[11:37.220 --> 11:42.340]  Well, she filed a complaint even though she didn't feel she had grounds to because the
[11:42.340 --> 11:51.780]  police encouraged her to, so she conspired to file a false complaint.
[11:51.780 --> 11:58.100]  All of the harm that accrued, accrued as a proximate result of that false complaint.
[11:58.100 --> 12:05.660]  So we're dragging Nordstrom into the ongoing criminal conspiracy.

[51:47.660 --> 51:56.660]  I'm the plaintiff and a neighbour parked his excavator on my property for five years
[51:56.660 --> 52:08.660]  So I took it to small claim support and I did not win and now he's asking for costs
[52:08.660 --> 52:16.660]  So if you want I could just brief you on the case
[52:16.660 --> 52:32.660]  Well, I think that would be good, yeah, just briefly, we don't need every detail, but yeah, whatever part really that you're most curious about you're not sure what to do with, yeah, fill us in on that part so we can speak to it
[52:32.660 --> 52:51.660]  Alright, so he was parked in my second driveway from 2017 to May 2022 and I had a lawyer help me starting in April 2021 with court orders, applications, claims, affidavits, all that
[52:51.660 --> 53:03.660]  And it was on May the 3rd, 2022 that he finally removed his excavator because he was very spiteful
[53:03.660 --> 53:07.660]  Oh wow, so he did this on purpose
[53:07.660 --> 53:23.660]  Yeah, and the judge even mentioned it in her endorsement that he wasn't creditable and she said it was dismissed based on the limitations act
[53:23.660 --> 53:35.660]  And there were text messages that showed I was asking him to remove the equipment several times in 2018 and I think this is what she was going by
[53:35.660 --> 53:50.660]  And then I had asked for damages to my driveway and broken trees and overgrowth, but I didn't notice that until May 2022, once he removed the equipment
[53:50.660 --> 54:01.660]  On the endorsement, the judge didn't write with prejudice or rest judicata, but in Canada, I think it may be the rule
[54:01.660 --> 54:06.660]  Well, it sounds like this is a different issue though
[54:06.660 --> 54:21.660]  Whatever might have been time barred in 2017 that you originally knew about and brought to the court for adjudication was not the same damage that later happened in 2022, right?
[54:21.660 --> 54:33.660]  So this is new stuff that happened. These are different damages. Yes, it's the same person and it's the same excavator, but you have new complaints, right?
[54:33.660 --> 54:47.660]  Yeah, but it didn't actually go to the court until April 2021 and they're looking at the text messages from 2018, which is when I started asking him to remove it
[54:47.660 --> 54:52.660]  And that's what they're going by, if that makes sense
[54:52.660 --> 55:00.660]  Yeah, I think that could speak to the first part, the part where he eventually did remove it
[55:00.660 --> 55:12.660]  But then when he did remove it, during the process of removal, he's breaking your trees and damaging your driveway in the process. That's new problems, right?

[55:18.660 --> 55:37.660]  True, true. So I still have probably a year left, but from what I heard is that because she didn't write with prejudice or rest judicata, that it's the rule that that order is final

[55:55.660 --> 56:04.660]  He didn't say either, but from what I heard in Canada, they don't have to. It's just the rule

[56:12.660 --> 56:26.660]  If someone files a suit and the suit is insufficient for one reason or another, it's equitable to give the person an opportunity to fix the suit.
[56:26.660 --> 56:38.660]  The whole legal system in the United States is built that way. You file a suit
[56:38.660 --> 56:52.660]  Then if the judge dismisses, then the judge must tell you exactly what's wrong with your suit. This is in the Fed, the federal courts. They will tell you precisely what is wrong with your suit and how to fix it.
[56:52.660 --> 56:59.660]  And they'll tell the other side the same thing so that they get the best suit before the court.
[56:59.660 --> 57:10.660]  So you almost expect your first pleading to be dismissed, at least I do.
[57:10.660 --> 57:18.660]  And then I'll expect them to tell me exactly why it's dismissed so I can file an amended pleading to fix it.
[57:18.660 --> 57:30.660]  You might check Canada law. It is unequitable not to give someone opportunity to repair a suit.
[57:30.660 --> 57:44.660]  Yeah, well, what I was thinking of doing was an appeal, a notice of appeal to start with, and then maybe starting a new case as of May 2022.
[57:44.660 --> 57:54.660]  But in the pleadings, I did mention continuing trespass and ongoing trespass.
[57:54.660 --> 58:03.660]  And I did find some case law on that. So that might help me.
[58:03.660 --> 58:12.660]  You mean with regards to ongoing, meaning that it's not beyond limitations?

