[01:02.240 --> 01:07.360] In the news, Silk Road trial day six, which began with defense attorney Joshua Dreidel [01:07.360 --> 01:10.200] cross-examining FBI agent Tom Kiernan. [01:10.200 --> 01:14.960] He's the computer specialist who first examined Ross Ulbricht's computer after his arrest. [01:14.960 --> 01:19.000] Ulbricht is the creator of the Silk Road marketplace and is charged with crimes associated with [01:19.000 --> 01:23.800] his alleged involvement in facilitating drug sales between vendors and customers. [01:23.800 --> 01:27.280] Part of Dreidel's questioning focused on the fact that BitTorrent, a peer-to-peer file [01:27.280 --> 01:30.360] sharing program, was running on Ulbricht's computer. [01:30.360 --> 01:34.480] It appeared he was trying to insinuate that through malware put on Ulbricht's computer, [01:34.480 --> 01:38.720] through BitTorrent, someone could have placed the chat logs in journals on his hard drive. [01:38.720 --> 01:42.000] Any doubt that may have been in the jury's mind after hearing about the possibility of [01:42.000 --> 01:46.840] malware likely vanished after the state's redirect, where U.S. Attorney Howard asked [01:46.840 --> 01:50.240] agent Kiernan if the computer did in fact have any malware. [01:50.240 --> 01:52.080] Kiernan replied in the negative. [01:52.080 --> 01:56.280] Of significance for the defense, there were chats from Ulbricht with a friend where he [01:56.280 --> 01:59.480] states he sold the site in the fall of 2011. [01:59.480 --> 02:04.320] That aligns with an interview conducted in 2013 with Dread Pirate Roberts by Wired reporter [02:04.320 --> 02:09.400] Andy Greenberg, where DPR states he acquired the site from someone else. [02:09.400 --> 02:13.280] The revelation seems to go along with the defense's narrative that Ulbricht built the [02:13.280 --> 02:17.240] site but later gave it up after it became too stressful. [02:17.240 --> 02:21.760] Also revealed during the day through discussion between the judge and the defense is the possibility [02:21.760 --> 02:24.340] that Ulbricht himself may take the stand. [04:06.500 --> 04:14.600] We had a bit of a discussion on the break and I lost track of where we were. [04:14.600 --> 04:19.600] The one thing I mentioned on the break that I probably should mention here is the thing [04:19.600 --> 04:29.400] of bringing the patent forward takes you out of the contract with the state and it has [04:29.400 --> 04:36.560] certain drawbacks because when you sever your contracts with the state you're no longer [04:36.560 --> 04:44.200] a part of this state so you no longer have a right to the amenities provided by this [04:44.200 --> 04:54.360] state, police protection, fire protection, city water, sewage, all of these things that [04:54.360 --> 05:03.720] the city and the states provide that are paid for by our taxes you opt out of those contracts. [05:03.720 --> 05:09.680] Right so you have a contract and pay for the services that you want. [05:09.680 --> 05:15.880] Exactly and that's what we spoke of on the break, some of these people who have done [05:15.880 --> 05:19.480] this have went to the fire department, went to the police department and entered into [05:19.480 --> 05:22.160] contracts with them. [05:22.160 --> 05:29.440] But mainly what interested me about your affidavit was how well documented it was and how it [05:29.440 --> 05:33.480] all seemed to fit together and make sense. [05:33.480 --> 05:40.920] So essentially you have the state of Texas and then what Harmon Taylor talks about is [05:40.920 --> 05:48.520] this state and when we're talking about a land patent we're talking about this state. [05:48.520 --> 05:56.520] You take your property out of this state, am I correct in that? [05:56.520 --> 06:03.360] So it says it's like we have two federal prisons in Texas that have been ceded to the [06:03.360 --> 06:06.640] federal government. [06:06.640 --> 06:12.440] They have been taken out of this state. [06:12.440 --> 06:18.000] So when you bring forward a land patent you essentially do the same thing. [06:18.000 --> 06:20.120] Would that be a correct analogy? [06:20.120 --> 06:31.600] Yes and in fact there is a Texas archives, it's a government page on one of their historical [06:31.600 --> 06:37.240] things and they talk about all the different historical documents that they have in their [06:37.240 --> 06:44.520] archives and on one of them they talk about deeds of land, deeds of session of land and [06:44.520 --> 06:54.400] jurisdiction and they repeat that phrase repeatedly and it's deeds of session of land and jurisdiction [06:54.400 --> 06:57.520] and it goes hand in hand. [06:57.520 --> 07:05.960] When they deeded you the land by land patent they relinquished all right and title into [07:05.960 --> 07:06.960] the land. [07:06.960 --> 07:13.880] So when you look up the definition for session in Black's Law Dictionary it will say that [07:13.880 --> 07:20.520] the definition for session is relinquishment but when you look up the word for relinquish [07:20.520 --> 07:22.680] it doesn't say session. [07:22.680 --> 07:33.080] So it's kind of confusing at times but basically when they ceded and relinquished the land [07:33.080 --> 07:40.800] of all right and title they divested themselves of any interest including jurisdiction and [07:40.800 --> 07:47.000] when I ended up in this court hearing thing the judge asked me, he says well are you trying [07:47.000 --> 07:51.840] to say that we don't have any jurisdiction on your property and I said yes. [07:51.840 --> 07:58.920] I said by common law unless I harm my neighbor or harm his property or I renege on a contract [07:58.920 --> 08:04.960] I have not broken the law and he couldn't get his head around that even though he's [08:04.960 --> 08:15.800] an attorney but I found the court case which is Hale versus Hinkle and it's 1906 and the [08:15.800 --> 08:21.040] one statement at the bottom of the quote it says he owes nothing to the public so long [08:21.040 --> 08:28.880] as he does not trespass upon their rights and you know in Black's Law I was looking [08:28.880 --> 08:34.320] through that one time and I guess it wasn't Black's Law it was Black's Commentary and [08:34.320 --> 08:44.840] it was talking about the fact that you cannot be required to contribute to the upkeep of [08:44.840 --> 08:50.400] the government or even serve in the military you know unless you consent. [08:50.400 --> 08:56.360] And so you know it's all about consent but somehow or another they've forgotten that. [08:56.360 --> 09:03.640] This is what Harmon Taylor talks about is when I first met Harmon Taylor he was doing [09:03.640 --> 09:13.920] constitution classes and then he was an attorney and he represented a grandmother of one of [09:13.920 --> 09:25.720] the children killed in the J.P. Murrow