[01:20.000 --> 01:24.640] The lawsuit was compiled after an 11-month-long investigation by the Office of the Texas Secretary [01:24.640 --> 01:30.000] of State and the Texas Department of Public Safety which sought to identify non-U.S. citizens [01:30.000 --> 01:33.360] who were registered to vote when obtaining major artisans. [01:33.360 --> 01:37.000] Over half of the 95,000 did indeed vote, it seems. [01:37.000 --> 01:41.120] However, further controversy was raised when it became clear that some of the names were [01:41.120 --> 01:45.280] not in fact belonging to those who were non-citizens and registered. [01:45.280 --> 01:50.880] Apparently around 25% of all Latino immigrants become naturalized, gaining the right to vote. [03:24.480 --> 03:28.140] Make them mind by criminal cops Psychopathic predators here, rise in neighborhood [03:28.140 --> 03:30.720] Glock Dequip with pepper spray, mate, cuffs, jazzy and [03:30.720 --> 03:32.640] Glock They like serial killers acting out [03:32.640 --> 03:35.120] supplemental thoughts Forget what you talk, these cops have [03:35.120 --> 03:38.000] got a license to kill Witness intimidation means that they can [03:38.000 --> 03:40.760] use it at will Code of silence means that the people never let [03:40.760 --> 03:43.040] out a will And if they go to court, they know the judge [03:43.040 --> 03:45.560] will make them a deal For real, that's why they're sobbing me [03:45.560 --> 03:48.800] Locking me up and sobbing me Complicating my poverty, talking in my [03:48.800 --> 03:51.400] democracy Making them poor commodity, profiting off [03:51.400 --> 03:55.000] of poverty, deporting apology, supporting prison economy, yeah [03:55.000 --> 03:57.000] No one makes money with no problem I first did this evening [03:57.000 --> 03:59.320] This is the Monday Night Rule of Law radio show [03:59.320 --> 04:06.840] It is April 8, 2019, we are live tonight Now, I have opened up the phone line [04:06.840 --> 04:09.160] because everybody will start getting in line and give us a call [04:09.160 --> 04:14.120] 512-646-1984, call it, remember, if you want to call and get in line [04:14.120 --> 04:17.640] with an issue or a question I don't have a whole lot to die [04:17.640 --> 04:19.800] trial about at the beginning of the show tonight [04:19.800 --> 04:23.160] It's been a very hectic week for me, still rebuilding computers [04:23.160 --> 04:26.400] and trying to get those streaming classes set up and everything else [04:26.400 --> 04:29.600] And it has been nothing but one problem after the next [04:29.600 --> 04:34.280] And it's getting very daunting at this stage I just want to take a nap [04:34.280 --> 04:37.000] and stay there for a while I want to be Rip Van Winkle [04:37.000 --> 04:45.120] But that ain't the case Now, for what little bit I do have this week [04:45.120 --> 04:51.560] I would like to read something that I posted up on Facebook [04:51.560 --> 04:58.920] that basically covers all these people that come up to me via email [04:58.920 --> 05:02.840] or on Facebook or all these other places and say [05:02.840 --> 05:07.680] I want to sue a cop who did me dirty and I can't get a lawyer who will take the case [05:07.680 --> 05:11.600] and I want you to help me and blah blah blah and all that kind of stuff [05:11.600 --> 05:15.520] Okay, well, what I want to do is I'm going to read you what I wrote [05:15.520 --> 05:19.520] which is basically a self-help [05:19.520 --> 05:25.400] And the fact of the matter is I can't help you [05:25.400 --> 05:31.000] I can sort of help you I can answer some fundamental questions and all that stuff [05:31.000 --> 05:38.280] but what I cannot do in any way shape or form is go to court and speak for you [05:38.280 --> 05:43.320] since you are the one that will have to do all of the talking at any place [05:43.320 --> 05:46.840] other than a federal court where I could possibly get in as next friend [05:46.840 --> 05:52.240] and help you out there but in a state court I never get to open my mouth [05:52.240 --> 05:56.560] It's all up to you if you cannot get an attorney to do the job [05:56.560 --> 06:03.720] Okay, now since it is up to you you're going to have to know several things [06:03.720 --> 06:06.480] and that's what this self-help that I wrote up is all about [06:06.480 --> 06:09.200] It was meant to do, accomplish two things [06:09.200 --> 06:14.840] One, give somebody an outline of the things they need to study and learn [06:14.840 --> 06:18.400] in order to handle a case by themselves [06:18.400 --> 06:28.200] and two, to show where the patronut methodology has its most incredibly large sized holes [06:28.200 --> 06:34.120] Okay, the patronuts are all looking for silver bullet ways to stop everything dead in its tracks [06:34.120 --> 06:36.440] which isn't going to happen [06:36.440 --> 06:39.160] This is not a television show [06:39.160 --> 06:46.680] This is not a movie where justice is superior to everything else [06:46.680 --> 06:54.360] These courts, these prosecutors, these people love their procedure more than they love liberty [06:54.360 --> 06:58.920] and I have a thing I wrote up about that too but that's something else [06:58.920 --> 07:02.960] Right now I'm going to stick with what I wrote for this post [07:02.960 --> 07:05.400] So let me read it to you [07:05.400 --> 07:08.400] I want to sue that cop for what he did to me [07:08.400 --> 07:13.480] but I can't get an attorney to help me, I guess I'll just have to do it myself [07:13.480 --> 07:20.840] Okay, but do you really understand what that actually means and entails on your part? [07:20.840 --> 07:25.160] First you're going to need to learn how to conduct a lawsuit properly [07:25.160 --> 07:28.680] If that's the case, that means you're going to have