[08:10.280 --> 08:16.440] Well, yeah, I was doing some research today and believe it or not, the search terms that [08:16.440 --> 08:24.240] I plugged into Google were corrupt Austin municipal courts and what came up was the [08:24.240 --> 08:31.240] Texas Municipal Courts Education Commission's training materials. [08:31.240 --> 08:37.480] And what we have is I've been going through this and they have a checklist of particular [08:37.480 --> 08:44.680] publications they make both for training and for reference for municipal judges and municipal [08:44.680 --> 08:47.080] prosecutors. [08:47.080 --> 08:50.840] And I brought this to Randy's attention earlier today. [08:50.840 --> 08:57.840] One of the things that's in this right in the very first chapter on duties of magistrate, [08:57.840 --> 09:04.440] the very first item in their checklist says that they have to hold a probable cause determination [09:04.440 --> 09:14.040] hearing under 1517 code of criminal procedure, which they don't do, as we all well know. [09:14.040 --> 09:21.040] But the most interesting aspect of this is who these people are that's training these [09:21.040 --> 09:22.040] judges. [09:22.040 --> 09:29.240] The Texas Municipal Commission is the original founding entity. [09:29.240 --> 09:36.360] And what this entity does, let me get back over to my other computer here, this particular [09:36.360 --> 09:40.240] entity is started in Travis County in Houston, Texas. [09:40.240 --> 09:46.600] What it was was a bunch of municipal prosecutors and a bunch of municipal judges got together [09:46.600 --> 09:57.280] and decided to create a standardized system of education and information transfer and [09:57.280 --> 10:02.680] communications between Texas Municipal Courts and prosecutors. [10:02.680 --> 10:11.120] They set this organization up as a 5013C nonprofit corporation. [10:11.120 --> 10:18.000] They have since then expanded into several others, including the Texas Municipal Court [10:18.000 --> 10:21.800] Education Center. [10:21.800 --> 10:26.040] This is who actually conducts the training. [10:26.040 --> 10:34.240] And they also are a 5013C nonprofit private corporation. [10:34.240 --> 10:42.560] They do have contributing donors, so to speak, from existing municipal judges and existing [10:42.560 --> 10:45.360] municipal prosecutors. [10:45.360 --> 10:50.720] But right there, right off the bat, while Randy and I were looking through this, they [10:50.720 --> 10:58.040] are teaching these people incorrect information. [10:58.040 --> 11:02.520] For instance, Randy, give them the example of what you saw today that ticked you off [11:02.520 --> 11:08.040] right off the bat. [11:08.040 --> 11:17.240] In there, they said that if you were arrested on a warrant, they did not have to do an examining [11:17.240 --> 11:18.720] trial. [11:18.720 --> 11:22.200] Now, granted, it's in there. [11:22.200 --> 11:23.880] They don't do an examining trial anyway. [11:23.880 --> 11:28.980] They said there is no term to define what they're supposed to do. [11:28.980 --> 11:30.600] So they make up these terms. [11:30.600 --> 11:32.560] They call it a magistration. [11:32.560 --> 11:35.960] Well, excuse me. [11:35.960 --> 11:40.840] Article 2.11 is very clear. [11:40.840 --> 11:47.720] When a magistrate sits for the purpose of examining into a criminal accusation, that [11:47.720 --> 11:50.160] is an examining trial. [11:50.160 --> 11:55.920] What part of that is hard for them to understand? [11:55.920 --> 12:01.960] They don't want to understand it because an examining trial is controlled by a whole chapter [12:01.960 --> 12:08.560] in the Code of Criminal Procedure, which they very seriously want to ignore, Chapter 16. [12:08.560 --> 12:12.880] And then they're saying that if you're arrested on a warrant, they don't have to hold an examining [12:12.880 --> 12:13.880] trial. [12:13.880 --> 12:14.880] Hold on. [12:14.880 --> 12:20.960] They cite Gerstein Pugh, and Gerstein Pugh says you have to be brought before one regardless. [12:20.960 --> 12:28.640] If you are arrested on a warrant, that means that you weren't in court when the warrant [12:28.640 --> 12:30.920] was issued. [12:30.920 --> 12:37.120] And so, therefore, the examining trial had to be held in an ex parte hearing. [12:37.120 --> 12:39.040] Ex parte. [12:39.040 --> 12:41.480] Just one litigant was there. [12:41.480 --> 12:47.680] Therefore, when you are arrested, you are to be brought before the magistrate. [12:47.680 --> 12:50.480] Didn't they read the warrant? [12:50.480 --> 12:56.560] The warrant says you're arrested, this person, and bring him before me. [12:56.560 --> 13:01.880] And the reason you're to bring him before me is so that I can hold a proper examining [13:01.880 --> 13:06.200] trial with both litigants, both sides here. [13:06.200 --> 13:11.840] Now you get to speak your side, and the court has to make another determination after it's [13:11.840 --> 13:13.440] heard both sides. [13:13.440 --> 13:20.160] Well, that is administratively inconvenient, and if they actually do that, they might not [13:20.160 --> 13:25.040] get a 99.6 conviction rate. [13:25.040 --> 13:30.560] So the age of the prosecutors lying to the judges. [13:30.560 --> 13:33.400] I'm mad as hell, and I'm not going to take it anymore. [13:33.400 --> 13:35.680] Actually it's not just the prosecutors. [13:35.680 --> 13:43.000] Now granted, most likely these trainers in these schools are prosecuting attorneys, but [13:43.000 --> 13:49.000] they're teaching the prosecutors and the judges to work together in collusion to deprive you [13:49.000 --> 13:51.160] of these rights. [13:51.160 --> 13:57.600] Now it says right here in their checklist that they are supposed to do the 1517 examining [13:57.600 --> 13:58.600] trial. [13:58.600 --> 14:01.960] It is step number one in their list. [14:01.960 --> 14:06.040] And after step number one, you go down just a little bit more, the next thing they're [14:06.040 --> 14:12.600] supposed to do is, if necessary, they issue an arrest warrant, and that's if a proper [14:12.600 --> 14:15.520] complaint has been filed. [14:15.520 --> 14:20.120] Then they're supposed to, it says an arrest warrant must also be supported by an affidavit [14:20.120 --> 14:21.680] of probable cause. [14:21.680 --> 14:28.240] That's called a complaint, folks, that has to be signed and sworn to. [14:28.240 --> 14:33.080] Now the nice thing about this checklist is it's giving you every single article of the [14:33.080 --> 14:37.360] Code of Criminal Procedure that applies to that section. [14:37.360 --> 14:42.760] But I looked at one today when I was going over this with Randy, and they are directly [14:42.760 --> 14:46.920] misquoting what the statute actually says. [14:46.920 --> 14:48.680] Well I want to know who they are. [14:48.680 --> 14:49.680] I want to know who's writing up... [14:49.680 --> 14:53.680] They are the instructors in the TMCEC programs. This is under the brief history of the TMCA [23:21.640 --> 23:27.160] The Texas Municipal Courts Association parent organization was organized in 1974 [23:27.720 --> 23:34.120] By a group of municipal court judges and prosecutors in the Harris County Houston area for the sole purpose [23:34.920 --> 23:38.040] of forming a viable support organization [23:38.040 --> 23:52.360] Dedicated exclusively to serving municipal courts. The original charter filed in 1975 was for the Gulf Coast Association of Municipal Judges and Prosecutors, Inc [23:52.360 --> 23:58.360] But was amended in 1977 to be the Texas Municipal Courts Association [23:58.360 --> 24:03.800] The 1977 amendment also changed the purpose of the association from [24:03.800 --> 24:09.800] To organize an association of Texas Municipal Judges and Prosecutors to [24:09.800 --> 24:15.800] To organize an association of Texas Municipal Courts personnel [24:17.800 --> 24:27.800] So this basically is what they've been organized to do is to unify the methods and procedures that all of these municipal courts and prosecutors use [24:27.800 --> 24:33.800] To railroad everybody [24:33.800 --> 24:39.800] We can better defend our position if we can get everybody doing the same thing the same way [24:39.800 --> 24:47.800] Then if we bend the law we can get our superiors to look the other way because at least we're all consistent [24:47.800 --> 24:51.800] So agents, a peace officer and a magistrate [26:53.800 --> 27:07.800] The justice officer has some discretion that the primary and ultimate decision to restrict the citizens liberty must be made by a neutral and detached magistrate, the fact is fundamental to our system of criminal justice [27:07.800 --> 27:23.800] Whether the arrest is made with or without warrant, one of the arresting officer's first duties after arrest is to have the arrested person taken before a magistrate and the magistrate must inform the accused of his rights to an examining trial [27:23.800 --> 27:34.800] What part of examining trial is hard for these people to understand, not a magistration, not simply a 1517 warning, but an