[01:28.440 --> 01:30.480] This is not an exercise in finger pointing. [01:30.480 --> 01:34.520] This is an exercise in asserting the responsibility that everybody has to make sure the people [01:34.520 --> 01:37.360] of Flint have an opportunity to get back on their feet. [01:37.360 --> 01:41.240] President Obama did declare a state of emergency in mid-January and ordered federal aid in [01:41.240 --> 01:43.560] addition to the state and local response. [01:55.080 --> 01:58.920] Israel's Justice Minister Ayelet Shaked in an interview with the Washington Post stated [01:58.920 --> 02:03.880] today that, quote, in the past, we've seen European leaders speaking against the Jews. [02:30.560 --> 02:34.200] In response to comments made in recent weeks by members of Britain's Labor Party claiming [02:34.200 --> 02:38.720] that Hitler was a Zionist and previous remarks by lawmakers that Israel's population should [02:38.720 --> 02:43.560] be transported out of the Middle East to America, Shaked stated that, quote, today it is not [02:43.560 --> 02:47.920] politically correct to be anti-Semitic, but being anti-Israeli is acceptable. [04:07.160 --> 04:14.800] I don't know how to make this simple at all, but I had a call with regard to a case back [04:14.800 --> 04:17.240] in 2007. [04:17.240 --> 04:23.760] I was cultivating marijuana within the county limits and with a medical prescription. [04:23.760 --> 04:30.320] And what I was led to believe, following a name change on my electric bill, PG&E's billing [04:30.320 --> 04:35.480] department flagged their own legal department, who in turn contacted the county sheriff with [04:35.480 --> 04:37.560] a concern about my electric usage. [04:37.560 --> 04:43.000] PG&E provided the sheriff department with my bill, then the sheriff used this bill, [04:43.000 --> 04:48.200] and some photos of somebody's trash cans with stems and twigs wrapped up in a newspaper [04:48.200 --> 04:51.200] to a judge to issue a search warrant. [04:51.200 --> 04:59.040] About half a dozen sheriffs served this warrant in January of 2007 when I was away at lunch. [04:59.040 --> 05:01.960] When I returned, they searched me and my girlfriend. [05:01.960 --> 05:03.240] They let her leave. [05:03.240 --> 05:07.680] I was told I wasn't under arrest, but not allowed to leave or move around in my own [05:07.680 --> 05:08.680] home. [05:08.680 --> 05:13.040] They emptied my pockets and interrogated me for about two and a half hours. [05:13.040 --> 05:16.240] I knew in my gut from the start they didn't have any right to be in my house. [05:16.240 --> 05:22.000] There was no reason for them to be there that I was aware of. [05:22.000 --> 05:26.400] Intermittently, various officers approached me with questions and making subtle threats. [05:26.400 --> 05:31.360] They didn't seem to act like law enforcement, so half the time I believed that I was being [05:31.360 --> 05:35.000] robbed and my life was in danger. [05:35.000 --> 05:40.480] They threatened to make mine a federal case sometime during that as well. [05:40.480 --> 05:45.160] They did a real good job convincing me that I broke the law, but wasn't under arrest. [05:45.160 --> 05:50.000] So I decided to get them out of my house any way possible. [05:50.000 --> 05:54.760] So I told them that I intended to sell any extra marijuana that I might have someday [05:54.760 --> 06:00.120] to a licensed club or a dispensary. [06:00.120 --> 06:04.880] I didn't say that I had any extra, but I was in possession of one pound and had some [06:04.880 --> 06:07.440] plants growing in my garage. [06:07.440 --> 06:11.880] They took $800 from my safe and took my medicine and all my plants. [06:11.880 --> 06:16.360] At the end, one of the sheriff's deputies handed me a business card and told me I could [06:16.360 --> 06:19.280] start growing again, but only if it was for myself. [06:19.280 --> 06:25.960] Now, four months later, the DA mailed me a summons regarding a complaint filed, which [06:25.960 --> 06:29.800] included two felony counts and one misdemeanor count. [06:29.800 --> 06:36.600] I retained an attorney who took my case on from start to finish, so she said, for $10,000. [06:36.600 --> 06:42.460] They dragged on for almost two years and the closer we got to trial, the more my attorney [06:42.460 --> 06:47.560] complained about having run out of money and wanted to dismiss herself from my case. [06:47.560 --> 06:52.240] The attorney filed a request to have the public defender sign to me and directed me to fill [06:52.240 --> 06:58.240] out a financial form fraudulently so that I would qualify for free representation. [06:58.240 --> 07:01.760] The judge asked the attorney why she wanted to be dismissed and she responded accurately [07:01.760 --> 07:03.800] that I could not afford her service. [07:03.800 --> 07:06.040] Accurately, I couldn't afford anyone else's service. [07:06.040 --> 07:12.400] By the way, I later found she was disbarred from Texas. [07:12.400 --> 07:17.160] The judge then asked me if what she stated was accurate and if that's what I wish to [07:17.160 --> 07:18.160] do. [07:18.160 --> 07:21.320] I informed the judge that I have paid her up front and am told to represent me through [07:21.320 --> 07:22.320] trial. [07:22.320 --> 07:26.880] I did not wish to retain any other attorney and in truth, I didn't want to be implicated [07:26.880 --> 07:31.200] or associated with defrauding the court of the state of California, so she stayed on [07:31.200 --> 07:32.200] reluctantly. [07:32.200 --> 07:38.080] Now, my attorney and the assistant DA made a deal for one count of felony cultivation [07:38.080 --> 07:46.240] to which I played no contest, which I was sentenced on 60 days community service, jaded [07:46.240 --> 07:51.320] fees and penalties, three years probation without circumceder, no jail time or drug [07:51.320 --> 07:58.120] classes and included with a promise to expunge my case at