[05:04.780 --> 05:11.660]  in a small town near me. A police officer stopped
[05:11.660 --> 05:19.340]  to me because he said my license plate was obscured.
[05:19.820 --> 05:23.180]  Well, it was perfectly visible, didn't have any dirt on it.
[05:23.180 --> 05:27.820]  Yeah, it was kind of bent up where I backed into a few trailers with it but
[05:27.820 --> 05:31.980]  it was perfectly readable. The edges were bent up a little bit.
[05:31.980 --> 05:39.020]  So that was obvious and I fought them and the first three hearings the
[05:39.020 --> 05:43.180]  judge didn't like one bit. I asked him to arrest his clerk
[05:43.180 --> 05:47.340]  and he refused. I told him at the next hearing I wanted
[05:47.340 --> 05:53.260]  a security present and he said why would I need security on a Zoom hearing?
[05:53.260 --> 05:58.620]  Well, so the next time you commit a crime I'm going to ask security to
[05:58.620 --> 06:04.860]  arrest you. He denied. I filed a subject matter
[06:04.860 --> 06:09.740]  jurisdiction challenge and he denied it. Well, there are a lot of things you can
[06:09.740 --> 06:13.500]  do with a subject matter jurisdiction challenge.
[06:13.500 --> 06:20.220]  Deny it is not one of them. So they set two hearings,
[06:20.220 --> 06:27.900]  set two Zoom hearings and they neglected to notify me of them.
[06:27.900 --> 06:33.420]  Then they sent a notice to the Department of Public Safety
[06:33.420 --> 06:39.100]  stating that I failed to appear and the Department of Public Safety
[06:39.100 --> 06:45.740]  suspended my license. Well, I just went to a hearing yesterday
[06:45.740 --> 06:50.540]  and because I got pulled over and found out my license had been suspended
[06:50.540 --> 06:59.420]  so I sent in a change of plea to Nolo Contendre and a notice of appeal
[06:59.420 --> 07:08.380]  and a petition for inability to pay. I went into a hearing and the judge was
[07:08.380 --> 07:14.860]  surprisingly cautious. He actually turned on the recording for
[07:14.860 --> 07:19.740]  my hearing, said this was a court of record.
[07:19.740 --> 07:23.740]  Well, he shouldn't have said that to me because I'm going to want a recording of
[07:23.740 --> 07:29.820]  every hearing I've been to, Mr. Court of Record.
[07:29.820 --> 07:37.420]  So anyway, I got in the notice of appeal and he
[07:37.420 --> 07:41.180]  actually granted it
[07:41.660 --> 07:48.380]  and set a bond for $800 but they didn't have to pay it
[07:48.380 --> 07:55.740]  and now he says I have to put in a bail. It's very complicated.
[07:55.740 --> 08:03.100]  No, it's not. The bond is an option.
[08:03.100 --> 08:11.340]  Bail is a constitutional right. The bail form is in the Texas Code of
[08:11.340 --> 08:15.900]  Criminal Procedure. They actually have the form in there
[08:15.900 --> 08:19.180]  and I actually have a template of one on my website
[08:19.180 --> 08:25.020]  in my file so I'll give him a bail form and then we'll go to
[08:25.020 --> 08:31.180]  the county court. Well, the county court judge
[08:31.180 --> 08:38.380]  happens to be the only public official I believe that doesn't hate me.
[08:38.380 --> 08:43.420]  He was the county attorney. I knew him when he was a county attorney
[08:43.420 --> 08:49.500]  and then he was the district attorney for about 20 years
[08:49.500 --> 08:54.140]  and we have had a very good relationship over the years
[08:54.140 --> 08:57.980]  and he told me once when I went to his office he said what were you doing in
[08:57.980 --> 09:01.660]  Wichita Falls? I said you know about that? He said oh
[09:01.660 --> 09:05.260]  yeah. I got a call from the prosecutor attorney
[09:05.260 --> 09:08.860]  and he wanted to know if I knew you and I told him yes I did
[09:08.860 --> 09:13.820]  and then he wanted to know if you were crazy. I said
[09:13.820 --> 09:17.260]  what did you tell him? He said yeah he's crazy
[09:17.260 --> 09:20.780]  but if he tells you something about law pay attention
[09:20.780 --> 09:27.980]  because he does his homework. I said I'll take that.
[09:28.780 --> 09:32.700]  If doing my homework and knowing the law better than they do is crazy
[09:32.700 --> 09:39.740]  I can deal with that. So now I'm going to go before him with this appeal
[09:39.740 --> 09:44.380]  and I'm going to unload everything on him.
[09:44.460 --> 09:49.820]  I really believe this guy wants to do things right
[09:49.820 --> 09:55.100]  and he knows that I'm filing these so that I can get them to the court of
[09:55.100 --> 09:57.660]  appeals

