[01:21.720 --> 01:26.480] The 116-page report had blamed for every level of government from local Flint officials to [01:26.480 --> 01:30.880] the Federal Environmental Protection Agency, but blamed the Michigan Department of Environmental [01:30.880 --> 01:35.480] Quality, the state agency responsible for monitoring Flint's water supply, as primarily [01:35.480 --> 01:38.440] responsible for the water contamination in Flint. [01:38.440 --> 01:42.760] The report said that the Flint water crisis is a story of government failure, intransigence, [01:42.760 --> 01:51.360] unpreparedness, delay in action, and environmental injustice. [01:51.360 --> 01:55.200] Turkey's President Recep Tayyip Erdogan said today that Belgian law enforcement and [01:55.200 --> 01:59.180] anti-terror departments ignored warnings last June that one of the brothers suspected of [01:59.180 --> 02:03.120] blowing himself up in the terror attacks there on Tuesday was a terrorist. [02:03.120 --> 02:08.320] Ibrahim El-Bakroi, suspected of being the bomber who blew himself up at the Zabintem [02:08.320 --> 02:12.940] airport killing at least 11, was stopped crossing into Turkey from Syria nine months ago when [02:12.940 --> 02:17.160] Turkish officials said that they apparently told anti-terror agencies in Brussels of his [02:17.160 --> 02:21.120] involvement with ISIS, the group who claimed responsibility in Tuesday's attacks. [02:21.120 --> 02:25.400] A Turkish official stated Dutch authorities allowed Bakroi to go free because they were [02:25.400 --> 02:28.360] unable to establish any ties to terrorism or ISIS. [02:28.360 --> 02:31.880] The Israeli newspaper Haaretz reported today that Belgian security services, as well as [02:31.880 --> 02:36.960] other Western intelligence agencies, had advanced in precise intelligence of the pending terror [02:36.960 --> 02:38.700] attacks prior to them. [02:38.700 --> 02:42.360] The newspaper said government agencies had specific warning that the attacks were coming [02:42.360 --> 02:46.880] soon and would take place at the airport and in the subway system, though it is not clear [02:46.880 --> 02:53.440] how exactly said agencies were warned of the attacks in advance. [03:23.440 --> 03:37.720] Okay, we are back, Randy Kelton, Rule of Law Radio, and we're talking to our special guest, [03:37.720 --> 03:43.920] Mr. Ron Avery about his suit against harsh communications. [03:43.920 --> 03:49.640] And I'm looking at your talking points here and one word or two words jumped right out [03:49.640 --> 03:54.200] at me, weaponized media. [03:54.200 --> 03:57.920] Will you explain what you mean by weaponized media? [03:57.920 --> 03:59.720] Yeah, sure. [03:59.720 --> 04:12.000] I think that, you know, media in the first place, its purpose was to report on news, [04:12.000 --> 04:18.000] report facts about everyday occurrences, things that are going on. [04:18.000 --> 04:25.640] And you know, the better ones were the ones that could do the best job of reporting that [04:25.640 --> 04:32.600] news accurately and completely and understandably. [04:32.600 --> 04:45.060] But when the media gets bought up by either a few individuals or a lot of individuals [04:45.060 --> 04:55.980] with all the same goals, it can shift, the purpose of the media can shift from reporting [04:55.980 --> 05:07.680] news to creating reality, to creating the truth, creating or what I'd like to call [05:07.680 --> 05:09.760] hardening a myth. [05:09.760 --> 05:14.120] They could create a myth and harden it into reality. [05:14.120 --> 05:16.720] And this is weaponized media. [05:16.720 --> 05:24.160] This is when the media is turned into a tool to be used against the people, to control [05:24.160 --> 05:31.880] them, actually to control their government even, to essentially overthrow their government. [05:31.880 --> 05:42.040] And I've been looking at the different tools that tyrants could use and have found that [05:42.040 --> 05:49.920] media is the strongest and most powerful tool they have at their disposal because every [05:49.920 --> 05:56.920] other tool they have, whether it be taking over the Pentagon or the military or black [05:56.920 --> 06:06.280] operations and controlling the three branches of government or passing laws and unlawful [06:06.280 --> 06:15.400] taxes and infiltrating the bureaucracy and you name it, law enforcement into one unit [06:15.400 --> 06:18.040] and creating the police state. [06:18.040 --> 06:29.400] It's all done, the most strongest weapon at their disposal to effect this is the media. [06:29.400 --> 06:36.240] If they don't have all the media and they can't control the opinion and mind and myth [06:36.240 --> 06:42.800] that the people live in, then none of this other stuff they have can be effective. [06:42.800 --> 06:51.320] So it's the media that is the strongest tool that is presently being used against the people [06:51.320 --> 06:59.920] of America and unless people wake up to that and realize that this media is being used [06:59.920 --> 07:08.640] against them, then they'll never be able to get out from under oppression. [07:08.640 --> 07:19.600] Yes, and you and I grew up being told about the communist Red Horde who wanted nothing [07:19.600 --> 07:27.200] more than to completely destroy our entire way of life. [07:27.200 --> 07:36.880] And then we catch this spy, this guy Anderson, and we find out that for the last 20 years [07:36.880 --> 07:47.240] the Russians had all our launch codes so they could shut the missiles off in the silos. [07:47.240 --> 07:55.200] They could have launched on us at any time they wanted to with impunity. [07:55.200 --> 08:01.960] But they never wanted to because they needed us, because they were telling their people [08:01.960 --> 08:08.120] about these capitalist thieves that want to steal everything we got. [08:08.120 --> 08:17.200] Yeah, they were using the other story, I guess, as a creation of enemies, false enemies. [08:17.200 --> 08:25.320] Exactly, then you don't pay attention to what's going on and a politician who is stealing [08:25.320 --> 08:30.000] from the public doesn't want anybody looking at him, so he gives them something else to [08:30.000 --> 08:31.000] look at. [08:31.000 --> 08:37.200] Yeah, that's an old tactic that's mentioned even in the Federalist letters that at the [08:37.200 --> 08:43.720] foundation of our country they were arguing about things at the Constitutional Convention. [08:43.720 --> 08:49.960] And one of the founders said, well, that one of the oldest tricks in the book is to start [08:49.960 --> 08:57.880] a foreign war and get all the young people involved and create an enemy. [08:57.880 --> 09:04.480] And then when the people become restless for liberty and freedom and concerned about corruption [09:04.480 --> 09:10.560] at home, they have a foreign war and all the babies and young ones are over there getting [09:10.560 --> 09:16.920] killed and everything and nobody wants to hear about any of that local stuff anymore [09:16.920 --> 09:23.880] because the kids and the husbands are dying and sacrificing and that puts an end to all [09:23.880 --> 09:28.280] that quibbling around at home. [09:28.280 --> 09:36.760] And one of the things I see as a mitigating force is the Internet. [09:36.760 --> 09:44.960] And there is something so satisfying about the fact that the Internet, the seed for the [09:44.960 --> 09:48.360] Internet was planted by the Pentagon. [09:48.360 --> 09:50.360] Really? [09:50.360 --> 09:53.960] That is perfect. [09:53.960 --> 10:01.720] The Pentagon had a lot of universities and contractors doing research and they found [10:01.720 --> 10:07.320] that they had multiple universities doing redundant research so they said, we got to [10:07.320 --> 10:13.120] fix this and they asked their programmers, can you rig a way so that these people can [10:13.120 --> 10:18.960] all communicate with one another so we don't wind up spending money on the same thing twice? [10:18.960 --> 10:28.440] So they put together these 800 trunk lines and one to this university and one to this [10:28.440 --> 10:31.600] government contractors and this really worked well. [10:31.600 --> 10:35.320] So the government contractor said, well, I'm working with this university over here, we'll [10:35.320 --> 10:38.520] just win a line from us to that university. [10:38.520 --> 10:43.960] So we did trunk lines and these trunk lines started spreading out like a spider web and [10:43.960 --> 10:49.000] the Pentagon came in and said, hey, hey, hey, hold on guys, you got to cut that out. [10:49.000 --> 10:52.000] So we're losing control of this. [10:52.000 --> 10:57.800] And the contractor said, heck with you, I read those lines, they're mine. [10:57.800 --> 11:02.240] And the Pentagon told them, well, if you don't cut that out, we'll pull our hub. [11:02.240 --> 11:05.960] And they said, go