[04:47.000 --> 04:50.720]  I had planned on to do that for a long time.
[04:50.720 --> 04:58.920]  I'm suing him because of harm caused by his mask issues.
[04:58.920 --> 05:03.640]  Have someone I'm helping prepare a suit for, and I joined in the suit with her.
[05:03.640 --> 05:05.920]  She went to Nordstrom Rack.
[05:05.920 --> 05:16.840]  This was months before the governor rescinded his mask requirements and called beforehand
[05:16.840 --> 05:23.640]  because she had issues and couldn't wear a mask, and they assured her it would be fine.
[05:23.640 --> 05:29.240]  They honored medical exemptions.
[05:29.240 --> 05:35.960]  She went to Nordstrom Rack and wound up with a security officer who she didn't know was
[05:35.960 --> 05:42.400]  a security officer, given her a hard time, grabbed her arm so hard she left her fingerprints
[05:42.400 --> 05:44.680]  in bruises on her arms.
[05:44.680 --> 05:59.520]  So carried jerk loose and went into one of the changing rooms locked door called 911.
[05:59.520 --> 06:06.080]  Arrested her, instead of her dressing her 911 issue, put her in a car, hot box turned darn
[06:06.080 --> 06:07.680]  near killed her.
[06:07.680 --> 06:13.600]  A bystander watching went over and ordered the police to get her out of the car because
[06:13.600 --> 06:17.680]  she was banging her head on the window to get somebody's attention.
[06:17.680 --> 06:21.200]  And by the time they got her out, she was going into heat stroke.
[06:21.200 --> 06:23.800]  They called paramedics.
[06:23.800 --> 06:27.960]  They got her temperature under control.
[06:27.960 --> 06:36.080]  And then the policeman, once he figured out he had screwed up really bad, went into Nordstrom
[06:36.080 --> 06:37.080]  Rack.
[06:37.080 --> 06:40.920]  Now, with this security officer called 911.
[06:40.920 --> 06:45.720]  She told the 911 operator she did not want to file criminal charges.
[06:45.720 --> 06:49.440]  Just wanted the person removed.
[06:49.440 --> 06:53.280]  All right, say that again.
[06:53.280 --> 06:54.720]  She wanted the person removed.
[06:54.720 --> 06:57.920]  What you're going to cut out.

[07:01.920 --> 07:06.840]  So you said she wasn't going to file criminal charges.
[07:06.840 --> 07:09.000]  She just wanted the person removed.

