[08:02.760 --> 08:15.640]  public officials to do something wrong you know we have our legislature we the people through our
[08:15.640 --> 08:23.960]  legislature have set up a lot of rules on how we expect our public officials to behave we say hey
[08:23.960 --> 08:30.280]  we want you to be transparent with records we're going to allow you to take care of our records
[08:30.280 --> 08:34.920]  for us we're going to hire you you're going to get a paycheck and you're going to take care of
[08:34.920 --> 08:40.600]  our records and whenever we want to see these records we're going to come to you and ask to
[08:40.600 --> 08:47.800]  see them and you are going to bend over backwards and be as transparent as possible somehow they
[08:47.800 --> 08:55.000]  don't excel at that part very often and it doesn't take long if you're curious about something

[09:37.320 --> 09:43.880]  to go in the category of a records request but these people today wanted to act like it is
[09:43.880 --> 09:51.960]  is and so they wanted to charge me for per page copies of it well i didn't want to fumble around
[09:51.960 --> 09:56.840]  with any cash at the moment i wanted to go ahead and get into that courtroom because i thought hey
[09:56.840 --> 10:05.960]  they're about to start i'll uh check on that later but yeah so i so the lady told me we don't

[13:00.600 --> 13:06.760]  litigating and we're in discovery and the other three were still in the pleading phase they've
[13:06.760 --> 13:18.120]  answered and then i'm set to reply we had one mediation which we got very close um but we didn't
[13:19.320 --> 13:24.360]  end up settling and that was and that's why i was kind of getting wanting maybe a little your
[13:24.360 --> 13:35.880]  opinion because the four that are in discovery we have a lot of motions and actually the motions
[13:35.880 --> 13:42.360]  have now been kind of sitting for like 20 days i've had a couple things happen so i had to um
[13:42.360 --> 13:47.400]  you know family type of emergency well i don't know if they're emergencies but priorities
[13:48.120 --> 13:56.040]  and so i had to kind of stop the the action for a few weeks and so now i'm ready to get back in
[13:56.040 --> 14:05.640]  the but it's it's i'm quickly seeing how i'm just kind of getting buried with so many
[14:06.520 --> 14:14.840]  um actions and then all the different like it's very hard to keep up um with you know especially
[14:14.840 --> 14:21.400]  in the discovery because they're they're like not answering things or they're answering a handful of
[14:21.400 --> 14:27.320]  things and there's there's not like my they haven't answered any of my interoperability and just the
[14:27.880 --> 14:36.120]  the different motions we have in i have actually um i talked to uh uh james he he was kind enough
[14:36.120 --> 14:41.480]  and kind of advised me and really thinks that i should focus on my federal suit against them
[14:42.280 --> 14:47.480]  getting that written and and that that'll be that and that i'm getting a bit distracted by
[14:47.480 --> 14:55.320]  having so much uh you know following through with these mandamus um for the public record so i do
[14:55.320 --> 15:04.200]  think that that is my main goal is to try to just get these through like don't spend all my
[15:05.240 --> 15:10.040]  brain cells and effort like trying to follow track them down and everything so i had that

[15:16.440 --> 15:25.000]  a second mediation and they did agree to that okay so well i can't say i have much of an opinion

[15:54.920 --> 16:03.960]  the federal level to um to indicate that you've you've explored every avenue of remedy and you're
[16:03.960 --> 16:14.200]  coming to them last uh so you might consider that it sounds let me just make one um remark about
[16:14.200 --> 16:23.960]  your you're in ohio and a mandamus there sounds much more involved than i would expect maybe it's
[16:23.960 --> 16:31.560]  just ohio you have discovery going on interrogatories you have uh motions in connection with the mandamus
[16:31.560 --> 16:38.600]  and that's um it's like it's its own civil suit so that sounds very very involved
[16:41.640 --> 16:50.600]  when i in texas we we just lob a grenade to the attorney general we say it's basically a one-page
[16:50.600 --> 16:56.520]  criminal complaint and that's it so let's talk some more about those differences after we come

[22:11.080 --> 22:17.640]  once you've exhausted all of your options in the state how would you describe or where do you draw
[22:17.640 --> 22:24.920]  that line okay what i generally try to do is get the state to screw up all it can
[22:24.920 --> 22:31.720]  before i go to the fed i want to give the state every opportunity that i can and the fed is going
[22:31.720 --> 22:38.440]  to want to know did you exhaust all of your available remedies and when i go there i want
[22:38.440 --> 22:44.200]  to be able to tell him yes i have and if he the case you have here is not inherently federal
[22:46.040 --> 22:52.600]  inherently a state issue it's open records that's you're asking for state records
[22:52.600 --> 23:00.360]  you're asking for state records that's purely state how would you get from the state to the fed
[23:01.560 --> 23:08.600]  so my fed suit is for a deprivation of rights and a first amendment retaliation and the
[23:08.600 --> 23:16.680]  so it wouldn't be for what they're doing now except maybe um maybe there's some deprivation
[23:16.680 --> 23:22.680]  of rights just in the fact of them you know obstructing justice and with hold on hold on hold
[23:22.680 --> 23:35.160]  on uh we were speaking to a state suit being removed to the fed or a state action moved to
[23:35.160 --> 23:44.440]  the fed so you already have a case in the fed is that correct no i don't i what i'm saying is that
[23:44.440 --> 23:54.360]  instead of focusing my energy on fighting them on the public records violation to switch my focus
[23:56.200 --> 24:00.440]  for writing my federal lawsuit and getting that in front of them because they've already made me an
[24:00.440 --> 24:08.680]  offer on to get rid of me over the the mandamus public records violations and i have a strong
[24:08.680 --> 24:15.640]  um retaliation case and the the public records are just connected to help prove my case more
[24:16.440 --> 24:20.600]  um and they're fighting me a lot on giving me those records which is why i'm kind of stuck
[24:20.600 --> 24:29.000]  over here in the appeals court trying to litigate that but um it's becoming apparent that
[24:29.000 --> 24:39.480]  how important is that appeals case to you how important is this case are these cases

