Representative King made it clear that the purpose of the follow-up bill was to quote, [01:33.600 --> 01:38.000] to simply clarifying the bill that it applies to enterprises, to businesses, to companies, [01:38.000 --> 01:43.440] to pension funds, that it doesn't apply to small individuals who are doing single contracts such [01:43.440 --> 01:50.480] as this lady in Fluggerville. A new report commissioned by the Senate Intelligence Committee [01:50.480 --> 01:54.960] conducted by New Knowledge, a security company that tracks online misinformation, examined [01:54.960 --> 02:00.560] Russian digital propaganda efforts over a two-year period since January 2015. Their findings are [02:00.560 --> 02:05.120] alleging that apparently the Internet Research Agency, the Russian company accused of meddling [02:05.120 --> 02:10.320] in U.S. politics via Internet trolls on social media, was busy sharing links from sites including [02:10.320 --> 02:15.120] Breitbart, The Daily Collar and The Washington Examiner, giving them the upper hand due to [02:15.120 --> 02:20.640] extra exposure. In addition to this report, the University of Oxford's computational propaganda [02:20.640 --> 02:25.920] project in partnership with the social media data firm, Graphica, also published findings on [02:25.920 --> 02:31.120] the IRS work dating back to 2016, apparently uncovering that popular Second Amendment and [02:31.120 --> 02:36.800] Texas secessionist pages on Facebook, which had huge sways on voter sentiments, were also allegedly [02:36.800 --> 02:43.280] run by a Russian bot in online trolls. Senator Mark Warner of Virginia, the committee's top Democrat, [02:43.280 --> 02:48.160] characterized the report as a, quote, wake-up call. I hope these reports will spur legislative [02:48.160 --> 02:52.480] action in the Congress and provide additional clarity to the American public about Russia's [02:52.480 --> 03:13.920] assault on our democracy. Tim has a little, if you've been listening to show regularly, you have heard Tim a number of times over the last year and a half or so. [11:53.960 --> 12:01.960] So you pretty well know what's going on in his case. Well, Tim has a little crowing to do. [12:01.960 --> 12:06.960] Tim, are you ready to do some cock-o-doodle-doo? [12:06.960 --> 12:22.960] I guess so. Yeah. Last night was our once-a-month city council meeting, and the last we heard, we were gonna pay $8,000 and sign away all of our rights for this thing to go away. [12:22.960 --> 12:34.960] Well, last week we had a friend that we've become acquainted with. Randy knows him. His name is Ken Almond. He's out of Kansas City. [12:34.960 --> 12:49.960] And he suggested that we do a motion to stay for cause shown, and it was just a couple of sentences, and we turned it into the appeals court. [12:49.960 --> 13:06.960] The appeals court said to, well, you have to tell the other side, and then they deny it. Then our policy is to wait 10 days, then to reinsert it to the justices at the appeals and see what they have to say. [13:06.960 --> 13:17.960] So we had to wait until the 13th, which was last week, and then the next day on a Friday, which has been a week now, they sent it back to the justices. [13:17.960 --> 13:29.960] And of course, they didn't come to any conclusion then, but Monday at noon 30, I called, and she read it to me, the little clerk, and said, yes. [13:29.960 --> 13:43.960] And they've given you a motion to stay till January the 31st, and then they will automatically reinstate it the next day, and then you'll have until March 4th to do your appeals brief. [13:43.960 --> 13:52.960] So I was really excited. My wife was really excited. And then, of course, last night, at the 20th... [13:52.960 --> 14:04.960] Wait, hold on. For those who haven't been following us, go back and give us a lead in. How did we get here? [14:04.960 --> 14:15.960] Well, I mean, it all started with the code enforcement coming after me at my shop for having junk vehicles. [14:15.960 --> 14:17.960] And when I tried to... [14:17.960 --> 14:20.960] Well, we'll explain. You have a repair shop. [14:20.960 --> 14:26.960] Yeah, repair shop. And we're in a little small town, a little incorporated town here in Texas. [14:26.960 --> 14:29.960] And how long have you had this shop? [14:29.960 --> 14:34.960] Twenty-four years come January 24. [14:34.960 --> 14:42.960] So you've had a business in the city for almost a quarter of a century? [14:42.960 --> 14:46.960] Yeah. Yeah, so everybody knows me. [14:46.960 --> 14:54.960] And my wife had been on city council for three terms. She was Mayor Pro Tem for six years. [14:54.960 --> 15:03.960] And anyway, the city administrator kind of had it in for us. She's just a little vindictive individual. [15:03.960 --> 15:08.960] And so I tried to get some clarification and I didn't want her on my property. [15:08.960 --> 15:14.960] Tried to talk code enforcement officer. It just turned into a big mess. [15:14.960 --> 15:17.960] She filed a false incident report against me. [15:17.960 --> 15:24.960] I threatened her, brought her husband down, you know, if he was going to threaten me. He was scared. [15:24.960 --> 15:28.960] He was like, what is she getting me into? You know, it was a mess. [15:28.960 --> 15:31.960] But I had to ask for a hearing. [15:31.960 --> 15:40.960] When I went to the hearing, a prosecuting attorney, which these small towns had to hire law firms to do all their law stuff. [15:40.960 --> 15:44.960] So the prosecuting attorney is a hired hand. [15:44.960 --> 15:49.960] He took me to the back room, her and my wife, me and my wife. [15:49.960 --> 15:56.960] My wife recorded the entire conversation and she suggested that we do what was called an administrative hearing. [15:56.960 --> 16:04.960] And she made it sound like if there wouldn't be any trial, it would just be we'll determine whether these are actually junk or not, [16:04.960 --> 16:08.960] because I kept saying they're not junk. They were just