to get jurisdictionary [07:28.680 --> 07:36.960] which is the only program out there that I know of that teaches the layman how to properly conduct a lawsuit from beginning to end [07:36.960 --> 07:42.920] The downside of jurisdictionary [07:42.920 --> 07:49.720] It does not teach you how to sue governmental actors or entities directly [07:49.720 --> 07:59.480] nor does it teach you how to deal with the absolutely guaranteed 100% fundamental going to happen [07:59.480 --> 08:07.080] 12B6 and other dismissal style motions that are sure to follow the moment you file the suit [08:07.080 --> 08:11.680] especially against a government employee or agency [08:11.680 --> 08:16.840] Just realize that up front [08:16.840 --> 08:24.320] That also means becoming intimately familiar with the rules of civil procedure and evidence for whatever state you are in [08:24.320 --> 08:28.320] or at the federal level if you plan to sue them there [08:28.320 --> 08:35.240] You could also sue in both but you would have to do the same thing in learning and using the rules established for both [08:35.240 --> 08:40.440] which doubles your study time and mental retention requirements [08:40.440 --> 08:46.840] Oh and let's not forget possibly having to become an expert on the Federal Tort Claims Act and RICO [08:46.840 --> 08:56.080] which may give your lawsuit an extra boost in certain instances like for instance you're suing federal employees or agencies and actors [08:56.080 --> 09:02.240] Finally along with all of that studying you will necessarily need to become an expert in procedure [09:02.240 --> 09:12.160] which can and does vary from state to state and the federal and which of which there is a lot of ground to cover throughout the process of a lawsuit [09:12.160 --> 09:20.440] You also will have to learn how to object, what to object to, when to object to it and why you are objecting to it [09:20.440 --> 09:28.720] All of which must be based from a legal basis associated with one or more of these various rules [09:28.720 --> 09:35.480] On top of that you will need to study case after case after case and other similar successful lawsuits [09:35.480 --> 09:45.080] to see and understand how to overcome and deprive the government officer, employee or entity of their or its judicially constructed protections and immunities [09:45.080 --> 09:48.000] and there are many [09:48.000 --> 09:51.520] So this means learning to do proper legal research [09:51.520 --> 10:03.880] That means a lot of time in a law library using Lexis, Nexus and Westlaw to make sure your cases are on point and still controlling or relevant to the issues you raise in your causes of action [10:03.880 --> 10:09.000] Yes, you must learn what a valid cause of action is as well [10:09.000 --> 10:20.320] You must also learn how to properly state and frame your claim in your lawsuit complaint so it survives those inevitable 12B6 and other dismissal style challenges that will occur [10:20.320 --> 10:24.920] 100% of the time as a matter of course [10:24.920 --> 10:37.520] If it hasn't dawned on you yet, your regular everyday normal life is going to totally disappear for an unknown period of time and your stress levels are going to fly right off the scales [10:37.520 --> 10:46.040] In short, you have to become an actual, knowledgeable and experienced lawyer all by yourself [10:46.040 --> 10:54.640] Because no one can go in and speak for you in these courts with certain exceptions that usually only are available at the federal level [10:54.640 --> 11:01.680] If you are successful, you will actually know more than the vast majority of licensed attorneys that are out there in the real world [11:01.680 --> 11:05.520] Because most of them are totally incompetent at what they do [11:05.520 --> 11:10.600] Believe me, I've talked to many, I've worked with many, I've argued with many [11:10.600 --> 11:15.120] They do not know the stuff they're supposed to know [11:15.120 --> 11:17.440] 9 times out of 10 [11:17.440 --> 11:19.160] Oh, and guess what? [11:19.160 --> 11:28.640] This is the same thing you have to do when it comes to defending yourself in a lawsuit or a criminal case all by yourself [11:28.640 --> 11:42.120] There simply aren't any legal magic bullets that will let you get justice in a responsive and less costly time-consuming, frustrating, aggravating, terrifying and hopelessly outgun banner [11:42.120 --> 11:46.600] I wish there was such a silver bullet scenario, but there just isn't [11:46.600 --> 11:54.320] And anyone who tries to tell you and convince you that there is such a bullet is a died-in-the-wool liar [11:54.320 --> 12:07.600] Short of having go directly to prison and don't pass go incriminating evidence against virtually everyone involved, which includes the cops, the judges and the opposing counsel for the defense, etc. [12:07.600 --> 12:15.720] Thus allowing you to blackmail them and letting you win, it just isn't going to happen that silver bullet way ever [12:15.720 --> 12:26.080] If, despite all of this, you are still determined to do it all yourself and you are willing and capable of doing all that is required to do it correctly and succeed [12:26.080 --> 12:31.960] Then I say more power to you, less to them, and congratulations [12:31.960 --> 12:43.280] Now folks, that's just a very simplified outline of the things you need to focus on in order to learn how to do the stuff that the attorneys do [12:43.280 --> 12:45.480] Okay? [12:45.480 --> 12:52.560] There is, of course, details buried in details below this level [12:52.560 --> 13:00.840] But that involves you actually getting into the material that this level talks about before those details even matter [13:00.840 --> 13:10.240] And most people and attorneys simply don't want to do it and