[04:19.360 --> 04:26.280] The end of the world was supposed to end in 2012, I think most people forgot about that. [04:26.280 --> 04:30.760] But anyway, had an interesting week. [04:30.760 --> 04:42.080] Just went to court yesterday with Scott Richardson, he's been fighting for a long time and everybody [04:42.080 --> 04:48.000] there was surprisingly solicitous. [04:48.000 --> 04:54.800] When I told the bailiff to tell the judge that I want to videotape these court proceedings, [04:54.800 --> 05:00.720] he went up and told the judge, and the judge said no, and he came back and I'm smiling [05:00.720 --> 05:05.440] real big and I said, he said no, didn't he, said yes, he did, said good, good, good, good, [05:05.440 --> 05:06.440] good. [05:06.440 --> 05:12.680] I want you to take my criminal complaint against the judge and he said, oh, okay, and he did. [05:12.680 --> 05:20.000] Took my complaint, I signed it in front of him, took it out, came back with a copy and [05:20.000 --> 05:23.360] a copy of the court rules. [05:23.360 --> 05:25.560] So that was the nice setup. [05:25.560 --> 05:32.640] I've set that up because recently in Turner v. Driver, this is a case that came down in [05:32.640 --> 05:41.720] February this year, where a guy was videotaping the courthouse, the police department in Fortworth. [05:41.720 --> 05:45.720] When the police come out and they jerked him around a while, cuffed him and threw him [05:45.720 --> 05:50.160] in the back of their car and held him there for an hour or so with the air conditioning [05:50.160 --> 05:58.120] off, so it's a nice sweat box, and then they decided to let him go, will he sue them. [05:58.120 --> 06:05.880] And they got to the Fifth Circuit Court of Appeals, the Federal Court of Appeals, and [06:05.880 --> 06:17.160] the Fifth Circuit granted the officers qualified immunity stating that the right to videotape [06:17.160 --> 06:26.640] public officials prior to that time had not been clearly defined, but they said after [06:26.640 --> 06:31.000] this time it is clearly defined. [06:31.000 --> 06:39.280] So I read that and said, say what, the right to do something had not been clearly defined [06:39.280 --> 06:44.680] so the police could manhandle you, arrest you, throw you in a sweat box for an hour [06:44.680 --> 06:49.880] and punish you because your right had not been clearly defined? [06:49.880 --> 06:53.320] What is wrong with that picture? [06:53.320 --> 06:57.280] They've got everything backwards. [06:57.280 --> 07:10.320] So I filed my accusation claiming that the authority of the judge to deny me in an activity [07:10.320 --> 07:14.480] had not been clearly defined. [07:14.480 --> 07:18.120] We don't need our rights clearly defined. [07:18.120 --> 07:24.000] Public officials, before they exert or purport to exert an authority, that authority must [07:24.000 --> 07:26.800] be clearly defined. [07:26.800 --> 07:31.520] So I constructed this to raise that question. [07:31.520 --> 07:36.920] Bring that to the Court of Appeals and see how they deal with that one. [09:22.080 --> 09:25.200] They don't tell you about that, about all that stuff. [09:25.200 --> 09:28.120] That's what your jurisdictionary does. [09:28.120 --> 09:33.080] Mark in Wisconsin called me years ago about an issue with his son being stopped in a car [09:33.080 --> 09:38.840] load of teenagers and they found pot in the center console. [09:38.840 --> 09:44.120] The son wasn't the driver, he was just a passenger and they charged him with the pot. [09:44.120 --> 09:50.040] And I said, well, you need to file a real man damage and he said, did that and it weren't [09:50.040 --> 09:54.640] releasing discovery information. [09:54.640 --> 09:56.600] So he didn't file a real man damage. [09:56.600 --> 09:58.640] He said, did that. [09:58.640 --> 10:01.600] Everything I suggested that he do, he said, I did that. [10:01.600 --> 10:06.760] I said, if you went through jurisdictionary, oh yeah, I've been through jurisdictionary. [10:06.760 --> 10:15.880] If you have a legal issue and you don't know what's going on, you need to get jurisdictionary. [10:15.880 --> 10:23.480] It will give you the basic procedure in how things work with the courts. [10:23.480 --> 10:24.480] Okay. [10:24.480 --> 10:32.600] Now, if you have a traffic ticket, now you need it is course because it is course is not [10:32.600 --> 10:41.040] a bunch of rah, rah, you should