[10:18.540 --> 10:25.500]  don't have my license it's still revoked or not revoked it's still
[10:25.500 --> 10:29.580]  suspended but I my license expired so I couldn't
[10:29.580 --> 10:33.340]  renew it. So that's caused me a real problem but
[10:33.340 --> 10:37.980]  when I was at this hearing I told the prosecutor wanted to
[10:37.980 --> 10:40.700]  make a deal and I said no there won't be any deals.
[10:40.700 --> 10:48.140]  I've already filed a change of plea and a plea of no law contend a
[10:48.140 --> 10:52.140]  and notice of appeal but what I'm here for
[10:52.140 --> 10:58.940]  is I want to see from the clerk's
[10:58.940 --> 11:04.940]  computer the email that she sent me to appear at these two
[11:04.940 --> 11:08.700]  hearings. Well she went and looked and she brought
[11:08.700 --> 11:12.380]  me an email for a different hearing one that I actually got
[11:12.380 --> 11:16.140]  and I looked at it and I said yeah I actually got this one.
[11:16.140 --> 11:23.340]  I want to see the two I didn't get and she never came up with those.
[11:23.340 --> 11:30.780]  When I had a ticket in Combi they charged me with a failure to appear
[11:30.780 --> 11:35.020]  but they never noticed me for me to appear.
[11:35.020 --> 11:41.980]  Brett he's not here yet he's on his way he got a ticket in Combi same thing
[11:41.980 --> 11:48.140]  happened to him. It appears as though
[11:48.140 --> 11:53.660]  since the I think it was the last legislature
[11:53.660 --> 11:59.580]  they made it so that the municipal courts could no longer issue a
[11:59.580 --> 12:06.060]  warrant for failure to appear on a class city misdemeanor.
[12:06.060 --> 12:09.500]  So they had a problem they couldn't coerce us
[12:09.500 --> 12:13.020]  so they figured out another way to do it.
[12:13.020 --> 12:19.420]  Set a zoom hearing don't give notice when you don't appear at the zoom hearing
[12:19.420 --> 12:23.340]  then they send a notice to the department of public safety
[12:23.340 --> 12:28.060]  and the department of public safety will suspend your license for failure to
[12:28.060 --> 12:34.780]  appear. Neat trick problem is
[12:34.780 --> 12:40.060]  she should have never sent me an email notice to appear.
[12:40.060 --> 12:47.500]  First three were email and if she had mailed a notice
[12:47.500 --> 12:53.420]  to appear with no certified mail she could testify that she sent it.
[12:53.420 --> 13:00.540]  I could testify that I never received it and I would be screwed
[13:00.540 --> 13:07.260]  but she didn't she sent three email notices to appear and then
[13:07.260 --> 13:12.060]  all of a sudden there are no email notices to appear
[13:12.060 --> 13:17.260]  and she's saying she mailed it and I'm saying well show me the certified mail
[13:17.260 --> 13:20.460]  with my signature on the return receipt saying prove I
[13:20.460 --> 13:24.860]  you actually mailed it you're saying you did but I didn't get it
[13:24.860 --> 13:29.260]  and I'll testify that I didn't get it well she couldn't produce
[13:29.260 --> 13:33.100]  the emails from her server.
[13:33.100 --> 13:40.380]  So this will get interesting if she doesn't produce the
[13:40.380 --> 13:47.260]  emails then I sue her personally her and the judge for conspiring with
[13:47.260 --> 13:51.020]  one another to deny me due process because I
[13:51.020 --> 13:55.580]  fought the ticket and now I'll dig into the rest of her
[13:55.580 --> 13:59.580]  emails I want to see all of the notices to appear
[13:59.580 --> 14:07.100]  and all of the failures to appear that they have issued
[14:07.100 --> 14:12.620]  and then I'm going to compare them see if I see more of these and I suspect
[14:12.620 --> 14:18.460]  I will and then we'll have ourselves a wonderful
[14:18.460 --> 14:23.820]  lawsuit and I won't be in there claiming that the
[14:23.820 --> 14:28.700]  statues don't apply to me because I'm a man on the land and all
[14:28.700 --> 14:32.780]  that other crap I'll be taking them on on their own

[22:45.740 --> 22:51.820]  you know since it wasn't like uh posted in a newspaper or something like that

[23:00.940 --> 23:07.980]  right i can go to the court and they'll have to show me that record
[23:07.980 --> 23:14.140]  she they have this is a the lowest trick they can pull because when a
[23:14.140 --> 23:20.700]  child is actually abused nobody takes it serious
[23:20.700 --> 23:26.300]  because every time they make that accusation
[23:26.300 --> 23:29.980]  this judge hears this in most every case that he addresses
[23:29.980 --> 23:33.420]  it's a standard procedure to accuse the the
[23:33.420 --> 23:37.180]  the male of abusing the children it's just what they do
[23:37.180 --> 23:42.460]  we've talked about it on the show before so
[23:42.460 --> 23:47.660]  charge them criminally this is aggravated perjury
[23:47.660 --> 23:53.900]  have you bar grieve the lawyer yes i just mailed one out uh
[23:53.900 --> 23:58.380]  i haven't found a way to do it like by fax or whatever
[23:58.380 --> 24:02.300]  so i mailed one out i think the day before yesterday
[24:02.300 --> 24:09.900]  and uh i um i'm not exactly sure what rules
[24:09.900 --> 24:13.340]  he got you know off the top of my head but uh
[24:13.340 --> 24:20.620]  i definitely went after him for um okay one two
[24:20.620 --> 24:25.180]  c and eight four b those are the rules i had him for
[24:25.180 --> 24:31.180]  and uh basically uh he knowingly assisted by it and
[24:31.180 --> 24:34.300]  conduct that he knew was illegal and fraudulent
[24:34.300 --> 24:41.420]  and then the other one he engaged in conduct involving dishonesty fraud
[24:41.420 --> 24:48.300]  okay did he did he do all all of this in one action yeah

