[05:04.360 --> 05:08.640] And ultimately, I guess it kind of was, we were going to either get pretty much Barack [05:08.640 --> 05:13.600] Obama or Mitt Romney, and I thought there was no way for me to find any kind of satisfaction [05:13.600 --> 05:22.000] at all on Tuesday, but on Tuesday night, I realized, hey, this is, somehow I'm sitting [05:22.000 --> 05:28.600] here and I'm very upset and not happy that Barack Obama is going to be present for four [05:28.600 --> 05:36.440] more years, I'm not happy that he's winning, but man, was I ever happy that Romney lost. [05:36.440 --> 05:41.840] I was extremely happy Romney lost because of the abuse. [05:41.840 --> 05:46.160] And for those that don't know, probably most of the people that are listening to your broadcast [05:46.160 --> 05:51.840] know, but the Republican establishment at not just the RNC convention, which was the [05:51.840 --> 05:57.600] Big Daddy Republican Convention in Tampa, but all the prior conventions at the state [05:57.600 --> 06:03.720] level and at the senatorial level, county level, precinct level, there was just YouTube [06:03.720 --> 06:12.760] video after YouTube video, the old guard Republican establishment abusing their power and squashing [06:12.760 --> 06:18.920] the new folks coming in that supported Ron Paul, which ultimately did lead to the just [06:18.920 --> 06:24.600] incredible tyrannical display that happened at the Republican National Convention. [06:24.600 --> 06:27.600] And unfortunately, it hasn't really been properly covered. [06:27.600 --> 06:29.760] I don't think it's really gotten the coverage that it should have. [06:29.760 --> 06:36.360] But you know, when I saw that, and from my perspective is going to the state of Texas [06:36.360 --> 06:42.040] convention as a delegate and I saw what happened at the RNC and I wasn't even there and I could [06:42.040 --> 06:48.680] just imagine how crazy it could have been for the folks that did attend the RNC and [06:48.680 --> 06:55.360] the just outright blatant tyranny of what basically the Republican National Convention [06:55.360 --> 06:57.840] basically is just like a beauty contest. [06:57.840 --> 07:00.520] It's not even the main contest. [07:00.520 --> 07:06.400] It's not worth squashing people over, but that's exactly what the Republican establishment [07:06.400 --> 07:14.000] did to the freedom and liberty delegates, the Ron Paul delegates, the info warrior delegates [07:14.000 --> 07:15.200] that showed up there. [07:15.200 --> 07:24.000] They squashed them, they absolutely put that big jack boot on the backs of our delegates [07:24.000 --> 07:27.760] next in heads and other parts of their bodies. [07:27.760 --> 07:35.400] And so when Romney lost, I said, vindication, vindication, Republican establishment, I tell [07:35.400 --> 07:41.640] you what, I'm going to make some enemies tonight, I'm sure, at the Republican party, but don't [07:41.640 --> 07:42.640] shoot the messenger. [07:42.640 --> 07:43.640] I'm the messenger. [07:43.640 --> 07:44.640] I'm the messenger. [07:44.640 --> 07:46.200] Now, you can shoot me. [07:46.200 --> 07:51.800] You're not going to like what I got to say, but look, the Republican establishment leadership [07:51.800 --> 07:55.600] proffered in 1996 candidate Bob Dole. [07:55.600 --> 07:59.680] They proffered John McCain in 2008. [07:59.680 --> 08:05.440] In 2012, they proffered Mitt Romney as your designated candidate. [08:05.440 --> 08:12.840] Do you like just repeatedly losing and losing and losing to the likes of Bill Clinton's [08:12.840 --> 08:15.600] and to the likes of Barack Obama's? [08:15.600 --> 08:16.760] Come on, guys. [08:16.760 --> 08:24.160] It's just if you're not going to put forth a true constitutionalist candidate, then you [08:24.160 --> 08:26.680] might as well just get used to losing. [08:26.680 --> 08:31.640] And we, in the meantime, will continue fighting within the system to change it. [08:31.640 --> 08:36.600] But we're also going to be digging our foxholes, buying our guns, buying our ammunition, buying [08:36.600 --> 08:41.080] our storable food, getting our bunkers set up. [08:41.080 --> 08:44.640] And maybe if you're nice to us later, maybe we'll have a little room in the foxhole for [08:44.640 --> 08:48.160] you when our country goes down in flames. [08:48.160 --> 08:53.120] I tell you, the Republican establishment has got to wake up. [08:53.120 --> 08:54.800] They lost this election. [08:54.800 --> 09:02.480] Look, Deborah, had it not been for the injustice that occurred at the Republican National Convention, [09:02.480 --> 09:07.560] I may have held my nose and voted for Romney. [09:07.560 --> 09:09.960] We all had to sit there and think about it. [09:09.960 --> 09:11.000] But you know what? [09:11.000 --> 09:16.360] A lot of people made the same decision that I made without even being prompted. [09:16.360 --> 09:17.840] They made this decision. [09:17.840 --> 09:19.080] You know what? [09:25.520 --> 09:30.840] There's people on Daily Paul that have actually gone and dug up the numbers and have demonstrated [09:30.840 --> 09:37.400] how in these, especially in the key swing vote states like Florida, Ohio, I think New [09:37.400 --> 09:42.280] Hampshire, I don't have that list right here in front of us if I can pull it up, Connecticut, [09:42.280 --> 09:49.400] Florida, New Hampshire, Ohio, Virginia, in those five states, the Ron Paul primary votes, [09:49.400 --> 09:55.560] had they shown up, would have been greater than the loss of margin, the loss margin that [09:55.560 --> 09:56.960] Romney had in those states. [09:56.960 --> 10:02.760] In other words, if those Ron Paulers had come and voted for Romney, boom, Romney would [10:02.760 --> 10:05.000] be president right now. [10:05.000 --> 10:13.000] So Republican establishment, please learn your lesson finally, Bob Dole, John McCain, [10:13.000 --> 10:15.720] and now Romney, we're just not going to go there. [10:15.720 --> 10:24.000] We would rather not, just rather not join you and compromise and elect a trader candidate. [10:24.000 --> 10:27.600] As a matter of fact, one thing I had to print out, and Deborah interrupted me any time you [10:27.600 --> 10:31.840] feel like doing it, but I just said, you know, when I'm