[07:05.120 --> 07:12.960] I said, well, I got a constitution, I got a statute and I got a first circuit federal [07:12.960 --> 07:19.680] appeals court decision that says I can, so you wipe your behind with that rule and they [07:19.680 --> 07:26.440] got really, really excited and were in the process of manhandling me and throwing me [07:26.440 --> 07:27.440] out. [07:27.440 --> 07:32.440] Well, while they were in the process of manhandling me and throwing me out, Mike was right behind [07:32.440 --> 07:33.600] me. [07:33.600 --> 07:41.960] I looked back and there is Mike, Mr. Oh, I'm sorry, I hope I didn't offend anyone. [07:41.960 --> 07:47.240] He is standing right in the middle of these guys, asking them their names with his camera [07:47.240 --> 07:54.680] on, taking pictures of them and I thought, you line SOB. [07:54.680 --> 07:58.200] You ain't the least bit afraid of these jerks. [07:58.200 --> 08:02.160] You've been setting them up from the beginning. [08:02.160 --> 08:06.200] I really do think that Mike may be the one to change everything. [08:06.200 --> 08:11.320] He has struggled with this thing for what, three, four years now? [08:11.320 --> 08:15.040] Yeah, it's really insane. [08:15.040 --> 08:25.000] There's a John Wayne movie where John Wayne and his niece gets taken by the Indians and [08:25.000 --> 08:29.520] the uncle and the nephew go try to get her back. [08:29.520 --> 08:37.920] Four years later, the nephew said, Uncle, don't you think it's time we stopped? [08:37.920 --> 08:42.680] And John Wayne said, the Indians are an odd critter. [08:42.680 --> 08:46.720] He will chase something for a while and then he'll quit. [08:46.720 --> 08:53.840] He just doesn't understand a critter that'll keep on coming. [08:53.840 --> 09:02.000] And the city of Austin and the county ran into a critter that'll just keep on coming. [09:02.000 --> 09:09.800] And it appears as though he has gotten so many people bound up, Judge Sparks. [09:09.800 --> 09:15.920] He may well get Judge Sparks thrown out of office because Judge Sparks, because he acted [09:15.920 --> 09:22.480] so stupid because he underestimated Mike and then Mike landed only like a ton of bricks. [09:22.480 --> 09:29.440] He becomes a liability. [09:29.440 --> 09:30.440] Perception is everything. [09:30.440 --> 09:39.160] And Mike is creating so much negative perception against these judges that it's been my experience [09:39.160 --> 09:45.240] when people fight these issues, even if it's a minor issue, they will fight you and fight [09:45.240 --> 09:50.920] you and never stop because they're using taxpayer money. [09:50.920 --> 09:55.680] And like with Mike, we were talking about when they were prosecuting him over taking [09:55.680 --> 10:03.960] a voice recorder into the county courthouse, they accused him of pointing a deadly weapon [10:03.960 --> 10:08.600] at him and it was a digital recorder. [10:08.600 --> 10:16.600] They went after him big time and never backed up an inch until they got to the courthouse [10:16.600 --> 10:19.320] steps. [10:19.320 --> 10:27.360] And Mike was terrified, but he never, ever backed up from these guys. [10:27.360 --> 10:35.920] They got to the courthouse steps and offered him a deal and he told him to cram their deal. [10:35.920 --> 10:38.120] I did that in Cherokee County. [10:38.120 --> 10:46.480] I told the jury, do your worst, but I'm here doing the right thing for the right reason. [10:46.480 --> 10:53.360] There is nothing you can do to me that doesn't pale into insignificance over what my, the [10:53.360 --> 10:55.880] price my brother paid for these rights. [10:55.880 --> 10:58.160] I will not back up from them. [10:58.160 --> 11:01.280] But I had a really good reason. [11:01.280 --> 11:06.560] Mike didn't have my reason, but he did not back up. [11:06.560 --> 11:12.080] And when they got to the courthouse steps, the prosecutor dropped everything. [11:12.080 --> 11:19.120] This is how they do it and Mike is pushing these guys up against the wall. [11:19.120 --> 11:26.080] They will kick and scratch and fight right till the last second. [11:26.080 --> 11:28.560] And then they'll duck and run for cover. [11:28.560 --> 11:37.960] And Mike has pushed this so far, when this goes to the Supreme, I am