[00:00.000 --> 00:16.000] bad boys what you wanna do what you gonna do when Sherry John Brown come for you
[00:16.000 --> 00:40.520] What are you gonna do, what are you gonna do, when you were eight and you had bad traits,
[00:40.520 --> 00:45.440] you'll go to school and learn the golden rule, so why are you acting like a bloody
[00:45.480 --> 00:52.320] Okay, howdy, howdy, Randy Kelton, Brett Fountain, Rule of Law Radio on this Friday,
[00:52.320 --> 01:03.480] the 18th day of October 2024. Okay, I'm opening the phone lines, we'll have the phone lines on
[01:03.480 --> 01:12.160] all night, call in number 512-646-1984. I heard a little glitching in and out when we started,
[01:12.400 --> 01:15.560] if we're not sounding right, somebody call in and tell us.
[01:15.560 --> 01:22.120] Okay, Brett, what do you have to fill up the first couple hours of the show?
[01:22.120 --> 01:30.920] Well, I guess I could, I can always tell you about how great my wife is. We could start,
[01:30.920 --> 01:37.520] we can start with A's, right? We start them in alphabetical order and just keep on going.
[01:37.520 --> 01:40.320] Yeah, she must be sitting in the room with you.
[01:40.800 --> 01:41.680]  How did you guess?
[01:43.040 --> 01:50.000] Hey, I'm just psychic. That's not usually how you talk about her.
[01:53.760 --> 01:55.280]  I will help you out, Bubba.
[01:56.240 --> 01:56.880]  Thanks.
[01:57.600 --> 01:58.880] Hey, some kind of guy.
[02:01.600 --> 02:06.320] So, our traffic site is getting closer to coming up.
[02:07.200 --> 02:17.440] We're getting a bunch of generic documents that we're going to load those up. And these are
[02:17.440 --> 02:25.760] documents that you really don't care what the outcome of them is. We're just filing them to
[02:25.760 --> 02:36.160] give them an opportunity not to respond to them. So that we can then bargrieve the attorney into
[02:36.160 --> 02:42.800] the Stone Age. Yeah, you know, they typically don't want to respond. And so we're ready for
[02:42.800 --> 02:53.920] that. It's the same kind of a thought process I've recently, as I've gotten into a kind of a new
[02:55.920 --> 03:01.040] pattern of how I'm, when I'm sending out a records request, I go ahead and prepare
[03:01.040 --> 03:07.360] the criminal complaint. Because I know they're likely to come up with some silly pushback and
[03:08.480 --> 03:16.880] just act ignorant and have obstacles that are not appropriate. You know, and then the criminal
[03:16.880 --> 03:22.240] complaint is already as I just do it as part of the same preparation, I prepare the records
[03:22.240 --> 03:29.280] request, I prepare the criminal complaint. And, you know, you can do that in multiple levels. If I
[03:29.280 --> 03:34.000] could take the time, I could go ahead and write another criminal complaint for who didn't act on
[03:34.000 --> 03:42.720] the first criminal complaint. But the idea is, we know the whole routine. Yeah, it changes my
[03:44.560 --> 03:48.640] sense of, oh, boy, now here's this to deal with. I just go ahead and
[03:49.360 --> 03:53.200] just set it up and the document already has it in there. And I just go ahead and
[03:53.200 --> 03:55.280] plan for it and mentally unprepared for it.
[03:55.280 --> 04:02.800] That is a good idea. I need to look at doing that to mind because
[04:04.400 --> 04:11.120] the traffic tickets designed so that you get all these motions, you take them down and file them.
[04:12.160 --> 04:19.680] And they're gonna ignore them. And when they ignore them, then you,
[04:20.080 --> 04:26.240] there are certain documents you want to file in response to their failure to act.
[04:26.800 --> 04:30.320] Heck, we can write all those up. It's like when I was talking about going in and
[04:31.920 --> 04:34.000] asking them to do something they're not gonna wanna do.
[04:35.120 --> 04:39.840] And when they don't do it and you call 911, well, you know what the 911 guy's gonna do.
[04:40.640 --> 04:45.600] He's gonna do this little chicken dance and I can't do this and blah, blah, blah.
[04:45.600 --> 04:47.440] And then you take out the complaint against him.
[04:48.160 --> 04:50.560] It's already written up and just put his name on it.
[04:52.640 --> 04:58.160] And then ask for his supervisor. And we go in there and they do something wrong and
[04:58.160 --> 05:00.960] we tend to want to tell them how the cow ate the cabbage.
[05:00.960 --> 05:03.600] And we want to feel bad.
[05:03.600 --> 05:10.960] Yeah, or that. But mostly with the people we talk to,
[05:11.760 --> 05:16.480] they want to read them the riot act and rail and righteous indignation at them.
[05:16.480 --> 05:23.280] And we're saying don't rail at the one who did it. And then call 911 or call the
[05:23.280 --> 05:25.840] non-emergency number and ask for somebody to come out and arrest them.
[05:26.560 --> 05:33.600] And don't rail at this guy, this one either. Call this one supervisor and rail at the supervisor.
[05:34.080 --> 05:40.640] But what these two didn't do changes everything.
[05:42.720 --> 05:46.320] People tend to, you know, I get sometimes people are asking,
[05:46.960 --> 05:49.280] they tell me all this stuff that somebody did wrong.
[05:49.840 --> 05:52.640] The public official did this and this and that and then they,
[05:53.280 --> 05:57.520] they forced this and they coerced that and can they do that?
[05:59.120 --> 06:03.120] That's where they land is asking the question of whether they can do that or not.
[06:03.600 --> 06:10.640] Well, of course they can, but can they do that without repercussions?
[06:10.640 --> 06:12.240]  That's the real question.
[06:12.240 --> 06:13.280]  Exactly.
[06:14.960 --> 06:20.800] So we need to look ahead and let's start playing chess with them instead of checkers.
[06:21.600 --> 06:25.440] Yeah. So my response is what do you want to do about it?
[06:29.040 --> 06:32.800] And often I ask that question and most of the time I get a blank stare.
[06:34.480 --> 06:39.840] And a lot of what I've been doing on this show is about answering that question.
[06:40.960 --> 06:41.460]  Yeah.
[06:42.400 --> 06:46.880] People are there, they're just stuck. They have an expectation of good faith and fair
[06:46.880 --> 06:49.840] dealing from their public officials and that's not unreasonable.
[06:51.360 --> 06:55.840] If your boss hires you to do a job, he has an expectation of good faith and fair dealing.
[06:55.840 --> 07:00.560] And he expects you to do a job.
[07:02.160 --> 07:07.600] And these public officials that you put guns on their hips and put authority in their hands,
[07:08.320 --> 07:13.920] you really expect them to do right. And when they don't, people are just taking it back.
[07:13.920 --> 07:22.080] Now, probably most of my listeners aren't, but the general public for the most part is.
[07:22.560 --> 07:30.000] And these public officials are very accustomed to people not knowing how to deal with their bad
[07:30.000 --> 07:38.080] behavior. So they regularly get away with it. And frankly, I want to take advantage of that.
[07:40.400 --> 07:49.280] It is so much fun to see the look on their face when they refuse to do something and you take
[07:49.280 --> 07:54.320] out your cell phone dial 9-1-1, turn to the bailiff and ask the bailiff to arrest them.
[07:57.520 --> 08:03.600] That is so much fun. And it changes the narrative. I just watched a
[08:05.120 --> 08:10.640] First Amendment audit by this guy, James Freeman. He does a lot of these. Apparently,
[08:10.640 --> 08:17.200] sued someone recently and got a pretty good settlement with him. But he goes in and gets
[08:17.200 --> 08:25.680] them to violate law, which he knows they're going to do. And then he tries to school them,
[08:25.680 --> 08:31.760] and they wind up calling the police on him and trespassing him and all kinds of stuff like that.
[08:32.640 --> 08:37.840] I want to say, man, guys, cut that out. If we really want to be effective,
[08:38.800 --> 08:46.160] we need to be smarter than that. He's done enough of this that he knows precisely what
[08:46.160 --> 08:54.080] they're going to do. So just walk through the whole scenario. And then at each step,
[08:54.080 --> 08:58.160] make up a set of documents to address that step. They're always the same.
[08:59.680 --> 09:05.040] He goes in with the video. The guy comes out asking him what he's doing and tells him he's
[09:05.600 --> 09:11.600] exercising his First Amendment right. To me, that's the wrong thing to say. Say,
[09:11.600 --> 09:19.040] I've taken all these cool videos because I want them to tell me that I can't take these videos.
[09:20.400 --> 09:24.800] I'm not going to tell them what the law is first and what my right is before they've
[09:25.520 --> 09:28.160] done something wrong. I want to get them to do something wrong first.
[09:30.320 --> 09:36.400] So then you would be more inclined to tell them that you're taking videos of all of the officers'
[09:36.400 --> 09:38.960] personal vehicles in this public parking lot.
[09:40.080 --> 09:46.720] Yeah, I want to see how many VIN numbers I can get through the windshield.
[09:48.160 --> 09:51.280] Do you know you can see the VIN number right through the windshield? So I want to see how
[09:51.280 --> 09:55.200] many I can collect. It's my hobby to collect VIN numbers.
[09:55.200 --> 10:03.360] And then when they tell me I can't do that, bang.
[10:04.160 --> 10:09.120] Yeah, you can get them pretty quickly to the point that they were going to get to anyway,
[10:09.120 --> 10:11.200] but you went ahead and sped up the process.
[10:12.320 --> 10:18.720] And then I tell them, wait right there. Don't go anywhere. Somebody's going to want to talk
[10:18.720 --> 10:24.640] to you. I take out my phone. I dial 911. Need somebody out here to arrest this person.
[10:25.280 --> 10:31.520] The whole narrative changes at that point. Now they're not so huffy puffy and want to
[10:31.520 --> 10:38.720] push you around. Now they're trying to figure out how to keep you from dragging them into court.
[10:40.640 --> 10:47.440] And you don't wind up getting beat up and handcuffed and hot boxed and taken to jail
[10:47.440 --> 10:54.000] for a few hours and it gets the standard attitude adjustment treatment.
[10:54.640 --> 11:01.040] I've had a lot of my attitudes adjusted. And I get tired of them adjusting my attitude.
[11:01.920 --> 11:07.200] Three dislocated ribs, two broken collarbones, a chipped elbow and tooth knocked out.
[11:09.200 --> 11:11.360]  So this don't happen anymore.
[11:12.480 --> 11:16.000] I've had my attitude adjusted plenty of times when I didn't even have an attitude.
[11:16.560 --> 11:21.440] Yeah, I'm just minding my own business. And I still got yanked out
[11:23.040 --> 11:27.360] the glass broken in the car and yanked out through the glass and stomped all over by a bunch of
[11:27.920 --> 11:31.680] storm troopers who thought they needed to impress me with how important they are.
[11:32.400 --> 11:35.120]  I didn't have an attitude, but they sure did.
[11:35.920 --> 11:39.760] I don't want to sue a police officer for beating me up.
[11:39.760 --> 11:49.600] I want to sue a police officer for doing something really minor, like when I was in
[11:49.600 --> 11:51.520]  Collin County. Yeah, exactly.
[11:51.520 --> 11:57.840] And I gave him such a hard time, told him how ignorant he was until he finally moved his hand
[11:57.840 --> 12:07.680] over his pistol. Gotcha. 911 immediate. I got a guy here with a gun. He's threatening to pull
[12:07.680 --> 12:13.040] his gun on me. I need somebody to get out of here to arrest him. And all of a sudden,
[12:13.040 --> 12:20.640] his attitude changed. Funny how that works. I didn't need to get beat up, pushed around.
[12:20.640 --> 12:26.720] I had about six cops around me. And when I pulled out my cell phone dial 911,
[12:27.440 --> 12:30.960] boy, it was like a Chinese fire drill, them trying to get the heck out of there.
[12:31.680 --> 12:42.800] So no more getting beat up. And if you go down there and they feel like that you're trying to
[12:42.800 --> 12:50.480] set them up, changes everything. I bet I can go to Arlington, Texas today and ask to see some
[12:50.480 --> 12:57.360] criminal complaints from the clerk and they will bend over backwards to get me those complaints.
[12:57.360 --> 13:05.280]  Because she told me that since I wasn't a lawyer or I wasn't the accused that I couldn't see those.
[13:07.120 --> 13:12.160] And I didn't tell her what the law was. I knew what the law was. And I was pretty sure she knew
[13:12.160 --> 13:20.320] what it was. If she didn't, she should have. It wasn't my place to train her. I am the master.
[13:20.960 --> 13:30.240] She is the servant. I, through my taxes and everybody else's taxes, pays her bill. She
[13:30.240 --> 13:36.880] answers directly to me. She has sworn on her oath that when I ask to see these records,
[13:36.880 --> 13:45.120] she'll go get those records. She didn't go get those records. Gotcha. I called the bailiff over
[13:45.120 --> 13:51.440] and went to the bailiff to arrest her. And there never was any threat to arrest me after that point.
[13:52.080 --> 13:56.640] Hang on, Randy Kelton, Brett Fountain, Wheel of Law Radio. We'll be right back.