don't understand it when they do [13:10.240 --> 13:22.800] And those that do know anything about it know how the system does it even if the system is doing it incorrectly in accordance with the very rules we're discussing [13:22.800 --> 13:39.280] When the system ignores its own rules to operate outside of law to do what it does, the system is unconstitutional, the system is unlawful, the system is abusive, the system is corrupt [13:39.280 --> 14:01.160] And you need to understand that going in but the best chance you have of blocking the corruption and preventing it from overwhelming you is to understand how it happens, why it happens, where it happens [14:01.160 --> 14:11.000] And what you need to know to object to it because when you fail to object, then everything the record shows is that you're A-OK with it [14:11.000 --> 14:20.640] And if you're A-OK with it, then the appellate court's got nothing to argue about because even if it was a violation, you didn't object [14:20.640 --> 14:29.560] And therefore, since you didn't object, the violation stands even though it's wrong under the law, they don't care [14:29.560 --> 14:49.320] Because the onus is on the one being sued or the one being prosecuted or the one that is bringing the suit to know the rules to such a degree that you can either be the plaintiff or survive being the defendant [14:49.320 --> 15:05.000] OK? So if you can't be the defendant and argue back, you're going to get just run right over and this is where most of the patronets fail in court and then blame it all on the court system as being absolutely corrupt [15:05.000 --> 15:14.280] Even though it is, don't get me wrong, I'm not arguing that the court isn't corrupt, especially the lower level courts of no record, they absolutely are [15:14.280 --> 15:34.360] But how do you intend to fix it without evidence of it? How do you get evidence of it? By making a written objection about what they did wrong, which you will not know if you have not studied the things that I have told you to study in this write-up [15:34.360 --> 15:47.480] If you don't know any of these rules and you don't know any of the procedure, how can you make an argument that they did it wrong? How can you make an argument that they harmed you by doing it wrong? [15:47.480 --> 16:08.600] The answer is you can't and because you can't, you will lose, not only at trial but on appeal. Nine times out of ten, even if you do manage to get everything done to do your appeal, you're going to write your issues up incorrectly [16:08.600 --> 16:21.720] Or you're going to fail to object to the appellate's court spinning of the issues in a different direction than where you had them, without ever addressing why they ignored the way you had them [16:21.720 --> 16:39.720] And here, for instance, right here in Austin, the Third Court of Appeals is notorious for that. They will completely ignore what's in the pleadings and what's in the record to come up with any ruling they want if they can spin it to get the conclusion they desire to have [16:39.720 --> 16:59.720] Okay? We need to do something about this, but until we become educated on it, we can't stand together and scream at the top of our lungs to somebody that can do something about what is wrong, and that we need to change. [20:32.720 --> 20:37.720] Yeah, especially if you're married or have a job. [20:37.720 --> 20:47.720] If you're bad enough when this is the only work you're doing and you keep hitting a brick wall trying to pluck some information out of something, that's a bunch of double talk. [20:47.720 --> 21:02.720] But when you're married or you have a job that takes up a lot of your time, it gets really difficult to them when they're threatening you with all kinds of unpleasantness for spending all of your time away from them. [21:02.720 --> 21:13.720] And for me, this last two weeks, my business partner of 28 years was injected with a wrong medication and passed away last week. [21:13.720 --> 21:15.720] Oh, well, I'm sorry to hear that. [21:15.720 --> 21:20.720] You know, so it's like, and the court is making a mess of things right now. [21:20.720 --> 21:33.720] Okay, so my questions, I have been in the federal court from this is my third year now, I've had four judges in the last two years, which bothers me. [21:33.720 --> 21:35.720] I guess it's not a big deal. [21:35.720 --> 21:37.720] But I have never asked this question. [21:37.720 --> 21:42.720] What is the difference between a magistrate judge and a regular judge? [21:42.720 --> 21:44.720] Well, all judges are magistrates. [21:44.720 --> 21:47.720] It's just whatever hat they're wearing. [21:47.720 --> 21:57.720] The magistrate is the administrative side of the court, that hat, and the judge hat is the judicial side of the court. [21:57.720 --> 22:10.720] Okay, when I got into this case, they asked, I mean, they specifically asked me, I mean, the federal district court, they asked me, will you accept a magistrate judge or do you want a regular judge? [22:10.720 --> 22:14.720] Well, at the federal level, we're not asking that question. [22:14.720 --> 22:31.720] My best guess, I do not know the answer to this for certain, but based upon the fact that they asked you that, my best guess would be that either a, it's a judge from an inferior court that is sitting there for administrative review of your issue. [22:31.720 --> 22:32.720] Okay. [22:32.720 --> 22:42.720] And not one of the actual court where it would be heard if it was treated judicially rather than administratively. [22:42.720 --> 22:45.720] Okay, I'll have to do some more research on that. [22:45.720 --> 22:47.720] That's my best guess. [22:47.720 --> 22:54.720] I haven't looked to see why the Fed would draw that distinction or there are other