[00:00.000 --> 00:07.840] The following news flash is brought to you by The Lone Star Lowdown, providing the deli [00:07.840 --> 00:15.560] bulletins for the commodities market, today's history, news updates, and the inside scoop [00:15.560 --> 00:23.760] into the tides of the alternative. [00:23.760 --> 00:31.920] Cash for the 11th of April 2018, closed with gold $1,353.22 in ounce, silver $16.68 in ounce, [00:31.920 --> 00:41.800] Texas crude $65.51 of barrel, big coins at $6,902.19, ethereum $420.80, bitcoin cash [00:41.800 --> 00:55.800] $652.90, and finally light coins at $114.34, a crypto coin. [00:55.800 --> 01:02.920] Today in history, the year 1968, President Lyndon M. Johnson signed the Civil Rights Act of 1968, [01:02.920 --> 01:07.760] which prohibited private businesses from discriminating based on race, color, religion, sex, or national [01:07.760 --> 01:08.760] origin. [01:08.760 --> 01:13.480] It also prohibited unequal application of voter registration requirements, racial segregation [01:13.480 --> 01:18.560] in public schools, in employment, and public accommodations for places of business. [01:18.560 --> 01:28.000] Today in history, in recent news, tensions in Syria seem to reach new levels after a chemical [01:28.000 --> 01:32.520] attack on civilians in the city of Douma, which left 40 dead and many injured, an attack [01:32.520 --> 01:36.960] which is being blamed on the democratically elected president of Syria, Bashar al-Assad, [01:36.960 --> 01:41.880] by the United States, and on Israel by Russia, either accusatory narrative without any verified [01:41.880 --> 01:43.800] evidence as of yet. [01:43.800 --> 01:47.640] President Trump tweeted today Wednesday that if, quote, Russia vows to shoot down any and [01:47.640 --> 01:52.000] all missiles fired at Syria, get ready, Russia, because they will be coming in nice and new [01:52.000 --> 01:56.840] and smart, going on to warn Russia that you shouldn't be partners with a gas-killing animal [01:56.840 --> 01:59.080] who kills his people and enjoys it. [01:59.080 --> 02:03.120] Many in the West, including President Trump, have been quick to conclude that this chemical [02:03.120 --> 02:07.320] attack must have been conducted by Assad and his forces. [02:07.320 --> 02:11.560] Syria and Russia, on the other hand, have given approval since yesterday for the Organization [02:11.560 --> 02:16.360] for the Prohibition of Chemical Weapons to investigate the sign of the chemical slaughter. [02:16.360 --> 02:19.920] Assad has been successful in maintaining rule and support during Syria's seven-year civil [02:19.920 --> 02:24.520] war, a civil war that is being fought by the government of Syria and anti-Assad Syrian [02:24.520 --> 02:29.320] rebels that are openly being funded by Western governments, with ISIS being one of the more [02:29.320 --> 02:32.600] notorious splinter groups of the American-backed Syrian rebels. [02:32.600 --> 02:38.440] No surprise, then, why Russian Foreign Minister Spokeswoman Maria Zakoba posted on Facebook [02:38.440 --> 02:42.880] that smart missiles should be fired at terrorists and not at a legitimate government, which [02:42.880 --> 02:45.000] has been fighting terrorists. [02:45.000 --> 02:48.840] Or is this a trick to destroy all traces with a smart missile strike, and then there will [02:48.840 --> 02:52.160] be no evidence for international inspectors to look at? [02:52.160 --> 03:10.200] This was Kirk Rody with your lowdown for April 11, 2018. [03:10.200 --> 03:33.120] Okay, we are back, Randy Kelton with our radio, and we're going to John in New York. [03:33.120 --> 03:34.120] Hello, John. [03:34.120 --> 03:41.000] Hello, hold on, hi, Randy, how are you doing? [03:41.000 --> 03:51.680] I'm doing well, I don't care what my mother says, how's she doing? [03:51.680 --> 03:54.680] She is doing wonderful. [03:54.680 --> 03:55.680] I am glad. [03:55.680 --> 04:01.680] I've got her on a bunch of those vitamins you suggested, I give her a handful in the [04:01.680 --> 04:06.720] morning, a handful in the evening, and she is making great progress. [04:06.720 --> 04:07.720] Okay. [04:07.720 --> 04:13.040] We walked in the kitchen the other day, she was next to me, and my foot was hurting. [04:13.040 --> 04:19.320] I think I'm having trouble from one of my boots, and I said, Mom, my foot is hurting, [04:19.320 --> 04:21.120] will you kiss it and make it better? [04:21.120 --> 04:29.360] And she tried to step on it, told her I've been trying to get my wife to kiss my foot [04:29.360 --> 04:31.240] for 40 years. [04:31.240 --> 04:33.200] She said, how's that working out for you? [04:33.200 --> 04:36.720] Ain't working any better for her than it is for you. [04:36.720 --> 04:44.640] So she's doing really well, her mind is crystal clear. [04:44.640 --> 04:55.640] And she's actually, I'm getting some semblance of short-term memory coming back somewhat. [04:55.640 --> 05:05.800] Just remember the Omega 3Ds, vitamin D3, that's vitamin D3, and Omega 3, and you want, and [05:05.800 --> 05:11.440] check with the doctor on all these things, alpha-lipoic acid, tin-cold-bulb- [05:11.440 --> 05:16.760] No, I did not check with the doctor, I told him what I was going to do. [05:16.760 --> 05:23.240] And he told my sister, the nurse, that whatever your brother's doing, tell him to keep doing [05:23.240 --> 05:30.000] it, he's being real good for your mom, she has urinary infection, it causes your blood [05:30.000 --> 05:32.240] pressure to go up. [05:32.240 --> 05:36.320] So when I left here, I had to go back to Texas, I told him, if her blood pressure, her blood [05:36.320 --> 05:46.600] pressure is 117 over 75, she's about 95. [05:46.600 --> 05:53.160] So it goes up, they take her to the allopathic doctor, and oh, her blood pressure's going [05:53.160 --> 05:55.680] to put on her blood pressure medicine. [05:55.680 --> 06:02.680] Then I told him, get her to a urologist, they get her to a urologist, and he gives her antibiotics, [06:02.680 --> 06:08.120] it knocks out the urinary infection, and her blood pressure drops through her shoes to [06:08.120 --> 06:12.800] 91 over 70. [06:12.800 --> 06:16.440] I got back here, and that's when I checked it, that's what it was, I took the blood pressure [06:16.440 --> 06:18.440] medicine through in the trash. [06:18.440 --> 06:28.680] Well, it was that they had two doctors and they're not telling them everything, the allopathic [06:28.680 --> 06:32.960] doctor didn't do anything wrong, but he didn't know about the urinary infection, and the [06:32.960 --> 06:39.600] effect it had on her, but we're getting that kind of thing sorted out. [06:39.600 --> 06:43.360] Point for everybody also, when I came here a year ago, I thought my mother was almost [06:43.360 --> 06:44.360] dead. [06:44.360 --> 06:57.360] She's 95, she's got incontinence, diarrhea, disoriented, dizzy, can't walk, a year later, [06:57.360 --> 07:02.840] all of that's gone, every bit of it is gone, and my sister, the nurse, every time I ask [07:02.840 --> 07:11.880] her about some of this, oh, well, she's 95, no, no, no, no, no, no, no, something's wrong, [07:11.880 --> 07:18.880] which is not a necessary condition, what causes the condition, we looked at the conditions [07:18.880 --> 07:24.640] and I talked to John here and he'd give me suggestions and the difference in my mom is [07:24.640 --> 07:28.560] absolutely 180 degrees. [07:28.560 --> 07:33.840] So enough of that, what do you have for us today? [07:33.840 --> 07:42.200] Okay, I sent to the debt collector, remember the debt for the New York State taxes? [07:42.200 --> 07:43.200] Yes. [07:43.200 --> 07:51.920] A letter, a validation letter, I do not recognize you, I have never entered into any contract [07:51.920 --> 07:58.560] with you, I dispute your claim and require you to prove your claim and to prove I am [07:58.560 --> 08:05.320] legally bound to pay the alleged debt to you, thank you and in my name. [08:05.320 --> 08:06.320] Okay. [08:06.320 --> 08:10.320] I was, okay, go ahead, comment. [08:10.320 --> 08:14.320] UCC, that's right under the Uniform Promotional Code. [08:14.320 --> 08:20.560] Okay, now what do you mean, what do you mean, what I did was under the UCC? [08:20.560 --> 08:28.520] Yes, okay, we have some consumer protection laws, Fair Debt Collections Practices Act, [08:28.520 --> 08:35.200] the Real Estate Excalibur Procedures Act, this is about four of them and I think they're [08:35.200 --> 08:41.000] all a scam, the Truth and Linty Act, Truth and Linty Act and the Fair Debt Collections [08:41.000 --> 08:48.800] Practices Act are the biggest scams, they were passed as consumer protection laws and [08:48.800 --> 08:58.240] they give you these things that you can do and place a responsibility on the debt collectors [08:58.240 --> 09:05.560] to respond in certain ways, but then they set the statute of limitations for exercising [09:05.560 --> 09:11.800] these remedies to one in two years, so short as to make them ineffectual. [09:11.800 --> 09:18.560] What they don't tell you is everything that is in the consumer protection laws is in the [09:18.560 --> 09:26.480] Uniform Promotional Code and they don't have those idiotic restrictions, right? [09:26.480 --> 09:33.320] So my suggestion and goes to one of my rules is never give legal advice, when someone puts [09:33.320 --> 09:42.640] in an information request, never ever cite law, demand to see the records you want to [09:42.640 --> 09:49.160] see, if you ask for court records under the Freedom of Information Act, they will deny [09:49.160 --> 09:55.920] you access because the Freedom of Information Act doesn't apply and when they do that to [09:55.920 --> 10:05.080] me, I file criminal charges against them because the constitutional right to a public court [10:05.080 --> 10:13.080] applies and it makes no difference what law I cite it, it doesn't change your duty. [10:13.080 --> 10:20.880] So I never tell them, I never give them legal advice, this is what I want to see and if [10:20.880 --> 10:29.160] they have under any question about under what law am I requesting this information under [10:29.160 --> 10:33.560] any applicable law. [10:33.560 --> 10:40.440] I do not have to cite the law to engage the law. [10:40.440 --> 10:45.680] The law is effective whether I cite it or not. [10:45.680 --> 10:52.480] So the trick for you is to figure out if there is a law that commands you to show this to [10:52.480 --> 10:58.000] me, if there is, you better find it because you can be pretty sure I know exactly what [10:58.000 --> 11:04.720] it is and when you don't respond to it, I'm going to land on you like a ton of bricks [11:04.720 --> 11:10.080] and I have no duty to give you fair warning, I now have no duty to give you legal advice. [11:10.080 --> 11:12.880] If you want to know what law is applied, go hire an attorney. [11:12.880 --> 11:17.680] Well, Dr. Posketer, I'm sure he'll tell you what you're supposed to do. [11:17.680 --> 11:21.200] So go ahead and screw it up and see how this works for you. [11:21.200 --> 11:22.680] Does that make sense, John? [11:22.680 --> 11:25.120] Yes, it does. [11:25.120 --> 11:31.200] And now you mentioned there's a way to use the UCC to satisfy the debt with the collection [11:31.200 --> 11:32.200] agencies. [11:32.200 --> 11:36.320] Now, I used to be a debt collector, so please explain. [11:36.320 --> 11:38.480] I can't find the use. [11:38.480 --> 11:41.600] Did you listen to Tina earlier? [11:41.600 --> 11:51.720] Did you listen to Tina earlier talking about tender offered and tender denied is tender [11:51.720 --> 11:56.080] made. [11:56.080 --> 12:03.160] Under the Uniform Commercial Code, if I owe you a debt and I offer to pay that debt, [12:03.160 --> 12:06.960] then you refuse to accept my offer, the debts paid. [12:06.960 --> 12:11.360] You cannot refuse to accept tender. [12:11.360 --> 12:18.400] And then the courts moved against her for failing to tender. [12:18.400 --> 12:20.520] So they can apply the law? [12:20.520 --> 12:23.020] Yes. [12:23.020 --> 12:27.760] The debt collector, in this case it was foreclosure, and they wanted that property. [12:27.760 --> 12:32.560] They did not want her to tender, but she could tender. [12:32.560 --> 12:37.400] And they offered tender, and these guys just ignored it, and the court was bought and paid [12:37.400 --> 12:44.280] for, so the court accused her of not tendering and refused to address the issue she brought [12:44.280 --> 12:45.480] before the court. [12:45.480 --> 12:49.720] She's got a good case for the Fed. [12:49.720 --> 12:55.320] What offer can I make that I know they're going to refuse and then... [12:55.320 --> 13:00.640] I'm not the expert on the Uniform Commercial Code, but it is not that big. [13:00.640 --> 13:07.280] Read through the Uniform Commercial Code or the State of New York has adopted its [13:07.280 --> 13:10.960] own version of the commercial code. [13:10.960 --> 13:14.760] Read through that. [13:14.760 --> 13:22.960] The Uniform Commercial Code has, in one incantation or another, been around for at least 800 years. [13:22.960 --> 13:33.320] It comes from the Maritime Laws, how companies deal with each other, a uniform set of rules, [13:33.320 --> 13:37.720] and they are extremely well-developed. [13:37.720 --> 13:38.720] Read those. [13:38.720 --> 13:43.720] This is how contracts work. [13:43.720 --> 13:44.880] These are your rights. [13:44.880 --> 13:46.880] These are your duties under contracts. [13:46.880 --> 13:47.880] Read through those. [13:47.880 --> 13:48.880] They're... [13:48.880 --> 13:50.880] It's not that big. [13:50.880 --> 13:53.720] It'll read it to you like a comic book. [13:53.720 --> 13:57.560] Well, I tried to find it, and I couldn't find it. [13:57.560 --> 13:58.720] I even asked a lawyer. [13:58.720 --> 14:03.160] The lawyer didn't know where it was. [14:03.160 --> 14:08.160] Just look for the New York Commercial Code. [14:08.160 --> 14:12.720] I did all over the place, and I don't know if I could not find it. [14:12.720 --> 14:13.720] I'm serious. [14:13.720 --> 14:19.720] Now, if this were medical, I'd find it in five seconds, but it's legal, and I have [14:19.720 --> 14:22.920] a terrible time locating legal documents. [14:22.920 --> 14:27.840] I can't even find the declaratory judgment form for Virginia. [14:27.840 --> 14:28.840] Nobody... [14:28.840 --> 14:29.840] Uniform... [14:29.840 --> 14:30.840] Okay. [14:30.840 --> 14:38.120] So, New York Commercial Code, first hit New York Uniform Commercial Code. [14:38.120 --> 14:39.120] Just... [14:39.120 --> 14:40.120] Yeah? [14:40.120 --> 14:41.120] Hit on fine law. [14:41.120 --> 14:42.120] It is... [14:42.120 --> 14:43.120] Let's see. [14:43.120 --> 14:46.720] Uniform Commercial Code, Article 1. [14:46.720 --> 14:50.280] It doesn't give me the exact designation of where the code is found. [14:50.280 --> 14:53.960] Let me see if I can bring it up. [14:53.960 --> 15:05.920] NYUCC 1-101, look up NYUCC, New York Uniform Commercial Code. [15:05.920 --> 15:13.000] There it is, 13 sections, just not that big. [15:13.000 --> 15:23.600] The first section has eight paragraphs, second has seven, then seven more. [15:23.600 --> 15:24.760] That's not very big. [15:24.760 --> 15:31.080] Just look up New York Uniform Commercial Code, read that through, and you will be surprised [15:31.080 --> 15:33.480] at the remedy you have in there. [15:33.480 --> 15:36.520] Okay, NYUCC dot... [15:36.520 --> 15:41.520] Well, the first code was in, well, UCC-101. [15:41.520 --> 15:45.520] No, no, no, no, no, what's the address? [15:45.520 --> 15:46.520] NY... [15:46.520 --> 15:51.320] Oh, oh, just look up New York Commercial Code. [15:51.320 --> 15:53.320] All right. [15:53.320 --> 16:02.960] The first hit I got was on fine law, but I had a whole bunch of them. [16:02.960 --> 16:10.000] Just look up New York Uniform Commercial Code, Consolidated Laws of New York at NewYorkState.gov, [16:10.000 --> 16:19.320] Justia.com, DOS.New York, I got a whole stack of hits on it. [16:19.320 --> 16:23.840] Okay, NYUCC dot... [16:23.840 --> 16:29.320] No, NYUCC is the code. [16:29.320 --> 16:30.840] I know, but what address... [16:30.840 --> 16:32.880] It doesn't have dot, it doesn't have... [16:32.880 --> 16:34.360] That's the name of the code. [16:34.360 --> 16:36.760] Oh, I understand, UCC... [16:36.760 --> 16:42.280] If you go to dot 101, you'll get the first statute in the entire code. [16:42.280 --> 16:45.240] Why do you want to go there? [16:45.240 --> 16:54.960] Just do a simple search of New York Uniform Commercial Code, and you'll have first link [16:54.960 --> 16:58.360] us to send you what exactly to it. [19:46.240 --> 19:49.640] Okay, I forgot to unmute you. [19:49.640 --> 19:51.640] Okay, I'm here. [19:51.640 --> 19:57.640] Look that up, read that, then call back next Thursday and let's talk about it. [19:57.640 --> 19:58.640] Okay. [19:58.640 --> 20:01.640] You'll be surprised at the remedy you find. [20:01.640 --> 20:06.640] All right, I need a declaratory judgment form, can I find it? [20:06.640 --> 20:09.640] And nobody knows where they are, I even asked for the attorney. [20:09.640 --> 20:13.640] There's probably not one. [20:13.640 --> 20:20.640] Okay, contact me Monday morning, send me an email. [20:20.640 --> 20:24.640] I will make you up a form. [20:24.640 --> 20:29.640] I'll look at this case, I've just really been buried lately. [20:29.640 --> 20:34.640] I'll look at this case and make you up a declaratory adjustment form. [20:34.640 --> 20:40.640] I can pull out my New York, I've got forms from New York, so I have the style and such. [20:40.640 --> 20:47.640] Send me an email, ask for the declaratory adjustment form, I'll get it for you Monday. [20:47.640 --> 20:52.640] Okay, and with your help, my relatives had two tickets dismissed and one of those tickets [20:52.640 --> 20:58.640] that got dismissed was a seatbelt ticket and he actually was wearing a seatbelt. [20:58.640 --> 21:05.640] But he got another seatbelt ticket about a month ago and he actually had his seatbelt on again. [21:05.640 --> 21:10.640] Now, that's a fact, he always had the seatbelt on, I know him. [21:10.640 --> 21:13.640] Now, I don't understand how a cop can do that. [21:13.640 --> 21:14.640] What is it? [21:14.640 --> 21:16.640] Is it a slow ticket month? [21:16.640 --> 21:26.640] It must be, you might want to go in and ask to see all of their traffic tickets written for the last month. [21:26.640 --> 21:33.640] And dig through them, see how many seatbelts, see how many this cop writes. [21:33.640 --> 21:37.640] Where do I go to find that? [21:37.640 --> 21:42.640] Whatever court you, your friend went to, your relative went to. [21:42.640 --> 21:46.640] Oh, I can go to the court and ask to see all the tickets? [21:46.640 --> 21:48.640] That's who has them. [21:48.640 --> 21:54.640] That's who keeps the court record, the tickets filed with the court. [21:54.640 --> 21:57.640] Okay, and I can legally do that, I can look at the ticket. [21:57.640 --> 22:06.640] Oh yeah, they were acquired, that's all public courts, all courts shall be public. [22:06.640 --> 22:14.640] Okay, all right, then the other thing is, my only other question is, and then you can get to the next caller, [22:14.640 --> 22:18.640] the only other question is, what offer? [22:18.640 --> 22:27.640] Give me a typical example, I'm going to read the UCC code and I'm going to read it until I memorize, but that's beside the point. [22:27.640 --> 22:35.640] I don't understand how you can tender an offer and the agency, the collection agency, stupid enough to refuse it. [22:35.640 --> 22:38.640] I don't understand that. [22:38.640 --> 22:41.640] Join the club, welcome to my world. [22:41.640 --> 22:48.640] They just, they've got the courts bought and paid for, they can do whatever they want to. [22:48.640 --> 22:51.640] Well, we don't take them to the legal task. [22:51.640 --> 22:58.640] I'm so, I'm very hungry, I want to read the code, but in the meantime, on dying of curiosity, [22:58.640 --> 23:06.640] what offer could I possibly make that they'd be stupid enough to refuse and get me off the hook? [23:06.640 --> 23:10.640] I don't know, I haven't seen your case. [23:10.640 --> 23:13.640] What are they asking for? [23:13.640 --> 23:24.640] Well, they're asking to be paid for the amount of money that I owe in fees and principal to the state of New York. [23:24.640 --> 23:32.640] Have they provided a complete accounting of your entire history with this debt? [23:32.640 --> 23:35.640] No, they just said what the total was and it might be more. [23:35.640 --> 23:36.640] Okay. [23:36.640 --> 23:37.640] Okay. [23:37.640 --> 23:47.640] You offer tender if they will provide you with documentation proving up this total. [23:47.640 --> 23:53.640] So in other words, I have to tell them that I'm going to make you offer, but I need the total. [23:53.640 --> 23:56.640] That's all for me. [23:56.640 --> 24:04.640] If they don't provide a simple accounting, then that's all for refused. [24:04.640 --> 24:09.640] Oh, so in other words, this is what I would say. [24:09.640 --> 24:19.640] I'm going to tender an offer that first I need complete accounting step by step of what I owe. [24:19.640 --> 24:22.640] Yeah, and that's not unreasonable. [24:22.640 --> 24:23.640] Okay. [24:23.640 --> 24:38.640] Then when they don't tender, then you file an action in the court for restraining order and a declaratory judgment declaring that you made offer for tender. [24:38.640 --> 24:40.640] They refuse your offer for tender. [24:40.640 --> 24:49.640] Therefore, in the UCC, you have a right to a ruling that the debt has been tendered. [24:49.640 --> 24:52.640] Hmm. [24:52.640 --> 24:54.640] Not complex. [24:54.640 --> 24:55.640] It's so simple. [24:55.640 --> 24:57.640] I can't believe it. [24:57.640 --> 25:00.640] It is that simple. [25:00.640 --> 25:02.640] I mean, we're not we're not lawyers. [25:02.640 --> 25:04.640] We're not trying to make it more complex. [25:04.640 --> 25:05.640] Right. [25:05.640 --> 25:08.640] Well, you see, the whole thing is so simple. [25:08.640 --> 25:11.640] I can hardly believe that and I'm standing. [25:11.640 --> 25:14.640] I mean, right now I'm going home. [25:14.640 --> 25:24.640] It's just like it's just like when you go to the doctor and you've got psoriasis and you're going to take this $5,000 drug that's going to kill your immune system. [25:24.640 --> 25:27.640] And all you got to do is put apple cider vinegar