[16:47.040 --> 17:05.760] soul so i sit back and i watch the evidence unfold and i see justice is the goal yeah justice is the
[17:05.760 --> 17:14.400] goal sometimes we sell a little too far at sea and then we got to get back on course
[17:18.480 --> 17:21.520] from the man that came all the way from gallery
[17:25.360 --> 17:33.120] okay we are back randy kelton brett fountain rule of law radio and we figured out that when
[17:33.120 --> 17:37.280] we don't have any color it's the best thing we can do is start talking about something really boring
[17:38.320 --> 17:43.600] and the more boring it is the better because then we'll get john from new york to call us
[17:44.720 --> 17:52.160] hello john hello hello how are you we're good we didn't put you to sleep this time i see
[17:53.280 --> 17:59.920] well no no i sometimes what i do is i walk away from the phone and then i don't come back what
[18:00.720 --> 18:10.160] what i know okay okay what do you have for you asked for it now yeah i asked for it now my feelings
[18:10.160 --> 18:19.200] are hurt okay no not really not really no no not like that that's what i get that's what i get for
[18:19.200 --> 18:28.640] picking on you that's not what i really meant but that's okay anyway question you know these uh
[18:28.720 --> 18:34.800] charitable organizations if you have money problems and you seek them out to help you
[18:35.360 --> 18:42.960] take fix a roof or fix some siding or do a job on your porch or whatever it is you need
[18:43.600 --> 18:50.480] and you call them and they make you wait 10 months and i mean 10 months and that's not the
[18:50.480 --> 18:55.760] only time i'll tell you about another time but i'm going to summarize this quick and you're waiting
[18:55.760 --> 19:02.400] 10 months then they come out and the the construction manager they hire a former
[19:02.400 --> 19:07.200] construction guy in his own company you know and then they hire him to come out and look at your
[19:07.200 --> 19:12.480] job and tell them what you need and how much it should cost and whether or not they're going to
[19:12.480 --> 19:24.320] fund your project well they send out a real sob and he's talking down to you because i've run
[19:24.320 --> 19:30.720] across that in my job i've spoken to a lot of service organizations helping them on the air
[19:31.440 --> 19:35.920] and giving them you know free time because they're helping the public and we give them
[19:35.920 --> 19:40.560] free public service time so i've talked to a lot of them and i can see their attitude when they're
[19:40.560 --> 19:46.560] dealing with people who are down on their luck and especially when they're dealing with senior
[19:46.560 --> 19:52.640] citizens what happens oftentimes is they get abusive and you know they're having a hard day
[19:52.640 --> 19:58.240] and i understand that and they can be pretty rotten and it's easy to be rotten to somebody
[19:58.240 --> 20:02.560] who needs your money and needs your help because you're not going to you're going to let them do
[20:02.560 --> 20:10.160] anything that they want to do to you to belittle you to abuse you because hey right now they might
[20:10.160 --> 20:15.920] be the only game in town food so i've run across that many times with a lot of service organizations
[20:16.560 --> 20:24.400] and even got porky with me working with the station you know and so anyhow so he was porky
[20:24.400 --> 20:30.720] he didn't let me finish my sentences i'd start to say three words cut me off and then he's telling
[20:30.720 --> 20:36.640] me this and it's telling me that he's talking down to me and condescending so i called and i said you
[20:36.640 --> 20:43.040] know the guy's a little a little excitable and i was trying to smooth it over as best i could and
[20:43.040 --> 20:48.720] yet tell him you hired a real moron but this guy really abuses people and i couldn't quite say it
[20:48.720 --> 20:54.160] that way because i needed their help well they sent out another guy he wasn't too much better
[20:55.120 --> 21:00.480] and then when the whole thing was over and done with they said something well we can't fund your
[21:00.480 --> 21:04.800] project because it's going to be thirty to fifty thousand dollars because i just want you to do a
[21:04.800 --> 21:12.240] small section of the other roof is 20 years old and it's going to go soon i said i didn't ask you
[21:12.240 --> 21:19.600] to do that i really wanted you to do that 19 by 14 foot section which shouldn't cost thirty to
[21:19.600 --> 21:25.120] fifty thousand dollars and he's telling me which shrubs we're going to cut down all around the
[21:25.120 --> 21:29.920] house no we're not we're going to cut the shrubs where you have to put your land that's it i'll
[21:29.920 --> 21:37.760] take care of the rest myself so well then that's how that ended up and so i waited 10 months the
[21:37.760 --> 21:46.080] roof leaks like a sieve and is there any from what i described to you is there any remedy for
[21:46.080 --> 21:53.840] that or just you know take your hard knocks and move on no i'm going to say there's no remedy for
[21:53.840 --> 22:02.320] that okay no remedy am i right yeah they have who are these guys and why do they what's their
[22:02.320 --> 22:12.160] duty to you i guess well are they are they publicly funded uh publicly funded well they
[22:12.160 --> 22:18.160] take they take donations from places like department stores and you know things like
[22:18.160 --> 22:24.400] that and and and and rich people we have a lot of money and want to do a tax write-off are they
[22:25.040 --> 22:32.960] are they funded by uh any gov do they get any government funding they probably do they probably
[22:32.960 --> 22:44.800] do and they probably do get government funding yeah find out who funds them um how can i do
[22:44.800 --> 22:50.320] that without you should say it on the website wouldn't you think yeah well if you just send
[22:50.320 --> 22:59.520] a request and they for all government funding that this company received that's going to be
[22:59.520 --> 23:05.360] public record okay so contact the government for that or contact them they i don't think
[23:05.360 --> 23:11.520] they're going to yeah yeah you you really won't know you can't just contact the government because
[23:11.520 --> 23:17.280] you don't know who might be funding them they might be getting a grant from some company from
[23:17.280 --> 23:23.840] some program there's just so many different ways they can be funded as i think it would be hard
[23:25.360 --> 23:34.320] united way for one thing i did way is not a government agency but you might go to go to
[23:34.320 --> 23:41.280] united way and i call the united raise find out raise a complaint with them that it's one thing
[23:41.280 --> 23:49.520] for me to be in this difficult situation but to be treated with this kind of disrespect is
[23:49.520 --> 23:57.840] not necessary and yeah and like i say they do it because they can they can do it they're having
[23:57.840 --> 24:04.480] a rough day and you're nobody you're down on your luck and they can treat you that way because they
[24:04.480 --> 24:10.720] can get away with it most people they'll take that see i won't take that i stand up on my own legs
[24:11.120 --> 24:15.920] but i won't do that right away i'll take enough of it and enough of it and enough and finally
[24:15.920 --> 24:21.680] enough is too much and that's what happens see i i'm slow to anger but when i do watch out
[24:22.720 --> 24:28.720] anyway only you only stand up on your hind legs what do you do with your front legs
[24:29.840 --> 24:34.320] oh they're beating them in the face like i did to the state like i did to the state police one night
[24:34.320 --> 24:41.120] it yeah but yeah if if it's a private company then you really don't have any recourse
[24:42.480 --> 24:45.760] but i think they're funded by the united way does that help any or no
[24:47.040 --> 24:50.160] if you go contact united way and raise a complaint with them
[24:52.000 --> 24:56.640] then it's likely to get back to them they united way would have some influence you
[24:56.640 --> 25:04.000] tell united ways making you guys look bad oh yeah yeah yeah and i um
[25:04.400 --> 25:09.920] what was i going to say oh i lost it wait a minute um the um
[25:14.640 --> 25:21.440] well i'll think of it anyway you'll think of it as soon as you get off the live yeah probably
[25:25.440 --> 25:29.360] yeah um well i'm just trying to think john if if there's anything that i could
[25:30.320 --> 25:37.280] uh connect some dots here between their duty and their behavior which is a failure of that duty
[25:38.480 --> 25:44.960] and in order to say that they did something wrong you've got to find their duty
[25:46.720 --> 25:51.440] to be able to to map their behavior to something that they should have done
[25:52.080 --> 25:58.640] and we know as humans we we know oh well hey that wasn't right the way they just did this
[25:58.640 --> 26:04.640] that's not right but you have to be able to find it and point at it see where it's been codified
[26:04.640 --> 26:10.160] and written down and it's in point number subsection something just like a point at that
[26:11.360 --> 26:15.680] yeah just like a law like the law where the judge doesn't do something and it's written
[26:15.680 --> 26:22.720] down exactly yes yeah well i told them what i wanted to tell them but i'm going to go to
[26:22.720 --> 26:27.600] the people that you're i'm going to make this public and i think the people that are funding
[26:27.600 --> 26:33.280] you are going to want to know the way you treat people and whether or not you claim it was real
[26:33.280 --> 26:38.320] or not whether i imagine it that's not going to sit well with the court of public opinion
[26:39.200 --> 26:46.080] the fact that somebody raised this you know comments that raised raised a stink because of
[26:47.040 --> 26:52.480] you might go to a local call in line local radio and call in complain about them
[26:53.040 --> 26:57.760] um that'll get a man hang on randy kelton brett fountain you'll be right back
[27:01.200 --> 27:05.600] it's clear cell phones have changed the way we live and work but have they negatively affected
[27:05.600 --> 27:10.080] our health i'm dr kathryn albrecht and i'll be back in just a moment with new findings about
[27:10.080 --> 27:16.560] how cell phones may actually alter our brain chemistry privacy is under attack when you give
[27:16.560 --> 27:21.840] up data about yourself you'll never get it back again and once your privacy is gone you'll find
[27:21.840 --> 27:27.840] your freedoms will start to vanish too so protect your rights say no to surveillance and keep your
[27:27.840 --> 27:33.440] information to yourself privacy it's worth hanging on to this public service announcement
[27:33.440 --> 27:38.240] is brought to you by start page dot com the private search engine alternative to google
[27:38.240 --> 27:46.640] yahoo and bing start over with start page cell phones emit radio frequency energy it's a fact
[27:46.640 --> 27:50.880] but whether it's dangerous to have a phone beaming this kind of radiation near your head has been
[27:50.880 --> 27:56.160] disputed some have blamed it for brain tumors while cell phone companies have downplayed concerns
[27:56.160 --> 28:00.480] well now the journal of the american medical association is confirming that cell phones
[28:00.480 --> 28:06.160] affect brain chemistry a study of 47 volunteers showed that glucose metabolism in the area of
[28:06.160 --> 28:10.720] the brain closest to the cell phone antenna increases when the cell phone is on while
[28:10.720 --> 28:15.920] researchers aren't sure whether this exposure causes damage i'm not taking any chances i always
[28:15.920 --> 28:21.360] keep the phone far from my body and i use a corded headset i'm dr kathryn albrecht more news

[30:24.800 --> 30:28.320]  okay
[30:41.920 --> 30:49.440] okay howdy howdy randy kelton brett fountain the rule of law radio on this friday the 18th day of
[30:49.440 --> 30:57.120] october 2024 and we're finishing up with john john i think the
[30:58.800 --> 31:01.040] pretty well determined that you're just out of luck
[31:05.760 --> 31:12.880] oh we couldn't get you muted now we can't get you unmuted okay go ahead john all right uh just one
[31:12.880 --> 31:19.120] other question you know smart meters uh there is evidence and it's proof it's not just evidence
[31:19.280 --> 31:26.400] i did uh about 800 hours just on smart meters alone and i did all the research on
[31:26.400 --> 31:29.440] and they're dangerous to your health they're dangerous to your surveillance
[31:30.000 --> 31:36.800] they're they're really a control mechanism for the new world order and that's really what they are
[31:36.800 --> 31:43.120] now they're coming just put a faraday screen around it well no because then
[31:44.080 --> 31:50.320] you're gonna deal with uh dirty electricity in the in your whole house it's gonna it's gonna
[31:50.320 --> 31:53.760] throw it's gonna throw a dirty what they call dirty electricity in all the homes
[31:55.040 --> 32:02.640] that's such a thing dirty electricity was that like electricity that didn't come from solar power
[32:04.080 --> 32:10.640] no somebody tried to sell me that one time telling me that that the electricity that that's
[32:11.280 --> 32:17.520] uh that they sell comes from only solar power and so it's better it's clean
[32:20.960 --> 32:23.600] they clean they got clean electrons
[32:26.720 --> 32:33.520] john john what is dirty electricity dirty electricity is when a smart meter throws
[32:34.080 --> 32:40.160] uh certain certain rf frequencies down the line and it goes it travels through your whole house
[32:40.640 --> 32:46.640] it's not just around the meter it doesn't yeah but it doesn't transmit yeah yeah it does it
[32:46.640 --> 32:54.480] transmits it transmits uh an rf field of some type and it can be no no don't don't don't say
[32:54.480 --> 32:59.280] that to an electrical engineer say that to a mechanical engineer maybe but not to an
[32:59.280 --> 33:04.400] electrical engineer you got a 60 cycle beat frequency and if you super heterodyne
[33:05.040 --> 33:13.680] a signal on top of that 60 cycle beat frequency it will radiate somewhat around the power line
[33:13.680 --> 33:22.160] depending on the amount of power but your leads are not antennae antennae works when you set a
[33:22.880 --> 33:33.520] potential where you hook a hotline to a metal object and you have no ground line
[33:34.400 --> 33:40.320] so you apply the electrical pressure to it and it radiates out in the air but if you have a
[33:40.320 --> 33:51.520] complete circuit it doesn't radiate well i mean maybe maybe uh microscopic thousands of an inch
[33:51.520 --> 33:57.920] around the a conductor but not enough to get through the insulation well what we're going
[33:57.920 --> 34:02.320] well it's always going to have some magnetic a field going around it is that what you're
[34:02.320 --> 34:07.680] talking about joan it's the magnetic field let's let's leave that alone right now let's
[34:07.680 --> 34:13.840] not get tripped up on that i have a legal question and the legal question is the legal question is
[34:15.920 --> 34:23.280] do you have to accept that meter because it does cause no no no you don't uh but
[34:23.680 --> 34:27.600] what the electric company has said that no you don't have to accept a meter
[34:28.240 --> 34:31.760] but if we have to send somebody out there to read the meter
[34:32.960 --> 34:36.800] then you're gonna have to pay them we're gonna add that to your bill
[34:38.080 --> 34:42.720] i know how to read a meter and i've done it for years but they don't trust you
[34:43.600 --> 34:48.240] yeah of course they don't they only trust their people so you have an option
[34:49.680 --> 34:54.480] but if they put their meter out there and you happen to have a one thing if you're worried
[34:54.480 --> 35:01.680] about it transmitting in the house you can take a piece of this foil backed foam
[35:03.360 --> 35:12.080] and set it set it against the wall opposite the meter and then yeah tape them i'm not talking
[35:12.080 --> 35:18.240] for you actually i'm telling everybody else john you tape a wire to it so and you strip a
[35:18.960 --> 35:22.560] end of electrical wire put it on there put some tape on it to hold it to the
[35:22.560 --> 35:29.040] foam and then you attach it to something metal and that acts as a faraday screen to ground
[35:30.160 --> 35:36.480] when the emf when the emf hits that foil it'll travel through the foil ground so no emf will
[35:36.480 --> 35:43.680] pass it and if you happen to have a wash tub outside hanging over the meter they got a problem
[35:45.040 --> 35:50.160] yeah i know that's going to stop the signal and the transmission back to the company oh i know
[35:50.160 --> 35:55.120] what to do that's not a problem yeah and this the city the electric company is going to gripe
[35:55.120 --> 36:02.320] about it and you tell them yeah life is tough go to the fcc when you transmit something in the air
[36:02.320 --> 36:09.920] it goes to the public and you don't own it anymore so if it hits it's a piece of metal that i have
[36:09.920 --> 36:14.960] and the piece of metal sucks it down to ground your problem not my problem
[36:14.960 --> 36:22.800] um yep yep now say that again that was beautiful um yeah uh if it transmits in the air it's no
[36:22.800 --> 36:28.960] longer belonging to you i like that once you once you transmit it once it leaves your transmitter
[36:28.960 --> 36:36.800] it goes into the public domain and that's this where people trying to transmit and uh keeping
[36:36.800 --> 36:44.800] other people from receiving their transmissions and then we had a problem years ago where uh
[36:45.120 --> 36:51.600] a guy that lived a few days over had a cb radio and he had a 100 amp linear
[36:53.040 --> 36:55.840] amplifier on it and it would blast right over our tv
[36:57.440 --> 37:02.400] they'll call the fcc and they said your problem not his problem
[37:05.520 --> 37:11.120] it's in the air and your receiver is receiving this out of the air if you don't want your
[37:11.120 --> 37:16.560] receiver to receive this signal you need to put a filter in it to trap out that signal
[37:17.360 --> 37:21.360]  yeah yeah he's not responsible for what you're receiving
[37:22.960 --> 37:30.160] yeah then on the other hand if he's transmitting it you can receive it whether he likes it or not
[37:30.160 --> 37:40.880] anyway anything else john okay well that's basically it um there's a guy
[37:42.080 --> 37:47.600] well i won't get into him um he uh there's a guy that talks about this
[37:48.880 --> 37:56.320] and uh if you if people realize what the smart meter is really there for it's for control
[37:56.960 --> 38:03.680] they want to be every okay john we don't do conspiracy theories here
[38:04.880 --> 38:10.400] it may be true but this is not what we do here it's absolutely unsubstantiatable
[38:11.600 --> 38:18.640] everything somebody claims is a conspiracy and i get real frustrated with that
[38:19.600 --> 38:24.400] everything that happens people call me in when the guy did the shooting
[38:24.480 --> 38:32.000] in colorado in the movie theater within four hours i knew who his cia handlers were who got
[38:32.000 --> 38:37.760] him his psychotropic drugs i knew who the fbi agents were who got to be his weapons i had the
[38:37.760 --> 38:44.400] whole story yeah it's all horse it's all horse crap but i had it every time something happens
[38:45.120 --> 38:52.160] i get the whole story the two guys killed in mississippi the legal reform guy and his son
[38:52.800 --> 38:56.160] they set him up so they could murder and you're the one that told me that
[38:57.600 --> 39:04.160] he ran in a helicopter shot him from a helicopter what you didn't tell me these two sheriff's deputies
[39:04.160 --> 39:10.080] pulled him over because of this fictitious plate and the 16 year old stepped out of the car and
[39:10.080 --> 39:18.240] shot them down like they were dogs that part i didn't hear from the legal reform community
[39:18.240 --> 39:24.800] all i heard was it's a grand conspiracy the government of fbi did this so they could murder
[39:24.800 --> 39:30.880] these two guys and you came on my show and and told us that it was two years later i saw the video
[39:32.640 --> 39:36.320] he just murdered this this was the sheriff's son he just stepped out with an
[39:36.320 --> 39:44.080] ar-15 and shot them down like they were dogs i guess you were the one that called me and told
[39:44.080 --> 39:52.640] me it was a conspiracy and then there was was the shooter in dc i don't remember i don't remember
[39:52.640 --> 39:58.640] who it was that told me that the reason they shot all these other people was to cover up the fact
[39:58.640 --> 40:04.000] that they wanted to shoot this shoot this one fbi analyst well half of the people in northern
[40:04.000 --> 40:12.000] virginia are fbi analysts and then it turned out it really was just random shooting and then they
[40:12.000 --> 40:18.240] figured it was robert that told me about this this was big time conspiracy turned out it wasn't
[40:18.240 --> 40:26.560] conspiracy at all things just happen this meter is a meter so that the electric company doesn't have
[40:26.560 --> 40:32.400] to come send somebody out to your house and get bit by your dogs and get get into fire ants and
[40:32.400 --> 40:40.560] bees they can read your meter from from their office saves them a lot of money
[40:41.520 --> 40:47.840] and they don't transmit any of it to you and the covid vaccine is safe and effective
[40:49.120 --> 40:57.040] okay uh that's okay goodbye john we'll be right back