possibilities that operates like California. [22:54.720 --> 23:03.720] In California, the magistrate that sits in on your traffic ticket hearing is not actually a judge at all. [23:03.720 --> 23:20.720] They're simply a court clerk who's been given the duty of holding hearings and acting as someone with actual knowledge and authority to take your money by finding you guilty regardless of the facts and evidence. [23:20.720 --> 23:23.720] So that's another possibility. [23:23.720 --> 23:27.720] Can't say for certain, but it is possible. [23:27.720 --> 23:28.720] Okay. [23:28.720 --> 23:44.720] Okay, in the middle of March, this judge issued an order, which I have never received, and I knew there was something wrong with the paperwork, so I got under pacer and I started looking. [23:44.720 --> 23:58.720] The first sentence in this order, and I'm the plaintiff, it says, this is a prisoner civil rights matter in which the plaintiff proceeds pro se. [23:58.720 --> 24:03.720] I mean, to me, that says this judge thinks I'm a prisoner. [24:03.720 --> 24:08.720] Well, it also says this judge is probably not reading the information put in front of them. [24:08.720 --> 24:12.720] You need to object to the order. [24:12.720 --> 24:15.720] Okay, and guide me. [24:15.720 --> 24:16.720] How do I object to the order? [24:16.720 --> 24:34.720] Do you file a written objection with whatever in the case dealing with that order, and then you take it up for appeal, or you try to file an interlocatory appeal and challenge that order directly because that is not a factually accurate representation of the case. [24:34.720 --> 24:35.720] Okay. [24:35.720 --> 24:39.720] That was the verb that I'm looking for. [24:39.720 --> 24:40.720] Okay. [24:40.720 --> 24:48.720] And let me ask you, okay, we've gone through this, you know, we've been, you know, doing our motions and our discovery and everything for the last few years. [24:48.720 --> 24:58.720] The Defendants Council keeps using terms of art like driving, motor vehicle, and such things. [24:58.720 --> 25:00.720] How do I counter that in my... [25:00.720 --> 25:02.720] Make a motion in limiting. [25:02.720 --> 25:24.720] That unless this individual provides a definition relative to law for those terms, you object to their use because they're attempting to allow the jury to draw their own conclusions as to their legal meaning rather than that established by the legislature in law. [25:24.720 --> 25:26.720] Okay. [25:26.720 --> 25:36.720] And then one last thing is in the same writings, there are a lot of conflicting statements. [25:36.720 --> 25:45.720] There's one statement that says when the officer pulled me over, there was a firearm, you know, in plain sight. [25:45.720 --> 25:53.720] Then you need to object to the other council's attempt to introduce false facts into the case and move for sanctions. [25:53.720 --> 25:59.720] The other side's council is intentionally misstating the facts of the case to alter the outcome. [25:59.720 --> 26:02.720] That's the allegation you need to be making. [26:02.720 --> 26:16.720] They have a responsibility to accurately and properly state the facts of the case, not to mislead the judge or the jury about the facts of the case, which is exactly what these pleadings are doing. [26:16.720 --> 26:17.720] Okay. [26:17.720 --> 26:41.720] So file a written objection to that, file a motion for sanctions against that attorney for making false statements to the court, knowing and willful false statements to the court, and attempt to perpetrate fraud upon the court and get a judgment in their favor to the harm of the defense or the plaintiff. [34:45.720 --> 35:06.720] And I was listening to your show two, three weeks ago where it sounds to me like you need to be able to take each person from the issuance of that land patent, [35:06.720 --> 35:17.720] the assign or one of the heirs, and get them to sign off on it before you can bring it forward to the current day. [35:17.720 --> 35:24.720] So, the lady that I bought the property from now is about 80 years old, [35:24.720 --> 35:28.720] and she bought her, actually her husband bought it on a warranty deed. [35:28.720 --> 35:31.720] She inherited it when he died. [35:31.720 --> 35:51.720] I don't see any way, it seems to me that the train of ownership of that property can't be established directly. [35:51.720 --> 36:04.720] If she got it on a warranty deed and everyone else is dead, how can that patent be brought forward? [36:04.720 --> 36:09.720] Change the title. [36:09.720 --> 36:23.720] Yeah, so that was my thought that merely because, so when the patent is made, there are rights that are conveyed in that patent, [36:23.720 --> 36:31.720] and merely because the patent is not brought forward, the rights still exist. [36:31.720 --> 36:45.720] Yes, so the question remains is whether or not the law authorizes the chain of title to replace an actual delegation by an original heir or a sign, [36:45.720 --> 36:50.720] versus the original patent holder. [36:50.720 --> 37:00.720] The thing is, since the state is illegally transferring title without it, then they're creating a record that says it's valid. [37:00.720 --> 37:05.720] You see where their law would wind up getting them in a lot of deep trouble one way or the other there? [37:05.720 --> 37:11.720] Either you're saying the chain of title is illegal and I can't use it to carry my land patent forward, [37:11.720 --> 37:19.720] which means you people have been committing fraud by issuing these titles to land that you have no say so over, [37:19.720 --> 37:34.720] or my title's good via your so-called chain of title and I want the patent brought forward in my name because your title shows all the prior owners in the transfers by those owners to whoever the