[22:19.460 --> 22:20.460] There doesn't. [22:20.460 --> 22:27.460] But the new regulations through the executive order that they're asking for is to close the supposed gun show loophole. [22:27.460 --> 22:34.460] There's no such thing as a gun show loophole because everybody that has a table at a gun show typically is an FFL. [22:34.460 --> 22:37.460] If they're selling guns, they're more than likely an FFL. [22:37.460 --> 22:41.460] The point is they're trying to get the registration. [22:41.460 --> 22:45.460] They want to know where that weapon is, and there's no reason for that. [22:45.460 --> 22:52.460] Now, when you sell a private or when you sell a firearm and you do the next check, [22:52.460 --> 22:55.460] you fill out the, what's it, the form 4403? [22:55.460 --> 22:57.460] Is that what it is? [22:57.460 --> 22:58.460] 4473. [22:58.460 --> 22:59.460] Yes. [22:59.460 --> 23:00.460] 4473, yeah. [23:00.460 --> 23:02.460] Okay, when you fill that out. [23:02.460 --> 23:11.460] Now, you keep a copy of that for your records, and does the ATF actually come in and pick up copies of that? [23:11.460 --> 23:12.460] No. [23:12.460 --> 23:15.460] I hold that record for 20 years. [23:15.460 --> 23:21.460] The only thing that they have is they have that transfer number that usually gets put on after the guest leaves. [23:21.460 --> 23:25.460] I write the number that I've been given from Nix. [23:25.460 --> 23:28.460] And Nix isn't supposed to maintain those records longer than 30 days. [23:28.460 --> 23:30.460] That's federal law. [23:30.460 --> 23:36.460] But they certainly know who has sold that weapon because I've had to do traces before. [23:36.460 --> 23:38.460] Okay, so there it is. [23:38.460 --> 23:48.460] But you have not had the bureau come in there and actually grab your paperwork that you filled out and you keep on record for 20 years. [23:48.460 --> 23:55.460] They haven't been to you yet to grab that paperwork to see who you've sold the weapons to yet. [23:55.460 --> 24:00.460] Well, so they're not allowed to have my book. They have to come with a specific request. [24:00.460 --> 24:07.460] So they would say I have, for example, a Glock serial number, blah, blah, blah, sold on this date. [24:07.460 --> 24:16.460] And I go to my records, I dig it up based on that serial number, and then I have 24 hours to fax that information to the ATF. [24:16.460 --> 24:17.460] Okay. [24:17.460 --> 24:19.460] So that's what it is currently under law. [24:19.460 --> 24:33.460] Now, have you, I mean, well, I guess they're not, because it sounds like what's happening across the country is they're actually going in threatening gun dealers now and saying, [24:33.460 --> 24:41.460] you're going to do this, you're going to do that, or we're going to crack down on you and make it impossible for you to do business as an SSL dealer. [24:41.460 --> 24:46.460] Have you heard of that happening or is that a possibility happening to you? [24:46.460 --> 24:53.460] That was the whole thing with the Fast and Furious in Arizona. [24:53.460 --> 25:01.460] They came up there and said, look, you're going to make these sales. You're going to need to buy these specific weapons and have these in stock. [25:01.460 --> 25:10.460] And then when we do the background checks, the background check is going to come through as proceed instead of a delay or a denied, even if that person is a felon. [25:10.460 --> 25:19.460] And, you know, that was the big deal there. They went through and tried to shut down two of those places, and they were trying to blame them for it. [25:19.460 --> 25:34.460] So I didn't stop it was that one of the owners there had an actual recording of the conversation with the ATF officer. [25:34.460 --> 25:46.460] Right. Yeah, I remember that being in the news. And of course, nothing's happening to the criminals who've done that so far, which is our tyrant in the White House. [25:46.460 --> 25:53.460] So I want to switch directions here a little bit first. [25:53.460 --> 26:08.460] When you do these background checks and if you get a denial, is the assumption always that the person is a felon and the person cannot buy a gun because they're a felon? [26:08.460 --> 26:22.460] Well, in the shop, it's supposed to stop everything. And what I'm supposed to do is hand them a brochure that's been published by the ATF, and I handwrite the reference number from the NICS background check. [26:22.460 --> 26:29.460] And then they have to contact NICS and go, what was this about? What do I need to do to fix it? What's going on? [26:29.460 --> 26:38.460] Because a lot of times, if you don't put your social security number on there, which is actually an optional feature, then they could get you confused with somebody else. [26:38.460 --> 26:42.460] For example, my name. My name is this extremely simple Chris Hall. [26:42.460 --> 26:54.460] I've been denied several times. And it's funny because now that I have my FFL, I don't even have to do paperwork. But at the time, oh, it was, you know, I would have a three-day wait almost every time. [26:54.460 --> 27:03.460] Now, does the concealed carry holder, the CHL license concealed carry holder, do they have to do the background check? [27:03.460 --> 27:12.460] It depends on your state. Here in Texas, no. We still do the paperwork based on a transfer that has the serial number and blah, blah, blah. [27:12.460 --> 27:18.460] And I just take a copy of your concealed carry license and put it in the file. [27:18.460 --> 27:29.460] Okay. So, okay, now you live in Corpus Christi, so you're close to the border, very close. So I would imagine a lot of customers are Hispanic. [27:29.460 --> 27:43.460] So you have, because this was a question last week about whether you had to be a U.S. citizen to actually purchase a gun, quote, legally in this country. [27:43.460 --> 27:54.460] Now, what process is done if somebody walks in and they just say, and they declare on their paperwork, I'm a U.S. citizen, and maybe they're not really a U.S. citizen, [27:54.460 --> 28:00.460] what checks are in place to ensure that that person is actually a U.S. citizen? [28:00.460 --> 28:10.460] Well, it starts off with the identification that I get. And then, as a matter of fact, I've done several sales that had a TWIC card, a passport, [28:10.460 --> 28:17.460] and they were originally born in another country. And when they went to the ATF, it was the full delay. [28:17.460 --> 28:29.460] It took the entire 72 hours. And, you know, after 72 hours, I'm allowed to do a transfer, whether I get a deny or a proceed after the time. [28:29.460 --> 28:37.460] That's one of the advantages of the law. Now, you go to one of the larger retailers, they won't, if they get a delay, sales over. [28:37.460 --> 28:45.460] They're not even going to mess with you because they can go and sell that weapon 10 times over in that 72-hour period. [28:45.460 --> 28:57.460] Oh, so basically, the law is set up so that if there's a denial or a 72-hour hold after 72 hours, whether it's denied or proceed, [28:57.460 --> 29:06.460] the dealer can actually sell the weapon. And if it comes back later, denied, what happens after that? [29:06.460 --> 29:18.460] It's never happened, so I don't know. I have gotten a proceed nearly a week later, but the thing that I've noticed is they'll give you a countdown. [29:18.460 --> 29:25.460] You go to your NIC site, you've got a running list of your checks that you've done, and they keep a date on there. [29:25.460 --> 29:36.460] So it's 72 hours of business days. So if they're like going Christmas when we had all the holidays, and those things were an absolutely spotless clean record, [29:36.460 --> 29:42.460] if I got a delay, it was five, six days before those three business days had gone by. You could just wait it out. [33:23.460 --> 33:30.460] If you know for sure that you don't have any issues, you've never been arrested, you don't have any C in Texas, [33:30.460 --> 33:38.460] you can be denied if you have a misdemeanor domestic violence or domestic disturbance conviction, even a misdemeanor. [33:38.460 --> 33:41.460] If it's domestic disturbance, you're out. [33:41.460 --> 33:48.460] And if it's felon, you're out until after you've served your time, as Larry was talking about, these sorts of things. [33:48.460 --> 33:57.460] That's a state law, though, at any rate. If you get the delay, one option for people is just, if you don't want to give them your Social Security number, [33:57.460 --> 34:05.460] just wait a few days, unless you need the gun right now because you're going out of town on a sporting event or something. [34:05.460 --> 34:07.460] You don't have to give the Social Security number. [34:07.460 --> 34:14.460] But, Chris, say somebody just really needs the gun right now because they're on the way. They've got a skeet chute coming up. [34:14.460 --> 34:21.460] They have to leave town. They've got an important competition the next day or over the weekend, and they really need the gun. [34:21.460 --> 34:26.460] At that point, can they give you their Social Security number? [34:26.460 --> 34:33.460] You're saying that they have to contact the NICS people themselves and give them the Social Security number to try to work it out. [34:33.460 --> 34:39.460] And if they can work it out with them, then you wouldn't have to wait the full three days. Is that the way it works? [34:39.460 --> 34:47.460] Yes. As long as their business hour is open, if you can fix whatever it is, say you've got an adjudicated felony on your record. [34:47.460 --> 34:53.460] And what happens is the NICS operator is looking through there and sees that, you know, you've got this felony. [34:53.460 --> 34:59.460] They don't even bother reading to the end of it to see that it was adjudicated. They just go, oh, felony done, and you're done. [34:59.460 --> 35:04.460] But if you contact them and go, wait a minute, that was dismissed. I never did any time. [35:04.460 --> 35:13.460] You know, I had some probation. It was done. It was thrown out. Then, yeah, they can give me a phone call or they shoot me an email that says, oh, no, we made a mistake. [35:13.460 --> 35:20.460] It's OK. Then I can call that client up and say, yeah, here we go. We can do this transfer. [35:20.460 --> 35:25.460] The main problem is that you're waiting for business hours on that kind of stuff. [35:25.460 --> 35:31.460] Because if you have to correct it, if you really have to go through the steps to fix it, you have to send in fingerprints. [35:31.460 --> 35:35.460] You have to send in picture IDs. You have to go down to the police department. [35:35.460 --> 35:41.460] And if you've got a felony and you come to try to buy a gun and it's a really a felony, I'm supposed to call the police. [35:41.460 --> 35:47.460] Now, that's just for a denial. That's not for a delay. If it comes back that says delay. [35:47.460 --> 35:48.460] Right. [35:48.460 --> 36:00.460] OK, but if it comes back the first time around and it says delay, then the person or the potential customer could either try to fix it within the three days [36:00.460 --> 36:09.460] or they could just wait it out. And if there's no denial from the ATF within the three days, then they're good to go. [36:09.460 --> 36:10.460] They can purchase the fire. [36:10.460 --> 36:11.460] Yes. [36:11.460 --> 36:17.460] And you were saying on the break that a lot of these, actually you said on the air too, a lot of these major, you know, [36:17.460 --> 36:22.460] maybe large-scale gun dealers, if there's a delay, the transaction's over. [36:22.460 --> 36:25.460] They don't want to deal with it. They're not going to wait three days because