y'all that have been listening to the show for a while know that the music has changed a couple of times [04:25.400 --> 04:33.400] And this is all the stuff that you're hearing on the show lately is the latest iteration of songs that I've liked in my life [04:33.400 --> 04:39.400] But this is a fairly new and recent song, but it's a very apropos song [04:39.400 --> 04:45.400] I chose it for this show simply because of why this show exists [04:45.400 --> 04:55.400] To try to point out where the law is being used in an abusive and unauthorized, illegal manner against the public [04:55.400 --> 04:59.400] And who it is that is ultimately responsible for that abuse [04:59.400 --> 05:01.400] It isn't just the courts [05:01.400 --> 05:11.400] The courts would have nothing to abuse if there were not ignorant, under-trained, self-serving, self-important individuals out there [05:11.400 --> 05:19.400] Making false allegations, thus giving the court something to do [05:19.400 --> 05:25.400] And that set of people is exactly who that song is directed at [05:25.400 --> 05:27.400] It's the criminal cops [05:27.400 --> 05:29.400] And there are many of them [05:29.400 --> 05:33.400] In fact, there aren't really any other kind [05:33.400 --> 05:41.400] Because they're either guilty of the offenses directly or they are guilty of allowing the offenses to occur [05:41.400 --> 05:49.400] Thus making them co-conspirators and or someone who did nothing to prevent it but had a legal duty to do so [05:49.400 --> 05:55.400] That's aiding and abetting by any stretch of the imagination [05:55.400 --> 06:01.400] But let me go through some examples of why that song was chosen for this show [06:01.400 --> 06:13.400] As of February of this year, there is a Baton Rouge Louisiana woman that is being charged with the homicide of her one-year-old daughter [06:13.400 --> 06:27.400] Because a speeding, off-duty Baton Rouge police officer collided with their car, killing the infant [06:27.400 --> 06:31.400] Now the infant was in their car seat [06:31.400 --> 06:37.400] But the cops are trying to say that the car seat was not adjusted properly for the baby's height [06:37.400 --> 06:40.400] And that's the reason the baby's dead [06:40.400 --> 06:50.400] Not the fact that the cop was off duty had no reason to be doing 94 miles an hour when he collided with this family's car [06:50.400 --> 06:59.400] And sent all the people in it of which there were several to the hospital where the baby later died [06:59.400 --> 07:10.400] Now the cop has been charged with negligent homicide and will probably see zero prison time because he's a cop [07:10.400 --> 07:19.400] But they are trying to charge the mother without right homicide as if this was premeditated [07:19.400 --> 07:30.400] This is one example of the disparity that our government has created in what we created [07:30.400 --> 07:39.400] Versus where they've taken themselves without our authority and where we've allowed them to build [07:39.400 --> 07:51.400] Another example, there is no jail time for an El Paso County deputy who made child pornography for the dark web [07:51.400 --> 08:04.400] The El Paso County deputy cut a deal with the prosecutor and will see absolutely no jail time or criminal charges most likely of any kind [08:04.400 --> 08:16.400] Then we have a California deputy who shoots an 11 year old boy while trying to shoot his dog [08:16.400 --> 08:21.400] This is not the same story as the little girl that got a ricochet in the leg [08:21.400 --> 08:29.400] This is a little boy just very recently in California that got shot, yes it was by a ricochet [08:29.400 --> 08:40.400] But by a stupid deputy trying to kill his dog while the dog was in the proximity of the child [08:40.400 --> 08:47.400] Okay, let's see what else do we have in the world of ignorance [08:47.400 --> 09:05.400] We have a cop kills an unarmed 16 year old boy in a courthouse because the boy dared to intervene when the cop was shoving his mother [09:05.400 --> 09:10.400] Who wasn't charged with any crime or anything of that nature and wasn't there for anything like that [09:10.400 --> 09:19.400] But was shoving the boy's mother into a wall and the boy intervened and the cop killed him [09:19.400 --> 09:26.400] Shot him dead [09:26.400 --> 09:31.400] Let's see what else here, oh in Georgia [09:31.400 --> 09:44.400] An 87 year old woman was going to make herself some dandelion