[01:24.920 --> 01:28.600] Margaret Moore, the Travis County District Attorney, announced earlier this month that [01:28.600 --> 01:33.200] she was dismissing 32 felony possession and delivery of marijuana cases because of the [01:33.200 --> 01:34.200] law. [01:34.200 --> 01:37.760] Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter [01:37.760 --> 01:42.280] to county district attorneys back on Thursday that marijuana has not been decriminalized [01:42.280 --> 01:48.440] in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, as [01:48.440 --> 01:54.680] well as other cities, too, like the District Attorney in El Paso, Caima Esparza, a Democrat [01:54.680 --> 01:59.160] who also stated earlier this month that the law, quote, will not have an effect on the [01:59.160 --> 02:01.920] prosecution of marijuana cases in El Paso. [02:01.920 --> 02:06.960] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender [02:06.960 --> 02:10.920] in Harris County, who stated that, quote, the law is constantly changing on what makes [02:10.920 --> 02:13.640] something illegal based on its chemical makeup. [02:13.640 --> 02:17.560] It's important that if someone is charged with something, the test matches what they're [02:17.560 --> 02:22.760] charged with. [02:22.760 --> 02:27.400] A paper by Tulane University identified a five-and-a-half-inch American pocket shark [02:27.400 --> 02:32.520] as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket [02:32.520 --> 02:38.160] shark ever captured or recorded with the other one being found way back in 1979 in the East [02:38.160 --> 02:39.660] Pacific Ocean. [04:11.000 --> 04:18.760] The funny thing is that when we send these contracts and questionnaires and notices [04:18.760 --> 04:27.440] of fault, the notices of default, the notices of arbitration, they all go to the QWR address [04:27.440 --> 04:29.400] and they don't know what to do with them. [04:29.400 --> 04:36.240] So, the first time that the attorneys hear about it is when they get the award, when [04:36.240 --> 04:46.280] they get a copy of the award to you, you know, the people at the arbitration company send [04:46.280 --> 04:50.000] them the award and they say, oh, we better send this to our attorney and the attorney [04:50.000 --> 04:55.760] says, what's this, where does this come from, how does this happen, you know, and it's too [04:55.760 --> 05:02.080] late to do anything then, it's too late. [05:02.080 --> 05:09.520] You can be fairly certain they will start putting procedures in place, it'll still take [05:09.520 --> 05:18.760] time, yes it will, and bigger the company, the slower it moves, the more people it has, [05:18.760 --> 05:26.440] even if they come down with memos and directives, the guy sitting here, getting these documents, [05:26.440 --> 05:32.280] stamping them, sending them, he does the same thing all day, every day, they'll continue [05:32.280 --> 05:38.480] to miss it until the company does something major, it's really hard to move a big company [05:38.480 --> 05:39.480] like that. [05:39.480 --> 05:49.480] This may wind up being a very effective tool for guys who are being screwed around by the [05:49.480 --> 05:50.480] courts. [05:50.480 --> 06:01.200] It's to kind of get a trick the lawyers play on us, they've been doing it for years, yeah, [06:01.200 --> 06:07.320] they try to do things that we don't know how to handle, so what you're doing is the same [06:07.320 --> 06:09.680] thing to them. [06:09.680 --> 06:15.240] Yeah, because when we went in for credit card collections and stuff like that, they always [06:15.240 --> 06:21.000] take you to arbitration and you never win. [06:21.000 --> 06:28.960] So arbitration is not that, these judges should know about arbitration then. [06:28.960 --> 06:35.600] You would think they would, but usually they file a lawsuit first and then go to arbitration, [06:35.600 --> 06:40.080] the weakest one, straight to arbitration. [06:40.080 --> 06:42.080] That may be why they don't understand it. [06:42.080 --> 06:46.960] Yeah, because it doesn't have to go through a lawsuit. [06:46.960 --> 06:52.680] There's no requirement for a lawsuit. [06:52.680 --> 06:59.840] And tell me again how you initiate arbitration. [06:59.840 --> 07:09.080] We send a, it's like a statement of facts and you're telling them to either affirm or [07:09.080 --> 07:15.520] deny or agree or disagree and it's set out like a contract where you have all these statements [07:15.520 --> 07:24.320] and then you have the expectations and then if they don't prove these facts to be untrue, [07:24.320 --> 07:34.200] then they are liable to you for damages and it spells out the damages and then it says [07:34.200 --> 07:37.480] it's going to arbitration, it has an arbitration clause in it. [07:37.480 --> 07:43.600] Yeah, on the surface this sounds like UCC, but it's not, is it? [07:43.600 --> 07:45.760] No. [07:45.760 --> 07:48.360] This is federal statute. [07:48.360 --> 08:01.680] It's a federal arbitration act, yeah, FAA, and it's nine USC is where you find all of [08:01.680 --> 08:05.960] the directives on that, Title IX. [08:05.960 --> 08:08.920] That was the part I was most intrigued by. [08:08.920 --> 08:15.760] This is not your standard UCC argument. [08:15.760 --> 08:18.560] This is a straight statutory issue. [08:18.560 --> 08:22.440] But it does have UCC elements in it. [08:22.440 --> 08:25.640] Yeah, that's why it sounds like UCC. [08:25.640 --> 08:34.680] So it sounds like the process is taken from the UCC, but wherever it came from it was [08:34.680 --> 08:42.280] codified