[06:22.520 --> 06:28.760] court. And right now, I've got in my appellant brief, I'm the appellant because I brought
[06:28.760 --> 06:35.080] the appeal, and then the other side brought their appellee's brief, and then I made a
[06:35.080 --> 06:41.960] reply. At this point, we're waiting to hear what the court's going to say. Now, I've
[06:41.960 --> 06:49.120] asked for oral argument. So, there's nothing that's quite like the, in appeals court,
[06:49.120 --> 06:54.720] you don't have the rule 12 I of the civil procedures, which allows you to move for a
[06:54.720 --> 07:03.280] hearing before trial. So, we just have to wait. We do have one caller already. Go ahead
[07:03.280 --> 07:08.680] and take Tina in California. Good evening, Tina. What's on your mind?
[07:08.680 --> 07:18.040] Yes. Oh, well, I just wanted to give a couple of updates to my two cases, and then ask a
[07:18.040 --> 07:24.760] little advice. In the adversary proceeding case that's been going on for, you know,
[07:24.760 --> 07:30.000] just over three years, almost four, against the consignment store that stole hundreds
[07:30.000 --> 07:37.360] of people's property and sold it and didn't pay them. We finally got a ruling from the
[07:37.360 --> 07:45.200] judge, and he denied their bankruptcy just chapter seven discharge. He gave us three
[07:45.200 --> 07:56.240] out of the five actions that we'd asked for claims. He gave us a monetary judgment, and
[07:56.240 --> 08:01.240] the only thing he didn't give us was punitive because he said they've got enough debt as
[08:01.240 --> 08:07.800] it is, and I've just awarded you collectively 80 something thousand for the four of us.
[08:07.800 --> 08:12.000] And he didn't give us RICO, and I figured he wouldn't, but I put it in there anyway
[08:12.000 --> 08:21.480] because, you know, give him something to deny us. And then he wrote that order on the 30th.
[08:21.480 --> 08:28.040] We all got a copy of it on the 5th of September. Three days later, the defendants filed a chapter
[08:28.040 --> 08:31.040] 13 bankruptcy.
[08:31.040 --> 08:44.480] Oh my goodness. Wow. Well, congratulations, and I'm so sorry to hear that.
[08:44.480 --> 08:51.400] I just got in on the tail of that. Did I get that right? You wiped the floor with her?
[08:51.400 --> 09:01.640] We wiped the floor. We are on the 1% of people, because apparently 99% of chapter sevens are
[09:01.640 --> 09:07.760] given a discharge. She didn't get hers. So we're in that 1%. And the attorneys that,
[09:07.760 --> 09:13.000] you know, we've been checking in with in the bankruptcy health clinic said pro se litigants
[09:13.000 --> 09:18.200] never win adversary proceeding cases. And we've gone...
[09:18.200 --> 09:26.960] Unless they just happen to be Tina. Unless they happen to be a bit churnish.
[09:26.960 --> 09:36.400] Tenacious is more like it. But she had two attorneys in the AP case, four attorneys in
[09:36.400 --> 09:44.640] her chapter seven and one in her previous chapter 13. Now she has another attorney group,
[09:44.640 --> 09:52.280] and this is down in another, in South LA, the last one was in Central District. And
[09:52.280 --> 09:58.440] she still has the criminal case against her and she's on her third attorney there. But
[09:58.440 --> 10:06.680] what I have read is that you can't file a chapter 13 after not getting a chapter seven
[10:06.680 --> 10:14.840] discharge if you willfully disobeyed any of the court orders. And the judge was very clear
[10:14.840 --> 10:22.000] in his orders, very detailed. The defendant disobeyed the court order that they had to
[10:22.000 --> 10:29.520] produce pretrial stipulation. We do this meet and confer. They didn't come with the required
[10:29.520 --> 10:35.560] documents to the pretrial hearing. They did not come to court when they were required
[10:35.560 --> 10:41.720] to in person. And so he put all this in that they disobeyed these orders. And everything
[10:41.720 --> 10:48.480] I found said, you can't... It will not be granted if you do this. Now she's paid $1,500
[10:48.480 --> 10:55.040] to these new attorney firms. She owes them another $3,500. So I think I'm going to wait
[10:55.040 --> 11:01.280] till her appeal time is over, which I think is tomorrow. And she's got 14 days to put
[11:01.280 --> 11:06.320] all the documents into this new bankruptcy. So I'm going to wait till she puts those in
[11:06.320 --> 11:11.600] so we can get her husband's place of work. And then I'm going to bar grieve the attorneys
[11:11.600 --> 11:15.680] because they should know that she can't do this if they read the order. And if they didn't
[11:15.680 --> 11:25.320] read the order, then they're negligent. And then I've got to file to lift the stay. Because
[11:25.320 --> 11:32.440] she only did it because she hates that we got a monetary judgment. Have I lost you?
