[01:13.920 --> 01:17.880]  and San Antonio, have been dropping marijuana possession charges and even refusing to file
[01:17.880 --> 01:22.560]  new ones since they are stipulating that they do not have the time or the laboratory equipment
[01:22.560 --> 01:24.640]  to test the herb for THC.
[01:24.640 --> 01:28.280]  Margaret Moore, the Travis County District Attorney, announced earlier this month that
[01:28.280 --> 01:33.200]  she was dismissing 32 felony possession and delivery of marijuana cases because of the
[01:33.200 --> 01:34.200]  law.
[01:34.200 --> 01:37.440]  Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter
[01:37.440 --> 01:41.940]  to county district attorneys back on Thursday that marijuana has not been decriminalized
[01:41.940 --> 01:48.080]  in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works.
[01:48.080 --> 01:54.240]  As well as other cities too, like the District Attorney, in El Paso, Jaime Esparza, a Democrat
[01:54.240 --> 01:58.800]  who also stated earlier this month that the law, quote, will not have an effect on the
[01:58.800 --> 02:01.480]  prosecution of marijuana cases in El Paso.
[02:01.480 --> 02:06.560]  However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender
[02:06.560 --> 02:10.560]  in Harris County, who stated that, quote, the law is constantly changing on what makes
[02:10.560 --> 02:13.280]  something illegal based on its chemical makeup.
[02:13.280 --> 02:17.160]  It's important that if someone is charged with something, the test matches what they're
[02:17.160 --> 02:22.360]  charged with.
[02:22.360 --> 02:27.080]  A paper by Tulane University identified a five and a half inch American pocket shark
[02:27.080 --> 02:32.200]  as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket
[02:32.200 --> 02:37.840]  shark ever captured or recorded with the other one being found way back in 1979 in the East
[02:37.840 --> 02:39.120]  Pacific Ocean.
[02:39.120 --> 02:43.640]  According to the university paper, the shark secretes a luminous fluid from a gland near
[02:43.640 --> 02:45.480]  its front fins.
[02:45.480 --> 03:02.840]  For the purpose, it is hypothesized to lure and prey who may be drawn into the glow.