[44:04.240 --> 44:11.120] okay we are back randy kelton brett fountain rule of law radio and we're going to chris
[44:11.760 --> 44:22.480] in colorado hello chris hey guys hey again um so i chatted with you guys briefly last night about
[44:23.200 --> 44:28.560] this case law thing with the courts uh using case laws of course for
[44:30.080 --> 44:36.560] common public public you know uh yeah where the judge said he's dismissing your case because
[44:36.560 --> 44:40.640] you should have known that it was a government agency and so then you should have given notice
[44:40.640 --> 44:46.240] and you didn't give notice so your case is dismissed and the ones who told you it wasn't
[44:46.240 --> 44:54.080] a government agency are the ones who uh should know and the judge says well the case law says
[44:55.280 --> 45:00.640] that they have been found to be a government agency so it's on you to go and read up all
[45:00.640 --> 45:05.040] the case law that ever existed and see if you can figure out whether they're a government agency
[45:05.040 --> 45:06.080]  completely unreasonable
[45:09.040 --> 45:13.120] brett you just have a you have a way of putting things i'm actually put that in the i'm going
[45:13.120 --> 45:18.240] to put that in the the pleading that's the way i type it in the chat that's the way i type it
[45:18.240 --> 45:24.080] in the chat gp if it was human i could just be looking at me and blinking twice
[45:28.400 --> 45:31.680] so yeah we were talking about that you would be able to
[45:31.680 --> 45:39.280] to now add the the people who should have told you that it was a government agency and instead
[45:39.280 --> 45:45.600] told you it wasn't add them as defendants because it's kind of like a cross claim right
[45:45.600 --> 45:50.480]  they're a third party but they're they're they are culpable
[45:52.960 --> 45:58.880] that now they've caught you this entire suit it didn't get thrown out because of any other
[45:58.880 --> 46:04.480] good reasons it just got thrown out because they failed to inform you that it was government
[46:04.480 --> 46:09.360] agency you would have been happy to give notice in addition to the constructive notice they already had
[46:10.240 --> 46:21.040] but it was yeah all because of them you lost your suit so they owe you yes and i i hundred
[46:21.040 --> 46:26.000] percent agree and they they definitely will be hearing from me at some point but as i was sitting
[46:26.000 --> 46:34.400] here staring at this more after we talked last night i i i just got the the gut feeling i should
[46:34.400 --> 46:39.200] look more into the law because i'm looking at the phrasing he actually highlighted the phrase in the
[46:39.200 --> 46:44.080] in the order there's there's just basically a section of a sentence two sections and he
[46:44.080 --> 46:50.000] highlighted county counties plural as a government entity this is the definition of a government
[46:50.000 --> 46:59.600] entity and any entity formed by a county memorial hospital this is actually in the definition of the
[46:59.600 --> 47:05.840] law and i'm looking at it going that's really odd you know but even so if you it doesn't matter
[47:05.840 --> 47:11.440] because how do you come to a determination that a county but what's what's a county memorial
[47:11.440 --> 47:17.040] hospital where's the designation how do you how do you come to that how do you create one exactly
[47:17.040 --> 47:22.480] you know and then and then from there how does the public inform that that means anything you
[47:22.480 --> 47:28.000] know that they don't expand on it but i looked at wait wait a minute in speaking to definitions
[47:28.560 --> 47:35.360] you're saying county memorial hospital yeah what are the county hospital this not
[47:35.920 --> 47:42.400] my memorial hospital is not named after some dead guy exactly and that's what i started spinning on
[47:42.400 --> 47:46.800] and that was my i typed that in the chat gpt and we spun it around and it was just like i asked
[47:46.800 --> 47:52.320]  them i said i said can i can i can a hospital be designated government simply from a name
[47:53.120 --> 47:57.920] you know and chat gpt took took the devil's advocate approach and then i reminded it hey
[47:57.920 --> 48:03.040] wait a second where is this and he says then it says no and so we so i looked up all the
[48:03.040 --> 48:08.160] hospitals in wyoming and there's that i looked actually i looked at a memorial memorial is the
[48:08.160 --> 48:14.240] most used name in hospital in in a hospital designation than any other term anywhere there's
[48:14.240 --> 48:20.560] more hospitals with memorial in the name than there is anything else it's a very very very
[48:20.560 --> 48:27.840] common name across the united states okay okay so i look is the is the term memorial used in the law
[48:27.840 --> 48:34.880] or was it simply used in this judge's order well this is where it gets interesting and that's why
[48:34.880 --> 48:41.200] i blasted the telegram today just because i was just a surprise i needed somebody next to me to
[48:41.200 --> 48:45.600] tell this but i looked up all the hospitals just back to the original argument i looked up all the
[48:45.600 --> 48:51.680] hospitals in wyoming and they have multiple forms of it they have just just like uh chariton county
[48:51.680 --> 48:55.840] hospital they have a lot of memorial hospital they have memorial hospitals beginning the name
[48:55.840 --> 49:00.240] at the back end of the name with county somewhere they're all over the place it's not a uniform
[49:00.240 --> 49:06.720] naming all right so they can't i don't think they can they can land on that on that hill and say
[49:06.720 --> 49:12.080] well if it's if it has a memorial in the name then it's considered a county memorial hospital
[49:12.080 --> 49:17.520] well okay where is where is that poof it's government yeah where does it say anywhere
[49:17.520 --> 49:22.480] that that designates it doesn't but here's where it gets interesting randy so when i filed my case
[49:22.480 --> 49:33.120] in 2023 it didn't say that they amended the law in 2024 and then the judge used it the 2024
[49:33.120 --> 49:41.200] sentence from that again that should be a good point to appeal on oh absolutely but i just caught
[49:41.200 --> 49:48.400] it my brief is all the way already in i just caught this it's easy enough to file an amendment
[49:48.400 --> 49:49.120]  to the brief
[49:52.160 --> 49:57.440] or newly discovered law yes so how can you do that though
[49:59.280 --> 50:06.400] you just file a a document and called it an amendment to the brief or a newly discovered law
[50:08.320 --> 50:16.240] recently discovered that the law he used was not in effect at the time this occurred
[50:18.640 --> 50:24.720] right but here's two here's my conspiracy theory i don't want it shouldn't have followed john but
[50:27.680 --> 50:34.080] they amended only that sentence randy entities formed by a county memorial hospital which is
[50:34.080 --> 50:40.240] exactly what i argued in my pleadings now i haven't done the research i have oh wow
[50:41.040 --> 50:44.560] what is the definition of a memorial hospital
[50:46.560 --> 50:52.960] you asked chat gtp that yeah but well no i actually no i didn't ask that but i i scoured
[50:52.960 --> 50:57.840] the internet and memorial hospital like you said generally is for names for somebody who left a lot
[50:57.840 --> 51:04.320] of money to the hospital the secondary of that is the hospital may have achieved something
[51:04.320 --> 51:10.800] exceptional like a therapy or a vaccine or you know what i mean okay so that hospital will be
[51:10.800 --> 51:16.560] memorialized because of their contribution to the community or then probably one of the most common
[51:16.560 --> 51:24.640] it just sounds good so they use it just because it sounds good means nothing behind it i just looked
[51:24.640 --> 51:32.480] at it in chat gtp and that's essentially what it says memorial hospital is a type of hospital
[51:32.480 --> 51:39.520] that is named in honor of individuals that's it so the judge used the term memorial hospital in him
[51:39.520 --> 51:44.000] so you can essentially ignore memorial and just say hospital
[51:46.720 --> 51:50.960] well he puts county memorial hospital okay well why did you need to put memorial just
[51:50.960 --> 51:56.640] say county hospital entities formed by a county hospital right that's what you're saying that
[51:56.640 --> 52:01.360] the statute from the legislature actually says county memorial hospital is that right
[52:02.160 --> 52:05.680] yeah i'm looking right at it and that's the only section that was amended
[52:09.760 --> 52:19.200] that's weird it is so so okay that that begs the question what is a memorial hospital in law
[52:22.800 --> 52:29.200] they the the legislature made a distinction between a county hospital
[52:29.200 --> 52:35.040] and a county memorial hospital so what is the distinction
[52:38.560 --> 52:39.360]  if there is one
[52:43.440 --> 52:50.240] well i've looked through wyoming and from what i can gather i'm not seeing anything other than
[52:50.320 --> 52:57.440] just talk okay you might look at the code construction statute for wyoming
[52:59.600 --> 53:08.560] that this law is is inapplicable as it is the way it's written it's unclear
[53:10.640 --> 53:17.040] that it purports to only apply to county memorial hospitals what is the legal
[53:17.600 --> 53:22.240] distinction of a between a county hospital and a county memorial hospital
[53:27.920 --> 53:34.640] is there one this makes the the you claim that that this particular
[53:35.680 --> 53:38.320] addition to the statute is void for vagueness
[53:41.440 --> 53:43.280]  good point yeah that's what i was looking for
[53:43.680 --> 53:49.840] i asked why i'd get the big bucks tell deborah she'll double my salary again
[53:52.720 --> 53:59.120] stick some more zeros at the end yeah a couple more at the front too might as well
[54:02.160 --> 54:08.880] from what i can tell somewhere in the history of wyoming they made
[54:08.880 --> 54:15.520] history of wyoming they made there's a lot of county hospitals seems i mean
[54:15.520 --> 54:23.280] wyoming is a big state but it doesn't have a lot of people and so they took a lot of the hospitals
[54:23.280 --> 54:29.920] if not all of them from what i can tell and they became county hospitals but they all have special
[54:29.920 --> 54:34.080] names at the end they're all dvas as business and whatever to make them seem like they're not you
[54:34.080 --> 54:41.600] know but their their county hospitals are not state hospitals so it gets very confusing that's
[54:41.600 --> 54:45.680] why some of the even the state doesn't even know it's all hospitals they say no that's private
[54:45.680 --> 54:50.000] hospital and they said it with with absolute confidence the private hospital no we have
[54:50.000 --> 54:56.800] nothing to do with them private hospital okay but i i do find a lot of memorials in those names
[54:56.800 --> 55:00.240] so there's something about this memorial they memorialize all their county hospitals
[55:01.120 --> 55:07.040] so it's it's void for vagueness if you can't figure it out then it's void for vagueness
[55:09.200 --> 55:15.840] it doesn't actually that would that would that would give them the risk of having this overturned
[55:15.840 --> 55:20.560] if they don't make you a deal to get you to go away and leave them alone
[55:24.720 --> 55:28.400] now you want the law thrown out that always makes them nuts
[55:30.320 --> 55:36.240] i like that angle well i mentioned to get this to the supreme court if they screw me over again

[01:01:29.760 --> 01:01:36.960] to go after me is to claim that this this change on which the judge based his ruling
[01:01:37.040 --> 01:01:45.920] not only was it not in place at the time of your of the occurrences that happened so the judge
[01:01:45.920 --> 01:01:57.600] has to rule on the law as it existed at the time and even if it the law was purported to apply
[01:01:57.840 --> 01:02:07.280] to apply it is vague for avoid for vagueness as it specifically references a county
[01:02:07.280 --> 01:02:13.360] memorial hospital as opposed to simply a county hospital
[01:02:15.120 --> 01:02:23.680] and since memorial memorial a memorial hospital is not specifically defined in
[01:02:24.240 --> 01:02:30.960] in the statutes in the adjustment to the law is void for vagueness
[01:02:32.640 --> 01:02:36.880] yeah or even county hospital even if it would just say county hospital
[01:02:38.400 --> 01:02:45.040] how is that different from a hospital now that we can get we have a state hospital
[01:02:45.040 --> 01:02:50.080] or a county hospital we can have a federal hospital we got va hospitals
[01:02:50.800 --> 01:02:57.840] uh and we got uh hospitals that are in dc that are federal hospitals
[01:02:59.600 --> 01:03:07.680] we got hospitals that are supported by the state but in law there's no definition provided so
[01:03:07.680 --> 01:03:14.560] do they get to just say county in their name and they become poof government exactly good point
[01:03:14.560 --> 01:03:20.960] point and here's where it gets here's where it gets a little more confusing so so how would you
[01:03:20.960 --> 01:03:27.200] know so in my case the hospital is called memorial hospital of laramie county in another county it
[01:03:27.200 --> 01:03:34.960] says sheridan county hospital so how are you to know that those those titles define anything
[01:03:34.960 --> 01:03:40.560] with consistency or anything at all just because that's county in the name and as quoted by the
[01:03:40.560 --> 01:03:44.480] secretary of state just because they have county in the name doesn't mean it's a county hospital
[01:03:47.360 --> 01:03:51.920] articles of incorporation has to be a charter
[01:03:54.400 --> 01:04:00.160] but where that'll take hidden yeah but where are those charters hidden is the ultimate secret
[01:04:00.160 --> 01:04:06.960]  secretary of state hasn't no it's not there then it's not a it's not incorporated
[01:04:06.960 --> 01:04:13.520] first place i went was the secretary of state and then the secretary of state said oh let me dig
[01:04:13.520 --> 01:04:20.160] and they dug and they found well that that entity the cba doing business as shayan regional medical
[01:04:20.160 --> 01:04:26.640] center was the trademark name of memorial hospital laramie county i said okay they public or private
[01:04:26.640 --> 01:04:32.160] and they said well we can't tell it doesn't say that or etc it just says that's the business and
[01:04:32.160 --> 01:04:35.680] so what she what she landed on that's what the business used to be called was a moral hospital
[01:04:35.680 --> 01:04:40.880] laramie county which is kind of true but it doesn't have a charter doesn't have any designation
[01:04:40.880 --> 01:04:47.440] whether it's a non-profit or anything just says that's the business you read so how how does a
[01:04:47.440 --> 01:04:54.480] hospital become a hospital legally where i went that's where i went to the registering agent who
[01:04:54.480 --> 01:05:00.800] licensed them so it's like like a department of insurance in any state an insurance company
[01:05:00.800 --> 01:05:04.960] generally will not be found in a lot of states will not be found on the secretary of state but
[01:05:04.960 --> 01:05:10.160] they will be licensed through the department of insurance that's where you'll find their deep their
[01:05:10.160 --> 01:05:14.320] all their business licenses and their designation and that's what i you know i learned that from
[01:05:14.320 --> 01:05:22.880] the chicago suit so i with that i applied that common sense to the hospital who licenses the
[01:05:22.880 --> 01:05:26.960] hospital i asked around they said that's the department of health okay who within the department
[01:05:26.960 --> 01:05:30.480] of health and i went even further that's the licensing and survey department i get to them
[01:05:30.480 --> 01:05:40.560] like no that's private hospital let me look them up the private hospital has to be a legal entity
[01:05:40.560 --> 01:05:48.400] of some kind what kind of legal entity is a hospital is it a private business is it a
[01:05:48.400 --> 01:05:55.600] corporation is an llc what kind of business structure do they hold the the irs is going
[01:05:55.600 --> 01:06:04.160] to want them to have a business structure right um i check with the irs and find they may be able
[01:06:04.160 --> 01:06:09.840] to tell you well i finally found it because obviously when i got the ruling that this was
[01:06:09.840 --> 01:06:14.240] a private government entity i started looking around and sure enough it would pop up here and
[01:06:14.240 --> 01:06:20.080] there but it's an it's on very obscure sites it's not hiding in plain sight and even on those sites
[01:06:20.080 --> 01:06:25.040] they're not wyoming sites that i found that on what kind of business is it
[01:06:27.280 --> 01:06:30.240]  well it's listed for tax government entity non-profit
[01:06:32.480 --> 01:06:39.520] a non-profit that's there has to be uh that has to be highly regulated
[01:06:40.560 --> 01:06:44.480]  there's going to be a non-profit without any incorporation papers
[01:06:44.480 --> 01:06:51.760]  um i don't know it again it's still still confusing
[01:06:51.760 --> 01:06:58.080] okay when i when i was doing the sec codes i was breaking them down into questionnaires
[01:06:58.640 --> 01:07:06.080] and in regulation s for the sec if you're going to set up a business that you're going to sell
[01:07:06.160 --> 01:07:14.720] shares in then it specifies precisely the kind of business you will put together
[01:07:16.480 --> 01:07:22.080] tells you the kinds of checks and balances the kinds of audits the kinds of paperwork you have
[01:07:22.080 --> 01:07:31.680] to to to keep this is a non-profit they're not paying taxes they are going to be highly regulated
[01:07:31.680 --> 01:07:35.200]  is it a 501c
[01:07:39.040 --> 01:07:40.960]  that's generally what a non-profit is
[01:07:46.000 --> 01:07:49.040] yeah they have to have business filing somewhere
[01:07:53.520 --> 01:08:01.520] that'll tell you what they are but where where does the general public know to look to find that
[01:08:02.400 --> 01:08:06.960] that's my argument it's almost always the secretary of state
[01:08:07.680 --> 01:08:10.400] but i guess these are different states they can be different
[01:08:11.840 --> 01:08:20.160] uh don't know yeah wyoming try the rrs they're a non-profit the fact that you got this ruling
[01:08:20.160 --> 01:08:24.880] from a judge that says the only reason he's he's throwing your case out is because
[01:08:24.880 --> 01:08:31.440] is obviously this other previous case ruled that it is a government agency
[01:08:33.280 --> 01:08:41.520] so there's your source as crazy and ridiculous as it seems that's what you've got to work with
[01:08:41.520 --> 01:08:47.440] right now and so then you can point the finger of blame at the the ones who told you wrong
[01:08:47.840 --> 01:08:56.560] and put that ruling in their face yeah i did i hit them hard in my in my brief but i'm gonna sue
[01:08:56.560 --> 01:09:02.720] them at some point because this this this is this is what i was leading into and and i won't go off
[01:09:02.720 --> 01:09:11.680] on it but i want to start requesting uh freedom of information why this year of all years they've
[01:09:11.680 --> 01:09:15.920] had many many years to address this they've been dealing with the memorial hospital and people
[01:09:15.920 --> 01:09:20.960] suing that hospital and blah blah blah government notices for many years why this year did they
[01:09:20.960 --> 01:09:26.000] change it specifically that sentence for you they were trying to get a great question
[01:09:28.240 --> 01:09:30.480]  and and i want to say it's for me i don't know
[01:09:32.240 --> 01:09:39.760] but chris is coming after us we need to change the whole state they probably got a good reason
[01:09:39.760 --> 01:09:43.280] for that uh look up the the legislative history
[01:09:45.200 --> 01:09:52.400] okay go to your go to your state legal library for wyoming uh the librarians there they sit
[01:09:52.400 --> 01:09:57.760] there all day they get bored they are an incredible research source
[01:10:00.720 --> 01:10:03.360] talk to them about it it means they're happy to help
[01:10:03.360 --> 01:10:13.600] okay get the legislative history of this piece of legislation the legislators will say what they
[01:10:13.600 --> 01:10:22.960] intended when they uh passed this legislation and that directs the judges when they render their
[01:10:22.960 --> 01:10:31.600] their rulings they have to consider not only what the statute says but they also have to consider
[01:10:31.600 --> 01:10:36.000] the legislative history if you put the legislative history in front of them
[01:10:37.040 --> 01:10:44.000] i'm doing that with the speedy trial act in texas what they're saying in texas is in order to enjoy
[01:10:44.000 --> 01:10:50.480] a speedy trial you have to demand one and you have to show harm and what the the we have a
[01:10:50.480 --> 01:10:57.280] speedy trial act but it was overturned because the the title did not give adequate notice of
[01:10:57.280 --> 01:11:03.920] what the act was about and the act legislated a judicial determination
[01:11:05.520 --> 01:11:14.320] but it wasn't overturned for the the the rest of the content of the statute and what the legislative
[01:11:14.320 --> 01:11:24.320] history says the preamble to the speedy trial act states that it it is the intent of the legislature
[01:11:24.320 --> 01:11:32.240] that a delay in the prosecution of a misdemeanor more than 30 days is unreasonable and a violation
[01:11:32.240 --> 01:11:38.800] of the act so when the judge considers the speedy trial the right to a speedy trial
[01:11:39.840 --> 01:11:46.320] he has to consider that statement of legislative intent so go back to this one
[01:11:47.280 --> 01:11:55.200] find out what the arguments were on the on the house and senate floor you can use those arguments
[01:11:56.160 --> 01:12:02.880] in your motions and pleadings and the judge has to give deference to them
[01:12:05.040 --> 01:12:10.400] i was pretty surprised when i found that out everything these guys say on the house and
[01:12:10.400 --> 01:12:18.320] senate floor about a piece of legislation it's part of the legislative history and it's citable
[01:12:18.320 --> 01:12:28.880] in court so two things one is that reasonable for a member of the general public to go that
[01:12:28.880 --> 01:12:37.440] far into things just to get access to information yes that's what they're saying that's what the
[01:12:37.440 --> 01:12:46.160] courts say they don't cut you any slack that this is this is public public information you're
[01:12:46.160 --> 01:12:52.560] responsible for knowing it okay and i'll take that to heart second point though if a judge
[01:12:53.840 --> 01:12:59.360] has that brought to them during his research in a ruling and obviously if he's looking at the
[01:12:59.360 --> 01:13:05.760] legislative intent he's looking at the dates of the legislative intent he should know that
[01:13:05.760 --> 01:13:12.240] the date what he's looking at was only this year 2024 this case was filed six months prior
[01:13:12.960 --> 01:13:19.360] wouldn't he put that together yes he should have known that he was wrong in doing that
[01:13:20.160 --> 01:13:26.880] and you should if you call that to his attention he might not have realized that it was just past
[01:13:27.520 --> 01:13:33.440] and he might have made a mistake his clerks might have made it for him you're right yes
[01:13:37.120 --> 01:13:43.200] okay they make mistakes all the time if they did that he failed to properly apply the law to the