they can just sell the gun. [36:25.460 --> 36:36.460] But this is something that is an advantage to dealing with a smaller business like yourself. You'll wait for them. [36:36.460 --> 36:45.460] Yeah. Yeah, especially if it's an order. Because handguns are shipped in two days, if that's at my vendor or my wholesaler and I order it, [36:45.460 --> 36:53.460] I can have it in hand in 72 hours. So it just depends on what you're trying to accomplish. [36:53.460 --> 37:02.460] And like you were saying about a competition shooter or something that has a weapon that they need to get a weapon for a competition or something, [37:02.460 --> 37:10.460] there's actually places that can rent a weapon to someone. You know, you have to do the same type of a transfer, [37:10.460 --> 37:14.460] but it can be rented and then whoever uses it can use it. [37:14.460 --> 37:17.460] Okay. Let me ask you something else here. [37:17.460 --> 37:26.460] Concerning this background check, and correct me if I'm wrong here, but I've always considered that that's kind of a misnomer. [37:26.460 --> 37:30.460] People are like, oh, no, I don't want to do a background check. I'm not going to buy from an FFL. [37:30.460 --> 37:35.460] You know, I'm going to do private sale because I'm not going to go through a background check. [37:35.460 --> 37:40.460] And I think this is being confirmed to me. The way I understand this, this is not really a background check. [37:40.460 --> 37:49.460] It's just the next system is that all you have to do is give your name and address and really all they're checking is your name, [37:49.460 --> 37:55.460] just to see if your name is in a list. And if it's not, you're good to go. [37:55.460 --> 38:02.460] It's not really a background check as far as like pulling up your history or something. Is that correct? [38:02.460 --> 38:06.460] No, it's quite a bit more than that. [38:06.460 --> 38:10.460] The problem is if you don't use your social security number, you... [38:10.460 --> 38:12.460] Whoa, what was that? [38:12.460 --> 38:14.460] I was going to go ahead. [38:14.460 --> 38:24.460] If you get the wrong recognition of your name, you can get some really bad complications there because, you know, for example, [38:24.460 --> 38:32.460] say it's a violent drug offense and you have it denied based on a confusion of your name, [38:32.460 --> 38:37.460] there will be police meeting you at the store. They will... I'm supposed to come and say, [38:37.460 --> 38:43.460] oh, hey, it's no problem. We're just waiting on it and keep you entertained until the police arrive to take you on the, [38:43.460 --> 38:49.460] no, take your trip downtown. So you don't want to get the confusion too bad. [38:49.460 --> 38:56.460] But what I'm saying is that they're not really running a background check on you specifically. [38:56.460 --> 39:07.460] I mean, especially if you don't give your social security number, there's no way they can run a background check on you specifically. [39:07.460 --> 39:13.460] You have to give your driver's license number or your state ID. You have to give that. [39:13.460 --> 39:21.460] Yeah, I have to take a copy of that. They also have to have your birthplace, your date of birth, your physical description, [39:21.460 --> 39:30.460] your life with, you know, car and stuff like that. Instead of a driver's license, I should be able to use my state ID. [39:30.460 --> 39:34.460] Correct. Good. [39:34.460 --> 39:39.460] Yeah, there's no problem. And you were asking about getting an FFL because that's another thing. [39:39.460 --> 39:46.460] I got my FFL because I can buy weapons a lot cheaper with my FFL through wholesalers and stuff like that. [39:46.460 --> 39:52.460] And it's not a whole lot more complicated than just purchasing a weapon. [39:52.460 --> 39:59.460] The main problem is that it takes about three months to go through the ATF and the FBI to do the background check, [39:59.460 --> 40:05.460] where they're really wanting to know what states you've been in, where you've lived in the last seven years. [40:05.460 --> 40:09.460] If there's, you know, there's possible aliases under your name. [40:09.460 --> 40:14.460] I mean, it gets a little more detailed, but it's not, if you can own a gun, you can have an FFL. [40:14.460 --> 40:19.460] Well, well, Chris, you said that they only want to know where you lived in the last seven years. [40:19.460 --> 40:21.460] Yes. [40:21.460 --> 40:26.460] Only in the last seven years? I mean, why is it only the last seven years? [40:26.460 --> 40:34.460] I mean, if you're going to become a federal firearms license dealer, why wouldn't it be where you've lived ever? [40:34.460 --> 40:41.460] Because typically if you've caught a felony charge, it's going to be tied to your identification. [40:41.460 --> 40:47.460] If you're just caught misdemeanor charges, they're more tied. [40:47.460 --> 40:50.460] They are tied to it, but it's not that important. [40:50.460 --> 40:58.460] It's actually easier to get a federal firearms license than it is to get the state-concealed handgun license. [40:58.460 --> 41:05.460] The state-concealed handgun license wants to know every arrest you've ever had in your life. [41:05.460 --> 41:14.460] So if you're a federal firearms license dealer, can you carry concealed without the license, without the CHL? [41:14.460 --> 41:15.460] No. [41:15.460 --> 41:17.460] No, you can't. Okay. [41:17.460 --> 41:21.460] No, but there is a law in Texas that most people don't know about. [41:21.460 --> 41:27.460] It's the 1986 Motorist Protection Act, and that allows you to carry a locked and loaded firearm in your car, [41:27.460 --> 41:30.460] and it just has to be concealed in your vehicle. [41:30.460 --> 41:35.460] Now, I wouldn't put it in the console or the glove box because police react badly when they see