[04:07.360 --> 04:11.660] Alright folks, good evening, this is the Monday Night Rule of Law radio show with your host [04:11.660 --> 04:18.480] Eddie Craig, it is June 25th, 2018, we are live tonight, this is not an archive, just [04:18.480 --> 04:24.840] in case you're wondering, now that being said, I hope you pay close attention to the words [04:24.840 --> 04:31.000] of the opening song for this show that I put up a few months ago, and understand why I [04:31.000 --> 04:40.320] did so, there is more truth in this one song about the current state of America than in [04:40.320 --> 04:46.920] any number of songs you could line up and play back to back, and the reason we know [04:46.920 --> 04:54.720] it's true is because more and more what these guys do behind the scenes, or at least what [04:54.720 --> 05:01.000] they used to be behind the scenes, is getting exposed to the light of day because of cell [05:01.000 --> 05:07.480] phone cameras, security cameras, and people willing to come forward and testify against [05:07.480 --> 05:17.600] them. Now, you guys know that I'm a next deputy, I worked the county jail back home, it wasn't [05:17.600 --> 05:21.520] for a long period of time, never said I had years of experience at it, but I learned an [05:21.520 --> 05:26.200] awful lot while I was in it because like everything else I do, I don't half ask things when I [05:26.200 --> 05:32.200] go into it, I work my butt off to become the absolute best at whatever I undertake that [05:32.200 --> 05:38.880] I possibly can. I may not be first, but if I'm not, it will not be for lack of trying, [05:38.880 --> 05:44.320] I promise you. So the things that I pick up when I take something on, I accumulate at [05:44.320 --> 05:50.280] a very rapid rate. I experiment with it, I stretch it as far as I can, and I look for [05:50.280 --> 05:56.440] other ways to augment it as much as possible. This is how I approach learning law and everything [05:56.440 --> 06:03.120] else I've ever done in my life. Now, a lot of people out there would say well the number [06:03.120 --> 06:06.120] and amount of time you spent doesn't really make you an authority on any of this and blah [06:06.120 --> 06:13.000] blah blah, well I've got news for you. How long you do something is not necessarily relative [06:13.000 --> 06:19.320] to how well you are able to learn how to do it or to do it in the first place. We have [06:19.320 --> 06:22.840] proof of that in the very fact that there are people out there that have been in law enforcement [06:22.840 --> 06:31.640] for decades and still can't do it right, okay? And their version of right is what suits [06:31.640 --> 06:37.120] them and the power trip they're on. Not what the law says, not what they're actually allowed [06:37.120 --> 06:42.680] to do and so on and so forth. So if the measure of longevity is the measure of corruption, [06:42.680 --> 06:50.760] I'm glad I don't have that much time involved because that would be sad. All the things [06:50.760 --> 06:54.880] that I've learned and tried to share with other people, there are those who absolutely [06:54.880 --> 07:00.240] appreciate it and there are those who will absolutely pee on it before they'll even begin [07:00.240 --> 07:04.920] to consider it. Either because it goes against the way they want to do it, it goes against [07:04.920 --> 07:08.760] what they think they know, it goes against what they believe or it goes against what [07:08.760 --> 07:16.360] they feel. Take your pick or choice of mixture, however you want to do it. The fact remains [07:16.360 --> 07:25.480] that there are those that will ignore reality to pursue that which they want or wish for [07:25.480 --> 07:35.080] regardless of any ability to achieve it. Now, it's not that I don't want people to be motivated. [07:35.080 --> 07:38.000] It's not that I don't want people to push the envelope. It's not that I don't want people [07:38.000 --> 07:43.880] to try things that have never been tried before. But there comes a time that when it has been [07:43.880 --> 07:52.040] tried and it has been tried correctly according to all sources and it has failed utterly every [07:52.040 --> 08:00.720] single time that you might need to consider that it's not the people that's the problem. [08:00.720 --> 08:07.440] It is not the method that is as far as the system itself in this particular case, which [08:07.440 --> 08:14.400] is rare but true, is not the actual problem. It is that you are basing what you're doing [08:14.400 --> 08:22.520] on a bottomless foundation. What you think you're standing on is solid until you apply [08:22.520 --> 08:30.080] weight and it crumbles. That right there summarizes the epitome of the patronage arguments that [08:30.080 --> 08:36.120] I spend my days dealing with such as yesterday and today, for example, in some of these Facebook [08:36.120 --> 08:41.800] discussions. Now, on top of all this, when I'm trying to go through this and answer [08:41.800 --> 08:46.080] questions and provide information where I can in these forums, I have spent the better [08:46.080 --> 08:52.800] part of my day trying to go through some research material that I got, sent a request to the [08:52.800 --> 08:56.760] state law library for, which I got the documents on and I have been pouring through it with [08:56.760 --> 09:01.360] a fine tooth comb looking to see what else I may need in addition to it. And the reason [09:01.360 --> 09:10.560] it's important and took up so much of my time is because it goes directly to the information [09:10.560 --> 09:15.040] that I talked about in last Monday night's show dealing with both the Department of Public [09:15.040 --> 09:18.440] Safety, the Department of Transportation, how they were created, when they were created [09:18.440 --> 09:25.360] and so on and so forth. But it also goes directly to the heart of the facts asserted in the [09:25.360 --> 09:33.240] constitutional challenge motion to SB 971. So the folks that are still waiting on a copy [09:33.240 --> 09:38.280] of that, it's not that I have forgotten you, it's not that I'm ignoring you. Please understand [09:38.280 --> 09:43.080] that as I'm doing updates on the material, I get in the middle of something and I'm trying [09:43.080 --> 09:48.760] to get it fixed and I lost the original of the constitutional challenge. I don't know [09:48.760 --> 09:53.600] how the one that I was sending out, I have no idea how I managed to misplace the one [09:53.600 --> 09:59.880] copy that was more complete than the rest. It wasn't as new as the rest of it, but it [09:59.880 --> 10:06.080] was organized better, it was interlinked better, it had the case law in it better and so on [10:06.080 --> 10:10.880] and so forth. But somehow or other I've managed to lose the only copy that I could find or [10:10.880 --> 10:17.080] had available. And now I'm having to piece together the different iterations that I had [10:17.080 --> 10:24.040] did getting to that point and making a single one out of it, but I'm also trying to integrate [10:24.040 --> 10:32.320] the new information at the same time and it's taking, because it is such a massive amount [10:32.320 --> 10:39.440] of resources in the statutes and the legislative history, it's a massive document. When you [10:39.440 --> 10:45.120] put it in at one and a half spacing instead of the double space the court wants it in, [10:45.120 --> 10:54.880] it's 74 pages long, okay? So if I increase that by another 50%, well it's 130 something [10:54.880 --> 11:02.640] page motion by the time we're all said and done, see? And that's a lot of information [11:02.640 --> 11:09.800] for