[05:00.000 --> 05:08.000] The very homeowner did it. I looked in New Jersey and Pennsylvania and they've got similar laws on fraud. I had all the laws on it for Pennsylvania and how I put it together for a quiet title and everybody's got to do it to get ahead. [05:23.000 --> 05:40.000] Yes, I've been moving toward a quiet title, but in looking at the issues that are there, I'm looking to go for something before a quiet title. [05:40.000 --> 05:54.000] In Texas, we have a special law they put in to screw the Republic of Texas and that gave us a really backdoor way of sticking it to the lender. [05:54.000 --> 06:08.000] I haven't found something comparable in most other states, but I am finding various laws that give us tools like in California. [06:08.000 --> 06:20.000] The clerk is forbidden to file a document that doesn't meet the statutory requirements. It's considered a class A misdemeanor if the clerk does. [06:20.000 --> 06:27.000] So we can go in and say that the clerk filed this document, but it's fraudulent. [06:27.000 --> 06:46.000] And the clerk violated the law. She had no power to file this document because she did that. I was harmed and we asked the court to rule that this document is avoided and no force of effect to eliminate this harm caused by the clerk. [06:46.000 --> 06:57.000] So we're giving the court a political reason to give us the judicial decision that we want. [06:57.000 --> 07:07.000] I'd like to look in Pennsylvania everywhere. We're going to have access to a declaratory judgment. [07:07.000 --> 07:16.000] But a petition for declaratory judgment brings in both sides into an evidentiary hearing. [07:16.000 --> 07:26.000] I was looking for ways that have to be there in each state to correct errors in the public record. [07:26.000 --> 07:37.000] Say we see errors in your record that would say a document was filed in a case that's gone to probate. [07:37.000 --> 07:49.000] And the person who was involved at the time or possibly both of them are passed away. [07:49.000 --> 07:58.000] And we say this document was filed and harmed this person. And it was filed for this other guy, but they're both dead. [07:58.000 --> 08:11.000] So we can't have an evidentiary hearing and call them into court. What remedy do you have to correct this record? [08:11.000 --> 08:22.000] In every state, because the county records are so important, every state is going to have some remedy. [08:22.000 --> 08:32.000] I'm looking to find them where we can go in and ask the court to look at this document, look at the four corners on the document. [08:32.000 --> 08:42.000] We are from the four corners of the document that doesn't need to find and stand requirements and ask the court to rule that the document is void and no force of effect. [08:42.000 --> 08:55.000] Then we go for quiet title. Now we can go into quiet title with rest of your card. Does that make sense to us? [08:55.000 --> 09:01.000] Yeah, in that way, yeah. That could do it, too. [09:01.000 --> 09:11.000] Is there anything in Pennsylvania that you know of, any mechanism for correcting errors in the public record? [09:11.000 --> 09:16.000] The only way I know is to bring it before a judge. [09:16.000 --> 09:32.000] Well, okay, I understand that, but is there a method of doing that that is singular, or is the only method that you have a petition for declaratory judgment? [09:32.000 --> 09:45.000] I think it's a petition for declaratory judgment, and if the other parties can't be there in their disease, then someone would have to represent their estate, and that's who they would bring in, I would imagine. [09:45.000 --> 09:52.000] Yeah, well, we have one here in Texas where the other side doesn't get to show up. [09:52.000 --> 10:09.000] And if a document is clearly void on its face, for instance, we have a document that is required to be verified, and the document contains no jurret. [10:09.000 --> 10:19.000] There's nothing to argue here. This document on its face absolutely does not meet filing requirements. [10:19.000 --> 10:32.000] Would we have to go to court, call both the person who filed it, the person who was filed against, and have a debate over whether or not this met the requirements? [10:32.000 --> 10:47.000] I would think the courts would have put in an expedited procedure that would allow the court to look at this and say, yeah, there's no way this thing meets the filing requirements, and rule that it's void. [10:47.000 --> 11:06.000] Now, I have no problem with notifying the other side, but having an evidentiary hearing and legal argument on a document that is