[01:04:38.660 --> 01:04:50.660]  I'm not finding anything, actually. I'm in the Canadian Rules of Civil Procedure.
[01:04:50.660 --> 01:05:01.660]  And when I do dismissal, I'm not—the only thing I get is dismissal is being fired from a job, being dismissed from employment.
[01:05:01.660 --> 01:05:04.660]  Well, that sounds prejudicial.
[01:05:04.660 --> 01:05:13.660]  You know, and I did a search for prejudice and didn't get any hits.
[01:05:13.660 --> 01:05:20.660]  I find it hard to find things here in Canada.
[01:05:20.660 --> 01:05:26.660]  Can I just read something in the endorsement that she wrote, the judge?
[01:05:26.660 --> 01:05:28.660]  Yeah.
[01:05:28.660 --> 01:05:39.660]  Okay. She said, she, meaning me, claimed to have suffered from depression and anxiety. However, the evidence was insufficient to support this.
[01:05:39.660 --> 01:05:46.660]  What I do find is that the defendant intentionally interfered with the plaintiff's enjoyment of her property.
[01:05:46.660 --> 01:05:54.660]  It must have been very difficult to have lived in a neighborhood where her neighbor flaunted his power and control over everyone to see.
[01:05:54.660 --> 01:06:02.660]  If this claim had been pled, I would have awarded some damages. But absent such a claim, I cannot.
[01:06:02.660 --> 01:06:08.660]  However, the defendant's behavior deserves punitive damages had they been pled.
[01:06:08.660 --> 01:06:16.660]  Unfortunately, for the plaintiff, punitive damages were also not pled. I cannot grant punitive damages when they have not been pled.
[01:06:16.660 --> 01:06:28.660]  And finally, there is the issue of the Limitations Act, pled by the defendant and raised at trial. The plaintiff commenced this claim on June 30th, 2022.
[01:06:28.660 --> 01:06:39.660]  I'm limited by the two-year limitation to commence a legal proceeding from the day the plaintiff could have discovered the damage through due diligence.
[01:06:39.660 --> 01:06:50.660]  No. Okay. So when she drew that line about limitations, you have to go from that date that it was commenced.
[01:06:50.660 --> 01:06:57.660]  And now if you want to commence a new one, you'll go from today's date and go backwards two years.
[01:06:57.660 --> 01:07:07.660]  And anything that is encompassed, any damages that this guy did in that time frame, forget about what happened before.
[01:07:07.660 --> 01:07:13.660]  But anything in that time frame you can still address.
[01:07:13.660 --> 01:07:35.660]  There is one more issue. Anything that was addressed in the current suit, even if it was not within that time frame, even if that portion of it would have been within the statute of limitations, they are likely to consider that res judicata.
[01:07:35.660 --> 01:07:39.660]  Or double jeopardy.
[01:07:39.660 --> 01:07:45.660]  If suiting wants for that and lost, you can't sue and begin for it.
[01:07:45.660 --> 01:08:03.660]  Okay. Later on, she says, I find that the limitation period of two years expired probably in the summer of 2020, a few months after the plaintiff requested the defendant to remove the excavator from her property through text messages.
[01:08:03.660 --> 01:08:08.660]  So she said two different things, I think, there.
[01:08:08.660 --> 01:08:16.660]  Well, what about the damages that occurred when he did remove the excavator? You said that was 2022?
[01:08:16.660 --> 01:08:27.660]  Yeah, may, but I've already brought that up before the court in trial and I brought that up already. So I don't know if I can.
[01:08:27.660 --> 01:08:39.660]  Did you bring it up in a way that was like you just mentioned it during trial or you put it in your pleadings and that was part of your claim of damage?
[01:08:39.660 --> 01:09:00.660]  Yeah, I don't even know if I did the right paperwork, but I had about six different contractors with estimates and then I had about three statements from the contractors and then I had two witnesses. One got up on the stand to say how the driveway looked before the excavator and after.
[01:09:00.660 --> 01:09:06.660]  So I don't know if I did the right paperwork because it was my first time.
[01:09:06.660 --> 01:09:14.660]  It sounds like you're going to be barred by Reg Giudicata. If these issues are already brought before the court.