ahead, we don't care, we'll just route around it. [11:05.960 --> 11:06.960] There you go. [11:06.960 --> 11:07.960] That's how it started. [11:07.960 --> 11:10.960] Now, Randy, we got to go off the cliff or anything? [11:10.960 --> 11:13.600] No, we got about five minutes. [11:13.600 --> 11:14.600] Okay. [11:14.600 --> 11:25.180] So let me come back one little step here before we go too far there is that I also wanted [11:25.180 --> 11:32.720] to mention that what the apparent goal of this weaponized media really is. [11:32.720 --> 11:42.800] Because they exemplify a goal, there's a pattern to what they're doing and what their narrative [11:42.800 --> 11:47.000] and mass media message is because they're in lockstep. [11:47.000 --> 11:54.920] It's not like CNN is reporting one kind of news and ABC another kind and NBC another [11:54.920 --> 11:56.720] kind of Fox another kind. [11:56.720 --> 12:05.120] They're all pretty much reporting the same stuff and likewise with the newspapers like [12:05.120 --> 12:09.720] in the big Hearst communications thing. [12:09.720 --> 12:19.120] And it has to do with where they want to move society, what they want society to be thinking [12:19.120 --> 12:20.760] about. [12:20.760 --> 12:29.080] And the reason we know that there's a narrative rather than just clean reporting of news is [12:29.080 --> 12:34.120] because of what they do report on and what they don't report on. [12:34.120 --> 12:38.120] And I mean, let me give you an example. [12:38.120 --> 12:48.200] The 9-11 terror attack, let me give you first of all what their message and narrative is. [12:48.200 --> 12:55.240] And the cornerstone of it is that on 9-11-01 the whole world changed by the terror attack [12:55.240 --> 13:01.560] on America where 19 hijackers brought America to its knees. [13:01.560 --> 13:07.560] That's the cornerstone of the new world order where they want to go. [13:07.560 --> 13:09.960] This is the main myth. [13:09.960 --> 13:15.040] And two, that there is a religious group that hates America and wants to destroy it and [13:15.040 --> 13:21.680] that's the Muslim, and three is that Muslims hate America because of its alliance with [13:21.680 --> 13:27.680] the righteous, peace-loving nation of Israel, and four is that Muslims are coming to every [13:27.680 --> 13:32.280] nation on earth to harm every nation that supports Israel's right to exist. [13:32.280 --> 13:36.120] Okay, hold on just a second. [13:36.120 --> 13:39.300] You're not saying this is what's true. [13:39.300 --> 13:44.960] You're saying this is what the media is trying to create is true in our minds. [13:44.960 --> 13:54.400] This is what they want to form in the American mind and essentially have been totally successful [13:54.400 --> 13:56.000] at doing. [13:56.000 --> 14:02.140] And the fifth one is that Christians and Jews are essentially the same and share the same [14:02.140 --> 14:10.000] religious heritage unlike the Muslims and Christians and they call this thing Judeo-Christian. [14:10.000 --> 14:15.800] And then, but there's a secondary message that they're working on now which reveals [14:15.800 --> 14:31.160] the second phase of their agenda and that is that bad people have to go beyond just [14:31.160 --> 14:32.160] Muslims. [14:32.160 --> 14:38.260] And this is where the lone wolf, homegrown, anti-government terrorists come into play [14:38.260 --> 14:45.200] and they want to cast the idea that this is everywhere and it's in every town and it's [14:45.200 --> 14:51.360] all over the world, it's every city, everyone should be on the lookout for them. [14:51.360 --> 14:57.240] Now, they don't know how to identify them, of course, until after it happens, but this [14:57.240 --> 15:01.040] is what they want to put into your mind. [15:01.040 --> 15:08.120] And the idea is that lots of people fit into this secondary message from tea party activists, [15:08.120 --> 15:14.840] crime poll supporters and conspiracy theorists and all of this stuff, people that are unhappy [15:14.840 --> 15:21.560] with taxes or whatever it is, these people can fall into this secondary category which [15:21.560 --> 15:26.040] are essentially homegrown terrorists. [15:26.040 --> 15:33.520] And this is exactly what I and this group that I wasn't even a member of became a subject [15:33.520 --> 15:34.520] to. [15:34.520 --> 15:38.580] They were converting us into their agenda. [15:38.580 --> 15:49.960] They were using this agenda and the secondary message that we were right-wing fascists hanging [15:49.960 --> 15:57.360] out with neo-Nazis and we're secessionists and trying to break up the United States of [15:57.360 --> 16:06.600] America and then they use these links to show that, oh yeah, the Homeland Security thinks [16:06.600 --> 16:13.220] that we would drive violence at home and on and on and in government facilities. [16:13.220 --> 16:20.760] And all they had to connect all this together was secessionists, was that they called us [16:20.760 --> 16:23.680] secessionists, which we aren't. [16:23.680 --> 16:29.680] I'm not a secessionist, I talk against it all the time and I have good reasons for it. [16:29.680 --> 16:34.840] And neither was the Republic of Texas because they have all kinds of good reasons for opposing [16:34.840 --> 16:35.840] it. [23:07.920 --> 23:17.880] They don't want borders, they don't want strong independent nations, so it all boils down [23:17.880 --> 23:29.940] to this, the individual against global governance, and the next part of this, the secondary agenda [23:29.940 --> 23:37.240] they have is to create the idea that they're a lone wolf, homegrown, anti-government terrorist [23:37.240 --> 23:45.720] among your own citizens who have been there all their lives, who are the descendants of [23:45.720 --> 23:53.040] the founders, and they're in every country, and they operate, and they're going to operate, [23:53.040 --> 23:58.600] and that all kinds of people fall into this category, so that all people should be watching [23:58.600 --> 24:07.080] their neighbors and be able and willing to report any suspicious activity. [24:07.080 --> 24:14.440] Now this doesn't mean anybody knows what suspicious activity is, but that's their agenda. [24:14.440 --> 24:22.480] Now I say there are reasons that we know this is an agenda and a message rather than just [24:22.480 --> 24:35.800] merely happenstance, or they're just reporting on news, or whatever, there's a revealed method [24:35.800 --> 24:40.840] to what they're doing, and let me show it to you, and here's what I'm going to say. [24:40.840 --> 24:47.120] If the mass media had been reporting on news as it really happens, they would have covered [24:47.120 --> 24:54.360] several earth-shattering news events, which they never mentioned, much less covered, and [24:54.360 --> 24:59.240] that's the discovery of super nanothermite in all the dust samples at the World Trade [24:59.240 --> 25:06.160] Center, meaning that the US military explosive was found in the dust samples. [25:06.160 --> 25:11.120] Now they never covered that, they never said a word about it, and it's all over everything, [25:11.120 --> 25:19.720] and it's even in chemical magazines, and it's under peer review and been reviewed, and nobody [25:19.720 --> 25:26.760] can dispute it, and the next earth-shattering fact is that the discovery of tons of molten [25:26.760 --> 25:33.000] iron, a byproduct of a nanothermite reaction, was found in the basements of all three World [25:33.000 --> 25:40.720] Trade Center skyscrapers six weeks after their collapse, and the discovery that the 47-story [25:40.720 --> 25:46.080] World Trade Center building collapsed at freefall acceleration in the first two and a quarter [25:46.080 --> 25:51.560] seconds, meaning explosive charges had to have been used. [25:51.560 --> 25:59.360] Well had they reported that, I would say there's no agenda behind mass media and where they [25:59.360 --> 26:03.160] want to take the American and world public. [26:03.160 --> 26:11.880] Now wait a minute, I thought that the British news reported the collapse, they were so on [26:11.880 --> 26:20.040] the spot that they reported the collapse of that building 45 minutes before it fell. [26:20.040 --> 26:25.040] Yeah they did, they reported that it collapsed before it fell, so they were obviously reading [26:25.040 --> 26:31.000] the handed out agenda before, in this case before it even happened, and of course that [26:31.000 --> 26:36.920] brings up the other idea which I'm fixing to mention, the two mind-blowing admissions [26:36.920 --> 26:42.360] by Larry Silverstein who was the original developer of the World Trade Center building [26:42.360 --> 26:51.120] 7, which collapsed on 9-11, and he was the leasy of the World Trade Center at the time [26:51.120 --> 27:01.040] of 9-11, and one year after 9-11-01 he admitted that he told the New York Fire