thinking about Romney, I had to [10:31.840 --> 10:37.680] go back and print out a quote, and I think everybody sometime sooner or later has probably [10:37.680 --> 10:40.920] heard this quote, but it's called, the enemy is within the gates. [10:40.920 --> 10:47.320] Now I don't consider Barack Obama, I mean, he's within the gates, but this particular [10:47.320 --> 10:49.440] quote refers to traders. [10:49.440 --> 10:52.680] You know, Barack Obama basically openly is a trader. [10:52.680 --> 10:56.720] He talks about how he'd like to take Americans guns openly. [10:56.720 --> 11:03.080] So you know, everybody can pretty much know that this guy is really ultimately an enemy [11:03.080 --> 11:08.920] of the Constitution, but Mitt Romney, on the other hand, is one of these people that could [11:08.920 --> 11:10.120] be designated trader. [11:10.120 --> 11:15.400] Here's the quote, a nation can survive its fools and even the ambitious, but it cannot [11:15.400 --> 11:17.440] survive treason from within. [12:25.080 --> 12:31.480] I mean, what do you expect, you know, do you think that we're really going to vote for [12:31.480 --> 12:36.160] your establishment candidate and be quote unquote loyal to the party after the way you [12:36.160 --> 12:37.160] treat us? [12:39.360 --> 12:46.880] I mean, and the thing is, you don't even have to look at the number of votes that went in [12:46.880 --> 12:51.800] for Gary Johnson because a lot of the Ron Paul supporters just stayed home and didn't [12:51.800 --> 12:52.800] even vote. [12:52.800 --> 12:53.800] That's right. [12:53.800 --> 12:54.800] Exactly. [12:54.800 --> 12:56.880] A lot of them did stay home, Deborah, and it's a darn shame. [12:56.880 --> 13:01.920] It's an absolute shame they stayed home, though, because there were so many important local [13:01.920 --> 13:05.600] races, state level, county levels, you name it. [13:05.600 --> 13:08.360] There's just so many things, ballot initiatives. [13:08.360 --> 13:10.160] It's just a shame. [13:10.160 --> 13:13.720] I just want to remind everybody that it was out there, and I know, Deborah, you were one [13:13.720 --> 13:17.560] of those folks, and I know a lot of the listeners out there were the folks that were at that [13:17.560 --> 13:22.600] Hyde Park Baptist Church here in Austin, Texas, back at our senatorial convention. [13:22.600 --> 13:28.320] I think it was back in May, I think it was, April or May. [13:28.320 --> 13:33.640] We saw some activity there that you could just call tyrannical as well. [13:33.640 --> 13:41.000] Well, the whole setup, the whole nine yards, what happened at that Hyde Park Baptist Church [13:41.000 --> 13:45.360] was just absolutely ridiculous from the beginning. [13:45.360 --> 13:50.680] They manipulated things in the rules committee ahead of time to do away with all the precinct [13:50.680 --> 14:00.360] caucusing, and we managed to beat that, but it took almost all day just to get that done, [14:00.360 --> 14:06.680] and so then it's like they're thanking the people who rented the place, and I have to [14:06.680 --> 14:14.560] say shame on you, the people who run the Travis County Republican Party for acting like you [14:14.560 --> 14:20.240] didn't know that this was going to be a big fight over number one, the precinct caucuses, [14:20.240 --> 14:29.000] and number two, challenging the slate of the committee selected at large candidates. [14:29.000 --> 14:34.880] I mean, of course we're going to challenge that, of course we're going to want to select [14:34.880 --> 14:42.120] our own delegates, and I remember four years ago, we were at the convention center, it [14:42.120 --> 14:46.960] was at the convention center four years ago, we were there till like midnight, one o'clock [14:46.960 --> 14:51.240] in the morning, and then, oh, they think that four years later there's not going to be a [14:51.240 --> 14:59.200] fight, and so they spend exorbitant amounts of money renting the Hoity Toity High Park [14:59.200 --> 15:04.400] Baptist Church, probably the most expensive venue they could have possibly found just [15:04.400 --> 15:09.400] to act like they're all that, and they can only afford to rent it until six o'clock [15:09.400 --> 15:15.480] in the evening, and then by five thirty we just barely finished the precinct caucuses, [15:15.480 --> 15:19.960] and it's time to start the real business of the convention, and so then we have to go [15:19.960 --> 15:27.320] out to the parking garage, because the church could not donate any time to us, because it's [15:27.320 --> 15:32.120] against their 501C3, alright, so then we're out in the parking garage, and we're sitting [15:32.120 --> 15:38.680] there waiting for like four or five hours while the committee comes up with their slate, [15:38.680 --> 15:45.200] and then they do a voice vote, and then we couldn't challenge it ahead of time, because [15:45.200 --> 15:49.240] I didn't even hear this, I'm sure it was against the rules of the party, and against all these [15:49.240 --> 15:50.240] convention rules. [15:50.240 --> 15:56.600] There was no sound system, there was no amplification for the chairman's voice, and so he quieted, [15:56.600 --> 16:00.880] this is what I heard from someone else anyway, I didn't hear it myself, and he says, okay, [16:00.880 --> 16:04.480] as long as there's no objections, like he's real quiet, as long as there's no objections, [16:04.480 --> 16:07.520] once the committee hands down their slate, we're just going to do an up or down vote, [16:07.520 --> 16:13.920] okay, and it's like there's hundreds of people in the parking garage that did not hear this, [16:13.920 --> 16:18.360] and if I would have heard that, I would have said, oh no, there is an objection, I do object, [16:18.360 --> 16:22.800] I don't want to just have an up or down vote when the committee hands their slate down [16:22.800 --> 16:29.120] four hours from now while we're sitting in this parking garage, and so then when the [16:29.120 --> 16:33.440] slate comes, then all these people are trying to challenge it, and they're like, oh no, [16:33.440 --> 16:37.440] we already agreed, we're just going to have an up or down vote, remember, no one objected, [16:37.440 --> 16:41.240] blah, blah, blah, okay, the