[00:00.000 --> 00:05.840] The following use flash is brought to you by the Lone Star Lowdown, providing your jelly [00:05.840 --> 00:08.360] bulletins for the commodities market. [00:08.360 --> 00:21.200] Today in history, news updates and the inside scoop into the tides of the alternative. [00:21.200 --> 00:26.840] Markets for Friday, the 18th of March, 2016, are currently treading with gold, $1,255.09 [00:26.840 --> 00:27.840] an ounce. [00:27.840 --> 00:34.800] Silver, $15.79 an ounce, Texas crude, $40.20 a barrel, and Bitcoin is currently sitting [00:34.800 --> 00:43.280] in about 409 U.S. currency. [00:43.280 --> 00:48.920] Today in history, the year 1314, Jacquez de Malay, the 23rd and last Grand Master of the [00:48.920 --> 00:53.480] Knights Templar, is burned at the stake at a scaffold in front of Notre Dame by decree [00:53.480 --> 00:58.440] of the Cardinals in conjunction with the Archbishop of Seine and some other prelates who were [00:58.440 --> 00:59.560] called in. [00:59.560 --> 01:04.240] Templar Grand Masters de Malay and Charnay were slowly burned to death for refusing to [01:04.240 --> 01:11.040] recant their heretical beliefs today in history. [01:11.040 --> 01:15.660] In recent news, Salah Absalom, Europe's most wanted man for being suspected of physically [01:15.660 --> 01:20.080] partaking in the Paris Islamic State shootings November of last year, was captured today [01:20.080 --> 01:22.140] after a shootout in Brussels. [01:22.140 --> 01:25.680] This captured finally giving investigators the first suspected active participant to [01:25.680 --> 01:27.440] be taken alive. [01:27.440 --> 01:31.600] Prosecutors said a second wanted man, who used the false name of Amin Chakuri, was also [01:31.600 --> 01:33.320] wounded and captured in the raid. [01:33.320 --> 01:38.000] Luckily, French President Francois Hollande was visiting Brussels for a European summit [01:38.000 --> 01:42.120] and was able to personally conduct a joint news conference with the Belgian Prime Minister [01:42.120 --> 01:46.920] Charles Michel where he said that France would request very soon the extradition of Salah [01:46.920 --> 01:48.480] Absalom. [01:48.480 --> 01:53.360] Charnay's services will obviously be seeking information on Islamic State plans and structures, [01:53.360 --> 01:58.080] his contacts in Europe and in Syria, and looking into his support and financial networks. [01:58.080 --> 02:07.120] Police did obtain Absalom's fingerprints as well as fake Syrian and Belgian identity documents. [02:07.120 --> 02:10.760] Radar scans of King Tut's burial chamber have revealed two hidden compartments. [02:10.760 --> 02:15.840] Yesterday at a Cairo news conference, Egyptian Antiquities Minister Mumdo Altamati declined [02:15.840 --> 02:20.360] to comment on whether any royal treasure or more mummies might be inside of the rooms, [02:20.360 --> 02:25.080] but did state that the unexplored chambers could hold some kind of organic or metal objects. [02:25.080 --> 02:29.000] He also showed the results of the radar scans that revealed anomalies in the walls of the [02:29.000 --> 02:33.880] tomb, indicating a possible hidden door and rooms behind false walls that were covered [02:33.880 --> 02:35.760] up and painted over with hieroglyphics. [02:35.760 --> 02:40.200] The radar scans of the chamber taken last year and analyzed in Japan are set to be repeated [02:40.200 --> 02:43.760] at the end of the month for verification. [02:43.760 --> 02:47.280] If you want to start a lowdown that's currently looking to fill some ad slots, either a product [02:47.280 --> 02:54.280] or a service that you'd like to advertise with us, feel free to give me a call at 210-363-2257. [02:54.280 --> 03:22.840] This has been Rick Roadie with your Lowdown for March 18, 2016. [03:25.280 --> 03:32.280] Bad boys, bad boys, whatcha gonna do, whatcha gonna do when they come for you? [03:32.280 --> 03:38.280] Bad boys, bad boys, whatcha gonna do, whatcha gonna do when they come for you? [03:38.280 --> 03:43.280] When you were eight and you had bad treats, you'd go to school and learn the golden rule, [03:43.280 --> 03:46.280] so why are you acting like a bloody fool? [03:46.280 --> 03:52.280] If you get caught in your master coup, bad boys, bad boys, whatcha gonna do, whatcha [03:52.280 --> 03:54.280] gonna do when they come for you? [03:54.280 --> 04:00.280] Bad boys, bad boys, whatcha gonna do, whatcha gonna do when they come for you? [04:00.280 --> 04:05.280] You chuck it on that one, you chuck it on this one, you chuck it on your mother and [04:05.280 --> 04:07.280] you chuck it on your father, you chuck it on your brother and you chuck it on your sister, [04:07.280 --> 04:14.280] you chuck it on that one and you chuck it on me, bad boys, bad boys, whatcha gonna do? [04:14.280 --> 04:16.280] FK, we are back. [04:16.280 --> 04:28.520] to Kelton. We'll go radio on this Friday the 18th day of March 2016. Can it be [04:28.520 --> 04:34.800] that we are already a quarter of the way through another year? That's kind of [04:34.800 --> 04:40.520] scary. And we're here and spring is beginning to spring. It's spring is [04:40.520 --> 04:46.020] beginning to spring something like that. We've just gotten through the winter [04:46.020 --> 04:57.040] that never was. January and February of this year is, were the hottest January [04:57.040 --> 05:06.080] and February months ever, ever in recorded history. So it looks like we're [05:06.080 --> 05:16.240] in for global warming. But then again there is the young group dry us. We are [05:16.240 --> 05:23.800] at the coldest point we have been for 11,000 years in spite of what El Gormi [05:23.800 --> 05:28.480] might want to tell us. So we'll have some global warming for the next 250 years [05:28.480 --> 05:34.520] no matter what. Anyway, enough of global warming for tonight. Tonight we're going [05:34.520 --> 05:41.640] to have a very special guest on. Mr. Michael Banerich who I believe it was [05:41.640 --> 05:47.800] 04 that he ran for president on the libertarian ticket and made some pretty [05:47.800 --> 05:54.120] serious waves and I may get him to reminisce about a little of those. And he [05:54.120 --> 06:02.560] also is, he has moved back to Texas from Indiana and he's in Austin and will [06:02.560 --> 06:09.040] start doing his constitution classes again which were always very well [06:09.040 --> 06:15.160] received. I hope we can get some folks to give it to him and tonight I'll have [06:15.160 --> 06:21.960] Robert, Robert have Michael talk about his constitution class and then we're [06:21.960 --> 06:25.680] going to leave from that into some of the things that we have been talking [06:25.680 --> 06:35.960] about in terms of methods to encourage our public officials back from their [06:35.960 --> 06:42.840] wayward ways back toward constitution. But before I get to that we are going to [06:42.840 --> 06:50.320] extend our fundraiser. We're hasn't done as well as we need it to to be able to [06:50.320 --> 06:53.880] keep this thing on there. We're going to just extend it to the end of [06:53.880 --> 07:01.280] March and we're going to have to end it regardless. You might have noticed we [07:01.280 --> 07:08.080] weren't here yesterday and that's because we're having, we've had some [07:08.080 --> 07:12.000] technical difficulties lately and you may have noticed some of our equipment [07:12.000 --> 07:19.160] has went down and we're having to replace some rather costly equipment in order to [07:19.160 --> 07:25.240] keep this thing going and the show is not bringing in as much as we would like [07:25.240 --> 07:32.080] but then we're we're really not so much of a commercial show as you all may [07:32.080 --> 07:37.280] notice that when we do get on the show and do the commercial side we really [07:37.280 --> 07:41.600] struggle with it because it's really not what we're about it's just something [07:41.600 --> 07:50.440] that we have to do. So if you find value from the show, if you take value from it [07:50.440 --> 07:57.280] it would be greatly appreciated if you would send a little bit of value back. It [07:57.280 --> 08:03.040] doesn't take a lot. If every one of our listeners sent us ten bucks we'd be in [08:03.040 --> 08:09.440] good shape because most of us who do these shows we don't get any, we don't [08:09.440 --> 08:19.080] get paid for it. Actually most of us pay into the show. I put quite a bit of money [08:19.080 --> 08:26.760] into the show every month and most of the other broadcasters do as well and [08:26.760 --> 08:30.400] we're dedicated, we're dedicated. We're here for a purpose. We're certainly not [08:30.400 --> 08:39.000] here to make money. We're here to provide value. You know one day we'd all get old [08:39.000 --> 08:45.920] and we'll look back on our lives and we'll say what did we do that made our [08:45.920 --> 08:54.840] lives of value? And when I get old and look back I'll get to say that this [08:54.840 --> 09:01.920] radio show was something I did for the purpose of giving back value and [09:01.920 --> 09:08.280] if I've given value to some people and helped them along the way that will be a [09:08.280 --> 09:15.280] good thing. Yes as we get older we tend to remember all of our failures and [09:15.280 --> 09:21.640] weaknesses. Dr. Veece is on the show and he spoke about how getting older was [09:21.640 --> 09:27.960] learning to cope with loss and regret. And we get older we look back with regret [09:27.960 --> 09:33.960] on our mistakes but on occasion there are some things we get to look back on [09:33.960 --> 09:39.400] and say well yeah I made some mistakes but I gave back and the show was one of [09:39.400 --> 09:46.520] them. But we do have to ask for a little and we are asking for a little so if you [09:46.520 --> 09:52.120] have a couple bucks extra we'd certainly appreciate it and whatever you [09:52.120 --> 09:59.720] do don't forget about Randy Spear Fund. Okay we really don't have a Randy Spear [09:59.720 --> 10:07.160] Fund. But go to Logos Radio Network and look at our sponsors. We've got a number [10:07.160 --> 10:13.520] of sponsors there and for the most part our sponsors don't pay us monthly. They [10:13.520 --> 10:20.480] pay us based on what you buy from them. So if they have products you could use [10:20.480 --> 10:32.000] especially look at Jurisdictionary, Eddie's Traffic Seminar and the if you [10:32.000 --> 10:41.960] have credit issues we have Michael Morris. Anyway look at our [10:41.960 --> 10:46.800] just go over look at all of our sponsors. We've got a number of sponsors that have [10:46.800 --> 10:52.280] revaluable products that if you can use them it would help us along. We have [10:52.280 --> 10:58.600] Michael Banerich with us. Hello Michael. Hey I'm here can you hear me? Yes I can [10:58.600 --> 11:05.240] I'm gonna stop the shameless promotion and we're gonna we're gonna ask Michael [11:05.240 --> 11:12.560] to do some shameless self-promotion. I understand you're back in Austin. Yeehaw [11:12.560 --> 11:18.720] thank goodness I've been away for way too long. I've traveled all over the [11:18.720 --> 11:29.060] world and I tell everybody Austin is my favorite place on earth because of the [11:29.060 --> 11:32.480] people. So I'm glad you're in Austin. I think Austin will benefit from you being [11:32.480 --> 11:37.880] there and talk to us about what you've been doing and especially want to hear [11:37.880 --> 11:43.760] about your Constitution class. Well I took about five years to go back to [11:43.760 --> 11:51.720] Indiana take care of mom and dad working as a caregiver and now I'm back in [11:51.720 --> 11:59.000] Texas I'm able to kind of get my life together and anybody who's been watching [11:59.000 --> 12:06.400] the presidential debates Republican or Democrat I mean they're just a joke and [12:06.400 --> 12:12.120] people are starting to ask I mean it's like oh my gosh what's going on what [12:12.120 --> 12:20.160] does the Constitution actually say and so I'm gaining a whole lot of you know [12:20.160 --> 12:27.400] popularity after the fact now that people are starting to worry and I'm in [12:27.400 --> 12:33.640] Austin I'll be teaching my Constitution class as often as I possibly can. There's [12:33.640 --> 12:42.800] a class in Austin on March 26th in Chicago April 2nd and then in San Antonio [12:42.800 --> 12:52.440] on Friday April 8th that's just before the Libertarian State Convention so if [12:52.440 --> 12:58.200] you would like a Constitution class in your town all you have to do is call me [12:58.200 --> 13:06.800] I will travel out we'll get it organized and it's it's really helpful to know [13:06.800 --> 13:12.080] what the Constitution actually says why it was written in the first place and [13:12.080 --> 13:17.480] you know what the founding fathers meant you know when they were putting that [13:17.480 --> 13:28.000] thing together so I've also been asking my students for commentary at the end of [13:28.000 --> 13:35.680] the class and if you go to my website Constitutionpreservation.org you can go [13:35.680 --> 13:44.800] to the start here menu and find a calendar for all the places that I have [13:44.800 --> 13:52.880] taught or will be teaching and for all the classes that are in the past I have [13:52.880 --> 13:59.760] commentary from the students and I asked them to rate the class from one to five [13:59.760 --> 14:06.000] stars with five being you know wonderful and terrific and after six classes I [14:06.000 --> 14:13.400] have a unanimous five-star reading I haven't had a single student rate me [14:13.400 --> 14:20.920] less than five so it's pretty dynamic very interactive [14:20.920 --> 14:27.120] Randy can confirm today I get very animated and energetic