[01:16:19.920 --> 01:16:23.200]  don't bore me
[01:16:26.640 --> 01:16:27.140]  well
[01:16:27.140 --> 01:16:30.980]  yeah
[01:16:35.540 --> 01:16:43.300] i was blindsided but now i can see your plan you put the fear in my pockets
[01:16:44.260 --> 01:16:50.580] okay we are back randy kelton we're out and we have our radio and we're talking to chris in
[01:16:50.580 --> 01:16:59.860] colorado okay chris we have we pretty well got this sorted out yeah um again i'm not i'm not
[01:16:59.860 --> 01:17:05.380] letting myself get paranoid or excited about it but i did i did message the journalist who wrote
[01:17:05.380 --> 01:17:11.940] the article about it turns out she wrote three articles about this case um she's been she's been
[01:17:11.940 --> 01:17:15.540] following it and now she's going to follow the appeal i just let her know that i'm in the
[01:17:15.540 --> 01:17:21.540] appellate court so my thought is is this and i'm going to probably play it out just to see
[01:17:21.540 --> 01:17:26.260] if it's true or not i think there's something going on behind the scenes just from the beginning
[01:17:26.260 --> 01:17:31.140] when this this this judge the head judge took over this case instead of leaving with the original
[01:17:31.140 --> 01:17:38.100] judge um i don't know if that's true or not it could just be coincidental but once i find the
[01:17:38.100 --> 01:17:45.300] people who are responsible for the legislative intent then what might i do might i start
[01:17:45.300 --> 01:17:50.420] requesting their emails their correspondence through public records to see what the language
[01:17:50.420 --> 01:17:59.220] and the the uh efforts were behind this specific little phrase yes okay yes that's
[01:17:59.860 --> 01:18:07.460] and that i was very rare that i see that done in court but i have seen it done a number of
[01:18:07.460 --> 01:18:14.500] times and frankly when i saw it i was always impressed that the lawyer went back that far to
[01:18:14.500 --> 01:18:23.700] get things clarified and and that's that's controlling what the legislator said on the
[01:18:23.700 --> 01:18:31.140] house or senate floor is controlling because it is the place of the judge to determine the
[01:18:31.140 --> 01:18:37.140]  legislative intent and really cool that's that's that's good to know
[01:18:38.820 --> 01:18:45.220] that we can go and do that clearly stated legislative intent he can't get around it
[01:18:49.540 --> 01:18:55.060]  i mean that's that's fun i've done it uh i haven't put it in my documents but i have
[01:18:55.060 --> 01:19:01.060] went back and read it well actually i did in this this federal suit about uh speedy trial
[01:19:02.420 --> 01:19:04.740] it was fun to dig back there and find all that
[01:19:11.140 --> 01:19:19.460] okay i'll do that um anything else well i do but how many you get a full board
[01:19:19.460 --> 01:19:30.180] and we've got two so we got time for another question okay you last night you hold on hold
[01:19:30.180 --> 01:19:39.060] a second let me check with mary okay it's mary are you there yes can you can you hang on for
[01:19:39.060 --> 01:19:47.780] one more question yes he's interesting yes okay thank you and we've also got eric
[01:19:48.500 --> 01:19:53.940] eric are you in a hurry no i'm not in a hurry i'm just calling just to fill time for you but i got
[01:19:53.940 --> 01:20:04.980] a bunch of questions okay okay we'll take another one from chris okay chris individual versus
[01:20:04.980 --> 01:20:10.340] official capacity last night you talked a little bit about this so i sued the police for wrongful
[01:20:10.980 --> 01:20:14.340] arrest and a whole myriad of fourth and 14th amendment stuff
[01:20:17.380 --> 01:20:24.260] false imprisonment simulation of a legal process all that kind of stuff now the judge kicked it
[01:20:24.260 --> 01:20:30.020] back and he says well okay this is fine but you need to plead with much more specifics of what
[01:20:30.020 --> 01:20:38.980] each individual did okay so in my screening he spelled out i think it's the he exactly what needs
[01:20:38.980 --> 01:20:44.180] to be corrected in an amended complaint now when he gets down to points d and e he talks about
[01:20:44.180 --> 01:20:48.660] individual versus official capacity plaintiff alleges that he's suing defendant in their
[01:20:48.660 --> 01:20:57.140] individual physical capacity it only seeks money damages as relief so basically saying that i need
[01:20:57.140 --> 01:21:01.940] to expand more okay thus plaintiff should not sue the individual defendants in their official
[01:21:01.940 --> 01:21:07.620] capacities in the amended complaint unless he speaks specific for prospective injunctive relief
[01:21:09.940 --> 01:21:14.580] so i do want to get injunctive relief against the police because i want them to correct their
[01:21:14.580 --> 01:21:26.580] policies do i not yes okay well that wouldn't be really injunctive and relief would be
[01:21:28.500 --> 01:21:33.860] to prevent them from doing something if you want them to change their policies that's that's kind
[01:21:34.020 --> 01:21:37.220]  of that's different a mandamus would be injunctive
[01:21:39.380 --> 01:21:42.340] or you where the court orders them to do a certain thing
[01:21:45.220 --> 01:21:51.940] so if they're not following law if their policy is outside law are you familiar with monel
[01:21:52.740 --> 01:21:59.780] press yeah i actually quoted that case yes okay good so this is their acting and their policy
[01:22:00.180 --> 01:22:00.780]  the
[01:22:01.380 --> 01:22:09.220] causes them to act outside of law and you can ask the court to order the department to bring their
[01:22:09.220 --> 01:22:20.500] policy in compliance with law and that's not injunctive that's injunctive okay yes okay
[01:22:20.500 --> 01:22:26.260] that's the where you ask the court to order them to do something that doesn't involve paying you
[01:22:26.260 --> 01:22:36.180] money okay that that would be the injunctive okay so i'll do it and the fact that an officer
[01:22:36.180 --> 01:22:44.740] regardless of whether he is acting in accordance with policy or not before policy he has an oath to
[01:22:45.780 --> 01:22:51.860] law and constitution so where policy deviates deviates from law and constitution
[01:22:52.660 --> 01:23:00.820] as you are responsible for knowing the law knowing the legislative intent of the law
[01:23:01.460 --> 01:23:11.380] all of that so is that police officer if he violates a law it must be presumed
[01:23:11.940 --> 01:23:15.540] that he violated the law with deliberate intent
[01:23:16.180 --> 01:23:22.020] unless he ran over your foot by accident and it's against the law to run over your foot
[01:23:23.220 --> 01:23:28.100] but if he took an act an intentional act regardless of his good faith
[01:23:30.180 --> 01:23:36.100] regardless of the fact that he believed that what he was doing was legal
[01:23:36.180 --> 01:23:44.100] belief in good faith is irrelevant in this case mens rea is there is irrelevant
[01:23:45.620 --> 01:23:55.140] in that the policeman has a statutory duty to do a certain thing if he fails to perform that duty
[01:23:55.620 --> 01:24:00.580] then he's liable even if he did not act with the malicious intent
[01:24:01.380 --> 01:24:04.660] even if he did not act with the malicious intent
[01:24:08.740 --> 01:24:15.140] okay so and and under under the young doctor and hey did i give you a copy of my
[01:24:15.140 --> 01:24:20.260] suit on these judges no i was supposed to request it i forgot to do that
[01:24:21.140 --> 01:24:28.420] okay do that because i have that argument in there the argument of how you get these guys
[01:24:28.420 --> 01:24:30.500] outside the scope of their authority
[01:24:32.820 --> 01:24:38.340] i sent a criminal complaint to the chief justice and the law said
[01:24:39.860 --> 01:24:44.340] texas is different in every other state when a complaint's forwarded to a magistrate complete
[01:24:44.340 --> 01:24:54.980] in accordance with 1505 the magistrate shall forthwith issue a warrant no wiggle room there
[01:24:55.860 --> 01:25:01.780] no the magistrate shall examine into his efficiency none of that he shall issue a warrant
[01:25:02.500 --> 01:25:09.860] absolutely clear where the statute says this officer must do a certain thing and he does
[01:25:09.860 --> 01:25:17.780] not do that certain thing then he's acted outside the scope of his authority he's acted outside the
[01:25:17.780 --> 01:25:28.260] bounds of the contract he's in and he is outside the scope so he cannot be indemnified by the state
[01:25:29.620 --> 01:25:36.420] as according to the young doctor and that would be a violation of the supremacy clause you would
[01:25:36.420 --> 01:25:48.660] have the state paying people to defeat uh require federal requirements essentially paying them to
[01:25:48.660 --> 01:25:58.100] commit crimes yeah so in the sense the federal law is supreme over the state law to pay for
[01:25:58.100 --> 01:26:06.100] their defense the feds have said would violate the supremacy clause so the key is alleged they acted
[01:26:06.100 --> 01:26:16.340] outside of scope false imprisonments outside of scope amongst other any violation of law is outside
[01:26:16.340 --> 01:26:22.580] of scope i agree i want to add to the argument about that in my case i'm not sure if i should
[01:26:22.580 --> 01:26:27.060] add it in it's like if if we're tasked with knowing like you mentioned all this information
[01:26:27.060 --> 01:26:31.060] then obviously our government entities should be known should know this information and then
[01:26:31.300 --> 01:26:38.900] otherwise why are we paying them what is their exact of all people those charged with the
[01:26:38.900 --> 01:26:46.100] enforcing the law should know the law a hd wells in his outline of history on speaking to the
[01:26:46.100 --> 01:26:53.060] corruption of the popes during the dark ages very aptly observed the giver of the law most knows the
[01:26:53.060 --> 01:26:58.420] law allegiance he of all beings should behave as though the law compels him and we'll finish this
[01:26:58.420 --> 01:27:06.260] is sorry soft drink lovers even diet drinks can make you fat the new study shows that diet

[01:27:49.780 --> 01:27:55.060] researchers at ut san antonio followed hundreds of diet soda drinkers for nearly a decade they
[01:27:55.060 --> 01:28:00.900] found that regularly drinking diet soda expanded people's waistlines five times more than no soda
[01:28:00.900 --> 01:28:05.620] at all the studies authors say artificial sweeteners trigger the appetite but unlike
[01:28:05.620 --> 01:28:10.980] regular sugars don't deliver anything to squelch it waking up hunger without satisfying it leads

[01:31:18.900 --> 01:31:26.980] okay we are back frank kelton brett fountain rule of law radio cup chris in colorado back to
[01:31:27.620 --> 01:31:31.220] me hg wells and his outline of history
[01:31:32.580 --> 01:31:39.860] that the giver of the law most owes the law allegiance be of all beings should behave as
[01:31:39.860 --> 01:31:48.020] though the law compels him but it is the universal failing of mankind that what we are given to ed
[01:31:48.020 --> 01:31:57.060] minister we promptly resume the own that is exactly what i see with my public officials
[01:31:58.020 --> 01:32:02.020] and frankly i find it very offensive that's my story and i'm sticking to it
[01:32:03.940 --> 01:32:09.140]  we're all offended we're we're insulted extremely i think you're right
[01:32:09.140 --> 01:32:12.260]  okay
[01:32:13.300 --> 01:32:20.580] i throw that quotation in all the time i found it in hg wells outline of history
[01:32:20.580 --> 01:32:25.380] i've never heard anybody else quote it but it really goes directly to this point
[01:32:30.180 --> 01:32:34.900] okay last part about this the judge then goes on the municipal liability
[01:32:35.860 --> 01:32:40.340] this says i need to be clear about policies some type of language but could i sue the municipal
[01:32:41.060 --> 01:32:45.780] the police station itself as an individual or and official capacity or
[01:32:46.580 --> 01:32:52.500] either one of those would apply you you can sue the individuals in their individual capacity
[01:32:52.500 --> 01:32:54.340] and you can sue the department
[01:32:55.140 --> 01:33:03.700] in what capacity in in effect effectively you sue the state because the the department
[01:33:03.700 --> 01:33:11.620] established these policies i don't like suing the department but but it may be my lack of
[01:33:11.620 --> 01:33:18.180] sophistication i haven't been through to the back side of enough of these
[01:33:18.580 --> 01:33:20.660] through to the back side of enough of these
[01:33:21.780 --> 01:33:28.820] my problem when i sued all these highest judges i sued them all in their personal capacity so i
[01:33:28.820 --> 01:33:38.260] had nobody to pay the bill so when i do this again i'm going to look at suing all these individuals
[01:33:38.260 --> 01:33:45.060] in their personal capacity and then i have to figure out how to sue the jurisdiction
[01:33:46.020 --> 01:33:52.900] but suing the jurisdiction is much more tricky because the case law says that a
[01:33:54.500 --> 01:34:00.260] government that the sovereign is cannot the sovereign can do no wrong
[01:34:02.900 --> 01:34:09.620] so i'm trying to sue the sovereign but if you sue the the sheriff's deputies in their
[01:34:10.580 --> 01:34:16.660] official capacity the courts say you're suing the state the sovereign but then they say that
[01:34:16.660 --> 01:34:24.260] the sovereign can do no wrong now you in this case can sue the sovereign because one of your claims
[01:34:25.140 --> 01:34:33.940] is a false imprisonment and false in in the matter of false imprisonment all of the jurisdictions
[01:34:34.100 --> 01:34:43.060] have waived their sovereign immunity so that gets you in that door that should be enough on its face
[01:34:43.940 --> 01:34:57.780] to avoid the 12b1 12b1 is the immunity defense so if you sue in their the sovereign in its official
[01:34:57.780 --> 01:35:06.100] capacity for false imprisonment they cannot claim immunity as they have waived it so in your case
[01:35:06.100 --> 01:35:14.980] that would solve that problem even if they threw out all of your other claims you can get the full
[01:35:14.980 --> 01:35:22.580] remuneration just from the one claim so you only have to win one to be able to win the whole thing
[01:35:22.580 --> 01:35:24.500] so you got that one in your favor
[01:35:28.740 --> 01:35:34.340] does that make sense it does yeah and and i want to do it because i actually have a recording from
[01:35:34.340 --> 01:35:38.900] the sergeant on a phone call stating that his officers could have done things better
[01:35:39.620 --> 01:35:44.980] among many many other things so he was very concerned about what i was up to so he spent
[01:35:44.980 --> 01:35:49.700] almost two hours speaking to me about that incident which is not good for them because
[01:35:49.700 --> 01:35:56.500] i have it all recorded but good they definitely have policies they're not not sufficient
[01:35:57.620 --> 01:36:01.220] so i think it's important i mean and the reputation is awful i've called lawyers and
[01:36:01.220 --> 01:36:04.820] they go yeah they're just brutes they they don't train them well so i mean it's well known that
[01:36:04.820 --> 01:36:15.860] they need some correction there so okay i'll add them in and i'll report clean this up thank you
[01:36:15.860 --> 01:36:22.900] very much guys i appreciate it as always okay thank you chris now we're going to go to
[01:36:23.940 --> 01:36:32.180] we have a first time caller mary eric i know i'm holding you guys up you both been on for an hour
[01:36:37.620 --> 01:36:39.940] mary doesn't take too long let me go ahead and take mary
[01:36:40.660 --> 01:36:48.340] okay hello mary what do you have for us today good evening gentlemen another great show
[01:36:48.340 --> 01:36:52.020] thank y'all so much you are welcome
[01:36:54.900 --> 01:37:01.620] i know i've said it before um but the techniques i've learned about being a pro se from hell
[01:37:02.260 --> 01:37:10.180] have helped me in almost every area of my life um i'm being bold on getting involved
[01:37:10.820 --> 01:37:17.780] on having healthy boundaries and being a heroine i've used it at work i've used it in personal
[01:37:17.780 --> 01:37:26.100] relationships and um in political matters as well so i just thank you so much
[01:37:27.060 --> 01:37:33.540] yeah yeah miss mary has become a big-time politician i have had to take an oath of office
[01:37:34.740 --> 01:37:45.060] i'm an official now i guess i'm some sort of there you go um but let me say i hope you won't
[01:37:45.060 --> 01:37:50.260] think poorly of me but i'm starting to feel sorry for john and john thank you for what you said
[01:37:50.260 --> 01:37:54.660] about smart meters because it has some relevance in my personal experience
[01:37:55.700 --> 01:38:03.140] oh man don't let john hear you say that we will never hear the end of it i love john from you're
[01:38:03.140 --> 01:38:10.980] getting hugs and kisses from texas you yankee and um but and you know john go ahead and go to the
[01:38:10.980 --> 01:38:17.940] uh bbb and take those people to small claims court that's what i'd say but um otherwise
[01:38:18.420 --> 01:38:25.300] uh with the last caller in the discussion about making somebody financially accountable um i know
[01:38:25.300 --> 01:38:30.180] this isn't a term but i'm looking at collateral conspiracy or what frederick graves calls a third
[01:38:30.180 --> 01:38:36.100] party lawsuit so getting it kind of goes back to the oj stuff about the criminal case versus the
[01:38:36.100 --> 01:38:42.100] civil case you know get that criminal case in and you're going to win your civil case but still
[01:38:42.100 --> 01:38:47.140] doesn't mean you won't that you will lose your civil case if the criminal case didn't hold
[01:38:47.940 --> 01:38:56.500] any water or didn't pass in your favor so i would say with your um the folks you're dealing with
[01:38:56.500 --> 01:39:04.020] those judges the rotten judges uh get them before the judge you know and they they um the judge
[01:39:04.020 --> 01:39:10.260] agrees with you and then um throw the third party in like fred grave says you know throw the third
[01:39:10.340 --> 01:39:17.300] party in about the strawberry fields so i would say that you can attach the state when it's
[01:39:17.300 --> 01:39:23.380] convenient for you scare these guys about acting like criminals not with racketeering sedition
[01:39:24.100 --> 01:39:32.340] or conspiracy but for whatever other cause you find and then um you know attach uh the state
[01:39:32.340 --> 01:39:38.660] to it as third party that they had to do diligence and they they operated under negligence um but
[01:39:39.620 --> 01:39:46.660] what i'm looking at right now is just a general theoretical question
[01:39:50.180 --> 01:39:56.980] regarding official oppression law and i don't want to get into the meat of it
[01:39:56.980 --> 01:40:03.380] but just theoretically how can i help apply the power of official oppression
[01:40:04.340 --> 01:40:12.580] to local high-ranking attorneys or politicians as we uh suffer to deal with