tea, she goes into an area across the street from her family's house [09:44.400 --> 09:48.400] Now this woman does not speak any English, okay [09:48.400 --> 09:57.400] She walks across the street to where there's some dandelions growing and she's got a little knife of some kind to cut the dandelions off to take them back to the house [09:57.400 --> 10:04.400] Someone calls the cops because they see the lady with a knife not having any clue what she's doing [10:04.400 --> 10:13.400] The cops show up and repeatedly tell the woman to drop the knife who of course not speaking English doesn't know what the problem is [10:13.400 --> 10:20.400] She's not familiar with how cops in this country operate and she doesn't understand what they're saying or why they're even there [10:20.400 --> 10:28.400] So they tase her, they tase her until she has to go to the hospital [10:28.400 --> 10:36.400] Just because she was trying to cut some dandelions to make herself some dandelion tea [10:36.400 --> 10:53.400] So here we have a Seattle Washington Sergeant who actually does get punished with 23 years in prison for repeatedly raping his two daughters [10:53.400 --> 11:00.400] Since they were little girls and both of them are college age now [11:00.400 --> 11:14.400] He has been raping them for decades and they finally charged him and sent him to prison after his conviction [11:14.400 --> 11:32.400] And then we have a deputy, or I'm sorry, not the deputy, the chief of police of a New Jersey town, Palisades Parkway [11:32.400 --> 11:42.400] The police chief gets busted after buying cocaine online [11:42.400 --> 11:51.400] You get that? The police chief was busted for buying cocaine online [11:51.400 --> 12:15.400] And then you have one in Arizona, a police officer who used the body cam on his clothes to record himself having sex in his office at the police station [12:15.400 --> 12:30.400] And finally, an officer in California is finally arrested for repeatedly raping a 12 year old girl [12:30.400 --> 12:46.400] Now folks, I gotta ask you, in all honesty, what do you think the founding fathers would have done with any officer of the law that did any of these things? [12:46.400 --> 13:03.400] Or with any judge that would have made excuses for that officer and said it was okay, or any department that that officer worked for that tried to say that was okay [13:03.400 --> 13:15.400] What do you think the founding fathers would have done with men like that? Do you think they would have shrugged their shoulders and said well that's just the way it is? Alright, so today I've got something for you with regards to what Art Patton's been working on and your last, was second to last podcast regarding how the State Highway Patrol and the Department of Public Safety have decided to use enhanced authority to pull people over for speeding when they're not engaging in commerce. [21:18.400 --> 21:25.400] Well, more like created their own enhanced authority. Not just using it, but they created it out of thin air. [21:25.400 --> 21:35.400] Right. That said, my dad and I, well, my father got caught speeding. Alright, it was North Carolina State Highway. [21:35.400 --> 21:42.400] Your father got accused of speeding. Not caught speeding, since it's technically impossible for him to do that very thing, right? [21:42.400 --> 21:48.400] Right. Well, according to the copy, admitted it on camera, but that remains to be seen. [21:48.400 --> 21:54.400] So what we've done is, with the advice of Art Patton and Rod Glass, I'm sure you know him. [21:54.400 --> 22:01.400] I know of him. I don't think Rod Maverick actually talked, but... [22:01.400 --> 22:14.400] Needless to say, they've advised me and given me a little guidance on the issues, and I've done some study and some research, and we filed for an administrative hearing with the State Board of Administrative Courts. [22:14.400 --> 22:25.400] That case was accepted as of a couple of days ago, which Art wanted me to tell you that's the first shot in your battle. [22:25.400 --> 22:33.400] Okay. So apparently we've managed to get this case accepted on those merits. [22:33.400 --> 22:38.400] And what are the issues you're going to raise with the Administrative Law Judge? [22:38.400 --> 22:46.400] The first one was going to be the DOT certifications of the officers in question. [22:46.400 --> 22:51.400] Do they have the DOT certifications necessary to pull people