[00:00.000 --> 00:05.680] If you're using pans with non-stick coating to scramble your eggs, you may want to stop. [00:05.680 --> 00:10.240] The makers of Teflon say their products are safe for consumer use, but some researchers [00:10.240 --> 00:11.240] disagree. [00:11.240 --> 00:15.800] I'm Dr. Catherine Albrecht and I'll give you the details in just a moment. [00:15.800 --> 00:17.520] Privacy is under attack. [00:17.520 --> 00:21.120] When you give up data about yourself, you'll never get it back again. [00:21.120 --> 00:26.120] And once your privacy is gone, you'll find your freedoms will start to vanish too. [00:26.120 --> 00:31.080] So protect your rights, say no to surveillance, and keep your information to yourself. [00:31.080 --> 00:33.880] Privacy, it's worth hanging on to. [00:33.880 --> 00:39.440] This message is brought to you by StartPage.com, the private search engine alternative to Google, [00:39.440 --> 00:41.200] Yahoo, and Bing. [00:41.200 --> 00:44.760] Start over with StartPage. [00:44.760 --> 00:47.920] No one can deny the convenience of non-stick cookware. [00:47.920 --> 00:52.200] Pancakes flip beautifully, eggs don't stick, and clean up sabris, but that sleek coating [00:52.200 --> 00:55.520] may not be so slick when it comes to your health. [00:55.520 --> 01:01.920] When pans coated with ammonium perfluoro octanoate, or C8, get too hot, they release toxic fumes [01:01.920 --> 01:04.560] into the air and into your food. [01:04.560 --> 01:11.320] C8 is carcinogenic, impairs fertility, raises cholesterol, damages the thyroid, and causes [01:11.320 --> 01:15.040] irreversible environmental pollution, few. [01:15.040 --> 01:20.720] Like canaries in a coal mine, thousands of pet birds have died for breathing Teflon fumes. [01:20.720 --> 01:23.840] Cast iron, glass, or stainless steel are much safer options. [01:23.840 --> 01:29.520] I'm Dr. Catherine Albrecht for StartPage.com, the world's most private search engine. [01:29.520 --> 01:36.600] Would you give up your ability to have children in exchange for a chance to win a blender? [01:36.600 --> 01:38.080] How about a TV? [01:38.080 --> 01:39.080] No? [01:39.080 --> 01:40.080] Can I tempt you with a car? [01:40.080 --> 01:44.360] I'm Dr. Catherine Albrecht, and I'll be back in just a moment with details on a bizarre [01:44.360 --> 01:46.840] birth control boondoggle. [01:46.840 --> 01:48.440] Privacy is under attack. [01:48.440 --> 01:52.840] When you give up data about yourself, you'll never get it back again, and once your privacy [01:52.840 --> 01:56.800] is gone, you'll find your freedoms will start to vanish too. [01:56.800 --> 02:01.840] So protect your rights, say no to surveillance, and keep your information to yourself. [02:01.840 --> 02:04.560] Privacy, it's worth hanging on to. [02:04.560 --> 02:08.880] This public service announcement is brought to you by StartPage.com, the private search [02:08.880 --> 02:12.400] engine alternative to Google, Yahoo, and Bing. [02:12.400 --> 02:14.760] Start over with StartPage. [02:14.760 --> 02:18.840] Remember all the fairy tales where someone gives up their firstborn child for something [02:18.840 --> 02:20.280] foolish like a cabbage? [02:20.280 --> 02:24.160] Well, in at least one state in India, couples can now do likewise. [02:24.160 --> 02:28.640] As part of a plan to reduce birth rates, the government is hoping couples will give up [02:28.640 --> 02:34.640] all future children for a chance to win prizes, like a car, a TV, or a blender. [02:34.640 --> 02:39.200] The program gives couples a lottery ticket in exchange for surgical sterilization and [02:39.200 --> 02:41.200] hopes to attract 30,000 couples. [02:41.200 --> 02:46.000] You'd think for all that it would be a great set of wheels, but last, the first prize is [02:46.000 --> 02:49.120] the Tata Nano, the world's cheapest car. [02:49.120 --> 02:51.320] I'm guessing the blender is even worse. [02:51.320 --> 02:53.200] I'm Dr. Catherine Albrecht. [02:53.200 --> 03:19.200] For more news and information at CatherineAlbrecht.com, you are listening to the Logos Radio Network, [03:19.200 --> 03:28.120] KTVU. [03:28.120 --> 03:55.840] Alright folks, good evening, this is Rule of Law Radio, it is May 7th, 2012, we are live [03:55.840 --> 04:01.760] tonight, I have come back from hiatus, I have recently relocated from the north side of [04:01.760 --> 04:08.000] Austin to the south side of Austin and internet service has been lacking seriously in the [04:08.000 --> 04:13.160] remote location I am currently in, so we do apologize for the archives that we've been [04:13.160 --> 04:18.240] having to run for the past couple of weeks, but hopefully after the middle of this week [04:18.240 --> 04:23.800] I will have permanent internet installed and will be able to go in, if the show has spotty [04:23.800 --> 04:28.160] sound or anything tonight, again that will be my fault, I am currently having to use [04:28.160 --> 04:34.200] a borrowed clear wireless connection out here where I am at and hopefully that will be sufficient [04:34.200 --> 04:39.720] despite the atmospheric interference we are soon going to be getting from the thundercloud [04:39.720 --> 04:45.480] cover that is over the area at the moment, okay, I really don't have anything set up [04:45.480 --> 04:50.880] for specific tonight, but I was threatened with blood beating if I didn't show up for [04:50.880 --> 04:55.320] the show tonight, but we just want to make sure that tonight we didn't want to leave [04:55.320 --> 05:02.880] you guys hanging too much, now there is something that we went over in our class yesterday dealing [05:02.880 --> 05:12.760] with an exercise that we did on how to make your outstanding objections right before you [05:12.760 --> 05:18.200] actually go in the trial and then there was a couple of other things that we went into, [05:18.200 --> 05:22.280] one of which was one of the folks from the class brought in an article from the Austin [05:22.280 --> 05:28.240] Police Department that was in the paper, it seems like the Austin Police Department wants [05:28.240 --> 05:36.720] to save money by not having to pay the county for locking people up in jail on traffic and [05:36.720 --> 05:46.240] parking tickets, what they want to do is set up an independent magistration court in which [05:46.240 --> 05:52.120] to take people rather than taking them to jail, guess what morons, that's what you're [05:52.120 --> 05:59.680] supposed to be doing anyway, you already have a municipal court, it's already open till [05:59.680 --> 06:07.360] 10 o'clock at night, it should be open 24 hours a day, if you're going to arrest people [06:07.360 --> 06:13.400] for this crap then you're supposed to be taking them to a magistrate, you're not supposed [06:13.400 --> 06:21.240] to be taking them to jail at all, it's not within your authority to imprison, only to [06:21.240 --> 06:29.560] arrest and deliver to a magistrate, oh but I forgot, most of you guys obviously can barely [06:29.560 --> 06:36.640] read and what you read you barely understand, if that wasn't true we wouldn't have a need [06:36.640 --> 06:44.400] for this show, that part should be rather obvious, now don't get me wrong, I do not [06:44.400 --> 06:50.360] dislike police officers, I do not dislike peace officers or anything of the like, I used [06:50.360 --> 06:59.400] to be one, but the point here is is that you took an oath to do a job a particular way [06:59.400 --> 07:08.160] under particular conditions and those conditions are not how you're operating, you're operating [07:08.160 --> 07:16.320] under somebody else's idea of how things should be rather than the idea that is put directly [07:16.320 --> 07:25.240] in the oath each of you had to take, which part of I shall support and defend the Constitution [07:25.240 --> 07:32.120] of the United States and this state are you guys not getting, when you were given a directive [07:32.120 --> 07:41.040] or told to enforce a law or statute or ordinance or regulation that obviously violates the [07:41.040 --> 07:52.200] oath that you took, you have a duty to question that, okay, you have to question that, you [07:52.200 --> 08:01.840] swore to do so because you can't uphold the elements of your oath if you're willing to [08:01.840 --> 08:10.360] violate it simply because somebody in the food chain ordered you to, what good are you to [08:10.360 --> 08:17.320] the people that you swore to protect if you're willing to bite the hand that feeds you just [08:17.320 --> 08:23.000] because some other junkyard dog said it was okay. [08:23.000 --> 08:27.400] You guys, that's where I feel sad for you. [08:27.400 --> 08:33.640] I feel sad for you that you think you're all that in the bag of chips when really you're [08:33.640 --> 08:39.600] being led around with a ring in your nose and you're being conned into doing things that [08:39.600 --> 08:47.200] a moral principled individual, which I pray that all of you started out as, would never [08:47.200 --> 08:53.320] consider doing because they inherently know how wrong it is. [08:53.320 --> 08:55.560] But no, not you guys. [08:55.560 --> 09:02.120] Once we slap a badge on you, put you in a dark colored uniform and put a gun on you [09:02.120 --> 09:08.240] and then dress you in body armor, you feel like you are no longer responsible to anybody [09:08.240 --> 09:15.560] except who signs the check and that is part of the problem. [09:15.560 --> 09:21.520] So what we should be doing here is we should put us back on equal footing. [09:21.520 --> 09:26.760] You don't want us to have guns, then you shouldn't be having them either. [09:26.760 --> 09:33.400] If we're not allowed to wear body armor, you shouldn't be wearing it either. [09:33.400 --> 09:36.280] Put us back on equal footing. [09:36.280 --> 09:42.720] You people were a whole lot nicer till you thought you could get away with anything. [09:42.720 --> 09:53.840] Well, we're here to educate people to make sure that you do not get away with everything. [09:53.840 --> 10:01.560] And if we can help it, you will never again get away with anything that you are not supposed [10:01.560 --> 10:05.040] to be able to do. [10:05.040 --> 10:10.240] The rule of law also governs you. [10:10.240 --> 10:21.040] It governs those above you, including those highest over you, the people, okay? [10:21.040 --> 10:27.640] It is the people you must ultimately answer to no matter what your bosses tell you. [10:27.640 --> 10:32.240] And your bosses are going to have to answer us to one day as well. [10:32.240 --> 10:35.240] We're going to see to that. [10:35.240 --> 10:39.040] We fought a revolution to get this country. [10:39.040 --> 10:43.840] We fought a war to keep our rights in this country. [10:43.840 --> 10:51.440] And it was only by military force that certain states were taken over and forced to live [10:51.440 --> 10:58.000] a certain way under certain set of rules they never agreed to, Texas being one of them. [10:58.000 --> 11:04.880] We haven't had a valid constitution in Texas since 1836. [11:04.880 --> 11:12.280] Every single thing we've had since 1836 has been nothing less than a military charter. [11:12.280 --> 11:17.240] It's not been voted in and accepted by the people by and large. [11:17.240 --> 11:23.640] It was put in by those that were in the military rule and set up as a de facto government that [11:23.640 --> 11:28.680] would support the military dictatorship we were put under. [11:28.680 --> 11:33.480] Rather than acting like an independent nation, Texas has always been. [11:33.480 --> 11:42.160] See, this is where the people of America have forgotten what we actually are. [11:42.160 --> 11:52.680] Every state of the union is a separate, sovereign, independent nation unto itself. [11:52.680 --> 12:01.600] It has a borders agreement with all of the other nations to which it is a part, okay? [12:01.600 --> 12:05.120] It is a collection of independent nation. [12:05.120 --> 12:08.560] That's what America is. [12:08.560 --> 12:11.680] It's not one big nation. [12:11.680 --> 12:19.720] It's a lot of independent ones that have joined together to be a cooperative. [12:19.720 --> 12:27.920] We will fight and defend each other's home ground if and when it's necessary. [12:27.920 --> 12:32.600] That was the purpose of it, okay? [12:32.600 --> 12:39.280] So now the states have all forgotten this little bit of independence that they once [12:39.280 --> 12:46.720] had and they have acquiesced and allowed a takeover, an illegal takeover by one federal [12:46.720 --> 12:52.320] government acting as if it is government to all and it isn't. [12:52.320 --> 12:59.840] The federal government was never designed to regulate or to write law that directly [12:59.840 --> 13:07.360] affected any individual within the several states of the union. [13:07.360 --> 13:14.080] The United States Congress can only write laws that affect individual people within [13:14.080 --> 13:21.040] its territories, protectorates and enclaves, not within the several states. [13:21.040 --> 13:29.600] Now it can write legislation regarding the interstate commerce clause that will maintain [13:29.600 --> 13:36.840] the regularity of commerce between the individual states, but that was the limit of its authority [13:36.840 --> 13:43.840] to address anything within the borders of any given state of the union. [13:43.840 --> 13:46.120] But we no longer acknowledge that. [13:46.120 --> 13:49.720] We act like that's the farthest possible thing it could be. [13:49.720 --> 13:55.280] Like the Congress has the right to make laws for anything and they don't. [13:55.280 --> 14:02.240] Look at the 18 enumerated powers of the federal constitution if it actually existed any longer. [14:02.240 --> 14:05.400] Look at it and see for yourself. [14:05.400 --> 14:10.960] Nowhere in there is there any authority granted to the federal government to charge anyone [14:10.960 --> 14:14.360] with a criminal act other than treason and counterfeiting. [14:14.360 --> 14:16.360] That's it. [14:16.360 --> 14:22.120] That's the only crimes the federal government was ever given any authority over. [14:22.120 --> 14:25.680] Treason and counterfeiting. [14:25.680 --> 14:29.800] Everything else is to the states. [14:29.800 --> 14:38.720] Yet we have federal laws against all kinds of things, drugs, guns, you name it. [14:38.720 --> 14:45.160] And yet they have tried to use the interstate commerce clause as the gateway for the institution [14:45.160 --> 14:48.840] of all of these separate criminal laws. [14:48.840 --> 14:57.360] Yet there is not a single granted power to the Congress to create a criminal act for [14:57.360 --> 15:00.400] any breach of commerce. [15:00.400 --> 15:02.080] None. [15:02.080 --> 15:08.360] Again, treason and counterfeiting. [15:08.360 --> 15:13.840] Everything in there about creating a criminal act simply because it involved interstate [15:13.840 --> 15:15.840] commerce. [15:15.840 --> 15:19.040] That's a power that doesn't exist. [15:19.040 --> 15:25.520] Yet the states sat on their duffs and instead of raising their voices and withholding their [15:25.520 --> 15:31.800] money which they have every right to do when the federal government refuses to stay within [15:31.800 --> 15:35.400] its bounds. [15:35.400 --> 15:44.320] We allowed them to establish this beachhead and now they continue to encroach further [15:44.320 --> 15:50.840] and further inland on the rights and powers and property rightfully belonging to the states [15:50.840 --> 15:55.400] and the individual citizens of those states. [15:55.400 --> 15:58.400] I mean it's ridiculous. [15:58.400 --> 16:05.680] How inept have we become at taking care of ourselves, folks? [16:05.680 --> 16:13.920] I mean you got to admit it's pathetic when you go around and you look at what's going [16:13.920 --> 16:19.720] on in some of these government agencies like the Welfare Office, the