[01:29.360 --> 01:32.600] Some of the messages recovered from the account concerning Etchenwald stated that, I know [01:32.600 --> 01:37.200] he has epilepsy, I hope this sends him into a seizure, and let's see if he dies. [01:37.200 --> 01:41.040] In charging Reveal with cyber-stalking, the FBI concluded that the tweet had been sent [01:41.040 --> 01:45.560] with the intent to kill, injure, harass, and intimidate, and today, Monday, a Dallas County [01:45.560 --> 01:49.760] grand jury indicted Reveal stating that he knew Etchenwald was susceptible to epileptic [01:49.760 --> 01:54.920] seizures and used them as a deadly weapon, that is, the animated images in the tweet [01:54.920 --> 01:55.920] to assault him. [06:07.640 --> 06:11.960] When we get into something really complex, we've got a lot of things going on, it's [06:11.960 --> 06:17.120] sometimes hard to keep all the balls in the air. [08:28.360 --> 08:34.440] So I'm not directly arguing the right to travel. [08:34.440 --> 08:45.000] I'm challenging the authority of the jurisdiction to interfere with me. [08:47.840 --> 08:53.320] If I argue the right to travel, I have to prove it but if I argue their authority and [08:53.320 --> 08:58.120] the sufficiency of the complaint and they have to prove it up. [08:58.120 --> 09:04.760] And this argument said, this particular one says that there is no evidence before the [09:04.760 --> 09:13.200] court that the jurisdiction has authority to enforce the transportation code and there [09:13.200 --> 09:19.480] is no evidence in the court that the officer is authorized to enforce the transportation [09:19.480 --> 09:26.560] code and there is no evidence in the court that establishes that I fall within the statutory [09:26.560 --> 09:31.120] scheme. [09:31.120 --> 09:36.120] It's different than arguing your right to travel. [09:36.120 --> 09:42.480] You're arguing their ability to enforce against you. [09:42.480 --> 09:44.840] They have to prove it up. [09:44.840 --> 09:48.680] So it kind of turns the tables on them. [09:48.680 --> 09:52.000] We've actually been winning with these here in Texas. [12:25.520 --> 12:30.560] If a complaint is filed with the magistrate in accordance with law, the clerk is required [12:30.560 --> 12:37.880] to give the complaint to the judge, but they also always, even though they're not required [12:37.880 --> 12:43.080] to, they give the complaint to the prosecuting attorney as opposed to counsel. [12:43.080 --> 12:50.640] So when the prosecutor gets that complaint, the complaint is intended to be written by [12:50.640 --> 12:54.360] a ordinary citizen. [12:54.360 --> 12:58.960] If the police officer, when he writes that complaint, he does not do so in his capacity [12:58.960 --> 13:01.200] as a peace officer. [13:01.200 --> 13:08.840] He does so in his capacity as a private citizen and then he presents it to a magistrate. [13:08.840 --> 13:14.520] The magistrate sends it to the prosecutor or to the trial court and then the trial court [13:14.520 --> 13:21.640] sends one to the prosecutor and the prosecutor looks at it at the complaint and has to take [13:21.640 --> 13:27.520] that complaint and convert and prepare an information. [13:27.520 --> 13:31.960] An information looks just like a complaint. [13:31.960 --> 13:36.560] It is a complaint in proper form. [13:36.560 --> 13:43.440] Since complaints are intended to be filed or written by individuals, ordinary non-professional [13:43.440 --> 13:53.200] individuals, when it's presented to the court, the prosecutor is to convert it into an information [13:53.200 --> 13:59.400] and an information is a complaint in the proper form. [13:59.400 --> 14:04.360] So you look in the record and find a couple of informations and just take out the spot [14:04.360 --> 14:07.920] where it says information and replace it with complaint. [15:29.200 --> 15:34.600] He is required to give notice to the attorney general. [15:34.600 --> 15:39.240] And then you wait a couple of weeks and you send a letter to the