In recent news, since Governor Greg Abbott signed House Bill 1325, [01:08.400 --> 01:13.160] legalizing HEPA to test his law back in June, county prosecutors around the state, including [01:13.160 --> 01:17.480] Houston, Austin, and San Antonio, have been dropping marijuana possession charges and even [01:17.480 --> 01:21.880] refusing to file new ones since they are stipulating that they do not have the time or the [01:21.880 --> 01:26.840] laboratory equipment to test the ear for THC. Margaret Moore, the Travis County District [01:26.840 --> 01:30.840] Attorney, announced earlier this month that she was dismissing 32 felony possession and [01:30.840 --> 01:35.240] delivery of marijuana cases because of the law. Mr. Abbott and other state officials, [01:35.240 --> 01:39.280] including the Attorney General, stipulated in a letter that county district attorneys back [01:39.280 --> 01:44.440] on Thursday that marijuana has not been decriminalized in Texas and that these actions demonstrate [01:44.440 --> 01:50.440] a misunderstanding of how HB 1325 works, as well as other cities, too, like the district [01:50.440 --> 01:56.920] attorney in El Paso, Cayma Esparza, a Democrat who also stated earlier this month that the law, [01:56.920 --> 02:02.560] quote, will not have an effect on the prosecution of marijuana cases in El Paso. However, the [02:02.560 --> 02:07.240] issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender in Harris [02:07.240 --> 02:11.280] County, who stated that, quote, the law is constantly changing on what makes something [02:11.280 --> 02:15.280] illegal based on its chemical makeup. It's important that if someone is charged with [02:15.280 --> 02:22.680] something, the test matches what they're charged with. [02:22.680 --> 02:27.760] A paper by Tulane University identified a five and a half inch American pocket shark as the [02:27.760 --> 02:32.800] first of its kind in the Gulf of Mexico, the specimen being only the second pocket shark [02:32.800 --> 02:38.440] ever captured or recorded with the other one being found way back in 1979 in the East Pacific [02:38.440 --> 02:43.120] Ocean. I accepted [03:25.760 --> 03:35.000] it for fire right away. It's not sooner. Not later. We are originators. And I'm not [03:35.000 --> 03:41.520] sure. Okay, we are back. Randy Kelton, rule of law radio on this Friday, the 27th day [03:41.520 --> 03:53.440] of September, 2019. And with our special guests, Don and Amy Terry. And on the break, we wanted [03:53.440 --> 03:58.480] to go to what they did at the different court dates. [03:58.480 --> 04:07.040] Yes. Well, actually, in every court date that they had, there was never a judge present. [04:07.040 --> 04:13.640] And they were always doing the plea bargaining. And he was, the judge was behind the scene. [04:13.640 --> 04:21.280] And the lawyers were coming to the room making deals. So this lawyer that was so-called appointed [04:21.280 --> 04:28.520] to Don. And really at the point legally, he was dismissed because he was only present [04:28.520 --> 04:33.760] for the psychological evaluation for Don. And the order said that they'd be finished [04:33.760 --> 04:40.960] with this lawyer when the order came back, when the evaluation came back. And it came [04:40.960 --> 04:47.600] back so this guy was no longer Don's lawyer. So he comes to Don and presents himself as [04:47.600 --> 04:58.480] if he is a go-between for the judge and Don. And they offer Don three different pleas. [04:58.480 --> 05:07.160] And the last plea is the plea of best interest. And they told him, if you take the charge [05:07.160 --> 05:11.040] of dispelling me, we'll let you go. [05:11.040 --> 05:18.400] Yeah, basically pled guilty and they'll just let me walk. And I turned it down. I said, [05:18.400 --> 05:22.320] there's no way I'm going to do that. I said it very loud, too. I'm not going to lie because [05:22.320 --> 05:25.960] two police officers lied. [05:25.960 --> 05:27.760] That was their last ditch effort. [05:27.760 --> 05:28.760] That was it. [05:28.760 --> 05:29.760] Yeah. [05:29.760 --> 05:34.960] They had nothing. And then what was the other court date? It was going to talk about Don. [05:34.960 --> 05:35.960] The last one. [05:35.960 --> 05:40.840] That was really it. That was the only one. And the judge comes out, calls a roll and leaves. [05:40.840 --> 05:46.160] And when he called my name, I was about to say something, but something told me to just [05:46.160 --> 05:51.200] shut up. And he just looked right at me and said, he's here. I only met him once. He knew [05:51.200 --> 05:56.680] who I was. [05:56.680 --> 06:03.320] So what was the, okay, at least the judge made an appearance. If the judge hadn't made [06:03.320 --> 06:11.280] an appearance, you know, I went into South Lake and over to help a guy with a ticket [06:11.280 --> 06:16.920] and they had summoned them to be there, 58 people, and they sent them all in to talk [06:16.920 --> 06:19.800] to a lawyer. [06:19.800 --> 06:24.760] And so when the