Social Security Office, [16:19.720 --> 16:23.720] any type of government benefit office. [16:23.720 --> 16:29.880] It is lined up with people that can't or won't work to earn a living. [16:29.880 --> 16:30.880] Okay? [16:30.880 --> 16:38.000] And don't get me wrong, I'm not so hard hearted as to think that the people shouldn't take [16:38.000 --> 16:44.080] care of those that need to be taken care of, but a lot of these people don't need it. [16:44.080 --> 16:47.400] They're doing it out of an entitlement mentality, not a need. [16:47.400 --> 16:49.600] Alright folks, we're about to go to break. [16:49.600 --> 16:54.360] This is rule of law radio, the college numbers 5126461984. [16:54.360 --> 17:00.200] Joshua C. on the board will start taking your calls on the other side with the right man. [17:00.200 --> 17:01.200] America is in trouble. [17:01.200 --> 17:03.560] Washington is a disgrace. [17:03.560 --> 17:04.560] Government has become too big. [17:04.560 --> 17:05.560] It's overtaxing, overspending. [17:05.560 --> 17:06.560] We need to change direction. [17:06.560 --> 17:07.560] We really need change. [17:07.560 --> 17:12.160] We can't afford to make the same mistakes we've made in the past. [17:12.160 --> 17:14.280] Mitt Romney's reputation is a flip-flopper. [17:14.280 --> 17:17.640] He went the other way when he got paid to go the other way. [17:17.640 --> 17:19.640] There is need for economic stimulus. [17:19.640 --> 17:20.640] It's about serial hypocrisy. [17:20.640 --> 17:21.640] This election is about trust. [17:21.640 --> 17:22.640] There's been one true consistent candidate. [17:22.640 --> 17:23.640] And that's Dr. Ron Paul. [17:23.640 --> 17:24.640] Ron Paul has been so consistent from the very beginning. [17:24.640 --> 17:25.640] He seems like a more honest candidate. [17:25.640 --> 17:26.640] He tells the truth about what he believes, whether you like it or not. [17:26.640 --> 17:27.640] He's never once voted for a tax increase. [17:27.640 --> 17:28.640] Never once voted for an unbalanced budget. [17:28.640 --> 17:29.640] Ron Paul's plan is bold. [17:29.640 --> 17:30.640] He's got five departments. [17:30.640 --> 17:31.640] It's what we need. [17:31.640 --> 17:32.640] When he says he's going to cut a trillion dollars in the first year, I believe it. [17:32.640 --> 17:33.640] If you don't like it, he's going to cut a trillion dollars in the first year. [17:33.640 --> 17:34.640] If you don't like it, he's going to cut a trillion dollars in the first year. [17:34.640 --> 17:59.640] If you don't like it, he's going to cut a trillion dollars in the first year. [17:59.640 --> 18:04.640] Are you being harassed by debt collectors with phone calls, letters, or even lawsuits? [18:04.640 --> 18:08.640] Stop debt collectors now with the Michael Miras Proven Method. [18:08.640 --> 18:13.640] Michael Miras has won six cases in federal court against debt collectors, and now you can win two. [18:19.640 --> 18:23.640] What to do when contacted by phones, mail, or court summons? [18:23.640 --> 18:25.640] How to answer letters and phone calls? [18:25.640 --> 18:28.640] How to get debt collectors out of your credit reports? [18:28.640 --> 18:33.640] How to turn the financial tables on them and make them pay you to go away? [18:59.640 --> 19:28.640] All right folks, we are back. This is ruleoflawradio. [19:28.640 --> 19:34.640] We are running Hot Straight Live tonight, and we are about to start taking your calls. [19:34.640 --> 19:39.640] This is going to Joshua in Texas. Joshua, how can we help you? [19:39.640 --> 19:41.640] Hey Eddie, how are you doing? [19:41.640 --> 19:44.640] So far so grand. No one's shooting at me. [19:44.640 --> 19:50.640] All right. Well, I got pulled over for running a red light, [19:50.640 --> 19:53.640] and I didn't do any of the things that you say to do, [19:53.640 --> 19:57.640] and before I knew it, I had given them my license and I was explaining to myself what happened. [19:57.640 --> 20:00.640] So that's all water under the bridge at this point. [20:00.640 --> 20:07.640] I'm going to trial a week, and there's a couple questions I have. [20:07.640 --> 20:12.640] First off, are they from, I'm going to tell you what I remember, [20:12.640 --> 20:14.640] and then I want to tell you what they're going with, [20:14.640 --> 20:19.640] and I want to tell me what statute's covered and how, if there's anything I can do. [20:19.640 --> 20:25.640] So I have it that the citation can temporarily serve as a complaint, [20:25.640 --> 20:29.640] and there still must be information made by the attorney. [20:29.640 --> 20:35.640] No, the citation cannot serve as a complaint, even temporarily. [20:35.640 --> 20:38.640] Okay, well, there's something about that in the statute. I remember what it says. [20:38.640 --> 20:42.640] 27.14d. Okay. [20:42.640 --> 20:52.640] Okay, but in order for them to use that statute, you must sign a written waiver of a complaint. [20:52.640 --> 20:55.640] Have you done that? [20:55.640 --> 20:57.640] There's some permission that needed to happen, yeah. [20:57.640 --> 21:01.640] Okay. They have a complaint. They don't have information. [21:01.640 --> 21:05.640] Did they serve you with a copy of the complaint? [21:05.640 --> 21:10.640] They did not serve me, but when I read on their rules, [21:10.640 --> 21:14.640] I was listening to one of your shows and reading the rules as we were going through it [21:14.640 --> 21:21.640] in one of your research archives, and in the rules, it says that it's available to clerk for me. [21:21.640 --> 21:23.640] It's available what? [21:23.640 --> 21:26.640] At the clerk of the court. The rules. [21:26.640 --> 21:28.640] No, no. [21:28.640 --> 21:30.640] If they're going to... [21:30.640 --> 21:32.640] Is this Austin? [21:32.640 --> 21:34.640] Is this Austin? [21:34.640 --> 21:35.640] Yeah, Austin, yeah. [21:35.640 --> 21:39.640] Okay. What they're doing is not what they're required to do. [21:39.640 --> 21:44.640] They can't just stick it in the court record and say they provided you notice. [21:44.640 --> 21:47.640] That's completely wrong. [21:47.640 --> 21:51.640] State statute says something else. Is that what you're saying? [21:51.640 --> 21:54.640] No. Due process says something else. [21:54.640 --> 21:55.640] Okay. [21:55.640 --> 21:57.640] They have the burden of notice. [21:57.640 --> 22:02.640] Notice requires that when they file something, you are notified it's been filed, [22:02.640 --> 22:05.640] and you are given a copy of it. [22:05.640 --> 22:06.640] Uh-huh. [22:06.640 --> 22:14.640] Sticking it in the record behind your back and saying nothing does not constitute notice. [22:14.640 --> 22:17.640] Okay. Have I moved past the point to do anything about that? [22:17.640 --> 22:19.640] Now, I've already agreed to go... [22:19.640 --> 22:27.640] No. No. Notice, unless you've waived it by signing something, must be done properly. [22:27.640 --> 22:33.640] You are entitled to notice pursuant 1.05 code of criminal procedure, [22:33.640 --> 22:41.640] 45.018B code of criminal procedure, and Article 1, Section 10, Texas Constitution. [22:41.640 --> 22:46.640] I'll just give up here. I was trying to write them down. Okay. [22:46.640 --> 22:50.640] I did sign to say I was going to be there for this trial. [22:50.640 --> 22:54.640] What else was on the paper you signed? [22:54.640 --> 22:56.640] Um... [22:56.640 --> 22:57.640] I don't know how to... [22:57.640 --> 22:59.640] Did you enter a plea? [22:59.640 --> 23:02.640] Yeah, it was a long time ago. I'm not guilty. [23:02.640 --> 23:04.640] Okay. Then... Okay. [23:04.640 --> 23:06.640] Open mouth, insert good. [23:06.640 --> 23:08.640] Yeah, I understand. [23:08.640 --> 23:14.640] Because if you go back and look at that document, here's what else you signed away. [23:14.640 --> 23:18.640] You signed away, notice. Okay. [23:18.640 --> 23:22.640] The moment you entered the plea, you signed away in personum jurisdiction. [23:22.640 --> 23:25.640] That's what the information could have been. [23:25.640 --> 23:27.640] That released information that I could have... [23:27.640 --> 23:30.640] That's something about them not having information. [23:30.640 --> 23:33.640] But once I put in a plea, that argument's out. [23:33.640 --> 23:34.640] Is that accurate? [23:34.640 --> 23:39.640] I don't know. They still have to have the information because it's required by law. [23:39.640 --> 23:43.640] Under 2.05 code of criminal procedure. [23:43.640 --> 23:46.640] Okay. [23:46.640 --> 23:47.640] What is that? [23:47.640 --> 23:49.640] They're relying on a statute... [23:49.640 --> 23:50.640] She's the judge, and she says that... [23:50.640 --> 23:53.640] I thought she said they don't have to. [23:53.640 --> 23:57.640] Yes, she says she don't have to, and she's dead wrong. [23:57.640 --> 23:58.640] Okay. [23:58.640 --> 24:03.640] They're relying on a statute that was repealed in 1999. [24:03.640 --> 24:09.640] They're relying on a court case that established that precedent in 1958. [24:09.640 --> 24:10.640] What? [24:10.640 --> 24:17.640] Well, when the statute that court decision was based on was repealed, so was the decision. [24:17.640 --> 24:18.640] Okay. [24:18.640 --> 24:19.640] Well, can you say that court... [24:19.640 --> 24:21.640] Do you know the name of that court case? [24:21.640 --> 24:23.640] I'll pop your head. [24:23.640 --> 24:26.640] It is... [24:26.640 --> 24:29.640] Ex parte Greenwood, I think, is what it is. [24:29.640 --> 24:30.640] Okay. [24:30.640 --> 24:32.640] What's the issue that it clarifies? [24:32.640 --> 24:36.640] The issue is lack of an information in place of a complaint. [24:36.640 --> 24:37.640] Okay. [24:37.640 --> 24:42.640] And the idiot judge there ruled that a complaint was sufficient, and it isn't. [24:42.640 --> 24:48.640] Nowhere in Texas law has a complaint ever been called a charging instrument. [24:48.640 --> 24:49.640] Yeah. [24:49.640 --> 24:50.640] Nope. [24:50.640 --> 24:51.640] I'm putting a number in statute. [24:51.640 --> 24:52.640] Yeah. [24:52.640 --> 24:53.640] No way. [24:53.640 --> 24:54.640] Yeah. [24:54.640 --> 24:55.640] Yeah. [24:55.640 --> 25:01.640] And the statute that used to be there that they relied on to make that opinion, all it ever said was that a... [25:01.640 --> 25:06.640] A complaint in a municipal court or a... [25:06.640 --> 25:07.640] I'm sorry. [25:07.640 --> 25:17.640] A cause of action can be initiated in a municipal court or must be initiated in a municipal court by complaint. [25:17.640 --> 25:19.640] That's all it said. [25:19.640 --> 25:20.640] The complaint... [25:20.640 --> 25:29.640] It didn't say that it could be initiated and prosecuted on complaint alone, which is what the opinion says. [25:29.640 --> 25:33.640] That's not what the statute said. [25:33.640 --> 25:34.640] Okay. [25:34.640 --> 25:43.640] All it did was confirm, the statute itself confirmed the same thing that held true in any other case involving a complaint. [25:43.640 --> 25:51.640] In a municipal court, there still must be a signed and sworn complaint to initiate a case. [25:51.640 --> 25:52.640] Uh-huh. [25:52.640 --> 25:54.640] That's true in any criminal case. [25:54.640 --> 25:56.640] It's true in a civil case. [25:56.640 --> 25:59.640] There is no complaint. There is no action. [25:59.640 --> 26:00.640] So there's... [26:00.640 --> 26:03.640] That's the complaint in the file before I even noticed it. [26:03.640 --> 26:05.640] Like, you know we have 10 days or whatever? [26:05.640 --> 26:07.640] The officer had that complaint in the file before... [26:07.640 --> 26:08.640] I looked at the data. [26:08.640 --> 26:09.640] It was there before my even... [26:09.640 --> 26:10.640] Like, day or two before my... [26:10.640 --> 26:11.640] I noticed it appeared. [26:11.640 --> 26:12.640] He did that almost immediately. [26:12.640 --> 26:13.640] But there's... [26:13.640 --> 26:17.640] Seeing that there's no information in the case, how can I go about it? [26:17.640 --> 26:18.640] I'm going to show it for trial. [26:18.640 --> 26:24.640] What actions can I take or objections can I make or motions can I make? [26:24.640 --> 26:33.640] To object to lack of notice and proper service, you are never served with a copy of the complaint. [26:33.640 --> 26:39.640] You are never served with a copy of a charging instrument, namely an information. [26:39.640 --> 26:45.640] You're going to object to the city attorney acting as an attorney for the state. [26:45.640 --> 26:53.640] Now, are you positive the signature on the complaint is the officer and not a clerk of the court? [26:53.640 --> 26:54.640] Okay. [26:54.640 --> 27:00.640] I almost guarantee you if you're dealing with Austin, it is not an officer that signed it. [27:00.640 --> 27:02.640] It's a clerk. [27:02.640 --> 27:05.640] And that's also illegal. [27:05.640 --> 27:09.640] There's three problems with a clerk signing the complaint. [27:09.640 --> 27:16.640] It makes the court a party to the case because the clerk is now the primary initiating witness for the state. [27:16.640 --> 27:24.640] And through agency, they are acting as an agency of the court, thus they are acting as an agent of the judge. [27:24.640 --> 27:28.640] Thus, it's the same as if the judge himself signed the complaint. [27:28.640 --> 27:33.640] You know, when I read that, I think what I read that I saw that and I just thought, [27:33.640 --> 27:38.640] okay, that's the witness to this sworn statement is what I was thinking the other name on there was. [27:38.640 --> 27:42.640] And it is what it is, but it's still a clerk of the court and not the cop. [27:42.640 --> 27:46.640] Uh, I think the officer, uh, owner of his signature is there too. [27:46.640 --> 27:47.640] They should both be there, right? [27:47.640 --> 27:49.640] His and their and the other. [27:49.640 --> 27:53.640] There will be two clerks, one swearing, one verifying. [27:53.640 --> 27:56.640] Okay. [27:56.640 --> 28:04.640] So before the case starts, I might make a motion to dismiss, lack of notice? [28:04.640 --> 28:11.640] Yeah, well, when the case, when they first call you up, you're going to tell the court after you demand that [28:11.640 --> 28:13.640] everything be on the record. [28:13.640 --> 28:14.640] Yep. [28:14.640 --> 28:15.640] Okay. [28:15.640 --> 28:22.640] You're going to tell the court that you have a list of outstanding objections you want to preserve in the record. [28:22.640 --> 28:23.640] Okay. [28:23.640 --> 28:28.640] And your objections, that's what our exercising class Sunday was all about. [28:28.640 --> 28:30.640] Here's the scenario. [28:30.640 --> 28:35.640] What list of outstanding objections should you be making to preserve in the record? [28:35.640 --> 28:36.640] Okay. [28:36.640 --> 28:41.640] And you have already filed documentation on to preserve the record. [28:41.640 --> 28:48.640] Oh, so do I, is there stuff I have to do a day before on this issue? [28:48.640 --> 28:54.640] Well, you should have done it more than, once you're within 14 days, they're not going to take any motions. [28:54.640 --> 28:55.640] Okay. [28:55.640 --> 29:01.640] But what you can file are his outstanding objections. [29:01.640 --> 29:03.640] You can write your objections down. [29:03.640 --> 29:10.640] Those aren't motions, because you're not asking the court to do anything or to rule on anything. [29:10.640 --> 29:11.640] They're just for the appeal. [29:11.640 --> 29:14.640] They'll be looked at in the appeal form with forward, right? [29:14.640 --> 29:15.640] Correct. [29:15.640 --> 29:23.640] They're written objections that you're going to be putting into the record, and then you're going to voice them at the beginning of your trial. [29:23.640 --> 29:26.640] Okay. [29:26.640 --> 29:29.640] But we do everything in writing. [29:29.640 --> 29:31.640] Don't forget that. [29:31.640 --> 29:33.640] Okay. [29:33.640 --> 29:34.640] I have