into U.S. code and that gives it more teeth. [08:42.280 --> 08:48.720] Yes, and it can be ordered by a judge or it can be part of the contract itself. [08:48.720 --> 08:53.680] In this case, it's part of the contract itself and if there is a disagreement on the contract [08:53.680 --> 08:59.280] or a noncompliance with the contract, you just send the notice that you're requesting arbitration. [08:59.280 --> 09:01.880] That's all this requires. [09:01.880 --> 09:10.480] So this kind of goes to TWIL and under UCC we want to say, we want to say the contract [09:10.480 --> 09:17.880] guys, the UCC guys are saying that if I send you this offer to contract, you are obligated [09:17.880 --> 09:20.920] to respond to me and I said, no, I'm not. [09:20.920 --> 09:26.120] I don't mean, you know, you see me an offer to contract. [09:26.120 --> 09:32.720] I can agree to it, but I don't have to deny it or refuse it. [09:32.720 --> 09:35.280] I can just ignore it because... [09:35.280 --> 09:36.280] So this is written so that... [09:36.280 --> 09:37.280] Yeah. [09:37.280 --> 09:40.040] This is written so that if they fail to respond... [09:40.040 --> 09:45.320] If they fail to respond to this, it's accepted as pass it, accepted to the contract. [09:46.320 --> 09:55.520] What TWIL says is failure to respond when you have a duty to respond and this is what [09:55.520 --> 09:57.720] the contract guys were screwing up. [09:57.720 --> 10:03.640] They're saying, I can send you a contract and somehow that invokes a duty on your part [10:03.640 --> 10:07.000] to respond and that wasn't the case. [10:07.000 --> 10:16.520] But here, now under US Code 9, in this case, you have a statutory duty to respond when [10:16.520 --> 10:19.640] it's a petition for arbitration. [10:19.640 --> 10:27.760] So now, TWIL applies when you fail to respond when you have a duty and that was when we [10:27.760 --> 10:33.640] first talked about it was the part I had the most difficulty wrapping my head around but [10:33.640 --> 10:42.160] then when you referenced it to US Code 9, it's statute, it's not contract law. [10:42.160 --> 10:52.360] Not only that, but sending it to the QWR department doesn't... [10:52.360 --> 10:59.000] You can put in the first couple paragraphs, items that would be... [10:59.000 --> 11:00.000] What would you call it? [11:00.000 --> 11:01.000] QWR documents. [11:01.000 --> 11:04.240] In a qualified written request. [11:04.240 --> 11:08.040] So it looks like a qualified written request. [11:08.040 --> 11:12.560] But also so that it gives them an additional duty to respond and it says that you have [11:12.560 --> 11:17.440] to respond to each and every paragraph. [11:17.440 --> 11:25.560] I have a 20-something page qualified written request and it asks for all kinds of garbage [11:25.560 --> 11:34.880] that you're not really allowed to ask for in a qualified written request. [11:34.880 --> 11:37.360] But I've got it in there anyway. [11:37.360 --> 11:42.320] And the reason it's in there is so that the lawyer will say, ah, this is garbage, this [11:42.320 --> 11:49.800] is garbage, this is garbage and won't get to the last paragraph that's a notice of [11:49.800 --> 11:50.800] rescission. [11:50.800 --> 11:51.800] Exactly. [11:51.800 --> 11:58.200] I've never had one notice, oh, I'm sorry, I did have one response that referenced the [11:58.200 --> 12:01.640] notice of rescission. [12:01.640 --> 12:02.640] Nobody else... [12:02.640 --> 12:06.880] They didn't go that far and that sounds like what you're documenting. [20:23.280 --> 20:27.800] Okay, let me give you a statistic that'll irk you even more. [20:27.800 --> 20:31.960] I love the word infestation. [20:31.960 --> 20:40.920] In the United States, there are 1,080,000 licensed practicing attorneys. [20:40.920 --> 20:48.560] There are more licensed attorneys than that, but only 1,080,000 are licensed and practicing. [20:48.560 --> 20:58.840] In the world, there are approximately 1,600,000 lawyers. [20:58.840 --> 21:04.200] But you know, for all this practicing, they never seem to get it right, do they? [21:04.200 --> 21:06.720] Yes, right. [21:06.720 --> 21:13.360] That statistic, it includes the United States. [21:13.360 --> 21:19.520] We have more lawyers in the United States than the rest of the world combined. [21:19.520 --> 21:30.560] It's almost like we have more people in prison than the world, we have more people in prison. [21:30.560 --> 21:34.480] We have 3% of the world's population. [21:34.480 --> 21:41.480] We house 20% of the world's population of inmates, worst police state the world has [21:41.480 --> 21:46.680] ever seen by far. [21:46.680 --> 21:48.320] Nobody seems to realize it. [21:48.320 --> 21:54.160] But then again, if you were in a police state, the vast majority of the people never have [21:54.160 --> 21:56.000] any problem with the police state. [21:56.000 --> 22:00.840] So they don't really realize they're in a police state, unless you're at war in a [22:00.840 --> 22:05.440] police state like Nazi Germany. [22:05.440 --> 22:07.320] This is by far the worst. [22:07.320 --> 22:13.400] Nazi Germany never incarcerated anyone near the relative number of people the United States [22:13.400 --> 22:14.400] does. [22:14.400 --> 22:16.400] Anyway, it's a mess. [22:16.400 --> 22:20.720] We have too many lawyers, way too many lawyers. [22:20.720 --> 22:24.800] You touched on something earlier. [22:24.800 --> 22:32.200] We have another public official, a county legislator that just got arrested. [22:32.200 --> 22:41.040] And it has, what it will go to is, if you're