unregistered. [16:08.960 --> 16:17.960] And so we went back out front. I guess her, the prosecutor and the judge had already had a little discussion [16:17.960 --> 16:24.960] that they were going to jack this up from $200 maximum fine per vehicle to $2,000 maximum fine per vehicle. [16:24.960 --> 16:31.960] And when she did that, then I was just sitting duck, you know. [16:31.960 --> 16:38.960] And when they set the administrative hearing up, I went there. They had three people on there. [16:38.960 --> 16:41.960] Wait a minute. Hold on. You did a big jump there. [19:41.960 --> 19:49.960] I didn't give this to start when we started to show because we had some technical difficulties. [19:49.960 --> 19:59.960] I think we've got those sorted out. [20:05.960 --> 20:19.960] Okay, Tim, you got these tickets, these assertions or allegations from the city. You went to a criminal trial court. [20:19.960 --> 20:28.960] The prosecutor came to you and said, hey, how about we set an administrative hearing? [20:28.960 --> 20:37.960] You said, okay, so they set an administrative hearing. What happened at the administrative hearing? [20:37.960 --> 20:47.960] The prosecutor attorney was standing to the side. She wouldn't let me ask any question. [20:47.960 --> 20:57.960] I could only answer questions and they just made it look like I was guilty and didn't pay attention to any of my evidence. [20:57.960 --> 21:00.960] And fined me $8,000. [21:00.960 --> 21:18.960] Okay, hang on. Tim was complaining that the vehicles, because they had an auto repair shop, weren't covered under the junk vehicle statutes. [21:18.960 --> 21:31.960] And the city said, well, sure they do. And the purpose of the hearing, the stated purpose by the judge when he allowed the hearing, [21:31.960 --> 21:41.960] was for the specific stated purpose of determining if the statutes applied to these vehicles or not. [21:41.960 --> 21:54.960] That was the purpose of the hearing. But instead of that determination, the administrative board made a final adjudication in the case. [21:54.960 --> 21:56.960] Right. [21:56.960 --> 22:13.960] They called him guilty and that's it. You're screwed. Then Tim filed a challenge subject matter jurisdiction. [22:13.960 --> 22:17.960] They didn't respond to it. You filed an opposition. [22:17.960 --> 22:28.960] But at the hearing, the judge said that if Tim's not happy with the results of the hearing, then he's going to raise an opposition in the court. [22:28.960 --> 22:39.960] We did that in terms by filing a subject matter jurisdiction challenge, which the prosecution did not respond to. [22:39.960 --> 22:47.960] And because they didn't respond to it, he filed a motion for summary judgment, which they did not respond to. [22:47.960 --> 22:53.960] The next thing he knows, he gets sued in the civil court, in the district court, in Decatur, Texas. [22:53.960 --> 22:59.960] He was sued in the municipal court in Newark, Texas. [22:59.960 --> 23:05.960] So now all of a sudden he's sued in the district court and they're suing him for $80,000. [23:05.960 --> 23:11.960] Yeah. Well, they were suing me for $8,000 plus civil penalty. [23:11.960 --> 23:18.960] So at the end of the day, the judge ruled against you. Okay, go ahead from there. [23:18.960 --> 23:28.960] Well, yeah. Well, during the time that we were waiting for them to answer our challenge subject matter jurisdiction, we were trying to get records request answered. [23:28.960 --> 23:35.960] We couldn't get them answered. And then they said we were asking too many. They wanted to charge us for them. So we had to go to the attorney general. [23:35.960 --> 23:44.960] Took 11 weeks to finally get an answer from the attorney general that said, yeah, you can't do this to this guy. [23:44.960 --> 23:48.960] But she still never answered our request. [23:48.960 --> 23:55.960] But after that, after we went to the district court, that completely caught me off guard. I had no idea what was going on. [23:55.960 --> 24:06.960] But we filed a countersuit. We filed an answer to their suit against us, and then we filed a countersuit. [24:06.960 --> 24:13.960] And I'm still not reading the documents properly, because this is the first time I've ever done this. [24:13.960 --> 24:19.960] And so finally, after about a year, no, I wouldn't make a year. It's probably about six, seven months. [24:19.960 --> 24:26.960] I actually started reading the documents and getting acquainted with what they were charging me with. [24:26.960 --> 24:33.960] And I think it was in May is when everything came down. [24:33.960 --> 24:43.960] They got $80,000, the $8,000, and we were running out of time. They wanted the deposition of all of our financial record. [24:43.960 --> 24:51.960] They were charging us for Tufta, which is hiding your money from debt collectors and stuff like that. [24:51.960 --> 25:00.960] I mean, it was getting nasty. And by that time, I think we went into panic mode, and we did... [25:00.960 --> 25:10.960] Randy, I think you suggested doing a petition for a writ of mandamus for a higher court to look and see if these people were being criminal. [25:10.960 --> 25:16.960] And we did, and they actually put a stay on the case. [25:16.960 --> 25:27.960] Okay, hold on. In mandamus, a mandamus is generally picked up about 12% of the time in state Texas. [25:27.960 --> 25:36.960] And about 2% of the time, a mandamus is ruled in favor of the filer. [25:36.960 --> 25:46.960] Ken at the time was a pro se filer of all things. [25:46.960 --> 25:58.960] With those statistics, the Court of Appeals granted his mandamus and threw out the original claim. [25:58.960 --> 26:01.960] Okay, go ahead. [26:01.960 --> 26:11.960] Yeah, so it took, let me think here, six of five, it took almost two months for them to come back with their answer. [26:11.960 --> 26:17.960] And they overruled the original $8,000 that the administrative hearing. [26:17.960 --> 26:23.960] They said that the administrative hearing was not