Charges [01:00.480 --> 01:05.160] brought against Kokesh were resisting arrest and refusal to submit to booking process in [01:05.160 --> 01:09.880] jail. However, it is unclear whether any initial charge that led to these additional charges [01:09.880 --> 01:15.200] existed. Adam Kokesh is the organizer of a planned July 4th armed march through Washington [01:15.200 --> 01:20.680] D.C. where all public display of firearms is prohibited. Many have pointed to the arrest [01:20.680 --> 01:25.880] as retaliation for Kokesh's promotion of the armed march. Those around Kokesh deny that [01:25.880 --> 01:32.880] the TV show host smoked or possessed any marijuana at the rally this weekend. They were subsequently arrested by local police. A similar story emerged from Spain last year in July when dozens of people [02:11.600 --> 02:18.600] destroyed two experimental GMO crops of corn. [02:20.360 --> 02:25.160] The District of Columbia is moving to require firearms owners to purchase costly liability [02:25.160 --> 02:29.660] insurance. California, Connecticut, Maryland, Massachusetts, New York and Pennsylvania have [02:29.660 --> 02:34.440] also proposed legislation to force gun owners to buy the liability insurance. The law would [02:34.440 --> 02:40.260] require residents to purchase at least $250,000 in insurance coverage before allowing citizens [02:40.260 --> 02:44.940] to register their firearms. There's more to Memorial Day than what you can stuff in your face and the [05:01.220 --> 05:07.220] number of friends and family you can share beer and barbecue with on this day. And what [05:07.220 --> 05:11.220] I would like to do for the first part of the show here is, I want to read you a couple [05:11.220 --> 05:18.220] of things I posted up on Facebook to try to get attention to Tower of Law when it launches. [05:18.220 --> 05:23.220] But this is something that is near and dear to my heart because I served 14 years in the [05:23.220 --> 05:28.220] military myself. I know what the lifestyle is like, I know the things you're asked to [05:28.220 --> 05:33.220] do, I know that most people that are asked to do a lot of these things don't agree with [05:33.220 --> 05:41.220] them and they do it more out of necessity than desire. And we need to understand that. [05:41.220 --> 05:47.220] The troops are not the ones that should be hated. The people that send them there for [05:47.220 --> 05:53.220] their personal profit and gain are the ones that deserve your ire. Not the men and women [05:53.220 --> 06:01.220] that fought, died, got injured, or just broken because of their service. You need to keep [06:01.220 --> 06:06.220] that in mind. Okay, there's two things I posted up here tonight and I'm going to start with [06:06.220 --> 06:11.220] the first one. And I'm just going to read what I posted so the context of it doesn't [06:11.220 --> 06:16.220] get lost. I served 14 years in the United States Air Force and I give a heartfelt thanks [06:16.220 --> 06:22.220] to all those men and women that have served and given everything, literally, so that others [06:22.220 --> 06:28.220] could have freedom and liberty. I am no fan of war or those that profit from it. I have [06:28.220 --> 06:33.220] no love for those men that could callously or could and would callously send others to [06:33.220 --> 06:38.220] fight, kill, and die, only so that their personal wealth and comfort are assured by the [06:38.220 --> 06:43.220] profits that follow their sponsoring both sides of the conflict. And it saddens me to [06:43.220 --> 06:49.220] no end that most Americans have not only lost sight of that sacrifice, but have completely [06:49.220 --> 06:54.220] nullified it by gutlessly and apathetically allowing our public servants to work diligently [06:54.220 --> 07:01.220] and corruptly to destroy both before our very eyes. It is a national disgrace to allow this [07:01.220 --> 07:06.220] traitorous charlatan of a man and president to even enter into the Arlington National [07:06.220 --> 07:12.220] Cemetery and stand upon the ground where lies so many that fought and paid the ultimate [07:12.220 --> 07:17.220] price to protect our liberty and freedom, much less pay false respects to the lives and [07:17.220 --> 07:23.220] sacrifices made by those that are in tune there. You know full well that in his heart, [07:23.220 --> 07:28.220] he would gladly see it turned into a landfill that remained standing as a memorial to [07:28.220 --> 07:34.220] everything that he has committed himself and the entire U.S. Congress to destroying. [07:34.220 --> 07:39.220] Where are the bold Americans that stood against the world's most powerful king and his [07:39.220 --> 07:45.220] army of the day? They stood up and said no more to a government that ruled totally by [07:45.220 --> 07:50.220] the force of that army. The Americans who understood that at some point, words and [07:50.220 --> 07:55.220] documents are no longer sufficient to protect that which you hold dear when another is [07:55.220 --> 08:02.220] willing to use any amount of force or kill you to take it. The same type of Americans [08:02.220 --> 08:06.220] who understood that if they fail to defend their liberty and the right to be left alone [08:06.220 --> 08:11.220] by government, not only their property and possessions were to be forfeit, but their [08:11.220 --> 08:16.220] very lives. Those Americans knew that if they failed, they would be branded traitors [08:16.220 --> 08:21.220] and terrorists by the very oppressors they sought to stop and their families would suffer [08:21.220 --> 08:28.220] along with them. Yet unite and stand, they did. And your predecessors were able to live [08:28.220 --> 08:35.220] freer for a period of time, more so than has ever been heard of since. And now we have [08:35.220 --> 08:41.220] come full circle. Now, just over 200 years later, we are once again faced with those [08:41.220 --> 08:46.220] same possibilities. The total loss of