whole thing was planned, and then they act like, how could [16:41.240 --> 16:46.640] we have possibly known, I mean you've got to be kidding, how many thousands of dollars, [16:46.640 --> 16:52.080] I mean, Richard, I could have rented a venue three times as big for two, three days in [16:52.080 --> 17:20.560] a row than the Hyde Park Baptist Church, okay, TISC, TISC, TISC, TISC, not very good spending. [19:54.740 --> 19:58.740] I'm sure it was all by design, but, you know, in the end, it's just, you know, [19:58.740 --> 20:01.740] it just goes against everything the Republican Party is supposed to stand for, [20:01.740 --> 20:06.740] which is conservative spending for sure and conservative time efficiency as well. [20:06.740 --> 20:08.740] But yes, vindication as well. [20:08.740 --> 20:13.740] I hope you Republican establishment like what you get, okay? [20:13.740 --> 20:16.740] Because in my opinion, Richard, it backfired. [20:16.740 --> 20:18.740] It totally blew up in their face. [20:18.740 --> 20:19.740] It sure did. [20:19.740 --> 20:22.740] I'll tell you what, we've got four more years of Obama. [20:51.740 --> 20:52.740] I got enough guns in ammo. [20:52.740 --> 20:53.740] I don't think I'll get any more. [20:53.740 --> 20:57.740] Or maybe somebody that doesn't even own a gun or ammo, maybe they wouldn't even get any. [20:57.740 --> 21:01.740] But Barack Obama, I think, will continue to at least inspire that. [21:01.740 --> 21:07.740] And going back to the scenario at the Hyde Park Baptist Church, I think Deborah, you're absolutely right. [21:07.740 --> 21:08.740] They figured out a way. [21:08.740 --> 21:13.740] See, when they prolong these events like that, then they turn these different factions [21:13.740 --> 21:18.740] against each other even harder, and it creates even more angst [21:18.740 --> 21:22.740] in fighting amongst the different factions present at these conventions. [21:22.740 --> 21:26.740] And to show you and demonstrate another thing that happened, one thing that happened [21:26.740 --> 21:30.740] at the State Convention was that I arrived there a little bit late [21:30.740 --> 21:35.740] because I'd been on the Bilderberg trip with Alex and the crew [21:35.740 --> 21:38.740] to do the Bilderberg event in Chantilly, Virginia. [21:38.740 --> 21:42.740] And so I wasn't able to get to the Texas State Convention right when it started. [21:42.740 --> 21:47.740] But I got there that first day, a little bit towards the afternoon, [21:47.740 --> 21:49.740] just in time to hear Ron Paul speaking. [21:49.740 --> 21:52.740] And if I remember right, it was around 1 p.m., 2 p.m. [21:52.740 --> 21:54.740] Somewhere around there that I got there. [21:54.740 --> 21:59.740] And Ron Paul was right there at center stage at the Tarrant County Convention Center [21:59.740 --> 22:01.740] up in Fort Worth, Texas speaking. [22:01.740 --> 22:04.740] And there were quite a few people in attendance at that moment in time. [22:04.740 --> 22:07.740] But since I had just arrived there, I didn't know the lay of the land. [22:07.740 --> 22:09.740] I didn't know what was going on. [22:09.740 --> 22:14.740] I knew things were going on at the convention besides the Ron Paul speech. [22:14.740 --> 22:18.740] But as time went by, I figured out what happened. [22:18.740 --> 22:24.740] I remember being surprised in hearing that Ron Paul was even going to be allowed to speak [22:24.740 --> 22:26.740] at the Texas State Convention. [22:26.740 --> 22:28.740] I was going, wow, that's a surprise. [22:28.740 --> 22:31.740] I would have thought that they'd have blocked that. [22:31.740 --> 22:35.740] Being that Rick Perry was at that time, I think he'd already dropped out by then. [22:35.740 --> 22:40.740] But being that Rick Perry was their guy and things like that, that they wouldn't even invite him. [22:40.740 --> 22:43.740] But lo and behold, they invited Ron Paul. [22:43.740 --> 22:47.740] And everybody in the Ron Paul camp thinks, wow, that's wonderful. [22:47.740 --> 22:48.740] That's great. [22:48.740 --> 22:54.740] Well, it just so happens that during the time that Ron Paul was speaking, [22:54.740 --> 22:57.740] they were having senatorial district caucusing. [22:57.740 --> 23:05.740] And so simultaneously, as Ron Paul is in the main area of the Tarrant County Convention Center, the main arena part, [23:05.740 --> 23:09.740] in the breakout rooms within the Tarrant County Convention Center, [23:09.740 --> 23:12.740] in the breakout rooms, they're having the senatorial district caucuses. [23:12.740 --> 23:17.740] And one, these caucuses, there's a lot of important business that happens in these caucuses. [23:17.740 --> 23:18.740] That's why they do them. [23:18.740 --> 23:23.740] One of the most important pieces of business that happened in the senatorial district caucuses, [23:23.740 --> 23:29.740] while Ron Paul is speaking on the floor and a lot of Ron Paul delegates are there listening and watching him [23:29.740 --> 23:31.740] instead of being in their district caucus. [23:31.740 --> 23:42.740] Well, Texas Republican committee people are being nominated and elected out of these senatorial district caucuses. [23:42.740 --> 23:51.740] And this virtually made us not have any representation going to the state level committee for the Republican Party here in Texas. [23:51.740 --> 24:00.740] That's the level of conniving that goes on with the Republican establishment and these conventions. [24:00.740 --> 24:03.740] Tell me that was coincidence, Deborah. [24:03.740 --> 24:11.740] That cannot possibly be a coincidence, but I'm a little surprised that the Ron Paul supporters didn't realize what was going on [24:11.740 --> 24:15.740] and just said, hey, you know, we love our man, but we got to participate in these precinct. [24:15.740 --> 24:19.740] I mean, we got to participate in these senatorial district caucuses. [24:19.740 --> 24:22.740] We're not going to be able to support him, but you got to remember. [24:22.740 --> 24:27.740] You got to remember that, you know, most of the people involved are new to this process. [24:27.740 --> 24:31.740] I mean, by myself and still I'm a newbie at it. [24:31.740 --> 24:34.740] I'm still learning every time I go more and more about this