[01:44:07.220 --> 01:44:15.220] okay we are back randy kelton red fountain rule of law radio and mary you're going right to one
[01:44:15.220 --> 01:44:23.860] of the things that we hope we can get across yeah i go in and i file criminal charges against
[01:44:23.860 --> 01:44:31.780] public officials at the drop of a hat but i never want a public official prosecutor that is
[01:44:31.780 --> 01:44:38.100] not my purpose i am well aware that the vast majority of all of our public officials
[01:44:38.820 --> 01:44:45.220] are right-minded individuals who want to do a good job and they're acting in accordance with
[01:44:45.220 --> 01:44:53.700] their training problem is their training but how do we get to the guys who trained them
[01:44:53.700 --> 01:45:00.020] that's why i sued all the highest judges in texas and i sued their heads of all the agencies that
[01:45:00.020 --> 01:45:05.780] the train people to get their attention i did not expect to win any money from any of them
[01:45:06.500 --> 01:45:11.060] i wanted to give the state a way to buy me out and get me to go away
[01:45:12.340 --> 01:45:15.860] but the third the fifth circuit threw my stuff out with no
[01:45:17.220 --> 01:45:19.780] judgment so i'm going to file criminal charges with the
[01:45:20.580 --> 01:45:27.940] a special agent charge the fbi on them see how that flies but my purpose in going after them
[01:45:27.940 --> 01:45:33.540] criminally is just to get them to pay attention you're going to get to get their attention so
[01:45:33.540 --> 01:45:37.780] they'll look at what the law says and look how vulnerable they are so they'll change their
[01:45:37.780 --> 01:45:46.420] behavior and mary you're being a big-time politician now this poll watching is a big deal
[01:45:46.420 --> 01:45:53.700] well and all they need to do if you're a poll if you're a poll watcher and you see something
[01:45:53.700 --> 01:45:58.660] that you believe is improper you don't want to go in there and disrupt the polling
[01:46:00.020 --> 01:46:06.820] so call a policeman say i have reason to believe that they're committing a crime in there and i
[01:46:06.820 --> 01:46:15.220] would like to investigate it instead of you going in there and wind up with this back and forth and
[01:46:15.220 --> 01:46:22.740] wind up with the the election judge calling the police on you you call the police on them
[01:46:24.340 --> 01:46:28.500] and then the policeman will go in there and ask them questions that they all have to answer
[01:46:29.940 --> 01:46:34.020] they are not going to like answering questions to a policeman
[01:46:36.740 --> 01:46:41.060] so when they go back when the policeman goes away they're going to go in there and say
[01:46:41.060 --> 01:46:51.220] you know if you're a a election worker and you've got to explain to a police officer
[01:46:52.420 --> 01:46:59.300] what you're doing on the however veiled threat of being arrested
[01:47:00.820 --> 01:47:07.300] if the election judge or the anybody down there tells you to do something that doesn't look
[01:47:07.300 --> 01:47:13.620] like it's proper you're going to tell them oh whoa hold on here guys you want that done you
[01:47:13.620 --> 01:47:20.260] go do it those people out there are going to call the cops on me get me arrested this is what the
[01:47:20.260 --> 01:47:29.780] police were intended to be used for not to arrest people but to arbitrate issues and keep them from
[01:47:29.780 --> 01:47:37.380] becoming criminals it's about getting their attention what do you think mary
[01:47:39.380 --> 01:47:46.820] i like that um that does make a lot of sense um i'm gonna have to get the strategy down
[01:47:47.700 --> 01:47:53.940] and memorize it the exact what we call the routine i don't know if that doesn't have anything to do
[01:47:54.340 --> 01:48:02.100] okay it's it's real simple you want the policeman to write a report based on your call
[01:48:03.620 --> 01:48:13.220] now it's it's on it's in the public record anybody can get it and it's preserved you've
[01:48:13.220 --> 01:48:17.780] raised this issue if you have to call them a second time on the same thing
[01:48:19.300 --> 01:48:23.140] then the policeman is going to consider you know this is getting more serious
[01:48:24.500 --> 01:48:31.220] and the policeman's not going to want to arrest an election judge but or a poll worker
[01:48:32.980 --> 01:48:37.620] but he's going to talk to them and say guys you got people out here watching you
[01:48:37.620 --> 01:48:44.900] you better make sure you do this right and he is the you use the policeman as an arbiter
[01:48:46.100 --> 01:48:52.660] to arbitrate between your issues if you call the police for something they're doing and what
[01:48:52.660 --> 01:48:58.500] they're doing is right then the policeman's going to come down and he's going to say
[01:48:58.500 --> 01:49:02.740] you know we looked into it and here's the law here they can do it this way they're
[01:49:02.740 --> 01:49:11.940] they're okay they'll harm no foul but you got their attention now now they know somebody
[01:49:11.940 --> 01:49:18.580] with authority is going to be looking over their shoulder and these problems will go away without
[01:49:18.580 --> 01:49:27.460] us going to court without us suing suing anyone it's just the way civil society was meant to function
[01:49:33.220 --> 01:49:36.340] and when you call the police never do it out of anger or avarice
[01:49:37.140 --> 01:49:44.340] do it because you have a legitimate question that needs to be answered then we'll do it for you
[01:49:49.140 --> 01:49:52.100] when you call the police you are absolutely protected
[01:49:54.100 --> 01:49:58.420] if the policeman says one word to you that you can take as a threat now
[01:49:58.420 --> 01:50:07.700] that is a really big deal then you call 911 on the policeman not be at the polling place
[01:50:09.620 --> 01:50:17.540] and then the policeman will get educated you have a lot of policemen that feel like poll watchers
[01:50:17.540 --> 01:50:24.500] are just troublemakers and they may have a their own ideas about how the election should go
[01:50:25.060 --> 01:50:32.100] and you may have to school them but you are the sovereign here and it's your job to school them
[01:50:36.260 --> 01:50:42.500]  okay and applying to a da that's corrupt let's say a da doesn't prosecute somebody
[01:50:43.220 --> 01:50:45.460] and they go out and they murder somebody again
[01:50:47.700 --> 01:50:53.220] how could we pull in official oppression to to uh we have a ruling we have a new law
[01:50:54.100 --> 01:51:01.060] have a new law that just went into effect this september was it last september do you remember
[01:51:01.060 --> 01:51:08.500] brett there's a new law which new law the one the one that says the district court can remove a
[01:51:08.500 --> 01:51:18.900] prosecutor for refusing to prosecute a class of crime and this this was put in specifically
[01:51:19.460 --> 01:51:26.900] to go after democratic prosecutors for not prosecuting complaints by poll watchers
[01:51:28.980 --> 01:51:33.380] that was exactly why they did however it applies to everything else
[01:51:34.100 --> 01:51:40.420] uh yeah and i'm looking at it if i file complaints against the public official
[01:51:41.540 --> 01:51:43.460]  and the prosecutor routinely
[01:51:46.260 --> 01:51:52.660] secrets my complaints from the grand jury then like in the county i live in i live in wise county
[01:51:52.660 --> 01:51:58.660] and our current district attorney is a real stinker the one who was in there was a personal
[01:51:58.660 --> 01:52:04.900] friend of mine he was really genuinely nice guy and been over backwards to do things right
[01:52:05.620 --> 01:52:11.620] the one we got in now is a real stinker can't say anything worse than that on the air but i have
[01:52:12.180 --> 01:52:19.860] absolutely no faith in him whatsoever but everybody hates him because he's such a jerk
[01:52:21.140 --> 01:52:26.740] so the district judge doesn't like him so i'm going to go in and file a bunch of criminal charges
[01:52:27.460 --> 01:52:33.140] and all of the same thing with the grand jury and he's going to block them from the grand jury
[01:52:33.140 --> 01:52:37.860] and then i'm going to file against him with the grand jury and he'll block them because he's done
[01:52:37.860 --> 01:52:43.700] it before and i can use the old ones but i want to use the fresh ones then i'll take it to the
[01:52:43.700 --> 01:52:53.780] district judge and give give the prosecutor notice of intent to sue and they know who i am and they
[01:52:53.780 --> 01:53:02.980] know who i've you know the suit i've already done so my my effectively my notice won't fall
[01:53:02.980 --> 01:53:09.460] on deaf ears and i may be able to get the district attorney to remove the district judge district i
[01:53:09.460 --> 01:53:19.860] mean district judge to remove the district attorney i'm going to try oh i'll i'll let you move on to
[01:53:19.860 --> 01:53:27.700] the next caller but this is sort of my focal point right now as i'm getting more engaged with
[01:53:27.700 --> 01:53:36.580] the local republican party and other attorneys and politicians and high ranking elected officials
[01:53:36.580 --> 01:53:42.100] here at the state capitol so i want to give them when you when you talk to these people
[01:53:42.100 --> 01:53:47.540] tell the poll watchers if you see something you think's wrong don't go in there and disrupt the
[01:53:47.540 --> 01:53:53.620] polling all that'll do is make you look bad and it'll cause lots of problems go ask a policeman
[01:53:53.620 --> 01:53:59.380] to go do that so that there is no don't cause any kind of difficulty
[01:54:01.780 --> 01:54:08.020] that'll work that'll make it easier for them to raise their issues they don't have to go
[01:54:08.020 --> 01:54:15.140] in there and get in a fight and if nothing's wrong the policeman will find that out everything will
[01:54:15.140 --> 01:54:21.940] be good so use the police with what they were intended and things will work out better well
[01:54:21.940 --> 01:54:28.580] and i like how you said that you know we have a duty to educate and the crowd i'm working with
[01:54:28.580 --> 01:54:38.100] at this point is a good collective of precinct chairs i'm not saying 120 but about and we're
[01:54:38.180 --> 01:54:45.860] expanding that base each precinct chair should have a personal text list of about 300 to 500
[01:54:45.860 --> 01:54:53.060] people coming up here soon on a new project we're working on so we're going to have a way to advance
[01:54:53.620 --> 01:54:59.540] a sovereign and political authority very soon so i like the idea of letting these other
[01:54:59.540 --> 01:55:04.740] precinct chairs know that we have a duty to inform and educate our fellow citizens
[01:55:04.740 --> 01:55:10.740] and the fellow officials either either get me in front of them or let me school you on how to do
[01:55:10.740 --> 01:55:18.100] that and you get in front of them and get them to use the police to help solve these problems so
[01:55:18.100 --> 01:55:28.740] there's no no chaos and no problems created and get this polling problems contention next
[01:55:28.740 --> 01:55:32.900] a lot of this tyranny so that's where i'll be going with you in the next month or two
[01:55:32.900 --> 01:55:38.100] and hopefully for some time so i can get this advanced and well well developed

[02:00:23.780 --> 02:00:35.220] i accepted it for value right away if not sooner not later we are originators and the pathway seems
[02:00:35.220 --> 02:00:45.220] to get straighter every day and i can take anything that belongs to me and put it to good use
[02:00:45.860 --> 02:00:48.660] what i was good for the gander
[02:00:53.300 --> 02:01:02.660] i know some architects i know some engineers they see the evidence
[02:01:04.180 --> 02:01:12.420] they know something seems queer okay we are back randy kelton brett fountain rudelaw radio