freedom and liberty, despite the best efforts of [08:46.220 --> 08:52.220] wise and experienced men to provide us with the knowledge, ideas, the means and the [08:52.220 --> 08:57.220] tools to make sure that the few powers we surrendered could never be turned against [08:57.220 --> 09:03.220] us and used to subjugate us once again. When is it enough to make you want to take a [09:03.220 --> 09:09.220] stand? When they take someone you know, when they take a family member, when you are [09:09.220 --> 09:18.220] the last one? When is it okay to start acting like and being an American? When? To [09:18.220 --> 09:22.220] those Americans that have taken a stand and are willing to do what is necessary to [09:22.220 --> 09:26.220] protect the opportunities, property and rights that American liberty and freedom was [09:26.220 --> 09:32.220] meant to provide, I say thank you. With all my heart, I pray for you to have strength [09:32.220 --> 09:38.220] of will, mind and spirit to sustain you in the trials and tribulations to come. Be [09:38.220 --> 09:43.220] honest. And to those Americans that have no desire to be involved in understanding [09:43.220 --> 09:49.220] and preventing what is being done to you and to the rest of us, as well as those that [09:49.220 --> 09:54.220] would rather just bury your heads in the sand and hope that the hunting lion will pass [09:54.220 --> 09:59.220] you by, or who are stupid enough to believe that this disgraceful and despicable human [09:59.220 --> 10:04.220] and his doppelganger cohorts in Congress are not willing to feed you to that lion to [10:04.220 --> 10:10.220] save their own worthless skins, I say this, don't be proud people. Just go on eating [10:10.220 --> 10:16.220] your hot dogs and burgers, drinking your beer and be ashamed because that is the only [10:16.220 --> 10:22.220] form of honor that you have earned this Memorial Day. Now in this I've got two [10:22.220 --> 10:27.220] pictures posted. One is a group of Marines paying respects at Arlington Cemetery and [10:27.220 --> 10:34.220] the other is Obama with a frown on his face hanging a wreath in front of the Tomb of [10:34.220 --> 10:43.220] the Unknown Soldier. That man should never be allowed to even touch that wreath. [10:43.220 --> 10:48.220] Now the second thing is, there's a picture here of a poem that someone named Sherry [10:48.220 --> 10:53.220] Ball wrote and I want to read that to you. And again, it's meant to go to the men and [10:53.220 --> 10:59.220] women that have served and fought and died for this day. [10:59.220 --> 11:05.220] I do not know your name, nor for which battle you died. I do not know your home, [11:05.220 --> 11:12.220] nor the tears that were cried. I do not know where you rest, nor the promises broken. [11:12.220 --> 11:19.220] I do not know your uniform, and your fears lay unspoken. But I know your spirit exists, [11:19.220 --> 11:26.220] that your courage is admired, and your sacrifices honored by each soul that's inspired. A hero is someone that knows fear, [11:59.220 --> 12:04.220] but does the task that needs to be done anyway. It takes a greater love of freedom [12:04.220 --> 12:08.220] and liberty to lay down your life for a total stranger than it does for your family [12:08.220 --> 12:14.220] and friends. But to do so for either is the greatest deed that one man or woman [12:14.220 --> 12:20.220] can perform for another. Christ did the same for us all, and just like His sacrifice [12:20.220 --> 12:25.220] and gift to us, we are just as free to accept or reject the sacrifice of all these men [12:25.220 --> 12:31.220] and women that died to make American faith and ideals the bedrock of our country. [12:31.220 --> 12:36.220] Today there seems to be too many Americans that are far more willing to reject both [12:36.220 --> 12:41.220] in the name of what is popular and what is politically correct. And that is okay, [12:41.220 --> 12:46.220] for that is the choice provided by free will, and God granted us that choice. [12:46.220 --> 12:52.220] What is your choice? Where do you stand this day? Where will you stand in the days [12:52.220 --> 12:58.220] of trials and tribulations yet to come? Will you stand fearfully back in the shadows, [12:58.220 --> 13:04.220] or will you choose to stand in the light and be fearless? I know what I have chosen, [13:04.220 --> 13:10.220] and I have faith in its foundation and reward. Do you? [13:10.220 --> 13:17.220] Ladies and gentlemen, I've been to these places where these people fight and die. [13:17.220 --> 13:30.220] I was there. I did the same. I was fortunate enough to come back, but so many were not. [13:30.220 --> 13:42.220] And to that far too large number of men and women, you owe a great thank you, [13:42.220 --> 13:50.220] even more so to our Creator who offered His Son to give you the opportunity to make those choices. [13:50.220 --> 13:55.220] Now, I know we have lots of listeners and lots of people out there that, [13:55.220 --> 14:01.220] as the previous host was stating, don't believe in God. [14:01.220 --> 14:06.220] But I'm here to tell you He's there, like it or not. [14:06.220 --> 14:11.220] And He did give you the choice to choose not to believe in Him. [14:11.220 --> 14:17.220] If you've made that choice, well, then you're free to do it. [14:17.220 --> 14:25.220] And I'm not going to hate you or disparage you because you made it, because God said you have it. [14:25.220 --> 14:31.220] He gave you two gifts, the gift of eternal life through His Son [14:31.220 --> 14:40.220] and the gift of making the choice of being able to accept it of your own free will. [14:40.220 --> 14:46.220] And that's all He's ever asked of us, that we try to be more like His Son [14:46.220 --> 14:55.220] and that we take the gift He offered freely and at great sacrifice to Himself. [14:55.220 --> 14:59.220] And these men and women chose to make a very similar sacrifice [14:59.220 --> 15:04.220] and lay down their own