[07:05.760 --> 07:13.680]  but just for some reason don't want to play anymore and well i borrowed my wife car and i was
[07:13.680 --> 07:19.120]  going across texas and well it did not take long before i got a speeding ticket
[07:20.400 --> 07:24.320]  and i didn't really mean to get a speeding ticket you know i wasn't trolling for a cop
[07:24.320 --> 07:32.640]  stop or anything i was driving safely and all that but uh yeah so the numbers said that i should
[07:32.640 --> 07:41.360]  have a ticket and the officer obliged and since then that was august since then we've been
[07:44.320 --> 07:51.440]  holding public officials accountable to follow the law in all kinds of ways they probably weren't
[07:51.440 --> 07:57.920]  expecting anybody to ever notice or care about i just want them to follow it follow the law as
[07:57.920 --> 08:06.640]  it's written and boy they're just really unprepared to do that they don't know they don't care and
[08:07.200 --> 08:15.520]  so we're holding them accountable i say we i'm holding them accountable and i'm documenting my
[08:16.960 --> 08:24.880]  step by step the things that we're doing along the way we being all of the the lawless public
[08:24.880 --> 08:34.800]  officials when they try to do something and i hold them accountable so check this out we have in
[08:34.800 --> 08:44.080]  texas something called a special prosecutor now that sounds special right sounds sounds important
[08:46.720 --> 08:54.400]  in this particular county and i suspect many other counties we have the district attorney
[08:54.400 --> 09:03.360]  and county attorney trying to pass off their duties the duties that are lawfully imposed on them
[09:04.800 --> 09:10.160]  by statute and trying to pass that off to somebody they're calling a special prosecutor
[09:11.120 --> 09:18.080]  the only that is the special prosecutor is not authorized to do these things the
[09:18.080 --> 09:25.840]  the role of a special prosecutor is very well defined in in and in the statutes you see it's
[09:25.840 --> 09:36.000]  super clear there has to be a certain kind of offense it's like a juvenile crime or a crime
[09:36.000 --> 09:43.680]  committed on some juvenile owned facility for what the uh texas department of juvenile whatever
[09:43.680 --> 09:50.960]  criminal justice and if there's a crime that's committed on that facility or committed by a
[09:50.960 --> 09:58.240]  juvenile and there's something going on about mental health issues and electroshock therapy and
[09:59.440 --> 10:04.560]  there's several different things like that well then the special prosecutor needs to be involved
[10:05.120 --> 10:11.360]  and he's going to assist the actual prosecutor which is by law the district attorney or the
[10:11.360 --> 10:23.760]  county attorney right okay well and my speeding ticket issue there was no juvenile factor and
[10:23.760 --> 10:30.640]  there was no mental health factor so if this guy's a special prosecutor he has zero business
[10:30.640 --> 10:39.440]  getting involved at all none but he imagines himself to be authorized and so he's in there
[10:39.440 --> 10:45.040]  dancing around doing the courthouse dance like we've all seen these attorneys do and acting like
[10:45.040 --> 10:55.520]  he's authorized well uh so he told the judge a whole bunch of lies i'm sorry i like to call them
[10:56.480 --> 11:03.440]  fibs or something but no they're straight up huge big lies act rated perjury these are false
[11:03.440 --> 11:10.640]  material statements one of which is that he's authorized to prosecute well i'm sorry but
[11:10.640 --> 11:16.880]  because we have something called the due course of the laws often known as due process in a more
[11:16.880 --> 11:22.320]  general sense there are certain ways for things to happen and he doesn't get to just make it up
[11:24.000 --> 11:31.120]  so uh if he's going to be authorized to prosecute he needs to be number one the district attorney
[11:31.120 --> 11:36.960]  or the county attorney and number two there needs to be something to prosecute you have to
[11:36.960 --> 11:43.920]  commence a case before you can prosecute it there's a special set of steps that have to be followed
[11:43.920 --> 11:52.960]  to commence a case none of it happened nobody filed one shred of paper so there has to be
[11:52.960 --> 12:02.000]  a commencing of the case with what's called primary pleadings which is clearly defined as
[12:02.000 --> 12:10.960]  an indictment i.e. the grand jury or an information either one of those documents can be used as
[12:10.960 --> 12:17.440]  the primary pleadings we can start a case we can commence it they say well once it's been commenced
[12:17.440 --> 12:21.360]  then he could prosecute it if he were the district attorney or county attorney
[12:21.360 --> 12:27.200]  which he's not and if there were some documents that were presented to the court
[12:27.200 --> 12:36.400]  texas constitution article five section 12 subsection b says the presentment of an indictment
[12:36.400 --> 12:42.400]  or an information to the court is what vests the court with jurisdiction
[12:43.600 --> 12:50.480]  how in the world are these people running around here just waving their arms and acting
[12:50.480 --> 12:58.480]  like they have jurisdiction when there's no paperwork in the case party you know in a criminal
[12:58.480 --> 13:03.760]  case that's not exactly a plaintiff you have the state kind of in the role of a plaintiff
[13:04.640 --> 13:12.800]  and the accuser is somebody who is authorized by our legislators to act as the accuser for the
[13:12.800 --> 13:19.440]  people for the state so they say well whether that's right or wrong that's how it is in law
[13:19.440 --> 13:25.760]  and if they want to commence a case that's what they have to do the constitution is very clear
[13:26.400 --> 13:35.760]  an indictment or an information so until some of that gets presented to the to the court the court
[13:35.760 --> 13:41.360]  does not have jurisdiction has not been vested with jurisdiction or another word another phrase
[13:41.360 --> 13:51.840]  that we see in the case law is that the court has not acquired jurisdiction so yeah the court likes
[13:51.840 --> 13:58.400]  to try to slip out of that but if you mention that to a judge he'll say oh denied what you're
[13:58.400 --> 14:03.920]  denying my challenge yeah denied because he's pretty sure he has jurisdiction and so that
[14:03.920 --> 14:12.800]  should be enough right nope so his thought of a judge's idea of having jurisdiction
[14:15.360 --> 14:28.960]  is often based on the mistaken premise that a non-party some cop can click a button on his
[14:28.960 --> 14:35.440]  mdt his mobile data terminal in his cruiser he can hit some button f11 or something and it will
[14:35.440 --> 14:42.480]  automatically zap his citation over into some system that sends somebody a fax it'll go to
[14:42.480 --> 14:50.240]  some court automatically well i'm sorry but the cop's not a party he's not authorized to commence
[14:50.240 --> 14:56.400]  the case and neither is the texas highway patrol that it got factched through they're not a party
[14:56.400 --> 15:01.920]  either maybe could be called in later as a witness you know if they were going to be
[15:06.640 --> 15:15.200]  i'm hearing a lot of BB again so he maybe could be called in as a witness later if a case actually
[15:15.200 --> 15:19.760]  commences and is authorized to prosecute it and pulls him in as a witness hey did you see this
[15:19.760 --> 15:25.520]  such and such happen yes okay so maybe he can be a witness but he's not a party he can't convince
[15:25.520 --> 15:31.600]  the case we have statues that define the due course of the laws that's not case commencement
[15:31.600 --> 15:38.880]  the writing of a citation well so they've got one more thing they try to do they try to say that
[15:39.520 --> 15:44.400]  oh well the writing of the ticket well actually that doubles as a complaint and in a classy misdemeanor
[15:44.400 --> 15:54.080]  a complaint is the charging instrument wrong we used to have something in texas that said
[15:54.080 --> 16:01.040]  that a complaint is the charging instrument in a classy misdemeanor we used to it doesn't say
[16:01.040 --> 16:05.920]  that anymore that was unconstitutional it was a problem and the legislature fixed it for us
[16:06.560 --> 16:18.080]  guess when 1999 so nobody has any excuses for still acting that way no a complaint is not
[16:18.080 --> 16:22.320]  the charging instrument they had something set up like that it was supposed to be for parking
[16:22.320 --> 16:29.360]  tickets and grass police and something but they were using it as a loophole and the legislature
[16:29.360 --> 16:37.440]  said no no no they fixed it they repealed the entire thing actually that was 1999 so