building bombing and he filed he raised an issue about [09:25.720 --> 09:33.640] trying Terry McVeigh in Colorado when the crime was committed in Oklahoma and the constitution [09:33.640 --> 09:44.200] specifically forbade that and the court denied his motion as irrelevant and I forget the [09:44.200 --> 09:51.000] three words they used he said he hit him with a hit him with a padded two by four but after [09:51.000 --> 09:55.560] that he got to do the research and then he came to the conclusion that the they were [09:55.560 --> 10:01.600] right in that the constitution did not apply it was all about contract it was all about [10:01.600 --> 10:10.960] agreements that the statutory law applies to us by agreement and this goes to that if [10:10.960 --> 10:21.000] we have property and we have the option of bringing forward a land patent and most all [10:21.000 --> 10:26.440] of the land in the state of Texas has that option but we don't elect that option then [10:26.440 --> 10:36.680] we agree to the contract with the state with this state yes so that that's essentially [10:36.680 --> 10:49.800] accurate have I got that right right right there's there's so many aspects to this with [10:49.800 --> 10:57.680] like so for instance when your property is paid for in total is completely paid for you [10:57.680 --> 11:03.520] think you own your property and that you have some sort of security there but if you get [11:03.520 --> 11:10.000] old and you can't work anymore and your property goes up in value because your house the house [11:10.000 --> 11:18.280] next door you know they build a little McMansion on it then your price goes up and if you get [11:18.280 --> 11:25.040] taxed out of house and home then you know if you can't pay the tax then you're out [11:25.040 --> 11:31.400] on your ear and you know I tried to explain that to the judge and explain to him that [11:31.400 --> 11:38.920] basically we have inalienable rights given to us by God and it predates common law rights [11:38.920 --> 11:46.440] it predates anything it's it's inalienable rights to have shelter from the elements and [11:46.440 --> 11:52.640] basically this is my dog house this is my shelter from the elements and I don't use [11:52.640 --> 11:58.280] it in commerce I don't make any money on it I don't have a business out of it I don't [11:58.280 --> 12:08.920] do anything other than just live here and and have a roof over my head and you know [12:08.920 --> 12:16.720] when when you look at the meaning of these words like the original tax code the original [12:16.720 --> 12:27.280] tax code stated that you know it defined it says in in this tax code and any other code [12:27.280 --> 12:35.320] that refers to taxes the meaning of the word person shall be you know a firm company or [12:35.320 --> 12:42.080] corporation and then you know it went on to define what a taxpayer was and it had to do [12:42.080 --> 12:47.800] with you know firm company corporation it had to do with businesses and then when it [12:47.800 --> 12:57.560] had to do in the multi-state compact it talks about you know who a taxpayer was and it had [12:57.560 --> 13:06.480] to do with in this state and it had to do with a person part you know a company corporation [13:06.480 --> 13:15.400] whatever but it had to do with being in business so everything in the tax code has to be around [13:15.400 --> 13:21.560] the the subject of being in business and making a profit well if it's just your home and just [13:21.560 --> 13:28.280] your shelter then you're not making any money on it then I don't believe it was meant to [13:28.280 --> 13:34.840] be taxed especially if you look at your senate debates prior to Texas becoming a state they [13:34.840 --> 13:41.160] had big debates about whether or not someone should be able to put up their property as [13:41.160 --> 13:47.440] collateral for loan for seed you know if they had had a bad year and they needed seed and [13:47.440 --> 13:52.280] they didn't have the money for it and should they be able to put their their homestead [13:52.280 --> 14:00.080] up for collateral for for a loan for seed and they said no because if you have two bad [14:00.080 --> 14:05.600] years or three bad years you know you would lose your home and they wanted to make sure [14:05.600 --> 14:12.480] that people always had a home to go back to no matter how bad things ever got well that [14:12.480 --> 14:19.960] was the intent of the law and somehow or another these lawmakers have gotten so greedy that [14:19.960 --> 14:27.800] they have forgotten what the intent of the law is but that that raises a question at [14:27.800 --> 14:38.320] the time Texas was a sovereign nation right when Texas became a state of the union what [14:38.320 --> 14:49.040] liability did this did the union adopt when it brought what liability toward prior contracts [14:49.040 --> 14:57.600] did tech did the union adopt when it brought Texas in the statehood from what I can see [14:57.600 --> 15:10.000] they said that they would honor all of the contracts and the one Gammels in Gammels [15:10.000 --> 15:20.440] 2 it talked about the fact that the let me see if I can find it here oh here it is it's [15:20.440 --> 15:31.360] Gammels laws of Texas volume 2 1839 through 1846 9th Congress Republic of Texas page 99 [15:31.360 --> 15:38.320] and there is an act and it has an enabling clause being enacted by the Senate and House [15:38.320 --> 15:43.200] of Representatives of the Republic of Texas and Congress assembled that the Commissioner [15:43.200 --> 15:49.000] of the General Land Office be authorized to require to issue patents in the names of the [15:49.000 --> 15:56.960] signees of all transferable land claims upon presenting to him a complete and properly [15:56.960 --> 16:03.640] authenticated chain of transfer or obligation for title from the original grantee in other [16:03.640 --> 16:11.360] words if you have the chain of title with your assignment that you are acknowledging [16:11.360 --> 16:19.880] and accepting the original assignment then they have to allow that patent and in the [16:19.880 --> 16:25.840] third section it says be further enacted that this act shall be enforced from and after [16:25.840 --> 16:35.520] its passage and it was approved on February 3rd 1845 now I have looked and they've never [16:35.520 --> 16:42.360] repealed or well they've moved it around but they've never repealed this okay okay okay [16:42.360 --> 16:47.240] hang on we're about to go to break this is certified they won't oh I could have a lot [22:00.340 --> 22:11.280] of fun with that I live in a small town and my taxes are relatively low and I've deferred [22:11.280 --> 22:17.080] them anyway but I could have a lot of fun with that there are other reasons I'd like [22:17.080 --> 22:24.560] to have the land back over I live next to