I don't know what that something else would literally be at this point, but the [05:14.600 --> 05:20.840] way Facebook is censoring everybody's ability to communicate and who can communicate and [05:20.840 --> 05:25.400] what they can communicate about, it is no longer someplace that I personally desire [05:25.400 --> 05:30.520] to be. If you're one of those kinds of people that spend so much time on Facebook that you're [05:30.520 --> 05:37.520] constantly having to clean blood off the windshield of your car, then you need to consider a different [05:37.520 --> 05:44.520] lifestyle to begin with, but Facebook itself needs to go. That being said, one of the reasons [05:44.520 --> 05:52.520] they claimed that they were doing this purge was so that people couldn't adversely affect [05:52.520 --> 05:59.520] election processes and so on and so forth, when in fact, its purge is doing exactly that. [05:59.520 --> 06:07.520] It is taking political dissenters and silencing them so that those that favor the outcome [06:07.520 --> 06:16.240] of those Facebook supports are the only ones with a voice. That's just one of the many [06:16.240 --> 06:24.840] reasons why that needs to be shut down as far as participation goes. If you haven't noticed [06:24.840 --> 06:28.520] that, then you're really not paying attention to what's going on, but it is what they're [06:28.520 --> 06:34.840] doing. All you have to do is look at the groups that are being closed down and kicked off [06:34.840 --> 06:44.640] to see how factual that pattern is as to who is actually being silenced and who is not. [06:44.640 --> 06:51.920] That being said, the one that I've started to move to was MIUI. I don't spend a whole [06:51.920 --> 06:56.520] lot of time on it mainly because nobody comes on there to communicate much and I don't get [06:56.520 --> 07:01.040] to spend a whole lot of time on either one of them except when I'm trying to answer questions [07:01.040 --> 07:06.680] and issues for folks, which I wasn't getting a lot of, except on Facebook where the following [07:06.680 --> 07:15.920] is a whole lot bigger. Right now, my time is so limited in what I'm able to do because [07:15.920 --> 07:21.840] I am trying so hard to get the case law and everything I need looked up, verified and [07:21.840 --> 07:28.440] cross-referenced and everything else to get the new seminar material further along than [07:28.440 --> 07:34.880] it is. This is, I thought the first one was hard to do in two months. This one I've been [07:34.880 --> 07:41.400] working on for years and I want to do absolutely right, but being by myself and having to keep [07:41.400 --> 07:48.360] up with everything and Texas law changing every two years because of legislative sessions, [07:48.360 --> 07:55.560] it's very hard to keep this stuff current all the time because every time I get to one [07:55.560 --> 08:00.600] point where I'm ready to get something else done, something previously done has to go [08:00.600 --> 08:05.440] back and be revisited because something new has come out about it, whether it be something [08:05.440 --> 08:12.160] actually done by the legislature or whether it be something actually done by the courts. [08:12.160 --> 08:18.560] So for every thing that happens out there and I become aware of, I've got to evaluate [08:18.560 --> 08:24.520] how that affects the information I've already got in place and then go back and figure out [08:24.520 --> 08:33.680] how to address it as to what the potential effects of it are. So this is one of the things [08:33.680 --> 08:39.680] about having to spend all of my time doing this and why I tell you that this is why we [08:39.680 --> 08:46.640] do what we do and we have to rely on you to keep us alive and keep us going. Now, any business manager will tell you or any [09:54.320 --> 10:01.720] economics professor will tell you that when you find something that a market needs, then [10:01.720 --> 10:07.400] your business will generally build itself because you are providing something that everyone [10:07.400 --> 10:15.800] needs. Well, that's not necessarily true, especially when that thing is something people do not [10:15.800 --> 10:23.360] understand or realize why they need it. They would rather have that cheese cutter or cucumber [10:23.360 --> 10:31.920] slicer or food processor than they would in education on how to live better than they [10:31.920 --> 10:42.000] are in a system that is stealing their livelihood out of their pockets at a return. And the [10:42.000 --> 10:51.360] thing that I have found most amazing about that is how that mindset was instilled in [10:51.360 --> 11:05.200] us to accept. I am astounded by the psychological manipulations and the indoctrination process [11:05.200 --> 11:15.200] in general that could be done in such a way that reasonable people fail to notice the [11:15.200 --> 11:24.680] disparities in everything that is being done to them with everything that they were originally [11:24.680 --> 11:35.720] taught was not allowed to be done to them. Now, I am not the oldest guy on this planet [11:35.720 --> 11:42.360] by a long shot. In fact, I am barely past the half century mark in the grand scheme [11:42.360 --> 11:51.760] of things. And yet for some reason, I am in a very small minority of living individuals [11:51.760 --> 11:58.840] that actually understands that we are being lied to on a daily basis about how this system [11:58.840 --> 12:08.400] was set up to work and who is actually responsible for the way that it works. And ultimately, [12:08.400 --> 12:13.480] when you get down to the brass tacks, the ones responsible for the way that it works [12:13.480 --> 12:24.960] is us because the duty falls to us to ensure that those in whom we instill certain powers [12:24.960 --> 12:31.880] and authority use that power and authority in accordance with the rules that we also [12:31.880 --> 12:40.600] established for them to comply with. And ladies and gentlemen of the listening audience, [12:40.600 --> 12:46.000] let me tell you something that my thought process immediately sets off alarm bells [12:46.000 --> 12:55.920] with. And that is when one of those persons to whom we have given a certain amount of [12:55.920 --> 13:05.280] power and authority begins to assert that they can use that power and authority in [13:05.280 --> 13:14.120] a manner that violates the other provisions that we have in place about what they can [13:14.120 --> 13:22.880] and cannot do with the claim that the necessity of the power given to them requires them to [13:22.880 --> 13:31.400] break those other rules in order to carry out that power. And therein lies a logical [13:31.400 --> 13:40.240] rub that I can't get around and I have been trying for years now to get others to understand [13:40.240 --> 13:50.600] cannot be the way that it actually works. Why? Well, first thing is, is we cannot delegate [13:50.600 --> 13:57.880] a greater power than we possess. If it's illegal for me to murder someone, then it's [13:57.880 --> 14:05.240] illegal