[27:30.340 --> 27:43.260]  Yeah, sure. So I initiated a custody case and in the answer from the opposing party,
[27:43.260 --> 27:55.180]  one of their points was ostensibly claiming that I was abusing my daughter in a very misleading,
[27:55.180 --> 28:03.660]  fraudulent way. And I was thinking about going after the lawyer for libel and Randy suggested
[28:03.660 --> 28:15.680]  aggravated perjury. Yeah, libel is a suit of its own where you're suing the lawyer civilly
[28:15.680 --> 28:23.900]  for damages. There's nothing wrong with that. If you do aggravated perjury, that's something
[28:23.900 --> 28:28.100]  that's more maintainable for you. And I don't know if that might be why he's suggesting
[28:28.100 --> 28:33.100]  that, but it's a criminal offense. So it's a lot simpler on your end. You don't have
[28:33.100 --> 28:37.260]  to maintain it through the courts. You don't have to deal with motions and hearing dates
[28:37.260 --> 28:42.500]  or anything. All you do, you write up the criminal complaint, you say, he did this,
[28:42.500 --> 28:50.060]  this and that. You borrow straight from the language of the legislators who have said
[28:50.060 --> 28:55.980]  word for word, this is what aggravated perjury is. If somebody does this and this and this.
[28:55.980 --> 29:00.780]  So you take that same language, copy and paste it into your criminal complaint and you match
[29:00.780 --> 29:08.820]  up the facts with that language. And now you've got a criminal complaint. You're done. You
[29:08.820 --> 29:14.000]  pull the pin, you lob the grenade and you don't have to maintain that through the courts.
[29:14.000 --> 29:20.180]  It has its effect on him without you having to kind of do two dances at once. You're in
[29:20.180 --> 29:25.980]  the middle of defending yourself against something, right? In the court.

[33:56.060 --> 34:05.020]  of people have issues with traffic tickets or something, and it doesn't get to the ripping
[34:05.020 --> 34:07.420]  your family apart kind of thing.
[34:07.420 --> 34:16.620]  Okay, so we were talking when we went out about the difference between addressing this
[34:16.620 --> 34:28.020]  lawyer's wrongdoing civilly, like libel versus criminally, like aggravated perjury. So Randy,
[34:28.020 --> 34:29.820]  are you back in there now?
[34:29.820 --> 34:31.900]  I'm back in here.