current person is, [37:34.720 --> 37:38.720] which in this case is me. [37:38.720 --> 37:43.720] It's kind of a catch-22 for them, don't you think? [37:43.720 --> 37:58.720] Yeah, when you put it that way, well, to have it any other way to me would be the state just grabbing rights that they have no legal basis to grab. [37:58.720 --> 38:01.720] Ding, ding, ding, we have a winner. [38:01.720 --> 38:06.720] What makes you think they're above that? They've been doing it for half a century. [38:06.720 --> 38:10.720] Well, they've been doing it for more than a century. [38:10.720 --> 38:13.720] Yeah, don't get me started. [38:23.720 --> 38:28.720] Now, if you don't know how to do that chain of title search, I'll tell you who can do it for you. [38:28.720 --> 38:34.720] A, a title company, B, an oil and gas landman. [38:34.720 --> 38:43.720] I cannot tell you which one will cost you more or less, but I can tell you those two people will know more about getting it right than anybody else in the business. [38:43.720 --> 38:56.720] Well, the previous owner suggested to me that I contact the title company that handled the land transfer. [38:56.720 --> 39:14.720] That's what I'm saying, a title company or an oil and gas landman who has to do research to find the correct person on every piece of land that can actually sign the agreement with the oil company to drill on that land. [39:14.720 --> 39:20.720] They can't just take any one signature to put up and courtest a piece of land. [39:20.720 --> 39:25.720] They must find the person who absolutely has the rights to that land. [39:25.720 --> 39:30.720] They do research better than title companies in some cases. [39:30.720 --> 39:39.720] Okay, well, in Idaho, I don't think there's too much oil to be found, but... [39:39.720 --> 39:47.720] That don't mean they ain't got landmen out there that go around doing courtesting contracts to see if there is. [39:47.720 --> 39:49.720] Yeah. [39:49.720 --> 39:57.720] For other minerals, for that matter, a landman is a landman, whether it be for oil, minerals, or something else. [39:57.720 --> 40:12.720] Okay, well, that answers the question, which is you are telling, I think, that even though the assigns are not living, [40:12.720 --> 40:20.720] it can be shown legally that you have the same rights as the assign as the... [40:20.720 --> 40:33.720] It shows that you have the right to be granted the position of air or assign on that land patent. [40:33.720 --> 40:34.720] Okay. [40:34.720 --> 40:45.720] I don't confuse your terminology because one is their paperwork and one is the original paperwork, and they do not do the same thing. [40:45.720 --> 40:54.720] Because I'm pretty sure that your land patent contains language that their title doesn't have at all, such as... [40:54.720 --> 41:00.720] We relinquish all rights and claims to this land forever. [41:00.720 --> 41:01.720] Right. [41:01.720 --> 41:07.720] Well, I'm sure it has language that puts me under the jurisdiction of... [41:07.720 --> 41:16.720] The land patent won't, their document will, the land patent's the one that says they gave up any right to that land, any claim to that land, [41:16.720 --> 41:23.720] and any way to tax or do anything to that land when they gave out that land patent. [41:23.720 --> 41:30.720] And if you have a copy of the original, guaranteed it's signed by the state governor, right? [41:30.720 --> 41:35.720] No, it's signed by the president of the United States. [41:35.720 --> 41:36.720] Oh, okay. [41:36.720 --> 41:40.720] Well, then it was federal land before it became, when that patent was handed out. [41:40.720 --> 41:41.720] So guess what? [41:41.720 --> 41:42.720] Yes. [41:42.720 --> 41:44.720] The state can't do anything about it. [41:44.720 --> 41:51.720] They cannot supersede the original federal grant. [41:51.720 --> 41:56.720] Yeah, well, yeah, tell them that. [41:56.720 --> 41:58.720] Sue them for breach of contract. [41:58.720 --> 42:00.720] That's exactly what this is. [43:16.720 --> 43:21.720] And so I, so, okay, let me back up. [43:21.720 --> 43:29.720] I knew that I was going to fail because I hadn't done my homework because I didn't have time to do my homework. [43:29.720 --> 43:36.720] And so although it was a court of record, I didn't have time to put together all the paperwork. [43:36.720 --> 43:40.720] And in fact, I almost wasn't going to go until I found out what the penalty was going to be for not showing up. [43:40.720 --> 43:46.720] Okay, well hang on just a second. [47:26.720 --> 47:41.720] He had no reason to do a search of that because the sticker on my plate did not indicate that it was out of date. [47:41.720 --> 47:52.720] So I brought those two issues up. They're not in writing. However, they are, it is a court of record, they are verbally recorded. [47:52.720 --> 48:00.720] And I'm going to get it, so I can get a copy of the transcript or the recording and get it transcribed. [48:00.720 --> 48:12.720] So my question is, although I did not cite the state law or any precedent, I did... [48:12.720 --> 48:16.720] Then you cited your opinion and nothing more. [48:16.720 --> 48:31.720] Okay, that was the question. So if you're going to cite it, so it was never before the court if I could not cite the law. [48:31.720 --> 48:32.720] Nope. [48:32.720 --> 48:33.720] Okay. [48:33.720 --> 48:48.720] What you should have said rather than he illegally searched the database is that he was illegally, he was unjustly testifying to hearsay. Computer information retrieved by a third party is hearsay. [48:48.720 --> 49:02.720] It is inadmissible. Therefore, any information he is testifying to that he drew first from the computer to perpetrate his stop was obtained through an illegal search. [49:02.720 --> 49:15.720] That