life, both in the very beginning of this nation [15:04.220 --> 15:10.220] and in every man-made war since, not because they wanted to fight, [15:10.220 --> 15:17.220] but because they believed and had faith that they were doing what was right [15:17.220 --> 15:21.220] and protecting those that could not protect themselves. [15:21.220 --> 15:28.220] So here in America, we have those choices, free to make them, free to exercise them. [15:28.220 --> 15:32.220] When do we become Americans again and start to do so? [15:32.220 --> 15:37.220] When do we take pride in being able to take care of ourselves [15:37.220 --> 15:41.220] and giving freely of ourselves to our neighbors [15:41.220 --> 15:48.220] without being forced to do so against our will at the barrel of a gun? [15:48.220 --> 15:52.220] And should I even mention that it's a gun that should never have been allowed [15:52.220 --> 15:56.220] to be pointed at us in the first place? [15:56.220 --> 16:03.220] Time to wake up, people. Time to do the job that being an American calls you to do. [16:03.220 --> 16:09.220] Protect yourself by protecting your neighbors. [24:31.220 --> 24:39.220] Now, as the courts have ruled when it comes to income tax, it is perfectly legal to seek methods of tax avoidance. [24:39.220 --> 24:47.220] OK. But it is illegal to not pay a tax that you owe. [24:47.220 --> 24:54.220] Well, how can it be illegal to not pay a tax you never owed? [24:54.220 --> 25:15.220] So that becomes the issue. And believe me, the reason I nitpick when statements like the one you made are made is because when it comes to dealing with the subject matter surrounded by law, semantics of words and phrases becomes extremely important. [25:15.220 --> 25:19.220] So you have to choose your words carefully. [25:19.220 --> 25:42.220] That's why lawyers tiptoe around virtually every issue, because the law is so convoluted and misconstrued because it's based more on opinions than reality and morality and ethics that you can make the law say and do virtually anything you want in any given situation. [25:42.220 --> 25:54.220] Yeah, I know, because the legal definition of a word is always going to be different than the dictionary definition of a word. And by the way, what's the hierarchy? Blacks, Bouviers, what is the hierarchy for looking up a word? [25:54.220 --> 26:04.220] The statute, then legal dictionaries and case law, which will be the basis for the definition in the legal dictionary. [26:04.220 --> 26:11.220] And if it doesn't exist in any of those, then and only then do you get to go to common English dictionaries. [26:11.220 --> 26:26.220] Yeah, and if you look at the definition for a cop or police officer or whatever the exact term is, you'll say he has only one job, and that job is to keep the peace. It's a shame a lot of cops don't understand that. [26:26.220 --> 26:41.220] Well, again, that's the whole thing about trying to educate a cop during a stop. What they understand or are even able to comprehend is highly suspect. [26:41.220 --> 26:45.220] That is true. [26:45.220 --> 26:53.220] And that's just a bad place to make any attempt at an educated guess. [26:53.220 --> 27:02.220] Yes, I know you talked all about that in your presentation. Remain silent, don't remain a deaf-mute, but don't say anything that'll incriminate you. [27:02.220 --> 27:14.220] Yeah, your task is one that does one of three things only. It invokes a right, demands the right be respected, or it protects a right that's already invoked. [27:14.220 --> 27:25.220] If you're doing anything that isn't doing one of those three things, then you're doing the wrong thing. [27:25.220 --> 27:35.220] Yes, that is the case, and common law and constitutional law always come statutory law, is that right? [27:35.220 --> 27:38.220] Well, yeah, if there's a conflict between them, yes. [27:38.220 --> 27:52.220] Because it says in your script no law is valid if it violates a fundamentally protected right. I don't remember the exact phrase, I haven't memorized it, but I know what it exactly is in the script. [27:52.220 --> 27:57.220] Any law that violates a fundamentally protected right is never valid. [27:57.220 --> 27:58.220] That is all. [27:58.220 --> 28:00.220] That's correct. [28:00.220 --> 28:05.220] Another thing people don't understand, and then people in government and law. [28:05.220 --> 28:21.220] Well, the problem is is what people see as fundamentally protected rights versus privileges that can be revoked, and that's where we've allowed the courts to go way outside of the boundaries of where we wanted them to be when it came to protection of those rights. [28:21.220 --> 28:34.220] The courts have eroded those rights to the point of collapse, and the people should have never allowed that to even begin, much less continue. [28:34.220 --> 28:46.220] Well, many people let that happen because they're so concerned about public safety and national security. If only people understood that those two phrases do not mean what they're led to believe it does. It's all a scam to inflict tyranny. [28:46.220 --> 28:56.220] Well, national security does not mean the security of the nation. It means the security of the elite group of people that want the capability to do whatever the heck they want. [28:56.220 --> 28:59.220] Exactly. [28:59.220 --> 29:05.220] That's what national security means, people. It's got nothing to do with the security of the country. [34:10.220 --> 34:14.220] Yeah, yeah, yeah. You as funny as screen doors on a submarine, dude. [34:14.220 --> 34:20.220] No, I just wanted to respond to your opening comment. [34:20.220 --> 34:32.220] I kind of have some mixed emotions based on a lot of interaction I've had with a lot of military people that I've run into in my neck of the woods. [34:32.220 --> 34:44.220] You know, I have the utmost respect for anyone who is willing to sacrifice his life for what he believes is right. [34:44.220 --> 34:58.220] However, you know, at