[04:01.800 --> 04:08.600]  Well, yeah, I mean, and I can share documents with you as well, or we can collaborate because
[04:08.600 --> 04:13.520]  probably it sounds similar enough that you'll be able to do some copying and pasting.
[04:13.520 --> 04:22.800]  I was down in Brazos County, court watcher, and I saw somebody that was criminally accused
[04:22.800 --> 04:28.620]  standing up trying to defend himself in a criminal case.
[04:28.620 --> 04:36.800]  And the judge was telling him, be quiet, sit down, shut up, I'm not going to hear you.
[04:36.800 --> 04:47.680]  And of course, in Texas Constitution, a criminally accused has an absolute right to be heard.
[04:47.680 --> 04:52.140]  So this man that was not allowed to speak is literally the only person in the room who
[04:52.140 --> 04:54.480]  has a right to be heard.
[04:54.480 --> 04:59.840]  Everybody else is just there talking, but this man who was told to sit down and shut
[04:59.840 --> 05:07.800]  up, his voice is the only one that was constitutionally protected.
[05:07.800 --> 05:12.580]  Anyway, I watched the judge tell this man that he wasn't allowed to defend himself,
[05:12.580 --> 05:14.680]  he needed to be quiet.
[05:14.680 --> 05:18.680]  And if he didn't, the third time he tried, the judge told him he's going to hold him
[05:18.680 --> 05:22.620]  in contempt of court if he doesn't cut it out.
[05:22.620 --> 05:27.680]  So he did, and he was quiet after that, he didn't bring up any more objections or anything
[05:27.680 --> 05:28.680]  else.
[05:28.680 --> 05:34.540]  Oh, the third time he did this, this is good.
[05:34.540 --> 05:40.280]  The third time this man made an attempt to defend himself, he said, your honor, I don't
[05:40.280 --> 05:44.580]  feel like it's not even possible for me to get a fair shake here.
[05:44.580 --> 05:50.200]  He said, I move for your immediate disqualification, your honor, for bias.
[05:50.200 --> 05:54.120]  And that's when the judge sat back, he got quiet for a minute, and then he leaned forward
[05:54.120 --> 05:58.720]  and he said, if you want to speak again, I'm going to hold you in contempt of court.
[05:58.720 --> 06:01.620]  So the man didn't say anything else the whole time.
[06:01.620 --> 06:06.080]  And the judge went ahead and ruled on all kinds of things against him, and it looked
[06:06.080 --> 06:07.080]  really bad.
[06:07.080 --> 06:12.160]  Well, I'm watching all this, right, so I wrote it all up and it's a felony tampering with
[06:12.160 --> 06:14.040]  the record.
[06:14.040 --> 06:18.120]  He did not allow that man to get his defense on the record, so he blocked it, he prevented
[06:18.120 --> 06:27.200]  it, and the statute says impaired the availability of it, and he tampered with it.
[06:27.200 --> 06:32.700]  So that was a felony, then, of course, there's a lawyer standing there, the lawyer didn't
[06:32.700 --> 06:37.940]  correct the judge, so that was a bar grievance for him, and complicity.
[06:37.940 --> 06:43.200]  He was criminally complicit in the judge's felony, because he didn't report the felony.
[06:43.200 --> 06:47.460]  He didn't even try to interfere or do anything to mitigate, nothing.
[06:47.460 --> 06:56.600]  So he's culpable too, and turns out that lawyer works at a law firm where there are eight
[06:56.600 --> 06:58.240]  other attorneys.
[06:58.240 --> 07:03.740]  So of course, just doing my civic duty, I reached out and made sure that they are aware
[07:03.740 --> 07:09.760]  that this lawyer just committed this crime and this bar grievance in this violation of
[07:09.760 --> 07:11.680]  the ethical rules.
[07:11.680 --> 07:21.640]  Well, what that does for them is it triggers their ethical duty to bar grieve him, unless
[07:21.640 --> 07:25.520]  they believe that he's doing it cuz he's a drug addict, then they can send him to rehab
[07:25.520 --> 07:27.640]  instead.
[07:27.640 --> 07:31.440]  But now those other eight attorneys, I mean, I guess they're probably gonna have some awkward
[07:31.440 --> 07:39.440]  moments around the water cooler, but that's just what happens when people go around running
[07:39.440 --> 07:43.920]  a muck and committing crimes, right?
[07:43.920 --> 07:47.320]  Does that sound like fun or what?
[07:47.320 --> 07:49.320]  Did we lose you, Max?
[07:49.320 --> 07:51.760]  No, it sounds like a blast.
[07:51.760 --> 08:02.280]  I do have a question, does that translate to civil matters, Article I, Section 10?
[08:02.280 --> 08:03.280]  I don't think it does.
[08:03.280 --> 08:06.680]  I think that Article I, Section 10 is specifically about crimes.
[08:06.680 --> 08:13.040]  No, wait, wait, Article I, Section 10, you're talking about Constitution?

[08:15.400 --> 08:22.160]  Absolutely, all the rights that you have apply to everything.
[08:22.160 --> 08:28.680]  Just because you're in a civil case doesn't mean you don't have a right to defend yourself.