[21:34.040 --> 21:40.040]  In different states you'll see that it's sometimes treated criminal or they call it quasi-criminal
[21:40.040 --> 21:45.040]  And sometimes it's treated as a civil infraction so you have to take a look at your state to see
[21:45.040 --> 21:50.040]  Which procedural rules these guys are supposed to be following
[21:50.040 --> 21:56.040]  In Texas it's criminal and the way that a criminal case is started
[21:56.040 --> 22:01.040]  As I was just describing they pretty much just blew it on every count
[22:01.040 --> 22:05.040]  They messed up almost everything that they could
[22:05.040 --> 22:13.040]  So in the process of, I was telling you about a special prosecutor
[22:13.040 --> 22:15.040]  Right?
[22:15.040 --> 22:25.040]  His job is to handle cases with mental health issues and electroshock therapy in the situation that's about juveniles
[22:25.040 --> 22:39.040]  So it has nothing to do with him replacing the prosecutor or somehow being magically delegated the prosecutorial duties of a real prosecutor
[22:39.040 --> 22:43.040]  He's supposed to be an assistant in these very special cases
[22:43.040 --> 22:51.040]  Well, this prosecutor went to the JP and lied like a dog
[22:51.040 --> 22:58.040]  He sat there and said all kinds of false material statements
[22:58.040 --> 23:03.040]  One including that he was authorized to do this to prosecute something that didn't exist
[23:03.040 --> 23:09.040]  And told the judge the due process doesn't apply, this is not a civil matter
[23:09.040 --> 23:18.040]  Because in his imagination the case that he was, you know, his imaginary case he had in his head was going to be criminal
[23:18.040 --> 23:23.040]  Even though nobody filed a shred of paper there was nothing before the court, literally zero
[23:23.040 --> 23:31.040]  So he says it's criminal and due process, oh that's only civil your honor
[23:31.040 --> 23:36.040]  Oh wow, that's a really big mistake for somebody to make
[23:36.040 --> 23:44.040]  I mean attorneys are surprised me sometimes with the kinds of crazy things they come up with
[23:44.040 --> 23:48.040]  But that was a really big one
[23:48.040 --> 23:52.040]  Randy you've probably heard some real twosies before
[23:52.040 --> 23:57.040]  Yeah, this was something else, he says due process only applies to civil
[23:57.040 --> 24:04.040]  Oh and he also lied to the judge and told the judge that jurisdiction, oh he's bringing up this issue of jurisdiction
[24:04.040 --> 24:08.040]  Well, that only applies in civil matters
[24:08.040 --> 24:11.040]  This is a criminal matter, or so he imagined
[24:11.040 --> 24:20.040]  This is a criminal matter and jurisdiction doesn't apply, you don't need to worry about that your honor, you have jurisdiction
[24:20.040 --> 24:25.040]  So there were one lie after another, so I took him to the federal court
[24:25.040 --> 24:31.040]  This guy who is trying to act like he's a prosecutor in the state court
[24:31.040 --> 24:35.040]  Suddenly found himself sued in the Fed
[24:35.040 --> 24:43.040]  I took him to the district court with a Title 42 section 1983 civil rights lawsuit
[24:43.040 --> 24:50.040]  Because with his 15 counts of aggravated perjury, he's depriving my right to due process
[24:50.040 --> 24:53.040]  The federally protected right
[24:53.040 --> 25:03.040]  We can look at the United States Constitution and we can see certain rights that are enumerated
[25:03.040 --> 25:10.040]  Of course everybody knows, the Ninth Amendment is saying, hey these are not all the rights that people have
[25:10.040 --> 25:15.040]  Just because it's not enumerated specifically here, that doesn't mean you don't have the right
[25:15.040 --> 25:28.040]  And yet these rights that are very clearly defined are rights that we can say a little more easily I suppose
[25:28.040 --> 25:31.040]  That it was deprived
[25:31.040 --> 25:35.040]  Because its contours are clearly defined is how they say
[25:35.040 --> 25:43.040]  So I said that this guy's aggravated perjury deprived me of due process