completion of probation. [07:58.120 --> 08:04.440] I did all the above and hired a different attorney to file a motion 17B. [08:04.440 --> 08:10.040] The first judge refused to hear the motion and he yelled at the lawyers to get out of [08:10.040 --> 08:12.200] his court. [08:12.200 --> 08:14.440] Very confusing and a little frightening. [08:14.440 --> 08:19.720] The second judge heard the motion and allowed me to, if I'm using the word correctly, revoke [08:19.720 --> 08:27.080] my plea of no contest and enter a plea of not guilty by reopening my original case. [08:27.080 --> 08:34.160] The felony was dismissed and the misdemeanor was reintroduced as a charge or I was recharged [08:34.160 --> 08:36.680] with a misdemeanor to which I fled not guilty. [08:36.680 --> 08:40.880] I was informed that my rights at that point were restored. [08:40.880 --> 08:45.200] The clerk's office never sent my expungement or the court minutes to DOJ. [08:45.200 --> 08:49.840] This was in 2011 by this time. [08:49.840 --> 08:56.960] I went and just recently this year, having to work security now, I used to be a chiropractor. [08:56.960 --> 08:59.560] I went to purchase a gun for my security job and got denied. [08:59.560 --> 09:05.400] I went back to the court and got the papers sent off to the DOJ. [09:05.400 --> 09:08.520] That court actually laughed at me and said, we don't arrest people for things like that [09:08.520 --> 09:09.520] these days. [09:09.520 --> 09:13.440] I went to purchase a second gun and it was denied again. [09:13.440 --> 09:14.440] I called the court. [09:14.440 --> 09:20.360] I found a mistake and was really confused by the proceedings because they weren't very [09:20.360 --> 09:21.360] common. [09:21.360 --> 09:25.960] She was never seen anything like that before. [09:25.960 --> 09:31.680] That leads us right about to today where I have been without my chiropractic license [09:31.680 --> 09:39.960] of practice since 2009, lost my gun rights until whenever the DOJ processes the paperwork [09:39.960 --> 09:40.960] if they do. [09:40.960 --> 09:45.520] Lost my practice, my home, two cars, all my possessions and valuables, destroyed my credit [09:45.520 --> 09:47.960] and defaulted on my student loans. [09:47.960 --> 09:54.800] I didn't know anything obviously about common law or my rights at this time. [09:54.800 --> 10:01.480] I've just over the last year or so been learning as much as possible about the right to travel. [10:01.480 --> 10:06.160] I don't know what to do if anything from here about this case. [10:06.160 --> 10:14.200] Okay, what would you like to achieve? [10:14.200 --> 10:15.680] What do you want to do? [10:15.680 --> 10:23.600] Well, I feel like filling my rights were violated in several different ways. [10:23.600 --> 10:26.480] I don't want to sound like a victim, but I do feel victimized. [10:26.480 --> 10:27.720] Okay, hold on. [10:27.720 --> 10:33.520] At the end of the day, how would you like things to be different? [10:33.520 --> 10:39.000] What would you like to achieve as a ultimate outcome? [10:39.000 --> 10:46.160] As an ultimate outcome, I would like for justice to be served on those who trespass against [10:46.160 --> 10:47.160] me. [10:47.160 --> 10:48.160] Okay, hold on. [10:48.160 --> 10:49.160] Forget about justice. [10:49.160 --> 10:50.160] Okay. [10:50.160 --> 10:56.840] The system is not just, never has been and never will be. [10:56.840 --> 11:03.440] I know they talk about justice in high school and all that, but when we get out here looking [11:03.440 --> 11:11.800] for justice, justice is so subjective that nobody can really define what it is. [11:11.800 --> 11:23.960] In order to achieve some outcome, we need to determine some place that you want to get [11:23.960 --> 11:25.800] to. [11:25.800 --> 11:37.440] If you could reach this point, then is this something that you could live with? [11:37.440 --> 11:39.240] I know this sounds harsh, but- [11:39.240 --> 11:42.480] Well, that's very clear. [11:42.480 --> 11:43.480] Yeah. [11:43.480 --> 11:51.560] If you're trying to secure justice from the system, you will be continually disappointed. [11:51.560 --> 11:58.320] One of the dangers of getting into these kinds of circumstances, especially when you didn't [11:58.320 --> 12:06.320] know what was going on in the beginning and they really rolled rough shot over you, is [12:06.320 --> 12:13.360] if you're not careful, it becomes about the fight and not about an outcome. [12:13.360 --> 12:18.080] I had a friend that helped people with IRS issues. [12:18.080 --> 12:19.080] She was in Pennsylvania. [12:19.080 --> 12:23.520] They sent her to the next door neighbors who had some IRS tax liens they were trying to [12:23.520 --> 12:25.560] get rid of. [12:25.560 --> 12:28.320] She sat down and asked them, what do you want to do? [12:28.320 --> 12:29.680] I want to get rid of these liens. [12:29.680 --> 12:30.680] She looked at them and said, okay. [12:30.680 --> 12:32.360] She tore them up and threw them in the trash. [12:32.360 --> 12:33.360] They're gone. [12:33.360 --> 12:35.640] Now what do you want? [12:35.640 --> 12:36.640] They were flabbergasted. [12:36.640 --> 12:43.160] She said, guys, these liens expired two years ago and the IRS didn't reinstate them. [12:43.160 --> 12:44.160] They're gone. [12:44.160 --> 12:47.360] What do these people do? [12:47.360 --> 12:57.160] They sent a blistering letter to the IRS and when the IRS did, they reinstated the liens. [12:57.160 --> 13:06.680] At the end of the day, where would you like to be to get yourself back in a position where [13:06.680 --> 13:08.600] you can restart your life? [13:08.600 --> 13:18.880] You may be able to get justice, but not if you're being run over by a truck. [13:18.880 --> 13:22.080] First we need to get stabilized. [13:22.080 --> 13:29.040] What would it take to get you back in a stable position? [13:29.040 --> 13:36.000] I would say having my