[01:58.600 --> 02:02.640] Many in the West, including President Trump, have been quick to conclude that this chemical [02:02.640 --> 02:06.800] attack must have been conducted by Assad and his forces. that and ask the court to [09:18.880 --> 09:25.280] Grant them a thousand dollars a day for each vehicle [09:25.280 --> 09:27.520] That was not in compliance [09:27.520 --> 09:29.120] Well, actually they brought them all in compliance [09:29.120 --> 09:33.520] There was no evidence before the court that they hadn't brought them in compliance [09:33.520 --> 09:37.920] But the judge accepted it, it didn't matter what it was [09:37.920 --> 09:42.480] Whatever they filed he accepted it, so he granted it [09:42.480 --> 09:52.320] 80,000 dollar claim over eight city ordinances violations [09:52.320 --> 09:59.680] So if you live in municipality and you do anything to upset [09:59.680 --> 10:04.320] anyone in the any official in your municipality [10:04.320 --> 10:09.040] You can wind up exactly where the Pixlers don't work [10:09.040 --> 10:13.360] But they did not back down and the court ruled [10:13.360 --> 10:21.360] that the court lacked subject matter jurisdiction [10:21.360 --> 10:27.600] over the claim against the Pixlers because the [10:27.600 --> 10:33.760] prosecution was improper [10:33.760 --> 10:39.520] And therefore the the results of the prosecution were void [10:39.520 --> 10:47.280] Well, the claim they made for this [10:47.280 --> 10:54.880] failure to abate the violation was based on a determination that [10:54.880 --> 10:58.400] Tim had vehicles in violation [10:58.400 --> 11:02.560] Then the court threw out that determination [11:02.560 --> 11:07.200] So now there is no grounds to support a claim of an ongoing [11:07.200 --> 11:11.920] violation because there is no evidence that there ever was a violation [11:11.920 --> 11:14.800] It was only an accusation [11:14.800 --> 11:21.920] The court we believe wrongly ruled that [11:21.920 --> 11:27.680] the court had jurisdiction to rule on [11:27.680 --> 11:35.840] the abatement, the restraining or the [11:35.840 --> 11:38.400] What's the term or I lost the term [11:38.400 --> 11:44.320] It's a temporary injunction and a temporary restraining order [11:44.320 --> 11:48.160] And the injunctive relief was concerning health and safety issues [11:48.160 --> 11:53.920] that never occurred The health and safety issues [11:53.920 --> 11:59.120] was the thousand dollars per vehicle per day that they were claiming [11:59.120 --> 12:05.920] And that was based on a conviction of a violation [12:05.920 --> 12:09.280] When the conviction of the violation went out [12:09.280 --> 12:14.320] then there is no claim So but the court ruled that [12:14.320 --> 12:18.560] the judge would have jurisdiction over that part of the claim [12:18.560 --> 12:21.920] Well, that's not exactly true because [12:21.920 --> 12:28.800] our claim said that the plaintiff lacked legal standing [12:28.800 --> 12:34.160] to invoke subject matter jurisdiction of the court and court agreed [12:34.160 --> 12:41.040] Now if the plaintiff came to the court with [12:41.040 --> 12:48.000] sued for the purpose of this injunction [12:48.000 --> 12:52.480] the court would ordinarily have jurisdiction over an injunction of [12:52.480 --> 12:56.560] this nature but not if the plaintiff lacked [12:56.560 --> 12:59.760] standing to invoke that subject matter jurisdiction and that's where we think [12:59.760 --> 13:04.800] the court fared in their ruling [13:04.800 --> 13:08.960] But the way I see it, they left the door open to give the judge [13:08.960 --> 13:12.800] opportunity to reverse his bogus ruling [13:12.800 --> 13:17.360] that he made based on false premise But we're not going to leave it just for [13:17.360 --> 13:20.640] this judge to get to determine that himself are we going to be [13:20.640 --> 13:24.240] absolutely not we're going to request a [13:24.240 --> 13:27.840] we're going to file a motion for reconsideration based on the ruling [13:27.840 --> 13:32.560] of the court of appeals that his ruling granting the [13:32.560 --> 13:36.320] injunction was based on the false premise [13:36.320 --> 13:40.800] was based on the premise that the [13:40.800 --> 13:47.760] pixelers were actually convicted of having junk vehicles [13:47.760 --> 13:53.440] there is no conviction there is no evidence before this court that the [13:53.440 --> 13:58.960] pixelers had a junk vehicle so there is no grounds for [13:58.960 --> 14:02.880] alleging a continuing violation because there is no evidence of an original [14:02.880 --> 14:07.760] violation so we're going to