[04:44.280 --> 04:53.040]  Brett and I were talking about this suit that I filed, and Brett gave me an insight that
[04:53.040 --> 04:56.240]  I didn't expect.
[04:56.240 --> 05:03.360]  It's all politics guys, Brett filed a read of habeas corpus for some people in Henderson
[05:03.360 --> 05:04.360]  County.
[05:04.360 --> 05:07.640]  Will you explain that Brett?
[05:07.640 --> 05:17.880]  Well, over at Henderson County right now, it was in December of 2021, a couple, a man
[05:17.880 --> 05:24.440]  and wife were suspected of having killed their baby.
[05:24.440 --> 05:34.320]  Their baby died and the autopsy was withheld, nobody can actually show how the baby died.
[05:34.320 --> 05:42.640]  They were obviously grieving and the CPS, they called 911, the sheriff came and CPS
[05:42.640 --> 05:48.120]  got involved and CPS took away their other two children.
[05:48.120 --> 05:56.040]  So now the sheriff incarcerated these two, the mother and father, and they're still,
[05:56.040 --> 06:03.080]  as of today, there's no paperwork, some sworn complaint that says that would be the
[06:03.080 --> 06:09.280]  support for a probable cause determination and for the commencement of a case.
[06:09.280 --> 06:11.200]  That hasn't happened yet.
[06:11.200 --> 06:17.240]  Instead, all we have is you can look them up online and say, are they in this jail?
[06:17.240 --> 06:21.640]  You can search for people by their names and it says whether or not they're, it's jail
[06:21.640 --> 06:23.240]  records really.
[06:23.240 --> 06:29.000]  And it shows that you can see some line item where it says whatever it was they were accused
[06:29.000 --> 06:32.140]  of, but there's no paperwork to back that up.
[06:32.140 --> 06:36.280]  And there's no judicial order, there needs to be a commitment order, right?
[06:36.280 --> 06:44.040]  Coming out of the setting of bail, there should be per Texas Code of Criminal Procedure 17.028.
[06:44.040 --> 06:51.280]  They have to take certain factors into consideration when setting bail and it needs to be the least
[06:51.280 --> 06:58.540]  restrictive that would ensure that the person is going to reasonably ensure that the person
[06:58.540 --> 07:02.440]  will show up for court when it's their court date.
[07:02.440 --> 07:08.720]  Well, these people are not even, the court's not setting a court date, there's no paperwork
[07:08.720 --> 07:10.640]  for them to start with.
[07:10.640 --> 07:15.480]  So that can't set a court date, they're just leaving the people sitting there.
[07:15.480 --> 07:28.040]  Now, then you go to the grandfather, the grandfather has been trying to, I'm pretty frustrated
[07:28.040 --> 07:33.600]  with him because he didn't ask what's the right thing to do about this, he's just been
[07:33.600 --> 07:37.080]  trying all kinds of things.
[07:37.080 --> 07:41.840]  Looks like mostly patriot mythology kind of stuff and it's just gotten him in such hot
[07:41.840 --> 07:42.840]  water.
[07:42.840 --> 07:48.260]  But I mean, you've got to understand he's frustrated, his grandchildren were ripped
[07:48.260 --> 07:52.680]  away from his children.
[07:52.680 --> 07:58.840]  And his children are sitting in jail with no charges, just a line item on some website,
[07:58.840 --> 08:00.720]  that's the only charges they have.
[08:00.720 --> 08:07.520]  There's no actual judicial orders of anything, no probable cause order, no, there's nothing
[08:07.520 --> 08:14.040]  to support an arrest, like there's no, a judge would have to, according to the constitution,
[08:14.040 --> 08:20.840]  the judge would have to have some kind of support for an arrest warrant, right?
[08:20.840 --> 08:27.040]  Upon oath or upon probable cause, oath or affirmation, there's nothing.
[08:27.040 --> 08:39.440]  So then he, the grandfather ends up getting arrested and then the grandmother gets arrested
[08:39.440 --> 08:46.600]  and then their house, the next day their house gets a sheriff's sale, some kind of sheriff
[08:46.600 --> 08:50.000]  tax sale kind of a thing.
[08:50.000 --> 09:01.920]  And yeah, well the next day after the grandma got arrested, it was the day before she filed
[09:01.920 --> 09:06.680]  a suit that Randy had prepared for her that was hopefully going to stop that.
[09:06.680 --> 09:09.920]  But I think she took it to the wrong court.
[09:09.920 --> 09:15.640]  And so that ended up not having the effect it needed to.
[09:15.640 --> 09:22.000]  And then the day after they arrested her, sheriff came in there and sold off everything,
[09:22.000 --> 09:26.360]  some kind of auction or something, it was really swift.
[09:26.360 --> 09:36.640]  But anyway, yeah, this whole family now, the four of them are all in jail with no due process.
[09:36.640 --> 09:38.200]  Now, regardless...