legal because they had never adopted it into the city's ordinances. [26:23.960 --> 26:38.960] But they left the other parts of the suit, the injunction, the civil penalties, and the tough to claim that they ruled that it was rightful in the district court. [26:38.960 --> 26:42.960] Okay, hold on. Let me explain how that worked. [26:42.960 --> 27:00.960] What the court said was, is because the original adjudication was problematic, that the original determination that Tim was guilty of eight violations, was it eight violations? [27:00.960 --> 27:01.960] Yeah, eight. [27:01.960 --> 27:06.960] Eight violations of the junk vehicle statute. [27:06.960 --> 27:11.960] That adjudication was done improperly and it was thrown out. [27:11.960 --> 27:23.960] And the city sued to collect a, to collect on a claim against him. [27:23.960 --> 27:24.960] Yeah. [27:24.960 --> 27:37.960] And that in the municipal code, or in the government code, a city is allowed to sue in the district court to collect a civil penalty. [27:37.960 --> 27:41.960] And they said, we had filed a subject matter jurisdiction challenge. [27:41.960 --> 27:51.960] They said, because the original jurisdiction wasn't, it wasn't constitutional, wasn't in accordance with law, that it was invalid. [27:51.960 --> 27:54.960] And they said, yeah, that part was. [27:54.960 --> 28:01.960] But the part about the city suing to collect a civil penalty, were there authorized to do that by the code? [28:01.960 --> 28:06.960] So the court technically had jurisdiction over that part. [28:06.960 --> 28:31.960] So when that comes before the court, then you're able to say that because the court threw out the original determination, now your claim to the court, or your petition to the court to collect these fees is not supportable because there is no underlying determination. [28:31.960 --> 28:40.960] And essentially the court of appeal said that's something that the district court can rule on. [28:40.960 --> 28:41.960] Yeah. [28:41.960 --> 28:52.960] So it went back to the district court, the district court just ruled against Tim on everything in spite of the fact that the original determination was thrown out. [28:52.960 --> 28:59.960] What the city was saying is, you owe $1,000 a day for this ongoing violation. [28:59.960 --> 29:00.960] Yeah. [29:00.960 --> 29:03.960] And it's been 80 days. [29:03.960 --> 29:04.960] Right. [29:04.960 --> 29:09.960] But the court's rule, the original determination was invalid. [29:09.960 --> 29:24.960] So the only thing the trial court could do is rule that the city did not have standing to invoke subject matter jurisdiction of the court because the original adjudication had been tossed. [29:24.960 --> 29:27.960] But the judge didn't do that. [29:27.960 --> 29:28.960] Right. [29:28.960 --> 29:34.960] The judge had a different ruling and he ruled against Tim anyway. [29:34.960 --> 29:37.960] So the fight was still on. [29:37.960 --> 29:40.960] It didn't make any difference what the law said. [29:40.960 --> 29:41.960] Okay. [29:41.960 --> 29:42.960] Hang on Tim. [34:08.960 --> 34:17.960] Okay, so we're in panic mode because the judge has given the city attorney everything that's wanted [34:17.960 --> 34:19.960] and has denied everything that we wanted. [34:19.960 --> 34:24.960] Wait, wait, there's this one piece, a little piece of information you forgot. [34:24.960 --> 34:34.960] This city attorney came to you at one point and asked you who you were talking to. [34:34.960 --> 34:36.960] What did she say she was? [34:36.960 --> 34:41.960] Oh, yeah, she was the prosecuting attorney. She said that she was the licensed attorney. [34:41.960 --> 34:43.960] I learned attorney, too. [34:43.960 --> 34:50.960] Yeah, she's like, I don't know who you've been listening to, but I am a licensed attorney and I know what I'm talking about. [34:50.960 --> 34:53.960] So anyway, now she's on the run. [34:53.960 --> 34:56.960] So she got Tim set straight. [34:56.960 --> 34:57.960] Yeah. [34:57.960 --> 35:04.960] But Tim, being just an old ignorant redneck, he didn't know that, so he kept fighting them. [35:04.960 --> 35:06.960] Okay, where are we now? [35:06.960 --> 35:12.960] Okay, so we're trying to figure out what we're going to do. [35:12.960 --> 35:17.960] So we immediately filed in September, we filed for a noticeable bill. [35:17.960 --> 35:25.960] And then we had to try to get together money because they got an $80,000 suit against us. [35:25.960 --> 35:26.960] That they won. [35:26.960 --> 35:27.960] That they won. [35:27.960 --> 35:31.960] So we get this $80,000 together, borrowed from friends. [35:31.960 --> 35:34.960] And we put in a bank account well for it. [35:34.960 --> 35:39.960] So it's sitting there in case, you know, they come down on us, we don't go to jail. [35:39.960 --> 35:46.960] And then in the meantime, the clock is ticking on when we have to have this pills brief in. [35:46.960 --> 35:56.960] And so from when I started tonight talking, we had put in what is called a motion to stay. [35:56.960 --> 36:02.960] And they accepted it on Monday afternoon, so that means that the pressure was off of us. [36:02.960 --> 36:06.960] We didn't have to have anything until March 4. [36:06.960 --> 36:07.960] Okay, hang on. [36:07.960 --> 36:13.960] Let's back up a little bit and talk about your interaction with the city. [36:13.960 --> 36:23.960] You know, anybody who listens to the show a lot, you hear me say that you'll never win your case simply because you have the law and the facts on your side. [36:23.960 --> 36:25.960] Right. [36:25.960 --> 36:32.960] Everything is political and all politics is local. [36:32.960 --> 36:48.960] So in the interim, once we got past the trial part and Tim and Laura wanted to go after the city and the lawyers and everything involved. [36:48.960 --> 37:01.960] I kept telling them not time yet, not time yet, and it was really hard for them because they knew they were being treated very badly. [37:01.960 --> 