a gun fall out [41:35.460 --> 41:39.460] when you're trying to hand them your insurance information. [41:39.460 --> 41:46.460] But you are legally allowed to do it as long as you're not committing a crime over a misdemeanor, which is a traffic violation. [41:46.460 --> 41:48.460] Okay. Let me ask you one other question. [41:48.460 --> 41:50.460] I want to back up for a second on the felony. [41:50.460 --> 41:55.460] When you're talking about a person coming in, if they try to purchase a gun and they have a felony, [41:55.460 --> 42:00.460] you're supposed to basically delay them until the cops get there. [42:00.460 --> 42:12.460] Now, Obama was claiming that 3 million people have been, they have prevented 3 million people who shouldn't have had a gun from getting a gun [42:12.460 --> 42:17.460] since the NICS check system has been implemented. [42:17.460 --> 42:19.460] 20 years. [42:19.460 --> 42:20.460] Pardon me? [42:20.460 --> 42:22.460] That's over 20 years. [42:22.460 --> 42:30.460] 3 million people in over 20 years, and we sold 2.7 million background checks just in December alone. [42:30.460 --> 42:36.460] Okay, but if they did not 3 million, now, just because there was a denial, [42:36.460 --> 42:40.460] do they count that denial as, oh, we stopped somebody? [42:40.460 --> 42:41.460] Yes. [42:41.460 --> 42:46.460] Or do they go back and check to find out if there was a, like, your name, Chris Hall, [42:46.460 --> 42:50.460] or if somebody's name is John Smith or their last name is Washington. [42:50.460 --> 42:58.460] These common names, there could be lots of people with that name and the person could clear it up over the next month or so. [42:58.460 --> 43:03.460] Does that go, do they account that back into their records of people that they've denied? [43:03.460 --> 43:09.460] How many times do actual felons go in and legally try to buy a gun? [43:09.460 --> 43:13.460] If I had a guess, I would probably say almost never. [43:13.460 --> 43:20.460] I've talked to several people and they say, well, you know, I might have a warrant, I don't want to take that chance. [43:20.460 --> 43:23.460] So they just, you know, they won't even buy a gun based on that. [43:23.460 --> 43:27.460] I've been arrested for a traffic violation trying to purchase a weapon before. [43:27.460 --> 43:32.460] So, I mean, it happens, it just depends on the county you're in. [43:32.460 --> 43:34.460] All right, well, listen, we're heading to break. [44:33.460 --> 44:39.460] The ATF initially denied these claims, and now variously claim that one of their agents was in a free-falling elevator [44:39.460 --> 44:45.460] which has been disproven, or that they had been in an all night stick out, or that they had been in a golf tournament. [44:45.460 --> 44:50.460] As they try to sort out their lies, all we want to know is, did the ATF receive a warning, [44:50.460 --> 44:54.460] and if so, why did they not pass it on to others in the mortals? I mean, it's ridiculous. Who would? Who would try? [48:04.460 --> 48:09.460] Who would try knowing that they are going to get arrested? I mean, it's ridiculous. [48:09.460 --> 48:14.460] Anybody that, anytime that happens, it's almost always going to be a case of mistaken identity, [48:14.460 --> 48:19.460] which goes back to what I was saying before. I just want to clarify, [48:19.460 --> 48:24.460] we talked with Chris over the break about this, so that we make sure we're all in the same page here. [48:24.460 --> 48:31.460] Really, it really is not a quote-unquote background check in the true sense of the word, [48:31.460 --> 48:38.460] which is you give somebody your personal information, including your social security number, et cetera, et cetera, [48:38.460 --> 48:45.460] and then they go into a system where they can pull up all the information on you, [48:45.460 --> 48:50.460] like the cops can, like a rap sheet. That's not what this is. [48:50.460 --> 48:55.460] It's not a real quote-unquote background check in that sense of the word. [48:55.460 --> 49:04.460] Some jobs, some employers require a quote background check, a real one, [49:04.460 --> 49:09.460] where you give them all this personal information on you, and then they have access through [49:09.460 --> 49:13.460] private detective systems or law enforcement systems, et cetera, [49:13.460 --> 49:18.460] because they deal with sensitive data or whatever, or maybe in security or something like that. [49:18.460 --> 49:24.460] They look up your rap sheet. They see your personal history. That's not what's going on here. [49:24.460 --> 49:30.460] What this is is that you are giving a certain set of information to an FFL dealer, [49:30.460 --> 49:40.460] and then they enter that into the NICS system, and the purpose is to see if that information matches what is in the NICS database. [49:40.460 --> 49:46.460] It's like mix and match. Does it match? Yes or no? That's what it is. [49:46.460 --> 49:52.460] If there is a match for whatever reason, because it's a common name and you didn't give yourself security number, [49:52.460 --> 49:59.460] if it's a delay, then as Chris was saying, the routine is you can either wait, wait it out. [49:59.460 --> 50:04.460] If you know for sure that you don't have any problems, it's just my name matches somebody else's name. [50:04.460 --> 50:12.460] No big deal. Just wait it out. If it's a denial, then if it's a delay, you could also try to fix it through the NICS. [50:12.460 --> 50:18.460] You could call up the NICS people and try to fix it. If it's a denial, then you have to go through the FBI to fix it, [50:18.460 --> 50:26.460] which I can see how that would be extraordinary, but again, it's not a background check in the sense that I was mentioning it. [50:26.460 --> 50:33.460] Personally, I really don't think that people have that much to fear, but obviously