City Hall and they don't mess with me they [22:24.560 --> 22:30.280] don't want anything to do with me frankly I just had a long conversation with the new [22:30.280 --> 22:38.560] city administrator and he was looking for my help to get some taxes to some way the [22:38.560 --> 22:43.080] taxes are distributed changed and he used to be the chief of police he's the one that [22:43.080 --> 22:49.640] I told him I was going to run him over with the bus but yeah so I don't have much problem [22:49.640 --> 22:56.040] with the city here but I could have fun with that and one thing I don't want people doing [22:56.040 --> 23:04.940] is misunderstanding how this works from your perspective what are the advantages other [23:04.940 --> 23:12.360] than the tax issue to bringing the patent forward well I haven't found that the advantage [23:12.360 --> 23:23.200] yet I'm still fighting it and that's part of my my issue here supposedly you know I'm [23:23.200 --> 23:32.600] supposed to be able to sever this and be able to show that they don't have any contract [23:32.600 --> 23:41.840] or any interest or whatever basically this is torturous interference with a contract [23:41.840 --> 23:54.160] or torturous trespass okay that brings a good question with torturous interference with [23:54.160 --> 24:04.960] a contract right you have a contract with an entity that no longer exists or okay I [24:04.960 --> 24:13.120] mean that contract was brought forward so you have a contract with this with this state [24:13.120 --> 24:21.600] and the contract separates your property from this state I'm trying to understand how to [24:21.600 --> 24:32.320] frame the interference so since originally the patent was with the Republic of Texas [24:32.320 --> 24:38.760] when the Republic of Texas became the state of Texas then all of those prior contracts [24:38.760 --> 24:49.800] were still in effect so even if the state of Texas has passed laws that would tend to [24:49.800 --> 24:57.520] by their nature violate this contract you still have standing to adjudicate the contract [24:57.520 --> 25:07.480] right because in the codes they have revalidated those land patents many many times and so [25:07.480 --> 25:16.920] they've they've reauthenticated them revalidated them and they've they've you know agreed that [25:16.920 --> 25:24.160] yes they're contracts and you know there's a bill of rights and I can't remember exactly [25:24.160 --> 25:32.120] which one I usually use my phone app but but it talks about that you can't have retroactive [25:32.120 --> 25:41.840] laws and those levitation expo facto right and they cannot do anything that would inhibit [25:41.840 --> 25:47.280] the obligations of contracts and that's in the bill of rights but then when you go that's [25:47.280 --> 25:53.720] also in the federal constitution right and it all comes out of the Magna Carta so it's [25:53.720 --> 26:00.280] been around since the 1700s and I never really understood quite how it was the foundation [26:00.280 --> 26:08.560] for our constitution until I went to visit the Houston Magna Carta exhibit and realized [26:08.560 --> 26:14.360] that all of the Magna Carta is almost word for word right into our bill of rights okay [26:14.360 --> 26:20.960] wait a minute Magna Carta the original Magna Carta was 1216 but there have been a number [26:20.960 --> 26:31.120] of them since then what is the current Magna Carta are they the last Magna Carta that everybody [26:31.120 --> 26:37.080] refers to where would I go to look for that one you know I'm not an expert on that I [26:37.080 --> 26:42.400] have a book on it but I haven't had a chance to read it yet okay from what I understand [26:42.400 --> 26:50.940] the original Magna Carta has was changed dramatically over the ensuing years some of the basic [26:50.940 --> 26:57.320] tenants were still there and they changed it and enhanced they made it worse initially [26:57.320 --> 27:04.520] you know King John you understand how it came about right right yeah there's an excellent [27:04.520 --> 27:15.400] Robin Hood movie where the guy playing Robin Hood is an imposter because Luxley gets killed [27:15.400 --> 27:22.360] in France but it's a great historical movie the King John takes over from his brother [27:22.360 --> 27:37.120] Arthur who dies in in France or in the Crusades and John inherited a kingdom that was essentially [27:37.120 --> 27:48.680] bankrupt so he was somewhat ruthless and he started extracting more taxes from the subjects [27:48.680 --> 27:56.600] and at the time you had a network of dukes and the duke was essentially sovereign over [27:56.600 --> 28:04.600] the lands he could protect but they had all pledged sovereignty to a single king and that [28:04.600 --> 28:10.640] was kind of like the United States and the separate states the dukes were like the states [28:10.640 --> 28:18.720] and the king was like the federal government and as the king he had an army to use that [28:18.720 --> 28:23.680] army to protect the realm itself and then the dukes had their own armies where they [28:23.680 --> 28:28.880] fought against each other with each other all the time and when somebody came in from [28:28.880 --> 28:32.520] the outside they'd all get together and throw them out and then go back to fighting amongst [28:32.520 --> 28:41.640] one another kept their armies sharp but then the French invaded and the dukes were really [28:41.640 --> 28:47.880] upset at John and refused to help him repel the invasion unless he agreed to sign the [28:47.880 --> 28:55.760] Magna Carta he agreed to to repel the invasion and then he refused to sign it they went down [28:55.760 --> 28:59.680] got him and drug him down the river Thames and told him either sign it or we cut your [28:59.680 --> 29:08.880] head off this 1216 so he signed it he signed it under duress so immediately he starts trying [29:08.880 --> 29:14.480] to undermine it and he did somewhat and it went back and forth and people keep referring [29:14.480 --> 29:24.320] to the Magna Carta I want to be able to find the last one that when we refer back to the [29:24.320 --> 29:32.520] Magna Carta one I can point to and your situation and how you got to where [33:53.200 --> 33:59.520] you're at and what it is you tried to achieve when you kind of give us an idea of what brought you [33:59.520 --> 34:12.640] to this position well i got here because in 2007 they doubled overnight our property tax [34:13.520 --> 34:20.000] and i had you know when you get your notice in the afternoon you know in the fall of the year [34:20.000 --> 34:26.160] it says this is not a bill don't pay this is just an estimate blah blah blah and so [34:26.160 --> 34:32.080] you know you kind of look at that and go uh no i don't think so this is you know double what it was [34:33.120 --> 34:39.200] and so i went up