obviously fraudulent, or obviously insufficient, would seem judicially uneconomical. [11:06.000 --> 11:11.000] So I'd hope that there's something there. You might talk to the courts and see who can find something. If the trace is there, if there is law allowing this, but it's simply not used, then you might go to the clerk and say, you know, they've screwed up your records and made this whole mess. [15:14.000 --> 15:20.000] So he got his default judgment against the original lender not knowing there was another lender. [15:20.000 --> 15:26.000] And that showed up on the records after the default judgment was entered. [15:26.000 --> 15:37.000] And so he had to add him to the lawsuit. And I don't understand. Does the, what does the list pendant, notice the list pendants do? [15:37.000 --> 15:44.000] Doesn't that put the new lender in the shoes of the other lender? And if neither one of them answered, isn't it a default against both of them? [15:44.000 --> 15:58.000] No, it puts the purchaser in the position that he cannot complain when he purchases the property that there is litigation against it. [15:58.000 --> 16:03.000] It doesn't give him a claim because he knew it was there. [16:03.000 --> 16:04.000] Oh, I see. [16:04.000 --> 16:23.000] So if you come in and sue and the suit's already there, if you win the suit, you get the property back. That means that the purchaser can't come in and raise an issue because he had full knowledge that the claim was there when he purchased the property. [16:23.000 --> 16:33.000] That's what the list pendants is for. And it generally scares away a buyer because they do not want to be put in that position. [16:33.000 --> 16:41.000] But it's enough when you purchase a property or a foreclosure that you can show it to a pair of. If there's a list pendants, it's even worse. [21:50.000 --> 22:02.000] Hold on just a second. When I mentioned earlier that we had a special law in Texas, that's what Ramon was referring to, Chapter 51 of the government code. [22:02.000 --> 22:10.000] The Republic of Texas had been filing these liens against public officials, and technically the liens were legal. [22:10.000 --> 22:19.000] They weren't being used the way they were actually intended, but technically they were legal and these officials were having a heck of a time with them. [22:19.000 --> 22:32.000] So they got this legislation passed that let them sneak into the court, filing a pleading with the court, there's no oral argument, the judge makes his ruling based on that pleading, [22:32.000 --> 22:44.000] the other side's not even notified and they just tossed the lien. So they did that to get rid of these liens that were technically legal, but they were causing these guys problems. [22:44.000 --> 22:53.000] So we worked for them. The problem is we get to use against the banks. Okay, go ahead. [22:53.000 --> 23:09.000] So, okay, so on the subject of the banks now, in regard to the note, my most recent experience recently I received a letter, and here's, you know, first off, you know, I don't know if your callers know, [23:09.000 --> 23:26.000] but, you know, we look up the U.S., the UCC code under Article III of the Negotiable Instruments under Section 301, and it talks about enforceable, who's able to enforce those negotiable instruments, right? [23:26.000 --> 23:38.000] So basically this is the holder of that note, right? So here's a response I've recently gotten, and it says, quote, we cannot provide you with the original mortgage note. [23:38.000 --> 23:54.000] As it needs to be retained, since it documents your obligation to make payments on your mortgage stop in lieu of providing or allowing inspection of the original copy of the note we have enclosed, [23:54.000 --> 24:06.000] herewith a true and correct copy of the original note, unquote. The copy is a copy from the title company's copy. So it's a copy of a copy. [24:06.000 --> 24:17.000] So this is just, I don't even know what to say. Does anybody else out there, anyone else out there? [24:17.000 --> 24:20.000] You should send them a thank you note. [24:20.000 --> 24:30.000] You've got to hold the note. You don't send someone a copy of a copy and say, oh, I have all claims to your anything. It could be your typewriter, it could be your computer, whatever, you know, your car, who cares? [24:30.000 --> 24:32.000] It's a copy of a copy, something that you owe me. [24:32.000 --> 24:42.000] Okay, what you need to do is take their copy, scan it in at about 600 dpi. [24:42.000 --> 25:00.000] Okay, and then do optical character recognition on it, go in and change a few