[08:00.000 --> 08:03.680] And then that one internally jumps to another one, jumps to another one, depending on how [08:03.680 --> 08:06.080] you answer the questions. [08:06.080 --> 08:09.680] So it is extremely complex. [08:09.680 --> 08:14.800] And by we are naming each of the files so you can tell when it jumps from one file to [08:14.800 --> 08:16.320] another. [08:16.320 --> 08:23.560] And then you begin to get an idea of how complex and how involved it is. [08:23.560 --> 08:29.040] And this is primarily right now for investors to look at to give them an idea of the level [08:29.040 --> 08:33.800] of sophistication of these questionnaires. [08:33.800 --> 08:44.160] But so far we are getting good response if we get the angel funding, we are hoping to [08:44.160 --> 08:50.360] be able to get that by the end of December. [11:56.360 --> 12:03.040] It was basically the case where they have erected illegal fencing in the neighborhood [12:03.040 --> 12:07.920] that has no HLA but has pretty strict restrictive covenants. [12:07.920 --> 12:10.800] And the second thing, it just looked like- [12:10.800 --> 12:11.800] Okay, hold on. [12:11.800 --> 12:18.760] Restrictive covenants, are they, are they title restrictions if there is no HLA? [12:18.760 --> 12:22.400] How are the restrictions implemented? [12:22.400 --> 12:29.600] They were, when the subdivision was developed, the covenants were filed with the registrations. [12:29.600 --> 12:33.400] Okay, so they're title restrictions? [12:33.400 --> 12:37.240] That's how the restrictions are taken away, just another name for it. [12:37.240 --> 12:38.240] Oh, okay. [12:38.240 --> 12:43.840] I filed it with the Superior Court of Wake County in North Carolina. [12:43.840 --> 12:50.040] And right now, it's, you know, they've been going through the 30 days, so the 30 days [12:50.040 --> 12:51.040] has not passed. [12:51.040 --> 12:54.160] It will be on the 10th of December. [12:54.160 --> 12:55.160] And I know that- [12:55.160 --> 12:56.160] Okay, hold on. [12:56.160 --> 12:59.160] Let's step back a second. [12:59.160 --> 13:00.160] Okay. [13:00.160 --> 13:09.320] Did you file an action to enforce title restrictions against someone else? [13:09.320 --> 13:15.640] Or is there a method within the title restrictions for enforcement? [13:15.640 --> 13:19.120] Well, I filed a complaint. [13:19.120 --> 13:25.560] And in the complaint, I stayed to jurisdiction in the venue, then I stayed to factual allegations [13:25.560 --> 13:31.920] in the last- the long one, but it's the last one, and there it says, we are seeking judgment [13:31.920 --> 13:36.640] for removal of the legal chain link fence, and it's during the landscaping, they asked [13:36.640 --> 13:40.680] against- again, against a defendant. [13:40.680 --> 13:46.440] So it's a regular complaint filed in the Superior Court because, you know, it's attached all [13:46.440 --> 13:52.360] the exhibits of the restrictions into the complaint, specifying where it states that [13:52.360 --> 13:55.800] the wire and chain link fencing is not allowed. [13:55.800 --> 13:58.800] So that has been- all that has been filed. [13:58.800 --> 14:03.600] And now we had a lawyer that's working with the defendant contact us. [14:03.600 --> 14:07.840] A few days, actually, he talked to my husband, he didn't call me. [14:07.840 --> 14:09.640] He had his number. [14:09.640 --> 14:14.720] And it was just trying to pry for any information he could get to negotiate a deal. [14:14.720 --> 14:18.920] How can we close- you know, how can we make this go away? [14:18.920 --> 14:21.920] And so they- he said, we're not threatening. [14:21.920 --> 14:28.960] I'm not trying to threaten, but, you know, the defendant is going to sue you for having [14:28.960 --> 14:31.080] a chicken coop. [14:31.080 --> 14:33.520] And so can we finally, you