anybody to wade through. So as I'm trying to get it rewritten I'm trying to take out [11:09.800 --> 11:18.040] superfluous language, repetitive language, and basically whittle the entire redwood [11:18.040 --> 11:24.480] down into the smallest toothpick I can. Right now the toothpick is about 140 feet long and [11:24.480 --> 11:30.440] weighs several tons. So until I get beyond that I can't even lift it to send it to one [11:30.440 --> 11:36.400] of you and get it anywhere. So please be patient. I'm not trying to ignore you or shove you [11:36.400 --> 11:42.240] aside. This is just a lot more involved and complex that it appears on the surface when [11:42.240 --> 11:48.120] you hear me talk about it. And the reason for that is because I've already formulated [11:48.120 --> 11:52.480] the argument. I've already looked up the facts. When I'm sitting here talking to you about [11:52.480 --> 11:57.560] it, I've already either written it down or got it ingrained, but it may or may not be [11:57.560 --> 12:02.680] in its final form, especially when I've written it down. That may just be my preliminary review [12:02.680 --> 12:09.080] of it that I'm trying to teach you about that time on the air. So please bear with me. There [12:09.080 --> 12:13.880] are lots of other ways to go after these particular cases rather than just the constitutional [12:13.880 --> 12:18.640] challenge motion. And those are all available in the seminar. At least that package is still [12:18.640 --> 12:23.720] wrapped up nice and neat and ready to go out as far as the original version of it goes. [12:23.720 --> 12:27.640] But as I'm getting through the new one I am integrating more and more information, but [12:27.640 --> 12:34.840] I am trying to refine it and boil it down to its more of an essence of what it means [12:34.840 --> 12:40.360] instead of a straight detail on everything it means. Because the detail is what you need [12:40.360 --> 12:47.240] to understand it, but the essence is what you need to see it big picture. Okay? So understand [12:47.240 --> 12:51.280] the distinction between the two. The reason these documents and writings and everything [12:51.280 --> 12:58.280] get so involved is when you get into the details. And as much as they dislike having to read [12:58.280 --> 13:03.920] it, courts run on details. Because if you don't provide them with a detail, then they [13:03.920 --> 13:10.760] tend to make up their own version and that is not something you want to do. Now on top [13:10.760 --> 13:17.760] of all of that, another thing I have been working on for the last four or five days [13:17.760 --> 13:25.200] is writing a Title 42 lawsuit. This one is directed at a specific judge in a specific [13:25.200 --> 13:31.520] court on behalf of a specific individual for crimes that this judge has committed under [13:31.520 --> 13:39.720] color of his official office. Now we've already levied criminal accusations against a JP and [13:39.720 --> 13:45.840] we actually got the county attorney prosecuting this gentleman's case to take the criminal [13:45.840 --> 13:52.360] complaint. He didn't want it, but he took it. Okay? And we informed him right then he [13:52.360 --> 13:57.320] had a duty under the law to forward it to the grand jury, which we're going to check [13:57.320 --> 14:01.920] the minutes of the grand jury and see if that was ever done. If it was not, then the next [14:01.920 --> 14:06.400] set of complaints that goes up not only has the original one, but it's also got one against [14:06.400 --> 14:13.600] this county attorney for secreting the original criminal complaint, shielding from prosecution [14:13.600 --> 14:18.640] and a corrupt public official and conspiring with that public official to protect them [14:18.640 --> 14:25.280] in their crimes. And that of course is going to trickle up to their boss, who we will take [14:25.280 --> 14:29.240] it to directly at that point. And then when they do nothing with it, we'll repeat the [14:29.240 --> 14:34.280] process and add their boss to the mix, just like Randy suggests. And it's not that that's [14:34.280 --> 14:39.600] not a good plan and it's not that it's not the way to do it, it's just time consuming. [14:39.600 --> 14:47.160] Now in this Title 42 lawsuit, I have had to sit down and read through several different [14:47.160 --> 14:53.720] lawsuits that have been written over the last couple decades or so, because I want to see [14:53.720 --> 15:00.600] how the original old school attorneys wrote them versus how the newer people are writing [15:00.600 --> 15:06.400] them. So I can see where the court may have shifted the way it wants to view an argument. [15:06.400 --> 15:11.120] I'm all about trying to do this the best, cleanest way possible that'll get the most [15:11.120 --> 15:17.360] attention from the judge. So in that regard, I've had to delve into a half a dozen or so [15:17.360 --> 15:24.760] lawsuits so far, and I've got about two dozen more to dig through to get myself collected [15:24.760 --> 15:28.800] on how I want to write this one. It's the same way I went about designing my first [15:28.800 --> 15:34.000] aquaponic system on a commercial scale was I took everything I learned, good, bad and [15:34.000 --> 15:39.240] ugly from all the other stuff and tried to figure out and distill it down to the best [15:39.240 --> 15:45.160] practices for the design that I've come up with, that I'm trying to get also drawn out [15:45.160 --> 15:54.400] and make a 3D model of so that I can use it to get certified for organic growing and [15:54.400 --> 15:59.720] so on and so forth. And let me tell you just real quick off the topic of law and onto aquaponics [15:59.720 --> 16:09.280] here for just a half a second, but you would be astounded how absolutely frustrating it [16:09.280 --> 16:21.240] is to try to find materials in America and Texas too that are food safe to build these [16:21.240 --> 16:27.400] systems out of. The more research I do on how the like supermarkets with their produce [16:27.400 --> 16:32.680] misting systems and some of these people that are making all of these certified organic [16:32.680 --> 16:37.280] systems, but when you look at what they've got the system constructed of, you have to [16:37.280 --> 16:42.440] wonder how they got organically certified because a lot of the plastic stuff they're [16:42.440 --> 16:49.120] using like PVC pipe, spray nozzles and stuff like this are all made with toxic chemicals [16:49.120 --> 16:54.640] that aren't supposed to be used for this purpose. Now, while we're going through that, [22:01.200 --> 22:09.320] let's go back to the other stuff I was talking about originally, the Title 42 lawsuit especially. [22:09.320 --> 22:17.880] There appears to be only one correct way to write a Title 42 lawsuit and any variances [22:17.880 --> 22:28.560] to that are small to none and usually they deal only with the specific facts and maybe [22:28.560 --> 22:36.600] just maybe a little bit of the way you word your complaint, but not a lot because if you [22:36.600 --> 22:42.840] don't cite certain elements for certain types of charges that you're trying to make and [22:42.840 --> 22:49.720] recover under, the court won't pay attention to it. Now, I don't know why that is because [22:49.720 --> 22:55.400] that is something they've been prohibited to do for decades by the Supreme Court, but [22:55.400 --> 23:01.440] they're still doing it. Some of these cases that I've read have been the intent of reading [23:01.440 --> 23:09.560] ones that failed, that the court dismissed on a 12b6 or whatever reason to try to figure [23:09.560 --> 