[27:21.040 --> 27:26.040]  And because I can't really, I'm looking at the ticket and I can't really tell the charges
[27:26.040 --> 27:31.040]  So there's no DL and expired license, I think?
[27:31.040 --> 27:35.040]  I don't know, I can't tell from the chicken scratch that was on the ticket
[27:35.040 --> 27:42.040]  See, and that is one of the problems is when you have somebody trying to accuse you of a crime
[27:42.040 --> 27:46.040]  You have a right to be informed of the nature and the cause
[27:46.040 --> 27:54.040]  And if you can't make sense of their chicken scratch or their unrelated cryptic pile of acronyms and abbreviations
[27:54.040 --> 27:58.040]  Then they failed in their duty to inform you
[27:58.040 --> 28:04.040]  And you're the only one that can make a call of whether or not you understand clearly what you're being charged with
[28:04.040 --> 28:08.040]  If you can't understand it, then the document's no good
[28:08.040 --> 28:15.040]  But just like we were talking about a moment ago, the document that you're holding is a citation
[28:15.040 --> 28:22.040]  It didn't come from a grand jury, and it didn't come from a prosecutor attorney, a district attorney, or a county attorney

[28:25.040 --> 28:29.040]  So that's not a document that can start a case

[28:32.040 --> 28:34.040]  So let's look at one other thing

[29:04.040 --> 29:12.040]  An interesting part is it was an independent school district cop that pulled him over on a city street
[29:12.040 --> 29:16.040]  So that's another issue I'm having, like, how does that work?
[29:16.040 --> 29:22.040]  Well, it's probably not going to be something that's not a battle you're going to probably want to pick
[29:22.040 --> 29:25.040]  They do have provisions for each other
[29:25.040 --> 29:35.040]  They sign these memorandum of understanding, they call it, between corporations, you know, the ISD and the state and the city that's nearby
[29:35.040 --> 29:45.040]  They sign these agreements where they can kind of go over into each other's territory to do enforcement of various laws and codes
[29:45.040 --> 29:51.040]  Now, it's beside the point that they don't have authorizations of the Texas Transportation Code

