[01:19.800 --> 01:24.600] The list was compiled after an 11-month-long investigation by the Office of the Texas Secretary [01:24.600 --> 01:30.000] of State and the Texas Department of Public Safety which sought to identify non-U.S. citizens [01:30.000 --> 01:33.320] who were registered to vote when obtaining age arbitrage license. [01:33.320 --> 01:37.000] Over half of the 95,000 didn't indeed vote, it seems. [01:37.000 --> 01:41.080] However, further controversy was raised when it became clear that some of the names were [01:41.080 --> 01:45.320] not in fact belonging to those who were non-citizens and registered. [01:45.320 --> 01:50.840] Apparently around 25% of all Latino immigrants become naturalized, gaining the right to vote. [03:55.440 --> 04:06.040] That being said, I would like to take this opportunity to ask, do you want to learn how [04:06.040 --> 04:11.040] this stuff works, what they're doing, what the law is on it and what to do about it? [04:11.040 --> 04:16.040] Now, I'm assuming since you're listening to this show, the answer to that is already yes, [04:16.040 --> 04:20.040] or why else would you be listening to this show? [04:20.040 --> 04:26.040] What I have been trying to do for the past three weeks is get a server set up so that [04:26.040 --> 04:33.040] I could do online classes and streaming directly from where I'm at, and that way I could control [04:33.040 --> 04:38.040] everything about it, including where the recording goes and et cetera, et cetera. [04:38.040 --> 04:43.040] I can get things set up the way I want it to work and go from there. [04:43.040 --> 04:48.040] The problem is I'm not getting a whole lot of cooperation out of the software, the operating [04:48.040 --> 04:53.040] systems, or the hardware from one round to the next. [04:53.040 --> 05:00.040] I finally figured out the installation problem for Linux desktop on these NVMe drive-based [05:00.040 --> 05:05.040] systems, but it did nothing to solve the server installation problem. [05:05.040 --> 05:06.040] No figure. [05:06.040 --> 05:10.040] So much for the concept of Linux is Linux in any form. [05:10.040 --> 05:11.040] It's not. [05:11.040 --> 05:17.040] I can get the desktop versions to install, but I cannot get the server versions to install [05:17.040 --> 05:20.040] on the same computer. [05:20.040 --> 05:22.040] I managed to get a desktop installed. [05:22.040 --> 05:29.040] I managed to get the majority of the software installed that I wanted to have on it as far [05:29.040 --> 05:36.040] as setting up an actual scheduled class and being able to conference into that class with [05:36.040 --> 05:38.040] a little caveat. [05:38.040 --> 05:45.040] I didn't have a way of doing video because Linux does not natively support the web camera [05:45.040 --> 05:48.040] that I have, which is the Logitech C920. [05:48.040 --> 05:50.040] So I did a lot of looking around. [05:50.040 --> 05:57.040] I finally found the tech video that showed me how to get a C920 cooperating nicely with [05:57.040 --> 06:03.040] Linux and not only cooperating, but actually working at its full capacity of 1080p. [06:03.040 --> 06:09.040] Now, it would only do 64 frames per second, or I'm sorry, 24 frames per second, and not [06:09.040 --> 06:18.040] the 60 that is capable of, but at least it worked at 1080p until I installed the software [06:18.040 --> 06:20.040] that was supposed to make that function. [06:20.040 --> 06:28.040] Now, the video only covered version 16.04, not 18.04, which is what I was using. [06:28.040 --> 06:33.040] Now, you would think it would have improved and it would work better or at least the same [06:33.040 --> 06:35.040] between those two versions. [06:35.040 --> 06:37.040] However, it did not. [06:37.040 --> 06:42.040] Installing the same configuration for the camera, everything installed with zero errors. [06:42.040 --> 06:48.040] I got no error messages of any kind when I got everything installed until I rebooted. [06:48.040 --> 06:55.040] And from that point forward, Linux refused to boot at all, dropped to a command line that [06:55.040 --> 07:00.040] never fully reached the command line, and that was as far as it would go. [07:00.040 --> 07:02.040] Now, it wouldn't let me type, wouldn't let me nothing. [07:02.040 --> 07:07.040] It was hung up as much as George Bush on a rocky war. [07:07.040 --> 07:14.040] So that being said, I have now wiped that machine clean yet again, and I'm trying to [07:14.040 --> 07:17.040] find another way of doing this. [07:17.040 --> 07:21.040] So I am in the progress trying to find a way to make this work. [07:21.040 --> 07:22.040] So cross your fingers. [07:22.040 --> 07:25.040] If you've got any information that would help, hey, feel free to email me. [07:25.040 --> 07:27.040] Can't guarantee I haven't tried it. [07:27.040 --> 07:30.040] Can't guarantee I will try it if I'm in the middle of something else. [07:30.040 --> 07:35.040] But hey, any little bit of information that can get me beyond the point of where I'm at [07:35.040 --> 07:38.040] and make this work, great. [07:38.040 --> 07:42.040] Now, where that leaves me is this. [07:42.040 --> 07:47.040] Since it's getting so difficult to set up everything where I can control it from here, [07:47.040 --> 07:54.040] I'm going to be forced to pay for a streaming service that will allow me to do everything [07:54.040 --> 08:00.040] off-site except for the actual sit-down in front of the camera and do the class bit. [08:00.040 --> 08:04.040] Don't want it that way, but that's the way it's going to be. [08:04.040 --> 08:11.040] Fortunately, I've got a secondary streaming box set up so that