attorney general asking [15:39.240 --> 15:47.760] for a copy of the notice that the attorney general received from this FBI agent subsequent [15:47.760 --> 15:51.880] to your criminal complaint against whoever. [15:51.880 --> 15:56.040] Last one I did that with, I got no response. [15:56.040 --> 16:00.560] Now I'm going to file against the attorney general for violating the Freedom of Information [16:00.560 --> 16:10.480] Act and against this special agent in charge for not forwarding my complaint or giving [16:10.480 --> 16:14.760] notice to the attorney general. [16:14.760 --> 16:18.760] Fail to perform a duty he is required to perform. [16:18.760 --> 16:22.800] And the original complaint against the federal judge I'm filing against. [20:41.640 --> 20:48.640] When he has knowledge that a public official has committed a crime he must give notice to the Attorney General. [20:48.640 --> 20:57.640] I don't see anything in that code that exempts the U.S. Attorney from that requirement. [20:57.640 --> 21:06.640] So when I filed with the U.S. Attorney I sent another for you and asked for a copy of the notices that the U.S. Attorney sent them. [21:06.640 --> 21:19.640] And when I get back the letter that says we have no record responsive to your request we've sponsored all then I file against the U.S. Attorney under FOIA. [21:19.640 --> 21:30.640] But if I got responses then I file against the U.S. Attorney and the SAC and the original person with the grand jury. [21:30.640 --> 21:42.640] Because when you file with the federal grand jury you just send a certified mail address to the former of the grand jury at the U.S. Attorney's address. [21:42.640 --> 21:52.640] I'd like to send it registered restricted so only the person whose name can sign for it and I name the former of the U.S. grand jury. [21:52.640 --> 21:56.640] Well the kind of mail room is going to get signed for it. [21:56.640 --> 22:01.640] And then he's going to send it and put it on the prosecutor's desk and the prosecutor's going to open it. [22:01.640 --> 22:13.640] And now he's looking at a document addressed to the former of the grand jury that has criminal complaints against him in there. [22:13.640 --> 22:17.640] Now that's when he'll realize you're setting him up. [22:17.640 --> 22:20.640] Because now he just stepped in it deep. [22:20.640 --> 22:28.640] Now when the U.S. Attorney contacts you and says he either threatens you, that's what they did to me in Fort Lauderdale, [22:28.640 --> 22:35.640] or tells you he's not going to pursue prosecution or you don't hear anything back from him. [22:35.640 --> 22:41.640] Then you file a criminal complaint with the U.S. Attorney General in D.C. [22:41.640 --> 22:48.640] Now the likelihood of you getting this U.S. Attorney fired is somewhere between little and not. [22:48.640 --> 22:56.640] You're just a chump pro se out here in Bow Dump, Georgia. [22:56.640 --> 23:09.640] What you're going to do is give the Attorney General a reason to accept the resignation of this U.S. Attorney. [25:22.640 --> 25:35.640] Do you think that after filing criminally with the SAC, with the local grand jury, which I'm assuming is the federal grand jury? Is that correct? [25:35.640 --> 25:38.640] Yeah, I'm talking federal. [25:38.640 --> 25:39.640] Yeah. [25:39.640 --> 25:46.640] There are some issues with the Georgia grand jury if I remember right. [25:46.640 --> 25:52.640] Do you know what the law is concerning grand jury duties in Georgia? [25:52.640 --> 25:54.640] No, I don't. [25:54.640 --> 26:06.640] Okay, and there will be a statute that specifically stipulates their duty. Do you have grand jury sitting all the time in Georgia? [26:06.640 --> 26:08.640] That I did, I know. [26:08.640 --> 26:17.640] Okay, you need to read that in your criminal procedure code, there's going to be a section on grand juries and it's not going to be very big. [26:17.640 --> 26:33.640] In Texas, we've got chapter 19 and 19, 20 and 21 and both of them, all three of them only have about 20 issues