paragraphs and then print it out and make a copy of that [25:00.000 --> 25:05.000] and give it to them and say, is this the copy you sent me? [25:05.000 --> 25:08.000] They'll look at it and say, oh yeah, it is. [25:08.000 --> 25:17.000] But if you read this paragraph, this is a problem with these copy notes. [25:24.000 --> 25:38.000] You gave me something that I can take to a jury of reasonable people and they'll listen to that and they will all think, are you kidding me? [25:38.000 --> 25:57.000] You're saying that because you have a loan and you're holding this note as security for the obligation, nobody can look at it? [26:39.000 --> 26:42.000] I think it's under the Housing and Urban Development. [26:42.000 --> 26:50.000] 3044 is the Fannie Mae Freddie Mac. [26:50.000 --> 27:10.000] Right. And under the definitions, subsection E or section E of definitions on the actual form from Freddie Mac, it talks about, well, it moves on to what is line F on mine, [27:10.000 --> 27:20.000] my copy of the deed of trust. And in my copy of the deed of trust, which I'm sure probably everyone else's deed of trust copy, it has section E has MERS inserted into there. [27:20.000 --> 27:26.000] And if you go down to the transfer section. [27:26.000 --> 27:28.000] Oh, exactly. [27:28.000 --> 27:40.000] And when I do an evaluation, I take the deed of trust and I build a statement of facts. I say on this day at this time, a document is filed with the County Rec. [27:40.000 --> 27:49.000] The corridor titled as follows, and I copy out the title of the document, deed of trust, I drop it on the page. [27:49.000 --> 27:59.000] I say this document was provided to the borrower at closing by the closing trustee and contains the following footer. [27:59.000 --> 28:02.000] And I drop that in there. [28:02.000 --> 28:10.000] The judge when he reads that he's going to look at that and say, what do you put that in there for? [28:10.000 --> 28:16.000] And then I'll go down the document defines itself as a security instrument under paragraph A. [28:16.000 --> 28:21.000] Under paragraph B, it defines the borrower. Under C, it defines the lender. [28:21.000 --> 28:25.000] Under D, D and E sometimes switched. [28:25.000 --> 28:34.000] D is usually the trustee and then E is MERS and then F is the note. [28:34.000 --> 28:43.000] And then I go down to the transfer section and some of them will transfer the property to the trustee. [28:43.000 --> 28:47.000] Others will transfer the property to MERS. [28:47.000 --> 28:59.000] Right under the transfer section, the next paragraph, that's the tricky one. [28:59.000 --> 29:04.000] That paragraph, if MERS is involved in the deed of trust, [29:04.000 --> 29:17.000] that paragraph has language and has a front so I can read it, that takes the powers that were intended to be in the hand of MERS, [29:17.000 --> 29:22.000] I'm sorry, in the hand of the trustee and gives it to MERS. [35:07.000 --> 35:19.000] So we go to the judge and say, at closing, I'm not a sophisticated borrower, so I exercised [35:19.000 --> 35:26.000] due diligence and only used licensed professionals to protect my interest. [35:26.000 --> 35:35.000] At closing, I used a licensed professional closing agent as a trustee. [35:35.000 --> 35:39.000] And the agent produced the documentation used at closing. [35:39.000 --> 35:46.000] And since he was a trustee, it was his place to be a neutral party to ensure that both [35:46.000 --> 35:49.000] sides were treated fairly. [35:49.000 --> 35:57.000] He presented this document as if it were a uniform, Fannie Mae Freddie Mac, Fannie Mae [35:57.000 --> 36:01.000] Freddie Mac Uniform Instrument Number 344. [36:01.000 --> 36:13.000] When, in fact, it was no such thing that it contained, buried in the document, sentences [36:13.000 --> 36:20.000] that dramatically changed the nature of the document from a deed of trust. [36:24.000 --> 36:31.000] But down in the document, it takes all the power and authority that the trustee would [36:31.000 --> 36:37.000] have, and it gives it to the MERS who's defined as the beneficiary. [01:22:12.800 --> 01:22:15.800] We were never served with bankruptcy attorney. [01:22:15.800 --> 01:22:20.800] Okay, how did the garnishment take effect? [01:22:20.800 --> 01:22:24.800] Was it by court order? [01:22:24.800 --> 01:22:27.800] Well, I suppose it was. [01:22:27.800 --> 01:22:30.800] So, does that suffice? [01:26:40.800 --> 01:26:53.800] Because of one of these garnishments, we were forced into bankruptcy which was a business bankruptcy and I got blindsided and Fannie Mae came to have a relief from