for someone I give authority to to do that thing in my place. I don't have the [14:05.240 --> 14:09.040] power and authority to murder. They don't have the power and authority to murder and [14:09.040 --> 14:17.040] I can't give it to them. And it doesn't matter whether it's one of us or 10 million of us. [14:17.040 --> 14:23.000] One of us of individual as individuals have the lawful right to murder someone else. So [14:23.000 --> 14:30.960] we cannot give that right to those who are operating as our agents or servants. That's [14:30.960 --> 14:44.240] law 101. And yet, here we have courts, prosecutors, cops, and everybody else claiming that the [14:44.240 --> 14:53.280] necessity of the governmental powers allows them to do things that it is otherwise wholly [14:53.280 --> 15:01.440] illegal for you and I to do as individuals. Now, if you want to understand when you have [15:01.440 --> 15:11.120] lost control of your government, that is the best example I can give you. When your government [15:11.120 --> 15:19.520] insists that the power you gave it can be used to violate the other rules that you use [15:19.520 --> 15:26.200] to prevent them from doing that thing in the first place, then you no longer control the [15:26.200 --> 15:40.640] mad dog you call government. And I don't understand why people don't understand that. And know [15:40.640 --> 15:46.520] for you patronuts out there that may eventually hear this or are listening now, that doesn't [15:46.520 --> 15:54.200] mean stand under anything. Learn proper English. Stop trying to rewrite it to suit your idiotic [15:54.200 --> 16:01.520] concepts of what words mean and how they're used. None of you are linguistic specialists. [16:01.520 --> 16:06.680] And the more you try to do things like that, the more you prove you're one of those people [16:06.680 --> 16:12.360] that needs to be put in a special ed class because somewhere you've gone completely off [16:12.360 --> 16:19.880] the rails and your meds are no longer working properly. So either up the dosage or commit [16:19.880 --> 16:26.800] yourself something because you are trying to rewrite the entire language that has existed [16:26.800 --> 16:34.520] since long before you came into being to suit the mental state you've created for yourself [16:34.520 --> 16:41.960] on what these words and terms mean. Would you mind, if that is [23:59.280 --> 24:07.120] the reason you're calling anyway, on letting the folks know why I made that segue to you? [24:07.120 --> 24:14.600] Well, Friday morning, this last Friday morning at Old Dark 30 in the morning, I was heading [24:14.600 --> 24:25.240] north from US Highway 90 heading up towards IH 10 where I go over and catch the road [24:25.240 --> 24:32.640] and go on into Ozona. Which is how many miles from the US-Mexico border? Well, the town [24:32.640 --> 24:39.440] of Dryden is 22 miles where I was stopped at at 7.15 in the morning by three Border [24:39.440 --> 24:46.920] Patrol agents who were totally out of their jurisdiction was well over another 30 miles [24:46.920 --> 24:53.400] north. So, you're about 50- So, 50-plus miles from the border, you were pulled over by three [24:53.400 --> 24:59.920] Border Patrol agents? Yes, sir. Okay. Now, before we continue, let me fill in some folks [24:59.920 --> 25:05.040] here real quick. First and foremost people, Article 2.12 of the Texas Code of Criminal [25:05.040 --> 25:09.200] Procedure very clearly says Border Patrol is not a law enforcement agency within the [25:09.200 --> 25:13.920] territorial borders of the state of Texas. As they are not a law enforcement agency, [25:13.920 --> 25:19.840] they have no authority to enforce any Texas law on Texas soil. There are no areas where [25:19.840 --> 25:24.320] they perform this stop that are ceded to the federal government, and therefore they are [25:24.320 --> 25:29.960] not within an area of authority where they could apply any federal law to this stop. [25:29.960 --> 25:39.280] All right, Pat, please continue. Well, you kind of hit the nail on the head. As I explained [25:39.280 --> 25:46.920] to the young man who was the supervisor of the total little team here, he was out of [25:46.920 --> 25:54.560] his jurisdiction. He loved my explanation so much that he pulled a Glock stuck in my [25:54.560 --> 26:02.240] face. Now, for those of you that are not familiar with a Glock, it has no safety. And [26:02.240 --> 26:11.000] these things all have hair triggers. So, we had a little discussion back and forth for [26:11.000 --> 26:17.320] a couple of minutes. It wound up with me being spread eagle on the side of my automobile, [26:17.320 --> 26:23.480] being handcuffed and stuffed or tried to be stuffed into another pickup. Now, for those [26:23.480 --> 26:28.000] who don't know, I'm a 100% disabled veteran. I have absolutely no use of my right arm or [26:28.000 --> 26:37.560] my left leg. And I weigh 103 pounds, and I'm a senior citizen. So, start off with, in [26:37.560 --> 26:45.360] the Texas Code of Penal Code, aggravated assault on a handicapped or senior citizen under the [26:45.360 --> 26:53.840] color of law or the color of a government agency is a first degree felony. Secondly, [26:53.840 --> 27:01.640] I was detained by people who had no jurisdiction to even turn on their lights out on the highway. [27:01.640 --> 27:09.000] And no probable cause to do so. Well, the reason that they gave for the stop, not to [27:09.000 --> 27:19.240] me, but to the senior supervisor on the radio later was because of a suspicious vehicle. [27:19.240 --> 27:26.720] I live in the county. It's my inspection sticker and registration and all that stuff, which [27:26.720 --> 27:33.760] is all one sticker, says my county name, you know, the county on it. And I am very well [27:33.760 --> 27:39.080] known out here, considering there's less than a thousand people in the whole county, probably [27:39.080 --> 27:50.080] at least 600 of them know me, at least by sight. And all the law enforcement in the county [27:50.080 --> 27:57.120] definitely know me, including the JPs and everybody else, county judge, and our dear [27:57.120 --> 28:07.040] sheriff. I'll get into him in a minute. But after they had me placed in one of the Border [28:07.040 --> 28:12.680] Patrol vehicles sitting in the back seat, they came over and asked me for permission [28:12.680 --> 28:22.360] to move my vehicle. I denied to give them permission. Under Texas law, transportation [28:22.360 --> 28:32.480] code, if you're arrested at a remote location and your vehicle is out there, your automobile, [28:32.480 --> 28:37.800] and you do not give them permission to move it or tow it, they have to give you the ability [28:37.800 --> 28:45.400] to get other arrangements made. That was refused to me. Now, you have to understand [28:45.400 --> 28:52.920] at this point, this is about 7.30 in the morning at that point, they finally told me who the [28:52.920 --> 28:58.960] senior supervisor for the day was or for the shift. A man I know pretty well, I've known [28:58.960 --> 29:05.680] him about seven years, and he's one of the best Border Patrol agents I've ever met. [29:05.680 --> 29:12.960] Now, don't get me wrong, or anybody else. I believe in the Border Patrol. They have [29:12.960 --> 29:19.240] a job, and it's not easy. But it is like every organization out here, every agency [29:19.240 --> 29:26.120] that I have ever dealt with, you have good, and you have bad, and you have a few indifferent. [29:26.120 --> 29:36.000] But the bad in Border Patrol seem like they have this God complex, and they wear a weapon [29:36.000 --> 29:41.880] on their hip, and a patch that resembles a badge sewn onto the uniform. [29:41.880 --> 29:45.120] Yeah, hang on just a second, Pat. I got a break here, and I'll pick up on the other [29:45.120 --> 29:49.520] side, okay? They grilled him on his hobbies and the video, and then Justin says they tried [31:12.440 --> 31:18.840] to recruit him as an informant. He declined. [33:44.200 --> 33:53.440] Well, as you well know Eddie, if you have a law enforcement individual, whether it be [33:53.440 --> 34:00.000] a deputy or a police officer or whatever, to make a stop, they have to have articulated [34:00.000 --> 34:08.960] probable cause of some sort. There has to be at least more than just a suspicion of [34:08.960 --> 34:21.040] something or a hunch. A suspicious vehicle is not an articulated probable cause. They [34:21.040 --> 34:25.600] knew who I was. When they called in, I was sitting listening to the radio, and they [34:25.600 --> 34:37.800] told dispatch who they'd gotten, and, well, they got Baker, you know, okay. And the senior [34:37.800 --> 34:45.920] supervisor asked him by name first and last, if that was who they got, and they said yes. [34:45.920 --> 34:56.520] He said he was going to be in route. Now, that was over 50 miles from my location to [34:56.520 --> 35:05.720] the station. He made it there in about 20 minutes, so he was cooking. Yeah, assuming [35:05.720 --> 35:11.360] he was actually at the station at the time? Well, yeah, he may have already been moving [35:11.360 --> 35:17.280] somewhere else. It's quite possible, knowing the radio communications and everything else [35:17.280 --> 35:28.240] out there. And when he got on site, he apologized, but said his hands were tied. Now, he's not [35:28.240 --> 35:35.920] in the upper echelon of the station. He is a senior supervisor, shift supervisor, and [35:35.920 --> 35:43.080] there was other things that had transpired, not between me or anybody else, but between [35:43.080 --> 35:52.480] one of my neighbors a few days prior, who then called me the day before and told me about [35:52.480 --> 35:58.080] the verbal altercation with the station chief. The station chief called him. He didn't call [35:58.080 --> 36:05.800] him. The station chief, my neighbor, that is. And the station chief brought my name up [36:05.800 --> 36:14.240] in the conversation, totally unrelated to anything, and accused my neighbor of listening [36:14.240 --> 36:22.720] to me. I haven't talked to my neighbor about any of this in, I don't know, a year or so, [36:22.720 --> 36:30.600] but what I did do in the past was I provided him a copy of the Texas Code of Criminal Procedures [36:30.600 --> 36:38.880] and a copy of the memorandum between DOJ and DHS of pertaining to Border Patrol's drug [36:38.880 --> 36:45.720] interdiction policies. They don't have the authority, but that's a whole other side. [36:45.720 --> 36:52.200] And then a couple other documents, all standard stuff, you can get at almost any bookstore, [36:52.200 --> 36:53.200] right? [36:53.200 --> 36:54.200] Right. [36:54.200 --> 37:03.680] Little things. And what preceded was, I asked the senior supervisor, what was the charge? [37:03.680 --> 37:10.960] He said 18-111. That's interfering with an investigator's investigation. Well, in the [37:10.960 --> 37:24.680] Texas Code of Criminal Procedures 2.122, it lists multiple paragraphs of special investigators. [37:24.680 --> 37:30.200] All the other special investigators, other than Border Patrol and Customs agents, have [37:30.200 --> 37:36.840] some form of arrest authority. Border Patrol and Customs agents do not. They are not peace [37:36.840 --> 37:45.240] officers. Their jurisdiction is limited to the ports of entry between the land border [37:45.240 --> 37:46.240] crossing ports. [37:46.240 --> 37:51.080] Did he actually cite state law or did he try to cite federal law? [37:51.080 --> 37:57.680] He cited federal law and said that his guys could go anywhere they wanted to go and all [37:57.680 --> 38:03.040] this other stuff. And I looked at him and I said, nope. Your jurisdiction is outlined [38:03.040 --> 38:08.760] in accordance with a couple of different documents. One of them is Article 1, Section 8, Clause [38:08.760 --> 38:17.200] 17 of the U.S. Constitution that gives legislative authority for the federal legislature. [38:17.200 --> 38:24.120] The next one is a document that was commissioned by President Eisenhower in 1956. It was completed [38:24.120 --> 38:31.400] in 1957 or how the federal government could get jurisdiction within the many states for [38:31.400 --> 38:37.480] the construction of the Eisenhower Highway System, which we all know now as the Interstate [38:37.480 --> 38:45.680] Highways. It came back with one way, Article 1, Section 8, Clause 17 of the federal Constitution. [38:45.680 --> 38:50.720] You could not get around it. There is absolutely no way around it. These are their documents. [38:50.720 --> 38:53.320] I didn't make this stuff up. [38:53.320 --> 39:02.960] Now, the only places that the federal government has jurisdiction seated to them by the state [39:02.960 --> 39:11.120] legislature are the places that they have physically purchased and they have land patented [39:11.120 --> 39:18.680] granted to them by the state. And then they had to go back and request the seating of [39:18.680 --> 39:27.600] the jurisdiction. But if you look at Grammels, which is the old laws from 1925, the jurisdiction [39:27.600 --> 39:34.000] that is to be seated to the federal government is a joint jurisdiction. Joint jurisdiction [39:34.000 --> 39:43.400] in accordance with all the jurisdictional traditional work that's been done from 1925 [39:43.400 --> 39:51.440] until today says joint jurisdiction is a limited jurisdiction on the federal boy. They cannot [39:51.440 --> 40:02.000] prosecute in federal court if there's a crime that's been committed, whether it's state [40:02.000 --> 40:10.720] or federal, on federal territory that they own. They have to prosecute in state court. [40:10.720 --> 40:17.080] I've got that document. Now, I didn't sit there and argue with him. It was useless to [40:17.080 --> 40:25.000] sit and argue, especially the first guy. You don't argue with a man with a gun who's decided [40:25.000 --> 40:32.440] he's going to plant it in your face. I'm retired military. Eddie, you know that. And [40:32.440 --> 40:37.240] they disabled that. I've seen too many wars. I've