[08:30.440 --> 08:41.560]  So that's the complaint part on behalf of the judge.
[08:41.560 --> 08:50.600]  But on the other side, for the lawyer that's moving a case against me without standing,
[08:50.600 --> 08:54.880]  what would be the best avenue to address that?
[08:54.880 --> 09:00.420]  I would say Texas Rules of Civil Procedure has a Rule 12.
[09:00.420 --> 09:04.560]  To show authority of opposing counsel.
[09:04.560 --> 09:09.420]  So if you don't think they have standing, you just simply swear that you don't believe
[09:09.420 --> 09:11.120]  they have standing.
[09:11.120 --> 09:15.960]  And now the burden of proof is on them to show that they do have standing.
[09:15.960 --> 09:16.960]  Look at Rule 12.
[09:16.960 --> 09:26.280]  Would I do this in an affidavit or a motion or what's the process for that?
[09:26.280 --> 09:33.320]  It is a motion, a motion to show cause, a motion to show authority of counsel.
[09:33.320 --> 09:38.560]  And it does need to be sworn according to Rule 12.
[09:38.560 --> 09:42.480]  Let me make a comment here.
[09:42.480 --> 09:52.120]  The way you said that gave me the impression there was a idea that you had about filing
[09:52.120 --> 09:57.520]  motions in court that may not exactly be accurate.
[09:57.520 --> 10:06.800]  A motion in a court is simply a request that the judge do something.
[10:06.800 --> 10:13.960]  The only difference between a motion and a letter is the heading.
[10:13.960 --> 10:17.000]  You could send a letter to the judge and say, Judge, I think you did this wrong.
[10:17.000 --> 10:19.800]  I want you to do this other thing.
[10:19.800 --> 10:23.320]  The only difference between that and a motion is the heading on it.
[10:23.320 --> 10:25.720]  It's got a different heading on it.
[10:25.720 --> 10:34.880]  And the one condition of a motion is you have to move the court.
[10:34.880 --> 10:38.860]  You write him a letter and say, Judge, this is what went wrong.
[10:38.860 --> 10:41.360]  This is what they should have done.
[10:41.360 --> 10:48.760]  And then you say, this is what I want you to do.
[10:48.760 --> 10:54.720]  That's where you move, that's in the prayer section that normally a business letter wouldn't
[10:54.720 --> 10:55.720]  have.
[10:55.720 --> 10:59.600]  If you had a business letter at the bottom, you would ask them to do something.
[10:59.600 --> 11:06.640]  In a motion, you just put prayer on top of it and say, this is what I want you to do.
[11:06.640 --> 11:14.840]  Anything you think the judge does wrong, just write it up like a letter, put a court heading
[11:14.840 --> 11:21.840]  on the bottom of it, and put a court heading on the top and a prayer at the bottom.
[11:21.840 --> 11:25.560]  It really is that simple.
[11:25.560 --> 11:29.520]  So motions are not some mystical thing.
[11:29.520 --> 11:39.540]  I sat in a courtroom with Robert Fox, and his motions were a mess.
[11:39.540 --> 11:44.720]  And the prosecutor and the judge are trying to figure out what to call them.
[11:44.720 --> 11:48.720]  He had headings on them, but they didn't make any sense.
[11:48.720 --> 11:54.220]  And the judge and the prosecutor are trying to figure out what to call these motions.
[11:54.220 --> 12:02.680]  And the reason they're doing that is it makes no difference what you call a motion.
[12:02.680 --> 12:09.480]  If you ask the court to do something, it's a motion.
[12:09.480 --> 12:13.840]  If you name it some mystical, crazy stuff, it makes no difference.
[12:13.840 --> 12:16.440]  The motion is what it is.

[12:19.800 --> 12:24.680]  The point I'm trying to make here is, anytime you think the judge did something wrong, write

[14:32.480 --> 14:43.280]  You can expect, you should expect the court to rule against you out of hand at every turn.
[14:43.280 --> 14:46.360]  If he doesn't, so much the better.
[14:46.360 --> 14:55.000]  But if he does, it's okay, cuz your only purpose is to set the record.
[14:55.000 --> 14:58.800]  The judge has two duties.
[14:58.800 --> 15:02.380]  Determine the facts in accordance with the rules of evidence, apply the laws that comes