[07:10.000 --> 07:17.080]  Well, the officer realized he had screwed up because he didn't have any reason to arrest
[07:17.080 --> 07:18.080]  her.
[07:18.080 --> 07:20.640]  They had put her in the patrol car so they could search her car.
[07:20.640 --> 07:22.480]  They had no cause for all of that.
[07:22.480 --> 07:31.480]  So he went back into Nordstrom Rack and pressured the security officer to file criminal charges.
[07:31.480 --> 07:36.400]  So the security officer capitulated, filed criminal charges.
[07:36.400 --> 07:40.240]  They arrested her, well, they gave her a citation and let her go home.
[07:40.240 --> 07:44.640]  And then prosecuted her for two years, forced her to come into court.
[07:44.640 --> 07:53.160]  And for two years, offered her a deal and I gave her my 16, 17 and speedy trial motions.
[07:53.160 --> 07:55.440]  They were before the court.
[07:55.440 --> 08:00.800]  They refused to hear any of them and after two years, they dismissed the case.
[08:00.800 --> 08:02.840]  Look for it.
[08:02.840 --> 08:03.840]  Lack of evidence.
[08:03.840 --> 08:08.400]  I don't know what they were thinking.
[08:08.400 --> 08:14.560]  Generally the prosecutor, if he wants to dismiss the case, he will dismiss the case in the
[08:14.560 --> 08:15.560]  entry.
[08:15.560 --> 08:18.480]  He'll ask the judge to dismiss the case in the interest of justice.
[08:18.480 --> 08:22.640]  But for some reason they dismissed for lack of evidence.
[08:22.640 --> 08:25.720]  Well, that does not look good on them.
[08:25.720 --> 08:29.720]  Oh, no, it does not because they did not.
[08:29.720 --> 08:35.240]  The first time she was ordered to appear at the court, they did not hold an examining
[08:35.240 --> 08:36.240]  trial.
[08:36.240 --> 08:41.520]  And even if they were going to pretend like they had a case commenced and they were going
[08:41.520 --> 08:45.120]  to pretend like they had already followed due process, they should have at the very
[08:45.120 --> 08:49.840]  least recognized at that point, lack of evidence.
[08:49.840 --> 08:53.400]  They could care less if there was evidence or not evidence.
[08:53.400 --> 09:03.960]  And that's the accusation I'm making that everybody's doing it wrong.
[09:03.960 --> 09:11.640]  And it's not just that everybody's doing it wrong, they're all doing it wrong in exactly
[09:11.640 --> 09:12.640]  the same ways.
[09:12.640 --> 09:15.560]  So how does that work?
[09:15.560 --> 09:21.920]  How does it happen that every policeman in the state of Texas decides all on his own
[09:21.920 --> 09:30.800]  that he will ignore the requirement of 14.06 and 15.16, and arrest someone and take them
[09:30.800 --> 09:33.280]  directly to jail and stitches to the nearest magistrate?
[09:33.280 --> 09:35.880]  How the heck does that happen?
[09:35.880 --> 09:40.800]  It's bad training, but it's diabolical, intentional bad training.
[09:40.800 --> 09:47.640]  Oh, yeah, yeah, that was kind of a rhetorical question because we know the answer.
[09:47.640 --> 09:56.720]  Well, I mentioned on this show last time a statute that I hadn't seen before, 17.024.
[09:56.720 --> 10:02.920]  Brett, while I was talking about it, you look it up and found that it was just passed
[10:02.920 --> 10:07.440]  into law at the last legislative session.
[10:07.440 --> 10:12.440]  Well, that was really interesting.
[10:12.440 --> 10:25.640]  Because it directed the auction court administration in conjunction with the court of criminal
[10:25.640 --> 10:38.880]  appeals to develop curricula for a curriculum for magistrates in the setting of bail and
[10:38.880 --> 10:43.640]  other duties.
[10:43.640 --> 10:48.680]  And that they were to prepare an eight-hour course and a two-hour course, and they listed
[10:48.680 --> 10:56.480]  a whole bunch of agencies for the state of Texas that were required to give these courses.
[10:56.480 --> 11:08.840]  But they didn't prepare a set of curriculum for the setting of bail and other magistrates
[11:08.840 --> 11:10.960]  for administrative duties.
[11:10.960 --> 11:19.560]  What they did instead was created an ongoing criminal conspiracy and conspired with every
[11:19.560 --> 11:29.120]  magistrate in the state of Texas to obstruct justice, deny due process, and essentially
[11:29.120 --> 11:40.080]  create an ongoing criminal enterprise in the form of a street gang as defined by 71.01
[11:40.080 --> 11:45.440]  Texas Code of Criminal Procedure.
[11:45.440 --> 11:56.880]  And in as much as this requirement under 17.024 is not a judicial duty, it is an administrative
[11:56.880 --> 12:06.160]  burial duty, preparing training can hardly be construed as judicial, it is an administrative
[12:06.160 --> 12:15.800]  duty and in as much as it is an administrative duty, there is no immunity for anybody.
[12:15.800 --> 12:22.160]  So I'm suing every member of the Texas Code of Criminal Appeals as a director of the Office
[12:22.160 --> 12:29.120]  of Court Administration, and the director of each of these other agencies named in the
[12:29.120 --> 12:30.120]  17.04.
[12:30.120 --> 12:39.680]  I have this up, I'm bringing up 17.04, if I can get to it.

[13:26.880 --> 13:33.600]  duties, including duties with respect to setting bail in criminal cases.
[13:33.600 --> 13:43.680]  And then it says, notwithstanding, office, the office shall provide a method of certifying
[13:43.680 --> 13:51.320]  that a, let me hear this, here it is, paragraph D, any course developed or approved by the
[13:51.320 --> 13:58.360]  Office under this article may be administered by the Texas Court Training Center, the Texas
[13:58.360 --> 14:03.760]  Municipal Courts Education Center, the Texas Association of Counties, Texas Center for
[14:03.760 --> 14:08.960]  the judiciary, or a similar.
[14:08.960 --> 14:13.120]  Yeah, a similar entity.
[14:13.120 --> 14:17.360]  It kind of cut out, Randy, I might adjust your cable there.

