[06:55.920 --> 07:03.480]  Now you and I have done this a lot and there was a saying in the military when I was working
[07:03.480 --> 07:12.560]  with nuclear weapons part, primarily they preached familiarity breeds contempt and we
[07:12.560 --> 07:15.480]  have to be real careful about that.
[07:15.480 --> 07:22.280]  We talk about this stuff and talk about this stuff and we kind of lose the real importance

[07:25.440 --> 07:31.320]  Violent criminal complaints, when we ask someone to put their signature on the document and
[07:31.320 --> 07:39.200]  go file it, whoa, hold on, I mean, it's okay for us to gripe and complain rail and righteous
[07:39.200 --> 07:48.360]  indignation about the inequity of it all, but wait a minute, you're asking me to put
[07:48.360 --> 07:55.320]  my name on the document and stand up in front of these bad boys.
[07:55.320 --> 08:05.520]  Now Brett and I know these bad boys ain't so bad as they seem, but it's hard to say
[08:05.520 --> 08:12.320]  it to someone else in a way that they will understand it.
[08:12.320 --> 08:20.640]  Intuitively, it's something inside, we have this terror of taking that first step out
[08:20.640 --> 08:23.760]  there and I struggle with this.
[08:23.760 --> 08:32.440]  This is one of my major issues that I try to work with is how do I get people off that

[08:33.440 --> 08:39.760]  I'm looking forward to this, this fellow right here, he's got a whole lot of public officials
[08:39.760 --> 08:44.040]  to hold accountable, but he's not scared.
[08:44.040 --> 08:52.200]  What is it about this guy that he's been six months in jail and they beat him up pretty
[08:52.200 --> 08:53.200]  good.
[08:53.200 --> 09:01.840]  What is it about him that keeps him from bowing to the corruption?
[09:01.840 --> 09:06.200]  They took his home, the judge is his neighbor.
[09:06.200 --> 09:11.400]  Judge wanted to buy his land and he says, no thanks, I don't really want to sell.
[09:11.400 --> 09:18.040]  After enough rounds of that, judge found some reason to throw him in jail and deemed his
[09:18.040 --> 09:19.040]  land abandoned.
[09:19.040 --> 09:29.520]  When you do something like that to a fellow, he's not really inclined to consider, well,
[09:29.520 --> 09:31.520]  do I really want to do something about that or not?
[09:31.520 --> 09:34.880]  He pretty much doesn't have a choice.
[09:34.880 --> 09:40.240]  There's a lot of people that get railroaded.
[09:40.240 --> 09:45.800]  When I was doing the foreclosures back in 08, all these people are getting hammered
[09:45.800 --> 09:50.800]  and railroaded by the banks and I'm telling them, you need to file criminal charges against
[09:50.800 --> 09:52.800]  the president of the bank.
[09:52.800 --> 09:57.080]  Oh man, they run backwards really fast.
[09:57.080 --> 10:01.640]  The vast majority of them wouldn't even consider it.

[23:58.440 --> 24:06.440]  Yes, the ESSER grant is the federal money that they, the school districts get.

[24:20.440 --> 24:28.440]  So how does a foreign entity give money to my elected officials?

[24:30.440 --> 24:33.440]  That sounds like a bribe to me.

[24:35.440 --> 24:45.440]  I don't remember authorizing my public officials to accept money from outside sources.
[24:45.440 --> 24:52.440]  Okay, I'm not trying to bring you off point, just want to mark that as we move ahead.
[24:52.440 --> 25:02.440]  We've had some people sue superintendents against their bond based on taking outside funds.
[25:02.440 --> 25:09.440]  And when the suit is filed, they block all of the outside funding.
[25:09.440 --> 25:18.440]  And we had one where the lawyers came to the school and said, we can't accept into this funding while the suit's in place.
[25:18.440 --> 25:23.440]  They didn't have enough to pay the janitors.
[25:23.440 --> 25:27.440]  He really hammered them big time.
[25:27.440 --> 25:29.440]  Oh, that's good.
[25:29.440 --> 25:32.440]  Just as a little note is how you can get their attention.
[25:32.440 --> 25:37.440]  Okay, I'm going to shut up now.
[25:37.440 --> 25:45.440]  Well, anyways, you talked about Simonelle and the Social Service and unconstitutional policy.
[25:45.440 --> 25:51.440]  You shared that in the same January 21st one with the motion to dismiss.
[25:51.440 --> 26:00.440]  So they're putting in unconstitutional policy by requiring them to put masks on the kids and then the school implementing it.
[26:00.440 --> 26:08.440]  Because do you think the school boards would all do this COVID crap if they weren't getting federal money from the government?
[26:08.440 --> 26:09.440]  I don't think so.
[26:09.440 --> 26:11.440]  They wouldn't, you know?
[26:11.440 --> 26:12.440]  Absolutely.
[26:12.440 --> 26:20.440]  They would not put up with all the heat they're getting unless there was a payday.

[26:23.440 --> 26:32.440]  But she used the same Smart Start plan in her exhibit, I mean, in her post that she put requiring a mask.
[26:32.440 --> 26:37.440]  And in the Esther Fund paper, it's the Smart Start plan too.
[26:37.440 --> 26:39.440]  So they're both the same plan.
[26:39.440 --> 26:42.440]  So I put her in there for conspiracy.
[26:42.440 --> 26:49.440]  So my question is, can a plaintiff ever get like a summary judgment in there?
[26:49.440 --> 26:53.440]  Wait a minute, I'm missing part of what you're saying.

[26:54.440 --> 26:57.440]  Can what get a summary judgment?
[26:57.440 --> 27:04.440]  You know how they do motions to dismiss for the defendant, you know, like a summary judgment, you know, for the defendant?