I can actually local record [08:11.040 --> 08:16.040] the entire session as it's going out, the white boarding everything. [08:16.040 --> 08:23.040] And I have managed to make it where I can use big blue button through a web browser [08:23.040 --> 08:26.040] so everyone can access the class and everything else. [08:26.040 --> 08:32.040] My biggest problem, though, is still finding a way to properly authenticate users [08:32.040 --> 08:34.040] who have actually paid for the class. [08:34.040 --> 08:37.040] That's the secondary issue that I'm in the middle of trying to work. [08:37.040 --> 08:44.040] While the service will allow me to do that, there's no way for me to prevent the person [08:44.040 --> 08:52.040] who logs into the class from sharing the link they paid for so that other people can log into it as well [08:52.040 --> 08:57.040] unless the streaming service is the only link that I share. [08:57.040 --> 09:02.040] But if I do it that way, then that means one bit of a problem, [09:02.040 --> 09:05.040] and that is that it's not an interactive class. [09:05.040 --> 09:07.040] You're only looking at a stream. [09:07.040 --> 09:12.040] There is no live participation, which is how I want this class to operate. [09:12.040 --> 09:16.040] That's the reason for looking at big blue button in the first place, [09:16.040 --> 09:23.040] because it is designed as an open source, distance learning, and conferencing software. [09:23.040 --> 09:27.040] That's exactly what it does from the ground up. [09:27.040 --> 09:31.040] I had that installed on this system before it ate its lunch, [09:31.040 --> 09:35.040] and it was working just fine as far as all that was going. [09:35.040 --> 09:38.040] All I had left to do was to get it connected to the outside world, [09:38.040 --> 09:43.040] and you could have come in and done it, except I would not have had any video [09:43.040 --> 09:48.040] because Linux didn't support the webcam, and it's the only camera I've got. [09:48.040 --> 09:55.040] That being said, those are my difficulties for the last three weeks in trying to get this up and running. [09:55.040 --> 09:58.040] Needless to say, it's not going to work the way I want it. [09:58.040 --> 10:03.040] I need someone that knows Linux a lot better than me to help me figure this out. [10:03.040 --> 10:12.040] I'm not a total ignoramus in it, but I am by no means as well versed in Linux as I am in Windows and DOS [10:12.040 --> 10:14.040] and programming on that side of things. [10:14.040 --> 10:18.040] I just don't know enough about Linux to do myself any good that way. [10:18.040 --> 10:26.040] That being said, I will now move on to the other stuff that we're going to be doing with that class [10:26.040 --> 10:35.040] and try to find out, at least via email at the moment, how many of you that are out there listening would be willing to participate. [10:35.040 --> 10:43.040] I'm going to try to make the classes as economical as possible and still make enough to pay for the cost of doing them in the first place [10:43.040 --> 10:45.040] and to eat while I'm doing them. [10:45.040 --> 10:50.040] That being said, I don't know exactly what they're going to cost yet, [10:50.040 --> 10:56.040] but I'm looking at two sessions a week, two hours a session, [10:56.040 --> 11:02.040] and it will be dedicated to straight up study and discussion. [11:02.040 --> 11:12.040] It will not be there for debate as far as how we do things, the procedure for doing things, et cetera, et cetera, and patron up mythology. [11:12.040 --> 11:15.040] That will not be a part of this class. [11:15.040 --> 11:20.040] And the first time that someone interrupts the class to start throwing it out there, [11:20.040 --> 11:24.040] that person will no longer be participating in that class or any other. [11:24.040 --> 11:33.040] This is meant to teach and for you to learn so that they will stop being able to steal from us wholesale. Just to let me know so I can get some idea of how many people out there would be interested [11:49.040 --> 11:56.040] in spending four hours out of their week learning how to do things the correct way [11:56.040 --> 12:00.040] and actually doing something that stands a chance of being successful. [12:00.040 --> 12:05.040] And what to do about it long term when the lower courts, which they're prone to do, [12:05.040 --> 12:09.040] ignores everything and tries to walk all over you and your right to do process. [12:09.040 --> 12:13.040] Where this is going to be a wholesale class. It's not going to all be done in one shot, [12:13.040 --> 12:20.040] but we are going to start from the very beginning and we are going to build on each part of the code of criminal procedure [12:20.040 --> 12:23.040] and everything else from the very get go. [12:23.040 --> 12:27.040] The first thing I'm going to do is sit down and talk to you about the rules of statutory construction. [12:27.040 --> 12:30.040] That much, I already know exactly what the first class is going to be. [12:30.040 --> 12:35.040] It is all about the rules of statutory construction and interpretation. [12:35.040 --> 12:42.040] I'm going to teach you what the courts are doing, which is absolutely unconstitutional by their own admission [12:42.040 --> 12:46.040] as to how the rules of interpretation are supposed to work. [12:46.040 --> 12:53.040] They admit in opinion after opinion after opinion that they are putting in stuff that is not in the law [12:53.040 --> 13:02.040] if they think that they can determine through some manner of seance what the legislature intended when they wrote a statute. [13:02.040 --> 13:06.040] Now that right there