absolutely confident [11:37.960 --> 11:42.680] that the Supreme is going to say, you guys cannot do this. [11:42.680 --> 11:48.800] The Supreme Court of the United States is not going to protect some chump municipal [11:48.800 --> 11:52.360] judge down here in Austin. [11:52.360 --> 11:57.640] When he lands on all of them, Mike's going to change everything. [11:57.640 --> 12:00.800] Well, thank you, Randy. [12:00.800 --> 12:02.600] Those are, that's a lot of praise. [12:02.600 --> 12:05.800] I hope I can live up to that. [12:05.800 --> 12:08.240] You know you can, you chump. [12:26.520 --> 12:31.520] And all these courts have just root against me without one, not so much as one word in [12:31.520 --> 12:32.520] opposition. [12:32.520 --> 12:37.760] So the county actually had to produce an appellee brief and I, I've skimmed through it as I'm [12:37.760 --> 12:38.760] reading it. [12:38.760 --> 12:44.600] I just got it today and it's full of so many fraud, you know, so many inaccurate facts. [12:44.600 --> 12:50.200] I mean, it's just, it really makes me kind of nauseous on, but they didn't, you know, [12:50.200 --> 12:53.800] they don't, they don't take things to the level that I do and the courts don't acknowledge [12:53.800 --> 12:54.800] it either. [12:54.800 --> 12:56.880] I verify every document. [12:56.880 --> 12:57.880] They didn't verify anything. [12:57.880 --> 13:01.680] They didn't even certify that any of this is true. [13:01.680 --> 13:07.400] It's just a story and I'm reading through it and I was like, oh, that's a nice story. [13:07.400 --> 13:15.680] Doesn't resemble reality, but you know, that's what I've got to do in the next 10 days and [13:15.680 --> 13:20.080] get my, my rebuttal back up to them. [15:09.320 --> 15:14.200] And when they don't do it, you're on the one hand, you're handing out the, holding out [15:14.200 --> 15:16.120] the offer for them to do this thing. [15:16.120 --> 15:20.240] And then the other hand, you got this big mallet you're fixing to whack them with when [15:20.240 --> 15:27.320] they don't and that's what Mike's been doing for the last three years and it's beginning [15:27.320 --> 15:29.400] to add up on them. [15:47.360 --> 15:48.360] And she already knew. [15:48.360 --> 15:53.640] I mean, there must have been elaborate conversation going on that's ex parte. [15:53.640 --> 15:58.200] I mean, it was amazing how much she knew that I didn't have to bring anything up. [15:58.200 --> 16:01.720] You know, like, well, you haven't served Travis County yet. [16:01.720 --> 16:04.560] I mean, how did she know that? [16:04.560 --> 16:08.000] How did she know that the constable would want to serve? [16:08.000 --> 16:12.960] And here's the thing, you know, the Travis County attorney is, is the agent for Travis [16:12.960 --> 16:13.960] County. [16:13.960 --> 16:15.560] You know, so I understand. [16:15.560 --> 16:18.600] And he's saying, and the judge is like, well, who's the agent? [16:18.600 --> 16:22.760] And Travis County attorney is like, I don't know, like, oh, really? [16:22.760 --> 16:23.760] You don't know. [16:23.760 --> 16:30.440] You're here representing the sheriff, aren't you not here to represent the county also? [16:30.440 --> 16:33.640] I mean, you are in this hearing. [23:11.000 --> 23:24.480] I haven't found them to be much of a test because I already know what dumb people do. [23:36.680 --> 23:43.760] He seems to always be three steps ahead of me, but he's really good for me, so I would [23:43.760 --> 23:46.160] like some of these guys who are really good. [35:54.880 --> 36:00.880] If you misunderstood that point that I was making that wasn't the case, you see, [36:00.880 --> 36:08.880] Danny Murphy was a personal friend of mine and I knew the case and we were holding [36:08.880 --> 36:11.880] mock trials because he's being prosecuted. [36:11.880 --> 36:13.880] We was afraid he'd go to jail. [36:13.880 --> 36:19.880] So we had picked and we had people go out and ask people on the street if they would [36:19.880 --> 36:27.880] sit in as a jury in a mock trial and we had a jury of people that didn't know him. [36:27.880 --> 36:29.880] And I'm sitting up here as the judge. [36:29.880 --> 36:32.880] I'm on his side. [36:32.880 --> 36:37.880] I want him to be able to