whenever I'm [14:27.120 --> 14:35.040] talking about Liberty and it's contagious so if you want me to teach my [14:35.040 --> 14:41.080] class in your town give me a call if you want to take it someplace where we're [14:41.080 --> 14:45.240] already teaching it just call me and let me know that you're going to be there [14:45.240 --> 14:51.560] it's very very simple yes I've been to his class and he does get [14:51.560 --> 15:01.880] animated and sometimes I'm glad he doesn't bring the 45 with him Michael is [15:01.880 --> 15:09.120] a very strong advocate of the right to carry and just so you know we now have [15:09.120 --> 15:15.720] right to open carry in Texas I am certainly hoping that a lot of people [15:15.720 --> 15:25.680] take advantage of that because I've been in places where there was open carry and [15:25.680 --> 15:39.000] there was a combat zone but the level of aggression amongst the population [15:39.000 --> 15:46.000] military personnel where we where everybody was armed to the teeth it was [15:46.000 --> 15:54.440] somewhere between zero and nothing so all of these people who complain about [15:54.440 --> 16:01.080] guns it's my position that if everybody was armed guns would be meaningless [16:01.080 --> 16:08.920] except for someone coming in from the outside the first time we had the one [16:08.920 --> 16:17.760] this attack we had in Sandy Hook when that happened we had all of the liberals [16:17.760 --> 16:25.200] jumping up and say we need to get gun control and the American public jumped [16:25.200 --> 16:31.600] up and said no we need to arm the teachers we need to arm everybody and the [16:31.600 --> 16:37.920] vast majority of the people said that every time there's one of these attacks [16:37.920 --> 16:46.640] those people out there who are actually thinking about these things they all say [16:46.640 --> 16:52.960] arm everybody don't take away the weapons yes you're not going to take the [16:52.960 --> 16:58.560] weapons away from the bad guys put them in the hands of the good guys and logos radio network [19:27.920 --> 19:40.880] okay we are back ready to kill him rule of law radio and we're here with our [19:40.880 --> 19:49.120] very special guest mr. Michael Banneric and this just so everybody know some [19:49.120 --> 19:54.120] kind of bushwhacking Michael here this is not something that I've talked to him [19:54.120 --> 19:57.640] about before I've touched on the subject with him but I haven't really went into [19:57.640 --> 20:05.640] it I'm gonna ask Michael to give commentary on what we've been promoting [20:05.640 --> 20:13.760] here on the air in terms of legal remedy for the first few years to do in the [20:13.760 --> 20:21.720] show the primary thrust of the show was to get away from the patriot mythology [20:21.720 --> 20:27.880] it moved toward the Corpus Juris the body of law and the consistent [20:27.880 --> 20:35.720] application of the body of law especially as that body of law affected [20:35.720 --> 20:41.600] the duties and responsibilities of our public officials because it's always [20:41.600 --> 20:49.720] been our purpose to put our public officials in a position such that they [20:49.720 --> 20:55.560] had little rational or reasonable alternative but to follow the code as [20:55.560 --> 21:01.400] it's written and in the process of working with this a few years we've [21:01.400 --> 21:08.320] worked out some ways of thinking about it and the primary thing that has [21:08.320 --> 21:16.240] changed over the years is our focus on politics most of those of us who are [21:16.240 --> 21:23.200] legal researchers we don't really have much use for politics and when I began [21:23.200 --> 21:29.680] researching this I did it from the perspective of an engineer and as far as [21:29.680 --> 21:39.200] I was concerned the statutes and codes were a tech manual and I opened the tech [21:39.200 --> 21:45.440] manual and I followed the steps but then we looked at what was actually going on [21:45.440 --> 21:52.280] and it seemed as though our public officials read a different tech manual [21:52.280 --> 21:59.840] than I did because nothing was done the way the code seemed to say it was [21:59.840 --> 22:06.320] supposed to be done and clearly something was wrong and I came across [22:06.320 --> 22:12.920] a fellow named Ken Magnuson and he had these four rules the perception is [22:12.920 --> 22:21.560] everything everything is negotiable and everything is political and it turned [22:21.560 --> 22:27.800] out that everything is political was absolutely key to understanding how to [22:27.800 --> 22:38.480] bring our public officials to task now you or I as a singular individual it's [22:38.480 --> 22:43.680] hard for us to imagine especially if you're in Texas you're one of 25 [22:43.680 --> 22:53.720] million so how on earth could just one singular solitary individual with no [22:53.720 --> 23:02.840] special power or authority affect the whole system what turns out we can and [23:02.840 --> 23:10.080] one of the reasons we can is most everybody can't imagine how one person [23:10.080 --> 23:15.560] could affect the whole system so they tend not to try and when they think [23:15.560 --> 23:23.200] about affecting the system it seems like a daunting task and I believe a lot of [23:23.200 --> 23:31.520] the reason is perspective is how we think about it everything's political if [23:31.520 --> 23:40.160] you go into court you have to expect that the court is going to rule against [23:40.160 --> 23:45.440] you out of hand at every turn without regard to the right of things of the [23:45.440 --> 23:52.840] rule of law now that may not be right but you will find if you act as if it [23:52.840 --> 24:01.960] is right that it works very well when you step into a courtroom you can expect [24:01.960 --> 24:06.160] the judge to rule against you out of hand at every turn when I go in that's [24:06.160 --> 24:12.640] what I expect and I don't care judging me what everyone wants to my only purpose [24:12.640 --> 24:21.320] in that courtroom is set the record for appeal if the judge's only responsibility [24:21.320 --> 24:26.320] and his duty in the courtroom is to determine the facts in accordance with [24:26.320 --> 24:30.840] the rules of evidence then apply the law as it comes to him to the facts in the [24:30.840 --> 24:41.000] case if he has another agenda that triggers a responsibility that I have I [24:41.000 --> 24:46.240] once swore on my oath that I protect this country from all enemies foreign and [24:46.240 --> 24:52.560] domestic and when I mustered out of the military was made very clear to me that [24:52.560 --> 24:58.120] I was not released from that oath that it was a lifetime oath well I found an [24:58.120 --> 25:07.400] enemy and he is domestic and the fight is on now this enemy is not necessarily an [25:07.400 --> 25:14.520] intentional enemy this it's only secondarily personified in an individual [25:14.520 --> 25:24.480] the real enemy is apathy and disregard and distraction when I tell you know I [25:24.480 --> 25:28.240] tell everybody when I walk into a courthouse I am the baddest motor scooter [25:28.240 --> 25:33.800] in the building and there is only one reason I'm the baddest motor scooter in [25:33.800 --> 25:41.560] the building and I think Michael will back this up 100% the only reason I'm [25:41.560 --> 25:47.200] the baddest motor scooter in the building is I'm nobody I'm not a judge I'm [25:47.200 --> 25:51.640] not a prosecutor I'm not a bailiff a court clerk I'm not any of those things [25:51.640 --> 25:59.240] they're all public fish they're all public servants me I am the map master [25:59.240 --> 26:04.280] they're the servants and I'm the master of those servants I come into the [26:04.280 --> 26:12.760] courthouse to address an issue that I have and I have engaged a judge I've [26:12.760 --> 26:17.080] engaged that judge for the purpose of determining the facts in accordance the [26:17.080 --> 26:19.880] rules of evidence and applying the law as it comes to him to the facts of the [26:19.880 --> 26:30.160] case if he has himself another agenda then that activates my duty as the [26:30.160 --> 26:36.440] master of the servant and when I will give him a rope through the legal system [26:36.440 --> 26:44.640] he will not believe because I'm the one who can do that that's lawyer certainly [26:44.640 --> 26:50.880] can't because that lawyer comes before that judge dangling by his bar card I'm [26:50.880 --> 26:57.080] not dangling by anything I just had a case removed from the state court to the [26:57.080 --> 27:03.160] federal court here in Fort Worth and it was assigned to Judge McBride Judge [27:03.160 --> 27:09.960] McBride's a 98 year old federal judge he may be 99 by now and he is a real [27:09.960 --> 27:19.320] cantankerous stinker he is very well known for his bad attitude and his [27:19.320 --> 27:27.720] capricious and arbitrary manner well I'm looking forward to Judge McBride [27:27.720 --> 27:32.120] doesn't pride you won't have yourself an attitude I see if I can't get it [27:32.120 --> 27:40.240] adjusted for you and I can do that because I am the master of the servants [27:40.240 --> 27:50.640] Michael your opinion oh I agree and they are elected for the explicit purpose of [27:50.640 --> 27:56.080] protecting and defending the Constitution which means that they have [27:56.080 --> 28:02.720] taken an oath to protect our life liberty and private property my first [28:02.720 --> 28:09.480] action usually is to ask them if they have taken this oath and if they say yes [28:09.480 --> 28:14.240] then I asked them how many articles are in the Constitution and when they don't [28:14.240 --> 28:21.320] know I asked them how they purport to defend a Constitution that they haven't [28:21.320 --> 28:28.760] read that they don't understand and it's amazing how quickly they go from you [28:28.760 --> 28:40.440] know aggressive bad cop attitude to you know very passive indeed yes sir mr. [28:40.440 --> 28:52.480] Ben Narek sir I had a circumstance where I I almost had the police officer in [28:52.480 --> 29:00.600] tears not not quite but when I told him that you know he was apparently [29:00.600 --> 29:07.120] impersonating a police officer and that quite possibly was guilty of treason and [29:07.120 --> 29:12.720] that I was going to file lawsuits against him and basically have him put [29:12.720 --> 29:23.360] in jail I I was able to explain it with enough believability I guess that he was [29:23.360 --> 29:31.160] genuinely concerned about his job so one of the things that I think you know your [29:31.160 --> 29:37.000] listeners you know they they listen in and they go wow you know Randy's really [29:37.000 --> 29:42.920] great because you know Randy appears to have a fit you know this will of stone [29:42.920 --> 29:49.320] how do you go into the dragon's den and tweak the tweak the dragon's nose okay [29:49.320 --> 29:55.120] hang on mom like we're about to go to break this is Randy Kelton Michael [29:55.120 --> 30:01.360] Ben Narek rule of our radio our call-in number 512 ever think about all the [30:01.360 --> 30:04.960] things you toss into the garbage and how they might someday be used against you [30:04.960 --> 30:09.440] well most of us don't I'm dr. few years before doctors had determined he was medically unable to [30:53.280 --> 30:57.200] father a child he suspected the father was Hollywood producer Stephen Bing [30:57.200 --> 31:01.520] notorious for also fathering actress Liz Hurley's baby however to no one's [31:01.520 --> 31:05.640] surprise Bing refused to take a paternity test sir Kerkorian hired an [31:05.640 --> 31:09.500] investigator who went fishing about Bing's garbage from the curb outside his [31:09.500 --> 31:13.800] house they hit pay dirt when a used piece of dental floss yielded the DNA [31:13.800 --> [33:55.840 --> 33:57.840] vote for me [33:57.840 --> 33:59.840] okay we are back [33:59.840 --> 34:01.840] read the kelton rule of law radio [34:01.840 --> 34:03.840] and michael you were talking about [34:03.840 --> 34:05.840] the application of constitution [34:05.840 --> 34:07.840] I was [34:07.840 --> 34:09.840] I was merely suggesting that [34:09.840 --> 34:11.840] the listeners [34:11.840 --> 34:13.840] may not [34:13.840 --> 34:15.840] have the same level of [34:15.840 --> 34:17.840] tenacity [34:17.840 --> 34:19.840] that we do [34:19.840 --> 34:21.840] just because we've you know [34:21.840 --> 34:23.840] had just a little bit more experience at it [34:23.840 --> 34:25.840] but just about anybody [34:25.840 --> 34:27.840] can do this I mean you [34:27.840 --> 34:29.840] it really is more about guts [34:29.840 --> 34:31.840] than training [34:31.840 --> 34:33.840] we can give you the information [34:33.840 --> 34:35.840] that proves [34:35.840 --> 34:37.840] that these people [34:37.840 --> 34:39.840] the judges and attorneys [34:39.840 --> 34:41.840] have violated [34:41.840 --> 34:43.840] not only the law but their oath of [34:43.840 --> 34:45.840] office etc [34:45.840 --> 34:47.840] but you've got to have the [34:47.840 --> 34:49.840] courage to go in [34:49.840 --> 34:51.840] and use that [34:51.840 --> 34:53.840] information you know it doesn't matter [34:53.840 --> 34:55.840] how big your gun is if you're not willing to pull [34:55.840 --> 34:57.840] the trigger it's not going to do any [34:57.840 --> 34:59.840] good so [34:59.840 --> 35:01.840] I've kind of worked up [35:01.840 --> 35:03.840] a way to do that [35:03.840 --> 35:05.840] since we're in Texas [35:07.840 --> 35:09.840] in Texas [35:09.840 --> 35:11.840] in law [35:11.840 --> 35:13.840] Bushwhack is perfectly acceptable [35:13.840 --> 35:15.840] it's a great [35:15.840 --> 35:17.840] way