on it. [25:27.640 --> 25:31.640] People will go home. [25:31.640 --> 25:34.640] It's kind of like that. [25:34.640 --> 25:53.640] You set them up to act in direct violation of a specific statutory requirement and then ask the court to rule that they acted in violation of the statutory requirement. [25:53.640 --> 26:04.640] If the court says based on these facts are ruling is yes, they did act in violation of this statutory requirement. That's res judicata cannot be challenged. [26:04.640 --> 26:08.640] It's a done deal. [26:08.640 --> 26:09.640] Now you go to them. [26:09.640 --> 26:10.640] They're in breach of contract. [26:10.640 --> 26:14.640] They're in breach of UCC. [26:14.640 --> 26:15.640] Wow. [26:15.640 --> 26:17.640] Okay. [26:17.640 --> 26:18.640] Read the code first. [26:18.640 --> 26:24.640] Talk about it next week and then I need you to bring me up to speed on the universal commercial code. [26:24.640 --> 26:25.640] I haven't. [26:25.640 --> 26:28.640] We haven't addressed it here in quite a while. [26:28.640 --> 26:30.640] Say again. [26:30.640 --> 26:38.640] I said I need you to read it a couple of times and then come on the air and bring me up to speed and bring all our listeners up to speed on the UCC. [26:38.640 --> 26:39.640] All right. [26:39.640 --> 26:43.640] And any last words about the seat belt ticket. [26:43.640 --> 26:50.640] He's already done the statement and sworn to it before a notary that he was wearing a seat belt. [26:50.640 --> 26:56.640] I told him that not only his witness has to have one, I told him to go out and get one too. [26:56.640 --> 27:00.640] He didn't swear out a statement for himself. [27:00.640 --> 27:05.640] He needs to do that before a notary that he was wearing a seat belt. [27:05.640 --> 27:14.640] Here's another last minute of advice that you can throw along with those two affidavits file a motion to dismiss. [27:14.640 --> 27:15.640] Okay. [27:15.640 --> 27:16.640] And how do you word it? [27:16.640 --> 27:18.640] It just simple word. [27:18.640 --> 27:27.640] Move the court to dismiss the case based on proof of innocence. [27:27.640 --> 27:28.640] Okay. [27:28.640 --> 27:32.640] Is that all I say? [27:32.640 --> 27:33.640] That's it. [27:33.640 --> 27:35.640] Yep. [27:35.640 --> 27:36.640] That's all I say. [27:36.640 --> 27:37.640] That one sentence. [27:37.640 --> 27:39.640] Right. [27:39.640 --> 27:49.640] So I'm going to file a motion to the court to dismiss based on proof of innocence. [27:49.640 --> 27:52.640] By attached affidavits. [27:52.640 --> 27:54.640] By attached affidavits. [27:54.640 --> 27:59.640] And those affidavits utter what he had done before the... [27:59.640 --> 28:06.640] You have two verified affidavits from two different witnesses saying that he had his seat belt on. [28:06.640 --> 28:10.640] You have one witness saying he didn't have his seat belt on. [28:10.640 --> 28:17.640] The court is required to take the word of the two against the one. [28:17.640 --> 28:19.640] And that's the final word? [28:19.640 --> 28:21.640] Final word. [28:21.640 --> 28:25.640] Unless the officer can bring some other evidence. [28:25.640 --> 28:30.640] Does he have clear and unequivocal photographic evidence? [28:30.640 --> 28:37.640] That absolutely proves the evidence that is time stamped. [28:37.640 --> 28:43.640] That proves that he didn't have a seat belt on because the word of an officer against the word of a citizen. [28:43.640 --> 28:49.640] Absent supporting evidence the court must always accept the word of the citizen. [28:49.640 --> 28:56.640] The word of an officer against the word of two citizens is enough to charge the officer with aggravated perjury. [28:56.640 --> 28:58.640] Wow. [28:58.640 --> 29:00.640] And you should. [29:00.640 --> 29:02.640] Whoa, whoa, whoa. [29:02.640 --> 29:05.640] Thank you. [29:05.640 --> 29:06.640] All right. [29:06.640 --> 29:12.640] And should he include anything about the fact that there's only two possibilities? [29:12.640 --> 29:14.640] Number one, the officer is obviously mistaken. [29:14.640 --> 29:18.640] Or number two, this is retaliation. [29:18.640 --> 29:26.640] No, unless there's some clear evidence of retaliation, it is not needed. [29:26.640 --> 29:28.640] Only give the judge what he needs. [29:28.640 --> 29:33.640] Don't throw in extra stuff that will give him reason to try to protect his office. [29:33.640 --> 29:35.640] Okay, got it. [29:35.640 --> 29:37.640] Don't say the officer was mistaken. [29:37.640 --> 29:39.640] He was wearing it. [29:39.640 --> 29:41.640] The officer said he weren't. [29:41.640 --> 29:42.640] We got two people said he was. [29:42.640 --> 29:43.640] It's a done deal. [29:43.640 --> 29:44.640] Okay. [29:44.640 --> 29:45.640] Going to break. [29:45.640 --> 29:46.640] Brandy Kelton. [29:46.640 --> 29:48.640] We'll be right back. [30:16.640 --> 30:42.640] We'll be right back. [30:42.640 --> 30:49.640] We'll be right back. [31:12.640 --> 31:22.640] We'll be right back. [31:42.640 --> 32:02.640] We'll be right back. [32:02.640 --> 32:27.640] We'll be right back. [32:27.640 --> 32:34.640] We'll be right back. [32:57.640 --> 33:04.640] Together we can have free society we all want and deserve. [33:04.640 --> 33:21.640] Live free speech radio, logosradionetwork.com. [33:21.640 --> 33:43.640] We'll be right back. [33:43.640 --> 33:45.640] Okay, we are back. [33:45.640 --> 34:11.640] We'll be right back. [34:11.640 --> 34:17.640] Hello, what do you have for us today? [34:17.640 --> 34:18.640] I'm just fine. [34:18.640 --> 34:30.640] I just wanted to call today to thank you and thank Eddie for the effort that you guys put into educating us about the law. [34:30.640 --> 34:31.640] No, wait a minute. [34:31.640 --> 34:33.640] You can't thank Eddie. [34:33.640 --> 34:39.640] If you thank Eddie, he'll get the big head. [34:39.640 --> 34:41.640] Well, he deserves it. [34:41.640 --> 34:43.640] He deserves it. [34:43.640 --> 34:49.640] He deserves being picked on and I help him out with that at every opportunity. [34:49.640 --> 34:51.640] Okay, go ahead. [34:51.640 --> 34:54.640] I just like picking on Eddie. [34:54.640 --> 34:55.640] I got you. [34:55.640 --> 34:57.640] There's two questions that I had in mind. [34:57.640 --> 35:01.640] I've been listening to the show on and off whenever I can. [35:01.640 --> 35:07.640] I'm glad that you guys keep a record on your website to listen to them later on because I'm not usually... [35:07.640 --> 35:09.640] I don't have... I have a hectic schedule. [35:09.640 --> 35:14.640] I work as a truck driver and sometimes I drive the night. [35:14.640 --> 35:17.640] So I'm glad that you guys keep a record of that. [35:17.640 --> 35:25.640] But the first question is regarding a gentleman who called from New York and he asked you about... [35:25.640 --> 35:32.640] I think it was a highway patrol or commercial code enforcement officer who pulled him over. [35:32.640 --> 35:51.640] He was in his own car, automobile, and he pulled him over and he dragged him out of the vehicle because he wasn't... [35:51.640 --> 35:56.640] He didn't... he failure to ID basically is what the officer claiming. [35:56.640 --> 36:04.640] And I was anticipating you saying the same thing because that's a highway patrol officer. [36:04.640 --> 36:13.640] And I was waiting for you to say something that you didn't say on that particular thing that that was a commercial enforcement officer. [36:13.640 --> 36:23.640] And he was trying... I know there's a failure to ID in the code because you said that during that episode that there is a failure to ID in the commercial code. [36:23.640 --> 36:32.640] Which is... yeah, but he is... again, he is not... he's not okay to apply the municipal or the penal code. [36:32.640 --> 36:38.640] This is kind of a difficult area. [36:38.640 --> 36:42.640] The person had a commercial license. [36:42.640 --> 36:45.640] So put yourself in the policeman's position. [36:45.640 --> 36:53.640] You see this vehicle and it has commercial license plates on it. [36:53.640 --> 37:01.640] And you run those license plates and you find that the owner of the vehicle has a commercial license. [37:01.640 --> 37:16.640] So that would give a reasonable person of ordinary prudence cause to believe that this commercially licensed vehicle operated by a commercially licensed individual fell within the transportation code. [37:16.640 --> 37:26.640] And that commercially... that publicly displayed license, an officer can claim, gives him probable cause to believe. [37:26.640 --> 37:31.640] Now, why does he pose the vehicle over? [37:31.640 --> 37:39.640] The first thing he has to do is determine whether or not he has subject matter jurisdiction. [37:39.640 --> 37:44.640] He has to make a determination of whether or not the person is in commerce. [37:44.640 --> 37:55.640] However, when the person filled out the request for the license or the application for the license, [37:55.640 --> 38:03.640] he agreed to provide that license on request. [38:03.640 --> 38:08.640] Now, there are conflicting laws here. [38:08.640 --> 38:16.640] If you have voluntarily entered into a contract and you've agreed to do a certain thing, [38:16.640 --> 38:26.640] does the fact that at the time the officer stops you, you're not actually acting in commerce? [38:26.640 --> 38:33.640] But you do have a license that when you got that license, you agreed to show it on demand. [38:33.640 --> 38:42.640] But does that make the DMV falls under the... is that a municipality? [38:42.640 --> 38:44.640] It should be a municipality, isn't it? [38:44.640 --> 38:50.640] If it was Highway Patrol, he falls under the state and Highway Patrols were created [38:50.640 --> 38:54.640] for the purpose of enforcing the commercial transportation code. [38:54.640 --> 38:59.640] And the law says if you get... when you sign for this license, you agree to show it on demand. [38:59.640 --> 39:02.640] Does it say anything about commerce? [39:02.640 --> 39:04.640] Okay. [39:04.640 --> 39:12.640] You entered into this contract and I have a problem with not showing them your license. [39:12.640 --> 39:14.640] They already know who you are. [39:14.640 --> 39:15.640] They already know you got one. [39:15.640 --> 39:16.640] They already know all of that. [39:16.640 --> 39:19.640] What is the point? [39:19.640 --> 39:26.640] Why on earth would you create this particular fight? [39:26.640 --> 39:29.640] I don't understand the point, the purpose. [39:29.640 --> 39:37.640] And the way I read the codes, they don't exactly enforce it that way. [39:37.640 --> 39:45.640] And I believe it's because they don't want us to recognize what they have done. [39:45.640 --> 39:56.640] That requirement to show the license on demand, if it is applied to someone who is not actually [39:56.640 --> 40:05.640] engaged in commerce, amounts to an unconstitutional application of the requirement. [40:05.640 --> 40:13.640] It's not unconstitutional on its face, but it is unconstitutional if at the time of the [40:13.640 --> 40:16.640] stop the person is not operating in commerce. [40:16.640 --> 40:24.640] But as far as I can tell, there is no case law addressing that issue. [40:24.640 --> 40:32.640] So until we get some law saying that application of the requirement