Commander that [27:01.040 --> 27:05.680] because we had had such tremendous loss of life, the smartest thing to do was just pull [27:05.680 --> 27:10.880] it and that they made the decision to pull and we watched the building collapse, or the [27:10.880 --> 27:19.200] building collapse, and then 13 years later in 2014 he admitted in a speech made in Israel [27:19.200 --> 27:24.760] that he went to the architects to begin the design of the replacement of building 7 in [27:24.760 --> 27:32.560] April of the year 2000, a full 17 months prior to 9-11-01, and this is why he could start [27:32.560 --> 27:40.360] reconstruction of World Trade Center building 7 so quickly after 9-11-01 because the plans [27:40.360 --> 27:45.000] were well in advance if not complete by that time. [27:45.000 --> 27:54.920] So obviously the hijacker thing shows that the hijackers really did not cause the collapse [27:54.920 --> 28:03.240] of the World Trade Center and neither the government nor the mass media ever investigated [28:03.240 --> 28:08.900] who put the super nanothermite in the World Trade Center and they never investigated or [28:08.900 --> 28:13.680] even questioned Larry Silverstein concerning his role in the demolition of World Trade [28:13.680 --> 28:14.680] Center. [28:14.680 --> 28:17.960] Now, you can't deny that. [28:17.960 --> 28:28.600] This shows complicity in the myth being hardened in the world that these events were just done [28:28.600 --> 28:36.680] by 19 hijackers that got four jets and did all this damage. [35:27.040 --> 35:32.600] And I don't know how much I went to the case again tonight, but you know, when they send [35:32.600 --> 35:38.040] down two freaking lawyers from New York City, I'm like, well, I'm gonna drop what I was [35:38.040 --> 35:42.300] doing and dive down there and watch court and get my pen and paper out. [35:42.300 --> 35:43.800] And I'm gonna keep my mouth shut. [35:43.800 --> 35:49.400] I'm gonna be quite respectful and I'm gonna take notes and I'm gonna sit on the other [35:49.400 --> 35:54.320] side up front so I can see and hear everything because they never have the mics working for [35:54.320 --> 35:58.360] the audience, which can be really helpful for your journalists as well. [35:58.360 --> 36:09.120] Mary, you might try the old hearing aid trick that I pulled on a JP in Mansfield, Texas. [36:09.120 --> 36:16.160] I asked him to turn the sound up because I told him I had a hearing defect and he said, [36:16.160 --> 36:18.120] Mr. Kelton, what's the matter with your hearing? [36:18.120 --> 36:22.440] Oh, Judge, I was down in Mexico the other day and I drank too much of that cheap tequila [36:22.440 --> 36:25.320] and lost my hearing aid. [36:25.320 --> 36:29.000] And then when he wouldn't turn the sound up, I asked the bailiff to arrest him. [36:29.000 --> 36:31.280] That was great fun. [36:31.280 --> 36:34.800] But yeah, how long did you spend in jail after that? [36:34.800 --> 36:36.360] I didn't. [36:36.360 --> 36:39.440] That was the most effective thing I've ever done. [36:39.440 --> 36:44.720] I was amazed because we got out of the courtroom, you know, I asked the judge to turn the sound [36:44.720 --> 36:46.920] up and he refused. [36:46.920 --> 36:52.560] So I asked him to speak up and he did and he told the bailiff that if I didn't sit down [36:52.560 --> 36:54.360] and shut up, he's going to throw me out of the courtroom. [36:54.360 --> 36:59.200] But when my hearing was over, I started to leave, I told the bailiff, you come with me. [36:59.200 --> 37:04.720] We got out in the hall and I told the bailiff I wanted to arrest the judge and he said, [37:04.720 --> 37:05.720] well, why? [37:05.720 --> 37:10.440] I said, Class A Mr. Meador, Official Oppression Criminal Violation 3903 Penal Code in that [37:10.440 --> 37:14.880] he failed to perform a duty he was required to perform and in the process denied me full [37:14.880 --> 37:17.160] free access to an enjoyment of a right. [37:17.160 --> 37:19.400] Well, what right did he deny you in? [37:19.400 --> 37:27.080] He denied me and my right to accommodation for the Americans with Disabilities Act. [37:27.080 --> 37:32.560] The bailiff said, he said, Mr. Kelton, why didn't you tell the judge about the Americans [37:32.560 --> 37:34.040] with Disabilities Act? [37:34.040 --> 37:38.840] Heck, if I'd have done that, he might have turned the sound up. [37:38.840 --> 37:43.240] The bailiff stood there a minute and his grin started across his face. [37:43.240 --> 37:49.680] I was surprised, the bailiff was absolutely elated. [37:49.680 --> 37:50.680] You set him up. [37:50.680 --> 37:55.360] I said, yeah, he was a sucker for that, wasn't he? [37:55.360 --> 38:01.400] I went to a political event two days later and that bailiff was running security, called [38:01.400 --> 38:04.360] me over and he had a half a dozen bailiffs over there. [38:04.360 --> 38:07.280] This is the guy, this is the guy that set up the judge. [38:07.280 --> 38:14.520] And after that, every time we get in front of a JP in the Dallas-Fort Worth area, man, [38:14.520 --> 38:18.640] are they ever careful with me. [38:18.640 --> 38:24.480] So I think the fact that they found out that we wasn't afraid of them seemed to terrify [38:24.480 --> 38:25.760] them. [38:25.760 --> 38:31.400] And Miss Mary there, when we were down at the Senate, the House Subcommittee, Criminal [38:31.400 --> 38:38.320] Justice Subcommittee, I thought I was going to have to pull her off the, who was that, [38:38.320 --> 38:39.320] the sergeant at arms. [38:39.320 --> 38:43.640] I said, I'm afraid she's going to beat them all up. [38:43.640 --> 38:47.000] Mary gets pretty active sometimes. [38:47.000 --> 38:51.320] I want to respond, Randy, to what Mary was saying here too. [38:51.320 --> 38:57.600] I think she made a very good point here, was that she was concerned that I and a group [38:57.600 --> 39:07.360] of people that had been meeting that the newspaper reported on may be being set up for a raid [39:07.360 --> 39:13.760] or some kind of thing like that, or even a false flag thing, something goes, somebody [39:13.760 --> 39:19.840] blows something up and blames it on us like false flag events are designed to do. [39:19.840 --> 39:28.600] And I'm going to say, I think she's exactly right, that that's why I responded in the [39:28.600 --> 39:35.560] way I did by suing them, because first of all, none of the stuff they said was really [39:35.560 --> 39:36.560] true. [39:36.560 --> 39:41.320] It was false and it was damaging. [39:41.320 --> 39:50.680] And I think they're actually carrying out their secondary agenda, which is to demonize [39:50.680 --> 39:59.320] and make terrorists out of essentially every citizen in the world of every place and to [39:59.320 --> 40:01.320] turn their neighbors on one another. [40:01.320 --> 40:08.800] And then, so the news media can just say who's bad and then an event happens and then they [40:08.800 --> 40:10.600] blame it on them. [40:10.600 --> 40:18.160] Nobody says anything, nobody questions it, nobody has any proof otherwise, and that just [40:18.160 --> 40:26.600] becomes the hardened fact, and maybe none of it is a fact, like 9-11. [40:26.600 --> 40:35.000] So little of it is actually really factual, but they've made the cornerstone of the new [40:35.000 --> 40:39.880] millennium out of it, and they're trying to carry it on. [40:39.880 --> 40:45.560] And now the secondary part of it is that it's not just Muslims anymore that's terrorists, [40:45.560 --> 40:52.180] and that was one of the main points they made in their article that they put another article [40:52.180 --> 41:01.840] in there that said that right-wing extremists, the growing right-wing terror threat was the [41:01.840 --> 41:08.880] name of the article, and that it was trying to show that right-wing anti-government people [41:08.880 --> 41:13.720] are more dangerous than Muslim terrorists in America. [41:13.720 --> 41:18.160] And this is their agenda, they're pushing it, and that's what they tried to make us [41:18.160 --> 41:24.280] out to be, and the public got it, because they wrote it down in the blog afterwards [41:24.280 --> 41:31.020] that we were just like Muslims, and we ought to be rounded up, sent to Gitmo, and waterboarded. [41:31.020 --> 41:36.320] And I don't believe these newspapers should be allowed to do this. [41:36.320 --> 41:39.600] I don't think they ought to be able to make anybody into a terrorist. [41:39.600 --> 41:43.840] They want to do that and run around and do this kind of stuff. [41:43.840 --> 41:48.720] When they get that wrong, and they're creating stuff, and we know they're doing it, they [41:48.720 --> 41:50.660] ought to be hammered. [41:50.660 --> 41:55.560] These people ought to be hammered to not do that anymore. [41:55.560 --> 42:04.040] And I was thinking when Mary was saying that, that your