[14:47.480 --> 14:54.560]  the Court of Criminal Appeals, the Director of every agency named here, and any other

[15:31.560 --> 15:39.400]  suit is because in subsection A, it says that they are supposed to be, it says the Office
[15:39.400 --> 15:46.240]  of Court Administration shall in consultation with the Court of Criminal Appeals develop
[15:46.240 --> 15:48.400]  or approve all of this training.
[15:48.400 --> 15:54.400]  So the Court of Criminal Appeals is inextricably related.
[15:54.400 --> 15:57.440]  Well, am I on?

[16:25.040 --> 16:30.640]  and they have zero immunity.
[16:30.640 --> 16:35.200]  So I'm suing all of them and I'm also suing the Governor.

[20:38.640 --> 20:52.880]  I am essentially moving from exclusively criminal to using the criminal to enhance civil actions.
[20:52.880 --> 21:00.880]  And in researching civil litigation I came across something very interesting, Brett
[21:00.880 --> 21:03.280]  have you ever heard of the Stowers Doctrine?
[21:03.280 --> 21:04.280]  Stowers?
[21:04.280 --> 21:06.840]  No, I've not.
[21:06.840 --> 21:10.040]  STOWERS Doctrine.
[21:10.040 --> 21:21.160]  It was pioneered in Texas and what the Stowers Doctrine is is you send a tort letter to the
[21:21.160 --> 21:36.080]  potential defendant, notice them of your intent to sue and request a Storrs Agreement and what
[21:36.080 --> 21:45.720]  the Stowers Agreement is, is you agree to pay me the full limit of your insurance or bond
[21:45.720 --> 21:51.400]  and I won't sue you or if I've already sued I will drop the suit against you.
[21:51.400 --> 22:02.040]  If you don't under the Stowers Doctrine and I win a court, this is to the insurance company.
[22:02.040 --> 22:05.480]  We ask the insurance company to settle.
[22:05.480 --> 22:13.400]  If the insurance company doesn't settle and we win, if we win more than the maximum limit
[22:13.400 --> 22:21.440]  of the insurance, they have to pay the full amount.
[22:21.440 --> 22:25.400]  So you put them on the dime.
[22:25.400 --> 22:34.800]  If it's not the full amount, whatever you ask for as a settlement and if they don't
[22:34.800 --> 22:42.800]  accept it and you win, they have to pay you that amount even if it is over the limit of
[22:42.800 --> 22:47.360]  their insurance, of your coverage.
[22:47.360 --> 22:57.720]  So remember we talked earlier about when you sue a lawyer, it's just like if you get in
[22:57.720 --> 23:03.920]  a car wreck, your insurance company comes in and takes over things and now I understand
[23:03.920 --> 23:11.040]  why it's the Stowers Doctrine because the insurance company is now at risk beyond the
[23:11.040 --> 23:16.200]  limits of their coverage.
[23:16.200 --> 23:22.040]  And one lawyer told me that if somebody, the lawyer gets sued, they tell their insurance
[23:22.040 --> 23:26.880]  company just pay them off and this is the reason.
[23:26.880 --> 23:32.080]  If you don't pay them off, they're going to drag me through the courts and then if
[23:32.080 --> 23:41.560]  they, because of that, because you didn't pay them off, now it's, if they win at all,
[23:41.560 --> 23:45.800]  you have to pay the full amount of the coverage.
[23:45.800 --> 23:52.160]  So if I win and I don't win more than the coverage, if I get this right, they still
[23:52.160 --> 23:54.080]  have to pay the amount of the coverage.
[23:54.080 --> 23:58.040]  I'll have to research it a little bit more to be sure of the specific details.
[23:58.040 --> 24:02.240]  That sounds pretty scary for them.
[24:02.240 --> 24:06.920]  Yeah, it puts them on the dime and that's why an insurance company will settle your
[24:06.920 --> 24:11.760]  claim, you know, say if you hit somebody else and they're claiming a whole bunch of money
[24:11.760 --> 24:16.040]  and you're saying they're full of BS that this will go against my records or don't

[27:22.200 --> 27:35.240]  So Nordstrom Rack is looking at 20% of their cost on an object as 20% of the retail price

[27:53.440 --> 27:56.200]  And if you wanted a coupon, you come to his site, you can find his coupon.

[28:02.320 --> 28:10.640]  So that means Nordstrom Rack is spending a very large amount of money on advertising.