[35:21.040 --> 35:28.040]  Then act the violation of Texas Transportation Code 543.001
[35:28.040 --> 35:41.040]  Which says that a peace officer can, I'll just paraphrase, he can bother anybody for something that's within sections 541 to 600
[35:41.040 --> 35:56.040]  Well, that's a subtitle C, any peace officer could do that as opposed to the entire Texas Transportation Code which is enforceable by the state troopers
[35:56.040 --> 36:00.040]  So you've got some ISD cop over here, right?
[36:00.040 --> 36:08.040]  And he's trying to reach outside the lines of what he would be able to do
[36:08.040 --> 36:27.040]  You know, if he saw a violation happening within subtitle C, 541 to 600, then he could go in there and pull the guy over and they call that a detaining but it's really a form of an arrest
[36:27.040 --> 36:29.040]  Well, the arrest was a warrant
[36:29.040 --> 36:39.040]  Yes, what? Yeah, exactly, and this registration issue has been subtitled C
[36:39.040 --> 36:44.040]  I think it's over into A, like 504 or somewhere
[36:44.040 --> 36:48.040]  And that's outside of the boundaries
[36:48.040 --> 36:55.040]  And I also like to go talk about insurance, that's a big one for him, but that one's 601, that's just outside the lines as well
[36:55.040 --> 36:59.040]  That's not something that he can pull somebody over for
[36:59.040 --> 37:13.040]  Even if he does an unconstitutional warrantless search of your private data, you know, he goes doing a deep dive in somebody's government databases and comes up with the idea that you don't have any insurance
[37:13.040 --> 37:20.040]  Even that doesn't give him the authority to pull you over
[37:20.040 --> 37:29.040]  If your son was pulled over specifically for no registration, then that's a flag right there at the get go
[37:29.040 --> 37:42.040]  But yeah, as an ISD officer, he has a lot of authority to do things that peace officers do and he doesn't have authority to enforce this Texas Transportation Code
[37:42.040 --> 37:56.040]  Provision for that. If he were a city top and if he worked for certain cities with certain populations that were within certain distance from an airport, international seaport
[37:56.040 --> 38:05.040]  He could be eligible to go down to Austin, sit in with these guys, the state troopers, and get some special training
[38:05.040 --> 38:17.040]  The Texas Administration Code makes a provision for that. Rule 4.13, rule 4.14 have a special provision for these guys that work for those specific cities
[38:17.040 --> 38:30.040]  It's certified. They have to re-app every year and they have to, you know, have the training and the certification so that they can be authorized to enforce the Texas Transportation Code
[38:30.040 --> 38:37.040]  There's no provision for an ISD officer to do that
[38:37.040 --> 38:50.040]  I thought that those two chapters only allowed peace officers to do DOT inspections
[38:50.040 --> 38:57.040]  That's right. It's 644 and 701. Yes, that's right
[38:57.040 --> 39:10.040]  When it says in 543.001, any peace officer, so it's another layer. It's like a Venn diagram. You have another layer of possibility for somebody to enforce
[39:10.040 --> 39:22.040]  So this guy is an ISD officer. He's a city cop, so he's not even up for being eligible to maybe get the commercial 644, 701. That's not even an option for him
[39:22.040 --> 39:39.040]  But he has a peace officer, right? So he could get in there and squeeze in with this 543.001, which says he can enforce, he can arrest without a warrant if he sees an onsite offense of somebody doing something in subtitle C
[39:39.040 --> 39:50.040]  Okay, so there's a little window for him to exercise some authority, right? However, what he pulled the guy over for
[39:50.040 --> 39:56.040]  Well, within that, he reached all the way over to registration and that's none of his business
[39:56.040 --> 40:06.040]  That's like he's trying to enforce the Texas Water Code or some business copyright issues or something. He has no business talking to that
[40:06.040 --> 40:18.040]  Okay, so let's see. You said Dan, you said that he got the ticket and then what happened? What have you since then?
[40:18.040 --> 40:32.040]  The very next day on the night, I went down to the county clerk, about the county of the JP office, and I went to the clerk and said, hey, I can't read what the charges are. What do you have on file for this?
[40:32.040 --> 40:42.040]  I've got a ticket number and he goes, well, we don't have anything on file and you're going to have to wait three or four weeks until the cop turns it in
[40:42.040 --> 40:51.040]  And I was like, that's going to be past the date on the ticket for our notice to appear. I said, do you see the issue we have here?
[40:51.040 --> 40:59.040]  And she's like, we'll send you a letter. So I feel like I'm on a railroad fixing to get run over on this one.
[40:59.040 --> 41:11.040]  Yeah, I hear you. So it would be great if you get from her a certified response. When you went to her and asked her on the phone
[41:11.040 --> 41:13.040]  No, I wouldn't personally.
[41:13.040 --> 41:31.040]  You're in person. Great. So a records request is in writing and you say, I want to see all records you have for, I don't know, you could say since there's no case number or anything yet, you could just say anything you have related to my son.
[41:31.040 --> 41:43.040]  He's a minor, give his name or have him there and give his ID, whatever. And she's going to say, have no records responsive to your request.
[41:43.040 --> 41:52.040]  You say, that's fine. Can you please certify that response for me? So that means she's got to come up with a piece of paper with her signature or court seal or both.
[41:52.040 --> 42:01.040]  And it needs to say on there that there are no records responsive to your request for records relating to your son.
[42:01.040 --> 42:08.040]  Okay, so as of today's date, the stamp on that document, how do you walk off with that in your fat little hands?
[42:08.040 --> 42:22.040]  They have not, you know, they have nothing, but I can you to, you know, hoping you'll just kind of go along with the idea that it'll eventually have something. And that's not how this works.
[42:22.040 --> 42:30.040]  We have a due process. We have due course of the laws. There are certain ways for things to happen and they're not following the laws, but they're hoping that you don't mind.
[42:30.040 --> 42:38.040]  And you'll just go along with it and just hurry up to the part about paying and don't worry too much about all the steps they're skipping.
[42:38.040 --> 42:51.040]  So yeah, we can walk through that with you and help you, help your son to turn this into a learning experience.
[42:51.040 --> 43:04.040]  Yes, that would be, that would be excellent. What, what are my, I guess, how would I pressure the clerk to actually, if she doesn't want to give me that, what do I, where am I at then?
[43:04.040 --> 43:11.040]  Well, Randy, I think that's where you would call 911, wouldn't you?
[43:11.040 --> 43:28.040]  Well, what I would tip it at there is just say, oh, that's no problem. You know, I had to ask, you had refused, and then go ahead and I'll just write up a criminal complaint and say that she failed to refuse to perform her duty.
[43:28.040 --> 43:43.040]  And I'll have another affidavit where I'm saying, under penalty of perjury, I'll promise through and say just a few facts, simple, you know, lay out the details and say, I went on such and such a day.
[43:43.040 --> 43:48.040]  I suppose this person, I asked for these documents. She said she doesn't have any documents.
[43:48.040 --> 43:55.040]  And just, just leave it like that. It's personal, first-hand knowledge, and that's best evidence.