news. [29:34.640 --> 29:39.640] Black in notice, black in the information. [29:39.640 --> 29:40.640] Yes. [29:40.640 --> 29:41.640] Okay. [29:41.640 --> 29:42.640] Hang on just a second, Joshua. [29:42.640 --> 29:44.640] We'll finish this up to the other side. [29:44.640 --> 29:46.640] Gregory, we see you there on the board. [29:46.640 --> 29:47.640] Hang on. [29:47.640 --> 29:48.640] We'll get to you on the other side. [29:48.640 --> 29:49.640] This is Rule of Law Radio. [29:49.640 --> 29:54.640] The calling number is 512-646-1984. [29:54.640 --> 29:55.640] This is Eddie Craig. [29:55.640 --> 29:59.640] They'll be right back. [29:59.640 --> 30:05.640] A Noble Lie at Oklahoma City, 1995 will change forever the way you look at the true nature of terrorism. [30:05.640 --> 30:09.640] Based on the damage pattern to the building, what the government says is impossible. [30:09.640 --> 30:13.640] The grand jury did not want to hear anything I had to say. [30:13.640 --> 30:16.640] The decision was made not to pursue any of those individuals. [30:16.640 --> 30:21.640] Some of these columns were ripped up, shredded, tossed around. [30:21.640 --> 30:25.640] The people that did the things they did knew going on well what they were doing. [30:25.640 --> 30:29.640] Expose the cover-up now at anoblelie.com. [30:55.640 --> 31:00.640] Or call 908-69-12608 today. [31:00.640 --> 31:06.640] It is so enlightening to listen to 90.1 FM, but finding things on the Internet isn't so easy. [31:06.640 --> 31:09.640] And neither is finding like-minded people to share it with. [31:09.640 --> 31:12.640] Oh, well, I guess you haven't heard of Brave New Books then. [31:12.640 --> 31:13.640] Brave New Books? [31:13.640 --> 31:14.640] Yes. [31:14.640 --> 31:20.640] Brave New Books has all the books and DVDs you're looking for by authors like Alex Jones, Ron Paul, and G. Edward Griffin. [31:20.640 --> 31:24.640] They even stock Interfood, Berkey products, and Calvin Soaps. [31:24.640 --> 31:26.640] There's no way a place like that exists. [31:26.640 --> 31:28.640] Go check it out for yourself. [31:28.640 --> 31:32.640] It's downtown at 1904 Guadalupe Street, just south of UT. [31:32.640 --> 31:36.640] Oh, by UT? There's never anywhere to park down there. [31:36.640 --> 31:43.640] Actually, they now offer a free hour of parking for paying customers at the 500 MLK parking facility just behind the bookstore. [31:43.640 --> 31:47.640] It does exist, but when are they open? [31:47.640 --> 31:56.640] Monday through Saturday, 11 a.m. to 9 p.m. and 1 to 6 p.m. on Sundays, so give them a call at 512-480-2503 [31:56.640 --> 31:59.640] or check out their events page at bravenewbookstore.com. [32:03.640 --> 32:06.640] Yeah, I got a warrant. [32:06.640 --> 32:14.640] And I'm gonna solve them to the government then, prosecute them. [32:14.640 --> 32:17.640] Okay. [32:17.640 --> 32:20.640] What's up? [32:20.640 --> 32:25.640] This isn't a race for the bush. [32:25.640 --> 32:30.640] This isn't a race for the team. [32:30.640 --> 32:33.640] Well, I need a prosecutor to come and help me. [32:33.640 --> 32:35.640] Prosecute them wicked leaders, you see. [32:35.640 --> 32:37.640] They're my mother, a liar. [32:37.640 --> 32:38.640] Them tell me. [32:38.640 --> 32:39.640] Them are liars. [32:39.640 --> 32:40.640] They tell me stories. [32:40.640 --> 32:41.640] They mean a billy. [32:41.640 --> 32:42.640] They say what they tell me. [32:42.640 --> 32:45.640] 3% of America vote for the show. [32:45.640 --> 32:47.640] So how did he get the presidency? [32:47.640 --> 32:50.640] That's what we have a warrant for him. [32:50.640 --> 32:52.640] Everybody listen carefully. [32:52.640 --> 32:54.640] Listen to the words of the fishing species. [32:54.640 --> 32:58.640] This isn't a race for this double show. [32:58.640 --> 33:00.640] This isn't a warrant. [33:00.640 --> 33:01.640] All right, folks. [33:01.640 --> 33:02.640] We are back. [33:02.640 --> 33:04.640] This is Rule of Law Radio. [33:04.640 --> 33:05.640] This isn't a race. [33:05.640 --> 33:07.640] Okay, we're gonna finish up with Joshua. [33:07.640 --> 33:09.640] All right, Joshua, go ahead. [33:09.640 --> 33:11.640] What else do you need to know? [33:11.640 --> 33:13.640] So I have a question about direct selection. [33:13.640 --> 33:16.640] But what was the thing you said about the city attorney acting [33:16.640 --> 33:18.640] state attorney that was object, something to object to? [33:18.640 --> 33:22.640] There is no authority in Texas law for a city attorney [33:22.640 --> 33:25.640] to prosecute in the name of the state. [33:25.640 --> 33:28.640] None, not a zip. [33:28.640 --> 33:31.640] The power to prosecute in the name of the state [33:31.640 --> 33:35.640] is specifically allocated by the Texas Constitution. [33:35.640 --> 33:40.640] It is given under the title attorney for the state. [33:40.640 --> 33:45.640] And it is specifically assigned to two public officers, [33:45.640 --> 33:48.640] the district or county attorney. [33:48.640 --> 33:52.640] That is it. [33:52.640 --> 33:53.640] Okay, got it. [33:53.640 --> 33:59.640] Even in the code of criminal procedure under 2.07, [33:59.640 --> 34:03.640] even an attorney pro temp can only be a county [34:03.640 --> 34:05.640] or district attorney. [34:05.640 --> 34:08.640] And in only a certain instances, [34:08.640 --> 34:11.640] it could be an assistant attorney general. [34:11.640 --> 34:15.640] When the legislature attempted to grant city attorneys [34:15.640 --> 34:20.640] the power to prosecute under 45.201 or 203, [34:20.640 --> 34:24.640] they went way beyond the authorization [34:24.640 --> 34:28.640] of who could prosecute in the name of the state. [34:28.640 --> 34:31.640] That statute is unconstitutional [34:31.640 --> 34:35.640] and a violation of due process on its face [34:35.640 --> 34:39.640] because it gives a corporate for-profit attorney [34:39.640 --> 34:42.640] the power to prosecute and steal money [34:42.640 --> 34:47.640] in the name of the municipality. [34:47.640 --> 34:50.640] Corporate for-profit attorney, is that person elected? [34:50.640 --> 34:51.640] Appointed. [34:51.640 --> 34:52.640] No, they're not elected. [34:52.640 --> 34:54.640] They're appointed by the city. [34:54.640 --> 34:56.640] They're city employees. [34:56.640 --> 34:58.640] Yeah, I hear you. [34:58.640 --> 35:02.640] Or in other cases, they're actually private attorney's firms [35:02.640 --> 35:04.640] that are contracted with the city. [35:04.640 --> 35:05.640] Wow. [35:05.640 --> 35:06.640] Yep. [35:06.640 --> 35:08.640] But again, think about that. [35:08.640 --> 35:11.640] That means that any attorney can automatically become [35:11.640 --> 35:14.640] an attorney for the state just by being a city employee [35:14.640 --> 35:16.640] for a while. [35:16.640 --> 35:19.640] Nowhere is that power granted under the Texas Constitution [35:19.640 --> 35:23.640] or any statute other than 45.201 or 203. [35:23.640 --> 35:25.640] I forget which one it is. [35:25.640 --> 35:26.640] Okay. [35:26.640 --> 35:30.640] But the legislature can't delegate a power [35:30.640 --> 35:35.640] that is specifically assigned to another public officer. [35:35.640 --> 35:38.640] And the power to prosecute in the name of the state [35:38.640 --> 35:42.640] as an attorney for the state is delegated only [35:42.640 --> 35:46.640] to the county and district attorney and no one else, [35:46.640 --> 35:51.640] not even an attorney general or an assistant, AG. [35:51.640 --> 35:52.640] Okay. [35:52.640 --> 35:53.640] Got it. [35:53.640 --> 35:55.640] I'll object to that. [35:55.640 --> 36:00.640] Jury selection, what statute covers guidelines [36:00.640 --> 36:04.640] and can I ask the jury people anything I want? [36:04.640 --> 36:08.640] You can do anything except argue the case. [36:08.640 --> 36:11.640] I can ask them whatever questions I want, right? [36:11.640 --> 36:12.640] Yes. [36:12.640 --> 36:17.640] Yeah. [36:17.640 --> 36:19.640] I'm not going to get too crazy with it, [36:19.640 --> 36:20.640] but I'm thinking I might ask them. [36:20.640 --> 36:21.640] You know who you're going to vote for? [36:21.640 --> 36:26.640] I might even say, you know that Ron Paul won Iowa? [36:26.640 --> 36:28.640] Just to find out which ones are awake. [36:28.640 --> 36:33.640] Which ones are still going on? [36:33.640 --> 36:35.640] Well, okay. [36:35.640 --> 36:38.640] What differences does it make whether or not they're awake? [36:38.640 --> 36:41.640] What? [36:41.640 --> 36:45.640] I have it that the people that would know that [36:45.640 --> 36:49.640] or would be interested in that or have their attention on that [36:49.640 --> 36:54.640] would also be people that would stand by liberty [36:54.640 --> 36:57.640] and stand for freedoms and... [36:57.640 --> 37:01.640] Well, that may be, but what I hear you telling me [37:01.640 --> 37:04.640] is you wish to try to educate your jury. [37:04.640 --> 37:07.640] Well, okay. [37:07.640 --> 37:11.640] And what I'm going to tell you up front from experience is [37:11.640 --> 37:14.640] you are wasting your time. [37:14.640 --> 37:16.640] Yeah. [37:16.640 --> 37:18.640] Okay. [37:18.640 --> 37:20.640] You do what you think you have to, [37:20.640 --> 37:25.640] but you are not going to educate any member of that jury [37:25.640 --> 37:29.640] to believe that they've been blind and stupid and gullible [37:29.640 --> 37:31.640] their whole life. [37:31.640 --> 37:33.640] Yeah. [37:33.640 --> 37:35.640] That might come back at me. [37:35.640 --> 37:37.640] Exactly. [37:37.640 --> 37:39.640] But I can ask any questions [37:39.640 --> 37:43.640] and I'll start to think my strategy there. [37:43.640 --> 37:46.640] Because I do think I'm going to win this case on marriage. [37:46.640 --> 37:48.640] I know that you say don't ever do that, [37:48.640 --> 37:51.640] so I'm going to do all the process stuff first. [37:51.640 --> 37:53.640] When you're forced to go to trial on the marriage, [37:53.640 --> 37:55.640] then you don't have a choice. [37:55.640 --> 37:59.640] But the first thing you need to do is to preserve the lack of notice issue. [37:59.640 --> 38:04.640] You get those outstanding due process violations in the record. [38:04.640 --> 38:07.640] Hopefully you have filed a ton of paperwork [38:07.640 --> 38:11.640] before this trial ever begins that did that. [38:11.640 --> 38:13.640] No, I didn't. [38:13.640 --> 38:16.640] If you didn't, then that tells me you don't have the traffic seminar [38:16.640 --> 38:19.640] and the court documents that go with it. [38:19.640 --> 38:21.640] I don't. [38:21.640 --> 38:24.640] Okay, that might be your next issue that you want to be looking into [38:24.640 --> 38:28.640] because all of these documents that address all of these issues [38:28.640 --> 38:32.640] are already in existence. [38:32.640 --> 38:35.640] You just have to do a small amount of editing and get them filed [38:35.640 --> 38:38.640] so that they're relevant to your case. [38:38.640 --> 38:42.640] But they're already pre-written to address these issues. [38:42.640 --> 38:46.640] Obviously I've planned on just settling and moving on a long time ago, [38:46.640 --> 38:48.640] but I do want to fight everything every chance I get. [38:48.640 --> 38:51.640] I'm just going to move out of state soon. [38:51.640 --> 38:54.640] It's actually working out for me to actually take this to trial. [38:54.640 --> 38:55.640] Right. [38:55.640 --> 38:57.640] Do you have any other questions, Joshua? [38:57.640 --> 39:00.640] Because I've got a few other callers here I need to get to. [39:00.640 --> 39:03.640] So after the trial, say I lose on judgment, [39:03.640 --> 39:05.640] what's the thing I have to do to appeal? [39:05.640 --> 39:08.640] I have to do some paperwork right there before there's a courtroom, right? [39:08.640 --> 39:10.640] To the appeal? [39:10.640 --> 39:15.640] You have 10 days from a court of record to file your motion for new trial. [39:15.640 --> 39:16.640] Uh-huh. [39:16.640 --> 39:23.640] And then they have, I believe it's 30 days to respond to your motion for new trial. [39:23.640 --> 39:25.640] Who does that? [39:25.640 --> 39:29.640] Once they deny it, which they will almost inevitably do, [39:29.640 --> 39:35.640] then you will file your notice of appeal and your appeal bond. [39:35.640 --> 39:38.640] Okay, the first motion for new trial and then notice of appeal. [39:38.640 --> 39:41.640] How much is appeal bond? [39:41.640 --> 39:45.640] Double whatever the amount of fines assessed against you at trial are. [39:45.640 --> 39:49.640] Okay. [39:49.640 --> 39:53.640] And are the court costs more for jury trials than are for bench trials? [39:53.640 --> 39:56.640] You're going to pay court costs either way. [39:56.640 --> 40:01.640] I watched a couple bench trials last week and every one of them was a court cost for a bench trial. [40:01.640 --> 40:05.640] One of them is the cost, period. [40:05.640 --> 40:08.640] Okay, either way. Okay, good. [40:08.640 --> 40:12.640] They can't charge you for the jury. [40:12.640 --> 40:15.640] Gotcha. [40:15.640 --> 40:21.640] If they digit that, then they're charging you a fee for something you have a right to and they can't do that. [40:21.640 --> 40:26.640] I thought there was something that you want to do right there before you leave the courtroom. [40:26.640 --> 40:28.640] Have it ready to go. [40:28.640 --> 40:37.640] If it's a court of no record, you need to have your motion for new trial right there or at least filed by the end of the next day [40:37.640 --> 40:40.640] because you've only got one day if it's a court of no record. [40:40.640 --> 40:45.640] Okay, that's what I was thinking. [40:45.640 --> 40:47.640] All right. [40:47.640 --> 40:49.640] Okay. [40:49.640 --> 40:54.640] I'll probably send you an email to let you know when this is happening if you want to be around for it. [40:54.640 --> 40:55.640] Okay. [40:55.640 --> 40:57.640] Alrighty. [40:57.640 --> 40:58.640] See you in a minute, Josh. [40:58.640 --> 41:00.640] Okay, ready? All right, bye-bye. [41:00.640 --> 41:04.640] All right, now we're going to go to Gregory in California. [41:04.640 --> 41:06.640] Gregory, what can we do for you? [41:06.640 --> 41:08.640] Yes, Eddie, I'd like to ask you a question. [41:08.640 --> 41:11.640] I think I'm being taken. [41:11.640 --> 41:22.640] I received a traffic ticket for California 23123 ABC, which is using a cell phone while driving. [41:22.640 --> 41:26.640] And I went to court and the judge gave me a bigger pardon. [41:26.640 --> 41:28.640] Were you? [41:28.640 --> 41:30.640] California, Fullerton, California. [41:30.640 --> 41:34.640] No, were you using a cell phone while driving? [41:34.640 --> 41:36.640] Yes, I was. [41:36.640 --> 41:38.640] Well, then you're screwed. [41:38.640 --> 41:39.640] No. [41:39.640 --> 41:41.640] If you're driving, then you're liable. [41:41.640 --> 41:45.640] If you're traveling, however, you're not. [41:45.640 --> 41:47.640] So which one were you doing? [41:47.640 --> 41:50.640] I was driving. [41:50.640 --> 41:53.640] Are you a commercial driver? [41:53.640 --> 41:55.640] No, I'm not. [41:55.640 --> 41:57.640] Then how were you driving? [41:57.640 --> 42:00.640] I was driving down the main intersection. [42:00.640 --> 42:03.640] Okay, something here is not registering. [42:03.640 --> 42:04.640] Okay. [42:04.640 --> 42:13.640] Driving only applies to those operating in commerce on the roads. [42:13.640 --> 42:16.640] A driver gets paid. [42:16.640 --> 42:20.640] Someone driving gets paid. [42:20.640 --> 42:23.640] Were you getting paid? [42:23.640 --> 42:25.640] No, I was traveling. [42:25.640 --> 42:26.640] Let's rephrase that. [42:26.640 --> 42:28.640] There you go. [42:28.640 --> 42:31.640] I knew that alarm clock would go off eventually. [42:31.640 --> 42:33.640] Okay, continue. [42:33.640 --> 42:35.640] Okay, I went to court. [42:35.640 --> 42:36.640] The judge gave me an option. [42:36.640 --> 42:41.640] Plead guilty, lowered the fine to 114 dollars. [42:41.640 --> 42:44.640] Or plead guilty. [42:44.640 --> 42:49.640] And it's, you know, excuse me, plead guilty 114. [42:49.640 --> 42:51.640] Plead not guilty once. [42:51.640 --> 42:53.640] So he gave me an option. [42:53.640 --> 42:57.640] I plead not guilty, went to court, said my spiel. [42:57.640 --> 42:59.640] I was found guilty. [42:59.640 --> 43:00.640] Okay. [43:00.640 --> 43:03.640] And it's only trial or jury trial. [43:03.640 --> 43:07.640] Just a commissioner trial, judge trial. [43:07.640 --> 43:11.640] No, a commissioner and a judge are not the same thing. [43:11.640 --> 43:13.640] Well, he was a commissioner. [43:13.640 --> 43:14.640] Right. [43:14.640 --> 43:18.640] So you went through a civil process, not a criminal process. [43:18.640 --> 43:19.640] Correct. [43:19.640 --> 43:22.640] You went through an administrative process. [43:22.640 --> 43:30.640] So let me ask you again, who is bound by administrative corporate procedures? [43:30.640 --> 43:32.640] A judge. [43:32.640 --> 43:34.640] Okay, hold that thought. [43:34.640 --> 43:37.640] Somewhere we're not firing on all cylinders here. [43:37.640 --> 43:39.640] We'll be right back after this break. [46:22.640 --> 46:26.640] Alright Gregory, let's see if we can get this back on track here. [46:26.640 --> 46:27.640] Yes sir. [46:27.640 --> 46:31.640] Okay, first off, a commissioner is not a judge. [46:31.640 --> 46:35.640] A commissioner is an administrative officer. [46:35.640 --> 46:36.640] Okay. [46:36.640 --> 46:39.640] The commissioner works for who? [46:39.640 --> 46:43.640] The city, not the state. [46:43.640 --> 46:44.640] Oh. [46:44.640 --> 46:45.640] Okay. [46:45.640 --> 46:55.640] Now, who is bound by the administrative rules and regulations of an incorporated entity? [46:55.640 --> 47:00.640] The district attorney? [47:00.640 --> 47:02.640] A judge, excuse me. [47:02.640 --> 47:04.640] Well, the city manager? [47:04.640 --> 47:06.640] I don't know, Eddie. [47:06.640 --> 47:12.640] How about the corporation's employees and contractors? [47:12.640 --> 47:19.640] Corporations, employees and contractors. [47:19.640 --> 47:27.640] Okay, would the administrative procedures of McDonald's Corporation apply to you? [47:27.640 --> 47:29.640] Yes. [47:29.640 --> 47:31.640] Yes, you work for McDonald's? [47:31.640 --> 47:32.640] No. [47:32.640 --> 47:33.640] No. [47:33.640 --> 47:35.640] You go fry cook or something? [47:35.640 --> 47:36.640] No. [47:36.640 --> 47:41.640] Okay, so what is the correct answer then? [47:41.640 --> 47:44.640] The mayor, I don't know. [47:44.640 --> 47:46.640] I just told you. [47:46.640 --> 47:48.640] I'm asking you, okay. [47:48.640 --> 47:51.640] You don't work for McDonald's, do you? [47:51.640 --> 47:53.640] I don't, absolutely not. [47:53.640 --> 48:00.640] Okay, so the corporate administrative rules and regulations of McDonald's don't have anything [48:00.640 --> 48:02.640] to do with you, do they? [48:02.640 --> 48:03.640] No. [48:03.640 --> 48:04.640] No. [48:04.640 --> 48:07.640] They only operate against who? [48:07.640 --> 48:13.640] McDonald's employees and those that are contractors to McDonald's, right? [48:13.640 --> 48:14.640] Correct. [48:14.640 --> 48:25.640] Okay, so when an officer of McDonald's holds an administrative review hearing, who must [48:25.640 --> 48:33.640] be in attendance for anything that they say or do to have any force in effect? [48:33.640 --> 48:36.640] The administrator, right? [48:36.640 --> 48:39.640] An employee or a contractor, right? [48:39.640 --> 48:42.640] Right, employee or a contractor. [48:42.640 --> 48:50.640] Okay, so why in the hell are you going through a non-judicial process for an administrative [48:50.640 --> 48:57.640] hearing that you cannot possibly be subject to? [48:57.640 --> 48:59.640] Well, I didn't know. [48:59.640 --> 49:04.640] I mean, you know, I guess I'm ignorant to the law. [49:04.640 --> 49:07.640] This is me off, excuse my language, sir. [49:07.640 --> 49:14.640] The $20 ticket, then the state of California imposed $28 for each $10. [49:14.640 --> 49:18.640] So that's $56 plus 2076. [49:18.640 --> 49:25.640] But now they're charging me $160 balance due because I was pleaded, you know, because I [49:25.640 --> 49:26.640] was found guilty. [49:26.640 --> 49:34.640] Then the court added on $40 court operations fees convicted, and then they added assessment [49:34.640 --> 49:44.640] fees, $35, and a convicted count of $30 per misdemeanor or felony, and $35 per infraction. [49:44.640 --> 49:46.640] So they're price gouging me. [49:46.640 --> 49:48.640] Well, of course they are. [49:48.640 --> 49:52.640] What is the mandate of any incorporated entity? [49:52.640 --> 49:54.640] I don't know. [49:54.640 --> 49:56.640] To make a profit. [49:56.640 --> 49:59.640] That's correct because the state of California is broke. [49:59.640 --> 50:04.640] Well, it ain't just the state of California, the city gets to keep at least half of that [50:04.640 --> 50:05.640] money. [50:05.640 --> 50:07.640] A percentage, correct. [50:07.640 --> 50:14.640] Okay, so you just went through an administrative process and gave away your wallet. [50:14.640 --> 50:15.640] What's your complaint? [50:15.640 --> 50:17.640] You agreed to it? [50:17.640 --> 50:18.640] Correct. [50:18.640 --> 50:22.640] So I'm appealing it due to price gouging. [50:22.640 --> 50:24.640] Well, sorry. [50:24.640 --> 50:28.640] The corporation can set any price for its services it wants to. [50:28.640 --> 50:31.640] There's nothing forcing you to buy them. [50:31.640 --> 50:34.640] But isn't that superior court, which is run by the state of California? [50:34.640 --> 50:38.640] They said they're not a city entity. [50:38.640 --> 50:44.640] They are a state entity because it's superior court. [50:44.640 --> 50:46.640] That's what they told me. [50:46.640 --> 50:51.640] The court may be, but you weren't in superior court. [50:51.640 --> 50:56.640] If you weren't, then a commissioner couldn't be sitting there. [50:56.640 --> 51:06.640] A commissioner is not a judge and only a judge can preside over a court. [51:06.640 --> 51:09.640] Even though they call it North Court, part of Orange County? [51:09.640 --> 51:15.640] We don't care if they call it the men's room. [51:15.640 --> 51:16.640] Okay. [51:16.640 --> 51:21.640] What they call it and what it is legally is two different things. [51:21.640 --> 51:22.640] Okay. [51:22.640 --> 51:30.640] Only a judge can sit in a judicial court, not a commissioner. [51:30.640 --> 51:31.640] Okay. [51:31.640 --> 51:35.640] The detail here is as you went to an administrative court. [51:35.640 --> 51:38.640] I want to admit, okay, all right. [51:38.640 --> 51:41.640] Which is not the same thing. [51:41.640 --> 51:44.640] Even though they call it superior court. [51:44.640 --> 51:49.640] Again, what they call it is irrelevant. [51:49.640 --> 51:52.640] You must know what it is. [51:52.640 --> 51:57.640] Not what it calls itself, but what it is. [51:57.640 --> 51:58.640] Okay. [51:58.640 --> 52:00.640] Yes, sir. [52:00.640 --> 52:09.640] It's just like when someone calls themselves a police officer just because they're wearing a police costume. [52:09.640 --> 52:10.640] Okay. [52:10.640 --> 52:11.640] You have the choice. [52:11.640 --> 52:15.640] Do I believe them or not believe them? [52:15.640 --> 52:16.640] Okay. [52:16.640 --> 52:25.640] If you accept their authority, even if they're not a police officer, then they can do to you the same thing a police officer can. [52:25.640 --> 52:28.640] And you are none the wiser, are you? [52:28.640 --> 52:29.640] Absolutely. [52:29.640 --> 52:35.640] Because you accepted their projected authority. [52:35.640 --> 52:36.640] Okay. [52:36.640 --> 52:38.640] You never questioned it. [52:38.640 --> 52:40.640] That's what you did here. [52:40.640 --> 52:47.640] The other one to court and said, are you a judge, attorney for superior court? [52:47.640 --> 52:57.640] You file a motion stating that you do not agree or consent to any non-judicial proceedings. [52:57.640 --> 52:59.640] Okay. [52:59.640 --> 53:09.640] Because the only way they can get you in an administrative proceeding is because you do consent. [53:09.640 --> 53:13.640] In other words, just be a man and pay it, right? [53:13.640 --> 53:16.640] Well, you kind of left yourself no choice. [53:16.640 --> 53:22.640] Well, they gave me a, I can appeal it and that's what I'm going to do. [53:22.640 --> 53:23.640] Sure. [53:23.640 --> 53:26.640] How much more is the appeal going to cost you over what you just spent? [53:26.640 --> 53:29.640] It's free. [53:29.640 --> 53:35.640] Believe me, there is nothing about this process that is free. [53:35.640 --> 53:38.640] Well, I get a waiver because I'm unemployed and disabled. [53:38.640 --> 53:41.640] Well, let's see how that works out for you. [53:41.640 --> 53:45.640] I hope the best, but from now on you need to understand something. [53:45.640 --> 53:50.640] Any authority you accept without question, that's your fault. [53:50.640 --> 53:51.640] Correct. [53:51.640 --> 54:02.640] You're the one required to know whether or not the person or entity telling you that they can make you do this, this or this actually has that power. [54:02.640 --> 54:04.640] And I have a right to question them. [54:04.640 --> 54:06.640] Absolutely. [54:06.640 --> 54:11.640] And if he says I'm a commissioner and not a judge for the judicial. [54:11.640 --> 54:20.640] And I do not consent or agree in any way, shape, or form to have you preside over any proceedings in this matter. [54:20.640 --> 54:27.640] Well, wonder, sometimes they call commissioner, sometimes a commissioner is an attorney, a licensed attorney. [54:27.640 --> 54:28.640] Is that true? [54:28.640 --> 54:29.640] I don't care. [54:29.640 --> 54:36.640] I don't care if they're an attorney, an engineer, or a CEO, or a boy scout. [54:36.640 --> 54:38.640] It makes no difference. [54:38.640 --> 54:43.640] They're not a judge. [54:43.640 --> 54:44.640] Okay. [54:44.640 --> 54:47.640] Makes sense now. [54:47.640 --> 54:49.640] That makes sense. [54:49.640 --> 55:01.640] So when I appeal it, the price gouging and try to have them lower it, then I can state that in my complaint or my appeal. [55:01.640 --> 55:03.640] You can state it, but it does you no good. [55:03.640 --> 55:05.640] You've already agreed to it. [55:05.640 --> 55:06.640] Okay. [55:06.640 --> 55:14.640] It's like signing a contract and then changing your mind later because you don't like the terms, even though you signed it with the terms right in front of you. [55:14.640 --> 55:16.640] Correct. [55:16.640 --> 55:17.640] Okay. [55:17.640 --> 55:21.640] Well, I got a little fight ahead of me and I'm going to let them take advantage of me. [55:21.640 --> 55:23.640] Well, good luck. [55:23.640 --> 55:25.640] Thank you very much. [55:25.640 --> 55:29.640] And I appreciate you giving me some advice and helping me. [55:29.640 --> 55:30.640] I appreciate it. [55:30.640 --> 55:31.640] Yes, sir. [55:31.640 --> 55:32.640] Not a problem. [55:32.640 --> 55:41.640] I wish there could have been better news and a better way of working out, but that's where if we're not awake and willing to do for ourselves, it's going to buy us in the butt. [55:41.640 --> 55:42.640] Okay. [55:42.640 --> 55:43.640] Thank you very much. [55:43.640 --> 55:45.640] And you have a wonderful evening. [55:45.640 --> 55:47.640] You too, very thanks for calling in. [55:47.640 --> 55:48.640] Thank you. [55:48.640 --> 55:49.640] Bye-bye. [55:49.640 --> 55:50.640] Bye-bye. [55:50.640 --> 55:51.640] All right. [55:51.640 --> 55:53.640] Now we're going to go to Clint in Texas. [55:53.640 --> 55:57.640] Folks, Clint is our last caller on the board, so please give us a call. [55:57.640 --> 56:00.640] 512-646-1984. [56:00.640 --> 56:07.640] If you have a question query or anything else, or what I've done with Clint, I'm going to have to go back to Randy and Ravey. [56:07.640 --> 56:08.640] Hey, Union Clint. [56:08.640 --> 56:09.640] What can we do for you? [56:09.640 --> 56:11.640] Hey, good evening. [56:11.640 --> 56:15.640] I was going to give a little news update. [56:15.640 --> 56:18.640] You remember Daryl, the loquacious fellow? [56:18.640 --> 56:20.640] Yes, I do. [56:20.640 --> 56:22.640] Well, he had a... [56:22.640 --> 56:23.640] I went over there to... [56:23.640 --> 56:34.640] Ravey's new books was kind enough to host a benefit forum, and he recently had that run-in with, I believe, his APD. [56:34.640 --> 56:35.640] Yeah. [56:35.640 --> 56:43.640] Yeah, would you... Clint, from the listeners out there, would you mind going through the story and giving them a little background on exactly what the issue is with Daryl? [56:43.640 --> 56:48.640] We do have about two minutes before the break, though, so if you don't get finished, we'll finish it on the other side. [56:48.640 --> 56:49.640] Okay. [56:49.640 --> 56:52.640] I don't remember all the details, so I'll try and make it quick. [56:52.640 --> 56:54.640] Daryl is a homeless man. [56:54.640 --> 57:05.640] He was living in Austin, Texas, and he was sleeping in a tent by Barton Springs, by our local river pool area. [57:05.640 --> 57:16.640] And essentially, the park rangers or whoever told him he needed to leave. [57:16.640 --> 57:18.640] Somehow, they got a hold of APD. [57:18.640 --> 57:19.640] APD came in there. [57:19.640 --> 57:20.640] He was rolling up his... [57:20.640 --> 57:27.640] He had an inflatable mattress, he was rolling that up, and they wanted him out of the tent. [57:27.640 --> 57:28.640] They got him. [57:28.640 --> 57:30.640] I think they ordered him out of the tent. [57:30.640 --> 57:33.640] He came out of the tent. [57:33.640 --> 57:36.640] I don't remember all the details. [57:36.640 --> 57:39.640] Basically, they got him. [57:39.640 --> 57:41.640] Arms behind his back. [57:41.640 --> 57:47.640] He informed one of the officers that his arm, you know, he can't raise it up, and they were being kind of aggressive with it. [57:47.640 --> 57:53.640] He told me that...Daryl told me that when they found that out, that they targeted that injury. [57:53.640 --> 57:59.640] And he told me that they broke his arm, and... [57:59.640 --> 58:00.640] I don't... [58:00.640 --> 58:02.640] I believe he went to a doctor. [58:02.640 --> 58:05.640] I can't remember all the details of how he knew it was broken. [58:05.640 --> 58:10.640] Yeah, he did say that he went to a doctor and told him it was broken in two places. [58:10.640 --> 58:13.640] Okay. [58:13.640 --> 58:22.640] And so, we had a benefit for that, and you know, trying to help him out, trying to get him some redress for his grievance there. [58:22.640 --> 58:28.640] And we got some news when I came in to brave new books this evening. [58:28.640 --> 58:30.640] And I'll tell you about that in a second. [58:30.640 --> 58:31.640] Okay. [58:31.640 --> 58:32.640] Well, hang on just a minute. [58:32.640 --> 58:34.640] We'll pick you up on the other side of the break. [58:34.640 --> 58:35.640] Hi, folks. [58:35.640 --> 58:36.640] This is Rule of Law Radio. [58:36.640 --> 58:38.640] This is your host, Eddie Craig. [58:38.640 --> 58:43.640] Calling number is 512-646-1984. [58:43.640 --> 58:47.640] If you have a question, query, problem, or ponderance, give us a call. [58:47.640 --> 58:50.640] The only thing we don't deal with right now is the mortgage stuff. [58:50.640 --> 58:52.640] We'll have to wait for Randall Thursday or Friday. [58:52.640 --> 58:54.640] Otherwise, give us a call. [58:54.640 --> 58:56.640] We'll be right back after the break. [58:59.640 --> 59:01.640] The Oklahoma City bombing. [59:01.640 --> 59:03.640] Top 10 reasons to question the official story. [59:03.640 --> 59:07.640] Reason number one, John Doe number two, and