stay in order to take the house. [01:26:53.800 --> 01:27:00.800] And so we lost our objection and I filed an appeal and we should go today. [01:27:00.800 --> 01:27:05.800] And I have filed a request for a stay pending appeal. [01:27:05.800 --> 01:27:15.800] That's kind of where we are and then the goal is to get back, I think, into the state court and either go for quiet title and or wrongful foreclosure. [01:27:15.800 --> 01:27:16.800] Okay. [01:27:16.800 --> 01:27:23.800] So you lost your objection for the motion for automatic relief, huh? [01:27:23.800 --> 01:27:31.800] We did. The bankruptcy was discharged last week and it was at the lower level, yes. [01:27:31.800 --> 01:27:38.800] Fannie Mae brought a deed of trust where they had purchased the house or had been assigned to them from... [01:27:38.800 --> 01:27:47.800] Chase brought the foreclosure and then purchased the house at trustee's auction and then 13 days later assigned it to Fannie Mae. [01:27:47.800 --> 01:27:52.800] And based on that, so now I filed an appeal. [01:27:52.800 --> 01:27:54.800] Okay. [01:27:54.800 --> 01:27:59.800] Well, so your loan is that Fannie Mae is involved in it. [01:27:59.800 --> 01:28:03.800] That would mean that your loan is privately securitized. [01:28:03.800 --> 01:28:10.800] I do want to, just like I told Randy the other day, when it comes to private, let me give you an explanation. [01:28:10.800 --> 01:28:16.800] A public security is a security that is registered with the Securities and Exchange Commission. [01:28:16.800 --> 01:28:30.800] There is a specific rule called Rule 144A with the SEC that basically provides an exemption for registration with the SEC. [01:28:30.800 --> 01:28:48.800] This particular rule, Fannie Mae, Freddie Mac, and Genie Mae are included in it, which means that anything including a Fannie Mae, Freddie Mac, or a Genie Mae trust is not going to be registered publicly, which means that the investigating [01:28:48.800 --> 01:29:03.800] and the level of height and data subscription services that are required for that make the investigating tougher and require more time as well as more resources. [01:29:03.800 --> 01:29:16.800] So when it gets to private securities, I also want you to know that Freddie Mac, for example, only started giving out loan level details since 2005. [01:29:16.800 --> 01:29:23.800] Fannie Mae, on the other hand, just started in the beginning of 2012, I think it was about February, March. [01:29:23.800 --> 01:29:37.800] When I say loan level details, what that means is the actual details of the trust by loan information, so interest rates, type of loan, and so forth. [01:29:37.800 --> 01:29:47.800] So when it comes to private security, in some cases that information is not readily available, and I'll talk to you a little bit more on the other side. [01:34:32.800 --> 01:34:44.800] And the three databases that we use would be your Bloomberg database, your black box logic, and also ABS net and ABS net loan. [01:34:44.800 --> 01:34:58.800] Those three databases collect data from servicer tapes and also harvest data from Fannie Mae and Freddie Max and BS search online searches. [01:34:58.800 --> 01:35:12.800] However, like I said, Fannie Mae just started giving out low level details in 2012, which means that when it comes to investigating these private securities, [01:35:12.800 --> 01:35:22.800] what we can do in most cases is narrow it down to two or three trusts that we believe your loan is located in. [01:35:22.800 --> 01:35:30.800] But because we can't look at low level details, we can't really give a thorough yes, this is where your loan is in. [01:35:30.800 --> 01:35:47.800] What we do is we do the investigation based on the understanding that the way that the investigation needs to be written and worded and conducted is specifically to give the borrower and their attorney, [01:35:47.800 --> 01:36:02.800] or and or attorney enough leg to stand on to get motions of discovery granted so that way you can go ahead and request specific information from the two to three trusts that we find. [01:36:02.800 --> 01:36:14.800] The way that we generate the report though is we pick based on a statistical equation the highest probability trust that we believe your loan is located in. [01:36:14.800 --> 01:36:26.800] And then we do the investigation on that one, but then we provide you with also the other two to three trusts that we believe that your loan could possibly be in as well. [01:36:26.800 --> 01:36:40.800] So we have to give that disclaimer out to people because it is a tougher battle when you have Fannie