23:19.320] out why the court found it necessary to dismiss the complaint and the reasons that I'm getting [23:19.320 --> 23:25.040] make it very clear that these judges are being far more picky than they should be from a [23:25.040 --> 23:31.920] pro se to begin with and just from the way the facts have to be stated in general. The [23:31.920 --> 23:38.840] courts as far as the people are concerned are supposed to make the effort to determine [23:38.840 --> 23:46.040] what the individual filing the suit is actually requesting and whether or not they have a [23:46.040 --> 23:53.360] proper claim once the judge determines what they're requesting. The court is required [23:53.360 --> 24:02.480] to do that, but these lazy bums don't want to do it. We have all these public servants [24:02.480 --> 24:10.160] making all this money off of us, but who do so with such an entitlement mentality that [24:10.160 --> 24:18.200] they feel they should get paid whether they're fully doing their job or not. I've got a problem [24:18.200 --> 24:27.440] with that, a big problem with that. Now, the reason that's important is because the judge [24:27.440 --> 24:32.600] that I'm saying that we were going to, that this lawsuit I'm writing up is directed at, [24:32.600 --> 24:38.840] has completely abused the power of his office. He has illegally falsified court documents [24:38.840 --> 24:46.320] which we can prove. He has acted with the intent to maliciously cause harm to the defendant [24:46.320 --> 24:55.080] in the case by his falsification. He has falsely reported information to another state agency [24:55.080 --> 25:03.880] which is a felony in Texas. He has abused the laws of Texas under the abuse of official [25:03.880 --> 25:12.360] capacity, official oppression, and simulation of legal process, penal code statutes, not [25:12.360 --> 25:16.680] only against this defendant, but every defendant's ever appeared in this court, and we have records [25:16.680 --> 25:23.400] of that as well. It holds true for the majority of these courts and these judges. They are [25:23.400 --> 25:33.480] every single one doing it wrong, and they're doing it criminally. Now, on my Facebook group [25:33.480 --> 25:42.560] I have posted an actual copy of the criminal complaint that we wrote against the JP in [25:42.560 --> 25:50.160] the case that is resulting from the falsification of government records that the first judge [25:50.160 --> 25:55.520] did. Okay? So there's two judges involved with this one individual right now under two [25:55.520 --> 26:00.920] separate cases. The original judge that falsified the information to the Department of Public [26:00.920 --> 26:07.800] Safety that prevented his license from being renewed, and then the fact that he was arrested [26:07.800 --> 26:13.920] by a DPS officer and charged with driving while licensed invalid because he could not [26:13.920 --> 26:20.120] get that license renewed due to the original judge's falsification. But the JP in the second [26:20.120 --> 26:27.240] case acted illegally under Texas law by sending out a notice that does not comply with the [26:27.240 --> 26:36.000] requirements of a proper summons. Under Texas law, that is called simulation of legal process. [26:36.000 --> 26:46.160] It is illegal to do, but every single municipal and JP court in the state of Texas does it [26:46.160 --> 26:55.200] the same way. Not a single one of them send out a validly formatted summons as required [26:55.200 --> 27:02.080] by law. Not a single one of them put the information on those things they send out that the law [27:02.080 --> 27:12.440] requires to be on it. And yet, on its face, it contains language threatening punishment. [27:12.440 --> 27:17.440] If the person does not comply with the order of appearing before the court in relation [27:17.440 --> 27:24.400] to that document. This is a direct violation of the statute for a simulation of legal process [27:24.400 --> 27:32.560] under the penal code. Let's see, 32.48, I think it is, is the statute. But when you go [27:32.560 --> 27:41.320] and read it, that statute was written to curb the activities of the Republic of Texas folks [27:41.320 --> 27:47.400] and their courts that they created and formulated and all the forms and things they were sending [27:47.400 --> 27:54.400] out to public officials and warrants and all this stuff. But it is not worded in a way [27:54.400 --> 28:00.760] that limits it to those of a particular group of people. The way it is worded, it applies [28:00.760 --> 28:15.160] to anyone, even an actual Texas court. Okay? So, given that, this county attorney, when [28:15.160 --> 28:21.680] we gave him the criminal complaint, had a duty to submit it to the grand jury. That's [28:21.680 --> 28:27.760] what their duties are under Chapter 2 of the Code of Criminal Procedure. In 2.03, 2.04, [28:27.760 --> 28:32.720] and 2.05, they are specifically directed on the things they must do when a complaint is [28:32.720 --> 28:41.520] presented to them or made before them. They're not doing their job either. Okay? So, what [28:41.520 --> 28:47.080] we're trying to do by all these things is we're trying to get all of the necessary records, [28:47.080 --> 28:53.280] all the necessary proof that we need to show that there is a statewide criminal conspiracy [28:53.280 --> 29:00.160] between the TMCEC, the prosecuting attorneys at the county and municipal levels, as well [29:00.160 --> 29:07.480] as the DAs in cases where the county attorney is not the prosecutor at the county level, [29:07.480 --> 29:14.120] and that the judges themselves are sanctioning this criminal conspiracy and aiding and abetting [29:14.120 --> 29:21.240] its commission. When this is all said and done, all the documents that we're going to [29:21.240 --> 29:28.000] have accumulated should show that interlink in a manner that is going to be absolutely [29:28.000 --> 29:38.440] undeniable, because the statutes are very, very clear on what the requirements are. Yet, [29:38.440 --> 29:45.800] what they're doing is very, very clearly being done in violation of those statutes, and no [29:45.800 --> 29:51.640] one is being held accountable for it, despite the number of complaints being filed about [29:51.640 --> 29:55.800] it. Well, good. [35:58.320 --> 36:00.320] I decided the one from California. [36:00.320 --> 36:05.320] I mean, these people tend to forget that what they're doing is not lawful. Not lawful. Yeah, it took one letter. What they did was they took a freeway here in Los Angeles [36:19.320 --> 36:24.320] that had a car pool lane and then they started charging for it decades later just recently [36:24.320 --> 36:28.320] and started charging for it. And we're like, that's ridiculous. So we're driving on all [36:28.320 --> 36:34.320] the toll roads and using this and doing that. So far we haven't paid. [36:34.320 --> 36:37.320] Oh, good. [36:40.320 --> 36:46.320] My question tonight would be, when it comes to doing business activities, when do you [36:46.320 --> 36:51.320] have to get a permit or a business license and when can you tell the government to go [36:51.320 --> 36:53.320] and count and say it? [36:53.320 --> 36:58.320] Well, when the business is one that has a direct public interest, for instance, like [36:58.320 --> 37:05.320] the practice of medicine or engineering, things that involve directly the health and [37:05.320 --> 37:09.320] welfare of the general public. That's why electricians have to have licenses. [37:09.320 --> 37:14.320] That's why plumbers have to have licenses because if they install something while they're [37:14.320 --> 37:20.320] getting