[27:05.440 --> 27:11.440]  Can they ever do that for the plaintiff, a summary judgment for a plaintiff?
[27:11.440 --> 27:14.440]  But I guess I know that might be a stupid question.
[27:14.440 --> 27:23.440]  Okay, when a plaintiff moves for summary judgment, it's generally not summary, it's default.
[27:23.440 --> 27:30.440]  A plaintiff can move for summary judgment, but after the opposing side has answered.
[27:30.440 --> 27:36.440]  If the opposing side doesn't answer within the time limit, then you move for default judgment.
[27:36.440 --> 27:40.440]  You can take a motion for default judgment and give it to the clerk.
[27:40.440 --> 27:50.440]  And the clerk will look in the record and see the date that the litigant was served.
[27:50.440 --> 28:02.440]  And then count 21 days or the Monday after the 20th day and see if there is a answer in the record.
[28:02.440 --> 28:06.440]  If there is no answer, the clerk can sign a default judgment.
[28:06.440 --> 28:14.440]  If the opposing side answers and their answer is frivolous.
[28:14.440 --> 28:21.440]  For instance, Mary Krennic in Texas, she calls him pretty regular, she sued an ex-employer.
[28:21.440 --> 28:29.440]  And the ex-employer filed an answer that said, we deny all claims by plaintiff.
[28:29.440 --> 28:32.440]  And that's on its face insufficient.
[28:32.440 --> 28:40.440]  And then they move for summary judgment claiming there are no facts in controversy.
[28:40.440 --> 28:49.440]  In order to get a summary judgment, they must show that there are no facts in controversy.
[28:49.440 --> 28:53.440]  Everybody agrees on the facts.
[28:53.440 --> 28:58.440]  They just don't agree on how the law applies to the facts.
[28:58.440 --> 29:01.440]  That's how you get to summary judgment.
[29:01.440 --> 29:02.440]  Does that make sense?
[29:02.440 --> 29:03.440]  Yeah, it does.
[29:03.440 --> 29:04.440]  It does.
[29:04.440 --> 29:07.440]  Now, there's one more thing.
[29:07.440 --> 29:12.440]  In Mary's case, the lawyers filed for summary judgment.
[29:12.440 --> 29:14.440]  I'm sorry, the other thing.
[29:14.440 --> 29:23.440]  They filed to dismiss for a summary judgment motion to dismiss for failure to state a claim on which recovery can be had.
[29:23.440 --> 29:33.440]  Since the Ashcroft and Twombly decisions a few years ago, they changed the pleading standards.
[29:33.440 --> 29:38.440]  So every case gets a motion to dismiss for failure to state a claim.
[29:38.440 --> 29:43.440]  Well, these guys filed a motion to dismiss for failure to state a claim,
[29:43.440 --> 29:49.440]  and then they started arguing the merits of one of the arguments.
[29:49.440 --> 29:53.440]  And I'll explain why that's important when we come back.

[36:23.440 --> 36:29.440]  if they produce some documents or you get the interrogatories,
[36:29.440 --> 36:33.440]  they give you an answer and it's like being able to pull on some yarn.
[36:33.440 --> 36:41.440]  So you want to have, at the end, you want to have admissions left over.
[36:41.440 --> 36:43.440]  Like you have a limit, right?
[36:43.440 --> 36:45.440]  I don't know what they would be in Wyoming.
[36:45.440 --> 36:52.440]  We get 15 admissions and 25 interrogatories.
[36:52.440 --> 36:58.440]  So if you think of a few good statements that they can't refute,
[36:58.440 --> 37:03.440]  that would totally destroy their case.
[37:03.440 --> 37:06.440]  And you put it out there and ask them to admit it.
[37:06.440 --> 37:09.440]  And if they admit it, their case is done for.
[37:09.440 --> 37:13.440]  And if they say deny, that means they're going to have to find a way to argue that one.
[37:13.440 --> 37:17.440]  And in court, because they're denying that it's true,
[37:17.440 --> 37:21.440]  so that means it's left open for judicial determination,
[37:21.440 --> 37:25.440]  they're going to have to bring evidence and it has to be admissible evidence.
[37:25.440 --> 37:28.440]  And you've got your affidavit of firsthand personal knowledge.
[37:28.440 --> 37:29.440]  What have they got?
[37:29.440 --> 37:30.440]  Nothing.
[37:30.440 --> 37:31.440]  They're a bunch of lawyers.
[37:31.440 --> 37:32.440]  They don't know anything.
[37:32.440 --> 37:35.440]  They only know whatever facts somebody told them.
[37:35.440 --> 37:40.440]  They don't have anything to bring to the table in terms of evidence.
[37:40.440 --> 37:44.440]  So they're pretty much done for one way or the other.
[37:44.440 --> 37:47.440]  Yeah, it is an art form to think about how would you phrase a question
[37:47.440 --> 37:54.440]  so that if they admit it, they've just cut their own legs out from under their case.
[37:54.440 --> 37:56.440]  Yeah.
[37:56.440 --> 38:01.440]  Even the lawyer said that he acted like masks were just a new dress code.
[38:01.440 --> 38:04.440]  And I was excited when you guys shared that Monell case.
[38:04.440 --> 38:08.440]  I'm like, well, that's the unconstitutional policy that she implemented.
[38:08.440 --> 38:11.440]  You know, so I went out putting that in there.
[38:11.440 --> 38:15.440]  Because I'm like, you know, I don't know.