present his case where he can win it. [36:37.880 --> 36:45.880] But as sitting as the judge, I can't tell him what he should be giving me. [36:45.880 --> 36:52.880] And it's kind of like when you play chess, you sit down at a chessboard, play six moves, [36:52.880 --> 36:58.880] and then both players gets up and walks around the table and takes the other side. [36:58.880 --> 37:02.880] When you look at the chessboard, it looks so totally different. [37:02.880 --> 37:13.880] When Pastor Massad asked me to sit as a mock judge, my perspective was totally different. [37:13.880 --> 37:22.880] And I was astounded at how different it was and how difficult it was because Danny is [37:22.880 --> 37:31.880] arguing all this patriot mythology stuff that has nothing to do with the merits of his case. [37:31.880 --> 37:40.880] And I'm hearing it and yeah, yeah, I understand all this, but what's that got to do with anything? [37:40.880 --> 37:46.880] What's that got to do with the allegation against you, the facts against you? [37:46.880 --> 37:50.880] Give me something I can work with. [37:50.880 --> 37:57.880] And we had someone that we were working with go into a Fort Worth bankruptcy court. [37:57.880 --> 38:05.880] And the lawyers on the other side on a foreclosure issue, they brought in all their paperwork. [38:05.880 --> 38:09.880] And this person did exactly what we told her to do. [38:09.880 --> 38:15.880] And she said, Your Honor, this lawyer over here has got a big stack of papers he's referring to. [38:15.880 --> 38:17.880] Can I see those? [38:17.880 --> 38:20.880] And the judge said, well, Counselor, show them to her. [38:20.880 --> 38:24.880] So she gives them to her and it's all her closing documents. [38:24.880 --> 38:28.880] And she said, Your Honor, I've never seen these before. [38:28.880 --> 38:32.880] And the lawyer, the judge said, well, isn't that your signature? [38:32.880 --> 38:35.880] I never signed these papers. [38:35.880 --> 38:37.880] These were photocopies. [38:37.880 --> 38:40.880] She had never seen those photocopies before. [38:40.880 --> 38:47.880] She said the judge ground on her for 10 minutes and she would not back down. [38:47.880 --> 38:49.880] She'd never seen these before. [38:49.880 --> 38:50.880] She didn't sign these. [38:50.880 --> 38:52.880] She didn't know anything about this. [38:52.880 --> 39:00.880] And she said, after about 10 minutes, the judge sat back and smiled and looked over at the lawyers on the other side and said, [39:00.880 --> 39:07.880] Well, Counselor, it seems she has never seen these before. [39:07.880 --> 39:11.880] You're going to have to bring in the originals. [39:11.880 --> 39:15.880] You see, the judge got it from the beginning. [39:15.880 --> 39:20.880] But he made sure that she knew exactly where she was at. [39:20.880 --> 39:29.880] She knew exactly the position she was taking and wasn't confused, wasn't missing the point and would not back down. [39:29.880 --> 39:36.880] And what I took from that is he said, Yes, she gave me what I need. [39:36.880 --> 39:42.880] Now he can turn to these lawyers and say, Well, Bubba, you're going to have to bring in the originals. [39:42.880 --> 39:43.880] They never did. [39:43.880 --> 39:47.880] They wrote off the loan. [39:47.880 --> 39:50.880] The judge actually got what he could work with. [39:50.880 --> 39:52.880] And that's the problem I was having. [39:52.880 --> 39:59.880] Danny's not given me what I need to give him the decision that he needs. [39:59.880 --> 40:02.880] Does that make sense, Terrence? [40:02.880 --> 40:12.880] Yes, it makes a lot of sense that it seems like there's so much more burden on the accused. [40:12.880 --> 40:18.880] Like you said, the judge hounded her. Are you sure? Are you sure? Are you sure? [40:18.880 --> 40:21.880] OK, well, this one was civil. [40:21.880 --> 40:27.880] In Danny's case, Pastor Massad was acting as the prosecutor. [40:27.880 --> 40:33.880] And he came in first and said, You know, we have this evidence. [40:33.880 --> 40:37.880] He did this, he did this, he did this, he did this, he did this. [40:37.880 --> 40:41.880] Therefore, we have reason to believe and do believe he committed this act. [40:41.880 --> 40:46.880] Now he's presented prima facie evidence. [40:46.880 --> 40:47.880] He gave facts. [40:47.880 --> 40:59.880] He gave law interpreting those facts sufficient to create a prima facie case against Danny. [40:59.880 --> 41:05.880] Once that's done, now the burden shifts. [41:05.880 --> 41:09.880] Before that, the presumption had to be that Danny was innocent. [41:09.880 --> 41:18.880] But once sufficient evidence is presented to indicate or to give a prima facie evidence of guilt, [41:18.880 --> 41:21.880] now Danny has to overcome that evidence. [41:21.880 --> 41:24.880] That's how the trial works. [41:24.880 --> 41:32.880] When the prosecutor came in and presented his side first, now Danny is in a position to rebut. [41:32.880 --> 41:37.880] So we didn't deny a presumption of innocence. [41:37.880 --> 41:39.880] Okay, you explained that well. [41:39.880 --> 41:45.880] Now it's the light of the bulb is starting to come on. [41:45.880 --> 41:48.880] Thank you very much for that explanation. We've got some pretty varied beliefs on religion. [49:06.880 --> 49:10.880] I tend to be an engineer, so I don't have a belief system. [49:10.880 --> 49:12.880] I don't believe one way or another. [49:12.880 --> 49:16.880] I just look at what is out there and try to make sense of it. [49:16.880 --> 49:21.880] So I don't really have a belief about that. [49:21.880 --> 49:25.880] And that's too sophisticated a question for me to ask anyway. [49:25.880 --> 49:27.880] Or be the answer, I think. [49:27.880 --> 49:34.880] But you explain it well that it's a Sumerian thing and it's mistranslated, [49:34.880 --> 49:39.880] and that that's why it's often is why would God punish men for something the sons of God did? [49:39.880 --> 49:44.880] And that's why I was wondering that, and I was just asking you to speculate on it anyway. [50:29.880 --> 50:39.880] He's concerned that his wife, Allah had given him the ability to understand animals, [50:39.880 --> 50:43.880] but was warned, don't reveal what they say or that day you die. [50:43.880 --> 50:46.880] His wife found out he could do it and she wouldn't know what to say. [50:46.880 --> 50:51.880] And at one point he's sitting in the yard, his children playing in the yard, [50:51.880 --> 50:57.880] and he's lamenting the fact that his wife would be willing to risk his death [50:57.880 --> 51:07.880] in order to satisfy her idle curiosity after we have been married these hundred and twenty years. [51:07.880 --> 51:10.880] I put on the brakes when I saw that. [51:10.880 --> 51:17.880] There are references to human beings living a thousand years or plus or minus. [51:17.880 --> 51:21.880] And then there are references to certain human beings never dying, [51:21.880 --> 51:26.880] Noah being one of them, Enoch being another one, and there's a couple more. [51:26.880 --> 51:30.880] So this is a complex subject. [51:30.880 --> 51:38.880] But for the most part, as it goes to the Bible itself and what the belief system is, [51:38.880 --> 51:41.880] don't really mean too much to the belief system overall. [52:48.880 --> 52:56.880] And it's pretty clear if you read that within the context and in those passages of the Word [52:56.880 --> 53:00.880] that what they're talking about is angels, okay, [53:00.880 --> 53:07.880] spiritual beings that were created to be servants of God in the spiritual realm, [53:07.880 --> 53:16.880] and they left their position and basically came down to do what they weren't supposed to do, [53:16.880 --> 53:18.880] which was mate with mankind. [53:18.880 --> 53:24.880] And most biblical scholars agree this is where the race of the Nephilim came from. [53:24.880 --> 53:31.880] All right, so that is a totally different issue from the question that you are asking, [53:31.880 --> 53:37.880] which is why was man's days limited to 120 years? [53:37.880 --> 53:40.880] And Randy is correct. [53:40.880 --> 53:48.880] Up until the days of Noah, up until the Great Flood, men and women lived hundreds, [53:48.880 --> 53:51.880] even upwards to a thousand years. [53:51.880 --> 53:58.880] And I have read reference in the Bible of Noah passing, you know, of Noah dying, [53:58.880 --> 54:06.880] but the only two human beings that in the Old Testament at least that I have read [54:06.880 --> 54:10.880] that were raptured or that