in each one, so they're not very big. [26:33.640 --> 26:43.640] And in the middle one, the one that goes to duties of officers, there's only about three or four in there you even care about. [26:43.640 --> 26:53.640] Some of them are just technical stuff. The one you really want to look at is the one that defines the duties of the grand jury. [26:53.640 --> 27:09.640] What it says in Texas, it shall be the duty of the grand jury to examine into all crimes subject to indictment that come to their knowledge by way of any member of the grand jury, [27:09.640 --> 27:14.640] any attorney or any other credible person. [27:14.640 --> 27:19.640] And that last part is the part you want to see. [27:19.640 --> 27:37.640] In the Fed and in Colorado that I know of and several other states I've seen, it says the grand jury shall investigate into all crimes subject to indictment that come to their knowledge by whatever means. [27:37.640 --> 27:48.640] So the first thing you want to know is what the duty of the grand jury is and what it says about getting to the grand jury. [27:48.640 --> 27:56.640] You can do anything that you are not statutorily forbidden to do. [27:56.640 --> 28:12.640] So look for anything you may be forbidden to do. If it's not in that code and somebody tells you otherwise, that's tampering with the witness, obstruction. [28:12.640 --> 28:23.640] If they tell you you have to take your complaint to the prosecuting attorney, I ask them, would you come up with that? [28:23.640 --> 28:29.640] I looked all through the code and I don't see anything that directs a complaint to the prosecuting attorney. [28:29.640 --> 28:34.640] I see something that directs complaints against public officials to the grand jury. [28:34.640 --> 28:38.640] I don't see anything directed under the prosecuting attorney. [28:38.640 --> 28:42.640] So do you just make that up? [28:42.640 --> 28:46.640] The following policy. [28:46.640 --> 28:53.640] And you want to challenge on that. So you need to look at Georgia Law and see what it says about how to get to a grand jury. [28:53.640 --> 28:57.640] And that'll tell you how to go after them. [28:57.640 --> 29:06.640] And like I said earlier, it's not so much that you actually get to a grand jury. [29:06.640 --> 29:15.640] Just making grand jury noises is going to terrify. There's one more question that listening to you that sort of gave me, [33:54.640 --> 34:02.640] and it was on filing a complaint on the court reporter, [34:02.640 --> 34:13.640] and this is this judge's court reporter who failed to give me the open records request on the audio recording, [34:13.640 --> 34:18.640] which in Georgia it's a public record, and she's the custodian of that record, [34:18.640 --> 34:26.640] and she never replied, never answered, and so I was thinking if I file a complaint against her [34:26.640 --> 34:37.640] and go on a date when that judge has emotions and take the red folder and go give him the complaint against her, [34:37.640 --> 34:41.640] do you think that would stir the pot? [34:41.640 --> 34:50.640] Oh, that would definitely stir the pot, and then you could, because you know the judge is going to follow [34:50.640 --> 34:57.640] their standard procedure and refuse to hold an examining trial. [34:57.640 --> 35:03.640] Now you can claim that since the statute requires him to hold an examining trial, [35:03.640 --> 35:13.640] that he failed to hold the examining trial as retaliation against you. [35:13.640 --> 35:19.640] Now it may not have been retaliation, but you don't really care. [35:19.640 --> 35:22.640] The first rule is everything is political. [35:22.640 --> 35:29.640] The second rule is perception is everything. [35:29.640 --> 35:35.640] So whether he actually did it for that reason or not, you'd make it look like it. [35:35.640 --> 35:40.640] And further poison is well. [35:40.640 --> 35:48.640] And subsequent file against him for not acting on the complaints against the court reporter. [35:48.640 --> 35:50.640] That would definitely