[02:02:36.340 --> 02:02:42.580] philadelphia pennsylvania okay you speak yankee that's okay i speak the dialect
[02:02:45.860 --> 02:02:50.260] okay barica from pennsylvania okay what do you have for us
[02:02:51.620 --> 02:03:02.100] yep so um recently my car was stolen by the by uh repossession and um this is what maybe like
[02:03:02.100 --> 02:03:08.900] two days ago actually i had sent out a debt validation letter to the to the bank that um
[02:03:08.900 --> 02:03:12.660] you know that was going through for my car and they didn't respond to anything
[02:03:13.540 --> 02:03:20.100] and um and i go outside to go warm my car up for work and i go outside of my car is gone
[02:03:20.660 --> 02:03:30.740] so first thing i did is i called 911 and i reported my car stolen and they asked me was i missing in
[02:03:30.820 --> 02:03:36.420] payments or was i behind on the payments or anything like that and they asked me for my
[02:03:36.420 --> 02:03:44.900] information and um they wind up telling me that my that they recoded my car and um they gave me
[02:03:44.900 --> 02:03:50.980] the information to where to find my car the phone number as well as the address so i went to
[02:03:51.780 --> 02:03:56.980] the um i went to where they sold my car at and um the gate was open so of course i have the keys
[02:03:57.060 --> 02:04:01.620] i'm going to go get my car and i'll at least get my belongings as far as
[02:04:01.620 --> 02:04:04.980] you know my my work bags and my work keys everything was in my car still
[02:04:05.780 --> 02:04:11.620] and um the guy who actually pulled my car he called the cops and he was saying i was
[02:04:11.620 --> 02:04:16.100] trespassing on private property as i was explaining to him that he stole my private
[02:04:16.820 --> 02:04:23.540] my private property that's my car and my car is in my truck okay okay hold on before we go any
[02:04:23.540 --> 02:04:32.820] further did they take this court and get a order allowing them to seize the car
[02:04:34.100 --> 02:04:39.140] no they never showed me no paperwork they said an order i said well can i see a copy of an order i
[02:04:39.140 --> 02:04:44.660] don't have an order i never see nothing in a mail nothing and they they didn't give me anything
[02:04:44.660 --> 02:04:51.300] they actually wouldn't so did you did you file did you file criminal charges against them
[02:04:51.300 --> 02:04:56.420] charging them with auto theft oh not yet i actually have the paperwork in front of me
[02:04:57.620 --> 02:05:01.860] okay that's what i'm working on for me that would have been the first thing i'd done is call the
[02:05:01.860 --> 02:05:07.300] police accuse them of stealing the car and they're going to say oh we didn't steal it we
[02:05:07.860 --> 02:05:16.180] we repo'd it well let's see the paperwork under what authority there was two officers there that
[02:05:16.180 --> 02:05:20.820] the repo guy called the cops the cops came i said i want to speak to your sergeant the sergeant came
[02:05:20.820 --> 02:05:25.140] down the sergeant were i said well is this a criminal or a civil matter he said the civil
[02:05:25.140 --> 02:05:29.940] mayor i said so why are you guys here that he said because of the disturbance i guess i was
[02:05:29.940 --> 02:05:37.220] disturbing and i said okay well now you're here i want to file a criminal complaint and he refused
[02:05:37.220 --> 02:05:46.820] to oh wonderful you got his name yep i got his name i got two officers names so then i um so he
[02:05:46.820 --> 02:05:52.420] said well on your on the on your on the dispatcher call you told the lady that you were behind on
[02:05:52.420 --> 02:05:56.820] payments and he told me that you weren't i said the problem is my car is stolen you worried about
[02:05:56.820 --> 02:06:01.700] the wrong thing and i said well i'm going to go to the station he said you can go to the station
[02:06:01.700 --> 02:06:07.300] you're going to waste your time i'm not going to file it there that i said so you're refusing so
[02:06:07.300 --> 02:06:12.100] i said well what about if i want to fill out our freedom of information form he said that's fine
[02:06:12.100 --> 02:06:16.900] i said okay well i want i say are your body cameras on they say yes i want your body cameras
[02:06:16.900 --> 02:06:21.220] they just literally tell me that you're refusing to file a criminal complaint that's this criminal
[02:06:21.220 --> 02:06:25.540] and i want to file a criminal complaint because my car was stolen you don't have any order you're
[02:06:25.540 --> 02:06:32.740] not showing me any paperwork i don't even know who you are you stole my car good for you you did that
[02:06:33.540 --> 02:06:34.100]  excellent
[02:06:36.420 --> 02:06:42.100] okay now if i what what we do have you listened to our show before
[02:06:43.460 --> 02:06:47.380] no this is my first time actually so i'll definitely be sort of tuning in some more
[02:06:48.900 --> 02:06:50.900] who sent you how did you find us
[02:06:50.900 --> 02:06:57.060]  this
[02:06:58.740 --> 02:07:08.740] okay yeah you got very intelligent and articulate and just say lots of nice things about them
[02:07:11.780 --> 02:07:17.860] okay what what we like to do is turn the system back on them
[02:07:18.820 --> 02:07:25.860] if this tow truck driver come out and towed your car and they had dubious cause
[02:07:27.220 --> 02:07:33.540] so you go to you try to file a complaint with the police and the complete the policeman
[02:07:33.540 --> 02:07:40.260] refuses to take your complaint now that becomes a whole separate issue
[02:07:40.260 --> 02:07:48.740] you now you go i would need to look at the criminal procedure code
[02:07:49.540 --> 02:07:55.940] for pennsylvania but all of the criminal procedure codes for the various states
[02:07:56.820 --> 02:08:05.380] are an adaptation of a model criminal code put out by the american bar associates i think was
[02:08:05.380 --> 02:08:11.780] the american bar as somebody put it out and they ask all the states to adopt it or
[02:08:13.140 --> 02:08:20.020] adopt a variation of it and most all of them did and there are i think three that didn't and
[02:08:20.980 --> 02:08:26.820] because there's already almost matched or maybe that was a bar association but anyway everybody's
[02:08:27.460 --> 02:08:36.340] the procedure codes are almost the same and one thing that the primary duty of a policeman
[02:08:37.540 --> 02:08:43.460] is when a policeman is given notice of crime he is to give notice to some magistrate
[02:08:45.060 --> 02:08:52.740] and the magistrate once he's been given notice of crime will listen to the complaint the officer
[02:08:52.740 --> 02:09:00.420] brings and if the magistrate finds probable cause then the magistrate will issue a warrant
[02:09:01.540 --> 02:09:06.020] and then the person needs to be arrested and brought before that magistrate
[02:09:07.700 --> 02:09:13.220] i'm walking through criminal due process so we could show how this policeman violated it
[02:09:14.420 --> 02:09:22.180] in in texas i'll use texas codes because i know those in texas under article 2.13
[02:09:23.620 --> 02:09:30.180] article paragraph c says when a when a police officer or a peace officer has it made known to
[02:09:30.180 --> 02:09:40.820] him that a crime has been committed he shall give notice to some magistrate now when a when a police
[02:09:40.820 --> 02:09:48.340] officer takes a criminal complaint to a magistrate he doesn't do so in his capacity as a peace officer
[02:09:49.140 --> 02:09:57.380] he does so in his capacity as a citizen in a in a republic a police officer does not have a special
[02:09:58.180 --> 02:10:06.980] right to give criminal complaints to magistrates magistrates tend to think that they do
[02:10:07.940 --> 02:10:15.380] i went to a common mistake i went to a magistrate in victoria texas and gave him four criminal
[02:10:15.380 --> 02:10:21.380] complaints he said are you an attorney oh no no no i sleep with it not keep hands of own pockets
[02:10:21.380 --> 02:10:26.820] thank you very much well he didn't find that as funny as i did he said have you talked to an
[02:10:26.820 --> 02:10:32.660] attorney nah i don't waste my time with those ignorant shysters they don't know squat he said
[02:10:32.660 --> 02:10:36.980] well if you're not an attorney i'm not even going to read these and threw them down on the counter
[02:10:36.980 --> 02:10:45.140] and stormed out in a huff i watched you leave and then said but well bubba we'll see how that works
[02:10:45.140 --> 02:10:50.740] out for you and i took out my cell phone dial 911 and asked for an officer to arrest the jp
[02:10:52.900 --> 02:11:02.260] oh we have these one of the rules is ever ask a public official to do anything you actually want
[02:11:02.260 --> 02:11:11.460] them to do because you never ask a public official to do anything that the law does not command him
[02:11:11.460 --> 02:11:21.300] to do in this case you ask a police officer to take a criminal complaint from you and he refused
[02:11:22.420 --> 02:11:30.260] to take your complaint and give notice to some magistrate well in texas if a public official
[02:11:31.060 --> 02:11:37.620] fails to perform a duty they are required to perform and in the process denies a citizen
[02:11:37.620 --> 02:11:44.900] in the full and free access to or enjoyment of a right that's an an act of official oppression
[02:11:45.860 --> 02:11:52.980] in most states that's called official misconduct yeah i think that's what it was in pennsylvania
[02:11:53.860 --> 02:11:59.780] yeah so and that's a generally a class a misdemeanor ten thousand dollar fine year in jail
[02:11:59.780 --> 02:12:04.580] well so this officer just committed that crime
[02:12:06.100 --> 02:12:14.020] the fact that he's got a a uniform and a badge on makes no difference now he has denied you
[02:12:14.580 --> 02:12:20.180] in the equal protection of of the laws in violation of the 14th amendment to the united
[02:12:20.180 --> 02:12:27.380] states constitution he's subject to be sued in the federal court in his personal capacity
[02:12:27.940 --> 02:12:32.100] most people don't do that because it costs a lot of time and trouble to do it
[02:12:33.460 --> 02:12:40.980] and you don't have to sue him what you can do is pursue him criminally that's what nobody does
[02:12:42.900 --> 02:12:50.260] so you go to a magistrate with a criminal complaint against the police officer
[02:12:50.420 --> 02:12:57.620] in pennsylvania you would actually give your complaint to a prosecuting attorney
[02:12:58.740 --> 02:13:08.260] because the prosecuting attorney in pennsylvania has first blush has first opportunity to examine
[02:13:08.260 --> 02:13:14.740] into a criminal accusation and determine whether or not he chooses to prosecute
[02:13:14.820 --> 02:13:22.340] to prosecute well if you do that you can be sure that the prosecuting attorney will refuse to
[02:13:22.340 --> 02:13:29.140] prosecute and that looks like a real problem and as far as i know pennsylvania is the only state
[02:13:29.140 --> 02:13:38.340] that does that but to compensate for that problem if a prosecuting attorney elects not to prosecute
[02:13:39.300 --> 02:13:45.300] then you can take you can appeal the attorney's decision to the court of common please
[02:13:49.140 --> 02:13:54.340] and when we come back on the other side we'll walk your way up the ladder

[02:16:51.620 --> 02:16:56.820] he is everything he's everything to me that's why i call him

[02:17:03.380 --> 02:17:07.860] they know business what we can man saying mankind you know is this
[02:17:07.860 --> 02:17:12.660]  me
[02:17:14.420 --> 02:17:21.460] okay we are back bandy kelton brett fountain rule of law radio and we're talking to marika in
[02:17:21.460 --> 02:17:29.620] pennsylvania and i do have some experience in pennsylvania i was once uh asked to come to
[02:17:30.340 --> 02:17:37.300] pennsylvania to intercourse and help the amish over a raw milk issue
[02:17:38.900 --> 02:17:45.460] it was an interesting place but i learned something about the legal process if the
[02:17:46.260 --> 02:17:51.140] prosecuting attorney refused to prosecute you can appeal to the court of common please
[02:17:51.700 --> 02:17:58.980] and if they if the court of common please refuses you can appeal all the way up to the
[02:17:58.980 --> 02:18:07.140] pennsylvania supreme court now it's it's our opinion that if you're going to have a fight
[02:18:07.140 --> 02:18:14.740] with the government the best fight fight to have is the one you picked so you got this
[02:18:15.220 --> 02:18:23.220] towing company over here that you're accused of stealing your car and now the prosecutor
[02:18:23.220 --> 02:18:26.820] is shielding the tow truck driver from prosecution
[02:18:29.940 --> 02:18:38.180] and then you appeal this all the way up to the supreme this is it's a small it's a focused issue
[02:18:38.980 --> 02:18:46.500] and you wind up when the prosecutor refuses to prosecute you have an attorney general
[02:18:47.140 --> 02:18:55.220] in pennsylvania who has prosecutorial powers so what you do is when the prosecutor refuses to
[02:18:55.220 --> 02:19:03.140] prosecute the peace officer for not taking your criminal complaint then you file against the
[02:19:04.100 --> 02:19:07.860] attorney do you the prosecutor with the attorney general
[02:19:10.100 --> 02:19:14.420] and when the attorney when the attorney general refuses to prosecute
[02:19:14.420 --> 02:19:21.540] you appeal that to the court of common please and you take them both all the way up to the supreme
[02:19:23.540 --> 02:19:29.620] it'll both of them plus the the criminal complaint of her own against the the thief right
[02:19:30.260 --> 02:19:34.740] yeah so so you got all of these public officials in pennsylvania
[02:19:36.100 --> 02:19:41.300] get got you hammering them and dragging them through the courts and they're all looking
[02:19:41.300 --> 02:19:49.780] it back at this guy who started all this and at some point you may well get them to take some
[02:19:49.780 --> 02:19:56.180] action and in the meantime you can certainly sue the towing company and you heard did you
[02:19:56.180 --> 02:19:58.260] hear the caller before you chris
[02:20:01.460 --> 02:20:08.420] yep okay the way we first got in touch with chris is he had his car stolen
[02:20:09.140 --> 02:20:17.060] by a towing company in chicago of all places now for the most part towing companies in chicago
[02:20:17.060 --> 02:20:21.940] are called controlled by the mob and he beat them in court
[02:20:24.820 --> 02:20:35.780] so we have a good resource for you yeah chris chris worked over so the best idea is
[02:20:36.500 --> 02:20:42.260] is you hammer them and get them to come to the table and make a deal there there is this thing
[02:20:42.260 --> 02:20:48.660] called the stowars doctrine it started in texas and then expanded to all the states
[02:20:50.020 --> 02:20:57.540] this towing company is going to have an insurance policy so if you sue them the insurance company
[02:20:57.540 --> 02:21:03.620] will take over the suit just like your insurance company would take over if you get an accident
[02:21:03.620 --> 02:21:09.940] and get sued you don't you don't get you don't get a defense counsel the
[02:21:10.660 --> 02:21:18.100] the insurance company defends the suit well what the court said is that the
[02:21:19.060 --> 02:21:26.900] insurance company cannot play fast and loose with his client's money so if they get an offer to
[02:21:26.900 --> 02:21:37.140] settle that's less than the maximum amount of their coverage less attorney fees and they don't
[02:21:37.140 --> 02:21:47.300] accept that offer and then they go to court and you get a claim higher than their coverage amount
[02:21:47.300 --> 02:21:53.300] they have to pay it because they said since you're running the defense
[02:21:53.540 --> 02:22:02.660] then and you refuse to take the deal if they the plant if winds up getting a larger claim now you
[02:22:02.660 --> 02:22:12.660] have cost your client money you can't do that so if you got a offer within your scope of your coverage
[02:22:13.460 --> 02:22:19.940] and you don't take it anything extra you have to pay that's the stowars doctrine so that gives
[02:22:20.420 --> 02:22:30.740] st-o-w-e-r-s the point of this is the insurance company for the towing company
[02:22:30.740 --> 02:22:41.860] has a motivation to settle with you so we have some rules and one of the rules is
[02:22:42.500 --> 02:22:49.220] you can never expect to win your case simply because you have the law and the facts on your
[02:22:49.220 --> 02:22:58.180] side to think so is naive you can only expect to win your case if you have the politics on your side
[02:22:58.980 --> 02:23:08.260] and all politics is local with that said the better you set up the legal side
[02:23:09.220 --> 02:23:15.780] the stronger will be your political side at the end of the day it's most all poker
[02:23:16.740 --> 02:23:22.740] you're going after them and building a poker hand so we start out by asking public officials
[02:23:22.740 --> 02:23:26.740] what they're to do things they're commanded to do so that when they don't don't do them
[02:23:27.460 --> 02:23:35.460] we get claims against them and each each one that doesn't do their job we get a claim against them
[02:23:35.460 --> 02:23:41.780] and we build our poker hand so that when we come to the table to make a deal
[02:23:41.860 --> 02:23:47.140] deal we got a better deal i am getting a lot of background noise from you
[02:23:48.820 --> 02:23:54.740] if you're moving stuff around it's this mic is really picking it up okay
[02:23:57.380 --> 02:24:02.180] okay so we're trying to so everything you're doing is trying to build a poker hand
[02:24:03.780 --> 02:24:07.460] so we ask them to do things they're not going to want to do
[02:24:07.700 --> 02:24:11.300] now lawyers never do this
[02:24:12.740 --> 02:24:20.980] lawyers they're more afraid of the court than they are of anyone else except a knowledgeable client
[02:24:22.500 --> 02:24:29.860] so you can get a lawyer to do this but what i suggest first is you do the stuff that a lawyer would never do
[02:24:30.340 --> 02:24:30.980]  do
[02:24:33.220 --> 02:24:38.500] you go in there and demand that these public officials do what the law commands them to do
[02:24:39.460 --> 02:24:43.780] and then when they don't do it you file criminal charges against the public officials
[02:24:44.980 --> 02:24:48.740] the nice thing about criminal charges is you can file those all day
[02:24:50.260 --> 02:24:56.900] you cannot be unless you commit aggravated perjury as long as you tell the truth
[02:24:57.780 --> 02:25:02.340] they cannot come back on you on in any way for a criminal complaint
[02:25:03.700 --> 02:25:10.580] if i file a criminal complaint and a policeman says oh you you got to be careful you could get
[02:25:10.580 --> 02:25:20.020] in a lot of trouble that gets a 911 call and now he gets a complaint against him for witness tampering
[02:25:20.500 --> 02:25:25.700] haha when you go in there as the plaintiff the complainant
[02:25:27.140 --> 02:25:32.180] they have to be extremely careful you can set them up to do all kind of stupid stuff
[02:25:33.140 --> 02:25:39.700] and then you just follow the read the code the criminal procedure code and read the penal code
[02:25:41.140 --> 02:25:44.420] they're not very big they're they're not as big as they look because they're all in
[02:25:44.420 --> 02:25:49.780] outline format so there's a lot of white paper what we suggest is get the criminal procedure
[02:25:49.780 --> 02:25:56.260] code and read it twice don't try to understand it the first time just read through it what you're
[02:25:56.260 --> 02:26:02.660] doing is laying down what we call referential index you're laying down mental markers so when
[02:26:02.660 --> 02:26:08.820] you read it a second time now you'll start stitching all these pieces together and you
[02:26:08.820 --> 02:26:14.260] will know it better than they do and then read the first half of the penal code and do the same
[02:26:14.260 --> 02:26:20.180] thing just cruise through it and go back and cruise through it a second time now you go down
[02:26:20.180 --> 02:26:26.180] there and say how can we set them up how can we ask them to do things that they're not going to
[02:26:26.180 --> 02:26:32.500] want to do so we can file against them and start building a a suit that they're going to want to
[02:26:33.060 --> 02:26:34.260] before they get to court
[02:26:35.780 --> 02:26:42.180] wow it's a little complicated on the front end but we can help you with that
[02:26:47.380 --> 02:26:52.500] okay hang on there's one more thing we will need before we move ahead and i'll get to that on the

[02:28:01.300 --> 02:28:06.580] speed were as good at predicting life expectancy as more traditional statistical measures generally