there and i asked them if they could you know explain themselves because i knew [34:39.200 --> 34:46.560] that the law says they could only go up 10 percent a year and so i went up there and i tried to get [34:46.560 --> 34:53.200] them to show me what houses and things that they had compared my property to to come up with this [34:53.200 --> 35:02.720] type of amount and they said they'd get back to me they didn't have anything prepared to give me [35:02.720 --> 35:09.600] which means they didn't have anything and so anyway they kept saying that they get back to me [35:09.600 --> 35:16.080] and i kept calling and they didn't have anything and so they put me off way past the time that [35:16.080 --> 35:23.680] they said that they allowed protest so you know you can only protest up until you know i don't [35:23.680 --> 35:30.160] know november 1st or something i don't know so anyway they never did come back with any type [35:30.160 --> 35:36.000] of definitive answer as to why my property tax had gone up so then after that it was oh well you [35:36.000 --> 35:42.080] missed the deadline so because of all of that and because i was such a novice at the time [35:42.080 --> 35:51.920] um i went to bed on the 31st of december and my taxes were based on like i don't know 38 39 [35:51.920 --> 35:58.400] thousand dollars or something like that and on january 1st the next day they were like you know [35:58.400 --> 36:05.760] 60 something 68 thousand something and i'm like you know how can this happen and several of my [36:05.760 --> 36:11.520] friends are getting older of course i'm getting older and you know my my friends are like getting [36:11.520 --> 36:16.240] up there and and they're getting kicked out of their houses and stuff because their their taxes [36:16.240 --> 36:23.040] are just astronomical and one of my friends uh her father built the house that she's living in [36:23.040 --> 36:31.360] and she's lived in it all her life and now that it's grown up around her and they want to you [36:31.360 --> 36:36.480] know extort all this money from her and she's so old what is she supposed to do to earn money [36:36.480 --> 36:42.480] i mean she's on social security so you know i'm sitting there thinking you know that could be me [36:42.480 --> 36:48.800] you know and i'm i'm trying to get this resolved now because hey if it's illegal for them to raise [36:48.800 --> 36:54.640] it more than 10 percent and they do anyway then what's to prevent them from doing it again and [36:54.640 --> 37:01.280] again and again you know they just tax you right out of your house which means they stole it but [37:01.280 --> 37:11.440] they stole it legally yeah well yeah the taxes tax something but we are hoping that you guys can work it out and you know they don't want to do their job [38:42.320 --> 38:47.360] basically did you why didn't you file against the attorney general general criminal allegations against greg abbott when greg abbott was the attorney general [39:26.080 --> 39:33.760] he made a deal with a judge in Cherokee county who had went to another county and changed a judicial [39:33.760 --> 39:42.320] decision this judge was hearing a case a family law case and boinking the litigant [39:43.920 --> 39:51.040] and writing all every ruling in her favor they got him recused sent it to another county [39:51.040 --> 39:55.360] the other judge wasn't boinking the litigant so he didn't rule in her favor all the time [39:56.560 --> 40:01.680] and this judge went to the other county and changed the judge's ruling [40:01.680 --> 40:07.680] well the judge in the other county was not a heptacamper they called in the attorney general [40:07.680 --> 40:13.680] and the attorney general agreed not to prosecute him if he would resign [40:15.920 --> 40:23.920] so my question is just where the heck did you get that authority bubba the way i read the code [40:23.920 --> 40:30.160] that when a pub when a prosecuting attorney is made known that a public prosecutor is not a heptacamper [40:30.160 --> 40:36.240] is made known that a public official has violated the law relating to his office he is required to [40:36.240 --> 40:44.000] reduce the complaint to an information submitted to the grand jury he has no discretion he must [40:44.560 --> 40:50.800] present it to a grand jury so since he failed to present it to a grand jury i read the code [40:50.800 --> 41:00.080] the instruction of justice 3606 penal code shielding from prosecution 3805 penal code [41:00.080 --> 41:06.400] official oppression 3903 penal code this is real easy two of those felonies [41:07.840 --> 41:14.240] yeah so we need to present those to a grand jury of our peers [41:14.240 --> 41:19.680] i was presenting complaints to the head criminal district judge in travis county [41:20.160 --> 41:26.000] kind of bushwhacked him in his courtroom went up to the bailiff and told him uh well you always [41:26.000 --> 41:30.560] do this when they're having motion hearings i said mr bailiff my name is randall kelton [41:30.560 --> 41:35.680] instructor judge that i have business with court and the bailiff said may i tell him the nature of [41:35.680 --> 41:39.520] the business though you may not i have business with the court and it's none of yours you're [41:39.520 --> 41:48.640] dismissed no one sat down and he was furious he didn't understand that's exactly what i wanted [41:48.640 --> 41:54.800] him to be he ran up to the judge jibber jabber jibber and the judge jibber jabber jibber back [41:54.800 --> 42:01.280] and he looks out at me sitting here holding this red folder and the judge just can't hit it he's [42:01.280 --> 42:09.680] can't hit it he's just got to know what this smart mouth has got in that folder so he finished his [42:09.680 --> 42:15.280] hearings and said mr kelton i understand you have business with the court yes your honor i do and i [42:15.280 --> 42:21.120] held up the folder may i approach that means can i give you these documents he said well come on [42:21.120 --> 42:27.280] up he was hearing the motions right at his bench so i walked up to the bench and set that on his [42:27.280 --> 42:33.360] office in front of him and he opened it up and he's looking at criminal charges against [42:34.400 --> 42:43.520] the district clerk for for i'm sorry against the district attorney for shielding all of the highest [42:43.520 --> 42:51.120] judges in texas for prosecution when i had gave him criminal complaints against the judges of the [42:51.120 --> 42:58.960] court of criminal appeals and i think bob perkins saw his whole career flash before his eyes [43:01.200 --> 43:02.320] but we could do that [43:04.560 --> 43:09.280] these officials forget something they're public servants [43:11.280 --> 43:17.600] you and i we are the masters and they should never forget it [43:17.600 --> 43:24.480] airport