know, kind of set cover solutions? [14:33.520 --> 14:38.480] And my husband said, well, you know, it's- the chicken coop has been there for over five [14:38.480 --> 14:39.480] years. [14:39.480 --> 14:43.800] So according to a law of latch, if nobody has complained about it ever before, it really [14:43.800 --> 14:45.800] will- I don't think it's going to stand. [14:45.800 --> 14:49.480] Anyway, so that's when the call ended, and he was going to follow up with me, and then [14:49.480 --> 14:52.240] we were going to follow up with the lawyer back, but I don't think he needs to follow [14:52.240 --> 14:56.640] up with the lawyer at all, because they don't really have a good case. [14:56.640 --> 14:58.640] Okay, hold on, hold on. [14:58.640 --> 15:04.040] Are chicken coops- do they fall under the restrictions? [15:04.040 --> 15:10.480] Yes, they are under the restrictions, but the house where they are housed was built [15:10.480 --> 15:11.480] in 1996. [15:11.480 --> 15:13.840] It was actually a kid's playhouse. [15:13.840 --> 15:15.600] It came along with the house. [15:15.600 --> 15:20.960] We just kind of rigged it to have a few chickens in there, a pet, so we have six of them that [15:20.960 --> 15:22.960] we call them the therapy pets. [15:31.400 --> 15:37.560] They are, but the law of latches, which your family applies in which case if nobody says [15:37.560 --> 15:43.360] anything, right, for more than after a year or two, actually it's more like three or four [15:43.360 --> 15:44.840] years, nobody married it. [15:44.840 --> 15:48.440] No, no, no, it's not quite that easy. [15:48.440 --> 15:54.480] Latches really doesn't attach here directly. [15:54.480 --> 16:05.520] There would have to be some type of clause in the covenants that would set a time limit [16:05.520 --> 16:09.160] for exercising the right to raise an issue. [16:09.160 --> 16:14.600] Is there anything in those covenants concerning enforcement of the covenants? [16:14.600 --> 16:15.600] It doesn't. [16:15.600 --> 16:16.600] It doesn't. [16:16.600 --> 16:17.600] It doesn't. [16:17.600 --> 16:18.600] It doesn't. [16:18.600 --> 16:19.600] And that's fine. [16:19.600 --> 16:24.280] If they rule against us having the chicken coop, like I said, the children's playhouse, [16:24.280 --> 16:26.400] I can be home with chickens, there's always six of them. [16:26.400 --> 16:33.400] I really care about the pets being taken out, so it's not even an issue from our perspective. [25:30.560 --> 25:41.560] I have to respectfully disagree with the latches because we've had cases in North Carolina where it was about a silly reef that somebody was putting on the front of the door, and they were doing it for five years. [25:41.560 --> 25:47.560] In the sixth year, the HOA came and said, hey, you can just put that reef on your door, and they have dealt with the wrong person. [25:47.560 --> 25:50.560] She was actually a lawyer, and so they sued her. [25:50.560 --> 25:52.560] She won based on law of latches. [25:52.560 --> 26:01.560] The term is never specified in television hardly ever, but they kind of had that built in, you know, a few years or so. [26:01.560 --> 26:12.560] They'll pass, and if you don't mind, if you haven't minded for that long, then the court may just, you know, excuse that because nobody's punishing anybody for that long. [26:12.560 --> 26:15.560] So why are you complaining now after five years? [26:15.560 --> 26:16.560] So that's common. [26:16.560 --> 26:18.560] It may actually work out in our favor. [26:18.560 --> 26:21.560] Even if it doesn't, that's okay. [26:21.560 --> 26:24.560] Their only claim, their only counterclaim against you is chickens. [26:24.560 --> 26:26.560] They don't have much to stand on. [26:26.560 --> 26:28.560] Exactly, exactly. [26:28.560 --> 26:36.560] So I'm not really concerned, and that's