suing a, let's say for example, a public [22:41.040 --> 22:47.000] official is harassing you, which you have some cases, I think Tim, you mentioned them. [22:47.000 --> 22:53.560] If this is public official, if you get into court and you get discovery, or you get into [22:53.560 --> 23:02.040] a suit and you get discovery, do you have the right or the can you go to court? [23:02.040 --> 23:08.200] Do you go fishing around for other things, like things that would hint at corruption, [23:08.200 --> 23:13.640] like when this person making other forms of income and et cetera? [23:13.640 --> 23:22.040] Only if you can show that what you're looking for is relevant to the instant case. [23:22.040 --> 23:23.040] Okay. [23:23.040 --> 23:29.440] Well, I once got it allowed by, say, just telling the judge, I'm looking for a pattern [23:29.440 --> 23:31.200] in practice here. [23:31.200 --> 23:38.680] It seems to be that there's a pattern of this behavior, and I need to confirm that. [23:38.680 --> 23:48.640] Well, I sent you the email of it earlier, and it's the newspaper article of it. [23:48.640 --> 23:50.000] There's several of them. [23:50.000 --> 23:51.720] Wait a minute. [23:51.720 --> 23:54.920] Was this the one where they're dragging the judge out of the courtroom? [23:54.920 --> 23:55.920] No, no, no. [23:55.920 --> 23:56.920] No. [23:56.920 --> 23:58.960] This is a county legislator. [23:58.960 --> 24:02.960] He was a fireman, he ran for public office. [24:02.960 --> 24:08.840] The legislator, we have term limited out after 12 years, and was a Democrat. [24:08.840 --> 24:09.840] This guy is a Republican. [24:09.840 --> 24:16.360] He's supposed to be a good family, managed by the fire chief, he's supposed to be an [24:16.360 --> 24:18.880] upstanding member of the community. [24:18.880 --> 24:27.720] Well, he has a salary of $102,000, and I guess he decided that was a big step down from the [24:27.720 --> 24:33.800] $175,000 he was making as the manager of a fire district. [24:33.800 --> 24:38.360] Now we have old volunteers that he went out like New York City, and this guy's making [24:38.360 --> 24:42.920] $175,000 a year, he runs for public office. [24:42.920 --> 24:48.880] Now he's making $102,000, he sets the shell corporation up through his wife, and then [24:48.880 --> 24:55.760] he starts consulting with the same fire departments he was working for originally at the price [24:55.760 --> 24:59.360] of $10,000 a month. [24:59.360 --> 25:04.440] And the district attorney caught him, and I'm arrested. [25:04.440 --> 25:11.440] And they're going through the usual thing, this is a political attack on my career. [26:19.400 --> 26:27.000] When they died, they brought it to a jury, grand jury in Suffolk County, and they decided [26:27.000 --> 26:29.760] to go forward with it. [26:29.760 --> 26:35.520] He must have made someone really upset at him, because generally public officials protect [26:35.520 --> 26:36.520] public officials. [26:36.520 --> 26:43.360] Unless it wasn't, I mean he's a volunteer fire department, I'm thinking I never heard [26:43.360 --> 26:47.320] anybody making $175,000 a year. [26:47.320 --> 26:53.320] You know, all the little guys going around, you know, responding to the fires, and taking [26:53.320 --> 26:55.320] the risk and doing it for free. [26:55.320 --> 27:08.080] Right, this guy's making $175,000, and then he was planning, he said he lied too by the [27:08.080 --> 27:16.360] way, they got him a perjury, five counts perjury, where he said that he did not make any money [27:16.360 --> 27:20.760] through this corporation, and he thought of what turned out, he was signing the checks. [27:20.760 --> 27:27.040] Then he was using a debit card, and he was buying groceries, and his daughter's dancing [27:27.040 --> 27:28.040] lesson. [35:14.680 --> 35:19.200] And these other two people came in and they did, bought something or did something, and [35:19.200 --> 35:25.240] then they asked us if we were, if we had come to God. [35:25.240 --> 35:30.080] Now if you listen to this show, you know I'm not particularly religious, but you also know [35:30.080 --> 35:38.360] that I don't have, you know, I respect religion as my, it's my consideration that the Bible [35:38.360 --> 35:45.400] is a compendium of cultural wisdom. [35:45.400 --> 35:57.040] But these two people standing in front of us professing their Christianity made me think, [35:57.040 --> 36:02.320] therefore, when Thou doest thine arms, be not like the scribes and Pharisees who pray [36:02.320 --> 36:08.520] in the streets in synagogues to have glory of men, for thoroughly, you know that part. [36:08.520 --> 36:14.800] These guys are doing things that really stand out from the cultural norm, and the very belief [36:14.800 --> 36:20.920] system that they're proclaiming forbids them from doing this, but they do it anyway. [36:20.920 --> 36:32.960] Now I ask myself, what statement are they trying to make to me about themselves? [36:32.960 --> 36:39.760] Because I consider that everything someone says or does can be construed as a statement [36:39.760 --> 36:43.000] to the self about the self. [36:43.000 --> 36:49.600] Everything I do is a projection of who I am, the way I stand, the way I dress, the way [36:49.600 --> 36:52.960] I interact with other people. [36:52.960 --> 37:01.360] I'm expressing my image of who I am on the world. [37:01.360 --> 37:04.760] Our scientists sent a probe to Mars. [37:04.760 --> 37:12.080] The first probe we sent, Carl Sagan, said it was about as smart as a grasshopper. [37:12.080 --> 37:17.560] But