[20:31.840 --> 20:38.320]  I've got against the attorney, has changed the hearing date.
[20:38.320 --> 20:47.480]  She brought mine forward to have the court appointed free counsel because I'm indigent,
[20:47.480 --> 20:51.720]  but then she brought the other side's hearing.
[20:51.720 --> 20:56.960]  She took that from September 29th to exactly the same date as my hearing.
[20:56.960 --> 21:02.880]  Now, as I was explaining to you, I talked to the clerk, the very friendly one that I
[21:02.880 --> 21:10.280]  wrote a nice letter about, and she said, well, you could, you know, because I said, it seems
[21:10.280 --> 21:16.600]  I'm being shafted, you know, how can the judge hear both at the same time?
[21:16.600 --> 21:24.320]  And I don't really want to speak if she's hearing the case against, you know, the motion
[21:24.320 --> 21:25.320]  to strike.
[21:25.320 --> 21:31.480]  So she said, well, you, the judge will, could maybe move this.
[21:31.480 --> 21:34.920]  Okay, well, hold on, hold on, Tina.
[21:34.920 --> 21:41.000]  Take a step back and give us context for what you're speaking to.
[21:41.000 --> 21:45.760]  You're speaking to this, to me, because I already know the facts.
[21:45.760 --> 21:52.000]  Give everybody else a little bit of a recap so they'll know what the context is.
[21:52.000 --> 22:00.760]  I filed a case against an attorney for the bank because they committed fraud against
[22:00.760 --> 22:08.920]  me in stating that they would send me some documents and after the earlier case was finished
[22:08.920 --> 22:11.240]  and they refused.
[22:11.240 --> 22:14.240]  They said in writing that they would send me them twice.
[22:14.240 --> 22:21.120]  Yeah, and wait, wait, wait, wait, one, one caveat to that is there is a specific statute
[22:21.120 --> 22:31.240]  in California that commands them to send that, to return that specific document to you and
[22:31.240 --> 22:35.960]  you asked them to do that and they said they would do that in accordance with the requirement
[22:35.960 --> 22:38.200]  of that statute.
[22:38.200 --> 22:44.000]  So it wasn't like they were just being agreeable, they, the law said they had to, okay, go ahead.
[22:44.000 --> 22:52.560]  But then they said they wouldn't and when I first filed my declaratory judgment, I asked
[22:52.560 --> 22:59.160]  the other side's assistant attorney why he wouldn't just send it because it would be
[22:59.160 --> 23:01.240]  much cheaper than going through all this stuff.
[23:01.240 --> 23:04.320]  She said, why couldn't he just do what he said he would do?

[23:33.200 --> 23:39.000]  then they're not, you know, he's not committing this fraud because I never had standing and
[23:39.000 --> 23:43.880]  I'm saying that doesn't matter because you said you would send it so I didn't ask in
[23:43.880 --> 23:47.800]  the prior court for it because you promised to send it.
[23:47.800 --> 23:54.360]  And they admitted in a letter to me that they had no intention of doing what they said they
[23:54.360 --> 23:57.520]  would do when those statements were made.
[23:57.520 --> 24:01.840]  That is saying we had every intention to defraud you.
[24:01.840 --> 24:10.120]  So now the court is not letting me have discovery, the court is saying they're going to hear
[24:10.120 --> 24:16.560]  their motion to strike and their anti-slap, and I can't get discovery when they filed
[24:16.560 --> 24:22.080]  anti-slap without the court's permission, and she denied me permission.
[24:22.080 --> 24:29.040]  So I asked for free counsel because according to the California Supreme Court, even civil
[24:29.040 --> 24:36.040]  litigants who are poor are entitled to counsel, and that makes real sense because why should
[24:36.040 --> 24:43.240]  a criminal be allowed free counsel and not someone who is not a criminal, who is just
[24:43.240 --> 24:46.400]  too poor to hire an attorney?
[24:46.400 --> 24:51.800]  So that's what I based my motion on, but now she wants to hear them both on the same day.
[24:51.800 --> 25:01.200]  This very friendly, helpful clerk said, well, you could write a letter, just a declaration,
[25:01.200 --> 25:02.200]  and-
[25:02.200 --> 25:11.840]  Okay, wait, wait, just for everybody's edification, will you explain why that clerk is friendly?
[25:11.840 --> 25:21.040]  She is friendly because the first time I came across her, she was not very helpful and quite
[25:21.040 --> 25:26.680]  rude and was trying to tell me I couldn't file something because it was the wrong venue,
[25:26.680 --> 25:33.300]  and I said, well, you know, you're practicing law here, and I said, if it's the wrong venue,
[25:33.300 --> 25:37.640]  the other side has the right to request to move it.
[25:37.640 --> 25:47.600]  But I filed under advice, I filed a, what was it, a conduct complaint, professional
[25:47.600 --> 25:48.600]  conduct complaint.
[25:48.600 --> 25:53.360]  I got an answer the next day, they said, you're right, and they put everything right because
[25:53.360 --> 25:56.000]  this was three weeks waiting for them to file.
[25:56.000 --> 26:06.720]  So the next time I call her, she is just over-friendly and just helpful and giving me not legal advice,
[26:06.720 --> 26:09.200]  but procedural help.
[26:09.200 --> 26:16.600]  And so I wrote a professional conduct compliment this time and filed it with her boss and said
[26:16.600 --> 26:23.520]  that, you know, this is the kind of stuff we expect from our public servants, and this
[26:23.520 --> 26:28.900]  is, you know, what we, you know, pro se's need because we're not, you know, we don't
[26:28.900 --> 26:30.160]  have the legal training.
[26:30.160 --> 26:36.920]  And it was a very nice letter, and now she's eating out of my hand, and if I call and ask
[26:36.920 --> 26:41.360]  for her, she'll send me an email, you didn't quite do this right, could you put an order
[26:41.360 --> 26:46.240]  in if you did this right, you know, could you change that, don't worry about it.
[26:46.240 --> 26:52.000]  And this time she told me that I could write a declaration, but then she said, well, you
[26:52.000 --> 26:57.020]  know, if you do that, the judge will read it, I said, but then she's not going to do
[26:57.020 --> 26:58.960]  anything until the hearing date.
[26:58.960 --> 27:02.200]  And she said, that's true because there's no order.
[27:02.200 --> 27:07.940]  Well, you could write something and ask, you know, write an order and write some kind of
[27:07.940 --> 27:08.940]  request.
[27:08.940 --> 27:13.160]  She said, you know, you really need to think about this very carefully.
[27:13.160 --> 27:17.820]  You've got plenty of time, so don't rush, let's do it right the first time.
[27:17.820 --> 27:23.280]  Think about what you want to ask and request an order and how you want to ask it.
[27:23.280 --> 27:25.040]  So that's what I'm on here for.