why when the lawyer calls my husband and tries to negotiate and, you know, wants to drop the complaint for that. [26:36.560 --> 26:38.560] And again, the chicken house looks beautiful. [26:38.560 --> 26:43.560] It's actually the children's little house painted and matching our house. [26:43.560 --> 26:53.560] People that even know the chicken house when they come over, they can kind of see, not really, you know, but no other neighbors can see from their house if the military comes on a property to actually notice it. [26:53.560 --> 26:58.560] But most people that come actually think it's a kid's playhouse because it looks like it. [26:58.560 --> 27:00.560] Okay, I have a question. [27:00.560 --> 27:04.560] Are they required to have a fence? [27:04.560 --> 27:05.560] No. [27:05.560 --> 27:06.560] No. [27:06.560 --> 27:12.560] So if the neighbors took the fence down altogether, would that be... [27:12.560 --> 27:16.560] a good solution for you? [27:16.560 --> 27:17.560] Yes. [27:17.560 --> 27:19.560] It would be a fantastic solution. [27:19.560 --> 27:20.560] Oh, okay. [27:20.560 --> 27:32.560] So the reason I was saying that, because if that wasn't a great solution, if you needed some kind of barrier, then you might make a deal with them to help cover the cost of the fence of the type you like right next to that chain link. [27:32.560 --> 27:34.560] So it hides the chain link. [27:34.560 --> 27:43.560] But if the fence being gone would be good for you, then these people have nothing to negotiate with. [27:43.560 --> 27:45.560] It would be good for us. [27:45.560 --> 27:48.560] It looks much better without the fence thing. [27:48.560 --> 27:51.560] So that is what we like to do is just to take it down. [27:51.560 --> 27:52.560] Exactly. [27:52.560 --> 27:55.560] So no, we have to complain. [27:55.560 --> 28:05.560] 30 days will elapsed and they got come with a counterclaim and then we have to reply, we have 30 days to reply to the counterclaim, right? [28:05.560 --> 28:08.560] Can I also do a summary judgment and do a reply within the summary judgment? [28:08.560 --> 28:16.560] You can only do a summary judgment depending on how they respond. [35:22.560 --> 35:32.560] And if I could come in and I got a friend next door, and he doesn't complain because I violate all these deed restrictions, [35:32.560 --> 35:39.560] and then the guy next door sells his property to somebody else and a new person comes in, I can't say to them, [35:39.560 --> 35:42.560] well, the guy before you didn't complain, so you can't complain. [35:42.560 --> 35:48.560] So I can see where leches would be appropriate on a deed restriction. [35:48.560 --> 35:55.560] If it's an HOA, the HOA was there, and the HOA was there for the purpose of enforcing those restrictions. [35:55.560 --> 36:05.560] If the HOA failed to enforce the restrictions, it would seem reasonable that you could go to latches. [36:05.560 --> 36:08.560] Does that make sense? [36:08.560 --> 36:10.560] Yes, but they have never asked us. [36:10.560 --> 36:15.560] That's a good point, and that's a very good point because there are new great neighbors there before, [36:15.560 --> 36:20.560] and these people have moved in 2016, so they've been there since 2016. [36:20.560 --> 36:27.560] But since that time, they have never said anything about it until now, trying to find something retaliatory. [36:27.560 --> 36:37.560] Do you have any record of complaints about noisy chickens, or about kicking poop on their fence or in their yard, [36:37.560 --> 36:41.560] or anything of any complaints about chickens? [36:41.560 --> 36:44.560] Zero, absolutely zero. [36:44.560 --> 36:53.560] In order for them to raise an issue, especially if it's been a long-term issue, they would have to show some kind of harm. [36:53.560 --> 36:59.560] While restrictions on chickens may be