all this stuff is being database, [50:33.460 --> 50:38.460] and so that's not a good thing either, but I just wanted to clarify that. [50:38.460 --> 50:41.460] Now, Larry, you had something you were about to ask Chris. [50:41.460 --> 50:52.460] Yeah, I want to bring up one thing, but before I do that, I want to bring up the fact that how accurate is this database that the NICS systems is keeping, [50:52.460 --> 51:03.460] because if we're looking at the no fly list that are being built out there by the TSA, there are little kids, [51:03.460 --> 51:09.460] little seven-year-old, five-year-old little boys and little girls put on no fly list. [51:09.460 --> 51:18.460] Now, if we go by what Rahm Emanuel said a few months back, he said, if you're on that no fly list, you're not going to be allowed to own a gun. [51:18.460 --> 51:28.460] So these little boys and little girls that have been put on this no fly list, and nobody knows how to get the list of who's on that no fly list, [51:28.460 --> 51:32.460] and nobody knows how to get off of that no fly list. [51:32.460 --> 51:38.460] So if these little boys and little girls are being put on these no fly list, they have no way to know how to get off of it. [51:38.460 --> 51:46.460] If they add that no fly list to the NICS system in the future, this is what I was talking about last week. [51:46.460 --> 51:56.460] The goal is, if they can't disarm the American people through confiscation of the weapons forcefully, they're going to do it through a rule of law, [51:56.460 --> 52:07.460] basically through code, and they're going to use statutes and saying that this person can't own a gun, this person can't own a gun, [52:07.460 --> 52:10.460] and this goes all the way down to a parking ticket. [52:10.460 --> 52:17.460] You're not going to be able to own a gun because you've ever done anything, and everybody's done something. [52:17.460 --> 52:22.460] Some states have a much more serious background check. [52:22.460 --> 52:32.460] For example, New York, if you have any sort of thing going on, they will definitely come and harass you over you trying to purchase a weapon, [52:32.460 --> 52:37.460] but you have to have a permit and you have to have a void card in Chicago and stuff like that. [52:37.460 --> 52:41.460] Those are basically the same thing as a concealing carry license here in Texas. [52:41.460 --> 52:46.460] That concealing carry license, they go through a serious background check. [52:46.460 --> 52:52.460] And those people that have concealed carries, they are in a database. [52:52.460 --> 53:02.460] When a police officer pulls them over immediately, that police officer knows that that person has a concealed carry license, correct? [53:02.460 --> 53:03.460] Correct. [53:03.460 --> 53:09.460] And he will ask you, that will be the first question while his partner on the other side is covering you. [53:09.460 --> 53:16.460] You want to turn your lights on, you want to have your hands on the side of the window or on the steering wheel where they can see it, [53:16.460 --> 53:20.460] because you do not want any accidents under those kinds of circumstances. [53:20.460 --> 53:25.460] Now, see how they're treating those people who have jumped through all the hoops, [53:25.460 --> 53:35.460] have did everything that the government required, they gave their entire life history and proved that they're this upstanding citizen. [53:35.460 --> 53:45.460] And still, the police treat them like common criminals when they get pulled over because they have a gun in their car and they know they're a concealed carry holder. [53:45.460 --> 53:46.460] And that's wrong. [53:46.460 --> 53:55.460] That's wrong, I mean. [53:55.460 --> 54:02.460] You have a nice conversation with them, but there are some areas where you really don't want to be dealing with that particular officer. [54:02.460 --> 54:05.460] It's just wrong. [54:05.460 --> 54:10.460] The person has already done everything to prove that they're this, quote, good person. [54:10.460 --> 54:20.460] And the police are still, and I'm not on down on all police, but I'm telling you, the police are out there still down on people who are carrying these weapons, [54:20.460 --> 54:27.460] quote, lawfully, according to what the government says you have to do to be a lawful carrier of a weapon. [54:28.460 --> 54:44.460] I've been pulled over like going to a gun show or something like that where I had multiple firearms, but I would like to see the reaction when they look in the backseat of my car and I've got 15 AR-15s and 30 handguns just to see the particular reaction I got. [54:44.460 --> 54:46.460] But yeah, I know exactly what you're talking about. [54:46.460 --> 54:48.460] It's just not right. [54:48.460 --> 54:52.460] But anyway, what I wanted to move on and ask about. [54:52.460 --> 54:53.460] Hold on one second. [55:20.460 --> 55:26.460] And of course, I think, oh, that's got to be a class three dealer, so I began to talk to him. [55:26.460 --> 55:28.460] He said, no, I'm not a class three dealer. [55:28.460 --> 55:32.460] I bought all these under my corporate name, under my corporation. [55:32.460 --> 55:35.460] And so I knew about that. [55:35.460 --> 55:46.460] Now, I've been told that you know something about this, about buying weapons as a corporation versus as an individual citizen. [55:46.460 --> 55:49.460] Can you speak to that a little bit? [55:49.460 --> 55:52.460] Yeah, I'm actually a type seven firearms dealer. [55:52.460 --> 55:54.460] I'm a type seven firearms manufacturer. [55:54.460 --> 56:00.460] So I can build guns and I send them into the ATF and get the licensing and stuff for each weapon and the serial number. [56:00.460 --> 56:11.460] But we're working on our class three SOT, three license, which that means is I manufacture suppressors and I can do dealer samples