seen too much bloodshed over stupid stuff [40:37.240 --> 40:46.600] to start with. So sometimes discretion is a better part of valor. So I shut my mouth [40:46.600 --> 40:53.040] and the senior supervisor had to be Miranda-ized, believe it or not. They actually read me the [40:53.040 --> 41:00.600] Miranda card federal. But they did not provide me an attorney, did not provide me a means [41:00.600 --> 41:06.800] of getting counsel, nor did they take me to go see a magistrate before booking. They [41:06.800 --> 41:14.680] took me to the border patrol station. They passed the county courthouse where there's [41:14.680 --> 41:20.960] three magistrates in there and the sheriff's department and with the county jail. We have [41:20.960 --> 41:25.560] no police out here. There's absolutely no city government plus over. [41:25.560 --> 41:30.120] Yeah, but regardless of whether there are any out there, Texas law says very clearly [41:30.120 --> 41:36.200] that if the border patrol arrests any individual, their mandate under Texas law is to immediately [41:36.200 --> 41:44.880] contact any local law enforcement agency available and to turn over the prisoner to that agency [41:44.880 --> 41:51.640] as quickly as possible. Without undue delay. Correct. Yes, that's what I was getting into [41:51.640 --> 41:56.160] next. Instead of doing all that and instead of taking me to a magistrate, because they [41:56.160 --> 42:02.160] could not take me to a federal magistrate, the closest federal magistrate is over 100, [42:02.160 --> 42:10.120] well, from my front gate is 100 miles from the station is about 126 miles one way to [42:10.120 --> 42:16.560] the nearest federal magistrate, which is Del Rio. So what they did is they, you know, [42:16.560 --> 42:25.000] went ahead. You do the body search stuff. You go in, they put me in a containment cell [42:25.000 --> 42:32.280] and you know, well, well know what I look like. I have no glutes. For those that don't [42:32.280 --> 42:40.040] know what that is, that's your backside. So I sit on bone when I sit down. The feeding [42:40.040 --> 42:47.480] in that cell number one is not ADA certified. The toilet facilities are not, but the seating [42:47.480 --> 42:56.280] in there are concrete benches, poured concrete. And I was not allowed to make a phone call. [42:56.280 --> 43:01.320] I was not allowed to talk to anybody other than that one senior supervisor. And that [43:01.320 --> 43:06.840] was from the time I got there and tell the time I was pulled out of the cell after four [43:06.840 --> 43:15.240] o'clock p.m. And told that they were going to release me because they finally realized [43:15.240 --> 43:23.520] after my only consumption of two small bottles of water and two small bags of Lay's potato [43:23.520 --> 43:30.360] chips. That's all I had to eat and drink all day long after eight and a half hours in confinement. [43:30.360 --> 43:36.760] That I might have a real problem eating the stuff that they tried to serve, which they [43:36.760 --> 43:40.880] did not serve. I hear the music, so we'll go to a pause. But what their plan was was to keep me from [47:38.400 --> 47:47.900] Friday to Monday over the weekend. And I informed them, quite frankly, I have a very special [47:47.900 --> 47:53.640] dietary requirement. There's nothing that's served in town. You have to understand that [47:53.640 --> 48:05.920] Sanderson's a wide-spotten road. The dietary services there are limited at best. Yeah, [48:05.920 --> 48:11.200] my wife just said that the best restaurant in town is a Stripe's gas station. So you [48:11.200 --> 48:18.760] might be a redneck if. But with that having been said, they did a warrantless search of [48:18.760 --> 48:24.160] the vehicle. They took the door panels off. One of my window regulators wasn't working. [48:24.160 --> 48:29.480] I had it scheduled for the day to be repaired because they had been back and forth trying [48:29.480 --> 48:37.160] to get the proper one. Finally got it done today. But somebody broke up the retaining [48:37.160 --> 48:43.920] pens and stuff on the panel on Friday. Their main concern was not me. It was the six live [48:43.920 --> 48:50.800] ducks in the back of the truck, the back of my van, because it was out there in the heat [48:50.800 --> 48:57.720] all day. But with that all having been said, when I told them, I said, if you can't get [48:57.720 --> 49:01.280] the federal prosecutor's office to give you an answer whether or not they're going to [49:01.280 --> 49:08.720] prosecute or not, then what you need to do is turn me over. Because you've already outstretched [49:08.720 --> 49:15.880] your requirements by many, many hours. And you have no jurisdiction. There was no jurisdiction [49:15.880 --> 49:26.240] from Jump Street. And the senior supervisor was very cordial, very on my side in a lot [49:26.240 --> 49:34.000] of ways. Yeah, but how can you be the supervisor and not have any authority to act is my question. [49:34.000 --> 49:40.680] The people over him, the station chief, the assistant station chief and the third guy [49:40.680 --> 49:47.760] in the chain there had already overruled him totally. You have to understand that this [49:47.760 --> 49:52.560] battle has been running now for many years. This isn't just something that's cropped up [49:52.560 --> 50:00.160] today. This has been an ongoing battle. No, I got all that. But at what point does he [50:00.160 --> 50:04.960] have to take a close look at what he's being told to do and say, you know what? I'm the [50:04.960 --> 50:11.160] one that's going to take the fall here if I do this just because they told me to. Because [50:11.160 --> 50:17.480] in order for this man to get his remedy, he has to sue them and me. And then what am I [50:17.480 --> 50:25.400] going to do? Because we've got criminal. We're processing some stuff right now. I don't know. [50:25.400 --> 50:30.040] I was talking to Randy about it. I've got to send some stuff up to Randy. He's in Dallas [50:30.040 --> 50:34.840] right now. He just got back from Mexico. But what I was told, and you have to understand, [50:34.840 --> 50:41.480] I did not talk to anybody. I could not make a phone call. I could not talk to a magistrate. [50:41.480 --> 50:49.920] I could not get out of that cell, period. That senior supervisor called my wife, told [50:49.920 --> 50:59.360] my wife what was going on. Well, she's right here next to me. She said that he called, told [50:59.360 --> 51:06.440] her that I was arrested. They had me in confinement. But he would not say why. What was the reason? [51:06.440 --> 51:12.960] What was the charge? Now, I was trying to get out of them. Was it a misdemeanor or was it [51:12.960 --> 51:20.280] a felony? And he said he didn't know. He wasn't the one filing the charges. He was the station [51:20.280 --> 51:28.880] chief. Now, he finally came back and said, well, they're going to make it a federal misdemeanor. [51:28.880 --> 51:36.720] I said, okay, A, B, or C. Didn't know. And nobody there would talk to me. Nobody