[10:35.540 --> 10:41.540]  About six miles from where I live, one of his officers wrote me a traffic ticket

[10:44.540 --> 10:49.540]  He's a municipal police officer, what is he doing writing me a traffic ticket?
[10:49.540 --> 10:53.540]  So I charged him with first degree felony aggravated assault
[10:53.540 --> 10:57.540]  And I filed a complaint with the chief of police
[10:57.540 --> 11:07.540]  And I fully expect that the chief of police will act in strict accordance with Article 2.13 Texas Code of Unprocedure
[11:07.540 --> 11:13.540]  Article 2.13 paragraph C
[11:13.540 --> 11:22.540]  That says that when a policeman is made known that the crime has been committed, he shall give notice to some magistrate
[11:22.540 --> 11:31.540]  It doesn't say that he shall examine into the criminal accusation and decide whether or not he believes the crime has been committed
[11:31.540 --> 11:40.540]  It doesn't say he can take a complaint and give it to a magistrate if he wants to
[11:40.540 --> 11:43.540]  It says he shall
[11:43.540 --> 11:47.540]  Yeah, except it's under B3
[11:47.540 --> 11:52.540]  I take that as an administrative
[11:52.540 --> 12:00.540]  If a public official fails to perform a duty that is administrative, that does not involve discretion
[12:00.540 --> 12:13.540]  And I know most people who hear this think that the police have some authority to determine whether or not they believe a crime has been committed
[12:13.540 --> 12:17.540]  And whether they want to because it was actually their buddy that committed it
[12:17.540 --> 12:27.540]  Yeah, well, even if they, in this case where they are given notice by their master
[12:27.540 --> 12:32.540]  When the master gives the service notice, servant notice of crime
[12:32.540 --> 12:41.540]  I can't find anything in the codes that allow the servant to usurp the master
[12:41.540 --> 12:48.540]  If that's the case, I would very much like to see where they get authority to do that
[12:48.540 --> 12:55.540]  So I've already talked to the chief and told him I'd be giving the complaint and I expect him to give it to some magistrate
[12:55.540 --> 12:57.540]  And he said he didn't know if he'd do that or not
[12:57.540 --> 13:02.540]  I said, well, life is filled with little decisions

[14:30.540 --> 14:35.540]  And now I'll give the Chief of Police another week
[14:35.540 --> 14:47.540]  And then I'll go to the municipal judge for the city of Rome
[14:47.540 --> 14:50.540]  Which is Judge Mentor
[14:50.540 --> 14:55.540]  Judge Mentor and I have clashed swords a time or two
[14:55.540 --> 14:59.540]  And he is not happy with me
[14:59.540 --> 15:05.540]  While he was holding court I was asking the bailiff to arrest him
[15:05.540 --> 15:09.540]  He smart mouthed me in court
[15:09.540 --> 15:13.540]  And asked me what my business was in the courtroom
[15:13.540 --> 15:19.540]  And I told him my business was my business and he used to butt out
[15:19.540 --> 15:23.540]  And he told me while I was to sit down and be quiet
[15:23.540 --> 15:26.540]  I said, Judge, you're the one that approached me
[15:26.540 --> 15:29.540]  I did not approach you
[15:29.540 --> 15:34.540]  So, I asked for a bit of civility
[15:34.540 --> 15:39.540]  Everybody says he's a really nice guy and he might be
[15:39.540 --> 15:43.540]  But he clearly did not understand his position
[15:43.540 --> 15:46.540]  And I'm going to see if I can help him with that
[15:46.540 --> 15:50.540]  But anyway, now he knows who I am
[15:50.540 --> 15:54.540]  So I will be coming to him with criminal charges against the Chief of Police

[16:01.540 --> 16:03.540]  And it will be interesting to see what he does

[19:55.540 --> 20:03.540]  And I was a little bored with that because going after the Attorney General is not very important, not very powerful

[20:34.540 --> 20:45.540]  I was just listening to a program about how different policing has become after the George Floyd demonstrations
[20:45.540 --> 20:52.540]  That police all over the country have had to dramatically change the way they're doing things
[20:52.540 --> 21:03.540]  And they're talking about transit systems in major cities, how they were eliminating or replacing a lot of the transit police
[21:03.540 --> 21:07.540]  with transit liaisons
[21:07.540 --> 21:16.540]  And that the transit police had been instructed, this is mainly due to people sleeping on the trains, homeless people and such
[21:16.540 --> 21:21.540]  That they were not to arrest them, they were not to push them around, abuse them or threaten them
[21:21.540 --> 21:28.540]  But try to assist them to find other accommodations
[21:28.540 --> 21:33.540]  This is what policing was supposed to be
[21:33.540 --> 21:42.540]  Before the federal government started training our police in military attack tactics
[21:42.540 --> 21:51.540]  I looked at what the police were doing and this reminded me of being in an occupied country and I was the occupier
[21:51.540 --> 21:59.540]  You had to have absolute control at all times
[21:59.540 --> 22:06.540]  Everyone was considered to be a combatant until they demonstrated otherwise
[22:06.540 --> 22:13.540]  Well, I am not in an occupied country, I am not a civilian
[22:13.540 --> 22:21.540]  I am the master, they are my servants and I expect them to conduct themselves that way
[22:21.540 --> 22:31.540]  Well, my most recent experience with police officers have demonstrated that they got that
[22:31.540 --> 22:42.540]  They have been much more cautious, much more civil than they've been in the past
[22:42.540 --> 22:51.540]  They see with all of this defund the police going on, they got the idea you can only push the master so far
[22:51.540 --> 22:56.540]  And he is going to stomp all over you and that is exactly what happened
[22:56.540 --> 23:02.540]  And all of the police seem to have been instructed in a different set of behaviors
[23:02.540 --> 23:10.540]  I take that as a very good thing, but it is something that we have to work with, we have to cultivate