for the police. [56:11.460 --> 56:21.460] Because I can sell to Department of Homeland Security, the, you know, DOJ, I can sell to PSA, which, you know, we're a large customs area down here. [56:21.460 --> 56:24.460] So there's a lot of those kinds of officers. [56:24.460 --> 56:37.460] The main point for civilians is when I do the 1986 act, you can't buy a new manufactured fully automatic weapon. [56:37.460 --> 56:47.460] But if you have the proper credentials for, you know, like a trust, then you can buy those as part of your corporation. [56:47.460 --> 56:56.460] And a trust does have to go through a background check, but that background check is only for that individual that put in the paperwork for the trust. [56:56.460 --> 57:07.460] Once they can hand that paperwork to anybody they want and that particular person can go down there and purchase a class three machine gun with a suppressor the whole nine yards, [57:07.460 --> 57:19.460] it still has to be kept at a certain location and it removes your fourth amendment right to search for seizure because the ATF can come in anytime they want and check that location for that weapon. [57:19.460 --> 57:26.460] But, you know, if that's the type of route you want to go, yeah, you can definitely do that. [57:26.460 --> 57:42.460] But if they go, if somebody was to pursue this type of a trust, if it was a quote convicted felon that tried to do this, that person's still going to have to go through the background check because he's the signer of the trust. [57:42.460 --> 57:45.460] He's the trustee for the trust, correct? [57:45.460 --> 57:49.460] Right, but you can establish the trust to a corporation. [57:49.460 --> 58:02.460] So if you were to have a business and you wanted to establish a trust for that particular business, then that business is the one that gets the background check ran on it. [58:02.460 --> 58:16.460] Basically, they're checking to make sure that it has seven years of existence and that it's not a, you know, because there's certain felon businesses can receive and seizures and closings and stuff like that. [58:16.460 --> 58:22.460] Typically, the best way to do that though is you contact an attorney and you can establish a trust. [58:22.460 --> 58:26.460] There will be one person on that trust that's going to have to go through the background check. [58:26.460 --> 58:34.460] It takes six to eight months, sometimes a year, and you have to have already a weapon that you've purchased, basically. [58:34.460 --> 58:42.460] And then there's the form four for your transfer for your suppressor or short braille rifle for different things, but it all depends on what you're buying. [01:05:16.460 --> 01:05:26.460] Can you explain, go over again what you was telling me about the difference between a purchase as a firearms dealer [01:05:26.460 --> 01:05:32.460] and buying it personally and reselling it again as a private person? [01:05:32.460 --> 01:05:38.460] Yeah, it's one of the few things that they don't talk about for FFLs. I'm still a person. [01:05:38.460 --> 01:05:47.460] So, what I can do is say I get a great deal on several Ruger minis 30s and I want one for my own collection. [01:05:47.460 --> 01:05:51.460] So, what I do is in my bound book, I write it down private collection. [01:05:51.460 --> 01:05:57.460] And now that weapon goes into my closet away from my weapons that I sell. [01:05:57.460 --> 01:06:03.460] If after a year I need some money for something or, you know, my wife wants new jewelry, [01:06:03.460 --> 01:06:10.460] she can take that weapon to the gun show and she can sell that weapon after one year with no background check. [01:06:10.460 --> 01:06:16.460] And there's another one of those deals that there's a lot of the non-background check sales. [01:06:16.460 --> 01:06:23.460] They're not really so much somebody skirting the law as they've already been a background check done. [01:06:23.460 --> 01:06:28.460] Now, you're trusting to the judgment of that individual selling the weapon as they're not going to sell it [01:06:28.460 --> 01:06:35.460] to somebody who's going to go out and sell it to the cartels and go on a rampage. [01:06:35.460 --> 01:06:45.460] Okay, so now let me, basically what we're understanding, like with this gun, we're giving away. [01:06:45.460 --> 01:06:48.460] The AR-15, the Rock River AR-15. [01:06:48.460 --> 01:06:50.460] That's a great gun too. [01:06:50.460 --> 01:07:02.460] Yes, it is. When we give this away to somebody, the person who gets it cannot sell it for at least one year after they receive it. [01:07:02.460 --> 01:07:04.460] Correct? [01:07:04.460 --> 01:07:05.460] Right. [01:07:05.460 --> 01:07:11.460] Because it would be getting a gift and then they would be selling it for a profit, [01:07:11.460 --> 01:07:16.460] even though they're a private person, so they're selling it for a profit to get the money for. [01:07:16.460 --> 01:07:17.460] Correct. [01:07:17.460 --> 01:07:21.460] They're actually, quote, breaking the law right there, correct? [01:07:21.460 --> 01:07:28.460] Right. Now, the odds of them enforcing that, the only way that the federal government would enforce that particular regulation [01:07:28.460 --> 01:07:31.460] is if they sold it to the wrong person. [01:07:31.460 --> 01:07:36.460] That person took that gun and used it in a bank robbery or something and lost the weapon. [01:07:36.460 --> 01:07:42.460] Well, then the police grabbed that weapon and they contact Rock River Arms and they say, [01:07:42.460 --> 01:07:49.460] hey, I got serial number, blah, blah, blah, blah, and they say, yes, I sold that to zombie killers and they give them my FFL. [01:07:49.460 --> 01:07:54.460] Well, then the ATF calls me and they go, hey, Chris, who'd you sell this gun to? [01:07:54.460 --> 01:08:01.460] And then I give them the information and