is absolutely unconstitutional on its face. [13:06.040 --> 13:13.040] It's exactly one of the reasons why they had to kill our Chief Justice [13:13.040 --> 13:25.040] because his manner of construction, statutory construction was constitutionally based in that the courts have no power [13:25.040 --> 13:36.040] to determine the intent of the legislature regarding a statute by any means other than the words used in that statute. [13:36.040 --> 13:43.040] And yet I went through a ton of court opinions today where all they talk about here in Texas [13:43.040 --> 13:49.040] is how they will create a definition or meaning for a word even if the law does not address it [13:49.040 --> 13:58.040] if they can infer that it's usable that way from how the legislature used it in the context of the statute. [13:58.040 --> 14:03.040] There's nothing in the rules of statutory construction that allows them to do that. [14:03.040 --> 14:09.040] They're required to interpret the language according to its proper common definition if the statute doesn't have one [14:09.040 --> 14:16.040] and in these opinions they were saying straight up that they were more than willing to give it an other than common definition [14:16.040 --> 14:24.040] if they can infer what they think the legislature wanted by doing it the way they did it. [14:24.040 --> 14:27.040] So right there the courts are admitting, especially the Texas courts, [14:27.040 --> 14:31.040] that they have gone completely off the reservation and robed. [14:31.040 --> 14:33.040] They're going to do what they want. [14:33.040 --> 14:40.040] This is exactly why the founding fathers despised attorneys. [14:40.040 --> 14:44.040] This is why the founding fathers didn't like attorneys in general. [14:44.040 --> 14:49.040] Even though many of them were well versed in the law and were themselves attorneys, [14:49.040 --> 14:52.040] they did not practice as such. [14:52.040 --> 14:59.040] Why? Because they didn't like the profession. [14:59.040 --> 15:08.040] If ever there was a profession that deserved to be celebrated each and every year by tarring, feathering, [15:08.040 --> 15:14.040] and riding every member out of town on a rail, it is the legal profession. [15:14.040 --> 15:17.040] And if that didn't convince them to find a new community to live in, [15:17.040 --> 15:24.040] then finding them and burying them in a culvert somewhere would work just as well in my book. [15:24.040 --> 15:31.040] This entire country has gone to hell in a handbasket and if you look hard enough and straight enough at everything that's happened [15:31.040 --> 15:38.040] and every event that's taken place, you will find the attorneys responsible. [15:38.040 --> 15:40.040] The courts have done it. [15:40.040 --> 15:42.040] The prosecutors have done it. [15:42.040 --> 15:44.040] The defense attorneys have done it. [15:44.040 --> 15:49.040] They have all worked hand in hand to undermine every aspect of the Constitution [15:49.040 --> 15:53.040] and the limitations on government that we the people gave them [15:53.040 --> 16:04.040] in order to run their own agenda of controlling everything through a single department of government, i.e. the courts. [16:04.040 --> 16:09.040] If they control the meaning of the law, the procedures for the law, [16:09.040 --> 16:17.040] and the means of obtaining remedy within the law and interpret it to suit the outcome they want, [16:17.040 --> 16:24.040] how does that limit them in any way in what they can do? [16:24.040 --> 16:28.040] Short answer is, it does not. [16:28.040 --> 16:40.040] And you are living in a world of very visible evidence to that fact if you just bother to look. [16:40.040 --> 16:42.040] The Queen of England is not doing this. [16:42.040 --> 16:44.040] The Pope is not doing this. [16:44.040 --> 16:46.040] The Vatican is not doing this. [16:46.040 --> 16:48.040] The certificate is not doing this. [16:48.040 --> 16:54.040] The MSO or MCO for your car is not doing this. [16:54.040 --> 16:56.040] People are doing this. [20:30.040 --> 20:56.040] And folks, you are looking at the result of allowing that entity, which is non-governmental in any way, from not only creating a branch of government that it controls, but it has disenfranchised you and I from having any power in an entire department of our own government, period. [20:56.040 --> 21:03.040] The people cannot participate in the judiciary at all. [21:03.040 --> 21:11.040] It is limited strictly to these people that have managed to take it over and disenfranchise the rest of us. [21:11.040 --> 21:18.040] And they now control every aspect of every department of government by having done so. [21:18.040 --> 21:35.040] And they do it all in violation of the separation of powers, they do it in violation upon constitutional limitations upon their authority, they do it in violation of the very law they say you and I must follow. [21:35.040 --> 21:57.040] Now I know this, I've studied it, I've been in it, I'm involved in it, I know for a fact this is how this is all working out and can show you and have shown you via specific documentation verifiable facts and law that's written right into the Constitution, the statute to the state of Texas and how the Bar Associations and Cells operate. [21:57.040 --> 22:12.040] They're doing it right out in the open, but by taking the ability of the American people to understand their Constitution and the limits of government that we're supposed to be familiar with and knowledgeable of and able to protect, we've gotten so slow and stupid they've gotten away with it. [23:30.040 --> 23:42.040] There was one female judge here in