[23:33.540 --> 23:35.540]  Yes sir, I do
[23:35.540 --> 23:39.540]  Why is it on your window? I didn't want to put it there
[23:39.540 --> 23:43.540]  You know, normally they will get all huffy puffy
[23:43.540 --> 23:46.540]  And he says, well, do you have it? I say, yes I do
[23:46.540 --> 23:48.540]  Well, where is it? What is here in the club compartment?
[23:48.540 --> 23:50.540]  Well, he actually asked me that first
[23:50.540 --> 23:54.540]  Then he asked me why it wasn't on the window and I said I didn't want to put it there
[23:54.540 --> 23:58.540]  He said, will you show it to me? No
[23:58.540 --> 24:03.540]  And you know, you live here, you know how police act
[24:03.540 --> 24:06.540]  I said no
[24:06.540 --> 24:09.540]  I don't think he had ever heard that before
[24:09.540 --> 24:11.540]  Well, I have to write you a ticket
[24:11.540 --> 24:13.540]  Oh, okay, okay, that will be
[24:13.540 --> 24:18.540]  You know, I step my hand out and tell him, yeah, yeah, yeah, that's okay, go ahead
[24:18.540 --> 24:21.540]  And he is wanting to get real huffy puffy
[24:21.540 --> 24:24.540]  But he has been told not to
[24:24.540 --> 24:33.540]  And it didn't take me long to realize that he was not comfortable with this new set of conditions
[24:33.540 --> 24:39.540]  I looked at him and he's one of those guys that are the tough guy cop
[24:39.540 --> 24:45.540]  And if I was in trouble and I needed someone to help me out, that's the guy I want
[24:45.540 --> 24:51.540]  He clearly had the capacity to be tough
[24:51.540 --> 24:58.540]  But also it was clear he had been muzzled
[24:58.540 --> 25:04.540]  Somebody warned him, you be careful
[25:04.540 --> 25:12.540]  We don't want any more of these problems like George Floyd or anything even anywhere near
[25:12.540 --> 25:23.540]  So the guy handled himself in exactly the way I expect a professional policeman to handle himself
[25:23.540 --> 25:30.540]  Now he did write me a ticket and I did file criminal charges against him for writing me the ticket
[25:30.540 --> 25:38.540]  But I will also write a letter of commendation for him with his chief
[25:38.540 --> 25:44.540]  Now consider the conundrum I'm going to put the chief of police in
[25:44.540 --> 25:49.540]  I'll explain to the chief what I did to him
[25:49.540 --> 25:56.540]  I very deliberately interrupted his expectations
[25:56.540 --> 26:02.540]  I did things he did not see coming and did not know how to deal with
[26:02.540 --> 26:09.540]  But he never once lost his professional decorum
[26:09.540 --> 26:16.540]  If I need somebody with a pistol to protect me, send that guy
[26:16.540 --> 26:22.540]  That guy's not going to be terrified like one of these videos
[26:22.540 --> 26:28.540]  The police officers arresting somebody and someone else came out a good ways away from them
[26:28.540 --> 26:32.540]  And was taking photographs of him
[26:32.540 --> 26:38.540]  And the policeman thought he was pointing a gun at him and the policeman absolutely freaked out
[26:38.540 --> 26:42.540]  I don't want that guy with a gun
[26:42.540 --> 26:49.540]  The other police got him under control and apparently he was removed from the force because he had an anxiety attack
[26:49.540 --> 26:52.540]  I want that guy
[26:52.540 --> 26:56.540]  I want the guy that's absolutely cool as a cucumber
[26:56.540 --> 27:00.540]  I want the guy I can't put over the edge
[27:00.540 --> 27:05.540]  That no matter what I do to him, no matter how much I annoy him
[27:05.540 --> 27:07.540]  He maintains his professional decorum
[27:07.540 --> 27:14.540]  I was in the military and that is precisely what we were ordered to do
[27:14.540 --> 27:17.540]  And that's what we did
[27:17.540 --> 27:21.540]  You could throw eggs at us, you could spit at us, you could do whatever you want
[27:21.540 --> 27:23.540]  Except point a gun at us
[27:23.540 --> 27:30.540]  You point a gun at us and we'll drop you like a sack of potatoes without hesitation
[27:30.540 --> 27:35.540]  But only if you did something that threatened our lives
[27:35.540 --> 27:37.540]  You did stuff that annoyed us
[27:37.540 --> 27:42.540]  We could not respond to that, we had orders
[27:42.540 --> 27:45.540]  Didn't make any difference how much you annoyed me
[27:45.540 --> 27:51.540]  Didn't make any difference how hyped up I was on adrenaline
[27:51.540 --> 27:58.540]  We had to maintain professional control and that's exactly what this officer did
[27:58.540 --> 28:01.540]  Yeah, if I need somebody with a gun, send this guy
[28:01.540 --> 28:05.540]  Now that doesn't mean I'm going to go any slack
[28:05.540 --> 28:13.540]  But I'm going to do what the CEO of a company would do
[28:13.540 --> 28:18.540]  To one of their low level employees
[28:18.540 --> 28:26.540]  I expect my employees to follow the company policies, I don't care if they like them or not
[28:26.540 --> 28:30.540]  And if they follow those policies, they're not going to have any problem from me
[28:30.540 --> 28:33.540]  If they don't follow those policies, they're going to have a problem
[28:33.540 --> 28:40.540]  That's all there is to it, it's not about emotion, it's not about personal opinions
[28:40.540 --> 28:42.540]  We're all professionals here
[28:42.540 --> 28:47.540]  And frankly, I'm beginning to see more professionalism in the police department
[28:47.540 --> 28:55.540]  And if you and I continue to demand it, then we will keep it
[28:55.540 --> 29:00.540]  When we stop demanding it, things will start going back to where they were
[29:00.540 --> 29:05.540]  And that's why I'm going to write this officer accommodation letter
[29:05.540 --> 29:13.540]  And I'll let the chief know that I did things that I knew for certain would be outside of his experience
[29:13.540 --> 29:19.540]  That would cause what a neuro-linguistic program would call a pattern interruption
[29:19.540 --> 29:23.540]  Where he would not know what to do
[29:23.540 --> 29:30.540]  So what does your officer do when he gets a situation that's new to him and unusual?
[29:30.540 --> 29:35.540]  How does he handle himself when this guy handles himself like a pro?
[29:35.540 --> 29:39.540]  So we'll pick this up on the other side, we do have one call