in the deed restrictions, [36:59.560 --> 37:10.560] you could certainly argue that the commercial raising of chickens is what the deed restriction intended, [37:10.560 --> 37:15.560] not five-pet chickens. [37:15.560 --> 37:20.560] Obviously, the five chickens hasn't caused any problem because nobody's raised any issues, [37:20.560 --> 37:25.560] so these are not chickens, these are pets. [37:25.560 --> 37:31.560] If they go to court, you've got to know you're going to get in front of a judge, and he's busy. [37:31.560 --> 37:36.560] He's got lots of ugly, nasty stuff coming to form all the time, [37:36.560 --> 37:43.560] and you come in front of the judge with them complaining about five chickens, give me a break. [37:43.560 --> 37:52.560] Complaining about a trashy fence next to my expensive house, that's a real issue, [37:52.560 --> 37:59.560] so I would suspect that this lawyer is not going to get very far with his chicken issue. [37:59.560 --> 38:10.560] Let me ask you, so the lawyer has called and almost triggered a threat that they're going to do this if we don't come to a similar deal, [38:10.560 --> 38:15.560] and the only deal for them is to cancel our complaint, which we're not going to do. [38:15.560 --> 38:29.560] The venue is asking us to kind of threaten us and throw this chicken coop at us. [38:29.560 --> 38:33.560] Wait a minute. Can you talk a little slower? You're talking a little faster than I can listen. [38:33.560 --> 38:36.560] I do go a little faster. Yeah, I'm sorry. [38:36.560 --> 38:50.560] So when the lawyer came and he asked us that the chicken coop, he's got to use that as the kind of claim if we don't do or don't reconsider this complaint. [38:50.560 --> 39:00.560] So my question to you, wouldn't that be considered a threat, something that I could maybe boggle him with? [39:00.560 --> 39:11.560] No, no, no. You can't threaten to do something that you have the right to do. That's not a threat. That's notice. [39:11.560 --> 39:13.560] It's not a threat. Okay. [39:13.560 --> 39:17.560] So that would be considered notice and opportunity. [39:17.560 --> 39:25.560] He's notifying you of something that he has the right to do and giving you opportunity to cure. [39:25.560 --> 39:36.560] The only time something is a threat is if somebody states they will do something that they don't have the right to do, like I'll duck your eye if you don't do that. [39:36.560 --> 39:40.560] That would be a threat. Does that make sense? [39:40.560 --> 39:43.560] Okay. Yeah, it does. [39:43.560 --> 40:01.560] So going back to the procedure, once I reply and they don't come back with anything else, is that when I would come back with a summary judgment or could they come back with a summary judgment as well because two judgments request one from the defendant, one from the plaintiff? [40:01.560 --> 40:09.560] The only time you can come back for summary judgment is when there are no facts in contention. [40:09.560 --> 40:10.560] In contention. [40:10.560 --> 40:26.560] Yeah, if everybody agrees on the facts, but they don't agree on the effect of the facts as regards to the current day restrictions, then you can go for summary judgment. [40:26.560 --> 40:36.560] But if you have a disagreement on the facts, then the court must first make a determination of what the facts are. [40:36.560 --> 40:42.560] Once they have all of the facts, then a ruling can be issued. [40:42.560 --> 40:51.560] A judge has a duty to determine the facts in accordance with the rules of evidence, then apply the law as it comes to him to the facts in the case. [40:51.560 --> 40:53.560] That's his job. [40:53.560 --> 40:57.560] Doesn't matter what he thinks is right, what he thinks is wrong. [40:57.560 --> 41:00.560] We're not in a common law state. [41:00.560 --> 41:11.560] Instead, he must determine the facts, then