do this, you should do that, you need a lawyer, you got [10:41.040 --> 10:46.000] this right, you need a lawyer, you got that right, you need a lawyer, it's not one of [10:46.000 --> 10:47.000] those. [12:48.880 --> 12:53.280] But then again, if this were a perfect world, good chance I wouldn't be in it. [12:53.280 --> 12:55.680] Actually, I'm certain I wouldn't be in it. [12:55.680 --> 13:01.840] If a good chance a bunch of you wouldn't be in it either, it's not perfect. [13:01.840 --> 13:10.120] Judges have been corrupt so long as we've had human beings acting as judges. [13:10.120 --> 13:15.000] Judges have been fallible, they make mistakes, they act on their personal passions. [13:15.000 --> 13:20.000] Yeah, I know they're not supposed to do that, but this is a real world. [13:20.000 --> 13:25.920] You file a motion with 20 cases the judge has never seen before, and he's got 20 more [13:25.920 --> 13:28.200] motions sitting out on his desk. [13:28.200 --> 13:34.920] You think he's going to look up all those cases and read them all, and denied. [13:34.920 --> 13:41.000] I mean, I'll be right, but in the real world we live in, that's how it works, and we talk [13:41.000 --> 13:42.520] about things like that. [13:42.520 --> 13:46.200] Don't write your own pleadings. [13:46.200 --> 13:48.400] Play to your eyes. [13:48.400 --> 13:55.720] Every state has litigation guards, and the vast majority of the lawyers and law firms [13:55.720 --> 14:02.360] follow those litigation guards, not necessarily because they need them, but because they know [14:02.360 --> 14:08.800] that most every other lawyer will follow those litigation guards, so we have a format for [14:08.800 --> 14:15.600] how to build motions and pleadings so that we are extremely uniform. [14:15.600 --> 14:22.080] Lawyers go into motion hearings, and there may be 30 lawyers in there with motions, and [14:22.080 --> 14:26.600] a judge just calls them up one after another, takes a couple of minutes for each motion, [14:26.600 --> 14:31.360] and he rules, they go to the next, they go to the next, well, that's because the motions [14:31.360 --> 14:39.840] he's got in front of him are almost identical in form, in case law. [14:39.840 --> 14:45.360] Just the issues specific to this particular argument are different, so the judge don't [14:45.360 --> 14:49.680] have to waste any time on all that other stuff, he already knows what it is, but then he gets [14:49.680 --> 14:59.280] a pro-safe pleading, and quite frankly, he is annoyed because he has to go through this [14:59.280 --> 15:05.440] original document that he's never seen before, he's got to look at case law he's never seen [15:05.440 --> 15:10.480] before, he is not going to be happy with you, odds are he's going to rule against you, not [15:10.480 --> 15:17.600] because he's basically corrupt, or because he's been paid off, but he's just acting [15:17.600 --> 15:24.560] from annoyance in the heat in the moment, he acts the way human beings act. I got the original [25:41.760 --> 25:50.160] ticket and then went to trial, was found guilty and was going to appeal it and then as soon [25:50.160 --> 25:56.760] as I left the court, the cop that testified against me pulls me over and arrests me again [25:56.760 --> 26:03.840] for driving with an invalid license. But now they get to charge it up to a class B. Well, [26:03.840 --> 26:11.440] so I can go straight to jail, get this secret registration that nobody knows what the definition [26:11.440 --> 26:16.760] of is and bond out four hours later back on the street, go get my car where they pulled [26:16.760 --> 26:25.080] me over and go home. Well, then I appealed that case, so it went up to the court at law [26:25.080 --> 26:30.600] and for the class C, well, then they also charged me with a class B when they pulled [26:30.600 --> 26:36.280] me over after court. So, now I'm going to court for both things and they basically combined [26:36.280 --> 26:43.600] them both together. So, it was about a year, almost a year to the day when I had that municipal [26:43.600 --> 26:51.680] court trial. So, but anyhow, so we had the trial and I've been filing tons of judicial [26:51.680 --> 26:56.680] conduct against this judge because they were being just designed, wanted to deny people [26:56.680 --> 27:05.560] access to bring an open court and, you know, delaying the court, you know, just have me [27:05.560 --> 