[27:00.280 --> 27:10.280]  fights most important to you yeah above all don't be like you're bailing out because you take a deal

[27:17.800 --> 27:25.240]  money next fight you have with them they've already paid your way right yeah that's what
[27:25.240 --> 27:32.280]  i'm thinking so now my now i'm kind of switching gears to um to negotiation strategies or you know
[27:32.280 --> 27:39.160]  how to um you know because we got really close last time but i i was kind of stubborn and
[27:39.160 --> 27:46.600]  wouldn't budge off of one number which i think it'll all work out but so now i'm thinking you

[52:49.960 --> 52:58.920]  on the lawyer yeah you know and that's what i was now i have to look at back very good point

[01:41:22.320 --> 01:41:31.320]  And you've got these cops down here, a whole bunch of them with loudspeakers, trying to talk him into coming down
[01:41:31.320 --> 01:41:38.320]  And I watched this and I was surprised, nobody's threatening him, nobody's pulling guns
[01:41:38.320 --> 01:41:43.320]  They're genuinely trying to talk him down off this bridge
[01:41:43.320 --> 01:41:47.320]  But his big complaint is the family law system
[01:41:47.320 --> 01:41:53.320]  The guy who brought me down there wanted me to take on a family law judge
[01:41:53.320 --> 01:42:01.320]  Because the family law judge had given custody of his son to his son's mother
[01:42:01.320 --> 01:42:07.320]  And I listened to him and he told me the whole story
[01:42:07.320 --> 01:42:15.320]  And I thought, man, if I was the judge, I wouldn't give kids to this crazy person either
[01:42:15.320 --> 01:42:25.320]  I just did a horrible quandary, he wanted me to go after the judge and I refused
[01:42:25.320 --> 01:42:33.320]  So I had to do some seminars to get enough money to be able to get back home
[01:42:33.320 --> 01:42:39.320]  Family law is a beast and I wouldn't be going here with you
[01:42:39.320 --> 01:42:47.320]  Except that you kind of did everything right
[01:42:47.320 --> 01:42:52.320]  You didn't give me the impression that you think everybody's a criminal
[01:42:52.320 --> 01:42:58.320]  And everybody's picking on me and we're being singled out for special persecution

[01:49:46.320 --> 01:50:00.320]  And the idea of asking the DA to ask the judge to appoint a guardian ad litem for this person because she has no one to speak for her
[01:50:00.320 --> 01:50:10.320]  She has someone who would speak for her, but you're not in a position to be appointed guardian ad litem
[01:50:10.320 --> 01:50:22.320]  Ask him to appoint a cousin or anyone. There are people out there who the courts use for this purpose of professionals
[01:50:22.320 --> 01:50:33.320]  It's kind of like an ombudsman. An ombudsman is if you've got a company that's highly regulated by the government
[01:50:33.320 --> 01:50:39.320]  Like your church companies or the electric company, it's a real complex business

[01:51:56.320 --> 01:52:02.320]  So how do we craft a solution? Ask the prosecutor, how do we craft a solution?
[01:52:02.320 --> 01:52:08.320]  Tell him that you've got a cousin here who may well act as guardian at Lido
[01:52:08.320 --> 01:52:16.320]  If not, don't you have professionals who could act as a guardian at Lido for this person
[01:52:16.320 --> 01:52:27.320]  and stand in for her in court or other circumstances where she may need expert assistance so that we can find the best outcome
[01:52:27.320 --> 01:52:33.320]  Regardless of how this affects the mother, at the end of the day this is going to dramatically affect the children
[01:52:33.320 --> 01:52:39.320]  and we want to lower the negative impact on the children as much as possible
[01:52:39.320 --> 01:52:50.320]  You're likely to get a prosecutor who will be your champion because he doesn't get to be the good guy very often
[01:52:50.320 --> 01:53:03.320]  Nobody likes to be the bad guy all the time. I've seen prosecutors that I personally knew get extremely bitter
[01:53:03.320 --> 01:53:10.320]  because they always got to be the bad guy. To give them an opportunity to step up and be the good guy I do