to identify to a person [40:32.640 --> 40:41.640] not in commerce is a nonconstitutional application of the code, then you still have to produce. [40:41.640 --> 40:50.640] Now, you may have an affirmative defense, but from the officer's position, he has [40:50.640 --> 40:58.640] knowledge that you applied for a license and the requirement was an agreement to produce [40:58.640 --> 41:02.640] that license on demand and you did not produce that license on demand. [41:02.640 --> 41:06.640] And there's a statute that says that's his crime. [41:06.640 --> 41:09.640] So he's got you from his perspective. [41:09.640 --> 41:17.640] Now, the courts would have to say to the officer, you first have to establish that he actually [41:17.640 --> 41:19.640] is operating in commerce. [41:19.640 --> 41:22.640] That's not in the law. [41:22.640 --> 41:30.640] They would have to change the law to say that if you are operating in commerce, then you [41:30.640 --> 41:35.640] must show the license, but that's not what it says. [41:35.640 --> 41:36.640] No. [41:36.640 --> 41:43.640] And until it says something different, the law may be unconstitutional in that application, [41:43.640 --> 41:51.640] but until a court has ruled that it's unconstitutional, then the officer can act as if it is perfectly [41:51.640 --> 41:52.640] alright. [41:52.640 --> 41:55.640] Does that make sense? [41:55.640 --> 42:00.640] There's one point that doesn't add up to me. [42:00.640 --> 42:05.640] How can you establish probable cause or the stop to begin with? [42:05.640 --> 42:09.640] Because most of them is going to be terrorist stop or that's what... [42:09.640 --> 42:14.640] You've got a commercial license on your vehicle. [42:14.640 --> 42:19.640] You could be hauling something in the trunk for pay. [42:19.640 --> 42:24.640] Maybe you're a delivery guy and you're delivering pieces. [42:24.640 --> 42:27.640] You've got a trunk full of pieces. [42:27.640 --> 42:29.640] You fall under. [42:29.640 --> 42:33.640] And you can see that from the outside. [42:33.640 --> 42:38.640] You'd have to stop you and then make a determination as to whether or not you're operating in commerce. [42:38.640 --> 42:47.640] But from his rules, the fact that you are prominently displaying a commercial license plate on your [42:47.640 --> 42:49.640] vehicle. [42:49.640 --> 42:57.640] And he can run a check on your license and find that you have been issued a commercial license. [42:57.640 --> 43:02.640] That indicates that you are in commerce. [43:02.640 --> 43:07.640] Now, that creates what would be called prima facie on the face of it. [43:07.640 --> 43:17.640] A reasonable person of ordinary prudence seeing someone driving a semi-trailer and he has a class A license. [43:17.640 --> 43:19.640] He's authorized to operate that semi-trailer. [43:19.640 --> 43:24.640] Would you automatically presume that he's not in commerce? [43:24.640 --> 43:26.640] Yeah. [43:26.640 --> 43:28.640] You'd assume he was. [43:28.640 --> 43:33.640] And because there's prima facie evidence that you are, then you would have to show that you're not. [43:33.640 --> 43:35.640] You'd have to tell the officer, [43:35.640 --> 43:37.640] I'm not in commerce at the moment. [43:37.640 --> 43:44.640] If you attempt to apply that requirement to me, that would be an unconstitutional application of the code. [43:44.640 --> 43:50.640] But the police officer is not the guy to make that determination. [43:50.640 --> 43:51.640] Hang on. [43:51.640 --> 43:52.640] We're about to go to break Randy Kelton. [46:32.640 --> 46:44.640] Alright, thanks everyone. [46:44.640 --> 46:48.640] I'm just here makin' my livin' and pushin' but... [46:48.640 --> 46:50.640] Okay, we are back. [46:50.640 --> 46:59.120] Randy Kelton, rule of L'Oreo on this Friday the 13th day of July, 2018, and we're talkin' [46:59.120 --> 47:01.120] to Salkton in Oklahoma. [47:01.120 --> 47:04.120] Okay, Salkton, did that make sense? [47:04.120 --> 47:11.640] Yeah, it did, but I'm still stuck on the point where he had a probable cause to stop [47:11.640 --> 47:18.560] you to begin with, which is I understand they have some codes for the tarry stop, but it's [47:18.560 --> 47:19.560] never a tarry stop. [47:19.560 --> 47:24.160] I mean, realistically, it's always detainable. [47:24.160 --> 47:29.640] They do a detention, a full detention on you, and then they say it's a tarry stop, which [47:29.640 --> 47:36.440] is very unconstitutional, but the problem is I just can't get to the point where I understand [47:36.440 --> 47:41.800] how they established the probable cause to pull me over and ask for a license, knowing [47:41.800 --> 47:46.320] that I do have a class ACBL, but I'm not engaged in commerce, I'm dead-hitting, as [47:46.320 --> 47:49.320] you said, of that particular case. [47:49.320 --> 47:53.520] Yeah, but how does he know you're dead-hitting? [47:53.520 --> 48:00.200] Okay, so basically, he does have a probable cause to stop you and ask you, well, that's [48:00.200 --> 48:01.200] what the tarry stop. [48:01.200 --> 48:03.400] That's where the tarry stop is. [48:03.400 --> 48:06.040] Yeah, he has probable cause to stop. [48:06.040 --> 48:13.080] Now, you have to tell him, hold on, guy, I'm not operating in commerce. [48:13.080 --> 48:20.840] Now you have bypassed his prima facie evidence of commerce. [48:20.840 --> 48:22.880] Now he has to establish commerce. [48:22.880 --> 48:27.520] If he doesn't at that point, then you call 911. [48:27.520 --> 48:28.520] Okay. [48:28.520 --> 48:32.760] Okay, I see how it is, okay, okay, okay. [48:32.760 --> 48:38.800] So he does have jurisdiction basically to stop you and ask you for your license, or [48:38.800 --> 48:44.680] not for your license, so I'd be in general, and to do the, to basically make a... [48:44.680 --> 48:52.320] No, no, no, no, he only has authority to ask for that commercial license because that's [48:52.320 --> 48:56.480] what you agree to produce, nothing else. [48:56.480 --> 49:00.200] Okay, okay, okay, that makes sense. [49:00.200 --> 49:02.520] Okay, okay, it makes sense. [49:02.520 --> 49:09.760] Yeah, and I get pedantic this way sometimes, but we have to ask the right question to get [49:09.760 --> 49:17.800] the right answer, and if we're going to set the cop up, we have to set him up right. [49:17.800 --> 49:25.640] So the first thing to say is, you know, I'm empty guy, I'm deadheading, what do you want? [49:25.640 --> 49:37.080] And then as for the license again, then you call 911, that is so much fun to do. [49:37.080 --> 49:41.080] And even, you know, if you're a commercial driver, you would think that if you get them [49:41.080 --> 49:48.880] upset at you, then they will retaliate against you, not the way it works. [49:48.880 --> 49:54.200] They try this, and you land on them like a ton of bricks, win, lose, or draw, you give [49:54.200 --> 49:58.720] them a hard fight to the courts, you go on that list, do not detain. [49:58.720 --> 50:05.840] They're out there trying to make money, and they don't make money stopping guys like you [50:05.840 --> 50:09.960] who fight them. [50:09.960 --> 50:16.840] Okay, do you have anything else for it, or did I answer your question? [50:16.840 --> 50:23.800] I have, you did answer it, very, I mean, I get the idea now, I see what you're hitting [50:23.800 --> 50:24.800] me with. [50:24.800 --> 50:30.960] I probably need to listen more, as you said, pedantic is the key to it, just being very [50:30.960 --> 50:34.960] precise on what you listen to and how to apply it. [50:34.960 --> 50:40.160] That's probably half of the skill that I'm lacking, but probably I need to work on it [50:40.160 --> 50:46.720] to be able to listen to every word that's in the call or in the question, and what the [50:46.720 --> 50:50.640] answer is, so I can fairly understand how the system works. [50:50.640 --> 51:01.400] I'm a very big fan of the routine you learn on the court, the U.S. 18 U.S. 242, I'm a [51:01.400 --> 51:03.400] big fan of that. [51:03.400 --> 51:10.520] I've been sent a lot of colors, that's like magic. [51:10.520 --> 51:14.240] It is a procedure that everybody should learn. [51:14.240 --> 51:22.760] Yeah, this is how we keep our governmental instruments that we've created under control. [51:22.760 --> 51:31.600] Besides, once you kind of get the pattern down, it is so much fun. [51:31.600 --> 51:38.240] I have to be careful, I tend to grin at them when I shouldn't, and it annoys the heck out [51:38.240 --> 51:44.360] of them, because they know that I'm having fun at their expense. [51:44.360 --> 51:48.640] It's probably going to get me beat up one of these days, again, I haven't been beat [51:48.640 --> 51:54.600] up in a long time, but that is a hazard, you get to enjoy it too much, so you wind up doing [51:54.600 --> 52:01.360] things to create it just so you can have fun at their expense. [52:01.360 --> 52:09.760] I'm glad I get to listen to the stories that you told about the bailiff, the court, how [52:09.760 --> 52:13.560] you told him, I enjoy those stories. [52:13.560 --> 52:19.880] I actually made a point where I needed to call you and to tell us more about these, [52:19.880 --> 52:22.680] because this is how people need to act in court. [52:22.680 --> 52:29.640] They need to know that, I mean, they are public servants, that's their job, it's not something [52:29.640 --> 52:35.000] that you're not looking down on him when you say he's a public servant, that's his job, [52:35.000 --> 52:39.880] just like any other job that people have, and he has to enforce the code, the code [52:39.880 --> 52:42.400] enforcement officers. [52:42.400 --> 52:49.240] And that's why I tell them when they complain, life is filled with little decisions, we [52:49.240 --> 52:51.600] all get to make some. [52:51.600 --> 52:57.200] I did not decide to be a policeman, he did. [52:57.200 --> 53:05.560] So if life is tough for you, deal with it, or go out and pick up, this is my favorite [53:05.560 --> 53:07.440] thing to tell them. [53:07.440 --> 53:11.600] If you can't handle this job, you need to go out there and pick up dead cats and skunks [53:11.600 --> 53:19.520] off the highway where you won't be a threat to my friends and my neighbors. [53:19.520 --> 53:26.080] But it could tend to get you roughed up a little bit. [53:26.080 --> 53:28.680] Now I have another question for you. [53:28.680 --> 53:35.880] I know you said before it's not your area of expertise, but I still, you will be probably [53:35.880 --> 53:40.680] more knowledgeable than anybody that I would know to ask you this question. [53:40.680 --> 53:47.320] I have rune to the house about six months ago, and there's a, after we left the house, [53:47.320 --> 53:58.080] my wife, her mother passed away after we left that house, and we had to leave in a hurry. [53:58.080 --> 54:05.240] So we know we left about $1,200 deposit, and we were counting on that to cover up any repairs [54:05.240 --> 54:09.360] or just pick up a little bit of stuff that we left in the house. [54:09.360 --> 54:14.680] We didn't, I mean, there's me and my wife and her daughter, we didn't have any kids [54:14.680 --> 54:19.680] almost every day there, so, you know, there's not any damage that was done to the house, [54:19.680 --> 54:22.040] and we were counting on that money to take care of it. [54:22.040 --> 54:25.680] But when we left the house, they send us, well, they didn't send us anything. [54:25.680 --> 54:32.840] We haven't received the proper notice of a collection or any debt that we left, but [54:32.840 --> 54:39.760] we received after probably two months of leaving the house a note of collection. [54:39.760 --> 54:41.800] Basically they send us to a debt collector. [54:41.800 --> 54:48.320] So my question is, when I write a pleading, wait a minute, what are they trying to collect? [54:48.320 --> 55:00.480] They're trying to collect $670 on for repair fee, grass, landscaping, and the landscaping, [55:00.480 --> 55:06.000] especially the landscaping, I made it clear because the gentleman who rent us the house [55:06.000 --> 55:12.400] said, the landscaping, you don't have to worry about, I'll come, I have my own people [55:12.400 --> 55:14.760] that will come mow it for you, and they never, [55:14.760 --> 55:15.760] Oh, okay. [55:15.760 --> 55:18.880] Second, just put it on the collection. [55:18.880 --> 55:19.880] You put it on... [55:19.880 --> 55:22.400] Just file suit against them, J.P. Court. [55:22.400 --> 55:23.400] J.P. Court. [55:23.400 --> 55:32.240] Yeah, just file suit against them and demand all of your deposit back, and demand $5,000 [55:32.240 --> 55:35.520] extra for punitive damage against them. [55:35.520 --> 55:39.800] You never get that much, but you don't care. [55:39.800 --> 55:44.040] Let them deal with trying to respond to your pleading. [55:44.040 --> 55:46.880] They don't have to hire a lawyer because they're a company. [55:46.880 --> 55:53.880] And then the first thing you do is bar grieve their lawyer, and the lawyer will get apoplexy [55:53.880 --> 55:56.880] and he'll quit and they'll have to hire another lawyer. [55:56.880 --> 56:02.000] It's a whole lot cheaper just to make you a deal. [56:02.000 --> 56:07.000] It sends you what you've got coming and you stop messing with you. [56:07.000 --> 56:15.560] Well, do I write it against the collection agency or against the owner of the company [56:15.560 --> 56:16.800] that leased us the house? [56:16.800 --> 56:20.520] The company that leased the property. [56:20.520 --> 56:21.520] Okay. [56:21.520 --> 56:26.480] And you can name the collection agency if you want to, and then you get more lawyers [56:26.480 --> 56:27.480] you get to sue. [56:27.480 --> 56:35.480] You get to file bar grievances against all their lawyers, that'll make them nuts. [56:35.480 --> 56:40.400] Have you heard us talk about what happens when you file a bar grievance against a lawyer? [56:40.400 --> 56:47.720] I have heard, but I don't mind hearing it again. [56:47.720 --> 56:48.720] Okay. [56:48.720 --> 56:53.200] If you file a bar grievance against a lawyer, the state bar is going to get that grievance [56:53.200 --> 56:55.640] and they're going to throw it into trash. [56:55.640 --> 56:59.000] They will send you a letter back that says we examine into your accusation, find it does [56:59.000 --> 57:05.680] not rise to the level of misconduct, does not matter what you accuse that lawyer of. [57:05.680 --> 57:07.320] And that's a good thing. [57:07.320 --> 57:12.160] It's a good thing because their insurance carrier knows they'll throw it in the trash. [57:12.160 --> 57:14.840] So how do they engage their level of risk? [57:14.840 --> 57:15.840] By valid bar grievances? [57:15.840 --> 57:18.800] They throw them all in the trash. [57:18.800 --> 57:19.800] By the numbers. [57:19.800 --> 57:24.480] Well, one bar grievance, your first year in practice, they cancel immediately. [57:24.480 --> 57:27.200] Two bar grievances, any one year of practice, they cancel. [57:27.200 --> 57:31.560] Three, they cancel your law firm's malpractice insurance. [57:31.560 --> 57:35.000] If you've been practicing for a while and you get a bar grievance, they double your [57:35.000 --> 57:37.760] malpractice insurance. [57:37.760 --> 57:42.080] Your fault, their fault, nobody's fault, they do not care. [57:42.080 --> 57:46.680] They know the bar is going to throw them all in the trash so they cannot gauge their level [57:46.680 --> 57:49.640] of risk by valid grievances. [57:49.640 --> 57:58.220] And it is the job of the agent to get out of paying any claims he can and charge his [57:58.220 --> 58:00.800] client as much money as possible. [58:00.800 --> 58:01.800] That's your buddy. [58:01.800 --> 58:04.800] He's the one on your side. [58:04.800 --> 58:10.320] So grieve their lawyers, double their malpractice insurance, and they'll quit immediately. [58:10.320 --> 58:15.440] You have to hire another set of lawyers and they'll charge him three times as much. [58:15.440 --> 58:20.040] And then it becomes a matter of the money, it's all money. [58:20.040 --> 58:21.040] Okay. [58:21.040 --> 58:22.040] Do you have anything else? [58:22.040 --> 58:23.520] Because we're about to go to break. [58:23.520 --> 58:25.240] No, thank you, sir. [58:25.240 --> 58:26.240] I appreciate it. [58:26.240 --> 58:27.240] Thanks a lot, Randy. [58:27.240 --> 58:28.240] Okay. [58:28.240 --> 58:29.240] Thank you, Salton. [58:29.240 --> 58:33.640] Now when we come back from break, we're going to go to Daniel in Kansas, his first time [58:33.640 --> 58:49.440] called in George, and then Tina will be right back. [58:49.440 --> 58:53.560] Would you like to make more definite progress in your walk with God? [59:47.840 --> 59:57.840] You're listening to the Logos Radio Network at www.logosradionetwork.com. [01:00:17.840 --> 01:00:31.880] Markets for the 11th of April 2018 close with gold $1,353.22 in ounce, silver $16.68 in ounce, [01:00:31.880 --> 01:00:41.680] Texas crude $65.51 of barrel, bitcoins at $6,902.19, ethereum at $420.80, bitcoin cash [01:00:41.680 --> 01:00:55.640] at $652.90, and finally litecoins at $114.34, a crypto coin. [01:00:55.640 --> 01:01:01.360] Today in history, the year 1968, President Lyndon M. Johnson signed the Civil Rights Act [01:01:01.360 --> 01:01:06.800] of 1968, which prohibited private businesses from discriminating based on race, color, religion, [01:01:06.800 --> 01:01:08.240] sex, or national origin. [01:01:08.240 --> 01:01:13.360] It also prohibited unequal application of voter registration requirements, racial segregation [01:01:13.360 --> 01:01:18.480] in public schools, and employment, and public accommodations for places of business today [01:01:18.480 --> 01:01:20.280] in history. [01:01:20.280 --> 01:01:28.200] In recent news, tensions in Syria seem to have reached new levels after a chemical attack [01:01:28.200 --> 01:01:32.520] on civilians in the city of Douma, which left 40 dead and many injured, an attack which [01:01:32.520 --> 01:01:36.960] is being blamed on the democratically elected president of Syria, Bashar al-Assad, by the [01:01:36.960 --> 01:01:42.200] United States, and on Israel by Russia, either accusatory narrative without any verified evidence [01:01:42.200 --> 01:01:43.640] as of yet. [01:01:43.640 --> 01:01:47.480] President Trump tweeted today Wednesday that if, quote, Russia vows to shoot down any and [01:01:47.480 --> 01:01:51.840] all missiles fired at Syria, get ready, Russia, because they will be coming in nice and new [01:01:51.840 --> 01:01:56.680] and smart, going on to warn Russia that you shouldn't be partners with a gas-killing animal [01:01:56.680 --> 01:01:58.920] who kills his people and enjoys it. [01:01:58.920 --> 01:02:02.960] Many in the West, including President Trump, have been quick to conclude that this chemical [01:02:02.960 --> 01:02:07.160] attack must have been conducted by Assad and his forces. [01:02:07.160 --> 01:02:11.400] Syria and Russia, on the other hand, have given approval since yesterday for the Organization [01:02:11.400 --> 01:02:16.080] for the Prohibition of Chemical Weapons to investigate the sign of the chemical slaughter. [01:02:16.080 --> 01:02:19.760] Assad has been successful in maintaining rule and support during Syria's seven-year civil [01:02:19.760 --> 01:02:24.360] war, a civil war that is being fought by the government of Syria and anti-Assad Syrian [01:02:24.360 --> 01:02:29.160] rebels that are openly being funded by Western governments, with ISIS being one of the more [01:02:29.160 --> 01:02:32.920] notorious splinter groups of the American-backed Syrian rebels. [01:02:32.920 --> 01:02:38.280] No surprise then why Russian Foreign Minister Spokeswoman Maria Zakhova posted on Facebook [01:02:38.280 --> 01:02:42.600] that smart missiles should be fired at terrorists and not at a legitimate government, which [01:02:42.600 --> 01:02:44.840] has been fighting terrorists. [01:02:44.840 --> 01:02:48.680] Or is this a trick to destroy all traces with a smart missile strike, and then there will [01:02:48.680 --> 01:02:52.600] be no evidence for international inspectors to look at? [01:02:52.600 --> 01:03:19.600] This was quick roadie with your lowdown for April 11, 2018. [01:03:19.600 --> 01:03:32.720] Okay, we are back, Randy Kelton, rule of law radio, and we were going to Daniel, Daniel [01:03:32.720 --> 01:03:33.720] in Kansas? [01:03:33.720 --> 01:03:35.720] Yes, Daniel in Kansas. [01:03:35.720 --> 01:03:36.720] Hello, Daniel. [01:03:36.720 --> 01:03:39.720] Hello, Shalom Shabbat. [01:03:39.720 --> 01:03:47.160] I have a predict- Shalom, you remind me of my father-in-law. [01:03:47.160 --> 01:03:50.400] He was an Armenian Jew. [01:03:50.400 --> 01:03:54.560] He was so much fun. [01:03:54.560 --> 01:03:59.800] You can't appreciate blazing saddles until you've watched it with someone who speaks [01:03:59.800 --> 01:04:00.800] Yiddish. [01:04:00.800 --> 01:04:01.800] That's right. [01:04:01.800 --> 01:04:13.600] When they're in the blazing saddles, when the black couple is in the covered wagon and [01:04:13.600 --> 01:04:20.200] the Indians ride up and they're saying stuff, my father-in-law started interpreting for [01:04:20.200 --> 01:04:21.200] the Indians. [01:04:21.200 --> 01:04:22.200] They were speaking Yiddish. [01:04:22.200 --> 01:04:23.200] Yeah. [01:04:23.200 --> 01:04:27.320] Only Bill Brooks would do something like that. [01:04:27.320 --> 01:04:28.320] Okay, go ahead. [01:04:28.320 --> 01:04:33.320] I've watched it many times with my mother who's Jewish. [01:04:33.320 --> 01:04:41.960] Anyway, my dilemma of driving while suspended or revoked dates back to 1992. [01:04:41.960 --> 01:04:47.960] I've never had a driver's license in Kansas or anywhere. [01:04:47.960 --> 01:04:51.640] I hate to put this out there, but I did 15 years in prison. [01:04:51.640 --> 01:04:55.760] I get out in 1991, get an ID card. [01:04:55.760 --> 01:05:02.600] The following year, I get pulled over by Reno County, Kansas Sheriff's Deputy, and promptly [01:05:02.600 --> 01:05:06.640] taken to jail for driving while suspended or revoked. [01:05:06.640 --> 01:05:14.640] This is a felony, and it's caused me problems ever since. [01:05:14.640 --> 01:05:21.800] Now, 2000, the state of Kansas Supreme Court ruled the state versus Bowie, knowing it can [01:05:21.800 --> 01:05:28.800] be charged driving while suspended or revoked if they've never had a driver's license. [01:05:28.800 --> 01:05:37.120] I got a rather odd Christmas present, December 