[34:34.060 --> 34:43.140]  This is really, really dirty pool. This is a lawyer standard approach. You really need
[34:43.140 --> 34:49.740]  to let the judge know this is horse manure. And the way to do that is to go after this
[34:49.740 --> 34:56.460]  lawyer for aggravated perjury and let them bring that daughter in and prove up their
[34:56.460 --> 35:02.500]  claims. If they can't prove up their claims, then you need sanctions against the lawyer,
[35:02.500 --> 35:05.780]  and you sue the lawyer personally for malpractice.
[35:05.780 --> 35:12.420]  Okay. That sounds like a good plan.
[35:12.420 --> 35:18.860]  This defense is a good, effective offense. If, Bubba, you want to fight, I'll give you
[35:18.860 --> 35:21.620]  a fight you won't believe.
[35:21.620 --> 35:22.620]  Right?
[35:22.620 --> 35:28.420]  Yeah, and they're typically not expecting that. When they come to court and they see
[35:28.420 --> 35:34.980]  that they're the lawyer and you're not, they're not expecting you to push back at all. So
[35:34.980 --> 35:38.940]  you come after them, it means something.
[35:38.940 --> 35:46.780]  Yeah. And Randy, before you went out, you were talking about basing out the fire grievances
[35:46.780 --> 35:51.260]  a couple of weeks. Is that so they treat them separately?
[35:51.260 --> 35:56.660]  Yes. If you put them all together, they'll treat it as one and dismiss them all at once.
[35:56.660 --> 36:06.620]  They're going to dismiss them all no matter what. And we expect that. But they're insurance
[36:06.620 --> 36:12.420]  carriers. It's the insurance carriers that they got to worry about. They're not going
[36:12.420 --> 36:22.000]  to dismiss them. So you space them apart by a week, and then the insurance carriers will
[36:22.000 --> 36:28.100]  consider each one of them as a separate grievance. Stack them up.
[36:28.100 --> 36:35.500]  Yeah. I ain't saying a week. It's different in different states. How much time it is before...
[36:35.500 --> 36:41.220]  The way you can find out is go to Michigan's... There's a review board. There's some rules
[36:41.220 --> 36:47.060]  that the state has laid out for their review board. And it will say in rule number whatever,
[36:47.060 --> 36:53.420]  2.1, and it's going to say that they have their triage team has to handle each one of
[36:53.420 --> 36:58.380]  these and categorize it within X number of days. So whatever that is, add one day to
[36:58.380 --> 37:03.420]  it and you could just like clockwork, roll them out on your calendar.
[37:03.420 --> 37:15.140]  Now, in the one I mailed this week, I only put two rule violations in this grievance.
[37:15.140 --> 37:18.980]  And I... Oh, man. You could have made two grievances
[37:18.980 --> 37:22.860]  out of that. Well, there's more rules that he violated.
[37:22.860 --> 37:26.660]  I'm not sure off the top of my head, but... Well, good.
[37:26.660 --> 37:33.940]  They're pretty much... I put 1, 2, C, and 8, 4, B. And I know there's at least one
[37:33.940 --> 37:41.340]  or two other ones. So can I do multiple grievances faced apart for the same occurrence? Would
[37:41.340 --> 37:45.820]  that be wise? Good question.
[37:45.820 --> 37:50.180]  I don't think it makes any difference about what you can do because they ignore them all
[37:50.180 --> 37:55.020]  anyway. Or they write you back a little letter that says that, well, this doesn't arise to
[37:55.020 --> 38:00.460]  the level of misconduct. We're treating this as an inquiry. We've dismissed it, whatever.
[38:00.460 --> 38:04.220]  And they send you back something that makes you feel like you failed. But they always
[38:04.220 --> 38:14.100]  do that. So just report what you need to report. Just always be truthful and put it out there,
[38:14.100 --> 38:18.500]  spacing out so that they can have the maximum effect. That's all you can really do.
[38:18.500 --> 38:24.980]  Yeah. It is the insurance company where their problem arises. The insurance company does
[38:24.980 --> 38:34.960]  not care if the bar finds them valid or not because they know the bar tosses all of them.
[38:34.960 --> 38:42.220]  So the only way for them to gauge their level of risk is by the numbers. And I need to comment
[38:42.220 --> 38:55.180]  here. The agent for the insurance carrier, he's a scoundrel. His purpose is to charge
[38:55.180 --> 39:00.220]  his client as much as possible and avoid any claims.
[39:00.220 --> 39:03.780]  Wait, wait. Is he a lawyer too?
[39:03.780 --> 39:07.620]  No, generally not. He's an insurance agent.
[39:07.620 --> 39:09.780]  But you just described, okay, nevermind.
[39:09.780 --> 39:17.300]  Yeah, so he's insurance. They're as bad as lawyers. So we seek the insurance agent on
[39:17.300 --> 39:27.300]  the lawyer. He don't care if it's not valid. Gives him an opportunity to raise the premium.
[39:27.300 --> 39:33.100]  And that's an opportunity he's not going to pass up. And if they get a grievance, they
[39:33.100 --> 39:39.900]  have to notify their insurance carrier because if they subsequently get sued over the content
[39:39.900 --> 39:46.380]  of the grievance and they haven't notified the insurance company, they're not covered.
[39:46.380 --> 39:57.340]  So they have to tell on themselves. So grieve them quick, grieve them often, except space
[39:57.340 --> 40:06.620]  them out a week or so, so they don't get lumped together. This lawyer wants to play hardball,
[40:06.620 --> 40:14.980]  introduce him to the deep end of the pool or some other mixed metaphor.
[40:14.980 --> 40:23.420]  In this criminal complaint that I'm going to file against this lawyer, do you have any
[40:23.420 --> 40:30.420]  other charges or crimes that you could think of that may apply? Or do you think just aggravated
[40:30.420 --> 40:34.540]  injury is great enough?
[40:34.540 --> 40:42.280]  There probably are. I'd have to read Michigan law. If it was in Texas, I could call this
[40:42.280 --> 40:53.340]  obstruction of justice. You'd have to read the penal code. You need to read it anyway.
[40:53.340 --> 40:58.540]  You need to read the penal code and the criminal procedure code. They're not that big. You
[40:58.540 --> 41:06.620]  read them twice, you'll know them better than they do. We had Ken from Kansas, he's
[41:06.620 --> 41:15.340]  dropped off. I hope he calls back. Because we gave him the homework to read the codes
[41:15.340 --> 41:22.580]  and the last time he called in, he was reading the codes. If you read those codes, you call
[41:22.580 --> 41:25.700]  back and we'll have a whole different conversation.
[41:25.700 --> 41:32.580]  Now, this is family law, but those guys, they violate laws all the time, especially when
[41:32.580 --> 41:41.300]  they're dealing with the court. And when they misrepresent facts or law to the court, they
[41:41.300 --> 41:51.300]  become very vulnerable. The lawyer is your low hanging fruit. He is terrified of that
[41:51.300 --> 42:00.500]  judge. His problem is, is you're not terrified of the judge. Since you're in there pro se,
[42:00.500 --> 42:10.020]  you expect the judge to rule against you out of hand every turn. You have to expect it.
[42:10.020 --> 42:17.380]  You can't expect to win your case in the trial court. You win your case in the appellate
[42:17.380 --> 42:25.380]  court. Your only purpose in the trial court is to set the record for appeal. Have you
[42:25.380 --> 42:29.700]  been through Dr. Graves' Jurisdictionary?