[10:02.240 --> 10:08.400]  There are several different kinds of extraordinary writs, but this one is one that kind of cuts

[10:10.640 --> 10:12.080]  I don't care what your rules are.
[10:12.080 --> 10:21.040]  I can write this in crayon, I can put it on a toilet paper roll and throw it at you.

[10:22.400 --> 10:28.600]  It cuts through all the form, all the rules and everything, and it can't be disregarded
[10:28.600 --> 10:33.560]  because of some formatting issue or you didn't pay a fee.

[12:18.080 --> 12:27.160]  established the underpinnings that need to be there lawfully to demand that you show
[12:27.160 --> 12:28.160]  up.
[12:28.160 --> 12:32.760]  So they have unlawfully restrained your liberty and your appropriate remedy for that is to
[12:32.760 --> 12:37.680]  petition for a writ of habeas corpus.
[12:37.680 --> 12:41.320]  That's what I did on these guys' behalf.
[12:41.320 --> 12:43.640]  First it was just the grandfather.
[12:43.640 --> 12:46.440]  That was the first one that I knew about.
[12:46.440 --> 12:50.640]  Then I started poking around and I started looking at these jail records and I found
[12:50.640 --> 12:52.600]  that there were a lot of people they've been doing this to.
[12:52.600 --> 12:58.960]  I came up with 10, well, came up with 12 different ones.
[12:58.960 --> 13:07.920]  Then I, out of those 12, I looked at 10 of them, I put up a, I did a mail merge and just
[13:07.920 --> 13:15.040]  put all of their names and dates that they were incarcerated and they all have the same
[13:15.040 --> 13:16.040]  situation.
[13:16.040 --> 13:22.520]  I've been sitting there for a very long time with no trial and no charges.
[13:22.520 --> 13:28.520]  I asked, I did records requests to try to find out which, if there were documents to
[13:28.520 --> 13:34.080]  support their being incarcerated and they have nothing, nothing.
[13:34.080 --> 13:40.640]  Can criminal charges be brought against those responsible for such an act?
[13:40.640 --> 13:43.240]  Yes, and I have done that too.
[13:43.240 --> 13:51.880]  We were talking about that on the break.
[13:51.880 --> 13:58.720]  The ones that I've targeted so far are the ones who are the judges to whom I sent these
[13:58.720 --> 14:02.920]  petitions for the great writ.
[14:02.920 --> 14:04.280]  They've done nothing about it.
[14:04.280 --> 14:06.200]  They don't have any discretion.
[14:06.200 --> 14:07.840]  They are required.
[14:07.840 --> 14:13.640]  It's their duty to issue the writ, but they've done nothing.
[14:13.640 --> 14:23.520]  You know, I did this once before in 2008, I filed a writ of habeas corpus with the court
[14:23.520 --> 14:37.400]  of criminal appeals and they demanded a motion for leave to file.
[14:37.400 --> 14:39.040]  Where did they get that idea?
[14:39.040 --> 14:42.960]  I don't know, but I made up criminal complaints against them and filed them with the grand
[14:42.960 --> 14:50.480]  jury and it took me a year and I got them presented to the grand jury.
[14:50.480 --> 14:57.080]  But as soon as I filed the complaints with the district attorney, they let this kid out
[14:57.080 --> 15:00.960]  of jail, but I was just trying to get out of jail.
[15:00.960 --> 15:07.360]  And it took me a year to get it to them.
[15:07.360 --> 15:12.520]  When I tried to file it, I filed complaints immediately and they let the kid out of jail.
[15:12.520 --> 15:15.920]  But it took me a year to get it in front of the grand jury.
[15:15.920 --> 15:20.600]  The grand jury got my complaints their first day in office and held them to their last
[15:20.600 --> 15:24.200]  day and then no build.
[15:24.200 --> 15:29.800]  So these judges spent three months wondering if their career was going to end tomorrow.
[15:29.800 --> 15:31.000]  Correct?
[15:31.000 --> 15:34.480]  I suggest we do that again.
[15:34.480 --> 15:37.120]  These people are certainly earning it.
[15:37.120 --> 15:40.440]  It's the same, the same situation.
[15:40.440 --> 15:50.960]  The prosecuting attorney at the time, Ron Earl, was a 25 year district attorney.
[15:50.960 --> 15:52.960]  He was a Democrat.
[15:52.960 --> 15:56.220]  All nine of these judges were Republicans.
[15:56.220 --> 16:02.160]  He was retiring, and he tried to take all these judges with him and used my complaint
[16:02.160 --> 16:04.240]  for cat and fodder.
[16:04.240 --> 16:10.740]  Now we have Jose Garza, who I just sued.
[16:10.740 --> 16:18.200]  And I sued him over some complaints Brett filed.
[16:18.200 --> 16:26.560]  And the complaints, Jose Garza got them and said, there were two of them, that it was
[16:26.560 --> 16:30.040]  questionable whether they were federal or not.
[16:30.040 --> 16:34.240]  And he said, I don't have jurisdiction and dropped them off.
[16:34.240 --> 16:37.000]  And what the heck is that crap?
[16:37.000 --> 16:43.640]  You may not have jurisdiction, but one thing you certainly don't have is the authority
[16:43.640 --> 16:45.880]  to make that determination.
[16:45.880 --> 16:51.720]  And I charged him with impersonating a public official, and now I've sued him, no, the
[16:51.720 --> 16:52.720]  district attorney.
[16:52.720 --> 16:53.720]  Yeah, he impersonated a judge.