[39:05.440 --> 39:08.440]  They denied me medical attention, trapped me in a chair,
[39:08.440 --> 39:10.440]  threw me in a room for four hours,
[39:10.440 --> 39:13.440]  charged me with five felonies and seven misdemeanors.
[39:13.440 --> 39:17.440]  I just beat October 1st.
[39:17.440 --> 39:19.440]  Dude, I'm so sorry.
[39:19.440 --> 39:20.440]  That's horrible.
[39:20.440 --> 39:23.440]  It's ridiculous.
[39:23.440 --> 39:28.440]  Well, June 26, 2019, I was in my home and I was having this person leave.
[39:28.440 --> 39:30.440]  Well, the police department came to my house.
[39:30.440 --> 39:32.440]  I told them they couldn't come in.
[39:32.440 --> 39:33.440]  They came in anyway.
[39:33.440 --> 39:36.440]  They arrested me in my kitchen because I wouldn't produce my identification.
[39:36.440 --> 39:37.440]  I told them I didn't have to.
[39:37.440 --> 39:39.440]  I didn't do anything wrong.
[39:39.440 --> 39:42.440]  They arrested me for not showing my identification,
[39:42.440 --> 39:45.440]  which we know Texas criminal code 30 or two, so that's actually an effective amendment.
[39:45.440 --> 39:47.440]  But anyways, that started...
[39:47.440 --> 39:48.440]  All right.
[39:48.440 --> 39:52.440]  That failure to show ID is something that happens after you're arrested for some other crime.
[39:52.440 --> 39:53.440]  That's what I told them.
[39:53.440 --> 39:54.440]  That's a secondary.
[39:54.440 --> 39:55.440]  That's what I told them.
[39:55.440 --> 39:57.440]  And so let me go back really fast.
[39:57.440 --> 40:00.440]  Yeah, it doesn't do much good to try to tell them anything, does it?
[40:00.440 --> 40:01.440]  No, no, it really doesn't.
[40:01.440 --> 40:03.440]  I saw the YouTube video and I was watching it.
[40:03.440 --> 40:07.440]  I was talking about traffic in Texas.
[40:07.440 --> 40:10.440]  It was one of your one of y'all's videos, actually, way back.
[40:10.440 --> 40:15.440]  And that started my whole questioning of what was going on and also how words have meaning in law
[40:15.440 --> 40:18.440]  and how they have meaning outside of the courtroom.
[40:18.440 --> 40:20.440]  And so this isn't all coming together.
[40:20.440 --> 40:22.440]  Here it is, you know, fast forward almost three years later.
[40:22.440 --> 40:28.440]  But what flabbergasted me was that they ended up charging me with all these different crimes or whatnot
[40:28.440 --> 40:30.440]  when I was the one that got beat up.
[40:30.440 --> 40:34.440]  And so how is it that they just go forward with that?
[40:34.440 --> 40:35.440]  How do they sleep at night?
[40:35.440 --> 40:36.440]  I have no idea.
[40:36.440 --> 40:39.440]  But they end up charging me for getting beat up.
[40:39.440 --> 40:42.440]  And I have the body camera footage, which means they have the body camera footage.
[40:42.440 --> 40:48.440]  And so if they know that you're unable to film them while they're in the course of their duties,
[40:48.440 --> 40:51.440]  trying to be a driver of the First Amendment, I mean, that's clearly established law.
[40:51.440 --> 40:57.440]  How do they in fact go forward with an indictment of the prosecution or I say persecution personally?
[40:57.440 --> 41:03.440]  But I mean, the fact that they even go forward with that is I think a travesty among all travesties.
[41:03.440 --> 41:07.440]  But I spent 14 months in jail because I went to take a plea bargain, you know.
[41:07.440 --> 41:09.440]  I spent 14 months in jail for getting beat up.
[41:09.440 --> 41:10.440]  Yes, sir.
[41:10.440 --> 41:15.440]  And my bondage meeting started off at $12,500.
[41:15.440 --> 41:20.440]  They had me for a public peace officer and harassing a public servant because this police officer said I spent on him,
[41:20.440 --> 41:21.440]  which I did not.
[41:21.440 --> 41:23.440]  And the body camera footage shows I didn't.
[41:23.440 --> 41:30.440]  But yes, that bond had been like $12,500 to begin with that in October of 2019.
[41:30.440 --> 41:38.440]  Fast forward to my last bond amount was for these same two charges, half a million dollars apiece.
[41:38.440 --> 41:43.440]  Because the judge, yeah, the judge didn't like the fact that I kind of would not be quiet about it.
[41:43.440 --> 41:44.440]  You know, I was like, I don't understand what's going on.
[41:44.440 --> 41:46.440]  So she put her in judicial orders.
[41:46.440 --> 41:48.440]  I was not able to talk to law enforcement.
[41:48.440 --> 41:49.440]  I couldn't curse.
[41:49.440 --> 41:51.440]  I couldn't use obscene gestures.
[41:51.440 --> 41:53.440]  I couldn't talk about my case.
[41:53.440 --> 41:56.440]  It's all these absurd orders for the conditions of bond.
[41:56.440 --> 41:58.440]  Well, I didn't quite, I didn't listen to them.
[41:58.440 --> 41:59.440]  It was ridiculous.
[41:59.440 --> 42:08.440]  Well, she ended up, which judge here in Texas and Dallas, she originally had me re-arrested for breaking my religious bond.
[42:08.440 --> 42:12.440]  Sent 15 U.S. Marshals to come get me.
[42:12.440 --> 42:16.440]  I was coming out of my house and all of a sudden they'd draw down on me AR-15s.
[42:16.440 --> 42:18.440]  I mean, just crazy.
[42:18.440 --> 42:19.440]  All of this for...
[42:19.440 --> 42:20.440]  My goodness.
[42:20.440 --> 42:21.440]  What did you do?
[42:21.440 --> 42:22.440]  Say a four-letter word?

[42:58.440 --> 43:03.440]  Well, you know what I'm most encouraged about with all of this?
[43:03.440 --> 43:10.440]  I can hear from your tone of voice that you didn't learn your lesson and you're about to teach them one.
[43:10.440 --> 43:13.440]  That's what I'm encouraged about all of this stuff.
[43:13.440 --> 43:17.440]  I mean, that's really a horrible story.

[47:14.440 --> 47:16.440]  Then they threw me to the ground.
[47:16.440 --> 47:19.440]  They clipped me, broke my shoulder when they threw me to the ground.

[47:22.440 --> 47:24.440]  They drugged me across the grass.
[47:24.440 --> 47:26.440]  They threw me in a chair with a spit mask.
[47:26.440 --> 47:30.440]  I'm only saying all this to say that I complained about it to the chief,
[47:30.440 --> 47:33.440]  and the chief wrote me back a letter and told me I deserved it.
[47:33.440 --> 47:34.440]  That's what kind of surprised me.
[47:34.440 --> 47:35.440]  And then I get indicted.
[47:35.440 --> 47:37.440]  And then, you know, I have to spend all this money.
[47:37.440 --> 47:40.440]  And like I said, my bondage being like $1.432 million.
[47:40.440 --> 47:41.440]  These same two charges.
[47:41.440 --> 47:45.440]  But what it really concerned me is that all the time I spent in Den County,
[47:45.440 --> 47:49.440]  and all these, just that time, I never got to go to court to face these charges
[47:49.440 --> 47:51.440]  in not one single time.
[47:51.440 --> 47:54.440]  They kept resetting and resetting and resetting.
[47:54.440 --> 47:58.440]  And so they'd get my bondage and like my, yes, sir.
[47:58.440 --> 48:03.440]  How long has it been since they dismissed the charges?
[48:03.440 --> 48:06.440]  October 2021.
[48:06.440 --> 48:07.440]  Just barely.
[48:07.440 --> 48:09.440]  They just dismissed charges October 1st.
[48:09.440 --> 48:11.440]  On the morning that I was, I was paid in the trial,
[48:11.440 --> 48:14.440]  the morning of the docket call, they dismissed all the charges.
[48:14.440 --> 48:15.440]  Okay.
[48:15.440 --> 48:17.440]  So it hasn't been a year.
[48:17.440 --> 48:22.440]  There's a statute of limitations a year on false imprisonment.
[48:22.440 --> 48:23.440]  Right.
[48:23.440 --> 48:27.440]  You've got lots of cool stuff you could do to them.
[48:27.440 --> 48:28.440]  Oh, my gosh.
[48:28.440 --> 48:29.440]  And that's why I need your help on it.