stuff. [24:34.740 --> 24:44.740] But yeah, they basically figured out a way to make sure that there's no Ron Paul people got to the state level of the Republican Party here in Texas. [24:44.740 --> 24:50.740] And so now we'll have to wait till, you know, 2014 Lord willing that we get another chance at it to try to get somebody. [24:50.740 --> 24:54.740] We need to be the ones that are on these committees. [24:54.740 --> 25:04.740] We need to be on these different committees to, you know, the nominations committees and the rules committees and all the different things that has to happen to make the party work. [25:04.740 --> 25:07.740] We need to be involved to help fight the good fight. [25:07.740 --> 25:17.740] And basically they figured out a way, I mean, just imagine if all our delegates had stayed in their central district caucuses and then Ron Paul all of a sudden is speaking virtually to an empty hall. [25:17.740 --> 25:20.740] So I mean, they were willing to allow that to happen. [25:20.740 --> 25:23.740] I mean, how ugly is that that they would? [25:23.740 --> 25:26.740] Oh, yeah, Ron Paul come and speak and we'll make sure you speak to nobody. [25:26.740 --> 25:27.740] Yeah, and they don't care. [25:27.740 --> 25:29.740] They don't care how ugly it is. [25:29.740 --> 25:33.740] Well, and so that's why they get uglyness thrown back right in their face. [38:52.740 --> 38:59.740] And when you get it, it won't take you long to figure out it's not a regular bar of soap. [38:59.740 --> 39:04.740] You can't take it in your hands and rub it around in your hands like you do a regular bar of soap. [39:04.740 --> 39:08.740] You will get way, way too much soap. [39:08.740 --> 39:19.740] The way I use it is I get it wet and set it down and then get my body wet and then reach up and set my hand on it for a second or so. [39:19.740 --> 39:28.740] And because of the way I'm making it, it doesn't have enough water in it to cause it to react. [39:28.740 --> 39:32.740] I have two chemicals that I put in it. [39:32.740 --> 39:43.740] And when they combine, both of them chemically change into a third chemical that really makes the soap work the way it does. [39:43.740 --> 39:47.740] Well, I don't put enough water in it to get that reaction to happen. [39:47.740 --> 39:56.740] So, when you put your hand on it, your hands wet, it causes it to react and the soap will foam right up under your hand. [39:56.740 --> 39:59.740] It's not like anything you've ever used before. [39:59.740 --> 40:07.740] So, anybody who donates, I will send you a sample and we will put together a set of products. [40:07.740 --> 40:11.740] I'm sending it as a solid soap. [40:11.740 --> 40:20.740] I've been working on that technology, but Deborah and my daughter and some others really prefer my soap as liquid. [40:20.740 --> 40:28.740] And if you get this open, you prefer it as liquid, just drop it in a quart of water. [40:28.740 --> 40:33.740] Leave it overnight and it'll turn into a liquid soap. [40:33.740 --> 40:41.740] If you don't have enough water in it, you'll get a suds on the top, a little white layer on the top. [40:41.740 --> 40:45.740] And that simply means there's not enough water to hold everything in solution. [40:45.740 --> 40:50.740] There's a little bit more water to it and it'll go to a nice amber viscous liquid. [40:50.740 --> 40:56.740] It has a real nice feel to it, but it doesn't take much. [41:07.740 --> 41:12.740] You know, my wife uses it for laundry, she uses it to clean carpet with. [41:49.740 --> 41:55.740] But it has good products, so if you're going to use it like to wash your car with, [41:55.740 --> 42:01.740] put a half a cup full of five gallons of water and that's way more soap than you'd expect to need. [42:01.740 --> 42:07.740] And by the way, it was developed for that purpose and it does that extremely well. Why don't you give us a little brief background and then tell us about the victory. [47:37.740 --> 47:46.740] Okay, a little bit of brief background is my daughter went over to an apartment complex to visit a friend. [47:46.740 --> 47:59.740] They were there all of five minutes and a tow truck came up and started to tow their car. They actually went out there and found him in the process of doing it. [47:59.740 --> 48:11.740] Well, I got news for everybody out there. If you have to go to court with these guys, they will lie, lie, lie in court. [48:11.740 --> 48:16.740] Yes, so that's a reason to film, videotape everything. [48:16.740 --> 48:28.740] On the spot, whenever there's something going down, you get video of it immediately on the spot, the whole thing, so that when they lie in court, then you can take them down for perjury. [48:28.740 --> 48:30.740] Okay, so go ahead, Chris. [48:30.740 --> 48:35.740] Yes, which is exactly what we have this tow truck driver. [48:35.740 --> 48:49.740] This was their fatal flaw when we had to go back to court. We went to court first time and we got a continuance, which I would imagine is unheard of for these little probable cause hearings that they have. [48:49.740 --> 49:07.740] And when we went back to court over here on Tuesday, their fatal flaw was bringing the tow truck driver in because he was not expecting for us to bring up the fact that his license was expired. [49:07.740 --> 49:24.740] And when I say license, let me explain what I mean when I say license. It's not his driver's license. He has to have a tow truck operator license with the Texas Department of Licensing and Registration. [49:24.740 --> 49:33.740] And if that license is expired, they are not able to do consent or non-consent towing. [49:33.740 --> 49:46.740] Oh, wait a minute. If he operated in a license capacity when he didn't have a license, that's a class A misdemeanor. [49:46.740 --> 49:51.740] Well, I was thinking more like grand theft auto being a felony. [49:51.740 --> 50:09.740] Well, that too. Well, actually, you can't accuse someone of stealing your automobile unless you can prove that they intended to permanently deprive you of the vehicle. [50:09.740 --> 50:21.740] Oh, well then. Okay, Randy, explain to me what constitutes aggravated perjury as opposed to just perjury. [50:21.740 --> 50:40.740] That is a good question. Aggravated perjury goes to lying about a