other accomplices. [59:07.640 --> 59:11.640] On the day of the bombing, nearly all of the witnesses that saw Tim McVeigh and the [59:11.640 --> 59:15.640] Ryder truck report that he was accompanied by other perpetrators. [59:15.640 --> 59:20.640] The FBI and federal prosecutors insist that Tim McVeigh alone delivered the Ryder truck [59:20.640 --> 59:23.640] bomb to the Murr Building and detonated it. [59:23.640 --> 59:27.640] The only witness the government produced to place McVeigh at the building that morning, [59:27.640 --> 59:31.640] Dana Bradley, who lost her children and one of her legs in the bombing, testified that [59:31.640 --> 59:36.640] she saw McVeigh with another man, the fable John Doe number two, exiting the Ryder truck. [59:36.640 --> 59:40.640] While at least 15 other witnesses claim to have seen McVeigh with other perpetrators [59:40.640 --> 59:46.640] the day of the bombing, no less than 226 witnesses placed him with other men in the [59:46.640 --> 59:50.640] days before the bombing, including when he rented the Ryder truck. [59:50.640 --> 59:54.640] And in some cases, have positively identified the other perpetrators. [59:54.640 --> 59:59.640] For more information, please visit okcbombingtruth.com. [01:00:10.640 --> 01:00:36.640] I'm Dr. Katherine Albrecht, and I'll be right back with details. [01:00:40.640 --> 01:00:43.640] Start Over with StartPage. [01:02:05.640 --> 01:02:08.640] This public service announcement is brought to you by startpage.com. [01:02:08.640 --> 01:02:12.640] The private search engine alternative to Google, Yahoo, and Bing. [01:02:12.640 --> 01:02:15.640] Start Over with StartPage. [01:02:15.640 --> 01:02:21.640] Imagine sitting in the corner of a store watching people buy the same products day after boring day. [01:02:21.640 --> 01:02:25.640] That's the life of the average security camera, yawn. [01:02:25.640 --> 01:02:30.640] But a British company called Internet Eyes gets people to pay to watch these video streams. [01:02:30.640 --> 01:02:36.640] They pay around 20 bucks, then members log on to watch UK stores and streets for criminal activity, [01:02:36.640 --> 01:02:39.640] hoping to win a monthly prize for being the most eagle-eyed. [01:02:39.640 --> 01:02:46.640] The plan is revolting, but it really went sour when members started posting YouTube videos of the unsuspecting shoppers. [01:02:46.640 --> 01:02:51.640] It's what you'd expect from the sort of person who enjoys watching surveillance cameras in the first place. [01:02:51.640 --> 01:02:53.640] Some people really need to get a life. [01:02:53.640 --> 01:03:10.640] I'm Dr. Catherine Albrecht. More news and information at CatherineAlbrecht.com. [01:03:23.640 --> 01:03:29.640] In a sense, it kills us for the unsightly. [01:03:29.640 --> 01:03:38.640] These warm unders come by that term right there. [01:03:38.640 --> 01:03:41.640] I won't pay for the war with my body. [01:03:41.640 --> 01:03:45.640] She ain't gonna pay for the car with my money. [01:03:45.640 --> 01:03:48.640] I won't pay for the fun with my body. [01:03:48.640 --> 01:03:53.640] The plan's wicked and the logic's shoddy. [01:03:53.640 --> 01:03:56.640] Ain't gonna pay for the war with my body. [01:03:56.640 --> 01:03:59.640] I won't pay for the poison with my money. [01:03:59.640 --> 01:04:00.640] Ain't gonna pay for the... [01:04:00.640 --> 01:04:03.640] Hi folks, we are back at CIS Rule of Law Radio. [01:04:03.640 --> 01:04:06.640] Right now we are talking to Clint in Texas. [01:04:06.640 --> 01:04:09.640] Alright, Clint, let me do a recap here. [01:04:09.640 --> 01:04:17.640] BraveDoo Books held a benefit for Darrell, which is one of the homeless folks that lives in downtown Austin. [01:04:17.640 --> 01:04:23.640] He was in an area close to Barton Springs camping in a tent. [01:04:23.640 --> 01:04:26.640] The park ranger told him he had to leave. [01:04:26.640 --> 01:04:36.640] They also contacted Austin Police Department, who then showed up after Darrell was in process of rolling up his air mattress [01:04:36.640 --> 01:04:43.640] and packing his tent, or about to pack his tent, and Austin PD showed up and accosted him [01:04:43.640 --> 01:04:50.640] and then physically abused him and broke his arm in two places after he had told him he had a frozen shoulder. [01:04:50.640 --> 01:04:55.640] They attacked that particular arm and wound up injuring him. [01:04:55.640 --> 01:04:59.640] Go ahead and pick it back up from there. [01:04:59.640 --> 01:05:01.640] Yes, sir, correct. [01:05:01.640 --> 01:05:11.640] So that benefit was this evening at 7, and I was informed by the man behind the desk there at BraveDoo Books [01:05:11.640 --> 01:05:16.640] on the counter that they received a phone call. [01:05:16.640 --> 01:05:21.640] I'm not sure if it was earlier in the day. [01:05:21.640 --> 01:05:25.640] I'm going to have to paraphrase here. [01:05:25.640 --> 01:05:26.640] There's a man who called. [01:05:26.640 --> 01:05:34.640] He said, how dare you throw a benefit for that guy? [01:05:34.640 --> 01:05:36.640] There was a threat. [01:05:36.640 --> 01:05:39.640] I don't remember what it was, something about breaking knees. [01:05:39.640 --> 01:05:49.640] I can't remember the details, but anyways, I got a phone call and somebody threatening violence. [01:05:49.640 --> 01:05:58.640] And the shocking part, well, it's not too shocking, but I want to make anybody think it's more serious. [01:05:58.640 --> 01:06:03.640] I mean, it's serious, but it's... [01:06:03.640 --> 01:06:08.640] I'm just going to overdo it here. [01:06:08.640 --> 01:06:16.640] So we found out that Daryl wasn't going to be there that night or tonight, that he had been arrested. [01:06:16.640 --> 01:06:23.640] And I didn't look this information up myself, but I was told from someone that they did look it up. [01:06:23.640 --> 01:06:32.640] I believe they called APD and Daryl is in jail for the charge of theft. [01:06:32.640 --> 01:06:42.640] So I'm worried about him just because of that phone call that the store received. [01:06:42.640 --> 01:06:47.640] Did anyone in the store contact the phone company and ask them to trace back the source of that call? [01:06:47.640 --> 01:06:50.640] No, sir, I don't believe so. [01:06:50.640 --> 01:06:54.640] Okay, did that phone call come in tonight? [01:06:54.640 --> 01:06:56.640] It came in this afternoon. [01:06:56.640 --> 01:06:59.640] I remember that it was a private call. [01:06:59.640 --> 01:07:02.640] Anonymous? [01:07:02.640 --> 01:07:07.640] Yeah, that may have shown up on your end, but it won't be anonymous in the phone company's records. [01:07:07.640 --> 01:07:18.640] If they can give the phone company an approximate time of the call, they can backtrack all calls that came into the store and find out where that call originated. [01:07:18.640 --> 01:07:25.640] Okay, I'll be sure to give the store a call this tomorrow and pass that information to them. [01:07:25.640 --> 01:07:37.640] Okay, because the phone company will report a criminal act which, using the phone services to make a terroristic threat, is a crime. [01:07:37.640 --> 01:07:48.640] And whoever is at that number, they will backtrack it and find out. [01:07:48.640 --> 01:07:49.640] You still there? [01:07:49.640 --> 01:07:50.640] Yes, sir. [01:07:50.640 --> 01:07:55.640] Okay, so Daryl's in jail allegedly for theft. [01:07:55.640 --> 01:07:59.640] Do we know any more than that about his arrest? [01:07:59.640 --> 01:08:00.640] No, sir. [01:08:00.640 --> 01:08:01.640] That's all I know. [01:08:01.640 --> 01:08:10.640] Okay, is anyone going to go down and see him or has anyone checked to see whether or not he can be released on bond or whatever? [01:08:10.640 --> 01:08:15.640] No, sir, I haven't heard anyone talk about that. [01:08:15.640 --> 01:08:25.640] Okay, well, please keep us updated, let us know Thursday or so if we don't have any other information before then, if you don't mind, if you find anything out. [01:08:25.640 --> 01:08:27.640] Yes, sir. [01:08:27.640 --> 01:08:36.640] I would like to, and I know that you're a believer and son of God, and would you mind praying with me over there? [01:08:36.640 --> 01:08:39.640] I mean, you know, I'm just a little worried about him and I know prayer... [01:08:39.640 --> 01:08:42.640] No, sir, I absolutely would not mind at all. [01:08:42.640 --> 01:08:46.640] If that's what you would like to do, do you want a lead or do you want me to? [01:08:46.640 --> 01:08:50.640] Well, you can call it, Eddie. [01:08:50.640 --> 01:08:51.640] What do you think? [01:08:51.640 --> 01:08:53.640] I'm fully capable. [01:08:53.640 --> 01:08:55.640] Well, it's up to you. [01:08:55.640 --> 01:08:56.640] It's your request. [01:08:56.640 --> 01:08:58.640] Sure, I'll go ahead and lead it. [01:08:58.640 --> 01:09:02.640] All right. [01:09:02.640 --> 01:09:19.640] Heavenly Father, you are the goodness that has been passed through Father's knowledge to their sons. [01:09:19.640 --> 01:09:23.640] Heavenly Father, I want to pray for Brother Darrell. [01:09:23.640 --> 01:09:28.640] I pray for protection and covering over him. [01:09:28.640 --> 01:09:33.640] I pray that you'll have friends. [01:09:33.640 --> 01:09:40.640] Even angels, Heavenly Father, are facing trouble right now. [01:09:40.640 --> 01:09:49.640] I pray that you deal with him and you give a cheer into his heart. [01:09:49.640 --> 01:10:02.640] I pray that those guards, Heavenly Father, that they would look at him and that they would see him as the boy that he once was, that they would not mistreat him if any of those thoughts arise into their minds. [01:10:02.640 --> 01:10:06.640] And thank you for everything, Heavenly Father. [01:10:06.640 --> 01:10:07.640] Thank you for our dreams. [01:10:07.640 --> 01:10:12.640] Thank you for our goal, our aspirations and for the light and the darkness. [01:10:12.640 --> 01:10:15.640] Eddie, would you have anything else to say? [01:10:15.640 --> 01:10:18.640] Lord, just keep your hand up for protection over Darrell. [01:10:18.640 --> 01:10:27.640] Please bless all those that would go to his aid, Lord, and please guide them in the knowledge and wisdom they need to help him through this situation. [01:10:27.640 --> 01:10:39.640] And as I know that he will eventually seek me out to gain assistance, please allow me to be knowledgeable and wise in the counseling I give him and the assistance that I provide. [01:10:39.640 --> 01:10:44.640] All these prayers and blessings we offer in the name of Jesus Christ. [01:10:44.640 --> 01:10:46.640] Amen. [01:10:46.640 --> 01:10:47.640] Amen. [01:10:47.640 --> 01:10:48.640] And anyone else? [01:10:48.640 --> 01:10:49.640] Thank you, Clint. [01:10:49.640 --> 01:10:51.640] Sacred names, Yahshua. [01:10:51.640 --> 01:10:53.640] Yahshua, we love you. [01:10:53.640 --> 01:10:55.640] Yeah, all right. [01:10:55.640 --> 01:10:58.640] Well, Eddie, I'm going to let you go. [01:10:58.640 --> 01:11:06.640] I think I'm going to give them a call and get somebody's name, see if I can get a status of them and see what's going on. [01:11:06.640 --> 01:11:07.640] All right. [01:11:07.640 --> 01:11:08.640] Please keep us informed. [01:11:08.640 --> 01:11:09.640] Let us know. [01:11:09.640 --> 01:11:10.640] We'll do. [01:11:10.640 --> 01:11:11.640] All right. [01:11:11.640 --> 01:11:13.640] Thank you, Clint, for calling in. [01:11:13.640 --> 01:11:14.640] Yeah, you're welcome. [01:11:14.640 --> 01:11:15.640] Bye-bye. [01:11:15.640 --> 01:11:16.640] All right. [01:11:16.640 --> 01:11:17.640] Okay. [01:11:17.640 --> 01:11:24.640] And folks, I know there are some folks out there that listen to this show that are not believers and that's okay if that's your choice. [01:11:24.640 --> 01:11:33.640] But if you choose to no longer listen to this show because of my preference and my choice, again, that's on you, not on me. [01:11:33.640 --> 01:11:44.640] I know you don't think this show should be about anything other than law, but I'm here to tell you right now there's a higher law than anything that can be printed in any book made up by any man. [01:11:44.640 --> 01:11:53.640] And if you don't cotton to that, well, then I guess you and I will not have eternal company, but that is still your choice, not mine. [01:11:53.640 --> 01:12:05.640] So if you do have an issue with this, please don't call in or rot me next to email saying that you don't think it should be on the show because after all, it's my show, not your show. [01:12:05.640 --> 01:12:08.640] All right, folks, we now have Tyler in Wyoming. [01:12:08.640 --> 01:12:12.640] Tyler, what can we do for you? [01:12:12.640 --> 01:12:14.640] How are you doing, Eddie? [01:12:14.640 --> 01:12:19.640] I'm so far so good, at least until the emails come in about that last comment. [01:12:19.640 --> 01:12:20.640] There you go. [01:12:20.640 --> 01:12:24.640] Well, I just want to say first of all, I think people can appreciate this. [01:12:24.640 --> 01:12:34.640] I'm actually a believer myself, but as I tell people, you know, that's a First Amendment issue which protects the freedom of speech and the freedom of religion and if you believe in the Constitution, [01:12:34.640 --> 01:12:42.640] then you at least have to respect that, you know, whether you're a believer or not. So, but I think that was a good thing. [01:12:42.640 --> 01:12:58.640] I had a question on a, I got a citation from a local police officer for a registered, I'm sorry, for a lapsed license plate or an expired registration, I guess they called. [01:12:58.640 --> 01:12:59.640] Okay. [01:12:59.640 --> 01:13:04.640] And that was the only reason he stopped me and that kind of annoyed me. [01:13:04.640 --> 01:13:15.640] Of course, actually, I didn't even know it was expired, in all honesty, but the first thing I asked him, I pulled off to a private road where I wasn't going to be in the way of traffic. [01:13:15.640 --> 01:13:18.640] I always believed in safety first. [01:13:18.640 --> 01:13:24.640] And I asked the officer, I said, you know, I said, if you don't mind me asking, I said, what was your problem? [01:13:24.640 --> 01:13:32.640] He stopped me. And he's kind of bledger with me. He said, well, we'll get to that. And he said, but first of all, I need to see your license for registration. [01:13:32.640 --> 01:13:40.640] And again, my license couldn't find my insurance after that, too. [01:13:40.640 --> 01:13:51.640] I have it, but I just couldn't find the card. And then I asked him again, I said, what was your reason for stopping me? He said, your license plate's expired. [01:13:51.640 --> 01:13:56.640] And I think the question I asked him, I said, did I damage anybody? Did I hurt anybody's property? [01:13:56.640 --> 01:14:00.640] Well, no, he said. [01:14:00.640 --> 01:14:12.640] And then I always try to get a warning, if I can, because first of all, I believe in the common law principle that if there's no damaged party, there's no crime. [01:14:12.640 --> 01:14:18.640] And here in Wyoming, they call tickets criminal, which is crazy. [01:14:18.640 --> 01:14:20.640] Yeah, they do the same here. [01:14:20.640 --> 01:14:29.640] I mean, yeah, I went to the arraignment and I got the first one postponed because they didn't want to give me a continuance. [01:14:29.640 --> 01:14:33.640] So I just said, well, I'm going to counsel with an attorney and that gave me a continuance. [01:14:33.640 --> 01:14:42.640] And I did actually talk to an attorney who was not lying, but I did not hire an attorney when it came back to the second arraignment. [01:14:42.640 --> 01:14:50.640] The first thing I told the judge, I said, because he asked me, well, he thought it was kind of, he wanted me to sign the waiver for an attorney. [01:14:50.640 --> 01:14:52.640] I said, no, I'm not going to waive any rights. [01:14:52.640 --> 01:14:55.640] I said, I might want to get an attorney later and he made the crack comedy. [01:14:55.640 --> 01:15:02.640] He