[49:25.440 --> 49:31.440]  And ask for an officer to come out and arrest this jackleg.
[49:31.440 --> 49:36.440]  If you haven't done that, you don't know what fun is.

[49:52.440 --> 49:56.440]  I had a friend who got a job in Wise County as a sheriff's deputy,
[49:56.440 --> 50:00.440]  but before he could start working,
[50:00.440 --> 50:07.440]  he had to go to Denton County and watch this video on how to deal with difficult people.
[50:07.440 --> 50:11.440]  And they showed this video of this guy in the Denton County,
[50:11.440 --> 50:15.440]  in the foyer of the Denton County jail,
[50:15.440 --> 50:18.440]  and he had about a half a dozen sheriff's deputies around him,
[50:18.440 --> 50:21.440]  and they've gone a little back and forth,
[50:21.440 --> 50:23.440]  and finally this guy told them,
[50:23.440 --> 50:25.440]  you guys need to leave.
[50:25.440 --> 50:26.440]  I'm done with you.
[50:26.440 --> 50:27.440]  I'm disgusted.
[50:27.440 --> 50:30.440]  Get lost. Beat it.
[50:30.440 --> 50:33.440]  They finally shuffled off.
[50:33.440 --> 50:35.440]  That was me.
[50:35.440 --> 50:39.440]  Yes, sir, and correct them real fast.

[52:10.440 --> 52:16.440]  And then they'll dispatch somebody, and when he gets out there, he'll do a little song and dance.
[52:16.440 --> 52:23.440]  And then you take out of your case this criminal complaint against a 911 responder
[52:23.440 --> 52:25.440]  for not taking your criminal complaint.
[52:25.440 --> 52:29.440]  And you put his name on it and ask him to get his supervisor
[52:29.440 --> 52:36.440]  so that the supervisor can verify your signature on this criminal affidavit and arrest you.
[52:36.440 --> 52:38.440]  I can just see it now.
[52:38.440 --> 52:40.440]  You lick the tip of your finger and you pull that one sheet out,
[52:40.440 --> 52:43.440]  and then the one right behind it, you're filling in the next guy's name,
[52:43.440 --> 52:47.440]  and they're like, wait, you already had all this planned out?
[52:47.440 --> 52:56.440]  I tell you, that's why the video that everybody, every cop has to watch before they can hit the street
[52:56.440 --> 52:59.440]  on how to handle difficult people.

[56:18.440 --> 56:23.440]  They want to be good guys, but they got in this system that is all screwed up.
[56:23.440 --> 56:28.440]  And if they're going to keep their job, they're going to do what they're taught to do.
[56:28.440 --> 56:35.440]  If we're going to fix the system, we have to give them plausible deniability.
[56:35.440 --> 56:42.440]  And the way you give them plausible deniability is you set them up and play them like a cheat fiddle

[01:05:10.440 --> 01:05:13.440]  There's this group called the Republic of Texas group.
[01:05:13.440 --> 01:05:18.440]  And they've been around for a long time, and they're legal reform guys.
[01:05:18.440 --> 01:05:22.440]  And I go before them and tell them that, you know,
[01:05:22.440 --> 01:05:25.440]  they want to get rid of the Texas government we have
[01:05:25.440 --> 01:05:28.440]  and replace it with another one.
[01:05:28.440 --> 01:05:31.440]  I said, well, you guys don't know how to run a government.
[01:05:31.440 --> 01:05:35.440]  Instead of getting rid of the one you got, fix it.
[01:05:35.440 --> 01:05:38.440]  And all you got to do to fix it is just take out a criminal complaint
[01:05:38.440 --> 01:05:40.440]  and sign your name to it.
[01:05:40.440 --> 01:05:43.440]  And when I mentioned them stepping forward
[01:05:43.440 --> 01:05:47.440]  and putting their name on the complaint,
[01:05:47.440 --> 01:05:52.440]  they could not get me out of there fast enough.

[01:05:56.440 --> 01:06:01.440]  Charles, have you ever stood in court and had the judge say something,
[01:06:01.440 --> 01:06:05.440]  and then you turn to the bailiff and say, Mr. Bailiff, did you hear that?
[01:06:05.440 --> 01:06:08.440]  The bailiff says, yes, Mr. Colton, I did.
[01:06:08.440 --> 01:06:11.440]  Arrest that judge.
[01:06:11.440 --> 01:06:17.440]  That is so much fun.
[01:06:17.440 --> 01:06:21.440]  I've done that seven times in court.
[01:06:21.440 --> 01:06:28.440]  And every time the judge sat there and kept his mouth shut,
[01:06:28.440 --> 01:06:31.440]  because he knew one word out of him,
[01:06:31.440 --> 01:06:35.440]  since I'm making criminal accusations against him,
[01:06:35.440 --> 01:06:41.440]  obstruction, witness tampering, both of them felonies.
[01:06:41.440 --> 01:06:45.440]  The judge is a public servant.
[01:06:45.440 --> 01:06:49.440]  A judge has two duties.
[01:06:49.440 --> 01:06:52.440]  Determine the facts in accordance with the rules of evidence.
[01:06:52.440 --> 01:06:55.440]  Apply the laws that comes to him to the facts in the case.
[01:06:55.440 --> 01:06:57.440]  That's it.
[01:06:57.440 --> 01:07:03.440]  If he has himself another agenda, he better leave that at home.
[01:07:03.440 --> 01:07:07.440]  Because if he don't, I'm going to do my best to put him in a position
[01:07:07.440 --> 01:07:14.440]  to explain himself to a grand jury of my peers, not his peers.