[39:08.760 --> 39:14.000]  And I filed the adversary proceeding on the very last day that I was allowed to.
[39:14.000 --> 39:20.400]  And three and a half years later, we were ready for trial next week and this week on
[39:20.400 --> 39:24.320]  Wednesday we had the pre-trial hearing.
[39:24.320 --> 39:28.840]  And of course, in December, the judge wrote an order of what we had to do.
[39:28.840 --> 39:38.560]  He ordered us to file a pre-trial stipulation and order in to follow Judge De Zolo's instructions
[39:38.560 --> 39:41.920]  and to have it filed by February 8th.
[39:41.920 --> 39:46.880]  And we were ordered to appear in person, everybody yesterday.
[39:46.880 --> 39:51.160]  Well I went ahead and I read the rules over and over again.

[39:58.480 --> 40:05.640]  one heck of an education the last three and a half years in this case because do not file

[40:14.040 --> 40:22.120]  We did see off two attorneys which is surprising mostly because their client was non-corporative,

[40:38.160 --> 40:43.080]  not respond, I mean not at all.
[40:43.080 --> 40:50.480]  And so I filed a unilateral stipulation, I filed a proposed order, they filed a response
[40:50.480 --> 40:55.400]  way, way, way late asking for an extension of time.
[40:55.400 --> 41:04.400]  I filed a rebuttal to that, you know, within a day and then magically two nights before
[41:04.400 --> 41:11.440]  the pre-trial hearing they filed a response to our separate pre-trial stipulation and
[41:11.440 --> 41:18.560]  all they did was the first two questions they put not contested which was they filed a bankruptcy
[41:18.560 --> 41:22.840]  and I filed the adversary proceeding, everything else they filed contested.
[41:22.840 --> 41:31.760]  They wrote, they just hand wrote it and they, you know, they even contested their own contract
[41:31.760 --> 41:36.920]  which gave the consignor 50% and then 50% and they wrote contested.
[41:36.920 --> 41:41.360]  So, you know, there's nothing I could do and I wasn't going to bother because it was
[41:41.360 --> 41:43.680]  a waste of my time.
[41:43.680 --> 41:49.520]  We had three thick binders, four inches was bothered with a bit to present to one of the
[41:49.520 --> 41:57.720]  judge, one of the defendants and on the board writing down there, I get a call from one
[41:57.720 --> 42:02.520]  of the defendants and she has not called me because she doesn't want to speak to me because
[42:02.520 --> 42:07.040]  I'm a terrible person because I filed a lawsuit for a living and the other party that was
[42:07.040 --> 42:12.800]  with me he harasses her because he sent two texts to her landlord.
[42:12.800 --> 42:16.960]  And she said, well, we're not on the docket here, I said, really?
[42:16.960 --> 42:21.000]  And she said, no, I don't see us on the docket and it's a long way for me to go from LA if
[42:21.000 --> 42:22.000]  we're not on the docket.
[42:22.000 --> 42:27.600]  I said, the judge ordered us to be there and he's ordered, well, we're not on the docket.
[42:27.600 --> 42:29.480]  I said, we were on Monday.
[42:29.480 --> 42:32.600]  Well, yes, but I checked just now, we're not on the docket.
[42:32.600 --> 42:39.800]  I said, well, we're in the car and it's up to you and just let's it that and 45 minutes
[42:39.800 --> 42:44.280]  later she texted me, oh, we are on the docket for 10 a.m.
[42:44.280 --> 42:47.440]  So I think she was trying to bluff me and say, well, you don't need to come because
[42:47.440 --> 42:49.120]  we're not on the docket.
[42:49.120 --> 42:54.880]  But I went immediately one on my phone and saw we were on the docket and I read the judge's
[42:54.880 --> 43:01.040]  tentative ruling, which I hadn't read the night before because I was busy trying to write
[43:01.040 --> 43:06.320]  a trial, a brief, which I'd never written before, but I was rereading the rules and
[43:06.320 --> 43:11.120]  saw you had to do one if you're going to trial and you have to file it seven days before,
[43:11.120 --> 43:12.120]  which was yesterday.
[43:12.120 --> 43:20.080]  So I'm throwing one together and didn't redistribute his tentative and it was a doozy.
[43:20.080 --> 43:25.440]  He said, well, basically, I don't see a defense.
[43:25.440 --> 43:33.720]  It seems to me the defendants are uninterested in proposing a defense to the, oh, you're
[43:33.720 --> 43:35.720]  running me off the paper, Andy.