to do things [35:17.840 --> 35:19.840] when I walk [35:19.840 --> 35:21.840] into a courtroom in the Dallas-Fort Worth [35:21.840 --> 35:23.840] area pretty much [35:23.840 --> 35:25.840] they all know me [35:25.840 --> 35:27.840] all the judges do [35:27.840 --> 35:29.840] if they don't know me [35:29.840 --> 35:31.840] they know who I am [35:31.840 --> 35:33.840] and they don't want to see me in their [35:33.840 --> 35:35.840] courtroom [35:35.840 --> 35:37.840] sometimes the smaller things [35:37.840 --> 35:39.840] you do turned out to be [35:39.840 --> 35:41.840] to have the greater [35:41.840 --> 35:43.840] effect we had [35:43.840 --> 35:45.840] been filing challenges [35:45.840 --> 35:47.840] in subject matter jurisdiction [35:47.840 --> 35:49.840] in eviction cases [35:49.840 --> 35:51.840] and we always waited to the last minute [35:51.840 --> 35:53.840] to file it because [35:53.840 --> 35:55.840] the subject matter jurisdiction [35:55.840 --> 35:57.840] can be filed at any time [35:57.840 --> 35:59.840] so I go into court [35:59.840 --> 36:01.840] and a friend of mine [36:01.840 --> 36:03.840] we've got two evictions here [36:03.840 --> 36:05.840] we're trying to help people stop foreclosures [36:05.840 --> 36:07.840] stop evictions and foreclosures [36:07.840 --> 36:09.840] so David was first [36:09.840 --> 36:11.840] and he goes in he sits down [36:11.840 --> 36:13.840] and this judge had thrown him in jail two or three times [36:13.840 --> 36:15.840] last time he was in court [36:15.840 --> 36:17.840] the judge told him [36:17.840 --> 36:19.840] you say one more you said that you are not [36:19.840 --> 36:21.840] to say a word or you'll be held in contempt [36:21.840 --> 36:23.840] and he said I object [36:23.840 --> 36:25.840] Bailey forrest him [36:25.840 --> 36:27.840] they threw him in jail [36:27.840 --> 36:29.840] so he's sitting out there waiting [36:29.840 --> 36:31.840] for his hearing to start [36:31.840 --> 36:33.840] and I had to give David credit [36:33.840 --> 36:35.840] it was gutsy just to go in front of this judge [36:35.840 --> 36:37.840] so while he was [36:37.840 --> 36:39.840] sitting up there I went and stood at the bar [36:39.840 --> 36:41.840] and most of my listeners [36:41.840 --> 36:43.840] heard this story [36:43.840 --> 36:45.840] and the judge finally looked up and said can I help you [36:45.840 --> 36:47.840] and I said yes your honor my name is [36:47.840 --> 36:49.840] Randy Kelton and I have hearing deficiency [36:49.840 --> 36:51.840] well Mr. [36:51.840 --> 36:53.840] Kelton what's wrong with your hearing [36:53.840 --> 36:55.840] I said oh judge I was down in Mexico the other day [36:55.840 --> 36:57.840] and I drank too much of that [36:57.840 --> 36:59.840] cheap tequila [36:59.840 --> 37:01.840] and I lost my hearing aid [37:01.840 --> 37:03.840] well why are you telling me I lied to him [37:03.840 --> 37:05.840] I had it in my pocket [37:05.840 --> 37:07.840] well why are you telling me this I said your honor [37:07.840 --> 37:09.840] do you have accommodation for the hearing [37:09.840 --> 37:11.840] impaired no I do not [37:11.840 --> 37:13.840] I see you have a sound system here [37:13.840 --> 37:15.840] would you turn it up no I will not [37:15.840 --> 37:17.840] well then will you [37:17.840 --> 37:19.840] speak up and he did he told Bailey [37:19.840 --> 37:21.840] if I didn't say shut up [37:21.840 --> 37:23.840] he stole me out of the court room [37:23.840 --> 37:25.840] so I sat down and shut up [37:25.840 --> 37:27.840] David had his hearing [37:27.840 --> 37:29.840] he called me up I sat down at the table [37:29.840 --> 37:31.840] they started the hearing objection your honor [37:31.840 --> 37:33.840] I'm here at arms length to the court [37:33.840 --> 37:35.840] I have a challenge subject matter [37:35.840 --> 37:37.840] jurisdiction before the court the judge said yes [37:37.840 --> 37:39.840] Mr. Kelton you just filed that 20 minutes ago [37:39.840 --> 37:41.840] he's about a 30 page doctorate he says yes your honor [37:41.840 --> 37:43.840] I did [37:43.840 --> 37:45.840] well I'm going to deny that motion [37:45.840 --> 37:47.840] I said well so you're [37:47.840 --> 37:49.840] going to deny a challenge subject matter jurisdiction [37:49.840 --> 37:51.840] without even reading it yes Mr. [37:51.840 --> 37:53.840] Kelton I am well thank you [37:53.840 --> 37:55.840] we're done here and I closed my [37:55.840 --> 37:57.840] folder and stood up got to [37:57.840 --> 37:59.840] the bar and pointed at the bait of you [37:59.840 --> 38:01.840] come with me [38:01.840 --> 38:03.840] I get to the door and the bait is [38:03.840 --> 38:05.840] standing there looking confused and I turned to her [38:05.840 --> 38:07.840] around and said well [38:07.840 --> 38:09.840] and one of the baits okay okay he comes on out [38:09.840 --> 38:11.840] get outside [38:11.840 --> 38:13.840] Mr. Bailey Mr. Kelton what can I do for you [38:13.840 --> 38:15.840] I said I need you to arrest [38:15.840 --> 38:17.840] the judge [38:17.840 --> 38:19.840] well why would I arrest the judge [38:19.840 --> 38:21.840] Class A misdemeanor official [38:21.840 --> 38:23.840] oppression criminal violation [38:23.840 --> 38:25.840] 3903 penal code in that [38:25.840 --> 38:27.840] he failed to perform a duty he was [38:27.840 --> 38:29.840] required to perform and in the process [38:29.840 --> 38:31.840] denied me the full free [38:31.840 --> 38:33.840] access to her enjoyment of her right [38:33.840 --> 38:35.840] the bail said well Mr. [38:35.840 --> 38:37.840] Kelton what right did he deny [38:37.840 --> 38:39.840] you in [38:39.840 --> 38:41.840] he denied me of my right to the [38:41.840 --> 38:43.840] accommodation under the hearing of the Americans [38:43.840 --> 38:45.840] with Disabilities Act [38:45.840 --> 38:47.840] the bait said well Mr. Kelton [38:47.840 --> 38:49.840] why didn't you tell the [38:49.840 --> 38:51.840] judge about the Americans with [38:51.840 --> 38:53.840] Disabilities Act heck [38:53.840 --> 38:55.840] if I had done that he might have turned [38:55.840 --> 38:57.840] the sound up [38:57.840 --> 38:59.840] Bailey stood there a minute and this [38:59.840 --> 39:01.840] grin started across his [39:01.840 --> 39:03.840] face [39:03.840 --> 39:05.840] why you set him up [39:05.840 --> 39:07.840] said yeah I did he's a real [39:07.840 --> 39:09.840] sucker for that one wasn't he [39:11.840 --> 39:13.840] that had more [39:13.840 --> 39:15.840] effect than anything [39:15.840 --> 39:17.840] else I've ever done and the point of that [39:17.840 --> 39:19.840] story is [39:19.840 --> 39:21.840] when you go into court [39:21.840 --> 39:23.840] and you invoke [39:23.840 --> 39:25.840] the duty of the court [39:25.840 --> 39:27.840] and [39:27.840 --> 39:29.840] the court doesn't do [39:29.840 --> 39:31.840] what is required to do [39:33.840 --> 39:35.840] then don't stand [39:35.840 --> 39:37.840] there and give legal advice [39:37.840 --> 39:39.840] to the court [39:39.840 --> 39:41.840] now you put your law in [39:41.840 --> 39:43.840] facts before the court as concerns your [39:43.840 --> 39:45.840] case but when the judge acts personally [39:45.840 --> 39:47.840] don't give him [39:47.840 --> 39:49.840] legal advice when a bailiff [39:49.840 --> 39:51.840] fails to do [39:51.840 --> 39:53.840] what he's required to do don't give him [39:53.840 --> 39:55.840] legal advice don't go in there and say [39:55.840 --> 39:57.840] oh well I got these rights [39:57.840 --> 39:59.840] and I got those rights [39:59.840 --> 40:01.840] you got to do this and you got no no no [40:01.840 --> 40:03.840] don't do that [40:03.840 --> 40:05.840] they're real accustomed [40:05.840 --> 40:07.840] to that and they know how to deal with [40:07.840 --> 40:09.840] it [40:09.840 --> 40:11.840] better to go in there [40:11.840 --> 40:13.840] and ask them to [40:13.840 --> 40:15.840] do something now I make it a [40:17.840 --> 40:19.840] requirement or a policy [40:19.840 --> 40:21.840] that I never ask [40:21.840 --> 40:23.840] a public official to do [40:23.840 --> 40:25.840] anything I actually want [40:25.840 --> 40:27.840] them to do [40:27.840 --> 40:29.840] because I never [40:29.840 --> 40:31.840] ask a public official to [40:31.840 --> 40:33.840] do anything that the [40:33.840 --> 40:35.840] law does not specifically [40:35.840 --> 40:37.840] require him to do [40:37.840 --> 40:39.840] and that's because he's [40:39.840 --> 40:41.840] the servant and I'm the master [40:41.840 --> 40:43.840] and when I [40:43.840 --> 40:45.840] request that he perform a duty [40:45.840 --> 40:47.840] he is required to perform [40:47.840 --> 40:49.840] the duty and when he doesn't perform [40:49.840 --> 40:51.840] that duty I'm not going to stand [40:51.840 --> 40:53.840] there and argue with him I'm [40:53.840 --> 40:55.840] the master he's the servant [40:55.840 --> 40:57.840] I don't argue with my servants [40:57.840 --> 40:59.840] when I leave the [40:59.840 --> 41:01.840] courtroom then I go to [41:01.840 --> 41:03.840] the grand jury and ask the grand jury to indict [41:03.840 --> 41:05.840] him and he can explain it to a [41:05.840 --> 41:07.840] grand jury [41:07.840 --> 41:09.840] or I'll prepare a criminal affidavit [41:09.840 --> 41:11.840] and file it with the local Texas [41:11.840 --> 41:13.840] ranger like I just did with my [41:13.840 --> 41:15.840] local district judge [41:15.840 --> 41:17.840] for threatening to [41:17.840 --> 41:19.840] arrest me in the courtroom [41:19.840 --> 41:21.840] when I challenged him for [41:21.840 --> 41:23.840] not giving me [41:23.840 --> 41:25.840] opportunity to challenge the grand [41:25.840 --> 41:27.840] jury pool as authorized [41:27.840 --> 41:29.840] under 16.27 [41:29.840 --> 41:31.840] Texas Code of [41:31.840 --> 41:33.840] Criminal Procedure he had never heard of it [41:33.840 --> 41:35.840] before [41:35.840 --> 41:37.840] never heard of it being done before [41:37.840 --> 41:39.840] his problem [41:39.840 --> 41:41.840] not my problem [41:41.840 --> 41:43.840] my problem is the statute [41:43.840 --> 41:45.840] authorized me to do that [41:45.840 --> 41:47.840] he impaneled the grand jury [41:47.840 --> 41:49.840] without giving me opportunity when I [41:49.840 --> 41:51.840] asked him about it he tried to have [41:51.840 --> 41:53.840] me arrested and a bailiff put his hand on my [41:53.840 --> 41:55.840] arm [41:55.840 --> 41:57.840] and when the bailiff put his hand on my arm [41:57.840 --> 41:59.840] and looked down I said Mr. Bailiff I see [41:59.840 --> 42:01.840] that you are prominently displaying [42:01.840 --> 42:03.840] a deadly weapon yes Mr. Kelton I am [42:03.840 --> 42:05.840] tell me Mr. Bailiff [42:05.840 --> 42:07.840] is that pistol loaded yes Mr. Kelton [42:07.840 --> 42:09.840] it is and then the judge stepped in [42:09.840 --> 42:11.840] that's okay Mr. Bailiff you can [42:11.840 --> 42:13.840] step back [42:13.840 --> 42:15.840] sorry Bubba [42:15.840 --> 42:17.840] too late [42:17.840 --> 42:19.840] the bail has already been [42:19.840 --> 42:21.840] run [42:21.840 --> 42:23.840] what the text [42:23.840 --> 42:25.840] penal code says [42:25.840 --> 42:27.840] if someone commits simple assault [42:27.840 --> 42:29.840] offensive touching or offensive language [42:29.840 --> 42:31.840] and he is prominently [42:31.840 --> 42:33.840] displaying a deadly weapon [42:33.840 --> 42:35.840] that's second degree felony in the state [42:35.840 --> 42:37.840] of Texas [42:37.840 --> 42:39.840] unless he is a public [42:39.840 --> 42:41.840] official acting [42:41.840 --> 42:43.840] under the color of an official [42:43.840 --> 42:45.840] capacity in which case [42:45.840 --> 42:47.840] felony of the first degree [42:47.840 --> 42:49.840] so I [42:49.840 --> 42:51.840] charged the [42:51.840 --> 42:53.840] district judge was committing [42:53.840 --> 42:55.840] first degree felony aggravated assault [42:55.840 --> 42:57.840] against me by assaulting [42:57.840 --> 42:59.840] me with the bailiff [42:59.840 --> 43:01.840] and I gave it to our local [43:01.840 --> 43:03.840] Texas Ranger [43:03.840 --> 43:05.840] and he is going to [43:05.840 --> 43:07.840] be a real unhappy [43:07.840 --> 43:09.840] camper [43:09.840 --> 43:11.840] we just got [43:11.840 --> 43:13.840] new law recently that went in [43:13.840 --> 43:15.840] last September [43:15.840 --> 43:17.840] that took the public [43:17.840 --> 43:19.840] integrity unit away from [43:19.840 --> 43:21.840] prosecuting attorneys [43:21.840 --> 43:23.840] and gave the duty to [43:23.840 --> 43:25.840] investigate public officials to the Texas [43:25.840 --> 43:27.840] Rangers and they were required to come up [43:27.840 --> 43:29.840] with protocols and they came [43:29.840 --> 43:31.840] up with protocols [43:31.840 --> 43:33.840] that violate law [43:33.840 --> 43:35.840] and I'll explain that when I come back [43:35.840 --> 43:37.840] and explain [43:37.840 --> 43:39.840] why I'll be filing criminal [43:39.840 --> 43:41.840] charges against the Texas [43:41.840 --> 43:43.840] Ranger this is so much fun [43:43.840 --> 43:45.840] hang on Randy Kelton I'm not his lawyer [47:23.840 --> 47:25.840] I'm his master [47:25.840 --> 47:27.840] I'm here to invoke [47:27.840 --> 47:29.840] his duty [47:29.840 --> 47:31.840] he can either do his duty or not [47:31.840 --> 47:33.840] and I've told a number of [47:33.840 --> 47:35.840] public officials [47:35.840 --> 47:37.840] I think I told one in front of you [47:37.840 --> 47:39.840] at one time, Robert [47:39.840 --> 47:41.840] that life is filled with [47:41.840 --> 47:43.840] little decisions, we all get to make some [47:43.840 --> 47:45.840] your turn [47:45.840 --> 47:47.840] you