paid to install it in someone else's house or property and it burns down or floods, [37:20.320 --> 37:24.320] then they're on the hook for that because they did it wrong. [37:24.320 --> 37:30.320] And so same thing with doctors and all these other people, they have to be licensed because [37:30.320 --> 37:35.320] the jobs they do directly impact the public health and welfare. [37:35.320 --> 37:46.320] Otherwise, if it's an occupation of common right, then they can't force you to get a license to do it. [37:46.320 --> 37:51.320] Like for instance, some of the most cities will require you to get a business license to do [37:51.320 --> 37:54.320] business in their city. [37:54.320 --> 37:59.320] Only if you're incorporated. You have a right to conduct business as a human being. [37:59.320 --> 38:04.320] They can only make you get a license from them to open a business if your business is [38:04.320 --> 38:09.320] incorporated or it's a business affecting public interest, like I said. [38:09.320 --> 38:11.320] Okay. [38:11.320 --> 38:17.320] And then what's your take on the reasons the Supreme Court ruling about the internet tax? [38:17.320 --> 38:22.320] I mean, I've heard you talk before that it can only possibly apply to if you're incorporated [38:22.320 --> 38:24.320] and under certain circumstances. [38:24.320 --> 38:30.320] Well, that sales tax in general as far as them forcing you to collect it. [38:30.320 --> 38:37.320] And nothing the Supreme Court ruled is going to do that for a mom and pop business that [38:37.320 --> 38:41.320] the state cannot compel them to act as its tax collector for them. [38:41.320 --> 38:45.320] But as far as corporate businesses, I'm completely against the ruling. [38:45.320 --> 38:52.320] There is no logical basis for the Supreme Court after all this time changing that except to [38:52.320 --> 38:55.320] increase government revenue and control. [38:55.320 --> 39:00.320] That's the only reason it could have been done because there was nothing else that could [39:00.320 --> 39:03.320] even be a good result from what they did. [39:03.320 --> 39:05.320] Nothing. [39:05.320 --> 39:13.320] Because now they have a hugely increased burden on businesses to track what states they sell [39:13.320 --> 39:17.320] so that the tax rates that are going to be different and every one of them can be paid [39:17.320 --> 39:21.320] properly or they're going to lose money on every sale because of it. [39:21.320 --> 39:27.320] Or the state making claims against businesses that they owe themselves tax when in fact they don't. [39:27.320 --> 39:31.320] So their litigation bill and all this other stuff is going to go up as well. [39:31.320 --> 39:32.320] It's a complete mess. [39:32.320 --> 39:36.320] And the Supreme Court has screwed everybody by what they ruled. [39:36.320 --> 39:39.320] Yeah. [39:39.320 --> 39:43.320] Okay. [40:32.320 --> 40:36.320] And they just end up walking away. [40:36.320 --> 40:39.320] They just throw their hands up in there and they don't want to do their due diligence to research. [40:39.320 --> 40:43.320] No, because they've already been told this is how you'll do it. [40:43.320 --> 40:45.320] And they don't want to go beyond that. [40:45.320 --> 40:51.320] This has become an issue of where everybody is acting for their own self-preservation, [40:51.320 --> 40:58.320] they think up until the individual that they're hosing over by not doing their due diligence [40:58.320 --> 41:02.320] decides to take action against them and hold them accountable for it. [41:02.320 --> 41:06.320] But then again, you've got to show that it's not somebody you were just having a discussion with, [41:06.320 --> 41:11.320] but someone that was taking your money and withholding it from you illegally. [41:11.320 --> 41:17.320] Is there any remedy for someone that is, I don't know, like beyond the interview process, [41:17.320 --> 41:21.320] you've been offered the job and you don't want to complete a W-9 or a W-4 [41:21.320 --> 41:24.320] and then they retract the job offer. [41:24.320 --> 41:28.320] Is there any remedy for that person to go after the company or the... [41:28.320 --> 41:32.320] If you can document that that's the reason they did it, [41:32.320 --> 41:36.320] that you would not authorize them to steal your money, then you might have a lawsuit [41:36.320 --> 41:41.320] if you can figure out a way to make the claim. [41:41.320 --> 41:46.320] But that's the only way you're going to get anything out of it. [41:46.320 --> 41:48.320] Yeah, the same. [41:48.320 --> 41:55.320] It is, but such as the system we're stuck in right now because of those who control it. [41:55.320 --> 41:58.320] It's amazing. I've talked to a few CPAs and tax attorneys. [42:03.320 --> 42:12.320] I mean, when I was a computer consultant and one of the contracts I had was a network migration for Sprint up in Rockville, Maryland. [42:12.320 --> 42:15.320] I was working in Maryland, living over in Centerville, Virginia, [42:15.320 --> 42:22.320] and I did three different contracts, four different contracts while I was living up there to do this stuff. [42:22.320 --> 42:29.320] But one of the things that I did while I was in DC, because the second project I did while I was up there, [42:29.320 --> 42:34.320] was rewriting the federal budget software for Congress because of Y2K. [42:34.320 --> 42:41.320] So while I was up there, I was leading the team of people that was rewriting the new software for the United States Congress to use. [42:41.320 --> 42:56.320] But on one of my, I took an extended lunch one day and went over and had a meeting with the House Ways and Means Committee head attorney on income tax. [42:56.320 --> 43:00.320] And we were in his conference room in his law library. [43:00.320 --> 43:07.320] We had law books scattered all over the table, and I had this guy in a screaming fit. [43:07.320 --> 43:17.320] Now this is an actual attorney, and he was livid that every single time he would argue something about a statute, [43:17.320 --> 43:24.320] I'd flip to another section and say, you're reading that without this, you're also skipping over that word, that word, and that word, [43:24.320 --> 43:33.320] and you can't do that because it changes the meaning of the statute, because when you take those words and you look them up over here in the definition section for that section, [43:33.320 --> 43:38.320] you'll find out it means something completely different than you're saying and you're screwed. [43:38.320 --> 43:43.320] Oh man, you would think somebody had set off a firecracker in his butthole the way he carried on. [43:43.320 --> 43:46.320] I mean this dude was out of it. [43:46.320 --> 43:52.320] He was screaming at me, his own people walking by his door looking at him in there like he's lost his mind. [47:09.320 --> 47:13.320] You start the law form and they either don't want to look it up or they want to ignore it. [47:13.320 --> 47:16.320] Yeah, or they want to say it means something it doesn't say [47:16.320 --> 47:21.320] and they want to read it outside the context of the other things to which it relates [47:21.320 --> 47:27.320] and everyone of them are guilty of doing that, whether it be the professional or the judge. [47:27.320 --> 47:30.320] They're not looking at the law as a whole like they're required to do. [47:30.320 --> 47:34.320] They're looking only at the part that supports the position they want to take. [47:34.320 --> 47:40.320] Not the one that says the position you have is wrong because you're missing 15 things over here. [47:40.320 --> 47:45.320] You're supposed to be including. [47:45.320 --> 