[02:30:28.820 --> 02:30:42.020] okay we are back randy kelton brett fountain rules law radio and we're talking to
[02:30:43.540 --> 02:30:50.340] marika in pennsylvania and marika i've thrown a whole lot of stuff at you and i got that
[02:30:50.980 --> 02:30:57.940] too much all at once and i did that on purpose i wanted to let you know there's a whole lot you
[02:30:57.940 --> 02:31:08.980] can do now to start first thing we have to do is build a timeline a timeline is not
[02:31:09.700 --> 02:31:15.300] a statement a statement in support a timeline is not even a statement of facts
[02:31:16.740 --> 02:31:24.900] it's just a a set of mental markers this happened on on this date and this happened on this date
[02:31:24.900 --> 02:31:33.700] and this happened on this date when you get into a situation like these you tend to respond
[02:31:34.260 --> 02:31:41.540] strongly to what goes on they stole your car you respond strong to that you have emotional responses
[02:31:41.540 --> 02:31:47.460] to it and then you go down to get your car and you try to get remedy and the police refuse to
[02:31:47.460 --> 02:31:54.020] do anything and you will when you think about these you will tend to move from one emotional
[02:31:54.020 --> 02:31:59.220] high point to the next to the next to the next and then when you tell them to somebody
[02:32:00.260 --> 02:32:06.740] memory doesn't work the way we used to think it does you don't go in and and read the memory and
[02:32:06.740 --> 02:32:14.660] then restate it science has shown that you go in and take the memory out and re-experience in the
[02:32:14.660 --> 02:32:21.940] telling it in the telling and then put it back you tend to put it back based on the telling
[02:32:22.660 --> 02:32:29.780] so if you if in this context certain facts were not important they tend not to get put back
[02:32:31.060 --> 02:32:38.980] and timing you get things out of place memory gets all screwed up so first thing we do is write
[02:32:38.980 --> 02:32:47.220] a timeline and only this happened on this day no don't get into the details of it because that gets
[02:32:47.220 --> 02:32:52.740] you into the emotion of it and you wind up jumping all over the place so just give us this
[02:32:52.740 --> 02:32:56.580] happened on this day this happened and this happened then this happened once we got that
[02:32:57.860 --> 02:33:03.460] then we can look at it we're going to look at it different than you look at it
[02:33:04.980 --> 02:33:12.500] you look at it from being immersed in the circumstance we will look at it from a detached
[02:33:12.500 --> 02:33:20.420] perspective you've probably heard that if someone who represents themselves has a fool for a client
[02:33:21.140 --> 02:33:28.500] i once represented myself in court and over an absolutely ridiculous
[02:33:28.500 --> 02:33:35.860] charge because i was an investigative journalist they charged me with being a private investigator
[02:33:36.740 --> 02:33:42.500] and i represented myself and i i'm so smart and i know all this law and i got this
[02:33:43.460 --> 02:33:48.500] i did so well that i got the jury to throw the book at me
[02:33:51.780 --> 02:33:59.540] they were right the problem i had it was extremely impressive i had to struggle
[02:34:00.340 --> 02:34:05.380] to write emotion or pleading it was incredibly hard for me and threw my butt in jail
[02:34:06.660 --> 02:34:13.860] i filed 35 criminal complaints against the prosecutor and the judge and in two days i was out
[02:34:14.500 --> 02:34:22.980] so i didn't spend a year in jail but almost did so you write the timeline and that helps you keep the
[02:34:23.700 --> 02:34:32.020] the pathos the the emotion out of this and then we'll look at the timeline and ask questions and
[02:34:32.020 --> 02:34:37.780] the next time you look at the timeline it'll trigger memories oh yeah this happened in here
[02:34:37.780 --> 02:34:43.300] this happened in here and once we got that down good now we're going to look at it and
[02:34:43.940 --> 02:34:49.140] we will look at it from a legal perspective we're looking for stuff you don't know to look
[02:34:49.140 --> 02:34:55.860] look for and then we start laying in all the places we can file criminal charges now
[02:34:56.420 --> 02:35:02.900] when we do that we're going to get more potential criminal charges that you could file
[02:35:02.900 --> 02:35:10.100] than you can ever get to the fact that i can say that with confidence
[02:35:11.140 --> 02:35:21.060] without regard to what state or jurisdiction you're in is a pitiful comment on the state of
[02:35:21.060 --> 02:35:27.780] the legal system in this country but that's the fact we will find more criminal charges you can
[02:35:27.780 --> 02:35:34.420] file than you can ever get to so once we got all the criminal charges we can file then we make up
[02:35:34.420 --> 02:35:46.580] this story and we take the criminal charges that fit our story and file those it's a little bit
[02:35:46.580 --> 02:35:54.500] complicated but it'll start with a timeline get us a timeline then now we can break your case down
[02:35:54.500 --> 02:36:05.380] into tiny pieces that's easier to grasp one at a time as you move through it and you take them to
[02:36:05.380 --> 02:36:15.540] the cleaners give them get them to give you opportunity to sue them so that you can get at
[02:36:15.540 --> 02:36:23.540] their bonding agents towing company has a insurance company the whoever the has the loan
[02:36:23.540 --> 02:36:31.380] against your car that ordered them to to repo it if if you're up to date they didn't do that
[02:36:31.380 --> 02:36:37.780] you know they might have made a mistake they might have got the wrong one their problem not
[02:36:37.860 --> 02:36:45.940] your problem so you get to sue them get to everybody yep they sound like fun
[02:36:49.940 --> 02:36:55.460] okay it's not fun at first but uh this is our job
[02:36:59.220 --> 02:37:04.020] if we don't bring the system to task who will
[02:37:04.020 --> 02:37:09.940] do and besides you will be surprised how much fun this could be
[02:37:12.740 --> 02:37:22.820] you know i like to to file really nitpicking criminal complaints this sergeant was was trying
[02:37:22.820 --> 02:37:33.620] to to solve a problem to keep from having any civil discord so he tried to find a a equitable
[02:37:33.620 --> 02:37:40.100] solution to what he saw as a problem well good for him too bad
[02:37:42.820 --> 02:37:51.140] when you give you are a citizen in a republic everybody answers to you
[02:37:52.420 --> 02:37:59.860] when you tell a policeman that you want to file a criminal complaint that is not a polite request
[02:37:59.860 --> 02:38:09.940] that is a command from the master to the servant when he when he elects to deny you access to the
[02:38:09.940 --> 02:38:16.580] equal protection of the laws he violated the constitution that he swore on his oath that he
[02:38:16.580 --> 02:38:26.420] had appalled you see how that works out for you bubba okay i've flooded you with information
[02:38:26.420 --> 02:38:40.340] yes and i'm i appreciate it at the end at the end of the day what do you want as an end result here
[02:38:44.660 --> 02:38:48.020] the same the same thing anybody would want if you
[02:38:48.020 --> 02:38:50.580] when you steal somebody's property they're going to pay for it
[02:38:50.980 --> 02:38:58.820] oh do you do you want to get your car back and get compensated for your for your problem
[02:38:59.700 --> 02:39:07.300] do you want to help fix the legal system so that your kids or grandkids don't have to put up with
[02:39:07.300 --> 02:39:14.660] this garbage what do you want and and you don't have to to want to fix the legal system if you
[02:39:14.660 --> 02:39:22.900] try to fix the legal system you have to really want to because it takes dedication and you're
[02:39:22.900 --> 02:39:29.620] not required to do that my kids are going to have kids but it starts it has to start somewhere

[02:39:33.460 --> 02:39:41.220] 2024 for the legal system still be ejected as it is it's crazy good that's what i needed to find
[02:39:41.220 --> 02:39:48.260] out because that will change how we deal with you if you just wanted to just fix so you could
[02:39:48.260 --> 02:39:54.020] go back to your life then you do this one way you set them up so you can get them in court and make

[02:40:14.820 --> 02:40:17.540] that gives you a shot at everybody
[02:40:20.500 --> 02:40:23.300] and it's not about getting any of them in trouble
[02:40:24.900 --> 02:40:28.260] i think of my public officials like i do my grandkids
[02:40:28.820 --> 02:40:37.220] i love them dearly but if if one of them runs out on the road i'm fixing to tan his hide

[02:44:09.940 --> 02:44:16.660] okay we are back randy kelton brett fountain rule of law radio and we're talking to marika
[02:44:16.660 --> 02:44:27.620] in pennsylvania and marika right now we need a timeline just write down the events no explanation
[02:44:27.620 --> 02:44:33.140] just this happened this step get that written down leave it set for a few days go back to it
[02:44:33.940 --> 02:44:40.180] and fill in any blanks that occur and then call us back next week and if you can find the
[02:44:41.540 --> 02:44:48.340]  criminal procedure code i think it's section 15 if i remember right
[02:44:48.340 --> 02:44:51.060]  right
[02:44:51.060 --> 02:44:59.620] i think i think 14 is criminal and 15 is civil or or it's 15 and 16 one of those but look up the
[02:44:59.620 --> 02:45:06.820] penal code and criminal procedure code and just read through them quickly don't study them and
[02:45:06.820 --> 02:45:13.220] try to understand all that stuff they're saying just read through them because when you go back
[02:45:13.220 --> 02:45:21.060] and read through it the second time like in texas the second time i read it i see 2.11 it says when
[02:45:21.060 --> 02:45:26.820] a magistrate sits for the purpose of examining into a criminal accusation that is an examining
[02:45:26.820 --> 02:45:36.660] court second time i read that i said oh that's what chapter 16 was talking about so you'll start
[02:45:36.660 --> 02:45:44.020] making these connections back and forth i talked to my prosecuting attorney and cited a code to him
[02:45:44.740 --> 02:45:49.940] my county attorney he told me that i could if i wasn't careful i'd get in trouble for legal
[02:45:49.940 --> 02:45:56.020] practice of law and i quoted it to him let's see it's a crime to hold yourself out as an attorney
[02:45:56.020 --> 02:46:03.460] and represent someone in court for property damage or a personal injury suit he said are you sure
[02:46:03.460 --> 02:46:07.940] yeah that's what says he looked it up greg you ought to be ashamed of yourself
[02:46:07.940 --> 02:46:11.780] when was the last time you read that he said well i don't know that i've ever
[02:46:11.780 --> 02:46:18.980] ever read the whole thing and he's a county attorney greg that's pitiful and he said well
[02:46:18.980 --> 02:46:29.780] mr kelton i don't know anyone any lawyer who's read the whole thing what if you read that twice
[02:46:29.860 --> 02:46:40.180] you'll know it better than they do you're probably operating now from the presupposition
[02:46:40.820 --> 02:46:43.860] that these lawyers and judges know what they're doing
[02:46:46.740 --> 02:46:52.180] good luck with that they don't know the law they just know what they do
[02:46:52.180 --> 02:46:54.580]  do
[02:46:56.100 --> 02:47:02.740] we go in to get them to do what they do and then hammer them for not doing what the law commands
[02:47:02.740 --> 02:47:10.340] them to do now i get it my son-in-law is the justice of the peace when he got when he got
[02:47:10.340 --> 02:47:17.220] elected i walked him through the codes i laid it out for him this has been my study for 40 years
[02:47:17.220 --> 02:47:23.940] almost 50 years and he saw the code he saw how it all fit together then he went to his training
[02:47:25.060 --> 02:47:31.460] they trained him to do it totally different so how do you think he does it he knows what
[02:47:31.460 --> 02:47:37.540] the law says he knows what his training says he does what they trained him to do
[02:47:38.180 --> 02:47:46.980] do so we look at what the law tells them to do and where they their training tells them to do
[02:47:46.980 --> 02:47:55.540] something else we push them over that line and then land on them i sued the chief justice of
[02:47:55.540 --> 02:48:05.860] the texas supreme i sent him a criminal complaint against the governor and he did not issue a warrant
[02:48:06.820 --> 02:48:13.460] 15.09 says when a complaint is presented is is forwarded to a magistrate complete in accordance
[02:48:13.460 --> 02:48:21.940] with 15.05 and that sets the requisites the magistrate shall forthwith issue a warrant
[02:48:23.300 --> 02:48:29.620] now what part of that is hard to understand when you file a complaint against a public official
[02:48:30.340 --> 02:48:37.860] magistrates in texas will never issue a warrant so i did that to the chief justice and when he
[02:48:37.860 --> 02:48:43.540] didn't issue a warrant i filed criminal charges against him with the presiding judge of the court
[02:48:43.540 --> 02:48:48.500] of criminal appeals and then i sued him for 20 million dollars in his personal capacity
[02:48:48.980 --> 02:48:59.140] hahaha how'd that work out for you mother oh he was not a happy camper you can do this
[02:49:00.580 --> 02:49:07.460] the only reason you can do this is because you're the baddest motor scooter in a building
[02:49:08.740 --> 02:49:15.460] you are a citizen in a republic and that is not an academic consideration
[02:49:16.180 --> 02:49:24.900] uh everybody answers to you including the chief justice of the pennsylvania supreme
[02:49:27.620 --> 02:49:35.220] everybody answers so you start taking them to task you start fixing the system
[02:49:37.060 --> 02:49:44.500] yes and i've got what what part of pennsylvania are you in philadelphia
[02:49:46.100 --> 02:49:50.180] philadelphia okay you're not close i when i was up there i was around uh
[02:49:52.500 --> 02:49:57.300] lancaster lancaster i was about to say you said omic i was about to say lancaster
[02:49:58.020 --> 02:50:06.500] yeah yeah up there i was i was at a place called uh intercourse shady maple and it was it was it
[02:50:06.500 --> 02:50:13.780] was just down the road from blue ball and what was the other one that was over there brett you just
[02:50:13.780 --> 02:50:22.100] looked up fidelity the fertility is off to the west they got great names and the omics were
[02:50:22.100 --> 02:50:29.380] incredible they were the omics was like going to a different country anyway it's lovely out there
[02:50:29.380 --> 02:50:38.020] it's amazing so get us get us a timeline call us back next week and we'll have a and email the

[02:51:03.460 --> 02:51:11.700] okay thank you i appreciate it okay we are going to eric in massachusetts hello eric
[02:51:12.340 --> 02:51:15.460] thank you for waiting what do you have for us today
[02:51:19.860 --> 02:51:22.820] i think we lulled him into unconsciousness
[02:51:27.620 --> 02:51:32.260] i just started to say you may have pulled a john on us and got out and walked around the room
[02:51:32.980 --> 02:51:39.220] i can't believe he said that on the air see he deserves my picking on him
[02:51:41.700 --> 02:51:50.900] okay just ran to the store for a red bull okay so i have two simple fast questions no stories in
[02:51:50.900 --> 02:51:57.140] fact we only have an hour left so we got no more story time it's all focused focus on the issues
[02:51:57.140 --> 02:52:03.140] all right so first quick question uh state supreme today sent me an email that my
[02:52:03.140 --> 02:52:11.620] coronto which was i made a motion to reconsider they were rescripting the issue to the trial court
[02:52:12.500 --> 02:52:19.860] and i'm not sure if they if they mean they're remanding it or because i don't have they didn't
[02:52:19.860 --> 02:52:25.380] give me a decision motion denied rescripted it to the trial court or
[02:52:27.220 --> 02:52:33.060] that rescripting means they're remanding it back to the trial court any opinion quick
[02:52:33.060 --> 02:52:37.460] question quick quick question on to the next one what's the answer
[02:52:40.100 --> 02:52:47.780] rescripting i've not heard that before i just typed in what does rescripting mean in
[02:52:50.500 --> 02:52:56.500] this federal court state okay in mass
[02:52:59.220 --> 02:53:03.860] no big deal gentlemen let's move on to the next question because i'll find out on monday okay
[02:53:03.860 --> 02:53:11.860] next question if i want to take an issue to the federal court after being denied in the state
[02:53:11.860 --> 02:53:22.100] supreme is there a time limit if the issue is a general issue for example if the appeals court
[02:53:22.900 --> 02:53:31.220] ruled an appeal and said you don't have standing but that but at the lower court it went to full
[02:53:31.220 --> 02:53:41.220] trial i'm due a full de novo review but they denied that understanding i appealed it to the
[02:53:41.860 --> 02:53:48.740] the supreme the state supreme they said we want to hear this issue can i take that with any amount
[02:53:48.740 --> 02:53:53.220] of time to the fed i don't have you know normally when you appeal something like that you have 90
[02:53:53.220 --> 02:54:00.020] days 60 days whatever but because this is a general issue does the does the state okay or
[02:54:00.020 --> 02:54:07.380] does the appeals court have an ability to deny a de novo review a full full de novo review with
[02:54:08.260 --> 02:54:17.940] you know a full de novo review is only granted by statute there has to be something specifically
[02:54:17.940 --> 02:54:24.900] that authorizes you in this circumstance a full de novo review otherwise what de novo means
[02:54:25.700 --> 02:54:33.140] is they don't have to abide by the determinations and rulings of the court by determinations i mean
[02:54:33.700 --> 02:54:40.820] if something is offered offered as a fact and there were objections and rulings by the judge
[02:54:41.540 --> 02:54:49.860] if if it's not de novo then the trial court has to consider all of those issues by the judge
[02:54:50.900 --> 02:54:57.460] if it's de novo they can set all that aside and they make their own decision so de novo only
[02:54:57.460 --> 02:55:05.220] happens when it's specifically authorized okay but let's say it's a general issue like you know
[02:55:05.220 --> 02:55:09.860] i have a contract and they say well you don't have standing and they didn't take the contract
[02:55:09.860 --> 02:55:16.420] into consideration i'm just saying in general not a specific ruling but like does the state
[02:55:16.420 --> 02:55:24.180] have the ability to deny me justice to process based on that i think you're mixing up
[02:55:25.140 --> 02:55:30.180]  uh you're when you're saying de novo you're you're mixing facts with law
[02:55:31.860 --> 02:55:41.140] the trial court will will review all of the law but in de novo they also review the facts
[02:55:41.700 --> 02:55:45.700] which facts are authorized allowed and which ones are not hang on i'll explain this a little
[02:55:45.700 --> 02:55:52.980] more when we get back would you like to make more definite progress in your walk with god