[11:32.440 --> 11:41.560] I was just thinking about that. Chapter 13, if you've got some rule or precedent that
[11:41.560 --> 11:49.240] prevents them from being able to file a Chapter 13, then are you going to tackle that next?
[11:49.240 --> 11:56.240] Yes, I am. But I'm going to wait till she submits all the other information or the two
[11:56.240 --> 12:02.120] of them so that we can get the information from the papers that we want to go and collect
[12:02.120 --> 12:07.080] the judgment. Because they've never divulged where her husband works. They said, oh, we'll
[12:07.080 --> 12:12.560] come and stalk them so they wouldn't divulge it. She has to in this Chapter 13. So I'm
[12:12.560 --> 12:24.920] waiting to get the information. Way to go. So it's just more work. And I've got to
[12:24.920 --> 12:28.920] figure out how to not have to pay the filing fees in that bankruptcy because she's causing
[12:28.920 --> 12:36.800] us more work, more fees. But I did let the judge know in the NRAP case, I just filed
[12:36.800 --> 12:43.840] a notice to the court saying, plaintiffs, thank the judge, we received your ruling dated
[12:43.840 --> 12:48.760] August the 30th and that we received it on the 5th. And just to let the court know that
[12:48.760 --> 12:55.920] defendants have filed a new Chapter 13 and here attached as the filing. Because he didn't
[12:55.920 --> 13:03.240] sanction her like we asked because we asked for sanctions because she disobeyed the court.
[13:03.240 --> 13:07.120] And he thought that, you know, she's already, she doesn't have the money because she's
[13:07.120 --> 13:14.960] already 400,000 in debt. So maybe he'll rethink that now. I don't know. I might ask him to
[13:14.960 --> 13:19.640] rethink it. So I'm going to think on that one. So that's that one. That's a success
[13:19.640 --> 13:25.800] yet. You know, we're not going to get the money yet. Then my new case-
[13:25.800 --> 13:31.280] That sounds like actually multiple successes in a row. I got to congratulate you on that.
[13:31.280 --> 13:37.280] I mean, even though they just moved to the finish line, still, that's a lot of successes
[13:37.280 --> 13:40.240] there. I think you did great.
[13:40.240 --> 13:46.920] It feels good to do that. The other plaintiffs are really happy that we got it and, you know,
[13:46.920 --> 13:50.920] they've expressed their thanks that they wouldn't have done it without me because I'm the one
[13:50.920 --> 13:57.280] who kept putting in the papers and writing them and just researching the law. So yeah,
[13:57.280 --> 14:02.580] it feels good. Even if we don't get any money out of it, because she's in a criminal case,
[14:02.580 --> 14:08.320] we might be able to go to the state for compensation. I don't know how that works. I'm looking
[14:08.320 --> 14:15.880] into it whenever I have a spare minute. But in my appeal case, where I have the same judges
[14:15.880 --> 14:24.600] as before, when you listened in, they denied me oral argument, denied me the disclosures
[14:24.600 --> 14:32.240] that I'm entitled to have, denied my request for judicial notice of exhibits to prove the
[14:32.240 --> 14:39.000] fraud that they've done, that the newly discovered evidence, because they denied me discovery.
[14:39.000 --> 14:45.240] Then they denied his own disqualification. And even after we submitted eight affidavits,
[14:45.240 --> 14:58.660] they denied it. So then I filed another thing. So I filed a notice, a complaint with a judicial
[14:58.660 --> 15:04.560] counsel about it, and then filed that into the court so he would see it because now he's
[15:04.560 --> 15:09.280] considered retaliating against me because he knows there's an investigation against
[15:09.280 --> 15:10.280] him.