response was exactly the right response. [42:04.040 --> 42:12.000] We get people on the air that advocate armed resistance to these guys, and guys, tell them [42:12.000 --> 42:15.400] I'm an ex-combat veteran. [42:15.400 --> 42:23.840] And in that context, when you pick a fight, you need to make sure you can win that fight. [42:23.840 --> 42:26.680] Don't get into a fight just because you can. [42:26.680 --> 42:32.760] Back up, look around, what is your best strategy from this point? [42:32.760 --> 42:36.240] And Ron did it exactly right. [42:36.240 --> 42:43.760] They can hardly create a false flag against him once he's got them in court and squeezing [42:43.760 --> 42:46.320] them on their own law. [42:46.320 --> 42:47.320] That's right. [42:47.320 --> 42:49.960] That's the way I look at it. [42:49.960 --> 43:01.720] You took all of the momentum out of that article, and now you got the newspaper defending themselves. [43:01.720 --> 43:03.880] And that is not a place they ought to be in. [43:03.880 --> 43:04.880] Right. [43:04.880 --> 43:05.880] Right. [43:05.880 --> 43:13.200] And they've got it dismissed now, but I fully intend to appeal this, and you know what? [43:13.200 --> 43:19.640] They may be appealing it themselves because the judge, when he signed the order dismissing [43:19.640 --> 43:28.200] it, he scratched out all the attorney's fees that they had asked for a future motion to [43:28.200 --> 43:32.360] set attorney's fees, expenses, and costs. [43:32.360 --> 43:37.920] And he just scratched all that stuff out and signed it and initialed it where he scratched [43:37.920 --> 43:38.920] it out. [43:38.920 --> 43:39.920] Okay. [43:39.920 --> 43:40.920] Okay. [43:40.920 --> 43:41.920] Hang on. [43:41.920 --> 43:42.920] Hang on. [43:42.920 --> 43:43.920] We're back there. [43:43.920 --> 43:44.920] Sure. [47:34.720 --> 47:42.720] Yeah, I just wanted to finish up by saying that when the judge signed the order dismissing the case, [47:42.720 --> 47:54.720] he scratched out the attorney's request for future motion to establish a reasonable attorney's fees and expenses and costs. [47:58.720 --> 48:07.720] But what the judge, I don't know if he realized it or not, under the act, under this Texas Citizen Participation Act, [48:07.720 --> 48:22.720] once a judge finds that the case should be dismissed, the attorney's fees, costs, and expenses are mandatory, and he has to award them. [48:22.720 --> 48:42.720] And also, he can, and it even says and should, he shall award sanctions to prevent the filing of a slapsuit like this in the future by the plaintiff. [48:42.720 --> 48:54.720] So the punishment is mandatory under this act, but the problem is that in the haste to quickly get it dismissed, [48:54.720 --> 49:00.720] the attorneys did not put in the record any information about their attorney's fees. [49:00.720 --> 49:06.720] So there's no evidence in the file, no affidavit, no nothing about attorney's fees. [49:06.720 --> 49:12.720] So even if the judge wanted to find them, there was nothing to find in there and he couldn't award them. [49:12.720 --> 49:25.720] So it looks like in reality, if I appeal it, that the defendants will also appeal on their own, [49:25.720 --> 49:32.720] requesting the mandatory attorney's fees, costs, and expenses, and even the sanctions. [49:32.720 --> 49:38.720] So that's kind of an amazing deal. [49:38.720 --> 49:42.720] It raises an interesting question. [49:42.720 --> 49:51.720] The way it sounds is the judge is required to grant attorney fees or sanctions. [49:51.720 --> 49:56.720] That's right, and it's also required to punish the plaintiff, [49:56.720 --> 50:06.720] because what a granting of this motion really says is that the lawsuit is groundless [50:06.720 --> 50:12.720] and is a slapsuit designed purely to prevent the exercise of liberties. [50:12.720 --> 50:19.720] And I'll be damned if that's what my lawsuit is, and they better all well know it. [50:19.720 --> 50:23.720] I mean, this is ridiculous. This suit is not about that. [50:23.720 --> 50:30.720] And I can't believe he even granted it under these conditions. [50:30.720 --> 50:34.720] I mean, it's bizarre. It's beyond comprehension. [50:34.720 --> 50:40.720] It's been my experience that when you are a pro se, [50:40.720 --> 50:45.720] the courts will just about rule against you out of hand at every turn [50:45.720 --> 50:49.720] without regard for the right of things or the rule of law. [50:49.720 --> 50:56.720] Well, I'm not sure that that's always the case, [50:56.720 --> 50:59.720] because I'm sure too that even if you had a lawyer, [50:59.720 --> 51:03.720] I've had a lawyer and gone up on appeal many times [51:03.720 --> 51:09.720] and had many things ruled against them where I had to appeal it now, [51:09.720 --> 51:11.720] but we won on appeal. [51:11.720 --> 51:16.720] But that doesn't mean that they're going to rule in your favor [51:16.720 --> 51:19.720] just because you have an attorney. [51:19.720 --> 51:21.720] Well, possibly not. [51:21.720 --> 51:25.720] And in fact, I've been talking to an attorney and I asked him yesterday, [51:25.720 --> 51:31.720] I said, if he wanted to actually handle the appeal. [51:31.720 --> 51:33.720] I said, you know, it might be better. [51:33.720 --> 51:34.720] And he said, no, Ron. [51:34.720 --> 51:40.720] He said, it's not going to be any better on me than it is on you. [51:40.720 --> 51:42.720] I said, you just go on up there with your stuff. [51:42.720 --> 51:47.720] I think these guys don't have a defense that I can see. [51:47.720 --> 51:50.720] And you just take it on up there, [51:50.720 --> 51:54.720] and you're going to do about as well as I do with it. [51:54.720 --> 51:57.720] In this case, I would tend to agree with him, [51:57.720 --> 52:00.720] and that's what I tend to agree with, [52:00.720 --> 52:03.720] is where you expect to win it is in appeal. [52:03.720 --> 52:09.720] And I tell everybody, expect them to rule against you in the trial court. [52:09.720 --> 52:13.720] That way you don't feel so devastated when they do. [52:13.720 --> 52:14.720] You expect it. [52:14.720 --> 52:15.720] Oh, yeah. [52:15.720 --> 52:16.720] Well, you're right. [52:16.720 --> 52:18.720] And that's the way I approached it, too. [52:18.720 --> 52:20.720] So I wasn't devastated. [52:20.720 --> 52:27.720] I just got my stuff together and planning on appeal. [52:27.720 --> 52:30.720] The appeal is where the action is. [52:30.720 --> 52:33.720] Because now you have a court of appeals, [52:33.720 --> 52:36.720] they have to maintain the court of jurors. [52:36.720 --> 52:41.720] They have a different agenda than that trial court does. [52:41.720 --> 52:45.720] They render this ruling, and if they rule against you, [52:45.720 --> 52:53.720] the most likely outcome will be is that the legislature will pick this up [52:53.720 --> 52:56.720] and readjust the legislation. [01:04:01.720 --> 01:04:18.720] And what I'd like to do is go in and ask for information they're either not going to want to give me or not going to understand where I'm going or what I'm looking for. [01:04:18.720 --> 01:04:29.720] So I plan on going down there early in the week and I'll start out by pulling her file. [01:04:29.720 --> 01:04:37.720] So this is Weatherford in Parker County, Texas, and they know who I am down there. [01:04:37.720 --> 01:04:39.720] They've had some run-ins with me. [01:04:39.720 --> 01:04:47.720] And this particular judge, Judge Buckner, has had a run-in with me where I tried to get the district attorney to arrest him. [01:04:47.720 --> 01:04:51.720] So he is not going to be happy when I show up. [01:04:51.720 --> 01:05:07.720] So how do we use that background, that reputation I have to get them to want to go back and revisit what they're doing? [01:05:07.720 --> 01:05:11.720] So you can't do that with a direct threat. [01:05:11.720 --> 01:05:24.720] If we go in and we say, you didn't do this like you were supposed to and we pushed them, then they're going to say, oh, yeah, we did, and they're going to push right back. [01:05:24.720 --> 01:05:33.720] So let's get them to try to figure out how we're going to try to sting them. [01:05:33.720 --> 01:05:40.720] Now, the judge is going to pretty well think that I'm going to be coming after him because that's what I did last time. [01:05:40.720 --> 01:05:43.720] I tried to get him arrested. [01:05:43.720 --> 01:06:02.720] And so what can we do to give the judge reason to believe that he may have done something that will make him vulnerable? [01:06:02.720 --> 01:06:11.720] First thing you need to do is contact the court and find out who the court reporter is. [01:06:11.720 --> 01:06:21.720] And ask the court if they have a method of requesting a transcript or do I have to do that directly with the court reporter? [01:06:21.720 --> 01:06:27.720] And if so, I need the court reporter's