did not die were Enoch. [54:10.880 --> 54:13.880] It says Enoch walked with God and then he was translated. [54:13.880 --> 54:16.880] All right, and then Elijah, Elijah was taken. [54:16.880 --> 54:21.880] Those are the only two that I have read, and I've studied the Word pretty intensely. [54:44.880 --> 54:52.880] That's how I liken it to, like, similar to DU poisoning, okay, or some kind of radiation poisoning. [54:52.880 --> 54:57.880] It's literally passed through your genes and it's literally passed through the DNA, [54:57.880 --> 54:59.880] and it gets worse over time. [54:59.880 --> 55:02.880] It gets worse from generation to generation to generation, [55:02.880 --> 55:08.880] and that's why mankind was becoming so degraded and corrupted. [55:08.880 --> 55:15.880] And so when it says after the flood, after righteous Noah and his family passed through the flood, [55:15.880 --> 55:23.880] then God limited man's days to 120 years because of the sin and his flesh, God said, [55:23.880 --> 55:27.880] I cannot strive, my spirit cannot strive with man any longer than that. [55:27.880 --> 55:29.880] That's what the Word says. [55:29.880 --> 55:38.880] And so it's just God is, it's like putting, you know, clean water into a dirty glass, okay? [55:38.880 --> 55:40.880] It just doesn't jive. [55:40.880 --> 55:42.880] You have to clean the glass. [55:42.880 --> 55:45.880] And so if, can I finish, Randy, okay? [56:26.880 --> 56:32.880] And there are other places in the Old Testament that say things like, you know, [56:32.880 --> 56:38.880] man's day shall be upwards of three score, okay, around 60 years, [56:38.880 --> 56:43.880] but for strength perhaps another score upwards of 80. [56:43.880 --> 56:47.880] And look, look at what the normal lifespan is right about now. [56:47.880 --> 56:48.880] It's 75, 80 years old. [56:48.880 --> 56:52.880] And there are some people that will live 100, 110, 120. [56:52.880 --> 56:58.880] We've heard even as of recently, people in Asia may be living up to around 130. [56:58.880 --> 57:00.880] But that is the reason. [57:00.880 --> 57:03.880] It's because basically Randy's right. [57:03.880 --> 57:06.880] God can only put up with the flesh of our sin for so long. [57:06.880 --> 57:11.880] But if we have faith in Christ, we have eternal life and we will receive a new body. [57:11.880 --> 57:13.880] So that's what the Word says. [57:13.880 --> 57:15.880] Take it or leave it, okay? [57:15.880 --> 57:17.880] But that's the answer to the question. [01:04:25.880 --> 01:04:35.880] But my question now was I had a foreclosure sale happen this past Tuesday the 14th on my house, [01:04:35.880 --> 01:04:43.880] and was kind of curious if you guys had any ideas or any advice. [01:04:43.880 --> 01:04:47.880] Okay, place to start. [01:04:47.880 --> 01:04:57.880] What has been filed with the county registrar of deeds? [01:04:57.880 --> 01:05:08.880] Pull every document filed with the registrar of deeds from the date you received a warranty deed on the property. [01:05:08.880 --> 01:05:11.880] Look at those documents very carefully. [01:05:11.880 --> 01:05:19.880] In the year 2000, the bank started a program where they were going to make a fortune [01:05:19.880 --> 01:05:24.880] and break the back of the economy, and they did just exactly that. [01:05:24.880 --> 01:05:33.880] They created this securitization scheme where they would take residential mortgages, [01:05:33.880 --> 01:05:46.880] which were long-term indebtedness, and sell it to long-term investments, primarily your retirement funds. [01:05:46.880 --> 01:05:49.880] It would look like a perfect match. [01:05:49.880 --> 01:06:07.880] The problem is round whole square peg, residential mortgages had reporting requirements that made it not work for securities investing. [01:06:07.880 --> 01:06:15.880] In the process of putting this scheme together, they really screwed up the paperwork. [01:06:15.880 --> 01:06:21.880] So without going into all of the details of what all this scheme was about, [01:06:21.880 --> 01:06:32.880] the net result to you is the paperwork they have in the county registrar's office is trash. [01:06:32.880 --> 01:06:38.880] And every state is going to have a statute similar to this one. [01:06:38.880 --> 01:06:46.880] In order