37:07.960] And I kept telling them never interfere with someone who screwed up. [37:07.960 --> 37:16.960] And, you know, it was easy for me to say that because I didn't have an $80,000 dog in this hunt. [37:16.960 --> 37:22.960] So it's easy for me to sit up here and say, oh yeah, you should do this, you should do that. [37:22.960 --> 37:24.960] Well, actually it wasn't easy for me. [37:24.960 --> 37:25.960] This was tough. [37:25.960 --> 37:27.960] This was very difficult. [37:27.960 --> 37:36.960] People were asking me what should I do and their whole life's works at stake here. [37:36.960 --> 37:38.960] This was tough. [37:38.960 --> 37:47.960] And I told them based on my experience and this is what I believe you should do. [37:47.960 --> 37:55.960] And a lot of times they did what I suggested they should do much to their own chagrin. [37:55.960 --> 38:04.960] There were things they wanted to do and they intuitively felt like they should do, but they didn't do it until we got past the trial part. [38:04.960 --> 38:11.960] And then once we got to the appellate part, then sick them. [38:11.960 --> 38:12.960] Go get them. [38:12.960 --> 38:20.960] So then Tim and Laura started interacting with the city on a Facebook page. [38:20.960 --> 38:28.960] Kind of give us an idea of what all you did there from the political side because at the end of the day when we finish what we're talking about here, [38:28.960 --> 38:31.960] it will be apparent why we're going here. [38:31.960 --> 38:34.960] Politics is everything. [38:34.960 --> 38:35.960] Go ahead. [38:35.960 --> 38:44.960] I got on the page and I explained everything that the council had done and how they've been trampling on our rights. [38:44.960 --> 38:48.960] And they had been doing whatever they wanted to whenever they wanted to. [38:48.960 --> 38:54.960] And we had people who got together to protest. [38:54.960 --> 38:56.960] So we had a lady who had a sign company. [38:56.960 --> 38:58.960] She said, well, I'll make some protest signs. [38:58.960 --> 39:02.960] So she made protest signs and people met at city halls. [39:02.960 --> 39:06.960] They met the council as they'd get out of the cars to come in and they were protesting. [39:06.960 --> 39:11.960] Had the news out there and it was a small newspaper. [39:11.960 --> 39:13.960] But anyway, they reported on it. [39:13.960 --> 39:15.960] I think it got their attention. [39:15.960 --> 39:20.960] And so one of the council members says, hey, how about if we work a deal out? [39:20.960 --> 39:22.960] We do a little mediation. [39:22.960 --> 39:26.960] And that's where they said, you know, how about you pay $800? [39:26.960 --> 39:28.960] Okay, wait, wait, wait. [39:28.960 --> 39:30.960] Let's back up a step. [39:30.960 --> 39:38.960] Tim and Laura petitioned the court of appeals to order mediation. [39:38.960 --> 39:40.960] On accident. [39:40.960 --> 39:52.960] This is kind of important because when you're a pro se, you have lawyers on the other side and they are not going to mediate with a pro se litigant. [39:52.960 --> 39:54.960] Unless they're forced to. [39:54.960 --> 40:00.960] So we went to the district court and asked the district court to order mediation and they did. [40:00.960 --> 40:02.960] And so they got into mediation. [40:02.960 --> 40:04.960] Okay, go ahead, Tim. [40:04.960 --> 40:11.960] Well, we never went to mediation because the council member met with us. [40:11.960 --> 40:18.960] My wife and I and we went over the whole case and they said, well, let's see if we can't work something out with the rest of the council. [40:18.960 --> 40:22.960] Okay, hold on, Tim. [40:22.960 --> 40:26.960] Mediation is a term of art that has a very specific meaning. [40:26.960 --> 40:34.960] And the mediation is where you engage a professional mediator. [40:34.960 --> 40:42.960] Both parties come before the mediator and the mediator enters a recommendation. [40:42.960 --> 40:56.960] Generally, the process is that before you get to that mediator, you talk to one another and see if you can find a consensus between one another. [40:56.960 --> 40:58.960] Can I interject something here, Randy? [40:58.960 --> 41:00.960] Yes. [41:00.960 --> 41:02.960] This is Laura. [41:02.960 --> 41:12.960] Anyway, when we were trying to get this mediation stuff taken care of and we had all finally agreed to mediate, we had found a mediator. [41:12.960 --> 41:18.960] All of the things were set in place to mediate and the emails had gone back and forth. [41:18.960 --> 41:22.960] They had a council meeting the night after that. [41:22.960 --> 41:38.960] And before that council meeting, it was probably 5.30, 4.00, somewhere around that time, we get an email from the TML attorney, which is the insurance company attorney, that was one of the first we've been fighting. [41:38.960 --> 41:41.960] And they were protesting mediation. [41:41.960 --> 41:46.960] They protested to the appeals court about mediation. [41:46.960 --> 41:48.960] Yes, let me explain that. [41:48.960 --> 41:51.960] You had the attorneys for the city. [41:51.960 --> 41:56.960] But the city has insurance policy and errors and emissions policy. [41:56.960 --> 42:01.960] And that's the Texas Municipal League. [42:01.960 --> 42:07.960] And it was the attorney for the Texas Municipal League that opposed mediation. [42:07.960 --> 42:18.960] And clearly, he was probably the only attorney in the mix who could see the train that was coming at him. [42:18.960 --> 42:19.960] Right. [42:19.960 --> 42:24.960] He knew they were being set up and he did not want to go there. [42:24.960 --> 42:31.960] Well, so I went to that meeting that night and you know that three minutes they allow you to speak. [42:31.960 --> 42:33.960] I don't think I took quite three minutes. [42:33.960 --> 42:35.960] I think we were longer. [42:35.960 --> 42:39.960] But I had that council's attention because I was shaking. [42:39.960 --> 42:40.960] I was so angry. [42:40.960 --> 42:46.960] How dare