[01:07:36.440 --> 01:07:39.440]  He said, I pulled somebody over a while back,
[01:07:39.440 --> 01:07:42.440]  and he kind of brought up the same kind of stuff.
[01:07:42.440 --> 01:07:44.440]  I said, was his name Scott?
[01:07:44.440 --> 01:07:47.440]  He said, no, I think his name started with an F.
[01:07:47.440 --> 01:07:49.440]  I said, was it Brent Fountain?
[01:07:49.440 --> 01:07:51.440]  Yeah, that's the one.
[01:07:51.440 --> 01:07:54.440]  And that had been what, like a year before or something?
[01:07:54.440 --> 01:07:56.440]  Yeah, same cop.
[01:07:56.440 --> 01:08:00.440]  He's kind of getting agitated a little bit, annoyed with me,
[01:08:00.440 --> 01:08:03.440]  and he put his hands on the door facing,
[01:08:03.440 --> 01:08:08.440]  because he's on the passenger side, because I'm on I-35,
[01:08:08.440 --> 01:08:12.440]  and it's heavy traffic and misty rain and fog.
[01:08:12.440 --> 01:08:13.440]  It's a mess.
[01:08:13.440 --> 01:08:16.440]  So he got on the passenger side so we could get run over.
[01:08:16.440 --> 01:08:20.440]  He's got his hands on the door facing, and I picked up my cell phone,
[01:08:20.440 --> 01:08:23.440]  and he said, you need to put that cell phone down when I'm talking to you.
[01:08:23.440 --> 01:08:28.440]  I said, no, you appear to be getting a little bit agitated,
[01:08:28.440 --> 01:08:32.440]  and you are prominently displaying a deadly weapon.
[01:08:32.440 --> 01:08:35.440]  You are causing me to fear for my life.
[01:08:35.440 --> 01:08:41.440]  Do I need to call 911 and get someone out here to get you under control?
[01:08:41.440 --> 01:08:46.440]  He stepped back, took a deep breath, exhaled,
[01:08:46.440 --> 01:08:50.440]  leaned back down in the window and said, no, Mr. Kelton,
[01:08:50.440 --> 01:08:55.440]  you do not need to call 911.
[01:08:55.440 --> 01:09:07.440]  If someone interferes with a 911 call, that's a felony in Texas, and he knew that.
[01:09:07.440 --> 01:09:10.440]  Cop give me half ounce of garbage.
[01:09:10.440 --> 01:09:16.440]  First, when I watched that video and the second time that policeman told me to back up,
[01:09:16.440 --> 01:09:20.440]  I'd had out my cell phone dialing 911.
[01:09:20.440 --> 01:09:22.440]  Wow.
[01:09:22.440 --> 01:09:27.440]  That changes everything.
[01:09:27.440 --> 01:09:31.440]  Then I tell the policeman, you need to wait right here.
[01:09:31.440 --> 01:09:34.440]  I have someone coming, and when they get here,
[01:09:34.440 --> 01:09:37.440]  I'm going to be filing criminal charges against you,
[01:09:37.440 --> 01:09:41.440]  so you really need to stand down until this person gets here.
[01:09:41.440 --> 01:09:47.440]  Then when this cop gets there on your 911 call, he's going to want to protect his buddy.
[01:09:47.440 --> 01:09:50.440]  You made the call, you're the victim.
[01:09:50.440 --> 01:09:51.440]  Right.
[01:09:51.440 --> 01:09:58.440]  You just turned everything upside down for him, but that guy's his buddy.
[01:09:58.440 --> 01:10:00.440]  But he's also the aggressor.
[01:10:00.440 --> 01:10:07.440]  Yeah, so what you'll get to see is what we call this little chicken dance.
[01:10:07.440 --> 01:10:10.440]  Have you ever seen a chicken that's kind of scared and nervous

[01:10:17.440 --> 01:10:21.440]  Well, now, Mr. Kelton, I can't arrest him.

[01:10:22.440 --> 01:10:27.440]  Just throw the cops on him and drag him off to jail.
[01:10:27.440 --> 01:10:31.440]  That's the title 18 U.S. Code 242, right?
[01:10:31.440 --> 01:10:36.440]  No, you got the right code, but the wrong jurisdiction.
[01:10:36.440 --> 01:10:41.440]  That would be correct if you're dealing with feds or federal crimes.
[01:10:41.440 --> 01:10:47.440]  Every state has a statute that reflects 18 U.S. Code 242.
[01:10:47.440 --> 01:10:54.440]  And in Texas, it's 39.03, penal code.
[01:10:54.440 --> 01:11:00.440]  If a public official exerts or purports to exert an authority
[01:11:00.440 --> 01:11:05.440]  he does not expressly have, and in the process denies you the full
[01:11:05.440 --> 01:11:09.440]  and free access to or enjoyment right, a right, for instance,
[01:11:09.440 --> 01:11:14.440]  the right to videotape your public, your officials in the performance
[01:11:14.440 --> 01:11:18.440]  of their duty in accordance with you should know this one.
[01:11:18.440 --> 01:11:21.440]  Charles, you're doing audits?

[01:11:24.440 --> 01:11:27.440]  Turner v. Driver.

[01:13:50.440 --> 01:13:55.440]  Okay, Denton County is close to my heart because I have beat them up a number of times.
[01:13:55.440 --> 01:14:05.440]  And it was especially appealing to me because you were before Judge Shipman.
[01:14:05.440 --> 01:14:12.440]  I tell a story on this show about being in front of Judge Shipman.
[01:14:12.440 --> 01:14:14.440]  But it wasn't a female judge.
[01:14:14.440 --> 01:14:15.440]  It was a male judge.