for the county registrar of deeds to have any force in effect, [01:06:46.880 --> 01:06:53.880] it must have a statute that says any claim against real property [01:06:53.880 --> 01:07:02.880] not properly filed in the county registrar's office is unenforceable as to the holder. [01:07:02.880 --> 01:07:11.880] And what that means is it don't matter if you are in fact the true and proper holder of the note and the deed of trust, [01:07:11.880 --> 01:07:24.880] that you have every right to collect on this note and thereby enforce the security instrument on default. [01:07:24.880 --> 01:07:31.880] If you don't have that properly filed in the county record, you cannot enforce it. [01:07:31.880 --> 01:07:36.880] Reason being, I sold a guy a business. [01:07:36.880 --> 01:07:43.880] He wanted me to give him credit and take a lien against his property, a mechanics lien. [01:07:43.880 --> 01:07:45.880] So I went down, looked in the county records. [01:07:45.880 --> 01:07:48.880] I didn't find a lien against his property. [01:07:48.880 --> 01:07:52.880] So I took a lien against his property. [01:07:52.880 --> 01:07:56.880] Now I've got JP Morgan Chase coming back saying, oh, we had a lien against the property. [01:07:56.880 --> 01:07:59.880] Well, sorry, Bubba. [01:07:59.880 --> 01:08:02.880] It wasn't in there when I checked. [01:08:02.880 --> 01:08:08.880] So you can't come back later now that I've taken a lien in good faith and try to exercise yours. [01:08:08.880 --> 01:08:11.880] OK. Does that make sense, Mike? [01:08:11.880 --> 01:08:15.880] It does. It does. And that's actually who I'm dealing with. [01:08:15.880 --> 01:08:20.880] OK. First place to look. Look at those records. [01:08:20.880 --> 01:08:23.880] And when I look at the records, this is what I look at. OK. [01:08:23.880 --> 01:08:27.880] Who's the borrower? When did it occur? [01:08:27.880 --> 01:08:32.880] Who's the trustee if it's a nonjudicial state? [01:08:32.880 --> 01:08:36.880] If it's not, who is the lender? [01:08:36.880 --> 01:08:42.880] Then I look at is there an assignment of the security instrument? [01:08:42.880 --> 01:08:45.880] If there is an assignment of the security instrument, [01:08:45.880 --> 01:08:50.880] I go back to that deed of trust and look to see if it's an FHA loan. [01:08:50.880 --> 01:08:57.880] If it's an FHA loan, there is no authorization to sell. [01:08:57.880 --> 01:09:03.880] I look at who did the assignment. Is MERS included in the deed of trust? [01:09:03.880 --> 01:09:04.880] Oh, yes. [01:09:04.880 --> 01:09:11.880] And if MERS is included in the deed of trust and there is an assignment of the deed of trust to somebody else, [01:09:11.880 --> 01:09:14.880] did MERS do the assignment? [01:09:14.880 --> 01:09:23.880] And if they did, did they say MERS as nominee for the original lender? [01:09:23.880 --> 01:09:28.880] Because if they didn't put the original lender's name in there, [01:09:28.880 --> 01:09:34.880] that probably means the original lender is out of business. [01:09:34.880 --> 01:09:41.880] And if the original lender is out of business, that means he's dead. [01:09:41.880 --> 01:09:48.880] The lender, a fictional entity is a person under law. [01:09:48.880 --> 01:09:56.880] I have one case here where Southern Star Lending issued the note in 2005. [01:09:56.880 --> 01:10:00.880] Southern Star Lending went out of business in 2007. [01:10:00.880 --> 01:10:06.880] In 2009, Deutsche Bank gave a loan modification. [01:10:06.880 --> 01:10:12.880] In 2012, MERS assigned the note from Southern Star to Deutsche Bank. [01:10:12.880 --> 01:10:14.880] Now, hold on, guys. [01:10:14.880 --> 01:10:22.880] 2009, how in the heck did Deutsche Bank give a loan modification? [01:10:22.880 --> 01:10:33.880] There's nothing in the record saying that Deutsche Bank has the power to make any claim against the property. [01:10:33.880 --> 01:10:41.880] 2012, MERS assigned this deed of trust from Southern Star to Deutsche Bank. [01:10:41.880 --> 01:10:42.880] Now, wait a minute. [01:10:42.880 --> 01:10:48.880] Southern Star was a person under law and that person died in 2007. [01:10:48.880 --> 01:10:51.880] You can't be an agent for a dead guy. [01:10:51.880 --> 01:10:52.880] Right. [01:10:52.880 --> 01:10:54.880] And that's