27:12.760] come there and reset, reset, reset. So, I filed criminal complaints about that and then actually [27:12.760 --> 27:17.680] filed a criminal complaint, sent it to the district attorney and the county's judge [27:17.680 --> 27:26.640] asking to have a court of inquiry or an examining trial for the criminal complaints to reset [27:26.640 --> 27:32.000] in this case so many times against the court at law judge. So, created a bunch of controversy [27:32.000 --> 27:38.600] with that, the judicial conducts on the judge, not only that, one time during the court proceedings, [27:38.600 --> 27:45.040] I had a court watcher with me who was able to write up third party complaints and whenever [27:45.040 --> 27:50.960] a judge goes off the chart, which they all do, so third party complaint is a very powerful [27:50.960 --> 27:59.280] tool that's why everybody should have a court watcher go with them. And so, when he went [27:59.280 --> 28:04.560] there one day, they accused him of filming in the court, brought him up out of the gallery, [28:04.560 --> 28:12.040] searched his phone after the Fourth Amendment warrant and proceeded to just ruffle through [28:12.040 --> 28:16.040] his personal possession. So, that triggered a... [28:16.040 --> 28:24.320] Okay, wait, wait, question on that. When did that happen? Okay. Was it after the middle [28:24.320 --> 28:25.320] of February? [28:25.320 --> 28:28.880] No, it was before the account. [28:28.880 --> 28:32.640] Okay. So, it was before Turner v. Driver? [28:32.640 --> 28:42.920] Yeah, before Turner v. Driver had his decision. So, but he did threaten him and then take [28:42.920 --> 28:47.960] his phone and grab somebody up out of the gallery, which is a... Basically, you're in [28:47.960 --> 28:52.960] a public street, they just jerk him off the street and just ruffle through his phone because [28:52.960 --> 28:59.040] the DA was grilling the DA on several things about a residue to caught and then they wouldn't [28:59.040 --> 29:03.920] accept that. So, then I turned in some criminal complaints to the judge about the municipal [29:03.920 --> 29:08.760] judge. The judge wouldn't take that. And then I started saying, well, nobody will take a [29:08.760 --> 29:13.800] criminal complaint because the DA wouldn't take a criminal complaint, already sent it [29:13.800 --> 29:18.640] to the chief of police. He referred it to the DA. So, he stood down, wouldn't take a [29:18.640 --> 29:23.240] criminal complaint. So, nobody's taking criminal complaints. And that's when the DA blew up, [29:23.240 --> 29:29.800] called Jody up out of the gallery and said, he's filming and just had a big hole of a [29:29.800 --> 29:36.160] loop. But that just triggered a lawsuit by Jody. So, we got it back going now. [29:36.160 --> 29:42.760] But hang on, hang on, we're about to go to break. Well, the reason for all the backfield is to get that kind of current caught up, [33:47.800 --> 33:56.800] and the reason for all the judicial complaints was to soften up the judge. Plus, we far grieve that the district attorney to the stone age. [33:56.800 --> 34:02.800] He just basically could come out and sit there and watch. He wouldn't even be the original guy by the end. [34:02.800 --> 34:11.800] So, he'd do all that and get them really softened up because they had forced me into a court appointed counsel, [34:11.800 --> 34:23.800] and so he was up there basically making some arguments, and the judge actually would let him make a few arguments that the prosecutor was trying to get with his object to. [34:23.800 --> 34:35.800] So, that kind of worked some in the favor, but when we get there, Randy was a real trooper because he came in on crutches because he had messed up his foot as Achilles heels. [34:35.800 --> 34:42.800] So, there was a band of us that came in there, about four of us that rolled in, and another guy came in. [34:42.800 --> 34:48.800] So, effectively, there's four people there that all witnessed the judge. [34:48.800 --> 34:59.800] Well, the bailiff, I was sitting there when Randy gave the criminal complaint up to the bailiff, and he just kind of looked at it and kind of taken care of some others. [34:59.800 --> 35:06.800] He walked off, and then I came back a little bit later and was sitting down there when he came back and handed you the actual document. [35:06.800 --> 35:12.800] Here's our court rules and policies or whatever, and it happened