guy I was helping was called, I started to go in with him. And the guy said, [06:24.760 --> 06:25.760] you can't go in there. [06:25.760 --> 06:30.960] I said, sure, again, I'm his buddy here. I'm his witness. It is paralegal. He said, oh, [06:30.960 --> 06:36.440] no, no, you can't go in there. I said, well, is the judge in there? He said, well, no, [06:36.440 --> 06:44.080] the prosecutor's in there. Well, is the judge in the building? He said, well, no, just a [06:44.080 --> 06:45.080] prosecutor. [06:45.080 --> 06:48.640] Well, in that case, you need to go in there and arrest the prosecutor for impersonating [06:48.640 --> 06:50.840] a judicial officer. [06:50.840 --> 06:59.440] He said, I need to call my sergeant. I said, you're smarter than you look. But they knew [06:59.440 --> 07:03.000] who I was already. [07:03.000 --> 07:10.920] After that hearing, I went to the JP and filed 58 felony charges of impersonating a judicial [07:10.920 --> 07:17.480] officer against this brand new lawyer. She just got out of law school. [07:17.480 --> 07:29.120] Oh, that was so much fun. But since the judge actually showed up, you don't have that particular [07:29.120 --> 07:39.880] charge. I'm hoping the point I'm making is you got so everything they do, you have the [07:39.880 --> 07:46.240] same authority they do. Now they've got to do everything right. You can hammer them for [07:46.240 --> 07:48.240] every step. [07:48.240 --> 07:58.120] And when you didn't take that deal and you didn't take that deal loudly, no doubt they [07:58.120 --> 08:04.680] went to that lawyer and told him to do something so we can dismiss this case. [08:04.680 --> 08:10.680] So this guy's not going to take a deal and we're running out of time. And it's longer [08:10.680 --> 08:14.120] re-holding the worst he's going to get for us. [08:14.120 --> 08:22.640] They came after him and they pulled this kind of crap on him for two and a half years. He [08:22.640 --> 08:29.720] wasn't in jail on this time, but when they got to the courthouse steps, the lawyers made [08:29.720 --> 08:33.640] him an offer and he told them to go scratch. [08:33.640 --> 08:43.440] They walked into the courtroom, told the judge, we moved to dismiss the case. No arguments, [08:43.440 --> 08:48.120] no reason, they just moved to dismiss and walked out. [08:48.120 --> 08:54.080] They will hammer you until you get right to the courthouse door and then if you stand [08:54.080 --> 09:04.640] up to them, they knuckle under and most people don't realize how hard this is. [09:04.640 --> 09:12.200] When they prosecuted me after 27 days in solitary confinement, you know, I consider that for [09:12.200 --> 09:19.280] me was a great opportunity. They sentenced me to a year in jail, $10,000 fine and after [09:19.280 --> 09:23.960] 27 days in solitary, they wouldn't let me out in the population. They did not want me [09:23.960 --> 09:26.160] talking to them. [09:26.160 --> 09:31.280] I looked in that little stainless steel mirror they had there and I said to myself, self, [09:31.280 --> 09:36.640] you told the jury that at the end of the day, they could do whatever. It wouldn't make [09:36.640 --> 09:44.880] any difference. I was here to protect the rights my twin brother gave his life for. [09:44.880 --> 09:51.040] It makes no difference what you do when you get done. I'm still going to be here. [09:51.040 --> 09:56.200] I looked in the mirror and I said, you told the jury to do their worst and they threw [09:56.200 --> 10:01.080] the book at you. So, did you mean it? [10:01.080 --> 10:11.040] I thought a while and darn right I meant it. I think that's what that hearing was for so [10:11.040 --> 10:20.720] I could get to prove myself to myself and that was of great value. Don has certainly [10:20.720 --> 10:27.840] proved himself. You're going to go on that list, Don. Do not detain. [10:27.840 --> 10:32.160] I have some. [10:32.160 --> 10:38.480] You'll be like, what happened to me? A sheriff's deputy come to me and said, would you do the [10:38.480 --> 10:43.840] sheriff? I said, I hadn't done anything to him lately. Why? Well, we had roll call this [10:43.840 --> 10:48.160] morning and the sheriff asked who here knew Randy Kelton. About half of us raised her [10:48.160 --> 10:57.040] hand. He said, look, you are not to stop him. You are not to cite him and whatever you [10:57.040 --> 11:06.120] do, don't put that SOB in my jail. What? I feel disparaged. [11:06.120 --> 11:08.800] What did I do? [11:08.800 --> 11:12.920] We need a convenience store and Bobby Jack Crews been listening to his scanner. What [11:12.920 --> 11:17.040] did you do that sheriff's deputy this morning? I didn't do anything to him. He stopped me [11:17.040 --> 11:25.080] for 17 to 60 and no plates on my goose neck trailer. He gave me a warning ticket and told [11:25.080 --> 11:31.320] me to slow down. He said, well, he called you in and the dispatcher said, you got Randy [11:31.320 --> 11:38.280] Kelton. He said, well, yeah, dude, don't you dare give him no