[22:14.760 --> 22:18.760] And I'll ask him, what happens if I don't sign the ticket? [22:18.760 --> 22:20.760] And he goes, well, you know what happens, you go to jail [22:20.760 --> 22:24.760] I just want to get that on the record on my tape [22:24.760 --> 22:30.760] Because right here that shows he is using his discretion to affect my liberty [22:30.760 --> 22:33.760] In a manner that contradicts the law [22:33.760 --> 22:37.760] Which means that officer is not trustworthy of that discretion in my opinion [22:37.760 --> 22:39.760] Wait a minute [22:39.760 --> 22:49.760] These are the only times when issuing a promise to appear is mandatory [22:49.760 --> 22:56.760] In other times, he can issue a promise to appear or he can throw you in jail [22:56.760 --> 23:05.760] It's been a long-standing law that the one thing that you can't be taken to jail for is a speeding ticket [23:05.760 --> 23:10.760] That he must allow a promise to appear [23:10.760 --> 23:17.760] For anything else, he can either allow you to sign a promise to appear or he can take you to jail [23:17.760 --> 23:25.760] And it looks like they've added one more to the things they can't arrest you for [23:25.760 --> 23:28.760] Open container and speeding [23:28.760 --> 23:34.760] He must issue a promise to appear [23:34.760 --> 23:36.760] He doesn't have any option [23:36.760 --> 23:38.760] I think maybe we're missing that [23:38.760 --> 23:43.760] In everything else, he has the option of taking you to jail [23:43.760 --> 23:49.760] Well, normally if they find you with an open container, they're taking you to jail, period [23:49.760 --> 23:53.760] It appears as though that's the one thing they're forbidden to do [23:53.760 --> 23:56.760] Well, there's lots of things they do they're forbidden to do [23:56.760 --> 23:58.760] That's kind of the point [23:58.760 --> 24:04.760] What I'm getting at with this though is that the officer is using his discretion [24:04.760 --> 24:09.760] We already know that person and everything that applies here is not to us to begin with [24:09.760 --> 24:12.760] We already know that [24:12.760 --> 24:20.760] And this clarifies it even more when it says that the person makes a written promise to appear [24:20.760 --> 24:22.760] And so on and so forth [24:22.760 --> 24:28.760] So really what I'm getting at is when I say that this is the only one for their mandatory [24:28.760 --> 24:32.760] He must make a written notice to appear [24:32.760 --> 24:36.760] He also has the option of if he isn't going to arrest you to let you go [24:36.760 --> 24:45.760] He can't use the premise of you're not signing a ticket that isn't mandatory to be signed as a premise for arresting you [24:45.760 --> 24:49.760] Now if he wants to arrest you on the charge, the trumped-up charges got you there for anyway [24:49.760 --> 24:51.760] Well, he's going to do that [24:51.760 --> 24:59.760] But to arrest you simply because you will not sign when these are the only two times when a signature for a notice to appear is mandatory [24:59.760 --> 25:03.760] That right there is overstepping his discretionary [25:03.760 --> 25:07.760] No, wait a minute. I think you're missing this [25:07.760 --> 25:11.760] It's not the signature that's mandatory [25:11.760 --> 25:18.760] It's the officer's duty to release you if you sign that's mandatory [25:18.760 --> 25:23.760] He may not arrest you for speeding or for open container [25:23.760 --> 25:26.760] If you sign, period [25:26.760 --> 25:33.760] For everything else he has the option of offer offering you the opportunity to sign [25:33.760 --> 25:36.760] But he doesn't have to he can go ahead and arrest you [25:36.760 --> 25:41.760] That would be that would be offering a contradiction in Randy because [25:41.760 --> 25:46.760] 4903 is a penal statute open container law is a penal statute [25:46.760 --> 25:54.760] Everything else that we would be referring to here that he can just go ahead and arrest you for is not a penal statute offense [25:54.760 --> 25:57.760] Not even close [25:57.760 --> 26:12.760] See, that's why I have a problem with that particular interpretation of it. It's simply because here we're saying that that one is a penal offense and one isn't and yet they're both mandatory to collect that signature and let them go [26:12.760 --> 26:16.760] Yet on any other offense that is not even a penal offense [26:16.760 --> 26:20.760] He has the option of just arresting you or getting this [26:20.760 --> 26:31.760] That's the way that's the way I read it to be that the legislature has for a long time forbidden the officer to arrest someone for a speeding ticket [26:31.760 --> 26:36.760] If they signed a promise to appear and that was because of the speed traps [26:36.760 --> 26:41.760] And it looks like they've added to that open container law [26:41.760 --> 27:01.760] Well see I've got a ton of good Texas case law that says that in actuality there can be no arrest of a citizen in this particular instance without a warrant because the only authorized arrest without warrant under Texas law despite the statutory interpretations thereof [27:01.760 --> 27:06.760] Is if a felony or a breach of the peace has been committed [27:06.760 --> 27:19.760] And I've got lots of case law that cites that so even though they've used this to say that he can arrest without warrant the case law is in conflict with the statute because the case law says different [27:19.760 --> 27:25.760] There's one more one more instance where an officer can arrest without a warrant [27:25.760 --> 27:36.760] Onside offense right that's what you know one right but the offense according to the courts has to be a felony or breach of the peace for him to arrest without a warrant [27:36.760 --> 27:59.760] No what it says is he can arrest