come [51:36.720 --> 51:44.520] over to that bulletproof glass and even scream through the door to let me know anything. [51:44.520 --> 51:51.760] I never got a copy of anything other than I did get booked, fingerprinted, mugshot and [51:51.760 --> 51:58.240] all this before I was given an examining trial. And I told them, well, they're doing it. You [51:58.240 --> 52:04.200] guys are messing up. You have violated the federal rules of criminal procedure. You violated [52:04.200 --> 52:14.640] the state rules of criminal procedure. You do not have jurisdiction on a rural thoroughfare [52:14.640 --> 52:19.040] or any other thoroughfare. I said, you need to go back and look at the Texas Code of Criminal [52:19.040 --> 52:23.760] Procedures. It gives you your jurisdiction points. You're out of your jurisdiction. [52:23.760 --> 52:32.000] You have no authority. And that's when I asked him one very pointed question. And this is [52:32.000 --> 52:39.640] Randy's question. And if you lived in a police state, would you know it? And he stopped and [52:39.640 --> 52:44.760] he looked at me and said, that's the best question I've ever heard. And he was serious. [52:44.760 --> 52:51.440] You could see the fear in his eyes. He knew what was going down. And he knew that this [52:51.440 --> 53:00.640] was not going to end well. But finally, shortly after the last phone call to the federal prosecutor's [53:00.640 --> 53:07.360] office in Del Rio, they came back and said they were going to discharge me. The man who [53:07.360 --> 53:13.080] walked in then was the number two guy, man who's been in that station for six years and [53:13.080 --> 53:20.040] I've never seen him, never even heard of him. And he and I had about a five minute discussion [53:20.040 --> 53:26.960] about jurisdiction. And he didn't have any comments. He said, we're federal. I said, [53:26.960 --> 53:34.920] yeah, but you're within the state. You're acting without authority. You have no jurisdiction. [53:34.920 --> 53:42.680] The man pulled a sidearm with just wearing it is an open indication of intent to use [53:42.680 --> 53:51.320] deadly force. When he pulled the weapon, he then intended to cause massive bodily injury [53:51.320 --> 53:59.720] or death. They're firing or illicit or incite fear in you that he was intending to do so. [53:59.720 --> 54:07.960] Well, it's the same basic thing. Right. And there's a lot of things that go there. You [54:07.960 --> 54:16.080] know, like I said before, Valor has a lot of different colors. And my boss here wants [54:16.080 --> 54:23.880] to talk to you in a second. If you don't mind, she's very upset. But as you can well imagine, [54:23.880 --> 54:29.920] you know, probably on the other end of no, not with you. Oh, okay. Wait a minute. I tried [54:29.920 --> 54:43.240] to help her. Yeah, you don't want to get on her bad side. But our sheriff now you have [54:43.240 --> 54:51.080] to understand I have not talked to anybody at that point all the way through being released. [54:51.080 --> 54:55.720] And they decided that they were going to give me an option. I could either call someone [54:55.720 --> 55:06.040] to come and get me or they would just let me walk out of the place. Now, you know how [55:06.040 --> 55:14.320] I walk. Not well. And my van had already been picked up by somebody else and brought out [55:14.320 --> 55:22.760] to the ranch. So it wasn't available. And the ducks, they got out of the cage. So they [55:22.760 --> 55:30.040] were out of incarceration fast and missed their date with destiny. But with that having [55:30.040 --> 55:41.640] been said, the bottom line was apparently the two phone calls that were made to my wife, [55:41.640 --> 55:46.760] the first one to let her know I'd been arrested and incarcerated. And the second one made [55:46.760 --> 55:54.120] by the number two guy at the station telling my wife to come in and pick up the van when [55:54.120 --> 56:00.760] she had no transportation in there to get it. And if she did have transportation, how [56:00.760 --> 56:08.120] is she going to drive two cars, you know, minor, minor little problems? And I know travel. [56:08.120 --> 56:19.160] But they never ever mentioned the number of phone calls that had come in from other people. [56:19.160 --> 56:26.560] Apparently a couple of the people that my wife called after she was called, elicited [56:26.560 --> 56:32.640] over 200 phone calls to the station to the point that they didn't want any more phone [56:32.640 --> 56:42.080] calls. Now some of the people actually know other people and got some staffers at different [56:42.080 --> 56:50.160] congressional critters offices to make inquiries about my health and safety and welfare while [56:50.160 --> 56:59.080] in incarceration. They never asked about the nature of the charges or the nature of the [56:59.080 --> 57:12.040] incarceration at all, which is now that that's the Congress staffers, both state and federal. [57:12.040 --> 57:18.400] Randy called, he was in Mexico, he called and kind of shook their tree a little bit. [57:18.400 --> 57:24.680] A friend of mine who owned the newspaper in the San Antonio area called and I've already [57:24.680 --> 57:31.680] written him a couple of emails. There's a lot of other things going on right now. My [57:31.680 --> 57:37.040] oldest brother, whom I've probably never ever mentioned in the past, I haven't spoken to [57:37.040 --> 57:46.720] him in 18 years, he's an attorney over in Houston. He lives in one of the villages and [57:46.720 --> 57:58.880] he's mainly land investment. But when he sits down and does things, he's very oriented [57:58.880 --> 58:07.200] towards the fine points of things. He threatened them right up front and from what I understand, [58:07.200 --> 58:12.680] I have not talked to him, but he was mainly dealing with the fact that I'm handicapped [58:12.680 --> 58:19.400] and about my health. Basically, they went ahead and released me without giving me any paperwork. I had to sign for all my property back. I stopped by the station to go ahead and drop off the water bucket that had been put into the van for the duck this morning. [01:04:30.400 --> 01:04:48.400] And the station chief, who loves me about like, well, somebody's ex-mother-in-law, greeted me at the door. I gave him the little bucket and all that. [01:04:48.400 --> 01:05:07.400] And I told him I did not appreciate his hospitality from last Friday because he was bowing down and doing all the body language for somebody who's trying to ingratiate themselves with somebody else. [01:05:07.400 --> 01:05:11.400] I think that they realized that they stepped on it. [01:05:11.400 --> 01:05:20.400] Yeah, but the question here becomes is how many other motivational factors are being allied against you here? [01:05:20.400 --> 01:05:40.400] Now, just for those listening, in case no one knows who Pat actually is, Pat is also the gentleman that was unlawfully indicted by a grand jury in his county illegally by the prosecutor of that county, the DA, [01:05:40.400 --> 01:06:01.400] and two district judges who cooperated with the DA in violating Pat's right to not only an examining trial before this indictment, but in stacking a grand jury that contained members with personal grudges against Pat, all in secret. [01:06:01.400 --> 01:06:10.400] And this is the gentleman that I wrote some paperwork for and we got the entire case dismissed with prejudice. [01:06:10.400 --> 01:06:22.400] Now what we're seeing here brings to the forefront the possibility that this is not just something the border patrol may be engaging in on their own. [01:06:22.400 --> 01:06:36.400] There may be other forces operating behind the scenes to act in concert and collusion with the federal border patrol agents in the area to repeat this scenario again. [01:06:36.400 --> 01:06:51.400] Well, I have a feeling it is because my wife, and not just my wife, but several other people called the sheriff's department and talked to the sheriff himself, who was one of the deputies that was involved in the last affair. [01:06:51.400 --> 01:06:54.400] He became, he got elected the sheriff. [01:06:54.400 --> 01:06:58.400] He told my wife, don't call him back. [01:06:58.400 --> 01:07:01.400] Don't call again. [01:07:01.400 --> 01:07:09.400] Coming up on another property owner just blew her off and several other people. [01:07:09.400 --> 01:07:20.400] And what he's done is basically told my wife by his actions and everything else that we're not going to get protected under the law. [01:07:20.400 --> 01:07:28.400] He's the chief law enforcement for the county and he's turning a blind eye to what's going on. [01:07:28.400 --> 01:07:33.400] He's also taking federal monies, just like the county itself is taking federal monies. [01:07:33.400 --> 01:07:46.400] So they've abrogated their authority and abrogated their positions of enforcement of protection of the citizen's rights right up front. [01:07:46.400 --> 01:07:54.400] And this is one of the things that has gotten me where I'm at right now, I guess, is I'm a little vocal about that. [01:07:54.400 --> 01:08:00.400] Which, if you don't stand up and do something about the problem, then you're part of the problem. [01:08:00.400 --> 01:08:06.400] And I've been talking to a lot of different people on the phone for the last few days. [01:08:06.400 --> 01:08:18.400] And then when I have told, like the mechanic that I went over to see this morning in Alpine, when I told him about it, he looked at me with total shock in his face. [01:08:18.400 --> 01:08:28.400] And I said, they can't do that. They don't have any authority. And I said, well, can or cannot is immaterial when somebody's got a gun to your head. [01:08:28.400 --> 01:08:47.400] They did it, okay? And at that point, I'd much rather back up just a little bit and then hit them after the facts and sit there and argue with them and get the road all covered with blood. [01:08:47.400 --> 01:09:02.400] So what we've got to do from here on, and we've already been doing paperwork for the last few days after we got over the initial emotional values of things, [01:09:02.400 --> 01:09:12.400] I want people to realize the emotional impact it has on someone's family if they haven't been through it. [01:09:12.400 --> 01:09:27.400] My neighbor's wife, after my neighbor got told that he was going to get arrested by the same man the day before I got arrested, she is scared to death of traveling out here now. [01:09:27.400 --> 01:09:33.400] And they live five miles from us. They're our closest neighbor. [01:09:33.400 --> 01:09:43.400] He, our neighbor over there, he has a brain tumor. He's medically retired at the age of 50. [01:09:43.400 --> 01:09:57.400] And there's a lot of other people out here in the same boat. I was talking to a former Georgia deputy who moved out here with her husband. [01:09:57.400 --> 01:10:08.400] I said, they can't do that. I said, well, they did it. And she said, this is crazy, but it's getting worse. [01:10:08.400 --> 01:10:16.400] And I want people to realize what is going on here. This scenario has been used many, many, many times. [01:10:16.400 --> 01:10:27.400] And it's a PSYOP type of operation to instill fear so people will be acquiescing and let certain people do whatever they want to do. [01:10:27.400 --> 01:10:44.400] Today, coming back from Alpine, I saw at least 100 rail cars, flat cars loaded with heavy military equipment, earth building equipment, earth moving equipment. [01:10:44.400 --> 01:10:52.400] Big dozers and everything else, they're going to build a wall one way or another. [01:10:52.400 --> 01:11:02.400] And those convoys that are coming north is just a false flag thing so people will back the building of the wall. [01:11:02.400 --> 01:11:17.400] Well, it's the same technique that was used in the early mid-50s when the East Germans threw up the wall in Berlin and all the way down through Split East and West Germany. [01:11:17.400 --> 01:11:31.400] They staged a false invasion of Western Germans into East Germany and said that they were all coming over so that they could get the benefits of being socialists. [01:11:31.400 --> 01:11:38.400] There were a bunch of troops, East German troops, that were doing this in civilian clothes. [01:11:38.400 --> 01:11:44.400] That's why they built the wall for the main reason, to keep the Westerners out. [01:11:44.400 --> 01:11:50.400] Well, if it's strong enough to keep them out, it's strong enough to keep you in. [01:11:50.400 --> 01:11:56.400] And after they built that wall, that's when they put the iron fist in place. [01:11:56.400 --> 01:12:03.400] Same thing was used as a concept in building the Great Wall of China. [01:12:03.400 --> 01:12:10.400] Israel has a wall between it and Palestine, basically. [01:12:10.400 --> 01:12:14.400] And it's always the same type of thing. [01:12:14.400 --> 01:12:20.400] What's coming down the road, if people don't realize it, is going to be a lot worse than they can imagine. [01:22:16.400 --> 01:22:32.400] Now, it would be one thing if he gave you information showing you why it was not a legally valid subpoena that didn't require you to comply with it so that you would have at least some sort of defense for not appearing because of it. [01:22:32.400 --> 01:22:43.400] But if he didn't do that, then it doesn't sound to me like his intention was to do you any good. [01:22:43.400 --> 01:22:45.400] What do you have going on in the background? [01:22:45.400 --> 01:22:49.400] Do you have a radio plan or somebody doing dishes in a kitchen or something? [01:23:18.400 --> 01:23:23.400] Why do I have a feeling the person your dad's talking to is not an actual attorney then? [01:23:23.400 --> 01:23:26.400] I mean, he said he was retired. [01:23:26.400 --> 01:23:31.400] He said, so this is something that your dad doesn't actually know. [01:23:31.400 --> 01:23:34.400] He doesn't know this person from before. [01:24:57.400 --> 01:25:13.400] Because if you don't know how to go in there and make the appearance and or challenge the subpoena based on a