[03:01:06.740 --> 03:01:14.340] okay we are back randy kelton fountain rule of law radio and we're talking to
[03:01:14.900 --> 03:01:25.140] eric in massachusetts and eric i looked up rescript i got a case text case called mass dot r dot app
[03:01:25.620 --> 03:01:35.620] p23 whatever the heck that is and it says notice of decision issuance of rescript stay of rescript
[03:01:35.620 --> 03:01:42.180] they're using rescript as a proper noun the clerk of the appellate court shall send to all parties
[03:01:42.180 --> 03:01:50.500] copies of or a link to the rescript and the decision if one if one was written
[03:01:50.500 --> 03:01:56.100] on the day the decision was released rescript has a specific meaning
[03:01:58.020 --> 03:02:06.500] and when i looked up the definition it had i've covered it over uh what did i say it was brett
[03:02:09.220 --> 03:02:13.220]  um i don't know you're supposed to remember that you're young
[03:02:14.180 --> 03:02:21.140] i'm old the issuance of rescript would automatically be stayed see this is a proper noun
[03:02:22.180 --> 03:02:27.140] anyway okay he's not worried about it he's gonna said he's gonna find out on monday sir okay
[03:02:29.300 --> 03:02:37.460] okay where were we oh we were talking about the difference between uh trial de novo and a appeal
[03:02:38.100 --> 03:02:40.100]  um not not exactly
[03:02:42.340 --> 03:02:50.900] not okay so let me rephrase the question if i'm appealing a supreme court state supreme court
[03:02:51.780 --> 03:02:59.380] very specific uh decision i only have you know whatever 60 days 90 days right or 30 days i don't
[03:02:59.380 --> 03:03:04.900] know to take it to federal court but if i'm appealing like a bigger issue like a deprivation
[03:03:04.900 --> 03:03:10.420] of rights like the way they're making these decisions there's a deprivation of rights
[03:03:10.420 --> 03:03:16.420] how long do i have to make that appeal to the federal court do you see the decision i'm making
[03:03:17.060 --> 03:03:26.020] yeah you have one one set of i think it's 90 days i remember right and that doesn't change
[03:03:26.020 --> 03:03:31.220] unless you petition the court for an extension of time
[03:03:34.180 --> 03:03:42.900] okay that's always going to be the same i didn't see any uh distinctions for different issues
[03:03:44.420 --> 03:03:48.500] okay but generally they're really generally pretty good about giving you
[03:03:48.500 --> 03:03:55.300] at least that first extension of time you'll get that almost without uh objection
[03:03:56.660 --> 03:04:06.180] okay um all right so my bigger issue um and i sent brett my uh complaint and it's kind of an
[03:04:06.180 --> 03:04:13.540] interesting complaint and what i did is i took the board of health if the individuals the five
[03:04:13.540 --> 03:04:20.900] individuals from the board of health in their individual capacity uh to court you know in a
[03:04:21.140 --> 03:04:30.500] lawsuit but i included in that two declaratory judgments uh one on jurisdiction and one on
[03:04:30.500 --> 03:04:38.420] void for vagueness and then if they don't give me the void for vagueness i asked for a variant
[03:04:40.500 --> 03:04:43.380] and then it ends with a tort claim against the individual
[03:04:44.260 --> 03:04:49.060]  um and i don't know if i can do this i don't know if i can take individuals
[03:04:49.940 --> 03:04:57.380] in their individual capacity and do a tort complaint complaint with these
[03:04:57.380 --> 03:05:06.740] declaratory judgments against basically laws or statutes if both the issues are based on
[03:05:07.620 --> 03:05:16.100] the same fact set not only can you you are encouraged to to include all of your claims
[03:05:16.740 --> 03:05:22.500] in the one action so for a judicial economy so that the court doesn't have to hear it twice
[03:05:25.140 --> 03:05:31.220] actually if you don't include all of your claims that go to a particular fact set
[03:05:31.940 --> 03:05:38.980] in a particular suit they can object to it yeah say you had your chance you didn't bring it up
[03:05:40.020 --> 03:05:47.140] yeah okay and i i've thought about that a lot because part of this is going to go to the
[03:05:47.140 --> 03:05:56.740] federal court and i'm being cautious on how i'm presenting this um so that's good that that's i
[03:05:56.740 --> 03:06:02.900] guess that's good the way that i did it i don't know if brett has taken a look at uh the complaint
[03:06:04.020 --> 03:06:09.700] no the one you just you just sent tonight yeah i sent it over on telegram and your personal
[03:06:10.660 --> 03:06:17.460] no not yet okay no no big deal but it be interesting i do want to go into
[03:06:18.180 --> 03:06:22.980] individual capacity because they you guys talked a little bit about it tonight you talked a little
[03:06:22.980 --> 03:06:31.780] bit about it last night um and so what i'm doing is is basically trying to punch these people
[03:06:31.780 --> 03:06:40.020] personally so they were they were required to allow me to petition for a variance and they didn't
[03:06:40.020 --> 03:06:46.180] it's a part of the statute it's a part of due process so that's the premise is that i wanted
[03:06:46.180 --> 03:06:55.540] to hurt them personally on the issue uh and then my thought is if if they don't want to be involved
[03:06:55.540 --> 03:07:04.020] in this lawsuit they may be more willing to give me the declaratory judgment what is your opinion
[03:07:04.020 --> 03:07:13.940] on that don't know what what the nature of the declaratory judgment is so i wouldn't know how
[03:07:13.940 --> 03:07:19.780] to speak to it okay so one of them is very simple one of them is standing you're a municipality
[03:07:20.740 --> 03:07:27.140] and you don't have jurisdiction over my property let's just say that i'm right let's not get into
[03:07:27.140 --> 03:07:32.020] an eddie craig debate battle about you know whiffs and holds and all you know the different
[03:07:32.020 --> 03:07:39.540] words let's just say i'm correct and they don't have jurisdiction um and i'm filing you know i'm
[03:07:39.540 --> 03:07:45.540] saying hey you don't have jurisdiction and i've made it a part of this individual complaint so
[03:07:45.540 --> 03:07:51.540] it's an approach that i'm thinking about like hey if i can make this work like instead of us filing
[03:07:51.540 --> 03:07:59.220] against these big municipalities or cities or whatever that can defend a jurisdiction claim
[03:07:59.220 --> 03:08:05.380] or a statute claim or whatever any type of declaratory judgment you take it against the
[03:08:05.380 --> 03:08:11.780] smaller person you might have a better chance of getting the declaratory judgment you see my strategy
[03:08:11.780 --> 03:08:23.380] here no okay i don't understand i don't know what the declaratory judgment you're asking for is
[03:08:23.380 --> 03:08:30.180] so i don't know how to apply it to the circumstance okay so this is the board of health
[03:08:31.060 --> 03:08:37.860] i own my property personally they don't have jurisdiction over my personal property
[03:08:37.860 --> 03:08:44.900]  it's a rental it's a rental property okay and it's a commercial it's rental is it's okay there are
[03:08:46.900 --> 03:08:55.140] stipulations is does the property contain more than six apartments doesn't that doesn't have
[03:08:55.140 --> 03:09:01.940] any relevance in my state i own it personally period it's not owned by a corporation or an
[03:09:01.940 --> 03:09:11.540] llc or a trust or anything but but you're using it in commerce doesn't matter does not matter go
[03:09:11.540 --> 03:09:18.660] back to the founding fathers the founding fathers did the same darn thing okay and that that's what
[03:09:18.740 --> 03:09:26.180] generally comes up that where the city will get jurisdiction is where you're using where you're
[03:09:27.220 --> 03:09:33.140] you're participating in commerce within the jurisdiction only if the law is written
[03:09:33.140 --> 03:09:40.180] correctly and the law is not written correctly okay and you're speaking to law specific to
[03:09:40.180 --> 03:09:45.780] massachusetts so i wouldn't know how to speak to that thank you so again let's just assume that i'm
[03:09:45.780 --> 03:09:51.780] right he doesn't want to be questioned he doesn't want to check and see if he's right he just wants
[03:09:51.780 --> 03:10:00.340] us to assume it and then go from there and see if he has a good idea yeah okay i'm just trying to
[03:10:00.340 --> 03:10:07.060] make sure i'm understanding to understood because eddie craig and i had this argument for an hour
[03:10:07.060 --> 03:10:11.860] and a half on your show back in and march or something which was great it was you know it was
[03:10:11.860 --> 03:10:17.460] a great discussion but but i don't want to have that argument again i want to say hey
[03:10:17.460 --> 03:10:24.020] what do you think is this a good strategy forcing the little guy to have to fight for jurisdiction
[03:10:24.020 --> 03:10:25.860] rather than the big municipality
[03:10:31.540 --> 03:10:37.540] i have missed something forcing the little guy can you frame that question again i've
[03:10:37.540 --> 03:10:44.740] lost my place somehow sure so i have a lawsuit against these people individually they're the
[03:10:44.740 --> 03:10:51.060] board of health they've by they've worked outside of scope they've clearly gone way outside of scope
[03:10:51.060 --> 03:10:55.860] i'm filing a suit against them individually there's no doubt in my mind they're outside
[03:10:55.860 --> 03:11:01.380] of scope i have the right to file it against them individually but as a part of this complaint
[03:11:02.100 --> 03:11:09.540] i've included two declaratory judgments one of which is you as the board of health have no
[03:11:09.540 --> 03:11:16.500] jurisdiction over my personal property it's not a corporation i'm not a part of the administrative
[03:11:16.500 --> 03:11:25.860] bodies of anything so i'm not a creature of statute so now you have to defend how do you have
[03:11:25.860 --> 03:11:30.020] you have jurisdiction over my personal property
[03:11:32.260 --> 03:11:38.980] so i'm making i'm making these people out of their own pocket fight me on jurisdiction
[03:11:38.980 --> 03:11:47.380] rather than having the municipality or the state fight me and okay that's a good argument because
[03:11:47.380 --> 03:11:50.660] i've got case law that says the sovereign can do no wrong
[03:11:50.660 --> 03:11:59.300] the municipality as a legal fiction is the sovereign and it can't do anything wrong it
[03:11:59.300 --> 03:12:05.780] can't do anything because it's a legal fiction only human beings can do things and what the
[03:12:05.780 --> 03:12:13.380] case law says that if human beings do things that are wrong in the name of the sovereign
[03:12:14.260 --> 03:12:22.660] the sovereign cannot be sued because the sovereign can do no wrong neither can the sovereign
[03:12:22.660 --> 03:12:31.780] authorize wrongdoing so if if a human being commits an act of wrongdoing it cannot be attributed to
[03:12:31.780 --> 03:12:37.540] the sovereign but that's what does that make sense all these laws well yeah but that's what
[03:12:37.620 --> 03:12:43.620] we do every day in these lawsuits right i mean we sue the city we sue the state we sue
[03:12:43.620 --> 03:12:48.900] you know the police station we you know we're not suing the police man or the police chief
[03:12:51.700 --> 03:12:58.980] and yeah we do that and and that is a conundrum when i come across this this line of case law
[03:13:00.020 --> 03:13:05.380] and this is not just a case it's a whole line all the way back from the beginning of the of
[03:13:05.380 --> 03:13:12.420] the country that the sovereign can do no wrong because the physically essentially in the united
[03:13:12.420 --> 03:13:22.100] states unlike england we have a king who is the sovereign here we have a legal fiction that is
[03:13:22.100 --> 03:13:29.540] the sovereign and the legal fiction doesn't have hands feet voice it doesn't have physical
[03:13:29.540 --> 03:13:36.660] existence it's just a mental concept so it can't do anything only people can do things
[03:13:38.260 --> 03:13:47.220] it can the key was the sovereign cannot authorize wrongdoing so if a human being does something
[03:13:47.220 --> 03:13:55.620] wrong then it's on them and not the sovereign hang on okay randy kelton brett fountain

[03:16:12.100 --> 03:16:22.180]  oh come on
[03:16:22.180 --> 03:16:36.580] okay we are back randy kelton brett fountain rule of law radio and we're talking to eric in
[03:16:36.580 --> 03:16:43.940] massachusetts and on the break eric i looked up the sovereign can do no wrong and i just
[03:16:43.940 --> 03:16:52.980] contradicted myself listen to this this is hicks v state 1976 out of new mexico
[03:16:55.620 --> 03:17:01.940] in hicks the supreme court determined that the long-held belief that the sovereign could do no
[03:17:01.940 --> 03:17:09.860] wrong was both archaic and unjust and that the rationalization which has been used to advance
[03:17:09.860 --> 03:17:16.260] the doctrine of sovereign immunity were invalid the original justification for the doctrine of
[03:17:16.260 --> 03:17:22.340] sovereign immunity was was the archaic view that the sovereign could do no wrong it is hardly
[03:17:22.340 --> 03:17:30.260] necessary for this court to spend time to refute this feudalistic contention this and all other
[03:17:30.260 --> 03:17:36.180] rationalizations which have been advanced to justify continued adherence to this doctrine are
[03:17:36.180 --> 03:17:44.660] no longer valid in new mexico i just watched a video the other day where a guy was advising
[03:17:44.660 --> 03:17:54.580] a new mexico cop that their immunity had been eliminated this must be where it comes from
[03:17:55.780 --> 03:18:00.660] so all that stuff i said about sovereign immunity i got about it
[03:18:00.660 --> 03:18:12.660] that's actually a new mexico case but there's probably some federal case to follow up on that
[03:18:12.660 --> 03:18:20.260] okay where were we before i contradicted myself no we were this is where we were so
[03:18:21.060 --> 03:18:27.620] so the you know the question is can i can i fallacy against these people individually and include
[03:18:28.580 --> 03:18:34.420] um include include the speculatory judgment i think i think the answer is still yes
[03:18:35.780 --> 03:18:44.020] oh yes you can definitely always include a declaratory judgment okay you're asking the court
[03:18:44.020 --> 03:18:52.820] to rule on point of law and this kind of goes back to walker v packer it's a fifth circuit
[03:18:53.460 --> 03:19:01.060] but it says a judge has no discretion in properly applying the law to the facts
[03:19:01.940 --> 03:19:08.980] so your petition for declaratory judgment is specifically asking the court to rule on the
[03:19:08.980 --> 03:19:16.980] facts and law in this specific circumstance okay so let's go back to my
[03:19:17.540 --> 03:19:23.540] here where i'm taking five individuals in their personal capacity who probably don't really want
[03:19:23.540 --> 03:19:32.260] to pay for it a lawyer right now they have to defend a declaratory judgment their motive okay
[03:19:32.260 --> 03:19:39.220] have to be pretty hold on before we move past this point have you looked in the massachusetts
[03:19:39.300 --> 03:19:46.580] constitution to see if it prohibits the government from providing
[03:19:47.540 --> 03:19:55.060] emoluments to a public employee that is not included in their original contract
[03:19:56.740 --> 03:20:02.500] yeah we've talked about this now it's not in there but i do have it in one of my i have it
[03:20:02.500 --> 03:20:09.460] in my federal case okay that was just a point i wanted to address for everybody else out there
[03:20:10.820 --> 03:20:17.620] a employee becomes an employee based on they swear to an oath and based on that oath they're
[03:20:17.620 --> 03:20:26.260] given a check once they receive the check that creates a contract and the contract they have
[03:20:26.260 --> 03:20:30.020] is an employment contract and it provides them with certain emoluments
[03:20:31.540 --> 03:20:39.540] and most states forbid this the state itself from giving this individual more money
[03:20:40.500 --> 03:20:44.820] because that opens the door to horrendous corruption
[03:20:46.980 --> 03:20:54.340] and what i use that for in texas is when the attorney general filed a response for the all of
[03:20:54.340 --> 03:21:01.380] the judges of the court of criminal appeals and all of the directors of all of the government
[03:21:01.380 --> 03:21:09.220] agencies i claimed that was an emolument these guys didn't have to pay for their own lawyer
[03:21:09.220 --> 03:21:13.540] the state paid for their lawyer for them and the state's not authorized to do that
[03:21:15.300 --> 03:21:22.500] have you looked at that in massachusetts there has to be something on that i really haven't
[03:21:22.500 --> 03:21:28.340] found it but let's let's say say to my point here say to my point we're short on time
[03:21:29.060 --> 03:21:35.060] so so these individuals have to defend the seculatory judgment against the statute
[03:21:36.420 --> 03:21:42.260] won't the state won't the state have issue with that like hey these individuals are now
[03:21:42.260 --> 03:21:48.020] defending one of our statutes is that an issue that you're saying that the judge needs to do
[03:21:48.020 --> 03:21:57.220] the point of law so yeah no they are in a position of where they can absolutely defend
[03:21:57.220 --> 03:21:58.980] that point of law if they you