the state that declared that the common law has always recognized property taxes on private property and the woman is absolutely brain dead and full of crap. [23:42.040 --> 23:45.040] It has never done any such thing. [23:45.040 --> 23:50.040] What you need to do is research the history of the Texas Constitution. [23:50.040 --> 24:09.040] The original 1824 Texas Constitution in the Bill of Rights specifically stated that no man could be deprived of his property or his property taken or sold or his property taxed without his express consent. [24:09.040 --> 24:10.040] Okay. [24:10.040 --> 24:16.040] Now, that was never something that anyone could vote out of the Bill of Rights. [24:16.040 --> 24:22.040] It doesn't matter how they amend the Bill of Rights, that's a right that predates that Constitution. [24:22.040 --> 24:26.040] That's a right that predates any Constitution. [24:26.040 --> 24:27.040] What's mine is mine. [24:27.040 --> 24:30.040] It's never yours, right? [24:30.040 --> 24:31.040] Right. [24:31.040 --> 24:43.040] So, since the Bill of Rights is not what gives us those rights, but what tells government they may never touch those rights, [24:43.040 --> 24:51.040] then how does the fact that someone rewrote the Bill of Rights to leave it out expressly alter the fact that it exists? [24:51.040 --> 24:53.040] It doesn't, right? [24:53.040 --> 24:54.040] Right. [24:54.040 --> 24:55.040] Okay. [24:55.040 --> 25:07.040] So, now if I do the research, I'm going to find the Bill of Rights in the original Constitution for Texas. [25:07.040 --> 25:10.040] Do I give that as judicial notice? [25:10.040 --> 25:14.040] You can give anything as judicial notice, but here's the thing. [25:14.040 --> 25:19.040] After the Civil War, Texas was put under a Reformation Constitution. [25:19.040 --> 25:26.040] The Constitution that is in effect right now was not enacted and voted upon by the people of Texas, period. [25:26.040 --> 25:29.040] It's not our Constitution. [25:29.040 --> 25:38.040] It was put in place by the Northern States people that they put in charge over the Southern States after the Civil War. [25:38.040 --> 25:40.040] Under a state of emergency? [25:40.040 --> 25:47.040] Well, at that time it was, but it's still a Reformation Constitution that the people of Texas never voted on. [25:47.040 --> 25:48.040] Okay. [25:48.040 --> 25:51.040] So, when the emergency was over, when did that stop? [25:51.040 --> 25:53.040] It's never been over. [25:53.040 --> 25:56.040] That's the point. [25:56.040 --> 26:03.040] Texas has never had an independent government from the Northern States since the Civil War, even though that's what they tell us, [26:03.040 --> 26:08.040] because we're still under the same Constitution that we were then. [26:08.040 --> 26:14.040] Well, actually we're under a second one, but it also was not voted on by the people of Texas. [26:14.040 --> 26:20.040] The 1864 and then the 1870, something or other, I forget which year exactly it is. [26:20.040 --> 26:23.040] But the one we're under right now is the 1870 something. [26:23.040 --> 26:26.040] So, how do I bind them up in this pilot court? [26:26.040 --> 26:30.040] Well, you must have missed the first part of my diet drive on here, [26:30.040 --> 26:34.040] because the people that I'm talking about are the ones that are going to control your ability to do that, [26:34.040 --> 26:38.040] and they're the ones responsible for making it the way it is now. [26:38.040 --> 26:39.040] Okay. [26:39.040 --> 26:45.040] So, I want to negotiate a lower, if I get the patent anyway, because I don't want to get that in sign. [26:45.040 --> 26:46.040] Well, see, here's the thing. [26:46.040 --> 26:51.040] If you get the land patent, stop trying to enforce it in Texas courts. [26:51.040 --> 26:53.040] Go straight to the federal courts. [26:53.040 --> 26:54.040] Why? [26:54.040 --> 27:00.040] Because this is an issue between the state and one of its people. [27:00.040 --> 27:01.040] Okay? [27:01.040 --> 27:02.040] All right. [27:02.040 --> 27:08.040] Whereas the state is in direct violation of the contracts clause, [27:08.040 --> 27:13.040] both under the Texas Constitution and the federal Constitution, [27:13.040 --> 27:22.040] because the land patents in Texas are 100% ironclad contracts between the state of Texas [27:22.040 --> 27:27.040] and the new landowner once that property was transferred under that patent. [27:27.040 --> 27:38.040] The state of Texas, right there in the language, says that they forever relinquish any claims or rights to that property. [27:38.040 --> 27:42.040] If they have no rights or claims, they have no power to tax. [27:42.040 --> 27:45.040] That's the end of it. [27:45.040 --> 27:46.040] Okay. [27:46.040 --> 27:51.040] So, they're using prima facie that someone abandoned the patent, or what are they doing? [27:51.040 --> 27:57.040] As long as you are submitting any paperwork other than a patent in your name, [27:57.040 --> 28:00.040] you are not an heir or a sign to that land. [28:00.040 --> 28:04.040] And as such, you do not have a claim that will allow you to win. [28:04.040 --> 28:06.040] You're a tenant. [28:06.040 --> 28:08.040] And tenants pay rent. [28:08.040 --> 28:09.040] I know. [28:09.040 --> 28:13.040] But they must be using prima facie evidence of abandonment of someone. [28:13.040 --> 28:16.040] They're not using prima facie anything. [28:16.040 --> 28:19.040] They are simply declaring that that's the way it is. [28:19.040 --> 28:30.040] And not in a single case in Texas has anyone shown me a case where anybody with a land patent has bothered to argue breach of contract. [28:30.040 --> 28:31.040] Okay. [28:31.040 --> 28:37.040] And violation of constitutionally protected rights by the state's attempt to breach that contract, [28:37.040 --> 28:45.040] because the state is forbidden in the Bill of Rights from ever violating the Bill of Rights. [28:45.040 --> 28:52.040] And in there, one clause very specifically says that they may not impair the obligations of contracts. [28:52.040 --> 29:00.040] Well, they're impairing the obligation of the contract to transfer that properly wholly and completely to an individual [29:00.040 --> 29:06.040] and relinquish all rights and claims the moment they turn around and try to levy a tax on it. [29:06.040 --> 29:11.040] They are interfering with the bill to that contract to function as intended. [29:11.040 --> 29:18.040] If we stay them off, if we pay the taxes or a portion of the taxes, [29:18.040 --> 29:24.040] do we lose all the rights to get that money back if we win? [29:24.040 --> 29:25.040] Probably. [29:25.040 --> 29:29.040] The way the case law is currently set up, probably. [29:29.040 --> 29:30.040] Okay. [29:30.040 --> 29:38.040] So I'm going to advise that we go straight to federal court and get an injunction for the appellate. [29:38.040 --> 29:42.040] Very seriously, if you're going to get the federal court to grant an injunction, [29:42.040 --> 29:50.040] you're going to have to file a full-blown lawsuit not only for injunctive relief but a permanent injunction [29:50.040 --> 29:58.040] that the state of Texas cannot tax any property for which a land patent has been carried forward in the current owner's name. [29:58.040 --> 30:02.040] Will that stop the process and the state? [30:02.040 --> 30:03.040] Pressure. [34:17.040 --> 34:21.040] Well, one, they're not going to want to do it. [34:21.040 --> 34:25.040] They're going to try to tell you that they don't do that or don't do that anymore. [34:25.040 --> 34:29.040] The problem is that's what they were set up to do. [34:29.040 --> 34:34.040] It is their actual job. [34:34.040 --> 34:35.040] Okay. [34:35.040 --> 34:36.040] Recursionage? [34:36.040 --> 34:47.040] Well, if they won't do their job, then what you're going to need is a copy of the land patent from the owner from whom you got the property, and it has to be in their name. [34:47.040 --> 35:01.040] And if it's not, then it needs to go back as far as you can to someone who may still be living that has a copy of it in their name, or at least a copy in someone's name that shows that it matches the parcel that you currently own. [35:01.040 --> 35:13.040] And a bill of sale and whatever other documentation you need to show that money changed hands, consideration was given, and that the property is now rightfully yours by default. [35:13.040 --> 35:31.040] Then you're going to have to sue not only the state of Texas, but the Bureau of Land Management, all its officers, and criminal conspiracy-wise and everything else in order to implement not only breach of contract, but an unlawful taking of private property, [35:31.040 --> 35:37.040] not only the land itself, but your money in the form of taxes. [35:37.040 --> 35:38.040] Okay. [35:38.040 --> 35:50.040] So if we do pay the taxes, or part of the taxes, whatever, we're never going to get that back, but we can stave off them for the next lifetime if we can get this done. [35:50.040 --> 35:51.040] Maybe. [35:51.040 --> 36:01.040] So I'm going to search land patent office for the previous patent holder. [36:01.040 --> 36:04.040] Now, can I do that on the Internet, or do I have to go down? [36:04.040 --> 36:06.040] I have no idea. [36:06.040 --> 36:09.040] I have no idea what the resources are that are available to do it. [36:09.040 --> 36:19.040] I am pretty sure that they would have gone out of their way to make it very difficult to do if they're willing to tell you to your face that they're not going to do their job. [36:19.040 --> 36:27.040] So I doubt very seriously if they've given you some simplified online method to do the very thing they're refusing to do in person. [36:27.040 --> 36:28.040] Okay. [36:28.040 --> 36:32.040] So I just got to record them while I'm there. [36:32.040 --> 36:33.040] No, no, no. [36:33.040 --> 36:34.040] Listen carefully. [36:34.040 --> 36:36.040] Go in and talk to them till you're blue in the face. [36:36.040 --> 36:38.040] You can record it all you want to. [36:42.040 --> 36:51.040] So anything they tell you they can or cannot provide to you, tell them you want that response or that thing in writing. [36:57.040 --> 37:00.040] They can't refuse it if you go about it the right way. [37:00.040 --> 37:21.040] For instance, file a public information request requesting copies of all Bureau of Land Management policy and procedures that state no Bureau of Land Management employee may provide services relating to the carrying forward of land patents to new heirs and assigns of a piece of property. [37:21.040 --> 37:23.040] Okay. [37:23.040 --> 37:30.040] And now I go in there and I tell them I'm an assigned and I have to check. [37:30.040 --> 37:38.040] So please give me the patent information on this parcel. [37:38.040 --> 37:43.040] Like I said, you can file anything you want to ask for a copy of the patent or anything else. [37:43.040 --> 37:49.040] But the fact is they can look up and tell you who the patent holder is on it originally. [37:49.040 --> 37:52.040] But the question is, will they? [37:52.040 --> 37:53.040] Okay. [37:53.040 --> 37:54.040] And I got it. [37:54.040 --> 37:55.040] Okay. [37:55.040 --> 37:56.040] So I got you. [37:56.040 --> 38:01.040] And whatever I miss, I'm just going to look at