23, 2015, Kansas Court of Appeals on two of [01:05:37.120 --> 01:05:45.600] my cases, unpublished opinion, said the same thing, so they reversed both convictions [01:05:45.600 --> 01:05:48.800] and ruled that double jeopardy attached. [01:05:48.800 --> 01:05:57.200] Now, I've been listening to you for the last several hours, and I've been found your website [01:05:57.200 --> 01:06:06.160] and radio show by sheer accident, or maybe the good Lord led me that way. [01:06:06.160 --> 01:06:13.640] But anyway, I know you specialize, it sounds like in Texas law. [01:06:13.640 --> 01:06:19.560] My problem is, this is Kansas, and some of the things you do with the magistrate, or in [01:06:19.560 --> 01:06:26.320] my case, municipal court judge, here in Kansas we'd be thrown in jail for direct contempt [01:06:26.320 --> 01:06:27.320] of court. [01:06:27.320 --> 01:06:34.360] Okay, this is not quite so easy for them. [01:06:34.360 --> 01:06:44.720] If when I asked the bailiff to arrest the judge, one word out of him is retaliation, [01:06:44.720 --> 01:06:47.280] witness tampering. [01:06:47.280 --> 01:06:52.920] I'm making a criminal accusation to the court security officer, that judge better keep his [01:06:52.920 --> 01:06:55.040] mouth shut. [01:06:55.040 --> 01:07:00.800] And every time I've done that, they've kept their mouth shut, because for the most part [01:07:00.800 --> 01:07:01.800] they knew. [01:07:01.800 --> 01:07:08.320] I did this first time I ever asked a bailiff to arrest the judge, was a district judge [01:07:08.320 --> 01:07:15.320] in Conroe, Texas, I had filed a rabies corpus for a kid they've had in jail for several [01:07:15.320 --> 01:07:16.320] weeks. [01:07:16.320 --> 01:07:21.960] They stopped the murder trial, they finished interviewing the last witness, sent the jury [01:07:21.960 --> 01:07:22.960] out. [01:07:22.960 --> 01:07:29.200] And the judge said, are you Mr. Randall Keltner, yes, you're on or I am, or did you file this [01:07:29.200 --> 01:07:32.440] habeas corpus yesterday, as a matter of fact I did. [01:07:32.440 --> 01:07:33.440] Are you an attorney? [01:07:33.440 --> 01:07:39.720] No, I said no, I sleep well at night and keep my hands mown pockets, thank you very much. [01:07:39.720 --> 01:07:44.440] Well he did not see the humor in that, and he said, well since you're not an attorney [01:07:44.440 --> 01:07:47.800] I'm not going to accept this habeas. [01:07:47.800 --> 01:07:50.680] That was an oops. [01:07:50.680 --> 01:07:55.640] So I turned to the bailiff, Mr. Bailiff, did you hear that, yes Mr. Keltner I did, arrest [01:07:55.640 --> 01:07:56.640] that judge. [01:07:56.640 --> 01:08:01.880] Well I can't arrest a judge, of course you can, just throw the cuffs on him and drag [01:08:01.880 --> 01:08:06.240] him off to jail, heck you don't have far to go, it's right down in the basement. [01:08:06.240 --> 01:08:11.560] And we had this back and forth, for quite a while I told the bailiff take his chicken [01:08:11.560 --> 01:08:17.120] suit off, and he refused to take his chicken suit off, I told the bailiff, you know, life [01:08:17.120 --> 01:08:21.920] is filled with little decisions, we all get to make some, your turn. [01:08:21.920 --> 01:08:27.240] Are you going to perform your duty as prescribed by article 2.13, code of criminal procedure, [01:08:27.240 --> 01:08:33.480] and arrest this judge for a crime he committed within your sight, within your hearings, wherein [01:08:33.480 --> 01:08:38.280] you're authorized under 14.03 to arrest him without warrant, or are you going to shield [01:08:38.280 --> 01:08:43.440] this judge from prosecution and violation of 3805 Penal Code which is found in the State [01:08:43.440 --> 01:08:50.440] of Texas, it's your call, either why I'm not going to arrest a judge, and then the judge [01:08:50.440 --> 01:08:57.440] said, Mr. Bailiff, if Mr. Keltner doesn't get out of my courtroom you're to arrest him. [01:08:57.440 --> 01:09:04.280] I said with all due respect your honor, that's cheating, he picked up the gavel he said maybe, [01:09:04.280 --> 01:09:11.600] but I got the gavel, good point, turn to the bailiff, you come with me, it's stormed out [01:09:11.600 --> 01:09:16.240] of the courtroom. In a traffic ticket case I asked the bailiff to arrest the judge three [01:09:16.240 --> 01:09:23.520] times and they had to send a jury out each time. Oh, that was so much fun, and no you [01:09:23.520 --> 01:09:30.960] will not get arrested for that, there will no be no direct contempt of court. [01:09:30.960 --> 01:09:39.360] Well, see, again sir, you have to understand the Kansas law and procedures are a lot different [01:09:39.360 --> 01:09:46.360] in Texas. No, they're not that much different, most of what I do is under federal oversight. [01:09:46.360 --> 01:09:56.040] The United States Supreme Court ruled, particularly on a habeas corpus in the 1940s, a friend of [01:09:56.040 --> 01:10:04.440] the court or defendant can file a habeas corpus with no money, so you was within your court. [01:10:04.440 --> 01:10:13.720] Well, I got more than that. Randall County, Texas, I go in to file a habeas and the clerk [01:10:13.720 --> 01:10:20.960] says that'll be $241 filing fee, oh ma'am, please do not tell me that, well I have to [01:10:20.960 --> 01:10:29.480] tell you that, no, no, no, no, don't tell me that, go get Lloyd, the Haysley elected district [01:10:29.480 --> 01:10:34.520] clerk, go get Lloyd to tell me that, because whoever tells me that, I'm going to pick up [01:10:34.520 --> 01:10:38.960] this phone dollar 9-1-1 and ask somebody to come out and arrest them and I do not want [01:10:38.960 --> 01:10:47.200] it to be you. She said, I'll be right back. She went and got Lloyd, he came out and said, [01:10:47.200 --> 01:10:56.680] well, that'll be a $241 filing fee. Right right there, don't go anywhere, somebody's [01:10:56.680 --> 01:11:05.640] going to want to talk to you. I gave this clerk legal advice, but he was the boss, he [01:11:05.640 --> 01:11:15.520] was the guy I wanted, he don't get any, never give fair warning. So, dollar 9-1-1, the operator [01:11:15.520 --> 01:11:21.880] come on, what can I do for you? I need you to send an officer over to the district court [01:11:21.880 --> 01:11:29.000] to arrest the district clerk. Well, what's the problem? He committed a crime. Well, what [01:11:29.000 --> 01:11:34.480] crime did he commit? Are you a lawyer? I said, no, I'm not. Then either get the prosecutor [01:11:34.480 --> 01:11:40.560] on the phone or send an officer out here to take my complaint. So he sent an officer out. [01:11:40.560 --> 01:11:46.640] We waited and I told Lloyd, don't go anywhere, somebody's going to want to talk to you and [01:11:46.640 --> 01:11:53.600] to his credit, he did not untrack a foot. He stood right there, this big old fat cop [01:11:53.600 --> 01:12:01.400] come in the back side door. What seems to be the problem here? I said, the problem is [01:12:01.400 --> 01:12:09.040] you don't have a pencil and paper. Well, why do I need a pencil and paper to take my criminal [01:12:09.040 --> 01:12:15.320] complaint against the district clerk? Well, why would I take a criminal complaint against [01:12:15.320 --> 01:12:23.400] the district clerk? Because he's a criminal, that's why. And the guy was smarter than he [01:12:23.400 --> 01:12:34.560] looked. When I read the code to him, where the code says, there shall be no filing fee [01:12:34.560 --> 01:12:47.320] for a habeas corpus. I asked the officer, what part of that is hard to understand? Well, [01:12:47.320 --> 01:12:55.200] he said, well, what's why is the criminal 39.03 penal code? So he said, I need to call [01:12:55.200 --> 01:13:03.000] my sergeant. Smart move. Now, I didn't get arrested, but I saw him in the court the next [01:13:03.000 --> 01:13:07.160] day, and I said, hey, Lloyd, how's it going? Fine, Mr. Cowell, you're going to try to get [01:13:07.160 --> 01:13:13.960] me arrested again? Oh, that. Heck, I was just screwing around. Wasn't that a hoot? Why [01:13:13.960 --> 01:13:22.760] didn't they get very funny? Good for you. Anyway, I take the law enforcement and use [01:13:22.760 --> 01:13:31.040] their tools. I have their tools. I walk in the court with, I have a digital audio recorder [01:13:31.040 --> 01:13:38.680] like a police carry, got everything at Walmart really cheap. And the judge, I was one time [01:13:38.680 --> 01:13:44.040] I was charged with three counts of assault under Kansas law, because that's more than [01:13:44.040 --> 01:13:50.080] one year in jail. I'm entitled to a jury of my peers, which is sick to a misdemeanor [01:13:50.080 --> 01:13:58.280] case in Kansas. And immediately I told him, I want a jury in panel. He immediately got [01:13:58.280 --> 01:14:05.280] up, slammed the gavel and said he's referring the case to the district attorney, Keith Schroeder. [01:14:05.280 --> 01:14:09.280] So I wait for a month. I go to Keith Schroeder. He says, we can't take this case because there's [01:14:09.280 --> 01:14:15.840] no evidence you committed assault. So, you know, it went my bite. But my point is, on [01:14:15.840 --> 01:14:22.880] the driver's license, I keep telling them I've never had a driver's license since I [01:14:22.880 --> 01:14:30.880] got out of prison in 91. So how the hell are you charging me? Okay, I have a solution. [01:14:30.880 --> 01:14:41.400] I have a solution. The Declaratory Judgments Act, ordinarily, in order to invoke the subject [01:14:41.400 --> 01:14:51.560] matter jurisdiction of a federal court, you must bring a true controversy to the court. [01:14:51.560 --> 01:14:57.360] I think it was, I forget the year they passed this, relatively recently, they passed the [01:14:57.360 --> 01:15:04.320] Declaratory Judgment Act. So you can go to the court and ask the court to rule on the [01:15:04.320 --> 01:15:14.200] rights of the parties. In a Declaratory Judgment Act, you cannot ask for any harm. You can't [01:15:14.200 --> 01:15:23.040] ask for attorney fees. You can't ask for anything. So you go to the court and say, and present [01:15:23.040 --> 01:15:31.360] by affidavit evidence that you have never had a driver's license. By affidavit, you have [01:15:31.360 --> 01:15:43.160] never operated a motorized conveyance in a commercial capacity. That you were charged [01:15:43.160 --> 01:15:51.840] with a revoked or suspended driver's license, or driving on one. This case law says that [01:15:51.840 --> 01:15:57.960] if you have never had a driver's license, you cannot be charged and asked the court [01:15:57.960 --> 01:16:06.240] to rule on the rights of the parties in this instance. You're not asking him to throw your [01:16:06.240 --> 01:16:12.440] case out. You're not asking him to give you a claim against the other party. You're asking [01:16:12.440 --> 01:16:21.400] him to apply the law to the facts and render you a ruling. Once you get that ruling, that [01:16:21.400 --> 01:16:30.360] ruling becomes a residue to cut it. It cannot, after 30 days after the ruling, if the other [01:16:30.360 --> 01:16:38.360] side has not appealed, the judge loses plenary jurisdiction and that ruling can never be [01:16:38.360 --> 01:16:47.880] challenged. Now you file suit against the officer who wrote