if you were on Mars and you saw this probe enter the Martian environment, slow, subtle [37:17.560 --> 37:22.920] to the ground, stock popping covers, arms moving, digging dirt, doing all kinds of stuff, you [37:22.920 --> 37:26.160] would think it was intelligent. [37:26.160 --> 37:34.240] But what was going on here was we had a set of scientists on Earth who had these ideas [37:34.240 --> 37:38.400] about the nature of the Martian environment. [37:38.400 --> 37:48.280] And based on these ideas, they developed certain theories and projections. [37:48.280 --> 37:53.720] And then they built experiments to test their theories and projections. [37:53.720 --> 37:57.680] They sent those experiments to this probe. [37:57.680 --> 38:05.240] I think of the probe as a good representation of the conscious aspect of the living mind. [38:05.240 --> 38:09.120] That's the part of our mind that deals and interacts with our environment. [38:09.120 --> 38:15.320] And it does so through a number of instruments, approximately five of them. [38:15.320 --> 38:19.480] Those instruments are able to detect different aspects of the Martian environment. [38:19.480 --> 38:25.600] One of them detects electromagnetic radiation in the atmosphere. [38:25.600 --> 38:29.040] One detects temperature and pressure. [38:29.040 --> 38:31.280] One detects vibrations. [38:31.280 --> 38:33.920] I think you get the message. [38:44.640 --> 38:50.200] So we monitor these environments, and there's some part inside us that gathers all this [38:50.200 --> 38:52.920] information tries to make sense of it. [38:52.920 --> 38:56.400] And we develop an idea of who and what we are. [38:56.400 --> 39:03.480] And when we interact with our environment, we push our theories out on the environment. [39:03.480 --> 39:09.720] And we have these ideas of how the environment should respond to us. [39:09.720 --> 39:18.720] If it responds the way we expect, then we mark this down as accurate and correct and reusable. [39:18.720 --> 39:22.640] But if we get a response we don't expect, and we say, hey, wait a minute, wait a minute, [39:22.640 --> 39:27.960] the inner mind pushes into the conscious awareness and says, wait a minute, something's wrong [39:27.960 --> 39:29.520] here. [39:29.520 --> 39:32.840] We got to make some adjustments and fix it. [39:32.840 --> 39:34.840] Well, this part's in the verbal theory. [39:34.840 --> 39:39.240] It's about pattern interruption. [39:39.240 --> 39:50.000] But sometimes we have people who don't notice the external environment very well. [39:50.000 --> 39:57.160] And they have a notion, this pathological, that they're trying to push on the environment. [39:57.160 --> 40:02.080] When you notice someone who acts outside the cultural norm, that means they're not picking [40:02.080 --> 40:09.720] up the clues that what they're doing is not fitting with the cultural norm. [40:09.720 --> 40:13.840] Whenever I see that, I always ask myself, what statement is that person making to himself [40:13.840 --> 40:15.680] about himself? [40:15.680 --> 40:21.040] What's he trying to convince me of and thereby convince himself of? [40:21.040 --> 40:27.240] And there's an example I use that if you're Christian, don't be offended by this. [40:27.240 --> 40:30.120] What I call Jesus Fricks. [40:30.120 --> 40:34.320] These aren't the truly religious people. [40:34.320 --> 40:39.960] Pastor Mass is one of my best friends and he's a pastor and I call him Master Pastor [40:39.960 --> 40:42.880] because he has control issues. [40:42.880 --> 40:44.280] But that's not what I'm talking about. [40:44.280 --> 40:53.360] I'm talking about the ones that you look at him and their posture says, oh, look at me. [40:53.360 --> 40:56.920] I'm so pious. [40:56.920 --> 41:07.920] I ask myself, what is he trying to convince me of and thereby convince himself of? [41:07.920 --> 41:15.720] And I presume that what he's trying to convince me of that stands out from the cultural norm. [50:36.200 --> 50:39.200] I have just another comment on it. [50:39.200 --> 50:42.200] The Republican Party. [50:42.200 --> 51:01.200] Hack said that the leader of the Republican Party, of course, stuck up for him and said, well, I am shocked at these baseless charges that have been brought against the man who for more than thirty two years has voluntarily run into fires to save the lives, homes and businesses of neighbors he did not even know. [51:01.200 --> 51:07.200] I looked out and I said, wait a minute, the guy's only forty nine years old. [51:07.200 --> 51:13.200] I don't think these people are all nuts. [51:13.200 --> 51:19.200] Yeah, I think the problem was that his mother never said no to one. [51:19.200 --> 51:21.200] That's what I wanted to do. [51:21.200 --> 51:27.200] Still everything you said in less than a hour down, his mother and father never said no. [51:27.200 --> 51:29.200] It was not that easy. [51:29.200 --> 51:41.200] He was making a hundred and seventy thousand a year as a respected fireman and he becomes a politician. [51:41.200 --> 51:42.200] Yeah. [51:42.200 --> 51:49.200] And he takes a fifty, sixty thousand or fifty thousand dollar decrease in pay. [51:49.200 --> 51:50.200] Right. [51:50.200 --> 51:54.200] And then he steals ten thousand a month. [51:54.200 --> 51:57.200] What is wrong with this picture? [51:57.200 --> 52:01.200] What is wrong with this person? [52:01.200 --> 52:07.200] I'm saying, look at him from a different perspective. [52:07.200 --> 52:13.200] He may be telling you or trying to tell everybody who he really is. [52:13.200 --> 52:16.200] We got