the archive and see what I missed. [38:01.040 --> 38:08.040] But the thing is, what happened was they're so criminal here. [38:08.040 --> 38:23.040] They sent a registered certified notice to appear without any card. [38:23.040 --> 38:28.040] They sent the envelope but the card torn off through the mail. [38:28.040 --> 38:31.040] And the guy wasn't even in town. [38:31.040 --> 38:37.040] And so the court date passed and now he has to go to appeals now. [38:37.040 --> 38:39.040] And the court date for what? [38:39.040 --> 38:41.040] For the original hearing. [38:41.040 --> 38:45.040] So what they don't have then is a signature saying that they delivered it. [38:45.040 --> 38:47.040] And that's what I said. [38:47.040 --> 38:53.040] We got to go to the postmaster and get that yellow piece of paper with the same number on it. [38:53.040 --> 38:55.040] Well, you can go to the court and get it. [38:55.040 --> 39:00.040] Go to the court and say in this case right here because all court cases are public. [39:00.040 --> 39:02.040] They're 100% public. [39:02.040 --> 39:03.040] Okay. [39:03.040 --> 39:04.040] All right. [39:04.040 --> 39:09.040] Under the court say I want to see the case file relating to this case right here. [39:09.040 --> 39:12.040] And then you get to see everything that's in that folder. [39:12.040 --> 39:22.040] There should be a piece of paper in there that someone signed saying that they certify under penalty of perjury that the opposing party was served. [39:22.040 --> 39:28.040] When they were served, how they were served and that they got the return receipt with the signature showing it was served. [39:28.040 --> 39:30.040] And then you've got a copy of it right there. [39:30.040 --> 39:37.040] You've also got all the other paperwork that shows somebody lied. [39:37.040 --> 39:38.040] You get it? [39:38.040 --> 39:41.040] And then my recourse is what? [39:41.040 --> 39:43.040] File charges. [39:43.040 --> 39:44.040] That's a crime. [39:44.040 --> 39:46.040] It's tampering with a government record. [39:46.040 --> 39:49.040] It is falsifying a government record. [39:49.040 --> 39:55.040] It is making false statements and suborning perjury. [39:55.040 --> 39:58.040] All of those are crimes. [39:58.040 --> 40:03.040] And how do I, who do I press that against the court or the officers? [40:03.040 --> 40:11.040] Whoever's name is on the documents has said they did all this. [40:11.040 --> 40:13.040] Maybe, what if they force him? [40:13.040 --> 40:17.040] It will most likely be some attorney. [40:17.040 --> 40:19.040] Okay. [40:19.040 --> 40:20.040] Okay, so. [40:20.040 --> 40:26.040] And then you file charges with the grand jury against whoever it was. [40:26.040 --> 40:32.040] Whether it be a judge, whether it be an attorney, whether it be a county attorney, a prosecutor, whatever, doesn't matter. [40:32.040 --> 40:36.040] Whoever's name is on that just committed fraud. [40:36.040 --> 40:38.040] They committed aggravated perjury. [40:38.040 --> 40:40.040] They defrauded the court. [40:40.040 --> 40:44.040] They tampered with a record and they falsified a record. [40:44.040 --> 40:46.040] All of those are crimes. [40:46.040 --> 40:47.040] Right. [40:47.040 --> 40:49.040] Okay, I know how to run the routine. [40:49.040 --> 40:54.040] But should I run the routine or should I try to? [55:00.040 --> 55:08.040] The judge is knowingly and willfully violated the laws associated with the duties of her office in an effort to undermine the laws of the state of Texas. [01:20:23.040 --> 01:20:30.040] We're talking about the secured creditor, and a secured creditor would actually be the [01:20:30.040 --> 01:20:34.040] one that would actually be the one that held the note per se. [01:20:34.040 --> 01:20:35.040] Right. [01:20:35.040 --> 01:20:40.540] And so, this loan servicing company has filed that they are actually the secured creditor [01:20:40.540 --> 01:20:43.040] when they are just the debt collector. [01:20:43.040 --> 01:20:46.040] So, in all reality, they cannot be a secured creditor. [01:20:46.040 --> 01:20:47.040] Right. [01:20:47.040 --> 01:20:51.040] So, I'm doing this case pro se. [01:20:51.040 --> 01:20:56.040] And in December, I sent the servicing company a letter and a disclosure statement requesting [01:20:56.040 --> 01:21:00.040] information in regards to this alleged debt. [01:21:00.040 --> 01:21:05.040] And, of course, the servicing company had the course to file, was to give me the information [01:21:05.040 --> 01:21:07.040] with a 10-day rule to validate. [01:21:07.040 --> 01:21:14.040] Now, are you talking about something that you did under the FDCPA? [01:21:14.040 --> 01:21:20.040] Or are you talking about something that you've done that is specific to mortgage in general? [01:21:20.040 --> 01:21:23.040] This is specific for the servicing company. [01:21:23.040 --> 01:21:25.040] Yeah, I understand who is direct to that. [01:21:25.040 --> 01:21:31.040] What I'm asking you is, is where did you get the authority to send what you sent to get [01:21:31.040 --> 01:21:33.040] the information from them? [01:21:33.040 --> 01:21:38.040] Is it something under the Fair Debt Collection Practices Act at the federal level, or is [01:21:38.040 --> 01:21:42.040] it something to do with mortgages at the federal level? [01:21:42.040 --> 01:21:48.040] It has to do with mortgages and with the Fair Debt Collection Act. [01:21:48.040 --> 01:21:49.040] Okay. [01:22:07.040 --> 01:22:12.040] And so I sent a copy of the letter, or I submitted the copy of the letter disclosure statement [01:22:12.040 --> 01:22:18.040] along with the motion to the judge to request extension