been upheld. [01:10:54.880 --> 01:10:57.880] These are the kinds of things we look for. [01:10:57.880 --> 01:11:01.880] First, just look at names, dates, who did what. [01:11:01.880 --> 01:11:13.880] Nobody can make a claim against property unless there's something in the record showing that they have the power to make that claim. [01:11:13.880 --> 01:11:17.880] That's the biggest thing you look for. [01:11:17.880 --> 01:11:19.880] And there are a lot of other details. [01:11:19.880 --> 01:11:26.880] We have a lot of guys talking about bifurcation of the note and securitization and all this stuff. [01:11:26.880 --> 01:11:33.880] Well, you know, that's pretty well been beat up by the courts. [01:11:33.880 --> 01:11:43.880] And I think the banks waved that around at us in order to send us down that rabbit hole. [01:11:43.880 --> 01:11:50.880] They didn't want us to go back and look at what they've got filed in the county record. [01:11:50.880 --> 01:11:57.880] The trustee or the person who did the sale, were they properly appointed to do that? [01:11:57.880 --> 01:12:04.880] Were they properly appointed to do that by someone who had power to properly appoint them? [01:12:04.880 --> 01:12:05.880] We look at these details. [01:12:05.880 --> 01:12:08.880] They don't want us going there. [01:12:08.880 --> 01:12:20.880] Read that security instrument, especially those sections that put limitations on the borrower, on the lender. [01:12:20.880 --> 01:12:24.880] Covenant 13, 14, 15. [01:12:24.880 --> 01:12:27.880] 13 generally limits the fees. [01:12:27.880 --> 01:12:35.880] It tells them they can only charge fees that are authorized by law or I forget exactly what it says. [01:12:35.880 --> 01:12:37.880] It addresses the fees they charge. [01:12:37.880 --> 01:12:41.880] And we talked about that earlier in the show. [01:12:41.880 --> 01:12:48.880] 14 generally requires certain notices. [01:12:48.880 --> 01:12:54.880] 15 defines governing law and severability. [01:12:54.880 --> 01:13:01.880] And in 15, both parties agree to abide by all governing law. [01:13:01.880 --> 01:13:07.880] If you can find any law that the lender violated, he breached the contract. [01:13:07.880 --> 01:13:09.880] He's in default. [01:38:34.880 --> 01:38:44.880] I simply faxed back a document in a very hurried fashion with my name on it or whatever, but it was never notarized in front of that person. [01:38:44.880 --> 01:38:54.880] Okay. That won't help you because the court will say, okay, this wasn't properly notarized. [01:38:54.880 --> 01:39:06.880] Did you sign a note and security instrument to secure this loan? [01:39:06.880 --> 01:39:07.880] And you're going to say yes. [01:39:07.880 --> 01:39:16.880] So, notary, on the note and security instrument will become irrelevant because it can be proven. [01:39:16.880 --> 01:39:17.880] Got it. [01:39:17.880 --> 01:39:20.880] And I made payments after for a while anyway. [01:39:20.880 --> 01:39:23.880] So, I get that. [01:39:23.880 --> 01:39:24.880] Then the next thing is MERS. [01:39:24.880 --> 01:39:36.880] Very interestingly, I suspect you know, I think it was 2010, there was a ruling by the Arkansas Supreme Court that MERS at least didn't have standing to foreclose. [01:39:36.880 --> 01:39:41.880] And I understand that MERS has to assign the note to someone. [01:39:41.880 --> 01:39:46.880] I originally financed it with Fremont Financial in 2007. [01:43:07.880 --> 01:43:14.880] I have four documents that were filed and these are there at the county record that say [01:43:14.880 --> 01:43:17.880] mortgagee's notice of default and intention to sell. [01:43:17.880 --> 01:43:24.880] This is prior to MERS assigning this to Chase but yet on Chase's behalf. [01:43:24.880 --> 01:43:28.880] I believe there's some material issue that's very important for many people. [01:43:28.880 --> 01:43:32.880] There's a very specific material issue there. [01:43:33.880 --> 01:43:37.880] That makes those notices void and unenviable force in effect, [01:43:37.880 --> 01:43:42.880] but you would have to file the claim against those documents. [01:48:46.880 --> 01:48:52.880] Immediately after calling the docket, the judge instructed the men and women that were there [01:48:52.880 --> 01:48:57.880] for these particular property