tickets. [11:38.280 --> 11:46.200] You're going to be on that list. There just aren't enough people who are able to withstand [11:46.200 --> 11:52.000] him this long. And the only reason I can do it is because God is in my life. It was God [11:52.000 --> 12:01.480] that gave me the strength. Well, he definitely gave it to you because you had it. Most people [12:01.480 --> 12:10.080] out there can't really appreciate how hard this is. I was on the job for a month. That [12:10.080 --> 12:11.080] was nothing. [12:11.080 --> 12:20.440] Well, think about it. They kept him for 10 months. I had no income whatsoever and they [12:20.440 --> 12:29.600] held him so he couldn't work. And they put him in the ice section. He wasn't allowed. [12:29.600 --> 12:38.720] They could only see people on a monitor. They, oh, get this. We sent him. We had to serve [12:38.720 --> 12:45.640] him. We put him to the appellate court. We had to serve him with the same thing we served [12:45.640 --> 12:52.360] everybody else with, certificate of service. They wrote on an envelope when I sent it to [12:52.360 --> 12:58.720] them, not allowed legal papers. The sheriff wrote that. [12:58.720 --> 13:01.760] All of this will come back to haunt them. [13:01.760 --> 13:10.320] Yes, it will. And what I was telling you before that wasn't really made clear is that lawyer [13:10.320 --> 13:18.160] that really was speaking for the judge, when Don went to that little municipal court that [13:18.160 --> 13:25.800] originally wrote the ticket that caused him all this trouble, that lawyer showed up at [13:25.800 --> 13:26.800] that little dinky. [13:26.800 --> 13:27.800] There he was. [13:27.800 --> 13:33.040] He could have knocked me over. I knew something was up when I saw him at that municipal court. [13:33.040 --> 13:34.040] Something was up. [13:34.040 --> 13:35.040] Yes. [13:35.040 --> 13:42.840] He was advising Don to plead guilty and he would get off and everything he'd forgotten [13:42.840 --> 13:47.240] with the 14, with the 10 months that he was in jail. [13:47.240 --> 13:51.800] David's control. That's exactly what it was. [13:51.800 --> 13:56.400] You need to bar grieve that lawyer. [13:56.400 --> 13:59.920] And here's something funny. I go up to him and I said, I didn't realize that's what [13:59.920 --> 14:03.120] he said. I go up to him and I said, well, why don't you let me talk to Don? Maybe I [14:03.120 --> 14:05.560] can take him. Maybe he'll plead. [14:05.560 --> 14:10.840] So I'm bringing Don out thinking, well, plead not guilty and pay the fine and then we'll [14:10.840 --> 14:12.440] take care of it. [14:12.440 --> 14:17.480] And that guy comes up and he goes, no, he's got to plead guilty. And I said, no way, no, [14:17.480 --> 14:18.480] he's pleading guilty. [14:18.480 --> 14:25.440] And Don said, I'm not lying. And he throws up his hands and walks away. Then he goes [14:25.440 --> 14:30.680] to the judge. He hands him a paper and he said, here, you decide what to do. So he gave [14:30.680 --> 14:34.720] him two choices, how to treat Don when he came up in front of him. [14:34.720 --> 14:37.760] Okay. You want to see that paper? [14:37.760 --> 14:40.200] Yeah, I really do. [14:40.200 --> 14:49.080] Oh, yeah. Because that lawyer was not there representing you. Oh, no. So you want to know [14:49.080 --> 14:52.960] what was going on between the judge and this lawyer? [14:52.960 --> 14:53.960] Yeah. [14:53.960 --> 14:59.800] Yeah. I think they were telling the city, this guy's about to drop the sky on all of [14:59.800 --> 15:08.760] us. So you can expect the city to try to pull some shenanigans. So when I go down to put, [15:08.760 --> 15:19.920] I've already asked the clerk to talk to the prosecutor and the judge to get me a 10 minute [15:19.920 --> 15:26.200] YouTube interview with him. Because we're going to talk about him on the air. And if [15:26.200 --> 15:33.720] we are likely to say something disparaging, we owe it to them to give them opportunity [15:33.720 --> 15:45.360] to rebut. So that always makes them crazy. So when I go back down there, I'm sure they're [15:45.360 --> 15:52.600] going to decline my interview and I'll do some song and dance and seltzer down your [15:52.600 --> 15:53.600] pants. [15:53.600 --> 16:01.200] Well, Don gave them a popper's form and told them he had no money because he'd been in [16:01.200 --> 16:12.000] jail for 10 months because of the traffic. Their policeman wrote to Don and I'm Don [16:12.000 --> 16:17.280] and the judge says, well, I don't know anything about that. And I don't know anything about [16:17.280 --> 16:30.000] the popper's form. So no. And they gave them a $1,000 cash fund and held them in prison [16:30.000 --> 16:33.000] for three more days. [16:33.000 --> 16:47.840] Tries event, $1,600 bucks a minute. We'll see how that works out for them. It's the right [19:55.000 --> 20:00.880] last name. The first name is Gerald and it's a self of my son who I've been calling in [20:00.880 --> 20:08.360] Joshua. So you're at the right