[27:27.080 --> 27:34.840]  Because do I ask for her to remove their hearing to strike, their motion to strike to January

[27:45.320 --> 27:52.200]  You would notice the judge that if he hears this on this day, you will be without counsel.
[27:52.200 --> 27:59.020]  And you will be inappropriately denied the right to counsel in this particular instance.
[27:59.020 --> 28:07.480]  So it would be appropriate to extend this particular issue out until you've had time
[28:07.480 --> 28:14.680]  to hear your request for counsel and for counsel to have time to examine the case so you would
[28:14.680 --> 28:21.200]  have adequate representation for the other issue.
[28:21.200 --> 28:25.400]  And then if she denies that, because I'm going to have to ask for an ex parte hearing for
[28:25.400 --> 28:27.680]  her to hear that.
[28:27.680 --> 28:35.240]  Well, that would be okay, and I'm going to suggest that this is not the kind of thing
[28:35.240 --> 28:43.600]  that the judge will want to come before a commission on judicial conduct.
[28:43.600 --> 28:51.640]  And I suspect, you know, the judge is busy and that the judge probably doesn't realize
[28:51.640 --> 28:58.800]  that she has both of these hearings on one day and that one will conflict with the other.
[28:58.800 --> 29:02.720]  It's probably just an error.
[29:02.720 --> 29:10.320]  So just give the judge notice that these two hearings are on the same day.
[29:10.320 --> 29:16.200]  And if that occurs, you will be denied counsel for one of them.
[29:16.200 --> 29:20.920]  And she will almost certainly move the second one to a different day.

[34:55.400 --> 35:00.820]  clerks and all these officials, all they get is griping and complaining from the public
[35:00.820 --> 35:08.640]  and the few times they get something positive from the public, it really goes a long way.
[35:08.640 --> 35:20.320]  So be careful of the fights you pick, okay, Tina, where are we with your issue?
[35:20.320 --> 35:24.800]  Well I think you've handled, you've given me some ideas, I'm going to write something
[35:24.800 --> 35:31.480]  up, I'll kind of run it by you and then kind of make it really friendly, as you said, and
[35:31.480 --> 35:37.000]  the clerk said the judge actually moved them to the same day, so I will just pretend that

[35:53.320 --> 35:58.880]  are the same way and if you notice the judge that you have, you're concerned that the judge