tax hearings that they were all going to go downstairs [01:48:57.880 --> 01:49:01.880] into another little room along with the attorney and the people from the school district [01:49:01.880 --> 01:49:05.880] and the people from the appraisal, blah, blah, blah. [01:53:34.880 --> 01:53:38.880] And one of the first things that I did is I told the adjudicator, [01:53:38.880 --> 01:53:44.880] I said I need you to produce your bar card and your certifications. [01:53:44.880 --> 01:53:48.880] As an adjudicator, you're required to have three years' experience, [01:53:48.880 --> 01:53:54.880] and you're supposed to have these four requirements, and here's the statue that says that. [01:53:54.880 --> 01:53:59.880] And he wouldn't produce any of the documents to me. [01:53:59.880 --> 01:54:03.880] So did you move to disqualify him? [01:54:03.880 --> 01:54:07.880] No, but I moved to dismiss the... [01:54:07.880 --> 01:54:10.880] Okay, here's a little more fun you can have. [01:54:10.880 --> 01:54:14.880] Okay. [01:54:57.880 --> 01:55:01.880] Oh, exactly, yeah, it doesn't even count on my driver's record if I'm found guilty. [01:55:01.880 --> 01:55:04.880] So who cares? [01:55:04.880 --> 01:55:06.880] Once you've done this... [01:55:06.880 --> 01:55:10.880] Anyway, right, right, but I wasted the time for an hour. [01:55:10.880 --> 01:55:18.880] You know, I made him produce papers, I made him spend money on sending me certified letters, and I haven't paid a dime yet. [01:55:18.880 --> 01:55:26.880] And if the judge failed to follow the law, you need to send a tort letter to the city, [01:55:26.880 --> 01:55:36.880] noticing then that the judge denied you in your rights and you were harmed by this amount, make behold would be sued. [01:55:36.880 --> 01:55:40.880] Now, this is very, very interesting. [01:55:40.880 --> 01:55:51.880] They have a statute that says if they use a videotape or a photo, that that videotape or that photo must have a time stamp stating the time, the date, the location. [01:55:51.880 --> 01:56:00.880] Well, when he ID'd my vehicle and, you know, saying that I was the registered owner, and when they used the videotape to prosecute me, [01:56:00.880 --> 01:56:04.880] none of those photos or tapes had those time stamps. [01:56:04.880 --> 01:56:09.880] And I brought those up to him, and it was the same thing like the other gentleman said, [01:56:09.880 --> 01:56:16.880] yeah, that might be it, but that's not how I see it, and found me guilty, you know? [01:56:16.880 --> 01:56:19.880] So judicial conduct complaints the judge. [01:56:19.880 --> 01:56:21.880] Yeah. [01:56:21.880 --> 01:56:24.880] These things are so powerful. [01:56:24.880 --> 01:56:28.880] You know, lawyers never do that kind of thing to judges and other lawyers. [01:56:28.880 --> 01:56:35.880] Now, I have one other thing to ask you. We were in the middle of the hearing, and I had him going for about 25 minutes, [01:56:35.880 --> 01:56:45.880] and as I was reading off the ordinances, you know, with my arguments, he goes, I'm not going to argue with these issues with you. [01:56:45.880 --> 01:56:55.880] Just hand me what you have as proof, and we'll go to the next issue, and I'll put it in as, what do they call that? [01:56:55.880 --> 01:56:57.880] Judicial notice? [01:56:57.880 --> 01:57:01.880] No, not, he marked it as exhibits. [01:57:01.880 --> 01:57:02.880] Okay. [01:57:02.880 --> 01:57:07.880] You know, as I handed in my, you know, arguments to him, and then what he did is he goes, you know what? [01:57:07.880 --> 01:57:16.880] This is taking too long. You go sit down. I'm going to go and handle these other people in front of you, okay? [01:57:16.880 --> 01:57:23.880] And so I sat down, and I think he handed my paperwork to somebody else, and they started reading it, [01:57:23.880 --> 01:57:33.880] and basically when I went to sit down, somebody pulled their placards off of where they sit at the podium, [01:57:33.880 --> 01:57:39.880] and they put their placards with their names down so I couldn't write their names. [01:57:39.880 --> 01:57:42.880] Wonderful. [01:57:42.880 --> 01:57:51.880] And then when they called me back up, that's where I noticed he was shaken, and then I gained my momentum, and then I just whacked him at the end.