[34:22.540 --> 34:30.540]  What I'm talking about here is I think we have a great opportunity
[34:30.540 --> 34:36.540]  For the public to reestablish rapport with the police
[34:36.540 --> 34:42.540]  The police have been trained to consider the public as criminal
[34:42.540 --> 34:46.540]  As far as they're concerned everybody's a perp
[34:46.540 --> 34:56.540]  But statistics show that about 6% of the people do 96% of the crime
[34:56.540 --> 35:07.540]  The police keep running into the same section of the population over and over and over
[35:07.540 --> 35:10.540]  The listeners out there
[35:10.540 --> 35:18.540]  You know I'm in my 70s and I look back on in the last 70 something years
[35:18.540 --> 35:21.540]  How many times have I encountered police officers?
[35:21.540 --> 35:24.540]  And I've encountered them much more than most people
[35:24.540 --> 35:27.540]  There's a lot of them I started myself
[35:27.540 --> 35:34.540]  Most people have almost no contact with the police
[35:34.540 --> 35:37.540]  Once or twice in their life
[35:37.540 --> 35:41.540]  Because they're good guys, they're not part of the 6%
[35:41.540 --> 35:46.540]  The problem the police have is they've been trained to treat everyone
[35:46.540 --> 35:50.540]  That they encounter as if they're a part of this 6%
[35:50.540 --> 35:55.540]  And what that amounted to was to steel themselves
[35:55.540 --> 36:03.540]  To protect themselves against the potential of being harmed or injured by these 6%
[36:03.540 --> 36:07.540]  But they treated everyone as if they were there to harm them
[36:07.540 --> 36:15.540]  And what they wound up doing is creating a much greater potential for harm than there would have been
[36:15.540 --> 36:22.540]  Had they treated the people they stopped initially as if they were part of the good guys
[36:22.540 --> 36:26.540]  The 94% who never get in trouble
[36:26.540 --> 36:36.540]  And if they did that, a much smaller percentage of the 6% would become a problem for them
[36:36.540 --> 36:40.540]  If they just simply treated people with dignity and respect
[36:40.540 --> 36:45.540]  You're right. Brett, if I come and I order you to do something
[36:45.540 --> 36:50.540]  Especially if I'm a policeman and you're a citizen, your first reaction is going to be, what?
[36:50.540 --> 36:53.540]  Oh yes sir, I'll do exactly what you say wherever you want it
[36:53.540 --> 36:56.540]  Is that going to be your response, Brett?
[36:56.540 --> 36:59.540]  My response was a typical response
[36:59.540 --> 37:01.540]  Your response?
[37:01.540 --> 37:07.540]  My response is to try to figure out where they get the authority to try to tell me anything
[37:07.540 --> 37:15.540]  Okay, if a policeman pulled you over and said, Mr. Fowden, I clocked you speeding
[37:15.540 --> 37:21.540]  Would you please let me see your license and proof of insurance? Would that be a problem for you?
[37:21.540 --> 37:23.540]  What would you do?
[37:23.540 --> 37:27.540]  I want to find out from him if this is some kind of a crime
[37:27.540 --> 37:37.540]  Are you trying to get me to produce some documents that you intend to use against me?
[37:37.540 --> 37:41.540]  You're not trying to compel me to give evidence, are you?
[37:41.540 --> 37:44.540]  Oh no, no, Mr. Fowden
[37:44.540 --> 37:48.540]  I have reason to believe that you may have committed a crime
[37:48.540 --> 37:52.540]  And these are just some steps I'm required to go through
[37:52.540 --> 37:57.540]  I'm not trying to entrap you or anything like that
[37:57.540 --> 38:00.540]  This is my job
[38:00.540 --> 38:03.540]  If I don't do this, I'm going to get in a lot of trouble
[38:03.540 --> 38:05.540]  I'm not trying to give you a hard time
[38:05.540 --> 38:07.540]  All right, well, there's been no crimes
[38:07.540 --> 38:09.540]  And I guess you're going to do your job
[38:09.540 --> 38:11.540]  Just go ahead, do your job, but not with me
[38:11.540 --> 38:13.540]  I don't have anything to tell you
[38:13.540 --> 38:19.540]  Okay, civility breeds civility
[38:19.540 --> 38:23.540]  If I asked you to hold your hand up with your palm out
[38:23.540 --> 38:28.540]  And I reach up and put my palm against your palm and push
[38:28.540 --> 38:30.540]  You're going to push back
[38:30.540 --> 38:33.540]  It's what human beings do
[38:33.540 --> 38:39.540]  Now, not all, there are some that will just fall backwards
[38:39.540 --> 38:41.540]  But the majority will push back
[38:41.540 --> 38:47.540]  They won't push back, they'll just steel themselves and resist
[38:47.540 --> 38:53.540]  But if I asked you politely to do something
[38:53.540 --> 38:59.540]  It is the tendency in a civilized culture to be civil
[38:59.540 --> 39:02.540]  You are much more likely to cooperate with me
[39:02.540 --> 39:05.540]  If I treat you with dignity and respect
[39:05.540 --> 39:15.540]  Than you are if I treat you with arrogance and aggressive behavior
[39:15.540 --> 39:18.540]  It just works better
[39:18.540 --> 39:23.540]  And if I as a policeman treat you with dignity and respect
[39:23.540 --> 39:25.540]  You're going to trust me more
[39:25.540 --> 39:28.540]  Now, I may be a dirty rotten scoundrel
[39:28.540 --> 39:32.540]  And be doing nothing but trying to find a reason to arrest you
[39:32.540 --> 39:36.540]  But if I treat you with dignity and respect
[39:36.540 --> 39:41.540]  You're more likely to give me what I need to arrest you
[39:41.540 --> 39:46.540]  Say, you know, do you mind if I ask
[39:46.540 --> 39:51.540]  Why did you steal all that stuff from that convenience store back there?
[39:51.540 --> 39:55.540]  Oh well, I was hungry
[39:55.540 --> 40:01.540]  If you treat people with dignity and respect, you get better results
[40:01.540 --> 40:10.540]  And right now, the police have been ordered to treat the public with dignity and respect
[40:10.540 --> 40:13.540]  If we want that
[40:13.540 --> 40:16.540]  We need to return that
[40:16.540 --> 40:20.540]  And compliment them when they do the right thing
[40:20.540 --> 40:28.540]  How many of you out there have sent letters of recommendation or commendation for officers?
[40:28.540 --> 40:32.540]  When they do the right thing
[40:32.540 --> 40:36.540]  I had a highway patrol
[40:36.540 --> 40:39.540]  I was pulled over on the side of the highway
[40:39.540 --> 40:43.540]  I had a motor in the back of my brand new avalanche
[40:43.540 --> 40:45.540]  And I noticed it moving around a little bit
[40:45.540 --> 40:50.540]  So I pulled over to tighten up all my ties to make sure it didn't come loose
[40:50.540 --> 40:55.540]  It was a light misty drizzly rain
[40:55.540 --> 40:58.540]  And a highway patrolman stopped in the highway, rolled down his window
[40:58.540 --> 41:01.540]  And he said, sir, is there a problem?
[41:01.540 --> 41:04.540]  And I told him, no, I've got this new avalanche
[41:04.540 --> 41:10.540]  If this motor comes loose and scratches it, you'll be called out to investigate a homicide
[41:10.540 --> 41:13.540]  Because my wife will kill me
[41:13.540 --> 41:16.540]  I said, well, do you need any help?
[41:16.540 --> 41:18.540]  Oh, no, no, I'm just tightening it up, I'm good
[41:18.540 --> 41:21.540]  He said, well, okay, I just wanted to see if you need any help
[41:21.540 --> 41:24.540]  I said, thank you, and he left
[41:24.540 --> 41:29.540]  I called the sergeant as soon as I got back in the car, got it all tightened up
[41:29.540 --> 41:33.540]  I called the local sergeant who hated me
[41:33.540 --> 41:35.540]  Sergeant Rankin had no sense of humor
[41:35.540 --> 41:41.540]  And I told him that one of your officers just stopped while I was on the side of the road
[41:41.540 --> 41:44.540]  Tightening up a load in the back of my vehicle
[41:44.540 --> 41:46.540]  And wanted to know if I needed any help
[41:46.540 --> 41:49.540]  He said, well, Mr. Carlton, what's the problem?
[41:49.540 --> 41:51.540]  Well, no problem at all
[41:51.540 --> 41:56.540]  I just wanted you to know and wanted him to know how much I appreciated that
[41:56.540 --> 42:03.540]  That he stopped not to find a reason to arrest me or to write me a ticket
[42:03.540 --> 42:08.540]  But he genuinely stopped to offer me assistance
[42:08.540 --> 42:11.540]  And I just wanted you to know how much I appreciate that
[42:11.540 --> 42:16.540]  Now, he knew me really well, I'd have hammered him several times
[42:16.540 --> 42:19.540]  So that was all there was to it
[42:19.540 --> 42:24.540]  Two years later I walked into the JP's office
[42:24.540 --> 42:31.540]  There were about a half a dozen DPS officers in there
[42:31.540 --> 42:36.540]  And this big tall guy walked up and said, well, hello, Mr. Carlton
[42:36.540 --> 42:38.540]  And I looked up at him
[42:38.540 --> 42:40.540]  He said, you don't remember me, do you?
[42:40.540 --> 42:43.540]  I said, did you arrest me?
[42:43.540 --> 42:46.540]  And two or three of them said, one of them said, I did
[42:46.540 --> 42:48.540]  Another said, well, I will
[42:48.540 --> 42:50.540]  They all kind of knew me
[42:50.540 --> 42:55.540]  And then he said, well, I'm the one that pulled over to see if you needed any help
[42:55.540 --> 43:02.540]  Two years later, he took one look at me and knew exactly who I was
[43:02.540 --> 43:07.540]  That was because I called the sergeant and gave a recommendation for him
[43:07.540 --> 43:09.540]  That don't happen often
[43:09.540 --> 43:11.540]  Yeah, it doesn't
[43:11.540 --> 43:22.540]  If we want good policing, we should reward good behavior just as quickly as we condemn bad behavior
[43:22.540 --> 43:25.540]  Boy, Randy, I've got to tell you, I'm ready to do that
[43:25.540 --> 43:30.540]  I wish one of them would do something like that that I could reward them for
[43:30.540 --> 43:32.540]  I'm so ready to do it

[46:45.540 --> 46:54.540]  What I was getting to is we have an opportunity here to really psych out the police
[46:54.540 --> 47:05.540]  We have an opportunity to get them to have reason to treat us with dignity and respect
[47:05.540 --> 47:10.540]  And I like to do this because it really psychs them out
[47:10.540 --> 47:14.540]  I got a ticket in Rome, Texas
[47:14.540 --> 47:19.540]  I called the dispatcher, I was trying to get to the chief of police
[47:19.540 --> 47:23.540]  And this female dispatcher, I talked to her
[47:23.540 --> 47:30.540]  And she was very professional
[47:30.540 --> 47:34.540]  And she asked me, I told her what I was doing
[47:34.540 --> 47:39.540]  We got into a conversation and I started explaining what I was doing
[47:39.540 --> 47:42.540]  I started giving her code, but she looked it up
[47:42.540 --> 47:47.540]  And it turned out she was surprisingly knowledgeable in code
[47:47.540 --> 47:52.540]  She brought up an unusual code out of the transportation code
[47:52.540 --> 47:58.540]  that appeared to authorize officers to enforce the transportation code
[47:58.540 --> 48:05.540]  I authorized police officers to enforce the transportation code
[48:05.540 --> 48:09.540]  So I told her that is interesting and I looked it up
[48:09.540 --> 48:21.540]  Well it turned out that the code she quoted was only referred to the transportation authority
[48:21.540 --> 48:29.540]  Transportation authority goes to like trains and bus terminals
[48:29.540 --> 48:37.540]  So only in those places could a peace officer enforce the transportation code
[48:37.540 --> 48:41.540]  Nowhere else, and we had a back and forth through the code
[48:41.540 --> 48:43.540]  It went really well
[48:43.540 --> 48:51.540]  And then when I filed, the second time I called
[48:51.540 --> 48:55.540]  I called to get the chief's email
[48:55.540 --> 48:58.540]  So I filed criminal charges against his officer
[48:58.540 --> 49:00.540]  I had talked to the chief about this
[49:00.540 --> 49:08.540]  And he was doing the standard bamboo line crapola
[49:08.540 --> 49:13.540]  And I told him that I'd be filing a criminal complaint against his officer
[49:13.540 --> 49:19.540]  And I expected him to give the complaint to some magistrate in accordance with Article 2.13
[49:19.540 --> 49:21.540]  Texas Court of Criminal Procedure
[49:21.540 --> 49:24.540]  Well Mr. Kelton, I don't know if I'll do that or not
[49:24.540 --> 49:31.540]  I said well life is filled with little decisions, we all get to make stuff, your turn
[49:31.540 --> 49:34.540]  But as far as I'm concerned, I don't care what you do
[49:34.540 --> 49:39.540]  You will either do what the law commands you to do or not
[49:39.540 --> 49:42.540]  And if you don't, I'll just take the next step
[49:42.540 --> 49:46.540]  Well the next time I called
[49:46.540 --> 49:49.540]  Because I had, I wanted to get his email
[49:49.540 --> 49:54.540]  Because I had sent a verified criminal affidavit by certified mail to him
[49:54.540 --> 50:00.540]  And I wanted to email him a copy because the document I created was fully hyperlinked
[50:00.540 --> 50:04.540]  And I wanted him to have access to all the hyperlinks
[50:04.540 --> 50:07.540]  I got this same dispatcher
[50:07.540 --> 50:12.540]  And she said, oh hello Mr. Kelton, she recognized my voice
[50:12.540 --> 50:19.540]  And she said, I hope you get done what you're trying to do
[50:19.540 --> 50:23.540]  Because I told her, you know, I wasn't trying to pick on the police or anything
[50:23.540 --> 50:28.540]  I was trying to fix something in the system
[50:28.540 --> 50:33.540]  So she remembered that, she remembered me clearly
[50:33.540 --> 50:41.540]  And that told me that she almost certainly talked to the chief about talking to me
[50:41.540 --> 50:46.540]  So what does the chief do? He wants to demonize me
[50:46.540 --> 50:50.540]  And I've always told his dispatcher that, you know, I'm not after this officer
[50:50.540 --> 50:56.540]  But I have to go after this officer and then through the chief
[50:56.540 --> 51:05.540]  And then the municipal court to get to the prosecuting attorneys who were really the problem
[51:05.540 --> 51:09.540]  So she's telling him, you know, that I'm a good guy
[51:09.540 --> 51:13.540]  So how does he demonize me?
[51:13.540 --> 51:18.540]  Guys, this is so much fun
[51:18.540 --> 51:21.540]  You take the police and make them a little crazy
[51:21.540 --> 51:29.540]  They want to consider you as agitated
[51:29.540 --> 51:33.540]  If you get yourself together
[51:33.540 --> 51:38.540]  And put away all your anger and animosity
[51:38.540 --> 51:46.540]  When you deal with policemen, think in terms of manipulating them the way they've been manipulating you
[51:46.540 --> 51:52.540]  You can have a dramatic effect on local departments
[51:52.540 --> 51:59.540]  It doesn't take everybody to make serious change, it only takes a few
[51:59.540 --> 52:06.540]  And if we get ourselves together, get ourselves under control
[52:06.540 --> 52:08.540]  We can have a dramatic effect
[52:08.540 --> 52:18.540]  We have the opportunity because of these demonstrations that raise so much concern
[52:18.540 --> 52:21.540]  Now the police have been ordered to act with dignity and respect
[52:21.540 --> 52:27.540]  And if we return that dignity and respect while we're kicking their behinds
[52:27.540 --> 52:31.540]  It will dramatically change how police deal with us
[52:31.540 --> 52:36.540]  And give us access to the higher levels that are actually causing this problem
[52:36.540 --> 52:41.540]  That's my story, that's all the lecture I'm going to do for today