[42:32.180 --> 42:38.300]  Good. All right then. Now, okay, now you got the tools. Those are the tools you need to
[42:38.300 --> 42:47.700]  beat him up with. Now, it's a matter of getting your head in the right place. You are the
[42:47.700 --> 42:55.060]  most powerful individual in the courthouse. You're the baddest motor scooter in the building.
[42:55.060 --> 43:03.940]  And the reason is you're nobody. You're not a clerk. You're not a bailiff, a prosecutor,
[43:03.940 --> 43:15.140]  a judge or a lawyer. They are all public servants. Even the lawyer is bound to the court. Lawyer
[43:15.140 --> 43:21.260]  is bound to the court more than anybody because he is absolutely terrified of that judge.
[43:21.260 --> 43:28.580]  The judge can sanction him at the drop of a hat. If the lawyer files a motion or a pleading
[43:28.580 --> 43:37.500]  and he has any case law in it, read the case law. They are always screwing up the case
[43:37.500 --> 43:38.500]  law.
[43:38.500 --> 43:42.180]  Yeah, they put it in there and they think nobody's going to look at it. They've misapplied
[43:42.180 --> 43:47.140]  it. They've quoted something that's not on point. Yeah.

[47:28.020 --> 47:36.940]  sanctions and how the lawyers are really scared because the judges can, for any reason, for
[47:36.940 --> 47:45.740]  no reason, just decide on a whim to sanction the lawyers. And it's true, they can. The
[47:45.740 --> 47:50.880]  judge could do that. They usually don't, but it's like Russian roulette. They don't know
[47:50.880 --> 47:55.980]  if the judge is going to do that to them. So when you move for sanctions, it gets all of
[47:55.980 --> 48:04.060]  them tight. And I was just thinking about this over the break. It just occurred to me.
[48:04.060 --> 48:11.060]  I recently moved for sanctions against some, on the opposing counsel, there was lawyers
[48:11.060 --> 48:21.580]  defending lawyers. And I moved for sanctions against the ones who are defending, right?
[48:21.580 --> 48:27.060]  And the defendants themselves. And I just thought about it. The defendants themselves
[48:27.060 --> 48:35.580]  being lawyers, why would I be asking for sanctions for all of them? Defendants and their counsel.
[48:35.580 --> 48:40.140]  Because those defendants knew better. They should have grabbed their attorneys by the
[48:40.140 --> 48:44.700]  neck and said, don't you dare do that. And they didn't. They just let them go ahead
[48:44.700 --> 48:49.620]  and abuse the process. And, oh, abusive process. That's another thing you may want to take
[48:49.620 --> 48:53.900]  a look at and see if Michigan has abusive process as a crime.
[48:53.900 --> 49:04.340]  All right. So there were, I got two more quick things. So, without getting into too many
[49:04.340 --> 49:11.180]  specifics, I filed my complaint. I served the other party with a process server and
[49:11.180 --> 49:22.220]  I did not get an answer in the 21 days. So I wrote up a order and a motion for default
[49:22.220 --> 49:30.460]  and I submitted them or I filed them. Two days passed a lot of time for them to answer.
[49:30.460 --> 49:39.100]  And then I scheduled a hearing and the hearing was like three weeks in the future. And I
[49:39.100 --> 49:48.780]  had been checking the docket online, you know, to look at the event. And I seen an answer
[49:48.780 --> 49:57.100]  magically appear in the system, you know, in the docket and the record, and it was predated.
[49:57.100 --> 50:06.260]  So I'm assuming that her lawyer, because he's like an hour away, faxed it over to the court
[50:06.260 --> 50:13.340]  because there's no online filing system in this county. And it just sat on the, you know,
[50:13.340 --> 50:21.140]  in their file or whatever for a few days before they actually entered it. So I canceled my
[50:21.140 --> 50:30.860]  hearing and I started doing my response. And when I, after I filed that and served them,
[50:30.860 --> 50:38.460]  I again began checking the events in the online system. And there was another thing in the
[50:38.460 --> 50:48.020]  system dated for like a week previously. And I just wanted to know, you know, I wasn't
[50:48.020 --> 50:55.140]  really sure if I could do something for timely filing, like, because I don't think it would
[50:55.140 --> 51:00.380]  really apply to the lawyer. It would more apply to the clerk that they're getting these
[51:00.380 --> 51:03.100]  documents and they're just hanging on to that.
[51:03.100 --> 51:10.740]  Well, wait a minute, wait a minute, something you need to check. If it was faxed, it will
[51:10.740 --> 51:18.420]  have a date that it was faxed. The date the lawyer put on the document, the document doesn't
[51:18.420 --> 51:20.420]  mean anything.
[51:20.420 --> 51:21.420]  Right.
[51:21.420 --> 51:25.300]  What's the date it was faxed?
[51:25.300 --> 51:33.980]  It was faxed for the day after the, the day they wrote it. So one day later, and that's
[51:33.980 --> 51:43.740]  the day that they entered it into the system. But that was still like a week before they
[51:43.740 --> 51:49.060]  actually entered into the online docket system for the event.
[51:49.060 --> 52:00.020]  Okay. So, so clearly the clerk had the documents a day after, you know, you've got until the,
[52:00.020 --> 52:05.420]  like in for most actions and like in the Fed, you've got until the Monday after the 20th
[52:05.420 --> 52:13.380]  day. But if you're a day or two late, the courts, they tend not to want to deny you
[52:13.380 --> 52:20.380]  your day in court. So they're not terribly strict with that. So if they got it in a day
[52:20.380 --> 52:29.020]  after you were, you were correct in withdrawing your, your emotion. But if the clerk has taken
[52:29.020 --> 52:36.100]  a week, that just may be standard. And it's, you're, you're, you're saying that the clerk