material fact. And to state the difference between the two, I'd have to go back and read the nuance of the code. [50:40.740 --> 50:45.740] One of them, I really don't know. [50:45.740 --> 51:00.740] Would a material fact be him sitting there telling the judge, yes, I went ahead and renewed my license four days before it expired in September, and it just hasn't arrived yet. [51:00.740 --> 51:10.740] And then he knows the judge that, I mean, she told him as soon as she brought it up on their website, she said, sir, your license shows here, it's expired. [51:10.740 --> 51:16.740] And he said, but I have, I've gotten it, it's on its way. [51:16.740 --> 51:24.740] And she said, well, you can bring that up on appeal. And that's when she found in favor of my daughter. [51:24.740 --> 51:36.740] Then when we were leaving, I called the TDLR and checked with them and they said that his license showed to be expired as of September 29, 2012, [51:36.740 --> 51:48.740] and that he had not renewed it, and then he would have to take a four hour class and $158 later, he could renew his license. [51:48.740 --> 51:56.740] That's a material fact. That's aggravated perjury. [51:56.740 --> 52:02.740] Okay. I thought that that's what he had done. [52:02.740 --> 52:15.740] Now, that's a nice thing to take to the first take to the district attorney, the district attorney refused to act on it, and then take it to the attorney general. [52:15.740 --> 52:26.740] Because as a, well, I don't know, as a licensed official, you take the district attorney to the attorney general. [52:26.740 --> 52:32.740] And this is something you can push directly to a grand jury. [52:32.740 --> 52:45.740] If the complaint was against a public official, then the attorney general would have had a regional jurisdiction along with the local prosecutor attorney. [52:45.740 --> 52:48.740] But this is a licensed issue, so that's different. [52:48.740 --> 52:53.740] But that's a class A misdemeanor. [52:53.740 --> 53:00.740] Aggravated perjury, that's a first degree felony. I'm sorry, I think it's a second degree felony. [53:00.740 --> 53:02.740] Yeah, the second or third degree. [53:02.740 --> 53:10.740] Yeah, but it's definitely a felony that put his behind back in the can. [53:10.740 --> 53:13.740] So, tell us how much you got. [53:13.740 --> 53:24.740] We ended up getting $400 plus what was $390.77, which is the exact amount of the toe, plus she gave us the court cost. [53:24.740 --> 53:32.740] She gave me the cost of the printing of all those pictures I had to print out for them and the cost of the paper. [53:32.740 --> 53:38.740] And she threw in like $10 for paper. [53:38.740 --> 53:40.740] Wonderful. [53:40.740 --> 53:46.740] Okay, now what is your plan from this point? [53:46.740 --> 54:08.740] I'm taking the judge's advice and going straight to the state court to sue them for the way that the law states it is that you consume for the amount of the property that they intended to deprive you of. [54:08.740 --> 54:13.740] Wonderful. Hope it was a new car. [54:13.740 --> 54:15.740] It was a brand new car. [54:15.740 --> 54:22.740] Oh, good news. So they might buy you a car from you, especially. [54:22.740 --> 54:28.740] Yeah, $24,000 car, and we can sue for three times that amount. [54:28.740 --> 54:35.740] Wonderful. And this is likely to be dead bank. [54:35.740 --> 54:39.740] You've already, it is rest judicata. [54:39.740 --> 54:44.740] It's already been adjudicated that he had no license at the time of the toe. [54:44.740 --> 54:47.740] It doesn't matter if he's applied for one. [54:47.740 --> 54:54.740] Even though, you know, he stated that that was aggravated perjury because that was a material fact. [54:54.740 --> 55:11.740] If he had applied for one soon enough and it had already been issued and he just didn't have it in his hand, then that would have been sufficient to overcome the convicted, the ruling against him. [55:11.740 --> 55:13.740] So it was a material fact. [55:13.740 --> 55:24.740] I have a question here because we've talked about this before in this particular court that Chris got involved with. He was going to file a state lawsuit. [55:24.740 --> 55:39.740] And then somehow the clerk managed to railroad him into filing for some administrative hearing for due process under the transportation code, but this has nothing to do with transportation. [55:39.740 --> 55:43.740] This is a private car on private property. [55:43.740 --> 55:45.740] So I don't understand. [55:45.740 --> 55:53.740] We didn't get the listeners and me, at least on this level, have not gotten the link here to what happened. [55:53.740 --> 56:00.740] Why did this hearing proceed anyway when this has nothing to do with transportation at all? [56:00.740 --> 56:10.740] Well, I thought that you were going to either make the clerk file the case in the proper venue. What happened here? [56:10.740 --> 56:13.740] That was before the phone call. [56:13.740 --> 56:21.740] I can't accuse the judge of being the one who made that clerk make the phone call on Monday. [56:21.740 --> 56:39.740] But on Monday, the clerk called up my daughter and said that the judge had said that she could not take into account city ordinances that that had to go over into either a municipal court or a state court. [56:39.740 --> 56:47.740] And that's also where the advice came from about the suing in state court. [56:47.740 --> 56:55.740] Okay, but I still don't understand why this case proceeded when this has nothing to do with transportation. [56:55.740 --> 56:59.740] I mean, was this the probable cause hearing that you were talking about? [56:59.740 --> 57:01.740] Yes, this was the probable cause hearing. [57:01.740 --> 57:07.740] But how did that go? I just don't even understand how that case even proceeded. [57:07.740 --> 57:11.740] How did the probable cause hearing even proceed when this case has nothing to do with transportation? [57:11.740 --> 57:15.740] This was a private car on private property. [57:15.740 --> 57:20.740] To be honest, I only allowed that to continue is because I knew the guy's license was expired. [57:20.740 --> 57:22.740] Oh, okay, okay. [57:22.740 --> 57:40.740] And I knew that I could take the judge's opinion and ruling that they did not