and Freddie Max just because it's not a sure shot that we know which trust your loan is in. [01:36:40.800 --> 01:36:51.800] Then the second thing is, on a Fannie and Freddie Mac trust, you have to understand that the paperwork that they use is extremely boilerplate. [01:36:51.800 --> 01:36:58.800] And so what I mean by that is Fannie Mae, for example, uses an offering circular supplement. [01:36:58.800 --> 01:37:07.800] And we've seen it many times where the same offering circular supplement is used for the entire year. [01:37:07.800 --> 01:37:13.800] So the hundreds of trusts that Fannie Mae created that year all are based on the same document. [01:37:13.800 --> 01:37:17.800] All they have is just minor changes specific to the trust. [01:37:17.800 --> 01:37:31.800] So the nice thing about Fannie and Freddie Mac is the fact that they use the universal documentation as we already know their promissory notes and the deed of trust and mortgage were universal for them, the uniform documentation. [01:37:31.800 --> 01:37:34.800] Same thing goes with the trust documents. [01:37:34.800 --> 01:37:58.800] So that does give you a nice way of attacking in court because even though you don't know which trust for 100% fact that your loan is in, you do know that most likely all of the trust that we believe your loan is in use the same paperwork. [01:37:58.800 --> 01:38:08.800] So when you're going into court with the investigation, it is completely going to be built around the fact that discovery needs to happen. [01:38:08.800 --> 01:38:33.800] And that's the way that the investigation is conducted in a manner in which you are able to provide the investigation and allow the judge in the court to understand that due to the fact that these institutions, Fannie and Freddie Mac and Ginny Mae conducted business privately, you must go through the discovery process. [01:38:33.800 --> 01:38:52.800] And from a lot of people that I speak to, ranging from attorneys to, you know, legal paraprofessionals and paralegals and so forth, as long as you can get to discovery and the specific documents that you asked for, your chances of winning have just exponentially grown for you. [01:38:52.800 --> 01:39:08.800] So that's the way that we purposely draft up the investigation. But again, the disclaimer is there is no exact loan match because it's not public information. [01:39:08.800 --> 01:39:35.800] Okay. Does that make sense, Francis? It does. It's not a kind of news I wanted to totally hear. Yeah, I know. Francis, the argument that you take into the courtroom is the fact that 55% of the market of securitization was securitized by Fannie Mae, Freddie Mac and Ginny Mae. [01:39:35.800 --> 01:39:53.800] And the fact that these institutions had the ability to privatize and hide these things from the American public should give you enough standing to be able to probe your private eye, if you will, on specific trust that you believe your loan is in. [01:39:53.800 --> 01:40:02.800] But we do our best to narrow it down to two. Sometimes there's three, but we do our best to narrow it to two. [01:40:02.800 --> 01:40:21.800] So that way you're not requesting discovery on like 100 different trusts because there's no way a judge is going to grant that. But if there's one or two, the judge in many cases will allow you to and will grant the different discovery motions that you are requesting. [01:40:21.800 --> 01:40:42.800] Yes, and we get Rule 12 motions because Vinder wants to avoid discovery at all costs because he's one aware that's when it really gets dangerous for him. And it looks like if you have Fannie Mae or Freddie Mac, because they are private, [01:40:42.800 --> 01:41:00.800] then that leaves you with your only solution is discovery. And that may well turn out to be an advantage because it's logical and reasonable to give discovery when the documentation is private. [01:41:00.800 --> 01:41:03.800] So it may help. [01:47:21.800 --> 01:47:28.800] And then it has on the site, defendant's name, and it has Jay Anderson and my address. [01:47:28.800 --> 01:47:38.800] It says that I'm supposed to be in court on August 27th that the violation has been changed from a misdemeanor to an infraction. [01:47:38.800 --> 01:47:44.800] Okay, that's a step down in California law. [01:47:44.800 --> 01:47:47.800] In California law, that's a step down, right? [01:47:47.800 --> 01:47:49.800] Right. [01:47:49.800 --> 01:48:04.800] But the thing about the infraction is, I don't know what infraction they're talking about, because the San Diego Code that she's quoting says that you're supposed to