pew. Okay, I knew it was wrong and I couldn't pull out [20:08.360 --> 20:21.280] the other name. Okay. Did you have something on point? No, I'm not pushing you to. Just [20:21.280 --> 20:27.840] if you did, it'd be nice. But what do you have for us? Well, I have several issues. [20:27.840 --> 20:37.840] The most current one is that I had filed a complaint with the American Arbitration Association [20:37.840 --> 20:45.280] based on an arbitration clause and a general contracting contract. And we were four months [20:45.280 --> 20:59.160] into it. And excuse me, the other party at the last minute hired an attorney. And three [20:59.160 --> 21:11.400] days before the final hearing, he filed for a preliminary injunction in joining the AAA [21:11.400 --> 21:22.400] claiming that the homeowner's Consumer Protection Act is a governing authority which they are. [21:22.400 --> 21:28.800] This was a commercial property, commercial retail. That being said, I went to the hearing. [21:28.800 --> 21:35.600] It was in the court of commonplace here in Pennsylvania. And I went there to appear on [21:35.600 --> 21:44.880] behalf of the corporation and also a sole proprietorship was involved. [21:44.880 --> 21:52.600] Can you do that, not being a lawyer? Or are you a lawyer? That was the first thing he [21:52.600 --> 22:02.400] said to me. Corporations... Well, that's another interesting point. In Pennsylvania, [22:02.400 --> 22:13.800] they allow anyone authorized by a corporation to represent them at the magisterial court [22:13.800 --> 22:23.960] level. But for some reason, and this is befuddling me, they will not allow you to represent a [22:23.960 --> 22:27.920] corporation at any higher court. [22:27.920 --> 22:38.160] Okay. This is similar in most states. But in most states, it's only an eviction, a petition [22:38.160 --> 22:45.840] for possession where they will allow a non-lawyer to stand in. And this is so you've got a manager [22:45.840 --> 22:52.080] of an apartment complex and they've got somebody that hasn't paid their rent. They don't have [22:52.080 --> 22:57.680] to hire a lawyer to come in and get an eviction order for the rent pair. They can get the [22:57.680 --> 23:07.600] manager to do that. It costs the apartment complex so much money to pay the lawyer that [23:07.600 --> 23:14.960] they would have to increase the rents to cover this. And so they allow this one exception. [23:14.960 --> 23:26.000] Well, I understand that. And I researched the law and it's relative to allowing... They [23:26.000 --> 23:33.720] have an actual authorization form to be signed at the magisterial level. And you can go in [23:33.720 --> 23:42.400] and represent the company for any matter, not just eviction, but for any matter whatsoever. [23:42.400 --> 23:48.520] So that's the part that befuddles me, that in the one court level in Pennsylvania, they'll [23:48.520 --> 24:00.160] allow an individual to represent a corporation. But then at another level, they won't. But [24:00.160 --> 24:05.440] moving on, I went to the hearing and those were the first words out of the judge's mouth, [24:05.440 --> 24:14.640] are you an attorney? And I said no. And I asked him if I can approach and he said, no, [24:14.640 --> 24:26.840] stand back. And I started to hand him, I had a motion to dismiss based on the facts of [24:26.840 --> 24:36.720] the law, which were that the arbitration clause and the arbitrator has jurisdiction over this [24:36.720 --> 24:46.280] dispute. And I couldn't get two words out of my mouth when he told me to shut up. And [24:46.280 --> 24:56.640] after that, I kept trying to talk and he told me not very nicely to sit down and shut [24:56.640 --> 25:11.760] up. Then he just went on to proceed, with the proceedings, as if I wasn't even there. [25:11.760 --> 25:19.480] And that's when I stood up and I just told him, I'm not getting a fair hearing here. [25:19.480 --> 25:28.040] And there's no way I'm going to participate in this, you know, my right of due process [25:28.040 --> 25:38.680] of being violated. And he very arrogantly said goodbye. So I have another hearing coming [25:38.680 --> 25:46.920] up. He issued the preliminary injunction. And the hearing at the American Arbitration [25:46.920 --> 25:55.760] Association was canceled. And the hearing on the whole matter of jurisdiction is going [25:55.760 --> 26:02.600] to be on October 10. And I've just been... Okay, okay, hold on, hold on. The hearing [26:02.600 --> 26:08.280] on the matter of jurisdiction, has someone filed a challenge subject matter jurisdiction? [26:08.280 --> 26:20.840] No, these are the... No, sir. Those are the things I'm wrestling with right now. My whole [26:20.840 --> 26:28.920] thought process was to get this thing bumped back to the AAA. And I felt that the motion [26:28.920 --> 26:33.400] to dismiss based on the fact of the law that I had put together was sufficient. [26:33.400 --> 26:39.080] Okay, did the... Did you file this document with the court? [26:39.080 --> 26:45.920] Yes, I did. I