honesty genes. [52:16.200 --> 52:17.200] They nag us. [52:17.200 --> 52:22.200] We live in, we are human beings, herd. [52:22.200 --> 52:24.200] We have a herding gene. [52:24.200 --> 52:32.200] That's why you can get teenagers to go to war and even risk dying and that's to protect the herd. [52:32.200 --> 52:34.200] So you're part of the herd. [52:34.200 --> 52:43.200] One of the instinctual requirements for the herd is honesty between the members. [52:43.200 --> 52:46.200] Otherwise the herd will fall apart. [52:46.200 --> 52:51.200] So he's got this instinctual honesty gene. [52:51.200 --> 52:52.200] Right. [52:52.200 --> 52:56.200] And at some point he's trying to tell the truth. [52:56.200 --> 53:05.200] If the people around him don't recognize and understand what's going on here, then he's wasting his time and he's wasting his life. [53:05.200 --> 53:14.200] My philosophy has always been I'm just like an old, you know, like the Italian play what goes around, come around. [53:14.200 --> 53:16.200] I'm definitely afraid of that. [53:16.200 --> 53:21.200] And if that's what keeps me... [53:21.200 --> 53:29.200] Well, this sounds like a situation where he went to a lot of trouble to bring this retribution on himself. [53:34.200 --> 53:42.200] All this whole story may not be true, but it is a different way of looking at things. [53:55.200 --> 54:02.200] Well, when he became elected, he asked the legislature to rule on what he was doing if it was an ethics violation. [54:02.200 --> 54:05.200] They told him it was and he went and did it anyway. [54:05.200 --> 54:08.200] And then when he got caught, he lied about it. [54:08.200 --> 54:12.200] So he took what he was doing and waved it in front of them. [54:12.200 --> 54:14.200] Yeah. [54:14.200 --> 54:17.200] And said, hey, look at me. You look at what I'm doing. [54:17.200 --> 54:21.200] What same rational person does that? [54:21.200 --> 54:23.200] Yeah. [54:23.200 --> 54:25.200] Something else is going on here. [54:25.200 --> 54:27.200] There's a different dynamic. [54:27.200 --> 54:29.200] We have something called a Suffolk County farm here. [54:29.200 --> 54:35.200] He's going to be milking cows on the sheriff's farm over in New York. [54:35.200 --> 54:45.200] It may be. However, like Jimmy Swaggered, he got that monkey off his back. [01:04:09.200 --> 01:04:16.200] They already had a buyer and once the county judge found out about it, we went to court [01:04:16.200 --> 01:04:20.200] on Monday and they immediately told us to get the hell out of here. [01:04:20.200 --> 01:04:29.200] This is done on submission and a real strong black male which found out later it was a female. [01:04:29.200 --> 01:04:35.200] It looked like a male, but she was very, you know, almost wanted to tell us to get the [01:04:35.200 --> 01:04:39.200] hell out, but she said get your stuff and get out of here. [01:04:39.200 --> 01:04:40.200] Not on a docket sheet. [01:04:40.200 --> 01:04:41.200] This is done on submission. [01:04:41.200 --> 01:04:42.200] Get out of here. [01:04:42.200 --> 01:04:46.200] And the judge stopped her proceedings on the criminal case as we walked in because we're [01:04:46.200 --> 01:04:47.200] on submission. [01:04:49.200 --> 01:04:56.200] So we left and on Wednesday, I went down there to make sure they didn't sell the property [01:04:56.200 --> 01:05:03.200] and filed some other forms in bankruptcy court regarding my bankruptcy for Chapter 13. [01:05:03.200 --> 01:05:09.200] Also, you know, Randy, on Friday, I did attach the quick claim to it, the voluntary petition [01:05:09.200 --> 01:05:15.200] and got schedules A done and then immediately filed a motion for extension of time for 45 [01:05:15.200 --> 01:05:20.200] days so I can pull my credit reports and find out and find out if there's any other liabilities [01:05:20.200 --> 01:05:22.200] out there and put it in the plan. [01:05:22.200 --> 01:05:26.200] So this gets even more interesting. [01:05:26.200 --> 01:05:32.200] So now here we are, July 24, Wednesday, I go down to the courthouse to make sure they [01:05:32.200 --> 01:05:37.200] don't sell the property and the whole court building is completely surrounded with sheriffs. [01:05:37.200 --> 01:05:44.200] Well, there was a bomb squad at the Erie County clerk's office on that day and it was shut [01:05:44.200 --> 01:05:50.200] down for the whole day and I was waiting around, waiting around and obviously they did never [01:05:50.200 --> 01:05:51.200] sold it. [01:05:51.200 --> 01:05:53.200] It was taken off the list, but I had no bother to later. [01:05:53.200 --> 01:05:55.200] It was taken off the list. [01:05:55.200 --> 01:06:01.200] And I walked outside and ran right into the county judge and she thought it was somebody [01:06:01.200 --> 01:06:04.200] else that introduced myself and she got really mad. [01:06:04.200 --> 01:06:09.200] She goes, oh, you filed bankruptcy and she just shook her head and just walked away from [01:06:09.200 --> 01:06:10.200] it. [01:06:10.200 --> 01:06:11.200] She was pissed. [01:06:11.200 --> 01:06:17.200] And I said, well, we tried to see you on Monday and she just kept on walking. [01:06:17.200 --> 01:06:22.200] I said, you wouldn't let's talk to us on Monday and we had two motions on there. [01:06:22.200 --> 01:06:27.200] And one was that there was no hearing for the referee fraudulent debt that they made up [01:06:27.200 --> 01:06:31.200] and the other motion was the dismiss because they never even filed a motion for summary [01:06:31.200 --> 01:06:32.200] judgment. [01:06:32.200 --> 01:06:33.200] So there's two major