the ticket, or the department [01:16:47.880 --> 01:16:59.520] for which he works. And the fact that he arrested you improperly is a fact of a matter of law. [01:16:59.520 --> 01:17:14.120] It's the 2018 Logos Radio Network annual fundraiser and gun giveaway sponsored by Central Texas [01:17:14.120 --> 01:17:21.400] Gun Works. Without the shows on this network, I'd be almost as ignorant as my friends. I'm [01:18:09.160 --> 01:18:13.160] so addicted to the truth now that there's no going back. I need my truth pick. I'd be [01:18:13.160 --> 01:18:18.120] lost without Logos and I really want to help keep this network on the air. I'd love to [01:18:18.120 --> 01:18:21.960] volunteer as a show producer, but I'm a bit of a Luddite and I really don't have any money [01:18:21.960 --> 01:18:26.520] to give because I spent it all on supplement. How can I help Logos? [01:18:26.520 --> 01:18:31.280] Well, I'm glad you asked. Whenever you order anything from Amazon, you can help Logos. [01:18:31.280 --> 01:18:35.840] When ordering your supplies or holiday gifts, first thing you do is clear your cookies. [01:18:35.840 --> 01:18:42.640] Now, go to logosradionetwork.com. Click on the Amazon logo and bookmark it. Now, when [01:18:42.640 --> 01:18:47.920] you order anything from Amazon, you use that link and Logos gets a few pesos. [01:18:47.920 --> 01:18:52.640] Do I pay extra? No. Do you have to do anything different when I order? No. Can I use my [01:18:52.640 --> 01:18:58.640] Amazon Prime? No. I mean, yes. Wow. Giving without doing anything or spending any money. [01:18:58.640 --> 01:19:18.640] This is perfect. Thank you so much. We are Logos. Happy Holidays Logos. [01:19:18.640 --> 01:19:31.640] I see tools. I see tools. We have a ton of tools. We have the tools of ingenuity. We use [01:19:31.640 --> 01:19:39.640] against the workers of iniquity. The tools of massacability fail above world eternity. [01:19:39.640 --> 01:19:49.640] They come from natural eternity with step-by-step roots in authenticity. The tools of ingenuity [01:19:49.640 --> 01:20:01.640] rebuild the credibility. And I say truth in nature must be just as I believe. Truth in nature [01:20:01.640 --> 01:20:03.640] must be justice. [01:20:03.640 --> 01:20:17.640] Okay. We are back. Randy Kelton, Ruvlau Radio. I was just kidding about Randy's Beer Fund. [01:20:17.640 --> 01:20:23.640] Everything that goes into Randy's Beer Fund goes into the network. I'm old. I can't drink [01:20:23.640 --> 01:20:30.640] beer anymore. It puts me to sleep. But we are struggling here. For anybody who listens all [01:20:30.640 --> 01:20:36.640] the time, they're familiar that we're always struggling. It's been a struggle the whole [01:20:36.640 --> 01:20:42.640] time. It probably wouldn't be as fulfilling if it wasn't a struggle. I forgot your first [01:20:42.640 --> 01:20:55.640] name from Kansas. We lost you. Call us back. I like that conversation. Daniel from Kansas. [01:20:55.640 --> 01:21:02.640] Good, good, good, good. We always bump first callers to the top of the heap. Okay, Daniel. [01:21:02.640 --> 01:21:04.640] Sorry we lost you there. [01:21:04.640 --> 01:21:08.640] That's okay. Things happen. [01:21:08.640 --> 01:21:11.640] Have you listened to our show before? [01:21:11.640 --> 01:21:18.640] No. This is the very first time, believe it or not, I found you through a video on YouTube. [01:21:18.640 --> 01:21:28.640] Well, first Facebook, and then I took that link to YouTube, found your video. [01:21:28.640 --> 01:21:36.640] Okay, there's something wrong with that video. They took out my face and put some old guy [01:21:36.640 --> 01:21:38.640] in my place. [01:21:38.640 --> 01:21:45.640] No, the one I'm talking about starts out with rule of law, some real fancy scripting. [01:21:45.640 --> 01:21:53.640] Okay, that may be some that Scott Richardson put up there, but the one I did on Info Wars, [01:21:53.640 --> 01:22:01.640] I accused them of photoshopping my face out and putting some old guy in there, and they [01:22:01.640 --> 01:22:09.640] shared me they didn't. Anyway, listen to our show. Go back and listen to our archives. [01:22:09.640 --> 01:22:18.640] We have a whole procedure of how to go after these guys. I'm a combat veteran. [01:22:18.640 --> 01:22:24.640] And I was a good soldier. I learned how to fight. [01:22:24.640 --> 01:22:32.640] And one thing you do is when you're in combat, is you never get into a fight you can't win [01:22:32.640 --> 01:22:35.640] because you don't only get to do that one time. [01:22:35.640 --> 01:22:39.640] Never get into a fight unless you have an exit strategy. [01:22:39.640 --> 01:22:46.640] Never get into a fight you can win if in winning the fight it won't move you towards your ultimate [01:22:46.640 --> 01:22:49.640] intended outcome. [01:22:49.640 --> 01:22:57.640] And a lot of what I do on the air goes back to my training. [01:22:57.640 --> 01:23:05.640] Never give fair warning. And under never give fair warning, never give legal advice. [01:23:05.640 --> 01:23:12.640] Legal advice is fair warning. Never say to someone, ah, well, you have a duty to do this, [01:23:12.640 --> 01:23:17.640] that, and other, and I got this right, and I got that right now, and I never do that stuff. [01:23:17.640 --> 01:23:24.640] You say, this is what I want you to do. Randall County, Texas, Amarillo. [01:23:24.640 --> 01:23:30.640] I go to the court clerk and I want to see the physical file for these cause numbers. [01:23:30.640 --> 01:23:35.640] Well, you can look at all of that in the computer. I know that, but I don't want to see it in the computer. [01:23:35.640 --> 01:23:40.640] I want to see the physical file because I'm concerned that some documents will be missing. [01:23:40.640 --> 01:23:43.640] And when I find them missing, I'm going to give you an information request for them. [01:23:43.640 --> 01:23:46.640] Well, if I don't have them, I can't provide them. That's why you can't. [01:23:46.640 --> 01:23:52.640] But you can provide me with a response saying, we have no records responsive to your request. [01:23:52.640 --> 01:23:56.640] She said, well, I don't have the time of the personnel. You're going to have to look on the computer. [01:23:56.640 --> 01:24:04.640] Wait, wait right there. Don't go anywhere. Somebody's going to want to talk to you. [01:24:04.640 --> 01:24:09.640] I pushed the door open and pointed at the sergeant on the latest. [01:24:09.640 --> 01:24:13.640] There are a whole bunch of them out there and I pointed at the sergeant, you come here. [01:24:13.640 --> 01:24:16.640] What can I do for you? Watch this. [01:24:16.640 --> 01:24:20.640] I said, Miss Clark, I want to see those records I asked you for. [01:24:20.640 --> 01:24:24.640] I told you I don't have the time of the personnel. You don't have to look in the computer. [01:24:24.640 --> 01:24:28.640] I turned to the bailiff. Did you hear that? Yes, I did. [01:24:28.640 --> 01:24:32.640] Arrest that woman. [01:24:32.640 --> 01:24:36.640] Same thing. I can't arrest the clerk. Of course you can. [01:24:36.640 --> 01:24:40.640] Just throw the cuffs on her and drag her off to jail. It's only a couple of blocks away. [01:24:40.640 --> 01:24:44.640] So he called his boss, Lieutenant Brown. [01:24:44.640 --> 01:24:48.640] I told him I wanted to arrest the clerk. We're not going to arrest anybody here today. [01:24:48.640 --> 01:24:53.640] What did you call him for? I need a real policeman. He said, I am a real policeman. [01:24:53.640 --> 01:24:58.640] No, you're a perp. I need the non-emergency number to the Sheriff's Department. [01:24:58.640 --> 01:25:04.640] He won better than me. He takes out a business card and hands it to me and I jerk it out of his head and look at it. [01:25:04.640 --> 01:25:10.640] I dialed 911 and I'm sorry, I'll dial the Sheriff's number on there. [01:25:10.640 --> 01:25:18.640] And I told him I need you to send a deputy out to arrest a Lieutenant Brown and a district clerk. [01:25:18.640 --> 01:25:22.640] I forget what her name was. And they gave me a little hard time. [01:25:22.640 --> 01:25:26.640] And I gave them a hard time. They agreed to send somebody. So I go over and sit down. [01:25:26.640 --> 01:25:30.640] And I'm writing out criminal complaints and this bailiff come over. [01:25:30.640 --> 01:25:34.640] Mr. Calton, you're going to have to leave the building. I looked up at him. [01:25:34.640 --> 01:25:38.640] Get lost. I go back to writing. [01:25:38.640 --> 01:25:42.640] Mr. Calton, you're creating a disturbance. You're going to have to get to leave the building. [01:25:42.640 --> 01:25:46.640] Beat it. I go back to writing. [01:25:46.640 --> 01:25:50.640] This Sergeant came over and said, leave him alone, leave him alone. [01:25:50.640 --> 01:25:54.640] He's just trying to get you to do something so he can call and try to get you arrested. [01:25:54.640 --> 01:26:02.640] I looked up at him and said, your Sergeant is really smart. You should listen to him. [01:26:02.640 --> 01:26:08.640] Then the clerk and this Lieutenant came out of the back office. [01:26:08.640 --> 01:26:12.640] And the clerk has got a handful of folders in her hand. [01:26:12.640 --> 01:26:20.640] This Lieutenant started to say something to me and I said, stop, stop, stop. I can't be talking to you. [01:26:20.640 --> 01:26:25.640] And I've filed, I've called 911 and they're sending someone to respond. [01:26:25.640 --> 01:26:28.640] When they get here, I will give them a full report. [01:26:28.640 --> 01:26:35.640] But since I'm filing criminal charges against both of you, it would be inappropriate for us to have any further communication. [01:26:35.640 --> 01:26:39.640] And the Sergeant said, well, she has all those records you asked for. [01:26:39.640 --> 01:26:45.640] Sorry, Bubba. That bell's already been rung. [01:26:45.640 --> 01:26:52.640] The book on the clerk's face was absolutely priceless. [01:26:52.640 --> 01:27:07.640] What we will show you how to do is take their code, use their code the way they use their code and cram it right down their throats. [01:27:07.640 --> 01:27:13.640] You become the biggest threat in the building very quickly. [01:27:13.640 --> 01:27:22.640] If we are going to get our system back, we have to reestablish ourselves as the master of our public servants. [01:27:22.640 --> 01:27:26.640] And we will show you how to do that. We have a whole routine for this. [01:27:26.640 --> 01:27:31.640] You set these guys up and just walk right up the line. [01:27:31.640 --> 01:27:48.640] If you will call back in next Friday at eight o'clock, I will go through this whole procedure, how to set these guys up and just walk them down to Primrose Path. [01:27:48.640 --> 01:27:55.640] You run one of these routines on them. They will never want you pulled over again. [01:27:55.640 --> 01:28:07.640] My problem is the way the system's corrupted in Kansas, if I tried anything what you're talking about, I'd be sitting right back in jail. [01:28:07.640 --> 01:28:13.640] Number one, I haven't driven since 2014 because I don't want to go back to jail. [01:28:13.640 --> 01:28:28.640] Number two, I filed a petition called Judicial Review of Administrative Action in Kansas and I filed it in the jurisdiction which means Topeka, not Reno County. [01:28:28.640 --> 01:28:36.640] And that judge denied it and I'm trying to appeal it and they won't let me because I don't have the money for the bond. [01:28:36.640 --> 01:28:41.640] Did you petition for inability to pay? [01:28:41.640 --> 01:28:43.640] I didn't hear you. [01:28:43.640 --> 01:28:48.640] Did you petition for indigency status and ability to pay? [01:28:48.640 --> 01:28:58.640] Yeah, it's called a poverty after David KSA 60-4001 with a small claims or appeal or any employee. [01:28:58.640 --> 01:29:02.640] Have you filed any criminal charges against these guys? [01:29:02.640 --> 01:29:04.640] They won't let me. [01:29:04.640 --> 01:29:13.640] We'll fix that. That is not a problem. I try to get them to not let me. [01:29:13.640 --> 01:29:22.640] Just go ahead guys, we'll see how that works out for you. I set them up to not take my complaints. [01:29:22.640 --> 01:29:35.640] I went to the police department which is down the hall. I demanded to follow a complaint against the clerk, the city prosecutor and the judge. [01:29:35.640 --> 01:29:43.640] No, no, no, that's not how you do it. We got how to do it. You are the master, they are the servants. [01:29:43.640 --> 01:29:47.640] You make up the complaint and stuff it right down there. [01:29:47.640 --> 01:29:52.640] We got to go to break. We'll pick this up on the other side, Randy Kelton. We have a lot of radio calling. [01:29:52.640 --> 01:29:57.640] I won't give out a call in numbers. We've got a full board of callers and we probably won't make it to all of them. [01:29:57.640 --> 01:30:26.640] We'll be right back. [01:30:28.640 --> 01:30:32.640] So now you know hemp is not marijuana and marijuana is not hemp. [01:30:32.640 --> 01:30:44.640] They are different varieties of the same species. [01:33:16.640 --> 01:33:22.640] Okay, Randy. Thank you for taking my call. [01:33:22.640 --> 01:33:28.640] I've got through my deposition and things seem to be looking pretty good. [01:33:28.640 --> 01:33:34.640] Okay, hold on, hold on. Give us a brief overview where you're at. [01:33:34.640 --> 01:33:49.640] Okay, this has to do with the 1983 suit that I filed against the sheriff's deputy for a Fourth Amendment violation and falsehood. [01:33:49.640 --> 01:33:53.640] Oh, the first responder? [01:33:53.640 --> 01:33:54.640] Yes. [01:33:54.640 --> 01:33:56.640] Oh, great. [01:33:56.640 --> 01:34:05.640] Okay, this is your fireman. You show up at a fire and the cops give you a bunch of crap over. [01:34:05.640 --> 01:34:19.640] Yeah, it was actually, yeah, pretty much it was actually, it was a search and rescue. But anyways, yeah, they pretty much arrested me for not identifying. [01:34:19.640 --> 01:34:32.640] And through the deposition, it was determined the officer actually admitted that he did not have reasonable suspicion. [01:34:32.640 --> 01:34:39.640] His reasonable suspicion was that I did not identify and that doesn't quite work. [01:34:39.640 --> 01:34:55.640] So he didn't understand that he can't charge you with failure to identify unless he has reasonable suspicion, but failure to identify can't be real reasonable suspicion to arrest for failure to identify. [01:34:55.640 --> 01:34:58.640] This guy doesn't sound like a rocket scientist. [01:34:58.640 --> 01:35:19.640] No, he really wasn't and he isn't. Yeah, it seems that he didn't appreciate me laughing and talking with other members of my department and considered that rude and that's what caused him to want me to identify. [01:35:19.640 --> 01:35:30.640] And when I refused to, he, anyways, he arrested me and claimed it with a terry stop. And anyways, that's that's how that went. [01:35:30.640 --> 01:35:49.640] What I'm going, my question here is, I am, what is the benefit of a motion for summary judgment versus going to trial? [01:35:49.640 --> 01:36:06.640] Well, excuse me, if if his deposition essentially admits that he did not have probable cause, there is no need for trial. You have a right to summary judgment. [01:36:06.640 --> 01:36:11.640] And it's over. [01:36:11.640 --> 01:36:13.640] Okay. [01:36:13.640 --> 01:36:29.640] So if it looks like I have plenty of support, supporting evidence, would it be to my advantage to go ahead and go to summary judgment? [01:36:29.640 --> 01:36:33.640] Absolutely. A summary judge must like chicken soup. [01:36:33.640 --> 01:36:40.640] The worst they can do is deny the summary judgment motion and you can appeal it. [01:36:40.640 --> 01:36:50.640] And if you have an admission by the police officer that he did not have probable cause, it's a done deal. [01:36:50.640 --> 01:36:52.640] Right. [01:36:52.640 --> 01:37:20.640] Yeah, they what they're trying to his attorney there did ask them questions. Basically, their questions that pertain to him having reasonable suspicion or at least reasonable cause to to question me or ask for my identity based on that he was in charge and he needed to know everybody that was on the call [01:37:20.640 --> 01:37:36.640] because he's responsible for for anybody there if there's any harm done to the to the subject of deception rescue and basically it's a lot of BS put out there. [01:37:36.640 --> 01:37:53.640] Objection relevance. What the officer needs has no bearing on your constitutional right to be free from unlaw reasonable seizure. [01:37:53.640 --> 01:37:58.640] You know, I probably should have objected at that time but I. [01:37:58.640 --> 01:38:09.640] If these are just depositions that's that's not a problem. You will you will object to the introduction of that into evidence is irrelevant. [01:38:09.640 --> 01:38:11.640] Okay. All right. [01:38:11.640 --> 01:38:16.640] The only thing that bears on relevance is probable cause. [01:38:16.640 --> 01:38:22.640] What the officer needs simply irrelevant. [01:38:22.640 --> 01:38:28.640] Yeah. All right. That sounds that sounds right. [01:38:28.640 --> 01:38:38.640] It comes under the legal doctrine of your problem, not my problem. [01:38:38.640 --> 01:38:40.640] Right. [01:38:40.640 --> 01:38:41.640] Yeah. [01:38:41.640 --> 01:38:48.640] Okay. Yeah. Okay. So. [01:38:48.640 --> 01:38:56.640] Okay. You're in Arizona. Do you have a good Samaritan statute in Arizona? [01:38:56.640 --> 01:38:58.640] Yes, there is. [01:38:58.640 --> 01:39:15.640] Then what did that the officer didn't need that because he the his department goes to no liability based on the action of a good Samaritan. So the questions are the answers are irrelevant. [01:39:15.640 --> 01:39:23.640] Okay. Look close. Look closely at the definitions. I mean at the deposition of what they're saying and on every. [01:39:23.640 --> 01:39:28.640] Thing they ask say so what. [01:39:28.640 --> 01:39:32.640] What does that have to do with probable cause. [01:39:32.640 --> 01:39:41.640] If you can articulate how it goes to probably cause object irrelevant. [01:39:41.640 --> 01:40:02.640] Okay. Yeah, they wanted to claim that they I was suspicious of impersonating a public servant, but I don't think that flies because, you know, laughing and talking with other members of a department and not one of them had any identifying the other members didn't have anything [01:40:02.640 --> 01:40:11.640] identifying them as being with a department. So he actually he actually singled me out because he heard me laughing. [01:40:11.640 --> 01:40:22.640] Okay. What does the statute say for impersonating. [01:40:22.640 --> 01:40:41.640] I know I read. Okay, go back and reread the statute from the perspective of how does anything you did or did not do go to one of the elements of impersonating for what you did. [01:40:41.640 --> 01:40:49.640] How does it establish suspicion what you did not do. How does it violate a duty. [01:40:49.640 --> 01:40:51.640] Right. [01:40:51.640 --> 01:40:55.640] Okay, go to either one of those objection or elements. [01:40:55.640 --> 01:41:11.640] Yeah, each time I asked him many questions and each time he at no time said that anything I did was considered suspicious. The only thing he said was suspicious was the fact that I refused to identify. [01:41:11.640 --> 01:41:22.640] Okay, so he had probable cause to demand identification because you refused to produce identification. [01:41:22.640 --> 01:41:29.640] That's a circular argument and it won't get there. So it sounds like he shot himself in the foot. [01:41:29.640 --> 01:41:31.640] Right. [01:41:31.640 --> 01:41:39.640] And here move for summary judgment to summary judgments to where I think that you're here. [01:41:39.640 --> 01:41:48.640] It's, yeah, it seems like, yeah, that has to be done, I guess, by the, yeah, when the next week or so. [01:41:48.640 --> 01:41:52.640] I guess I need to get that drawn up. [01:41:52.640 --> 01:41:57.640] Do you have a transcript of these depositions. [01:41:57.640 --> 01:42:06.640] That is actually, I just got a call today and they're, they're sending those, they're actually mailing them actually mail them from taxes. [01:42:06.640 --> 01:42:11.640] Okay, as soon as you get those, then you can follow for summary judgment. [01:42:11.640 --> 01:42:13.640] Okay. [01:42:13.640 --> 01:42:14.640] All right. [01:42:14.640 --> 01:42:19.640] This is good. You may actually win this one. That would be great. [01:42:19.640 --> 01:42:20.640] Right. [01:42:20.640 --> 01:42:27.640] What you can expect is when you get to the courthouse steps that offer you a deal. [01:42:27.640 --> 01:42:31.640] Okay. Yeah, that's what I've heard. So we'll see. [01:42:31.640 --> 01:42:41.640] And if you make a deal, one requirement of the deal, check in hand. [01:42:41.640 --> 01:42:50.640] No check in hand, no deal, because no check in hand, you'll never get it. [01:42:50.640 --> 01:42:56.640] Gotcha. So they have to write a check right then and there, or we're walking in. [01:42:56.640 --> 01:42:58.640] Exactly. [01:42:58.640 --> 01:43:01.640] All right. [01:43:01.640 --> 01:43:02.640] Thank you. [01:43:02.640 --> 01:43:07.640] This is great. This is, this is, this is what we like to hear. [01:43:07.640 --> 01:43:09.640] It took them on. [01:43:09.640 --> 01:43:11.640] This just wasn't about the money. [01:43:11.640 --> 01:43:15.640] He did the right thing for the right reasons. [01:43:15.640 --> 01:43:22.640] And at the end of the day, it'll be good for this officer if he, if, if his career survives. [01:43:22.640 --> 01:43:32.640] And it's certainly good for the whole department because everybody else is going to look at this and say, don't be like this clown. [01:43:32.640 --> 01:43:38.640] Don't wind up where he's at. So we need more people doing this. [01:43:38.640 --> 01:43:40.640] This is how we're going to fix the system. [01:43:40.640 --> 01:43:42.640] You and I are going to fix it. [01:43:42.640 --> 01:43:47.640] We can't expect, expect our public officials to fix the problem for us. [01:43:47.640 --> 01:43:49.640] And I really appreciate you. [01:43:49.640 --> 01:43:51.640] This is why I do the show. [01:43:51.640 --> 01:43:53.640] I find people just like you. [01:43:53.640 --> 01:43:55.640] So I appreciate you. [01:43:55.640 --> 01:43:59.640] Appreciate the health and so. [01:43:59.640 --> 01:44:00.640] Okay. [01:44:00.640 --> 01:44:03.640] We are about out of time. [01:44:03.640 --> 01:44:06.640] Mark, I'm sorry we didn't get to you, Scott, Tina.