name and business address. [01:06:27.720 --> 01:06:32.720] So that'll start this thing rolling. [01:06:32.720 --> 01:06:41.720] And then when I come down there, which will probably be Tuesday, I have to come into town Tuesday anyway and I don't have a show on Tuesday. [01:06:41.720 --> 01:06:54.720] So after you request the transcripts on Monday, then the thing about transcripts is anybody can request them. [01:06:54.720 --> 01:07:02.720] Since your wife does, have you filed an affidavit of inability to pay? [01:07:02.720 --> 01:07:04.720] No, sir. [01:07:04.720 --> 01:07:05.720] Okay. [01:07:05.720 --> 01:07:10.720] They file an affidavit of inability to pay and request the transcripts. [01:07:10.720 --> 01:07:12.720] That way you can get them you don't have to pay for them. [01:07:12.720 --> 01:07:15.720] And have your wife do that from inside the jail? [01:07:15.720 --> 01:07:17.720] No, sir. [01:07:17.720 --> 01:07:34.720] Okay, I can help you make up the affidavit or ask the court for you go down and ask the court for their form for an affidavit of inability to pay and motion for court appointed counsel. [01:07:34.720 --> 01:07:40.720] And ask for court appointed counsel, I'll show you how to take care of the counsel. [01:07:40.720 --> 01:07:51.720] And then I will come down and start asking for some really directed pieces of information. [01:07:51.720 --> 01:08:02.720] One of the things I want to see are payments to court appointed counsel. [01:08:02.720 --> 01:08:09.720] I want to see all of the payments to all court appointed counsel for the last month. [01:08:09.720 --> 01:08:14.720] And they're going to say, why is he asking us for that? [01:08:14.720 --> 01:08:19.720] And they can ask me why I'm asking for that, but I'm not going to tell them. [01:08:19.720 --> 01:08:24.720] What I tell them is, don't ask me that. [01:08:24.720 --> 01:08:26.720] Okay, that's the first thing. [01:08:26.720 --> 01:08:29.720] And here's the reason I'll be asking for that. [01:08:29.720 --> 01:08:31.720] I live in Wise County. [01:08:31.720 --> 01:08:50.720] And in Wise County, court appointed counsel, if they get a client and the client goes into a plea bargain with the court, the court will pay the lawyer $250. [01:08:50.720 --> 01:09:00.720] If the client does not agree to a plea bargain, they'll pay the lawyer $125. [01:09:00.720 --> 01:09:05.720] So how does that work? [01:09:05.720 --> 01:09:13.720] We had someone on there once who was fighting, who's pretty knowledgeable and had court appointed counsel. [01:09:13.720 --> 01:09:15.720] He's trying to get the counsel to do different things. [01:09:15.720 --> 01:09:26.720] And finally, the lawyer got frustrated and told him, look, my only job is to make sure you don't have anything you can appeal. [01:09:26.720 --> 01:09:28.720] Is that a fact, Jack? [01:09:28.720 --> 01:09:34.720] And that's what we think your lawyer or your wife's lawyer was originally doing. [01:09:34.720 --> 01:09:40.720] And then we put together a malpractice suit against the lawyer. [01:09:40.720 --> 01:09:49.720] Since you fired the lawyer before you got to court, then you have option to sue. [01:09:49.720 --> 01:09:58.720] If you go to court and lose your case, you've got law that says you can't sue the lawyer for malpractice because you lose. [01:09:58.720 --> 01:10:03.720] So since you fired him before you lost, now you can sue him. [01:10:03.720 --> 01:10:09.720] So you send a notice of tort to the lawyer and we'll bar-grieve the lawyer. [01:10:09.720 --> 01:10:11.720] We may bar-grieve the lawyer a couple of times. [01:10:11.720 --> 01:10:16.720] I need to know what all he has done. [01:10:16.720 --> 01:10:24.720] Oh, did your wife request from the lawyer all of the lawyer's records that he has on your case? [01:10:24.720 --> 01:10:26.720] We've requested everything. [01:10:26.720 --> 01:10:30.720] They wouldn't even let us use any of the transportation codes in the courtroom. [01:10:30.720 --> 01:10:31.720] They said they were scoffing. [01:10:31.720 --> 01:10:32.720] No, no, no, different issue. [01:10:32.720 --> 01:10:33.720] I understand that. [01:11:02.720 --> 01:11:07.720] But first, we need to do some, I'll do some digging from outside. [01:11:07.720 --> 01:11:15.720] And then we'll prepare some discovery that your wife can do from inside. [01:11:15.720 --> 01:11:20.720] And we'll prepare a challenge subject matter jurisdiction for the wife to file. [01:11:20.720 --> 01:11:24.720] You take it to her and she'll file it from inside. [01:11:24.720 --> 01:11:28.720] But first thing she needs is an affidavit of inability to pay. [01:11:28.720 --> 01:11:32.720] And it almost has to be graded because she's in jail. [01:11:32.720 --> 01:11:42.720] And before they can do that, we'll give her probably a habeas corpus. [01:11:42.720 --> 01:11:44.720] Yes, sir. [01:11:44.720 --> 01:11:50.720] A habeas, we show that the court lacks subject matter jurisdiction. [01:11:50.720 --> 01:11:57.720] And we'll prepare a challenge subject matter jurisdiction to file along with the habeas. [01:11:57.720 --> 01:12:02.720] So that's likely to get them excited. [01:12:02.720 --> 01:12:05.720] Then they'll see bad things coming at them. [01:12:05.720 --> 01:12:10.720] And then you file a bar grievance against the lawyer and the prosecutor. [01:12:10.720 --> 01:12:13.720] And we'll work out how to do that. [01:12:13.720 --> 01:12:18.720] You can bar grieve the prosecutor for not telling the judge when he's screwing up. [01:12:18.720 --> 01:12:24.720] And we're maintaining that the court lacks subject matter jurisdiction from the beginning. [01:12:24.720 --> 01:12:29.720] And it was the duty of the prosecutor to notify the court that it lacks subject matter jurisdiction. [01:12:29.720 --> 01:12:32.720] So you bar grieve the lawyer for that. [01:12:32.720 --> 01:12:40.720] And it's most likely an assistant district attorney and not the elected district attorney. [01:12:40.720 --> 01:12:44.720] If it's an assistant district attorney, they don't expect to be there forever. [01:12:44.720 --> 01:12:47.720] And you bar grieve them when they get out. [01:12:47.720 --> 01:12:54.720] Their malpractice insurance is going to go through the roof on them and they know it. [01:12:54.720 --> 01:12:56.720] So that stings them. [01:12:56.720 --> 01:12:59.720] And you might want to get a couple of bar grievances in. [01:12:59.720 --> 01:13:02.720] That way they can't get malpractice insurance. [01:13:02.720 --> 01:13:07.720] You want a couple of bar grievances on your original court appointed counsel. [01:13:07.720 --> 01:13:11.720] And you want a lawsuit against the court appointed counsel. [01:13:11.720 --> 01:13:15.720] Now you ask them to appoint you new counsel. [01:13:15.720 --> 01:13:22.720] And when you sue court appointed counsel, every lawyer in the venue is going to know about it. [01:13:22.720 --> 01:13:33.720] And then when the judge appoints somebody else, he's going to have a fit because he knows you're going to do the same thing to him. [01:13:33.720 --> 01:13:38.720] Unless he makes you happy. [01:13:38.720 --> 01:13:41.720] This is politics. [01:13:41.720 --> 01:13:48.720] Okay, when you go to court, it's like sitting at a three-sided chessboard. [01:13:48.720 --> 01:13:53.720] Across from you, I'm sorry, to your right you have your lawyer. [01:13:53.720 --> 01:13:56.720] To your left you have opposing counsel. [01:13:56.720 --> 01:13:59.720] Across from you you have the judge. [01:13:59.720 --> 01:14:05.720] Now, multiple-sided chess is all about relationships. [01:14:05.720 --> 01:14:12.720] Some of the players have to gang up on the other players to start eliminating them one at a time. [01:14:12.720 --> 01:14:16.720] So when you go to court, it's all about relationships. [01:14:16.720 --> 01:14:19.720] You have a relationship with your lawyer. [01:14:19.720 --> 01:14:25.720] Your lawyer has a relationship with opposing counsel because they deal with one another all the time. [01:14:25.720 --> 01:14:27.720] And he has a relationship with the judge. [01:14:27.720 --> 01:14:29.720] They both have a relationship with the judge. [01:14:29.720 --> 01:14:33.720] You're the odd one out. [01:14:33.720 --> 01:14:39.720] So if you don't do anything, they will use their relationships against you. [01:14:39.720 --> 01:14:47.720] And in this case, the judge and a prosecutor use their influence and relationship with your court-appointed counsel [01:14:47.720 --> 01:14:55.720] to influence court-appointed counsel to make sure you take a deal and you don't have grounds for appeal. [01:14:55.720 --> 01:15:00.720] So in this case, you fired the chump, so he wasn't able to do that. [01:15:00.720 --> 01:15:04.720] Now, you want to force them to give you another one. [01:15:04.720 --> 01:15:13.720] But before they give you another one, you want to professionally beat up the