can [47:47.840 --> 47:49.840] either follow law [47:49.840 --> 47:51.840] and arrest [47:51.840 --> 47:53.840] this, I think that was the district [47:53.840 --> 47:55.840] judge, I was trying to get him to arrest in [47:55.840 --> 47:57.840] Williamson County [47:57.840 --> 47:59.840] or you can [47:59.840 --> 48:01.840] save your job [48:01.840 --> 48:03.840] and shield the judge from prosecution and [48:03.840 --> 48:05.840] violation of 3805 P.M. Code [48:05.840 --> 48:07.840] it's your call [48:07.840 --> 48:09.840] and I don't care [48:09.840 --> 48:11.840] what they do [48:11.840 --> 48:13.840] and that's the idea, when you go into court [48:13.840 --> 48:15.840] you ask them to do what the law requires them to do [48:15.840 --> 48:17.840] and you really kind of hope they don't [48:17.840 --> 48:19.840] because if they don't [48:19.840 --> 48:21.840] you get there [48:21.840 --> 48:23.840] and then sting them good [48:23.840 --> 48:25.840] from somewhere else [48:25.840 --> 48:27.840] this judge threatened to have me arrested [48:27.840 --> 48:29.840] and had an armed bailiff put his hand on my arm [48:29.840 --> 48:31.840] in order to prevent me from [48:31.840 --> 48:33.840] exercising a right [48:33.840 --> 48:35.840] and the reason the judge stopped [48:35.840 --> 48:37.840] the bailiff [48:37.840 --> 48:39.840] is he could tell that I was [48:39.840 --> 48:41.840] trying to keep from grinning [48:43.840 --> 48:45.840] and all these [48:45.840 --> 48:47.840] warning bells went off and said [48:47.840 --> 48:49.840] wait a minute, this guy is setting you up again [48:49.840 --> 48:51.840] I set him up once before [48:51.840 --> 48:53.840] and the judge saw it coming [48:53.840 --> 48:55.840] so that's why they stopped the bailiff [48:55.840 --> 48:57.840] sorry Bubba [48:57.840 --> 48:59.840] too late [48:59.840 --> 49:01.840] so I went to our local Texas Ranger [49:01.840 --> 49:03.840] and the Rangers were required [49:03.840 --> 49:05.840] to set up a set of protocols [49:05.840 --> 49:07.840] and those protocols [49:07.840 --> 49:09.840] require [49:09.840 --> 49:11.840] the Ranger to get permission [49:11.840 --> 49:13.840] from the prosecuting attorney to investigate [49:13.840 --> 49:15.840] a public official [49:15.840 --> 49:17.840] well it's my position [49:17.840 --> 49:19.840] that a prosecuting attorney has [49:19.840 --> 49:21.840] no discretion concerning [49:21.840 --> 49:23.840] a complaint against a public official [49:23.840 --> 49:25.840] because the code says [49:25.840 --> 49:27.840] when a public prosecuting attorney is made known [49:27.840 --> 49:29.840] in any manner [49:29.840 --> 49:31.840] that a public official has violated [49:31.840 --> 49:33.840] a law relating to his office [49:33.840 --> 49:35.840] he shall reduce complaint and information submitted [49:35.840 --> 49:37.840] to the grand jury [49:37.840 --> 49:39.840] no discretion [49:39.840 --> 49:41.840] so for the Rangers [49:41.840 --> 49:43.840] to have to go to a prosecutor [49:43.840 --> 49:45.840] and ask his permission [49:45.840 --> 49:47.840] to investigate a public official [49:47.840 --> 49:49.840] that prosecutor has no power [49:49.840 --> 49:51.840] to grant or deny [49:51.840 --> 49:53.840] he has no power [49:53.840 --> 49:55.840] to have anything to do with it [49:55.840 --> 49:57.840] so I told [49:57.840 --> 49:59.840] I called the Ranger and told him I'd be filing [49:59.840 --> 50:01.840] criminal charges against the district judge [50:01.840 --> 50:03.840] what are you going to do with it [50:03.840 --> 50:05.840] he said well I'm going to take it to the district attorney [50:05.840 --> 50:07.840] and if the district attorney gives [50:07.840 --> 50:09.840] me permission then I'll investigate it [50:09.840 --> 50:11.840] oh [50:11.840 --> 50:13.840] and if the prosecuting attorney [50:13.840 --> 50:15.840] doesn't give you permission [50:15.840 --> 50:17.840] what are you going to do then [50:17.840 --> 50:19.840] well I'm not going to do anything with it [50:19.840 --> 50:21.840] oh okay that'll work [50:21.840 --> 50:23.840] so I [50:23.840 --> 50:25.840] went down and personally [50:25.840 --> 50:27.840] delivered a verified [50:27.840 --> 50:29.840] criminal affidavit against the district judge [50:29.840 --> 50:31.840] accusing him of first degree [50:31.840 --> 50:33.840] felony aggravated assault [50:33.840 --> 50:35.840] it's been about three weeks I haven't heard [50:35.840 --> 50:37.840] anything back [50:37.840 --> 50:39.840] so I want to give him about 30 days [50:39.840 --> 50:41.840] then I'm going to go to the [50:41.840 --> 50:43.840] district clerk [50:43.840 --> 50:45.840] and ask the district [50:45.840 --> 50:47.840] clerk to show me any [50:47.840 --> 50:49.840] complaints against the district judge [50:49.840 --> 50:51.840] that have been forwarded to the complaint [50:51.840 --> 50:53.840] to the court [50:53.840 --> 50:55.840] by some magistrate [50:55.840 --> 50:57.840] after an examining trial [50:57.840 --> 50:59.840] under chapter 16 [50:59.840 --> 51:01.840] which requires [51:01.840 --> 51:03.840] the magistrate after the [51:03.840 --> 51:05.840] examining trial under 17.30 [51:05.840 --> 51:07.840] to seal all documents had in the [51:07.840 --> 51:09.840] hearing cause his name to be [51:09.840 --> 51:11.840] written across the seal of the envelope [51:11.840 --> 51:13.840] and forwarded to the clerk to go to jurisdiction [51:13.840 --> 51:15.840] since the Texas Ranger [51:15.840 --> 51:17.840] is a certified peace officer [51:17.840 --> 51:19.840] in the state of Texas and is [51:19.840 --> 51:21.840] employed in that [51:21.840 --> 51:23.840] capacity when he's made known that a [51:23.840 --> 51:25.840] crime has been committed under 2.13 [51:25.840 --> 51:27.840] he's required to reduce [51:27.840 --> 51:29.840] complaint information submitted to some [51:29.840 --> 51:31.840] magistrate [51:31.840 --> 51:33.840] magistrate's required to hold an [51:33.840 --> 51:35.840] examining trial seal all the documents [51:35.840 --> 51:37.840] and send them to the clerk [51:37.840 --> 51:39.840] so I'm going to go to the clerk [51:39.840 --> 51:41.840] and see if she's got [51:41.840 --> 51:43.840] a complaint from [51:43.840 --> 51:45.840] the district judge [51:45.840 --> 51:47.840] it doesn't matter in an [51:47.840 --> 51:49.840] examining trial whether he [51:49.840 --> 51:51.840] finds probable cause or not [51:51.840 --> 51:53.840] he's to seal all the documents anyway [51:53.840 --> 51:55.840] send them to the clerk and when the clerk doesn't have it [51:55.840 --> 51:57.840] then I'll go file [51:57.840 --> 51:59.840] criminal charges against the Texas Ranger [51:59.840 --> 52:01.840] with the grand jury [52:01.840 --> 52:03.840] and the Ranger [52:03.840 --> 52:05.840] I'm going to go to the [52:05.840 --> 52:07.840] likely to get a call [52:07.840 --> 52:09.840] from somebody investigating [52:09.840 --> 52:11.840] him [52:11.840 --> 52:13.840] and what's he going to say? [52:13.840 --> 52:15.840] oh [52:15.840 --> 52:17.840] I filed a policy [52:17.840 --> 52:19.840] but that's not the question [52:19.840 --> 52:21.840] the question is [52:21.840 --> 52:23.840] did you fail [52:23.840 --> 52:25.840] to present [52:25.840 --> 52:27.840] this verified criminal complaint [52:27.840 --> 52:29.840] to some magistrate [52:29.840 --> 52:31.840] the way the statute requires you to [52:31.840 --> 52:33.840] my favorite [52:33.840 --> 52:35.840] kind of complaint to file [52:35.840 --> 52:37.840] against a public official [52:37.840 --> 52:39.840] is a complaint [52:39.840 --> 52:41.840] accusing the official of [52:41.840 --> 52:43.840] following policy [52:43.840 --> 52:45.840] now let [52:45.840 --> 52:47.840] that Ranger go to the guys who put [52:47.840 --> 52:49.840] together this policy [52:49.840 --> 52:51.840] and have them explain [52:51.840 --> 52:53.840] why this guy's out here [52:53.840 --> 52:55.840] trying to get him indicted [52:55.840 --> 52:57.840] the Ranger's never seen [52:57.840 --> 52:59.840] me [52:59.840 --> 53:01.840] it would work better if he [53:01.840 --> 53:03.840] never sees me [53:03.840 --> 53:05.840] when you file these complaints [53:05.840 --> 53:07.840] it's better if you do it by mail [53:07.840 --> 53:09.840] so nobody ever sees you [53:09.840 --> 53:11.840] you're sharp shooting them [53:11.840 --> 53:13.840] they don't know who they're dealing with [53:13.840 --> 53:15.840] everything is [53:15.840 --> 53:17.840] political [53:17.840 --> 53:19.840] when I file against the Ranger [53:19.840 --> 53:21.840] every Texas Ranger in the state [53:21.840 --> 53:23.840] of Texas is going to find out [53:23.840 --> 53:25.840] about it [53:25.840 --> 53:27.840] new protocols, Ranger [53:27.840 --> 53:29.840] protocols, now somebody's trying [53:29.840 --> 53:31.840] to get him indicted [53:31.840 --> 53:33.840] who's going to come in [53:33.840 --> 53:35.840] and save me from indictment [53:35.840 --> 53:37.840] who's going to preserve my career [53:37.840 --> 53:39.840] for [53:39.840 --> 53:41.840] following your [53:41.840 --> 53:43.840] protocols [53:43.840 --> 53:45.840] I can't [53:45.840 --> 53:47.840] find any code [53:47.840 --> 53:49.840] that authorizes a public [53:49.840 --> 53:51.840] official to follow a protocol [53:51.840 --> 53:53.840] that violates the law [53:53.840 --> 53:55.840] are you familiar with anything like that? [53:55.840 --> 53:57.840] no [53:57.840 --> 53:59.840] they do that [53:59.840 --> 54:01.840] on a semi-regular [54:01.840 --> 54:03.840] basis but they're never going to [54:03.840 --> 54:05.840] admit it, at least not in writing [54:05.840 --> 54:07.840] because [54:07.840 --> 54:09.840] their job is to [54:09.840 --> 54:11.840] follow the law [54:11.840 --> 54:13.840] and [54:13.840 --> 54:15.840] they've got most people buffaloed into thinking [54:15.840 --> 54:17.840] that that's exactly what they're doing [54:17.840 --> 54:19.840] but they're not [54:19.840 --> 54:21.840] and it's [54:21.840 --> 54:23.840] our job [54:23.840 --> 54:25.840] we are the masters [54:25.840 --> 54:27.840] it's our job [54:27.840 --> 54:29.840] when they step across one of our [54:29.840 --> 54:31.840] legal lines [54:31.840 --> 54:33.840] is to call them on it [54:33.840 --> 54:35.840] and the more [54:35.840 --> 54:37.840] minor the complaint the better [54:37.840 --> 54:39.840] I don't want [54:39.840 --> 54:41.840] to ruin this Ranger's [54:41.840 --> 54:43.840] career [54:43.840 --> 54:45.840] I don't want to do him any harm [54:45.840 --> 54:47.840] but [54:47.840 --> 54:49.840] we don't always get what we want [54:49.840 --> 54:51.840] and [54:51.840 --> 54:53.840] in that perspective [54:53.840 --> 54:55.840] I don't want to wait until the Ranger [54:55.840 --> 54:57.840] does something horrible [54:57.840 --> 54:59.840] I want to sting him [54:59.840 --> 55:01.840] the first time he steps across a legal [55:01.840 --> 55:03.840] line [55:03.840 --> 55:05.840] the smaller the better [55:05.840 --> 55:07.840] that'll make him more reluctant [55:07.840 --> 55:09.840] to step across a bigger one [55:09.840 --> 55:11.840] we do this show, we get these people [55:11.840 --> 55:13.840] calling in with all these horrible things they do [55:13.840 --> 55:15.840] we've got someone [55:15.840 --> 55:17.840] calling tonight who [55:17.840 --> 55:19.840] over a traffic ticket [55:19.840 --> 55:21.840] a police officer [55:21.840 --> 55:23.840] took out his billy club and smashed [55:23.840 --> 55:25.840] in this guy's window [55:25.840 --> 55:27.840] because the person was [55:27.840 --> 55:29.840] asking for probable cause [55:29.840 --> 55:31.840] now [55:31.840 --> 55:33.840] this could well cost the officer his [55:33.840 --> 55:35.840] job, this could get him put in prison [55:35.840 --> 55:37.840] if he put that [55:37.840 --> 55:39.840] the officer didn't know [55:39.840 --> 55:41.840] that Scott had his [55:41.840 --> 55:43.840] video camera on [55:43.840 --> 55:45.840] he was slightly hidden [55:45.840 --> 55:47.840] he put the video on the internet [55:47.840 --> 55:49.840] and got 1.8 [55:49.840 --> 55:51.840] in hits [55:51.840 --> 55:53.840] this policeman could lose his job [55:53.840 --> 55:55.840] for doing what he's been trained to do [55:57.840 --> 55:59.840] never what I want to happen [55:59.840 --> 56:01.840] I want to [56:01.840 --> 56:03.840] sting him over something minor [56:03.840 --> 56:05.840] so he doesn't do something bigger [56:07.840 --> 56:09.840] it's easier, it's less threatening [56:09.840 --> 56:11.840] to sting him over something [56:11.840 --> 56:13.840] minor [56:13.840 --> 56:15.840] and what is most threatening [56:15.840 --> 56:17.840] is when they feel like [56:17.840 --> 56:19.840] you set them up [56:19.840 --> 56:21.840] and I outright [56:21.840 --> 56:23.840] told this ranger [56:23.840 --> 56:25.840] that I was setting him up [56:27.840 --> 56:29.840] Ranger Howe [56:29.840 --> 56:31.840] I am sorry that you were the [56:31.840 --> 56:33.840] one that stepped in [56:33.840 --> 56:35.840] into this mess [56:35.840 --> 56:37.840] but I didn't [56:37.840 --> 56:39.840] pick you, you were there [56:39.840 --> 56:41.840] sorry I'm [56:41.840 --> 56:43.840] going to have to do it to you [56:43.840 --> 56:45.840] nothing personal [56:45.840 --> 56:47.840] life is tough [56:47.840 --> 56:49.840] but I'm going to sting his career [56:49.840 --> 56:51.840] over something that [56:51.840 --> 56:53.840] he feels like he was doing [56:53.840 --> 56:55.840] what he was supposed to be doing [56:57.840 --> 56:59.840] but we have screws v US [56:59.840 --> 57:01.840] and screws v US says [57:01.840 --> 57:03.840] that while a private