over? [22:51.400 --> 22:56.400] Okay. That was the biggest point. Wait, wait, wait, wait. That's your biggest one? [22:56.400 --> 23:01.400] Well, I wouldn't say it's the biggest one, more like the enhanced authority to do so. [23:01.400 --> 23:09.400] We were... See, your talk about the definition of the word transportation really hit a nerve with me. [23:09.400 --> 23:13.400] I can't remember exactly what podcast that was, but it really hit a nerve with me. [23:13.400 --> 23:17.400] So we have been looking for the original intent definition in North Carolina. [23:17.400 --> 23:23.400] Right. Guess what? Chapter 20, the definitions in Chapter 20, the driving code, [23:23.400 --> 23:26.400] this doesn't have that definition, strangely enough. [23:26.400 --> 23:32.400] Well, the entire code, I don't know of any state code that defines the term transportation for exactly that reason. [23:32.400 --> 23:35.400] It would give away the ballgame. [23:35.400 --> 23:43.400] Right, right. So we've been attempting to try and find the original intent definition of the word transportation. [23:43.400 --> 23:48.400] The original intent definition was established by the United States Supreme Court [23:48.400 --> 23:53.400] in the case of Interstate Commerce Commission versus Brimson. [23:53.400 --> 23:55.400] Brimson, okay. [23:55.400 --> 23:59.400] With an M, Brimson. [23:59.400 --> 24:04.400] Brimson, Brimson, okay. National and Brimson, all right. [24:04.400 --> 24:12.400] So that said, we were going to be trying to establish that that was never engaging in commerce. [24:12.400 --> 24:16.400] And we were going to first prove transportation equals commerce, [24:16.400 --> 24:20.400] then make the argument of not engaged in commerce, okay? [24:20.400 --> 24:21.400] Right, right. [24:21.400 --> 24:27.400] But now, well, let me put a bug in your ear considering what you told me so far. [24:27.400 --> 24:34.400] Your biggest argument here is and should always be lack of jurisdiction. [24:34.400 --> 24:40.400] And like I told someone else that called me up and asked me about the lawsuit that he's trying to file [24:40.400 --> 24:45.400] here in Texas in relation to that, [24:45.400 --> 24:53.400] you have to set this up in a particular set of steps because these steps interlock and make a solid foundation. [24:53.400 --> 25:00.400] If you put them together incorrectly, it's like stacking Lego blocks on the end of each other, [25:00.400 --> 25:06.400] but with nothing underneath each of those new added blocks on the other side. [25:06.400 --> 25:11.400] Hence, you get an unstable platform as you go up, okay? [25:11.400 --> 25:13.400] Very, very shaky argument, okay. [25:13.400 --> 25:18.400] All right, so here is what I told him and why I told it to him. [25:18.400 --> 25:22.400] The particular order you need to look at is this. [25:22.400 --> 25:32.400] Within your state transportation code, who is the primary entity that enforcement authority is granted to? [25:32.400 --> 25:38.400] Here in Texas, that entity is defined as the department. [25:38.400 --> 25:43.400] Every single statute says an officer of the department. [25:43.400 --> 25:55.400] The term department in every one of those chapters is defined as the Department of Public Safety of the State of Texas, okay? [25:55.400 --> 25:57.400] That's number one. [25:57.400 --> 26:07.400] They are the only agency given direct enforcement authority within the statutes and every single chapter of the transportation code itself, okay? [26:07.400 --> 26:09.400] They are the primary entity. [26:09.400 --> 26:13.400] Now, who is the Department of Public Safety? [26:13.400 --> 26:21.400] Here in Texas, they are a state administrative agency defined and regulated by the state administrative code. [26:21.400 --> 26:30.400] If the agency you're talking about has a chapter in the state administrative code, they are a state administrative agency. [26:30.400 --> 26:39.400] Now, the state admin code here in Texas specifically says that the DPS is not a law enforcement agency. [26:39.400 --> 26:41.400] Number one. [26:41.400 --> 26:49.400] Number two, it specifically says what the mission of the Department of Public Safety is. [26:49.400 --> 26:53.400] In other words, what their jurisdiction consists of. [26:53.400 --> 26:56.400] That's their mission, okay? [26:56.400 --> 27:03.400] In that mission statement, they have supervisory authority over traffic