[50:05.040 --> 50:09.040]  Fighting traffic tickets is one of the hardest things to do
[50:09.040 --> 50:17.040]  Because the traffic courts are so tenacious and so outrageously illegal
[50:17.040 --> 50:23.040]  So if you're not out there with the intention of fixing the system
[50:23.040 --> 50:26.040]  And make a deal
[50:29.040 --> 50:33.040]  Make a deal, deal it down, and it'll go away
[50:33.040 --> 50:37.040]  Make a deal? Okay, how should I make a deal?
[50:37.040 --> 50:47.040]  Should he start before he goes to the part where he's making a deal
[50:47.040 --> 50:52.040]  Should he start by challenging jurisdiction and bar-grieving the lawyer on the other side
[50:52.040 --> 50:56.040]  And then talk to him and then show up over there to try to make a deal?
[50:56.040 --> 50:58.040]  Come up a little bit
[50:58.040 --> 51:05.040]  As a traffic issue, if he bar-grieves the prosecutor or the judge
[51:05.040 --> 51:10.040]  It's likely to really take them off and they'll sting him harder
[51:10.040 --> 51:21.040]  The first thing I would suggest trying to do is try to get them to give you a deal you can absolutely live with
[51:21.040 --> 51:28.040]  If not, then sting them, then bar-grieve them a time or two and beat them up a little bit
[51:28.040 --> 51:33.040]  Then come back, maybe they'll give you a deal you can live with
[51:33.040 --> 51:36.040]  But it's a crap shoot
[51:42.040 --> 51:45.040]  You gotta just throw it
[51:50.040 --> 51:52.040]  Dan, did we lose you?

[51:56.040 --> 52:03.040]  Yeah, if my son weren't involved, I don't mind bar-grieving and going the distance
[52:03.040 --> 52:10.040]  But it's not just me, it's my son's involved, he's 16, he's taking the jurisdictionary course with me
[52:10.040 --> 52:18.040]  And it's a good learning experience, but then again I don't want to have to drag this further than it needs to go

[52:21.040 --> 52:26.040]  Oh, he's actually getting a kick out of it. We were going through the code of criminal procedures this afternoon
[52:26.040 --> 52:31.040]  And looking at the penal code, he said it's actually kind of fun
[52:31.040 --> 52:36.040]  For him, this might be a good learning experience
[52:36.040 --> 52:43.040]  It's not going to get any worse. The worst they're going to do is charge you the maximum fine, which they likely do anyway
[52:43.040 --> 52:50.040]  Unless you can deal them down, but if that's not that much of a big deal, then this is a great place to learn law
[52:50.040 --> 52:54.040]  Well, that's kind of what I was thinking
[52:54.040 --> 53:04.040]  Yeah, worst case scenario, you go through all the process, they stick it to you and end up paying the full amount of the fine at the end
[53:04.040 --> 53:11.040]  And then they really don't want to play with him again. They don't want to pull that truck over, they don't want to talk to him, they don't want to see him
[53:11.040 --> 53:23.040]  And you'll demonstrate to your son that you can deal with the legal system
[53:23.040 --> 53:29.040]  We have a lot of people out there who are terrified of the system
[53:29.040 --> 53:38.040]  And we'll just pay the ticket and duck their head and take whatever abuse they get just so they don't have to have a fight
[53:38.040 --> 53:46.040]  But if we're to maintain this republic, we need some people willing to get out there and fight these guys
[53:46.040 --> 53:52.040]  And a ticket is the simplest way to do it
[53:52.040 --> 53:56.040]  That seems like the easiest place to start
[53:56.040 --> 54:01.040]  And bargue them into the stone age
[54:01.040 --> 54:07.040]  And then if they say one word about the bargue vids, you bargue them for that
[54:07.040 --> 54:16.040]  And if it's a municipal court, the judge is probably a lawyer, so bargue him too
[54:16.040 --> 54:20.040]  Excellent
[54:20.040 --> 54:28.040]  And you might file a T. Cole complaint against the police officer, that'll tighten his shorts

[54:32.040 --> 54:38.040]  He doesn't even work for a city, he's just working for an ISD

[54:41.040 --> 54:46.040]  Is he a certified peace officer?

[54:54.040 --> 55:06.040]  There are two things that are required, he must be a certified peace officer and he must be employed as a certified peace officer

[55:15.040 --> 55:20.040]  Or is he a glorified security guard?