[15:10.280 --> 15:20.520] Yes, of course. Randy, did you catch that? She's got eight different affidavits from
[15:20.520 --> 15:26.160] different people. Well, one is for me, but she's got eight different ones saying why
[15:26.160 --> 15:37.640] this judge is no good, lousy, rotten, all that. And they're doing nothing.
[15:37.640 --> 15:43.320] Yeah, he's required to be disqualified if people of reasonable prudence, aware of the
[15:43.320 --> 15:49.480] fact, believe that I won't get a fair hearing. And so I filed a judicial complaint against
[15:49.480 --> 15:55.480] the court clerks because I found some finagling on the docket report where they were saying,
[15:55.480 --> 16:00.080] oh, it was filed on this date. Well, it really wasn't. And then the order came in right
[16:00.080 --> 16:08.280] at the same time as they said it was filed, all these things. So they took all day before
[16:08.280 --> 16:18.600] they actually put it in the docket. And then the next morning, it came in that a NUNC pro-tunk
[16:18.600 --> 16:27.400] changed one of the orders that we'd complained about that was tempered with. But a couple
[16:27.400 --> 16:33.920] of hours later, because we asked for judicial notice of that complaint and you're running
[16:33.920 --> 16:39.400] me off the cliff, but I will finish. We asked for judicial notice of it and the judge refused
[16:39.400 --> 16:48.520] and denied it. Immediately. Wow. All right. Well, we'll continue on the other side. This

[20:22.080 --> 20:27.720] Yeah. Before the break, I was stating that the judge refused to take judicial notice
[20:27.720 --> 20:35.080] of the complaint we put in about the judge's clerks. He just denied it. So, but he did
[20:35.080 --> 20:39.920] after, right after that, there was another notice in the court that oral hearing has
[20:39.920 --> 20:46.080] been set. Funny, he denied it before outright. Now he's set it for oral hearing on October
[20:46.080 --> 20:54.200] the 11th. Funny, that. And then, so I put in a notice to the court that the fundamental
[20:54.200 --> 20:59.040] doctrine of fairness has been thrown out the window in this court. Prejudice of the judges
[20:59.040 --> 21:03.360] are afoot, and the judges and panel of this appellate court are acting in absence of all
[21:03.360 --> 21:08.520] jurisdiction to rule and are unconstitutionally contravening the will of the people who have
[21:08.520 --> 21:13.280] spoken and concurred with the appellant and found the judges of this panel guilty of judicial
[21:13.280 --> 21:20.400] bias, discriminatorily prejudicing the right of the appellant. As on August the 29th, 2023,
[21:20.400 --> 21:26.920] the people disqualified them pursuant to and in accordance with Canon 3E4C of the Cannons
[21:26.920 --> 21:31.280] of Judicial Conduct. Judges, you no longer have authority in these proceedings, and therefore
[21:31.280 --> 21:37.400] you are committing treason, and your impeachment will be at hand, along with all who collaborated
[21:37.400 --> 21:44.040] with you. And then I put a case site in there, and a few other things. And now we'll see
[21:44.040 --> 21:51.040] that today I spoke to one of my local Senate, you know, staff members, and I'm putting
[21:51.040 --> 21:56.680] in a form for them to investigate why this judge should not be removed, or these judges
[21:56.680 --> 22:03.360] should not be removed from my case. So we'll see where it goes from here.
[22:03.360 --> 22:15.400] Well, so far, so good. Wins are hard to get. You got a one percenter. I once got a two
[22:15.400 --> 22:19.520] percenter here in Fort Worth, but you got a one percenter.
[22:19.520 --> 22:26.480] Yeah, but we just, you know, we still don't have money, but she keeps pouring money into
[22:26.480 --> 22:32.320] attorneys, so she has money somewhere. She claims she doesn't, but she's getting it
[22:32.320 --> 22:36.240] to pay them. But I really want to go after the attorneys, because they should have read
[22:36.240 --> 22:45.360] the order and should know that a Chapter 13 cannot be filed if you disobeyed any of the
[22:45.360 --> 22:53.880] court orders. So didn't she just lose the Chapter 7?
[22:53.880 --> 23:01.600] Yes, was denied. So when you file a bankruptcy, there's a
[23:01.600 --> 23:07.760] time limit before you can file another one, regardless of how the bankruptcy goes.