examining trial [27:34.800 --> 27:38.800] Chapter 16 governs the examining trial [27:38.800 --> 27:43.800] And we've talked about chapter 16 and all of those things that has to happen in there [27:43.800 --> 27:49.800] They are saying you don't have to do something inciting law that says you do have to do it [27:49.800 --> 27:58.800] They're trying to convince these judges, these court cases say exactly the opposite of what they say, the judge will use it as a reference for plans to perform some act that is criminal, that's called a criminal conspiracy [34:14.800 --> 34:22.800] And when individuals get together, when two or more individuals get together and conspire to inform the public about both the Texas judicial system and the laws relating to public safety and quality of life in Texas communities [35:24.800 --> 35:30.800] Another lie, they specifically prohibit access to this program by the public [35:30.800 --> 35:39.800] It says right here on the website, they will only allow elected or appointed judges and prosecutors to attend their classes [35:39.800 --> 35:45.800] They only tell the public what they want them to know and that's next to nothing [35:45.800 --> 35:48.800] Now this is the interesting part [35:48.800 --> 35:59.800] The Texas Municipal Court's Education Center is a 501C3 nonprofit corporation created by the Texas Municipal Court's Association in 1984 [35:59.800 --> 36:02.800] Now there's your tie-in to the TMCA [36:02.800 --> 36:10.800] And funded in large part by a grant from the Texas Court of Criminal Appeals [36:10.800 --> 36:18.800] So right on their website, they admit where they're getting a large portion of their financing [36:18.800 --> 36:34.800] So the Texas Court of Criminal Appeals is directly funding this misapplication and intentional miseducation of the law to these lower court prosecutors and judges [36:34.800 --> 36:36.800] Now wait a minute [36:36.800 --> 36:44.800] They are not allowing members of the public to sit in on these classes or view the curriculums or anything like that [36:44.800 --> 36:50.800] Yet these are courses that are being used to teach our public servants how to do their jobs [36:50.800 --> 37:01.800] Can't we use open records to demand this information anyway even though they're a private entity because they are involved with the educational process of the public servants? [37:01.800 --> 37:05.800] Well the question is what information are you going to demand from them? [37:05.800 --> 37:12.800] The only thing they offer besides what they teach in the classroom orally is a set of books [37:12.800 --> 37:16.800] And every municipal judge and prosecutor is given these books [37:16.800 --> 37:19.800] The course is $200 for a week-long course [37:19.800 --> 37:27.800] And TMCEC even pays for their rooms if a judge has to come from somewhere else in the state and stay 01:24:01.800] Not because of merit, they just didn't take on the case [01:24:01.800 --> 01:24:04.800] And you called it a writ of certiorari, which that's what it was [01:24:04.800 --> 01:24:06.800] But then what happened was in the meantime [01:24:06.800 --> 01:24:09.800] First of all, you know, it starts out at the district court level [01:24:09.800 --> 01:24:11.800] Then it goes to the appeals court level [01:24:11.800 --> 01:24:13.800] Then I went to the Supreme Court [01:24:13.800 --> 01:24:17.800] After the appeals court denied my case [01:24:17.800 --> 01:24:19.800] With a three-judge panel in New York City [01:24:19.800 --> 01:24:25.800] I filed misconduct charges against the district court judge [01:24:25.800 --> 01:24:29.800] And then after the Supreme Court, they didn't make any decision [01:24:29.800 --> 01:24:32.800] And after the Supreme Court denied my case [01:24:32.800 --> 01:24:39.800] Then the top judge in New York City at that 24-judge panel denied my misconduct charges [01:24:39.800 --> 01:24:43.800] And he gave, it was a very interesting answer he gave [01:24:43.800 --> 01:24:46.800] He just says, Walt, what you're doing is [01:24:46.800 --> 01:24:51.800] You're going after, he never even mentioned the judge's name in his answer [01:24:51.800 --> 01:24:57.800] He just says that you're going after his errors or his incorrectness [01:24:57.800 --> 01:25:02.800] And he didn't make a decision whether what I was pursuing was correct or not [01:25:02.800 --> 01:25:05.800] He just says that's not misconduct what you're bringing up [01:25:05.800 --> 01:25:11.800] So what Deborah told me on November 5th, I think [01:25:11.800 --> 01:25:13.800] When