anyone for an onside offense something that he personally sees he can arrest for a breach of the peace or a felony for a infraction that he does not personally see without a warrant [27:59.760 --> 28:14.760] The example I use is as I run to a policeman and I say I was just behind a building there and I saw this guy shoot somebody and then you see this guy coming out and I say that's the guy and he's got blood all over his clothes and he's got a pistol in his hand [28:14.760 --> 28:25.760] And the cop runs over and he looks behind the building sees guy there lay him with a bullet hole in him he can arrest that guy for a felony even though he didn't see him commit the a felony right [28:25.760 --> 28:37.760] Also for breach of the peace he can arrest even if he didn't see it if he has reasonable probable cause to believe the person committed it and if he doesn't make the arrest immediately the person will escape [28:37.760 --> 28:58.760] However a policeman can arrest anyone for any infraction they personally see or hear committed and that went to the seat belt case that Lincoln took all the way to the Supreme Court where they arrested a woman for a seat belt violation and took her to jail [28:58.760 --> 29:16.760] They took it all the way to the Supreme Court and the Supreme Court said yeah they can do that and they're saying well he should have let him sign on the ticket he said it doesn't have to the only thing he has to on speeding ticket open container anything else he can arrest [29:16.760 --> 29:32.760] Which goes back to the point of what makes sense to a degree but it also goes back to the point of them enforcing it against someone it doesn't apply to which that's the general comes in and assists the district attorney he's a special prosecutor but he works underneath the prosecuting attorney that's elected [42:53.760 --> 43:02.760] So that wouldn't be it attorney the newspaper as that we were sovereign who we were that we weren't beholden to any government that that violated the laws and I've got copies of it and the IRS really [51:32.760 --> 51:55.760] It took them over a year year and a half to write me back after I sent them a copy of it and then is all they did is that it was frivolous but that's fine they can do whatever they want to but it did I do have the the printings on it where it was ran as public notice and nobody ever challenged it so it is a fact [51:55.760 --> 52:18.760] Of course the UCC documents are different from that you're not you're not saying that you're a sovereign see I think a lot of people have a misunderstanding about the UCC-1 filing I've heard people say oh that's where you declare that your citizenship is of the state and not the feds and you know I've heard people say that's how you set up your sovereignty [52:18.760 --> 52:42.760] It has nothing to do with that a UCC-1 is a financial statement you declare a debtor and a secured party that's all it is okay so that you can basically turn the tables on them to declare that you as a living soul are the secured party not the debtor okay it's like that is a very important concept [52:42.760 --> 53:07.760] The way the whole system is set up is that they operate and function and do everything they do under the premise that they are presuming and assuming that you as a living soul are the debtor to the straw man and we are saying no it's the other way around because they have no documents to attest to that fact [53:07.760 --> 53:22.760] And so we are filing the documents that are setting it up saying no the straw man is the debtor to me the living soul and I am the secured party so it really has nothing to do with sovereignty it's a financial never want to just go start filing documents with the government in any capacity unless you thoroughly understand what exactly it is that you're signing and filing okay and I've never done the UCC-1 I did studying and I talked to Tim a long time and Greg and I've been learning about this stuff for a while and then when I got to the point that I felt that I truly understood [55:23.760 --> 55:38.760] what it is and what it means and what venue it operates in and what area of law then I knew how to fill out the form properly and file it okay because you have to fill out the form committing a crime [01:03:33.760 --> 01:04:02.760] that is a misdemeanor a B or C and say the magistrate knows you you're a well respected member of the community he does not think it's necessary to a constitutional right to an examining trial now you can have one granted they can give you one anyway but you don't have an absolute right to it however if you are restricted at your liberty if you're arrested then the magistrate has to set [01:04:25.760 --> 01:04:49.760] bail and under Texas law there's only one way that a magistrate can take bail 12.05 code of criminal procedure bail is taken by a magistrate after an examining trial only time bail can be taken so for the legislature for the courts to say well you don't have [01:04:49.760 --> 01:05:14.760] you don't have right to examine trial well that's true however I'm sorry no right to examining trial in a misdemeanor that means no automatic right anytime you are restricted at your liberty and examining trial always attaches it's not because it's fell into your misdemeanor [01:05:14.760 --> 01:05:38.760] it's because you've been restricted at your liberty that's what it attaches so they're interpreting this in a way that makes their life easier but it doesn't comport with the body of law in para materia the law considered as a whole and this is what will [01:05:38.760 --> 01:05:58.760] happen I know that when I go to court Monday for an examining trial the opposition is going to say you don't have a right to examine trial in a misdemeanor and I'm going