ask support throughout the injunction [14:07.760 --> 14:12.960] and I don't know how this will affect him [14:12.960 --> 14:19.040] having the court of appeals smack his knuckles this way [14:19.040 --> 14:22.480] and we've already filed the pictures already filed criminal charges against [14:22.480 --> 14:26.320] him and there will be we'll be filing [14:26.320 --> 14:31.120] two or three more and we'll move to disqualify him [14:31.120 --> 14:36.720] because of the criminal charges which are now supported by a court of appeals [14:36.720 --> 14:41.760] decision and if the judge if they rule against [14:41.760 --> 14:46.240] us we don't care because we'll appeal it to a court of [14:46.240 --> 14:49.760] appeals and the court of appeals is one that's just [14:49.760 --> 14:56.320] stung him so we'll appeal these decisions to them [14:56.320 --> 15:00.240] and the one thing that will almost certainly get thrown out is a [15:00.240 --> 15:07.120] ruling that denied the pixelers claim against the city [15:07.120 --> 15:12.320] in the amount of $300,000 he dismissed that with prejudice [15:12.320 --> 15:15.680] they asked for findings of fact and conclusions that law and the judge [15:15.680 --> 15:19.280] refused to provide them so we filed criminally against the judge for [15:19.280 --> 15:22.000] favor and form of duty is required to perform [15:22.000 --> 15:25.680] then the process denied the pictures and full free access to her enjoyment [15:25.680 --> 15:31.200] right and this denies the pictures in their [15:31.200 --> 15:36.560] right to appeal because they don't know what the basis of the ruling was [15:36.560 --> 15:42.400] judge just made it up well the judge somehow thinks he has [15:42.400 --> 15:47.520] authority to do that and i've got case law says he has no such thing [15:47.520 --> 15:52.560] so he has been around judges that pretty well did anything they wanted to and he [15:52.560 --> 15:56.800] was a lawyer and he would not dare stand up to [15:56.800 --> 16:00.880] one of them he wouldn't that wouldn't even consider [16:00.880 --> 16:08.720] standing up to a judge this problem was he's dealing with a pro se [16:08.720 --> 16:17.120] who wasn't so afraid of that judge and had the tools to come back after him [16:17.120 --> 16:23.520] with now he's got a problem so you i know you're concerned [16:23.520 --> 16:27.680] about the fact that they didn't directly throw out [16:27.680 --> 16:34.080] that $80,000 claim well they threw out the underpinnings of the claim [16:34.080 --> 16:38.000] that was my question says if there was no adjudication back at the municipal [16:38.000 --> 16:41.280] court for the eight thousand how could they suddenly have authority in civil [16:41.280 --> 16:50.080] court yeah the only authority the judge has now is authority to dismiss [16:50.080 --> 16:53.760] to reverse 21:36.560] the city or the court or the court of appeals will do that for him [21:36.560 --> 21:43.200] okay he has the rules that he had they they had no subject matter jurisdiction [21:43.200 --> 21:48.240] once he rules how can they have it on some things and have it on another [21:48.240 --> 21:52.160] that's what's thrown me i think for so much of a loop is that [21:52.160 --> 21:55.520] they divided it up and said yes we agree with this work [21:55.520 --> 21:59.600] you were right they didn't have the adjudication [21:59.600 --> 22:04.720] process proper and you know that's correct and that they've been made no [22:04.720 --> 22:09.360] one ever answered your subject matter jurisdiction [22:09.360 --> 22:14.320] filing it's actually says and they were unanswered [22:14.320 --> 22:19.680] and then yes now they suddenly got tough civil penalties and injunctive [22:19.680 --> 22:22.960] relief at the end but they didn't have [22:22.960 --> 22:26.640] anything at the beginning and that's what's thrown me for a loop is how could [22:26.640 --> 22:29.920] they get in their head from this point from [22:29.920 --> 22:33.440] eight thousand to eighty thousand and then say they had jurisdiction over the [22:33.440 --> 22:37.120] eighty but not the eight yeah and we will make sense [22:37.120 --> 22:41.920] we will address that in the court [22:42.080 --> 22:48.080] addressing it with the court we could file an appeal of that decision [22:48.080 --> 22:55.440] in the court of appeals but uh that's dangerous right [22:55.440 --> 22:59.360] because we give the opposing party another batter [22:59.360 --> 23:06.960] oh wait a minute hold on a mandamus a mandamus is not appealable [23:06.960 --> 23:10.720] yeah mandamus is a done deal we cannot appeal it [23:10.720 --> 23:14.640] we can address the ruling in the mandamus [23:14.640 --> 23:18.720] in a direct appeal to the court of appeals [23:18.720 --> 23:24.560] from the case itself yeah so we we can still get there and the next step is to [23:24.560 --> 23:29.200] request a reconsideration based on the ruling of the [23:29.200 --> 23:33.920] court of appeal then we see what the judge does and [23:33.920 --> 23:37.760] we also need to get timis writing this up a statement of everything that's [23:37.760 --> 23:41.120] happened and then we'll go through it and [23:41.120 --> 23:44.320] start cranking out criminal complaints bar grievances [23:44.320 --> 23:48.640] malpractice suits we will go after them [23:48.640 --> 23:54.880] with everything we got no slack no free rides [23:54.880 --> 24:00.640] would do to them what they did to you guys and see how they like it [24:00.640 --> 24:04.640] yeah so this this we're talking about the [24:04.640 --> 24:09.120] appealing the decision in court uh making for the reconsideration that is [24:09.120 --> 24:12.960] filed at the 271st district court yes it is [24:12.960 --> 24:17.600] to to the judge that is in the focus of all this discussion [24:17.600 --> 24:21.120] yeah they told this judge how to rule so [24:21.120 --> 24:26.320] he's bound to reconsider his ruling so we're going to file a motion for [24:26.320 --> 24:31.200] reconsideration oh he's probably thinking we're ignorant [24:31.200 --> 24:35.200] pro says we won't know enough to do that [24:35.200 --> 24:41.280] yeah so but we'll do that the file the motion for reconsideration we don't [24:41.280 --> 24:46.960] care what he does he part of it he cannot turn down [24:46.960 --> 24:53.200] the ruling that he gave that denied our subject [24:53.200 --> 24:57.440] matter jurisdiction challenge he has to revisit that [24:57.440 --> 25:03.360] and now we'll request that he revisit the dismissal with prejudice [25:03.360 --> 25:09.280] of your claims against the city because your claims against the city [25:09.280 --> 25:12.400] were based on the assertion that the city [25:12.400 --> 25:16.640] lacked subject matter jurisdiction now that's [25:16.640 --> 25:24.640] res judicata that's a done deal in this court cannot revisit it [25:24.640 --> 25:30.320] so that means that our claims are substantiated [25:30.960 --> 25:38.000] so he has to revisit his ruling and overturn it [25:38.000 --> 25:44.080] and when he does we file an amended pleading and now we go for punitive [25:44.080 --> 25:48.400] three times the original amount we asked for [25:48.400 --> 25:53.680] we might we might consider going for the five million [25:53.680 --> 25:58.960] that they claim that you should owe for every imaginable thing you could have [25:58.960 --> 26:05.520] done wrong over the last 20 years they actually put this in a motion [26:05.520 --> 26:10.640] I think it was 5.034 million yeah it's a whole number [26:10.640 --> 26:15.840] so we we file an amended pleading and ask for that amount [26:15.840 --> 26:23.920] from the city and that amount is justified because the amount was brought [26:23.920 --> 26:28.320] to the court by decision and sign it but he said i wouldn't do it [40:06.000 --> 40:11.120] for you because it's political suicide i go in front of that judge all the time [40:11.120 --> 40:15.120] he said now i will go to the court and try to smooth a little [40:15.120 --> 40:21.920] but he said um i can't file the the motion that you could file [40:21.920 --> 40:26.080] so i thought that was interesting for you to hear that and this is a guy [40:26.080 --> 40:33.440] you know who's really aggressive they are terrified of the judges [40:33.440 --> 40:37.280] and with good cause [40:37.680 --> 40:47.040] you cannot expect your lawyer to do anything that may excuse me [40:48.080 --> 40:53.120] okay you can't expect your lawyer to do anything that may upset the judge [40:53.120 --> 40:56.720] because he said bring more clients before this judge [40:56.720 --> 41:01.040] and if he backs the lawyer the judge into a corner in this case [41:01.040 --> 41:06.000] where he has to rule the way the lawyer wants him to [41:06.000 --> 41:12.800] then in the next case where the issues are not quite so definitive [41:12.800 --> 41:16.480] and it goes to the discretion of the judge [41:16.480 --> 41:20.240] then the judge can pay the lawyer back [41:20.240 --> 41:26.480] i filed an 11 million dollar lawsuit a few years ago against Denton County [41:26.480 --> 41:30.880] and talked to 60 lawyers the last one i talked to [41:30.880 --> 41:39.040] was the prior district attorney the one before the