I brought up that Wilting case [01:25:13.800 --> 01:25:17.800] When the judge was, I guess you called it litigating from the bench [01:25:17.800 --> 01:25:21.800] Or practicing law from the bench [01:25:21.800 --> 01:25:23.800] They brought up this Wilting case from Austin [01:25:23.800 --> 01:25:25.800] And I think Deborah said it was a crime [01:25:25.800 --> 01:25:28.800] And I didn't know at the time because I couldn't keep up with you [01:25:28.800 --> 01:25:32.800] Whether it was the Defendants Safecoast lawyers that brought it up or the judge [01:25:32.800 --> 01:25:35.800] And I looked through the case, the district court case [01:25:35.800 --> 01:25:38.800] And Judge Zaragoza himself brought it up [01:25:38.800 --> 01:25:41.800] So he is litigating from the bench [01:25:41.800 --> 01:25:43.800] And that's what I wanted to ask you [01:25:43.800 --> 01:25:45.800] If that's litigating from the bench [01:25:45.800 --> 01:25:49.800] I was just going to ask you how would I find out what law it is that's violated [01:25:49.800 --> 01:25:51.800] So I can pursue that [01:25:51.800 --> 01:25:55.800] And here's what I didn't get to yet, Randy, in the panel [01:25:55.800 --> 01:26:01.800] This judge in New York City that died in my misconduct of charge is the 29th of November [01:26:01.800 --> 01:26:07.800] He gave me 35 days to appeal it to something called the Judicial Council [01:26:07.800 --> 01:26:10.800] Which is a six-judge panel up there in New York City [01:26:10.800 --> 01:26:14.800] So do you think I should waste my time and appeal it [01:26:14.800 --> 01:26:18.800] And explain that Judge Zaragoza at the district court was violating laws [01:26:18.800 --> 01:26:21.800] And it wasn't just a mistake that he was making [01:26:21.800 --> 01:26:23.800] And that's my question to you [01:26:23.800 --> 01:26:26.800] And one other thing that he did that I know, like what Deborah said [01:26:26.800 --> 01:26:30.800] He was litigating from the bench, which is illegal [01:26:30.800 --> 01:26:36.800] He also, Judge Zaragoza, refused to address one of the Safecoast lawyers [01:26:36.800 --> 01:26:40.800] Defendants lawyers where I caught him committing perjury in one of his court papers [01:26:40.800 --> 01:26:42.800] He submitted to the court [01:26:42.800 --> 01:26:46.800] Where he said there was no misconduct found by any government agencies [01:26:46.800 --> 01:26:49.800] Regarding my complaint against Safeco, and that's not true [01:26:49.800 --> 01:26:52.800] There was the police department that found misconduct [01:26:52.800 --> 01:26:54.800] I mean, unlawful activities [01:26:54.800 --> 01:26:59.800] And also the New York State Department of Insurance found illegal activities by Safeco insurance [01:26:59.800 --> 01:27:01.800] So he committed perjury [01:27:01.800 --> 01:27:04.800] So those are the two issues I want to ask you [01:27:04.800 --> 01:27:08.800] Should I pursue this with the Judicial Council in New York City [01:27:08.800 --> 01:27:14.800] Appeal this misconduct charges against the district [01:49:50.800 --> 01:49:55.800] No, they wouldn't recognize the common law marriage [01:49:55.800 --> 01:50:03.800] But then when they changed the law saying people married [01:50:03.800 --> 01:50:08.800] But not living together as man and wife can no longer collect benefits [01:50:08.800 --> 01:50:16.800] So she did the reverse and claimed the common law marriage since they were living together but not legally married [01:50:16.800 --> 01:50:20.800] She can collect and she won on the ground [01:50:20.800 --> 01:50:26.800] But now she's trying to collect the back payments from the date of the first filing [01:50:26.800 --> 01:50:31.800] And what's their grounds for not paying? [01:50:31.800 --> 01:50:37.800] The grounds for not paying? [01:50:37.800 --> 01:50:42.800] Red tape, I don't know, we've been going through this for 16 years trying to collect [01:50:42.800 --> 01:50:49.800] Okay, they have to have some legal grounds for refusing to pay [01:50:49.800 --> 01:50:54.800] Half the time, but not following it in time [01:50:54.800 --> 01:51:01.800] But that was their negligence because they refused the common law marriage and then they accepted it later [01:51:01.800 --> 01:51:03.800] Because of their change of their new law [01:51:03.800 --> 01:51:07.800] Okay, so what is the question? [01:51:07.800 --> 01:51:15.800] They're asking us to drop the BVA hearing request to go back to an early effective date [01:51:15.800 --> 01:51:17.800] Back to 1994 [01:51:17.800 --> 