use ordinary care with your dog, which means your dog's supposed to be on the leash. [01:48:04.800 --> 01:48:13.800] My dog was never off the leash. This woman kept harassing me. She used the racial epitaph and told me, and I told you to get you and your dog out of here. [01:48:13.800 --> 01:48:16.800] She went to the hotel to try to get me to leave. [01:48:16.800 --> 01:48:35.800] So I'm trying to figure out how to start, whether I should start with the motion to dismiss for failure to state with specificity of charges, because the report that I was given when she supposedly praised me under civilian arrest is blank. [01:48:35.800 --> 01:48:44.800] I have no paperwork. So I don't even know what I'm being charged with, but I do know that this was racially motivated. [01:48:44.800 --> 01:48:50.800] Did you file a complaint against her, against the officer? No. [01:48:50.800 --> 01:48:54.800] I don't know. We don't have enough information to know how to talk about this. [01:48:54.800 --> 01:49:09.800] Okay, you have an idea. I filed a complaint against her, because before witnesses, several veterans that were at the conference were surrounding me, they told her that they heard her say that it's okay for her to lie. [01:49:15.800 --> 01:49:23.800] Did you get state, do you have these people's names so you can secure them as witnesses? Make them up, file them. Get affidavits from these folks. If you can get at least two witnesses to write you an affidavit, this woman has a problem. [01:49:57.800 --> 01:50:13.800] Then you can bring those complaints and affidavits to court and file them in the court record as evidence in support of your position. [01:50:19.800 --> 01:50:29.800] Okay, for the vicious dog, I've got an answer for her. I had the honor of being with the Vice President and the head of the VA this past weekend. [01:55:14.800 --> 01:55:33.800] Fatty, will you kind of give us an overview of what we can expect in a good effective securities analysis and how we can use that in court concerning a mortgage issue? [01:55:33.800 --> 01:55:53.800] Well, a great securitization investigation focuses a lot on the actual paperwork of the trust and then find specific things in the actual paperwork that have not been conducted by the actual parties to the trust. [01:55:53.800 --> 01:56:07.800] Let me give you an example. Obviously, the transfer of the loan into the trust, nine out of ten times, we find that it never was properly transferred to the trust. [01:56:07.800 --> 01:56:16.800] Also, in a securitization investigation, we do find random things that, let me give you an example of that one as well. [01:56:16.800 --> 01:56:40.800] The other day I did an investigation and in one of the parts of the prospectus supplement, it actually said that all loans that are MERS loans in the trust are not going to have original documentation transferred to the trust. [01:56:40.800 --> 01:57:04.800] Then two paragraphs below that, it stated that any defective documents missing, lost, or destroyed documents may prevent the servicer from collecting on the actual instrument. [01:57:04.800 --> 01:57:16.800] The reason why that's interesting is because two paragraphs above that specifically stated that original documentation is not going to be given to the trust or the trustee if the loan is in the name of MERS. [01:57:16.800 --> 01:57:25.800] And then two paragraphs below it, it states that if there is no original documentation, that it might prevent the servicer from actually collecting. [01:57:25.800 --> 01:57:39.800] The reason why that's interesting is because how do you say that if there isn't any actual original documentation or if it's destroyed or lost or whatever it may be, it may prevent the servicer from collecting. [01:57:39.800 --> 01:57:49.800] And then two paragraphs above it, you actually admit to the fact that all the loans that are MERS loans in the trust will not have documentation transferred to it. [01:57:49.800 --> 01:58:00.800] There are other things that we find, for example, in many cases servicers are not allowed to give out loan modifications according to the trust document. [01:58:00.800 --> 01:58:29.800] Yet they still misrepresent and neglect telling the truth to homeowners and they induce homeowners into, of course, missing out on payments to become qualified or to apply for loan modifications when in reality the trust that they are servicing the loan for has specifically banned the servicer from providing any loan modifications. [01:58:29.800 --> 01:58:33.800] Other things that the securitization investigation finds as a way to...