resulted in the use of hearsay testimony that he then relied upon to perpetrate the unlawful stop without probable cause or reasonable suspicion. [49:15.720 --> 49:22.720] And that's how I accessed the database in the first place, without probable cause or reasonable suspicion. The computer did it for him. [49:22.720 --> 49:32.720] The computer can't circumvent probable cause or reasonable suspicion and thus allow the officer to bypass that to do a search in private data. [49:32.720 --> 49:37.720] And then he can't testify to that data as a third person because it's hearsay. [49:37.720 --> 49:44.720] When it comes from a computer and he is not the one who entered it and he is not the one who knows the original source for it. [49:44.720 --> 49:50.720] In other words, he is not a competent fact witness to the information contained in the computer. [49:50.720 --> 49:54.720] He didn't put it there. [49:54.720 --> 50:01.720] Okay, but I would have to cite the court cases that say so. Yes. [50:01.720 --> 50:12.720] Okay. Well, that's pretty much what I thought. [50:12.720 --> 50:24.720] But I would still like to cause some problems for the prosecutor and the judge because... [50:24.720 --> 50:27.720] How do you plan on doing that? [51:29.720 --> 51:39.720] Well, like I said, I knew I wasn't prepared and I wasn't even going to show up, but then I looked at the penalty for not showing up. [51:50.720 --> 52:04.720] You get a ticket and you want to fight it, but that clock ticks very quickly and you need to get on the ball and do your homework, which I didn't do. [52:09.720 --> 52:18.720] I don't know how many times I have to tell people that on a regular basis and how many times we deal with it on this show and how many times I had to discuss that fact with a patron on Facebook. [52:18.720 --> 52:25.720] Everything you're sitting here talking about that you're doing isn't going to help you. It's not making a record. It's not addressing the facts. [52:25.720 --> 52:29.720] It is not providing authority to offset what they're trying to accuse you of. [52:36.720 --> 52:43.720] And there's court case after court case after court case that says the arguments they use aren't going to help them and they don't. [52:48.720 --> 53:02.720] But they have yet to do a single thing to be able to prove what they're saying in relation to the corruption because they're not making a record of what rules are being broken and who's doing it. [53:07.720 --> 53:15.720] And when they don't know what they are, they can't object because they have no clue what to say or why they're saying it. [55:32.720 --> 55:41.720] The cop arrested me that day. The Sheriff's deputy put me in jail and they let me out because it was the capious profan. [55:41.720 --> 55:46.720] They just said, oh, you know, we can't really put you in jail. That's how we call it. Tom served. [55:46.720 --> 55:56.720] But the cop never had me, he actually told me to sign the ticket because he was issuing me a new ticket for expired registration. [55:56.720 --> 56:02.720] He told him I said, well, I'm not promising to appear. You know, take me to jail because I was already in the bank. [56:02.720 --> 56:16.720] And anyway, so I just kind of let it go. Well, I got a thing in the mail today from the judge and the justice of the peace in Rockwell demanding me to pay a amount due to $202. [56:16.720 --> 56:24.720] If you don't pay by May 1st, a warrant will be issued. County Clerk, justice of the peace Rockwell, Texas. [56:24.720 --> 56:33.720] $202 without a trial? Yeah, yeah. Like I said, I didn't sign the ticket, but you know, you don't have to sign the ticket. [56:33.720 --> 56:42.720] Texas law only requires a signature on two kinds of tickets, open container and speeding. That's it. Okay. No other ticket has to be signed. [56:42.720 --> 56:53.720] If a cop takes you to jail for refusal to sign a ticket other than speeding or open container, that cop is acting 100% illegally when he does it. [56:53.720 --> 57:06.720] Absolutely. The point, I guess, is they were taking me to jail on another issue. And this one right here, I just told them I'm not signing. [57:06.720 --> 57:15.720] And that's not really the big issue. The big issue is since I didn't sign it, they've never summoned me to court to answer for it until today. [57:15.720 --> 57:27.720] And this was the 8th of January 16th that this occurrence took place. And then today, I get a letter in the mail for this issue, for the expired registration. [57:27.720 --> 57:35.720] And anyway, I just thought it was very interesting that they're demanding payment. And I've never been summoned to court. I've never had trial. [57:35.720 --> 57:46.720] File a judicial conduct complaint against the judge. File a motion to immediately disqualify the judge from any future case pending against you in that court. [57:46.720 --> 57:55.720] And make sure that you send a copy directly to the administrative judge of the district. [57:55.720 --> 58:06.720] Not to that court, but to the... you're going to send the original to that court, but you're also going to send a copy of that directly to the head administrative judge for the district you're in. [58:06.720 --> 58:09.720] Or therein, whichever way that is. [58:09.720 --> 58:11.720] Okay. [58:11.720 --> 58:22.720] And then make sure you put a copy of that letter with it, that the judge is demanding payment and threatening you with arrest for not paying without ever presenting you an opportunity to have a trial. I made the point that those are just objects under the single subject but of course they don't even understand the constitutional restrictions or limitations of the single subject clause. [01:04:25.720 --> 01:04:36.720] Assuming that they're going to rule against me, I just