[01:05:01.420 --> 01:05:10.260]  specialist. And yet she was notarizing substitution of trustee documents and other things. A little
[01:05:10.260 --> 01:05:16.940]  bit of a conflict of interest, I would think, but apparently Texas says that's okay. However,
[01:05:16.940 --> 01:05:24.820]  the records show there's conversations and documents, so emails and letters going back
[01:05:24.820 --> 01:05:32.260]  and forth, but they're all missing from the folder. They claim they did a very diligent
[01:05:32.260 --> 01:05:39.460]  search and all they could find was what they sent me, which was my complaint and letters
[01:05:39.460 --> 01:05:48.820]  from the investigator to the notary and records of this phone call where after the phone call
[01:05:48.820 --> 01:05:57.060]  from the attorney, they drastically reduced the educational reprimand from having to do
[01:05:57.060 --> 01:06:04.380]  the full notary exam and get a perfect score plus watch the notary video to only watching
[01:06:04.380 --> 01:06:13.980]  the video. Yet they detailed all the things she did wrong. And so I've sent a second,
[01:06:13.980 --> 01:06:19.940]  then I got, after talking with this person at the secretary of state's office, I guess
[01:06:19.940 --> 01:06:27.420]  she got a little bit rattled and I got an email from the council stating that they really
[01:06:27.420 --> 01:06:33.980]  had done a diligent search and no more records could be found. But if I wanted to put in
[01:06:33.980 --> 01:06:44.020]  another request with more specific detail, I could to them. So I did that today. And
[01:06:44.020 --> 01:06:52.060]  my question is to you, what responsibilities does the secretary of state's office, a notary
[01:06:52.060 --> 01:06:59.140]  division or any division, what are their responsibilities for ensuring that documents and complaint
[01:06:59.140 --> 01:07:06.620]  folders are complete at all times? Because it's only the very damning evidence that
[01:07:06.620 --> 01:07:09.380]  is missing from this folder.
[01:07:09.380 --> 01:07:18.860]  Okay, this is serious business. Tamper with the government document is a class A misdemeanor

[01:08:39.620 --> 01:08:46.180]  the affidavit that she was required to produce and her change of address. Then I asked for
[01:08:46.180 --> 01:08:53.860]  the stuff from the attorney and the notary logs. And I put I require to receive a copy
[01:08:53.860 --> 01:09:01.460]  of the notes, the call logs, and or recordings of the call between the attorney and the investigator
[01:09:01.460 --> 01:09:09.860]  and any other electronic communications, including emails between Ms. Zwecki and attorneys McGinnity
[01:09:09.860 --> 01:09:17.220]  and Campanose. So you're saying I should try to ask for the speech with an IT director?
[01:09:17.220 --> 01:09:22.540]  Yeah, because the director has a responsibility to respond to you about those records that
[01:09:22.540 --> 01:09:31.220]  he has. Okay. Those records are not going to be what everybody else typically thinks

[01:21:48.460 --> 01:21:54.540]  so that she gets full custody or gets her way in the court. And yes, it's a tactic.

[01:22:05.060 --> 01:22:17.340]  the person making the accusation, at least during the case as it goes through the court.