got a stamp from the court. Okay, hold on, hold on. Did this document [26:45.920 --> 26:52.440] state that the arbitrator had jurisdiction and not this court? [26:52.440 --> 26:57.240] Yes, it did. Filed criminally against the judge? [26:57.240 --> 27:07.320] Well... For impersonating a judicial officer, you had a document that challenges the jurisdiction [27:07.320 --> 27:15.240] does not have to be titled a challenge to jurisdiction. A document is what it is without [27:15.240 --> 27:23.120] regard to how it's titled. If that document challenged the jurisdiction, that was a threshold [27:23.120 --> 27:31.200] issue, the judge had to hear that issue first. Did he address jurisdiction? [27:31.200 --> 27:41.400] Well, again, the document was filed with the propventary and... I don't even know if it... [27:41.400 --> 27:46.440] Okay, for those of you not in Pennsylvania, in Pennsylvania, what would be equal to an [27:46.440 --> 27:53.560] account to a county court, a county clerk in Pennsylvania is called a propventary. And I tried to explain this to the [35:57.920 --> 36:07.000] judge. And again, unceremoniously, he, you know, again told me to shut up and sit down. [36:07.000 --> 36:14.080] He would not accept my explanation. I gave the form to the opposing attorney and the [36:14.080 --> 36:18.640] judge says, the judge asked him, what did it say? Well, he said, this is a form that [36:18.640 --> 36:23.000] they used in the lower courts. He didn't tell them that the one was a sole proprietorship. [36:23.000 --> 36:30.440] He just said, these are the forms that are used in the lower courts for authorization. [36:30.440 --> 36:45.960] So my concern is, though, that again, what battle do I take on if I'm faced with battling [36:45.960 --> 36:59.320] standing as well as the... How critical will the rulings be to your ability to function [36:59.320 --> 37:08.120] in your business? The business, unfortunately, due to this particular account, put us under. [37:08.120 --> 37:16.880] And my son had to find other employment and at 77, not too many doors being knocked down [37:16.880 --> 37:23.760] from me. And there was about eight or ten minor violations that they pointed [38:38.080 --> 38:51.960] out. And that were allegedly violated the HICPA Act. [38:51.960 --> 38:56.880] Okay, wait a minute. What did that have to do with the issue between you and the other [38:56.880 --> 39:06.920] party? Well, nothing. There is a... There are only three types [39:06.920 --> 39:17.400] of consumer residents that come under that statute in Pennsylvania. And they're all either [39:17.400 --> 39:23.640] a single family, two family, or a condominium, period. Commercial properties, according to [39:23.640 --> 39:30.440] the Attorney General, do not come under that act. And that was my argument and my motion [39:30.440 --> 39:35.680] to dismiss. Yeah, that's a straight-up subject matter [39:35.680 --> 39:41.720] of your sticking challenge. I would suggest you get a lawyer to bring that to the court. [39:41.720 --> 39:47.800] Okay, that's kind of like where my head was right now. And we've been trying to search [39:47.800 --> 39:55.320] for a lawyer and every time I make a call, I end up talking to the club. So we're going [39:55.320 --> 40:00.640] to follow that. I'll follow that trail then that it was our take-all, so my son and I [40:00.640 --> 40:08.480] will proceed down that road. I appreciate that. Now, I have a second issue, and this [40:08.480 --> 40:13.920] is not the one we had called in prior. This had to do with my son and the transportation [40:13.920 --> 40:33.080] stuff. And this thing, we tried to file a criminal complaint against the judge. And I took the [40:33.080 --> 40:41.480] criminal complaint up to the district attorney in the local county courthouse, and he refused [40:41.480 --> 40:49.640] to accept it. There was an ADA there and a detective. And they said they don't take [40:49.640 --> 40:56.280] private criminal complaints. Well, that's not what the statute says. Then they pointed [40:56.280 --> 41:04.080] me to a sign on a desk. Now, they had taken a complaint from me like three or four months [41:04.080 --> 41:09.240] ago. But now there's a sign on the desk that says we do not take any private criminal complaints. [41:09.240 --> 41:16.400] So I looked close and my eyes weren't that good to read it. And by the time I read it, [41:16.400 --> 41:20.760] it did say just that. We don't take any private criminal complaints. When I turned around, [41:20.760 --> 41:27.760] their names, those two guys took off. I couldn't find them in the courthouse. So we said, the [41:27.760 --> 41:31.880] heck with this, then, we'll go to the attorney general. [41:31.880 --> 41:38.320] And did you file criminal charges against the district attorney with the attorney general? [41:38.320 --> 41:46.920] I tried to. And here's what happened there. I made the call. I got his executive assistant. [41:46.920 --> 41:53.480] And I told her, wanted to know where in the building, because