and took me to the [47:51.760 --> 48:00.880] high court sat down in the room and this guy is representing his mother's estate she's old and [48:00.880 --> 48:09.680] infirm and he is just writhing on riding on this judge just climbing down his throat and you know [48:10.480 --> 48:17.280] texas we'd go to jail for that i was amazed at how much the judge is put up with but apparently [48:17.280 --> 48:26.240] this judge was well known for being their hanging judge and the judge is trying to control this guy [48:26.240 --> 48:31.600] and the guy is just crawling down the judge's throat and he's saying mr brown you really need [48:31.600 --> 48:40.400] to get an attorney and he's he's telling him what he thinks of attorneys finally the judge got well [48:40.400 --> 48:45.600] part of it was that i went in there and told him i was a journalist from the united states and i [48:45.600 --> 48:53.520] was down here investigating into court corruption around the world so the bailiffs took that back [48:53.520 --> 49:00.960] so the bailiffs took that back to the the judge so he's he's staring over at me and he's i guess [49:00.960 --> 49:07.200] he don't want to get too ugly because he's afraid we'll splash his name all over the planet i fibbed [49:07.200 --> 49:15.680] to him that really wasn't why i was there but he finally said mr brown you really need to get a [49:15.680 --> 49:24.880] solicitor i can control your solicitor i can't control you and there were about a dozen of us [49:24.880 --> 49:35.280] in the room we all looked at each other like did he really say that yes yes he did you you know i [49:35.280 --> 49:42.560] tell people that when when i walk into a courthouse i am the baddest motor scooter in the building [49:42.560 --> 49:47.760] okay and there's only one reason i'm the baddest motor scooter in the building [49:48.960 --> 49:57.600] that's because i'm nobody i'm not a judge or a lawyer or prosecutor or bailiff or court employee [49:59.040 --> 50:04.960] they're all public servants i am the master and they are not to forget it [50:04.960 --> 50:14.720] okay there is a way of doing this these guys are very good at confrontation [50:16.240 --> 50:25.520] they're very good at getting you angry frustrated annoyed what they like to generally term as [50:25.520 --> 50:35.280] agitated well i'm going to show you how to turn that on its head and the way you turn it on its head [50:36.240 --> 50:45.200] is you don't give them the reactions that they expect and i'm not talking about the major reactions [50:45.200 --> 50:54.880] major reactions but the minor ones the the ones that most people don't even notice the little [50:54.880 --> 51:02.400] tenseness around the jaw a little dip in the lips showing an internal frown they know how to read [51:02.400 --> 51:10.000] these signs they know how to manipulate you with your emotions and your expectations so [51:10.000 --> 51:18.000] so first rule never ask a public official to do anything you actually want him to do [51:20.240 --> 51:24.960] the reason you never ask a public official to do anything you actually want him to do [51:25.920 --> 51:32.400] is that you never ask a public official to do anything that the law does not specifically [51:32.400 --> 51:43.200] require him to do so when i go in and i hand them a open records request i had one recently [51:43.200 --> 51:53.920] in a small town that had given me a ticket i asked to see all of the training and uh [51:53.920 --> 52:02.880] uh technical requirements for an officer for the officer who wrote the citation that allowed him [52:02.880 --> 52:10.960] to enforce the transportation code and the clerk came out with it and said and mr kelton i'm not [52:10.960 --> 52:17.600] sure what you're asking for here we'll call your lawyer i'm sure he can explain it well mr [52:17.600 --> 52:26.800] kelton can you be a little more specific yes ma'am i can what i want to see is exactly what i asked [52:26.800 --> 52:33.120] for in that request and she looked at like at me like she was hoping she could get one of these [52:33.120 --> 52:43.040] baits over here to shoot me but i gave her that request with the hope that she would not respond [52:43.040 --> 52:54.640] to it and she did not disappoint me so i came back to the court and filed with the court a [52:54.640 --> 52:59.840] criminal accusation against this person for violating the open records act [53:03.280 --> 53:06.400] now all of a sudden they got busy on getting me my answer [53:06.400 --> 53:16.560] right yeah my favorite one randall county texas i went in i was looking for missing criminal [53:16.560 --> 53:22.240] complaints it was a common problem i asked the clerk to see these certain documents she said [53:22.240 --> 53:27.280] well mr kelton you can see those on the computer right in the next room said no i need to see the [53:27.280 --> 53:34.320] physical documents i expect some documents to be missing and when i find them missing i'm going to [53:34.320 --> 53:38.400] give you a written request for those documents well if they're not in the record i can't give them [53:38.400 --> 53:45.200] to you that's true you cannot but what you can give me is a response saying that on this day at [53:45.200 --> 53:52.240] this time i have no records responsive to your request so that i can document their absence if i [53:52.240 --> 54:00.960] go look in the computer and raise an issue they will magically appear later on so i prefer to do [54:00.960 --> 54:07.120] it this way well mr kelton i don't have the personnel or the time to get those for you you'll [54:07.120 --> 54:16.480] just have to look in the record i said wait right there don't go anywhere somebody's going to want [54:16.480 --> 54:24.880] to talk to you walked over opened the door pointed at the valis you come here they hate to be summoned [54:24.880 --> 54:29.680] he comes so for what can i do for you i said listen to this i said miss clerk i want to see those [54:29.680 --> 54:33.280] records i asked you for i told you i don't have time to get those for you you'll have to look in [54:33.280 --> 54:40.080] the computer i turned to the bed if did you hear that yes mr kelton i did arrest that woman [54:43.200 --> 54:48.640] why can't arrest her i said sure you can just just throw the cuffs on her and drag her off to jail [54:48.640 --> 54:53.280] that could be fun you stand around here all day get bored i said i don't want to do that [54:53.280 --> 54:58.640] here all day get bored oh i need to get to my lieutenant so he gets his lieutenant the lieutenant [54:58.640 --> 55:05.680] said he's not taking any complaints for me at all i said oh okay and i asked the sergeant what'd you [55:05.680 --> 55:12.160] bring him for he's worthless said i need a real police officer this guy said a real police officer [55:12.160 --> 