[36:05.880 --> 36:07.840]  you almost certainly will.
[36:07.840 --> 36:14.280]  Okay, well I will do that and one quick, I wanted to just bring up because we were talking
[36:14.280 --> 36:24.640]  earlier about the things that you have, you know, in regard to this mask mandate, it strikes
[36:24.640 --> 36:30.120]  me that one of the things they're trying to do is keep training us like monkeys to just
[36:30.120 --> 36:35.960]  acquiesce and the case in point, whenever I go to a doctor or dentist or whatever, they
[36:35.960 --> 36:41.240]  always say I need to see your insurance and your ID and I said, you know, I let them see
[36:41.240 --> 36:45.680]  my insurance card and I showed them my ID, they said, oh no, we have to scan it, no you
[36:45.680 --> 36:53.560]  don't, you're looking at, you're just verifying that I am who I say I am, oh we have to scan
[36:53.560 --> 37:00.160]  it, I said no, my policy is I don't have my ID scanned, I said but I'm quite willing to
[37:00.160 --> 37:05.480]  just show it to you and my partner just had to go to the doctor by telemedicine and they
[37:05.480 --> 37:12.200]  insisted he scan his ID and he forgot that it was in the scanner and I said, well I never
[37:12.200 --> 37:16.280]  do that, I said I don't let them scan it, he said why do you pick that, what's the problem
[37:16.280 --> 37:21.080]  with scanning your ID, I said why am I, I don't want to be trained like a monkey to
[37:21.080 --> 37:27.680]  hand over my ID, my social security number because I never put that in, I just put zeros
[37:27.680 --> 37:34.900]  whenever they ask me and they've quit, you know, asking me about it and challenging me
[37:34.900 --> 37:41.120]  but isn't this what they're trying to do with this mask mandate, this force us to hand over
[37:41.120 --> 37:48.040]  ID papers and I watch other people at the doctor's offices, they always automatically
[37:48.040 --> 37:55.000]  hand over everything they're asked for and I don't think we have to.
[37:55.000 --> 38:05.400]  Rights belong to the belligerent litigant, if you want them you must claim them, Benjamin
[38:05.400 --> 38:14.080]  Franklin's the one that said that anyone who would give up his rights for a little security
[38:14.080 --> 38:21.840]  these nerves neither, we always have to be diligent.
[38:21.840 --> 38:31.000]  And why do they need to scan your ID every time you go in there, I don't see the point.
[38:31.000 --> 38:40.240]  Well, ask them you know where is the law that requires me to allow you to scan my ID, if

[38:42.320 --> 38:53.640]  I went into the VA and they said, this nurse said you have to wear a mask, I said no don't,
[38:53.640 --> 39:07.480]  she said well it's policy, no it's not, that's all that was said.
[39:07.480 --> 39:13.360]  Somebody directed me, will you wait in this room, I said sure and then this other nurse
[39:13.360 --> 39:21.080]  came to get me to do the blood and stuff and I said ma'am, if it makes you uncomfortable
[39:21.080 --> 39:27.040]  that I don't have a mask on, I would certainly put one on because I wouldn't want you to
[39:27.040 --> 39:29.760]  feel as though you were threatened by me.
[39:29.760 --> 39:45.480]  She stopped, turned and looked at me and said hell no, yes, so if we're to keep our rights
[39:45.480 --> 39:54.460]  we must claim them and your partner, he didn't see the value of that and he won't see the
[39:54.460 --> 40:00.040]  value of that until the system lands on him like a ton of bricks.
[40:00.040 --> 40:10.480]  Randy, here's another insight into that, some insurance companies have been so far abused
[40:10.480 --> 40:18.000]  and defrauded that they demand proof that that person on the policy did appear and that's
[40:18.000 --> 40:24.720]  why they asked to scan it because they have to attach it to the invoice.
[40:24.720 --> 40:33.800]  Well from my perspective, your problem, not my problem, you know I understand you can
[40:33.800 --> 40:40.640]  have good reasons for asking me to dance like a trained monkey.

[40:46.840 --> 40:53.080]  And if the person in front of you is looking at your ID, they can confirm with the insurance