[01:14:19.440 --> 01:14:27.440]  I went into court where they were having motion hearings.
[01:14:27.440 --> 01:14:29.440]  Motion hearings don't take very long.
[01:14:29.440 --> 01:14:32.440]  So they've got a bunch of lawyers in there and it goes real fast.
[01:14:32.440 --> 01:14:36.440]  And I walked into court and an old shirt had a big hole in it where I'd been welding it.
[01:14:36.440 --> 01:14:41.440]  I walked up to the bar and pointed at the bailiff, you, come here.
[01:14:41.440 --> 01:14:45.440]  And I said it loud enough so the judge could hear me.
[01:14:45.440 --> 01:14:48.440]  And the bailiff came over and said, okay, may I help you?
[01:14:48.440 --> 01:14:50.440]  Yes, you can.
[01:14:50.440 --> 01:14:52.440]  My name is Randall Kelton.
[01:14:52.440 --> 01:14:54.440]  I always tell them my name first.
[01:14:54.440 --> 01:14:59.440]  Instruct the judge that I have business with the court.
[01:14:59.440 --> 01:15:01.440]  And they always say the same thing.
[01:15:01.440 --> 01:15:04.440]  May I tell the judge the nature of the business?
[01:15:04.440 --> 01:15:09.440]  And in this case, I said, no, you may not.
[01:15:09.440 --> 01:15:11.440]  I have business with the court and it's none of yours.
[01:15:11.440 --> 01:15:12.440]  You're dismissed.
[01:15:12.440 --> 01:15:17.440]  And I flicked my fingers at it and then went and sat down.
[01:15:17.440 --> 01:15:21.440]  So as you might guess, he's a bit curious.
[01:15:21.440 --> 01:15:24.440]  But he don't know who I am.
[01:15:24.440 --> 01:15:29.440]  And this guy's coming into this court ordering me around like I'm his errand stepchild.
[01:15:29.440 --> 01:15:31.440]  And he's wondering, who is this guy?
[01:15:31.440 --> 01:15:34.440]  So he runs up to the judge and jibber jabber jibber.
[01:15:34.440 --> 01:15:40.440]  And the judge looks out at me and I'm sitting here holding this red folder.
[01:15:40.440 --> 01:15:43.440]  The judge can't help himself.
[01:15:43.440 --> 01:15:45.440]  He's got to know what's in it.
[01:15:45.440 --> 01:15:50.440]  And when I did that, there were a whole bunch of lawyers in there for this motion hearing.
[01:15:50.440 --> 01:15:55.440]  They saw me do that and all of them stayed to watch the fireworks.
[01:15:55.440 --> 01:15:58.440]  The judge finishes and said, Mr. Kelton, I understand you have business with the court.
[01:15:58.440 --> 01:15:59.440]  Yes, Your Honor, I do.
[01:15:59.440 --> 01:16:01.440]  And I held up this red folder.
[01:16:01.440 --> 01:16:02.440]  May I approach?
[01:16:02.440 --> 01:16:04.440]  That means can I give me these folders?
[01:16:04.440 --> 01:16:06.440]  What he sent to Bailiff to get it.
[01:16:06.440 --> 01:16:08.440]  Bailiff gets it, gives it to him.
[01:16:08.440 --> 01:16:09.440]  He opens it up.
[01:16:09.440 --> 01:16:20.440]  He's looking at criminal charges against the district clerk for shielding criminal charges against the district attorney from the grand jury.
[01:16:20.440 --> 01:16:26.440]  He said, Mr. Kelton, I'm not sure what to do with these.
[01:16:26.440 --> 01:16:31.440]  Normally, I would give them to the district attorney, but since he's implicated, I can't do that.
[01:16:31.440 --> 01:16:36.440]  I said, yes, Your Honor, if you gave those to the district attorney, I'd consider that a criminal act.
[01:16:36.440 --> 01:16:40.440]  Well, Mr. Kelton, just what do you suggest I do with them?

[01:20:21.440 --> 01:20:30.440]  And then the judge looked at me, and I've got this holy shirt I've been welding in, and he said, he's kind of miffed at me.
[01:20:30.440 --> 01:20:34.440]  Mr. Kelton, don't you want a suit?
[01:20:34.440 --> 01:20:38.440]  I said, well, yes, Judge, at last count, I own 35.
[01:20:38.440 --> 01:20:41.440]  Well, why aren't you wearing one in my courtroom?
[01:20:41.440 --> 01:20:44.440]  I said, well, Judge, I'm here on the scruful.
[01:20:44.440 --> 01:20:54.440]  And I only got one, and I had noticed that all these lawyers had stayed to watch the fireworks because he figured the judge was going to lambaste me.

[01:20:56.440 --> 01:21:00.440]  I didn't want to be like all these suits.
[01:21:00.440 --> 01:21:06.440]  They got lots of scruples, Judge, and all of them for sale or rent.
[01:21:06.440 --> 01:21:14.440]  And the judge ducked his head, put his head in his hand, and he said, oh, geez, I walked right into that one.
[01:21:14.440 --> 01:21:18.440]  And I said, yes, Judge, and I want to offer my thanks.
[01:21:18.440 --> 01:21:20.440]  Well, why do you want to thank me, Mr. Kelton?
[01:21:20.440 --> 01:21:24.440]  Well, I've been waiting a long time to deliver that line.

[01:26:01.440 --> 01:26:02.440]  Oh, no, Judge.
[01:26:02.440 --> 01:26:05.440]  I sleep well at night and keep my asthma own pockets.
[01:26:05.440 --> 01:26:07.440]  Thank you very much.
[01:26:07.440 --> 01:26:08.440]  Well, have you talked to a lawyer?
[01:26:08.440 --> 01:26:09.440]  Oh, no, no.
[01:26:09.440 --> 01:26:11.440]  I don't waste my time with lawyers.
[01:26:11.440 --> 01:26:13.440]  They don't know what the heck's going on.
[01:26:13.440 --> 01:26:21.440]  And he took my complaints and threw them down on the counter while I'm not going to take his eternity, stormed out of the office.