wanted to call in to kind of rescue and go over what I need to do to defend myself. [01:04:36.720 --> 01:04:40.720] You're going to need to take it on appeal to an actual judicial court. [01:04:40.720 --> 01:04:54.720] Correct. These are the things I brought up. I challenged the subject matter jurisdiction which went right over the top of their head. [01:04:54.720 --> 01:04:57.720] You're in California, right? Correct. [01:04:57.720 --> 01:05:05.720] That's because the person you were being judged by, like I said earlier, was a court clerk. Not somebody who knows what the hell they're doing. [01:05:05.720 --> 01:05:10.720] No, no, correct you. This wasn't even in a court. This was a city police. [01:05:10.720 --> 01:05:20.720] I know. They can send them anywhere they want. They can set them up in a room in a bowling alley. Doesn't matter. The fact is they're not judges. [01:05:20.720 --> 01:05:29.720] They don't know the law. They don't care what the law is. Their entire job is to render of a guilty verdict, no matter what. [01:05:29.720 --> 01:05:37.720] Or in this case, a libel verdict. [01:05:37.720 --> 01:05:53.720] So going forward, I challenged the Bill of Attainer, which does work with some other toll road companies. They dismiss it and whatnot, but this company does not. [01:05:53.720 --> 01:05:59.720] This company also made me pay a deposit to even get to protest. [01:05:59.720 --> 01:06:06.720] No. The company can't make you pay squat to enforce your rights. [01:06:06.720 --> 01:06:15.720] They shouldn't be able to, but they then sent the things, the notices, the fees up to the California State DMB. [01:06:15.720 --> 01:06:22.720] For right now, I'm keeping my car registered until I get better at this to get off of that. [01:06:22.720 --> 01:06:30.720] So that was part of the problem if I couldn't pre-do the registration without paying me some of these fees. [01:06:30.720 --> 01:06:37.720] So you capitulated. [01:06:37.720 --> 01:06:40.720] Yeah, I didn't have a choice. [01:06:40.720 --> 01:06:44.720] Okay. [01:06:44.720 --> 01:06:48.720] But that should be a due process, right? [01:07:28.720 --> 01:07:39.720] But in front of the natural judge, I made the argument that the California vehicle code, based on the couple statutes in it, [01:07:39.720 --> 01:07:45.720] with the intent of the commercial driver license, it says that it's written off of the federal motor carrier safety act. [01:07:45.720 --> 01:07:47.720] Right. Which only deals with commerce. [01:07:47.720 --> 01:07:50.720] Correct. I made that argument. [01:07:50.720 --> 01:07:55.720] But I made it the exact same way in front of the natural judge. [01:07:55.720 --> 01:07:59.720] Yes, but do it in writing and cite the authority upon which you're basing it. [01:07:59.720 --> 01:08:04.720] Okay. [01:08:04.720 --> 01:08:11.720] And then with Title 49, is it good to use the definitions in 390.5? The only time you can go to the federal law is when the state law can be shown to be based upon the federal law, [01:08:26.720 --> 01:08:34.720] and the state law either A, creates a definition that conflicts with the federal law upon which it's based, [01:08:34.720 --> 01:08:42.720] or does not define a term that the federal law does. [01:12:50.720 --> 01:12:59.720] And besides, the camera cannot draw conclusions about what's happening or not happening. [01:12:59.720 --> 01:13:00.720] Okay? [01:13:00.720 --> 01:13:04.720] It can't do that, except, you know, for speed cameras and stuff like that. [01:13:04.720 --> 01:13:09.720] And it can make the allegation, but it can't testify to it. [01:14:28.720 --> 01:14:35.720] So there has to be someone in there, even in the administrative hearing, that can speak to the facts of the matter. [01:21:00.720 --> 01:21:05.720] But the state cannot prove that I was the one in the car or have any knowledge of the car [01:21:05.720 --> 01:21:11.720] entering the toll road at any point of any time. [01:21:11.720 --> 01:21:17.720] Therefore, I object to this prosecution on those grounds based upon this statute unconstitutionally [01:21:17.720 --> 01:21:27.720] declaring me guilty without facts or evidence. [01:21:27.720 --> 01:21:28.720] And it denies me. [01:21:28.720 --> 01:21:36.720] It absolutely denies you in your right to face your accuser, et cetera, et cetera, et cetera. [01:21:36.720 --> 01:21:39.720] The camera cannot be your accuser. [01:21:39.720 --> 01:21:46.720] No one can testify to what the camera saw without it being hearsay because none of them input [01:21:46.720 --> 01:21:48.720] the data the camera got. [01:21:58.720 --> 01:22:03.720] So that would mean the toll company would have to send out an absolute expert on their system [01:22:03.720 --> 01:22:11.720] who could testify about every aspect of it in order to say how their computer wound up with it [01:22:11.720 --> 01:22:24.720] and how he has personal knowledge of what's in that record that he's testifying to, which he doesn't. [01:24:07.720 --> 01:24:17.720] The state statute that you're talking about is unconstitutional, and the state is attempting to expand the application of a federal law beyond that of commerce, [01:24:17.720 --> 01:24:24.720] which is all the federal law within the states can apply to. [01:24:24.720 --> 01:24:28.720] Can you repeat that for me then, the state attempting to expand? [01:24:28.720 --> 01:24:38.720] The federal law to encompass activities other than transportation, which is commerce. [01:24:38.720 --> 01:24:45.720] Federal jurisdiction within the states is limited to the commerce clause or the other enumerated powers, [01:24:45.720 --> 01:24:50.720] and they can't use this law to expand it at the state level, [01:24:50.720 --> 01:24:58.720] not when they're saying that the federal law is controlling