01:51:21.800] What are they offering you to get you to drop the date? [01:51:21.800 --> 01:51:29.800] The 86,000, that's not common evaluation and all that [01:51:29.800 --> 01:51:33.800] Are they offering to give you 86,000 if you drop the hearing? [01:51:33.800 --> 01:51:35.800] Yeah, on the phone but not on the paper [01:51:35.800 --> 01:51:37.800] Do you have it recorded? [01:51:41.800 --> 01:51:49.800] That's what I figured, so sending the certified back to them wouldn't be a good idea [01:51:49.800 --> 01:51:55.800] Okay, here's what I suggest you do, if you're talking to them on the phone and you don't have it recorded [01:51:55.800 --> 01:52:04.800] Take copious notes and as soon as you finish, write them a letter listing everything that occurred in the conversation [01:52:04.800 --> 01:52:08.800] And send it to them and ask them to verify [01:52:08.800 --> 01:52:16.800] Yeah, I restructured their facts and I sent them a public servants questionnaire [01:52:16.800 --> 01:52:21.800] Asking all the pertinent information who it goes to and so forth [01:52:21.800 --> 01:52:26.800] Okay, whenever you have a conversation that's not recorded [01:52:26.800 --> 01:52:32.800] Take notes, write down the conversation, send it to them and ask them to verify that this is true [01:52:32.800 --> 01:52:35.800] It doesn't matter if they respond or not [01:52:35.800 --> 01:52:39.800] You have the letter, you can testify that you sent it [01:52:39.800 --> 01:52:40.800] Okay [01:52:40.800 --> 01:52:43.800] And it will be almost as good as a recording [01:52:43.800 --> 01:52:54.800] Sounds good, one other question, how do you unregister your property out of the state's registry? [01:55:28.800 --> 01:55:33.800] Well I had a car on the property and they put an attachment on the house so I moved it right away [01:55:33.800 --> 01:55:40.800] And then they put a sticker on that and claimed it was a commercial vehicle and it doesn't apply [01:55:40.800 --> 01:55:48.800] So the court enforcement put her own statute, she legislated at large and put no tag on it [01:55:48.800 --> 01:55:52.800] Okay, so this has to do with like the grass police types of laws [01:55:52.800 --> 01:56:01.800] Because the thing that I was going to say about government confiscating property is like say the IRS or some other entity like that [01:56:01.800 --> 01:56:05.800] That may have a judgment against you and they come on your property [01:56:05.800 --> 01:56:15.800] If it's not very clear that automobiles or other high dollar value pieces of property like that are not owned by somebody else [01:56:15.800 --> 01:56:18.800] Even if you don't have them registered, even if you haven't registered the title [01:56:18.800 --> 01:56:22.800] They're going to assume they're yours and they're going to take them anyway [01:56:22.800 --> 01:56:27.800] And so that's why people move things into trusts and they even get barcodes for specific items [01:56:27.800 --> 01:56:35.800] And they will put a sticker on it that says property of such and such holdings or property of such and such leasing [01:56:35.800 --> 01:56:41.800] And that way it's clear on the item that it does not belong to you [01:56:41.800 --> 01:56:50.800] And there's another thing if you're in a municipality, my home in Boyd, Texas is right next to City Hall [01:56:50.800 --> 01:56:54.800] And I have this huge 40 foot bus sitting there [01:56:54.800 --> 01:57:03.800] And the mayor told me I had to move that bus because it was not licensed and didn't have a safety sticker on it [01:57:03.800 --> 01:57:11.800] So I did what I suggest you do, read the ordinances [01:57:11.800 --> 01:57:19.800] And it says that any vehicle visible from the street must be licensed or registered [01:57:19.800 --> 01:57:23.800] Now if you have a vehicle inside, that meant if you got one in a garage or something [01:57:23.800 --> 01:57:26.800] It said visible from the street [01:57:26.800 --> 01:57:31.800] So I went down to Clear Channel and these are guys that do billboard signs [01:57:31.800 --> 01:57:36.800] And all these billboard signs are done with tarpaulums and they print them [01:57:36.800 --> 01:57:38.800] And when they change out the signs, they take the tarp down [01:57:38.800 --> 01:57:45.800] They got all these tarpaulums and you can buy them for like 14 by 40 for like six bucks a piece [01:57:45.800 --> 01:57:50.800] So I got a couple of those and saw the mayor two or three days later [01:57:50.800 --> 01:57:54.800] And he asked me when I was going to move that bus, I said what bus?