you say we're going to mediate and you let them throw a wrench in this thing. [42:46.960 --> 42:49.960] And I just chewed them up one side and down the other. [42:49.960 --> 42:50.960] How dare you? [42:50.960 --> 42:52.960] You guys have, this is crazy. [42:52.960 --> 42:54.960] You don't deserve this money. [42:54.960 --> 42:57.960] I mean, I just threw a big old fit. [42:57.960 --> 43:02.960] And the mayor pro tem come to me after the meeting and said, can we step aside? [43:02.960 --> 43:04.960] Oh, no, no, we're doing everything public now. [43:04.960 --> 43:07.960] You get to talk to me in this room in front of all these people. [43:07.960 --> 43:10.960] And he said, we didn't know they filed that. [43:10.960 --> 43:14.960] I said, that tells me that you got two law firms you're not in charge of. [43:14.960 --> 43:22.960] And so they were allowing attorneys to rule the roost on my time because I'm the taxpayer. [43:22.960 --> 43:23.960] Yes. [43:23.960 --> 43:28.960] And it was the attorneys who engineered this whole mess. [43:28.960 --> 43:29.960] Yes. [43:29.960 --> 43:30.960] Yeah. [43:30.960 --> 43:31.960] Yeah. [43:31.960 --> 43:37.960] The point of this was that's why we went to the court of appeals and asked them to order [43:37.960 --> 43:45.960] the application because this, what this does, it gives the other party plausible deniability. [43:45.960 --> 43:50.960] Now we have a court order to mediate. [43:50.960 --> 43:57.960] Now they can come to the table and mediate without losing face. [43:57.960 --> 44:00.960] You know, if you play poker, you know, you don't want. [46:58.960 --> 47:03.960] And the city contacted us before we actually... [47:03.960 --> 47:04.960] Wait, hold on, hold on. [47:04.960 --> 47:06.960] ...the municipal mediation company. [47:06.960 --> 47:10.960] Hold on, Laura. You said they were opposing mediation. [47:10.960 --> 47:19.960] The new opposed mediation was the municipal league's attorney, not the city's attorney. [47:19.960 --> 47:26.960] The council members, they were agreeable to mediation. [47:26.960 --> 47:29.960] And this goes to what we say, everything's political. [47:29.960 --> 47:39.960] Once Tim unleashed on them and we held off for over a year until we got past the trial part [47:39.960 --> 47:43.960] because they kept doing all kinds of garbage stuff and I kept telling them, [47:43.960 --> 47:46.960] if somebody's screwing up, never interfere with them. [47:46.960 --> 47:52.960] Once they got past the trial court and got to the appeal, now you cannot load on them. [47:52.960 --> 47:54.960] So they went to the city. [47:54.960 --> 47:57.960] They went to other people who lived in the city and said, [47:57.960 --> 47:59.960] this is what's going on. [47:59.960 --> 48:05.960] This could be you just like me if someone in the city happens to get an attitude, [48:05.960 --> 48:09.960] happens to not like you, this could happen to you. [48:09.960 --> 48:15.960] And the city to their credit rose up in their defense. [48:15.960 --> 48:18.960] For me, it was amazing. [48:18.960 --> 48:25.960] This $80,000 they were claiming they needed a bond. [48:25.960 --> 48:28.960] They didn't have $80,000. [48:28.960 --> 48:37.960] So the city, people they knew put together $80,000 for Tim and Laura. [48:37.960 --> 48:43.960] Now it's really easy for people to say, oh, I'm your friend, I'm your buddy. [48:43.960 --> 48:48.960] But you never know who your friends are until it gets difficult, [48:48.960 --> 48:54.960] until they have to actually do something, especially reach in their pocket. [48:54.960 --> 49:02.960] And when that happened, I told Tim and Laura, I said, I thought this was an incredible gift [49:02.960 --> 49:07.960] that they got to find out that the people of Newark did care about them. [49:07.960 --> 49:13.960] And they raised $80,000 for Tim and Laura. [49:13.960 --> 49:22.960] And they showed up at the city council meetings in force. [49:22.960 --> 49:29.960] Almost as many people who voted in the last election showed up to protest what the city was doing. [49:29.960 --> 49:33.960] And the city started negotiating with Tim and Laura. [49:33.960 --> 49:36.960] Okay, pick it back up. [49:36.960 --> 49:43.960] Okay, so anyway, so we're trying to figure out what we have to do, when we have to do it, [49:43.960 --> 49:46.960] if they're going to come and hold us in contempt of court, [49:46.960 --> 49:49.960] because we didn't show up for deposition because I got sick. [49:49.960 --> 49:51.960] It was just a big mess. [49:51.960 --> 49:54.960] But anyway, I want to get back to the motion today, [49:54.960 --> 49:59.960] because this is really where I think everything got completely turned around, [49:59.960 --> 50:02.960] because I think they thought that they had us, [50:02.960 --> 50:06.960] because we had to wait all of those days, [50:06.960 --> 50:14.960] because everybody in that lawsuit that we had named originally in our counter claim, [50:14.960 --> 50:16.960] denied except for one lady. [50:16.960 --> 50:22.960] And she was the one who started all of this against us, and now she's our friend. [50:22.960 --> 50:25.960] So, and also I want to say this, [50:25.960 --> 50:32.960] the city administrator who was in cohort with the attorneys to go after us [50:32.960 --> 50:38.960] and to put together a huge file that made us look like evil and wicked individuals [50:38.960 --> 50:47.960] that made force to resonate. She had to resign, excuse me, yeah, I can't even talk. [50:47.960 --> 50:54.960] Sometimes Tim has a problem with pronunciation. [50:54.960 --> 51:00.960] He sometimes gets the emphasis on the wrong sololable. [51:00.960 --> 51:03.960] I get that from you though. [51:03.960 --> 51:09.960] But anyway, so she was made force to resign because she lied. [51:09.960 --> 51:14.960] She lied about hiring her son and her husband. [51:14.960 --> 51:16.960] Part-time, but she lied. [51:16.960 --> 51:19.960] If she hadn't have lied, they probably