of time to file a Chapter 13 bankruptcy [01:22:18.040 --> 01:22:22.040] plan, because I needed to have this information. [01:22:22.040 --> 01:22:28.040] And so the judge denied my request, and he scolded me for even writing and sending the [01:22:28.040 --> 01:22:35.040] letter calling it nonsensical, frivolous, other kind of adjectives, denied me my due process. [01:22:35.040 --> 01:22:37.040] Is this a federal or state judge? [01:22:37.040 --> 01:22:39.040] This is a federal judge. [01:22:39.040 --> 01:22:44.040] This is in the bankruptcy court here in the district of Montana. [01:22:44.040 --> 01:22:45.040] Okay. [01:22:45.040 --> 01:22:52.040] And so in my first confirmation hearing, he acted as prosecutor, judge, and jury. [01:22:52.040 --> 01:22:55.040] He didn't even let the attorney ask any questions. [01:22:55.040 --> 01:23:02.040] He told them for the attorney, basically, and tried to humiliate me, intimidate me at [01:23:02.040 --> 01:23:03.040] the hearing. [01:23:03.040 --> 01:23:06.040] So I have a friend who did some research. [01:23:06.040 --> 01:23:11.040] We found my bankruptcy case with me and traded on Wall Street, Wall Street, and had a CUSP [01:23:11.040 --> 01:23:12.040] number. [01:23:12.040 --> 01:23:18.040] And so I submitted a judicial notice with a CUSP number for my bankruptcy case, and this [01:23:18.040 --> 01:23:19.040] number was attached. [01:23:19.040 --> 01:23:21.040] Are you talking about the CUSP number? [01:23:21.040 --> 01:23:23.040] Yeah, the CUSP number. [01:23:23.040 --> 01:23:24.040] Okay. [01:23:24.040 --> 01:23:29.040] And the judge ruled against and denied that judicial notice, although I'm told he's not [01:23:29.040 --> 01:23:32.040] allowed to do that. [01:23:32.040 --> 01:23:37.040] And then I submitted a motion to compel the alleged predator to submit the requested document [01:23:37.040 --> 01:23:43.040] along with my objection to the loan servicing company's motion to modify this day. [01:23:43.040 --> 01:23:49.040] And so the judge then scheduled a hearing for both of these motions in February. [01:23:49.040 --> 01:23:56.040] And so then I filed a mandatory judicial notice of evidence and a judicial petition for judicial [01:23:56.040 --> 01:24:03.040] disclosure with a judge prior to this hearing on February 11th along with my objection to [01:24:03.040 --> 01:24:05.040] the creditors' proof of claim. [01:24:05.040 --> 01:24:11.040] So he's now ruled against the mandatory judicial notice of evidence and a judicial petition [01:24:11.040 --> 01:24:13.040] for judicial disclosure. [01:24:13.040 --> 01:24:19.040] He addressed those both at the court hearing, and he told me he never heard of a CUSP number. [01:24:19.040 --> 01:24:25.040] And until I could give him a law or a rule in regards to this, he was not going to answer [01:24:25.040 --> 01:24:27.040] this petition for judicial disclosure. [01:24:27.040 --> 01:24:28.040] Okay. [01:24:28.040 --> 01:24:32.040] Well, then start with a judicial conduct complaint to his superiors. [01:24:32.040 --> 01:24:33.040] Okay. [01:24:33.040 --> 01:24:39.040] File a motion to disqualify for judicial incompetency. [01:24:39.040 --> 01:24:45.040] If you've actually provided controlling opinions that supersede this judge's authority, they're [01:24:45.040 --> 01:24:50.040] required to abide by them if the facts of the case match up. [01:24:50.040 --> 01:24:55.040] And if he's refusing to do that and ignoring it, plus refusing to be fair and impartial [01:24:55.040 --> 01:24:59.040] and conduct fair proceedings, which is what it sounds like you're saying he's doing, [01:24:59.040 --> 01:25:03.040] okay, then that's not a judge you want sitting. [01:25:03.040 --> 01:25:05.040] What you want is to get rid of him. [01:25:05.040 --> 01:25:10.040] And the way to get rid of him is to bring up inquiry into his behavior. [01:25:10.040 --> 01:25:15.040] The fact that he tried to humiliate you is a direct violation of the judicial canons. [01:25:15.040 --> 01:25:16.040] Okay? [01:25:16.040 --> 01:25:17.040] Okay. [01:26:54.040 --> 01:26:59.040] So the lady took a point of substance that I was vacated out of the premises. [01:26:59.040 --> 01:27:04.040] And I'm like, no, I said, I've been in and out of my house over the last several years, [01:27:04.040 --> 01:27:07.040] but I keep my house because I ended up coming back to it. [01:27:07.040 --> 01:27:13.040] So the next thing I know, I get a complaint against me but you get your property co-violation. [01:27:13.040 --> 01:27:16.040] They went back, what was it? [01:27:16.040 --> 01:27:20.040] Four hundred and forty-three days charge me five hundred dollars a day. [01:27:20.040 --> 01:27:22.040] And I ended up missing and wanted to hear it. [01:27:22.040 --> 01:27:26.040] I didn't get a notice in the first place to appear for an argument. [01:27:26.040 --> 01:27:32.040] And then I ended up appealing that, took it to the court, kind of inch and blow out on me on the way to court, [01:27:32.040 --> 01:27:34.040] and now I have to try to appeal that. [01:27:34.040 --> 01:27:41.040] So I don't know what procedures are, where do I go, how to go back, how to appeal to get to accept that matter we heard. [01:27:41.040 --> 01:27:48.040] Well, what you're telling me is that they made an administrative ruling against you without proper notice or anything else, [01:27:48.040 --> 01:27:50.040] which they cannot do. [01:27:50.040 --> 01:27:56.040] So you just need to file a petition for re-hearing as well. [01:34:47.040 --> 01:34:57.040] First one is a motion demanding a re-hearing of the case for failure to provide proper sufficient and timely