have probable cause because he did not have a license and walk that right over into another court and say, hey, this is what the judge ruled over there. [57:43.740 --> 57:56.740] I had that kind of as a backup plan just in case because I also know that the vehicle storage facility has no insurance because the state revoked it. [01:03:44.740 --> 01:03:54.740] Before we went to break, we were talking about this due process hearing administrative court that falls under the transportation code [01:03:54.740 --> 01:04:02.740] that the clerk had apparently, quote, unquote, it would seem railroaded Chris to file his case [01:04:02.740 --> 01:04:07.740] when Chris was actually going to file a state lawsuit against this tow truck driver. [01:04:07.740 --> 01:04:18.740] Well, under normal circumstances, if he'd had a license, a valid license, you wouldn't want to file suit in that court [01:04:18.740 --> 01:04:20.740] because it's completely inapplicable. [01:04:20.740 --> 01:04:23.740] It's a non-sequitur. [01:04:23.740 --> 01:04:25.740] It wouldn't fall under the transportation code. [01:04:25.740 --> 01:04:31.740] There's a private car on private properties, a private civil matter, possibly even a criminal matter, [01:04:31.740 --> 01:04:34.740] but not anything that would fall under the transportation code. [01:04:34.740 --> 01:04:41.740] But because the guy didn't have a license, that's why Chris decided to go ahead and pursue it in that particular court. [01:04:41.740 --> 01:04:48.740] So I just wanted to make that clarification that if the guy did have a license, you probably wouldn't really want to do it in that court. [01:04:48.740 --> 01:04:53.740] You would want to withdraw and go into a standard court, possibly even federal court. [01:04:53.740 --> 01:04:56.740] Okay, this is an issue I wanted to look at. [01:04:56.740 --> 01:05:08.740] I suspect that the tow truck driver hears that the towing company is going to fall under the transportation code. [01:05:08.740 --> 01:05:15.740] And that's why you'd be able to take it to a hearing under transportation code, [01:05:15.740 --> 01:05:26.740] because you were subject to it because he was, because he was operating a business using the public thoroughfare. [01:05:26.740 --> 01:05:33.740] So that would put him under transportation code. [01:05:33.740 --> 01:05:40.740] Randy, how does that allow him to come onto private property under the guise of a contract? [01:05:40.740 --> 01:05:42.740] That's what I was going to say. [01:05:42.740 --> 01:05:45.740] What does that have to do with transportation? [01:05:45.740 --> 01:05:52.740] Because if he is operating under private contract and showing a car off private property, [01:05:52.740 --> 01:05:55.740] I don't see how the transportation code could possibly apply at all. [01:05:55.740 --> 01:06:02.740] His licensing and the operation of his business, it's just like if he was hauling product, [01:06:02.740 --> 01:06:11.740] if he came to a warehouse, if the warehouse is private property and he picks up materials and then he transports them somewhere else. [01:06:11.740 --> 01:06:20.740] This guy came and picked up your car for the purpose of transporting it on the public thoroughfares for pay. [01:06:20.740 --> 01:06:23.740] That puts him under transportation code. [01:06:23.740 --> 01:06:35.740] So I'm certain that, I haven't looked it up yet, but the towing activity is going to be regulated under the transportation code, [01:06:35.740 --> 01:06:46.740] because it is a business that is specifically about transporting automobiles for pay on the public thoroughfares. [01:06:46.740 --> 01:06:49.740] And that's probably what would bring him there. [01:06:49.740 --> 01:06:51.740] But haven't looked it up yet. [01:06:51.740 --> 01:06:53.740] Does that make sense? [01:06:53.740 --> 01:06:55.740] Yeah, that makes sense. [01:06:55.740 --> 01:06:58.740] I agree with you on him being under it. [01:06:58.740 --> 01:07:00.740] Right, you're not. [01:07:00.740 --> 01:07:13.740] They dragged you into it by making you go through this probable cause hearing to determine whether or not the individual who was in the transportation code [01:07:13.740 --> 01:07:16.740] had probable cause to take your property to begin with. [01:07:16.740 --> 01:07:19.740] Yeah, you're not the one being brought to court. [01:07:19.740 --> 01:07:21.740] He is. [01:07:21.740 --> 01:07:27.740] So he's the one that's being drugged into court by you, and this would challenge his license. [01:07:27.740 --> 01:07:31.740] Well, see, that was my question regarding the probable cause hearing. [01:07:31.740 --> 01:07:40.740] Was this a probable cause hearing to determine if the tow truck driver did anything wrong, or if your daughter did anything wrong? [01:07:40.740 --> 01:07:49.740] Well, the way the judge explained it at the very beginning of the hearing on the first hearing we had was she said, [01:07:49.740 --> 01:07:58.740] this is a probable cause hearing to determine whether or not the tow driver had probable cause to tow your car. [01:07:58.740 --> 01:08:04.740] In other words, if your daughter did anything wrong, that went out of the way. [01:08:04.740 --> 01:08:11.740] No, this was to see if the tow truck driver had authority to do what he did. [01:08:11.740 --> 01:08:22.740] To see if the tow truck driver, if there was probable cause for the tow truck driver to do what he did, which to me indicates to make a determination [01:08:22.740 --> 01:08:28.740] if Chris's daughter did anything wrong that would warrant probable cause for this tow truck driver to do something. [01:08:28.740 --> 01:08:34.740] In other words, the daughter is the one who's on the hot seat here, not the tow truck driver. [01:08:34.740 --> 01:08:38.740] That's why I was saying I don't see how that court would apply. [01:08:38.740 --> 01:08:41.740] She wasn't in transportation. She was on private property. [01:08:41.740 --> 01:08:45.740] You see, the driver's being, he's the defendant here. [01:08:45.740 --> 01:09:00.740] So the one who drags him into court, they have to come up first and give prima facia evidence that his act was improper. [01:09:00.740 --> 01:09:04.740] So she's the plaintiff. She's not the defendant here. [01:09:04.740 --> 01:09:13.740] So