[01:05:23.040 --> 01:05:36.040]  So the question is, can you use rule 5.1 to challenge an order, which is an obligation if you're challenging like a constitutional challenge? Can you use that?

[01:05:40.040 --> 01:05:59.040]  This is the federal rule. So rule 5.1 challenge to the constitutionality of the statute order regulation. So if you're going to do something, you're going to challenge something, you have to notify the attorney general.
[01:05:59.040 --> 01:06:17.040]  Yes, anytime you make a constitutional challenge, because the constitutional challenge goes to the state itself, and the attorney general is the attorney for the state. So he needs opportunity to chime in.

[01:06:18.040 --> 01:06:35.040]  I have made a lot of constitutional challenges and I never notify the attorney general. And I've never had anybody raise an issue. If they raise an issue, I'll just notify the attorney general.
[01:06:35.040 --> 01:06:45.040]  Okay. Well, I have a case in front of me where it has been used against the plaintiff. So let's just, for the sake of this question, let's say it's applicable and I need to do it.
[01:06:45.040 --> 01:06:51.040]  I want to use it as a tool. So what I want to do, I don't have time for another lawsuit. Okay.
[01:06:51.040 --> 01:07:07.040]  But what I want to do is take, you know, a 60 or 90 day notice of claim and intent and attached to that a 5.1 notice to the attorney general to get rid of a mask mandate.
[01:07:07.040 --> 01:07:15.040]  In my explanation, my complicated explanation, they're still requiring in Massachusetts masks in hospitals.
[01:07:15.040 --> 01:07:35.040]  So in 2020, the governor established a state of emergency. In 2021, he dropped the state of emergency, but covertly created a health emergency in which he drew upon laws that were written for the board of health.
[01:07:35.040 --> 01:07:48.040]  This is like a fireman arresting someone using laws for the policemen. Okay. So he's using laws to create a health emergency, which doesn't exist.
[01:07:48.040 --> 01:07:53.040]  Wait, wait, wait. Charge him with official misconduct.
[01:07:53.040 --> 01:07:59.040]  Understood. Understood. I'm not trying to do a lawsuit. I'm just trying to get them to drop the mask mandate.
[01:07:59.040 --> 01:08:11.040]  Charge them criminally. When I filed a hundred-page criminal complaint against the governor for his executive orders, he dropped them immediately.
[01:08:11.040 --> 01:08:18.040]  Understood. The governor is exerting or purporting to exert an authority he doesn't have. That's criminal.
[01:08:18.040 --> 01:08:23.040]  Understood. And it goes to separation of powers. It's a big deal.

[01:08:25.040 --> 01:08:34.040]  So again, so he's using Board of Health law to create something that doesn't exist, which is a health emergency declared by the governor.
[01:08:34.040 --> 01:08:43.040]  And the, every 90 days, the state Board of Health renews this mask mandate for the hospital. Okay.
[01:08:43.040 --> 01:08:50.040]  So I went to a hospital twice and I was assaulted. All right. Not physically, but what assault actually is.
[01:08:50.040 --> 01:08:59.040]  And then one time I was detained. They would not let me leave until I put on one of their official medical masks.
[01:08:59.040 --> 01:09:04.040]  I had my own mask and they wouldn't let me put that on. What was that called when someone detained you?
[01:09:04.040 --> 01:09:07.040]  They wouldn't let me leave. They said, you're not leaving.
[01:09:07.040 --> 01:09:10.040]  That's called arrest. Unlawful restraint.
[01:09:10.040 --> 01:09:17.040]  They have arrested your freedom of movement. You were arrested, whatever they call it.
[01:09:17.040 --> 01:09:20.040]  Yeah. Unlawful seizure.
[01:09:20.040 --> 01:09:29.040]  Does the mask requirement carry a criminal penalty?
[01:09:29.040 --> 01:09:32.040]  No.
[01:09:32.040 --> 01:09:39.040]  Then under what grounds did they arrest you or detain you?
[01:09:39.040 --> 01:09:43.040]  Well, of course they don't have a reason. It's their, it's their rules.

[01:09:48.040 --> 01:09:53.040]  They are public officials. Unlike you, you can do anything you want to.

[01:10:06.040 --> 01:10:13.040]  They may not arrest you for anything other than a crime.
[01:10:13.040 --> 01:10:19.040]  If they arrested you for something that's a non-crime, that's false imprisonment.
[01:10:19.040 --> 01:10:21.040]  Okay. They didn't arrest me.

[01:10:24.040 --> 01:10:26.040]  It was a security guard.

[01:10:31.040 --> 01:10:36.040]  That's being thrown in jail. That's not arrest. Arrest is when they arrest your freedom of movement.