sound legal basis, then you should have shown up with counsel. If you don't already know why the subpoena is legally invalid and you can't argue why that is and put that argument into writing and file it in the case, take your ass to court. [01:36:09.400 --> 01:36:16.400] The judge is guilty of abuse of discretion, which constitutes a breach of the right of due process. [01:36:16.400 --> 01:36:21.400] They will never say the judge acted with criminal intent if they can avoid it. [01:36:21.400 --> 01:36:27.400] They will say he abused his discretion in allowing the proceedings to continue without proper notice. [01:36:27.400 --> 01:36:34.400] But that issue still has to be raised in order to be preserved for the appellate process. [01:36:34.400 --> 01:36:35.400] Okay. [01:42:35.400 --> 01:42:40.400] It was a 92 Ford Mustang 5-liter. [01:42:40.400 --> 01:42:44.400] The car is not quite considered vintage, but it is a collector's item. [01:46:34.400 --> 01:46:41.400] Are they three-point restraints over the shoulder, or are they racing harness double-shoulder? [01:46:41.400 --> 01:46:45.400] I think it's a regular, you know, I don't know the answer to that, [01:46:45.400 --> 01:46:51.400] but I think that the seatbelt is pretty much standard like in any car. [01:46:51.400 --> 01:46:57.400] Okay, that's a three-point restraint. If it's not an antique with a lap belt only, [01:46:57.400 --> 01:47:02.400] and it's not a racing harness that comes down from over the top over both shoulders [01:47:02.400 --> 01:47:08.400] and latches across the chest, then it's more than likely a three-point restraint system. [01:47:08.400 --> 01:47:09.400] Okay. [01:47:09.400 --> 01:47:16.400] I have yet to see the three-point restraint system where you cannot take the over-the-shoulder portion of the belt [01:47:16.400 --> 01:47:19.400] and put it under your arm. [01:47:19.400 --> 01:47:22.400] Now, I'm not saying that was done. [01:47:22.400 --> 01:47:24.400] No, no, yeah, you can do that. [01:47:24.400 --> 01:47:32.400] Okay, but the point is you can't use photographs to show a judge that it can't be done because it absolutely can. [01:47:32.400 --> 01:47:37.400] It may not be comfortable, but it can be done. [01:47:37.400 --> 01:47:42.400] Well, it can be done under the arm, yes, but it can't run down the back, the side of the seat. [01:47:42.400 --> 01:47:47.400] You are presuming what the cop meant by side of the seat. [01:47:47.400 --> 01:47:51.400] That's a mistake. [01:47:51.400 --> 01:47:54.400] All right. [01:47:54.400 --> 01:48:01.400] During the trial, and the last question, during the trial, the guest witness who was hard of hearing [01:48:01.400 --> 01:48:07.400] misunderstood a question, and I know that for a fact, and he said something contrary to what he put in the answer, David, [01:48:07.400 --> 01:48:13.400] the sworn affidavit, and the judge jumped at the chance and said, okay, guilty because that, [01:48:13.400 --> 01:48:17.400] that's not something that's not in the statement and you're guilty. [01:48:17.400 --> 01:48:19.400] And that was it. [01:48:19.400 --> 01:48:26.400] He said something that's not in the statement or he said something that contradicts his previous statement. [01:48:26.400 --> 01:48:29.400] That contradicts the previous statement. [01:48:29.400 --> 01:48:31.400] Okay. [01:48:31.400 --> 01:48:37.400] And is there a transcript of what this person was asked and how they answered? [01:48:37.400 --> 01:48:45.400] We got a tape recording of it, the judge made a tape recording of it, and the defendant is asking for two transcripts. [01:48:45.400 --> 01:48:49.400] Why does the defendant have to ask for transcripts if you have a recording? [01:48:49.400 --> 01:48:52.400] Why can't you make a transcript yourself? [01:48:52.400 --> 01:48:53.400] Well, it's pretty low. [01:48:53.400 --> 01:48:55.400] I can hear it. [01:48:55.400 --> 01:48:56.400] I can hear it. [01:48:56.400 --> 01:49:00.400] Well, that doesn't answer my question. [01:49:00.400 --> 01:49:09.400] If you can transcribe the audio on your own, then why is he asking someone else for it and thus costing himself more money? [01:49:09.400 --> 01:49:14.400] Well, because they might not believe mine. [01:49:14.400 --> 01:49:17.400] They'll say it's phony. [01:49:17.400 --> 01:49:22.400] They would have to refute that with theirs in order for that to be true. [01:49:22.400 --> 01:49:27.400] Well, don't think for one minute that I won't compare mine with theirs to see if they've edited it. [01:49:27.400 --> 01:49:32.400] The judge is a copy of their audio recording. [01:49:32.400 --> 01:49:34.400] Oh, not a transcript? [01:49:34.400 --> 01:49:42.400] A transcript would be good, but I guarantee he's not going to get it for free, whereas the recording wouldn't probably cost him maybe ten bucks. [01:49:42.400 --> 01:49:43.400] Right, right. [01:49:43.400 --> 01:49:48.400] It's probably going to be a couple hundred dollars. [01:49:48.400 --> 01:49:53.400] Okay, but comment on the fact that the guest witness said something that was contrary. [01:49:53.400 --> 01:49:54.400] I can't comment. [01:49:54.400 --> 01:49:56.400] I don't know what the hell he said. [01:49:56.400 --> 01:49:58.400] Either before or after. [01:49:58.400 --> 01:50:00.400] How am I supposed to comment on that? [01:50:00.400 --> 01:50:08.400] The only comment I can make is, what is the judge basing his conclusion that it's contradictory on? [01:50:08.400 --> 01:50:14.400] It would have to be something clearly different than what is in the previous statement. [01:50:14.400 --> 01:50:17.400] I'm trying to tell you. [01:50:17.400 --> 01:50:20.400] No, you are trying to tell me what he said. [01:50:20.400 --> 01:50:23.400] You simply said he said something that was different. [01:50:23.400 --> 01:50:25.400] Well, I'm going to tell you now. [01:50:25.400 --> 01:50:29.400] After David, he said he was wearing his seatbelt properly. [01:50:29.400 --> 01:50:34.400] Then at the trial, he misunderstood, and I know he misunderstood. [01:50:34.400 --> 01:50:35.400] How do you know? [01:50:35.400 --> 01:50:37.400] Did you ask him after the fact? [01:50:37.400 --> 01:50:38.400] Did you misunderstand the question? [01:50:38.400 --> 01:50:40.400] Did you not hear it properly? [01:50:40.400 --> 01:50:42.400] Yes, I did. [01:50:42.400 --> 01:50:44.400] Then why didn't he clarify that for the judge? [01:50:44.400 --> 01:50:48.400] Why didn't he repeat what he thought he had heard himself being asked? [01:50:48.400 --> 01:50:54.400] Because at the time, he didn't know what the question was that he was asked, because he started hearing. [01:50:54.400 --> 01:51:00.400] He wouldn't have known that until the defendant told him afterwards that he goofed it up. [01:51:00.400 --> 01:51:06.400] Well, that's kind of problematic, don't you think, when the defendant is putting words in the mouth of the witness? [01:51:06.400 --> 01:51:09.400] No, he wasn't putting words in the mouth of the witness. [01:51:09.400 --> 01:51:16.400] If he's telling