stir the pot. [35:50.640 --> 35:54.640] You're saying you're in the superior court. [35:54.640 --> 36:00.640] The court that you appeal to from the misdemeanor court? [36:00.640 --> 36:02.640] Yes. [36:02.640 --> 36:08.640] Yeah, when I requested the jury trials, since they don't have jury trials in Magistrate Court in Georgia, [36:08.640 --> 36:13.640] they kicked me up to the superior court. [36:13.640 --> 36:18.640] Oh, so this is the first hearing on this issue? [36:18.640 --> 36:20.640] Yes. [36:20.640 --> 36:25.640] Oh, well, that's interesting. [36:25.640 --> 36:40.640] In Georgia, is an appeal from a justice court an appeal trial de novo? [36:40.640 --> 36:45.640] Yes, in the Magistrate Court, they don't keep any kind of record. [36:45.640 --> 36:48.640] Okay, so it's trial de novo. [36:48.640 --> 36:51.640] So now you're before the district court. [36:51.640 --> 36:55.640] Is this court keeping a record? [36:55.640 --> 36:57.640] Yes, yes, the superior court. [36:57.640 --> 37:01.640] Definitely they record everything. [37:01.640 --> 37:08.640] Okay, that seems to create a conflict. [37:08.640 --> 37:10.640] How so? [37:10.640 --> 37:23.640] Your first hearing in a classy misdemeanor is before an inferior court and you have a right to appeal de novo. [37:23.640 --> 37:26.640] So you don't have to appeal on writ of error. [37:26.640 --> 37:29.640] It's a do over. [37:29.640 --> 37:39.640] But now they put you in a position to where that you don't get a do over on that first hearing. [37:39.640 --> 37:42.640] How did they get this to a district court? [37:42.640 --> 37:51.640] How did a district court get jurisdiction? [37:51.640 --> 38:02.640] They would probably say that this superior court has the authority or the capacity to hear any case in Georgia. [38:02.640 --> 38:04.640] No, they don't. [38:04.640 --> 38:11.640] Justice of the peace and municipal court, inclusive original jurisdiction on classy misdemeanors. [38:11.640 --> 38:15.640] It's just weighing about every state. [38:15.640 --> 38:24.640] That justice of the peace is an elected official and the justice stands separate from the other officials. [38:24.640 --> 38:30.640] And classy misdemeanors are strictly her jurisdiction. [38:30.640 --> 38:36.640] So how does this superior court get jurisdiction? [38:36.640 --> 38:44.640] Now they can get it on an appeal, but you're not appealing. [38:44.640 --> 38:46.640] I'm not sure. [38:46.640 --> 38:59.640] All that I know is that when I asked for a jury trial, I never really had a hearing of any kind in the lower court. [38:59.640 --> 39:06.640] Magistrate court, they just send everything up to the superior court. [39:06.640 --> 39:09.640] Oh, this sounds like fun. [39:09.640 --> 39:22.640] You might want to do a little research on subject matter jurisdiction and go in and file a challenge to the subject matter jurisdiction of this court. [39:22.640 --> 39:31.640] If you lost in the JP court and it was appealed, where would it appeal to? [39:31.640 --> 39:36.640] Superior court. [39:36.640 --> 39:41.640] So they denied you a trial in the JP court. [39:41.640 --> 39:56.640] Now, isn't there a provision in law that denies you a jury trial and a classy misdemeanor? [39:56.640 --> 40:06.640] And my producer tonight is from Georgia. If he's listening, he might whisper in my ear if he knows. [40:06.640 --> 40:09.640] Yeah, I don't know that. [40:09.640 --> 40:16.640] This is an interesting issue. How does that court get original jurisdiction? [40:16.640 --> 40:30.640] You had a right to a trial, a not-identical trial before an inferior court that would give you the opportunity to file a trial de novo so you don't have to file on a written error. [40:30.640 --> 40:36.640] They've taken that right away from you simply because you asked for a jury trial. [40:36.640 --> 40:50.640] So you might look at the code. If there's nothing supporting that, then you file a challenge subject matter jurisdiction in this court and force them to bump it back down to the JP