the same time, I run into a lot of troops around here, and I make it a habit when I see them out in public to approach them and have, you know, conversations and Q&A with them. [34:58.220 --> 35:10.220] And I've been doing that for the last six or seven years, and I've probably had, I don't even know, I've probably talked to 150, couple hundred of them over the years. [35:10.220 --> 35:18.220] And I'll usually just approach them and, you know, thank them for their service and, you know, ask them what branch of the military they're in, what they do, and all that. [35:18.220 --> 35:25.220] And ask them if they would mind if I, you know, just ask them a few questions, and they're usually pretty open to it. [35:25.220 --> 35:33.220] And I always ask them, you know, have you sworn an oath to uphold and defend the Constitution? [35:33.220 --> 35:42.220] And they all say, oh, yeah, of course. I've had a few of them tell me, oh, yeah, I've done that two or three times, which to me, that's kind of an issue because it's supposed to be a lifelong oath. [35:42.220 --> 35:56.220] But anyway, you know, and I'll just ask them a few questions, and ultimately I'll ask them, would you ever, for any reason, if so, ordered fire on Americans, on American soil? [35:56.220 --> 36:09.220] And one time I had one guy say, hell no. Every single one of the rest of them has said, oh, gosh, wow, that's, you know, that's a really good question, man. [36:09.220 --> 36:22.220] I mean, you know, that's just something, you know, we don't want to do. But, you know, at the same time, I mean, we follow orders and, you know, and I'm like, wow, you know, I just don't know what to think about that. [36:22.220 --> 36:30.220] And I've had a few of them tell me that, you know, if they get orders that they disagree with, that there are processes that they could go through to oppose it. [36:30.220 --> 36:37.220] And then I'll ask them, would you actually go through that process, whatever it might be? And they say, well, you know, it takes a lot of time. [36:37.220 --> 36:54.220] There's a lot of paperwork involved. And so I, you know, and a lot of the, there are a lot of videos available online that are made by the troops themselves doing things, you know, throwing animals off bridges. [36:54.220 --> 37:16.220] And, you know, there's guys up on a roof, shooting women and children and laughing, talking about how it's a turkey shoot, like it's a video game. And, you know, and some of these guys, even when you can show them that from a historical standpoint, the same people have financed both sides of every war. [37:16.220 --> 37:30.220] And they're reaping huge profits from these wars. They just, you know, when you're in the military, you are programmed to not think, just do, don't question, don't question your orders, don't question your superiors. [37:30.220 --> 37:52.220] So it's, I really have mixed emotions. You know, I mean, like I said, any man who, who's willing to risk his life and die for what he believes is right, you know, I have the utmost respect for him. But at the same time, the, you know, a lot of the, a lot of the people that I've talked with have made it pretty clear that they're not going to question whether or not what they're doing is right. [37:52.220 --> 38:07.220] And even if it comes down to getting orders of firing on Americans on American soil, and granted, you know, my sample data, the conversations that I've had with them is probably, you know, it could be a little bit skewed because it's just here in my neck of the woods in my area. [38:07.220 --> 38:22.220] It may be totally different elsewhere, but it's really concerning when I've had that many conversations with that many soldiers, and I've asked the same question to all of them, and only one guy has actually said, no, I absolutely would not. [38:22.220 --> 38:31.220] All of the rest of them have indicated that they would, you know, really have to struggle with, well, it actually wouldn't even be a struggle. They would just probably just follow the orders. [38:31.220 --> 38:56.220] So, you know, I just wanted to, it's, it's, at least around here, it's a very concerning situation. I would encourage people if they see soldiers out in public when they're on leave or, you know, you see them in a sporting goods store buying ammo or whatever, just approach them and ask them those questions and kind of get a feel for, for, you know, kind of the kind of the climate around wherever they are. [38:56.220 --> 39:08.220] Well, I would agree with that. I mean, I do the same thing. I do it with, especially police officers, because I see a lot more of them, this being Austin, than I do actual military people. [39:08.220 --> 39:16.220] But having been ex-military, pretty much all I have to do is wear my Desert Storm veterans cap around, and they're more than willing to talk to me then. [39:16.220 --> 39:33.220] And then once I tell them I'm an ex-deputy sheriff, oh, they open up even more. So, you know, there's that kindred spirit thing that they enjoy. They'll talk more openly to someone they feel that's seen and done what they've had to do. [39:33.220 --> 39:53.220] Yeah, true, true. And as I understand it, that's actually one of the induction evaluation questions now. A standard, you know, one of the standard questions when you're going into the military, one of the things they ask you now is, you know, would you fire on Americans if you're told to? [39:53.220 --> 39:58.220] Yeah, and I think whoever came up with that question should have been court-martialed right off the bat. [39:58.220 --> 40:16.220] I agree. Absolutely. So, anyway, I just wanted to kind of respond and, you know, I guess it's like anything else, even like with cops, you know, you can't just assume that they're all bad, but at the same time, it's dangerous to assume that they're all good, you know. [40:16.220 --> 40:29.220] So, I would encourage people if you, you know, if you see military