to say okay judge set bail I have a constitutional right to that and he's going to try to set [01:05:58.760 --> 01:06:24.760] bail I'm going to say wait a minute wait a minute you haven't had an examining trial yet so under statute you cannot set bail time to appear before a magistrate so he can hold the examining trial and then set bail this all fits very neatly together in law it's just that our public officials have been trying to do a song and later the sale was pulled and we I couldn't figure out what the problem or what was the cause of why it would be pulled and I just wondered if Randy had any suggestions on maybe you know what why he thinks it might have been pulled well I suspect that when you filed [01:13:42.600 --> 01:14:08.600] for the emergency restraining order that word got back to these folks that you were pushing for that and so in a excess of caution they canceled the sale because they could always have the sale later but if they have the sale and you come up with evidence as why to why they shouldn't have the sale think maybe they were playing safe and decided to pull it yes I think that's exactly what they were doing they were thinking if this guy has got grounds to petition for an emergency restraining order just starting to get into it but if you can get if you can get the appraisal district to declare that they have no interest in that your property is not public property then you can get the court apparently [01:39:37.600 --> 01:39:52.600] this is the technique you can get the court to issue a court order declaring your property private property and then you can go back to the appraisal district and tell them to take your property off of the tax roll because it's private property but you have to go through the court to do that [01:39:52.600 --> 01:40:10.600] and I'm going to be learning about that process too so Eddie's right yeah you don't really have to go through the process of establishing a trust for your land you don't have to do that because private property is not attachable right now they try to do the same thing with the equipment in my [01:40:10.600 --> 01:40:28.600] business but mine is a private sole proprietor type business I own it and they tried to tell me that they were going to tax it the office furniture and my work benches and my computer equipment and all that because it was used to produce income [01:40:28.600 --> 01:40:42.600] or right off the bat my first question is and by what do you determine the definition of income and where do you get that my exchange of labor and private contract with another is taxable by you to begin with. special exemption yeah there is in the municipal court it says that they can mail it to the last known address they can be sent out by mail now I argue that point as well because I argue that the process has to be hand delivered according to the actual code of criminal procedure [01:47:14.600 --> 01:47:38.600] and the code of civil procedure it is hand delivered if a police officer writes your citation isn't there a special provision to allow the police officer to write you the citation well there's a special provision to get a promise to appear so you appear special [01:47:38.600 --> 01:48:00.600] appearance which and you challenge jurisdiction now you're saying the citation is only in effect a promise to appear and once they appear there has to be an information or a charging instrument there's got to be something else well yeah that's a requirement simply because he's 100 percent correct [01:48:00.600 --> 01:48:23.600] none of the prerequisites to embody a complaint under any part of the code of criminal procedure exists on a citation it's just not there right and so the citation is totally flawed and so we can beat them every time if we especially appear and we if we appear generally and you plead your screw [01:48:23.600 --> 01:48:38.600] but if you don't they're hung especially if you challenge them on these points because you're challenging them on procedure of process and they they've they've failed totally [01:48:38.600 --> 01:49:01.600] I need more details to be able to argue that issue in a cogent and effective manner in true form they have not delivered a true process okay you haven't given proper notice of any of the pending charges against you because the complaint itself does not exist the information itself does not exist [01:49:01.600 --> 01:49:21.600] the summons portion and the notice to appear is in default because that is a judicial function which an executive officer may not facilitate under the Constitution of Texas but then there is a legislature has passed a special statute no such animal the the division of powers doctrine is [01:49:21.600 --> 01:49:41.600] specified within the state constitution no special statute can surpass it I understand but so long as the special statute is enacted and not overturned by the quarter the courts it stands until it is overturned however again it is to whom this special statute [01:49:41.600 --> 01:50:06.600] applies that makes it viable under a constitutional sense under the commercial side it's viable without interference with the Constitution when it involves the people it crosses that line it is not viable in any way shape or form it okay so we go back to the place where the officer may not issue this citation to a non-commercial driver because it does not apply [01:50:06.600 --> 01:50:35.600] correct it's a whole circle deal everything seems to be coming back here but I think there was something it was there is valid argument here that the citation does not meet the requirements of a complaint right no it is neither is it a summons it must run in the name of the state of Texas he must state on his oath that he has reason to believe and does believe and