me, screwed up the answer he is. [01:51:16.400 --> 01:51:19.400] Trust me, I know what I'm talking about. [01:51:19.400 --> 01:51:22.400] Then why are you calling me? [01:51:22.400 --> 01:51:25.400] Because I know the facts of the case. [01:51:25.400 --> 01:51:27.400] I don't know how to apply it with the law. [01:51:27.400 --> 01:51:28.400] That's what I need you for. [01:51:28.400 --> 01:51:29.400] Okay. [01:51:29.400 --> 01:51:35.400] Well, I am basing what I'm telling you off the facts as you are giving them to me. [01:51:35.400 --> 01:51:36.400] Okay. [01:51:36.400 --> 01:51:38.400] What are the strong points for the defendant? [01:51:38.400 --> 01:51:40.400] What should he do in his appeal? [01:51:40.400 --> 01:51:48.400] Well, the first thing is, is can he show that the judge's ruling was an abuse of discretion? [01:51:48.400 --> 01:51:56.400] Did anyone inform the judge or anyone else in that courtroom that the witness was hard of hearing? [01:51:56.400 --> 01:51:58.400] There wasn't any time. [01:51:58.400 --> 01:51:59.400] The judge jumped on it. [01:51:59.400 --> 01:52:00.400] Wait a minute. [01:52:00.400 --> 01:52:06.400] Before you began this thing, there was plenty of time to say the witness is hard of hearing. [01:52:06.400 --> 01:52:09.400] Please state your questions loudly and clearly. [01:52:09.400 --> 01:52:11.400] Someone could have raised that point. [01:52:11.400 --> 01:52:12.400] Could they not? [01:52:12.400 --> 01:52:14.400] Yeah, they could have, but they didn't. [01:52:14.400 --> 01:52:19.400] Okay, then, so here is my problem with that. [01:52:19.400 --> 01:52:37.400] Trying to say he made a mistake after the fact when the witness himself does not know he made that mistake is your defendant trying to put words in the witness's mouth about what he should have heard. [01:52:37.400 --> 01:52:40.400] Hence the reason for my comment. [01:52:40.400 --> 01:52:41.400] No. [01:52:41.400 --> 01:52:45.400] Because he's saying this is what he was asked and this is what you should have said. [01:52:45.400 --> 01:52:51.400] That's trying to get him to testify to something different than what he believes he heard. [01:52:51.400 --> 01:53:06.400] Either way, the point is, if you don't have something in that record or some sort of record period to which to take to the appellate process to show that there was an abuse of discretion in that ruling [01:53:06.400 --> 01:53:21.400] and that there was, in fact, a confusion about the question asked in the testimony given, then what legal leg does your defendant have to stand on to argue his case on appeal? [01:53:21.400 --> 01:53:25.400] That's exactly my next question. [01:53:25.400 --> 01:53:41.400] Will effect what we discussed earlier with the judge, whatever it was you said, I don't remember now because I am so upset and so pissed off, it isn't funny. [01:53:41.400 --> 01:53:56.400] What we said in the beginning is it still holds water about the deposition and the fact that they didn't supply one properly. [01:53:56.400 --> 01:54:12.400] You also need to find out whether or not there was ever a discovery request for an actual copy of that deposition. [01:54:12.400 --> 01:54:18.400] Did the judge abuse his discretionary powers when he ruled that because the deposition was allegedly mailed, due process was served? [01:54:18.400 --> 01:54:20.400] All those points need to be raised. [01:54:20.400 --> 01:54:25.400] All of them need to be addressed on the appeal process. [01:54:25.400 --> 01:54:34.400] In New York State, I can tell you that the defendant always has the right to ask the court for a copy and if the court... [01:54:34.400 --> 01:54:37.400] Which has nothing to do with what I'm talking about. [01:54:37.400 --> 01:54:54.400] The right to ask for this does nothing to answer the question of whether or not the law says the judge abused his discretion in saying that because they claim it was mailed, due process was served. [01:54:54.400 --> 01:54:59.400] Right. Okay. How do you propose I do that? [01:54:59.400 --> 01:55:02.400] It's called legal research, John. [01:55:02.400 --> 01:55:06.400] What does the case law on that particular statute say? [01:55:06.400 --> 01:55:17.400] What does the statute itself say in regards to whether or not New York has to prove that the other person received the notice, et cetera, et cetera, et cetera? [01:55:17.400 --> 01:55:29.400] You've got to find out what state law and federal law governing that area has said about those particular rules and procedure and the right of due process in relation to those rules. [01:55:29.400 --> 01:55:35.400] Got it. Thank you. [01:55:35.400 --> 01:55:38.400] Okay. Anything else? [01:55:38.400 --> 01:55:45.400] No, but the case can... the appeal can be hung on that one point, can it? [01:55:45.400 --> 01:55:55.400] It depends on whether or not it's upheld and you can provide the authority to say that there was a clear abuse of discretion that violated a right and thus harmed the defendant. [01:55:55.400 --> 01:56:02.400] Assuming that that will be... that condition will be met, yes. You can hang the appeal on that one. [01:56:02.400 --> 01:56:07.400] You can get it remanded. I don't know. I'm possibly overturned. It just depends. [01:56:07.400 --> 01:56:14.400] Okay. I understand. In other words, it is a possibility if you satisfy all the information and all the... [01:56:14.400 --> 01:56:18.400] Which is what you need to figure out exactly what that is. [01:56:18.400 --> 01:56:33.400] What is all the information necessary to make sure that that is the end result, either an acquittal and a dismissal or a remand back for further proceedings with correct due process procedures put in place? I did a waiver of jury trial and they tried to push it to jury trial, push, push, push, and eventually I filed a criminal complaint objection and all that, and they turned it into a bench trial. [01:57:25.400 --> 01:57:39.400] What I'm asking about right now is a last minute letter from a brand new attorney saying that in addition to the evidence already provided, we've got some more evidence. [01:57:39.400 --> 01:57:47.400] Oh, and by the way, we've also got 20 pages worth of witnesses we want to call in and we've got subpoena requests, and I'm thinking there's bound to be... [01:57:47.400 --> 01:58:01.400] Then you need to file a motion demanding discovery of that information that the court rescheduled the case so that you have time to get to that because they can't pull that information out of their hat and just throw it at you as a surprise. [01:58:01.400 --> 01:58:16.400] You have the right to that information through discovery, so now you need to file a motion demanding that the trial date be reset so that you have an opportunity to present proper discovery and get copies of that information and the ability to interview those witnesses and review the evidence. [01:58:16.400 --> 01:58:17.400] Okay. [01:58:17.400 --> 01:58:18.400] Yeah. [01:58:18.400 --> 01:58:21.400] I'd like to find out if you know where to look that up.