47:49.320] Yeah, I know that all too well. [47:49.320 --> 47:51.320] Last question for tonight. [47:51.320 --> 48:02.320] Is there any reason or necessity to get your car deregistered if it is registered with your state DMV? [48:02.320 --> 48:06.320] Well, it depends on how private you want to be. [48:06.320 --> 48:11.320] The more things you have registered with government, the more things they can track. [48:11.320 --> 48:14.320] That's one reason not to do it. [48:14.320 --> 48:18.320] Well, if you go back and look at the history of registration, [48:18.320 --> 48:23.320] the only thing that you're actually agreeing to as a private individual by registering your car [48:23.320 --> 48:30.320] is that the state has access to the necessary information to help recover it if it is stolen, [48:30.320 --> 48:41.320] though they are not required to prioritize that or in their eyes to even actually provide the service of looking for it. [48:41.320 --> 48:49.320] So that would be an individual interest, which the courts say the cops are not obligated to protect anyone under. [48:49.320 --> 48:51.320] So it's a catch-22. [48:51.320 --> 48:58.320] You're being told the reason they invented the process was to track stolen material and property and help recover it, [48:58.320 --> 49:04.320] but over here they're telling you we don't have to provide that service even if you register it and pay us some money to do it. [49:04.320 --> 49:12.320] So what the courts are actually ruling is they can take your money saying they're taking it because they have to get paid to do a job, [49:12.320 --> 49:20.320] but then they're not required to do the actual job, which makes it fraud. [49:20.320 --> 49:22.320] Yeah, there's a lot of things to do that's fraud. [49:22.320 --> 49:27.320] Well, not arguing that as being an incorrect statement by any means. [49:27.320 --> 49:38.320] Okay, so I'm on my second round with the California DMV to get my car D registered under the pretense of fraud that it was registered originally. [49:38.320 --> 49:42.320] So I was just wondering if it was a necessity or not, but I do like my privacy. [49:42.320 --> 49:51.320] Well, I've talked before about what is potentially the best process for doing that, and it's not actually going through the DMV. [49:51.320 --> 50:01.320] It's going to the Secretary of State and informing them in writing that you intend to remove your car from the jurisdiction of this state. [50:01.320 --> 50:10.320] And you need them to do a title search to assure that there is no outstanding liens, loans, or any other claims against the property in question. [50:10.320 --> 50:19.320] And once they certify that there is no such claim against the property and that it's currently in the name of whoever it supposedly belongs to, [50:19.320 --> 50:21.320] then that's all there is to it at that point. [50:21.320 --> 50:23.320] D registration is no longer a big deal. [50:23.320 --> 50:24.320] It's not required to DMV. [50:24.320 --> 50:27.320] You can just let the registration expire and be done with it. [50:27.320 --> 50:32.320] But now the issue here becomes, is can you show proper ownership via a bill of sale? [50:32.320 --> 50:40.320] Because the certificate of title is not evidence of ownership except for legal ownership. [50:40.320 --> 50:44.320] It is not representative of equity ownership. [50:44.320 --> 50:52.320] The reason for that is because your state business and commerce code defines a certificate of title as a negotiable instrument, [50:52.320 --> 50:54.320] meaning it's transferable. [50:54.320 --> 51:02.320] That's exactly why when people sell a car, the only thing they have to do is sign the back of that certificate of title just like they're endorsing a check [51:02.320 --> 51:05.320] and handing it over to someone else to cash or deposit. [51:05.320 --> 51:13.320] You're doing exactly the same thing with a certificate of title except what you're exchanging isn't money, it's the car. [51:13.320 --> 51:17.320] It works exactly the same way. [51:17.320 --> 51:24.320] But possession of the money is the only semblance of ownership you've got, and in this case, the car. [51:24.320 --> 51:28.320] But equity ownership is different than legal ownership. [51:28.320 --> 51:34.320] Legal ownership only entitles you to possession and use, but not disposition. Yeah, well, I know that, but this may be a court clerk that wasn't there [01:06:14.000 --> 01:06:20.400] like when you did it. I don't know. Yeah. But you know, she told me, she said, I've never seen [01:06:20.400 --> 01:06:26.800] anything like this. Normally what happens is you enter a plea and you talk to the county attorney [01:06:26.800 --> 01:06:33.840] and I said, no, no, I'm not here to enter a plea. The county is charging her in a [01:20:39.440 --> 01:20:45.680] civil suit with failure to comply with codes, and they put like $48,000 or the fines on her. [01:20:45.680 --> 01:20:51.120] Well, more than the value of the property. They've threatened to condemn it and bulldoze it. They've [01:20:51.120 --> 01:20:57.200] said that she is a nuisance per se. They said she's a health hazard, the property is. [01:20:58.800 --> 01:21:04.160] None of which they have any actual evidence of, right? Well, you know, what's funny is I have [01:21:04.160 --> 01:21:09.440] one question to ask about the complaint. The complaint lists the county, a body corporate [01:21:09.440 --> 01:21:15.600] and politic, and the county board of supervisors, not by name, just by that title. Right. But none [01:21:15.600 --> 01:21:22.560] of those entities signed the complaint. Now, can a county inspector sign the complaint as an agent [01:21:22.560 --> 01:21:28.720] on behalf of the county in something like that, or would that just be an insufficient complaint? [01:21:30.880 --> 01:21:33.760] Well, the first thing is, who's claiming to be injured? [01:21:35.600 --> 01:21:40.000] Nobody. They're not listing any injuries. Right. They're simply saying it's a code violation, [01:21:40.000 --> 01:21:45.840] when in which case they're trying to claim the code is injured. But the thing about it is, is in Arizona, [01:21:47.200 --> 01:21:52.400] I'm sorry? They're claiming that she had somehow had a duty to abide by these codes, [01:21:52.960 --> 01:21:58.800] which have no enactment clause. Right. They're a complete violation of the state constitution [01:21:58.800 --> 01:22:04.560] as binding public law. Right. How do I get that across to them? I mean, they just throw, [01:22:04.560 --> 01:22:08.960] they look at the... Well, under the legislative section of the Arizona Constitution, who is [01:22:08.960 --> 01:22:15.840] authorized to make law? The Arizona legislature and nobody else. Is there any power in that, [01:22:15.840 --> 01:22:23.840] in any part of the legislative department or title of the Constitution that allows them to [01:22:23.840 --> 01:22:29.760] delegate that power to a political subdivision, or that directly authorizes such power to a [01:22:29.760 --> 01:22:36.400] political subdivision? You know, I'm unclear on that. There's... What do you mean, unclear? [01:22:36.400 --> 01:22:44.160] So, well, they delegate authority to the county to handle regulatory stuff that... [01:22:44.160 --> 01:22:50.640] Yeah, but the question is, is who can the county regulate with their rules and regulations, [01:22:50.640 --> 01:22:56.480] as far as it having enforcement power? See, there's the caveat that makes that the problem. [01:22:57.040 --> 01:23:04.640] The county has given power over its own stuff and its own people, but they cannot use that power [01:23:04.640 --> 