district attorney i sued [41:39.040 --> 41:45.280] and he answered the phone personally his name was Jerry Cobb i said hello Jerry [41:45.280 --> 41:51.040] my name is Randy Kelton and i have sued Denton County and i need someone to [41:51.040 --> 41:54.960] represent my suit he said oh mr kelton i know all about your suit [41:54.960 --> 41:59.920] i can't represent you you made accusations against the judges in there [41:59.920 --> 42:02.960] and i have to represent clients in this county [42:02.960 --> 42:06.560] i said what's the matter Jerry you're afraid those judges [42:06.560 --> 42:10.240] will screw your next client to get back at you [42:10.240 --> 42:14.480] and he said the same thing every other lawyer said [42:14.480 --> 42:22.080] you darn right they will now i don't know if that's true or not [42:22.080 --> 42:26.160] but i do know that Jerry Cobb and every one of these other in a position to where he has [42:39.200 --> 42:45.920] plausible deniability and have a guy in Tyler Texas [42:45.920 --> 42:51.120] he filed a bunch of motions he filed a motion to dismiss and the judge told him [42:51.120 --> 42:56.320] that only the district attorney in a criminal prosecution could file a [42:56.320 --> 43:01.520] motion to dismiss he filed the motion to recuse [43:01.520 --> 43:05.760] and the judge immediately pointed to counsel and then refused to hear the [43:05.760 --> 43:09.840] motion to recuse and then said he couldn't [43:09.840 --> 43:13.280] file anything else because he had counsel [43:13.280 --> 43:18.320] well so had the guy bar grief counsel [43:18.320 --> 43:23.440] counsel was not happy and went to the court and asked the court to remove him [43:23.440 --> 43:30.240] from the case so i wrote him up a opposition to withdraw [43:30.240 --> 43:35.920] the judge let him withdraw anyway now he gets to sue the judge for interfering [43:35.920 --> 43:39.520] in the private contract the judge allowed him to withdraw [43:39.520 --> 43:43.040] immediately appointed another lawyer even though this guy objected to it did [43:43.040 --> 43:47.840] not want a lawyer he appointed one anyway to prevent him from filing [43:47.840 --> 43:54.880] documents well now he's got a lawyer [43:54.880 --> 44:00.960] who has plausible deniability 51:08.560] the appeal doesn't fall on false ears or on deaf ears [51:08.560 --> 51:11.120] because they're all part of the same but you have to give him plausible [51:11.120 --> 51:15.200] deniability you have to give him no way out yeah [51:15.200 --> 51:20.400] yeah and judge to conduct complaint against the judge [51:20.400 --> 51:25.920] claiming that your lawyer absolutely refused to take any want to look at [01:51:12.800 --> 01:51:19.200] retaliation obstruction when you're in an informal hearing and you [01:51:19.200 --> 01:51:23.840] have two police officers bullying you [01:51:23.840 --> 01:51:29.280] that sounds like obstruction [01:51:29.280 --> 01:51:33.760] did you at any point ask the judge to direct these officers to conduct [01:51:33.760 --> 01:51:38.960] themselves in a civil manner absolutely i said will the court [01:51:38.960 --> 01:51:42.240] please recognize that the two percent threatening me [01:51:42.240 --> 01:51:45.600] because the one was looking was giving me the stare down and when i looked at him [01:51:45.600 --> 01:51:49.040] he's like don't don't look at me don't stare at me [01:51:49.040 --> 01:51:54.240] i mean just i mean animal tech did you keep did you keep staring at him [01:51:54.240 --> 01:51:59.600] no i would have kept staring at him at the time i didn't have the balls or the [01:51:59.600 --> 01:52:02.880] where yeah you know never got pulled over well then when i did get [01:53:10.480 --> 01:53:14.240] pulled over i cried foul about my license being suspended and [01:53:14.240 --> 01:53:17.600] and that was how i you know got the prosecutor to throw up those three [01:53:17.600 --> 01:53:21.440] charges last week but the judge is you know [01:53:21.440 --> 01:53:26.800] being being tough about um saying that i owe this money when [01:53:26.800 --> 01:53:30.320] i have a receipt saying that i don't [01:53:30.320 --> 01:53:36.480] oh so you have a receipt the judge is trying to collect money [01:53:36.480 --> have a state [01:54:48.880 --> 01:54:54.320] statute reflecting 18 us code 242 [01:54:54.320 --> 01:54:58.640] and it will almost always be called official misconduct in texas [01:54:58.640 --> 01:55:06.000] the only one i know of this different calls it official oppression [01:55:06.000 --> 01:55:12.080] and it's always a class a misdemeanor and this one's a lot more clear than