my son was near Harrisburg, [41:53.480 --> 42:02.200] should he go to file this private criminal complaint? And she tells me the same mantra. [42:02.200 --> 42:10.480] We don't take private criminal complaints. Now, I got her name. But I said, well, let [42:10.480 --> 42:17.960] me talk to one of the criminal divisions attorneys. And she refused to give me somebody to talk [42:17.960 --> 42:18.960] to. [42:18.960 --> 42:30.320] Okay, hold on. Hold on. Bad strategy. Never call these guys. Everything's in writing. [42:30.320 --> 42:37.640] Take up a criminal accusation against the prosecuting attorney for misfeasance in office [42:37.640 --> 42:45.720] and failing to perform a duties required to perform. Take it to a notary and have it authenticated. [42:45.720 --> 42:56.560] Put it in an envelope, send it registered to the certified mail to the attorney general. [42:56.560 --> 43:03.800] You don't care what they say. When the attorney general doesn't respond, then you come back [43:03.800 --> 43:11.120] to the court of common please and file criminal charges against the attorney general in the [43:11.120 --> 43:16.760] court of common please. You've filled out a verified criminal affidavit, send it registered [43:16.760 --> 43:22.160] to the court of common please. When the court of common please refuses to act on it, then [43:22.160 --> 43:34.280] you file with the next higher court. In Pennsylvania, unlike other states, you have standing. In [43:34.280 --> 43:41.520] every other state, if I can go give notice of, I'm saying every other state, all of the [43:41.520 --> 43:48.800] western states, all of the Spanish law states, the commonwealths are somewhat different. And [43:48.800 --> 43:54.960] I haven't worked with a number of the commonwealths, so I don't know how all of them work. You are [47:10.920 --> 47:19.440] the sovereign. He is the servant. The certified male, verified affidavit, that invokes his [47:19.440 --> 47:25.640] duty. When he fails to act on it, certified male, verified affidavit, to the attorney [47:25.640 --> 47:33.200] general, charging the prosecuting attorney with Ms. Feeson's in office, failing to perform [47:33.200 --> 47:43.720] a duty he is required to perform. If the prosecuting attorney does respond and exercises his discretion, [47:43.720 --> 47:49.840] then you allege to the attorney general that he did not exercise discretion in that he [47:49.840 --> 47:55.560] did not make a determination as to whether or not there was sufficient cause to believe [47:55.560 --> 48:00.800] that a crime had been committed and the accused had committed that crime, but rather he exercised [48:00.800 --> 48:09.960] prosecutorial caprice. And while a prosecutor in Pennsylvania does have discretion, first [48:09.960 --> 48:18.400] plus discretion, he does not have caprice. So you charge him with shielding from prosecution [48:18.400 --> 48:25.960] or obstruction with the attorney general and then you appeal his decision not to prosecute [48:25.960 --> 48:34.840] to the court of common place. And when the court of common place sides with the prosecutor, [48:34.840 --> 48:43.040] unlike every other state you have standing, this comes from the British and Australian [48:43.040 --> 48:49.200] law. When I was doing seminars in Australia, you could file what they call the criminal [48:49.200 --> 48:58.800] appearance notice, a can, as a common law public official. So you filed a summons and [48:58.800 --> 49:06.480] you had standing, you could, you had authority to move that all the way up through the courts [49:06.480 --> 49:14.560] just like Pennsylvania. So while you won't win this or you're not likely to, what you [49:14.560 --> 49:21.680] will do is embarrass these guys before every court all the way up to the Supreme. [49:21.680 --> 49:22.680] Gotcha. [49:22.680 --> 49:28.960] And then when you go back to the next fight, they're not going to want to fight with you. [49:28.960 --> 49:36.240] Once you have filed against the court of common place judge and next time you get in front [49:36.240 --> 49:45.760] of him, he's not going to be quite so sassy. What one of my favorite things to do is get [49:45.760 --> 49:56.640] a judge's attention. Yeah, it's like that. Like to me, you can't get to work. You don't [49:56.640 --> 50:00.680] want to abuse him. And when you hit him upside the head with that two before that's not [50:00.680 --> 50:07.840] abusing him, you just get his attention. Okay. And look at judicial conduct complaints, barb [50:07.840 --> 50:11.520] grievances. These are the most powerful tools you have. [50:11.520 --> 50:24.640] I hear you. We were having down on the road, the attorney general fiasco of filing a due [50:24.640 --> 50:34.440] process constitutional violation of constitutional rights with the FBI, local FBI. But it sounds [50:34.440 --> 50:48.320] like the stages that you guys just outlined have thought and process behind it in that [50:48.320 --> 50:54.920] way. These appear to be now the stages to go before we get the