notice to the accused. [01:34:57.040 --> 01:35:01.040] Okay, an improper service. [01:35:01.040 --> 01:35:11.040] Second, immediately file a motion to dismiss once they schedule it, and you're going to dismiss for lack of jurisdiction. [01:35:11.040 --> 01:35:24.040] Okay, there is no conflict before the court, as the state constitution specifically prohibits municipalities from creating binding public law. [01:35:24.040 --> 01:35:34.040] As such, city ordinances may not be used as binding public law, and therefore have no force and effect over private individuals or their property, [01:35:34.040 --> 01:35:43.040] regardless of their location, either within or without the territorial boundaries of said municipality. [01:35:43.040 --> 01:35:48.040] And that was something that someone else did, but he went through it about a different way. [01:35:48.040 --> 01:35:54.040] He basically said the same thing, because he was telling me something about territorial property jurisdiction. [01:35:54.040 --> 01:36:01.040] Well, the territory itself is not what deprives them of jurisdiction. It is the state constitution. [01:36:01.040 --> 01:36:09.040] Every state authorizes the legislature and only the state legislature to make binding public law. [01:36:09.040 --> 01:36:13.040] The legislature cannot delegate that power. [01:36:13.040 --> 01:36:21.040] Therefore, they cannot give it to a county or municipality to create binding public law on their own. [01:36:21.040 --> 01:36:23.040] Okay, binding public law. [01:36:23.040 --> 01:36:32.040] So, binding public law cannot be written or enacted by a city council. End of story. [01:36:32.040 --> 01:36:39.040] To do so is a violation of the constitution's delegation of powers. [01:36:39.040 --> 01:36:45.040] Okay, I heard that similar story. I know exactly what you're saying, not because that's what a gentleman was coming on. [01:36:45.040 --> 01:36:53.040] He was talking to me about powers of public offices, and he was saying what you was basically saying. [01:36:53.040 --> 01:36:58.040] Municipal cannot come after me in the way that it comes. Only the legislature, which is what you're saying, [01:36:58.040 --> 01:37:01.040] and that cannot be delegated at the bottom for them to do this. [01:37:01.040 --> 01:37:03.040] Well, here's the deal. [01:37:03.040 --> 01:37:10.040] Here in Texas, our Constitution forbids our legislature from making local law, period. [01:37:10.040 --> 01:37:18.040] It even gives a specific list in Article III, Section 56 of all the things the legislature is forbidden to write laws about. [01:37:18.040 --> 01:37:20.040] Okay? [01:37:20.040 --> 01:37:27.040] So, if the legislature can't write the law, then it cannot give someone else the power to write it either. [01:37:27.040 --> 01:37:32.040] And since the Constitution says only the legislature has the power to make law, [01:37:32.040 --> 01:37:36.040] then the legislature can't delegate it to someone else either. [01:37:36.040 --> 01:37:37.040] Get it? [01:37:37.040 --> 01:37:39.040] That's right. Right, I got that. I got it. [01:37:39.040 --> 01:37:46.040] All right, so all you need is to do what your Constitution says in that regard in making your argument. [01:37:46.040 --> 01:37:50.040] Okay, so when I go to my Constitution, I look up, again, do I look up to delegates? [01:37:50.040 --> 01:37:56.040] You look under whatever article or title deals with legislative power. [01:37:56.040 --> 01:38:00.040] Whatever it is in your state. Here it's Article III. [01:39:10.040 --> 01:39:12.040] So then he decided to ask me for my key and I wouldn't. [01:39:12.040 --> 01:39:14.040] I kept my window rolled up. [01:39:14.040 --> 01:39:15.040] I did not get out of my car. [01:39:15.040 --> 01:39:18.040] He threatened to break my window with a hammer. [01:39:18.040 --> 01:39:23.040] And then I told him, I said, will you be sitting here with that mallet? [01:39:23.040 --> 01:39:25.040] I told him, I said, in reference, don't be me and you. [01:39:25.040 --> 01:39:29.040] And so then he backed up car for back about six cars came. [01:39:29.040 --> 01:39:36.040] And so from that point on, he wrote up a bunch of tickets because I made a left turn with no cars with telephone blocks. [01:39:36.040 --> 01:39:42.040] And it was like a 50 foot run over the middle of the fire that I mean to the traffic going direct someone to go. [01:39:42.040 --> 01:39:45.040] So he put on a no stinkers going down the wrong way. [01:39:45.040 --> 01:39:47.040] I wouldn't get wouldn't wouldn't cooperate. [01:39:47.040 --> 01:39:49.040] I wrote up there. [01:39:49.040 --> 01:39:51.040] No tabs on my car. [01:39:51.040 --> 01:39:53.040] No license, no registration, all of that. [01:39:53.040 --> 01:39:56.040] So I got about 18 amount of tickets. [01:39:56.040 --> 01:40:02.040] So now I'm having to go to court because you sent me that thing and the thing about that there's no license. [01:40:02.040 --> 01:40:04.040] Motion to suppress. [01:40:04.040 --> 01:40:07.040] Everything is a result of an illegal stop. [01:40:07.040 --> 01:40:09.040] Civil infraction, remember? [01:40:09.040 --> 01:40:10.040] Yes. [01:40:11.040 --> 01:40:22.040] The officer has no authority without probable cause to detain you, much less arrest you, much less use force against you, [01:40:22.040 --> 01:40:25.040] or threaten the use of force against you. [01:40:52.040 --> 01:41:07.040] So motion to suppress everything, motion to quash everything, citations, complaint, anything, everything, officer testimony, all of it, suppress it or quash it. Stop going to these, like you told me, these tow hearings because I am losing.