[53:44.540 --> 53:53.540]  But I was wondering if you could help me out with some options that I might be able to exercise

[53:55.540 --> 54:07.540]  All right, so we've been having issues for a few years now with some property damage and just general aggression
[54:07.540 --> 54:11.540]  The person's actually been taken away
[54:11.540 --> 54:15.540]  She threatened the police a few times, she's gone to jail a few times basically
[54:15.540 --> 54:20.540]  And I'm not sure how she keeps ending up back at the house to cause problems, but
[54:20.540 --> 54:23.540]  Okay, wait a minute, wait a minute
[54:23.540 --> 54:24.540]  Sure
[54:24.540 --> 54:30.540]  Something, what I'm hearing tells me something else is going on
[54:30.540 --> 54:36.540]  Are you the only person this individual's having trouble with?
[54:36.540 --> 54:41.540]  Oh no, this has been going on for, I've heard since the 80s
[54:41.540 --> 54:50.540]  So I'm not the first and I probably won't be the last, but it's kind of impacting my family and I'm not sure what to do
[54:50.540 --> 54:55.540]  Okay, have you ever read my rubber ball theory?
[54:55.540 --> 54:59.540]  No, I do have your legal 101 book though
[54:59.540 --> 55:03.540]  Okay, send me an email and ask for my rubber ball theory
[55:03.540 --> 55:11.540]  I study law, but law is not my primary study, psychology is my primary study
[55:11.540 --> 55:18.540]  And what I just heard is you have someone that has issues
[55:18.540 --> 55:29.540]  And I suspect that your issues with her, your legal issues with her are simply not the problem
[55:29.540 --> 55:37.540]  If she has behavioral issues, you can address your issues with her
[55:37.540 --> 55:45.540]  But what you're likely to do is trigger what in psychology is called an ad reaction

[55:47.540 --> 55:59.540]  An unexpected and out of context reaction from someone who has emotional or behavioral issues

[56:02.540 --> 56:06.540]  There may be another way to deal with her
[56:06.540 --> 56:11.540]  I'm open to all ears, I just want to figure out a solution to the problem
[56:11.540 --> 56:21.540]  Okay, well, one of the things we talk about in the rubber ball theory is when I was five years old
[56:21.540 --> 56:29.540]  I pretty well knew the full range of human response within my native culture
[56:29.540 --> 56:34.540]  I knew what would make you smile, frown, happy, sad
[56:34.540 --> 56:45.540]  I pretty well knew how to anticipate the way you would respond to whatever I do
[56:45.540 --> 56:49.540]  Not to think so is naive
[56:49.540 --> 56:57.540]  Someone may say something or do something and you can feel your anal sphincter squeeze shut
[56:57.540 --> 57:04.540]  And it tenses you up, makes you really pisses you off
[57:04.540 --> 57:15.540]  Do you really imagine that the person who did that doesn't know exactly how you're responding to them?
[57:15.540 --> 57:18.540]  Of course, of course they know
[57:18.540 --> 57:27.540]  Okay, maybe they don't know in a conscious volitional awareness
[57:27.540 --> 57:35.540]  But on some level of awareness they know precisely what kind of behaviors they're triggering from you
[57:35.540 --> 57:44.540]  Anybody who's listened to my show a lot probably remembers the story I tell about the Denton County District Attorney's Office
[57:44.540 --> 57:56.540]  When I went to his office to get some criminal affidavits verified by a district attorney
[57:56.540 --> 58:01.540]  I asked the clerk, I had some criminal complaints here
[58:01.540 --> 58:08.540]  I need a prosecutor to verify these complaints in accordance with your duty under Article 2.06 Code of Criminal Procedure
[58:08.540 --> 58:10.540]  She said, oh sure, I'll send someone out
[58:10.540 --> 58:14.540]  I sent out this young kid and he came out and he looked at them
[58:14.540 --> 58:20.540]  He said, I can't sign these, these are against my boss
[58:20.540 --> 58:24.540]  I said, what's the matter, chicken?
[58:24.540 --> 58:27.540]  He said, darn right
[58:27.540 --> 58:32.540]  And I liked that guy
[58:32.540 --> 58:36.540]  This guy knew and understood who and what he was
[58:36.540 --> 58:41.540]  He wasn't putting on airs, he said this is the kind of guy you don't mess with