then they go to that person's house and they say, where's your gun? [01:08:01.460 --> 01:08:08.460] Well, if that person turns around and goes, well, I only had it for a month and I sold it as brand new on the auction site. [01:08:08.460 --> 01:08:15.460] Yeah, now there's going to be some problems because they're going to go, well, we ain't got any law that we can get you on, [01:08:15.460 --> 01:08:19.460] but we're certainly going to get you on this trafficking without a license law. [01:08:19.460 --> 01:08:21.460] And that's 10 years day for day. [01:08:21.460 --> 01:08:25.460] So you really don't want to make that particular mistake by selling it to the wrong person. [01:08:25.460 --> 01:08:26.460] Correct. [01:08:26.460 --> 01:08:30.460] But you can still go to an FFL and say, hey, I've got somebody who wants to buy this weapon. [01:08:30.460 --> 01:08:32.460] Can we do a transfer? [01:08:32.460 --> 01:08:40.460] And then that's when, you know, if it's within that first year. [01:08:40.460 --> 01:08:41.460] Right. [01:08:41.460 --> 01:08:45.460] If it's within that first year, after that first year, there's do whatever they want. [01:08:45.460 --> 01:08:48.460] It doesn't matter what they do with no issues after that. [01:08:48.460 --> 01:08:56.460] They can sell it to somebody and if that person uses it in a bank robbery, all they have to do is say, I sold it to so-and-so and they're done. [01:08:56.460 --> 01:09:01.460] And it's been a year, it's been over a year and I'm done. [01:09:01.460 --> 01:09:02.460] There's no issues. [01:09:02.460 --> 01:09:11.460] There's an issue in Arizona where the number two in charge of the Phoenix office of the ATF purchased a 5.7x28 FNH handgun. [01:09:11.460 --> 01:09:17.460] And this is one that the cartels really want because it fires a rifle cartridge and shoots through soft body armor. [01:09:17.460 --> 01:09:25.460] Now, I've seen them offer $3,000 to $6,000 for this pistol and my cost is about $1,200. [01:34:08.460 --> 01:34:12.460] She goes to this course. She comes back and tells me, she said, [01:34:12.460 --> 01:34:16.460] well, the shooting was only about 30 minutes. [01:34:16.460 --> 01:34:22.460] The other 11 and a half hours was telling us where we couldn't take the weapon. [01:34:22.460 --> 01:34:27.460] Okay? And so after that, we decided not to do it. [01:34:27.460 --> 01:34:29.460] I told her, no, you're not doing that. [01:34:29.460 --> 01:34:34.460] I said, because first of all, they tell them about the signs that are up at establishments [01:34:34.460 --> 01:34:42.460] like the establishment that has alcohol cells of more than 51% of their cells. [01:34:42.460 --> 01:34:46.460] You can't take, well, all these different places, they told the concealed carry holder, [01:34:46.460 --> 01:34:48.460] they could not take their weapon. [01:34:48.460 --> 01:34:51.460] A criminal doesn't care about those laws. [01:34:51.460 --> 01:34:52.460] They don't care. [01:34:52.460 --> 01:34:55.460] If somebody plans on shooting somebody, they're going to look, oh, well, [01:34:55.460 --> 01:35:00.460] I know there's no concealed carry holders in there because they got a sign up. [01:35:00.460 --> 01:35:04.460] And so I'm pretty safe to go in there and rob that place, definitely, [01:35:04.460 --> 01:35:07.460] because there's not going to be anybody in their arm. [01:35:07.460 --> 01:35:12.460] That's only thing that does is make sure that nobody has a weapon in all these different places. [01:35:12.460 --> 01:35:18.460] So first of all, one of the things that my wife told me coming out of this [01:35:18.460 --> 01:35:25.460] is if a person who has a concealed carry, if they tell somebody they are a concealed carry, [01:35:25.460 --> 01:35:28.460] they are no longer a concealed carry holder. [01:35:28.460 --> 01:35:35.460] And every person I've ever met that has a concealed carry, they walk around bragging about it. [01:35:35.460 --> 01:35:36.460] They brag about it. [01:35:36.460 --> 01:35:39.460] They'll pull out their license and show it to you. [01:35:39.460 --> 01:35:42.460] And I'm like, you're not a concealed carry holder anymore [01:35:42.460 --> 01:35:45.460] because you've just told me you have a concealed carry. [01:35:45.460 --> 01:35:47.460] Is that right, Chris? [01:35:47.460 --> 01:35:48.460] Yes, sir. [01:35:48.460 --> 01:35:52.460] And the only reason I ever tell anybody, and I tell my close friends, [01:35:52.460 --> 01:35:57.460] that if there's ever an active shooter situation, you get behind me and you keep running away. [01:35:57.460 --> 01:35:59.460] I'll delay them as long as I can. [01:35:59.460 --> 01:36:03.460] Now, the Israeli Special Forces says that a typical shooter can only be delayed [01:36:03.460 --> 01:36:09.460] for about 47 seconds from a pistol to a rifle. [01:36:09.460 --> 01:36:15.460] So that tells you what my odds are there, but you can only do so much. [01:36:15.460 --> 01:36:18.460] And you can't even carry where you work. [01:36:18.460 --> 01:36:21.460] Where you spend most of your time anyway is where you work. [01:36:21.460 --> 01:36:26.460] And that comes down to the owner of that business determining if you can carry there. [01:36:26.460 --> 01:36:27.460] Now, wait a minute. [01:36:27.460 --> 01:36:31.460] The Israelis are talking about a determined shooter. [01:36:31.460 --> 01:36:36.460] They're not talking about the guy who expects to be at a turkey shoot [01:36:36.460 --> 01:36:39.460] and finds the turkey shooting back at him. [01:36:39.460 --> 01:36:40.460] That's correct. [01:36:40.460 --> 01:36:42.460] It changes everything. [01:36:42.460 --> 01:36:46.460] And if you haven't been on the sharp end of one of those things [01:36:46.460 --> 01:36:51.460] and you decide that you're going to put somebody else on it [01:36:51.460 --> 01:36:56.460] and the other one