on rural highways. [27:03.400 --> 27:12.400] Supervisory in this case, meaning simply go take that detour, the bridge is out, the locks aren't working, there's an accident, any number of things. [27:12.400 --> 27:23.400] Roads out, roads being redone, take your pick, but they're supervising the traffic and sending it in a different direction or whatever else may have to be done on a rural highway, okay? [27:23.400 --> 27:28.400] So it's all based on two cars having an accident, let's go handle that. [27:28.400 --> 27:34.400] Well, supervision is simply traffic control and that's it. [27:43.400 --> 28:00.400] There's two parts to this as far as their mission, to supervise traffic on rural highways and number two, to supervise and regulate commercial and for hire traffic, okay? [28:00.400 --> 28:06.400] Now that term regulate has this particular thing that you need to pay attention to. [28:06.400 --> 28:11.400] And now you may need to find it up there, but here in Texas it's very specific. [28:11.400 --> 28:12.400] Okay. [28:12.400 --> 28:34.400] A couple of rules further down in the state administrative code, it says that the Department of Public Safety may create and manage the following regulatory programs consistent with their duties under Rule 1.2, which is supervision of traffic on rural highways [28:34.400 --> 28:38.400] and to supervise and regulate commercial and for hire traffic. [28:38.400 --> 28:53.400] Those three programs defined in the administrative code for those two specific requirements are driver's licensing, financial responsibility, and safety inspection, okay? [28:53.400 --> 28:54.400] Okay, okay. [28:54.400 --> 29:18.400] So all programs in Texas are linked to that specific set of mission parameters and since the only regulatory authority given to the Department of Public Safety relates to commercial and for hire traffic and those programs are intended to support that authority, they can't use it for anything else. [29:18.400 --> 29:21.400] So private traffic is all clinics? [29:21.400 --> 29:31.400] Right, it's not commercial or for hire, i.e. it completely accepted from inclusion by omission. [29:31.400 --> 29:32.400] Okay. [29:32.400 --> 29:36.400] All right, now this is what I meant about the building blocks. [29:36.400 --> 29:48.400] When you jump around from place to place without linking them together in a way that makes perfect sense to show where the authority does it does not exist, you're going to wind up getting yourself buried in this hearing. [34:00.400 --> 34:07.400] Right, and well, considering that it is admin court, it's going to be like the attorney general I'm going up against. [34:07.400 --> 34:10.400] I'm assuming. [34:10.400 --> 34:22.400] Well, that depends on how you requested the hearing, not necessarily. It'll most likely be an attorney for the agency, whatever agency that would be. [34:22.400 --> 34:26.400] In this case, who did y'all ask to have a hearing in relation to? [34:26.400 --> 34:28.400] North Carolina State Highway. [34:28.400 --> 34:33.400] Right, it'll probably be an attorney that represents them or their union. [34:33.400 --> 34:36.400] Okay, okay. All right, well, we did send it. [34:36.400 --> 34:45.400] Now, the attorney general might show up, but generally the attorney general is only going to show up if there's a constitutional challenge. [34:45.400 --> 35:05.400] So in addition to the challenges that I laid out, you might want to throw in there that the usurpation of authority to enforce against an entity not specifically defined by the law or intended by the legislature is unconstitutional. [35:05.400 --> 35:08.400] Can you say that again real slow? [35:08.400 --> 35:37.400] That another issue that arises is that when an agency such as the highway patrol usurps for itself a power and authority not created or covered by the law to use that law against a class of persons to whom it was never intended to apply either legislatively or in its language, that application and usage is unconstitutional. [35:37.400 --> 35:40.400] Okay, okay. [35:40.400 --> 35:42.400] All right, and that does make sense. [35:42.400 --> 36:04.400] Now, one other question I had with regards to municipal or district courts, with regards to the admin courts hearing and how it relates to the moving forward of the current district court trial or hearing date, that date still exists. [36:04.400 --> 36:10.400] Well, but here's