[10:41.880 --> 10:49.000] Then a week later, after I did that, that was last Friday, a week later, which is today,
[10:49.000 --> 10:55.600] I got a call from the municipal court and they said they were dropping all the charges.

[13:06.360 --> 13:14.720] That's the only place I can find where a magistrate is authorized to issue a warrant is after an
[13:14.720 --> 13:16.720] examining trial.
[13:16.720 --> 13:27.840] So, is there any other place in Texas law wherein anyone is authorized to issue an arrest
[13:27.840 --> 13:28.840] warrant?
[13:28.840 --> 13:42.040] There is one place, there's one place and that's 28.304 that says that when an indictment
[13:42.040 --> 13:48.680] is brought to the clerk, if the person hasn't been arrested, the clerk shall issue a tapias
[13:48.680 --> 13:50.680] warrant.
[13:50.680 --> 13:57.960] She can't make a note of the true bill in the court record until the person's been
[13:57.960 --> 13:58.960] arrested.
[13:58.960 --> 14:06.120] She must issue a tapias warrant once the person has been arrested, then she may enter the

[20:52.560 --> 20:59.320] but in reading the rest of the code, what Brent's just read, that only applies if a

[21:03.200 --> 21:10.520] What you're talking about, 15.09, seems to continue to be valid because it's talking

[22:42.160 --> 22:51.320] that criminal accusation and where is he authorized to do so and under what specific circumstance?
[22:51.320 --> 22:58.880] That's giving me a headache.
[22:58.880 --> 23:06.760] We have spaces where they're authorized to issue, but those are in special cases.
[23:06.760 --> 23:16.800] Here where a complaint is made, where is a magistrate commanded to take some action based

[24:03.000 --> 24:11.560] Well, they accept what the policeman says out of hand and are not required by 15.17

[34:59.760 --> 35:02.480] a warrant and forwarding a complaint?
[35:02.480 --> 35:08.800] Well, sure, it's just saying in 1509, you've been excited about this 1509 because it puts
[35:08.800 --> 35:11.080] a duty squarely on the judge.
[35:11.080 --> 35:18.040] When he receives this complaint, then he has a duty to perform.
[35:18.040 --> 35:23.440] And it says a complaint in accordance with 1505, so that talks about the sufficiency
[35:23.440 --> 35:29.720] of the complaint, may be forwarded as provided by 1508 to any magistrate in the state.
[35:29.720 --> 35:35.640] Well, the as provided by 1508 is the one right above it where it's talking about a warrant

[35:36.640 --> 35:41.440] And we don't have to worry about the warrant being forwarded because it's not, we're talking

[35:52.880 --> 35:59.680] Yeah, so we're not talking about warrant or complaint, we're talking about procedure.

[56:42.020 --> 56:47.020] So if the question of jurisdiction never comes up

[56:50.020 --> 56:53.020] Even if the judge didn't have jurisdiction
[56:53.020 --> 56:55.020] If you didn't challenge it
[56:55.020 --> 56:59.020] He can act as if he has
[56:59.020 --> 57:04.020] Because jurisdiction is presumed
[57:04.020 --> 57:08.020] As long as you meet the statutory jurisdictional requirements
[57:08.020 --> 57:13.020] And that generally goes to geography
[57:13.020 --> 57:20.020] Are you physically within the jurisdictional boundaries of this court?
[57:20.020 --> 57:26.020] Beyond that, if you are within the boundaries
[57:26.020 --> 57:29.020] Then it is presumed that the court has jurisdiction

[57:32.020 --> 57:36.020] The court has to prove up their jurisdiction
[57:36.020 --> 57:38.020] So always challenge jurisdiction
[57:38.020 --> 57:43.020] If a judge acts without subject matter jurisdiction
[57:43.020 --> 57:46.020] He acts on his own
[57:46.020 --> 57:53.020] As a private person and has zero immunity
[57:53.020 --> 57:55.020] So if you can find him outside
[57:55.020 --> 57:57.020] Even if he's not really outside
[57:57.020 --> 58:00.020] But you can make it look like he is
[58:00.020 --> 58:07.020] You can put him at a position of running the risk of being personally liable

[01:10:43.020 --> 01:10:49.020] One of the two times you can sue a judge
[01:10:49.020 --> 01:10:51.020] The other time you can sue a judge
[01:10:51.020 --> 01:10:57.020] Is when a judge fails to perform a duty he is required to perform
[01:10:57.020 --> 01:11:02.020] When subject matter jurisdiction is challenged
[01:11:02.020 --> 01:11:10.020] The judge is commanded to schedule a hearing
[01:11:10.020 --> 01:11:15.020] Wherein the judge is required to prove up jurisdiction
[01:11:15.020 --> 01:11:21.020] Not the opposing party
[01:11:21.020 --> 01:11:26.020] And if he fails to do so, he doesn't have jurisdiction

[01:53:47.020 --> 01:53:58.020] They bring your own phone and some things and then they get you to pay off your own account and pay off even the same phone for your own company.
[01:53:58.020 --> 01:54:09.020] And then they inform you after you do that that you must upgrade your Internet service, which is an extra $34.99 a month.
[01:54:09.020 --> 01:54:18.020] The existing phone that they provided you with the other plan no longer is compatible with that.
[01:54:18.020 --> 01:54:30.020] And so they upsell people to buy new phones that are compatible with the new promotion of buy one, get one free in this instance.
[01:54:30.020 --> 01:54:42.020] And it was just, you know, and then it was just so much upselling and jumping around and then calling customer service.
[01:54:42.020 --> 01:54:57.020] And they have no accountability as far as, you know, who they are, where they're from and notice that they bounce a customer around and especially to a state.