[01:29:03.040 --> 01:29:07.040]  And that appears to be exactly what the governor is doing

[01:29:11.040 --> 01:29:18.040]  He could convene the legislature and ask them to consider this legislation

[01:29:25.040 --> 01:29:28.040]  But he didn't trust the legislature to do the right thing
[01:29:28.040 --> 01:29:30.040]  So he decided to do it himself

[01:29:35.040 --> 01:29:44.040]  And I suspect it is also forbidden the same way in Massachusetts

[01:35:15.040 --> 01:35:26.040]  Well, so we had basically mediation over two, three separate mediation conferences.
[01:35:26.040 --> 01:35:38.040]  And they did offer me something that was actually decent to close just three of the cases and leaving one more open.
[01:35:38.040 --> 01:35:44.040]  And I actually have filed three more, but I played it pretty hard.
[01:35:44.040 --> 01:35:55.040]  And so they went back and asked for just a little bit more and they went back and had another executive session.
[01:35:55.040 --> 01:36:05.040]  And then they came back just two days ago and it was a little bit different because this time it was just the lawyer and the superintendent wasn't on there.
[01:36:05.040 --> 01:36:09.040]  And you could just tell there she was just not having it.
[01:36:09.040 --> 01:36:18.040]  She was just, I had filed all the bar grievances and I've just been going really hard on them and they basically retracted everything.
[01:36:18.040 --> 01:36:34.040]  So, which was, I knew it was a chance and they didn't want to talk about the global demand, which is basically like for everything with the first amendment retaliation and everything.
[01:36:34.040 --> 01:36:45.040]  I had put a global demand in front of them too that they were considering or at least the superintendent was, you know, verbalizing that they were going to discuss it and come with an offer.
[01:36:45.040 --> 01:36:50.040]  And then they had just decided that they, I think I might have taken off or something.
[01:36:50.040 --> 01:37:00.040]  So, which is fine because, I mean, that was a little pre-emptive as they had actually come and settled before I even filed the federal stew.
[01:37:00.040 --> 01:37:07.040]  I don't even, you know, know that their insurance would have been, you know, even able to do that.
[01:37:07.040 --> 01:37:12.040]  But we've doubled down now basically.
[01:37:12.040 --> 01:37:18.040]  So, we have, I have some motions in and then the lawyer just put in a motion today.
[01:37:18.040 --> 01:37:26.040]  And I was just kind of hoping you guys could walk me through a few things where I'm out with it and some suggestions on strategy.
[01:37:26.040 --> 01:37:34.040]  So, it sounds good.
[01:37:34.040 --> 01:37:36.040]  What do you got?
[01:37:36.040 --> 01:37:49.040]  So, the main thing is, so they, their first set of admissions came due the day after the day of our last mediation.
[01:37:49.040 --> 01:38:02.040]  And so, the lawyer went in and she objected to every single one and she, every single one objected and denied and said, mixed it up.
[01:38:02.040 --> 01:38:12.040]  But she, the one thing that was super just ridiculous was that she used the objection of making legal conclusions,
[01:38:12.040 --> 01:38:17.040]  which I was even checking the civil rules, the procedure and different things and then there's a difference.
[01:38:17.040 --> 01:38:19.040]  Yeah, that's not one of them.
[01:38:19.040 --> 01:38:23.040]  Yeah, it doesn't even, and it was so asinine.
[01:38:23.040 --> 01:38:30.040]  And then, and then the other one was that the question, some of them she said were too broad, big, ambiguous.
[01:38:30.040 --> 01:38:36.040]  And then all of them she said they're not relevant to the case.
[01:38:36.040 --> 01:38:48.040]  Now, so I filed a motion to deem those admitted, deem facts admitted and, you know, gave my reasons why that they were, you know, without merit.
[01:38:48.040 --> 01:38:55.040]  And then I, and then there was also my first request for productions due that they just ignored.
[01:38:55.040 --> 01:39:05.040]  So I filed a motion to compel and then I also filed a motion for sanctions citing rule 11 for the baseless objection.
[01:39:05.040 --> 01:39:12.040]  I put those most motions in the beginning of the week.
[01:39:12.040 --> 01:39:14.040]  And so I put those in the beginning of the week.
[01:39:14.040 --> 01:39:22.040]  My one question is, do I need to file a motion for a motion hearing on that?
[01:39:22.040 --> 01:39:27.040]  No, if you have filed a motion, you don't file a motion for a motion hearing.
[01:39:27.040 --> 01:39:42.040]  You contact the court coordinator, whoever keeps the record, the calendar for the court and ask the court, ask the coordinator when the judge will next sit to hear motions.
[01:39:42.040 --> 01:39:54.040]  And then file a request to set the motion for hearing on that. You will first you ask her for two different dates.
[01:39:54.040 --> 01:40:02.040]  And you send those two different dates to opposing counsel and ask them which date would be best for you.
[01:40:02.040 --> 01:40:05.040]  And they will probably ignore them.
[01:40:05.040 --> 01:40:10.040]  And when they do, you just pick the date you want.
[01:40:10.040 --> 01:40:16.040]  And then when you set the date, the other side will jump up and down, rail and rights to indignation.
[01:40:16.040 --> 01:40:25.040]  And then you send the court a copy of the certification that you sent them two potential dates and they failed to respond.
[01:40:25.040 --> 01:40:32.040]  So it is insincere to complain now and ask for sanctions against them.
[01:40:32.040 --> 01:40:40.040]  Yeah, but you don't have to file a motion to set for hearing. You just file a request.
[01:40:40.040 --> 01:40:54.040]  So I would call and get the schedule. Then I would contact the other attorney and then I will file a request with the local, because this is an appeal.
[01:40:54.040 --> 01:41:01.040]  So then file a request with my local court, which goes to the appeal for that date.
[01:41:01.040 --> 01:41:09.040]  Yes, make sure you get two dates and give the other side the option of picking the date that's best for them.
[01:41:09.040 --> 01:41:20.040]  Or if they respond and say that neither date is good for them, then ask them to produce a date that they're happy with.
[01:41:20.040 --> 01:41:23.040]  And this way you get them up on the dime.
[01:41:23.040 --> 01:41:40.040]  So that's how to get that rolling. Now they just filed a motion today for an order to have me quit contacting the board itself or in the parties and to only directly communicate with her.
[01:41:40.040 --> 01:41:49.040]  I thought it was interesting too, because she filed with that motion a, like, blink order for the judge to just sign.
[01:41:49.040 --> 01:41:53.040]  And I didn't know that was, like, something I should start doing, but it seemed both kind of convenient.
[01:41:53.040 --> 01:41:55.040]  Yeah. Have you seen that before?
[01:41:55.040 --> 01:42:13.040]  That's the good idea. In fact, I think it might even be a requirement at least in some local courts, if not the actual federal rules of civil procedure, where it's saying, go ahead and send a proposed order that makes it convenient for the judge.
[01:42:13.040 --> 01:42:18.040]  Here's what I'm asking the court to do, and here's the form that you can sign to make that happen.
[01:42:18.040 --> 01:42:36.040]  Okay. And when you send the order, you put in the things you want the judge to do, and you put in, as if the judge were ordering them to do this thing, and then you put two check boxes below it, one granted, and then one for denied.
[01:42:36.040 --> 01:42:46.040]  Okay. And so if I put in, so would that be, like, for example, the motions that I just filed that I could have put a proposed order in with those motions?
[01:42:46.040 --> 01:42:53.040]  Yes. Yes. You can go ahead. If you've already got a motion, you can follow up with the order.
[01:42:53.040 --> 01:43:08.040]  Okay. And my other question on that is, I don't want to, so I don't want to, like, appear to be, you know, like, trying to pick a battle on every, on every side of the issue.
[01:43:08.040 --> 01:43:20.040]  So I'm not sure if I should counter their motion to have me directly respond to them or just, because there's two different rules that seem to conflict with each other.
[01:43:20.040 --> 01:43:28.040]  And so I was using one, and now they're using another, or if I should just let that go and not bother with it.