[01:04:28.540 --> 01:04:34.540]  And here he was my parachute. I'm just devastated
[01:04:34.540 --> 01:04:40.540]  Okay, Taylor, you have a woman that's causing difficulty
[01:04:40.540 --> 01:04:44.540]  But she's not just causing difficulty with you
[01:04:44.540 --> 01:04:47.540]  She's causing difficulty with other people
[01:04:47.540 --> 01:04:54.540]  And for you to think that this problem is about you is naive
[01:04:54.540 --> 01:05:00.540]  This is something that she's doing
[01:05:00.540 --> 01:05:08.540]  And if you can shift gears and realize that you are not the center of this cyclone
[01:05:08.540 --> 01:05:15.540]  That she is creating in her life what she expects
[01:05:15.540 --> 01:05:22.540]  You will not get in your life what you want or what you wish for
[01:05:22.540 --> 01:05:26.540]  The brain is not structured that way
[01:05:26.540 --> 01:05:31.540]  You will create in your life your expectations
[01:05:31.540 --> 01:05:35.540]  Let's take the child who's been abused all his life
[01:05:35.540 --> 01:05:38.540]  Take him out of the abusive environment
[01:05:38.540 --> 01:05:41.540]  Put him in a nurturing and caring environment
[01:05:41.540 --> 01:05:46.540]  Where they treat him the way he's always wanted and wished for
[01:05:46.540 --> 01:05:50.540]  He likes it. This is great. This is wonderful
[01:05:50.540 --> 01:05:58.540]  However, it's not what he knows. It's not what he expects
[01:05:58.540 --> 01:06:03.540]  And he's always waiting for the other foot to fall
[01:06:03.540 --> 01:06:07.540]  And if it doesn't, he will create it
[01:06:07.540 --> 01:06:16.540]  Reason being is he doesn't know how to respond and react in this environment
[01:06:16.540 --> 01:06:21.540]  The worst thing that can happen to us is pattern interruption
[01:06:21.540 --> 01:06:28.540]  To have something happen where we don't know how to respond
[01:06:28.540 --> 01:06:33.540]  That's worse than not getting what we want or what we wish for
[01:06:33.540 --> 01:06:38.540]  Think about it. Think about the time something has occurred
[01:06:38.540 --> 01:06:42.540]  And you have no clue as to how to respond to it
[01:06:42.540 --> 01:06:47.540]  That is about the most ultimate pattern interruption you can have
[01:06:47.540 --> 01:06:52.540]  In this case, this young lawyer, he begged off
[01:06:52.540 --> 01:07:01.540]  So he went in the back and sent out the head of their criminal intake section
[01:07:01.540 --> 01:07:05.540]  Roger Jones. And Roger Jones came out
[01:07:05.540 --> 01:07:09.540]  And I gave him this set of complaints against his boss
[01:07:09.540 --> 01:07:14.540]  He looked at them and then took the papers by the corner
[01:07:14.540 --> 01:07:17.540]  And flung them. And papers went everywhere
[01:07:17.540 --> 01:07:21.540]  And he said, I'm not going to take these
[01:07:21.540 --> 01:07:24.540]  And I said, they just went everywhere
[01:07:24.540 --> 01:07:27.540]  And I'm picking them up and I said, is there any special reason?
[01:07:27.540 --> 01:07:29.540]  Or are you just pissed off today?
[01:07:29.540 --> 01:07:31.540]  I'm just not going to take them
[01:07:31.540 --> 01:07:34.540]  I said, okay, and I picked up all these papers and it's a big mess
[01:07:34.540 --> 01:07:38.540]  And I walk over to the receptionist and I said, ma'am
[01:07:38.540 --> 01:07:42.540]  Have you got an attorney who's literate?
[01:07:42.540 --> 01:07:44.540]  She said, huh?
[01:07:44.540 --> 01:07:47.540]  I'm one who can write. I need one to verify these criminal affidavits
[01:07:47.540 --> 01:07:52.540]  And according to their duty under Article 2.06, Texas Code of Criminal Procedure
[01:07:52.540 --> 01:07:58.540]  And Roger Jones said, Mr. Kelton, you are not welcome here anymore
[01:07:58.540 --> 01:08:01.540]  And I turned to Mr. Jones and I said
[01:08:01.540 --> 01:08:04.540]  Oh, Mr. Jones, I feel disparaged
[01:08:04.540 --> 01:08:07.540]  You're going to hurt my feelings
[01:08:07.540 --> 01:08:09.540]  He said, Mr. Kelton, you're creating a disturbance
[01:08:09.540 --> 01:08:11.540]  If you don't leave, you're going to
[01:08:11.540 --> 01:08:13.540]  I'm sorry, you're creating a disturbance
[01:08:13.540 --> 01:08:16.540]  You need to leave the building right now
[01:08:16.540 --> 01:08:18.540]  And I knew I shouldn't have done it
[01:08:18.540 --> 01:08:20.540]  But I couldn't help myself
[01:08:20.540 --> 01:08:24.540]  I said, I'll tell you what, Mr. Jones
[01:08:24.540 --> 01:08:26.540]  If you'll just bend over
[01:08:26.540 --> 01:08:30.540]  I'll pull that wild hair out of your behind for you
[01:08:30.540 --> 01:08:36.540]  And you and I can go back and treat one another like mature and responsible adults

[01:10:12.540 --> 01:10:22.540]  It is intended as a therapeutic metaphor, a form of secret hypnosis

[01:10:26.540 --> 01:10:31.540]  But if I've done my job right, it will install an internal understanding
[01:10:31.540 --> 01:10:37.540]  Of something about the nature of human interaction

[01:10:42.540 --> 01:10:46.540]  Yeah, I'm sorry, I'm in a truck right now, I'll mute while you're talking

[01:10:50.540 --> 01:10:57.540]  It is a tool for affecting positive change in other people
[01:10:57.540 --> 01:11:03.540]  And it will do so outside their conscious awareness
[01:11:03.540 --> 01:11:08.540]  It will go to the fact that emotions
[01:11:08.540 --> 01:11:14.540]  Emotions are not nouns, they're verbs
[01:11:14.540 --> 01:11:18.540]  Emotions are not things that happen to you
[01:11:18.540 --> 01:11:24.540]  They are internal communications between one aspect of mine and another
[01:11:24.540 --> 01:11:30.540]  When you realize what emotions really are
[01:11:30.540 --> 01:11:35.540]  It will give you a level of control of your environment that you've never experienced before
[01:11:35.540 --> 01:11:40.540]  And once you get it, once you understand it
[01:11:40.540 --> 01:11:45.540]  It becomes a realization and you can never go back to where you were
[01:11:45.540 --> 01:11:51.540]  But what it will do is give you the ability to interrupt someone
[01:11:51.540 --> 01:11:55.540]  On a level that's outside their awareness
[01:11:55.540 --> 01:11:59.540]  That's precisely what I did to the sergeant
[01:11:59.540 --> 01:12:04.540]  He hated me, I had really hammered him and some of his officers a number of times
[01:12:04.540 --> 01:12:07.540]  And that's what he was expecting me to do
[01:12:07.540 --> 01:12:13.540]  And I called in and for no other reason than to praise one of his officers
[01:12:13.540 --> 01:12:18.540]  He had no idea how to categorize that
[01:12:18.540 --> 01:12:22.540]  No idea how to deal with it
[01:12:22.540 --> 01:12:24.540]  He didn't know what I was doing to him
[01:12:24.540 --> 01:12:29.540]  This woman you're dealing with apparently doesn't just have issues with you
[01:12:29.540 --> 01:12:34.540]  She has issues with somebody, with other people
[01:12:34.540 --> 01:12:41.540]  You have the opportunity to give her an incredible gift
[01:12:41.540 --> 01:12:46.540]  And it's much easier than you would think
[01:12:46.540 --> 01:12:53.540]  She knows how you are likely to respond to her
[01:12:53.540 --> 01:13:05.540]  She apparently has grown up in an environment that has taught her to elicit negative responses from people around her
[01:13:05.540 --> 01:13:09.540]  I can't tell you specifically how to respond to her, but you can
[01:13:09.540 --> 01:13:11.540]  You can figure that out
[01:13:11.540 --> 01:13:18.540]  Your inner mind knows how to do that

[01:13:42.540 --> 01:13:51.540]  With that said, while you can dramatically manipulate someone
[01:13:51.540 --> 01:13:57.540]  Or manipulate is not the right word, you can dramatically affect someone
[01:13:57.540 --> 01:14:02.540]  What you cannot do is intentionally manipulate people
[01:14:02.540 --> 01:14:04.540]  You can interrupt them
[01:14:04.540 --> 01:14:09.540]  When I told Roger Jones that I'd pull that wild hair out of his behind for me
[01:14:09.540 --> 01:14:13.540]  He was mentally stopped in his tracks
[01:14:13.540 --> 01:14:20.540]  He had no behavior in his internal repertoire to deal with that
[01:14:20.540 --> 01:14:27.540]  And I guarantee you, when you do that to somebody, you have got their attention
[01:14:27.540 --> 01:14:41.540]  And what it does is forces them to go inside and reexamine the internal automatic behaviors that their experience triggers in them
[01:14:41.540 --> 01:14:47.540]  When their automatic behaviors come false, when they don't work the way they expect them to
[01:14:47.540 --> 01:14:55.540]  It triggers an aspect of mind that goes in and looks at the behaviors and says, okay, this really sucked
[01:14:55.540 --> 01:14:58.540]  I don't ever want that to happen to me again
[01:14:58.540 --> 01:15:05.540]  How can I do things different so that when I encounter this input
[01:15:05.540 --> 01:15:11.540]  I have a more sophisticated response to it so that I don't get tripped up like that
[01:15:11.540 --> 01:15:14.540]  This is an extremely powerful tool
[01:15:14.540 --> 01:15:18.540]  And I could give you all kinds of legal advice of how to deal with her
[01:15:18.540 --> 01:15:24.540]  But if you're dealing with someone who has behavioral issues
[01:15:24.540 --> 01:15:27.540]  These are going to keep coming back
[01:15:27.540 --> 01:15:32.540]  If you're dealing with someone who's not logical and reasonable
[01:15:32.540 --> 01:15:36.540]  Don't expect logic and reason to work for you
[01:15:36.540 --> 01:15:41.540]  You need to look beyond that and this will give you the tool to do that