[01:26:26.440 --> 01:26:29.440]  I took out my cell phone, called 911.
[01:26:29.440 --> 01:26:33.440]  I want an officer to come down here and arrest the judge.
[01:26:33.440 --> 01:26:43.440]  For class A misdemeanor, official oppression, criminal violation 39.03, penal code, in that he failed to perform a duty he was required to perform
[01:26:43.440 --> 01:26:51.440]  and in the process denied me the full and free access to or enjoyment of a right.
[01:26:51.440 --> 01:26:57.440]  And one of the clerks heard me do that and tattled on me.
[01:26:57.440 --> 01:27:02.440]  So I'm sitting there on the bench writing out a criminal complaint against the judge.
[01:27:02.440 --> 01:27:03.440]  And the judge come back out.
[01:27:03.440 --> 01:27:06.440]  He said, Mr. Thompson, did you talk to a lawyer?
[01:27:06.440 --> 01:27:08.440]  I said, stop, stop, stop, stop.
[01:27:08.440 --> 01:27:10.440]  I can't be talking to you.
[01:27:10.440 --> 01:27:15.440]  I've got an officer coming and I'm going to file criminal charges against you.
[01:27:15.440 --> 01:27:24.440]  And I'll give him a full statement so it would be inappropriate for us to have any further communications.
[01:27:24.440 --> 01:27:28.440]  He looked like I hit him with a bat.
[01:27:28.440 --> 01:27:30.440]  You did.
[01:27:30.440 --> 01:27:36.440]  Charles, that was so much fun.
[01:27:36.440 --> 01:27:40.440]  I hear these guys asking policemen to do what they're supposed to do.
[01:27:40.440 --> 01:27:47.440]  And when they don't do it, they get all frustrated and angry and they feel mistreated and betrayed.

[01:27:51.440 --> 01:27:54.440]  You don't want them to do what you're asking them to do.
[01:27:54.440 --> 01:28:00.440]  Because if they do what you ask them to do, you don't get to call 911.

[01:35:51.440 --> 01:35:53.440]  A guy called me for help.
[01:35:53.440 --> 01:35:58.440]  He got arrested on February 17th.
[01:35:58.440 --> 01:36:02.440]  He had just moved in to a shared living situation.
[01:36:02.440 --> 01:36:04.440]  It's 3 o'clock in the morning.
[01:36:04.440 --> 01:36:09.440]  He's in the kitchen and one of the other tenants came home.
[01:36:09.440 --> 01:36:14.440]  He happened to be a bartender, the guy that came home.
[01:36:14.440 --> 01:36:17.440]  They got into a squabble in the kitchen.
[01:36:17.440 --> 01:36:22.440]  The guy was in the kitchen again as the other guy came home, okay?
[01:36:22.440 --> 01:36:25.440]  And so he was in there making coffee.
[01:36:25.440 --> 01:36:30.440]  He has a pot of coffee in his hand when the other guy shoved him.
[01:36:30.440 --> 01:36:36.440]  And he just raised his hand up and, you know, in defense.
[01:36:36.440 --> 01:36:39.440]  And because the guy was coming at him, you know,
[01:36:39.440 --> 01:36:46.440]  he tapped him in the side of the head with this coffee pot.

[01:36:47.440 --> 01:36:48.440]  It was a glass coffee pot.

[01:36:50.440 --> 01:36:58.440]  And then the individual that had the coffee pot and actually, you know,
[01:36:58.440 --> 01:37:03.440]  his story is that he was the one that was basically attacked by the other guy.

[01:37:09.440 --> 01:37:14.440]  The bottom line is the deputy sheriffs come out and they arrest him,
[01:37:14.440 --> 01:37:19.440]  the guy with the coffee pot, and they charge him with assault with a deadly weapon.
[01:37:19.440 --> 01:37:24.440]  It's 3 o'clock in the morning on a Thursday the 17th.
[01:37:24.440 --> 01:37:33.440]  He bailed himself out later that day and he's told to come back in April.
[01:37:33.440 --> 01:37:38.440]  I wanted to put in, based on what I've heard from you guys,
[01:37:38.440 --> 01:37:45.440]  I think that we should put in a motion to dismiss for not taking him to the magistrate.
[01:37:45.440 --> 01:37:48.440]  Absolutely.
[01:37:48.440 --> 01:37:50.440]  This is California.
[01:37:50.440 --> 01:37:55.440]  California has a requirement for preliminary hearing.
[01:37:55.440 --> 01:37:57.440]  But you need to read the code real careful.

[01:38:20.440 --> 01:38:25.440]  That's City Riverside v. McLaughlin.
[01:38:25.440 --> 01:38:31.440]  And for the purpose of a preliminary hearing, not for some magistration crap folder
[01:38:31.440 --> 01:38:37.440]  where they read you your rights and set bond.
[01:38:37.440 --> 01:38:41.440]  Because when they do that, one of the rights they tell you is you have a right to an examining trial
[01:38:41.440 --> 01:38:45.440]  while they're denying you a right to an examining trial.
[01:38:45.440 --> 01:38:52.440]  So read that portion of the code in detail.
[01:38:52.440 --> 01:38:55.440]  It's generally only a chapter or two.
[01:38:55.440 --> 01:38:57.440]  And then compare it to what they do,
[01:38:57.440 --> 01:39:05.440]  and then you can start extracting specific complaints against them from that.
[01:39:05.440 --> 01:39:11.440]  They're just going to charge him with the highest possible crime they can
[01:39:11.440 --> 01:39:14.440]  so they can deal it down to something smaller.
[01:39:14.440 --> 01:39:20.440]  So that's why I charge police officers with first degree felony aggravated assault
[01:39:20.440 --> 01:39:26.440]  when they stop me for a traffic ticket.
[01:39:26.440 --> 01:39:29.440]  So that's the highest possible charge I can bring.
[01:39:29.440 --> 01:39:31.440]  Well, there's no way I'd get an indictment on that,
[01:39:31.440 --> 01:39:34.440]  but it's going to scare the poop out of them,
[01:39:34.440 --> 01:39:38.440]  and that's what they're trying to do to this guy.
[01:39:38.440 --> 01:39:43.440]  So again, and while you were telling me that,
[01:39:43.440 --> 01:39:53.440]  one other thing that always strikes me is people never tell you everything.

[01:42:06.440 --> 01:42:10.440]  and they forget things and miss stuff.