[01:43:31.040 --> 01:43:41.040]  Well, if they didn't have any grounds for it, you might look and see, did they adequately express, did they bring facts and law to say why?

[01:54:19.040 --> 01:54:35.040]  There's going to be rules of procedure that will limit you. You'll be allowed so many interrogatories, you'll be allowed so many requests for productions of documents, and things like that.
[01:54:35.040 --> 01:54:44.040]  There's different categories of discovery and depositions and things like that, and so the rules of procedure will limit you.
[01:54:44.040 --> 01:54:58.040]  You're only going to be able to ask so many questions. You're only going to be able to ask for so many documents, so you do need to narrow yourself and pick, you know, choose wisely the things that you're going to be asking for.
[01:54:58.040 --> 01:55:10.040]  But as far as waiting, don't wait. Don't wait for motion hearings and this and that. If you're the plaintiff, go get them. Hit them with discovery right away.
[01:55:10.040 --> 01:55:23.040]  I mean, you just start slamming them with discovery, okay, but you have to do it properly because, you know, if they push back, then you'll have to file a motion to compel discovery.
[01:55:23.040 --> 01:55:34.040]  And if the judge, you know, looks at, you know, your questions or whatever you're asking for and feels it's irrelevant, then you'll, you know, you'll get ruled against and then you'll start running out of time.
[01:55:34.040 --> 01:55:42.040]  See, they're going to try to run you out of time, so don't wait. Hit them with discovery. In fact, there's such a thing as pre-litigation discovery.
[01:55:42.040 --> 01:55:52.040]  You can start hitting people with discovery before you sue them because you have a right to know if you have a case or not. This is standard procedure.
[01:55:52.040 --> 01:56:10.040]  So just pick carefully because, you know, you could get ruled against, but go get them. Don't wait. And don't wait for motion hearings and things like that because they'll run you out of time.
[01:56:10.040 --> 01:56:19.040]  You're going to have a time limit to modify pleadings and do depositions and things like that. And they'll run you out of time on purpose.
[01:56:19.040 --> 01:56:31.040]  So go get them. And, yeah. And as far as the open records request, I want to make a comment on that too. Randy mentioned a third party.
[01:56:31.040 --> 01:56:46.040]  Okay. In some states, in Texas, you cannot use open records request to get documents or whatever information for a civil lawsuit against, you know, government entity or public servant or something.
[01:56:46.040 --> 01:56:55.040]  You're not allowed to use open records for the purpose of getting evidence. You have to go through discovery.
[01:56:55.040 --> 01:57:06.040]  And so, but if a third party gets it and happens to post it on their blog or their website, well, then somebody else made it public.
[01:57:06.040 --> 01:57:18.040]  Okay. But you can't, I mean, well, in Texas, you can't procure evidence through open records. That's Texas. But anyway, I just want to make a comment on that.