on there, no filming. [35:12.800 --> 35:21.800] Oh, there we go. I was like, oops, done deal now. So, the four people can actually file federal lawsuits on that because everybody was there to film. [35:21.800 --> 35:33.800] Everybody was not. This is how in my case now, so now the judge is, we have all the proceedings, I'm naturally found guilty on both counts, but on the class fee, [35:33.800 --> 35:45.800] they said all fines and fees and all, since I went to jail for four hours, everything was wasted, and it was a complete wash, over and done with. [35:45.800 --> 35:57.800] And on the class fee, they just wanted, they were just going to remand it back to the lower court's fine of the four hundred and something bucks, and it was over and done with. [35:57.800 --> 36:03.800] So, they said you can't appeal that one, but you said, yeah, we could go ahead and appeal it as one. [36:03.800 --> 36:21.800] But, you know, I'm also looking at putting in a notice of a void judgment, what I've used on a couple other cities because I have a federal lawsuit on the county judge for supervisory and neglect for Brady's policy violations. [36:21.800 --> 36:34.800] So, I'm writing it all up, and there's a point now for fraud upon the court, and really press the situation and see how far they want to go when they have two federal lawsuits on them right now. [36:34.800 --> 36:38.800] And that's the federal suit, and they're on the county judge. [36:38.800 --> 36:47.800] Okay, good. I am close to having the technology to put together this electronic lawyer. [36:47.800 --> 36:56.800] We're putting together the final pieces right now. The other guy who was at the court yesterday, that's my programmer. [36:56.800 --> 37:06.800] And they threw his five-year-old son out of the court because he was using a little iPad. [37:06.800 --> 37:15.800] And the bailiff said that that was capable of recording audio and video, so he threw him out of the courtroom. [37:15.800 --> 37:19.800] He'll be going after him about that, but we have this tool almost ready. [37:19.800 --> 37:32.800] So, the documents that you have written, I want to take those and turn them into a set of procedures. [37:32.800 --> 37:42.800] And anybody else who's constructing documents to address issues, I'm going to want those documents and how you got there. [37:42.800 --> 37:46.800] So, we'll start putting together a set of procedures. [37:46.800 --> 37:51.800] And I don't even care if your procedures are all wrong. [37:51.800 --> 37:56.800] What I'll do is we'll make a map of the procedures that we go through. [37:56.800 --> 38:09.800] And we have a structure. You know, Sigmund Freud, he was a psychiatrist, and he popularized Freudian psychology. [38:09.800 --> 38:13.800] It was wacko. It was pretty well nuts. [38:13.800 --> 38:18.800] And they have, for the most part, eliminated Freud. [38:18.800 --> 38:24.800] But Freud had mentored this map of a living mind. [38:24.800 --> 38:29.800] That was a not-so map because what Freud proposed was pretty wacko. [38:29.800 --> 38:33.800] And they finally threw out Freud, but they also threw out the map. [38:33.800 --> 38:39.800] And he just kept the map because we can look at the map and say, well, here it seems to be accurate, here it's not. [38:39.800 --> 38:49.800] We throw out what's not right, and we make adjustments, and we build something that another person could come and look at and make sense of. [38:49.800 --> 38:57.800] Well, that's what I'm trying to do with law, is we build a set of procedures. [38:57.800 --> 39:05.800] And then as we find the courts rule against certain things and tell us why they rule against it, we make adjustments. [39:05.800 --> 39:15.800] As we work through this, and I have some technologies to develop those procedures, we'll begin to build some really effective tools where you could just go on the internet, [39:15.800 --> 39:20.800] answer a bunch of questions, hit the button, and it'll start burping out documents. [39:20.800 --> 39:24.800] So that I'm going to want from you, Scott. [39:24.800 --> 39:28.800] Well, luckily, you have a pretty well... What are you talking about? [39:55.800 --> 40:03.800] Oh, notice avoid judgment. Addison, Michelle were brought upon the court, and they go through there and reflect everything. [40:03.800 --> 40:14.800] Oh, okay. Well, if it's a notice, then there's no... it doesn't compel a response. [40:14.800 --> 40:19.800] So that may be why you didn't get a response. [40:19.800 --> 40:26.800] Now, what's the legal basis of the notice? What can we do with that? [40:26.800 --> 40:27.800] Well... [40:27.800 --> 40:32.800] Okay, point is, why did you send it? [40:32.800 --> 40:41.800] To tell them that if they issued any kind of warrant or made any extra decision to terminate them, [40:41.800 --> 40:48.800] that it was considered a harm and harm to me and harm to my household. [40:48.800 --> 40:51.800] Oh, that's a tort letter. [40:51.800 --> 40:53.800] Yeah. [40:53.800 --> 41:01.800] But the problem with it is, it's a tort, but it's a notice that if you do something, it will be a tort. [41:01.800 --> 41:02.800] Right. [41:02.800 --> 41:05.800] We'll work out these procedures. [41:05.800 --> 41:06.800] Yeah. [41:06.800 --> 41:12.800] We can just read it on the air, but yeah, it goes into the fraud, it lists everything out, [41:12.800 --> 41:22.800] and it notices them as they start any more action that it's going to result in a civil lawsuit. [41:22.800 --> 41:26.800] So that can be construed as notice of tort. [41:26.800 --> 41:28.800] Let me go ahead and sue them. [41:28.800 --> 41:30.800] Oh, this can be fun. [41:30.800 --> 41:38.800] One of the things I want to get built are a set of lawsuits that we can file. [41:38.800 --> 41:43.800] We go through these things and we talk about what's wrong. [41:43.800 --> 41:51.800] And what I want to start talking about, when we talk about what's wrong, we also want to talk about the remedies. [41:51.800 --> 41:54.800] What remedies do we have available? [41:54.800 --> 42:03.800] I'm building a questionnaire for traffic right now, and the first part of it is subject matter jurisdiction. [42:03.800 --> 42:08.800] How do they get subject matter jurisdiction? [42:08.800 --> 42:15.800] And we go through and ask these questions, and if they, we ask questions that go to legal points, [42:15.800 --> 42:23.800] and when they respond to it, we say, okay, here's what they did wrong, and here's the remedy. [42:23.800 --> 42:32.800] The officer wrote a citation because your plates were expired, but your plates were out of Virginia. [42:32.800 --> 42:39.800] We tampered with the government document, aggravated perjury, official oppression, [42:39.800 --> 42:47.800] motion to strike the complaint as insufficient, there was something else. [42:47.800 --> 42:55.800] But everything that goes to a remedy, we put in our T-close complaint against the officer, [42:55.800 --> 43:03.800] and we use the facts we developed to get there to populate the complaint. [43:03.800 --> 43:09.800] So as we move through these questionnaires, everywhere there's something done wrong, [43:09.800 --> 43:16.800] we developed the remedies for it and spit out documents to address those remedies. [43:16.800 --> 43:21.800] So that's what I'm going to want to do with what's going on with you, Scott. [43:21.800 --> 43:28.800] We keep everything, we get it all organized, and then we will use it to develop a set of practices [43:28.800 --> 43:32.800] and procedures where we can wind these guys' clocks. [48:00.600 --> 48:05.920] Nobody has any of these records, blah, blah, blah, but the district attorney signed it. [48:05.920 --> 48:13.000] So I was just wondering, do I have to fool you, the district attorney's office specifically [48:13.000 --> 48:17.080] on this boy request that, or can it... [48:17.080 --> 48:22.640] No, the district attorney is not a repository for official documents. [48:22.640 --> 48:27.240] Okay, hold on, let me just take a step back. [48:27.240 --> 48:39.000] In the Brady, are you asking for the documents that would go to a officer who was not fit [48:39.000 --> 48:41.120] to be brought before court on appeals? [48:41.120 --> 48:44.440] All right, here's the three questions on the boy. [48:44.440 --> 48:50.400] One is, any and all evidence relating to any officer with the authority to enforce federal [48:50.400 --> 48:57.680] traffic laws has been certified and appointed by sworn elected sheriff as mandated by code? [48:57.680 --> 49:04.240] Two, the first two are kind of, you know, really working them up, but second, any and [49:04.240 --> 49:10.320] all evidence relating to an officer absent credibility, therefore unable to testify [49:10.320 --> 49:12.440] before his superior court? [49:12.440 --> 49:18.680] Three is the biggie, any and all