[01:16:43.540 --> 01:16:52.540]  You're going to keep having trouble with them unless you can kick the struts out from under her
[01:16:52.540 --> 01:17:00.540]  And make yourself someone that keeps her

[01:21:20.540 --> 01:21:26.540]  We all have behaviors that we've learned throughout our lives
[01:21:26.540 --> 01:21:31.540]  And we perceive a set of circumstances
[01:21:31.540 --> 01:21:35.540]  And a part of our mind that's not in the conscious awareness
[01:21:35.540 --> 01:21:39.540]  Goes in and says, okay, in these kinds of circumstances
[01:21:39.540 --> 01:21:42.540]  We normally react and respond from this context
[01:21:42.540 --> 01:21:45.540]  And it delivers up a context
[01:21:45.540 --> 01:21:51.540]  The context contains a set of behaviors
[01:21:51.540 --> 01:21:57.540]  In this context, we normally act from anger
[01:21:57.540 --> 01:22:04.540]  Now, if you grew up in a family that when the parents were angry
[01:22:04.540 --> 01:22:12.540]  They were still careful and controlled and acted with thoughtful consideration
[01:22:12.540 --> 01:22:16.540]  You may have that in your angry context
[01:22:16.540 --> 01:22:19.540]  But if you were up in a family that didn't have that
[01:22:19.540 --> 01:22:23.540]  That just did whatever they felt like did it, do it, and acted out
[01:22:23.540 --> 01:22:27.540]  Acting out any way they wanted to
[01:22:27.540 --> 01:22:30.540]  When this response is triggered
[01:22:30.540 --> 01:22:33.540]  You look inside that response
[01:22:33.540 --> 01:22:39.540]  And your ability to respond is restricted by that context
[01:22:39.540 --> 01:22:45.540]  If you have empathy and understanding in your angry response
[01:22:45.540 --> 01:22:49.540]  You may be able to react with empathy and understanding
[01:22:49.540 --> 01:22:51.540]  But if it's not in there
[01:22:51.540 --> 01:22:55.540]  Then you're restricted to what's in that angry response
[01:22:55.540 --> 01:23:03.540]  And this tool is designed to interrupt the response itself
[01:23:03.540 --> 01:23:10.540]  And allow you to stop and go back and look at the angry response and say
[01:23:10.540 --> 01:23:13.540]  Is this appropriate?
[01:23:13.540 --> 01:23:16.540]  Whenever somebody does something
[01:23:16.540 --> 01:23:21.540]  And your reaction is not stop, pause, and reflect
[01:23:21.540 --> 01:23:25.540]  Objectively analyze, decide on an action, and initiate
[01:23:25.540 --> 01:23:30.540]  When it's not that, whenever your response just comes out
[01:23:30.540 --> 01:23:35.540]  That's not yours, that's theirs
[01:23:35.540 --> 01:23:37.540]  We know how people respond to us
[01:23:37.540 --> 01:23:39.540]  Somebody pushes one of our buttons
[01:23:39.540 --> 01:23:45.540]  And our response doesn't
[01:23:45.540 --> 01:23:51.540]  Isn't a result of the process of conscious ration and reason
[01:23:51.540 --> 01:23:53.540]  But if it just comes out
[01:23:53.540 --> 01:23:57.540]  If it just rises up from our center and jumps out
[01:23:57.540 --> 01:24:00.540]  We need to pay attention to that
[01:24:00.540 --> 01:24:03.540]  We're being manipulated
[01:24:03.540 --> 01:24:06.540]  You know, I started this with saying when I was five years old
[01:24:06.540 --> 01:24:10.540]  I pretty well knew the full range of human response within the native culture
[01:24:10.540 --> 01:24:14.540]  If I say something or do something that pisses you off
[01:24:14.540 --> 01:24:17.540]  You've got to know I know
[01:24:17.540 --> 01:24:22.540]  If you respond to that, you're being manipulated
[01:24:22.540 --> 01:24:28.540]  So when somebody does something and your response just comes out
[01:24:28.540 --> 01:24:31.540]  Whoa, hold on here
[01:24:31.540 --> 01:24:37.540]  When you feel what you call an emotion
[01:24:37.540 --> 01:24:40.540]  It's not what you think it is
[01:24:40.540 --> 01:24:44.540]  It's not a noun, it's not something happening to you
[01:24:44.540 --> 01:24:46.540]  It's your inner mind saying
[01:24:46.540 --> 01:24:50.540]  Hey, this guy just pushed his button
[01:24:50.540 --> 01:24:54.540]  But I'm not certain this is exactly the right response
[01:24:54.540 --> 01:24:58.540]  So I'm going to push this up into your conscious awareness
[01:24:58.540 --> 01:25:01.540]  I need you to look at it and decide
[01:25:01.540 --> 01:25:04.540]  Is this the right way to respond or not?
[01:25:04.540 --> 01:25:09.540]  Who here has not been in a situation where something happened
[01:25:09.540 --> 01:25:12.540]  And your response was so automatic
[01:25:12.540 --> 01:25:15.540]  That you didn't even realize how you did it
[01:25:15.540 --> 01:25:17.540]  A car pulls out in front of you
[01:25:17.540 --> 01:25:20.540]  And you dodge him, duck through some bushes
[01:25:20.540 --> 01:25:24.540]  Spin around behind him and line yourself back up in the road
[01:25:24.540 --> 01:25:28.540]  Not even knowing how you did it, your body did that
[01:25:28.540 --> 01:25:32.540]  That's when the inner mind knows for certain
[01:25:32.540 --> 01:25:35.540]  We don't have time to screw around here
[01:25:35.540 --> 01:25:38.540]  We've got to do this and there's no question about it
[01:25:38.540 --> 01:25:40.540]  So it just happens
[01:25:40.540 --> 01:25:43.540]  If the mind is not sure
[01:25:43.540 --> 01:25:46.540]  It pushes it up into your consciousness
[01:25:46.540 --> 01:25:49.540]  And it's not something that happened
[01:25:49.540 --> 01:25:52.540]  It's asking you to look at it
[01:25:52.540 --> 01:25:54.540]  Is this right?
[01:25:54.540 --> 01:25:57.540]  So you can consciously process it
[01:25:57.540 --> 01:26:02.540]  Yeah, should I do this or should I do something different?
[01:26:02.540 --> 01:26:05.540]  When we make that change
[01:26:05.540 --> 01:26:08.540]  Everything changes
[01:26:08.540 --> 01:26:12.540]  That's totally too much

[01:26:59.540 --> 01:27:07.540]  Were responses in a way that they had no idea I had anything to do with it
[01:27:07.540 --> 01:27:12.540]  Most people who listen know that I'm not particularly religious
[01:27:12.540 --> 01:27:15.540]  But the Bible is filled with wisdom
[01:27:15.540 --> 01:27:18.540]  And one passage keeps coming to mind
[01:27:18.540 --> 01:27:20.540]  Therefore when thou doest thine alms
[01:27:20.540 --> 01:27:22.540]  Be not like the scribes and Pharisees
[01:27:22.540 --> 01:27:25.540]  Who pray in the streets and synagogues to have glory omit
[01:27:25.540 --> 01:27:29.540]  For they only are saying to you they have the reward
[01:27:29.540 --> 01:27:32.540]  They have their reward
[01:27:32.540 --> 01:27:35.540]  This is not about reward
[01:27:35.540 --> 01:27:41.540]  It's about effectiveness of intervention
[01:27:41.540 --> 01:27:47.540]  If I can introduce an intervention
[01:27:47.540 --> 01:27:52.540]  Where I don't try to manipulate you into doing one thing or another
[01:27:52.540 --> 01:27:54.540]  I just trip up what you're doing
[01:27:54.540 --> 01:27:58.540]  I make your expectation come false
[01:27:58.540 --> 01:28:02.540]  If you have no idea I had anything to do with it
[01:28:02.540 --> 01:28:06.540]  Then you can go inside and very congruently
[01:28:06.540 --> 01:28:09.540]  Make adjustments to your behavior
[01:28:09.540 --> 01:28:12.540]  So that outcome doesn't happen again