and the federal law is what it's based on. [01:26:31.720 --> 01:26:42.720] It was a claim dealing with the discrimination of race, sex, unequal pay, download disparities with a disparate impact. [01:26:42.720 --> 01:26:52.720] And I had within this case a request that the judge recused themselves three different times. [01:26:52.720 --> 01:27:02.720] The court had made an entry of a million dollars, but the judge has denied the evidentiary hearing. [01:27:02.720 --> 01:27:11.720] I requested five different times of evidentiary hearing, which he said I was unable to prove that my case was valued at a million dollars. [01:27:11.720 --> 01:27:16.720] But how am I going to prove it if you're denying me the evidentiary hearing? [01:27:16.720 --> 01:27:20.720] So now I want to take this deal. [01:27:20.720 --> 01:27:30.720] Okay, what have you read in the rules of procedure relating to when and how an evidentiary hearing must be granted? [01:27:30.720 --> 01:27:36.720] Does it support your position on how you're trying to use it? [01:27:36.720 --> 01:27:38.720] Well, I felt it did, yes. [01:27:38.720 --> 01:27:40.720] Well, you felt it did. [01:27:40.720 --> 01:27:44.720] What did you do in writing to show that it did? [01:27:44.720 --> 01:27:47.720] Well, I mean, I wrote request in the hearing. [01:28:09.720 --> 01:28:19.720] And you may have an abusive discretion and an official oppression allegation against the judge. [01:28:19.720 --> 01:28:20.720] Okay. [01:28:20.720 --> 01:28:27.720] So what you can do is you can attempt to appeal the order to a higher court. [01:28:27.720 --> 01:28:33.720] And if you can show that the law actually supports your right to the hearing, then you can file a mandamus. [01:28:33.720 --> 01:28:42.720] Because the rules for the mandamus are there's a couple of things you have to be able to prove and you have to state the language more directly up front. [01:28:42.720 --> 01:28:43.720] Okay. [01:28:43.720 --> 01:28:55.720] And one of the most important of those is the fact that an appeal would not remedy the problem that you're asking the higher court to intercede in. [01:28:55.720 --> 01:29:06.720] And the reason that won't work in your case is you can't get an appeal until you have a case and you can't get a case because you can't get the evidentiary hearing to get the case set. [01:29:06.720 --> 01:29:10.720] So an appeal isn't helping you. [01:29:10.720 --> 01:29:11.720] Right. [01:29:11.720 --> 01:29:21.720] So you're going to file a request for a written mandamus directing the judge to provide a legal reason why you are not entitled to that hearing and to state it plainly. [01:29:21.720 --> 01:29:23.720] Okay. [01:29:23.720 --> 01:29:28.720] That's also called a finding of facts and conclusions of law. [01:29:28.720 --> 01:29:38.720] So the judge has to state the basis for why he's denying your right to an evidentiary hearing to establish whether or not you have a valid case to begin with. [01:36:21.720 --> 01:36:30.720] They have to be using some semblance of their authority that would deprive them of that authority so as to render them personally liable. [01:36:30.720 --> 01:36:32.720] You get it? [01:36:32.720 --> 01:36:40.720] So they start off by saying, I can do this because I'm a judge, I'm a cop, I'm a prosecutor, I'm a whatever. [01:36:40.720 --> 01:36:41.720] Yes. [01:36:41.720 --> 01:36:49.720] So they're using the cover of their official capacity to perpetrate the act that is under color of law. [01:36:49.720 --> 01:36:50.720] Okay. [01:36:50.720 --> 01:36:57.720] Now, as far as the damages, I see where they have it as criminal or civil. [01:36:57.720 --> 01:37:00.720] You can't collect on criminal. [01:37:00.720 --> 01:37:04.720] You can only make the criminal allegation. [01:37:04.720 --> 01:37:05.720] Okay. [01:37:05.720 --> 01:37:12.720] If you witnessed it or you have knowledge of it and believe it to be true, you can file a criminal complaint, [01:37:12.720 --> 01:37:16.720] but you can only get civil damages for whatever they did to you. [01:37:16.720 --> 01:37:20.720] You can't sue them in a criminal capacity. [01:37:20.720 --> 01:37:21.720] Okay then. [01:37:21.720 --> 01:37:22.720] Yes. [01:37:22.720 --> 01:37:32.720] Because I was trying to wonder how was I going to do that when I thought that the plaintiffs can only file in civil as a plaintiff and a defendant, [01:37:32.720 --> 01:37:36.720] but then only as a defendant in a criminal manner. [01:37:38.720 --> 01:37:46.720] Yeah, you can make a criminal allegation against them and couple that with your lawsuit, but you can't use that as a basis of your claim. [01:42:55.720 --> 01:42:59.720] Every state requires an information of some kind. [01:42:59.720 --> 01:43:02.720] Texas requires both a criminal complaint and an information. [01:43:02.720 --> 01:43:06.720] The criminal complaint comes from the person making the allegation. [01:43:06.720 --> 01:43:12.720] The information must be prepared by the prosecutor to augment that complaint so that it states it in the [01:43:12.720 --> 01:43:19.720] required manner in order to provide proper information relating to the elements of states [01:43:19.720 --> 01:43:22.720] required to a legend-proofed trial. [01:43:22.720 --> 01:43:28.720] So the complaint and the information may not read identically in Texas. [01:43:28.720 --> 01:43:34.720] So are you sure that an information is the only thing that they're required to use? [01:57:23.720 --> 01:57:35.720] And he instructed me to go back in and basically reject the offer and return the letter to them and tell them that there was an illegal summit. [01:57:35.720 --> 01:57:43.720] And so I did that and they didn't know what to do with it, but they eventually took it back and they sent me another summons.