[47:43.440 --> 47:49.440]  told the others, you know, dress like you're in the 20s, do not chew gum, do not wear a
[47:49.440 --> 47:56.440]  hat, do not roll your eyes, do not react to anything this defendant says because she
[47:56.440 --> 47:57.440]  is crazy.
[47:57.440 --> 47:59.440]  I said, you just don't show any emotion.
[47:59.440 --> 48:03.440]  We just sit there and let the judge move it.
[48:03.440 --> 48:05.440]  And so he went in first.
[48:05.440 --> 48:06.440]  Perfect.
[48:06.440 --> 48:10.440]  And she, we had our three binders with all the exhibits.
[48:10.440 --> 48:11.440]  They were all right.
[48:11.440 --> 48:17.440]  Four and she's sick, you know, facing him with the folder saying one for the court, one for
[48:17.440 --> 48:22.440]  the defendant, so he could see we were ready to hand them over because you have to hand
[48:22.440 --> 48:24.440]  them over before trial.
[48:24.440 --> 48:27.440]  And so he said, started going on.
[48:27.440 --> 48:36.440]  Well, she started crying and begging and sleeping and I've got PTSD and COPD and some other ailments
[48:36.440 --> 48:37.440]  she come up with.
[48:37.440 --> 48:42.440]  I couldn't remember and I haven't slept and I can't, you know, eat and I, you know, and
[48:42.440 --> 48:48.440]  I'm just desperate and I'm terrified because my criminal attorney, I had to get a public
[48:48.440 --> 48:51.440]  defender and let the attorney go.
[48:51.440 --> 48:56.440]  And they said that if I have to tell the truth at trial, then that could hurt me at the
[48:56.440 --> 48:57.440]  criminal trial.
[48:57.440 --> 49:00.440]  Well, does that be a change if you told the truth?
[49:00.440 --> 49:07.440]  And she just lied, had her back teeth and then she just went on and on and I just can't
[49:07.440 --> 49:11.440]  possibly do this and I really need four to six week extension.
[49:11.440 --> 49:17.440]  And it's just so hard and I have this criminal trial going and this trial and I just can't
[49:17.440 --> 49:22.440]  possibly do this and I really beg of you to give me this extension.
[49:22.440 --> 49:25.440]  When he turned to her husband and he said, well, what about you?
[49:25.440 --> 49:27.440]  He said, well, I don't know anything.
[49:27.440 --> 49:29.440]  I've really not been participating.
[49:29.440 --> 49:34.440]  I've been working 10 to 12 hours a day and she just emailed us three days earlier.
[49:34.440 --> 49:38.440]  He was injured and, you know, he might not be able to participate.
[49:38.440 --> 49:41.440]  It turns out he injured his finger.
[49:41.440 --> 49:44.440]  So she then said, well, I never said that, but he wasn't working.
[49:44.440 --> 49:46.440]  Yes, you did.
[49:46.440 --> 49:48.440]  We have emails to prove it.
[49:48.440 --> 49:52.440]  But that's before she had to tell the truth.
[49:52.440 --> 49:54.440]  That's before she had to tell the truth.
[49:54.440 --> 49:58.440]  And then she just went on and on and on about this.
[49:58.440 --> 50:04.440]  And the judge is saying, well, you know, Ms. Gardner, why didn't you respond?
[50:04.440 --> 50:06.440]  You know, you got my order.
[50:06.440 --> 50:08.440]  I wrote it on the main team.
[50:08.440 --> 50:10.440]  It clearly stated what you had to do.
[50:10.440 --> 50:14.440]  You didn't respond to Ms. Colbrook's request to meet and confer.
[50:14.440 --> 50:16.440]  Why didn't you respond?
[50:16.440 --> 50:19.440]  Well, she stuttered and didn't answer.
[50:19.440 --> 50:21.440]  Mr. Gardner, why didn't you respond?
[50:21.440 --> 50:23.440]  Well, I didn't know about it.
[50:23.440 --> 50:27.440]  Well, you didn't respond to the pretrial stipulation.
[50:27.440 --> 50:32.440]  You didn't follow the rules and you kept reading out each rule that she was supposed to do.
[50:32.440 --> 50:36.440]  And, well, I just don't know how to do this and I couldn't get an attorney.
[50:36.440 --> 50:41.440]  And, you know, the team has got all this little experience and stuff like that.
[50:41.440 --> 50:45.440]  And then she went on about, you know, Kevin, the other plaintiff, saying,
[50:45.440 --> 50:50.440]  he harassed my landlord and he had the intent to get as evicted.
[50:50.440 --> 50:51.440]  And, you know, she...
[50:51.440 --> 50:54.440]  So then he said, well, is it fair?
[50:54.440 --> 50:57.440]  Do you think it's fair that you have an extension?
[50:57.440 --> 50:58.440]  Yes, it is.
[50:58.440 --> 50:59.440]  He went to her husband.
[50:59.440 --> 51:03.440]  Do you think it's really fair to these plaintiffs to put all this work in?
[51:03.440 --> 51:06.440]  Well, perhaps not.
[51:06.440 --> 51:12.440]  And so anyway, he came to us eventually and Kevin went for it because we'd agreed he would.