[01:22:23.260 --> 01:22:31.980]  lot, and it's across the country, and everybody does this. Or a lot of people do this. Horrible
[01:22:31.980 --> 01:22:40.260]  things do to the family, horrible things do to the kids. But I come back to that I'd
[01:22:40.260 --> 01:22:48.100]  get a charge of conspiracy between that lawyer and the client, and then come up with what
[01:22:48.100 --> 01:22:58.660]  they're conspiring to do as it applies to the law of that state.
[01:22:58.660 --> 01:23:05.740]  So if they're charged with conspiring with one another, you mentioned earlier that they
[01:23:05.740 --> 01:23:13.180]  each had to get a separate lawyer. What is the foundation for that?
[01:23:13.180 --> 01:23:25.060]  Well, if they were charged criminally, if you could make a conspiracy charge that is
[01:23:25.060 --> 01:23:30.900]  a criminal charge, they would have to get separate lawyers.

[01:25:05.300 --> 01:25:09.420]  divorce proceedings, the judge just poo-pooed the whole thing and said, yeah, yeah, everybody
[01:25:09.420 --> 01:25:16.380]  always says this, and didn't treat it like it had any weight. That's how common it
[01:25:16.380 --> 01:25:17.380]  is.
[01:25:17.380 --> 01:25:29.980]  And look, they could go—even the child who's now 13, I believe they could go to the police
[01:25:29.980 --> 01:25:44.940]  department, make a criminal complaint if the person has been abused, and so that then makes
[01:25:44.940 --> 01:25:50.380]  a separate criminal case. But coming back to what I was thinking for this guy is that
[01:25:50.380 --> 01:25:58.140]  he needs to hit him with some charges to where they'd have to go get their own lawyers,
[01:25:58.140 --> 01:26:04.180]  and also making this—see, I don't think that the lawyer could continue to represent
[01:26:04.180 --> 01:26:16.220]  her in the divorce case if he puts out that they're conspiring against him at a criminal
[01:26:16.220 --> 01:26:22.260]  level, you know, making an accus—because what they're accusing him of is a heinous
[01:26:22.260 --> 01:26:38.140]  crime. So again, you'd have to look at the laws of that state and see what—an example
[01:26:38.140 --> 01:26:46.940]  would be in my case, the criminal case I had, when the prosecuting deputy attorney has me
[01:26:46.940 --> 01:26:51.840]  in the hallways talking to me, and then I bring up the fact that they put in writing
[01:26:51.840 --> 01:26:58.940]  that they wouldn't put me in jail if I dropped the civil lawsuit from my house. And he threatens
[01:26:58.940 --> 01:27:04.700]  me right there on the spot with, if you bring that up again, I'm going to add six more
[01:27:04.700 --> 01:27:13.700]  felony counts. Well, first off, he's not supposed to be talking to me directly. And
[01:27:13.700 --> 01:27:29.140]  by doing that, he's tampering with a witness and witness intimidation, just as an example.
[01:27:29.140 --> 01:27:35.260]  And those were the things that I put into the bar on that particular attorney. And by
[01:27:35.260 --> 01:27:41.540]  the way, yes, the bar is not going to do anything. And also, another suggestion for this guy,
[01:27:41.540 --> 01:27:49.260]  have other people that know him make the bar complaint, too, saying this is outrageous
[01:27:49.260 --> 01:27:53.940]  that this lawyer put this in this pleading, that they know this man personally, they know
[01:27:53.940 --> 01:28:03.260]  the family, they've been to the house, and this is not in his character or whatever.
[01:28:03.260 --> 01:28:08.020]  But the lawyer should have known—the lawyer didn't know investigation, just makes it—I
[01:28:08.020 --> 01:28:16.380]  imagine what happened here is he took a statement. He probably has a declaration from the client
[01:28:16.380 --> 01:28:20.260]  saying that she believes of the abuse, and then he put it in the—the lawyer put it
[01:28:20.260 --> 01:28:26.460]  in the pleading as well. That's probably how it's fashioned. And then when it comes
[01:28:26.460 --> 01:28:34.220]  to this whole thing about filing, how come the lawyer is not serving him all papers that
[01:28:34.220 --> 01:28:44.780]  are being filed with the court? He shouldn't have to be looking at a log of the court to
[01:28:44.780 --> 01:28:51.460]  see what papers are being filed by the other side. He should be getting personally served
[01:28:51.460 --> 01:28:58.260]  on all this. And he probably has the answers because he did say he's been through jurisdictionary.
[01:28:58.260 --> 01:29:02.500]  And then the same goes for—I don't know in Texas how they get away with saying that
[01:29:02.500 --> 01:29:09.260]  they sent you an email unless you accept email service, you know, that they can't call
[01:29:09.260 --> 01:29:12.660]  you to court or tell you have a court date via email.