apply the law to the facts, so once all the facts are determined, the only thing left is law. [41:11.560 --> 41:17.560] Then you can ask the judge to rule on how the standing law applies to the facts. [41:17.560 --> 41:29.560] Now, the other guy is going to say, well, the standing law applies differently to the facts, so you have two different ideas of how the law should apply to the facts. [41:29.560 --> 41:33.560] If there are no facts in contention, then you can ask the judge for summary judgment. [41:33.560 --> 41:41.560] And what will happen generally when that's done, both sides ask the court for summary judgment. [41:41.560 --> 41:47.560] You ask for the judge to rule your way, they ask the judge to rule their way. [41:47.560 --> 41:49.560] Okay, does that make sense? [41:49.560 --> 42:01.560] Yes, after I answer the counterclaim, their counterclaim, and there's no more questions or anything, no other claims, then I can do the summary judgment, correct? [42:01.560 --> 42:02.560] Yes. [42:02.560 --> 42:11.560] If they say, well, she's got five chickens, and those five chickens are against the coverance. [42:11.560 --> 42:15.560] And you say, yes, as a matter of fact, I do have five chickens. [42:15.560 --> 42:17.560] That's the fact. [42:17.560 --> 42:24.560] But because of the nature of the way I have these chickens, they're not in violation of the coverance. [42:24.560 --> 42:28.560] So the only disagreement here is not on whether or not you have five chickens. [42:28.560 --> 42:30.560] That's agreed. [42:30.560 --> 42:33.560] Just how the law applies to those five chickens. [42:33.560 --> 42:36.560] So yes, you could go for summary judgment. [48:26.560 --> 48:28.560] Did you file a petition for a mandamus? [48:28.560 --> 48:30.560] Oh yeah, I filed that. [48:30.560 --> 48:32.560] I said, have you been through Jurisdictionary? [48:32.560 --> 48:35.560] Oh yeah, I've been through Jurisdictionary. [48:35.560 --> 48:41.560] Once you've been through Jurisdictionary, then you know what all the parts and pieces are. [48:41.560 --> 48:51.560] And in any case that comes along, you'll pretty well understand what the pieces are and how they work and how they fit together, [48:51.560 --> 48:58.560] like summary judgment as opposed to default judgment, as opposed to mandamus. [48:58.560 --> 49:05.560] We get a good basic overview. You know, they don't really teach all that in law school. [49:05.560 --> 49:08.560] Lawyers don't learn that stuff until they get out of law school. [49:08.560 --> 49:13.560] In law school, they learn how to argue legal issues. [49:13.560 --> 49:23.560] They don't learn how to isolate those issues, how to file motions, how to get motions put on for hearing, [49:23.560 --> 49:31.560] how to respond to motions, how to, there's just 100 things that they learn in practice. [49:31.560 --> 49:33.560] You know, most of the time, lawyers get out of law school. [49:33.560 --> 49:36.560] They don't have any idea how to practice law. [49:36.560 --> 49:42.560] And the ideal situation for lawyers to get hired, to get taken on by a law firm, [49:42.560 --> 49:46.560] and they kind of bring the young lawyer along. [49:46.560 --> 49:52.560] Otherwise, they get on the attorney's wheel and get appointed as court appointing counsel. [49:52.560 --> 49:56.560] And as court appointed counsel, the judge and the prosecutor, [49:56.560 --> 50:04.560] and while they're doing their job, will also teach the new lawyer how to do what they're supposed to do. [50:04.560 --> 50:10.560] Drift dictionary will give you that underpinning. [50:10.560 --> 50:13.560] And all of this stuff you're doing will get a lot easier. [51:38.560 --> 51:40.560] And he went inside. [51:40.560 --> 51:45.560] And when he counted, he got to 200 and wasn't done yet. [51:45.560 --> 51:48.560] He called the fire