the problem. What are they charging you with in the district court? [36:10.400 --> 36:13.400] Well, that's just going to be your average speeding ticket. [36:13.400 --> 36:20.400] Yeah, but that's not what I'm asking you. What is the nature of the speeding ticket? Is it civil or is it criminal? [36:20.400 --> 36:22.400] Although it'll be criminal. [36:22.400 --> 36:30.400] Well, here's the problem. How can an administrative court have jurisdiction of something that's criminal in another court? It can't. [36:30.400 --> 36:39.400] Exactly. So how can a criminal court have jurisdiction of something that's civil and try it as criminal? It can't. [36:39.400 --> 36:51.400] And see, that's where we came up with the idea with a certain couple of individuals' advice to do a 12B3 action, which is improper jurisdiction or venue. [36:51.400 --> 36:54.400] Okay, here comes the biggest issue. [36:54.400 --> 37:06.400] I took that motion. I drew up the motion last night. My father took it up to the courthouse. They summarily refused to his motion. [37:06.400 --> 37:07.400] Who is they? [37:07.400 --> 37:10.400] The Buncombe County Court of Courts Office of National and North Carolina. [37:10.400 --> 37:26.400] The criminal complaints with the state supreme court against that judge and that clerk for denying access to the courts and interfering with the right of due process by refusing to take pleadings from the accused individual. [37:26.400 --> 37:30.400] That's a direct violation of due process rights. [37:30.400 --> 37:35.400] North Carolina Constitution authorizes the people of North Carolina to act as their own counsel, right? [37:35.400 --> 37:36.400] That is correct. [37:36.400 --> 37:42.400] Then they absolutely have no authority to deny you a filing in a case in which you are the defendant. [37:42.400 --> 37:45.400] And even if local rules... [37:45.400 --> 37:49.400] Local rules can't supersede the right of due process. [37:49.400 --> 37:50.400] That's correct. [37:50.400 --> 37:53.400] Any more than the state rule can. [37:53.400 --> 37:59.400] Okay, so that said, tomorrow morning we need to be up there threatening to go to the federal courthouse and take out charges. [37:59.400 --> 38:08.400] No. Never, ever threaten. Never threaten. Just do. [38:08.400 --> 38:10.400] Okay. [38:10.400 --> 38:17.400] Go to the federal courthouse, file criminal complaints, or go to the U.S. Attorney's Office. [38:17.400 --> 38:20.400] File criminal complaints against that clerk and that judge. [38:20.400 --> 38:27.400] File agreements with the state supreme court against that judge and that clerk. [38:27.400 --> 38:28.400] Okay. [38:28.400 --> 38:35.400] File criminal complaints with your local prosecutor or your local grand jury against that judge and that clerk. [38:35.400 --> 38:42.400] The clerk can never be said to be acting under their own authority as they are acting as an agent of the judge [38:42.400 --> 38:49.400] and are entirely within his power and control to supervise and regulate in the performance of their duties. [38:49.400 --> 38:53.400] So never go after one without going after the other. [38:53.400 --> 38:58.400] What if the court state is two days from now, but the court date for the administrative... [38:58.400 --> 38:59.400] Get in it. [38:59.400 --> 39:00.400] ...is already... [39:00.400 --> 39:05.400] Then ask for an injun... stay or injunctive relief from the federal court in that area. [39:05.400 --> 39:07.400] File for it. [39:07.400 --> 39:20.400] They're trying to take a civil case and use it in a criminal proceeding while the administrative court that actually has jurisdiction is still awaiting the hearing on the matter. [39:20.400 --> 39:22.400] Right. It's kind of a conflict of interest there. [39:22.400 --> 39:26.400] Well, it's acting without jurisdiction. [39:26.400 --> 39:27.400] Right. [39:27.400 --> 39:37.400] No two courts can have simultaneous jurisdiction over the same matter, especially with different natures. [39:37.400 --> 39:38.400] Right. [39:38.400 --> 39:47.400] Which was, you know, one of the reasons why I was going to attempt file the 12B6, you know, no claims been stated to which relief can be granted. [39:47.400 --> 39:56.400] But it seemed more important considering that the administrative hearing was already in effect to do the lack of venue or lack of jurisdiction and venue. [39:56.400 --> 39:58.400] Of course, like I say, they refuse