issues. [01:06:33.200 --> 01:06:35.200] I'm just giving you a clip notes. [01:06:35.200 --> 01:06:36.200] Okay. [01:06:54.200 --> 01:07:00.200] I mean, maybe I'm missing something here, but why would the judge be upset about that? [01:07:00.200 --> 01:07:05.200] It's supposed to be totally fair and impartial, not have a dog in the hood. [01:07:05.200 --> 01:07:11.200] You know, and one of the chances of me running into her on that day, just like, you know, [01:07:11.200 --> 01:07:12.200] that's like getting hit by light. [01:07:58.200 --> 01:08:02.200] And I was real nice to her, shook hands with her and then she thought it was somebody else. [01:08:02.200 --> 01:08:05.200] And then as soon as she found out who it was, she goes, oh, you found bankruptcy. [01:08:05.200 --> 01:08:07.200] She shook her head and walked away from me. [01:08:07.200 --> 01:08:08.200] Like yeah, right. [01:08:08.200 --> 01:08:10.200] Like you're going to rule in our favor anyways, right? [01:08:10.200 --> 01:08:11.200] Give me a minute. [01:08:11.200 --> 01:08:13.200] Why did she have that? [01:08:13.200 --> 01:08:15.200] That raises the question. [01:08:15.200 --> 01:08:20.200] So now file the request for judicial disclosure. [01:08:20.200 --> 01:08:21.200] She's going to ignore it. [01:08:21.200 --> 01:08:24.200] She's going to refuse to answer it. [01:08:24.200 --> 01:08:28.200] But that lets her know that you're looking behind the curtain. [01:08:28.200 --> 01:08:39.200] Then go to the county assessor collector and the registrar of deeds and look her name up. [01:08:39.200 --> 01:08:40.200] Right. [01:08:42.200 --> 01:08:49.200] And then once you see the properties, see if there have been any mortgages against the [01:08:49.200 --> 01:08:53.200] property that were paid off relatively quickly. [01:08:53.200 --> 01:09:00.200] That is the primary way judges use to launder their. [01:09:00.200 --> 01:09:04.200] You'll gotten gains. [01:09:04.200 --> 01:09:05.200] That's amazing, Randy. [01:09:32.200 --> 01:09:39.200] So do a property check in Erie County and find out what she owes. [01:09:39.200 --> 01:09:48.200] And look at see if you can look up a buy owner, find out where she was born, where she went to school, check those counties. [01:09:48.200 --> 01:09:53.200] And then do the judicial petition for disclosure of financial assets. [01:09:53.200 --> 01:09:54.200] Correct. [01:09:54.200 --> 01:09:58.200] Yes, file that and then go do your own digging. [01:09:58.200 --> 01:10:07.200] Would it also be a good that would be the right time to go check in and see about her bond? [01:10:07.200 --> 01:10:12.200] Yes. [01:12:02.200 --> 01:12:04.200] And then he had to do some other petition. [01:12:04.200 --> 01:12:05.200] He finally got off. [01:12:05.200 --> 01:12:09.200] He set in jail for 10 days for just having silver in his pocket. [01:12:09.200 --> 01:12:14.200] I always liked that one. [01:12:14.200 --> 01:12:19.200] So maybe you can return the favor to this judge. [01:12:19.200 --> 01:12:22.200] Yeah. [01:12:54.200 --> 01:13:01.200] And now it's appropriate for you to try to figure out what that dog is. [01:13:01.200 --> 01:13:10.200] Okay, so you're did the bank, they did pull your property from the sale list. [01:13:48.200 --> 01:14:02.200] And it was February, no, January, the, the last week of January, 2015, two weeks after the Jesenowski case came out that they filed for foreclosure. [01:14:02.200 --> 01:14:06.200] They were still in the court of appeal. [01:14:06.200 --> 01:14:14.200] And there was a sheriff's bill, but they can't go any further because still in the court of appeals and it can be thrown out. [01:14:14.200 --> 01:14:20.200] And I'll get my house back. [01:14:20.200 --> 01:14:28.200] That's why they generally don't sell the property as long as there is litigation in place. [01:14:28.200 --> 01:14:41.200] Yeah, because if they lose at the end of the day, then sometimes if they've sold a party, sold the house to a third party who's essentially an innocent party, you generally can't get your house back. [01:14:41.200 --> 01:14:47.200] But you can get damages. [01:14:47.200 --> 01:14:53.200] Yeah, major damages if they've done all these properties. [01:14:53.200 --> 01:14:57.200] In my case, they sold the house to Fannie Mae. [01:14:57.200 --> 01:15:00.200] Oh, that's, that's just like not selling it. [01:15:00.200 --> 01:15:06.200] So as long as there's not a third party involved, Fannie Mae is not a third party. [01:15:06.200 --> 01:15:10.200] So that's like the bank buying it back itself. [01:15:10.200 --> 01:15:26.200] So I'm not sure that that's even a bad thing because now there's no question of a third party entering the mix because the third party is essentially an innocent party. [01:15:26.200 --> 01:15:31.200] And that can restrict your ability to recover your property at the end of the day. [01:15:31.200 --> 01:15:40.200] So if Fannie Mae bought it, then nothing's going to happen to the property as long as you're in court with them. [01:15:40.200 --> 01:15:47.200] And if you're still in the appellate court, you've still got another year or so at least, depending on what the appellate court does. [01:15:47.200 --> 01:15:55.200] We haven't even, we've not even due to file our appellate brief until September. [01:15:55.200 --> 01:16:03.200] Yes, because it's a different, it's a different appeal. It's all on the subject of jurisdiction. [01:16:03.200 --> 01:16:08.200] And so if there's no jurisdiction, they had no right to sell it to begin with and I'll get it back. [01:16:08.200 --> 01:16:17.200] And