chiropractic license reinstated, which I have that paperwork in [13:36.000 --> 13:42.960] the works, I don't know if it'll be successful, and to have my property returned, to have [13:42.960 --> 13:52.080] what I lost restored, and having a history in the medical profession, I would use the [13:52.080 --> 13:56.720] term pre-injury status in some sort. [13:56.720 --> 13:57.720] Okay. [13:57.720 --> 14:03.040] Of course, I defaulted on my loans and everything, too, and that may have prohibited me from [14:03.040 --> 14:07.960] getting back my license. [14:07.960 --> 14:11.600] I guess I'm looking for reprimand. [14:11.600 --> 14:12.600] Okay. [14:12.600 --> 14:13.600] Yeah. [14:13.600 --> 14:21.240] I understand that you want to be paid back for the harm, but in order to get paid back [14:21.240 --> 14:26.760] from the harm, you have to be in a position where you can fight them. [14:26.760 --> 14:36.760] One of the things that these guys do is they try to grind you down to you can't fight them. [14:36.760 --> 14:43.000] My suggestion is let's find a way to get re-stabilized. [14:43.000 --> 14:46.840] They don't like people who can fight them. [14:46.840 --> 14:52.360] Once you're out from under the criminal, are you out from under criminal that will cost [14:52.360 --> 14:56.880] you your liberty at this point? [14:56.880 --> 14:57.880] I believe so. [14:57.880 --> 15:06.880] I think that as of yesterday, the DOJ at least has been informed of the amended paperwork [15:06.880 --> 15:10.480] sent to them, and I'm out of way of harm. [15:10.480 --> 15:13.120] I do have a steady job now. [15:13.120 --> 15:14.120] Okay. [15:14.120 --> 15:18.040] Liberty for me is the most important thing. [15:18.040 --> 15:24.720] I am very reluctant to suggest that somebody do something that can cost them their liberty. [15:24.720 --> 15:28.400] You're mentioning the right to travel issue. [15:28.400 --> 15:34.280] I'm going to suggest leave that fight to me or to Eddie Craig or to somebody else. [15:34.280 --> 15:40.320] You got bigger battles to fight, and I've been doing this show for a long time. [15:40.320 --> 15:46.680] I've been researching this kind of thing for 30 years, and I'm just now taking on the travel [15:46.680 --> 15:48.400] issue just for yucks. [15:48.400 --> 15:55.880] I really don't care about it because I have really more important fights to fight, and [15:55.880 --> 16:02.840] the one I'm fighting is the one that will give us an underlying structure that we can [16:02.840 --> 16:06.200] use to win things like the travel issue. [20:28.840 --> 20:33.600] Well, it was brought up to the board. [20:33.600 --> 20:41.640] I think it's maybe a requirement, and it may depend if they enforce this in my case. [20:41.640 --> 20:47.400] But it is said that if you are on default of your student loan, they may retain the [20:47.400 --> 20:52.760] right to refuse re-licensure or new licenses and so forth. [20:52.760 --> 20:56.840] I'm looking for reinstatement, so it's a similar category. [20:56.840 --> 20:57.840] Okay. [20:57.840 --> 21:04.640] The first thing I suggest is get a hold of whoever is adjudicating your student loan [21:04.640 --> 21:12.960] and see if you can get them to reinstate because they don't want to default your student loan. [21:12.960 --> 21:15.080] All they care about is collecting money. [21:15.080 --> 21:23.000] And if you go to the arm and indicate that you had an interruption in your practice and [21:23.000 --> 21:29.800] that you have that taken care of and you would like to reinstate your loan and start paying [21:29.800 --> 21:37.960] it off again, very likely that they will bend over backwards to get you back on their books. [21:37.960 --> 21:44.560] So all you have to do is get them to refinance that loan and you can get back on the books [21:44.560 --> 21:48.160] and get in good standing there. [21:48.160 --> 21:52.160] What else would prevent you from getting your license back? [21:52.160 --> 21:56.120] Let's see. [21:56.120 --> 22:01.480] If they charged exorbitant fees, of course, I'd need to be able to afford those. [22:01.480 --> 22:08.320] There is the possibility that because, and this ties into the answer to a previous question [22:08.320 --> 22:17.640] you'd have, because the license was revoked by default, that they may be able to waive [22:17.640 --> 22:19.640] those fees. [22:19.640 --> 22:24.520] Okay. [22:24.520 --> 22:28.640] What would it take to get them to waive those fees? [22:28.640 --> 22:36.200] What I'm going to suggest is put justice behind you for the moment. [22:36.200 --> 22:38.200] Justice is always going to be there waiting for you. [22:38.200 --> 22:42.240] You can go after these guys anytime you want to. [22:42.240 --> 22:47.920] This is for a large degree what I do. [22:47.920 --> 22:52.280] I had a bailiff drag me down the stairs once, shove me out the door, knock me down, break [22:52.280 --> 22:55.560] my elbow. [22:55.560 --> 23:06.080] That really, really hurt and I was really, really upset at that bailiff, but I looked [23:06.080 --> 23:14.280] at my goals and what was I trying to achieve and I asked myself, will that help me toward [23:14.280 --> 23:18.360] my intended ultimate outcome? [34:13.800 --> 34:22.240] There is a stipulation, once you are approved or are scheduled for a hearing, if there's [34:22.240 --> 34:27.040] any reason for denial, you have to wait another year before you can even apply, and then you [34:27.040 --> 34:28.600] go back on the waiting list. [34:28.600 --> 34:36.400] I've been waiting since, oh gosh, October, I believe, and they have quarterly meetings. [34:36.400 --> 34:42.240] So, I did fill out their forms, and yeah. [34:55.160 --> 35:02.040] We have national licensing examinations and so forth, and there is some reciprocation [35:02.040 --> 35:03.280] between states. [35:03.280 --> 35:07.480] For example, my California license was in good standing. [35:07.480 --> 35:11.720] I could go to Washington, pay MSD, fill out some forms, and have a license in Washington, [35:11.720 --> 35:15.360] but not necessarily in Oregon, there'd be some extra tests. [35:15.360 --> 35:20.320] I suppose that it's possible that I could apply in other states. [35:20.320 --> 35:23.320] I haven't held a hope. [35:23.320 --> 35:24.320] Well, okay. [35:24.320 --> 35:30.720] So, let's say you're in California, and your license gets revoked there, and your [35:30.720 --> 35:36.120] parents live in Washington state, and they're ill, and you have to go to Washington state [35:36.120 --> 35:41.400] and stay there and take care of your parents, but you need your license back. [35:41.400 --> 35:48.440] Is going to be a provision to where you can go to the state of Washington and ask them [35:48.440 --> 35:57.200] to review the revocation in California and reinstate your license from Washington. [35:57.200 --> 36:06.240] If they have reciprocity, they're going to have reciprocity both ways. [36:06.240 --> 36:09.680] That's an interesting concept right there. [36:09.680 --> 36:15.120] That is something that you could request. [36:15.120 --> 36:18.800] People call me about law, and I'm not an attorney. [36:18.800 --> 36:30.040] A lot of times, most of what I do is I look at things and think, what would a reasonable [36:30.040 --> 36:36.520] person of ordinary prudence think in this circumstance, or what would a reasonable person [36:36.520 --> 36:42.560] of ordinary prudence do in these circumstances to handle these issues? [36:42.560 --> 36:50.320] If something seems like it ought to be a certain way, it almost always is, and when I go back [36:50.320 --> 36:53.840] and check the law, it almost always comes out that way. [36:53.840 --> 37:00.560] That's if we can think of things from a neutral perspective. [37:00.560 --> 37:05.520] If we look at things just from our own focused individual perspective, we sometimes get all [37:05.520 --> 37:12.520] screwed up, but from a neutral party perspective, what is right, just, and reasonable, I find [37:12.520 --> 37:18.760] is almost always the case in law. [37:18.760 --> 37:26.080] If you have to move to another state for some reason, if there is reciprocity, there is [37:26.080 --> 37:34.240] certainly reciprocity that goes to reinstating your license. [37:34.240 --> 37:42.520] You might look at the states that have the least stringent requirements, the ones that [37:42.520 --> 37:50.760] need chiropractors more than another state, so that once you get reinstated there, then [37:50.760 --> 37:58.760] you can come back to California or anywhere else and be able to just transfer it. [37:58.760 --> 38:18.840] There is more than one way of getting at this thing. [38:18.840 --> 38:24.880] You might start questioning and finding out which states need chiropractors more than [38:24.880 --> 38:33.320] others, or which states are more likely to reinstate you. [38:33.320 --> 38:34.320] That shouldn't take too long. [38:34.320 --> 38:43.720] That's a great idea, and you know, Randy, what I actually feel slightly more hopeful [38:43.720 --> 38:51.040] hearing that than years ago when I considered it for myself the first time is that, let's [38:51.040 --> 38:58.660] say the Pacific Northwest, due to its proximity and its beauty, I should love it up there [38:58.660 --> 39:06.760] and wouldn't mind living there, they had a very bleak view, legally speaking, of marijuana, [39:06.760 --> 39:14.160] and I did not want to risk taking that history up there for them to review. [39:14.160 --> 39:22.840] In the last few years, their laws have gone very different. [39:22.840 --> 39:26.760] Now maybe not for chiropractors, but for the general public. [39:26.760 --> 39:33.320] Yeah, the whole issue of marijuana, you know, your license is revoked in California for [39:33.320 --> 39:36.320] something that's legal in Washington. [39:36.320 --> 39:37.320] Yes. [39:37.320 --> 39:45.080] That's likely to give them a whole different perspective, Washington, Colorado, there are [39:45.080 --> 39:54.160] a number of states, I wouldn't suggest Colorado, because just a couple of times I was in Colorado, [39:54.160 --> 39:59.680] I hated Colorado. [39:59.680 --> 40:05.880] I couldn't get past that blue stallion in the airport with the red eyes, I just couldn't [40:05.880 --> 40:07.840] get past that. [40:07.840 --> 40:13.480] Oh yeah, that was at the great big airport there, huh? [40:13.480 --> 40:16.760] Yeah, that's a really creepy airport. [40:16.760 --> 40:21.080] Yeah, there's lots of stories about that. [40:21.080 --> 40:28.840] When I was in Colorado, I was called there to do some seminars, and the people that brought [40:28.840 --> 40:33.320] me there were at each other's throats like a pack of dogs. [40:33.320 --> 40:38.600] I'd never been to a place where people seemed so miserable to one another. [40:38.600 --> 40:45.040] And in Colorado's defense, I may have just been the group I was exposed to, but I was, [40:45.040 --> 40:47.520] I couldn't wait to get out of there. [40:47.520 --> 40:53.240] Go back to Texas where people smile at you on occasion. [40:53.240 --> 41:03.040] I shouldn't pick on Colorado, but yeah, I would look at states, if you're free to relocate, [41:03.040 --> 41:10.200] but certainly look at a place that would be more friendly to your situation, it's certainly [41:10.200 --> 41:18.000] worth looking into, and if you want to come back and seek justice later, fine. [41:18.000 --> 41:27.480] But I'm going to suggest, I've been fighting this fight for 30 years, and I've got lots [41:27.480 --> 41:34.240] of things to be upset about, the caller before you is from Cherokee County. [41:34.240 --> 41:38.400] I filed criminal charges with the grand jury in Cherokee County, and the judge I filed [41:38.400 --> 41:44.320] against prosecuted me for operating and investigating business without a license. [41:44.320 --> 41:52.520] When I was an investigative journalist, they tried me, convicted me, gave me a year in [41:52.520 --> 42:00.600] prison, and then after 24 days in solitary confinement, I filled out about 30 criminal [42:00.600 --> 42:07.800] complaints and sent them to the court of criminal appeals, and two days later, the prosecuting [42:07.800 --> 42:10.560] attorney came in and said, let's make a deal. [42:10.560 --> 42:19.040] They got me out of there, but I would really like to go back there and pay them back for [42:19.040 --> 42:20.040] what they did to me. [42:20.040 --> 42:25.880] The judge now has been removed from the bench, and they're all going to have stuff happen, [42:25.880 --> 42:32.600] but that won't lead me toward my intended ultimate outcome. [42:32.600 --> 42:38.840] So yeah, they beat me up, yeah, they subjected me to major misery, and I could go back and [42:38.840 --> 42:45.720] fight them and beat them up back, but that's not going to lead me toward my intended outcome [42:45.720 --> 42:49.040] in the end. [42:49.040 --> 42:55.760] Sometimes I've got to take some lumps, three dislocated ribs, two broken collarbones, broken [42:55.760 --> 42:59.040] elbow, and a tooth knocked out. [42:59.040 --> 43:05.440] That's part of the injustice I've paid for trying to find justice. [43:05.440 --> 43:16.080] Okay, I'll pay those debts and stay focused on what's most important to me, and once you [43:16.080 --> 43:21.400] get back on your feet, then if you want to come back and fight them, call me. [01:22:12.200 --> 01:22:20.200] There's certainly nothing in law about staple holes, and I've heard guys argue that a document [01:22:20.200 --> 01:22:28.520] that has staple holes in it is not an original document, unless whatever was stapled to it [01:22:28.520 --> 01:22:30.120] still stapled to it. Okay, well, somebody might have put a cover page on it saying, I get documents [01:23:38.560 --> 01:23:42.360] from the court and there's a cover page that just has my name and address in the middle [01:23:42.360 --> 01:23:43.360] of it. [01:23:44.360 --> 01:23:50.240] I've got one right here, an order from the court, and the first page is blank except [01:23:50.240 --> 01:23:53.280] for my name and address right in the middle of it. [01:23:57.840 --> 01:24:04.640] Just because there's staple holes or just because there was a page on top does not necessarily [01:24:04.640 --> 01:24:15.640] give cause to believe that a material portion of the document has been removed. [01:24:15.640 --> 01:24:27.800] Now, I always number my pages one of whatever, so if a document is removed, then it's clearer [01:24:27.800 --> 01:24:32.000] from observing the document that it's removed. [01:24:32.000 --> 01:24:38.240] If something's been added to the top that wasn't there when you created it or when you [01:24:38.240 --> 01:24:46.440] signed it and then it was taken away, I don't see how it could have any relevance. [01:26:17.480 --> 01:26:24.720] No, I didn't, I just amended my federal complaint to add them as a debt collector in the FDCPA [01:26:24.720 --> 01:26:25.720] case. [01:27:46.780 --> 01:27:53.800] If you're a plumber, electrician, a private investigator, they all have boards that are [01:27:53.800 --> 01:27:58.800] not licensed, they have attorneys and non-attorneys, I'm sorry, that have licensed personnel and [01:27:58.800 --> 01:28:01.240] non-licensed policing it. [01:28:01.240 --> 01:28:05.200] The only one that polices themselves is the bar association. [01:28:05.200 --> 01:28:06.200] Okay. [01:28:06.200 --> 01:28:15.360] If you file a bar grievance against a lawyer, the lawyer will get, I'm sorry, the bar, my [01:28:15.360 --> 01:28:17.600] tank is getting toggled. [01:28:17.600 --> 01:28:22.940] If you file a bar grievance against a lawyer, the state bar association will get that grievance [01:28:22.940 --> 01:28:27.520] and they will throw it in the trash. [01:33:42.920 --> 01:33:46.940] So in order to throw a bar grievance, how does one do that? [01:33:46.940 --> 01:33:50.120] Do you have to know the laws against the lawyer? [01:33:50.120 --> 01:33:54.320] I mean, how do you know where to pull one of these? [01:33:54.320 --> 01:33:55.320] Okay. [01:33:55.320 --> 01:33:57.840] This is the good part about bar grievances. [01:33:57.840 --> 01:34:06.200] Now, we have the American Bar Association standards, and most states, all but three, have adopted [01:34:06.200 --> 01:34:14.000] the model American Bar Association standards, and then they've made minor adjustments themselves. [01:34:14.000 --> 01:34:20.440] But the only ones that need to know what those are are the lawyers. [01:34:20.440 --> 01:34:25.760] You and I, we can grieve them for anything. [01:34:25.760 --> 01:34:32.320] I can file a bar grievance and claim that that no good, dirty, rotten schreister parts [01:34:32.320 --> 01:34:36.600] his hair on the left, if you can believe that. [01:34:36.600 --> 01:34:37.600] He should be disbarred. [01:34:37.600 --> 01:34:38.600] Really? [01:34:38.600 --> 01:34:39.600] Yeah. [01:34:39.600 --> 01:34:40.600] Really? [01:34:40.600 --> 01:34:41.600] Yeah. [01:34:41.600 --> 01:34:45.120] The bar is going to send me a letter back saying we examined into your accusation and [01:34:45.120 --> 01:34:49.320] find it does not rise to the level of misconduct. [01:34:49.320 --> 01:34:59.720] I can say the lawyer took this grieving widow's money and then took her house and sold it [01:34:59.720 --> 01:35:03.920] and had her evicted on the street, out onto the street. [01:35:03.920 --> 01:35:08.640] And I'll get this letter from the bar that says, we examined into your accusation and [01:35:08.640 --> 01:35:12.640] find it does not rise to the level of misconduct. [01:35:12.640 --> 01:35:18.680] It makes no difference what you accuse a lawyer of. [01:35:18.680 --> 01:35:25.040] If it's valid, invalid, it makes no difference. [01:35:25.040 --> 01:35:29.600] For