[01:38:13.540 --> 01:38:16.540]  Have cause to file them.
[01:38:16.540 --> 01:38:20.540]  Who needs cause to file a bar grievance?
[01:38:20.540 --> 01:38:22.540]  Well, I don't know.
[01:38:22.540 --> 01:38:24.540]  Brett, tell her.
[01:38:24.540 --> 01:38:29.540]  Well, if you have a reason to believe that anybody that's in Georgia
[01:38:29.540 --> 01:38:32.540]  did something that violated a Georgia rule,
[01:38:32.540 --> 01:38:36.540]  well, then you've got cause to file it.
[01:38:36.540 --> 01:38:39.540]  You need to report it, of course.
[01:38:39.540 --> 01:38:45.540]  You don't have to be right.
[01:38:45.540 --> 01:38:48.540]  It doesn't matter what you file.
[01:38:48.540 --> 01:38:50.540]  The state bar is going to get your grievance,
[01:38:50.540 --> 01:38:53.540]  and they're going to throw it in the trash.
[01:38:53.540 --> 01:38:57.540]  Valid, invalid, it doesn't matter.
[01:38:57.540 --> 01:38:59.540]  They're going to send you this letter that says,
[01:38:59.540 --> 01:39:04.540]  we examined into your accusation, find it does not rise to the level of misconduct.
[01:39:04.540 --> 01:39:08.540]  If you accuse them of pushing a carload of babies over a cliff,
[01:39:08.540 --> 01:39:11.540]  they're going to say, we examined into your accusation,
[01:39:11.540 --> 01:39:14.540]  find it does not rise to the level of misconduct.
[01:39:14.540 --> 01:39:20.540]  When I'm bar grieved a lawyer for parting his hair on the left,
[01:39:20.540 --> 01:39:24.540]  if you can believe that, then no good shyster.
[01:39:24.540 --> 01:39:27.540]  They sent me a letter that said, we examined into your accusation,
[01:39:27.540 --> 01:39:31.540]  find it does not rise to the level of misconduct.
[01:39:31.540 --> 01:39:35.540]  And that is a good thing,
[01:39:35.540 --> 01:39:40.540]  because their insurance carrier knows they're going to trash them all.
[01:39:40.540 --> 01:39:42.540]  So don't worry about what you charge them with.
[01:39:42.540 --> 01:39:45.540]  Just charge them with anything.
[01:39:45.540 --> 01:39:54.540]  I prefer to charge them with a violation of the bar association standards.
[01:39:54.540 --> 01:39:57.540]  And they're almost the same everywhere.
[01:39:57.540 --> 01:40:02.540]  If you read the bar association standards for Georgia,
[01:40:02.540 --> 01:40:07.540]  the first three chapters are the ones you want to look at.
[01:40:07.540 --> 01:40:13.540]  The first three, what is it, Brett, eight and nine?
[01:40:13.540 --> 01:40:20.540]  Eight, yes, speaks to their duty to report each other for each other's misconduct.
[01:40:20.540 --> 01:40:28.540]  The first three and the last couple, the ones in between are about lawyers selling law firms to other lawyers,
[01:40:28.540 --> 01:40:30.540]  and that's just lawyer stuff.
[01:40:30.540 --> 01:40:37.540]  The ones we care about are just one, two, three, and then I think five has some good stuff in it.
[01:40:37.540 --> 01:40:42.540]  One through four, really, for me, but then there's one at the beginning of five
[01:40:42.540 --> 01:40:52.540]  that speaks to being able to amplify the wrongdoing of an underling by reporting the supervisor
[01:40:52.540 --> 01:40:58.540]  and by reporting the partners of the law firm, because they're responsible for what their underlings did.
[01:40:58.540 --> 01:41:01.540]  It's not very big.
[01:41:01.540 --> 01:41:05.540]  You just got a little blurb in there, a little sentence or two,
[01:41:05.540 --> 01:41:08.540]  and then it goes to the next one, a little sentence or two.
[01:41:08.540 --> 01:41:10.540]  There's not a whole lot there.
[01:41:10.540 --> 01:41:15.540]  But when you read it, it'll read like a comic book.
[01:41:15.540 --> 01:41:20.540]  You'll be laughing and giggling at all the stuff you can hammer them for.
[01:41:20.540 --> 01:41:28.540]  We said earlier that when you file a bar grievance, the state bar will get it and they'll throw it in the trash,
[01:41:28.540 --> 01:41:35.540]  and that's a good thing, because their insurance carrier knows they'll throw it in the trash.
[01:41:35.540 --> 01:41:39.540]  So it makes no difference what you charge them with.
[01:41:39.540 --> 01:41:42.540]  The insurance carrier doesn't care.
[01:41:42.540 --> 01:41:54.540]  The agent for the carrier, his purpose is to charge his client as much as possible and avoid any claims.
[01:41:54.540 --> 01:41:58.540]  So whatever you charge, he's going to hammer them.
[01:41:58.540 --> 01:42:00.540]  Here's how it works.
[01:42:00.540 --> 01:42:03.540]  First, one bar grievance is your first year of practice.
[01:42:03.540 --> 01:42:07.540]  They're canceling your origin and mission policy immediately.
[01:42:07.540 --> 01:42:12.540]  Two grievances, any one year of practice, if you've been practicing 20 years, they cancel.
[01:42:12.540 --> 01:42:16.540]  Three, they'll cancel your law firms without practice insurance.
[01:42:16.540 --> 01:42:20.540]  Valid, invalid, they don't care.
[01:42:20.540 --> 01:42:30.540]  Okay, with that said, we prefer to file grievances based on the standards.
[01:42:30.540 --> 01:42:37.540]  So get the standards and read them, and then the way to file them is every bar, just like every bar association,
[01:42:37.540 --> 01:42:39.540]  has a complaint form.
[01:42:39.540 --> 01:42:47.540]  You can go to the bar association and do a search for complaints, and you'll get a form you can fill out online.
[01:42:47.540 --> 01:42:53.540]  You can either do the online, like a web form, or most of them you can print off a PDF as well
[01:42:53.540 --> 01:42:58.540]  in case you want to have your own copy of it instead of any facts or something.
[01:42:58.540 --> 01:43:01.540]  Okay.
[01:43:01.540 --> 01:43:07.540]  And a lot of people ask about, well, what if this is not a lawyer I hired?
[01:43:07.540 --> 01:43:09.540]  Can I still bar grieve this lawyer?
[01:43:09.540 --> 01:43:11.540]  The lawyer didn't actually represent me.
[01:43:11.540 --> 01:43:12.540]  Can I still?

[01:43:13.540 --> 01:43:20.540]  You need to report unethical behavior wherever you find it, whether you're the one that hired him or not.
[01:43:20.540 --> 01:43:30.540]  And like you said, in a different state, you just use that state's state bar ethics so that you'll be referencing.
[01:43:30.540 --> 01:43:39.540]  Like in Texas, we have rule 1.01, which is in most states, the numbering would just be 1.1.

[01:43:41.540 --> 01:43:48.540]  So you just take a look at the state that you're looking at to report them in and use that number.