marshal. [51:48.560 --> 51:57.560] And the fire marshal came down and evacuated the whole building. [51:57.560 --> 51:58.560] Oh, you love Art. [51:58.560 --> 51:59.560] He is insane. [51:59.560 --> 52:02.560] But he makes these people crazy. [52:02.560 --> 52:07.560] And he's got a real good head for how to co-act with these people. [53:08.560 --> 53:10.560] Well, when they deal with someone who's civil, [53:10.560 --> 53:16.560] even when the lawyer's not, the judge is a human being. [53:16.560 --> 53:20.560] And he gets annoyed with that. [53:20.560 --> 53:24.560] And everything should be documented. [53:24.560 --> 53:29.560] If they called you and you don't have it recorded, [53:29.560 --> 53:31.560] as soon as you get off the phone, [53:31.560 --> 53:38.560] take a pad and piece of paper and just write a quick synopsis of what went on on the phone. [53:38.560 --> 53:40.560] It doesn't have to be highly detailed, [53:40.560 --> 53:43.560] but that's a memnonic device. [01:04:47.560 --> 01:04:53.560] They, the prosecution did not file any opposition. [01:04:53.560 --> 01:04:57.560] And when I got into court for the hearing, [01:04:57.560 --> 01:05:00.560] I sat down and the judge said, [01:05:00.560 --> 01:05:02.560] well, it's your motion, proceed. [01:05:02.560 --> 01:05:05.560] And in a lightning moment, I said, [01:05:05.560 --> 01:05:07.560] well, I'm not going to sit here and argue with myself. [01:05:07.560 --> 01:05:10.560] And then I go, holy crap, what do I have to say? [01:05:10.560 --> 01:05:12.560] My papers stand for themselves. [01:05:12.560 --> 01:05:15.560] And they didn't file an opposition. [01:05:15.560 --> 01:05:17.560] And this all took a second. [01:05:17.560 --> 01:05:20.560] And I said, your honor, there's no opposition to the motion. [01:05:20.560 --> 01:05:23.560] So I expect it to be granted. [01:05:23.560 --> 01:05:28.560] And this lawyer that showed up said, oh, your honor, your honor, [01:05:28.560 --> 01:05:32.560] I'm here on behalf of the prosecutor. [01:05:32.560 --> 01:05:34.560] I work in the prosecutor's office. [01:05:34.560 --> 01:05:38.560] And I prepared to give an oral opposition to the motion. [01:05:38.560 --> 01:05:41.560] Well, he stopped talking, which was his first mistake. [01:05:41.560 --> 01:05:43.560] The judge looked at me and I said, [01:05:43.560 --> 01:05:46.560] well, I would object to that. [01:05:46.560 --> 01:05:48.560] And I said, look, your honor, I'm not a lawyer. [01:05:48.560 --> 01:05:51.560] And whatever this guy is going to say, [01:05:51.560 --> 01:05:53.560] I would need time to research. [01:05:53.560 --> 01:05:56.560] And your honor, this is not how this works. [01:05:56.560 --> 01:05:59.560] This is a, you know, look, you file a motion, [01:05:59.560 --> 01:06:01.560] they file an opposition. [01:06:01.560 --> 01:06:05.560] Then I have time to file a rebuttal. [01:06:05.560 --> 01:06:07.560] What they're trying to do right here right now [01:06:07.560 --> 01:06:10.560] is deny you due process. [01:06:28.560 --> 01:06:33.560] So this guy proceeds to say, well, Amir, the prosecutor, [01:06:33.560 --> 01:06:35.560] Amir looked at the motion. [01:06:35.560 --> 01:06:37.560] Amir did some research. [01:06:37.560 --> 01:06:40.560] Amir says the law was enacted in such a state [01:06:40.560 --> 01:06:43.560] and that he has found the enacting clause. [01:06:43.560 --> 01:06:46.560] Regarding the misdemeanor, [01:06:46.560 --> 01:06:49.560] Amir hasn't found the enacting clause, [01:06:49.560 --> 01:06:51.560] but he sure he can't. [01:07:32.560 --> 01:07:35.560] And I, by the way, I did have somebody observing all of this. [01:07:35.560 --> 01:07:38.560] And Randy, I was much cooler in the courtroom [01:07:38.560 --> 01:07:40.560] than I am right now. [01:07:40.560 --> 01:07:44.560] And I said, your honor, back in April, [01:07:44.560 --> 01:07:47.560] I had five motions on calendar. [01:07:47.560 --> 01:07:49.560] And he's like, Mr. Scott, Mr. Scott. [01:07:49.560 --> 01:07:51.560] Your honor, please, just a moment. [01:07:51.560 --> 01:07:52.560] I'll make this quick. [01:07:52.560 --> 01:07:55.560] I had five motions on calendar. [01:08:20.560 --> 01:08:22.560] He was also hand-served at the DA window, [01:08:22.560 --> 01:08:25.560] and I have file stamp copies to prove it. [01:08:25.560 --> 01:08:28.560] So that time he actually appeared and didn't answer. [01:08:28.560 --> 01:08:31.560] And now today he doesn't even appear. [01:08:31.560 --> 01:08:34.560] I said, this is sandbagging. [01:08:34.560 --> 01:08:37.560] And this is denial of due process. [01:08:37.560 --> 01:08:40.560] And Mr. Scott and Mrs. Scarlett, [01:08:40.560 --> 01:08:42.560] and the bailiff's getting closer. [01:08:42.560 --> 01:08:45.560] And I go, well, your honor, [01:08:45.560 --> 01:08:48.560] I just felt because this is the first time [01:08:48.560 --> 01:08:50.560] you have ever presided over the case [01:08:50.560 --> 01:08:52.560] that you needed a little bit of background [01:08:52.560 --> 01:08:54.560] as to why you should grant my motion today. [01:10:02.560 --> 01:10:06.560] So they had a closed courtroom hearing on me [01:10:06.560 --> 01:10:10.560] talking to the judge about my tooth and such, [01:10:10.560 --> 01:10:12.560] which by the way, I could have probably told them, [01:10:12.560 --> 01:10:14.560] no, I want this in open court. [01:10:14.560 --> 01:10:17.560] But they handled that with me and the judge, [01:10:17.560 --> 01:10:20.560] which is kind of ironic because I didn't want to get smart [01:10:20.560 --> 01:10:25.560] with this judge because she gave me some time in the past. [01:10:25.560 --> 01:10:28.560] And what I mean by time is she gave me more time. [01:10:28.560 --> 01:10:30.560] She didn't give me jail time. [01:10:30.560 --> 01:10:35.560] But I wanted to ask her where she got her medical degree. [01:10:35.560 --> 01:10:38.560] But instead I played it cool. [01:10:38.560 --> 01:10:42.560] I explained the situation and she denied it. [01:10:42.560 --> 01:10:44.560] Then she opened the court back up [01:10:44.560 --> 01:10:49.560] and she took on my motion to vacate the trial date. [01:13:49.560 --> 01:14:00.560] And remember what I said earlier, they're going to huff and puff and rant and rave until you get to the courthouse steps. [01:14:11.560 --> 01:14:20.560] The prosecutor has not showed up at the last five hearings. I have a bar complaint actively open against them being investigated. [01:14:20.560 --> 01:14:29.560] But I want to get back to another thing that, you know, they're denying me a copy of the court case file and a register of the record. [01:14:29.560 --> 01:14:32.560] The judge herself has denied those. [01:14:32.560 --> 01:14:38.560] I put in for ancillary expenses, and the judge denied those. [01:14:38.560 --> 01:14:43.560] Which that should get a mandamus. That's a simple mandamus. [01:14:43.560 --> 01:14:50.560] Okay. Well, what I've now figured out, we have a thing called a serenum motion. [01:14:50.560 --> 01:14:55.560] And you know, Randy, this is coming up on four years. [01:14:55.560 --> 01:15:04.560] I now have the proof that they filed the information against me on February 12th of 2015. [01:15:04.560 --> 01:15:10.560] They did not bring me to arraignment for 299 days after that. [01:15:10.560 --> 01:15:19.560] I see cases where that have gone to the appellate court that only five months after the filing of the information, [01:15:19.560 --> 01:15:28.560] these charges, serious charges, were dismissed for them on the serenum thing. [01:56:17.560 --> 01:56:30.560] And the next year, my law firm couldn't get, next year, my law firm's mouth practice insurance doubled.