the most part, anything that doesn't seem right is not. [01:35:29.600 --> 01:35:35.520] And if you read through the standards, you'll be amazed at what you can grieve them for. [01:35:35.520 --> 01:35:40.000] But I'm saying it doesn't matter. [01:35:40.000 --> 01:35:42.800] Grieve them because they part their hair the wrong way. [01:35:42.800 --> 01:35:45.000] You didn't create this mess for them. [01:35:45.000 --> 01:35:46.000] They did. [01:35:46.000 --> 01:35:52.360] Okay, so what if you have a lawyer that you hired and you feel as though that this lawyer [01:35:52.360 --> 01:35:57.920] hasn't represented you to what you need, but they told you from the very beginning, oh [01:35:57.920 --> 01:36:02.840] yes, I can do your case, we can get this, I feel 70% sure that we're going to win this [01:36:02.840 --> 01:36:03.840] case. [01:36:03.840 --> 01:36:06.240] And you get into it, halfway into it. [01:36:06.240 --> 01:36:07.240] They want more money. [01:36:07.240 --> 01:36:08.400] They want more money. [01:36:08.400 --> 01:36:11.200] And you don't feel like you've accomplished a damn thing. [01:36:11.200 --> 01:36:15.960] So can you throw a bar grievance at them for saying that you don't feel like you've accomplished [01:36:15.960 --> 01:36:20.240] it, feel like they misrepresented the fact that they could represent you? [01:36:20.240 --> 01:36:21.860] Absolutely. [01:36:21.860 --> 01:36:26.200] The point is you can bar grieve them for anything you don't like. [01:36:26.200 --> 01:36:33.480] And unfortunately, as far as the bar is concerned, it doesn't matter what you grieve them for. [01:36:33.480 --> 01:36:35.800] The bar is not going to act against them. [01:36:35.800 --> 01:36:38.960] So do they know that they were bar grievance? [01:36:38.960 --> 01:36:42.600] Oh yes, absolutely they know. [01:36:42.600 --> 01:36:48.720] And the worst part for the lawyer is when they're grieved, they have to notify their [01:36:48.720 --> 01:36:51.800] insurance carrier. [01:36:51.800 --> 01:36:58.960] They have to tell on themselves because if they don't, then they're not insured. [01:36:58.960 --> 01:37:05.240] And the point is, the bar is not going to pay any attention to what you file against [01:37:05.240 --> 01:37:08.560] a lawyer, no matter what it is. [01:37:08.560 --> 01:37:15.880] So you can bar grieve them for anything. [01:37:15.880 --> 01:37:17.120] How would you go about doing that? [01:37:17.120 --> 01:37:24.760] Say the person like Scott earlier, this happened seven years ago or whatever. [01:37:24.760 --> 01:37:30.160] And you feel like, well, if I had have had a better lawyer, she would have said that [01:37:30.160 --> 01:37:33.880] she couldn't represent me to my best, but here's someone she thinks could have represented [01:37:33.880 --> 01:37:34.880] me. [01:37:34.880 --> 01:37:44.360] And I mean, could you possibly see that you could make, would she possibly try something [01:37:44.360 --> 01:37:46.360] with you? [01:37:46.360 --> 01:37:53.720] Seven years is really too long to try to achieve any remedy. [01:37:53.720 --> 01:38:02.320] I mean, you could bar grieve the lawyer and even if the bar grievance is out of time for [01:38:02.320 --> 01:38:09.440] something that's absolutely doesn't matter, it's going to hurt the lawyer anyway. [01:38:09.440 --> 01:38:14.560] And you know, lawyers complain about that, that I can bar grieve them because they part [01:38:14.560 --> 01:38:19.200] their hair on the left and it's going to double their malpractice insurance. [01:38:19.200 --> 01:38:24.320] And I say, sorry, guys, you created this mess. [01:38:24.320 --> 01:38:27.360] You made it so that a bar grievance means nothing. [01:38:27.360 --> 01:38:30.160] That's why the insurance carrier stings you so hard. [01:38:30.160 --> 01:38:32.880] So how do you file that? [01:38:32.880 --> 01:38:41.720] Oh, you can go to the state bar association and they have a grievance form on their website. [01:38:41.720 --> 01:38:48.440] Now if your lawyer's done a number of things, don't put them all in one grievance. [01:38:48.440 --> 01:38:51.560] Don't file them all at the same time. [01:38:51.560 --> 01:38:56.200] Because if you do, the bar will treat it like one grievance. [01:38:56.200 --> 01:39:01.360] So you file them a week apart for each thing he's done. [01:39:01.360 --> 01:39:05.000] And that way they come in as separate grievances. [01:39:05.000 --> 01:39:10.200] Now you'll get a notice back from the bar that says be examined into your accusation [01:39:10.200 --> 01:39:13.880] and find it does not rise to the level of misconduct. [01:39:13.880 --> 01:39:19.200] And I can assure you that is exactly what it says. [01:39:19.200 --> 01:39:25.280] It doesn't matter what state you're in, they all say the same thing. [01:39:25.280 --> 01:39:27.480] It's how bad it is. [01:39:27.480 --> 01:39:30.880] So you're going to get that so don't feel frustrated. [01:39:30.880 --> 01:39:37.760] It's a good thing because what they're not going to tell you is you're going to double [01:39:37.760 --> 01:39:40.440] their malpractice insurance. [01:39:40.440 --> 01:39:42.520] It hurts them big time. [01:39:42.520 --> 01:39:44.600] So it doesn't matter what you file. [01:39:44.600 --> 01:39:54.680] It's better that, you know, I don't suggest you file fraudulent or facetious complaints. [01:39:54.680 --> 01:39:57.640] We don't need to. [01:39:57.640 --> 01:40:04.160] Lawyers will give you more than ample opportunity to file grievances against them. [01:40:04.160 --> 01:40:11.200] And if you read through the bar association standards, you'll read like a comic book. [01:40:11.200 --> 01:40:17.200] You won't believe the stuff you can nail them for, legitimately. [01:40:17.200 --> 01:40:23.120] So you can go to the state bar association, they have a fill in the blank site, a form [01:40:23.120 --> 01:40:27.960] on their site, and you can just fill that form out. [01:40:27.960 --> 01:40:30.120] And then you download it, print it, sign it. [01:40:30.120 --> 01:40:35.480] They won't accept it electronically and then you mail it to them. [01:40:35.480 --> 01:40:40.160] So you'll always get that same form letter back and that's okay because you've done [01:40:40.160 --> 01:40:41.160] them good. [01:40:41.160 --> 01:40:48.200] And the lawyer won't say anything to you about it because he's forbidden to. [01:40:48.200 --> 01:40:55.640] If he mentions it in court, you ask for sanctions against him because the bar forbids him to [01:40:55.640 --> 01:40:57.720] do that. [01:40:57.720 --> 01:41:00.880] And then you file a bar grievance against it for that. [01:41:00.880 --> 01:41:03.440] It really hurts lawyers. [01:41:36.600 --> 01:41:39.560] I need to fix that and re-send it. [01:41:39.560 --> 01:41:43.240] And you forgot the most important part about filing a bar grievance. [01:41:43.240 --> 01:41:46.600] When you get that letter back saying that your allegations don't rise to the level of [01:41:46.600 --> 01:41:50.560] misconduct and they're not going to do anything, you need to file a bar grievance against the [01:41:50.560 --> 01:41:53.560] attorney that sent that letter. [01:41:53.560 --> 01:42:06.680] This is what I've met earlier when we talked about how the courts hate pro-says because [01:42:06.680 --> 01:42:11.960] every once in a while they run across Rob from New Mexico. [01:42:11.960 --> 01:42:18.960] I think the court actually likes me, but the bar absolutely hates me. [01:42:18.960 --> 01:42:20.240] And this is what we have to do. [01:42:20.240 --> 01:42:26.640] I mean, this is dirty, rotten, low down, and it's patently unfair to lawyers. [01:42:26.640 --> 01:42:28.200] Sorry, guys. [01:42:28.200 --> 01:42:29.640] Life is tough. [01:42:29.640 --> 01:42:35.240] You created this mess for yourself, so you don't get to come and whine to us about it. [01:42:39.880 --> 01:42:49.760] There was an article recently in the American Bar Association newsletter that said 20% of [01:42:49.760 --> 01:42:58.920] all litigants now are pro-say litigants primarily because they don't trust lawyers. [01:42:58.920 --> 01:43:02.480] So lawyers have created this mess for themselves. [01:43:02.480 --> 01:43:10.280] So I suggest to people, don't feel bashful about filing bar grievances. [01:43:10.280 --> 01:43:15.360] If lawyers don't want bar grievances filed against them, then they need to start doing [01:43:15.360 --> 01:43:16.360] their job right. [01:43:16.360 --> 01:43:17.360] That's true. [01:43:17.360 --> 01:43:24.680] But then on the other hand, they're in business, they're in business to make money, and they [01:43:24.680 --> 01:43:33.760] don't dare adequately adjudicate your case because the judge is not going to be happy. [01:47:14.080 --> 01:47:20.080] And this guy asked for 800 bucks in attorney fees, so I'll just bargrieve him. [01:47:20.080 --> 01:47:29.080] And I'll charge him about, I'll cost him about 20 grand a year in increased malpractice insurance. [01:47:29.080 --> 01:47:35.080] And then if the judge, if the judge has no subject matter jurisdiction, [01:47:35.080 --> 01:47:42.080] so if the judge grants him the $800, I'll give him a dollar. [01:47:42.080 --> 01:47:44.080] I'll give him a dollar. [01:47:44.080 --> 01:47:53.080] He can't go back and ask the judge for sanctions for not paying the attorney fees because I'm paying them. [01:47:53.080 --> 01:47:56.080] So it's just him. [01:47:56.080 --> 01:48:05.080] He's doing that because he thinks that I'm indigent pro se and this is a fight in me so I won't come back after him. [01:48:05.080 --> 01:48:08.080] We're breaking from that habit. [01:48:08.080 --> 01:48:14.080] You can do the same thing, Rob. [01:48:14.080 --> 01:48:16.080] You there? [01:48:30.080 --> 01:48:32.080] And he keeps asking for money. [01:48:32.080 --> 01:48:35.080] So I'm going to be suing him in federal court. [01:48:35.080 --> 01:48:40.080] But my question is, you have a hearing on a cost issue on the 19th. [01:48:40.080 --> 01:48:43.080] So I've never faced this before. [01:48:43.080 --> 01:48:44.080] What do I do? [01:48:44.080 --> 01:48:47.080] They have this hearing on this particular issue. [01:48:47.080 --> 01:48:48.080] Wait a minute. [01:49:33.080 --> 01:49:37.080] There's a chance the judge will award attorney fees. [01:49:37.080 --> 01:49:41.080] So what did he ask for in attorney fees? [01:49:41.080 --> 01:49:44.080] What's that? [01:49:44.080 --> 01:49:46.080] How much? [01:49:46.080 --> 01:49:48.080] Yes. [01:49:48.080 --> 01:49:51.080] He's asking for $7,000. [01:49:51.080 --> 01:49:53.080] Now that's absorbent. [01:49:53.080 --> 01:49:58.080] And you might ask him for a complete accounting. [01:49:58.080 --> 01:50:07.080] Well, he gave a list of everything that he did and how long it took and what he charged for it. [01:50:07.080 --> 01:50:11.080] That's when you should have appealed. [01:50:11.080 --> 01:50:18.080] Most likely the court's not going to award it to him. [01:50:18.080 --> 01:50:28.080] The thing about summary judgments is they can almost always be overturned. [01:50:28.080 --> 01:50:29.080] Okay. [01:50:29.080 --> 01:50:32.080] Why didn't you appeal? [01:50:32.080 --> 01:50:37.080] Because I had already amended my FDCPA case to include these defendants. [01:50:37.080 --> 01:50:46.080] And I thought it would just be easier to deal with that rather than having another case going. [01:50:46.080 --> 01:50:48.080] I had three cases. [01:50:48.080 --> 01:50:50.080] Now I only have two, but I'm still... [01:50:50.080 --> 01:50:51.080] Oh, okay. [01:50:51.080 --> 01:50:52.080] Okay. [01:50:52.080 --> 01:51:00.080] Now you might file an objection claiming that these same issues are still being litigated [01:51:00.080 --> 01:51:08.080] as to why the reasons for not appealing and that the issues are still before court. [01:51:08.080 --> 01:51:12.080] Okay. [01:51:12.080 --> 01:51:14.080] That sounds good. [01:51:14.080 --> 01:51:24.080] And even if they do get a claim against you, you're familiar with Mike Maris? [01:51:24.080 --> 01:51:26.080] Yeah, absolutely. [01:51:26.080 --> 01:51:31.080] You don't have to worry about that because he'll try to collect and he won't collect properly [01:51:31.080 --> 01:51:36.080] and then you get to go back and you may be able to sue him for more than he's trying to collect. [01:51:36.080 --> 01:51:39.080] Yep. Yep. [01:51:39.080 --> 01:51:44.080] But make sure you bar-greed him again just for yucks. [01:51:44.080 --> 01:51:45.080] Oh, yeah. [01:51:45.080 --> 01:51:49.080] And I'm going to bar-greed the attorney today for submitting an altered document, [01:51:49.080 --> 01:51:52.080] even if that won't fly in court. [01:51:52.080 --> 01:51:54.080] Yeah. [01:51:54.080 --> 01:51:57.080] They may mess with the bar-greeders. [01:51:57.080 --> 01:52:00.080] It gives us leverage that we can use against them. [01:52:12.080 --> 01:52:17.080] You know, I sued the debt collector attorney and his law firm. [01:52:17.080 --> 01:52:18.080] Okay. [01:52:18.080 --> 01:52:23.080] During the process of my state case against the escrow company, [01:52:23.080 --> 01:52:30.080] they acknowledged that they obtained the account after a default. [01:52:30.080 --> 01:52:35.080] So I amended my FDCPA case in federal court to include them. [01:52:35.080 --> 01:52:38.080] In addition to the company, [01:52:38.080 --> 01:52:45.080] I named the executive officer who submitted the affidavit in the state court, [01:52:45.080 --> 01:52:48.080] and I named their four directors. [01:52:48.080 --> 01:52:58.080] Well, one of the directors has a name similar to the name of the debt collector, [01:52:58.080 --> 01:53:01.080] the debt collector attorney. [01:53:01.080 --> 01:53:08.080] So I named him in his capacity as director of the trust company. [01:53:08.080 --> 01:53:11.080] Well, they came back and answered. [01:53:11.080 --> 01:53:15.080] The trust company answered for the trust company, [01:53:15.080 --> 01:53:22.080] the executive officer, and all of the other directors, but not that guy. [01:53:22.080 --> 01:53:27.080] And the debt collector attorney, his law firm, [01:53:27.080 --> 01:53:32.080] and director of the trust company with a similar name to the debt collector attorney, [01:53:32.080 --> 01:53:38.080] all answered, admitting that that director of the escrow company, [01:53:38.080 --> 01:53:44.080] the trust company, is a debt collector. [01:53:44.080 --> 01:53:49.080] But they're saying that the trust company is not a debt collector. [01:53:49.080 --> 01:53:54.080] So how is this guy in his capacity as a director a debt collector, [01:53:54.080 --> 01:53:58.080] because the trust company is? [01:55:07.080 --> 01:55:16.080] Absolutely. The trust company and the executive and the other directors claim that they're not debt collectors. [01:55:16.080 --> 01:55:26.080] But the debt collector admitted to being a debt collector in his capacity as director of the trust company. [01:55:26.080 --> 01:55:34.080] Okay. So how does that affect the adjudication of your case? [01:55:34.080 --> 01:55:40.080] And what I'm going to is how does that give you a clue? [01:55:40.080 --> 01:55:49.080] If they had included all of the directors together with the trust company and said, we're not debt collectors. [01:55:49.080 --> 01:55:59.080] Oh, hold on. Okay. He is a director and they didn't include him in, oh, wait a minute. [01:55:59.080 --> 01:56:03.080] They didn't include him with the other directors. [01:56:03.080 --> 01:56:10.080] Okay. What I'm thinking is they failed to name a interested party. [01:56:10.080 --> 01:56:17.080] Did they file an action against you that included all these people except the debt collector? [01:56:17.080 --> 01:56:21.080] No, no. I sued them. They haven't done anything. [01:56:21.080 --> 01:56:26.080] Okay. I'm trying to find a way that this creates a claim. [01:56:26.080 --> 01:56:34.080] One way, if he's included in one place and not another, then the party is not included. [01:56:34.080 --> 01:56:41.080] They may well have no subject matter jurisdiction because they failed to name a necessary party. [01:56:41.080 --> 01:56:43.080] Right. [01:56:43.080 --> 01:56:51.080] Okay. Then what is the issue about this? Why is this important? [01:56:51.080 --> 01:57:01.080] Well, what I just said, if they had included him in his capacity as a director with the other directors and the trust company, [01:57:01.080 --> 01:57:06.080] that would probably fly and they could say, well, the trust company is not a debt collector, [01:57:06.080 --> 01:57:13.080] but this guy in his capacity as an attorney in his law firm, yeah, they might be debt collectors. [01:57:13.080 --> 01:57:19.080] Okay. But what they did instead was they cut him off. [01:57:19.080 --> 01:57:24.080] Everybody else is represented by one attorney saying that they're not debt collectors. [01:57:24.080 --> 01:57:33.080] He in both capacities as director of the company and as an attorney is represented by another attorney, [01:57:33.080 --> 01:57:37.080] wherein they admitted that they are all debt collectors. [01:57:37.080 --> 01:57:42.080] Well, did they admit they all were debt collectors or did just he was a debt collector? [01:57:42.080 --> 01:57:46.080] Just he, just he in both capacities. [01:57:46.080 --> 01:57:56.080] Okay. So if he is debt collector in his capacity as a director of the company, doesn't that tie the company to the debt? [01:57:56.080 --> 01:58:06.080] Not necessarily. If he can exercise the debt collecting functions independent of his capacity as a director of the company, I wouldn't. [01:58:06.080 --> 01:58:10.080] I'm not sure this is a really fine point of law. [01:58:10.080 --> 01:58:18.080] Whether a executive of a company can step aside and become a debt collector separate from the company.