court. [40:50.640 --> 41:00.640] That is depending on what you intend, what you want to do. What do you want to happen in this case? [41:00.640 --> 41:09.640] I want the thing dismissed so that I can file for false arrest. [41:09.640 --> 41:23.640] So you can file a challenge to subject matter jurisdiction claiming that this court never had subject matter jurisdiction in the matter. [41:23.640 --> 41:30.640] It's a good chance rather than have to redo, a good chance you'll get them to dismiss. [41:30.640 --> 41:36.640] And you can include in there a motion to dismiss for denial of due process. [41:36.640 --> 41:49.640] And if they want to just get rid of the case, they can take that motion and grant it and throw the whole thing out and save face. [41:49.640 --> 41:55.640] I understand the politics of this. [41:55.640 --> 42:00.640] At the end of the day, it's not about the laws, it's about the politics. [42:00.640 --> 42:06.640] They're in a fight with you and you're pushing them, they tend to push back. [42:06.640 --> 42:13.640] So how do you give them a way to walk away? [42:13.640 --> 42:18.640] You give them a motion, they can grant. [42:18.640 --> 42:39.640] I was hoping that the prosecutor would just dismiss this because in the rules that govern or they give their mission statement and govern the prosecutors, the district attorney, [42:39.640 --> 42:47.640] it actually says that their objective and goal is to seek justice, not to pad their record. [42:47.640 --> 42:56.640] And so if I've given the prosecutor this taking away the probable cause because nothing fell off my trailer, [42:56.640 --> 43:04.640] then the prosecutor in the goal of seeking justice no matter who wins, she should dismiss the thing. [43:04.640 --> 43:08.640] And if not, I would think that could be malicious prosecution. [43:08.640 --> 43:12.640] Well, it grounds for appeal, certainly. [43:12.640 --> 43:18.640] But keep in mind, everything in the trial court is about setting the record for appeal. [43:18.640 --> 43:26.640] But I'm looking at how does this Superior Court get jurisdiction just because you asked for a jury trial. [43:26.640 --> 43:42.640] So there may actually be a code that says if a defendant requests a jury trial, the case shall, the venue shall be removed to the district court, the Superior Court, one of the courtes. [43:42.640 --> 43:47.640] There might be a statute of that effect, but I doubt it. [43:47.640 --> 43:57.640] And if there's not, this court can't have jurisdiction. What I was going to say when we went out is you might challenge their jurisdiction and claim that this court doesn't have jurisdiction and put in a motion to dismiss, give the prosecutor something that he can use as an excuse to dismiss the case. [46:46.640 --> 46:51.640] He's not likely to dismiss unless you ask him to. [46:51.640 --> 47:12.640] And if you challenge jurisdiction here, but obviously first we need to look at Georgia law and see if there's some provision that transfers jurisdiction when you ask for a jury trial, although I can't, I've never heard of that before. [47:12.640 --> 47:25.640] But if it's not there, then you won't know how this court got jurisdiction and the courts are not going to want you to interfere with their ability to do this. [47:25.640 --> 47:51.640] So they're not going to want to grant you this motion, but if you put this one in there and then come up with another one that's easier for them to dismiss on, then the prosecutor may take it and dismiss it and end all these problems. [47:51.640 --> 48:02.640] I would hope so. The prosecutor already said that she was not going to dismiss it and she was going to recommend putting me in jail. [48:02.640 --> 48:12.640] Well, okay, you don't care what she does. You're going to recommend she be disbarred. [48:12.640 --> 48:18.640] So how does that work for you? Have you grieved this lawyer? [48:18.640 --> 48:25.640] Yeah, yeah, I've got four on her and then I got four on the other guy before her. [48:25.640 --> 