[51:12.440 --> 51:15.440]  And so he said, well, your honor, I just would like to, you know,
[51:15.440 --> 51:18.440]  negate something that Ms. Gardner said.
[51:18.440 --> 51:23.440]  She says I harassed and called repeatedly her landlord.
[51:23.440 --> 51:25.440]  I need three texts.
[51:25.440 --> 51:27.440]  I have copies here of three texts.
[51:27.440 --> 51:28.440]  Would you like to see them?
[51:28.440 --> 51:31.440]  They clearly state exactly what it was.
[51:31.440 --> 51:35.440]  And all I was doing was discovery, trying to find out who owned the Range Rover
[51:35.440 --> 51:39.440]  that's in the driveway when they said they only owned a Mini Cooper.
[51:39.440 --> 51:42.440]  And he said, no, I don't need to see it.
[51:42.440 --> 51:46.440]  He said, would you like to see the emails between us regarding settlement
[51:46.440 --> 51:49.440]  that she claims that we refuse to respond?
[51:49.440 --> 51:52.440]  We have them all here because we've got them all in binders.
[51:52.440 --> 51:54.440]  No, I don't need to see that.
[51:54.440 --> 51:59.440]  And she said, would you like to see the emails between Mr. Viara and her
[51:59.440 --> 52:04.440]  where she said she was going to pay him on Thursday in January and she didn't?
[52:04.440 --> 52:07.440]  I don't need to see that either.
[52:07.440 --> 52:13.440]  And then he, you know, said, you know, he was asking questions and I said,
[52:13.440 --> 52:16.440]  well, do you think there should be an extension?
[52:16.440 --> 52:18.440]  No, I oppose it.
[52:18.440 --> 52:22.440]  So then I get up and I, you know, say my piece and she said,
[52:22.440 --> 52:26.440]  well, I'd like to address this gardener saying that, you know,
[52:26.440 --> 52:30.440]  I have way too much legal experience because I've filed lawsuits for a living.
[52:30.440 --> 52:34.440]  I said, I actually think that only attorneys do that.
[52:34.440 --> 52:39.440]  And I said, I have studied very hard and for the last three years
[52:39.440 --> 52:41.440]  tried to follow all the rules.
[52:41.440 --> 52:42.440]  I followed your order.
[52:42.440 --> 52:46.440]  And I said, it's not been easy because it's very complex.
[52:46.440 --> 52:49.440]  And I said, I've had to have some help at times.
[52:49.440 --> 52:52.440]  And I said, but I tried my best.
[52:52.440 --> 52:56.440]  And I may have been an inartful and not perfect in my findings,
[52:56.440 --> 53:00.440]  but at least I have done an effort as opposed to say,
[53:00.440 --> 53:04.440]  and it's been a herculean effort to manage this three and a half years.
[53:04.440 --> 53:07.440]  And I've really opposed for getting an extension.
[53:07.440 --> 53:11.440]  We are ready for trial next week and we'd like to go forward.
[53:11.440 --> 53:16.440]  So the other two just said, we oppose, we oppose because they haven't really done a lot.
[53:16.440 --> 53:18.440]  Just Kevin and I, I've done all the writing.
[53:18.440 --> 53:23.440]  So he said, well, we said, you know, you're all people, you know,
[53:23.440 --> 53:28.440]  and he kept saying, I think I've been a little too lenient.
[53:28.440 --> 53:31.440]  I've been tried to be fair and I've been a little soft,
[53:31.440 --> 53:35.440]  but I think it's time to be firm.
[53:35.440 --> 53:36.440]  They followed the rules.
[53:36.440 --> 53:40.440]  They've done all this work and you haven't done anything.
[53:40.440 --> 53:43.440]  He said, I'm thinking I'm going to rule for the plaintiff.
[53:43.440 --> 53:45.440]  Can you give me a reason?
[53:45.440 --> 53:49.440]  And I said, well, you know, and I tried again and tried to bring it up
[53:49.440 --> 53:53.440]  and we just stood stoically, not saying a word.
[53:53.440 --> 53:58.440]  And then he said, well, you're all reasonable people.
[53:58.440 --> 54:02.440]  I think you could talk to each other about maybe you want mediation.
[54:02.440 --> 54:03.440]  I couldn't do that.
[54:03.440 --> 54:07.440]  I don't arrange for free mediation for four hours for you.
[54:07.440 --> 54:11.440]  He said, but that's different for the four to six week extension she wants
[54:11.440 --> 54:14.440]  if we do that because it'll take that long.
[54:14.440 --> 54:17.440]  And he said, but you you're willing to settle.
[54:17.440 --> 54:22.440]  I said, well, your honor, we agreed upon a settlement with her last attorney
[54:22.440 --> 54:25.440]  on September the 27th, 2021.
[54:25.440 --> 54:28.440]  And we all agreed and signed and she reneged on it.
[54:28.440 --> 54:32.440]  And then the attorney pulled out and the gardener contacted me and said,
[54:32.440 --> 54:34.440]  I think we can still settle Tina.