[01:35:06.660 --> 01:35:11.660]  And I think I have plenty of evidence to prove it, but he didn't want to do that.
[01:35:11.660 --> 01:35:15.660]  He just wanted to counterclaim with trespassing.
[01:35:15.660 --> 01:35:21.660]  But that, I mean, as far as counterclaim, as far as even getting anything out of it,
[01:35:21.660 --> 01:35:26.660]  I mean, I'd like to get something, but he's gonna get whatever his percentages do.
[01:35:26.660 --> 01:35:33.660]  But she's got $40,000 in attorney fee, and they're trying to get me to pay that.
[01:35:33.660 --> 01:35:35.660]  And I'm not the one who took her to court.
[01:35:35.660 --> 01:35:38.660]  She has no sense, so.
[01:35:38.660 --> 01:35:43.660]  If you, have you been declared indigent?
[01:35:43.660 --> 01:35:48.660]  I have, but that's a long time, but that was from a county court number four, but that's
[01:35:48.660 --> 01:35:50.660]  been over a year ago.
[01:35:50.660 --> 01:35:57.660]  If your finances have not dramatically changed, that will still be applicable, and you can
[01:35:57.660 --> 01:36:01.660]  make that claim so they can't assign you the attorney fees.
[01:36:01.660 --> 01:36:08.660]  And that's fine, but here's, I don't want that to have her win anyway, but he said earlier,
[01:36:08.660 --> 01:36:13.660]  I sent him a text message telling him about half of the, about 18 of the exhibits that
[01:36:13.660 --> 01:36:16.660]  they entered in, they need to be excluded.
[01:36:16.660 --> 01:36:23.660]  And he replied back with, he's calling his client, you and himself, to talk attorney
[01:36:23.660 --> 01:36:24.660]  fees.
[01:36:24.660 --> 01:36:31.660]  My examination of you will be during his case and chief, whatever that means, and then I'll
[01:36:31.660 --> 01:36:34.660]  testify to refute his argument about attorney fees.
[01:36:34.660 --> 01:36:36.660]  And then I said, is this out?
[01:36:36.660 --> 01:36:38.660]  And he said, yes.
[01:36:38.660 --> 01:36:42.660]  And I mean, I'm like, wonder why he's talking to me about that.
[01:36:42.660 --> 01:36:44.660]  I'm talking about the exhibit.
[01:36:44.660 --> 01:36:53.660]  And so then he said, oh, I asked him how come I asked him later, I didn't get a chance to
[01:36:53.660 --> 01:36:55.660]  get my witness series in Florida.
[01:36:55.660 --> 01:36:58.660]  And, and so, but she's got two witnesses.
[01:36:58.660 --> 01:37:03.660]  I can't imagine what two witnesses she would have, you know, I just can't imagine.
[01:37:03.660 --> 01:37:05.660]  And I don't even know who the witnesses are.
[01:37:05.660 --> 01:37:08.660]  Do they not have to tell us who they are?
[01:37:08.660 --> 01:37:10.660]  Yes, they do.
[01:37:10.660 --> 01:37:13.660]  And they have to give you contact information for each one.
[01:37:13.660 --> 01:37:17.660]  And you get opportunity to depose them.
[01:37:17.660 --> 01:37:20.660]  Okay, so then he can do that the day of the trial?
[01:37:20.660 --> 01:37:23.660]  No, you gotta do that beforehand.
[01:37:23.660 --> 01:37:30.660]  Okay, today at about five o'clock, I got an email from the people who file the e-filing
[01:37:30.660 --> 01:37:35.660]  or whatever and said that this is the plaintiff's witness list.
[01:37:35.660 --> 01:37:38.660]  And then another one was for the exhibit list.
[01:37:38.660 --> 01:37:41.660]  Well, the plaintiff's witness list didn't have anybody on it.
[01:37:41.660 --> 01:37:45.660]  Then they can't call any witnesses.
[01:37:45.660 --> 01:37:47.660]  Okay, all right.
[01:37:47.660 --> 01:37:55.660]  It did say something about any of the defendant witnesses that she calls that the plaintiff's
[01:37:55.660 --> 01:37:59.660]  going to be able to have a chance to ask questions too, but that's just normal.
[01:37:59.660 --> 01:38:01.660]  Yes, yeah, that's normal.
[01:38:01.660 --> 01:38:04.660]  You always get to cross.
[01:38:04.660 --> 01:38:07.660]  Yeah, so, but they didn't put anybody on the list.
[01:38:07.660 --> 01:38:09.660]  And so I guess that's good.
[01:38:09.660 --> 01:38:13.660]  So if they don't have them on the list and we go to trial that day, and after we try
[01:38:13.660 --> 01:38:18.660]  to exclude their exhibit, cuz he thinks that we actually are gonna go to trial.
[01:38:18.660 --> 01:38:21.660]  This judge has been real wishful, I feel like.
[01:38:21.660 --> 01:38:27.660]  At the beginning of the week, we were supposed to be number 12 on the list for the jury trial
[01:38:27.660 --> 01:38:28.660]  on Monday.
[01:38:28.660 --> 01:38:30.660]  And all of a sudden today we moved up to number two.
[01:38:30.660 --> 01:38:34.660]  So we're definitely gonna be going in there.
[01:38:34.660 --> 01:38:41.660]  Okay, well, if they don't have witnesses on the witness list, they can't call any.
[01:38:41.660 --> 01:38:45.660]  If you bring any witnesses, they can cross examine them.
[01:38:45.660 --> 01:38:50.660]  Okay, and I can't bring them cuz mine's in Florida, and it makes me mad.
[01:38:50.660 --> 01:38:53.660]  I said, well, why didn't we get an opportunity?
[01:38:53.660 --> 01:39:00.660]  Did you subpoena somebody?
[01:39:00.660 --> 01:39:02.660]  Did you subpoena somebody?
[01:39:02.660 --> 01:39:06.660]  No, my witness, my friend, was gonna move out to Florida.