[01:29:38.460 --> 01:29:44.420]  about it? Well, I was checking the record. He said, you have substantive notice. You

[01:34:41.260 --> 01:34:53.420]  it's really a big deal. And the fact that lawyers accuse them out of hand lessens the
[01:34:53.420 --> 01:34:58.140]  impetus of the police and everybody else to take this serious.
[01:34:58.140 --> 01:35:04.820]  Yeah. It starts to be like the boy who cried wolf. But you can't afford to ignore it because

[01:35:40.460 --> 01:35:45.620]  all the time we're talking about this, I'm thinking, well, what if Earl's not what he
[01:35:45.620 --> 01:35:54.500]  claims to be? And here we're working to help the bad guy get away.
[01:35:54.500 --> 01:35:59.740]  But then again, if Earl is what he claims to be, then these people are trying to ruin
[01:35:59.740 --> 01:36:08.700]  his life. And we need to find some way to deal with this. This is the kind of thing
[01:36:08.700 --> 01:36:17.700]  that needs to get a thorough police investigation every time. And if it's found that the accusation
[01:36:17.700 --> 01:36:25.020]  is not true, whoever made that accusation should get hammered big time.
[01:36:25.020 --> 01:36:32.520]  Because this is hardest on the children. Now, I feel for Earl if he's innocent because it's
[01:36:32.520 --> 01:36:44.060]  hard on him. It taints him. And he's always damaged by it because once it's out there,
[01:36:44.060 --> 01:36:48.900]  there are people who will always believe that that's the case no matter how it's proven
[01:36:48.900 --> 01:37:00.700]  not to be. So he's stained by it. But on the off chance, he really is a bad guy. Now we've
[01:37:00.700 --> 01:37:10.620]  got the child being harmed by it. And for me, that's a bigger deal. So I'm a grandpa
[01:37:10.620 --> 01:37:15.940]  and it gives me the chills just thinking about it.
[01:37:15.940 --> 01:37:27.420]  This is really a hard one. When this kind of claim is made, it should get serious scrutiny.
[01:37:27.420 --> 01:37:38.740]  And whoever the bad guy is should get hammered big time. I just watched a YouTube video about
[01:37:38.740 --> 01:37:50.580]  a guy who killed his daughter's boyfriend who sold her to a sex slave ring. First he
[01:37:50.580 --> 01:37:56.540]  tracked him down, got his daughter back. Then he tracked down the boyfriend and beat him
[01:37:56.540 --> 01:38:10.060]  up and bashed his head in with a concrete block. So what do you do? The guy went to
[01:38:10.060 --> 01:38:19.380]  jail for a while but not as long as he could have. Is he really the bad guy? And how bad
[01:38:19.380 --> 01:38:29.220]  is he? They actually showed the one, I saw it live, where this karate instructor was
[01:38:29.220 --> 01:38:36.780]  molesting this boy and they brought him to New Orleans in the airport. This guy was standing
[01:38:36.780 --> 01:38:45.300]  by a phone and they walked by and he turned around and put one in the guy's temple. And
[01:38:45.300 --> 01:38:54.420]  he never spent any time in jail. So this is a hard subject and it makes me uncomfortable
[01:38:54.420 --> 01:39:02.700]  to have to deal with it but we really do need to deal with this. And for a lawyer who would,
[01:39:02.700 --> 01:39:10.940]  if the lawyer put his wife up to this, the lawyer should go to prison. Not just get disbarred
[01:39:10.940 --> 01:39:23.940]  but go to prison. This is heinous. And that's my story and I'm sticking to it. Ted, what's
[01:39:23.940 --> 01:39:27.460]  your opinion?
[01:39:27.460 --> 01:39:33.780]  I don't disagree with anything that you said. I just went on the premise, took the man at

[01:39:42.380 --> 01:39:51.340]  job here. At the end of the day, what we're doing is just examining the legal ramifications.

[01:39:57.900 --> 01:40:05.820]  call in, I got drunk and I had a wreck and they're trying to persecute me and they're
[01:40:05.820 --> 01:40:13.180]  picking on me. And I want to say they should throw you under the jail. But that's not what
[01:40:13.180 --> 01:40:23.860]  I'm here to do. I'm here to take that on face and address the legal issues. And I do recognize
[01:40:23.860 --> 01:40:34.100]  how hard this is because lawyers do use this to demonize fathers and ruin their lives.
[01:40:34.100 --> 01:40:42.020]  I have a personal friend who is struggling. He's divorced and his wife is turning the
[01:40:42.020 --> 01:40:54.260]  kids against him. And he's just beside himself. And all I could tell him was, be patient.
[01:40:54.260 --> 01:41:02.900]  Your children are young for a very short time. And whatever your wife tells them that poisons
[01:41:02.900 --> 01:41:08.540]  them against you, they'll get older and sort that out so long as you're always there for
[01:41:08.540 --> 01:41:21.580]  them, no matter what. And he was talking about, what is it when you give up all of your parental
[01:41:21.580 --> 01:41:31.540]  rights, there's a term for it. He was wondering, what are you saying? Terminate? Yeah, I think
[01:41:31.540 --> 01:41:42.380]  he had another word for it. But I wanted to say to him, don't. Whatever your wife is
[01:41:42.380 --> 01:41:53.500]  doing, deal with it. Whatever you do, do not abandon those children. And terminating your
[01:41:53.500 --> 01:42:00.940]  parental rights to them, they will perceive it as abandoning them. Yeah, you and your
[01:42:00.940 --> 01:42:07.780]  wife are having difficulties, but the kids didn't do that. That was you and your wife.