points one back at you, it changes everything. [01:36:56.460 --> 01:37:01.460] Yeah, look what happened to that shooter that was in the mall and his firearm jammed. [01:37:01.460 --> 01:37:02.460] I can't remember where this was. [01:37:02.460 --> 01:37:04.460] It's a big news story pretty recently. [01:37:04.460 --> 01:37:05.460] Michael Ms. Martin. [01:37:05.460 --> 01:37:09.460] Yeah, and then one of the mall patrons came after him [01:37:09.460 --> 01:37:12.460] and started shooting back at him, pointing the gun at him. [01:37:12.460 --> 01:37:14.460] Well, the guy just killed himself. [01:37:14.460 --> 01:37:15.460] Right. [01:37:15.460 --> 01:37:16.460] Exactly. [01:37:16.460 --> 01:37:24.460] So like I said, only thing the concealed carry, in my opinion, does is it limits the places [01:37:24.460 --> 01:37:30.460] and puts a notice up to the criminals exactly where they have the best chance of going in [01:37:30.460 --> 01:37:34.460] and breaking the wall because they know no concealed carry. [01:37:34.460 --> 01:37:36.460] Now, if a concealed carry, tell me this, Chris. [01:37:36.460 --> 01:37:42.460] If a concealed carry holder takes a gun into a place where he's not supposed to have a gun [01:37:42.460 --> 01:37:50.460] and then a crime is committed in the business and he shoots the criminal who's committing the crime, [01:37:50.460 --> 01:37:53.460] what happens to the concealed carry holder? [01:37:53.460 --> 01:37:54.460] Does he lose his license? [01:37:54.460 --> 01:37:55.460] Does he go to jail? [01:37:55.460 --> 01:37:56.460] What happens? [01:37:56.460 --> 01:38:00.460] That comes down to the DA to decide if he's going to prosecute. [01:38:00.460 --> 01:38:06.460] And I wouldn't do it in Austin because judging from what I've read about Austin, they would probably prosecute you. [01:38:06.460 --> 01:38:13.460] But the whole point is, is then, you know, if you do get something like that, take it to jury trial [01:38:13.460 --> 01:38:16.460] because I guarantee you that jury is going to sit there and go, well, wait a minute. [01:38:16.460 --> 01:38:19.460] He stopped a felony in commission. [01:38:19.460 --> 01:38:24.460] You know, yeah, we'll give him his trespassing charge and he'll go get his 30 days in jail. [01:38:24.460 --> 01:38:26.460] But that's still not a felony. [01:38:26.460 --> 01:38:29.460] You shouldn't lose your license over that. [01:38:29.460 --> 01:38:32.460] Yeah, and really, it shouldn't be up to the DA. [01:38:32.460 --> 01:38:37.460] It should be up to the grand jury because if the grand jury refuses to indict the person, [01:38:37.460 --> 01:38:41.460] then the prosecutor can't prosecute no matter how much he wants to. [01:38:41.460 --> 01:38:46.460] And that's something that we're working on right now is educating grand jurors about these sorts of things. [01:38:46.460 --> 01:38:47.460] They can stop that. [01:38:47.460 --> 01:38:50.460] Exactly, you got it. [01:38:50.460 --> 01:39:00.460] We know with listening to Randy and Eddie that the jury, I mean, that the grand jury is inaccessible, almost completely inaccessible. [01:39:00.460 --> 01:39:03.460] The DA is the one who has the accessibility. [01:39:03.460 --> 01:39:06.460] It's getting better, Larry. [01:39:06.460 --> 01:39:12.460] I mean, Randy has kicked some serious blood even here in Travis County over the last few years. [01:39:12.460 --> 01:39:21.460] And even the assistant DA now is not getting in people's way anymore when they go to bring criminal complaints to the grand jury to again. [01:39:21.460 --> 01:39:24.460] I'll give you an idea. [01:39:24.460 --> 01:39:37.460] I went to a Justice of the Peace and asked to see some records and the Justice of the Peace said that I would be a security risk that I had to go down to the county clerk and look at her records from the county clerk. [01:39:37.460 --> 01:39:43.460] And I said, I don't want to go to the clerk. I want to see yours, which he refused. I asked the bailiff to arrest her. [01:39:43.460 --> 01:39:47.460] And the bailiff told me if I created a disturbance, he'd arrest me. [01:39:47.460 --> 01:39:50.460] So I asked him, are you threatening me? [01:39:50.460 --> 01:39:52.460] And he eventually said he wasn't. [01:39:52.460 --> 01:40:01.460] So I talked to the prosecutor attorney and told her, I'm going to come down there and I'm going to file criminal charges against that Justice of the Peace. [01:40:01.460 --> 01:40:07.460] 3903 Penal Code of Fish and Oppression for denying me full free access to her enjoyment rights. [01:40:07.460 --> 01:40:17.460] And I'm going to charge that bailiff with first degree felony aggravated assault, 2204B2A. [01:40:17.460 --> 01:40:20.460] Do I need to bring a Texas Ranger with me? [01:40:20.460 --> 01:40:27.460] And she said, well, why would you need a Texas Ranger to arrest anyone who tries to interfere with my access? [01:40:27.460 --> 01:40:38.460] And she said it. And I told her I would give the complaint to the bailiff for the grand jury and instruct him to tell the form and I had business with the grand jury and give him this. [01:40:38.460 --> 01:40:42.460] She said, if that's what you want to do, no one will interfere with you. [01:40:42.460 --> 01:40:56.460] Now several years ago, my picture was hanging up in the grand jury room in the same place, Tarrant County, because I filed over 50 felony and misdemeanor charges against public officials. [01:40:56.460 --> 01:41:00.460] For them interfering with my access to the grand jury. [01:41:00.460 --> 01:41:07.460] And one of the prosecutors was still there and knew exactly who I was and they decided to stand aside. [01:41:07.460 --> 01:41:10.460] This is a big deal. [01:41:10.460 --> 01:41:12.460] It's a big deal and it's getting better. [01:41:12.460 --> 01:41:14.460] Okay, listen, we need to go back to our callers.