would have kept her. [51:19.960 --> 51:22.960] But she had resigned. [51:22.960 --> 51:26.960] And now she's working part-time places. [51:26.960 --> 51:28.960] I don't know, she'll get another job like she had here. [51:28.960 --> 51:30.960] She had a really good job. [51:30.960 --> 51:36.960] But anyway, so we had to wait all those days and then the court ruled, was it Monday? [51:36.960 --> 51:38.960] Yeah, Monday. [51:38.960 --> 51:41.960] Monday in our favor for the motion to stay. [51:41.960 --> 51:45.960] Wednesday we didn't have to have the brief, thank God. Thursday. [51:45.960 --> 51:50.960] Okay, wait, hold on Tim. This was the concern. [51:50.960 --> 52:04.960] We believed that the lawyers for the city were conniving so that in order to get Tim and Laura embroiled in mediation [52:04.960 --> 52:08.960] and get them to forget to keep track of the appellate deadline. [52:08.960 --> 52:09.960] Yeah. [52:09.960 --> 52:13.960] We're hoping they would miss the appellate deadline and then they lose everything. [52:13.960 --> 52:18.960] Right. And that's what they kept doing. [52:18.960 --> 52:27.960] Anyway, so last night my wife goes to the council meeting because we were going to see if our friend, there was an open council meeting, I see. [52:27.960 --> 52:31.960] And they had been putting that off for like three months. [52:31.960 --> 52:35.960] Wait a minute, wait a minute, you gave bits and pieces of that. [52:35.960 --> 52:36.960] Okay. [52:36.960 --> 52:40.960] They had a friend, someone who had stepped down from the council, there was an empty slot. [52:40.960 --> 52:41.960] An empty slot. [52:41.960 --> 52:50.960] And so the friend in June, so her name in, filled out the application process. Well, the city administrator conveniently lost it. [52:50.960 --> 52:56.960] She actually put it in a file in the back and never showed it to anybody and said, we're not going to fill that seat. [52:56.960 --> 53:00.960] And so she raised cane. [53:00.960 --> 53:05.960] We got 80 signatures in a petition for her. [53:05.960 --> 53:19.960] And so they had to, in the last second, the last second, they got a friend of one of the council members and they all live in this little neighborhood where these $450,000 houses are. [53:19.960 --> 53:21.960] Not my friend, but the other people. [53:21.960 --> 53:25.960] And last night they interviewed her. [53:25.960 --> 53:30.960] And then they came out and they announced that they were going to fill the seat with our friend. [53:30.960 --> 53:37.960] And so that was good. So they, they swore her and she sat behind the bench, took her little position. [53:37.960 --> 53:45.960] And then the guy that was giving us the hardest trouble on the council was the one who made the announcement. [53:45.960 --> 53:46.960] I wasn't there. [53:46.960 --> 53:48.960] My wife was and a bunch of our friends. [53:48.960 --> 53:53.960] I was always told not to go because I could get myself in trouble. [53:53.960 --> 53:57.960] And plus it messed with their heads, I think, me not being there. [53:57.960 --> 53:59.960] Well, since I was there, I get to pick up from here. [53:59.960 --> 54:00.960] Go ahead. [54:00.960 --> 54:06.960] So they went out for their general two hour executive session that they like to go into. [54:06.960 --> 54:15.960] And when they came out and they announced that they were going to place Darla on the council, it took the whole room a few seconds to absorb that. [54:15.960 --> 54:16.960] That's what they actually said. [54:16.960 --> 54:20.960] And we began to scream and clap and, you know, the whole thing. [54:20.960 --> 54:22.960] Everybody was so excited. [54:22.960 --> 54:29.960] And we had had these multiple conversations while waiting the two hours, you know, that they're not putting Darla on. [54:29.960 --> 54:31.960] They're not going to do anything about the case. [54:31.960 --> 54:35.960] They're going to do the same thing that drag their feet like they've always done. [54:35.960 --> 54:42.960] And so when they announced that Darla was going to be on council, we really didn't expect it so we were shocked. [54:42.960 --> 54:44.960] And it took a second to be happy. [54:44.960 --> 54:46.960] And so everybody was screaming and clapping. [54:46.960 --> 54:53.960] Well, they swore her in and put her up there like Tim says, I mean, immediately we never dreamed that, first of all, that they would do it immediately. [54:53.960 --> 54:57.960] We figured they would go, oh, come next month and we'll take care of that. [54:57.960 --> 55:03.960] But then the room calmed down after they got her all settled. [56:03.960 --> 56:07.960] You got to understand what happened there. [56:07.960 --> 56:22.960] The city made an offer to Tim and Laura that if they would pay this $8,000 and plead guilty that the city would drop this $80,000. [56:22.960 --> 56:28.960] But Tim and Laura had to drop all their claims against the city. [56:28.960 --> 56:40.960] Because Tim and Laura had a $300,000 lawsuit against the city or against a number of city employees and the city attorneys. [56:40.960 --> 56:44.960] They had a suit against the city, but that was a declaratory judgment suit. [56:44.960 --> 56:48.960] They weren't asking for any damages from the city. [56:48.960 --> 56:55.960] They were asking damages from public officials who had acted beyond the scope of their authority. [56:55.960 --> 57:00.960] And for the lawyers that asked, that advised them to do so. [57:00.960 --> 57:06.960] So the city came back and said they would do this if Tim and Laura dropped all of their claims. [57:06.960 --> 57:15.960] And we talked about it and Tim and Laura went back and said, we will do that. [57:15.960 --> 57:22.960] But we will not drop the claims against the attorneys. [57:22.960 --> 57:34.960] It was our opinion from the beginning that it was the attorneys that created this mess and we will not drop the claim against the attorneys. [57:34.960 --> 57:41.960] So the city went back