type folks out and about, just approach them and ask them and, you know, you may be a little bit surprised at some of the answers you get. [42:18.220 --> 42:29.220] You have to learn how to do this, and it's better to have the time to learn it when you're not under the gun than have to try to pick it up when you are out of time. [42:39.220 --> 42:43.220] And yes, you'll have to keep coming to class to practice the skills and get good at it, [42:43.220 --> 42:57.220] but still what you're going to learn out of it will be invaluable because what nobody seems to realize is that they are pushing harder and harder and harder to get as many people involved in this as they can [42:57.220 --> 43:04.220] by writing as many citations for as many reasons as they can, including completely fabricated ones. [43:04.220 --> 43:07.220] Why? Revenue. [43:07.220 --> 43:12.220] All of the counties, all the cities, all the states are screaming, we're hurting for money. [43:12.220 --> 43:14.220] People, you're not hurting for money. [43:14.220 --> 43:23.220] What you're hurting for is something that has purchasing power that actually serves as currency. [49:40.220 --> 49:49.220] I don't have to give you money to support that which I do not want to support or believe in via any form of taxation. [49:49.220 --> 50:05.220] I do not have to use my property or my labor to improve your situation in any way, shape, or form unless it is completely by my free choice and exercise thereof to do so. [50:05.220 --> 50:10.220] And again, not at the barrel of a gun. [50:10.220 --> 50:18.220] Now, I don't agree with everything Mark Stevens says, but that point of view I absolutely agree with. [50:18.220 --> 50:28.220] Government should never be allowed to compel you to accept what it does at the barrel of a gun. [50:28.220 --> 50:35.220] Government was created with a single solitary focus for the powers it was given. [50:35.220 --> 50:48.220] To use those powers to ensure the individual rights and property of every American was protected against intrusion by anyone else. [52:59.220 --> 53:09.220] We've got people here that light off fireworks, and like you said, they stuck their face with beer and barbecue, and that seems to be about all it is for them. [53:09.220 --> 53:14.220] So I know where you're coming from with that. [53:14.220 --> 53:33.220] But to get to my question here, now you specialize, as you say, in transportation and traffic loss, and ever since I discovered you, I first heard you on the Freedom Slips broadcast about two years ago, about four hours long, and that was fantastic. [53:33.220 --> 53:55.220] Ever since I've discovered you and found out about what you do, I've been telling almost everybody within earshot, friends, family members, about this concerning the transportation law and what they're using against us, how they're completely distorting the laws and so forth. [53:55.220 --> 54:05.220] Anyway, I've been telling everybody I know, and some of them are interested. Actually, most aren't, probably because they're too dumbed down. [54:05.220 --> 54:29.220] But what I wanted to ask you, Eddie, is regarding corporate entities that you might deal with, whatever it may be, banks and so on and so forth, which, of course, they're essentially, I got this correct, regulated by their own private law. [54:29.220 --> 54:43.220] But arguably, the corporations and the big companies and so forth may be picking our pockets even more than the cops and the courts. [54:43.220 --> 55:12.220] So what do you think would be the best route for a person to take, I have a couple of examples if you want to hear them, but what would be the best route to take for a person who, you know, if say, a bank that you're with is trying to rip you off by sending you a bill, let's say, for something that you've never had, a charge that you've never had, how would you say to deal with people like that? [55:12.220 --> 55:15.220] If there is a way. [55:15.220 --> 55:23.220] Well, I mean, can you give me a context here? When you say send you a bill, what bank can send you a bill? [55:23.220 --> 55:42.220] Okay. Absolutely. Absolutely. I will give you an example. For instance, in December of 2011, around that time, I started getting notices from my particular bank saying that I had opened a security deposit box in early 2005. [55:42.220 --> 55:54.220] And they kept sending me emails and that, you know, I had a fee that was due, et cetera, and they were also tacking on late fees. [55:54.220 --> 55:57.220] And this was up to about $60 at this point. [55:57.220 --> 56:12.220] So I called the bank and I said, look, I have never opened the safety deposit box there. I've never, you have no record. So you have a signature, you know, a sign in to access a deposit box. You have no video of it. [56:12.220 --> 56:16.220] I said, I don't have a key to a deposit box. I don't have a number to a box. [56:16.220 --> 56:25.220] And they kept insisting that I did. And they said, we have a signature is what they told me. We have your signature for a lot. [56:25.220 --> 56:32.220] And I said, well, then it's a forgery and it's somebody else that came in and signed for it because it wasn't me. [56:32.220 --> 56:41.220] So you need to look into that. And they never did because they charged me anyway. [56:41.220 --> 56:57.220] And to give you a little more context of where I'm coming from personally, like back in the 90s, I was the kind of person where if I went into a store, Walmart, Best Buy, whatever it may have been, [56:57.220 --> 57:05.220] if I bought an item, excuse me, and the item didn't work for me or didn't perform as advertised, I would go to return it. [57:05.220 --> 57:12.220] And when I would have to talk to, you know, first the girl behind the service counter and ultimately to the manager, [57:12.220 --> 57:23.220] and they would tell me, well, it's our policy that we don't refund an item, refund the money for an item after the plastic