goes, well, this is kind of crazy because he said, you know, either you had registration or you don't. [01:15:02.640 --> 01:15:06.640] You know, I don't understand the need for an attorney, but he goes, but that's up to you. [01:15:06.640 --> 01:15:11.640] And right there is when I jumped in and I made the comment. [01:15:11.640 --> 01:15:16.640] I said, well, your honor, I said, first of all, I'm appearing especially not generally. [01:15:16.640 --> 01:15:18.640] I didn't make a plea. [01:15:18.640 --> 01:15:23.640] I said, I'm appearing especially not generally, challenging the subject matter jurisdiction of this citation. [01:15:23.640 --> 01:15:25.640] Comments, whatever. [01:15:25.640 --> 01:15:27.640] I remember my exact term. [01:15:27.640 --> 01:15:29.640] And right away, it didn't take a second. [01:15:29.640 --> 01:15:34.640] He said, I deny your special appearance. [01:15:34.640 --> 01:15:36.640] And I said, I take exception to your rule. [01:15:36.640 --> 01:15:40.640] And he responded with, yes, you can do that. [01:15:40.640 --> 01:15:44.640] And I was thinking to myself, I know. [01:15:44.640 --> 01:15:55.640] But I, my guess, my first question is, is the judge, I don't think he has authority to deny a special appearance. [01:15:55.640 --> 01:15:58.640] He can't tell me how I can appear. [01:15:58.640 --> 01:16:01.640] They can't just assume that that's a general appearance. [01:16:01.640 --> 01:16:03.640] Can they? [01:16:03.640 --> 01:16:05.640] No, they cannot. [01:16:05.640 --> 01:16:10.640] You have every right to reserve a special appearance. [01:16:10.640 --> 01:16:11.640] Okay. [01:16:11.640 --> 01:16:18.640] Now, because I took exception to that on the record, is that something that I could immediately bring into the pellet court? [01:16:18.640 --> 01:16:25.640] Well, if you made, if it was a court of record, then it's already made for a pellet court. [01:16:25.640 --> 01:16:28.640] And that I'm not, not sure. [01:16:28.640 --> 01:16:42.640] Yeah, you need to file an affidavit just to make sure, but you need to file a signed and sworn affidavit that this is the procedure and what was said between the judge and the defense. [01:16:42.640 --> 01:16:49.640] And the judge attempted to deny a special appearance without authority and jurisdiction to do so. [01:16:49.640 --> 01:16:52.640] Hang on just a second, Tyler, we're just going to go to break. We are talking to Tyler in Wyoming. Alright, Tyler, go ahead. [01:19:18.640 --> 01:19:30.640] Okay, so just to make that clear, I need to write up an affidavit of the conversation that took place and where the judge had denied my special appearance. [01:19:30.640 --> 01:19:32.640] That's correct. [01:19:32.640 --> 01:19:42.640] And I haven't had my official trial yet. That'll be in June. So do I bring that up with the trial, that affidavit, or when do I reserve that? Who do I send it to? [01:19:42.640 --> 01:19:48.640] Well, you file the affidavit in the court record as soon as you get it completed and verified. [01:19:48.640 --> 01:19:57.640] Then at trial, you're going to make a list of outstanding objections that you won't record it into the record if it is a court of record. [01:19:57.640 --> 01:20:13.640] If it's not, then you need to make sure that these outstanding objections are written into a motion for that purpose and filed with the court before trial. [01:20:13.640 --> 01:20:34.640] Okay. And remember, always do everything in writing, make the record in writing, regardless of whether or not there's a court reporter, because court reporters, as in my case, are renowned for not getting everything into the record, whether intentionally or not. [01:20:34.640 --> 01:20:47.640] Now, forgive me for not knowing this. I just, I have not gone to court except for once. How do you, these objections and these things you want to put, like Mr. Savage, how do you get that into the court record? [01:20:47.640 --> 01:20:54.640] You just write it up and then you take it into the clerk of the court and say file this and this cause number. [01:20:54.640 --> 01:20:56.640] Under the case number. [01:20:56.640 --> 01:20:58.640] Correct. [01:20:58.640 --> 01:21:04.640] Okay. And then that automatically becomes a part of the record. Now, do you do the same thing with your legal briefs and stuff before trial? [01:21:04.640 --> 01:21:05.640] Yes. [01:21:05.640 --> 01:21:07.640] Make those a part of the, okay. [01:21:07.640 --> 01:21:13.640] Yes. Everything you write to put into the case is filed the same way. Do the clerk of the court. [01:21:13.640 --> 01:21:18.640] Okay. And then just tell her that you're filing this for the record? [01:21:18.640 --> 01:21:23.640] You don't have to tell her anything. Just say file this and give me a stamp on my copies. [01:21:23.640 --> 01:21:25.640] Okay. Okay. Under that case number. [01:21:25.640 --> 01:21:30.640] As long as it's got the cause number on it, then that's all she needs. [01:21:30.640 --> 01:21:39.640] She does not have, he or she does not have the authority to tell you what you can and cannot file. So don't let them get away with that either. [01:21:39.640 --> 01:21:54.640] Okay. Well, and they're, they're a little behind schedule here. They even, I don't know if they just don't know if they're trying to buffalo you because I even had one lady tell me she looked at me when I was trying to file something in my last, if you could have thought. [01:21:54.640 --> 01:21:57.640] And she said, are you an attorney? I said no. [01:21:57.640 --> 01:22:07.640] Okay. Here's the deal. If ignorance is truly bliss, then you were dealing with some ecstatically happy people. [01:22:07.640 --> 01:22:17.640] Okay. The other possibility is, is that they are criminally denying you in a right. [01:22:17.640 --> 01:22:18.640] Right. [01:22:18.640 --> 01:22:20.640] Either way does not bode well for them. [01:22:20.640 --> 01:22:22.640] Sure. Sure. [01:22:22.640 --> 01:22:28.640] Okay. Okay. And real quick, I know you got probably some other callers, but [01:22:28.640 --> 01:22:31.640] No, if you're the only one I got at the moment, so take your time. [01:22:31.640 --> 01:22:35.640] Okay. Okay. So I have a couple questions then. [01:22:35.640 --> 01:22:51.640] I, the way I want to fight this, and I told the judge, I said after I took exception to his denial, I said, Your Honor, I said, I'm not coming in here to argue the merits of the case, whether I had a current tag or not. [01:22:51.640 --> 01:23:01.640] I said, I am going to base my defense on the fact that I did not commit a crime. [01:23:01.640 --> 01:23:04.640] And he just got quiet. He didn't say anything. [01:23:04.640 --> 01:23:09.640] But then another question I'd asked him, he wanted me to post the bond. [01:23:09.640 --> 01:23:13.640] The bond was the exact amount that the ticket was, $85. [01:23:13.640 --> 01:23:22.640] But it says right on my summons, right on my ticket, it's marked, it says may forfeit bond and lieu of appearance. [01:23:22.640 --> 01:23:24.640] And I told him that. [01:23:24.640 --> 01:23:25.640] I said, No, wait a minute. [01:23:25.640 --> 01:23:27.640] I said, Why do I have to put the bond before my trial? [01:23:27.640 --> 01:23:29.640] Because it's the same value of the ticket. [01:23:29.640 --> 01:23:31.640] It says, It's like I'm chasing my money. [01:23:31.640 --> 01:23:33.640] I'm figured once they have it, they don't want to give it back. [01:23:33.640 --> 01:23:41.640] So it almost like it make it like even harder for me with the case because they got it in their possession, you know, and that's what I'm thinking. [01:23:41.640 --> 01:23:45.640] And I'm thinking on this summons and this is what I'm supposed to be controlled by. [01:23:45.640 --> 01:23:49.640] It says that if I show up, I can forfeit the bond. [01:23:49.640 --> 01:24:00.640] And he tried to tell me that he just made the excuse that, Well, we used to do it that way, but people weren't showing up for court and wasting our time basically. [01:24:00.640 --> 01:24:04.640] You know, the officers were showing up, but the defense wasn't. [01:24:04.640 --> 01:24:08.640] And I said, Well, your honor, if I did that, I said you could charge me with failure to peer. [01:24:08.640 --> 01:24:13.640] And he said, Well, we don't have to worry about that if you prepay for the bond. [01:24:13.640 --> 01:24:17.640] And I'm wondering, but he never cited a law or anything. [01:24:17.640 --> 01:24:21.640] In my misinterpreting map, I mean, can he make me post the bond? [01:24:21.640 --> 01:24:24.640] See, I didn't have to post it before it came to the arraignment. [01:24:24.640 --> 01:24:28.640] So my question is, why would I have to post it before I'm going through my trial? [01:24:28.640 --> 01:24:30.640] And said to fight it, decided to. [01:24:30.640 --> 01:24:35.640] Well, that's what you need to be familiar with the criminal procedures in your state for. [01:24:35.640 --> 01:24:38.640] That's why you need to read the rules of the game. [01:24:38.640 --> 01:24:45.640] What is the lawful authority for demanding a bond in these types of cases? [01:24:45.640 --> 01:24:46.640] Okay. [01:24:46.640 --> 01:24:55.640] For instance, here in Texas, except for good cause shown, the judge must release you on a PR bond, meaning no money. [01:24:55.640 --> 01:24:57.640] It's a personal reconnaissance bond. [01:24:57.640 --> 01:24:59.640] You're to appear on your word. [01:24:59.640 --> 01:25:09.640] He can't charge you a monetary bond unless he can give good cause as to why he's requiring a monetary bond. [01:25:09.640 --> 01:25:11.640] Okay. [01:25:11.640 --> 01:25:21.640] So unless you know what the rules governing a bond in these types of cases are, they can demand anything they want because you don't know how to say no, you can't. [01:25:21.640 --> 01:25:22.640] Exactly. [01:25:22.640 --> 01:25:23.640] Yeah. [01:25:23.640 --> 01:25:33.640] So now what you need to do is look up those rules and if he did something that was not allowed, then you do another affidavit. [01:25:33.640 --> 01:25:47.640] And then you file a motion to recuse or disqualify because the judge violated your rights and fell to abide by the rules related to the duties of his office. [01:25:47.640 --> 01:25:48.640] Okay. [01:25:48.640 --> 01:26:02.640] Which means he's incompetent to act because he neither understands nor abides by the rules that govern his method of operation. [01:26:02.640 --> 01:26:07.640] And that would be a motion to recuse from that judge from residing over that case? [01:26:07.640 --> 01:26:11.640] It's either a motion to disqualify or a motion to recuse. [01:26:11.640 --> 01:26:17.640] You have to look and see what the qualifications are for each of those in Wyoming. [01:26:17.640 --> 01:26:18.640] Okay. [01:26:18.640 --> 01:26:21.640] So it'll be either a motion to disqualify or a motion to recuse. [01:26:21.640 --> 01:26:22.640] It'll be one or the other. [01:26:22.640 --> 01:26:23.640] Yes. [01:26:23.640 --> 01:26:24.640] Alrighty. [01:26:24.640 --> 01:26:25.640] I'll look that up. [01:26:25.640 --> 01:26:32.640] And the rules, is this going to be just the traffic and traction rules or would this be in the... [01:26:32.640 --> 01:26:33.640] No. [01:26:33.640 --> 01:26:34.640] This is the court procedure rules. [01:26:34.640 --> 01:26:46.640] And if it's for criminal cases like for instance here in Texas, it will be governed by the Code of Criminal Procedure because they're saying that the act is a crime, then the criminal procedure rules is what governs. [01:26:46.640 --> 01:26:54.640] So whatever constitutes the criminal procedure rules in Wyoming, that's what you need to be reading. [01:26:54.640 --> 01:26:59.640] And then there may be a separate set of rules depending upon what kind of court it is. [01:26:59.640 --> 01:27:09.640] For instance, here in Texas courts of record have separate rules written for them into a particular chapter of the government code. [01:27:09.640 --> 01:27:11.640] Wyoming may have the same thing. [01:27:11.640 --> 01:27:19.640] So there may be several things you need to get familiar with, but you need to do it. [01:27:19.640 --> 01:27:20.640] Okay. [01:27:20.640 --> 01:27:25.640] Because it's the only way to play by the rules of the game is to know what they are. [01:27:25.640 --> 01:27:33.640] Otherwise, the other people playing the game can tell you anything they want and say that's the rules and you're none the wiser. [01:27:33.640 --> 01:27:35.640] And that's what they do. [01:27:35.640 --> 01:27:39.640] That's exactly what they do. [01:27:39.640 --> 01:27:40.640] Okay. [01:27:40.640 --> 01:27:46.640] I have made it my job to teach the people of Texas where that's a lie. [01:27:46.640 --> 01:27:48.640] Okay. [01:27:48.640 --> 01:27:55.640] This is kind of a dumb question, Eddie, forgive me, but in the Wyoming Rules of Criminal Procedures, it's a pretty big book. [01:27:55.640 --> 01:27:56.640] How do you know? [01:27:56.640 --> 01:27:58.640] Yeah, but you don't need to know it all. [01:27:58.640 --> 01:28:02.640] There's only going to be specific things in there you will need to read. [01:28:02.640 --> 01:28:06.640] You'll need to read any section dealing with a bond, for instance. [01:28:06.640 --> 01:28:07.640] A bond. [01:28:07.640 --> 01:28:20.640] And yeah, you'll need to read anything dealing with the authority to arrest without warrant, which is what will happen when you're stopped for the purpose of being issued a citation. [01:28:20.640 --> 01:28:25.640] That may be in whatever constitutes your transportation code there. [01:28:25.640 --> 01:28:39.640] But no matter how you slice it, the offense will be in whatever that code is, and then the rules governing the court and the prosecution will be in the Code of Criminal Procedure, whatever that is in Wyoming. [01:28:39.640 --> 01:28:45.640] So you need to know, one, what the Code of Criminal Procedure says your rights are, which should be the very first chapter. [01:28:45.640 --> 01:28:53.640] Second chapter will probably be what the duties of the officers are, which will be the judge and the prosecutor. [01:28:53.640 --> 01:29:00.640] After that, you will find the individual chapters and sections that deal with the areas over which you have questions. [01:29:00.640 --> 01:29:11.640] See if there's a section dedicated, is this a municipal court, a justice court, or a particular type of court where only fine only offenses are heard or what? [01:29:11.640 --> 01:29:13.640] It is municipal. [01:29:13.640 --> 01:29:14.640] Okay. [01:29:14.640 --> 01:29:22.640] Then see if there's something in the Code of Criminal Procedure that is specific to municipal courts and their procedures and jurisdiction. [01:29:22.640 --> 01:29:24.640] Okay. [01:29:24.640 --> 01:29:26.640] Okay. [01:29:26.640 --> 01:29:34.640] For instance, here it's chapter 45, and that chapter deals specifically with justice courts and municipal courts. [01:29:34.640 --> 01:29:36.640] Okay. [01:29:36.640 --> 01:29:38.640] Okay. [01:29:38.640 --> 01:29:40.640] All right, anything else? [01:29:40.640 --> 01:29:43.640] I just had one question, the other side of the question. [01:29:43.640 --> 01:29:48.640] Hang on, we'll get that on the other side then and finish up with you. Dennis, I see you on the board, hang on. [01:29:48.640 --> 01:29:56.640] We'll be back to get you here as soon as we're finished with Tyler on the other side. This is rule of law radio 512-646-984 is the call-in number. [01:29:56.640 --> 01:29:59.640] We'll be right back after the break. [01:29:59.640 --> 01:30:05.640] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11. [01:30:05.640 --> 01:30:07.640] The government says that fire brought it down. [01:30:07.640 --> 01:30:12.640] However, 1,500 architects and engineers concluded it was a controlled demolition. [01:30:12.640 --> 01:30:15.640] Over 6,000 of my fellow service members have given their lives. [01:30:15.640 --> 01:30:19.640] I'm