[23:07.760 --> 23:13.800] Yeah, but they filed it, and that gives her a 30-day stay. And the interesting part is
[23:13.800 --> 23:20.960] she filed a Chapter 7 to say she had no money, discharged the debt, and start a clean. Now
[23:20.960 --> 23:27.920] she's filed a Chapter 13, which is reorganize the debt, because you have assets. Really?
[23:27.920 --> 23:33.880] How do you do that? How do you suddenly change to a Chapter 13? Because I think she's thinking
[23:33.880 --> 23:40.160] that she can make some payments, tiny payments, for five years, and if she makes them on time,
[23:40.160 --> 23:45.320] then the rest of the debts are discharged. But we can file for an exemption for that.
[23:45.320 --> 23:53.200] But it's not going to get that far, because I'm not going to allow it.
[23:53.200 --> 24:00.800] You're being what Deborah said on the break. You're being tenacious.
[24:00.800 --> 24:10.760] Yes. But you know what? Hopefully it gives people a little hope that even though those
[24:10.760 --> 24:16.560] adversary proceedings are really tough, and if you get an attorney against you, it can
[24:16.560 --> 24:26.220] be even tougher. But it's worth going after. It's worth the fight, first of all, to learn,
[24:26.220 --> 24:32.620] but also we have made her life miserable for the last four years. And it's still miserable
[24:32.620 --> 24:35.480] because she's still going through the criminal case.
[24:35.480 --> 24:44.200] Yes, you may wind up in prison. So now with the Chapter 13 on reorganization, they will
[24:44.200 --> 24:50.960] have to disclose the information you haven't been able to get up to this point.
[24:50.960 --> 24:53.540] Correct.
[24:53.540 --> 24:57.240] So for them, that may turn out to be a big time oops.
[24:57.240 --> 25:06.680] Because they refuse to give her husband's place of work. And they know that once we
[25:06.680 --> 25:13.880] got this judgment, we would go and attach their wages. And we'd call them in for a
[25:13.880 --> 25:19.520] hearing on what their assets were and the bank accounts, because you can call them in
[25:19.520 --> 25:26.200] for a discovery hearing. She knows that we'll do that. So this is her desperate attempt
[25:26.200 --> 25:35.680] to get another 30 days. Because she hired a big law firm, you know, out of LA. So I'm
[25:35.680 --> 25:40.560] not afraid of them. And they will get a bar grievance right off the bat as soon as I've
[25:40.560 --> 25:43.160] got that information I want.
[25:43.160 --> 25:47.640] A bar grievance? Some, some bar grievance.
[25:47.640 --> 25:52.960] Okay, I'll find a few then. I'll look for a few of them. And I think I'll file against
[25:52.960 --> 25:59.120] the whole firm because it's, you know, it's one attorney, but they notified four or five
[25:59.120 --> 26:05.480] other attorneys of the notice of bankruptcy. I saw that they'd, you know, cc'd all the
[26:05.480 --> 26:09.360] other attorneys in the firm. So I'll just grieve them all.
[26:09.360 --> 26:17.040] Every name, every name that appears should get one. In my case, I got a filing by a attorney
[26:17.040 --> 26:24.880] from the attorney general's office. And his name was at the bottom. Above his name were
[26:24.880 --> 26:31.620] five other individuals. One was the acting attorney general because our current attorney
[26:31.620 --> 26:37.140] general Paxton is being impeached right now. They're trying to impeach him. So we have

[29:11.280 --> 29:26.680] to try to get my case thrown out. So you really can't get to them. And these guys, the attorneys

[01:40:13.740 --> 01:40:24.420] got wind that she had crafted this phony lease where supposedly I was the renter and that
[01:40:24.420 --> 01:40:27.100] she was going to try and screw me out of the house.
[01:40:27.100 --> 01:40:33.900] So to preempt that, I filed a constructive fraud lawsuit.
[01:40:33.900 --> 01:40:42.140] Long story short, the judge threw it out, said that I was just imagining it and that
[01:40:42.140 --> 01:40:47.500] clearly I was the renter with no right to it.
[01:40:47.500 --> 01:40:58.460] And then as it progressed along, her attorney switched arguments and totally against judicial
[01:40:58.460 --> 01:41:05.580] estoppel and said that, no, he's not a renter, he's a squatter in the house.