55:18.160] said well in that case i need the non-emergency number to sheriff's department he said well i'll [55:18.160 --> 55:23.040] do you one better the lieutenant he takes out a card and hands me a card i jerk it out of his hand [55:23.840 --> 55:29.680] dial the number and ask the sheriff's department to dispatch an officer to arrest [55:30.320 --> 55:32.720] this lieutenant brown and the district clerk [55:35.360 --> 55:41.360] and then the dispatcher argued with me a little bit and i accused her of being being a lawyer [55:41.360 --> 55:46.320] giving me legal advice and she finally cut that out dispatch somebody went to sit down [55:46.320 --> 55:52.480] and while i'm waiting i'm writing out criminal complaints as i'm sitting a bailiff came over and [55:52.480 --> 55:55.440] said mr kelton you're creating a disturbance you're going to have to leave the building [55:56.160 --> 56:02.080] i looked up at him and said beat it went back to write mr kelton you're creating a disturbance [56:02.080 --> 56:08.720] you're going to have to leave the building get host and the sergeant came over and said leave [56:08.720 --> 56:13.440] him alone leave him alone he's just trying to get you to do something so he can file a complaint [56:13.440 --> 56:19.280] he can file a complaint against you i looked up and said he's a really smart guy you should [56:19.280 --> 56:28.160] listen to him and then the lieutenant and the clerk came walking across the hall and the clerk's [56:28.160 --> 56:34.160] got some documents in her hand the lieutenant started to say something to me i held up my hand [56:34.160 --> 56:41.920] stop stop stop i can't be talking to you i've called nine more i've called the sheriff's [56:41.920 --> 56:47.440] department and they're dispatching someone and i will give that person a complete report but [56:47.440 --> 56:52.320] since i'll be making criminal accusations against both of you it would be inappropriate for me to [56:52.320 --> 56:58.640] have any further communication and the sergeant said well the clerk has the records you requested [56:59.840 --> 57:04.560] i looked up at him and said sorry bubba that bell's already been rung [57:04.560 --> 57:10.960] clearly the look on the clerk's face was absolutely priceless [57:12.880 --> 57:16.000] this is what you and i can do [57:18.000 --> 57:26.800] and the only problem with it is it is so much fun you spend most of your what they're required to do because they know you will respond [57:41.200 --> 57:49.120] by feeling of betrayal and that tends to be frightening because you have an expectation [57:49.120 --> 57:54.000] that the law protects you and these guys are demonstrating very clearly to you it does no such [57:54.000 --> 58:02.480] thing now you're outside your element you become frustrated you become angry and they accuse you [58:02.480 --> 58:11.920] of being agitated when you go in there and ask them to do what they're required to do [58:11.920 --> 58:17.600] when they don't you don't argue with them you go get somebody else try to get them to arrest them [58:19.200 --> 58:25.680] everything changes these well these problems that you've been having they will start going away and i have done a lot but i ran into a time [01:08:12.240 --> 01:08:18.800] issue and right now my house is more important than i have two years to file on him so right now [01:08:18.800 --> 01:08:25.520] i'm working on this but um they they are rather okay whether you file or not [01:08:29.200 --> 01:08:38.080] you it's it works much better if you shift this gear never ask a public official to do anything [01:08:38.080 --> 01:08:45.840] they're not required to do because they are not going to do you any favors you must always assume [01:08:45.840 --> 01:08:52.400] they're going to do their worst and i can assure you whether you actually file complaints or not [01:08:52.400 --> 01:08:57.600] that's not so important but go to the prosecuting attorney make a complaint to him [01:09:00.160 --> 01:09:03.600] what's going to happen when you make your complaint to the prosecuting attorney [01:09:03.600 --> 01:09:09.360] is he's going to call he's going to call the judge and say i got somebody down here trying to get me [01:09:09.360 --> 01:09:16.720] to arrest you can you explain what's going on and then the prosecuting attorney will refuse [01:09:17.520 --> 01:09:23.280] to arrest the judge then you call the attorney general and the prosecuting attorney [01:09:24.640 --> 01:09:30.160] everything's political and this gets lots of politics bouncing around because the attorney [01:09:30.160 --> 01:09:34.720] general's office is going to call it the district attorney's office and say i got somebody down [01:09:34.720 --> 01:09:45.360] calling down here want me to arrest you the higher up you get the more dangerous you become to these [01:09:45.360 --> 01:09:52.160] guys the ones down there at the bottom i i that's kind of i don't think they even understand [01:09:52.160 --> 01:10:00.800] they even understand but those are high-level elected officials the last thing the attorney [01:10:00.800 --> 01:10:06.480] general is going to want is for you to go to his opponent in the next election [01:10:07.760 --> 01:10:15.840] and tell his opponent how this attorney general shielded this prosecutor and these judges [01:10:15.840 --> 01:10:22.400] challenge [01:13:22.720 --> 01:13:29.440] jurisdiction and he told me it wasn't my turn to talk and that he was going to give the floor to [01:13:29.440 --> 01:13:37.200] the other attorney and she just like started the court thing with without proving jurisdiction [01:13:37.200 --> 01:13:44.880] standing whatever i knew she had her company anyway that she worked for had a a contract with [01:13:44.880 --> 01:13:51.600] the appraisal district but i don't think that she had a contract with the school district and all [01:13:51.600 --> 01:13:59.280] the rest and those were the entities that were suing me and so i had done a rule 12 and i was [01:13:59.280 --> 01:14:09.520] i had challenged the court probably i don't know a month or more in advance to prove jurisdiction [01:14:09.520 --> 01:14:20.320] proof standing and agency and authority and they just totally blew past that and he just told me [01:14:20.320 --> 01:14:28.240] that he found that he had jurisdiction but he okay hold on did do you know if he actually [01:14:28.240 --> 01:14:35.200] read the document he told me three different times in front of all my witnesses and the court [01:14:35.200 --> 01:14:43.760] reporter that he had not read my document oh wonderful against me this is okay you you [01:14:45.120 --> 01:14:48.800] how well do you understand subject matter jurisdiction challenges [01:14:51.280 --> 01:14:57.040] i've read them i'm i'm in the process of reading them and trying to understand them very well