not a conspiracy theorist. [01:30:19.640 --> 01:30:20.640] I'm a structural engineer. [01:30:20.640 --> 01:30:21.640] I'm a New York City correctional. [01:30:21.640 --> 01:30:22.640] I'm an Air Force pilot. [01:30:22.640 --> 01:30:24.640] I'm the father who lost his son. [01:30:24.640 --> 01:30:26.640] We're Americans, and we deserve the truth. [01:30:26.640 --> 01:30:49.640] Go to RememberBuilding7.org today. [01:30:56.640 --> 01:31:00.640] Let's see what our powders, sieves, and oil can do for you. [01:31:11.640 --> 01:31:17.640] The team behind Centrition believes that supplements should over-deliver on their promises. [01:31:17.640 --> 01:31:20.640] And Centrition does just that. [01:31:20.640 --> 01:31:25.640] Centrition utilizes the ancient healing wisdom of Chinese medicine. [01:32:18.640 --> 01:32:29.640] This is Bill Launt Radio and your host, Eddie Craig. [01:32:29.640 --> 01:32:35.640] On this citation complaint, it is titled, Topp, State of Wyoming. [01:32:35.640 --> 01:32:41.640] And then it says, member in RBC, which I hear is a joke. [01:32:41.640 --> 01:32:44.640] I don't know all about it. [01:32:44.640 --> 01:32:48.640] Okay, that's something else you're going to need to look up in the statutes. [01:32:48.640 --> 01:32:51.640] Can the citation constitute a proper complaint? [01:32:51.640 --> 01:32:57.640] You'll need to find out what the rules are about what a complaint must contain. [01:32:57.640 --> 01:33:02.640] And then you're going to want to compare it to that citation and see if it does. [01:33:02.640 --> 01:33:13.640] Most complaints must have a signature, and they must be signed in front of someone that can administer an oath for that signature. [01:33:13.640 --> 01:33:17.640] And they must verify with their own signature. [01:33:17.640 --> 01:33:29.640] So if the complaints in Wyoming, like they are in Texas, are required to be sworn, then that citation cannot be a proper complaint. [01:33:29.640 --> 01:33:33.640] And you need to be challenging it on those rules. [01:33:33.640 --> 01:33:34.640] That's a good idea. [01:33:34.640 --> 01:33:37.640] I will look into that. [01:33:37.640 --> 01:33:43.640] My question here is, and that's a good thanks for bringing that up. I'll check that out, Eddie. [01:33:43.640 --> 01:33:46.640] It says, State of Wyoming on the citation. [01:33:46.640 --> 01:33:55.640] But when I set this trial and they sent me the time schedule, the mail here, it doesn't say the State of Wyoming. [01:33:55.640 --> 01:33:58.640] It says, the City of Cheyenne. [01:33:58.640 --> 01:34:00.640] And that may not be a big deal. [01:34:00.640 --> 01:34:09.640] It may say, well, that's incorporated in the State, but it just seems like if somebody issues you a summons and it's a State, [01:34:09.640 --> 01:34:16.640] and then it goes to trial, and then all of a sudden it has the City on there, it seems like it's two different parties. [01:34:16.640 --> 01:34:19.640] And I don't wonder if that would even be worth making an issue of. [01:34:19.640 --> 01:34:20.640] Well, it is. [01:34:20.640 --> 01:34:25.640] The question is, is who has the power to prosecute the case? [01:34:25.640 --> 01:34:35.640] Like, for instance, here in Texas, the Texas Constitution specifically grants the power to prosecute in the name of the state, [01:34:35.640 --> 01:34:39.640] to the county or district attorney, and to no one else. [01:34:39.640 --> 01:35:00.640] Yet in Texas, they try to use in municipal courts the city attorney as a prosecutor because the legislator that created a certain statute believes they have the power to delegate a constitutional authority to a non-state actor. [01:35:00.640 --> 01:35:02.640] And they don't. [01:35:02.640 --> 01:35:05.640] So that's another thing to challenge. [01:35:05.640 --> 01:35:09.640] Who is given the prosecutorial power of the state in Wyoming? [01:35:09.640 --> 01:35:12.640] Check your state constitution and find out. [01:35:12.640 --> 01:35:25.640] Then, if that is not who is acting as the prosecutor, object to that in writing as a violation of the constitutional section and article that it violated. [01:35:25.640 --> 01:35:28.640] Okay, and that would be an affidavit form as well. [01:35:28.640 --> 01:35:34.640] No, that would be a motion to dismiss or to disqualify. [01:35:34.640 --> 01:35:35.640] Okay. [01:35:35.640 --> 01:35:41.640] You're going to disqualify the prosecutor as being incapable of serving in that office. [01:35:41.640 --> 01:35:42.640] I see. [01:35:42.640 --> 01:35:43.640] All right. [01:35:43.640 --> 01:35:48.640] Or you're going to demand a dismissal because this is a kangaroo court. [01:35:48.640 --> 01:35:57.640] If any Tom, Dick, and Harry attorney can come say, I'm going to prosecute you today, even though I'm not an officer of the state. [01:35:57.640 --> 01:35:59.640] All right. [01:35:59.640 --> 01:36:00.640] Okay. [01:36:00.640 --> 01:36:01.640] Well, you've been helpful. [01:36:01.640 --> 01:36:03.640] I appreciate your time. [01:36:03.640 --> 01:36:04.640] Yes, sir. [01:36:04.640 --> 01:36:06.640] Thank you for calling in. [01:36:06.640 --> 01:36:07.640] Thank you. [01:36:07.640 --> 01:36:08.640] Yes, sir. [01:36:08.640 --> 01:36:09.640] All right. [01:36:09.640 --> 01:36:11.640] Now we're going to go to Dennis in Michigan. [01:36:11.640 --> 01:36:13.640] Dennis, what can we do for you? [01:36:13.640 --> 01:36:15.640] It's a pleasure to talk to you, Eddie. [01:36:15.640 --> 01:36:22.640] I'm a rule of law or a logos radio member, and I first heard about you through the Alex Jones show. [01:36:22.640 --> 01:36:26.640] So I'm glad you took the time to be on the show. [01:36:26.640 --> 01:36:29.640] Well, time to be on is not an issue. [01:36:29.640 --> 01:36:31.640] Getting back on there seems to be the... [01:36:31.640 --> 01:36:34.640] I'm sure you're a busy man, too. [01:36:34.640 --> 01:36:42.640] So a funny thing happened to me on the way to work about two months ago. [01:36:42.640 --> 01:36:50.640] I was traveling on my way to work, and my vehicle stalled out on me. [01:36:50.640 --> 01:37:00.640] So I was ready to call a tow truck, and a police officer pulled up behind me, and he asked me if I needed any assistance. [01:37:00.640 --> 01:37:05.640] And if I wanted him to push me into the nearest church parking lot. [01:37:05.640 --> 01:37:10.640] And, you know, he seemed really friendly, and I was like, well, sure, you know, it'd be great. [01:37:10.640 --> 01:37:19.640] And so he went ahead and pushed my vehicle into the parking lot, and we kind of had, you know, made a little small talk. [01:37:19.640 --> 01:37:24.640] And he was on his way back to his vehicle, you know, wished me a good day. [01:37:24.640 --> 01:37:25.640] He was on the way... [01:37:25.640 --> 01:37:31.640] And he turned around and said, you know, you mind if I just, you know, see your driver's license? [01:37:31.640 --> 01:37:33.640] And I didn't really think much of it. [01:37:33.640 --> 01:37:34.640] I said, sure, go ahead. [01:37:34.640 --> 01:37:39.640] And are you still there, Eddie? [01:37:39.640 --> 01:37:40.640] Yeah, I'm here. Go ahead. [01:37:40.640 --> 01:37:42.640] Oh, I'm sorry. I'm sorry. [01:37:42.640 --> 01:37:46.640] And so I, you know, he grabbed my license. [01:37:46.640 --> 01:37:54.640] I gave him my driver's license, and he comes back a couple minutes later and said, well, you know, [01:37:54.640 --> 01:38:02.640] were you aware that there was a bench warrant put out for you, you know, about two years ago? [01:38:02.640 --> 01:38:05.640] And I said, well, no, but I know now. [01:38:05.640 --> 01:38:10.640] And he said, well, and he had this weird look on his face. [01:38:10.640 --> 01:38:13.640] He said, did you recently move? [01:38:13.640 --> 01:38:17.640] And I said, no, I've been at this same address for the last 10 years. [01:38:17.640 --> 01:38:21.640] And he kind of had like a weird look on his face. [01:38:21.640 --> 01:38:23.640] And he said, so you haven't moved? [01:38:23.640 --> 01:38:26.640] I said, no, I've been here for the last 10 years. [01:38:26.640 --> 01:38:35.640] And, you know, and he said, well, because here's the thing, this is what I found out later on. [01:38:35.640 --> 01:38:37.640] Right here, I'm kind of going out of order here. [01:38:37.640 --> 01:38:43.640] So he said, well, you know, I'm afraid I'm going to have to take you in so that you can, you know, get this cleared up. [01:38:43.640 --> 01:38:44.640] I don't really know what's going on. [01:38:44.640 --> 01:38:48.640] I only know what's on the computer in front of me, you know, and it says you have a bench warrant. [01:38:48.640 --> 01:38:50.640] It has a different address, though. [01:38:50.640 --> 01:38:58.640] That's why, and that's why he asked me if I had moved because he didn't even know if he was, you know, if I was even the right guy, [01:38:58.640 --> 01:39:00.640] because he even seemed a little confused. [01:39:00.640 --> 01:39:05.640] And so we're in the back of the top car and that's, I was in the back of the top car. [01:39:05.640 --> 01:39:11.640] And that's when he explained to me, you know, he's really nice and he's like, well, you know, I'm not really sure what's going on here, [01:39:11.640 --> 01:39:14.640] but you're going to have to get this cleared up, of course. [01:39:14.640 --> 01:39:29.640] And, you know, what I found out is that I actually got into, I got, two years ago, I was actually attacked by two guys that were, you know, drunk. [01:39:29.640 --> 01:39:35.640] And I defended myself and they ended up getting the, you know, short end of the stick. [01:39:35.640 --> 01:39:40.640] And that is, you know, just two years ago, I didn't really think much of it. [01:39:40.640 --> 01:39:47.640] And I've had, you know, I think about like elementary school, I mean, playground fights that were worse than this. [01:39:47.640 --> 01:39:50.640] I mean, this wasn't anything, you know, too serious. [01:39:50.640 --> 01:39:54.640] It was like a minor stopper that lasted all about 30 seconds. [01:39:54.640 --> 01:40:00.640] And I was lucky that, you know, I didn't get hit by a beer bottle or whatever, you know, you got two drunk guys attacking me. [01:40:00.640 --> 01:40:04.640] And so I didn't really think much of it. [01:40:04.640 --> 01:40:11.640] You know, and I found out that one of the guys actually had the nerve to press charges against me. [01:40:11.640 --> 01:40:21.640] And what happened was, and I found this out after I got bonded out, after I, you know, made bail, and I talked to my lawyer. [01:40:21.640 --> 01:40:26.640] And so I'm trying to figure out what's going on here, who, you know. [01:40:26.640 --> 01:40:36.640] And what happened was the person, the, you know, the person who, you know, is accused of assaulting him, [01:40:36.640 --> 01:40:41.640] basically he made up an address. [01:40:41.640 --> 01:40:43.640] He didn't even really know my name. [01:40:43.640 --> 01:40:46.640] And he heard from some other people. [01:40:46.640 --> 01:40:51.640] He basically got my name from a friend of a friend, I guess. [01:40:51.640 --> 01:40:57.640] I had no idea where I lived or anything like that. So he basically told the police I made up address. [01:40:57.640 --> 01:41:05.640] And so that is why, you know, I've been, that's why, you know, for the last two years I had no idea that anyone pressed any charges against me, [01:41:05.640 --> 01:41:10.640] let alone, you know, running around town with a bench warrant out for my arrest. [01:41:10.640 --> 01:41:24.640] So I've heard Randy and you talk about the, you know, how, you know, getting in cases dismissed because no due notice, no proper notification. [01:41:24.640 --> 01:41:32.640] And I was wondering if this would fall under that, if I was wondering if this would fall under that. [01:41:32.640 --> 01:41:38.640] Well, I'm okay. I don't understand what you mean by fall under that. [01:41:38.640 --> 01:41:46.640] Well, I never received any type of notification. I never received anything from a detective, nothing. [01:41:46.640 --> 01:41:53.640] This is just completely, you know, it seems to me that, you know, if you're being charged with a crime, [01:41:53.640 --> 01:41:59.640] you know, or, you know, you should receive something from a detective or, you know, receive something. [01:41:59.640 --> 01:42:06.640] Well, you should, but if they gave them the wrong address, then they would not have located you unless they actually came out and searched. [01:42:06.640 --> 01:42:10.640] The best way to find that out is go take a look at the incident report. [01:42:10.640 --> 01:42:22.640] If there's been any investigation into the accusation, everybody would have been filing a report for any activity they've taken in the case during the investigation. [01:42:22.640 --> 01:42:31.640] Now, you may or may not be allowed to see that, but there should a minimum be a police report associated with the bench warrant. [01:42:31.640 --> 01:42:38.640] Because in order for the bench warrant to have been issued, there has to be a sworn statement of probable cause, [01:42:38.640 --> 01:42:47.640] which means the guy making the complaint would have had to sign a sworn statement under that to make that complaint and get that warrant issued. [01:42:47.640 --> 01:42:50.640] And you have the right to see that. [01:42:50.640 --> 01:43:02.640] Okay, so he told, he basically, he told the authorities, the police officer, he basically made up address, you know, the address, the home address that he gave. [01:43:02.640 --> 01:43:05.640] I don't know where he got it from or anything, you know, I have no idea. [01:43:05.640 --> 01:43:10.640] But anyways, the address that he gave them, I've never, you know, I don't live there. [01:43:10.640 --> 01:43:12.640] And here's the strip too. [01:43:12.640 --> 01:43:22.640] I was going to say, if I could, if I might add, what's strange is that about four months ago, I received from the very same court, [01:43:22.640 --> 01:43:36.640] which I'm going to be going to trial for, the exact same court actually sent jury duty request papers to the right address. [01:43:36.640 --> 01:43:40.640] So they had my correct address for the last 10 years. [01:43:40.640 --> 01:43:47.640] Well, yeah, but that doesn't necessarily mean that they associate two people with the same name as being in the same address. [01:43:47.640 --> 01:43:48.640] That may or may not be. [01:43:48.640 --> 01:43:51.640] They need a other identification to differentiate. [01:43:51.640 --> 01:43:52.640] Hang on, Dennis. [01:43:52.640 --> 01:43:54.640] All right, folks, this is a little long radio. [01:43:54.640 --> 01:43:55.640] We're about to go to break. [01:43:55.640 --> 01:43:59.640] 512-646-1984 will be... [01:46:19.640 --> 01:46:25.640] Okay Hannibal, I see you there on the board, hang on and as soon as I get finished with Dennis, I will get to you. [01:46:25.640 --> 01:46:28.640] Alright Dennis, let's see what else we can handle here. [01:46:28.640 --> 01:46:38.640] As I was saying, they don't necessarily know that just because you have the same name, that this other address that you're the same guy. [01:46:38.640 --> 01:46:48.640] So the fact that they have you under one address and a name for you at a different address doesn't mean they're going to reconcile the two automatically. [01:46:48.640 --> 01:46:53.640] Oh sorry, I forgot to unmute you. [01:46:53.640 --> 01:46:55.640] Go ahead and say that again. [01:46:55.640 --> 01:47:10.640] Oh I was going to say I guess you really did, I guess you did answer the question that I was really kind of getting at which was the level I guess of responsibility they have to, I mean all they had to do was check the Secretary of State. [01:47:10.640 --> 01:47:23.640] You know, because they had my name, age and everything else correct except my home address, which is because, you know, because the person who's accusing me of assaulting