citizen cannot [57:03.840 --> 57:05.840] claim ignorance of the laws of defense to [57:05.840 --> 57:07.840] prosecution [57:07.840 --> 57:09.840] a public official is held to a much [57:09.840 --> 57:11.840] higher standard [57:11.840 --> 57:13.840] if a public official [57:13.840 --> 57:15.840] violates a ruling [57:15.840 --> 57:17.840] of this court [57:17.840 --> 57:19.840] and he'd be sane [57:19.840 --> 57:21.840] he may not be heard to say he knows [57:21.840 --> 57:23.840] what he does so [57:23.840 --> 57:25.840] if you're going to strap that pistol [57:25.840 --> 57:27.840] on your hip and you're going to assume [57:27.840 --> 57:29.840] that authority [57:29.840 --> 57:31.840] you need to be well [57:31.840 --> 57:33.840] aware of the requirements of that [57:33.840 --> 57:35.840] authority and don't come crying to me [57:35.840 --> 57:37.840] because I did notice [57:37.840 --> 57:39.840] that you breached it [57:39.840 --> 57:41.840] you're the [57:41.840 --> 57:43.840] servant, I'm the master [57:43.840 --> 57:45.840] you are to follow my law [57:45.840 --> 57:47.840] and I really don't care what your [57:47.840 --> 57:49.840] opinion about it is [57:49.840 --> 57:51.840] this has been [57:51.840 --> 57:53.840] the most effective tactic [57:53.840 --> 57:55.840] we can find [57:55.840 --> 57:57.840] we have a number of people doing it [57:57.840 --> 57:59.840] we've opened up the grand jury [57:59.840 --> 58:01.840] we're about to go to break [58:01.840 --> 58:03.840] I'll explain how we've done that [58:03.840 --> 58:05.840] on the other side [58:05.840 --> 58:07.840] and it's using their own law [58:07.840 --> 58:09.840] we just [58:09.840 --> 58:11.840] read the code and follow the code [58:11.840 --> 58:13.840] the way it's written [58:13.840 --> 58:15.840] we read the constitution and hold [58:15.840 --> 58:17.840] them to it [58:17.840 --> 58:19.840] might like to hear [58:19.840 --> 58:21.840] their opinion [58:21.840 --> 58:23.840] but as to the prosecution [58:23.840 --> 58:25.840] it's not [58:25.840 --> 58:27.840] relevant [58:27.840 --> 58:29.840] okay, back to go to break [58:29.840 --> 58:31.840] Randy Kelton, Wheel of Law Radio [58:31.840 --> [01:00:00.720 --> 01:00:05.800] The following news flash is brought to you by the Lone Star Lowdown, providing the deli [01:00:05.800 --> 01:00:13.520] bulletins for the commodities market. Today in history, news updates and the inside scoop [01:00:13.520 --> 01:00:24.080] into the tides of the alternative. Markets for Friday, the 18th of March, 2016, are currently [01:00:24.080 --> 01:00:33.680] treading with gold $1,255.09 an ounce, silver $15.79 an ounce, Texas crude $40.20 a barrel, [01:00:33.680 --> 01:00:44.360] and Bitcoin is currently sitting in about $409 U.S. currency. Today in history, the [01:00:44.360 --> 01:00:50.440] year 1314, Jacques Demolet, the 23rd and last Grand Master of the Knights Templar, is burned [01:00:50.440 --> 01:00:55.080] at the stake at a scaffold in front of Notre Dame by decree of the Cardinals in conjunction [01:00:55.080 --> 01:01:00.160] with the Archbishop of Seine and some other prelates who were called in. Templar Grand [01:01:00.160 --> 01:01:05.320] Masters Demolet and Tornay were slowly burned to death for refusing to recant their heretical [01:01:05.320 --> 01:01:14.320] beliefs today in history. In recent news, Salah Absalom, Europe's most wanted man for [01:01:14.320 --> 01:01:18.520] being suspected of physically partaking in the Paris Islamic State shootings November [01:01:18.520 --> 01:01:23.680] of last year, was captured today after a shootout in Brussels, this capture finally giving investigators [01:01:23.680 --> 01:01:28.200] the first suspected active participant to be taken alive. Prosecutors said a second [01:01:28.200 --> 01:01:32.640] wanted man who used the false name of Amin Chakouri was also wounded and captured in [01:01:32.640 --> 01:01:37.400] the raid. Luckily, French President Francois Hollande was visiting Brussels for a European [01:01:37.400 --> 01:01:41.520] summit and was able to personally conduct a joint news conference with the Belgian Prime [01:01:41.520 --> 01:01:46.680] Minister Charles Michel where he said that France would request very soon the extradition [01:01:46.680 --> 01:01:51.680] of Salah Absalom. Security services will obviously be seeking information on the Islamic State [01:01:51.680 --> 01:01:56.520] plans and structures, his contacts in Europe and in Syria, and looking into his support [01:01:56.520 --> 01:02:01.640] in financial networks. Police did obtain Absalom's fingerprints as well as fake Syrian and Belgian [01:02:01.640 --> 01:02:07.120] identity documents. [01:02:07.120 --> 01:02:10.920] Radar scans of King Tut's burial chamber have revealed two hidden compartments. Yesterday [01:02:10.920 --> 01:02:16.400] at a Cairo news conference, Egyptian antiquities minister Mumdou Aldamadi declined to comment [01:02:16.400 --> 01:02:20.960] on whether any royal treasure or more mummies might be inside of the rooms, but did state [01:02:20.960 --> 01:02:25.280] that the unexplored chambers could hold some kind of organic or metal objects. He also [01:02:25.280 --> 01:02:29.840] showed the results of the radar scans that revealed anomalies in the walls of the tomb, [01:02:29.840 --> 01:02:34.160] indicating a possible hidden door and rooms behind false walls that were covered up and [01:02:34.160 --> 01:02:38.200] painted over with hieroglyphics. The radar scans of the chamber taken last year and analyzed [01:02:38.200 --> 01:02:42.200] in Japan are set to be repeated at the end of the month for verification. [01:02:42.200 --> 01:02:55.720] The Moscow Lowdown is firmly looking to fill some ad slots. If you have a product or service [01:02:55.720 --> 01:03:18.800] that you would like to see with your Lowdown for March 18, 2016. [01:03:18.800 --> 01:03:25.800] We are back, Randy Kelton, Redelaw Radio, here with Michael Bennerick, and on the show [01:03:25.800 --> 01:03:32.000] we were talking about a little experience in Williamson County where it was part of [01:03:32.000 --> 01:03:41.280] my learning experience. This is before I learned enough not to do this directly in front of [01:03:41.280 --> 01:03:51.720] them but to use bushwhack, and in this case I kind of got in their faces. Michael, do [01:03:51.720 --> 01:03:55.040] you want to tell that story? [01:03:55.040 --> 01:04:06.480] I love this story. I was invited. I was living in Texas here in Austin, and Deborah called [01:04:06.480 --> 01:04:13.400] and she said that, you know, you and she were going to go up to Williamson County and you [01:04:13.400 --> 01:04:19.280] were going to be, you know, filing this paperwork against the district attorney, or I guess [01:04:19.280 --> 01:04:24.640] that we were going to file paperwork against a police officer, and she's telling me all [01:04:24.640 --> 01:04:30.800] this stuff, and I'm going, yeah, you go sister, I'm just like giving all sorts of moral support, [01:04:30.800 --> 01:04:38.240] and she said, well, we want you to come too. For those who don't know, Williamson County [01:04:38.240 --> 01:04:47.600] is the epitome of the good old boy network, and there are people literally who will circumvent [01:04:47.600 --> 01:04:51.160] Williamson County so they don't have to drive through it. [01:04:51.160 --> 01:04:55.080] So that's how Alex Jones is one of them. [01:04:55.080 --> 01:05:01.640] Yeah, I don't know if Alex does or not, but it's not a place that you want to get pulled [01:05:01.640 --> 01:05:09.440] over. So anyway, Deborah is telling me that, you know, she wants me to go along, and while [01:05:09.440 --> 01:05:16.760] I really didn't want to because Williamson County has such a famous reputation, but she [01:05:16.760 --> 01:05:23.240] kind of, you know, she, while she was going, and I couldn't very well hold my head up high [01:05:23.240 --> 01:05:30.920] knowing that Deborah was brave enough to go, and it's like, well, okay, I mean, how bad [01:05:30.920 --> 01:05:32.200] can it be? [01:05:32.200 --> 01:05:41.360] So we were all driving up in your truck, and you were explaining to us that, you know, [01:05:41.360 --> 01:05:47.040] when they get the drug war, you know, they get the guy who buys a couple ounces of marijuana, [01:05:47.040 --> 01:05:52.400] and they don't really care about him, but they threaten him with a bunch of jail time [01:05:52.400 --> 01:05:58.400] so that he will give them the names of, you know, the bigger dealers, and that way they [01:05:58.400 --> 01:06:00.440] can move it up the chain. [01:06:00.440 --> 01:06:06.080] And so this is basically a similar strategy. We file a little complaint against one of [01:06:06.080 --> 01:06:12.480] the police officers, and we're not really aiming for the police officer, but when the [01:06:12.480 --> 01:06:19.840] district attorney doesn't follow the rules, then we can file, you know, paperwork against [01:06:19.840 --> 01:06:25.400] the district attorney. So, okay, I'm listening to all this, and we get there, and I think [01:06:25.400 --> 01:06:30.240] we had a camera with us too. There was a TV camera going along. I don't remember what [01:06:30.240 --> 01:06:31.240] that was all about. [01:06:31.240 --> 01:06:33.760] Yeah, we had a camera crew. [01:06:33.760 --> 01:06:42.320] So we go upstairs to the district attorney's office, and we explain that we have this paperwork [01:06:42.320 --> 01:06:50.040] we want to give to the district attorney. Well, one of the detectives came to speak [01:06:50.040 --> 01:06:56.120] to us, and the detective is, you know, well-dressed, shirt and tie, and a shoulder holster, his [01:06:56.120 --> 01:07:04.040] badge on his belt and all this, and the detective leads us into the small waiting room. And, [01:07:04.040 --> 01:07:09.200] you know, Randy is explaining that we have this paperwork against the police officer. [01:07:09.200 --> 01:07:19.600] We want the detective to take it to the district attorney and have it filed. And the detective [01:07:19.600 --> 01:07:26.800] said, well, I can't do that. And Randy knows the Texas statutes the way I know the Constitution, [01:07:26.800 --> 01:07:33.280] and he's rattling off this statute and that statute and explaining to the detective that [01:07:33.280 --> 01:07:41.160] he has no discretion in this case, that the law says that when he is given a complaint [01:07:41.160 --> 01:07:47.760] that he will sign it and take it to the district attorney. That's his job. [01:07:47.760 --> 01:07:51.920] So the detective said, well, let me go talk to him. So he goes to talk to the district [01:07:51.920 --> 01:07:55.640] attorney, and we're sitting in the waiting room and waiting and waiting and waiting. [01:07:55.640 --> 01:08:02.280] And finally, I'm thinking, it's been a long time. It's been 30, 45 minutes. I mean, I'm [01:08:02.280 --> 01:08:10.600] getting a little bit nervous. So the detective comes back, hands Randy the paper and says, [01:08:10.600 --> 01:08:19.760] we've decided to decline your offer. And Randy says, okay, and he jumps up, pulls his cell [01:08:19.760 --> 01:08:26.960] phone out of his pocket and dials 911. He says, I need two sheriff's deputies at the [01:08:26.960 --> 01:08:35.920] district attorney's office. And the detective is stunned. And Randy is continuing to say, [01:08:35.920 --> 01:08:45.600] yes, I want these deputies to come and arrest the district attorney. And he says, and also [01:08:45.600 --> 01:08:50.080] the detective, and he turns to the detective and says, what's your name? The detective [01:08:50.080 --> 01:08:57.560] turned white. I mean, this badge and a gun. And here's this man standing in front of him [01:08:57.560 --> 01:09:04.580] talking to somebody on the phone saying that he wants to arrest him. And it was about three [01:09:04.580 --> 01:09:09.520] minutes later, the two sheriff's deputies come running up the stairs. Well, they don't [01:09:09.520 --> 01:09:14.720] come to talk to us. We were the ones that called, but they go running down the hall [01:09:14.720 --> 01:09:20.320] to the district attorney's office. And when they come back a couple of minutes later, [01:09:20.320 --> 01:09:25.560] they escort us out of the office, let us know that we are no longer welcome to sit in the [01:09:25.560 --> 01:09:32.920] office. And Randy's explaining that, well, we've got this paperwork, we want you to arrest [01:09:32.920 --> 01:09:40.200] the district attorney. And they go, not going to happen. You know, you're smoking something, [01:09:40.200 --> 01:09:44.120] you know, get out of here and we're just not going to happen. So then we go downstairs [01:09:44.120 --> 01:09:51.240] to the lobby. And I'm thinking, well, okay, that was interesting. Time to go home. And [01:09:51.240 --> 01:09:58.800] Randy says, okay, what I need is a district judge. I go, what? It's like, yeah, we need [01:09:58.800 --> 01:10:05.960] to file paperwork against the district attorney with the district judge. And Randy says, I [01:10:05.960 --> 01:10:11.400] need a volunteer. Now, at that particular moment, I was standing shoulder to shoulder [01:10:11.400 --> 01:10:17.200] with Debra, who's standing there looking really wonderful. She's got a blouse and a skirt [01:10:17.200 --> 01:10:24.560] on and high heels. And I took a step backwards, just like in the movies. I wanted it to look [01:10:24.560 --> 01:10:29.440] like Debra had volunteered because I figured, you know, she's too pretty, they're not going [01:10:29.440 --> 01:10:34.880] to like beat her up. And Randy points at me and says, Michael, you know, here, and he [01:10:34.880 --> 01:10:41.640] gives me a tablet of paper and a pencil. He says, take notes, look important. And