[20:15.660 --> 20:25.440]  In 2008, I filed against all these judges, and they have filed against them for requiring
[20:25.440 --> 20:30.160]  me to file a motion for leave to file.
[20:30.160 --> 20:34.740]  The clerk said he had to have it or he couldn't take my habeas, and I said, what are you talking
[20:34.740 --> 20:35.740]  about?
[20:35.740 --> 20:41.340]  This is the habeas, the great writ, the writ of right.
[20:41.340 --> 20:46.560]  This court has no power to grant or deny me leave to file a habeas.
[20:46.560 --> 20:50.580]  And he said, that's the way they've been doing it for 20 years.
[20:50.580 --> 20:53.660]  So I made him up one.
[20:53.660 --> 21:00.600]  They denied me leave to file a habeas immediately.
[21:00.600 --> 21:04.400]  So I made up criminal charges and filed against them.
[21:04.400 --> 21:08.540]  Well, this seems like a perfect storm.
[21:08.540 --> 21:13.080]  They spent three months, it took me a year to get it presented to the grand jury.
[21:13.080 --> 21:17.600]  Ron Earl, 25 year district attorney, he was retiring.
[21:17.600 --> 21:19.280]  He was a Democrat.
[21:19.280 --> 21:23.880]  All nine of these judges are Republicans, that dirty rotten scoundrel, he tried to
[21:23.880 --> 21:28.440]  take these guys with him when he got out of office.
[21:28.440 --> 21:32.840]  Well, I recently went down to the Ron Earl building.
[21:32.840 --> 21:38.800]  He retired and they built a 10 or 12 story building and named it after him and filed
[21:38.800 --> 21:42.320]  criminal complaints against the governor.
[21:42.320 --> 21:51.280]  And Jose Garza, the current district attorney, gave those complaints to the grand jury.
[21:51.280 --> 21:56.520]  Brett has filed a habeas with the Court of Criminal Appeals.
[21:56.520 --> 22:06.120]  We have a Democratic district attorney and all nine of those judges are Republicans.
[22:06.120 --> 22:14.000]  And since Garza gave the governor's complaints to the grand jury, it's a very good chance
[22:14.000 --> 22:17.920]  he'll give the ones against the Court of Criminal Appeals to the grand jury.
[22:17.920 --> 22:23.200]  We put him in front of a grand jury another again.
[22:23.200 --> 22:29.240]  This could be a perfect political storm.

[28:02.680 --> 28:10.000]  procedure and 15.05 lists the requisites of a complaint.

[52:28.680 --> 52:34.520]  Because they have to prepare a witness, what is it, some kind of witness statement or not
[52:34.520 --> 52:48.880]  a witness statement, what is it, Brett, when the person who's been harmed, victim statement.
[52:48.880 --> 52:51.960]  They're going to need a victim statement.
[52:51.960 --> 52:55.280]  But they've been very casual.
[52:55.280 --> 52:57.120]  The one guy is going to trial in September.
[52:57.120 --> 52:59.320]  They still don't have a witness statement for me then.

[53:13.120 --> 53:15.800]  They just take care of the plea deals behind the scenes.
[53:15.800 --> 53:17.520]  Most of the victims don't even know what's going on.
[53:17.520 --> 53:21.560]  In our case, there is some restitution issues, but even that, they haven't been asking me
[53:21.560 --> 53:23.040]  a whole lot about it.
[53:23.040 --> 53:27.120]  But now they know that I'm on this or I'm trying to be on it.
[53:27.120 --> 53:32.240]  And so now they're actually very cautious.
[53:32.240 --> 53:35.760]  They weren't saying, hey, no, what you're saying isn't good or actually that's great.
[53:35.760 --> 53:38.040]  They were just like, hmm, hmm.
[53:38.040 --> 53:39.720]  I think a lot of that's the incompetence.
[53:39.720 --> 53:43.200]  But I think what I'm getting at, Andy, is there's a fear factor here.

[54:24.160 --> 54:28.040]  But I always say your honor, and other people call her judge, but she wants me to know that

[54:29.040 --> 54:32.760]  But at the end of the day, she's giving me more and more of what I want because she knows