[54:34.440 --> 54:36.440]  Could we work together?
[54:36.440 --> 54:37.440]  I'm sure we could.
[54:37.440 --> 54:43.440]  And I said, I remember emailing her saying I was available to talk with her family
[54:43.440 --> 54:47.440]  between, you know, Tuesday and Friday from 7 a.m. to 7 p.m.
[54:47.440 --> 54:49.440]  Which day would suit her?
[54:49.440 --> 54:53.440]  Oh, I don't I'm not available any of those days, but I'm available Friday
[54:53.440 --> 54:54.440]  because I had it verbatim.
[54:54.440 --> 54:57.440]  I remembered it when I said, please give me a time.
[54:57.440 --> 55:01.440]  And she didn't give me a time and she never contacted me again about settlement.
[55:01.440 --> 55:06.440]  So he's getting the picture that she's, you know, just constantly pushing things
[55:06.440 --> 55:08.440]  down the road and lying.
[55:08.440 --> 55:11.440]  And I said, I believe I speak for the other three points.
[55:11.440 --> 55:16.440]  He said, more than willing to settle for the amount we agreed upon at that time
[55:16.440 --> 55:18.440]  if it's in a reasonable time.
[55:18.440 --> 55:21.440]  And I said, but this is pretty much don't fit.
[55:21.440 --> 55:23.440]  These defendants don't seem to want to settle.
[55:23.440 --> 55:28.440]  So he said, well, go out in the break that room and talk to each other.
[55:28.440 --> 55:30.440]  And we said, do you want us to come back?
[55:30.440 --> 55:31.440]  He said, no, no.
[55:31.440 --> 55:37.440]  He said, by the 17th, you have to file this and file if you want to mediation.
[55:37.440 --> 55:40.440]  You have to file all these papers in this order and this order.
[55:40.440 --> 55:44.440]  And if you want a settlement, you have to write all this.
[55:44.440 --> 55:49.440]  So we went in there and she said, you know, leaving this and trying to blame us
[55:49.440 --> 55:52.440]  and everything that said, you know, we're not interested.
[55:52.440 --> 55:56.440]  You either settle or we get the judgment or whatever.
[55:56.440 --> 55:58.440]  You know, but well, I've got the criminal front.
[55:58.440 --> 55:59.440]  It doesn't matter.
[55:59.440 --> 56:01.440]  You have the time to settle.
[56:01.440 --> 56:04.440]  Then her husband came in and said, well, I know we should have settled.
[56:04.440 --> 56:06.440]  We should have paid you more often.
[56:06.440 --> 56:09.440]  And I'm really sorry, but I'm going to try to make it right.
[56:09.440 --> 56:10.440]  Okay.
[56:10.440 --> 56:12.440]  So that's where we left it.
[56:12.440 --> 56:16.440]  And the judge did mention a stipulated judgment.
[56:16.440 --> 56:19.440]  I'm just researching what that means.
[56:19.440 --> 56:23.440]  How it relates to if he and we don't know what he's going to give us.
[56:23.440 --> 56:29.440]  I put in my order what we wanted and he could give us punitive the amount we wanted
[56:29.440 --> 56:31.440]  or he could give us less.
[56:31.440 --> 56:36.440]  I don't know if we plan enough to prove our case.
[56:36.440 --> 56:42.440]  But the lesson learned here is that don't lie to the judge.
[56:42.440 --> 56:44.440]  You can see right through you.
[56:44.440 --> 56:48.440]  Do not ignore the judge's order.
[56:48.440 --> 56:55.440]  Even if you don't file something perfect, file it on time and try to at least respond.
[56:55.440 --> 57:02.440]  I mean, I took that sample pre-trial stipulation and I just rewrote everything with us.
[57:02.440 --> 57:08.440]  And I had to ask for a little help to figure out how to do the point of fraud.
[57:08.440 --> 57:11.440]  But I got it done and I got it done on time.
[57:11.440 --> 57:15.440]  And no, it was not perfect, I'm sure.
[57:15.440 --> 57:21.440]  But this is what I learned when he was castigating her and he was very polite.
[57:21.440 --> 57:31.440]  And but it, you know, he said they have done all the work they needed to do and you haven't melted one percent.
[57:31.440 --> 57:35.440]  So why would I not give them their judgment?
[57:35.440 --> 57:36.440]  And there we go.
[57:36.440 --> 57:39.440]  He's, you know, he said he's ruling for us.
[57:39.440 --> 57:44.440]  He's going to wait until the 17th to see if we ask for mediation, which we're not.
[57:44.440 --> 57:49.440]  And see if we come up with a settlement that we can all sign for.
[57:49.440 --> 57:54.440]  And in the meantime, I'm going to research what stipulated judgment is.
[57:54.440 --> 57:57.440]  So that was a room.
[57:57.440 --> 57:59.440]  That is great news.
[57:59.440 --> 58:01.440]  I love to hear this.
[58:01.440 --> 58:02.440]  Well, I do.
[58:02.440 --> 58:08.440]  We're not going to get any money, but because they don't tell me, but we stopped the bankruptcy.