48:33.640] Good, good. And this doesn't sound like a case they can win in court. [48:33.640 --> 48:36.640] And they probably know that. [48:36.640 --> 48:45.640] And generally when they knuckle under is when you're standing on the courthouse steps waiting for the trial to start. [48:45.640 --> 48:49.640] So I wouldn't worry about it until I was there. [48:49.640 --> 48:57.640] And in the meantime, it doesn't matter what the prosecutor says when you start. [48:57.640 --> 49:16.640] Wait a minute, hold on. Is this prosecutor and assistant county attorney? [49:16.640 --> 49:28.640] Since the JP, okay, does the same prosecutor prosecute in the justice of the peace court? [49:28.640 --> 49:38.640] In the lower court, the officer usually act as the prosecutor and in the superior court, the district attorney's office takes over. [49:38.640 --> 49:54.640] You really need to challenge subject manager restriction in this case, this court. Get this back down to the JP court where you don't have a prosecutor standing in your face. [49:54.640 --> 49:59.640] It's between you, the judge and the officer. [49:59.640 --> 50:09.640] So do you think I should wave my right to a jury trial? [50:09.640 --> 50:23.640] Well, you need to look at the law, but I can't imagine a statute that would deny the court subject matter jurisdiction because you asked for a jury trial. [50:23.640 --> 50:26.640] That don't make sense. [50:26.640 --> 50:38.640] It's really strange because in Georgia, they consider all of these little tic-tac misdemeanors as a crime that can have up to a year in jail penalty. [50:38.640 --> 50:43.640] And you would think that you should be able to get a trial by jury. [50:43.640 --> 50:45.640] Yes. [50:45.640 --> 50:57.640] And for them to kick you to a different court, if there is no specific statute authorizing that, then absolutely challenge subject matter jurisdiction. [50:57.640 --> 51:06.640] Subject matter jurisdiction can be challenged at any time, no matter how remote in history. [51:06.640 --> 51:23.640] I would definitely take that tact. Other than that, it sounds like you have a really good case and I would definitely want a jury to see this because you're driving down the road with a piece of equipment chained to your trailer. [51:23.640 --> 51:37.640] And it's on your trailer where you put it. And a police officer subjects you to a year in prison because he doesn't like the way you chained it? [51:37.640 --> 51:53.640] Well, yeah. One year for each offense. So you got the bald tire. I mean, the judge, I mean, he threatened me quite close to a dozen times, oh, I'm going to put you in jail for three years. [51:53.640 --> 52:08.640] And of course, he's bluffing. He wants me to separate from my money. But still, bald tire, only one chain instead of two, and then not giving him my license as soon as he wanted me to. [52:08.640 --> 52:11.640] And so they're just trying to... [52:11.640 --> 52:18.640] Does the statute specifically require two chains? [52:18.640 --> 52:36.640] No, it doesn't mention anything. It just says verbatim that the load on such vehicle is adequately secured to prevent the dropping or shifting of such load onto the roadway. [52:36.640 --> 52:50.640] It says nothing about chains. All that stuff is, actually, that's a commercial driver's license code for some trucker to have a certain number of restraints. That's something... [52:50.640 --> 53:09.640] Okay, that should definitely get a challenge to the applicability of the code. Have you read the transportation code for Georgia? [53:09.640 --> 53:12.640] Not the whole thing. [53:12.640 --> 53:26.640] You need to get it and read it. You need to see what the enacting clause is. You need to see what this code applies to. All of this is pretty much going to be in the front. [53:26.640 --> 53:41.640] But they're looking at trying to put you in jail for three years. You really need to read that transportation code real careful because we know the transportation code doesn't apply to you. [53:41.640 --> 