evidence of the Brady List training schedule date, [49:18.680 --> 49:24.480] policy requirements for training and certification, and last known completed date of training [49:24.480 --> 49:31.560] five prosecutors instructing police on the limitations and potential constitutional violations [49:31.560 --> 49:33.360] of the Brady policies. [49:33.360 --> 49:47.920] Okay, that implies that there is some statutory or administrative requirement for the someone [49:47.920 --> 49:49.760] to hold this kind of training. [49:49.760 --> 49:52.400] Do you have something on that? [49:52.400 --> 49:59.440] I have, we'll see on this one, it just said I addressed it to the court clerk, and they [49:59.440 --> 50:04.000] didn't know if the special patients go to county clerk or district clerk, neither court [50:04.000 --> 50:10.880] clerk has or maintains any such records, either do the police, because they, one got sent [50:10.880 --> 50:16.560] to the police and they said they don't maintain any records, nor does the county district [50:16.560 --> 50:17.560] attorney. [50:17.560 --> 50:22.200] He admitted they don't, but normally what I did is I readdressed them all to the district [50:22.200 --> 50:23.200] attorney specifically. [50:23.200 --> 50:26.440] Okay, wait a minute, that wasn't my question. [50:26.440 --> 50:27.440] Okay. [50:27.440 --> 50:34.360] Is, is there some requirement that these officers have this kind of training? [50:34.360 --> 50:40.360] Yeah, they're supposed to be in compliance with the Brady policy and the Brady policy [50:40.360 --> 50:42.160] mandates that they should have. [50:44.440 --> 50:48.040] The issue I'm having here is you're making proactive statements of law out of your own [50:48.040 --> 50:49.040] mouth. [52:15.640 --> 52:25.640] This is a conscious indifference at best, deliberate negligence or contrived negligence [52:25.640 --> 52:26.640] at worst. [52:26.640 --> 52:27.640] That's great. [52:27.640 --> 52:35.440] Supervisory neglect, supervisory neglect that the county judge and all his little underlings [52:35.440 --> 52:40.000] in their various, in their vicarious and strict liability. [52:40.000 --> 52:46.240] And this is administrative, it's not judicial, so they don't have any immunity. [52:46.240 --> 52:47.240] Right. [52:47.240 --> 52:53.240] See, and here's how the breakdown on the, on the vicarious and strict liability works. [01:21:36.640 --> 01:21:49.640] That is probably, okay, I had someone mentioned this recently and I looked it up and there really is statutory law supporting pre-trial diversion, [01:21:49.640 --> 01:21:55.640] especially with a family law issue. [01:21:55.640 --> 01:21:59.640] This could really haunt you. [01:21:59.640 --> 01:22:08.640] If you could get a diversion and it actually be expunged, it would be of great benefit. [01:22:08.640 --> 01:22:16.640] Because if that stays on your record, any family law issue, they're going to assume family violence. [01:22:16.640 --> 01:22:22.640] I have a couple of friends who's been through this issue and it really haunts them. [01:22:22.640 --> 01:22:29.640] And it's extremely difficult for them to get work with that on their record. [01:22:29.640 --> 01:22:41.640] When an employer sees family law, he sees a family violence, that throws up a real red flag. [01:22:41.640 --> 01:22:50.640] So if you can get a diversion, it's my opinion you should certainly look at it. [01:22:50.640 --> 01:22:53.640] Okay. [01:24:35.640 --> 01:24:36.640] I don't know. [01:24:36.640 --> 01:24:41.640] He was doing construction in the yard that day, so he could have been hurt by something else. [01:25:44.640 --> 01:25:51.640] I had touched the oven grate, and as he was coming out berating and ranting and raving, he was upset. [01:25:51.640 --> 01:25:55.640] You never know if he has a tool on him or what was on him. [01:25:55.640 --> 01:25:59.640] He carries a gun half the time around the house. [01:25:59.640 --> 01:26:03.640] He's very happy that Texas has a non-concealed weapon now. [01:26:03.640 --> 01:26:12.640] I picked up the oven grate to protect myself from him because he usually comes at me and I fell backward. [01:26:12.640 --> 01:26:16.640] He says I hit him with the oven grate, but I did not. [01:26:16.640 --> 01:26:23.640] I'm protecting myself from him because I never know what he's going to do. [01:26:23.640 --> 01:26:33.640] This is a toxic relationship. [01:26:33.640 --> 01:26:42.640] This is a problem because if you try to fight it, the courts are just corrupt. [01:26:42.640 --> 01:26:44.640] Especially when it comes to family at all. [01:26:44.640 --> 01:26:49.640] I went to Australia and did some seminars down there. [01:26:49.640 --> 01:26:56.640] When I got off the airplane, Joe was over and we were about to cross the Sydney Bay Bridge. [01:26:56.640 --> 01:27:09.640] There are cop cars everywhere and some guy up on the bridge has laid out this huge banner telling about how corrupt the family courts are. [01:27:09.640 --> 01:27:12.640] It's the same everywhere. [01:27:12.640 --> 01:27:20.640] The family courts are absolutely, in my opinion, by far the most corrupt courts of all. [01:27:20.640 --> 01:27:24.640] If you expect justice in a family court, you forget that nonsense. [01:27:24.640 --> 01:27:27.640] That ain't going to happen. [01:27:27.640 --> 01:27:29.640] This is a difficult situation. [01:27:29.640 --> 01:27:36.640] You might look at some other remedies which I cannot suggest. [01:27:43.640 --> 01:27:49.640] I don't suggest that you actually tie him up in a sheet and beat him with a sack of oranges. He thinks counselors are just trying to get to money. [01:28:13.640 --> 01:28:18.640] I'm looking at politics. [01:28:18.640 --> 01:28:32.640] The politics of the situation would be such that you might consider agreeing to a deferral if the court will order counseling. [01:28:32.640 --> 01:28:41.640] Then if he doesn't show up at counseling, now the onus comes back on him. [01:28:41.640 --> 01:28:43.640] Go ahead and let him resist counseling. [01:28:43.640 --> 01:28:51.640] Then go back to the court and ask the court to hold him in contempt for not going to counseling. [01:28:51.640 --> 01:29:03.640] That way, if he tries to make accusations against you again, because the problem here is if you have this accusation hanging over you, then he can use it against you. [01:29:03.640 --> 01:29:12.640] But if you ask the court to order counseling and he doesn't show up or doesn't participate, then you go back to the court and ask for sanctions against him. [01:29:12.640 --> 01:29:24.640] Of course, it's not likely to give it, but you have it on the record that he is not actively participating in trying to cure the yields of the marriage. [01:38:29.640 --> 01:38:36.640] The charge was dismissed because the driver went to the court, [01:38:36.640 --> 01:38:39.640] went to the sheriff's office with evidence [01:38:39.640 --> 01:38:43.640] that they replaced the license plate bulbs, [01:38:43.640 --> 01:38:47.640] and the county attorney dismissed their charge [01:38:47.640 --> 01:38:57.640] two days before this felony case was presented to the VA. [01:38:57.640 --> 01:39:02.640] That means to... [01:39:02.640 --> 01:39:07.640] Okay, your son made a deal, so he got his liberty back. [01:39:07.640 --> 01:39:10.640] Now you need to reopen the case. [01:39:10.640 --> 01:39:13.640] This was another person in the household [01:39:13.640 --> 01:39:16.640] that was operating this automobile. [01:39:16.640 --> 01:39:18.640] They got their case dismissed, [01:39:18.640 --> 01:39:21.640] the county attorney signed off on it, [01:39:21.640 --> 01:39:26.640] and it very clearly states license plate lamps [01:39:26.640 --> 01:39:32.640] have been replaced satisfactorily, dismissed. [01:39:32.640 --> 01:39:37.640] Was this before your son was stopped in that vehicle, [01:39:37.640 --> 01:39:40.640] that it was dismissed? [01:39:40.640 --> 01:39:47.640] Two days, that's aggravated perjury against the officer. [01:39:47.640 --> 01:39:49.640] My suggestion? [01:39:49.640 --> 01:39:56.640] First thing you do, sue the officer. [01:39:56.640 --> 01:40:02.640] And in the lawsuit, you develop evidence that you can then take back [01:40:02.640 --> 01:40:10.640] and reopen the criminal case and move to get it to a drop. [01:40:10.640 --> 01:40:14.640] Well, you know, I still have those outstanding criminal complaints [01:40:14.640 --> 01:40:19.640] against the officer that, of course, you're very well aware of that, [01:40:19.640 --> 01:40:25.640] and the criminal complaints against the DA for failure to prosecute. [01:40:25.640 --> 01:40:32.640] And shielding prosecution, this opens up an entirely different scenario. [01:40:32.640 --> 01:40:34.640] Yes, it does. [01:40:34.640 --> 01:40:41.640] You get to sue the prosecutor because he had