we start [01:10:41.640 --> 01:10:47.200] running to go look for a district judge's office. Well, in for a penny, in for a pound. [01:10:47.200 --> 01:10:52.720] I mean, I'm not going to let Randy go on its own, but I'm not really sure. We're going [01:10:52.720 --> 01:10:58.840] into the Dragon's Den and I sure would like some armor and, you know, big sword. So we [01:10:58.840 --> 01:11:06.920] go into the district, the district judges office, and we're talking to the secretary. [01:11:06.920 --> 01:11:12.120] Randy's explaining to her that she needs to give this paperwork to the district judge [01:11:12.120 --> 01:11:18.520] and have the district judge sign it and all this stuff. And again, quoting many of the [01:11:18.520 --> 01:11:24.040] Texas statutes and, you know, sounded very important. So the secretary says, well, just [01:11:24.040 --> 01:11:30.800] a minute, I'm going to go see what he says. So she goes into the district judges office [01:11:30.800 --> 01:11:38.360] and we're standing or, you know, sitting in the district judges office where the secretary [01:11:38.360 --> 01:11:45.200] is. And, and I'm just nervous. I am deep in the bowels of the Williamson County court [01:11:45.200 --> 01:11:54.560] system and I don't like it a whole lot. All of a sudden we hear footsteps running down [01:11:54.560 --> 01:12:02.360] the hall, running. And in a few seconds later, the two sheriff's deputies that we had seen [01:12:02.360 --> 01:12:09.440] upstairs a few minutes ago come running around the corner. And Randy says, oh, we're glad [01:12:09.440 --> 01:12:18.920] to see you. And I'm thinking, we are? Why, why are we glad? And Randy says, well, we [01:12:18.920 --> 01:12:25.520] want you to go in and arrest the district judge. And, and the, the sheriff's deputies [01:12:25.520 --> 01:12:31.760] are just stunned. They've never heard that sentence before. And it's like, what? Well, [01:12:31.760 --> 01:12:40.840] the younger deputy goes into the judge's office and the older deputy, and I don't know if [01:12:40.840 --> 01:12:45.240] he was a sergeant. I don't know how to count all the stripes, but he, he was obviously [01:12:45.240 --> 01:12:52.560] a veteran of the force, had been there for many years and was smart enough not to go [01:12:52.560 --> 01:13:00.020] tiptoeing through a minefield and, and clever enough to actually listen to Randy's explanation [01:13:00.020 --> 01:13:06.200] of what was going on. And I think that the older deputy was starting to understand and [01:13:06.200 --> 01:13:11.800] starting to buy into all of this. When the younger guy comes out and they said, look, [01:13:11.800 --> 01:13:18.400] you may be right, but we're not going to arrest the district judge. I mean, that is a career [01:13:18.400 --> 01:13:28.320] limiting move that we're just not willing to take. And so while we may empathize with [01:13:28.320 --> 01:13:35.480] your position and, and we may see some logic and merit to the conversation, you're going [01:13:35.480 --> 01:13:41.800] to have to go and file your paperwork someplace else. So now we're getting ready to leave [01:13:41.800 --> 01:13:47.320] and I'm breathing a sigh of relief. I can't get out of this building fast enough. As we're [01:13:47.320 --> 01:13:56.240] walking back to the door to local police officers, these are Williams, Williamson, they're not [01:13:56.240 --> 01:14:02.600] Williamson County, they're local police. They come running down the hall and they basically [01:14:02.600 --> 01:14:13.240] grab Randy and I and escort us into a interrogation room and they shove Randy and I in, Randy [01:14:13.240 --> 01:14:19.640] and I are by the wall. Now you've got two regular police officers and two big burly [01:14:19.640 --> 01:14:26.960] sheriff's deputies standing between me and the door. And I am very conscious of the fact [01:14:26.960 --> 01:14:37.760] that I'm unarmed. It's like, Oh no. And so they are starting to interrogate Randy and [01:14:37.760 --> 01:14:43.520] they're being very aggressive. And I could tell this whole thing was choreographed and [01:14:43.520 --> 01:14:49.640] they start poking Randy in the chest. And as Randy, you know, like starts to squirm to [01:14:49.640 --> 01:14:57.520] defend himself against all this chest poking, they grab Randy, slam him down to the table [01:14:57.520 --> 01:15:07.000] and start to handcuff him. And they accused Randy of assaulting the police officers, which [01:15:07.000 --> 01:15:13.440] is absolutely a ludicrous statement because the police officers were clearly assaulting [01:15:13.440 --> 01:15:21.000] Randy and Randy was just, you know, just like said, responding to the attack. So they are [01:15:21.000 --> 01:15:26.120] arresting Randy, they're putting handcuffs on him. And one of the police officers looks [01:15:26.120 --> 01:15:36.200] at me and says, you're a witness to a crime. And my response was, yes, I am. Now I didn't, [01:15:36.200 --> 01:15:41.040] I don't think that the police officer and I thought about the same crime. I think he [01:15:41.040 --> 01:15:48.280] was, you know, telling me that I was a witness to Randy's crime, but clearly I was a witness [01:15:48.280 --> 01:15:55.120] to the police officer's crime. I mean, they, they had no call whatsoever to be manhandling [01:15:55.120 --> 01:16:01.960] Randy. And Randy's smiling, he's going along with the whole thing and they are now taking [01:16:01.960 --> 01:16:09.520] Randy off in handcuffs. The TV camera is there and everybody's going, what happened? What, [01:16:09.520 --> 01:16:15.520] what's going on? Why is Randy in handcuffs? Why are they putting him in a police car? [01:16:15.520 --> 01:16:22.780] And they want me to explain all of this on camera. And I said, no, I'm, I'm not going [01:16:22.780 --> 01:16:29.320] to say anything. Not at this point because Randy's in jail. I'm not sure what details [01:16:29.320 --> 01:16:38.160] may hinder whatever legal action comes next. So, yes, I am a witness. I have all my information, [01:16:38.160 --> 01:16:43.960] but I'm going to save it for the appropriate time. Forge. Okay. We'll come back to this [01:16:43.960 --> 01:16:52.880] right after the commercial. Okay. This is Randy Hilton with our radio. We'll be right [01:16:52.880 --> 01:16:59.880] back. [01:17:22.880 --> 01:17:29.880] We'll be right back. [01:17:52.880 --> 01:17:59.880] We'll be back. [01:18:22.880 --> 01:18:29.880] We'll be right back. [01:18:52.880 --> 01:18:59.880] We'll be right back. [01:19:22.880 --> 01:19:48.040] Okay. We are back. Randy Hilton with our radio here with Michael Bannerick. And month was [01:19:48.040 --> 01:19:56.840] finishing up the story of the great Williamson County escapade. Well, we had been there and [01:19:56.840 --> 01:20:06.640] fortunately Deborah was far sighted enough to get your truck keys before you and I had [01:20:06.640 --> 01:20:13.960] ventured off towards the judge's office. And so after you got, you know, tossed into the [01:20:13.960 --> 01:20:20.680] police car and taken away, Deborah was able to drive the truck home. And, and here we [01:20:20.680 --> 01:20:26.480] are, we're, you know, we're coming home without Randy. Well, we were nervous about you and [01:20:26.480 --> 01:20:30.560] we're trying to figure out how, what we're going to do. Well, the next morning Deborah [01:20:30.560 --> 01:20:36.800] called and said, we're going back to Williamson County. They're letting Randy out of jail. [01:20:36.800 --> 01:20:42.300] We got to go pick up Randy. So yeah, I'm now I want to see the conclusion of all this. [01:20:42.300 --> 01:20:49.040] So I jumped in the truck. We drive up to Williamson County and we're in the, you know, lobby [01:20:49.040 --> 01:20:56.920] at the police station and they were throwing Randy out of jail. They were trying to get [01:20:56.920 --> 01:21:06.320] rid of him so fast. Now, Randy had applied paperwork in Wise County and had tormented [01:21:06.320 --> 01:21:11.600] the judges and attorneys and police officers there to the point where they were afraid [01:21:11.600 --> 01:21:19.560] of the name Kelton. I guess Williamson County didn't know about Randy yet. Well, overnight [01:21:19.560 --> 01:21:26.400] while Randy was in jail, Williamson County apparently contacted Wise County and Wise [01:21:26.400 --> 01:21:34.760] County said, get him out of the building. You do not, you do not want to make Randy [01:21:34.760 --> 01:21:42.840] Kelton mad. And so when Deborah and I show up to pick Randy up, the sheriff's deputies [01:21:42.840 --> 01:21:48.520] are going, well, I'm sorry, Mr. Kelton. I had no idea that, you know, that you were [01:21:48.520 --> 01:21:53.920] in jail. Can I get you a bottle of water, Mr. Kelton? Let me remind you that I had nothing [01:21:53.920 --> 01:21:59.320] to do with putting you in jail, Mr. Kelton. And I'm really sorry that this happened to [01:21:59.320 --> 01:22:05.200] you. That's a really terrible thing, but it wasn't my fault, Mr. Kelton. And they were [01:22:05.200 --> 01:22:10.800] so deferential. I think that if Randy had held out his finger with a ring, they would [01:22:10.800 --> 01:22:20.520] have kissed it. It was, it was amazing to me to be there at both ends to see on the [01:22:20.520 --> 01:22:26.000] night before where these two police officers, I mean, they were like literally like Gestapo [01:22:26.000 --> 01:22:34.720] agents. They, they were aggressive. They were mean. They were unfriendly. And Randy was [01:22:34.720 --> 01:22:39.800] terribly submissive. I mean, he just kind of went along with it and didn't give them [01:22:39.800 --> 01:22:48.280] a reason to be any more aggressive than they already were. But once they found out that [01:22:48.280 --> 01:22:56.280] Randy was really, really good at paperwork and putting judges and lawyers and police [01:22:56.280 --> 01:23:02.400] officers in the spotlight, so to speak, their attitude changed completely. [01:23:02.400 --> 01:23:09.960] So I guess the moral of the story is that, yes, we have to stand up for our rights. Yes, [01:23:09.960 --> 01:23:16.880] it's going to be require a little bit of education and training on your part. And yes, there [01:23:16.880 --> 01:23:24.480] are some times when you may actually be put in jail for a short period of time, but it's [01:23:24.480 --> 01:23:32.080] not fatal. It's a little uncomfortable. And it gives you an opportunity. It gives you [01:23:32.080 --> 01:23:40.800] more excuse to file more paperwork against these people. And unless we make their lives [01:23:40.800 --> 01:23:47.920] miserable, they're not going to stop doing what they're doing. And the general idea that [01:23:47.920 --> 01:23:54.600] Randy and I want to talk about tonight is that we are beginning to win. There are enough [01:23:54.600 --> 01:24:01.680] people that are going into court. We are throwing so much paperwork at the judges and lawyers [01:24:01.680 --> 01:24:08.400] and police officers that they are now starting to feel the pressure. And if we can keep it [01:24:08.400 --> 01:24:17.200] up and teach more people to do this, then we will eventually win because we have the [01:24:17.200 --> 01:24:30.920] law and logic on our side. I'm done. But that's one of my favorite. That's my favorite Randy [01:24:30.920 --> 01:24:31.920] Kelton story. [01:24:31.920 --> 01:24:32.920] Thank you. [01:24:32.920 --> 01:24:37.280] I just turned on the phone line. So if anybody has a question or comment, give us a call [01:24:37.280 --> 01:24:49.840] 512-646-1984. And the main thing that came out of that and a subsequent visit to Williamson [01:24:49.840 --> 01:25:02.400] County, it indicates that the more corrupt a county is, the more afraid of you they are. [01:25:02.400 --> 01:25:09.120] Debra and I went back to Williamson County. I'm sorry, Debra wasn't with me the second [01:25:09.120 --> 01:25:17.400] time. I went back to, actually she was with me one time. We went back and I had put, there [01:25:17.400 --> 01:25:26.080] was a guy that was arrested for having two prescription drugs in an aspirin bottle. And [01:25:26.080 --> 01:25:36.280] after the arrest, he brought them the prescriptions for the drugs, but they're still prosecuting. [01:25:36.280 --> 01:25:45.720] So I went down there with him and one other person and I told him, if anybody asks, you [01:25:45.720 --> 01:25:50.800] don't know me, we're not together. So I went in and they went to talk to the prosecutor [01:25:50.800 --> 01:25:55.280] and I went to the county clerk and asked to see the criminal complaint, but I asked to [01:25:55.280 --> 01:25:59.520] see the file first. And I looked in the file and there was no criminal complaint. And I [01:25:59.520 --> 01:26:04.400] called the clerk over and asked, where's the criminal complaint? Well, we don't get that. [01:26:04.400 --> 01:26:10.600] Well, how do you initiate a criminal prosecution or there's no criminal accusation? Well, we [01:26:10.600 --> 01:26:15.920] don't know. This is all we get. And they had a little sign up on the wall that said, it's [01:26:15.920 --> 01:26:22.880] a crime to tamper with a government document. And I said, you see that sign up there? It's [01:26:22.880 --> 01:26:28.000] a crime to tamper with the government document. Someone has secreted this criminal complaint [01:26:28.000 --> 01:26:33.320] from you because when someone's arrested, they're required to be taken for a magistrate. [01:26:33.320 --> 01:26:37.080] The magistrate required to hold a hearing and then seal all the documents in an envelope [01:26:37.080 --> 01:26:42.040] to put his name, cause his name to be written across the seal of the envelope and forward [01:26:42.040 --> 01:26:48.440] it to you. Where is it? I don't know. Who has it? I don't