53:54.640] You read the one through Texas and you'll think you've stepped through the looking glass because they very specifically define who can enforce it and who can't. [53:54.640 --> 54:07.640] They very specifically stipulate what jurisdictions can enforce it and which ones can't. So you need to see what is in Georgia law. [54:07.640 --> 54:09.640] Okay. [54:09.640 --> 54:21.640] You need to see what is there to give you, to give them jurisdiction to bring you within the statutory scheme. [54:21.640 --> 54:33.640] This is a licensed profession. You know, I'm a chauffeur. I've got a chauffeur's license in my pocket. [54:33.640 --> 54:44.640] I don't chauffeur people, but I could. So that falls under a professions code. The transportation code is a professions code. [54:44.640 --> 54:52.640] So how do they get you into the profession? You know, when I get pulled over, I don't want to give them my ID. [54:52.640 --> 55:01.640] I mean my driver's license because I tell them, you know, I have one, but I'm not using it right now. [55:01.640 --> 55:03.640] That's what I told you. [55:03.640 --> 55:14.640] So do you need to look carefully at the transportation code for Georgia and see what it actually says? [55:14.640 --> 55:28.640] That is the absolute first place you should go and you want to create a circumstance where the court runs the risk of getting a ruling against them [55:28.640 --> 55:37.640] that would shut down all of their traffic ticket tax collection. [55:37.640 --> 55:39.640] Their major beer farm. [55:39.640 --> 55:43.640] Yeah, they don't want that bad case law. [55:43.640 --> 55:59.640] There's a jazz, a nonsky case out of Minnesota over foreclosure issues where they filed on the last day. They had three years to file a rescission. [55:59.640 --> 56:07.640] They filed it on the very last day and they claimed the right to rescission, not because though the lender didn't give them a notice of right to receive, [56:07.640 --> 56:14.640] but because there were two of them there and they didn't give each one a notice. [56:14.640 --> 56:18.640] That was the most nitpicking complaint I could think of. [56:18.640 --> 56:31.640] And Wells Fargo let that issue get to the U.S. Supreme and the Supreme dropped the sky on them. [56:31.640 --> 56:39.640] Big time, they should have paid that out, made a deal, dropped a case, something. [56:39.640 --> 56:53.640] That had, that was potentially such a dangerous ruling, they should never have a risk getting that ruling because now we've got people cramming it down their throats every day. [56:53.640 --> 57:01.640] Ibanez in Massachusetts, they should never have allowed that to get to the Supreme. [57:01.640 --> 57:12.640] You need to raise an argument that they're going to look at it and say the last thing we want is a court of appeals to rule that he's right. [57:12.640 --> 57:17.640] Then we might as well fire all of our traffic cops. [57:17.640 --> 57:25.640] So, see if you can find an argument that they do not want you to bring before a court of appeals. [57:25.640 --> 57:28.640] Does that make sense? [57:28.640 --> 57:29.640] Yeah, yeah. [57:29.640 --> 57:39.640] I've definitely got a lot of stuff that I can do and I've definitely got some homework. [57:39.640 --> 57:40.640] Okay. [01:04:24.640 --> 01:04:28.640] He ran in the hood until all of a sudden they came with the dogs, [01:04:28.640 --> 01:04:30.640] found him, and then the rest of them. [01:04:30.640 --> 01:04:34.640] Meanwhile, he had a friend in the car who had a warrant. [01:04:34.640 --> 01:04:38.640] And when the officers came over to talk to her while he was still here, [01:04:38.640 --> 01:04:42.640] she had made mention of a gunman in the street. [01:05:12.640 --> 01:05:15.640] So I wasn't there, so I don't know if they already searched the car, but she told him what was in there. [01:05:15.640 --> 01:05:18.640] The car was not registered to him. [01:05:18.640 --> 01:05:23.640] And so they had towed the car, which I didn't know if that was legal at the