she has to make a prima facia case. He doesn't have to prove anything until a prima facia case has been made against him. [01:09:13.740 --> 01:09:23.740] And once a prima facia case has been made, then he has to address the burden shifts to him. [01:09:23.740 --> 01:09:32.740] Just like you get a ticket, the prosecution has to make their case first before you have to respond. [01:09:32.740 --> 01:09:40.740] So here we've all watched these TV programs where somebody put on a case and the defendant, after the prosecutor got finished, [01:09:40.740 --> 01:09:49.740] the defendant stands up and says, I move for summary dismissal as the prosecution failed to prove its case. [01:09:49.740 --> 01:09:52.740] If they don't prove the case, you don't have to defend. [01:09:52.740 --> 01:09:54.740] So that's why the daughter had to tell her story. [01:09:54.740 --> 01:10:02.740] And in no case under any kind of threat or obligation here, only he was. [01:10:02.740 --> 01:10:18.740] And it was probably the transportation code that stipulated this hearing and designated the justice of the peace as the person to preside over the hearing. [01:10:18.740 --> 01:10:23.740] Eddie would probably know that. [01:10:23.740 --> 01:10:31.740] And the thing that really, this is why for anybody listening, this is why you don't want to have to go to one of these little hearings, [01:10:31.740 --> 01:10:41.740] because your individual cities have city ordinances that govern these particular issues. [01:10:41.740 --> 01:10:45.740] The state statute even says that it allows for it. [01:10:45.740 --> 01:10:52.740] But when you get to the justice of the peace court, she immediately tells you, I cannot hear city ordinance. [01:10:52.740 --> 01:10:55.740] That's because of the nature of the hearing. [01:10:55.740 --> 01:11:08.740] If you were to bring accusations against the towing company based on city ordinance, you'd bring that to the municipal court. [01:11:08.740 --> 01:11:10.740] The JP can't adjudicate. [01:11:10.740 --> 01:11:12.740] He's a county official. [01:11:12.740 --> 01:11:18.740] I mean, he can't address municipal court issues. [01:11:18.740 --> 01:11:22.740] So that would have to go to a municipal court and JP was right. [01:11:22.740 --> 01:11:24.740] He could only address the state issues. [01:11:24.740 --> 01:11:34.740] And I suspect he's going to have specific authority concerning transportation code issues, which we already know he does because he here's tickets. [01:11:34.740 --> 01:11:44.740] So actually it would seem that if he's under the same authority that he has otherwise in the transportation code, [01:11:44.740 --> 01:11:48.740] the municipal court would be able to hold this hearing as well. [01:11:48.740 --> 01:11:53.740] Well, the municipal courts where it goes when they go on appeal. [01:11:53.740 --> 01:11:56.740] No, no, that'll go to the county. [01:11:56.740 --> 01:12:02.740] Hmm. They told me over there that it went to the, because we asked them if they do appeal it, where's it going to go? [01:12:02.740 --> 01:12:05.740] And she said it'll go to the municipal court. [01:12:05.740 --> 01:12:09.740] Absolutely not ever going to happen. [01:12:09.740 --> 01:12:15.740] The municipal court judge is an appointed official. [01:12:29.740 --> 01:12:39.740] Well, I definitely take your word for it more than I take theirs because they also did not know what rules govern that court over there. [01:12:43.740 --> 01:12:49.740] But here we're talking about strictly a transportation code issue, but it's going to be the same as a ticket. [01:12:49.740 --> 01:12:53.740] Tickets under transportation code as well. [01:12:53.740 --> 01:13:02.740] If a ticket is issued by a municipal police officer, a municipal judge can hear transportation code issues. [01:13:02.740 --> 01:13:11.740] So it may be that this towing company is primarily governed by the county. [01:13:11.740 --> 01:13:15.740] And that's why the justice of the piece here is it. [01:13:15.740 --> 01:13:22.740] If you're given a ticket outside of municipality, then the JP hears it. [01:13:22.740 --> 01:13:27.740] If you're given a ticket inside of municipality, the municipal court hears it. [01:13:27.740 --> 01:13:38.740] But if this towing company is governed county-wide, then by the county, then it would almost certainly go to the JP. [01:13:38.740 --> 01:13:42.740] And that's probably why the venue went where it did. [01:13:42.740 --> 01:13:50.740] But before we went to the break, you asked me about perjury, an aggravated perjury. [01:13:50.740 --> 01:13:51.740] Yes, sir. [01:14:27.740 --> 01:14:35.740] Or he makes a false, unsworn declaration under Chapter 132, Civil Practice and Remedies Code. [01:14:35.740 --> 01:14:37.740] I haven't looked that one up yet. [01:14:37.740 --> 01:14:40.740] Then offense under this section is a class A misdemeanor. [01:14:40.740 --> 01:14:44.740] Aggravated perjury, 37.03. [01:14:44.740 --> 01:14:50.740] A person commits an offense if he commits perjury as defined in 3702, [01:14:50.740 --> 01:14:57.740] and the false statement is made during or in connection with an official proceeding, [01:14:57.740 --> 01:15:00.740] and is material. [01:15:00.740 --> 01:15:05.740] And offense under this section is a felony of a third degree. [01:15:05.740 --> 01:15:18.740] So in your account, materiality, 37.04, a statement is material regardless of the admissibility of the statement under the rules of evidence [01:15:18.740 --> 01:15:25.740] if it could have affected the course or outcome of the official proceeding. [01:15:25.740 --> 01:15:37.740] It is no defense to prosecution under 37.03, Aggravated Perjury, that the death are mistakenly believed the statement to be immaterial. [01:15:37.740 --> 01:15:44.740] Whether a statement is material in a given factual situation is a question of law. [01:15:44.740 --> 01:15:47.740] There you have it. [01:15:47.740 --> 01:15:52.740] So if you lie on an affidavit, that's perjury. [01:24:35.740 --> 01:24:40.740] The police, when they call for a tow, they have this list [01:24:40.740 --> 01:24:42.740] They have this rotation list [01:24:42.740 --> 01:24:46.740] Yeah, they go down the list and they just take one after the other [01:24:46.740 --> 01:24:50.740] It's