has been opened or whatever. [57:23.220 --> 57:34.220] I would say, well, it's my policy that I do not, you know, I don't pay for an item that does not work for me or does not work as advertised. [57:34.220 --> 57:37.220] And so on and so forth. [57:37.220 --> 57:42.220] And how does that fit in with a safety deposit box? [57:42.220 --> 57:47.220] OK, well, I'm just but I wanted to give you a context of sort of my style of thinking. [57:47.220 --> 57:56.220] I've been doing stuff like that since the 90s when when the big stores and corporations are trying to rip this off, in my opinion. [57:56.220 --> 58:07.220] OK, so anyway, getting back to the safety deposit box thing now, I thought I had this result in December of 2011 and now they're doing it again. [58:07.220 --> 58:17.220] So I guess what I'm asking is, is there any way to fight that and you're fighting a pretty big corporate entity? [58:17.220 --> 58:22.220] Well, yeah, they can't prove that you're the one that actually signed for the deposit box. [58:22.220 --> 58:27.220] I mean, you can basically sue them for small claims, you know, if they're going to harass you. [58:27.220 --> 58:31.220] I just send them a written tort letter. So, as you said earlier, it would be a tort letter, so it's in writing. [01:05:16.220 --> 01:05:28.220] I think if I were to try to synopsize sort of the heart of what I'm talking about, and like I said earlier, arguably perhaps the big corporations take our pockets even more than the courts do, [01:05:28.220 --> 01:05:40.220] that bills that just seem to, you know, I say bills, but any kind of a bill, an extraction, whatever, that seems to come out of nowhere these days. [01:05:40.220 --> 01:05:45.220] You know, you get a bill from somebody, you don't even, you don't know what the company it is. [01:05:45.220 --> 01:05:52.220] Well, of course, because in the commercial realm, a bill that's not disputed is valid. [01:05:52.220 --> 01:06:03.220] Right, right. And I don't know if it's true, I think I read it in that book by Mary Elizabeth Croft, is that how to clobber every little long title to the book? [01:06:03.220 --> 01:06:13.220] Yeah, I know the book, and if you're going to put lock, stock, and barrel in that book, just get prepared to disappear. [01:06:13.220 --> 01:06:24.220] Well, I don't know, okay, I don't know if this is true or not, but I've heard that the IRS, I want to make sure the audience is clear, I don't know if this is true, check it for yourself, [01:06:24.220 --> 01:06:35.220] that the IRS will send out a certain percentage of essentially completely bogus bills to... [01:06:35.220 --> 01:06:39.220] Well, they're all bogus unless they're sent to a corporation for taxes. [01:06:39.220 --> 01:06:51.220] Right. Okay. But yeah, just the way that the, whether it's the IRS or corporations or some place, like I said, out of the blue, coming out of nowhere, you get billed and you're like, what's this? [01:06:51.220 --> 01:07:05.220] I never signed up for this, I never did this, but then you are, you know, you're taken to task on having to, like you said, you're going to have to go through the forms, written documents to prove... [01:07:05.220 --> 01:07:18.220] No, no, no, no, wait a minute, you're misconstruing what I said here. You don't ever get into arguing the merits of something that's completely wrong, okay? [01:07:18.220 --> 01:07:26.220] Because once you start arguing the merits, you're acquiescing to some amount of application and truth. [01:07:26.220 --> 01:07:27.220] Right. [01:07:27.220 --> 01:07:53.220] Okay, the exact same thing happens in the realm of transportation. The moment you start arguing, I can't possibly be speeding, or I wasn't going that fast, or I don't owe that much money to the IRS, now you're arguing the merits that only a taxpayer has any standing to argue, or a transportation person has any standing to argue. [01:07:53.220 --> 01:08:12.220] Okay, so in other words, with this bank scam thing that they're trying to do, that would be like, again, arguing, I never signed a signature card for a safety deposit box. That would be arguing an merit. [01:08:12.220 --> 01:08:24.220] Yeah, what you want to know is, can you prove beyond a shadow of a doubt that you have my true and correct signature on any document related to the alleged debt? [01:08:24.220 --> 01:08:31.220] Okay, okay. Well, they shouldn't be able to because, again, if they have... [01:08:31.220 --> 01:08:43.220] Well, now careful with that. If you've never had it, then there's no such thing as shouldn't be able to. [01:08:43.220 --> 01:08:49.220] See, again, you're stepping into the realm of possibility by using the term shouldn't. Well, I was going to bring up again, and then I realized that would be merits again, the fact that there's no video recording of me accessing a box, because you have to sign in. [01:09:09.220 --> 01:09:23.220] You simply want to know, where is your factual evidence that the signature you claim to be in possession of is mine and was put there by me? [01:09:23.220 --> 01:09:33.220] It's up to them to produce whatever factual evidence, whatever form it is, not for you to say and dispute what the evidence is before you even know if it exists. You don't think flicking on those lights and declaring that emergency in order to get you to do something they want you to do doesn't require any authority? [01:20:50.220 --> 01:21:07.220] I can't even remember the last time I've had to go to court for a traffic ticket or even pay one for that matter. Every time that I've done what I've done either at the stop or afterwards with the magistrate, the case has just sort of disappeared. [01:21:07.220 --> 01:21:20.220] The only one that didn't was the one here in Austin and it is still sitting in the county court at law over a year now despite our prompting that they only had 60 days to rule on it. [01:21:20.220 --> 01:21:39.220] They're still sitting on it and the only reason that I can