a statutory duty [01:40:41.640 --> 01:40:45.640] to present the complaints to some magistrate [01:40:45.640 --> 01:40:50.640] and prepare an information and present that to the grand jury. [01:40:50.640 --> 01:40:51.640] That's statutory. [01:40:51.640 --> 01:40:58.640] Yeah, well, you know, he had that obligation even without this recent information. [01:40:58.640 --> 01:40:59.640] Right. [01:40:59.640 --> 01:41:03.640] When you filed a complaint, he had no discretion. [01:41:03.640 --> 01:41:09.640] So now you have evidence to indicate that the officer committed aggravated perjury, [01:41:09.640 --> 01:41:12.640] and I suggest that you hang on to that. [01:41:12.640 --> 01:41:19.640] Whatever you do, don't wave it in front of him until you got him on the stand. [01:41:19.640 --> 01:41:22.640] I'm going to need your assistance. I thought that was really odd for him to say that he had a green tail lamp, [01:47:39.640 --> 01:47:46.640] and I wonder where did he come up with that? So apparently they did have one, but they replaced it, [01:47:46.640 --> 01:47:51.640] and you have absolute evidence that they were. [01:47:51.640 --> 01:48:03.640] Actually, that's incorrect. There was never a green tail lamp, ever. No, never. It was always white. [01:48:03.640 --> 01:48:11.640] I pulled the light bulbs out, and the manufacturer indicates that those light bulbs are white, [01:48:11.640 --> 01:48:18.640] according to the number on the bulb. So what we had there is a lying officer, pure and simple. [01:48:18.640 --> 01:48:27.640] And the fact that the other operator of that automobile went and bought new lamps, [01:48:27.640 --> 01:48:36.640] and the officer signed off that they were under, that they were proper, and according to status, [01:48:36.640 --> 01:48:46.640] and white, then he had no grounds whatsoever by his own signature for making that accusation [01:48:46.640 --> 01:48:53.640] and doing all the stuff he did, which included tasing the operator of that automobile [01:48:53.640 --> 01:49:01.640] for a allegedly green light. It's a total fabricated deal. I want this officer indicted, [01:49:01.640 --> 01:49:07.640] and I don't really care about the DA or the assistant DA. They're just a couple of punks. [01:49:07.640 --> 01:49:17.640] They will behave very nicely if they see their little punk officer arrested and indicted. [01:49:17.640 --> 01:49:21.640] Well, the way to get your... [01:49:21.640 --> 01:49:33.640] The way to get this punk officer arrested and indicted is to step right on the prosecutor's professional quote. [01:49:33.640 --> 01:49:44.640] The prosecutor you have a lot of leverage over. When you start bar-grieving him and suing him [01:49:44.640 --> 01:49:51.640] for not presenting your complaint to the grand jury the way he was statutorily required to do, [01:49:51.640 --> 01:49:57.640] that is really going to get his attention. And I would very much like to write that lawsuit. [01:49:57.640 --> 01:50:01.640] Well, you know, Randy, I have to ask you a question. [01:50:01.640 --> 01:50:07.640] I received an email from you telling me that we need to kind of tread lightly on this [01:50:07.640 --> 01:50:12.640] and kind of go easy after the prosecutor, and I didn't understand that. [01:50:12.640 --> 01:50:18.640] The prosecutor absolutely violated statute by not presenting the criminal complaint [01:50:18.640 --> 01:50:23.640] which was properly verified to the grand jury. [01:51:37.640 --> 01:51:43.640] It is their belief that if I come into their courtroom, [01:51:43.640 --> 01:51:51.640] I'm there to try to get them to not do something so that I can call the police and try to get them arrested. [01:52:12.640 --> 01:52:19.640] Once, if we do this right, you go after the prosecutor with the district judge. [01:52:19.640 --> 01:52:23.640] We take him criminal complaints against the prosecutor. [01:57:10.640 --> 01:57:19.640] The last time I went to court with someone who was called in for one of these hearings, 58 people were called in the same day. [01:57:21.640 --> 01:57:26.640] They finally called up Ernie and I walked up with him and the bailiffs come running over, oh, wait, wait, wait, wait. [01:57:58.640 --> 01:58:11.640] I went back to the judge when the judge at the next hearing and gave the judge a criminal complaint with 58 counts of state jail felony [01:58:11.640 --> 01:58:15.640] assimilating the legal process against the lawyer.