[01:47:49.540 --> 01:47:57.540]  the lawyer knew me because he used to be a county attorney, and I was in his office griping at him about what they were doing,
[01:47:57.540 --> 01:48:03.540]  and he said, one moment, Mr. Kelton. He got up, went around, closed the door, came back to sit down,
[01:48:03.540 --> 01:48:13.540]  and he said, Mr. Kelton, don't stop. You need to keep doing what you're doing. I can't do this.
[01:48:13.540 --> 01:48:22.540]  He used to be a prosecutor for Tarrant County, Texas, and he said, I just couldn't do it anymore.
[01:48:22.540 --> 01:48:28.540]  He was embarrassed to get up in the morning and look in the mirror and quit, and he came to the small county.
[01:48:28.540 --> 01:48:35.540]  He said, what you're doing, you need to keep doing. I can't do this. You need to fix it.
[01:48:35.540 --> 01:48:41.540]  And then he got up, opened the door, come back, sat down, and started arguing with me again.
[01:48:41.540 --> 01:48:47.540]  Years later, I had him as a bankruptcy attorney, and he told me about, he knew what I did,
[01:48:47.540 --> 01:48:56.540]  so he told me about a friend of his who got his license and was representing people as court-pointed counsel,
[01:48:56.540 --> 01:49:03.540]  and his client disappeared, and 11 months later, he went to the court and asked the court to remove him from the case
[01:49:03.540 --> 01:49:07.540]  because he couldn't find his client, and the court removed him.
[01:49:07.540 --> 01:49:14.540]  The next month, the client showed up, and he was PO'd at his lawyer, Duncan, and he filed a bar grievance,
[01:49:14.540 --> 01:49:20.540]  and they canceled his buddy's law, his malpractice insurance immediately.
[01:49:20.540 --> 01:49:29.540]  And he said, that was patently unfair, and I was standing there grinning from ear to ear.
[01:49:29.540 --> 01:49:38.540]  He said, I shouldn't have told you that. I said, no, you should not have told me that.
[01:49:38.540 --> 01:49:45.540]  That's what put me on this, and I've been grieving lawyers for a number of years,
[01:49:45.540 --> 01:49:52.540]  and then Brett, he was calling the show asking, what do I do about this? What do I do about that?
[01:49:52.540 --> 01:49:58.540]  And we told him, read this, read that, and he actually read it, and he actually did it,
[01:49:58.540 --> 01:50:08.540]  and I have in 15 years recommended two people to be hosts or co-hosts on the show, and Brett was one of them.
[01:50:08.540 --> 01:50:12.540]  I'm sorry, three people. One of them is in prison right now.
[01:50:12.540 --> 01:50:20.540]  One of them is Eddie Craig, and the other is Brett, but I consider Brett my best acquisition.
[01:50:20.540 --> 01:50:28.540]  When it came to bar grievances, Brett raised it to a whole different level.
[01:50:28.540 --> 01:50:35.540]  Will you address bar grievances, Brett?
[01:50:35.540 --> 01:50:42.540]  Well, I think what Randy is particularly impressed about is this.
[01:50:42.540 --> 01:50:53.540]  When a lawyer injects himself into a conversation that he doesn't need to be in,
[01:50:53.540 --> 01:51:00.540]  so you're just random, we the people, reaching out to your public officials,
[01:51:00.540 --> 01:51:05.540]  and you're the master, they're the servant, you're asking your servant to do something,
[01:51:05.540 --> 01:51:09.540]  and a lawyer jumps in the middle and starts telling you how important he is,
[01:51:09.540 --> 01:51:13.540]  and telling you that he represents blah, blah, blah, whatever.
[01:51:13.540 --> 01:51:25.540]  And I think what Randy was particularly enjoying was that it's unnecessary to talk to that lawyer,
[01:51:25.540 --> 01:51:38.540]  and you could even show that lawyer some very polite disdain by telling them,
[01:51:38.540 --> 01:51:43.540]  I don't know who you are, who you think you are, never mind, I don't care, don't tell me,
[01:51:43.540 --> 01:51:47.540]  and yeah, go away, shoo.
[01:51:47.540 --> 01:51:52.540]  And yeah, that's I think one of Randy's favorite parts.
[01:51:52.540 --> 01:51:59.540]  But as far as bar grieving then, in Texas we have a crime called baritory,
[01:51:59.540 --> 01:52:07.540]  and that crime lines up with a couple of ethics rules in our state bar.
[01:52:07.540 --> 01:52:09.540]  They're called the rules of professional conduct.
[01:52:09.540 --> 01:52:13.540]  So if you look that up in Georgia, rules of professional conduct.
[01:52:13.540 --> 01:52:23.540]  And in Texas it is, there's an 8.04 and 8.06 that refers to lawyers that engage in baritory.
[01:52:23.540 --> 01:52:28.540]  They're stirring up peace into controversy so they can get paid to litigate it.
[01:52:28.540 --> 01:52:33.540]  This is kind of like solicitation, when you think of it like ambulance chasers,
[01:52:33.540 --> 01:52:39.540]  people that, oh, you look like you're really hurt, you should sue them, that kind of thing, right?
[01:52:39.540 --> 01:52:45.540]  Well, lawyers who butt in the middle just to stir up problems and then try to get paid for that,
[01:52:45.540 --> 01:52:51.540]  that's a crime, and it's unethical, so you can call them on that.
[01:52:51.540 --> 01:52:59.540]  But I don't want to reply to their email until after I've bar grieved them.
[01:52:59.540 --> 01:53:03.540]  So I'll put in a bar grievance real quick and then reply to them,
[01:53:03.540 --> 01:53:10.540]  tell them don't bother to leave me alone, go away, shoo, and invariably,
[01:53:10.540 --> 01:53:17.540]  they will be so quick to reply back to me, they want to tell me how important they are,
[01:53:17.540 --> 01:53:25.540]  they want me to understand, don't you know how much I paid for my tie?
[01:53:25.540 --> 01:53:30.540]  And by the time they have found out that I bar grieved them,
[01:53:30.540 --> 01:53:33.540]  it might be a day or two later they figure that out,
[01:53:33.540 --> 01:53:41.540]  and they've already committed the crime of harassment because I told them not to bother me.
[01:53:41.540 --> 01:53:48.540]  So that's one way to do it.
[01:53:48.540 --> 01:53:55.540]  There's something about this that most people miss, and I missed it.
[01:53:55.540 --> 01:54:01.540]  If you have two parties come to the court and they have their own counsel,
[01:54:01.540 --> 01:54:05.540]  when they enter into a contract with their attorney,
[01:54:05.540 --> 01:54:14.540]  one provision of the contract is that the client will not talk to the client on the other,
[01:54:14.540 --> 01:54:22.540]  the opposing client, that only the lawyers can communicate back and forth.
[01:54:22.540 --> 01:54:29.540]  But in the cases where one party has a lawyer and the other party doesn't,
[01:54:29.540 --> 01:54:34.540]  then maybe the one party has agreed not to talk to the other client,
[01:54:34.540 --> 01:54:40.540]  but the nonrepresented party has entered into that agreement.
[01:54:40.540 --> 01:54:46.540]  So they have agreed to only speak through their lawyer because they don't have one.
[01:54:46.540 --> 01:54:55.540]  And they're not in any kind of contractual relationship with the attorney on the other side.
[01:54:55.540 --> 01:55:02.540]  So when that attorney says, you can only talk to me, Brett says, who the heck are you?
[01:55:02.540 --> 01:55:07.540]  I don't have any contractors. You get lost. You're annoying me.
[01:55:07.540 --> 01:55:14.540]  It renders the opposing counsel impotent. It drives them crazy.
[01:55:14.540 --> 01:55:21.540]  They're charging their client a lot of money, but they have no way of earning that money
[01:55:21.540 --> 01:55:26.540]  because they can't deal with the other side. Does that make sense?
[01:55:26.540 --> 01:55:28.540]  Yes.
[01:55:28.540 --> 01:55:35.540]  Lawyers haven't had that done to them. They don't know how to deal with it.
[01:55:35.540 --> 01:55:42.540]  And one thing that if you have a lawyer, we have a way of controlling them
[01:55:42.540 --> 01:55:48.540]  because of the Sixth Amendment to the Constitution.
[01:55:48.540 --> 01:55:53.540]  They cannot interfere with a private contract.
[01:55:53.540 --> 01:55:57.540]  Your contract with your lawyer is between you and your lawyer.
[01:55:57.540 --> 01:56:01.540]  So if you have a lawyer and you hammer the lawyer,
[01:56:01.540 --> 01:56:05.540]  the first thing he's going to want to do is withdraw.
[01:56:05.540 --> 01:56:11.540]  No, no, no, no, no. You don't get to withdraw.
[01:56:11.540 --> 01:56:17.540]  If the lawyer is entered into a contract with you and you ask him to do his job,
[01:56:17.540 --> 01:56:20.540]  he's not going to want to. He's going to want to withdraw.
[01:56:20.540 --> 01:56:24.540]  So what you do is when he files a motion to withdraw,
[01:56:24.540 --> 01:56:28.540]  you go to the court and tell the court, don't you dare let him withdraw.
[01:56:28.540 --> 01:56:36.540]  He's in a contract with me and you have no authority to interfere with that contract.
[01:56:36.540 --> 01:56:42.540]  And we've had a number of cases where this has happened just recently as in Hayes County.
[01:56:42.540 --> 01:56:48.540]  Lawyer tried to withdraw. The client told him, told the judge, absolutely not.
[01:56:48.540 --> 01:56:52.540]  I paid him. He's under contract and you're not to interfere in the contract.
[01:56:52.540 --> 01:56:58.540]  And the judge told him, sorry, counselor, you're going to have to fix this with your client.
[01:56:58.540 --> 01:57:02.540]  And then the client, Marguerite, is the lawyer.
[01:57:02.540 --> 01:57:06.540]  So the lawyer is in an incredibly difficult situation.
[01:57:06.540 --> 01:57:10.540]  He's stuck with his client and he can't get away from him.
[01:57:10.540 --> 01:57:13.540]  So now he has to go to the judge and the lawyer on the other side and say,
[01:57:13.540 --> 01:57:16.540]  hey, guys, you've got to help me out here.
[01:57:16.540 --> 01:57:20.540]  You help me out with this client who's going to ruin my career
[01:57:20.540 --> 01:57:24.540]  and I'll pay you back with the next client I get.
[01:57:24.540 --> 01:57:26.540]  Yeah, they're wheeling and dealing anyway.
[01:57:26.540 --> 01:57:32.540]  But this puts you on the other side of those deals.
[01:57:32.540 --> 01:57:38.540]  Lawyers are low-hanging fruit.
[01:57:38.540 --> 01:57:41.540]  Sheila, is there something else in specific?