come up with that that can possibly be is that this is a ruling they don't want to make and document because if they do, the city of Austin is in deep doo-doo. [01:21:39.220 --> 01:22:01.220] Didn't you do a mandamus on that too? We have not filed a mandamus yet. We're working on doing so, but again, my guess is what they're attempting to do is to sit on any ruling of any kind to attempt to run out the statute of limitations on my ability to sue. [01:22:01.220 --> 01:22:05.220] That's what we're proposing they're doing. [01:22:05.220 --> 01:22:16.220] I'm going to go ahead and get off. If you have any callers, can you just do a review of the pretrial motions that you file in traffic cases? [01:22:16.220 --> 01:22:32.220] Sure. The motions that are part of the seminar material that get filed in these cases right off the bat, there is a special appearance motion that documents the complete and total lack of notice in a timely manner in accordance with law and the rights of the accused. [01:22:32.220 --> 01:22:39.220] There's a declination to plea. There's a waiver of counsel and there's an affidavit of not in transportation or commerce. [01:22:39.220 --> 01:22:50.220] Those are the primary filings at the beginning. After that, it all depends on what happens during any appearances and other proceedings. [01:22:50.220 --> 01:23:02.220] So if the judge enters a plea for you regardless of that and sets a court date... [01:23:02.220 --> 01:23:15.220] If the judge enters a plea without respecting all of your other due process rights, one of the things you will file immediately is a judicial conduct complaint and then a motion to disqualify or recuse. [01:23:15.220 --> 01:23:23.220] And then do you also file a motion for a jury trial? [01:23:23.220 --> 01:23:29.220] No. Our whole thing here is the court never had jurisdiction in the first place. [01:23:29.220 --> 01:23:41.220] Right. I understand that, but you've also said in the past that you always go for a jury trial. I'm just wondering at what point do you... [01:23:41.220 --> 01:23:51.220] As long as you're doing everything in writing and you're reserving your rights and you're saying that this is by no means a waiver of consent to these proceedings, [01:23:51.220 --> 01:24:03.220] but an attempt to protect my rights at all instances, in which case I invoke the right to a jury trial in these illegal proceedings, and so on and so forth. [01:24:37.220 --> 01:24:41.220] Well, explain what you mean by pushing down your throat. [01:24:41.220 --> 01:24:51.220] They're trying to force people into these homeowners' associations. The developers are building them, building homes with these associations attached to them. [01:24:51.220 --> 01:24:58.220] And you're forced to, pretty much you're forced to buy into an HOA if you want a decent new house. [01:24:58.220 --> 01:25:06.220] And some of these rules are ruthless and they take people's property away from them for just the most piddly little things. [01:25:06.220 --> 01:25:11.220] And they also find them tremendous amounts of time, so they just eat up your equity. [01:25:11.220 --> 01:25:18.220] Okay. Well, let me ask you a question, and I know you're not going to like these questions, but I can already tell you where this conversation is going to go. [01:25:18.220 --> 01:25:23.220] So let me ask you a couple of things and you tell me what you believe to be or not be. [01:25:23.220 --> 01:25:24.220] Okay. [01:26:21.220 --> 01:26:26.220] See, you're talking about in order to buy a new house, you had to go into an HOA. No, you didn't. [01:26:26.220 --> 01:26:32.220] If you could get a loan to buy a new house, why couldn't you get a loan to buy land and build a house? [01:26:32.220 --> 01:26:34.220] Then there is no HOA. [01:26:34.220 --> 01:26:36.220] That's true. [01:26:36.220 --> 01:26:42.220] Well, you see, the house that I bought, it's an old house and on an old neighborhood. [01:26:46.220 --> 01:26:54.220] And see, when I bought my house in Aurora, Colorado several years ago, back in 1995, I told my friend, who was also my real estate broker, I said, [01:26:54.220 --> 01:27:07.220] look, you find me a place that has no active HOAs. I will not look at any property where an HOA exists or where an HOA is on the table as coming into existence in order to buy the property. [01:27:07.220 --> 01:27:12.220] If you can't meet those needs, then I'm not buying. [01:27:12.220 --> 01:27:20.220] Well, what about some people, like in Houston, I know that they can force an HOA and put one in it, you know, years after you bought the house. [01:27:20.220 --> 01:27:22.220] No, they can't. [01:27:22.220 --> 01:27:23.220] I thought they could. [01:27:23.220 --> 01:27:24.220] No. [01:27:24.220 --> 01:27:30.220] How can they force you to be party to a contract you don't accept? [01:27:30.220 --> 01:27:41.220] Because the HOA's authority comes strictly from the contract you made with them when you bought the property or signed it after the fact. [01:27:41.220 --> 01:27:55.220] You know, that makes sense. So, therefore, just don't buy them and hopefully these developers will have enough people that won't buy into HOAs if they start to go bankrupt and the HOA's are going to go away. [01:27:55.220 --> 01:27:59.220] Well, right. I mean, let's look at what the purpose of an HOA is. [01:27:59.220 --> 01:28:15.220] The purpose of an HOA is to maintain a certain level of exclusivity, okay, and on top of that, to maintain a certain level of value for the properties inside of their domain. [01:28:15.220 --> 01:28:16.220] Yeah. [01:28:16.220 --> 01:28:17.220] Okay. [01:28:17.220 --> 01:28:26.220] As fascist and unrealistic as that may be, that's the purpose. [01:28:26.220 --> 01:28:33.220] Everybody's concerned about how much they spent for their house, so they want to be concerned about how much they can sell it for later. [01:28:33.220 --> 01:28:51.220] Everybody, of course, wants their property value to go up, but what