kind of like a point in court upon a council, they do the same thing [01:24:50.740 --> 01:24:53.740] So they're involved with the cities [01:24:53.740 --> 01:24:58.740] If there's entanglement [01:24:58.740 --> 01:25:06.740] You can wind up with public officials getting entangled in this issue [01:25:06.740 --> 01:25:09.740] And this all goes to politics [01:25:09.740 --> 01:25:15.740] And it goes to the big fish while on the little fish [01:25:15.740 --> 01:25:22.740] And in the overall scheme of things, the towing companies are relatively little fish [01:25:22.740 --> 01:25:30.740] So if you can make the big fish nervous enough, they'll swallow the little fish for you [01:25:30.740 --> 01:25:36.740] Or they will feed you the little fish to keep you from eating them [01:25:36.740 --> 01:25:39.740] This could get real interesting [01:25:39.740 --> 01:25:41.740] But the way to... [01:25:41.740 --> 01:25:47.740] And pre-negation discovery is a good way to get them to come to you and say, hey [01:25:47.740 --> 01:25:50.740] Let's make a deal [01:25:50.740 --> 01:25:54.740] What can we do to make this go away? Requirements for a private property towing permit [01:37:55.740 --> 01:38:01.740] A private property towing permit is required for a truck used to perform a non-consent tow [01:38:01.740 --> 01:38:09.740] authorized by a parking facility owner under this chapter to be eligible for a private property towing permit [01:38:09.740 --> 01:38:19.740] An applicant must submit evidence that the tow truck is equipped to tow light or heavy duty vehicles according to manufacturer's towing guidelines [01:38:19.740 --> 01:38:28.740] The applicant has at least 300,000 of liability insurance and the applicant has at least 50,000 of cargo insurance [01:38:28.740 --> 01:38:38.740] Well, if they don't have this insurance, they have, what do you call it? Not revoked, but they have voluntarily rescinded their license as a permit [01:38:54.740 --> 01:39:13.740] And issues here, this one, since the private property company, the towing facility that is using these people [01:39:13.740 --> 01:39:23.740] I mean, the parking facility that's using these people would have knowledge that that requirement was not being met [01:39:23.740 --> 01:39:28.740] That would make them culpable [01:39:28.740 --> 01:39:32.740] I don't know that she'd be able to make that connection [01:39:32.740 --> 01:39:51.740] Oh, this, okay, if this is a requirement, the tow truck company is going to have to have their insurance carrier provide evidence of liability insurance [01:39:51.740 --> 01:40:01.740] And this is really standard practice, every company I worked for, I had to provide them with evidence of my insurance [01:40:01.740 --> 01:40:09.740] And if anything changed on my insurance policy, everyone they have noticed gets noticed immediately [01:40:09.740 --> 01:40:29.740] So the private parking facility owner would have knowledge that this towing company lacked the proper insurance in order to maintain a permit [01:40:29.740 --> 01:40:39.740] So their permit is invalid because they don't no longer meet the requirements, and this facility would know that [01:40:39.740 --> 01:40:53.740] So this apartment complex knew as a matter of law that this towing operator lacked the permit because they lacked the proper insurance [01:40:53.740 --> 01:40:59.740] Ah, and then what section were you looking at there again Randy? [01:50:01.740 --> 01:50:09.740] The city has to keep records of this for two years and then they get a copy, a report from the tow company [01:50:09.740 --> 01:50:18.740] For every car they tow, either incident management control or your tow or non-consent tow [01:50:18.740 --> 01:50:25.740] They get a report from the tow companies every week on Monday [01:50:25.740 --> 01:50:30.740] So you could simply request these reports from this company and get them all [01:50:30.740 --> 01:50:32.740] This is good [01:50:32.740 --> 01:50:36.740] Yes, what you want to do is, I don't know about every other city so far [01:50:36.740 --> 01:50:44.740] But in the city of Fort Worth and the city of Dallas, you would request these from the city manager [01:50:44.740 --> 01:50:46.740] Wonderful [01:50:46.740 --> 01:50:50.740] So you've got some homework to do [01:50:50.740 --> 01:50:55.740] You might find out getting paid well for this [01:50:55.740 --> 01:51:02.740] We have been like hound dogs on this, I'm sorry, bloodhounds [01:51:02.740 --> 01:51:05.740] We have just been following the trail [01:51:05.740 --> 01:51:12.740] When I take these on, that's always what I do, I just follow the thunder [01:51:12.740 --> 01:51:18.740] Just follow it where it leads you, but if you pay attention and think about it [01:51:18.740 --> 01:51:26.740] Each step you take, you look at it and ask yourself what are the implications [01:51:26.740 --> 01:51:30.740] Who else is implicated? [01:51:30.740 --> 01:51:37.740] In this case, you have a towing company, so who else has something to do with this towing operator? [01:51:37.740 --> 01:51:45.740] And here you have an operator that cannot have a permit because his insurance has been revoked [01:51:45.740 --> 01:52:00.740] He specifically, expressly says in the statute that no one with a felony background can have or own a vehicle storage facility or towing company [01:52:00.740 --> 01:52:08.740] And you have direct evidence that the owner has a felonies background [01:52:08.740 --> 01:52:12.740] Yes, publicdata.com [01:52:12.740 --> 01:52:20.740] Then this goes to city manager [01:52:20.740 --> 01:52:26.740] This was his job to ensure that this company wasn't used [01:52:26.740 --> 01:52:38.740] He has placed the city at serious risk because the towing operator is not indemnified by insurance [01:52:38.740 --> 01:52:43.740] That leaves the city open for any harm the tow driver causes [01:52:43.740 --> 01:52:47.740] So you'd have to sue the city as well [01:52:47.740 --> 01:52:49.740] Okay [01:52:49.740 --> 01:52:52.740] Is this still going to fall in state court? I said no I didn't [01:57:08.740 --> 01:57:10.740] You didn't, no I didn't [01:57:10.740 --> 01:57:13.740] Well who created it? Oh the computer did [01:57:13.740 --> 01:57:19.740] Oh well, how do you know all these figures are right?