know. Well, who might have [01:26:48.440 --> 01:26:53.040] it? Well, the prosecuting attorney might have it. So I went to the prosecuting attorney's [01:26:53.040 --> 01:26:57.320] office and asked them for it. And they didn't know what I was talking about. So I made out [01:26:57.320 --> 01:27:04.480] a information request under say, demanding under the open records act demand all records [01:27:04.480 --> 01:27:08.920] collected symbol maintained by the department that are specifically referenced by article [01:27:08.920 --> 01:27:17.480] 17.30. And I put in a, a date span two days before and two days after this particular [01:27:17.480 --> 01:27:23.520] arrest. Well, then I went to the court and they were having this cattle call hearings [01:27:23.520 --> 01:27:27.240] for their taking pleas and I went and sat down in the courtroom and I'm in a nice suit [01:27:27.240 --> 01:27:32.760] and tie and I sat down, I'm taking notes and I asked the bailiff where I could get a copy [01:27:32.760 --> 01:27:38.840] of the docket sheet. And he told me I could get it downstairs. So I'm sitting here watching [01:27:38.840 --> 01:27:46.120] what's going on, taking notes. Nobody knows who I am. So this young prosecutor came over [01:27:46.120 --> 01:27:51.480] and he said, sir, sir. And I looked up at him and I said, yes. Uh, do you have a case [01:27:51.480 --> 01:27:57.560] here today? Oh, no, no, no, nothing like that. I go back to writing. He stands there a minute, [01:27:57.560 --> 01:28:03.240] sir, sir. And I look up, yes. Do you have a civil case in this court? Oh, no, no, nothing [01:28:03.240 --> 01:28:08.320] like that. And I turned back and go back to writing, stands there a minute. And then he [01:28:08.320 --> 01:28:13.800] says, sir, sir. And I look up at him, hold up both hands with my palms out. No more questions. [01:28:13.800 --> 01:28:20.480] You'd have thought I slapped him, but he, he stood there a minute. I went back to writing [01:28:20.480 --> 01:28:25.240] and he kind of shuffled around a little, little left that an older guy came and leaned over [01:28:25.240 --> 01:28:30.760] the bar and said, sir. And I said, yes. He said, I'm the prosecuting attorney. Is there [01:28:30.760 --> 01:28:36.640] something I can do for you? No. And I went back to writing. He said, well, you know, [01:28:36.640 --> 01:28:42.040] you can get a docket sheet downstairs. I said, you know, as bailiff told me, thank you. And [01:28:42.040 --> 01:28:44.920] I go back to writing. [01:28:44.920 --> 01:28:51.400] I left there and Doug, the one who had been with Sarah to try to get his charges dropped. [01:28:51.400 --> 01:28:57.960] He said, what did you do? Well, nothing. He said, they came to me and said, there's somebody [01:28:57.960 --> 01:29:01.680] in the court. Were you here with somebody else? Oh no, just us. Was somebody here going [01:29:01.680 --> 01:29:05.600] through your record? And Doug told them, I told you, I had this top secret clearance [01:29:05.600 --> 01:29:11.880] and you were going to screw that up. So now they think I'm a fed. They dismissed his case [01:29:11.880 --> 01:29:18.400] and took him down to the clerk and filled out a paper so he could get his bond money [01:29:18.400 --> 01:29:24.320] back and actually took him to the judge and got the judge to sign the dismissal order. [01:29:24.320 --> 01:29:31.600] He came to one of my seminars. I was doing a little presentation to Brave New Books and [01:29:31.600 --> 01:29:37.760] he said, have you ever walked into a room and turned the lights on and watched cockroaches [01:29:37.760 --> 01:29:43.680] scatter? He said, that's what it looked like. And what happened was, is they all looked [01:29:43.680 --> 01:29:49.680] in their deepest, darkest closet at their most horrible skeleton and they knew I knew [01:29:49.680 --> 01:29:54.280] exactly what it was. The more corrupt they are, the more afraid they are. Randy Kelton, [01:29:54.280 --> 01:30:15.640] New Low Radio, we'll be right back. [01:30:15.640 --> 01:30:45.280] Is [01:30:45.280 --> 01:30:50.480] it a girl or a boy? In Denmark and Germany, you should be able to tell by the baby's name. [01:30:50.480 --> 01:30:55.120] It's the law. For example, the name Matty is verboten in Germany because it could cause [01:30:55.120 --> 01:30:59.760] gender confusion. Several countries won't allow names considered harmful to a child's [01:30:59.760 --> 01:31:04.840] self image. The names Adolf Hitler and Satan are banned in New Zealand, which might be [01:31:04.840 --> 01:31:09.200] understandable. But fans of the king of rock and roll might wonder why the name Elvis has [01:31:09.200 --> 01:31:14.600] been rejected in Sweden. What's not surprising is that Chinese baby naming laws reflect the [01:31:14.600 --> 01:31:19.560] country's control agenda. Parents must give newborns names that can be easily scanned [01:31:19.560 --> 01:31:25.520] by a computer for the country's national ID card program. I'm Dr. Catherine Albrecht. [01:33:07.760 --> 01:33:31.080] Okay, we are back with our radio and this story kind of goes to show why it's best to [01:33:31.080 --> 01:33:41.440] bushwhack. Because they know they're doing it wrong. Every police officer that I know [01:33:41.440 --> 01:33:46.880] personally and who will talk to me has said the same thing. They go into police court [01:33:46.880 --> 01:33:51.240] because they want to be the good guys. And they get into police work and find it's not [01:33:51.240 --> 01:33:57.120] anything like they thought it was. They know the system is a horrible mess. They didn't [01:33:57.120 --> 01:34:04.600] create the mess. But once they got into it, their career is committed to it. They're stuck [01:34:04.600 --> 01:34:12.040] with it. I once had a prosecutor. I was crawling down his throat and this was in Wise County. [01:34:12.040 --> 01:34:16.680] He said, one moment, Mr. Kelkin. He got up, he walked past me, he closed his office door, [01:34:16.680 --> 01:34:25.280] came back, sat down and he said, now, if you tell this, I will deny it, but don't stop. [01:34:25.280 --> 01:34:32.240] He said he was a prosecutor for Tarrant County for five years and he just could not do it [01:34:32.240 --> 01:34:41.960] anymore. He said, I could not get up in the morning and look in the mirror and like what [01:34:41.960 --> 01:34:48.480] I saw looking back at me. He said, you may be the only one who can do this. So don't [01:34:48.480 --> 01:34:56.240] stop. He got up, went back, opened the door and we went back to arguing like cats and [01:34:56.240 --> 01:35:03.920] dogs. Okay. We do have a bunch of callers. The call board has lit it up and we have a [01:35:03.920 --> 01:35:09.840] first time caller. So I'm going to go to Lisa in Texas. Hello, Lisa. What do you have for [01:35:09.840 --> 01:35:15.320] us today? Yes, I have a question concerning a simple [01:35:15.320 --> 01:35:22.920] will and a beneficiary. I went to a lawyer with my lover to draw up a simple will as [01:35:22.920 --> 01:35:27.840] to be her beneficiary because she had been put in a nursing home and we don't know how [01:35:27.840 --> 01:35:34.960] much longer she's going to live. And many complications have happened since that where [01:35:34.960 --> 01:35:43.040] I am now being informed that I'm being investigated by a lawyer, all of which I didn't know for [01:35:43.040 --> 01:35:50.800] the last three months now. Okay. On the will, this was your lover's will [01:35:50.800 --> 01:35:55.600] that you were filing? Yes. [01:35:55.600 --> 01:36:06.480] Was your lover deemed to be essentially incompetent at the time you filed the will? [01:36:06.480 --> 01:36:15.640] No. And I took in a letter from her doctor from the nursing home saying from the doctor [01:36:15.640 --> 01:36:25.520] that she had not been deemed incompetent and that she was able to go ahead and go forth [01:36:25.520 --> 01:36:33.480] with talking to legal attorneys to file a will and to carry out her wishes. [01:36:33.480 --> 01:36:42.920] So essentially, you were a courier in filing the will that you weren't a party to the will. [01:36:42.920 --> 01:36:48.760] I mean, you may have been named it, but you weren't a party because she's the party. Did [01:36:48.760 --> 01:36:57.760] she verify the will before a notary or before two independent witnesses? [01:36:57.760 --> 01:37:06.640] Yes. Okay. Do you know who's investigating you? [01:37:06.640 --> 01:37:12.440] I don't know who's investigating me other than, can I just give you a little bit of [01:37:12.440 --> 01:37:15.840] a background quickly? Yes. [01:37:15.840 --> 01:37:22.800] I went to this first lawyer that I just spoke about to get this will and he never returned [01:37:22.800 --> 01:37:28.600] our calls, no matter what. So after about the fourth call, I finally went in. [01:37:28.600 --> 01:37:32.840] Okay. Hold. Stop a second. Did you pay this lawyer? [01:37:32.840 --> 01:37:35.440] No. Okay. Okay. [01:37:35.440 --> 01:37:41.320] No. So we went in. I went in to say, why haven't I heard from you? He said there had been a [01:37:41.320 --> 01:37:48.280] lot of sickness in the firm and that he had done nothing about anything. So we decided [01:37:48.280 --> 01:37:57.160] that we wanted to go to a second lawyer and not retain his services. That is at the point [01:37:57.160 --> 01:38:02.960] three months later down the line now after talking with this second lawyer that we have [01:38:02.960 --> 01:38:12.800] found out that it appears perhaps that this first lawyer went to the judge and told him [01:38:12.800 --> 01:38:19.120] that he had reasons, suspicions, of which I don't know what those are in order to go [01:38:19.120 --> 01:38:29.080] to this judge. And then from that judge, another court-appointed attorney was appointed to [01:38:29.080 --> 01:38:37.320] come out and subpoena me for records on all of my expenditures. [01:38:37.320 --> 01:38:49.520] Okay. Hold on. Everything. Hold on. You said to the judge, what did this judge [01:38:49.520 --> 01:38:56.960] have to do with anything? I don't know other than I was told that a judge [01:38:56.960 --> 01:39:05.840] was now involved and that this judge had subpoenaed another court-appointed attorney to see about [01:39:05.840 --> 01:39:12.080] overriding my guardian ad litem. Okay. You had a guardian ad litem. Who appointed [01:39:12.080 --> 01:39:16.400] you as guardian ad litem? My lover. [01:39:16.400 --> 01:39:21.280] Okay. I heard the dies of the second lawyer. [01:39:21.280 --> 01:39:27.680] You need to file a motion with the court ending the complaint against you. [01:39:27.680 --> 01:39:32.800] Okay. You need to see what was filed. And if this [01:39:32.800 --> 01:39:40.160] lawyer filed it, you need to bar-grieve him immediately. Unless, unless. I shouldn't pick [01:39:40.160 --> 01:39:47.280] on lawyers too much. He didn't take the case. And it may well be that he had a legitimate [01:39:47.280 --> 01:39:53.000] concern. And before we start picking on our public officials, sometimes they do do the [01:39:53.000 --> 01:39:58.720] right things for the right reason. You're saying you're lovers, so I'm assuming this [01:39:58.720 --> 01:40:04.880] is a female-female. So you're not husband and wife. [01:40:04.880 --> 01:40:14.080] We are not husband and wife or married. So the lawyer, he doesn't know for certain [01:40:14.080 --> 01:40:22.360] that you actually have a viable legal relationship. So he may be thinking, I don't know if this [01:40:22.360 --> 01:40:27.800] person has anything to do with this woman. She may just know that this woman is sick [01:40:27.800 --> 01:40:35.800] and can come in here and try to sneak a wheel in. Is there, I'm trying to look at both sides [01:40:35.800 --> 01:40:44.760] before you, before we decide that these guys are bad guys, it may well be that lawyers [01:40:44.760 --> 01:40:53.280] doing what he believes is right. So it may be best to hold, to ask the judge to hold [01:40:53.280 --> 01:41:04.720] an evidentiary hearing on your right to be an ad litem and then ask him to bring up whatever [01:41:04.720 --> 01:41:10.080] issues or questions they have, because they may have some legitimate questions and then [01:41:10.080 --> 01:41:21.040] you can answer those in this issue, go away. I can show you how to start a big fight, but [01:41:21.040 --> 01:41:26.760] this is not really about you. It's about your lover and it's about what's best for her. [01:41:26.760 --> 01:41:37.480] Sometimes we have to bite her lip and just be more concerned about your lover getting [01:41:37.480 --> 01:41:42.760] the outcome that she would have wanted. Even though they may have hurt your feelings and [01:41:42.760 --> 01:41:50.920] make you feel like you're being persecuted, it could well be that that's not the case. [01:41:50.920 --> 01:41:59.600] So they do are speaking about wanting to take her house, her car, of which it's our house. [01:41:59.600 --> 01:42:07.000] Okay, hold on, hold on. You're using pronouns and adverbs and I hate those because I don't [01:42:07.000 --> 01:42:10.200] know who they is referring to. Okay. [01:42:10.200 --> 01:42:22.080] Did you have a new ad litem? The second court-appointed attorney from the [01:42:22.080 --> 01:42:31.800] judge has said that they may want to take the house and all the money and her car away [01:42:31.800 --> 01:42:42.760] from me, of which we live together, and use these as they deem necessary. [01:42:42.760 --> 01:42:49.440] This is often the case when someone's put into a convalescent home. They don't have [01:42:49.440 --> 01:42:56.440] a way to pay for the services. Well, she doesn't have a way to pay. [01:42:56.440 --> 01:43:03.360] She does have a way to pay in these instances. She has the money to pay. [01:43:03.360 --> 