they don't understand is, is if there was any real money in existence, real currency of real value, the property value would stay the same all the time and the HOA would be completely worthless. [01:28:51.220 --> 01:29:02.220] Other than forcing people to keep their property in a certain state and condition. [01:29:02.220 --> 01:29:11.220] Yeah, but the value of property is not very good right now. The value of currency is very shaky right now. [01:29:11.220 --> 01:29:12.220] Absolutely. [01:29:12.220 --> 01:29:14.220] It's going to get much, much, much shakier. [01:29:14.220 --> 01:29:22.220] Yeah, the only time the property values would start to change is when we finally run out of property to sell, because that's one thing they're not making any more of. [01:36:51.220 --> 01:37:12.220] Okay, so let me ask you again, if you are not going to fight the fight the way it needs to be done and can't afford to do so, so that you don't have to pay in order to get the courts to rule in your favor, then why are you fighting at the stop in the first place? [01:37:12.220 --> 01:37:20.220] Because this is not supposed to be about the money, this is supposed to be about protecting your rights. [01:37:20.220 --> 01:37:30.220] And unless you're going to go to court and protect your rights rather than argue the merits, then why are you starting that fight? That just means having enough property that they could satisfy the fine or fees if it came to that because you didn't show. [01:40:28.220 --> 01:40:32.220] I'm asking for an emergency hearing to have it re-heard. [01:40:32.220 --> 01:40:42.220] My question is, what's the time limit of when you're already set for, to have it heard and I'm in appeals court. [01:40:42.220 --> 01:40:48.220] What is the time limit to have this stuff done? Because it's been since back this last month. As I understand it, a subject matter jurisdiction can be challenged at any time. [01:52:47.220 --> 01:53:00.220] And I'm thinking that if you were convicted of some traffic offense when there was no commerce involved, [01:53:00.220 --> 01:53:09.220] no commercial activity, that you might be able to challenge subject matter jurisdiction. [01:53:09.220 --> 01:53:11.220] Wait, say that one more time. [01:53:11.220 --> 01:53:22.220] Well, I'm thinking that if you were convicted in a traffic court of some non-commercial activity [01:53:22.220 --> 01:53:35.220] and you didn't defend yourself properly there, you could go back and challenge subject matter jurisdiction by claiming it was a void judgment. [01:53:35.220 --> 01:53:40.220] Well, that all depends on what you mean by didn't properly defend yourself there. [01:53:40.220 --> 01:53:41.220] Yeah. [01:53:41.220 --> 01:53:55.220] Remember that most of these cases, the losses occur because you stepped into the realm of the rules and regulations themselves, thus making them applicable by your participation and your acceptance. [01:53:55.220 --> 01:53:56.220] Right. [01:53:56.220 --> 01:54:07.220] Most of these cases in every state of the union, so to speak, they only have to make a prima facie case. [01:54:07.220 --> 01:54:13.220] They don't have to do preponderance of the evidence. They don't have to do beyond a reasonable doubt, though they tell you they do. [01:54:13.220 --> 01:54:15.220] They don't. [01:54:15.220 --> 01:54:22.220] All they have to do is make a prima facie case that you were doing what they accused you of. [01:54:22.220 --> 01:54:28.220] And you do that simply by not rebutting their assertion that you were. [01:54:28.220 --> 01:54:33.220] And that's where the use of the seven deadly sins comes in. [01:54:33.220 --> 01:54:34.220] OK. [01:54:34.220 --> 01:54:47.220] If you don't object to the application of the seven deadly sins, then you are agreeing that they are somehow applicable to you and your activities, which are at issue. [01:54:47.220 --> 01:54:52.220] That's all they need for a prima facie case. [01:54:52.220 --> 01:55:12.220] So challenging the jurisdiction of the court after the fact won't get you anywhere because the appeals court that looks at it says, no, they did have jurisdiction because you accepted the application of the terms and therefore made the case for them. [01:55:12.220 --> 01:55:14.220] OK. [01:55:14.220 --> 01:55:36.220] Well, all right. I just kind of figured that if you could challenge subject matter jurisdiction at any time, that you could go back whether you had fallen into it or not and blow it away. [01:55:36.220 --> 01:55:40.220] Well, in normal cases, that would be true. [01:55:40.220 --> 01:55:44.220] But again, these are not treated like normal cases. [01:55:44.220 --> 01:55:47.220] They never are treated like normal cases. [01:55:47.220 --> 01:55:48.220] Right. [01:55:48.220 --> 01:55:55.220] These, in fact, are so far outside the proper application of due process and rights, it's not even funny. [01:55:55.220 --> 01:55:56.220] Yeah. [01:55:56.220 --> 01:56:13.220] But the point here is, is since they're administrative in nature, no matter what they tell you, these are administrative and in administrative hearings, you don't get to challenge jurisdiction if you've accepted jurisdiction because it is completely by agreement. [01:56:13.220 --> 01:56:17.220] You're bound at all. [01:56:17.220 --> 01:56:28.220] So you don't get to challenge subject matter in the same way you would in a real criminal case or in a real civil case. [01:56:28.220 --> 01:56:30.220] It's an illusion. [01:56:30.220 --> 01:56:32.220] Yeah. [01:56:32.220 --> 01:56:40.220] Well, government in general is an illusion that I'll absolutely agree with you on. [01:56:40.220 --> 01:56:45.220] Yeah, it is a dysfunctional perception of reality. [01:58:02.220 --> 01:58:08.220] But as far as proving whether or not the facts are as described by the alleged witness, [01:58:08.220 --> 01:58:18.220] all you have to do is be able to introduce evidence that proves the witness's testimony is either wrong or false.