them made up a phony address. [01:47:23.640 --> 01:47:34.640] Right, well what you do have evidence of here, or at least prima facie evidence of, is that no one has actually investigated the complaint. [01:47:34.640 --> 01:47:42.640] If they had, they would have come looking for anyone with that name regardless of address. [01:47:42.640 --> 01:47:44.640] They would have done exactly that. [01:47:44.640 --> 01:47:52.640] The first thing they would have done would be open up a locator file to figure out where anyone with this name actually is. [01:47:52.640 --> 01:48:06.640] Because when they go to that site of the address and it's invalid and no one by that name lives there, if the address even exists, then the next thing they're going to do is start tracing down the name. [01:48:06.640 --> 01:48:11.640] Well obviously that hasn't happened, they would have been knocking on your door. [01:48:11.640 --> 01:48:14.640] Which I wish they would have, so at least they would have had when they got here. [01:48:14.640 --> 01:48:27.640] Well that may be true. Now what has to happen is, is you're going to have to demand that this guy be called in and you need to immediately file counter charges against him. [01:48:27.640 --> 01:48:28.640] Yes. [01:48:28.640 --> 01:48:43.640] And here's why. If there are no witnesses to the event, then an assault is basically put on the back burner if both parties press charges against the other party. [01:48:43.640 --> 01:48:52.640] It's a stalemate because the only witnesses are the two of them and both of them are arguing the other guy did it. [01:48:52.640 --> 01:48:59.640] So there's no one to corroborate the stories and point the finger at any particular one. [01:48:59.640 --> 01:49:10.640] Now if you said two guys came at you, pray real hard that they don't team up unless you've got witnesses of your own that can verify your side of the story. [01:49:10.640 --> 01:49:15.640] And that your witnesses are more credible than either of these guys. [01:49:15.640 --> 01:49:26.640] And that kind of reminded me of another question that I wanted to ask you which is, if I remember correctly, the Sixth Amendment and the Confrontation Clause. [01:49:26.640 --> 01:49:35.640] Because one of the things that got brought up at the pre-settlement conference, which that's what we do here in Grand Rapids, [01:49:35.640 --> 01:49:41.640] and this is the very first time I talked to my lawyer. [01:49:41.640 --> 01:49:51.640] She remarked that it doesn't look as though they can even find out where this guy lives because this guy is a bit of a vagabond. [01:49:51.640 --> 01:49:53.640] Right. [01:49:53.640 --> 01:49:59.640] In which case there will be no one to come to your trial to testify against you and they'll have to drop the case. [01:49:59.640 --> 01:50:03.640] But now here's another thing. Are you being charged with a felony or a misdemeanor? [01:50:03.640 --> 01:50:08.640] No, it's just a misdemeanor. This is like a little off. [01:50:08.640 --> 01:50:09.640] Okay. [01:50:09.640 --> 01:50:14.640] Then the statute of limitations on it should be no more than two years. [01:50:14.640 --> 01:50:22.640] And if this was ten years ago or three years ago, they're outside of the statute of limitations to prosecute. [01:50:22.640 --> 01:50:24.640] Ah, okay. [01:50:24.640 --> 01:50:26.640] Eddie, I'm so glad you said that. [01:50:26.640 --> 01:50:30.640] You should know this. [01:50:30.640 --> 01:50:39.640] Yeah, like I said, I only talked to my lawyer one time and she was pretty confident that this really... [01:50:39.640 --> 01:50:43.640] Her whole thing was that they can't even track this guy down. [01:50:43.640 --> 01:50:47.640] They don't even know where this guy is. [01:50:47.640 --> 01:50:51.640] And her whole thing was this is probably going to get thrown out just because this guy... [01:50:51.640 --> 01:50:55.640] No one can find him. [01:50:55.640 --> 01:50:58.640] But I don't really want to rely on that. [01:50:58.640 --> 01:51:07.640] The Conflictation Clause, the right to face your accuser, does that happen? [01:51:07.640 --> 01:51:09.640] How do you... [01:51:09.640 --> 01:51:15.640] Well, that's what I'm telling you. If they can't find him, there's no one to be a witness against you. [01:51:15.640 --> 01:51:19.640] He signed the complaint. He is the initiating witness. [01:51:19.640 --> 01:51:23.640] If they try to hold a trial and they don't have a witness, [01:51:23.640 --> 01:51:29.640] then you have a malicious prosecution suit you can bring against them. [01:51:29.640 --> 01:51:30.640] Okay. [01:51:30.640 --> 01:51:37.640] And even if they find this guy, they're outside of their statute of limitations, most likely. [01:51:37.640 --> 01:51:45.640] In which case, if they still try to prosecute, they're going to lose. [01:51:45.640 --> 01:51:51.640] Here's the thing that you triggered a memory from, Eddie. [01:51:51.640 --> 01:51:55.640] Actually, now I just remembered this. [01:51:55.640 --> 01:52:02.640] What happened after he got my name, my first and last name from a friend of a friend, [01:52:02.640 --> 01:52:08.640] because this guy wasn't a friend of mine, he was like an acquaintance. [01:52:08.640 --> 01:52:11.640] What happened was he... [01:52:11.640 --> 01:52:14.640] I think it's called FileMaker or something. [01:52:14.640 --> 01:52:19.640] Basically, what you were describing where they run someone's name and they try to get information. [01:52:19.640 --> 01:52:27.640] What I was told when I looked at the police report was that they brought him in for a photo lineup, [01:52:27.640 --> 01:52:33.640] because I had a misdemeanor from like 15 years ago. [01:52:33.640 --> 01:52:35.640] A misdemeanor from 15 years ago. [01:52:35.640 --> 01:52:41.640] So I was in the criminal database, I just could say. [01:52:41.640 --> 01:52:43.640] And so my photo was right there. [01:52:43.640 --> 01:52:47.640] And that's actually where he fingered me. [01:52:47.640 --> 01:52:53.640] In fact, he said, I think that's the guy although he looks a little different now. [01:52:53.640 --> 01:52:55.640] But here's the thing too. [01:52:55.640 --> 01:53:03.640] The address that they would have had in that criminal database is the same address that I still live in. [01:53:03.640 --> 01:53:10.640] So I don't see how they decided to use the address that he made up. [01:53:10.640 --> 01:53:16.640] When my correct address was right there in the database for them to see. [01:53:16.640 --> 01:53:24.640] Well, again, it's just a prima facie proof that nobody ever investigated the complaint. [01:53:24.640 --> 01:53:25.640] Right. [01:53:25.640 --> 01:53:34.640] If they had, then all of that information would have been checked and somebody would have been paying you a visit. [01:53:34.640 --> 01:53:37.640] Which I wish would have happened today. [01:53:37.640 --> 01:53:38.640] Right. [01:53:38.640 --> 01:53:40.640] And you can bring that up. [01:53:40.640 --> 01:53:43.640] Why was this not investigated sooner? [01:53:43.640 --> 01:53:47.640] Why did no one ever come and talk to me about this? [01:53:47.640 --> 01:53:51.640] Because all the information you need is right there. [01:53:51.640 --> 01:53:52.640] Right. [01:53:52.640 --> 01:53:56.640] So you had an outstanding warrant and nobody investigating anything. [01:53:56.640 --> 01:54:09.640] And now suddenly I'm caught up in an old incident that the other guy is actually guilty of starting but lied and pressed charges against me. [01:54:09.640 --> 01:54:15.640] So can I get this dismissed just because it wasn't thoroughly investigated then or? [01:54:15.640 --> 01:54:16.640] Oh, no. [01:54:16.640 --> 01:54:21.640] But your attorney can use that as mitigating factors to the case. [01:54:21.640 --> 01:54:22.640] I see. [01:54:22.640 --> 01:54:24.640] Now here's the other thing. [01:54:24.640 --> 01:54:32.640] In case they try to charge you with being fleeing prosecution or anything of that nature. [01:54:32.640 --> 01:54:33.640] No. [01:54:33.640 --> 01:54:51.640] In fact, usually at a pre-settlement conference, I haven't even talked to a prosecutor or anything because I don't even know if they're going to go through this whole thing because they can't find the person who they can't find the complaint. [01:54:51.640 --> 01:54:52.640] Right. [01:54:52.640 --> 01:54:53.640] And probably they won't. [01:54:53.640 --> 01:55:00.640] Like I say, they're getting close to their statute of limitations if they're not past it already. [01:55:00.640 --> 01:55:01.640] Yeah. [01:55:01.640 --> 01:55:09.640] So most likely they're not going to, especially if they can't find a guy that's got an old record, which it sounds like this guy probably does. [01:55:09.640 --> 01:55:11.640] I imagine he does. [01:55:11.640 --> 01:55:13.640] He's quite the troublemaker. [01:55:13.640 --> 01:55:14.640] Okay. [01:55:14.640 --> 01:55:17.640] Was there anything else I could help you with then? [01:55:17.640 --> 01:55:20.640] I got one more call before we run out of time here. [01:55:20.640 --> 01:55:21.640] No. [01:55:21.640 --> 01:55:24.640] I just wanted to tell you, I'm so glad that... [01:55:24.640 --> 01:55:25.640] Oh, I do have one last question. [01:55:25.640 --> 01:55:27.640] It's a real quick one. [01:55:27.640 --> 01:55:34.640] Are you going to, in the future, you, Eddie, and Deborah, are you going to sell a rule of law t-shirt so I can be a walking billboard for you guys? [01:55:34.640 --> 01:55:42.640] You know, because you've got such a great product, a great show, and more people need to know about it. [01:55:42.640 --> 01:55:47.640] Well, actually, I like designing t-shirt slogans in my spare time. [01:55:47.640 --> 01:55:53.640] I've come up with quite a few, and I was actually going to breach that subject with Deborah at some point. [01:55:53.640 --> 01:55:57.640] We just have to figure out how we design it, but it's possible. [01:55:57.640 --> 01:56:06.640] And the last thing I want to say is I would encourage everyone who's listening to this radio broadcast to become a member. [01:56:06.640 --> 01:56:09.640] I mean, it's only, what, it's only $4.95 a month. [01:56:09.640 --> 01:56:11.640] I mean, you can't beat it. [01:56:11.640 --> 01:56:16.640] So, you know, the service that you're providing, I mean, I can't tell you how... [01:56:16.640 --> 01:56:31.640] You know, just the vicarious thrill that I get listening to some of your stories and Randy Calton's stories of him just sticking into, you know, public officials that need to be knocked down a peg. [01:56:31.640 --> 01:56:35.640] I mean, I can't even express how happy that makes me. [01:56:35.640 --> 01:56:36.640] I mean, it's... [01:56:36.640 --> 01:56:40.640] That's what we're here to do is to motivate and educate. [01:56:40.640 --> 01:56:44.640] And I definitely need a whole lot of educating, but I do have money. [01:56:44.640 --> 01:56:48.640] I'm more than happy to help you guys out and I have. [01:56:48.640 --> 01:56:50.640] So take care and thank you so much for your time. [01:56:50.640 --> 01:56:51.640] God bless. [01:56:51.640 --> 01:56:52.640] Thanks Dennis. [01:56:52.640 --> 01:56:53.640] You too. [01:56:53.640 --> 01:56:54.640] All right. [01:56:54.640 --> 01:56:56.640] Let's get to Hannibal in New York. [01:56:56.640 --> 01:56:58.640] Hannibal, you got about two minutes. [01:56:58.640 --> 01:57:00.640] What can I do for you? [01:57:00.640 --> 01:57:09.640] Hey, I just have a hearing conference hearing for... [01:57:09.640 --> 01:57:11.640] I'm like, feel like I'm being rushed. [01:57:11.640 --> 01:57:22.640] Anyway, my question is, if I call the City of New York to the stand and they don't respond and I get a default hearing, have you ever heard of anything like that? [01:57:22.640 --> 01:57:24.640] You can't call the state. [01:57:24.640 --> 01:57:27.640] You can only call a representative of the state. [01:57:27.640 --> 01:57:29.640] The state is a legal entity. [01:57:29.640 --> 01:57:35.640] Any legal entity must be represented in a court of law by an attorney. [01:57:35.640 --> 01:57:46.640] Therefore, you can only call a living human being to the stand that is a verifiable representative of that legal entity. [01:57:46.640 --> 01:57:57.640] Now, that means you can call anybody that's an employee of the state that has the capacity to answer in response to whatever your suit is. [01:57:57.640 --> 01:58:06.640] But you are always better going after individuals and then the state as an additional party. [01:58:06.640 --> 01:58:09.640] You can't go just against the state. [01:58:09.640 --> 01:58:12.640] There's no one there to suit. [01:58:12.640 --> 01:58:14.640] Okay. [01:58:14.640 --> 01:58:15.640] All right. [01:58:15.640 --> 01:58:16.640] Thanks very much. [01:58:16.640 --> 01:58:17.640] Okay. [01:58:17.640 --> 01:58:18.640] You're welcome. [01:58:18.640 --> 01:58:20.640] All right, folks. [01:58:20.640 --> 01:58:21.640] Mark, I'm sorry. [01:58:21.640 --> 01:58:22.640] That's the end of the show. [01:58:22.640 --> 01:58:24.640] We don't have time to take your call. [01:58:24.640 --> 01:58:27.640] Please call back in Thursday if at all possible. [01:58:27.640 --> 01:58:29.640] This is Eddie Craig. [01:58:29.640 --> 01:58:35.640] This has been the Rule of Law Radio Monday Night Traffic Show with Debra Stevens, Randy Kelp. [01:58:35.640 --> 01:58:37.640] Take all of you out there for listening. [01:58:37.640 --> 01:58:39.640] Please continue to do so. [01:58:39.640 --> 01:58:42.640] Please remember to financially support the network. [01:58:42.640 --> 01:58:50.640] We really need your help to stay on the air and keep doing all that we do for your benefit and helping people the way we do. [01:58:50.640 --> 01:58:54.640] Please keep sending in your donations and funding the new site. [01:58:54.640 --> 01:58:56.640] We greatly appreciate it. [01:58:56.640 --> 01:58:59.640] God bless and good night to you all. [01:58:59.640 --> 01:59:01.640] Hey, did you hear? [01:59:01.640 --> 01:59:03.640] Ron Paul has announced he's running for president in 2012. [01:59:03.640 --> 01:59:04.640] Who's Ron Paul? [01:59:04.640 --> 01:59:05.640] Really? [01:59:05.640 --> 01:59:07.640] Okay, put down the cell phone for one minute. [01:59:07.640 --> 01:59:10.640] Your friends really don't care about your Twitter updates on what you had for breakfast. [01:59:10.640 --> 01:59:13.640] Oh, but I love to make those little smiley faces with punctuation marks. [01:59:13.640 --> 01:59:14.640] Of course you do. [01:59:14.640 --> 01:59:15.640] Now, listen closely. [01:59:15.640 --> 01:59:19.640] You need to go down to Brave New Books and learn as much as you can about Ron Paul and his message before it's too late. [01:59:19.640 --> 01:59:22.640] They have all of his books and many of the books he talks about. [01:59:22.640 --> 01:59:27.640] They also have t-shirts, bumper stickers and yard signs so that you can show your support for him during the campaign. [01:59:27.640 --> 01:59:28.640] Brave New Books? [01:59:28.640 --> 01:59:30.640] Do they have Harry Potter and Twilight? [01:59:30.640 --> 01:59:36.640] No, but they do carry a large selection of survival and preparedness books to protect your family in time of emergency. [01:59:36.640 --> 01:59:39.640] Ugh, that sounds like that show on the Discovery Channel. [01:59:39.640 --> 01:59:46.640] Yeah, there's even a wilderness survival expert that teaches classes called Earthskill School that you can sign up for on the website bravenewbooksstore.com. [01:59:46.640 --> 01:59:47.640] What are you doing? [01:59:47.640 --> 01:59:52.640] I'm tweeting all my friends that they should go to bravenewbooksstore.com or down to the bookstore in person. [01:59:52.640 --> 01:59:53.640] Where's it located? [01:59:53.640 --> 01:59:55.640] 1904 Guadalupe Street. [01:59:55.640 --> 01:59:56.640] There, it's set. [01:59:56.640 --> 01:59:57.640] I even made a smiley face. [01:59:57.640 --> 02:00:19.640] Great.