FBI involved. [50:54.920 --> 51:01.920] Exactly. Yeah. I'm glad you didn't go to them yet. Everything here is a setup. You [51:01.920 --> 51:08.120] always expect them to rule against you. I mean, I've got this rule. Never ask a public [51:08.120 --> 51:14.800] official to do anything you actually want him to do. Because you never ask a public [51:14.800 --> 51:20.160] official to do anything that the law does not compel him to do. [51:20.160 --> 51:25.440] So when he doesn't do it, you get to hammer him. So you go to the prosecutor and ask [51:25.440 --> 51:29.720] him to prosecute, but you really don't want him to. You want him to screw it up so you [51:29.720 --> 51:35.560] can hammer him with somebody else. What you do is you get everybody all the way up the [51:35.560 --> 51:46.120] line upset at everybody below them for getting you on to them. And you get every state actor [51:46.120 --> 51:53.720] to act him properly, at least from your perspective, all the way up to the Supreme. When the Supreme [51:53.720 --> 51:58.920] refuses to act, then you take the Supreme and everybody else to the feds. [51:58.920 --> 52:06.800] Okay. You make these accusations. The feds aren't really going to do anything, but what [52:06.800 --> 52:10.440] they are going to, you know, they're not going to take any real action, but they are [52:10.440 --> 52:15.920] going to call down there and say, Hey, guys, I got this guy down here wanting me to arrest [52:15.920 --> 52:20.160] all you guys. You want to tell me why I shouldn't do that? [52:20.160 --> 52:28.880] They really arrested and got rid of one attorney general two years ago on the state FBI did. [52:28.880 --> 52:36.800] So I guess it was my nickname that phone call. Yes, I remember that. And every official in [52:36.800 --> 52:46.680] the state is going to remember that as well. It goes to Pucker Factor. Well, it'll make [52:46.680 --> 52:52.520] it, if there's a chance of you getting a ruling in your favor, this will give them a reason [52:52.520 --> 52:59.400] not to want to get another fight with you. If this should be an arbitration, this will [52:59.400 --> 53:06.000] give them a reason to send it back to arbitration. It just doesn't work the way they taught [53:06.000 --> 53:10.080] us in high school. That's for sure. [53:10.080 --> 53:15.560] Yeah. You will never win your case simply because you have the law and the facts on [53:15.560 --> 53:23.240] your side. It's all politics, but that's not a problem. It's only a problem if you don't [53:23.240 --> 53:30.360] understand that it's all politics. Once you understand it, then you look for who is the [53:30.360 --> 53:39.200] guy with the most clout that I can really get PO and everybody below him. [53:39.200 --> 53:48.680] I love to hammer district judges. I had a guy, I live next to City Hall in Texas, and [53:48.680 --> 53:53.240] I was out working on a plastic tank. I was doing some plastic welding on it, and we had [53:53.240 --> 53:59.720] a fire ban on. I was using a propane torch with a little deflector. And this new police [53:59.720 --> 54:05.240] officer I had never seen before. They just hired him. I hear, sir, sir, and I turn around [54:05.240 --> 54:11.040] and said, yes, and I don't recognize this cop, so I know he's new. You can't have that [54:11.040 --> 54:15.840] open flame. And I held up this little propane torch and said, sure, I can't look. Nothing [54:15.840 --> 54:20.720] to it. Oh, no, you don't understand. We have a fire ban on. I told him, see all this equipment [54:20.720 --> 54:25.360] here is high pressure equipment. I can outrun the fire department. I understand, sir, but [54:25.360 --> 54:32.800] you can't have that open flame. Wait a minute. You're just joshing me, right? Oh, no, sir, [54:32.800 --> 54:39.920] no, sir. Wait a minute. That John Faustel sent you down here, didn't he? That's a local [54:39.920 --> 54:47.760] district judge. He sent you down here to harass me just because I filed one crummy little [54:47.760 --> 54:53.280] making a terroristic threat against him with a state attorney general. He sent you down [54:53.280 --> 54:59.280] here to screw with me, didn't he? The cop held up both hands with his palms out, took [54:59.280 --> 55:06.280] a step back. One moment, sir, took out his cell phone. He dialed about 30 seconds. The [55:06.280 --> 55:12.880] chief of police stepped out of the city hall, looked across at me and said, Randy, what [55:12.880 --> 55:20.520] are you doing to my new officer? I said, Oh, Tom, I was just jerking his chain. And the [55:20.520 --> 55:32.400] officer said, Oh, God, I saw my whole career pass before my eyes. He was concerned that [55:32.400 --> 55:39.560] I would make a claim against the district attorney, a district judge accusing him of [55:39.560 --> 55:47.160] sending this guy out to harass me and a district judge had nothing to do with it. He was terrified [55:47.160 --> 55:55.080] that the district judge would be go ballistic. And he would have. It's politics, guys. It's [55:55.080 --> 56:05.040] all politics. I hear you. And again, you guys put clarity on from where we stand. And believe [56:05.040 --> 56:12.720] me, we appreciate you very much. And all I can say is thank you. You are welcome. No law firm in their right mind [57:03.320 --> 57:09.760] to pick him up if he's got more than three bar grievances. Valid in valid. Nobody cares. [57:09.760 --> 57:17.200] You just have caught the complaints against the judge. It hikes them political liability. [57:17.200 --> 57:23.000] So when they go to get reelected and these guys with money, look at his records and you [57:23.000 --> 57:29.760] got all these complaints against you. And he said, Oh, those weren't valid. And they're [57:29.760 --> 57:38.480] going to say, Well, maybe, but perception is everything. It looks bad. [01:14:03.640 --> 01:14:04.640] No, he can't record it. [01:14:04.640 --> 01:14:05.640] And they went on it for two hours. [01:49:05.120 --> 01:49:09.760] My favorite one was a woman in Fort Worth, she filed a direction really good, they brought [01:49:09.760 --> 01:49:15.640] in all this stuff and showed them to her, and she looked at them and said, Your Honor, [01:49:15.640 --> 01:49:18.160] I've never seen these before. [01:49:18.160 --> 01:49:22.800] They were the closing documents, and the judge said, You've never seen these before? [01:49:22.800 --> 01:49:23.800] No, Your Honor. [01:49:23.800 --> 01:49:25.400] Did you didn't sign that? [01:49:25.400 --> 01:49:29.080] No, Your Honor, I did not sign these documents. [01:49:29.080 --> 01:49:30.080] That's not your signature? [01:49:30.080 --> 01:49:36.360] I don't know whose signature that is, but I did not sign these documents, and the judge [01:49:36.360 --> 01:49:45.720] knew exactly where she was going, these were copies. [01:49:45.720 --> 01:49:51.040] She never seen these documents before, and she said the judge ground owner for about [01:49:51.040 --> 01:49:56.720] 10 minutes, and she wouldn't back up, and this is exactly what we told her to do, and [01:49:56.720 --> 01:50:01.960] said, Finally, the judge sat back and grinned real big and looked over at the lawyers and [01:50:01.960 --> 01:50:10.000] said, Well, counselor, it seems she has never seen these documents before. [01:50:10.000 --> 01:50:17.160] You're going to have to bring in the originals, set it for 60 days out. [01:50:17.160 --> 01:50:22.400] They come back, the lawyers didn't show up. [01:50:22.400 --> 01:50:25.320] They wrote the whole get off. [01:50:25.320 --> 01:50:31.280] That's exactly what's going on right here, right now, exactly. [01:50:31.280 --> 01:50:34.160] They're bringing copies. [01:50:34.160 --> 01:50:36.720] You don't know anything about these. [01:50:36.720 --> 01:50:37.720] They're committing perjury. [01:51:54.040 --> 01:52:00.040] You put that in an envelope and send it to the special agent charge of the FBI. [01:52:00.040 --> 01:52:06.680] He's going to get it and look at it and say, yeah, I'm not going to go after these guys, [01:52:06.680 --> 01:52:10.480] but I've got to do cover your behind. [01:52:10.480 --> 01:52:14.320] So he gives this to an agent and he says, hey, call these guys, find out what's going [01:52:14.320 --> 01:52:15.320] on. [01:52:15.320 --> 01:52:24.280] And then all of a sudden the lawyers getting the call from the FBI goes to Pucker Factor. [01:52:24.280 --> 01:52:27.480] Now we got to be careful. [01:52:27.480 --> 01:52:29.560] Now we got the feds looking over our shoulder. [01:52:29.560 --> 01:52:32.640] Well, the feds are not really looking over their shoulder. [01:52:32.640 --> 01:52:34.320] They don't want to mess with it. [01:52:34.320 --> 01:52:38.640] They just want to be able to say they looked into it. [01:52:38.640 --> 01:52:43.680] But when they look into it, these lawyers are going to Pucker. [01:52:43.680 --> 01:52:49.200] They may get them to stop being quite so blatant in their criminal activity. [01:53:18.680 --> 01:53:24.920] What if one of these prosecutors is a lawyer I screwed around once, screwed over sometime [01:53:24.920 --> 01:53:34.440] in the past, and he sees he gets a shot at me, presents me to the grand jury. [01:53:34.440 --> 01:53:39.640] Grand jury is always a crap shirt. [01:53:39.640 --> 01:53:43.680] Criminal charges against them is always a crap shirt for them. [01:55:23.360 --> 01:55:28.600] But remember one thing, I found all my motions before they filed a proof of claim and I raised [01:55:28.600 --> 01:55:32.720] that, that they were trying to let this stay and they never filed a proof of claim. [01:55:32.720 --> 01:55:36.280] Now they filed a proof of claim on the very last day. [01:55:36.280 --> 01:55:37.280] Okay. [01:55:37.280 --> 01:55:43.200] They can do that if it's the last day they actually had to file and that's a standard [01:55:43.200 --> 01:55:46.200] practice on their course. [01:55:46.200 --> 01:55:48.520] You should do the same thing to them. [01:55:48.520 --> 01:55:52.440] But it's legal as long as you're within the time limit.