that's on top of the arbitration award and all the damages I collected there. [01:19:51.200 --> 01:20:01.200] And I got him at the point of foreclosure, we stopped the foreclosure, and he finally lost the property seven years later. [01:20:01.200 --> 01:20:05.200] And he only lost it because he didn't do what we told him to. [01:20:05.200 --> 01:20:20.200] Take half the mortgage and put it in a bank so that when you get to that point, then you've got a handful of money that you can go to them and broker a deal. [01:20:20.200 --> 01:20:27.200] So you're not even close to losing the property. [01:20:27.200 --> 01:20:34.200] What's even really interesting is the first lean holder has not even filed a motion to stay in a bankruptcy cooler. [01:20:34.200 --> 01:20:39.200] So they're using the second lean holder, which the judgements only for $59,000. [01:20:39.200 --> 01:20:58.200] And we want the court back at the county level on Monday to be heard because the judge never even had a hearing for us to sit and have a hearing with the referee to establish what they believe we owe, or my mom owes, I should say, not me. [01:20:58.200 --> 01:21:04.200] And they just skipped it and granted an order and a reference to the referee with no due process hearing, no nothing. [01:21:04.200 --> 01:21:12.200] We didn't even know the referee report was done, Randy. It was done last year, back in April 2018. They just did it. [01:21:12.200 --> 01:21:16.200] No notice, no nothing. [01:21:16.200 --> 01:21:21.200] So have you moved to have that ruling stricken? [01:21:21.200 --> 01:21:25.200] Yes, that's what the motions were on Monday to be heard. [01:21:25.200 --> 01:21:35.200] And as soon as we found out we were kicked out of the courthouse, or I'm sorry, as soon as we found out that was going to be done on submissions, I said, screw this, I'm going to bankruptcy court. [01:21:35.200 --> 01:21:39.200] They're not going to ruin our favor at all. They don't want us to make a record. [01:21:39.200 --> 01:21:48.200] The writing was on the wall, Randy. The writing was on the wall. So I went down there Friday and filed the skeleton bones of Chapter 13. [01:21:48.200 --> 01:21:58.200] Got that all filed, got the filing fee paid, and got at least Schedule A done, but I still have the other schedules to get done, but I have to pull up my credit reports, which I just sent out today. [01:21:58.200 --> 01:22:11.200] And so anyways, at least we stopped the sale. And I got my work cut out because the meeting is already set for September 3rd, the 341 meeting, and I already got the credit counseling class done already. [01:22:11.200 --> 01:22:18.200] And that's really important to get that done. It's supposed to get that done immediately. The pre and then the post is done after the 341 meeting. [01:22:18.200 --> 01:22:21.200] They give you 60 days, but I don't think it's done anyway. [01:22:21.200 --> 01:22:29.200] You know you can file an adversarial pleading in the bankruptcy. [01:22:29.200 --> 01:22:36.200] I absolutely know that. I didn't want to talk about that because it's kind of premature because I still have five weeks to get to that point. [01:22:36.200 --> 01:22:47.200] But yeah, that's already in my... I'm already in the process of doing that, but I got to get the preliminary stuff in. [01:27:15.200 --> 01:27:24.200] I don't have no contract with this bank. I have nothing to do with any of this stuff and they're already trying to attach a less debt. [01:27:24.200 --> 01:27:34.200] Good thing. That's a good thing because that gives you the opportunity to give them an arbitration agreement to force them. [01:28:30.200 --> 01:28:42.200] That law firm got indicted by the federal government, a civil indicted, and they paid a big fine back in December of $6.8 million for using Franny and Freddie's name, [01:28:42.200 --> 01:28:44.200] exactly what they did to us. [01:28:44.200 --> 01:28:57.200] And originally, the first lean holder was HSBC, but they bailed out that we have no interest in this property at all, so they changed the judgment from HSBC to the Federal National Mortgage Association 30 days later. [01:28:57.200 --> 01:29:00.200] And then two weeks after they did that, get this. [01:29:00.200 --> 01:29:09.200] That's when the government announced the big bolt and that Rosicki and Rosicki has been civilly indicted, not a criminal indictment, it's a civil indictment. [01:29:09.200 --> 01:29:17.200] And eight months after that, they had to pay, I think, maybe $6.9 million to law firm out in New York City. [01:29:17.200 --> 01:29:24.200] And they had our case for almost four years, but they couldn't budge on it because we were right on top of all the filings. [01:29:24.200 --> 01:29:29.200] And that's another long story, but the first lean holder will not file a motion with the state bankruptcy court. [01:29:29.200 --> 01:29:35.200] So they used the second, the junior lean holder, the key bank to try to sell the property on Wednesday. [01:29:35.200 --> 01:29:37.200] And then I came in and stopped that. [01:29:37.200 --> 01:29:39.200] So this is the third time. [01:29:39.200 --> 01:29:40.200] Hang on. [01:34:57.200 --> 01:35:00.200] I don't want to spend too much time presenting that other colors, [01:35:00.200 --> 01:35:05.200] but one thing I will say about the first lienholder, the referee did the report last year [01:35:05.200 --> 01:35:10.200] and said that my mom owes $144,000. [01:35:10.200 --> 01:35:18.200] Remember, we recorded that conversation with the Federal National Mortgage Association out in Washington, D.C., [01:35:18.200 --> 01:35:23.200] and you can even go online and look up the Federal National Mortgage Association, [01:35:23.200 --> 01:35:26.200] put the property address in, social security number and all that, [01:35:26.200 --> 01:35:30.200] and said there are no liens or loans with the Federal National Mortgage Association. [01:35:30.200 --> 01:35:32.200] Zilch, none. [01:35:32.200 --> 01:35:37.200] And they gave me two law firms that represent the Federal National Mortgage Association [01:35:37.200 --> 01:35:44.200] and none of them that filed a proof of claim have been hired by the Federal National Mortgage Association. [01:35:44.200 --> 01:35:48.200] So basically, there is no debt owed to the first lienholder. [01:35:48.200 --> 01:35:50.200] Well, even a sign... [01:35:50.200 --> 01:36:03.200] You can file an adversarial action and demand proof that they represent Fannie Mae by a contract that they have with Fannie Mae. [01:36:07.200 --> 01:36:13.200] That's exactly what we did in the adversary proceeding, Randy, way back about three months ago. [01:36:20.200 --> 01:36:21.200] Next month, of all people. [01:36:21.200 --> 01:36:28.200] And he had everybody come in, and he dismissed everything, and he said nobody in here is allowed to talk. [01:36:33.200 --> 01:36:42.200] And he said, and all he said, everybody wants to scream, fraud this, fraud that, fraud that, fraud this, and then nobody wants to pay their bills. [01:51:10.200 --> 01:51:19.200] But yeah, I mean, I just... One guy I called, he lost his house, but twice I've been on the phone with him for two hours trying to talk him out of suicide. [01:51:19.200 --> 01:51:23.200] I ended up having to call him first time since I had prevention. [01:51:23.200 --> 01:51:30.200] And it's... But this guy, he's just such a fighter and a hard worker, but I can tell he's at the end of his rope. [01:51:30.200 --> 01:51:40.200] He needs a miracle right now. But he's relied way too much on horrible attorneys who have taken him for every penny he's got. [01:51:40.200 --> 01:51:55.200] I will tell you right now, attorneys are wonderful for some things, but you have to create every pleading and tell them when exactly to put it in and don't take no for an answer. [01:51:55.200 --> 01:52:03.200] Because I had attorneys screw me left and right, and it's not what you pay or what you don't pay. It's their carelessness. [01:52:03.200 --> 01:52:10.200] They don't have a dog in the hunt, so they're not... They really are not what you call focused. [01:52:10.200 --> 01:52:14.200] No. And nobody's focused like you are. [01:52:36.200 --> 01:52:47.200] Well, then I had another attorney. I was recommended to this other BK attorney. She said, oh, I've never lost the case yet, but you need to change this to Chapter 7. [01:52:47.200 --> 01:52:59.200] But like the other guy, I didn't have any debt except this house. I had already taken care of all that, and then she failed to file something on time, and then the judge just said, no, this belongs in the state court. [01:52:59.200 --> 01:53:11.200] I had taken it out, and I lost the house because of the judge, the attorney, and the judge failing to do something on time and just lying about it. [01:53:11.200 --> 01:53:13.200] And so... [01:53:13.200 --> 01:53:23.200] I'll tell you something here. I had the same thing this week. I had an appeal here in Arizona on a foreclosure case where I had... [01:53:23.200 --> 01:53:41.200] They found against me, and they violated the law to do it, and we have it in a court of appeals, and they said the amount was due by the 25th, and the lawyer didn't send the money in in time, and I told him a week ago to do it. [01:53:41.200 --> 01:53:59.200] Fortunately, they filed some paperwork and got an extension of three days. But it's like I'm saying, you have to be on them all the time. Do not trust an attorney to be by himself. You stay right on his back end and check everything he files. [01:53:59.200 --> 01:54:11.200] And they don't... Their worst is when they come to in front of the judge. You know, I told my last attorney, I said, you're a total pussy in front of the judge. You're too afraid of him, and this is wrong. [01:54:11.200 --> 01:54:21.200] I said, are you even talking to the other side? And I swear he was talking to the other side, and just make using me to pay his rent. [01:54:21.200 --> 01:54:26.200] I would stop hiring attorneys if you could do it for yourself better. [01:54:26.200 --> 01:54:39.200] I mean it. I'm trying to write this. They're doing the declaratory judgment. I did that, and I'm trying to get the answer. I have troubles writing it, but I'm trying not to hire an attorney, probably because I don't have any money to hire one anyway. [01:55:59.200 --> 01:56:07.200] I said, no, I hired you to write a complaint against the judges, because you said you've had judges and policemen kicked off. [01:56:07.200 --> 01:56:15.200] That's what I hired you to do. And she didn't do it. She kept saying, you need another complaint. No, I've got residue to cut her. [01:56:15.200 --> 01:56:24.200] I've got all this. I need to file these complaints in time. Of course, she spent eight months telling me how wonderful she was and then didn't do it. [01:56:24.200 --> 01:56:33.200] And she's still trying to do the same with James. So if he can go kind of behind the scenes like you're doing, I think it's a wonderful idea. [01:56:33.200 --> 01:56:43.200] And I wish I had a few more people that you could help to do this. In fact, I do have one, but I don't even think she can make the money for the arbitration.