to mediating or to negotiating on their side. [57:41.960 --> 57:53.960] And then the next thing Tim and Laura here is, well, they had, Tim and Laura had filed with them a counter proposal. [57:53.960 --> 57:56.960] And they had to send that to their attorneys. [57:56.960 --> 58:01.960] And their attorneys subjected to say, you got some problems with the language and blah, blah, blah. [58:01.960 --> 58:07.960] What the attorneys are trying to do is protect themselves so that Tim and Laura don't come after them. [58:07.960 --> 58:17.960] Because the court of appeals has already ruled that what the attorneys did was unlawful. [58:17.960 --> 58:22.960] So that was resjudicata, already determined. [58:22.960 --> 58:26.960] That is not a question and these lawyers knew it. [58:26.960 --> 58:36.960] So they see a freight train coming at them and they advised the city they got to have different verbiage and disagreement. [01:03:45.000 --> 01:03:51.080] Now I've been through this a number of times, a few times myself, and helping other people [01:03:51.080 --> 01:04:01.080] that I understood the process, and frankly it doesn't always come to a positive conclusion, [01:04:01.080 --> 01:04:11.000] but the only possible way to get to a possible update, a positive conclusion is to go through [01:04:11.000 --> 01:04:19.280] these steps, it's a long process and it's difficult, and for Tim and Laura it was especially [01:04:19.280 --> 01:04:21.480] difficult. [01:04:21.480 --> 01:04:26.080] But first you start out thinking that the law and the facts apply, and then you find [01:04:26.080 --> 01:04:27.840] out it's all political. [01:05:02.080 --> 01:05:09.680] It took a while, but that frames what happened last night because they were in mediation. [01:05:21.120 --> 01:05:29.680] They essentially said to Tim and Laura, you can come back and do anything you want to. [01:05:34.520 --> 01:05:44.040] But Tim and Laura had said, if you do this thing, I will not come back after you. [01:05:44.040 --> 01:05:54.440] The city apparently accepted that on its face, and I am astounded that they accepted it on [01:05:54.440 --> 01:05:59.520] its face because everybody's always trying to protect themselves. [01:05:59.520 --> 01:06:06.760] So to be clear, this is a bigger deal than I would have ever expected. [01:06:06.760 --> 01:06:13.240] I would have expected them to come back and make an offer to Tim and Laura and say, okay, [01:06:13.240 --> 01:06:16.760] if you'll do this thing, we'll do this other thing here. [01:06:16.760 --> 01:06:23.360] But apparently the political pressure, this is all politics, has nothing to do with law. [01:06:23.360 --> 01:06:28.040] The political pressure that was put on all of them paid off. [01:07:45.360 --> 01:07:51.480] But you know, all the things that we face, if it had not been for God, none of this could [01:07:51.480 --> 01:07:56.120] have happened because Tim and I would have killed each other in the beginning. [01:07:56.120 --> 01:08:02.960] We have been through some major stress and some major times, but we have made it. [01:09:31.760 --> 01:09:37.720] We assess a fine of $0. [01:09:37.720 --> 01:09:43.080] We assess a period of confinement in the county jail of zero days. [01:09:43.080 --> 01:09:46.960] That was the first time, the second time they threw the book at me. [01:09:46.960 --> 01:09:50.800] You're in prison, $10,000 fine. [01:10:13.280 --> 01:10:18.040] So I had been through here and I kind of knew how this thing goes. [01:10:41.040 --> 01:10:52.720] It never, ever quit and I helped Tim and Laura with this the whole time and it was hard. [01:12:06.960 --> 01:12:11.320] The city's lawyers had a relationship with the city, but they also had their own dog [01:12:11.320 --> 01:12:20.040] in the hunt and then we had the Texas Municipal League who also had their own dog in the hunt [01:12:20.040 --> 01:12:29.280] because if the city gets sued, then the Municipal League has to pay up. [01:12:29.280 --> 01:12:39.480] What I'm not sure of now, what if the city's lawyers get sued? [01:12:39.480 --> 01:12:48.600] Does the Municipal League indemnify the city or the city and the city's lawyers? [01:12:48.600 --> 01:12:54.640] This will be an interesting test because the city grabbed up the lawyers and tossed them [01:12:54.640 --> 01:12:59.600] under the bus just the way Tim and Laura wanted them to do. [01:12:59.600 --> 01:13:07.120] All politics, if you back a bulldog in a corner, you always got to give him a way out. [01:13:07.120 --> 01:13:09.600] The city took the way out. They all went [01:47:21.440 --> 01:47:25.360] into the courtroom, and the prosecutor stood up in front of the judge and said, Your Honor, [01:47:25.360 --> 01:47:34.560] we move to dismiss all charges against Mr. Handel. He fought them. He never backed up, [01:47:34.560 --> 01:47:38.080] and they will fight you right up until they can't fight you anymore. [01:47:38.080 --> 01:47:45.120] They never go away, and this is how they work. You have to fight through this process. This [01:47:45.120 --> 01:47:53.760] was a great example to demonstrate the process, and following this, now we'll get to demonstrate [01:47:54.800 --> 01:48:03.280] the backside. Well, mine was a false arrest case three years ago, [01:48:17.200 --> 01:48:25.200] and I've been going after this deputy ever since. We got to the point where I was deposing the [01:48:25.200 --> 01:48:35.440] deputy on Monday, and there's two female attorneys representing this deputy, and I've dealt with [01:48:36.560 --> 01:48:40.320] one that was very professional and courteous as we've been going through the process. [01:48:43.280 --> 01:48:50.480] I have been told that the other one was the attorney from hell, and so she showed up with [01:48:50.480 --> 01:48:58.400] the deputy at the deposition on Monday, and I've got to tell you, I have never run up such a rude, [01:48:58.400 --> 01:49:06.560] rotten female in my life, and I'm not the same vintage you are, and