01:23:09.280] against the general public, at least the unincorporated general public, and private property. [01:23:10.480 --> 01:23:17.440] Because it is not legislation enacted by the legislature. It is not authorized by the Constitution, [01:23:17.440 --> 01:23:22.400] and the people cannot be bound by anything that is not enacted by the legislature. [01:23:24.240 --> 01:23:29.600] Now, how can I assert that on paper? Well, the first thing you need to do is search the statutes [01:23:29.600 --> 01:23:36.320] for a definition of the term law. The way you do that is you do a search inside of double quotes [01:23:36.320 --> 01:23:45.600] that says law means, or law includes. What you're likely to find is you're going to find the definition [01:23:45.600 --> 01:23:52.960] of the term law, where they have added things that the legislature did not enact, such as ordinances, [01:23:52.960 --> 01:23:59.680] for instance, to the meaning of the term. That statute would be fought as being unconstitutional [01:23:59.680 --> 01:24:08.480] on its face, because it is authorizing by statutory fiat and mere definition the delegation [01:24:08.480 --> 01:24:15.840] of an authority that the state constitution itself forbids. Because there is tons of case [01:24:15.840 --> 01:24:25.200] law that a delegated power cannot be redelegated. This lady got all the way to a summary judgment, [01:24:25.200 --> 01:24:31.040] and they ruled against her, because she's totally, she's aged, never been to court before, [01:24:31.040 --> 01:24:34.560] knows nothing about it, and I'm not sure she has the capacity to know about it. [01:24:34.560 --> 01:24:41.600] And they count on that too. They gave her a summary judgment, and I drew up a document to help her, [01:24:41.600 --> 01:24:45.840] and it was a motion for relief from judgment, from summary judgment. [01:24:47.280 --> 01:24:52.080] When you say they got a judgment against her, what kind of court does she go into? [01:24:53.440 --> 01:24:59.760] The county superior court, but I don't know how to tell if the judge was acting administratively or [01:25:00.400 --> 01:25:06.960] Because the statute, if the judge is acting in some capacity under law, then the law has to say [01:25:06.960 --> 01:25:13.600] what that capacity is. In other words, what kind of action was this intended to be? Was it [01:25:13.600 --> 01:25:19.520] intended to be administrative, in which case he's acting solely as an administrative officer, [01:25:19.520 --> 01:25:25.200] with no immunity, no nothing, and no judicial authority, which means it was not a judicial [01:25:25.200 --> 01:25:31.680] decision, which means it's unconstitutional on its face under the takings clause, because she was [01:25:31.680 --> 01:25:40.160] not given proper judicial hearing. So you've got to find out. That's imperative to know. [01:25:41.760 --> 01:25:48.400] Okay, so all of the charges were only codes and regulations. There were no [01:25:48.400 --> 01:25:54.480] Right, which would make them entirely administrative under almost anything with any sense. But this [01:25:54.480 --> 01:25:59.440] is not about making sense. This is about making money through theft and legalized robbery. [01:25:59.440 --> 01:26:04.480] So what do I have to do to determine whether he's administrative? [01:26:04.480 --> 01:26:09.760] You've got to read the statutes. What does the statute say the type of action is required to [01:26:09.760 --> 01:26:16.160] be in relation to the actions they took against her? There has to be a law that backs up the [01:26:16.160 --> 01:26:21.360] actions that the court took and that the county took. There has to be. Can't just be their own [01:26:21.360 --> 01:26:26.480] regulations because if it is, then it's 100% administrative and it's illegal on its face. [01:26:26.480 --> 01:26:34.400] Okay, so if they acted in a state court, then there has to be a state law that says what that [01:26:34.400 --> 01:26:41.280] action has to be considered as and treated as. And under what authority the judge of that court [01:26:41.280 --> 01:26:48.720] is acting, whether it's judicial or non-judicial. But you've got to know that if you can't determine [01:26:48.720 --> 01:26:52.640] that, then you can't determine the nature of the action. If you can't determine the nature, [01:26:52.640 --> 01:26:58.560] then you've got a rights deprivation because no one's telling you. And you have a right to know [01:26:58.560 --> 01:27:04.400] that. Would a request or a motion to request that information from the judge be effective? [01:27:05.200 --> 01:27:09.200] The case is over. There's no motion to be filed with the judge. [01:27:09.200 --> 01:27:14.640] A motion's only good in a case. There is no case. Wait a minute. Wait a minute. Now it's not over. [01:27:15.680 --> 01:27:18.000] Well, you said they got a summary judgment against her. [01:27:18.000 --> 01:27:25.680] Right. Are you appealing it? Yes. She went to a motion for relief from [01:27:25.680 --> 01:27:30.800] summary judgment and she got there so late she didn't file the document that I handed her. [01:27:30.800 --> 01:27:34.640] And she went in and tried to argue it herself. And the judge basically told her to sit down [01:27:34.640 --> 01:27:39.360] and shut up. He didn't have time to listen to her argument. And then she went out and filed [01:27:39.360 --> 01:27:45.280] that document. And then a couple of days later, she filed her appeal. And that took the jurisdiction [01:27:45.280 --> 01:27:51.600] away from the Superior Court. And the appellate court looked at that document that had been filed [01:27:51.600 --> 01:27:59.040] and gave her in order to file a motion that the Superior Court take on the jurisdiction again [01:27:59.040 --> 01:28:06.480] and rule upon that document that we filed. And according to Rule 56B, it's saying that there's [01:28:06.480 --> 01:28:11.600] no more things to be dealt with that he finished it. And that he's got to do that. And she's got [01:28:11.600 --> 01:28:23.120] to get that in by the 5th of July. Okay. Then do that. Then yeah, if it's been sent back and they [01:28:23.120 --> 01:28:29.200] have been ordered to resume jurisdiction and continue the case, then yeah, file a motion [01:28:29.200 --> 01:28:39.840] demanding nature and cause. And don't leave it up to them to tell you, provide them with a question. [01:28:39.840 --> 01:28:44.160] Is this actually considered administrative? Is this actually considered civil? Is this [01:28:44.160 --> 01:28:53.840] actually considered criminal? Pick one and tell me. That administrative is a form of civil, [01:28:53.840 --> 01:29:00.080] but it doesn't have to do process protections. So be aware of that. If they try to say, well, [01:29:00.080 --> 01:29:10.080] civil and administrative are the same thing. No, they are not. Okay. So I got to get that motion [01:29:10.080 --> 01:29:14.560] separate from the motion she's doing according to the order from the... It depends on what [01:29:14.560 --> 01:29:19.680] they're telling her that motion is for. You might can do both, but I would do it separate anyway [01:29:19.680 --> 01:29:25.200] to make sure that they take notice of the two different issues. They proceeded without providing [01:29:25.200 --> 01:29:30.960] nature and cause, even though that was originally requested. But since you didn't do it in writing [01:29:30.960 --> 01:29:36.640] until now, you're going to have a hard time proving it was requested earlier. And when she told them to get off [01:34:43.200 --> 01:34:49.520] the property, they did. Yeah, an administrative warrant has absolutely no probable call statement [01:34:49.520 --> 01:34:54.160] and no criminal implication to it, so there can't be probable cause. They can't enter [01:34:54.160 --> 01:34:59.320] with an administrative warrant unless you're an administrative entity like a corporation [01:34:59.320 --> 01:35:04.360] or something. They know that. They did later. They did later by coming back when she wasn't [01:35:04.360 --> 01:35:09.400] home and they took photos and entered them into evidence. And I complained that they [01:35:09.400 --> 01:35:13.560] were collected illegally and they are a fruit of the poison tree and not admissible. Well, [01:35:13.560 --> 01:35:20.080] they can use anything that they took pictures of outside of her fence line from the road [01:35:20.080 --> 01:35:24.920] or anything like that. But as far as private property, you know what the Supreme Court just [01:35:24.920 --> 01:35:32.920] ruled on that. And he is well [01:36:35.300 --> 01:36:39.800] aware of that. And if he, if he isn't, he'd have sure shouldn't be sitting in an elected [01:36:39.800 --> 01:36:51.280] job doing what he's doing. Um, the, the county codes and the, uh, and the, uh, statutes [01:36:51.280 --> 01:36:58.000] that they're citing, they don't have enactment clauses, but the laws behind them may. Well, [01:36:58.000 --> 01:37:03.400] the statutes will have them in the laws behind them, but their ordinances won't because the [01:37:03.400 --> 01:37:10.880] legislature didn't enact them. So with no, and all these things are ordinances with, [01:37:10.880 --> 01:37:15.680] with no enactment clause, there's no law and no duty to put on anybody. Right. Okay. That's what Pierce and making them directly and personally [01:38:14.040 --> 01:38:18.760] responsible for the corporation's actions because they were the ones who instigated [01:38:18.760 --> 01:38:24.360] them or carried them out and they were in violation of law. Such as the guy that signed [01:38:24.360 --> 01:38:30.320] the complaint on behalf of the county. Well, that's not necessarily true. Criminal complaints [01:38:30.320 --> 01:38:36.600] do not necessarily have to be signed by the person making the allegation directly. Complaints [01:38:36.600 --> 01:38:42.760] can be hearsay, which is why they're not valid charging instruments. And the state of Texas [01:38:42.760 --> 01:38:48.200] uses them in class C's for that all the time and it's just not right. It's not due process [01:38:48.200 --> 01:38:53.080] because the person making the hearsay complaint has no firsthand knowledge of what they're [01:38:53.080 --> 01:38:58.840] saying and they're not allowed to testify to anything asserted in it and yet they're [01:38:58.840 --> 01:39:05.920] going to trial based solely on what's in that complaint. And that's not right because there's [01:39:05.920 --> 01:39:12.400] no probable cause attached to a hearsay instrument. All of these charges are his opinion, the [01:39:12.400 --> 01:39:14.400] inspector. Exactly. [01:39:14.400 --> 01:39:20.080] He's put down what are your opinion and signed it. These are all true according to the best [01:39:20.080 --> 01:39:26.440] of my knowledge and belief. And the thing is, is if he's actually citing his opinion of the law, then you can [01:39:34.280 --> 01:39:41.480] challenge him on the stand and that regard. Are you qualified to offer an expert opinion [01:39:41.480 --> 01:39:46.240] on the law? And he's going to have to say, well, no. And so is the prosecutor in the [01:39:46.240 --> 01:39:52.680] court. Well, no, he's not. Well, then how can he testify that this is true? It's all his [01:39:52.680 --> 01:39:58.160] opinion and his conclusions and his presumptions of law, which you just said he can't testify [01:39:58.160 --> 01:40:07.200] to and are inadmissible hearsay because he's not qualified. You're talking about her making an allegation [01:40:41.480 --> 01:40:47.360] against them for their actions? Yeah. And that way she can ask... If this is civil [01:40:47.360 --> 01:40:52.800] or administrative, you most certainly can file cross complaints. Would that give her [01:40:52.800 --> 01:40:57.200] any advantage at this stage? As long as she can prove what she's claiming, it may give [01:40:57.200 --> 01:41:03.920] her an absolute advantage, especially as her claim is that they acted illegally and they're [01:41:03.920 --> 01:41:09.840] using the laws incorrectly and unconstitutionally because that not only proves their case is [01:41:09.840 --> 01:41:24.120] dead in the water and that she's right, it proves a lawsuit. Okay. And the unconstitutional [01:41:24.120 --> 01:41:34.600] use of those codes. The unconstitutional application of ordinances as binding public law under [01:41:34.600 --> 01:41:44.520] color of law and lawful authority. That's all illegal. It's a direct violation of your [01:41:44.520 --> 01:41:51.480] own state's constitution. And the legislature cannot circumvent the constitution by creating [01:41:51.480 --> 01:41:58.480] a statutory definition that empowers an agency outside of the parameters of that constitution. [01:41:58.480 --> 01:42:05.880] Okay. So that kind of allegation would be made as a civil charge in this case and used [01:42:05.880 --> 01:42:09.880] as a... It could be made as both. She can file a criminal charge against them and she [01:42:09.880 --> 01:42:17.000] can file a civil suit against them for it. In the same court? In the same action? Well, [01:42:17.000 --> 01:42:20.800] no. The criminal complaint is directed at the county or district attorneys or whoever [01:42:20.800 --> 01:42:25.960] in your state is required to take criminal complaints and apply them to a grand jury [01:42:25.960 --> 01:42:31.000] and a charge against whoever it's made against. That'll be a magistrate, a county attorney, [01:42:31.000 --> 01:42:36.600] a district attorney, someone that's authorized in your state to accept criminal complaints [01:42:36.600 --> 01:42:42.920] and administer oaths. So you got to look that up. It'll be in your code of criminal procedure, [01:42:42.920 --> 01:42:47.720] whatever that may be, as to who's required to take a criminal complaint and how they [01:42:47.720 --> 01:42:52.320] have to go about it and what they have to do with it. Then her civil suit is something [01:42:52.320 --> 01:42:58.720] completely separate from the criminal complaint. Now, it may be based upon the facts and circumstances [01:42:58.720 --> 01:43:03.480] relating to the criminal complaint, but the civil suit won't mention anything about the [01:43:03.480 --> 01:43:09.800] crime other than how it caused her harm. Because that's what the civil suit is all about is [01:43:09.800 --> 01:43:17.160] the harm she suffered through these actions by these people. Acting under color of a law [01:43:17.160 --> 01:43:26.920] and authority that they didn't actually have. Okay, so the harm and distress suffered. There [01:43:26.920 --> 01:43:31.080] could be all kinds of basis for harm. It all depends upon the cause of action as to what [01:43:31.080 --> 01:43:36.600] you can claim. So you need to look that up too. The lawsuit, you've got both a state [01:43:36.600 --> 01:43:41.640] and a federal lawsuit if you could show civil rights violations as they determine civil [01:43:41.640 --> 01:43:47.240] rights anyway. I got there right at 3. There was a girl standing at the door at 159. [01:48:43.520 --> 01:48:47.520] I don't know what the deal was, but they stopped people and waited a few minutes out there, [01:48:47.520 --> 01:48:51.520] and finally went in. He called me up to the judge and asked to ask my name, [01:48:51.520 --> 01:48:57.520] and the other didn't have me on the