to take it. [39:58.400 --> 40:01.400] So I'm going to have to take another step, it looks like. [40:01.400 --> 40:04.400] Please tell me you recorded it. [40:04.400 --> 40:07.400] No. [40:07.400 --> 40:09.400] Unfortunately not. [40:09.400 --> 40:12.400] You know, one of these days, I'm going to get, you didn't do it right, Taser. [40:12.400 --> 40:22.400] And I'm going to start going around and saying, did you do this? Did you do this? And if every time I get a no answer or wrong answer, somebody's getting zapped. [40:22.400 --> 40:26.400] Because I know this is about the old millionth time on this show. [40:44.400 --> 40:49.400] Yeah. Well, that kind of reminds me of the cop up on the stand saying you're speaking. [40:49.400 --> 40:52.400] Just as much hearsay as mine. [40:52.400 --> 40:55.400] But okay, so let's say this. [40:55.400 --> 40:59.400] Let's say he goes back up there tomorrow and tries the same thing, but it's recording it again. [41:02.400 --> 41:09.400] Just plan on leaving there immediately and going directly over to get an injunction at the federal courthouse. [41:09.400 --> 41:14.400] Have all your paperwork and everything to request a hearing for an injunction, [41:14.400 --> 41:18.400] an immediate hearing for an injunction over at the federal courthouse. [41:18.400 --> 41:22.400] Have all that ready before you even go to the local court. [41:22.400 --> 41:24.400] Don't mention that you're going to the federal court. [41:24.400 --> 41:27.400] Say absolutely nothing about it. [41:27.400 --> 41:31.400] Go in, record the attempt to file, record the denial. [41:31.400 --> 41:35.400] Go to the federal court and get the filing. [41:35.400 --> 41:39.400] Okay. All right. Sounds like a good game plan. [41:39.400 --> 41:47.400] It's a whole lot better than getting thrown in jail for interfering with a public duty because you threatened them with going. [41:47.400 --> 41:57.400] Yeah, I was going to say, you know, they may not take to it too kindly if I say, hey, you know, I'm going to go take you to court now. [41:57.400 --> 42:01.400] Yeah, never threaten. Just do. [42:01.400 --> 42:03.400] Right. That way there's no stopping you. [42:03.400 --> 42:06.400] Right. They can't say that you did it to influence their actions. [42:06.400 --> 42:09.400] You did it because you had a duty to do it. [42:09.400 --> 42:18.400] But when you threaten first, they can say that you attempted to threaten them in order to influence the outcome of your case or your issue before that court. [42:18.400 --> 42:20.400] And that's a crime. [42:20.400 --> 42:21.400] Right. [42:21.400 --> 42:27.400] And it's not going to matter if that was your intent or not, if they can prove you made the threat. [42:27.400 --> 42:31.400] Right. So better for them to be the only one that's committed crime. [42:31.400 --> 42:34.400] Yeah. Well, that's kind of the way it works. Yeah. [42:34.400 --> 42:36.400] Yeah. Okay. Well, now, you remember, I told you there was a statute 45.014 subsection G that specifically forbids magistrates in Texas from issuing warrants for failure to appear on citations. [48:53.400 --> 48:54.400] Period. [48:54.400 --> 48:58.400] Yeah. Yeah. I got that. [48:58.400 --> 49:02.400] But I was hoping he'd do it, to be honest. [49:02.400 --> 49:08.400] Anyhow, now, and I'm sure you know Judge Ball. [49:08.400 --> 49:12.400] Well, Springer was the judge down there. [49:12.400 --> 49:17.400] Now, I know there used to be a judge ball. [49:17.400 --> 49:21.400] He's the dad of Ryan Ball, who's a sheriff's deputy. Didn't know that. [49:37.400 --> 49:41.400] But anyhow, it's all been moved to Judge Ball. [49:41.400 --> 49:44.400] He's trying. [49:44.400 --> 49:50.400] First ticket was June 7. Second one was June 22. [49:50.400 --> 50:00.400] On the first one, the complaint was signed by the deputy on the 20th of June. [50:00.400 --> 50:05.400] On the one from the 22nd, they didn't sign. [50:05.400 --> 50:12.400] The DPS officer didn't sign the complaint until last Monday, August 13. [50:12.400 --> 50:13.400] All right. [50:13.400 --> 50:20.400] So they got almost two months of, you know, the speedy trial clock not running. [50:20.400 --> 50:23.400] Right. And that's the way they love to do it. [50:23.400 --> 50:28.400] They won't file the complaint and then they'll go through all of the judicial process [50:28.400 --> 50:33.400] without a complaint ever being filed, which means