[01:39:26.660 --> 01:39:28.660]  He said, well, no, we've had that date for a while.
[01:39:28.660 --> 01:39:32.660]  I didn't think we were gonna go because we were so far down the list.
[01:39:32.660 --> 01:39:36.660]  He said, but all of a sudden now we're up in the top of the list.
[01:39:36.660 --> 01:39:39.660]  Well, yeah, that's not the court's fault.
[01:39:39.660 --> 01:39:43.660]  That's the pro bono attorney's communication problem.
[01:39:43.660 --> 01:39:50.660]  He should have let you know we have this date and told you that it doesn't look very likely
[01:39:50.660 --> 01:39:55.660]  that we're gonna have it because we're down far on the list, but this is the date.
[01:39:55.660 --> 01:40:00.660]  If he had told you that, then the court didn't do anything wrong.

[01:40:03.660 --> 01:40:09.660]  Well, no, he told me, except for the thing is that the issue is the fact that, I mean,

[01:48:05.660 --> 01:48:09.660]  fighting in the courts and giving it to them and all that, I don't know.
[01:48:09.660 --> 01:48:15.660]  I mean, there's just something about those Texas girls, man.
[01:48:15.660 --> 01:48:21.660]  And I spent three years down in Houston, Texas.
[01:48:21.660 --> 01:48:24.660]  I actually went to Spicer High School.
[01:48:24.660 --> 01:48:32.660]  So that being said, I got a little experience in Texas, Dallas, Houston.
[01:48:32.660 --> 01:48:37.660]  And my favorite part is Austin.
[01:48:37.660 --> 01:48:45.660]  But what I called in about tonight is that I received the county letter
[01:48:45.660 --> 01:48:57.660]  of rejection of claim and they're basically saying that I only had six months
[01:48:57.660 --> 01:49:00.660]  to claim, to make a claim.
[01:49:00.660 --> 01:49:06.660]  So they're saying that the past eight years that they,
[01:49:06.660 --> 01:49:11.660]  I want you to know that the county board of supervisors knew what was going on
[01:49:11.660 --> 01:49:15.660]  this whole time and this whole eight years.
[01:49:15.660 --> 01:49:19.660]  And I went and spoke at county meetings.
[01:49:19.660 --> 01:49:24.660]  I told, I asked them to do a vote of no confidence on district attorney,
[01:49:24.660 --> 01:49:26.660]  Jeffrey Francis Rosen.
[01:49:26.660 --> 01:49:32.660]  And remember, I filed in the Fed a couple of times during this eight year
[01:49:32.660 --> 01:49:35.660]  criminal persecution.
[01:49:35.660 --> 01:49:42.660]  And the judge up there gave a nine page ruling, which Randy reviewed in the past.
[01:49:42.660 --> 01:49:50.660]  And it's noted in there to come back after the criminal case resolved.
[01:49:50.660 --> 01:49:55.660]  The judge in the federal court didn't want to interfere with the jurisdiction
[01:49:55.660 --> 01:50:01.660]  of the other court, but also it appears that I had about four causes of action.
[01:50:01.660 --> 01:50:10.660]  And that, and then in all capital letters, without prejudice.
[01:50:10.660 --> 01:50:13.660]  So she dismissed without prejudice.
[01:50:13.660 --> 01:50:16.660]  She put it in all capital letters and told me to come back.

