him because all he'll do is [50:45.960 --> 50:51.320] feed you a bunch of song and dance and sells her down your pants send him a [50:51.320 --> 51:02.760] verified criminal affidavit and invoke his duty if you talk to him you give a [51:02.760 --> 51:10.880] voluntary statement a voluntary statement is just generally notice it invokes no [51:10.880 --> 51:15.800] specific duty you're essentially asking him hey I think something went wrong here [51:15.800 --> 51:25.160] will you go check it out however when you send the officer a verified criminal [51:25.160 --> 51:31.080] affidavit that's whole other animals that invokes the officer's duty to give [51:31.080 --> 51:38.280] notice to some magistrate when they fail to do that then you get to go directly [51:38.280 --> 51:49.680] after the agent himself or herself I had a judge in Southside Alabama little [51:49.680 --> 51:58.000] po-dunk Hamlet South of Huntsville and I was in the court and asked to see the [51:58.000 --> 52:03.920] court record of a hearing it just took place and the judge was a young guy he [52:03.920 --> 52:08.680] asked the prosecutor should I show this to him the prosecutor said oh well Mr. [52:08.680 --> 52:14.000] Carlton are you a citizen of the state of Alabama I said well no I'm not well in [52:14.000 --> 52:18.240] that case I don't think you should be able to see him so I said well judge what [52:18.240 --> 52:22.240] do you think well a prosecutor said you shouldn't be able to see him I said well [52:22.240 --> 52:27.160] that's nice the prosecutor say that but he's not the judge he's not the one on [52:27.160 --> 52:33.520] this dime so what do you say well I'm kind of go about what the prosecutor [52:33.520 --> 52:38.760] said oh no this is I got these records here I want to look at these records can [52:38.760 --> 52:43.400] I look at these records well I need to follow what's the prosecution no no no [52:43.400 --> 52:48.520] judge that was a yes or no question are you gonna allow me to look at these [52:48.520 --> 52:54.480] records or not he said well I guess it's a no and I said oh thank you thank you in [52:54.480 --> 53:02.200] the state of Alabama there is no official misconduct statute so if you [53:02.200 --> 53:08.320] look at that at first it looks like you don't have a remedy well as a matter of [53:08.320 --> 53:15.200] fact you do have a remedy a act of official misconduct has the effect of [53:15.200 --> 53:20.880] denying you the due process of the laws and while the state may not have one the [53:20.880 --> 53:27.400] state does so I'm going to charge you this municipal judge in podunk [53:27.400 --> 53:36.920] Alabama with official misconduct under 18 us code 242 with a special agent in [53:36.920 --> 53:46.960] charge of the FBI in Jackson Tennessee oh this is going to be a hoot we get to [53:46.960 --> 53:51.600] see what the special agent does and the special agent is going to say oh well [53:51.600 --> 53:57.400] I'll send that to sunny something I forget his last name the special agent [53:57.400 --> 54:01.720] charge in Birmingham so I don't and I'll tell her I don't care what you did with [54:01.720 --> 54:08.440] it as long as you did not send it to the grand jury if you didn't give it to [54:08.440 --> 54:14.560] grand jury then I don't care what else you did with it I'm going to take you [54:14.560 --> 54:19.920] to the grand jury and I'll file criminal charges against the special agent [54:19.920 --> 54:26.360] charge with the grand jury and you know what's going to happen I'll send it to [54:26.360 --> 54:33.800] the grand jury by way of the prosecuting attorney's office what do you get Scott [54:33.800 --> 54:40.160] what's the odds of that getting past the US attorney well you know he's gonna [54:40.160 --> 54:44.600] wipe it up and throw it away that's where you put that little note in there asking [54:44.600 --> 54:49.200] him to initial stating that he received it and when you don't get that note back [54:49.200 --> 54:55.800] he confirmed that he or actually you send the note to the to the foreman of [54:55.800 --> 55:00.640] the grand jury asking them to initial and have a self-addressed stamped envelope [55:00.640 --> 55:04.760] so that they could the foreman of the grand jury can send it back to you when [55:04.760 --> 55:08.680] you don't get that letter back then you can assume that the prosecutor had [55:08.680 --> 55:13.720] interfered with that with your complaint getting to the grand jury then [55:13.720 --> 55:17.720] you file criminally against the prosecutor yeah now we have to make sure that the [55:17.720 --> 55:24.440] prosecutor does that so the way we do that is it's in this little notice as you [55:24.440 --> 55:31.560] ask the foreman to initial this document don't sign it because the US attorney [55:31.560 --> 55:36.880] has a rubber stamp with your name on it that he uses to rubber stamp super [55:36.880 --> 55:41.760] sheeting indictments so he kind of bypasses you on a super sheeting [55:41.760 --> 55:47.200] indictment super sheeting is indictment is a an indictment that follows an [55:47.200 --> 55:51.760] original indictment they get a little bit of evidence they run in get an [55:51.760 --> 55:55.840] indictment and then they start doing their investigation and as they find [55:55.840 --> 56:01.080] more stuff they just were a stamp the subsequent indictments well the last [56:01.080 --> 56:05.480] thing that US attorney's gonna want is for the foreman to know he has a rubber [56:05.480 --> 56:11.800] stamp so that'll make sure you don't give it to the foreman and when the foreman [56:11.800 --> 56:18.720] don't get it we've insured this thing for 500 bucks we send both inspectors in [56:18.720 --> 56:25.400] first and then we file criminal charges against the US attorney for shielding [56:25.400 --> 56:30.720] criminal complaints against the special agent agent in charge from the grand [56:30.720 --> 56:37.400] jury we send that one in and the US attorney's go to get that one and he's [56:37.400 --> 56:44.240] gonna open it is gonna have his name on it whoops he's gonna say those dirty [56:44.240 --> 56:52.200] rocks countless set us up when we sue when I sue the SEC I hope to do that big [56:52.200 --> 57:00.120] time the US attorney will defend and I will be all over that US attorney [57:00.120 --> 57:07.800] well that was like that I sent the criminal complaint to the Fort Worth [57:07.800 --> 57:12.000] of the Tarrant County grand jury and the Tarrant County foreman wrote me back [57:12.000 --> 57:20.480] said oh we can't prosecute this blah blah blah okay we find no Tarrant County [57:20.480 --> 57:32.640] offenses subject to indictment Scott if you were called to a grand jury and you [57:32.640 --> 57:36.720] got a complaint about something that happened outside the county your grand [57:36.720 --> 57:43.600] jury for would you think of writing that on a letter back to somebody of course [57:43.600 --> 57:51.880] not I would wonder wonder where that foreman got that verbiage you know he [57:51.880 --> 57:56.600] got it from the prosecutor the district attorney told him oh yeah here's how you [57:56.600 --> 58:01.560] get rid of this guy well he certainly did he brushed me off for about a year [58:01.560 --> 58:06.280] until I filed criminally against the foreman of that grand jury and gave that [58:06.280 --> 58:12.520] to the other foreman of the grand jury via the prosecutor funny thing when that [58:12.520 --> 58:16.200] foreman had to open it up and read a criminal complaint on a Tarrant County [58:16.200 --> 58:22.960] foreman grand jury I wonder what he thought these are some of the dirty [58:22.960 --> 58:31.280] rotten tricks we've got in this case if I see the SEC the US attorney will be [58:31.280 --> 58:40.400] opposing counsel as opposing counsel he doesn't have any immunity he's not a [58:40.400 --> 58:46.080] prosecutor he's just a lawyer hang on going to break Randy Helton with law [58:46.080 --> 58:53.000] radio we'll be