one you had by bar grieving him a couple of times [01:15:13.720 --> 01:15:16.720] and then file a malpractice suit against him. [01:15:16.720 --> 01:15:21.720] And what do you think this next lawyer who gets appointed is going to say? [01:15:21.720 --> 01:15:27.720] Holy crap, guys, what did you get me into? [01:15:27.720 --> 01:15:31.720] Now he has plausible deniability. [01:15:31.720 --> 01:15:40.720] Now you can take his relationship with the judge and the opposing counsel and use it to your benefit. [01:15:40.720 --> 01:15:50.720] He gets to tell the judge, you gave me this client who's out of control. [01:15:50.720 --> 01:15:54.720] Now this client is likely to ruin my career. [01:15:54.720 --> 01:15:58.720] You got to do something to protect me from my client. [01:15:58.720 --> 01:16:07.720] Last case I had in Austin, they dismissed my case to protect my lawyer from me [01:16:07.720 --> 01:16:10.720] because the lawyer was afraid I was going to bar grieve him. [01:16:10.720 --> 01:16:17.720] If I bar grieved him, he's a new lawyer, he would lose his malpractice insurance immediately, then he couldn't practice. [01:16:17.720 --> 01:16:23.720] So he's terrified I'm going to cost him his ability to practice. [01:16:23.720 --> 01:16:29.720] Yeah, and the judge dismissed the case clearly to keep me from grieving the lawyer. [01:16:29.720 --> 01:16:36.720] I gave the lawyer a whole stack of criminal complaints to give to the prosecutor, and he held up his hands. [01:16:36.720 --> 01:16:39.720] I'm not going to touch him. I'm not going to touch him. Take him, you chicken. [01:16:39.720 --> 01:16:41.720] And I did this right in front of the judge. [01:16:41.720 --> 01:16:46.720] Went out to lunch. [01:21:07.720 --> 01:21:12.720] We had some storms down in Austin and they give us a little bit of a hiccup, [01:21:12.720 --> 01:21:13.720] but we're getting all that straightened out. [01:21:13.720 --> 01:21:21.720] Okay, back to how to handle your lawyer. [01:21:21.720 --> 01:21:24.720] Lawyers are terrified. [01:21:24.720 --> 01:21:30.720] Lawyers go through law school and they incur an incredible amount of debt, [01:21:30.720 --> 01:21:35.720] on the order of $150,000 to $180,000. [01:21:35.720 --> 01:21:42.720] And they get out of law school and if a law firm doesn't pick them up, [01:21:42.720 --> 01:21:47.720] they have a lot of trouble getting started because in law school, [01:21:47.720 --> 01:21:52.720] they don't teach them how to get motions filed, how to get them put on for hearing. [01:21:52.720 --> 01:21:58.720] All of these technical details that involve the actual practice of law, they don't know. [01:21:58.720 --> 01:22:08.720] And as a result, one of the ways to pay their office help is being court appointed counsel. [01:22:08.720 --> 01:22:15.720] And so most of these guys on the attorney wheels are either new lawyers [01:22:15.720 --> 01:22:24.720] or they're lawyers who, when they were in college, thought they were the mascot for the beer companies. [01:22:24.720 --> 01:22:29.720] Not everybody graduates at the top of their class. [01:22:29.720 --> 01:22:34.720] The ones who graduate at the top of their class get picked up by law firms. [01:22:34.720 --> 01:22:39.720] The ones that are down toward the bottom don't, so they struggle. [01:22:39.720 --> 01:22:46.720] So the judges were lawyers and they're all part of the same group, so they all work together. [01:22:46.720 --> 01:22:50.720] They appoint these guys as court appointed counsel to get them some dollar flow. [01:22:50.720 --> 01:22:52.720] And they don't want them to work too hard. [01:22:52.720 --> 01:22:58.720] Actually, what they want them to do is just get their client to take a deal. [01:22:58.720 --> 01:23:00.720] They don't have to do much of anything. [01:23:00.720 --> 01:23:05.720] And if he takes a deal, you can't appeal because you've agreed to everything. [01:23:05.720 --> 01:23:14.720] The only time they have a problem is when one of these rascal clients actually believes he's innocent. [01:23:14.720 --> 01:23:17.720] And they hate that. [01:23:17.720 --> 01:23:24.720] So in the process, the judge is going to pretty well take care of the new lawyer. [01:23:24.720 --> 01:23:26.720] And the prosecutor is the same way. [01:23:26.720 --> 01:23:31.720] They're not going to hammer this lawyer very hard because they want to train him and bring him along. [01:23:31.720 --> 01:23:35.720] They're all part of the process. [01:23:35.720 --> 01:23:39.720] So there's politics there. [01:23:39.720 --> 01:23:46.720] There's all this political influence from one party to another. [01:23:46.720 --> 01:23:49.720] Generally, that influence is used against you. [01:23:49.720 --> 01:23:54.720] But if you know how to do it, you can turn it back and use it to your favor. [01:23:54.720 --> 01:24:00.720] What your lawyer needs is plausible deniability. [01:24:00.720 --> 01:24:07.720] And the way you give your lawyer plausible deniability is kick him right in his professional behind. [01:24:07.720 --> 01:24:16.720] And here, if you file a bar grievance against the first lawyer, that's going to sting him big time. [01:24:16.720 --> 01:24:20.720] And then you do a malpractice suit against him. [01:24:20.720 --> 01:24:23.720] This guy's not going to be able to practice for a while. [01:24:23.720 --> 01:24:28.720] The only way he's going to be able to practice is if he goes to work for another law firm. [01:24:28.720 --> 01:24:32.720] They're going to put him to work at $15, $20 an hour. [01:24:32.720 --> 01:24:38.720] And he's got a $100,000 student loan to pay off. [01:24:38.720 --> 01:24:40.720] So he'll be struggling for a while. [01:24:40.720 --> 01:24:43.720] You'll really hurt the lawyer. [01:24:43.720 --> 01:24:45.720] But he deserves it. [01:24:45.720 --> 01:24:47.720] And then you ask for another lawyer. [01:24:47.720 --> 01:24:56.720] And the other lawyer is going to be really, really unhappy that he's getting forced to step into this lion's den. [01:24:56.720 --> 01:25:06.720] So it's very likely that his influence with the judge, this good old boy network, [01:25:06.720 --> 01:25:12.720] is going to put the judge in a position to where he has to protect the lawyer. [01:25:12.720 --> 01:25:18.720] And the only way he can protect the lawyer from the lawyer's client is to give the client what the client wants. [01:25:18.720 --> 01:25:20.720] Does that make sense, Jim? [01:25:20.720 --> 01:25:22.720] Yes, sir. [01:25:22.720 --> 01:25:30.720] I know this is not how you were taught in school to think about how the law works. [01:25:30.720 --> 01:25:34.720] But this is how it actually works in the real world. [01:25:34.720 --> 01:25:37.720] Everything is political. [01:25:37.720 --> 01:25:50.720] OK, so on your part or on your wife's part, she will get her a habeas corpus. [01:25:50.720 --> 01:26:01.720] She will ask for an affidavit of inability to pay and a request for transcripts. [01:26:01.720 --> 01:26:08.720] And then I'll go in and ask to see all of the files. [01:26:08.720 --> 01:26:10.720] And that's going to make him really unhappy. [01:26:10.720 --> 01:26:16.720] And then I'll put in a request for payment to lawyers from court appointed counsel payments [01:26:16.720 --> 01:26:34.720] because I want to see if the lawyers are paid the same thing for representing a client if they plea out or if they fight the case. [01:26:34.720 --> 01:26:35.720] But I'm not going to tell them. [01:26:35.720 --> 01:26:39.720] They're going to have to try to figure out what I'm after. [01:26:39.720 --> 01:26:44.720] And I'll figure out some other really obnoxious things to ask them for. [01:26:44.720 --> 01:26:49.720] And maybe the habeas may be enough. [01:26:49.720 --> 01:26:55.720] If we get a good habeas in, they might decide they want this case to go away. [01:26:55.720 --> 01:27:00.720] They don't want to have a fight, especially if you sue the lawyer. [01:27:00.720 --> 01:27:08.720] Because if you sue the lawyer, now you have something to negotiate with. [01:27:08.720 --> 01:27:18.720] So what the prosecutor is likely to do is come to you and make a deal in order to get you to drop the suit against this lawyer. [01:27:18.720 --> 01:27:20.720] Because they got him to screw it up. [01:27:20.720 --> 01:27:21.720] You call him on it. [01:27:21.720 --> 01:27:24.720] Now they owe it to him to protect him. [01:27:24.720 --> 01:27:27.720] Yes, sir. [01:27:27.720 --> 01:27:31.720] OK, does that sound like a plan? [01:27:31.720 --> 01:27:34.720] It sounds like a good plan. [01:33:32.720 --> 01:33:37.720] Okay, well, let's address some of the issues that you were talking about today, [01:33:37.720 --> 01:33:40.720] especially with the license plate thing. [01:33:40.720 --> 01:33:46.720] My deal is now, because I originally thought, oh, yeah, I want to take my license plates off, [01:33:46.720 --> 01:33:50.720] put