they're acting without any jurisdiction, [50:33.400 --> 50:36.400] which you need to file written objections to. [50:36.400 --> 50:40.400] Every single thing they've done, when there was no complaint filed, [50:40.400 --> 50:43.400] is a no jurisdiction event. [50:43.400 --> 50:50.400] It had no full effect of any kind or no lawful effect, I should say. [50:50.400 --> 50:54.400] And so it was absolutely patently illegal. [50:54.400 --> 50:58.400] Yeah. I just got the notification from Judge Ball today. [50:58.400 --> 51:00.400] So I haven't done anything yet. [51:00.400 --> 51:04.400] I was hoping to get the talk to you tonight. [51:04.400 --> 51:07.400] But of course, he's already scheduled a trial. [51:07.400 --> 51:15.400] He's trying to lump both traffic citations into one trial on October 31. [51:15.400 --> 51:19.400] Well, of course, the statute of limitations will have run out on the first one. [51:19.400 --> 51:20.400] What year was it? [51:20.400 --> 51:21.400] Because it's four months, right? [51:21.400 --> 51:23.400] No. No. Now, listen. [51:23.400 --> 51:24.400] I thought you had- [51:24.400 --> 51:29.400] No. I know what you're thinking and that's what I'm about to tell you. [51:29.400 --> 51:35.400] They have up to two years from the day to the event to file the criminal complaint [51:35.400 --> 51:37.400] and to prosecute. [51:37.400 --> 51:39.400] The limit, the max limit is two years. [51:39.400 --> 51:40.400] Okay. [51:40.400 --> 51:41.400] Okay. [51:41.400 --> 51:46.400] Once they have filed and the speedy trial clock starts, [51:46.400 --> 51:50.400] that's when you have three months is too little, [51:50.400 --> 51:53.400] five months is too many according to Texas case law, [51:53.400 --> 51:57.400] making the sweet spot anything beyond four months. [51:57.400 --> 51:58.400] Okay. [51:58.400 --> 52:00.400] But that's from filing the criminal complaint. [52:00.400 --> 52:03.400] That's from the date the complaint is filed. [52:03.400 --> 52:04.400] Okay. [52:04.400 --> 52:07.400] It was filed on June 20. [52:07.400 --> 52:08.400] Yeah. [52:08.400 --> 52:09.400] That's what I'm saying. [52:09.400 --> 52:13.400] On the first one, they should be out of, by October 31, [52:13.400 --> 52:16.400] should be out of speedy trial clock. [52:16.400 --> 52:17.400] Yeah. [52:17.400 --> 52:21.400] But you have to file a motion for a speedy trial before that happens. [52:21.400 --> 52:24.400] And then they have to have denied it to you. [52:24.400 --> 52:27.400] Otherwise, if you don't demand a speedy trial and then don't get it, [52:27.400 --> 52:31.400] the courts say you didn't have a right to it because you didn't ask for it. [52:31.400 --> 52:35.400] It's baloney, but it's the way the Texas courts are doing it. [52:35.400 --> 52:39.400] So I need to get one typed up and filed in the next day or two. [56:42.400 --> 56:49.400] So they both have to assert it in the complaint and prove it at trial. [56:49.400 --> 56:51.400] Yeah, and that's the funny thing. [01:20:35.400 --> 01:20:40.400] She was accused of first degree aggravated harassment, which has nothing to do with what [01:20:40.400 --> 01:20:41.400] she did. [01:20:41.400 --> 01:20:46.400] First degree aggravated harassment in New York State is harassment related to a person's [01:20:46.400 --> 01:20:53.400] race, color, national origin, ancestry, gender, religion, age, disability, or sexual orientation. [01:20:53.400 --> 01:20:59.400] Or the defendant damages premises primarily used for religious purposes at the church. [01:20:59.400 --> 01:21:05.400] Or has been fully convicted of the crime of aggravated harassment in the second degree, [01:21:05.400 --> 01:21:06.400] which she has not. [01:21:06.400 --> 01:21:08.400] She's only been charged with it. [01:21:08.400 --> 01:21:12.400] Or places of flostica or septum spirex fraud. [01:21:12.400 --> 01:21:14.400] So displays a noose. [01:21:14.400 --> 01:21:19.400] Aggravated harassment in the first degree is a class E felony, and like I said, she's [01:21:19.400 --> 01:21:24.400] being treated for OCD, compulsive, obsessive-compulsive. [01:21:26.400 --> 01:21:33.400] I ask this therapist if obsessive-compulsive disorder is an affirmative defense, and he [01:21:33.400 --> 01:21:37.400] said he himself is better at this as OCD. [01:21:37.400 --> 01:21:43.400] So he understands, and yet, she's the newest obsessive-compulsive as a defense, as an [01:21:43.400 --> 01:21:45.400] affirmative defense. [01:21:50.400 --> 01:21:56.400] The police accused her of aggravated harassment second degree as the first charge. [01:22:07.400 --> 01:22:13.400] They said she dialed 911, but actually she dialed their regular seven-digit number. [01:22:13.400 --> 01:22:15.400] I don't know if that makes a difference. [01:22:15.400 --> 01:22:17.400] Well, of course it makes a difference. [01:22:17.400 --> 01:22:23.400] They can't levy a charge of abuse of an emergency 911. [01:22:23.400 --> 01:22:24.400] Well, that's number one. [01:22:24.400 --> 01:22:27.400] She didn't call 911. [01:22:27.400 --> 01:22:29.400] The police charged... [01:22:29.400 --> 01:22:34.400] But there's nothing in the charge that requires them to be calling 911 to commit the offense, [01:22:34.400 --> 01:22:35.400] is there? [01:27:48.400 --> 01:27:54.400] Then you can go to the news agency and say, are you in the habit of broadcasting false [01:27:54.400 --> 01:28:01.400] facts that impugn the character and slander and libel an individual? [01:28:01.400 --> 01:28:03.400] Because that's what that is. [01:28:03.400 --> 01:28:09.400] If you did not verify that information from a reputable source and they can't show that [01:28:09.400 --> 01:28:16.400] they did, then what they did was broadcast a false fact that is now considered a libelous [01:28:16.400 --> 01:28:22.400] statement about an individual because it impugns their character unjustifiably. [01:35:02.400 --> 01:35:08.400] To do so is a direct violation of Article 3, Section 29 through 39 of the Texas Constitution, [01:35:08.400 --> 01:35:15.400] which specifically dictates who can create law, when they can create law, how they must create law, [01:35:15.400 --> 01:35:19.400] and where that law must originate in order to be a valid law in the first place, [01:35:19.400 --> 01:35:24.400] and it ain't with no county commissioner's court or city council. [01:37:48.400 --> 01:37:53.400] Municipal ordinances and county ordinances, as a matter of law, [01:37:53.400 --> 01:37:59.400] can be nothing more than the corporate policy of that municipality or that county, [01:37:59.400 --> 01:38:07.400] and it is binding only upon its employees over those legal entities operating within its jurisdictional [01:38:07.400 --> 01:38:15.400] territorial limits and those who are contracted with it and bound by those things via contract. [01:38:15.400 --> 01:38:17.400] Nobody else is subject to a city ordinance. [01:39:30.400 --> 01:39:39.520] The appeals court tossed that out back in the 26th of July, but they said that the first [01:39:39.520 --> 01:39:46.480] three things, which was the injunctive relief, the civil penalties, and the Tuftah laws that [01:39:46.480 --> 01:39:51.600] they brought up were in the jurisdiction of the district court. [01:39:51.600 --> 01:39:57.560] So they immediately filed another motion to compel for us to go back. [01:39:57.560 --> 01:40:06.160] And so we're going in tomorrow, and we have filed for them to pick back up our case over [01:40:06.160 --> 01:40:16.160] the original filing that they dismissed, which was a countersuit against them for what they [01:40:16.160 --> 01:40:17.160] were doing. [01:42:40.680 --> 01:42:45.480] If they were putting it as an administrative action, odds are that's outside the jurisdiction [01:42:45.480 --> 01:42:47.480] of that court. [01:42:47.480 --> 01:42:48.600] Right. [01:42:48.600 --> 01:42:53.640] But now if you've actually got an administrative action ongoing that you started relating to [01:42:53.640 --> 01:43:00.280] that same set of things, then you can challenge the district court's jurisdiction because [01:43:00.280 --> 01:43:05.000] there has been no determination made by the administrative law judge. [01:43:14.000 --> 01:43:18.840] When an administrative agency is attempting to assess someone with punitive fines that [01:43:18.840 --> 01:43:24.600] falls under the regulatory authority of Chapter 2001 of the Texas Government Code, which is [01:43:24.600 --> 01:43:30.120] the Administrative Procedures Act, then the administrative law judge of which are administrative [01:43:30.120 --> 01:43:37.160] law court, of which there is only one, and it's here in Austin, Texas, you have a right [01:43:37.160 --> 01:43:42.200] to a hearing in that court to get a ruling on whether or not that entity can do what [01:43:42.200 --> 01:43:43.200] it's trying to do.