in all my years, [01:49:06.560 --> 01:49:12.640] I have never run up anybody with this foul of an attitude. Oh, I love those. [01:49:12.640 --> 01:49:22.080] Well, because, you know, they get this attitude, but if you understand, they're giving you ammunition. [01:49:24.400 --> 01:49:30.800] If it sounds rude to you, it's going to sound rude to the bar, and it's going to, you know, [01:49:30.800 --> 01:49:38.720] I'm always thinking, what is it, what will a jury of my peers think about this behavior? And I just wrote a letter to the partners and told them, I said, [01:49:52.640 --> 01:49:58.320] look, I'm getting tired of this woman, and if she earns another bar grieve, I'm going to bar [01:49:58.320 --> 01:50:05.280] grieve the partners and cited the rule that says the partners must control their attorneys. [01:51:40.080 --> 01:51:55.520] So, if you just send them a notice, a tort letter, a tort letter is under the UCC, [01:51:55.520 --> 01:52:04.240] Uniform Commercial Code, is notice an opportunity. You send them a letter giving them notice that [01:52:04.240 --> 01:52:10.800] you feel like you've been harmed by this attorney through her improper practices. [01:52:12.480 --> 01:52:17.440] And you give the law firm opportunity to make you whole. [01:52:20.000 --> 01:52:24.160] That you've damaged me, and I feel like you've damaged me for X amount of dollars, [01:52:24.160 --> 01:52:32.000] make me wholly be sued. Whether you sue them or not, not that important, [01:52:32.000 --> 01:52:35.680] they have to send that to their errors and omissions carrier. [01:52:37.520 --> 01:52:47.440] And they have an agent for the carrier. His only, where his primary purpose is, [01:52:48.160 --> 01:52:53.360] to charge his client as much as possible and avoid paying any claims. [01:52:53.360 --> 01:53:02.560] So, you give the agent an opportunity and reason to increase their rates. [01:53:05.520 --> 01:53:06.720] Does that sound like fun? [01:53:10.240 --> 01:53:17.120] Every time they step across a legal line, okay, what the American Bar Association standards and [01:53:17.120 --> 01:53:28.240] most states standards say is that these, a violation of these standards does not create a [01:53:28.240 --> 01:53:36.640] cause of action. Okay, maybe they don't create a cause of action on their face, [01:53:37.840 --> 01:53:44.720] but the behaviors that are declared by the bar to be on ethical conduct, [01:53:44.720 --> 01:53:48.400] the behavior itself creates a claim against the lawyer. [01:53:50.400 --> 01:53:56.400] So, you don't have to cite the statute, I mean the standard, [01:53:57.520 --> 01:54:02.080] but you write your complaint in the verbiage of the standard. [01:54:04.080 --> 01:54:11.760] So, they can't say that I didn't act wrongfully because the bar association standards specifically [01:54:11.760 --> 01:54:21.680] forbids that kind of behavior. There's no one-one way to get to this thing, but the primary thing [01:54:21.680 --> 01:54:29.280] is it will dramatically increase their errors and omissions policy costs, and if you increase it [01:54:29.280 --> 01:54:37.440] enough, they have to close the law firm and open another one. Tim's law firm, I can almost assure [01:54:37.440 --> 01:54:45.280] you that long before Tim's done with them, the law firm will close down because they won't be able [01:54:45.280 --> 01:54:54.560] to get insured. So, law you want to have yourself an attitude? Well, you knock yourself out. I see [01:54:54.560 --> 01:55:00.800] if I can adjust that attitude for you. And there's one thing you should, you could tell her, she [01:55:00.800 --> 01:55:10.640] comes in with a real bad attitude. My favorite one was the head of criminal intake section [01:55:11.760 --> 01:55:19.040] for the Denton County District Attorney's Office. When I tried to get him to sign a criminal complaint [01:55:19.040 --> 01:55:26.640] against his boss, told me that he wasn't going to sign it, and I said, is there any reasons, [01:55:26.640 --> 01:55:36.400] any special reason, or are you just upset today? I didn't exactly say upset. And he said, well, [01:55:36.400 --> 01:55:40.720] I gave him the complaints, and he said, I'm not going to sign these and toss them at me. And while [01:55:40.720 --> 01:55:47.520] I'm picking up the papers, I said, is there any reason, or are you just a PO today? And he said, [01:55:47.520 --> 01:55:51.200] I'm just not going to sign them. I said, okay, so I went to the clerk. I had went to the [01:55:51.200 --> 01:55:58.080] district attorney's office and asked for a lawyer to verify these affidavits. And they sent this [01:55:58.080 --> 01:56:03.680] young guy out. He looked at them, their complaints against his boss. I was across the hall trying [01:56:03.680 --> 01:56:08.800] to file him with a district judge, and he wouldn't take them because they weren't verified. So I [01:56:08.800 --> 01:56:13.280] came to the district attorney because the district attorney's authorized to verify and asked for [01:56:13.280 --> 01:56:18.720] somebody to do this. And they sent this young guy and he looked at him. He said, I can't sign these. [01:56:18.720 --> 01:56:22.720] I'm just a PO around here. I said, what's the matter? Are you chicken? [01:56:23.360 --> 01:56:31.040] Darn right I am. That's I like this guy. So they got his boss. I'm not going to sign these and he [01:56:31.040 --> 01:56:37.040] tosses them at me. Papers went everywhere. Any special reason, you just PO today. I'm just not [01:56:37.040 --> 01:56:40.880] going to sign them. So I went to the clerk and I said to the receptionist, I said, ma'am, [01:56:40.880 --> 01:56:49.680] have you got an attorney who's literate? She said, huh? You got one who can write. I need one to [01:56:49.680 --> 01:56:54.960] verify these criminal affidavits in court through duty under Article 2.06, Texas Code of Criminal [01:56:54.960 --> 01:57:00.240] Procedure, and this Roger Jones said, Mr. Kelston, you are not welcome here anymore.