but [01:14:57.040 --> 01:15:03.520] i know well enough that he totally destroyed all of it then it's presumed that the court has jurisdiction however once jurisdiction is [01:15:20.640 --> 01:15:28.400] challenged it must be proven once you challenge jurisdiction the court loses jurisdiction [01:15:30.320 --> 01:15:36.720] and it's not the other side that has to prove jurisdiction it is the court a [01:15:39.120 --> 01:15:45.280] guy with one of my callers called in he being sued over a credit card [01:15:45.280 --> 01:15:50.720] the lawyers filed a suit they did not a file attached affidavit that was required by statute [01:15:52.080 --> 01:16:00.240] he went into court and filed a challenge subject matter jurisdiction judge and ignored it the next [01:16:00.240 --> 01:16:06.240] hearing he went to the judge came in the court and the client said your honor what are you doing here [01:16:06.240 --> 01:16:15.920] what are you doing here you can't be here i sued you what what he went home got the the record and [01:16:15.920 --> 01:16:25.360] we sued the judge for impersonating the public official so he got the county attorney to write [01:16:25.360 --> 01:16:31.600] his answer for him so we sued the county attorney for misappropriation of public funds thought i had you live it didn't take okay there you go now you're [01:20:18.560 --> 01:20:27.520] live okay yeah i have um pretty well figured out that i do have a rico suit because there has been [01:21:54.240 --> 01:21:59.360] guys out there that think they can be a private attorney general no they can't private attorney [01:21:59.360 --> 01:22:08.400] general suit is just a name the courts gave to a particular kind of suit say you get a ticket and [01:22:08.400 --> 01:22:17.040] they do everything criminal and illegal and they they steal your money from you mine's only 300 [01:22:17.040 --> 01:22:24.640] bucks that's not enough to sue for and most people they just pay it what a private attorney [01:22:24.640 --> 01:22:34.640] general suit is is where you sue in your own capacity and for the benefit of other people [01:22:34.640 --> 01:22:44.720] and for the benefit of others similarly situated it's not some there's no special law for this [01:22:45.680 --> 01:22:54.960] this is just a type of suit that the courts allow because it's not worth it for someone to sue to [01:22:54.960 --> 01:23:00.800] write this wrong because the amount is so small but if you sue as a private attorney general to [01:23:00.800 --> 01:23:07.920] benefit for the benefit of all those others similarly situated then you can take on the [01:23:07.920 --> 01:23:13.280] whole issue without a recosuit recosuit is a lot more difficult and complex to file [01:23:14.160 --> 01:23:20.080] a private attorney general is just like a regular lawsuit except you do a little research you know [01:23:20.080 --> 01:23:26.880] and here it's obvious they've they've done this to everybody but if you sue for the benefit of [01:23:26.880 --> 01:23:36.480] yourself and older people who are unable to defend themselves because of their income limitations [01:23:38.800 --> 01:23:46.880] this goes to perception is everything now you're in here trying to protect these older people [01:23:47.520 --> 01:23:54.960] who are unable now because of advancing age to protect themselves from these money-grubbing [01:23:54.960 --> 01:24:04.400] public officials and oh one other thing i didn't want to mention [01:24:06.720 --> 01:24:10.800] the only reason you go to the trial court [01:24:13.120 --> 01:24:22.480] do you know what that is to set a precedent for appeal exactly always keep that in mind [01:24:22.480 --> 01:24:26.960] that keeps it from upsetting you so much when they do what they shouldn't [01:24:27.760 --> 01:24:36.480] well i've got tons of information on the record the only issue is that we have a situation where [01:24:36.480 --> 01:24:46.640] there's three counties only one district court meaning one district judge and he's the one that [01:24:46.640 --> 01:24:52.800] doesn't read anything and wait wait a minute is he the one that didn't read the challenge subject [01:24:52.800 --> 01:25:03.920] matter jurisdiction yes and oh goody okay only that but when when can you sue a judge [01:25:03.920 --> 01:25:13.760] uh yes it's only one time it's when he acts without subject matter jurisdiction [01:25:15.520 --> 01:25:20.480] yeah i we were doing uh helping people with foreclosure here in tarrant county [01:25:21.520 --> 01:25:28.400] tarrant and dallas and i went before judge cooper in garland and i filed a challenge [01:25:28.400 --> 01:25:34.800] subject matter jurisdiction the day of the hearing that always really gets them hot they hate that [01:25:34.800 --> 01:25:45.120] it's 30 page challenge so i get in front of him and he he's good the clerk brought him the challenge [01:25:45.120 --> 01:25:51.120] and he just looks at it and challenges subject matter jurisdiction mr caldon i have subject [01:25:51.120 --> 01:25:56.560] matter jurisdiction i'm going to overrule your challenge and he's a lawyer i'm going to overrule [01:25:56.560 --> 01:26:04.640] it and he's a lawyer he should have knew better so judge you're going to deny my challenge to [01:26:04.640 --> 01:26:11.360] subject matter jurisdiction without even reading it i made my ruling thank you your honor we're done [01:26:11.360 --> 01:26:18.800] here i go out in judges that didn't read it gets this and he says well [01:26:59.760 --> 01:27:09.600] it looks like some people have been looking on the internet he read every one of them [01:27:12.240 --> 01:27:16.960] now he he ruled against all of them but he read every one of them even though they were all the [01:27:16.960 --> 01:27:23.920] same he sat up there in front of everybody and read those documents what happened was [01:27:25.120 --> 01:27:30.880] is they went to one of their meetings and somebody brought up this challenge subject matter [01:27:30.880 --> 01:27:36.960] jurisdiction and one of the judges said well i denied i didn't read it and it probably had a [01:27:36.960 --> 01:27:42.240] lawyer another lawyer in there and knew what he was doing and said you did what are you out of your [01:27:42.240 --> 01:27:50.880] mind man that's the only the only time they can clobber you so you have a shot at this district [01:27:50.880 --> 01:28:00.400] judge you sue the district judge for impersonating a public official because when you file the [01:28:00.400 --> 01:28:05.600] challenge subject matter jurisdiction he's asking of all people not to read the motion a district [01:28:05.600 --> 01:28:14.480] judge he he's got to be out of his mind so you sue him personally and then move to disqualify him [01:28:14.480 --> 01:28:21.520] from the case the next judge that me so um i you know i tried to um negotiate with affidavits and