[58:11.440 --> 58:16.440]  So you really hung in there and done well and it's coming back.
[58:16.440 --> 58:17.440]  You're getting paid back for it.
[58:17.440 --> 58:18.440]  And that's it.
[58:18.440 --> 58:24.440]  If it's a lesson to anybody out there, the courts are not completely corrupt.
[58:24.440 --> 58:30.440]  When it's two individuals, the court really doesn't have a dog in that hot.

[01:04:39.440 --> 01:04:43.440]  And they all came up afterwards and introduced themselves and said,

[01:04:45.440 --> 01:04:48.440]  That was an awesome result.
[01:04:48.440 --> 01:04:50.440]  They said, per se, never get that.
[01:04:50.440 --> 01:04:52.440]  And they said, you did great.
[01:04:52.440 --> 01:04:59.440]  And then the court reporter came up to one of our other plaintiffs and, you know, she said,

[01:11:11.440 --> 01:11:16.440]  They're all attacking her, not giving me the ability to take care of the bed bugs for her to sleep

[01:11:49.440 --> 01:11:55.440]  I didn't find out a dang thing till tonight, today's afternoon, about 2 o'clock, speaking to the oppose.

[01:15:11.440 --> 01:15:34.440]  We addressed municipal codes in Texas claiming that municipal codes could not be applied to the individual. They could only be applied to a employee of a municipality or a county or someone who is in contractual
[01:15:34.440 --> 01:15:41.440]  privacy with the county wherein they have agreed to the statutory scheme.
[01:15:41.440 --> 01:15:47.440]  And we're saying this because the legislature is authorized to write law.
[01:15:47.440 --> 01:15:58.440]  They are not authorized to delegate that authority. Now they allowed municipalities to write ordinances.
[01:15:58.440 --> 01:16:16.440]  But those ordinances could not be applied to the individual, to the general public, because if they applied the ordinance in that way, then it would have the effect of a law.
[01:16:16.440 --> 01:16:25.440]  And they're not authorized to write law, only the legislature is. So that would be an unconstitutional application of the ordinance.
[01:16:25.440 --> 01:16:41.440]  What I don't know is how municipalities and counties in New York get authorization to write ordinances. Do you know about that?