the not for hire thing on there, yada, yada, yada. [01:33:50.720 --> 01:33:55.720] But since the events have happened in the way they have, [01:33:55.720 --> 01:34:02.720] getting the Addison case going and several other tickets and things like that, [01:34:02.720 --> 01:34:10.720] and then once I started filing criminal charges against the judge and then a cop, [01:34:10.720 --> 01:34:17.720] the attitude towards me with the cops have seemed to change dramatically [01:34:17.720 --> 01:34:22.720] because they've obviously flagged my license [01:34:22.720 --> 01:34:27.720] and because I've noticed that cops will pull up behind me, [01:34:27.720 --> 01:34:33.720] they'll run my license plate, and instead of pulling me over, they'll just go around me. [01:34:33.720 --> 01:34:37.720] Now, I test the theory a little bit different. [01:34:37.720 --> 01:34:41.720] I run around without my tags and inspection on my car. [01:34:41.720 --> 01:34:47.720] You know, it's pretty trivial, it seems like, but it's also a good kind of testing ground [01:34:47.720 --> 01:34:53.720] because when they see me driving around without that tag or inspection, [01:34:53.720 --> 01:34:58.720] they'll automatically come up behind me and they're going to want to pull me over. [01:34:58.720 --> 01:35:03.720] But then when they run my plate, they have a whole different attitude then. [01:35:03.720 --> 01:35:11.720] Let me interject here, and I'm glad you spoke to this this way, [01:35:11.720 --> 01:35:20.720] because when I said earlier, if you decide to take tags off your car, then that's a strategic decision. [01:35:20.720 --> 01:35:27.720] Before you do that, you have to determine that you are prepared to fight this fight. [01:35:27.720 --> 01:35:31.720] And in Scott's case, he was absolutely prepared to fight this fight. [01:35:31.720 --> 01:35:35.720] He did his homework, he put in the time he needed to put in [01:35:35.720 --> 01:35:41.720] so that when they came after him, he was ready for them. [01:35:41.720 --> 01:35:45.720] That is important. You need to stop them early on. [01:35:45.720 --> 01:35:54.720] And Jim's wife had three tickets for expired license. [01:35:54.720 --> 01:35:56.720] It shouldn't have gotten that far. [01:35:56.720 --> 01:36:00.720] The fight should have been on on the first one, big time. [01:36:00.720 --> 01:36:04.720] Keep them from coming back to the second or third. [01:36:04.720 --> 01:36:06.720] But you can eventually pick it up. [01:36:06.720 --> 01:36:10.720] You don't want to have to pick it up once you're serving 90 days in jail. [01:36:10.720 --> 01:36:14.720] We expect that we'll get around a whole lot quicker than that, [01:36:14.720 --> 01:36:19.720] because that's what this other guy in Parker County was serving, [01:36:19.720 --> 01:36:21.720] same time for the same thing. [01:36:21.720 --> 01:36:25.720] And they got him out pretty quick on the habeas. [01:36:25.720 --> 01:36:28.720] So anyway, if you're ready to fight this fight, [01:36:28.720 --> 01:36:31.720] and we have some tools that can help you fight this, [01:36:31.720 --> 01:36:38.720] we, me and Craig, then do your homework first and then take it on. [01:36:44.720 --> 01:36:50.720] And once you've done your homework and you're absolutely ready, [01:36:50.720 --> 01:36:53.720] then you are picking the fight now, [01:36:53.720 --> 01:36:59.720] and you're dictating the narrative on how things are going to go, [01:36:59.720 --> 01:37:02.720] because you already have planned ahead. [01:37:02.720 --> 01:37:04.720] You already know that, okay, I'm going to get a ticket. [01:37:04.720 --> 01:37:09.720] Okay, I'm going to follow charges on a cop or a judge. [01:37:09.720 --> 01:37:11.720] And you know how to do it. [01:37:11.720 --> 01:37:16.720] You're basically three or four moves ahead of the court system, [01:37:16.720 --> 01:37:21.720] because you're planning on everything that they're going to come against you, [01:37:21.720 --> 01:37:24.720] and you're going to get pretty much railroaded. [01:37:24.720 --> 01:37:29.720] But if you're prepared for that, now your mindset's a whole lot different. [01:37:29.720 --> 01:37:32.720] Your attitude's a whole lot different too, [01:37:32.720 --> 01:37:40.720] because instead of being really mad and going and just letting your emotions take over, [01:37:40.720 --> 01:37:44.720] now you're starting to use your intellect. [01:37:44.720 --> 01:37:50.720] And then, like I say, once you can start changing your whole mindset, [01:37:50.720 --> 01:37:55.720] they notice this, and when you start smiling at them [01:37:55.720 --> 01:38:01.720] instead of cussing at them and verbally throwing rocks, [01:38:01.720 --> 01:38:03.720] then they kind of get a little bit nervous too, [01:38:03.720 --> 01:38:07.720] because all of a sudden you're not scared, you're not intimidated. [01:38:19.720 --> 01:38:26.720] The change is we want to show the police that, [01:38:26.720 --> 01:38:32.720] hey, what you're doing is wrong, but your policy and the way you're training is [01:38:32.720 --> 01:38:36.720] you're not upholding the rule of law, [01:38:36.720 --> 01:38:42.720] so we're going to force you to by bringing it to light. [01:38:42.720 --> 01:38:50.720] Yes, and the one primary problem you will have, and Scott is struggling with this [01:38:50.720 --> 01:38:57.720] at the moment, is that it becomes way too much fun. [01:38:57.720 --> 01:39:00.720] You're used to them coming after you, [01:39:00.720 --> 01:39:05.720] you feel yourself squirming under the pressure they put on you. [01:39:05.720 --> 01:39:09.720] When you turn that around on them and you get to watch these police officers [01:39:09.720 --> 01:39:13.720] standing there doing this little chicken dance, [01:39:13.720 --> 01:39:18.720] and the little chicken dance is where they're trying to figure a way [01:39:18.720 --> 01:39:20.720] around what you're throwing at them, [01:39:20.720 --> 01:39:24.720] and they wind up there shifting from one foot to the other, [01:39:24.720 --> 01:39:28.720] and they kind of bob back and forth like a chicken. [01:39:28.720 --> 01:39:34.720] The first time I saw that, it reminded me of a trip I took to Florida, [01:39:34.720 --> 01:39:39.720] and I was just from Florida to Chicago, and I'm just north of Atlanta, [01:39:39.720 --> 01:39:41.720] and there's a chicken truck in front of me. [01:39:41.720 --> 01:39:43.720] It's got chicken crates stacked up on it, [01:39:43.720 --> 01:39:47.720] and a chicken has got out at the back of the last crate, [01:39:47.720 --> 01:39:48.720] and he's right up on the top. [01:39:48.720 --> 01:39:50.720] It's tapered up like a pyramid, [01:39:50.720 --> 01:39:56.720] and he's right one step below the top of the whole thing, [01:39:56.720 --> 01:39:58.720] and they're running down the road about 70 miles an hour, [01:39:58.720 --> 01:40:00.720] and there's a chicken standing there, [01:40:00.720 --> 01:40:04.720] and he kept poking his head up over that crate, [01:40:04.720 --> 01:40:08.720] and I'm back here behind him waiting for that chicken [01:40:08.720 --> 01:40:10.720] to try to jump up on that crate [01:40:10.720 --> 01:40:15.720] so I can see him get plucked at 70 miles an hour. [01:40:15.720 --> 01:40:19.720] It didn't occur to me that he'd wind up coming through my windshield [01:40:19.720 --> 01:40:23.720] if he did that, but I was younger and more ignorant then, [01:40:23.720 --> 01:40:30.720] but then when I saw one of these policemen kind of just straighten up [01:40:30.720 --> 01:40:32.720] and then shift from one foot to the other, [01:40:32.720 --> 01:40:36.720] it reminded me of that chicken on that crate, [01:40:36.720 --> 01:40:40.720] thinking about jumping up on top of it, [01:40:40.720 --> 01:40:46.720] and I get so tickled it's hard for me to keep a straight face, [01:40:46.720 --> 01:40:52.720] but when you do that for the officer, what it does, [01:40:52.720 --> 01:40:56.720] it causes a thing we call pattern interruption. [01:40:56.720 --> 01:41:01.720] You make their expectations come false, [01:41:01.720 --> 01:41:06.720] and this is something that works on a really subtle level. [01:41:06.720 --> 01:41:11.720] My local district judge almost went berserk on me. [01:41:11.720 --> 01:41:16.720] He threatened to have me arrested when the bailiff came over, [01:41:16.720 --> 01:41:23.720] because I'm pressing the judge on the fact that he denied me a right, [01:41:23.720 --> 01:41:27.720] and he called the bailiff over, and the bailiff put his hand on my arm, [01:41:27.720 --> 01:41:31.720] and I looked down at his hand, and then I looked down at his pistol, [01:41:31.720 --> 01:41:36.720] and I said, Mr. Bailiff, I see you wearing a pistol. [01:41:36.720 --> 01:41:40.720] Yes, Mr. Carrollton, I am, and I almost grinned at him, [01:41:40.720 --> 01:41:43.720] and I had to struggle not to, and I