01:43:16.200] Then that should get ugly because this is a common scam on the part of lawyers in courts. [01:43:16.200 --> 01:43:21.640] People get old and they get infirm and these no good scoundrels come in and swallow everything [01:43:21.640 --> 01:43:29.480] they have. This is a really major issue in Florida because it's a retirement state. [01:43:29.480 --> 01:43:35.560] They have a whole scam where you end your life absolutely bankrupt because the lawyers [01:43:35.560 --> 01:43:43.320] in courts steal everything you have. In that case, do you have a lawyer? [01:43:43.320 --> 01:43:49.880] You might consider a lawyer in your behalf, but before you do that, you really need to [01:43:49.880 --> 01:44:00.320] do your homework. I'm trying to think. Are you still the Ed Lydum? [01:44:00.320 --> 01:44:03.880] You feel tired when talking about important topics like money and politics? [01:44:03.880 --> 01:44:06.560] Sorry. Are you confused by words like the Constitution [01:44:06.560 --> 01:44:08.280] or the Federal Reserve? What? [01:44:08.280 --> 01:44:12.600] If so, you may be diagnosed with the deadliest disease known today, stupidity. [01:44:12.600 --> 01:44:18.020] Hi, my name is Steve Holt. Like millions of other Americans, I was diagnosed with stupidity [01:44:18.020 --> 01:44:22.760] at an early age. I had no idea that the number one cause of the disease is found in almost [01:44:22.760 --> 01:44:28.160] every home in America, the television. Unfortunately, that puts most Americans at risk of catching [01:44:28.160 --> 01:44:32.700] stupidity, but there is hope. The staff at Brave New Books have helped me and thousands [01:44:32.700 --> 01:44:37.200] of other foxaholics suffering from sports zombieism recover. And because of Brave New [01:44:37.200 --> 01:44:42.680] Books, I now enjoy reading and watching educational documentaries without feeling tired or uninterested. Lisa, [01:46:28.200 --> 01:46:36.040] I don't see you on the line. If your call has dropped, call us back. We've lost you [01:46:36.040 --> 01:46:42.160] there. If we've given you enough, if you're still listening, the first thing you want [01:46:42.160 --> 01:46:47.160] to do is do your homework. You want to look at everything that's been filed in the court [01:46:47.160 --> 01:46:59.080] record. Especially, you want to see the justification for swallowing your lover's possessions. So, [01:46:59.080 --> 01:47:04.960] if you dropped off, give us a call back. If not, check everything that's in the court [01:47:04.960 --> 01:47:12.320] record and then call us back next week. Okay, now we're going to go to Scott in Texas. [01:47:12.320 --> 01:47:21.480] Hello, Scott. Oh, somebody didn't. Okay, hold on. There we go. Okay, now you're unmuted. [01:47:21.480 --> 01:47:25.320] The button didn't take. Go ahead. [01:47:25.320 --> 01:47:34.200] Dang it, boy. Well, anyhow, I just want to let everybody know out there that we are winning. [01:47:34.200 --> 01:47:41.320] And I got a couple of stories that are really good. There are one here in Texas, in Garland, [01:47:41.320 --> 01:47:50.480] Texas, and another one in Boulder, Colorado. So, I've been driving around with my tags [01:47:50.480 --> 01:47:56.720] expired and not even on my car now. In fact, I scraped them off. I don't even drive around [01:47:56.720 --> 01:48:02.920] with tags anymore. Cops passed me. They just kind of keep going because about a week or [01:48:02.920 --> 01:48:10.840] so ago, I went to court for the tags expired, sent in a motion, subject matter of jurisdiction, [01:48:10.840 --> 01:48:18.400] stated everything in the constitution and Texas state law. And the city attorney had [01:48:18.400 --> 01:48:25.600] to hang his hat and admit that it wasn't worth their fight because they knew I'd already [01:48:25.600 --> 01:48:32.920] indicted a judge, already indicted cops because they smashed that one, all that other stuff. [01:48:32.920 --> 01:48:42.000] But anyhow, the thing is people have the power to start turning the actual law back on these [01:48:42.000 --> 01:48:51.360] people. All you have to do is just stand up and use what you have in your own discretion. [01:48:51.360 --> 01:48:57.680] And once people start realizing all this stuff, it's going to be a much better place. But [01:48:57.680 --> 01:49:07.440] we have the duty to put these corrupt judges back in their place. And so, once we take [01:49:07.440 --> 01:49:16.480] the mindset to be able to go in there and do this, it's not that hard. It's just a [01:49:16.480 --> 01:49:24.200] matter of changing all your, the way you feel and I don't know, I got to stop and interject [01:49:24.200 --> 01:49:28.200] for a minute. I'm too hypered up. [01:49:28.200 --> 01:49:32.080] Okay, what about the Colorado issue? [01:49:32.080 --> 01:49:38.760] Okay. Now, I had a buddy of mine because I've been telling him about, you know, all this [01:49:38.760 --> 01:49:46.840] stuff and everything. And he took his tags off and went before judge. And the judge asked [01:49:46.840 --> 01:49:52.400] him, did he want to trial by judge or trial by jury? They want to trial by jury. The judge [01:49:52.400 --> 01:49:57.680] cleared out the courtroom and asked him, why did he want to trial by jury? He said, judge, [01:49:57.680 --> 01:50:04.160] I have a right to travel. It's the constitutional right. He was able to dig up some Colorado [01:50:04.160 --> 01:50:10.280] statutes and sign a little bit of state law. But he confronted them on that. The judge [01:50:10.280 --> 01:50:15.080] actually admitted, you do have a right to travel. He didn't want everybody to know. [01:50:15.080 --> 01:50:20.680] That's why he cleared out the courtroom. And then he had his case dismissed. Just like [01:50:20.680 --> 01:50:28.200] I had my case dismissed with a city attorney. He admitted he had no case and he didn't want [01:50:28.200 --> 01:50:33.320] to fight it. And all I had to do was to stand up and make, he knew I was going to drive [01:50:33.320 --> 01:50:40.800] around without my tags on my car. Cops follow me. If they pull up my plates, they know that [01:50:40.800 --> 01:50:46.760] they got a bear fight coming on their hands because I will take them to court, unlike [01:50:46.760 --> 01:50:53.000] other people that just don't do it. If you stand up and you take them to court, you follow [01:50:53.000 --> 01:50:59.640] the motion, you listen to Randy, y'all will be empowered and be able to do everything [01:50:59.640 --> 01:51:08.040] that he does and not back down on anything. And both my friends in Colorado, he couldn't [01:51:08.040 --> 01:51:14.760] believe he won. And he's just so empowered now, hell, it's just unbelievable. [01:51:14.760 --> 01:51:20.640] And Scott is the one who the judge shouted him down in court when he brought up the right [01:51:20.640 --> 01:51:29.400] to travel issue. So he went and filed a criminal charge against the judge with the grand jury. [01:51:29.400 --> 01:51:33.160] And he filed it in Tarrant County instead of Dallas County because it occurred in Dallas [01:51:33.160 --> 01:51:41.360] County. And the foreman of the grand jury sent him a letter saying that we find no crimes [01:51:41.360 --> 01:51:48.360] subject to, no Tarrant County crimes subject to indictment. So now we're going to go back [01:51:48.360 --> 01:51:54.240] and he's going to file criminal charges against the foreman of the grand jury because 20.09 [01:51:54.240 --> 01:52:01.920] says the grand jury shall investigate into all crimes subject to indictment that come [01:52:01.920 --> 01:52:05.720] to their knowledge by way of any member of the grand jury, by way of the prosecuting [01:52:05.720 --> 01:52:14.440] attorney or any credible person. So the question is, what part of all crimes [01:52:14.440 --> 01:52:23.060] was hard for the foreman to understand? This is an issue that I've been raising. When [01:52:23.060 --> 01:52:31.120] a district judge in panels of grand jury, the district judge has a venue restriction. [01:52:31.120 --> 01:52:37.880] The district judge is a state judge, but since we got enough population and enough judges, [01:52:37.880 --> 01:52:48.360] we no longer have circuit judges. Now we have judges in specific districts and their venue [01:52:48.360 --> 01:52:54.520] is restricted to the district, but there's nothing in law restricting the venue of a [01:52:54.520 --> 01:53:01.840] group grand jury. So the grand jury is claiming a venue restriction or they're acting as if [01:53:01.840 --> 01:53:06.760] there is one, but there's not one in law. So we go back and file against the foreman. [01:53:06.760 --> 01:53:13.160] Now we know that either the prosecutor or district judge who impaneled the grand jury [01:53:13.160 --> 01:53:24.400] advised him to act in that regard. And here's the problem. Whoever advised the grand jury [01:53:24.400 --> 01:53:34.040] was not acting in a judicial capacity. They were acting as a lawyer giving legal advice [01:53:34.040 --> 01:53:43.480] and there is no immunity when you're giving legal advice. So we nail the foreman and let [01:53:43.480 --> 01:53:50.600] the foreman throw whoever gave him that advice under the bus. And then we get to, if it was [01:53:50.600 --> 01:53:56.920] the judge, we get to sue the judge and there's no immunity from that. So we'll go back and [01:53:56.920 --> 01:54:03.000] hammer them. We're working on getting the grand juries completely open. And in the next [01:54:03.000 --> 01:54:10.080] legislative session, we're going to try to get legislation proposed as an addition to [01:54:10.080 --> 01:54:18.280] 20.09 Texas Code of Criminal Procedure that will require the grand jury to sit at least [01:54:18.280 --> 01:54:27.520] once a month for the purpose of hearing criminal complaints by private citizens. We get that [01:54:27.520 --> 01:54:33.080] door open to changes everything. It's like we said, we don't want anybody indicted. That's [01:54:33.080 --> 01:54:38.960] not really the purpose. I mean, sometimes we may if they're really horrible, but we [01:54:38.960 --> 01:54:46.860] really want to file minor teensy-tinesy little things. So we sting them good and let them [01:54:46.860 --> 01:54:52.960] know they can be indicted so that when the policeman pulls me over and I have my usual [01:54:52.960 --> 01:55:02.120] demanding and obnoxious self and he gets to this notion of giving me an attitude adjustment, [01:55:02.120 --> 01:55:08.560] he may have to consider what is a grand jury of my peers, not his peers, likely to think [01:55:08.560 --> 01:55:15.320] about what he's considering doing. That could change his behavior considerably. Go ahead [01:55:15.320 --> 01:55:22.760] Scott. Well, I just want to let you know that I [01:55:22.760 --> 01:55:29.840] got another case in Rockwall and talking about setting these judges up, which is perfect [01:55:29.840 --> 01:55:38.440] because it is 17.03, I believe, and if I'm citing it correctly, Ty. But anyhow, the main [01:55:38.440 --> 01:55:47.720] focus was the judges do not follow procedure when handling criminal complaints from a civilian [01:55:47.720 --> 01:55:55.200] versus a cop. And they get to basically get a warrant out for a person with a judge when [01:55:55.200 --> 01:56:03.560] the cop goes to a person. But when the average person, we the people, try to indict a cop, [01:56:03.560 --> 01:56:09.840] try to indict, but we submit paperwork to indict, it just gets dismissed. But they don't [01:56:09.840 --> 01:56:16.000] handle the paperwork properly and even do it. It gets back to what you're saying is [01:56:16.000 --> 01:56:24.200] people take and read the code and they process it differently than what you process. I mean, [01:56:24.200 --> 01:56:29.080] it's a manual. We read the manual. They're not following the manual. Well, the judges [01:56:29.080 --> 01:56:36.560] aren't following the manual. Well, here's something I'd like Michael to chime in on. [01:56:36.560 --> 01:56:46.160] It is my consideration that when a police officer files a criminal complaint, he does [01:56:46.160 --> 01:56:54.760] not do that in the capacity of a police officer or a peace officer. He does that in the capacity [01:56:54.760 --> 01:57:03.560] of a private citizen. We go back to Kennedy v. State that addresses this issue indirectly [01:57:03.560 --> 01:57:09.600] in addressing prosecuting attorneys. It said in order to avoid the accumulation of power [01:57:09.600 --> 01:57:13.320] in any one office for the purpose of filing a criminal complaint, a prosecuting attorney [01:57:13.320 --> 01:57:23.200] is not a credible person. And a police officer being a part of the executive would amount [01:57:23.200 --> 01:57:32.440] to the government accusing you and prosecuting you. Michael, what's the Constitution say [01:57:32.440 --> 01:57:43.320] about that? I don't know what it says about that. I'm still trying to figure out. I don't [01:57:43.320 --> 01:57:53.000] know that the police officer files the complaint in his private person. We fought a revolution [01:57:53.000 --> 01:58:02.500] to prevent the king from being able to charge you and prosecute you. That's why it was separated [01:58:02.500 --> 01:58:09.800] so that any citizen who has knowledge of crime has a duty to report that crime. I can't find [01:58:09.800 --> 01:58:18.360] anything in law anywhere that gives a police officer any special capacity in that regard. [01:58:18.360 --> 01:58:29.520] That makes sense. When it speaks to crimes, to reporting crime, it has to be reported [01:58:29.520 --> 01:58:39.760] by a citizen under oath. Okay, hang on. We'll be right back. Oh, we got a little more. Randy [01:58:39.760 --> 01:58:50.400] can't move our radio. Getting gunshot running off the cliff. Hang on. We'll be right back.