list. He said, no, you're on free trial, [01:48:57.520 --> 01:49:02.520] and I said, oh, I have a motion hearing, thinking they had made a mistake. [01:49:02.520 --> 01:49:09.520] He said, no, that's free trial, and he had a chip on his shoulder, and said it would only take three minutes. [01:49:09.520 --> 01:49:15.520] So I signed the clipboard for the free trial people, and I was last one in line. [01:49:15.520 --> 01:49:18.520] Last one was there. It took two hours to wait. [01:49:18.520 --> 01:49:26.520] So after listening to his bad attitude with a couple of folks, [01:49:26.520 --> 01:49:34.520] I went to the library next door for about 40 minutes, and I come back, [01:49:34.520 --> 01:49:38.520] and the people that had signed in right after me are walking out for the parking lot. [01:49:38.520 --> 01:49:45.520] So I kind of panicked and got in there as fast as I could, and there's still a handful of defendants in the courtroom. [01:49:45.520 --> 01:49:48.520] It wasn't just one person. It was not like they were just one person waiting on a ride. [01:49:48.520 --> 01:49:51.520] They're obviously still dealing with the court. [01:49:51.520 --> 01:50:00.520] And I approached the clerk in the bay up there, and she explains that he had instructed her to issue a warrant for IRS, [01:50:00.520 --> 01:50:05.520] and that he had said that, you know, I shouldn't have left. [01:50:05.520 --> 01:50:08.520] You know, I warned up. You know, she said that... [01:50:08.520 --> 01:50:13.520] Who instructed her to write up a warrant? [01:50:13.520 --> 01:50:15.520] The judge. [01:50:15.520 --> 01:50:17.520] Ah, what state is this? [01:50:17.520 --> 01:50:19.520] Texas. [01:50:19.520 --> 01:50:21.520] He screwed. [01:50:21.520 --> 01:50:29.520] The judge cannot request the issuance of a warrant. Was the county or district attorney there? [01:50:29.520 --> 01:50:31.520] No, this was municipal. [01:50:31.520 --> 01:50:34.520] Okay, was the city attorney there? [01:50:34.520 --> 01:50:37.520] I believe they would have been there. [01:50:37.520 --> 01:50:42.520] Well, I didn't ask if they would have been there. I asked, were they there? [01:50:42.520 --> 01:50:48.520] I'm not sure. I could call in and find out tomorrow. [01:50:48.520 --> 01:50:51.520] Okay, should have been yes, but here's the thing. [01:50:51.520 --> 01:50:57.520] In Texas under Chapter 23, the judge is not the one authorized to request a warrant. [01:50:57.520 --> 01:51:02.520] The warrant must be specifically requested by the attorney prosecuting for the state, [01:51:02.520 --> 01:51:05.520] which city attorneys are not lawfully authorized to do. [01:51:05.520 --> 01:51:07.520] Okay? [01:51:07.520 --> 01:51:11.520] And they cannot do it in relation to Class C misdemeanors. [01:51:11.520 --> 01:51:20.520] Everything in the law only authorizes them to request the issuance of a warrant for A and B misdemeanors or felonies, [01:51:20.520 --> 01:51:23.520] not Class C fine-onies. [01:51:23.520 --> 01:51:25.520] Okay? [01:51:25.520 --> 01:51:33.520] Now, last but not least, if they're the ones that told you they were not going to see you for X amount of time, [01:51:33.520 --> 01:51:38.520] which this is a trick they use all the time, so it's what they do. [01:51:38.520 --> 01:51:44.520] You need to file a complaint against that judge and that prosecutor for subverting people's rights by the process they're using, [01:51:44.520 --> 01:51:46.520] because here's what they do. [01:51:46.520 --> 01:51:51.520] They intentionally tell you we're not going to see you for this amount of time. [01:51:51.520 --> 01:52:01.520] Then they very carefully monitor every one that's there to see if anyone leaves the building or goes out of earshot to the bathroom or anywhere else. [01:52:01.520 --> 01:52:10.520] Then they immediately inform the judge who then immediately calls that person's name, who of course is not there to hear it, [01:52:10.520 --> 01:52:21.520] so that they can then turn around and order the issuance of a warrant for failure to appear and thus get the fee for the warrant on top of everything else. [01:52:21.520 --> 01:52:24.520] This is a common practice in these courts. [01:52:24.520 --> 01:52:34.520] It is absolutely 100% corrupt and it goes on thousands of times a day across the state. [01:52:34.520 --> 01:52:37.520] Yeah, I can tell they're pulling the rug off my feet. [01:52:37.520 --> 01:52:39.520] Yeah, they do that with everybody. [01:52:39.520 --> 01:52:42.520] This is exactly the kind of crap they pull. [01:52:42.520 --> 01:52:49.520] This is exactly what's dishonest about them and why they should never be allowed to handle cases. [01:52:49.520 --> 01:52:54.520] Yeah, so I was like, they're still here though, right? [01:52:54.520 --> 01:52:55.520] She's like, no. [01:52:55.520 --> 01:52:59.520] She went through her spiel, explained it why. [01:52:59.520 --> 01:53:05.520] I didn't want to stand there and argue because the bailiff was standing right there and I was like, well, are you going to slap some cuss on me? [01:53:05.520 --> 01:53:07.520] I was like, okay, I'll handle it. [01:53:07.520 --> 01:53:09.520] They walked out. [01:53:09.520 --> 01:53:20.520] Yeah, file a motion to recall the warrant, file a criminal complaint against the prosecuting attorney and the judge for criminal conspiracy to violate rights under color of law, [01:53:20.520 --> 01:53:32.520] which they did by telling you they weren't going to see you before a certain amount of time or a certain time of day and then knowingly calling your name when you were no longer present to make it appear that you had failed to appear. [01:53:32.520 --> 01:53:36.520] It's a complete scam job. [01:53:36.520 --> 01:53:42.520] Okay, but then, dang, I'm just afraid they're going to say, well, he wasn't there. [01:53:42.520 --> 01:53:45.520] He was left and they even sent the bailiff outside. [01:53:45.520 --> 01:53:57.520] This is the reason why I tell people, take a witness and record all at the same time so that someone is there that can testify as to what was said and what you were told. [01:55:49.520 --> 01:55:54.520] What do you mean to get in line, to be heard or to even get into court room? [01:55:54.520 --> 01:55:59.520] To be heard to have the pre-trial, because, no, it was in... [01:55:59.520 --> 01:56:08.520] I was in the court room, but to be heard in line, they called people off for pre-trial off this sign-in sheet. [01:56:08.520 --> 01:56:11.520] And that's what happened. [01:56:11.520 --> 01:56:15.520] I mean, the people who were working to sign in after me were walking in the parking lot. [01:56:15.520 --> 01:56:20.520] I walked in and, oh, she told me the judge had disappeared. [01:56:20.520 --> 01:56:26.520] Yeah, and that's because they're very carefully watching to see if anyone on that list leaves that building so that they can do this. [01:56:29.520 --> 01:56:36.520] Yeah, I would have argued, hey, there's a bunch of other people still in this court room, but I just didn't want to see them slapping those cuffs on me. [01:56:40.520 --> 01:56:44.520] Well, that's liable to happen anyway if they issued that warrant. [01:56:44.520 --> 01:57:08.520] The thing is, is when you read 15.17 and 14.05 and 06 of the Code of Criminal Procedure and you look at Chapter 23, you will find very clearly that there is no language whatsoever that authorizes the issuance of a warrant for failure to appear in relation to a citation. [01:57:08.520 --> 01:57:13.520] Now, did they send you a written notice of your motions hearing? [01:57:13.520 --> 01:57:17.520] I believe there was. [01:57:17.520 --> 01:57:18.520] Yeah.