do all [01:29:04.560 --> 01:29:11.120] kinds of stuff challenge them and they just ignored it completely totally i never got a response at [01:29:11.120 --> 01:29:16.240] all um but they just went ahead and and said that they were going to foreclose on the lien [01:29:16.240 --> 01:29:26.000] and um so being as i had kids at home and different things uh i went ahead and did a um affidavit [01:29:26.800 --> 01:29:35.680] um of application for these funds and i i provided the funds but i put the serial numbers down for [01:29:35.680 --> 01:29:45.520] each hundred dollar bill and sent it in and um he kept the money but he admitted without providing [01:29:45.520 --> 01:29:52.240] the documentation of proof of authority that he was since 2011 and it was in the record and um i told the county clerk or [01:35:40.640 --> 01:35:48.560] the county frazier that and i told her that i did not need her statutory uh homestead exemption [01:35:48.560 --> 01:35:56.320] application in other words i didn't need her statutory benefit that i had to apply it's kind [01:35:56.320 --> 01:36:01.360] of like a marriage license you know where you apply for the government's permission to do [01:36:01.360 --> 01:36:07.920] something that would otherwise be illegal and um so anyway you could tell that she was just [01:36:07.920 --> and interest and all the rest the only screpancy is that i've told her many many times that her [01:36:37.760 --> 01:36:44.560] public record is in error and that it needs to be corrected and i've explained to her number one [01:36:44.560 --> 01:36:52.000] this is a homesteaded property and that it has been on the um public record has been homesteaded [01:36:52.000 --> 01:37:00.000] since 2011 as well as the fact that um she has me down for having a house that was built on this [01:37:00.000 --> 01:37:09.680] property in 1958 when in fact this house was sitting in a different county and i have evidence [01:37:09.680 --> 01:37:16.240] that i bought the house i have the bill of sale and that i had this house moved and i've got the [01:37:16.240 --> 01:37:23.040] bill for that and so basically that was done prior to even having the property so we closed [01:37:23.040 --> 01:37:30.480] on the property like a month after we actually bought the house so um i have a bifurcated title [01:37:30.480 --> 01:37:40.000] really so anyway i've done all this kind of noticing of her that her records are in error and that she [01:37:40.000 --> 01:37:47.120] needs to correct them and she refuses to correct them she wants to maintain okay are you are you [01:37:47.120 --> 01:38:02.160] familiar with 51 with the texas government code 51 901 a c c okay 51 901 through 903 [01:38:04.000 --> 01:38:11.840] uh i think it's 901 that tells the clerk if she has reason to believe that [01:38:11.840 --> 01:38:16.720] that i'm sorry i'm thinking the wrong one i think of a document filed in error [01:38:18.480 --> 01:38:26.480] this is a would be a separate suit against the clerk for failing to keep the record [01:38:28.240 --> 01:38:32.560] yeah this is actually against the appraisal district the chief appraiser [01:38:32.560 --> 01:38:38.560] who has been noticed many many times that her record is in error and she refuses [01:38:38.560 --> 01:38:46.480] to correct it in fact we even did a corrected deed to include an acknowledgement and acceptance of [01:38:46.480 --> 01:38:52.800] the the warranty deeds and then we refiled the patent on top of it the purpose for that was [01:38:52.800 --> 01:39:00.160] because it's kind of like an offer in commerce on a contract where somebody offers something to you [01:39:00.160 --> 01:39:07.280] and you accept it and they may sign the deed that they're offering it to you and their signature [01:39:07.280 --> 01:39:13.280] and their signature is notarized but the person that purchased it doesn't ever sign it that they [01:39:13.280 --> 01:39:20.800] accepted it and claimed it as theirs so what we did was we did a corrected deed and we [01:39:21.760 --> 01:39:27.360] included the acknowledgement and acceptance and i had to fight like crazy the district attorney [01:39:27.360 --> 01:39:34.800] he did not want me to accept and acknowledge our deed said i didn't have to do it and i kept saying [01:39:34.800 --> 01:39:39.360] it's my right to do it and so finally i was able to do it after showing him several statutes [01:39:40.080 --> 01:39:46.720] and so we went ahead and did that and then we filed our patent on top but what it is is that [01:39:48.560 --> 01:39:57.520] she never she's still hanging on to a deed from like 1981 you know she has not updated her records [01:39:58.160 --> 01:40:04.240] and she refuses to update her records and she doesn't want to acknowledge the patent she doesn't [01:40:04.240 --> 01:40:09.600] want to acknowledge the corrected deed she doesn't want to acknowledge patent recorded in the county so i have superior title and steven said [01:40:44.800 --> 01:40:52.000] that he thinks that i can make a pretty good case that after 160 years that the county abandoned [01:40:52.000 --> 01:41:01.360] all interest and title and that i have superior title because of the land patent you'll almost [01:41:01.360 --> 01:41:08.400] certainly beat this win this on appeal the court of appeals is not going to want to overturn [01:41:09.040 --> 01:41:10.160] 100 years of law [01:41:13.280 --> 01:41:21.200] right but what i'm saying though is okay say for instance um he ruled against me on the 10th of [01:41:21.200 --> 01:41:27.760] november i immediately filed a demand for findings and facts and conclusions of law [01:41:28.720 --> 01:41:34.000] he went ahead and turned around and because he had never read any of my documents he didn't know [01:41:34.000 --> 01:41:40.800] why he ruled against me so he demanded that we the other attorney and myself write our own [01:41:41.440 --> 01:41:47.840] findings and facts and conclusions of law as to why he ruled the way he ruled can you believe it [01:41:47.840 --> 01:41:53.520] he is the lazy bum i've ever seen that it is common for the for the judges to do that [01:41:55.040 --> 01:42:01.200] so i go ahead and i spend my time and i had the most brilliant package together i mean it was [01:42:01.200 --> 01:42:09.040] totally outlined completely she had a few codes but she could not tell you what those codes [01:42:09.040 --> 01:42:15.360] correlated to in the form of statutes or laws i had quoted laws i had quoted supreme court cases [01:42:15.360 --> 01:42:22.240] i had quoted treaties i had quoted you know even some codes and statutes i had quoted everything [01:42:22.240 --> 01:42:28.160] and everything was in my favor she had quoted a few codes in the tax code that didn't even apply to me [01:42:29.040 --> 01:42:37.520] and um he of course signed off on hers so by that time it's like