[01:51:23.660 --> 01:51:29.660]  Socrates Peter Mnuchin, to make rulings and orders while he's a state court
[01:51:29.660 --> 01:51:32.660]  judge while the case was removed to federal court.
[01:51:32.660 --> 01:51:38.660]  And for that, I added his name to the federal lawsuit.
[01:51:38.660 --> 01:51:43.660]  And then I Googled him, Socrates Peter Mnuchin.
[01:51:43.660 --> 01:51:47.660]  Then I Googled him after I added his name to the federal case.
[01:51:47.660 --> 01:51:54.660]  Also, guys, very distinct in this, not all the time when you sue a judge,
[01:51:54.660 --> 01:51:57.660]  most of the time not.
[01:51:57.660 --> 01:52:00.660]  They don't have to pay for private counsel.
[01:52:00.660 --> 01:52:05.660]  Socrates Peter Mnuchin had to pay for private counsel.
[01:52:05.660 --> 01:52:08.660]  However, the county paid it.
[01:52:08.660 --> 01:52:10.660]  It was $10,000.
[01:52:10.660 --> 01:52:17.660]  And that private law firm represented him in the federal court.
[01:52:17.660 --> 01:52:21.660]  And what I'm telling you here, guys, is there's my retaliation.
[01:52:21.660 --> 01:52:23.660]  It started right then and there.
[01:52:23.660 --> 01:52:30.660]  I went to the FBI and said, hey, you need to start watching this guy.
[01:52:30.660 --> 01:52:36.660]  I felt I had no choice but to add his name to the federal lawsuit because I'm in
[01:52:36.660 --> 01:52:41.660]  federal court and this state court judge is interfering and holding hearings
[01:52:41.660 --> 01:52:44.660]  and making orders down in the state court.
[01:52:44.660 --> 01:52:46.660]  He has no jurisdiction to do so.
[01:52:46.660 --> 01:52:53.660]  And in fact, his history is that he's against people fighting for their homes.
[01:52:53.660 --> 01:53:00.660]  And the California Supreme Court already castigized him in a case of Bank of New
[01:53:00.660 --> 01:53:04.660]  York Mellon versus Passario.
[01:53:04.660 --> 01:53:11.660]  And the Supreme Court, state Supreme Court, ordered their ruling published to
[01:53:11.660 --> 01:53:14.660]  publicly spank him.
[01:53:14.660 --> 01:53:19.660]  But he's undeterred and he's continuing to help the banks steal people's homes
[01:53:19.660 --> 01:53:22.660]  without due process.
[01:53:22.660 --> 01:53:27.660]  And the FBI, you know, they did nothing.
[01:53:27.660 --> 01:53:33.660]  And so then the next thing you know, guys, that's when I have 30 people at my
[01:53:33.660 --> 01:53:43.660]  home with machine guns and armored vehicles and they look like regular army.
[01:53:43.660 --> 01:53:47.660]  Actually, they look like Rangers is what they look like.
[01:53:47.660 --> 01:53:49.660]  Okay, hold on, hold on, Ted.

[01:54:56.660 --> 01:54:57.660]  So I'm appealing.
[01:54:57.660 --> 01:55:03.660]  But remember, the appellate court also has Socrates Peter Manoukian's wife on it.