[01:42:12.440 --> 01:42:17.440]  so it's kind of your duty to help them sort out what really went on
[01:42:17.440 --> 01:42:24.440]  as opposed to that portion of what went on that they consciously remember.
[01:42:24.440 --> 01:42:29.440]  So if something doesn't feel right, probe it.
[01:42:29.440 --> 01:42:32.440]  Make them feel in the empty spaces.
[01:42:32.440 --> 01:42:36.440]  A lot of times, these things will go away because they'll realize that,
[01:42:36.440 --> 01:42:39.440]  yeah, this other guy didn't act appropriately,
[01:42:39.440 --> 01:42:44.440]  but I didn't exactly act appropriately either.
[01:42:44.440 --> 01:42:47.440]  I'm minding my own business, making some coffee,
[01:42:47.440 --> 01:42:52.440]  and somebody comes in, starts fighting, and I have to hit him with a coffee pot.
[01:42:52.440 --> 01:42:58.440]  And I'm saying, you know, that don't sound right.
[01:42:58.440 --> 01:43:03.440]  This guy had to have some reason to come after you.
[01:43:03.440 --> 01:43:08.440]  You didn't say he was so drunk you didn't know what he was doing,

[01:51:11.440 --> 01:51:18.440]  That's appeal to someone with greater knowledge, appeals to flattery,
[01:51:18.440 --> 01:51:25.440]  a straw man, straw man issue, a red herring.
[01:51:25.440 --> 01:51:31.440]  If you don't know what constitutes a red herring,
[01:51:31.440 --> 01:51:34.440]  you really don't recognize it.
[01:51:34.440 --> 01:51:37.440]  My favorite one's a straw man.
[01:51:37.440 --> 01:51:42.440]  I was watching a political debate,
[01:51:42.440 --> 01:51:48.440]  and it was back when the farmers were trying to get parity,
[01:51:48.440 --> 01:51:52.440]  and someone asked this senator a question.
[01:51:52.440 --> 01:51:54.440]  I don't even remember what it was,
[01:51:54.440 --> 01:51:58.440]  and the senator said, no, no, no, no, that's a red herring.
[01:51:58.440 --> 01:52:02.440]  And I thought, I knew what a red herring is.
[01:52:02.440 --> 01:52:09.440]  A red herring is when you bring up an issue that appears to be on point
[01:52:09.440 --> 01:52:12.440]  but is really a distraction.
[01:52:12.440 --> 01:52:19.440]  And as he explained why it was a red herring, I was annoyed that I had missed that.
[01:52:19.440 --> 01:52:26.440]  But if you don't know what a red herring is, you don't know how to recognize it.
[01:52:26.440 --> 01:52:29.440]  The easiest one to explain is a straw man.
[01:52:29.440 --> 01:52:32.440]  A straw man issue is where you pick a minor point,
[01:52:32.440 --> 01:52:38.440]  exaggerate that minor point, then attack the exaggeration.
[01:52:38.440 --> 01:52:42.440]  Once you know what the pattern is,
[01:52:42.440 --> 01:52:51.440]  then in the midst of a conversation, your brain will listen to the facts
[01:52:51.440 --> 01:52:53.440]  and the interactions going back and forth,
[01:52:53.440 --> 01:52:59.440]  but another part of your brain looks at the underlying patterns,
[01:52:59.440 --> 01:53:02.440]  and it'll cause you to say, meh, that's a straw man issue.
[01:53:02.440 --> 01:53:09.440]  And then you know something's wrong with that argument, but it's not clear what it is.
[01:53:09.440 --> 01:53:13.440]  Once you can call it a straw man, then you know exactly what's wrong with it.
[01:53:13.440 --> 01:53:16.440]  Does that make sense?
[01:53:16.440 --> 01:53:20.440]  It'll make more sense while I listen to it again.
[01:53:20.440 --> 01:53:28.440]  If you don't know what the underlying pattern is, it's really hard to detect it.
[01:53:28.440 --> 01:53:32.440]  But your conscious mind listens to the details.
[01:53:32.440 --> 01:53:39.440]  There's another aspect of mind that pays attention to the underlying patterns.
[01:53:39.440 --> 01:53:43.440]  So if you can define the underlying pattern,
[01:53:43.440 --> 01:53:50.440]  then the conscious part will collect all these details and compare them to all the stuff you know.
[01:53:50.440 --> 01:53:54.440]  And one of the things you know once you know the pattern is that pattern,
[01:53:54.440 --> 01:53:56.440]  and it'll compare it to that pattern.
[01:53:56.440 --> 01:54:06.440]  If it fits, then bingo, it lets you step outside of the content and look at the patterns.
[01:54:06.440 --> 01:54:13.440]  You catch people trying to manipulate you using these underlying patterns.
[01:54:13.440 --> 01:54:16.440]  And most of the times when people do that,
[01:54:16.440 --> 01:54:20.440]  they don't realize they're using an underlying pattern.
[01:54:20.440 --> 01:54:29.440]  What I found in studying neurolinguistic programming is these destructive patterns people use,
[01:54:29.440 --> 01:54:33.440]  for the most part, they don't know they're doing it.
[01:54:33.440 --> 01:54:39.440]  So if you can learn to recognize speech patterns and interrupt people,
[01:54:39.440 --> 01:54:45.440]  it causes them to become much more effective.
[01:54:45.440 --> 01:54:50.440]  That's something we could do a four-hour show on.
[01:54:50.440 --> 01:54:53.440]  Pacing, leading, reality stacking, analog marketing,
[01:54:53.440 --> 01:55:02.440]  we've got all these tools we can use that nobody catches because they go past right outside awareness.

[01:56:07.440 --> 01:56:14.440]  or magistrate in the nearest court of record without delay, doesn't specify a specific time.
[01:56:14.440 --> 01:56:17.440]  I'm just wondering what do I do with that fact?
[01:56:17.440 --> 01:56:22.440]  There is a mountain of case law on that issue.
[01:56:22.440 --> 01:56:31.440]  They are to take you directly to the nearest magistrate by the most direct route without unnecessary delay.
[01:56:31.440 --> 01:56:37.440]  If there's a snowstorm, that's necessary delay.
[01:56:37.440 --> 01:56:46.440]  If there's a flood, lightning strike, riots in the street, that's reason for delay.
[01:56:46.440 --> 01:56:52.440]  But it has to be, you know, there has to be good reason for the delay.
[01:56:52.440 --> 01:56:56.440]  They never take you directly to the magistrate.
[01:56:56.440 --> 01:57:01.440]  They don't do that because it serves the prosecutorial purpose.
[01:57:01.440 --> 01:57:10.440]  You're in Colorado, read the criminal procedure codes concerning arrest.