time, [01:05:23.640 --> 01:05:25.640] arrested him. [01:05:25.640 --> 01:05:28.640] So now he's been sitting in jail and he's trying to get out. [01:05:28.640 --> 01:05:31.640] They got an $80,000 bail on him. [01:05:31.640 --> 01:05:37.640] What they charged him with was to deliver, it was like drugs. [01:05:37.640 --> 01:05:41.640] And since there was two guns running under the seat [01:05:41.640 --> 01:05:43.640] and Wunder was on him when he ran. [01:05:43.640 --> 01:05:48.640] And he tossed that somewhere in the box area there. [01:05:48.640 --> 01:05:54.640] So they charged him with two counts of a gun, which is intent to deliver. [01:05:54.640 --> 01:05:58.640] So that became what they call an enhancement, I believe, with the gun. [01:05:58.640 --> 01:05:59.640] Yes. [01:05:59.640 --> 01:06:01.640] It was a fire. [01:06:01.640 --> 01:06:02.640] Okay. [01:06:02.640 --> 01:06:06.640] So now he's sitting in there and they charged him with eluding the officer. [01:06:13.640 --> 01:06:16.640] And so that to me means you incriminate yourself. [01:06:16.640 --> 01:06:20.640] So my question is, since he's the opener, but he told him what to fight. [01:06:20.640 --> 01:06:23.640] That was all he said he said. [01:06:23.640 --> 01:06:29.640] Now, did he give up his rights when he gave them to his ID when he didn't have to talk to him at all? [01:06:29.640 --> 01:06:33.640] And also by him telling the person where to find the gun at. [01:06:33.640 --> 01:06:37.640] Did he also incriminate himself from that point on? [01:06:37.640 --> 01:06:42.640] Because we try to get him out of the motion that it was an improper arrest and all of that, [01:06:42.640 --> 01:06:44.640] due to the fact he didn't have to talk to them. [01:09:14.640 --> 01:09:16.640] Then they came down with nine years on it. [01:09:16.640 --> 01:09:20.640] Now they asked, now he's telling them, he's got seven accounts against him. [01:09:20.640 --> 01:09:23.640] He can get seven years on it if he takes the police. [01:09:23.640 --> 01:09:26.640] He's for no judge on this whole deal or anything yet. [01:50:18.640 --> 01:50:21.640] And the mayor was angry at the judge and the prosecutor, [01:50:21.640 --> 01:50:24.640] they decided they were going to dismiss my case. [01:50:24.640 --> 01:50:27.640] The prosecutor called me to make peace and, you know, [01:50:27.640 --> 01:50:30.640] trying to just do what we need to do and let's take care of this. [01:50:30.640 --> 01:50:33.640] And I'm a good person and all that. [01:50:33.640 --> 01:50:35.640] So I guess she didn't want to get a bargery. [01:50:35.640 --> 01:50:40.640] But all of a sudden, right after all that got dismissed, [01:50:40.640 --> 01:50:43.640] not to get this weird letter in the mail. [01:50:43.640 --> 01:50:48.640] And it's not from the counties where the prosecutor was prosecuting from. [01:50:48.640 --> 01:50:53.640] It's from the city, the little Long Temple city out there. [01:50:53.640 --> 01:50:57.640] And they're saying stuff that wasn't in the original charge. [01:50:57.640 --> 01:51:01.640] And they're saying failure to appear, violated promise to appear, [01:51:01.640 --> 01:51:05.640] on something that I never even, they never even asked me to appear, [01:51:05.640 --> 01:51:07.640] let alone that I agree to it. [01:51:07.640 --> 01:51:09.640] It's just the weirdest thing. [01:51:09.640 --> 01:51:12.640] The heading on the thing says, Department of Public Safety. [01:51:12.640 --> 01:51:15.640] Notice the denial of renewal of Texas driver's license. [01:51:15.640 --> 01:51:17.640] I'm not trying to renew the driver's license. [01:53:31.640 --> 01:53:39.640] They're using a fraudulent document to try to extort money out of you. [01:53:39.640 --> 01:53:42.640] So they want to play hardball? [01:53:42.640 --> 01:53:45.640] We introduce them to the deep end of the pool. [01:53:45.640 --> 01:53:51.640] If this purports to be from the DPS, [01:53:51.640 --> 01:53:59.640] then file a criminal complaint against the director of the DPS.