said, [01:41:43.720 --> 01:41:47.720] tell me, Mr. Bailiff, is that pistol loaded? [01:41:47.720 --> 01:41:52.720] And as soon as I said that, the judge said, Mr. Bailiff, you can stand down. [01:41:52.720 --> 01:41:59.720] The judge is looking at me, and he's thinking, something's not right here. [01:41:59.720 --> 01:42:02.720] I'm threatening to have him arrested, [01:42:02.720 --> 01:42:08.720] and he's clearly got some other agenda going on because he is not impressed, [01:42:08.720 --> 01:42:12.720] and the judge was absolutely right. [01:42:12.720 --> 01:42:17.720] I will be presenting him or giving notice to the grand jury [01:42:17.720 --> 01:42:22.720] of first-degree felony aggravated assault against him. [01:42:22.720 --> 01:42:29.720] When you are a step ahead of them, they know one of my favorite stories. [01:42:29.720 --> 01:42:32.720] His kid, Magnuson, is in court. [01:42:32.720 --> 01:42:35.720] He files a motion. The judge rules against him. [01:42:35.720 --> 01:42:41.720] He stands up and offers a motion for reconsideration to the court, [01:42:41.720 --> 01:42:46.720] and the judge said, well, Mr. Magnuson, you already had that prepared. [01:42:46.720 --> 01:42:49.720] Well, yes, Your Honor, I did. [01:42:49.720 --> 01:42:53.720] Well, Mr. Magnuson, it seems you were a step ahead of the court, [01:42:53.720 --> 01:42:57.720] and the kid raised three fingers. [01:42:57.720 --> 01:43:00.720] That's where you want to be. [01:43:00.720 --> 01:43:04.720] And in traffic, it is so consistent, so predictable. [01:43:04.720 --> 01:43:08.720] You can be there. It's not hard. [01:43:08.720 --> 01:43:13.720] Once they come across someone, they can't intimidate. [01:43:13.720 --> 01:43:17.720] They can't push around and can't frighten, [01:43:17.720 --> 01:43:22.720] and they realize that you're setting them up. [01:46:45.720 --> 01:46:53.720] Yeah, actually, it was really ironic because I turned in a subject matter jurisdiction, [01:46:53.720 --> 01:46:57.720] and it also had a criminal complaint against the cop. [01:46:57.720 --> 01:47:02.720] Well, the guy before me had the exact same motion, [01:47:02.720 --> 01:47:07.720] and so I'm listening to the judge kind of ring this guy, [01:47:07.720 --> 01:47:12.720] give him the railroad on this motion, and then next, so she, you know, [01:47:12.720 --> 01:47:16.720] says, oh, I'm going to dismiss your motion on both counts, blah, blah, blah, [01:47:16.720 --> 01:47:21.720] and then it's my turn, and then we go through, but here's the difference. [01:47:21.720 --> 01:47:26.720] This guy was trying, doing everything he could to try to, you know, [01:47:26.720 --> 01:47:33.720] make some kind of points about his motion and argue this point, argue that point. [01:47:33.720 --> 01:47:38.720] When she dismissed everything and said, no, no, no, no, I'm not accepting any of that, [01:47:38.720 --> 01:47:42.720] well, when it was my turn, I didn't argue anything. [01:47:42.720 --> 01:47:46.720] All I asked the judge was, did you read the motion? [01:47:46.720 --> 01:47:50.720] And she went off on a little tyrant raid, [01:47:50.720 --> 01:47:54.720] and then the little city attorney got up and he babbled for a little bit, [01:47:54.720 --> 01:47:58.720] and then it came back to me, and I just came back to the same question. [01:47:58.720 --> 01:48:00.720] I said, judge, did you read the motion? [01:48:00.720 --> 01:48:04.720] And she finally, I finally was starting to get under her skin [01:48:04.720 --> 01:48:08.720] and I was forcing her to answer the question, and she didn't like it, [01:48:08.720 --> 01:48:13.720] and she finally got a little bit nasty, and she goes, yes, I read the motion. [01:48:13.720 --> 01:48:18.720] And I said, and you're going to, and judge, you're going to deny my motion? [01:48:18.720 --> 01:48:20.720] Yes, I'm going to deny your motion. [01:48:20.720 --> 01:48:22.720] I said, on what ground? [01:48:22.720 --> 01:48:24.720] And she says, oh, wow. [01:48:24.720 --> 01:48:26.720] I said, we're done here, judge. [01:48:26.720 --> 01:48:31.720] And that just fried everybody's brain right there because they're like, what? [01:48:31.720 --> 01:48:32.720] And I was like, we're done. [01:48:32.720 --> 01:48:33.720] That's it. [01:48:33.720 --> 01:48:35.720] I got nothing else to say. [01:48:35.720 --> 01:48:43.720] You know, I said, oh, it's the thing where you tell them you don't agree with their, [01:48:43.720 --> 01:48:47.720] with the, I can't believe I'm going into a brain fart now. [01:48:47.720 --> 01:48:54.720] But anyway, I basically told her, with all due respect, you know, [01:48:54.720 --> 01:48:57.720] and I was going to be a little salty about it, but be really nice. [01:48:57.720 --> 01:49:02.720] It's kind of a nice way of saying I, you know, pissed off or whatever. [01:49:02.720 --> 01:49:07.720] And she was like, oh, with all due respect, thank you. [01:49:07.720 --> 01:49:12.720] And then when the whole thing was over, she was kind of like, what is going on? [01:49:12.720 --> 01:49:15.720] There's these motions going around on the internet. [01:49:15.720 --> 01:49:18.720] And I said, judge, this is rule of law radio. [01:49:18.720 --> 01:49:23.720] And I said, we're coming back to take over the court. [01:49:23.720 --> 01:49:26.720] And she kind of just sat there and just looked at me a little wild-eyed. [01:49:26.720 --> 01:49:31.720] And a couple of the bailiffs, they were kind of sitting around grinning and stuff. [01:49:31.720 --> 01:49:33.720] They didn't really know what to think. [01:49:33.720 --> 01:49:35.720] And I just said, that's it. [01:49:35.720 --> 01:49:36.720] We're done. [01:49:36.720 --> 01:49:40.720] And here's the thing I want to convey to a lot of people, or everybody. [01:49:40.720 --> 01:49:47.720] All kinds of motions, but the one motion so far that I filed was when I asked for [01:49:47.720 --> 01:49:53.720] discovery to get the video camera evidence from the cops, especially in the [01:49:53.720 --> 01:49:59.720] Addison case, when I submitted that, Addison wrote me back a letter saying [01:49:59.720 --> 01:50:04.720] they're going to hold the hearing for the discovery to see if they even [01:50:04.720 --> 01:50:06.720] wanted to proceed. [01:50:06.720 --> 01:50:10.720] They don't want to give up that information, because I already have that [01:50:10.720 --> 01:50:11.720] video. [01:50:11.720 --> 01:50:14.720] It's got over 1.8 million hits on YouTube. [01:50:14.720 --> 01:50:20.720] And so they don't want nobody else getting that video, especially from their [01:50:20.720 --> 01:50:21.720] side. [01:50:21.720 --> 01:50:27.720] So now they're looking at any way they can to dismiss this case and get me out [01:50:27.720 --> 01:50:30.720] of there at all costs. [01:50:30.720 --> 01:50:32.720] And I'm happy with that. [01:50:32.720 --> 01:50:40.720] Their problem with that is if they decide they don't want to proceed, you [01:50:40.720 --> 01:50:46.720] still get to request the video. [01:50:46.720 --> 01:50:52.720] Open Records Act, or actually a public court. [01:50:52.720 --> 01:50:54.720] So that don't help them. [01:50:54.720 --> 01:51:03.720] They figure if they dismiss the case, you go away and leave them alone. [01:51:03.720 --> 01:51:10.720] Good luck on that, guys. [01:51:10.720 --> 01:51:14.720] Well, there's going to be a lot of surprises for a lot of these little cities, [01:51:14.720 --> 01:51:18.720] because I got one in basically Dallas County, Rockwell County, and Denton [01:51:18.720 --> 01:51:19.720] County. [01:51:19.720 --> 01:51:26.720] And so far, when I started coming back at them, they punted all the court dates [01:51:26.720 --> 01:51:27.720] back three months. [01:51:27.720 --> 01:51:31.720] It was like all of a sudden, everybody's starting to go, I don't really want to [01:51:31.720 --> 01:51:33.720] talk to this guy right now. [01:51:33.720 --> 01:51:37.720] And the more paperwork I submit, it seems like the more they kind of get a [01:51:37.720 --> 01:51:38.720] little bit leery. [01:51:38.720 --> 01:51:46.720] So my advice to everybody is study hard, listen to the show regularly, and [01:51:46.720 --> 01:51:50.720] fight it at all costs. [01:51:50.720 --> 01:51:52.720] Let me interject here. [01:51:52.720 --> 01:51:56.720] This is not about getting out of a ticket. [01:52:46.720 --> 01:52:52.720] I don't know a single police officer that became a police officer so he could [01:52:52.720 --> 01:52:54.720] be a jackbooty thug. [01:52:54.720 --> 01:52:56.720] They want to be the good guys. [01:52:56.720 --> 01:52:57.720] They want to help people. [01:52:57.720 --> 01:53:02.720] And they get into a system they didn't create, and they get stuck inside it. [01:53:02.720 --> 01:53:08.720] So we owe it to them to help fix the system they're stuck in. [01:53:08.720 --> 01:53:11.720] They can't fix it because they're stuck in it.
